Pandora Papers: The Kenyatta’s secret companies

President Uhuru Kenyatta’s family, the political dynasty that has dominated Kenyan politics since independence, for many years secretly owned a web of offshore companies in Panama and the British Virgin Islands, according to a new leak of documents known as the Pandora Papers.

The Kenyattas’ offshore secrets were discovered among almost 12 million documents, largely made up of administrative paperwork from the archives of 14 law firms and agencies that specialise in offshore company formations.

Other world leaders found in the files include the King of Jordan, the prime minister of the Czech Republic Andrej Babiš and Gabon’s President Ali Bongo Ondimba.

The documents were obtained by the International Consortium of Investigative Journalists and seen by more than 600 journalists, including reporters at Finance Uncovered and Africa Uncensored, as part of an investigation that took many months and spanned 117 countries.

Though no reliable estimates of their net worth have been published, the Kenyattas are regularly reported to be one of the richest families in the country.

They are well known in Kenya as the owners of a vast business empire, including significant interests in the banking, insurance and media sectors, as well as hotels, agricultural land and the large Brookside dairy on the outskirts of Nairobi.

But what has not been known is their activity through tax and secrecy havens, maintained by a network of bankers, advisers, offshore service providers and front figures.

Seven members of the Kenyatta family are revealed through the Pandora Papers as being variously connected to 11 offshore companies and foundations.

The documents reveal that family members have used offshore companies to own three properties in the United Kingdom. One, a flat near Westminster in London, now worth an estimated £1m, was until this summer rented out to a British Member of Parliament, although she did not know who owned it.

The Pandora Papers also show that Muhoho Kenyatta, the president’s younger brother who manages large sections of the family’s businesses, owned an offshore company with a portfolio of cash, stocks and bonds worth $31.6m in 2016.

Other documents in the leak show a foundation set up in Panama in 2003 for the president’s now 88 year old mother, “Mama” Ngina Kenyatta. Upon her death, all the assets held in the foundation were to pass to her son, Uhuru.

The Pandora Papers contain only a handful of clues about the purpose of the Kenyattas’ offshore interests or what funds and assets they might have placed in these secretive entities.

One document simply says a company in the British Virgin Islands (BVI) had been set up by Kenyatta family members with “savings from their family and their activities”.

In 2018, President Kenyatta (pictured below in Nairobi last week) was asked about his family wealth during an interview on the BBC’s Hardtalk programme. He said: “I have always stated, what we own, what we have, is open to the public. As a public servant, I am supposed to make my wealth known and we declare every year.

“And I have always said: ‘If there is an instance where somebody can say that what we have done or obtained has not been legitimate,’ say so: we are ready to face any court.”

Jack Blum, an American financial crime lawyer and former staffer on the U.S. Senate Foreign Relations Committee, said: “If you see that a prominent political family has set up offshore arrangements it certainly would pique one’s interests. You would really have to begin to investigate further because the question would be: Have state assets… been moved and used for the benefit of the individuals involved?”

However, Blum added: “Now, can we say with certainty that the simple use of [offshore companies] is evidence of some kind of criminal activity? I would have to say ‘No’. You have to do a lot more work.”

The Pandora Papers show no evidence that state assets have been stolen or hidden in offshore entities controlled by the Kenyattas.

We tried to contact President Uhuru Kenyatta, his brother Muhoho, his mother Ngina and all relevant members of the Kenyatta family, as well as the president’s office in Nairobi. We asked why they had set up complex corporate structures in some of the world’s top secrecy havens, how much money they had taken offshore and where that money came from. We also asked whether they still used the entities and if so what assets they currently contain.

No-one acknowledged or responded to our letters, emails, phone calls and texts.

There is nothing unlawful about using secrecy structures or making overseas investments. Many wealthy families choose to spread their investments overseas, particularly when their home country faces political or economic turmoil. This is known as capital flight.

However, capital flight — whether lawful and illicit — often drains local investment and increases inequality.

Attiya Waris, Professor of Fiscal Law at the University of Nairobi, said that when ruling elites are discovered to have parked cash offshore, it “is a signal to the rest of the economy that they can do the same”.

She said: “The kind of knowledge on how to do this circulates among professional classes such as lawyers and accountants and they use it to implement the system for others, drawing even the middle classes into engaging with capital flight.”

Transparency and anti-corruption campaigners have long argued public officials should fully disclose their assets and earnings.

Waris said while complete transparency was never realistic, the concept itself is critical, particularly when countries are trying to rebuild themselves in the wake of the global pandemic.

“The greater the disparities in wealth are in a country, the more you have social problems,” she added.

Under Kenyan law, President Kenyatta is required to make asset declarations for him and his wife, though they are not made public. However, as in most other countries with such requirements, asset disclosure rules do not extend to the wider family.

The findings from the Pandora Papers come as Kenya enters an election period. President Kenyatta is constitutionally bound to step down from office in 2022 after eight years in office — two terms that have seen improved infrastructure yet concerns about inequality and national debt.

First Family
President Kenyatta has carefully nurtured the reputation of the country’s “first family”. It is a family whose history is tied inextricably to the country’s independence and a business empire employing thousands of people.

Uhuru’s father, Jomo Kenyatta, swept to presidential power as a near-penniless independence activist in 1963, ushering in the birth of a new republic.

His status and reputation as the father of the nation grew. So too did his family’s wealth.

But by the time he died in 1978, there were already murmurs.

As noted in a now declassified report by the US Central Intelligence Agency (CIA), written days after Jomo’s death, there were allegations of controversial land dealings involving the Kenyattas.

The report said funds provided by foreign governments — earmarked to pay for redistribution of land from colonial settlers back to landless Kenyans — had instead allegedly been used by the Kenyattas and their associates to buy land for themselves.

US intelligence officers wrote that there was “growing public disenchantment with the Kenyatta clan’s economic monopoly”.

While Jomo Kenyatta himself owned only about half a dozen properties, on roughly 4,000 hectares of land, his fourth wife Mama Ngina owned at least 115,000 hectares including a large ranch, two tea plantations and three sisal farms, the report said.

The Pandora Papers show that in the late 1990s, Swiss wealth advisers had begun helping with the financial affairs of Mama Ngina (pictured below with her late husband, President Jomo Kenyatta) and other members of her family.

The Swiss advisers, in turn, used an offshore law firm called Alemán, Cordero, Galindo & Lee — or Alcogal.

The Pandora Papers include a leak of thousands of documents from Alcogal.

They show that in 1999, Alcogal incorporated a BVI registered company called Milrun International Ltd for Mama Ngina, a minority shareholder, and her two daughters.

Alcogal also provided the registered office for Milrun and supplied Alcogal staffers to act as the company’s official directors.

The result, explained in the diagram below, was an entirely anonymous company, with an address and directors that could not be traced back to the true beneficial owners.

This company was used a year later to buy an apartment thousands of miles from Kenya and Panama, in Westminster, central London, for £280,000.

The Pandora Papers show that the Kenyatta daughters still owned Milrun until at least 2017. We asked them if they still owned the company but they did not respond.

Today, Milrun is still listed on UK Land Registry records as the proprietor of the apartment — now estimated to be worth £1m.

Until this summer, Emma Hardy, a British Labour party MP, rented the apartment when away from her constituency on parliamentary business. As she did so, she lawfully reclaimed £2,600 a month in rent expenses from state funds.

After Ms Hardy was shown the findings from the Pandora Papers, a spokesperson for the MP said: “Emma had absolutely no knowledge of this. She signed a standard tenancy agreement through a reliable agency approved by the independent organisation that administers MPs’ accommodation costs. She is shocked at what this investigation has uncovered, and believes it shows why more transparency is urgently needed.”

In December 2002 Mwai Kibaki was elected Kenya’s third president, defeating Uhuru Kenyatta. It triggered a mood change among the country’s elites as Kibaki promised an anti-corruption drive.

“The era of ‘anything goes’ is gone forever,” Kibaki said at his inauguration rally. “Corruption will now cease to be a way of life in Kenya.”

In the wake of these remarks, there was a rush of money leaving the country. There were disputed allegations that Kibaki’s predecessor as president, the deeply unpopular Daniel arap Moi, had been among those sending money abroad, in part using offshore structures and Swiss banks.

Uhuru had been Moi’s choice to succeed him and his defeat was a blow for the Kenyattas.

It was around this time in 2003 that a trust-like entity called Varies Foundation was formed in Panama, again with the assistance of the Swiss wealth advisers and Alcogal, the Pandora Papers show.

The documents show that Mama Ngina was the beneficiary, and that upon her death this secret foundation was to be run for the financial benefit of her son, Uhuru.

The Pandora Papers do not show what funds, if any, were held by Varies. According to searches of public files in Panama, the foundation is still active. However, it has not paid local regulatory taxes in the Central American country since 2014, suggesting it may now be in disuse.

A spokesperson for Mama Ngina Kenyatta did not respond to our questions.

President Kenyatta’s press office did not respond to any of our questions, including those about his offshore inheritance.

Secrecy haven
Another member of the Kenyatta family named in the Pandora Papers is Udi Gecaga, former brother-in-law to Uhuru Kenyatta. The 76-year-old today has another link to the president through his son, Jomo Gecaga, who serves as his personal secretary.

Gecaga’s fortunes had risen quickly under president Jomo Kenyatta after Lonrho, a powerful and controversial British conglomerate, with land and mining interests throughout post-colonial Africa, picked him out to be a senior executive.

Gecaga was flown to London and offered a huge sum to take the job on account of his influence within the Kenyatta family, according to a biography of Lonrho’s late chairman Tiny Rowland by journalist Tom Bower. Rowland wrote out a cheque for a five-figure sum and handed it to Gecaga: “Is this enough?… It’s for you and your family. Take care of the political problems.”

Later, Rowland occasionally said he eventually wanted Gecaga to succeed him as chairman, but within days of the death of Jomo Kenyatta in 1978, the Lonrho boss demanded his dismissal. He was eventually replaced by a close associate of Kenyatta’s successor, Moi.

Gecaga’s name appears only fleetingly in the Pandora Papers, but further investigations have shown he was no stranger to offshore investments. While he worked at Lonrho, an exotic corporate entity called Blim Securities Anstalt, formed in Liechtenstein in 1977, bought a large mansion an hour’s drive from London, which became his family home. In 1999, Blim Securities also bought an apartment near in the upmarket London neighbourhood of Knightsbridge.

An anstalt is an obscure type of trust in Liechtenstein, one of the world’s top secrecy havens.

Neither Udi Gecaga nor his son Jomo responded to our questions.

In response to questions, a spokesperson for Alcogal said it leaves clients when it suspects clients are involved in money laundering. The company added it has “a robust compliance department, comprising around 20 professionals with high-level education, that receive ongoing training in compliance according to the highest industry levels.”

The company added: “It is equally important to note that corporate providers are not legally responsible for the activities of the companies which they incorporate. While no corporate service provider or financial institution is infallible, we have always acted according to the law, and have cooperated in all respects with competent authorities.”

Having received no response from the Kenyatta family, Pandora Papers journalists searched public records in the BVI and Panama to establish whether the entities linked to the Kenyatta family were still active.

Three of the four Panamanian foundations are active and one is suspended. However, none of the four have paid the required regulatory taxes in Panama since 2014, suggesting they may have fallen into disuse.

Of the seven BVI companies we examined, one was struck off the corporate register in 2014, five were struck off between 2018 and 2021, and one remains active. A company that has been struck off the BVI register is not dissolved, and can, if required, be reinstated once outstanding regulatory fees are paid.

DOES ZAMBIA REALLY NEED THE IMF: PART 1 OF 3

1. The debate about whether we really need an IMF loan is clearly an unending one, largely because of the impact that the decision we are going to make as a nation will have on the lives of our people. You see, there are three primary reasons why countries get an IMF loan, and in most instances all three reasons must exist in order to justify placing a country on an IMF program. The first reason is if a country is in a consistent balance of payment deficit position. The second is when a country lacks fiscal discipline such that they have a consistent fiscal deficit. And the third is if the country is unable to borrow from anywhere else i.e where it has defaulted on loans too many times such that no one wants to lend it money anymore. The question is; does Zambia fit the bill? Do we tick the three boxes above?

2. With regard to the balance of payment position, firstly allow me to explain what this is. As a country we need to import things such as fuel, machinery, repay our external debt etcetera and we cannot pay for these things using Kwacha. We need foreign currency, mostly the US Dollar. Our major source of forex is the exports that we make, mostly our minerals such as copper. When we sell our copper outside Zambia, we are mostly paid in US Dollars and that is the money that we use to import fuel and other things. When the Dollars that we earn as a country through exports exceed the Dollars that we spend on imports, the difference is called a balance of payment (BoP) surplus. Of course the opposite is called a BoP deficit.

3. As a country, we often need to do a projection of our BoP position for the next couple of years so that we can plan accordingly. Like all projections, the BoP projection is based on assumptions, some of which come true, some of which don’t. However, you might wish to know that unlike other countries in the region, our central bank which we call the Bank of Zambia does not have any Research Department to make these projections, despite having so many employees with PhDs. Similarly our Ministry of Finance also does not have any Research Department. I know that your next question is how we then manage to do the projections about our balance of payment position and other economic projections if our key institutions do not have research departments? Well, the IMF does the projections for us based on the information that they collect when they come for article 4 meetings.

4. The last time that the IMF did BoP projections for Zambia was in 2019 and they projected that we were going to have a BoP deficit of approximately US$120 million for the years 2020, 2021 and 2022. In their BoP projections, the IMF also said that our projected BoP deficit would become a surplus if we got an IMF loan. It sounds like a conflict of interest right? Well, l agree. These IMF economic projections are usually self-serving to the IMF itself. And by the way, our new UPND administration relied on these BoP projections of 2019 to make the decision of putting the country on an IMF program. By the way, the BoP projections which the IMF made in 2019 for Zambia have so far not penned out because instead of an annual BoP deficit of approximately US$120 million, we are currently in a BoP surplus for 2021 of approximately US$167 million year to date. This has largely been caused by the increase in copper prices on the world market due to increased demand for electric cars, as the world goes green. Copper is a major input in electric vehicles which means the high copper prices are likely to be sustained in the medium to long term. The 2019 IMF projections for Zambia’s BoP position was based on copper prices of US$5,000 per metric tonne, the current copper prices are almost double of that. And yet the UPND Administration wants to insist on relying on the clearly unreliable IMF projections of 2019 to make their case for an IMF bailout loan. Anyone with a contrary view such as myself is insulted and scandalized by UPND supporters instead of their offering a sober counter-argument why the country should be put on an IMF program.

5. This brings us back to the initial question; Do we really need to get on an IMF Program and procure an IMF loan? Tomorrow l will address the issue of our fiscal position, both current and projected, as well as whether it merits the country being put on an IMF programme or not. But my appeal to fellow Zambians is that for as long as you get intimidated with the insults of our colleagues from the UPND to those who hold contrary views, you are doing this country a deservice. So far all the voices that were against the IMF loan have quietened because of the venom that has been unleashed on them by UPND supporters. Unfortunately UPND supporters do not want anyone to challenge the President on his policy decisions, even though the decisions that the President makes affect us all and not just UPND supporters. But for the sake of our country, l want to appeal to everyone who holds a contrary view on the issue of the IMF to speak freely without fear of intimidation or insults. You just need to develop a thick skin for the sake of the nation. Besides, a couple of insults from UPND supporters will not break any bones.

