COURT STRIKES OUT JAY JAY’S ABDUCTION CASE AGAINST NGOMA, HAMASAKA

THE Lusaka High Court has struck out a matter in which Emmanuel Jay Banda sued the state, Levy Ngoma, Clayson Hamasaka and Trevor Mwiinde, seeking damages for his abduction.

According to an order endorsed by Justice Mwape Bowa, the case was struck out from the active cause list due to the failure of Banda’s lawyers to make an appearance.

Justice Bowa ordered that Banda had 30 days to restore the petition, failure to which it would be dismissed for lack of prosecution.

“This matter came up for a status conference and hearing of the petitioner’s application for a conservatory order this morning. The petitioner’s advocates are not before court and no reasons have been advanced for the non attendance.

  1. The court had obliged him by agreeing to hear his case. Sakwiba Sikota has a convenient excuse: he has no instructions from his client. If JJ Banda’s serious together with his lawyer Sakwiba Sikota, he can arrange to have the case heard through a video conference. It’s accepted in Zambia. In fact I would urge Levy Ngoma and Clayson Hamasaka to insist on this option unless Sakwiba Sikota and his client decline.