Speaker Nelly Mutti Is Too Emotional And Her Conduct Is Worrisome- Nakacinda

“THE SPEAKER IS TOO EMOTIONAL AND HER CONDUCT IS WORRISOME.”

It is with a heavy heart, that we wish to comment on the conduct the Speaker of National Assembly Madam Nelly Mutti. It is under very difficult circumstances that we deem it necessary to call her out for the sake of protecting and preserving the sanctity and decorum of not only her office but that of the entire legislature. Zambia’s democracy stands tall on the presumption of separation of powers in the equal disposition and distribution of power among it’s three arms of government, but the conduct of our speaker today leaves much to be desired to say the least.

Being one of the very few senior lawyers, that even qualifies to occupy the office of a judge, our expectations were extremely high in the manner with which she would discharge her duties at parliament, it has become more apparent that she lacks the impartiality that is critical for her to earn the much needed respect and credibility from both sides of the aisle in the house.

The moment she began to conduct day to day business as speaker, the scale of fairness and non bias ruling and interjections have placed her in harm’sway with one side of parliament.

Parliament in terms of rules of the house, has guidelines on the acceptable conduct that governs how each member of the house behaves and conducts thier representative role on the floor of the house.

A case record, of the latest being that of Kabushi lawmaker Bowman LUSAMBO, whose the duly elected representative of the good people of Kabushi constituency on the Copperbelt, has left us dumbfounded by the way she misconducted herself in the manner she treated him.

SHE WAS TOO EMOTIONAL, and that in itself is recipe for turning the house upside down. Notwithstanding the tone of her language, the choice of words and the subtle subliminal message she was sending through Honorable Lusambo, is incriminate and discriminate, clearly showing impartiality and partisanship.

Ofcourse, it is a public secret that her way into parliament came through her sponsorship by UPND, however the her political affiliation is assumed nonexistent the moment she occupies that very noble office. Unfortunately she has failed to attract the necessary goodwill from both the public and parliamentarians owing to her selective application of rules. At times even giving her personal partisan opinions against others.

She firstly must quickly RETIRE HER MEMBERSHIP FROM UPND, to avoid herself becoming a subject of politics outside the house as that has the potential generate dissent on her as a person, which will make it difficult for her to execute her duties freely. Further, forcing the house to degenerate into a partisan platform.

We wish to remind her, that unlike her whose just an appointee, all members of parliament including Bowman Lusambo are not serving at the whim and wish of anybody but at the mercy of the people who onerously elected them. So she is not doing any of them a favor by being in that parliament, it’s at the will of those electorates who elected them to represent them. So she must regard, every voice as that which represents thousands. Atleast that’s how our democracy is structured, so she doesn’t need to like any of the MPs personally, shes not there to like anyone, that’s not her job or privilege but that’s her duty, to respect each and every one in the house if she expects respect in return.

This is an early warning, if she has to succeed. Speakers before her, have taken heed of advise in helping them rise above partisanship and helped them navigate swiftly in circumventing this bipartisan question.

Being the first female Speaker, we would so much like her to succeed, so as to create more opportunities for others women, young girls who dream big in our different communities. She will do a de-service not only to her appointing authority but to the many women who should be looking up to her.

This is our free advise, stay out of politics.

Open Process In Appointment Of Chief Justice Designed To Restore Credibility In The Judiciary- John Sangwa

OPEN PROCESS IN APPOINTMENT OF CHIEF JUSTICE DESIGNED TO RESTORE CREDIBILITY IN THE JUDICIARY-SANGWA

Prominent lawyer, John Sangwa SC has reiterated that his proposal to have the position of Chief Justice advertised will help restore credibility in the Judiciary.

Sangwa also emphasised that his proposal was within the provisions of the law and dismissed assertions by Mr. Dickson Jere and others that there was no legal framework to accommodate his proposal.

He also said that the Judicial Service Commission was also empowered by law to issue regulations in the event the legal framework governing the appointment of the Chief Justice and Judges to Superior Courts was deemed inadequate.

Below is the full letter responding to such assertions;

I applaud Mr Dickson Jere and others that have read my letter to the President and shared their thoughts on the subject.

Engaging in intellectual debate on governance issues is healthy and good for our democracy.

No one has a monopoly of ideas and countries are built and developed on ideas and not threats or arrogance. This is the best of way of avoiding the mistakes of the past.

The purpose of my letter to the President was to bring to his attention the bad practices, which have stained the soul of our Judicature, and generate debate on the best procedures to be followed in the appointment of the Chief Justice and Judges of the Superior Courts.

The new process must restore the integrity and independence of the Judicature, which has been seriously eroded.

There are two issues raised by Mr Jere that merit my response.

The first is the idea that I want us to adopt the South African model in the appointment of our next Chief Justice.

The second is the argument that there is no law, which underpins what I have called for in my letter.

In relation to the first point, I do not advocate that we replicate the South African experience or that of any other country in the appointment of the Chief Justice and Judges of the Superior
Courts.

What we need is a Zambian solution to the Zambian problem informed by the Zambian experience to be solved relying on the Zambian resources and within the Zambian
constitutional order.

That South Africa is going through the same experience is an indication that the problem of choosing a Chief Justice and appointment of Judges in a transparent manner is not a challenge unique to Zambia.

Whilst South Africa has to find a system or process that works for South Africa we have to devise a system that will work for Zambia.

That is the essence of the discourse. We can learn from the South African experience but we cannot transplant its experience or solution to Zambia.

The second point raised by Mr Jere is the alleged lack of a legal framework to support what I have called for. I disagree with this proposition on several grounds.

First, what I have called for is a simply a matter of common sense and fairness in the management of opportunities in public institutions.

Opportunities for employment in the public offices should be open to all Zambians and appointment should be on merit through a competitive process that is transparent and fair.

You do not need a law to require the Commission to publish an advertisement in newspapers inviting suitably qualified Zambians to apply for appointment to the office of Chief Justice of the Republic of Zambia, publicly interview those that have come forward, invite the people to participate in the process; then come with a list of candidates with their respective scores and recommend the best candidate to the President.

Secondly, the idea that there is no law in place to govern the procedure I have called for is not correct. I would not advocate for anything that is not backed by law.

What I have called for is backed by Article 173(1) of the Constitution and sections 3 and 41 of the Service Commissions Act of 2016.

Article 173 provides for the values and principles of public service. The values and principles apply to service (a) at national, provincial and local government levels; and (b) to all State organs and State institutions. The Constitution defines State organs to include the Judiciary.

I, therefore, confine myself to the application of the values and principles to the Judicature.

Article 173(1) sets out the guiding principles and values of public service which include “merit as the basis of appointment and promotion.”

Article 173(2) provides that the principles specified in Article 173(1) apply to service in State organs. Calling for appointments and promotions in the Judicature to be founded on merit is therefore consistent with Article 173.

Based on Article 173 all appointments and promotions in the Judiciary must be based on merit. Any appointment or promotion not founded on merit is unconstitutional and therefore null and void.

The President, the Judicial Service Commission, the National Assembly and the person accepting promotion or appointment to the office of Chief Justice are bound by Article 173 of the Constitution.

Article 173 of the Constitution leaves it to those with power to make appointments or
promotions in the Judicature to devise the practice and procedure of ensuring that such
appointments and promotions are based on merit. Interested parties have a corresponding
obligation to ensure that they only take part in a process that is based on merit.

Article 173 of the Constitution must be read with the provisions of the Service Commissions Act, 2016.

Section 3(f) of the Act has amplified the values and principles of public service. It reads: “— fair competition and merit as the basis of appointments and promotions.”

For those that see a need for the law to expressly provide for the advertisement of the vacancy in the office of Chief Justice and subjecting the candidates to public interviews, there is
nothing that stops the Judicial Service Commission from issuing the necessary regulations to provide for such a process.

This, in any event, is provided for in Section 41 of the Service Commissions Act which states that; “A Commission may, in consultation with the Minister under whose statutory function
a Commission falls, by statutory instrument, make regulations for the better carrying out of
the provisions of this Act.”

It follows, therefore, that the appointing of the Chief Justice through a process other that one which is open, fair and competitive would be unconstitutional.

One of the greatest mistakes that cost Edgar Lungu an election is his failure to make personal judgments based on common sense, rationality and morality in preference for defective advice given to him by those who surrounded the former President.

Not long ago, Edgar was every one’s darling. Between 2015 to about 2017, you could not talk openly against Edgar without attracting scorn from the general populace. Edgar was seen as humble, peaceful and down to earth person with the interest of the people at heart. Somehow, elements whom he appointed into various advisory positions turned Edgar into a monster in the eyes of people. The same people that celebrated Edgar begun to view him as selfish, uncaring and a reckless leader.

Edgar is today hated not because he is a bad person. You can judge some of his decisions as President harshly and even blame him for all the wrongs during his administration, but the truth is that Edgar is still a very humble, down to earth and good person. We are saying this because we would like to bring to the attention of Hakainde Hichilema the risks associated with getting every advice he is given by elements around him.

It is clear that Hakainde is being misled by some of the people around him. The President may be loved by the great majority of the people today but that love is not a birth right and can fade any time. It is love anchored on conditions, on premise that he does the right things as he discharges his duties.

We are saying this because we do not believe that renewing the contract of Kingsley Chanda, the Zambia Revenue Authority Director General is a noble and honorable thing to do by the administration of Hakainde.

You cannot on one hand say you are committed to fighting corruption and moral ills yet maintain Kingsley at the helm of ZRA. Kingsley is a huge stakeholder in tax administration in this country as Director General of ZRA and at the same time, he owns a clearing agency Nishati which does business with that tax authority. This is in itself is a serious conflict of interest. That same company has monopolized agenceship of clearing goods and services. It would not be wrong to assume that even the access of business by Nishati is because those that deal with it know that they are doing favors to the very person they will be paying taxes to, at the top of ZRA. If this does not look like corruption, then what exactly is corruption? We all know that clearing agents across the country have complained and protested against the monopolizing of clearing business by Kingsley’s company. Of course, this smells of the highest form of corruption which we do not expect any normal person to ignore.

Again, ZRA is one of the most corrupt public institutions where employment and promotions are concerned. If Hakainde is very serious about his pledge to fight corruption, his actions must be seen even at the level of public institutions like ZRA. Fighting corruption must not only mean investigating former ministers and their associates. There is too much filthy corruption at ZRA where workers are employed based on who they are connected to and, for the sake of women, whom they open their legs for.

If you do an audit of how employment and promotions are done at ZRA, you will discover that there a number of unqualified elements who have been moved to better grades on account of opening legs for someone. All this is happening right under the leadership of Kingsley. While we appreciate that ZRA has been exceeding its targets of revenue collection on several occasions, we believe that the success of that institution cannot be in any way credited to an individual person. It is the collective efforts of every one who works there. If Kingsley or indeed anyone at ZRA stopped working there, there is no justifiable reason to believe that the tax authority will stop meeting its revenue collection targets.

We are here to question Kingsley over conflict of interest and the corruption that lurks at ZRA. We are here to question Kingsley why he has allowed a situation where people are employed and promoted on account of whom they sleep with.

Why would Hakainde – on one hand claim he is serious about fighting corruption – yet on another hand keep at ZRA Kingsley who is clearly in a very compromising situation in as far as corruption is concerned? Why would Hakainde – on one hand claim he is serious with instilling morals in our society – yet on another hand keep at the help of ZRA a person like Kingsley who presides over an institution that hires and promotes people based on who is a girlfriend to those with the necessary power and authority?

SPEAKER of the National Assembly Nelly Mutti yesterday sent out Kabushi PF member of parliament Bowman Lusambo for disrespecting the decorum of the House.

This was after Lusambo earlier on walked out of parliament when Speaker Mutti ordered him to sit down as he tried to argue with her.

After being ordered to sit, Lusambo walked out of the House in anger and only went back after some time.

Later, home affairs minister Jack Mwiimbu raised a point of order on Lusambo’s conduct, asking the Speaker if the Kabushi lawmaker was in order to walk out on the presiding officer.

“As I raise this very important point of order, Madam Speaker, I would like you to take judicial notice pertaining to the rulings of this House on the decorum, etiquette and general conduct of the members of this House. Madam Speaker, you may be aware that this House has made various rulings pertaining to the conduct of members who walk out on the presiding officer immediately the presiding officer makes a ruling that goes against them,” said Mwiimbu. “Is the Honourable member for Kabushi, Honourable Bowman Lusambo in order to walk out on you and protest because of his unhappiness pertaining to the ruling and guidance you made on the question he was trying to raise on the floor of the House during Her Honour, the Vice-President’s Question Time? Is he in order to bring your status into public ridicule by walking out on you in protest and in anger that you ruled against him? Is he in order, Madam Speaker?”

In response, Speaker Mutti acknowledged that Lusamabo was certainly out of order.

“Indeed, I did notice the Honourable member for Kabushi walking out when I asked him to sit down. So, the Honourable member for Kabushi actually is definitely out of order. And this conduct amounts to ridiculing the presiding officer who was presiding over the affairs of this House,” said Speaker Mutti. “And in order for us to continue with the decorum and dignity of this House, the Honourable member for Kabushi will be excused from the sitting of this House for today so that he can go and vent his anger outside, not in this House. The Honourable member for Kabushi is requested to leave the House.”

Earlier during the Vice-President’s Question Time, Lusambo lost his temper when Mutti was giving him guidance as he tried to ask a question.

Instead of going straight to the question, Lusambo started going round as he invited heckles from ruling party members.

Despite constant guidance from the Speaker, he insisted on responding back.

And as the Speaker asked him to sit down, Lusambo who was still standing burst into a tirade targeted at ruling party members.

“Guys, you’re in government. You are not in opposition. You’re in government, in Executive; and you are reliable (sic) to these checks and balances. Grow up guys,” he shouted.

Again, Speaker Mutti ordered him to sit down as she gave guidance.

“Can you sit down, please! When I’m making an order you know the rules, you’re supposed to sit down. I’m giving guidance here,” she said. “For me to be able to listen to your question properly, please be specific. Ask the question so that I get the gist of the question. As you’ve been talking, I’ve not even gotten what your question is. Can you stand up now and ask a proper question?”

Immediately he stood, Lusambo tried to justify his conduct which the Speaker had already ruled on.

“Madam Speaker, when you’re coming up with a question, the question is supposed to have a background,” said Lusambo.

But Mutti quickly interjected and cautioned him, “Don’t argue, honourable member!”

Seemingly ignoring the guidance, Lusambo tried to engage the Vice-President directly.

“Madam Vice-President,” said Lusambo as Mutti quickly chipped in. “Honourable, can you sit down! Sit down, that question will be disregarded.”

Scribes, help us convince The Minister of Home Affairs to disband Thrift Police Cooperative. It is a crime scene just at the core of the Zambia Police Service. It is a conduit for plunder. Junior Police officers were forced to buy shares in this Cooperative at K100 per share with minimum of 5 shares. They were told they can opt out later but no one is allowed. It means officers are supposed to be getting something like dividents but they do not do that. The people who benefit from Thrift are big bosses some even have highly mechanised farms with Centre Pivots.

Currently, Thrift has a Manager called Christopher Chanda who together with former IG Kakoma Kanganja used Thrift as a personal cash cow. Mr. Eugene Sibote the former Deputy IG was and is still a beneficiary. What they did is that they replaced two women. Mr. Muleta a relative to Mr. Sibote replaced Madam Shamwale whilst Mr. Sinkala replaced madam Zulu.These two are now running Thrift Butcheries and they are selling meat from only Mr. Sibote’s farm. Even the Accountant at Grandview School in Shimabala which is a School under Thrift only buys things for the Kitchen from Mr. Sibote’s farms at exorbitant prices.

With the new dawn that encourages entrepreneurship, it is important that the supply of food stuffs, goods and services is open to every eligible Zambian.
About Grandview School, it is another Scandal. The School was built with contributions from Junior officers but only the bosses Children go to that School.
The new IG Mr. Kajoba can not claim he does not know the happenings at Thrift. Unless he also wants to start benefiting from it. Otherwise, may the New Minister of Home Affairs Honourable Jack Mwiimbu who is a seasoned lawyer disband Thrift. It is simply a crime scene.

I can just imagine if our Messiah Christ Jesus had come in this world with the blame and accusing tools for Adam. It was going to look like He was not the Solution but because He knew he was, He never wasted time to blame, accuse and condemn Adam and Eve. A Messiah doesn’t focus on pointing fingers or shifting blames to others but rather on fixing things or putting things in order then people will begin to realise how disorderly things were. So Mr President when you said you were going to fix it, people believed and they voted for you so that you can turn around the economy. Apportioning blame to the previous regime is not a solution BUT an early SIGN of failure on your PART.

Unless if you meant fixing people I will say you are on the right path. But if you meant the economy, you are on the wrong alley sir. Among the 1.8 million that voted for PF, some wanted PF to continue so that they can continue to benefit from political handouts and personal favours due to high connections. Others had a different view which is massive developments in almost all the sectors of the economy. As such it is not everyone who supported or voted for PF who was a kandile. Equally among the 2.8 million that wanted change, they wanted it for different reasons. So if you focus on witch hunting, you will displease the group that voted for you on assumptions that you will reduce the cost of living.

While each administration cannot go out without flows, even Rupiah Banda is remembered for keeping the dollar at K5. So no President is going to be 100% good or 100% bad at all. It is even wrong for the 1.8 million to believe that Mr HH will be 100% bad in other sectors he will score. ECL is human and he did wrong in some areas but we must not take away the excellent works he did. Out of 10, I give him 7. So when blaming him for his flows, kindly praise him for the massive developments he brought.

Now for Mr Hakainde Hichilema sir, you must realise that too much of everything is dangerous. Too much witch hunt is dangerous. Too much blaming is dangerous because you are sending a bad signal to us that you have actually failed to fix it. The quicker you realise that the 2.8 million people that voted for you did not do so with the same objective the better. Some of these voted on some reasons known to Hon Kambwili, others voted for you so that you can work on the wrongs ECL was tolerating. So as a leader whom 2.8 million including my wife to be believed you can fix it, please concentrate your time and efforts in trying to find solutions to reduce high cost of living and stop pointing fingers at others. It’s your responsibility to fix the economy and not to fix people.

People were able to see the breakdown in the rule of law hence the reason they changed. You said you won’t bring gay rights because you are a Christian and a church elder at SDA. Well and good but sir your heart is boiling so hot for revenge for the treason charges you were imprisoned for. Mr President sir Christians forgive and move on. But I can see that your continued blame of PF is aimed at alarming the situation to lift the immunity of ECL nothing else. And if that is what the 2.8 million people voted you for, please go ahead and do it to please them. But if they voted for you so that you can fix the economy, do so without excuses.

We are tired of hearing the same blame song in almost each and every speech. I remember Dr Chiluba in trying to make Dr KK look so bad to the people he started to review Statehouse secrets which backfired when Captain Solo was determined to oust him out of power. He had no proper hiding place. For now your bigger assignment sir is to bring the Kwacha down to K10. To bring the price down of fuel to a single digit from K17. To create employment for the youths. To reduce the price for fertilizer to K200 etc. This is what you were voted for by the majority not what you are singing the loudest sir.

Strive to be a different politician despite being a Zambian and African. That’s how you will leave a legacy. Not everyday PF this, PF that or ECL this, ECL that. We are tired sir. We want you to organise the fixing tools and get back to work. I’m sure I will not be wrong to say a bad carpenter always blames his tools. By now you should be tired of talking. You have been talking for 20 years and above that you spent in opposition and now it’s time to act. Actions are what you were voted for not talking please. Talema Navo Ivo. People changed so that they can stop hearing about PF. Let the law enforcement agencies persecute everyone that will be found wanting independently and without any interference. Not in a witch hunt way sir.

Allow recalled ambassadors exit with dignity, respect – Nevers Mumba

MMD president Never Mumba says it is indisputable that the President does have power to recall diplomats and also to appoint new ones when there is a change of power or government.

But he urges allowing recalled diplomats to exit with dignity and respect “by giving them the three months that is necessary for them to close their tour of duty and come back in dignity”.

Mumba, who once served as high commissioner to Canada, said there is nothing illegal or strange that after the change of government there would be change of diplomats around the world.

He said it is an international tradition that diplomats across the world are replaced in line with the new administration’s policy advancement.

“In terms of diplomatic service, when governments change and a new government comes into place, in our case one political party loses power and another one takes power, the international tradition is that the diplomats across the world that have been sent by the country are in effect changed to the extent that new ambassadors and high commissioners are deployed for the purpose of ensuring that the policies of the new government that has come into place are being relayed in a manner that is in line with the new governing party,” Mumba said. “So it is not strange that after the change of government there will be change of diplomats around the world. But I have to be very clear that it is a constitutional position and the President does have power to recall diplomats and also to appoint diplomats in different countries. So that is indisputable. There is nothing illegal if the President or the new President recalls the diplomats from around the world and replaces them with those he deems would carry out the policies of the new government. I think it’s important that we settle that one for once.”

He recalled that when he was high commissioner to Canada and as per tradition when MMD lost power, and PF took over, he was recalled.

Mumba however said although it was irregular to be recalled in just seven days after the MMD lost power, the decision to recall him was constitutional as the president had power to do what he did.

He explained that when the US change from
Republicans to Democrats and vice-versa there always a shift of diplomats especially the heads of missions.

“Those who work in administration could still remain but for heads of missions it is almost a foregone conclusion that they are going to be
recalled back to Washington like many other countries. So it is important to establish certain brutal facts. Brutal fact number one is that the new President has the constitutional right to recall ambassadors and replace them with that he deems will follow through the policies of the new administration,” he said. “No dispute about that but the challenge comes in when the President will now have to use his discretion if there is information given to him that the exercise would be too costly for the government at this particular point to afford. At that, the President will again use his discretion and decide which key mission stations are going to receive the first attention and be replaced. Then as the resources are made available would continue…and sometimes it takes several years before certain recalls could be made.”

However, Mumba said his advice as a person who served as high commissioner and Republican vice-president is that each diplomat who has a contract and it is unfinished then they should be allowed to
finish their contracts so that the recall is normal in the manner that it does not apply too much pressure on the treasury.

He said however that there are certain missions where there can be no delay as they are extremely cardinal and fundamental to the President and effectual running of the foreign policy in those affected countries.

“I see these things happening in major countries like the United States, Europe, South Africa and certain nations in which our interests are extremely high including the United Nations and also the African Union. So these are issues that the President will have to use his discretion,” he said. “The concern of anyone of us would be on the fact of how many should be recalled and do we have the money to do that. If the answer is that the money is not available now, then it is advisable that there is a wait.”

Mumba also noted that there are guidelines and standing orders on how to proceed with a particular exercise and in this case the recalling of ambassadors.

He said those that have gone “out there to work under previous administrations it’s under the assumptions that they are servants of the people and are in those countries in the name
and the person of the President and even when the Head of state change, the said description does not change”.

“For instance, when I was high commissioner I was there under president Rupiah Banda and when president Rupiah Banda left, Mr Sata became my president and now I became the personal representative of president Michael Sata in Canada. I know the people say Zambia, but the credentials that we present stipulate that I am there representing the President and it is very clear so it doesn’t matter whether presidents change or not,” Mumba said adding, “right now all the diplomats that are in their stations, their allegiance is to President Hakainde Hichilema as the President of the Republic of Zambia and are there in his name. And if they do anything there, they are doing it in his name. If they do an embarrassing thing they are embarrassing President Hakainde Hichilema. That’s the way the democratic story is told.”

He said diplomats did not send themselves out there but are there as the country’s representatives.

Mumba said although they belonged to the political parties that lost the election, it does not mean that they are less Zambian than anyone else who is going to replace them.

“They need to be allowed to exit with dignity and respect by giving them the three months that is necessary for them to close their tour of duty and come back in dignity,” he advised. “The reason why this is important is that the way a country calls back its diplomats has a lot to do with the perception that the receiving government will forever view that country. For instance, when I was recalled, there was so much zeal from the PF that they told me that you will have to come back now and I started to pack. But when I went through the standing orders, and also diplomatic regulations, it was clear that I have got three months in which to prepare myself to depart, bid farewell to the host country and the other countries I was representing which were about nine of them and that’s the procedure.”

He said when he was told to leave immediately, Canada was very distraught since he was also the president of the diplomatic association.

Mumba said Canada did not understand why the PF government would treat him in the manner they did thus wondered what kind of
president Sata was.

He said foreign affairs must ensure each diplomat is brought back in respect and dignity and not shame them for having gone there to
serve Zambia.

Mumba said it was important to follow recall procedure in order to protect the dignity of the nation.

“When the next batch goes there and when another president comes in, they are going to treat them the same way. We are all Zambians and let’s make sure we treat each other with great respect,” said Mumba. “It is very important to make sure that before the names are reflected in the media, the diplomats serving in many countries have already received their letters of recall. It’s only after that that you can start to throw their names in the media. Prior to that lets give them some respect.”

Renowned Lusaka lawyer John Sangwa SC has appealed to President Hakainde Hichilema to subject the filling in of the vacant position of Chief Justice to a competitive and transparent process before it is taken to Parliament for ratification.

In a letter written to President Hichilema dated 1st October 2021, and copied to the Law Association of Zambia( LAZ) and the Judicial Service Commission, Sangwa has proposed that the position of Chief Justice should be advertised and the Judicial Service Commission must interview such shortlisted candidates publicly.

Sangwa has also proposed that future appointments of Judges to Superior Courts must follow a similar rigorous, open and competitive process.

He said following the death of Chief Justice, Madam Justice Ireen Mambilima, the President was required, with the recommendation of the Judicial Service Commission, to appoint someone to the office of the Chief Justice.

Sangwa has called upon President Hichilema to abandon the practice followed by his predecessors in the appointment the Chief Justice and judges to superior courts.

He said the current process has been a sham as it lacked any semblance of transparency or fairness.

He said the process has resulted in Zambia having a judiciary that suffered eroded Independence and integrity and the process institutionalised “political nepotism” in the Judiciary.

He said the consequences of this process has been the emergence of a Judiciary that doesn’t command the respect of the people it is supposed to serve.

“Today, going to Court is like going to a Casino in that there is no consistency in decision-making. The outcome, in most cases, is a matter of chance.”

He said under these circumstances, the Independence of the Judiciary became a fiction.

He said the judicial branch as an arm of government, was reduced from a co-equal with the Executive, to an apparent department under the Executive.

He also cautioned that while the President was obliged to respond to regional diversity in his appointments of persons to public office, the concept should not be used to justify the appointment of an unfit person to occupy the Office of the Chief Justice.

He said the person who should take up the position of Chief Justice should be someone with an active conscience, a keen mind committed to fairness and a person that will help implement the inevitable reform of the Judiciary.

He said such a person must be of unquestionable integrity, should have no record of abusing public trust.

He said such a person must have demonstrable devotion to scholarship and a willingness to learn to understand better and to judge better.

Dangote’s alleged side chic delighted as U.S. Court dismisses suit against her

Autumn Spike, the alleged former girlfriend of Africa’s richest man, Aliko Dangote, has taken to the social media to jubilate after a U.S. court dismissed the lawsuit filed against her.

Aliko Dangote under the pseudonym John Doe filed a civil suit against Ms Spike in January, seeking “excess of $30,000” in damages against her after she shared a controversial video of herself together with him on her Instagram page on January 1st, 2021.

The video which quickly went viral on social media after Spike first posted it on her Instagram account showed the billionaire lying on a couch with Ms. Spike sitting next to him.

Following the video release, Dangote accused Spike of libel, defamation, and a breach of agreement “to keep their relationship private and away from the social media.” Also, Dangote accused her of attempting to extort him through her demand for $5 million in palimony.

The court has now dismissed the case following the plaintiff, Aliko Dangote’s voluntary withdrawal. While Dangote’s counsel stated in the “Notice of Dismissal” that Spike’s conduct which was the object of complaint has ceased, she insisted she was vindicated because Dangote’s legal team had no evidence to back claims against her.

Nothing about this says he “went easy on me and called it quits”. He’s a liar and he’s petty.

PF should apologise for its ‘atrocities’ – Kalala

IT’S inhumane and cruel to claim or pretend that the PF regime did nothing injurious to the people of Zambia, says Jack Kalala.

He says the PF leaders proved to be heartless, cruel and sadistic when they were in power.

Kalala, who served as special assistant to late president Levy Mwanawasa, expressed shock at what he described as “many fallacious and malicious claims” made by PF vice-president Given Lubinda during a press conference on Monday last week.

Kalala said Lubinda attempted to launder the “barbarous and brutal” former ruling party.

He thanked God that the PF was last month voted out of power by peace-loving Zambians.

“Mr Lubinda, are you sure that what you said at the press conference was nothing else but the truth? Was your conscience clear when you
claimed that your party did not commit atrocities against Zambians during the 10 years of its rule? Did I hear correctly that you complained of lack of coverage on ZNBC, Times of Zambia and Daily Mail? Come on man, spare us the agony!” he said. “Lest you have forgotten, you need to be reminded of what your PF regime was. I take the liberty to refresh your memory and tell you that Zambia was hell under the PF rule.”

He said the nation experienced more brutality and lawlessness during the tenure of “humble” leader Edgar Lungu.

Kalala reminded Lubinda that under the PF’s notorious rule, the nation experienced the traumatising gassing that started in Chililabombwe and eventually spread to rest of the country.

He said the traumatising episode lasted for almost a year and only came to an end after the Catholic Church’s pastoral letter, condemning the nefarious ploy and called upon the government to stop it.

“The pastoral letter was issued on Friday and by Monday of the following week the gassing surprisingly stopped. Apart from traumatising the nation, the gassing claimed 50 innocent lives. To date, the perpetrators of this criminal act against the people continue to remain a mystery,” Kalala noted. “In the absence of information of what happened, people have speculated that the barbaric act was a PF regime’s conspiracy intended to implicate President HH [Hakainde Hichilema – then in opposition] to create ground for his arrest so as to prevent him to stand for elections. Unfortunately for them the plot failed to work, HH is Republican President today.”

He said in case Lubinda had forgotten that the PF regime was not what he described it to be at the press conference, many people lost their lives at the hands of the police and party cadres while under the leadership of Lungu and Lubinda himself as justice minister.

“The following are some of the PF atrocities and human rights violations: Vespers Shimunzhila, Glaizia Matapa, Lawrence Banda, Hardly (the Misisi UPND youth), Mushaukwa Mushaukwa, Frank Mugala, Kennedy Mudenda, Obed Bwalya Kasongo, Peter Masani (shot at by Boswell Namuswa, survived but living with a bullet in his body), Nsama Nsama, Joseph Kaunda, Mapenzi Chibulo and Mark Choongwa, among many others,” he said.

Kalala said Lubinda and the “monstrous” PF
should have the humility to show remorse and apologise to the people.

He said to continue exhibiting arrogant impunity of not accepting responsibility for the many atrocities that happened under the PF brutal rule is a mockery, a charade and infuriating.

“Mr Lubinda and the PF leadership should be sensitive to people’s emotions, more especially the victims and their relatives and friends. It is inhumane and cruel to claim or pretend that the PF regime did nothing injurious to the people of Zambia,” Kalala. “There is honour in admitting a wrong and apologising for it.”

He said the PF under the leadership of
Lungu was the most dictatorial, brutal and lawless regime in Zambia’s history, with no regard for human rights and the rule of law.

“I challenge Mr Lubinda – who was then minister of justice – to tell the nation and indeed the world at large details of the treasonous offence that President Hakainde Hichilema had committed in Mongu to warrant his arrest for treason? The PF leaders proved to be heartless, cruel and sadistic when they were in power,” he said. “When [Hichilema] was incarcerated for no reason at all, they subjected him to the most inhumane, ruthless devilish treatment unheard of in society of sane human beings. President Lungu and his hard-hearted cohorts directed that fresh faecal matter be put in the HH’s cell. How so awful and sadistic, cruel one can be to a fellow human being whose only crime is to exercise his constitutional right?”

Kalala said it is irrefutable that there was a reign of terror under the PF rule as people were attacked, brutalised and, in some instances killed for wearing UPND regalia.

“I was myself a victim of the PF hateful and horrid intolerance. On 11th August, two suspected PF cadres smashed the rear screen and side window of my wife’s car at Intercity Bus Station. I was returning from Ndola where I had gone for campaign in Copperbelt rural and my wife came to pick me up. I was wearing a red UPND T-shirt. This did not go well with the PF cadres who threw stones at the car as we drove off. The matter was reported to [Lusaka] Central Police and no arrest has been made,” he said.

Kalala added that during the “PF reign of terror”, opposition parties were not allowed to hold public meetings or to feature on radio and television.

He recalled how private radio and television stations that attempted to feature the UPND were victims of PF cadres’ barbaric attacks.

“The buildings and equipment would be damaged. The PF leadership, inclusive of president Lungu, never raised their voices to condemn these criminalities and flagrant violation of people’s rights,” Kalala recalled. “Unfortunately, the police could not dare arrest the criminals for fear of losing their jobs under the express orders of president Lungu. Instead of creating jobs and business opportunities for the youths, the PF leadership used them to fight their political opponents, which was an abuse of the youths.”

He said it was because of the PF bad leadership that Zambians on August 12 resolved to withdraw the mandate from them and give it to the UPND.

Kalala said instead of trying to launder the former ruling party, Lubinda should accept the people’s verdict and learn to live with it.

Guinea coup leader Mamady Doumbouya sworn in as president

Colonel Mamady Doumbouya, who led last month’s coup in Guinea, was sworn in as interim president on Friday promising to respect all the West African state’s international commitments.

Doumbouya, who led the overthrow of president Alpha Conde on September 5, was sworn in by Supreme Court head Mamadou Sylla for a transition period of unspecified length.

The new interim president spoke of his “commitment” that neither he nor any member of the junta would stand in any future elections that the military have promised to organise after a transition period.

His administration’s mission is to “refound the state” he said, by drafting a new constitution, fighting corruption, reforming the electoral system and then organising “free, credible and transparent” elections.

He once again said nothing at the time of his swearing in about how long he will remain the interim leader.

The new president also promised to “respect all the national and international commitments to which the country has subscribed.”

‘Consolidate democracy’

Wearing a beige dress uniform, red beret and dark glasses, the new national leader also vowed to “loyally preserve national sovereignty” and to “consolidate democratic achievements, guarantee the independence of the fatherland and the integrity of the national territory”.

The ceremony was held at the Mohammed-V palace in Conakry on the eve of a public holiday celebrating the 1958 declaration of independence from France.

Doumbouya will serve as transitional president until the country returns to civilian rule, according to a blueprint unveiled by the junta on Monday that does not mention a timeline.

The September 5 coup, the latest bout of turbulence in one of Africa’s most volatile countries, saw the overthrow of 83-year-old president Conde.

Conde became Guinea’s first democratically elected president in 2010 and was re-elected in 2015.

But last year he pushed through a controversial new constitution that allowed him to run for a third term in October 2020.

The move sparked mass demonstrations in which dozens of protesters were killed. Conde won re-election but the political opposition maintained the poll was a sham.

The “charter” unveiled on Monday vows that a new constitution will be drafted and “free, democratic and transparent” elections held, but does not spell out how long the transition will last.

The document says the transitional president will be “head of state and supreme chief of the armed forces… (and) determines the policies of the Nation,” with the power to name and fire an interim prime minister.

However, the president will be barred from being a candidate at the elections that will take place after the transition, it says.

The turbulence in the former French colony has sparked deep concern among Guinea’s neighbours.

The coup is the second to take place in the region, after Mali, in less than 13 months.

The region’s bloc, the Economic Community of West African States (ECOWAS), is demanding that elections be held within six months, as well as Conde’s release.

Auditor General uncovers K1.4bn govt wasteful expenditure in 2020

AUDITOR General Dick Chellah Sichembe says wasteful expenditure on the accounts of the Republic increased from K3.7 million in 2019 to K1.4 billion in 2020.

Dr Sichembe addressed journalists at his office in Lusaka yesterday.

The media briefing was centred on the Auditor General’s Office sharing salient issues on the report of the Auditor General on the accounts of the Republic for the financial year ended December 31, 2020 and the report of the Auditor General on the accounts of parastatal bodies and other statutory institutions for the financial year ended December 31, 2019.

According to Article 212 of the Constitution of Zambia (Amendment) Act No. 1 of 2016, the Auditor General shall no later than nine months, after the end of a financial year, submit an audit to the President and the National Assembly on accounts of the Republic audited in respect of the preceding financial year.

“In view of the foregoing, I am delighted to inform you that I successfully met this constitutional requirement yesterday, 29th September 2021,” Dr Sichembe said.

He said the said report on the accounts of the Republic for the financial year ended December 31, 2020 generally reveals evident financial irregularities in ministries, provinces and agencies.

Dr Sichembe noted that the irregularities that have increased outnumber the irregularities that have reduced during the period under review, “thus negating the strides made in the management of public resources.”

He indicated that the irregularities that have seen an upward trend include wasteful expenditure, failure to follow procurement procedures, unvouched expenditure, unaccounted for revenue, unaccounted for funds, unretired accountable imprest, irregular payments, failure to recover loans and non-submission of expenditure returns.

“The largest irregularity amount in the report is wasteful expenditure which increased from K3.7 million in 2019 to K1.4 billion in 2020 representing an increase of 378 per cent,” Dr Sichembe said. “This irregularity involves Ministries of Finance – Head 21 K856 million in payment of interest and penalties incurred on a contract between Food Reserve Agency and Advanced African Solutions; housing and infrastructure – K362 million in payment of accrued interest and transfer of property tax, transport and communication – K153 million; general education – K32 million, fisheries and livestock – K9 million; water development sanitation and environment protection – K4 million, among others.”

He explained that wasteful expenditure is expenditure incurred where the government does not derive any benefit or obtain goods and services at exorbitant prices or cost.

Dr Sichembe noted that the implication of wasteful expenditure is that deserving sectors of the economy are deprived of the much-needed resource.

“Going forward, the Office through its forensic and investigations unit, will actively follow up such matters to their logical conclusion to understand the motive behind such expenditures,” he said. “Where it is evident that an offence was committed arising from the wasteful expenditure, the Office will engage law enforcement agencies [with] whom we have established memoranda of understanding to take up the matter.”

Dr Sichembe added that the report had also cited the second largest irregularity amount as failure to follow procurement procedures in four amounts totaling K234 million.

“This irregularity increased from K504,500 in 2019 to K234 million in 2020, representing 463 per cent increment,” he explained. “The huge jump is of great concern to us as an office as it is a clear indication of non-compliance to the Zambia public procurement Act and disregard of procurement guidelines in the purchase of various goods and services.”

And Dr Sichembe said the report on accounts of parastatal bodies and other Statutory Institutions for the financial year ended December 31, 2019 reveals poor financial performance.

“The report highlights failure to collect funds in amounts totalling K16.6 billion as the largest irregularity, followed by failure to settle/remit statutory obligations K1 billion during the period under review,” said Dr Sichembe.243358992_1516318168707077_4535521418655905502_n

Finally DEC has charged and arrested the KCM provisional Liquidator Mr. Milingo Lungu for allegedly stealing huge sums of money from the unconscious KCM. What the Liquidator allegedly did to KCM is like a Doctor stealing life saving drugs from a very sick patient. Mr Milingo Lungu was appointed Provisional Liquidator of KCM by former President Lungu. Therefore PF was using Milingo Lungu to steal from KCM. We say so because we believe that the former President knew what was going on at KCM long before he even left office through intelligence reports. But since PF was a direct beneficiary from what was happening at KCM they opted to keep quite. While PF and the Liquidator were busy stealing, they decided to ill treat Miners by paying terminal benefits in three piece meals. A very sad development

From the onset we knew that PF was using KCM as a cash cow. When we reminded them about the theft at KCM, they responded with insults. The way KCM assets have been run down it requires very huge investment to turn things around at KCM. There is very little life at KCM and one wonders why Mr. Milingo Lungu cut the KCM copse into two and called them KCM Mining Resources and KCM Smelter. This action was un called for and a waste of resources.

We also demand that the Minister of Labour and Social Security should investigate thoroughly the conduct of the two Union leaders of MUZ and NUMAW. Clearly the two labour leaders abandoned Miners and decided to identify themselves with the liquidator. We are very sure that had the MUZ and NUMAW leaders stood with the Miners at KCM, Miners could have been paid their benefits in full.

Miners were left in the cold by the leadership of MUZ and NUMAW. The relationship that we saw between PF, the two Union Officials and Mr. Lungu raises a lot suspicions. We can reasonably suspect that there could have been an illegality between PF, Mr. Milingo Lungu and the two Union officials. We need answers from the Minister of Labour as to why Miners were treated in such a manner by people who were supposed to protect them.

Putting into context the state of the nation before, during and after the 2021 general elections, I’ve been meaning to write this article for a very long time. Looking at how politically inclined the The Civil society is, it is safe to say that has largely found itself in a compromised state which has made the ordinary citizen a candidate of political manipulation. Perhaps this is a result of lack of knowledge on the true role of the civil society and the how political proxies mascaraed themselves. Some political proxies hide in the name of News Papers, TV stations, NGOs, “Activists”, e.t.c. Allow me to briefly explain the role of the civil society and how to identify a manipulative political proxy.

1. Civil society is defined as ‘the arena, outside of the family, the state, and the market, which is created by individual and collective actions, organisations and institutions to advance shared interests.’ The term ‘arena’ is used to describe the particular realm or space in a society where people come together to debate, discuss, associate, and seek to influence broader society.

2. The use of proxies in warfare is typically understood as a state sponsor’s reliance on military surrogates that are outside the purview of the state’s conventional armed or security forces, and that offer services to their benefactors in exchange for tangible material support. Thus, in a political sense, proxies are political entities hiding under the guise of being non political to push a political agenda.

3. It is important to differentiate the two and allow for citizens to know who means well for them or who is just helping someone gain political milage using manipulation.

4. Civil society desire to contribute towards improving the way society functions. This is the primary motive for association among like minded individuals and groups. While on the other hand, political proxies don’t subscribe to norms and values but align themselves with politicians in the name of being in an NGO. So whenever you see someone or and organization say things that align first with a politician instead of Zambia, you have your self a manipulative political proxy.

5. Civil society is supposed to be independent in terms of management and control from the state. The state and government are only supposed to provide an enabling environment such as an enabling legal framework for organised action for various groups but not to interfere in the running of such organizations. One the other hand political proxies are directly sponsored by the state or political entities to push agendas that don’t align with the values of a country but with the Values of who is sponsoring them.

6. No one should force anybody to join or belong to a particular organisation. Joining or forming civil society organisations runs on a voluntary basis. On the other hand, proxies like to belittle individuals who don’t align themselves with their agenda. They use what we call a “band wagon” strategy to make sure people feel insecure about their freedom of association and are forced to join the proxy or political entity that the proxy is advocating for.

In conclusion, it is clear that Zambia has become a more political country. Many Zambian right now are victims of political manipulation without knowing because of political proxies that have influenced them, especially leading up to the 2021 general elections. It is for this reason that citizens need to know who actually stands for Zambia without fear or favour and who hides in the name of activism to push agendas of politicians as mushanina Bwali’s. PRESIDENT HH has set a good governance tone not only for Zambia but the global as a whole for holding a media conference yesteday to give feedback to the nation on his trip abroad.

For the first time in recent years, a country has a leader who is very sensitive, reflective and responsive in the use of public resources.

This rare occurrence where a leader comes back to feedback and elaborate his trip and stay abroad is unprecedented in Zambia and most African counties.

Some even cheat that they went for UNGA or any other meeting but divert to other countries for medical attention or for personal errands.

President HH’s decision to feedback the nation on what he went to do abroad, which trip was facilitated by taxpayers’ money must be commended and be the norm throughout his presidency and beyond.

It is a rare act in Africa to have a president to account, at his/her own volition, for his/her trip and stay abroad and made an imprest holder irrelevant whilst abroad!

In most cases, our leaders and their delegations never bring back imprest given tp them instead, excuses will be given how the imprest was all exhausted.

Imagine if it were the *Ubomba Mwibala Alya Mwibala regime*, the imprest holder would have been a roommate if not a bedmate to the President and only the Ukwabag that was carrying the imprest would have been retired for another fill for another trip.

This return of imprest and presidential feedback on foreign trips can’t happen in Africa but it has happened in Zambia which is in Africa.

Indeed President HH is sending a very positive signal to Zambians, his party and government and Africa the need for prudent use of public resources and how to be accountable to the je nation and its people as leaders.

Moreso, in promoting accountability, transparency, integrity and responsiveness to public management and administration.

On cadres in markets, bus stations and stops, the President was more than clearer that no more cadres or indeed establishment of political parties branches in markets and at bus stations and stops.

Senior party and government leaders must or seen to pull in the same direction with the President on issues like the fight against caderism, corruption, tribalism, regionalism discrimination than undermining his good will.

On removal of his predecessor’s immunity, his guidance was clear too *let us wait until we cross the bridge if at all we reach there.*

In total, the President has displayed good tenets of good governance and democracy and soon we hope to enjoy me democratic dividends which can be attained if he continued on this governance trajectory .

Outgoing Deputy Head of Mission in Brazil and veteran Journalist, Samuel Ngoma has called for civility in the new UPND government.

In an interview with Daily Revelation from Brasilia, Brazil, Ngoma decried the ongoing recalls of diplomats, where the government is not even taking into account people’s track records, just because they were appointed by the former ruling party, saying not all eggs are bad in a tray.

“My recall simply means the UPND government may actually not be seriously looking for men of integrity to serve. Nor is it meritocracy anymore. If it was, they would have examined my record,” said Ngoma. “I have no shame in saying I am a born again christian and a man of integrity. I advise President Hichilema to walk his talk on meritocracy and accountability.”

He said he was now just tired of being recalled each time there was a change of government as if he has done anything wrong.

“In 2011, I was recalled so painfully when the PF government came to power. I was reappointed in 2016. In 2021, my age-mate’s government has also recalled me. All I have practised in foreign service is live by example, an upright life unto the Lord Jesus and perform professionally, for some people that’s not enough,” he said.

He called out President Hichilema over double standard, saying he condemned the same recalls of diplomats by late president Michael Sata in 2011 when the country’s coffers were very sound, but he is doing the same things even while complaining that he inherited empty coffers from the PF.

“In 2011, President Hichilema vehemently opposed the massive recall of diplomats when the Patriotic Front came to power but now the shoe is on the other foot amid the most hackneyed post-election diatribe of ‘we inherited empty coffers’. In 1991’s revolution, late President Chiluba still stands a cut above the rest. He did not recall diplomats, not on a massive scale,” Ngoma said. “Zambian envoys were stunned to hear Dr. Chiluba’s soothing words, ‘We shall let your contracts run full circle and thereafter, for some of you, we may need your service back home”. He assured diplomats. The polished Vernon Mwaanga was his Minister of Foreign Affairs then. No prizes for guessing why. He said it’s not how long one has served, but it was what one has meaningfully contributed to his country.

Ngoma advised President Hichilema even as a veteran Journalist who served at Times of Zambia, Farmers’ house when HH was at Grant Thornton and survived a number of Heads of State as a scribe starting from the Kaunda era, to scrutinize the list from Foreign Affairs.

“The President must not buy into the list of names to be recalled as submitted by Foreign Affairs, he must treat each name on merit and ask the hard questions. Cancel some names and let some continue to serve the nation. You mean from the dawn of pluralism in 1991, each time there is a change of government all diplomats must be recalled regardless of their expertise, professionalism and integrity?” Ngoma asked. “Righteousness exalts a nation, righteous people. Whether in diplomacy or civil service. It’s integrity and meritocracy that will make the whole difference for Zambia if the new dawn is to see the light of day.”

He said apart from being a man of principles he also had wonderful qualifications to back up the President’s claim to appoint people on merit.

“I have a Masters in Diplomacy (ISPD, Belgium) and another Masters in Political and Mass Communication from UK’s University of Leicester. I have never been a cadre of any political party, ever a professional. So, what’s missing?” he wondered.

He urged President Hichilema that, “humanly-speaking, he should tread carefully so that it does not look like those of us with eastern names are being victimized.”

“To unite Zambia and avert the rallying cry of 1967’s “Umodzi Kum’mawa” that almost disintegrated the nation, the UPND government should not be brazen with its dismissal of Easterners, tread carefully. Fire the crooks, by all means. But not Easterners who are upright and ooze with professionalism. Remember, you got 49% of the vote in Eastern Province and Mr. Lungu got 51%, that’s almost a tie. Spax Writes Police To Clear Him Of Gassing

PROPRIETOR of Spax Mining, Baba Kabaso Mulenga known as Spax, has written to Inspector General of police Lemmy Kajoba requesting that his name be cleared from the chemical gassing incidents.

Between December 2019 and March 2020, the nation witnessed a spate of incidents across the country where citizens, including school children, were gassed by unknown people.

Mulenga has challenged the Zambia Police Service to investigate and arrest anyone accusing him of being the master minder of the gassing incidents across the country and cause a public announcement clearing his name of the heinous crime.

On February 26, 2020 Mulenga was arrested for murder.
He was later released in August this year after the state entered a nolle prosequi due to lack of evidence.

However, Mulenga has complained to the Police against the false media allegations linking him to the recent gassing incident at Buyantanshi Technical School in Chingola district on the Copperbelt, including the previous incidents.

In a letter addressed to the nation’s top cop, Mulenga contended that the unfounded accusations were not only intended to tarnish and bring his name in disrepute, but were also criminal in nature.

He said they had the potential to incite members of the public to rise against him and his family.

Mulenga added that the allegations had left his children and family distressed.
“I have noted with concern social media comments and posts linking me to the gassing incident that engulfed the country from October 2019 to about March 2020, and the most recent which occurred in Chingola district on September 28, 2021,” read the letter.

“I have equally noted the failure on the part of the Zambia Police to exonerate me of these accusations despite the fact that numerous social media comments have linked me to this heinous crime. The Zambia Police is duty bound to protect innocent citizens from unscrupulous individuals peddling malicious information about others.”

He said as a law-abiding citizen he was concerned with the tragic incidents, especially that innocent lives were lost as a result of the gassing.

Mulenga explained that he had never been charged, arraigned or convicted for the gassing incidents by any competent court.

“Like many Zambians, I equally want your service to expedite investigations or indeed inform the nation as to the findings of the Zambia Police as to who was behind these unfortunate incidents. I am aware that when a complaint is made, it is right that the police have an opportunity to consider and respond to the matters raised,” read the letter further.

“In view of the foregoing, I would like the Zambia Police to investigate and arrest anyone who makes false allegations connecting me to the gassing incidents. Further, I am requesting that the Zambia Police cause a public announcement clearing me of any involvement in the gassing incident.”

The Patriotic Front (PF) has sued Attorney General as principal defendant, Anti-Corruption Commission (ACC), Drug Enforcement Commission (DEC) and police for alleged unlawful harassment of its members.

This is after PF secretary general Davies Mwila wrote a complaint letter to, among others, the European Union, African Union and Southern African Development Community (SADC) against what he termed victimisation, intimidation, misrepresentation and purported investigation regarding the party’s sources of funding for the general election. “I am not defending the Patriotic Front.

I am just saying if these investigations will be opened to political parties, then all of us should be investigated.“You will be amazed at where political parties were getting their money from. Speaking as a Zambian, one of the things political parties do is that they get funding for their political activities,” Ms Kateka said.She said Zambians would not vote for some political parties if they knew conditions attached to money they receive from donors.

Ms Kateka is ready to be investigated because she has nothing to hide.“The temptation to get the money out there is very high for all of us but the conditions are what some of us think about. “They will give you money and say you will do this when you are voted into power,” Ms Kateka said.

Foundation for Democratic Process (FODEP) executive director George Chimembe said PF is on firm ground to take the three investigative wings to court because there is no law that compels political parties to reveal their source of funding.Mr Chimembe said if DEC is investigating the former ruling party, then the exercise should be extended to other political organisations.

He said it is only fair that all parties that participated in the general election are probed because this will be part of the rule of law.“What DEC is doing is amounting to harassment of PF members because we do not know the law these people are using to conduct the questioning.

“As we do electoral reforms, let us deal with issues of the Political Parties Bill, which will compel political parties to reveal their sources of funding,” Mr Chimembe

Probably yes to others. For me the fact that I have taken the issue to various people and I am forced to be begging them to do something is really depressing. I don’t have any more energy to carry on. Many of you will not forgive me but I am down. I have reached the end of my tether.

If I continue living I will hurt others and I don’t want that to happen I am already suffering from my post polio syndrome which is getting worse everyday. Compounded by this these people think I am asking for charity and yet this is a vehicle I bought with my own money.

I love my wife Sullea she has given me the best 11 years or so since I made a choice to live with her. We have seen ups and downs and she is my pillar in times of hurt like this. Yes we had plans to wed in December. Ring or no ring you gave me the best days. I love my children Bhubhile Sandra Crecencia Caleb and Clement Jr.

I really want to apologize to them for the pain I will bring to them. My fear is if I continue living I will hurt others especially the people that have decided to make my life miserable that way my family will be ostracized. I am going to Parliament and do this to make a statement that I know they are doing this because I am disabled and they don’t value me.

I would like to thank Martha Chizuma as Oumbsdsman because she saw the injustice and also judges at the Commercial court for their part in trying to see this come to an end. Parliament feels they have the audacity to deny me what belongs to me and I have to go and beg them. I have had enough of that.

With a fully loaded gun I could have killed these people but I will go alone. Let them prevail. I want everything that I have to be enjoyed by my mum my wife and my kids mentioned above. ABOUT UNREASONABLE EXPECTATIONS

1. I really feel sorry for the Zambian people and their unreasonable expectations that their new President Mr Hakainde Hichilema has what it takes to turnaround the Zambian economy and improve the living standards of the people. The truth of the matter is that HH lacks what is needed to really convert the huge potential that Zambia has into actual wealth for the benefit of the people. This is not something that l am saying for the first time, no. I’ve been saying this from as far back as 2014 before l joined active politics. l said this when HH was in opposition and l am repeating this now that he is President of Zambia. Some people might call me a prophet of doom, but l see myself as more of a therapist. Someone who is helping you to adjust your expectations of what the “New Dawn” government will be capable of delivering so that when you finally see the disaster that will inevitably come, you will not be too heartbroken, because Sean Tembo would’ve warned you in advance.

2. Fellow countrymen and women, there is no question that this our country is endowed with huge economic potential in all sectors and sub-sectors of the economy. Whether you talk about mining or agriculture or tourism or the visual arts. Just name it, we have it all. The only reason why we have so much poverty in our country despite the huge economic potential that we posses, 56 years after independence, is because we have always lacked the necessary national leadership with the vision and fortitude needed to convert our economic potential into actual wealth for the benefit of our people. I am fully aware that it is impossible to eliminate all of the problems of our citizens. That can only happen when we go to heaven. I am also fully aware that when you solve one problem, the solution often gives birth to another problem, albeit smaller usually. That is why l have always advocated that as a nation, we need to sort out the basic problem of poverty. Poverty is simply a lack of basic necessities of food, shelter, clothing, access to health, education etcetera. For a country that has huge economic potential and which has been independent for more than 56 years now, we are not supposed to be grappling with these types of basic problems at such a large scale.

3. But then some people might ask to say why are you so confident that President Hichilema will not take us anywhere? Isn’t it too early to make such a conclusion? Am l not supposed to be encouraging and supporting the President because when HH succeeds in his new job, Zambia and the Zambian people would’ve succeeded too? Well, that is very true. But like l said at the beginning, my position that HH is incapable of achieving the economic transformation which Zambia desperately needs is actually long-held and emanates from as far back as 2014. That was the time that l had resolved to join active politics and l was considering whether to join the then ruling PF party under Bashikulu Ba Sata or the then de facto main opposition UPND under the leadership of HH or just form a new party from scratch. My conclusion then was that there was no difference between the PF and UPND. Even after the demise of Bashikulu Ba Sata and the ascendancy of Mr Edgar Lungu, l still held the same view that there wasn’t any difference between the PF and UPND, nor between President Hichilema and President Lungu.

4. But someone might ask to say what exactly do l find wrong with our new President, Mr Hakainde Hichilema and why am l comparing him to former President Edgar Lungu so early? Well, the reason is simple. President Hichilema has a self-defeatist mentality. He believes that Zambia cannot achieve an economic turnaround unless we are assisted to do so through the intervention of foreign countries and entities such as the IMF. Instead of being inward looking, he is outward looking. And l can assure you my brothers and sisters that there is no outward looking leader that ever managed to make their nation prosperous in the history of mankind. Never. The reason is simple. All foreign nations and entities look out for their own self interests and it is naive for anyone, let alone a President of a country to think that another nation or foreign entity will look out for Zambia’s interests. That is not to say we should not create alliances with foreign nations and entities, of course we should. I mean the world is now a single village so we cannot run away from collaborations with foreign countries and entities. But we need to have our own home-based economic turnaround plan and foreign countries and entities should merely supplement it here and there whereby their betrayal would not be fatal to our national interests. What l am trying to say here is that we cannot rely on the goodwill of foreign countries and entities for our prosperity. That is exactly what President Hichilema is doing by putting our country on an IMF program and getting an IMF loan.

5. If l was elected President of Zambia on 12th August, instead of going to America for my first foreign trip, I would’ve gone to DR Congo to discuss with my counterpart there how we can increase trade between our two countries by opening up more border crossings and reducing barriers to trade as well as how Zambia’s tech industry can leverage on DRC’s vast deposits of rare earth minerals. From there l would’ve gone to spend a couple of days with my counterpart in Angola to discuss how Zambia can replace countries from continental America as a major supplier of agricultural produce to Angola. These are the type of bilateral relations that matter to this country and not wasting time in New York with a begging bowl and posing for selfies in front of alleged American icons who were in fact slave traders during their time. Indeed, the tragedy of President Hichilema is that he has an inferiority complex to all white people while at the same time having a superiority complex towards his fellow black people. He thinks he is the most brilliant Zambian to have ever walked the face of our nation while at the same time, am sure that if he had a choice, he would rather have been born white. A President with such a conflicting mindset can never develop our country.

Am innocent and I will prove it in Court. KCM Liquidator Milingo Lungu vows

The provisional liquidator of Konkola Copper Mines (KCM), Milingo Lungu has called the money laundering charges against him as baseless.

Mr Lungu was yesterday arrested and charged with laundering more than $2 million by the Drug Enforcement Commission.

“The money is said to have come into his possession by virtue of being the Provisional Liquidator for Konkola Copper Mines Plc,” the Drug Enforcement Commission, which handles such cases, said.

Mr Lungu called the allegations leveled by the commission “baseless and untrue” in a statement issued by KCM’s corporate affairs department later on Wednesday.

“I welcome the opportunity to clear my name in Court,” Mr Lungu said in the statement.

“This will be done following due process and not in the Court of public opinion.”

The commission alleged that Mr Lungu, acting with others, “did engage in theft” involving 110.4 million Zambian kwachas and $250,000 between May 22, 2019 and Aug. 15, 2021, and “obtained money by false pretenses” amounting to $2.2 million.

“He has also been charged for money laundering for the said amounts,” the commission said.

Mr. Lungu has been released on police bond and will appear in court soon, the commission said.

According to DEC, Further, after the Commission concluded investigations in some of the matters pertaining to the case at Konkola Copper Mines (KCM) Plc it decided to charge and arreste Mr Milimo Lungu, a male aged 43 of Plot 22763, Mulungushi Road in Roma, Lusaka for obtaining money by false pretenses contrary to section 308 as read with section 309 of the Penal Code Act, Chapter 87 of the Laws of Zambia, Theft contrary to section 280 of the Penal Code Act, Chapter 87 of the Laws of Zambia, and money laundering contrary to section 7 of the Prohibition and Prevention of Money Laundering Act No 14 of 2001 as read with the Amendment Act No. 44 of 2010.

Allegations are that Mr Milingo Lungu, jointly and whilst acting together with other persons unknown, on dates unknown but between 22nd May 2019 and 15th August 2021 did engage in theft involving K110.4m and US$250,000.00.

It is further alleged that he obtained money by false pretenses amounting to US$2,200,000.00. He has also been charged for money laundering for the said amounts.

The money is said to have come into his possession by virtue of being the Provisional Liquidator for Konkola Copper Mines Plc.

I Don’t Want To Talk About Politics – GBM

Geoffrey Bwalya Mwamba (GBM) says he will not be drawn into talking about political matters, but those pushing for his PF presidential aspirations should be allowed to do so.

Speaking with Daily Revelation, Mwamba said those who wanted to jostle for the position of party President in the PF should go ahead, but that he reserved his comment on whether he was available for that position or not.

Mwamba, who is a member of the PF central committee, said that the issue of party presidency in the former ruling party is being handled by the Central Committee; stressing that he will comment at an appropriate time.

“If you have noticed, of late I don’t talk about political party matters. Those that want to jostle for power in the PF, particularly for the position of party President, should go ahead; but I will not come out in the open and comment on the issue. This issue is being handled by the Central Committee, of which I am part of. And those that are discussing me, let them discuss…they are free to discuss. But currently I am not discussing party matters,” said Mwamba, who is popularly known as GBM.

And when asked what to make of his self acclaimed influence following the PF loss in the just ended elections, Mwamba vehemently stated that he is not ready to comment on the matter.

“Haah. No, no! I have no comment. Have you ever heard me talking about political issues of late? I have no comment.”

Meanwhile, losing council chairperson candidate for Kapiri Mposhi Brian Nkolola reiterated that PF needs to pick on a credible person for the position of party President.

Speaking with the Daily Revelation on Tuesday, Nkolola said PF needs to pick an individual who will be sellable to the electorate.

He explained that the PF risks losing in the 2026 general election if they field a Presidential candidate with a questionable character.

“I will be honest with you. We cannot risk having ba Chishimba Kambwili as party president for the Patriot Front. Yes, he is popular in the Northern region. He is a good mobiliser and a fearless leader. And that is why I have been saying that he should be Patriot Front national chairman and not party president. He has issues with the Courts of Law. His name should be cleared,” said Nkolola. “What we need for the position of party president is a person who is not only vigorous and knows party structures very well; but also with strong character. We need a credible person who is sellable. The moment we fall to pick a credible and sellable individual, then we are doomed. At the moment, we need to restore publicnconfidence in the Patriot Front.”

Nkolola also opposed calls by some party members to have Professor Nkandu Luo as PF president.

“As we rebrand the Patriot Front, I strongly feel that ba mayo ba Nkandu Luo should take a back seat. We risked by having ba Nkandu Luo as presidential running mate. And we cannot risk again by having her as party President,” added Nkolola.

Arrest Of KCM liquidator Milingo Lungu Is Misplaced – Sean Tembo

1. Before arresting the KCM liquidator, Government should’ve first made a decision on how to proceed with KCM issue. Remember that it is Govt which put KCM into liquidation, albeit against the wishes of other shareholders such as Vedanta. Therefore if Govt decided to stop the liquidation, they can simply enter a consent judgement with the other shareholders in court.

2. Even if Govt decided to proceed with the liquidation process, they could’ve replaced the current liquidator before proceeding to arrest him for the alleged crimes.

3. The bottom line is that the liquidator needed to do a proper handover of the mine either to a new liquidator or to the management of the mine. For the past 3 years or so, the liquidator had total control of the mine without any oversight from a board. He entered into contracts and made decisions which the new liquidator or management will need to understand, hence the need for an amicable handover of the mine.

4. Additionally, there will inevitably be a protracted legal battle between Govt and Vedanta going forward. Such legal battle will boil down to how the mine was run by the liquidator in the past 3 years, and Govt will need the goodwill and institutional memory of the liquidator if it is going to put up a decent fight in such a legal battle. Even if Government halts the liquidation process, there will be a possible compensation claim from Vedanta for the period that the mine was taken away from them. So a legal battle is inevitable. And you need the guy who was running the mine to be on your side when such a legal battle ensues.

5. Overall, the arrest of the liquidator was done prematurely. It could’ve been postponed and done at the right time when the issues at the mine had been resolved. Bally has shot himself in the foot once more. Or more succinctly he has shot the Zambian people on the foot. Bally has put his personal hatred for the liquidator above the interests of the nation. He just couldn’t wait to fix the liquidator. He was oblivious to the bigger picture. The KCM issue was already a mess but it has now become messier. All thanks to Bally’s infinite wisdom.

Following a spark of insinuations from members of the pubic due to former British Prime Minister Tony Blair’s visit to Zambia, opposition Patriotic Front Vice president Hon Given Lubinda says Zambia should never embrace gay rights.

Speaking when he featured on Lusaka Music Radio today, Hon Lubinda said Zambia is a Christian nation and that the mentioned rights have no space in the country.

The visit of Mr Blair who is expected to meet with President Hakainde Hichilema among other series of meetings has sparked public debate because the former British Prime Minister is a known gay rights champion.

Some members of the public have questioned what the agenda for Blair’s visit is.

The opposition party Vice president said Zambians need to ask themselves if they will embrace the mentioned rights.

“I pray to God that no one interferes with the values of Zambians…..We are a Christian Nation and we cannot have such rights,” he said.

Commenting on the issue of the party convention, Hon Lubinda said the party will go to the convention as soon as members are ready. He added that members need to regroup and make ensure that people are ready.

The party vice president stressed that the sooner PF goes to the convention the better.

Meanwhile, Hon Lubinda reiterated that President Hichilema is shocked that he won the August 12 general elections that is why he does not have Permanent Secretaries.

He said the Head of State would have had his team ready way before being declared President if he was ready.

Hon Lubinda urged members of the party to stop finger pointing and ensure that there is concerted effort in rebuilding it. He is optimistic that PF will bounce back into power.

And Hon Lubinda clarified that party president Edgar Lungu can never abandon PF.

He said the president wants to leave a united party.

“ECL has the interest of the party at heart. This is a party that he helped build, he can’t just abandon it like he is frustrated. He wants to ensure a smooth transitioning. He wants to ensure that he leaves a united PF.

“There are a few people who maybe causing confusion but the majority want to see the party emerge stronger.”

PRESS STATEMENT

Lusaka, Wednesday, 29th September 2021.

The Drug Enforcement Commission wishes to update members of the public on the cases that have been reported to the Commission for both pre and post the 2021 general elections.

The Commission wishes to state that it has received a total of Ninety (90) reports during this period of which Three (03) were received just before the elections and eighty-seven (87) after the election. Verifications have been instituted in all the 90 reports and the public will be updated once investigations are concluded. As stated earlier, the Commission is very grateful for all the information received from members of the public. In this regard, we are urging the public to familiarize themselves with the provisions of the Public Interest Disclosure (Protection of Whistleblowers) Act No. 4 of 2010. While we welcome verifiable information from the public, we must be quick to state that information must not be malicious, frivolous, vexatious, trivial or made in bad faith. Further, information must not be made for pecuniary gain or illegal purpose. Section 13 (1) of the said Act is very instructive in this regard.

We further wish to state that financial crimes are complex in nature as they require the investigators to go through the process of following every transaction in order to establish how assets, especially money has been moving. The Commission undertakes thorough and systematic authentication of all transactions in line with applicable laws and international standards such as the Financial Action Task Force standards. Further, the Commission is also very strict in observing human rights and freedoms of persons in carrying out investigations. It therefore goes without saying that the perceived delay in the arrest of suspects or indeed conclusion of investigations is not because the Commission has stopped investigating but rather that investigators go through this rigorous process to ensure that cases that are taken to court are on firm ground.

In this regard, the Commission wishes to announce the conclusion of investigations in a case that was reported prior to the elections which involved six (06) suspects from a named Mobile Network Operator (MNO) who have since been arrested for theft contrary to section 278 of the Penal Code Act, Chapter 87 of the Laws of Zambia and money laundering contrary to section 7 of the Prohibition and Prevention of Money Laundering Act No. 14 of 2001 as read with the Amendment Act No. 44 of 2010 of the Laws of Zambia. These are, Kaseele Hamanyanga, a male aged 37, Bright Kakana, a male aged 46, Jethro Mukatasha, a male aged 40, George Kambole, a male aged 42, Clarence Kauseni, a male aged 40 and George Tapula, a male aged 40.

The allegation is that Kaseele Hamanyanga, jointly and whilst working together with Bright Kakana, Jethro Mukatasha, George Kambole, Clarence Kauseni, George Tapula and other persons unknown, on dates unknown but between 1st January 2018 and 31st December 2019, did steal a total of K624,700.00 property of the said MNO without lawful authority. The suspects were released on police bond and will appear in court soon.

Zambia Won’t Benefit Anything From HH’s US Trip – Lusambo

KABUSHI PF member of Parliament Bowman Lusambo says President Hakainde Hichilema inherited a stable country which already had friends like China, Russia, South Africa, among others.

Commenting on President Hichilema’s sentiments that Zambians would soon see the benefits of his trip to the United States of America, Lusambo said the Head of State only went to the USA to see places as well as the vice president of that country.

“President Hakainde Hichilema should know that Zambia as a country is not at a standstill. President Hakainde Hichilema succeeded or inherited the country which was moving and stable and a country which had friends. We had friends like China, Russia, South Africa, Kenya and Egypt. President Hakainde Hichilema went to the United States of America on holiday. He just went to see places and see the Vice-President of the USA and that is all. Which benefits are we going to get from President Hakainde Hichilema?” Lusambo asked.

“Is it the IMF? The IMF is not a benefit, it has just come to milk our country and we have seen this before. Those people who are excited about the IMF should come and ask us when the IMF came in 1990 to 1991. That is how we have failed to recover in this country economically because the policies which came from the IMF were to cripple a country like Zambia. I can assure you that there is nothing that you can get from the whites because they do not want Africa to develop. They do not want Zambia to develop and they just want their country to develop. How can you explain the situation where today, the IMF comes to Zambia and they will give us the loan which will take so many years to repay? It does not make sense.”

Lusambo said there was need for mindset change and to stop seeking solutions outside the country.

“So President Hakainde Hichilema, the only thing why we are happy as Zambians is that he came back safely into his country Zambia and we want him to concentrate on home-based solutions to home-based challenges we have. There is no solution which will come from America, it is a lie. There is no solution which will come from America to come and sort out home-based challenges. We have plenty of natural resources. If we want to change the fortunes of this country it is us ourselves, the Zambians, to change the fortunes of this country because we have everything. Americans will come through USAID, pandemic because those are the things which they support. They do not give money to the country. Our colleagues in China will give you money to build schools and hospitals,” said Lusambo.

“So in short, if this country has to develop, it is you and me to make sure that we change our mindsets. The biggest problem Zambians have is that our bodies are in Zambia but our minds are in America, UK, South Africa, Dubai and everywhere, our minds are scattered. Until we bring the mind and the body together and start thinking in the right direction to start seeing money in the minerals we have then we will develop. So the trip by the President is just one of those trips. It is more like your father has gone on holiday in Solwezi just because Solwezi has minerals and you think those minerals proceeds will come to benefit your household, it cannot. So in short that is Hakainde Hichilema’s personal achievement but what is the benefit of the people of Zambia? Nothing.”

President HH boasting in an interview with CNN promised the world, that we shall be surprised by his choice of appointment of the new Bank of Zambia Governor only to come to learn today that he has just recycled Doctor Daniel Kalyalya a failed Governor who had 3yrs contract with the PF Government and left the economy and the dollar on its knees.

Are you telling me sure that the entire UPND political party has no one with the capacity to be appointed Governor of Zambia? under the UPND government.

The continuation of frustrating members of your political party that worked with you during the struggle for 25yrs will soon fix you sir if at all you don’t change the mathematical models in the selection of competent people in key positions. I know for a fact that upnd is the only party which has serious educated intellectual members at that level of the Governor up to the PS, but if we the young people continue to see the quality of choice of PF (president lungu) on your so-called Bar table in the new Dawn then I doubt that will see a lot of new development apart from the same movie during ECL government.

This road clearly shows that youths have no space to play at the governance level today, let’s face it and accept that no matter how educated with an Oxford, Harvard University Masters Degree, PHD holder, the young people will remain in the baby section class.

We hope that this is the last person from the recycled list sir, we need new faces for new ideas, a new development for better results and benefits for the people of Zambia.
This governor had 3 good years to perform but he failed to perform under Hon…mutati, Hon..mwanakatwe, Hon.. bwalya ngandu and today he is working with Hon..musokotwane 4 ministers now, sir we can only wish you Gods blessings and guidance in the new dawn.

I understand he is a very educated human being just like our new recycled minister of finance hope they deal with the dollar and deliver for our hardworking HH our President of today in Zambia who has a list of promises to deliver to the youths in the majority and the people of Zambia.

UPND deputy secretary general Patrick Mucheleka says Rainbow Party leader Wynter Kabimba has always been bitter towards President Hakainde Hichilema.

Commenting on Kabimba’s remarks that if President Hichilema continued making pronouncements that the PF government was corrupt he would force investigative agencies to start rounding up innocent people, Mucheleka said Kabimba had always had a grudge against the Head of State.

“Wynter Kabimba has always had a grudge for whatever reason against our President. I think it is coming out of sheer jealousy. As far as I know, they should be brothers but you have a brother who is so jealous of the achievements of the other brother. That may explain the bitterness that Wynter Kabimba has against our President. It is not anything new. You will never find anywhere that Wynter has had any kind words for President Hichilema and being a statesman, he has never responded to Wynter’s bitterness,” Mucheleka said.

He said the corruption in PF was so rampant that it was in their genes.

“If there is one political party that was very corrupt, and where corruption was so rampant, it was in their genes, it is PF. It is one of the reasons as to why Zambian people rose up, especially the young people and women to vote out PF. The issue of empowerment funds, up to now, no one can tell you from the time PF was in power how this money has been utilized or if there is a project anywhere in the country where the youths have benefited or if there is a project of which these funds were used. You won’t find. There is an issue of Higer buses, go to the Ministry of Youths and Sports, you will not find a single bus. We don’t know whether they are moving or not. Recently, there was an issue of the so-called fuel tankers, it is PF and some of their leaders who were involved in corruption and the evidence is there through the Financial Intelligence Centre reports pointing to that fact,” Mucheleka said.

Mucheleka further called on investigative wings to do better now that there was no interference in their work.

“The main reason perhaps there might not have been convictions on any PF senior member apart from Emerine Kabanshi is because there was no political will by the PF government to fight corruption. They were tolerating corruption, they were benefiting from it. We have seen how the Anti-Corruption Commission, the Drug Enforcement Commission, FIC are giving out information, summoning individuals. Except those institutions also, they can do better, they need to jack up their standards. Especially now that there is no interference in their work, they must rise to the occasion. They must go back to their files, they have them and they know who is corrupt. They must bring to book every corrupt element from the PF,” he said.

Mucheleka said once stolen money was recovered, it would be channeled to key sectors like youth employment.

“The youths are looking for opportunities, they are looking for jobs. Once that stolen money is recovered and it is redirected in the key sectors of our society such as education, health and other social sectors, the other money will be used in economic activities where the youths can participate and that can lead to access to job opportunities. Where there is rampant corruption, there is lack of resources that can help to create jobs. That is why the President has created special vehicles such as the Ministry of Small and Medium Enterprise, it is meant to make sure that we bring down corruption and create jobs,” he said.

Meanwhile, Mucheleka said the PF government forced out former US Ambassador to Zambia Daniel Foote because he commented on corruption.

“Why shouldn’t the President talk about corruption? Who doesn’t know that there was corruption in Zambia? We have diplomats accredited to Zambia who have been part and parcel of what has been going on. Remember they forced out the American Ambassador to Zambia Daniel Foote because he commented on some of these elements of corruption. They should explain how they chased the Ambassador, as I speak, we don’t even have a US Ambassador to Zambia. Now that we have a new government in place, we hope that they can upgrade the American Embassy in Zambia to the status of an Ambassador,” said Mucheleka.

“Remember they are the same ones that forced out the IMF country representative who commented on corruption. So what is Wynter saying that we must not be commenting and that President HH must not talk about Zambia’s corruption in America? Everybody knows. And those people have representatives in Zambia, they know what is happening because they receive reports.”

Zambia’s Chinese debt nearly twice official estimate, study finds

Reuters reports that Zambia’s debt to Chinese public and private lenders is $6.6 billion, almost double the amount disclosed by the previous Zambian government, an analysis of loan data by the China Africa Research Initiative (CARI) has estimated.

Zambia became Africa’s first Pandemic-era sovereign default last November and its ongoing debt restructuring has become a test case of Western multilateral efforts for countries to fully disclose their borrowings.

Zambia’s previous government led by Edgar Lungu said its Chinese debt stood at $3.4 billion. But the estimate published by CARI on Tuesday chimes with recent comments from newly-elected President Hakainde Hichilema, who took office last month, that the debt load is likely higher.

The country’s international creditors, which the government is in talks with, have complained that the lack of detail on Zambia’s China loans – which carry specific non-disclosure terms – has hindered the debt restructuring process.

“Given the complicated situation… reaching consensus on burden-sharing is likely to prove exceptionally difficult,” the CARI researchers who made the new estimate, Deborah Brautigam and Yinxuan Wang, wrote.

The new $6.6 billion figure is based on Chinese loan data collected by CARI at the Johns Hopkins University School of Advanced International Studies.

It is likely to continue to grow as it does not include penalties or interest arrears that continue to build up.

China is Africa’s largest creditor.

It is part of the World Bank and International Monetary Fund-supported Debt Service Suspension Initiative which has temporarily frozen debt payments to dozens of the world’s poorest countries, but it is being urged to do more in terms of disclosure.

Tuesday’s study estimated that $7.77 billion in loans to Zambia and its state-owned enterprises were disbursed by 18 major and minor Chinese banks or funds from 2000 to August 2021.

Of those, Zambia has repaid at least $1.2 billion.

Their estimate does not change Zambia’s total debt load of $14.3 billion, the researchers said, but shows that the Lungu government “was not transparent about the heavy weight of Chinese financiers among its many external creditors”.

Bwalya Ngandu, finance minister under Lungu, has said it is not true that Zambia’s debt numbers were understated.

“We have never hidden any debt,” he said in a statement earlier this month.

The researchers found six instances where Chinese lenders cancelled debt owed by Zambia, for a total of $392 million.

Youths Didnt Vote Out PF Because Of Corruption, They Wanted Jobs – Wynter Kabimba

RAINBOW Party general secretary Wynter Kabimba says if President Hakainde Hichilema continues making pronouncements that the PF government was corrupt, he will force investigative agencies to start rounding up innocent people.

And Kabimba says youths did not vote out PF because of corruption but because they wanted jobs.

In an interview, Kabimba said it was not right for the Head of State to prejudice investigations.

“Nobody has been convicted so far over corruption charges, we have not heard of any official in the PF government who has been arrested or charged with corruption, that is most unfair. I think President Hichilema must allow investigative agencies to investigate cases of corruption systematically, professionally and bring those that were involved in corruption to book. It is not right for the President to prejudice those investigations by investigative agencies. If he continues making those pronouncements, like he is doing, he will force the investigative agencies to start rounding up innocent people so that they can prove to him that yes, there was corruption,” Kabimba said.

“He will make investigative agencies take weak cases to court where they will not secure any conviction and the people may turn round that because the President said that there was corruption and X has been acquitted, therefore that is the fault of the Judiciary that is an environment that he is creating. You can see that he is manning the matter to the extent that he has even made people like Joe Biden, the American President, believe that the youths of Zambia voted against PF because of corruption.”

And Kabimba said the youths in Zambia did not vote PF out because of corruption but because they wanted employment.

“The youths of Zambia did not vote PF out because of corruption, they voted for UPND because Mr Hichilema promised them jobs. They were voting for employment that he forced he promised the youths of Zambia. He was going round, asking youths to submit lists for employment consideration. As far as the Zambian youths are concerned, even if you arrest everybody in PF over corruption, it doesn’t put food on their table. What they want is to earn a living, earn an income to look after themselves and their families. So he has said enough about corruption, he has misled people enough including the general community, we want to see action now, And he must keep quiet so that the investigative agencies can get on with their work and prove to us that indeed, the corruption that President HH is talking about, existed in PF,” he said.

Kabimba, however, said anyone who abused their offices while serving in government should be brought to account but that due process should be followed.

He said it was not fair for President Hichilema to start making narrowed statements on corruption internationally.

“I am a strong advocate that anybody in the PF government that abused their authority in office must be brought to account. They must answer for their misdeeds that they committed. But we would like to see that done through the due process of the law not by way of kangaroo pronouncements. It has been believed in terms of general perception that there was corruption in the PF government. There was corruption perpetrated by the PF government. And it is one of the reasons why the people advocated for change and decided to vote the PF out of government on the 12th of August, 2021. President Hichilema during campaign trails, he dwelled on this issue of corruption in the PF government which coincided very much with the perception held by the general public. So they decided to give him the vote so that they can bring to an end the suspected or alleged corruption in PF and show that those that perpetrated corruption or were engaged in corruption in the PF could be brought to account,” said Kabimba.

“And starting with his first press briefing, his inaugural speech and all his subsequent speeches, President Hichilema has laid emphasis on this issue of the UPND government fighting corruption, so it has been his crusade. However, he also promised the Zambian people that the UPND government was going to promote the rule of law, in other words, every citizen according to our criminal justice system is innocent until they are proven guilty by an established tribunal i.e. the Judiciary in Zambia. So it is unfair and it is not right in my view that he must continue or make narrowed statements both here and internationally about Zambian corruption.”

Now that he has died, he lives forever: Remembering Simon Zukas- Sishuwa Sishuwa

In April 1952, a 26-year old man stood before the Northern Rhodesia Chief Justice, who had been asked by the Attorney General to consider whether this young man was ‘a danger to peace and good order’ and whether he had been ‘inciting Africans against Europeans’. The judge was further asked to consider whether he found grounds to recommend to the Governor that the man should be deported. Following two days of court hearings, the young man was solemnly declared to be ‘a danger to peace and good order’, and, after a fruitless appeal to the High Court and eight months in jail in Livingstone, he was deported to England, a country he had previously neither visited nor lived in. That young man was one of the few white men to stand up against white supremacy in Northern Rhodesia. He was a member of Harry Mwaanga Nkumbula’s African National Congress (ANC), and is one of the heroes of Zambia’s struggle for independence. His name is Simon Ber Zukas. On 27 September 2021, Zukas died peacefully in his sleep at home in Lusaka. He was aged 96. Who is Zukas and how did he end up in prison?

Born 31 July 1925 in Ukmerge, Lithuania, Zukas came to Zambia on 26 July 1938 to join his father, a Jewish settler who had earlier migrated to the industrial Copperbelt and established himself as a successful trader. After completing his secondary education in Luanshya and colonial Zimbabwe and serving briefly in the armed forces during the Second World War, Zukas went to South Africa to read for a degree in Civil Engineering at the University of Cape Town in 1947. His time in South Africa, coinciding with the inauguration of apartheid, thrust him into radical student politics where he distinguished himself as a shrewd operator and rehearsed his later confrontations with the African colonial apparatus.

Upon graduation in December 1950, the young engineer returned to Zambia where he learnt of the colonial government’s plans to federate the country with Zimbabwe (then Southern Rhodesia) and Malawi (Nyasaland). Arguing that this would serve the interests of the white settler minority, further disadvantaging the black majority and delaying the attainment of independence, Zukas put aside his professional and personal considerations to join the ANC, the main nationalist movement at the time. Though constituting a risk to his own life, his decision to confront those who perpetuated injustice and become an active participant in the struggle for independence was a statement of his commitment to equality and was in sharp contrast to most whites at the time, whose support for African causes was limited to hushed statements from the safety and comfort of home.

When white settlers and the colonial regime intensified their campaign for the Federation of Rhodesia and Nyasaland, Zukas – alongside other young, militant nationalists like Justin Chimba, Reuben Kamanga, Jonathan Chivunga, Nephas Tembo and Abner Kazunga – formed, in April 1951, the Anti-Federation Action Committee, of which he became secretary, and began rallying thousands of Zambians, especially those on the influential Copperbelt, to resist the proposed plans. Noting his growing influence in the nationalist movement, the colonial authorities ordered him to abandon his opposition to the Federation of Rhodesia and Nyasaland and, when he defied the directive, sent him to prison in April 1952. He remained in detention until December that year, when he was deported. But Zukas never turned his back on Zambia. He remained a hugely significant political figure in the nationalist movement, rendering support from London in the form of strategic advice, mobilising considerable resources and serving as the crucial link between the African nationalists in Zambia and their backers abroad.

Upon independence in October 1964, the new government led by President Kenneth Kaunda and his United National Independence Party (UNIP) invited Zukas to return to Zambia. Despite running a successful engineering consulting firm in England, he came back to Lusaka and, in a unique manifestation of patriotism, took Zambian citizenship in October 1965. While he was close to Zambia’s political leadership in the First and Second Republics, Zukas devoted much of his time during this period to establishing and leading his engineering consultancy firms. He offered the young country his professional expertise and was responsible for the structural designs and supervision of major public constructions such as Parliament, State Lodge, University of Zambia (UNZA) School of Mines and the flyover bridge on the Great East Road. The UNIP leadership also regularly consulted him on a variety of subjects and his advice was greatly valued. Further national involvement was expressed through his board membership to state institutions such as Industrial Development Corporation, Zambia National Building Society, National Council for Scientific Research and UNZA Council, on which he served from 1966 to 1990.

After his efforts to persuade President Kaunda and UNIP to abandon the one-party state failed, Zukas, like many Zambians, broke ranks with his friends and joined the drive towards multi-party politics. He attended the Garden House Conference that resulted in the creation of the Movement for Multiparty Democracy (MMD) in July 1990, was elected as the party’s first Vice-National Chairperson at its inaugural convention in February 1991 and played a leading role in the political revolution that followed. In the founding general elections following the re-introduction of multiparty politics, Zukas easily won a parliamentary seat in Sikongo constituency, Western Province. That he, a white Zambian, achieved that feat in one of the country’s most conservative regions, where he had no roots whatsoever, speaks to Zukas’ nationalist credentials as well as his political skill and ability to convince people of the need for change.

Between 1991 and 1996, under President Frederick Chiluba’s government, Zukas held several ministerial positions and history shows that he stood by his principles, was never afraid to speak his mind, and championed the interests of the poor and disadvantaged. He frequently cautioned his colleagues not to lose sight of the reasons why the MMD was formed and had been given an overwhelming mandate by the electorate. Zukas despised political sycophancy and hero-worshipping leaders. He was almost always guided by pragmatism, his conscience and respect for human dignity. Thus, when the Chiluba government passed the 1996 Constitution, which, among other things, barred Kaunda and Lozi Senior Chief Inyambo Yeta from contesting the 1996 general elections, Zukas, as did Dipak Patel, quit his Cabinet position in protest. His resignation signified that there could be civility in politics and that the principle of collective responsibility could not be sustained when the government was doing wrong. He remains one of very few politicians to voluntarily resign their lucrative ministerial positions in the Third Republic, along with Akashambatwa Mbikusita-Lewanika, Baldwin Nkumbula, Ludwig Sondashi, Rodger Chongwe and Vice-President Levy Mwanawasa.

When Chiluba hatched plans, towards the end of his second term, to amend the constitution of Zambia and seek an unconstitutional third term of office, Zukas joined hands with other progressive forces to oppose the President’s bid. He travelled abroad extensively to canvass support for the Oasis Forum, the grouping of civic associations that championed the campaign against the third term. When Chiluba finally succumbed to political pressure and shelved his plans in early 2001, Zukas was among those who formed the Forum for Democracy and Development (FDD) and became its first National Chairperson. He remained active in politics until 2005 when he retired and voluntarily stepped down as FDD chairperson at the age of 80.

Over the past fifteen years, Zukas continued to speak out periodically on matters of national importance, stressing the need to fight corruption, uphold peace, promote national unity, support media freedom, protect democracy, improve the delivery of social services, reduce (rural) poverty, and scale down the high rate of unemployment. More recently, worried about the negative turn that the country took under the leadership of Edgar Lungu, he joined hands with other concerned citizens to form the appropriately named Our Civic Duty Association, an organisation that seeks to foster good governance, encourage effective management of the economy, and serve as a platform for robust discussion of the most salient policy and national issues.

A teetotal non-smoker who exercised daily and a man who was utterly at ease with himself, his personal life spoke of temperance, mental and physical discipline and the presence of an equal partner – Cynthia Robinson, whom he married on 30 January 1954 and with whom he has two sons – that helped him reach such a grand age in an era when lifespans and marriages are increasingly short.

As a genuine and dedicated cadre of progressive change, a defender of principle and the public good, and a porter of a moral power earned from selfless service as a foot soldier for freedom, development, democracy, equality and justice, Zukas evinced true citizenship. Ever on the right side of history, he showed us that to live is a state of continual consciousness. While highly approachable and humble, he held strong political beliefs for which he was prepared to sacrifice privilege. The young generation of political activists should look to his long and distinguished political career for example and inspiration.

In a world in which many are driven to show off not just their wealth and power but also their heroism, the numerous sacrifices they had to make and the grand battles they had to fight, Zukas refused to beat his own drum, repeatedly praising the work of others rather than himself, and he remained extraordinarily modest about his considerable achievements. Zambia has great need of such patriots and active citizens as Zukas, who understand that the essence of life is service. It was as if he was spurred by the words of the Chilean poet and revolutionary, Pablo Neruda, who, in the poem “So is my life” wrote:

“My duty moves along with my song: I am I am not: that is my destiny. I exist not if I do not attend to the pain of those who suffer: they are my pains. For I cannot be without existing for all, for all who are silent and oppressed I come from the people and I sing for them: My poetry is song and punishment. I am told: you belong to darkness. Perhaps, perhaps, but I walk toward the light. I am the man of bread and fish and you will not find me among books But with women and men: They have taught me the infinite”.

May we all attend to the pain of those who suffer, exist for the silent and oppressed, walk towards the light and learn, from Zukas’ life, the infinite! His death represents the end of an epic life. Zukas felt so permanent, as if in his case, and that of a few others such as Kenneth Kaunda and Andrew Sardanis who died earlier this year, death would make an exception. The good thing though is that legends never die; they simply change form and locations.

It remains my conviction that the relevance of death lies in its impact on those that live. Let Zukas’ death inspire us to continually improve ourselves because it is in our quest for individual excellence that we truly become witnesses to the greatness of life and service to humanity. Let such deaths remind us to celebrate the ephemera and gift that each day is, to live now and in the present. We sometimes miss out on life when we seek more, when we seek permanence, for what we have is now, and we must live in the moment. For that is all there is to life – now.

Meet Simon Zukas: the Jewish man who fought for Zambian statehood

In the years before Zambia achieved statehood in 1964, one of the few white men to stand up against the culture of white supremacy was a Jew — Simon Zukas.

Mr Zukas and his family came from pre-war Lithuania to what was then the British colony of Northern Rhodesia because it did not employ quotas limiting Jewish settlers — unlike South Africa and Southern Rhodesia, later Zimbabwe.

He later joined the territory’s struggle for independence and today remains a standard-bearer for its small Jewish community as chairman of the Council for Zambian Jewry, an umbrella organisation.

“The threat of Hitler was around when we moved from Lithuania but we didn’t foresee what was going to happen,” he once told the Zambian website Extraordinary.

“We left for economic reasons but we were lucky. Only a few years later it would have been very difficult because of the war.”

Mr Zukas’s schooling took him to the University of Cape Town, where he studied civil engineering. His time there coincided with the inauguration of apartheid, which thrust him into radical student politics and inspired him to join the main nationalist movement, the African National Congress, when he returned to Northern Rhodesia.

An active participant in the country’s struggle for independence, he was eventually deported to Britain but, following statehood, was invited in 1965 to return by the new country’s president, Kenneth Kaunda.61U+Q25j6BL

By now a qualified engineer running a successful consultancy in England, Mr Zukas said he moved back to offer his professional expertise in major infrastructure projects.

A career in politics also followed: his efforts to persuade Mr Kaunda and his United National Independence Party to abandon a one-party state failed and, in 1990, he joined the drive towards multi-party politics, playing a leading role in its subsequent return.

Now 93, Mr Zukas was most recently leader of the Forum for Democracy and Development, an opposition political party. He retired from politics in 2005.

His wife Cynthia, an anti-apartheid activist from South Africa in the 1960s, made a name for herself in the world of art and cultural heritage. Six years ago, she was awarded an MBE.

But Zambian independence also triggered a change in the land laws and an exodus of white residents, including many from the Jewish community.

Today, just 12 Jews still live in the country and the last remaining synagogue in the capital, Lusaka, was sold — with the money donated to charities in both Zambia and Israel.

“There is,” Mr Zukas revealed, “a general wish to use our funds to build a small replacement synagogue but we have not as yet managed to find a suitable, affordable plot.”

Kalyalya Has A Very Poor Record At BOZ From 2015-2020 Says Zambia Business Times

Dr. Denny Kalyalya’s re-appointment is controversial

President Hakainde Hichilema upon returning home from the trip to the US has made three appointments, one of the key ones is the re-appointment or Dr. Denny Kalyalya as Bank of Zambia Governor.

Dr. Kalyalya is a former President Edgar Lungu’s appointee who fell out of favour in the last hours of his presidency. We have done some research on why Dr. Kalyalya’s appointment is being viewed as controversial and below are the top five reasons:

1. When Dr. Denny Kalyalya was first appointed as BOZ Governor in February 2015, Zambia’s currency exchange rate was about K5.3 per US dollar and by the time he was sacked, the local unit had depreciated to about K22.5 per US dollar; is this a good record to defend and say that the re-appointment has been made on merit?

2. When Dr. Kalyalya was appointed as Governor in 2015, Zambia’s international reserves stood at about US$3 billion, by the time he left the post, it was at one of its all time lows of US$1.3 billion and less than the recommended 3 months import cover. Could he had done better to defend the country’s reserves than hold on for the sake of protecting his job? Is this a strong performance and integrity record?

3. Monetary policy in Zambia adopted an inflation targeting system, but when Dr. Kalyalya was appointed, in February 2015, Zambia’s annual inflation rate was in the single digit range and stood at about 7%, at the time of his sacking by former President Lungu, inflation rate for the country had climbed to double digit and well over 15% – was the Monetary Policy he supretendted on helpful to the Zambian economy?

4. When Zambia discovered notable gold reserves at Kasenseli – Mwinilunga, establishing national gold reserves at BOZ did not move at a higher and faster pace and this was reported to have not received top leadership prioritization and support, this was during Dr. Kalyalya time as Governor. Do you think he did a good job on establishing alternative reserves in gold?

5. When you look at banks, micro financial services providers and market lending rate as at February 2015, lending rates in Zambian based lenders were below 15% per annum and by the time Dr. Kalyalya was sacked, lending rates in banks and other financiers for consumers had spiked to above 27%? Was this also something that was beyond his call to resign on moral grounds?

It is also acknowledged that Dr. Kalyalya was only responsible for the Monetary Policy side and there is an argument that the problems Zambia encountered were largely on account of lapses the fiscal policy side.

But it can be counter argued that Dr. Kalyalya should or ought to have resigned to show the public that his efforts on the monetary side were being hampered by the fiscal side and that he was not a willing partner of the former government’s actions or is it inactions.

This is perhaps why this appointed is being seeing as controversial by some inquisitive minds- This is why there are calls for de-classifying reasons behind Dr. Kalyalya sacking by former President Lungu so that he can be fully and publicly exonerated.

Court Restores Contempt Proceedings Against Nawakwi

COURT RESTORES CONTEMPT PROCEEDINGS AGAINST NAWAKWI

THE Lusaka High Court has restored contempt proceedings against FDD leader Edith Nawakwi to the active cause list after the case was struck out for want of prosecution.

According to an affidavit in support of ex parte summons for an order to restore the matter to the active cause list, Counsel Kamuwanga Phiri of Malambo and Company stated that the matter was scheduled to come up for hearing on September 6, 2021 at 09:00 hours but he had another matter at 08:30 hours before Justice M Zulu.

He added that another lawyer, Mulambo Haimbe was supposed to attend before the court but his meeting on national duty took longer than planned.

“We rushed to the chambers and arrived shortly after 09:00 hours at this honorable court’s chambers and was advised by the Marshal via phone call that the court had struck the matter off the active cause list on account of non-attendance of parties with liberty to restore within seven days,” stated Phiri.

He stated that the non-attendance at 09:00 hours was unintentional and was not meant to be discourteous to the court and was deeply regretted.

Phiri said the defendant was desirous to proceed with the hearing of the contempt proceedings on the merits and verily believes that no prejudice will be occasioned to the alleged contemnor should the court grant the defendant an order restoring the matter to the active cause list.

And according to the ex parte order signed by Judge Susan Wanjelani, she ordered that the matter be restored to the active cause list.

“It is hereby ordered that the contempt proceedings be and are hereby restored to the active cause list and that the costs of and incidental to this application shall be in the cause,” read the order.

Hearing in the matter has since been set for January 24, 2022.

In this matter, Dickson Mtonga and 22 other security guards sued African Life Financial Services limited in 2014 demanding US$300,000 and terminal benefits owed to them following their transfer.

But the company asked the court to commit Nawakwi to prison for misrepresenting facts during a press briefing on February 6, 2021, which was simultaneously and subsequently broadcast on various media platforms when the matter was pending determination before the court.

Nawakwi is stated to have said that workers who were yet to be paid their terminal benefits were transferred from Anglo America to African Life with a package of US$3,000.

“During the press briefing, and during the pendency of this matter before this Honourable Court, Edith Nawakwi did make use of speech by which she misrepresented the facts herein in such a manner as to make it appear that the defendant, African Life Financial Services (Z) Limited, is liable to pay the plaintiffs the sum of US$300,000 and other monies, which is a matter pending determination before this Honourable Court and which speech is and was calculated at prejudicing the general public against the said defendant,” read the motion filed before the Court.

The company stated that during the said briefing, Nawakwi’s speech was contemptuous and capable of prejudicing it.

African Life Financial Services further stated that Nawakwi committed an act of intentional disrespect to the court and the judicial proceedings before it.

They also added that Nawakwi was to bear the costs of the action

When U.S. President Joe Biden cited Zambia for corruption in his speech to the United Nations General Assembly, I honestly expected a fiercest response from our President or UN ambassador. Instead, I got a smile from President Hichilema, and praises from his followers! Without any protest, our president met with U.S Vice President Harris.

Yet it was clearly a violation of the Westphalia Protocol that prohibits foreign leaders from interfering in other nations’ domestic affairs. Zambia’s democratic credentials go back to 1991, to claim that this election is the first time we have voted against corruption and bad governance was insulting. Worse still to place Zambia among countries like Sudan is saddening. What was even more embarrassing is the fact that the President of Zambia was in the audience when the country he vowed to protect from external and local interests was insulted by another Head of State.

I get it–President Hichilema’s understanding of international relations vis-à-vis domestic politics is next to none, but they are things he must understand. In International Relations, his standing is the same as Joe Biden’s–another reason I found it most insulting that he took a meeting with Vice President Harris after President Biden “canceled.” He simply justified his lower status–he is a second class president. In diplomatic standing, however, they are both equals.

The victory of Joe Biden and Hakainde Hichilema are similar in many ways. Both unseated very unpopular sitting Presidents, had women as running mates, and ran against the most corrupt administrations. But there were major differences too. Unlike Lungu, Trump came to power through the back door–Russians and corruption propelled him into office. Trump’s entire circle is either in jail or about to go to jail for corruption or other crimes against America. Trump is the first President to face countless lawsuits.

In addition, Trump didn’t concede defeat to this day. Instead, he asked his followers to attack the Capitol so as to stop the certification of votes to make Joe Biden the 46th President of the United States. On January 6, people died, and many more are nursing the trauma of that day. But Lungu allowed the peaceful transition of power, and managed to attend the inauguration of HH as the 7th President of Zambia. Trump didn’t!

Did it occur to President Hichilema that Biden didn’t mention Trump, and American elections? He was there to promote the best ideals of America to the world. Our President should have lectured him about conceding and peaceful transfer of power. Maybe he should have taught him about police brutality and racism. He should have reminded him that, unlike Americans, once elections are counted and announced, Zambians honor them. We don’t storm the Parliament like they did in America on January 6. I assure you, that would have surely led to the cancelation of his meeting with Vice President Harris, and the recalling of the US ambassador from Zambia.

No western nation would talk publicly about American elections or the failure of Trump to concede to Biden. Unless you are enemies or looked down on, the Westphalia Protocol prohibits nations from interfering in domestic affairs. That is why all the countries Biden mentioned are beggars. Yes our President may have felt great, but Biden insulted him as a poor moron. As a baby President, it is ok, but once an adult, President HH will be forced to make decisions that would make Joe mad. If he insults him then, he shouldn’t cry aloud–he just exposed himself to the West in the presence of the world.

There is a reason why African presidents avoid being ponies of the West–they will use you and dump you at will. I am afraid President HH is likely to be a lone woof in Africa–something that may work against him. Zambia needs other African countries to develop–the West is not a reliable partner at all. I understand he is in love with capitalism, but Bretton Woods guys are exploitative and equally corrupt. You are only good as long as you deliver the goods.By the way, they may lie to you–but one of America’s biggest creditors is China.

I am not surprised that many Zambians were celebrating the insult! But we must ask ourselves why European countries never mentioned the Capitol insurrections or the voting out of Trump due to corruption. Our colonized minds make us view the white man as the standard of good; thus we are celebrating an insult because it is coming from a white man. America won’t develop Zambia! We Zambians are the solutions to our poverty. We have been begging since colonial times–we have the waters, the land and the minerals. We have mangoes and we have oranges. The money we waste on visas alone can buy machines to make juices for export. Most importantly, the money we waste sleeping in their expensive Hotels to beg for peanuts can be used to buy tractors to empower communities to produce flowers for export–we don’t need America to develop. America has its own poor people. President HH saw them on the streets begging for cents. So what makes him think that Biden will help poor Zambians for nothing? Have you forgotten our own Dambisa Moyo’s Dead Aid? The mentality of I am “the only African” this and this, can be dangerously deceptive. The West is always looking for ponies to use, and the new boy on the street is the best candidate for the job!

As for corruption, America is the last country on earth to tell the world about it. Yes they may call it lobbying, inside dealings or dark money, but the outcome is the same. Politicians are paid by so called special interests to drive their agenda. So stop begging or cutting deals with so called experts, they are just after their profit. Only the hard working Zambians will develop Zambia! The Chinese or Americans will come, make money, and leave, but only Zambians will remain.

PF HAVE NO REMORSE…they shouldn’t be allowed any closer to power – Mufalali

NOMINATED member of parliament Likando Mufalali says the PF have no remorse whatsoever.

Debating President Hakainde Hichilema’s speech to Parliament, Mufalali said PF members should not have been claiming being harassed if they had any remorse.

He said the former ruling party had abused and hurt many people such that they should have been scared to even claim victimisation.

“And, unfortunately, they have no remorse whatsoever in this House. Without remorse they are able to complain that ‘we are being beaten’, even without being beaten. They have no remorse. They are even being comical here,” he said on Friday. “They keep on standing in remembrance of, you know, chairman what, chairman this, that. I think that is comedy, Madam Speaker.”

Cataloguing horrible events during PF’s 10-year rule, Mufalali said they should not have been given power.

He added that even former president Edgar Lungu should not have been allowed access to State power.

“The PF were a danger to this society. The PF, Madam Speaker, should have never been allowed to come any closer to power, or to rule this country. They brought misery, untold misery, to many families,” Mufalali said. “We must be serious and we need to be serious. We can’t allow a situation where many women and men died at the hands of the police under the PF regime. And they have the audacity and prowess to stand and start claiming or playing victim! It must not be. We have serious business for this country. We cannot continue with comedy, rising up and moments of silence; it’s comedy.”

Mufalali pleaded that what happened under PF should never be allowed again in the country.

“…this country deserves better. What we have seen in the past 10 years of PF rule should never get back to the Zambian people. The suffering was too much, Madam Speaker,” he added. “For those who are academicians, I think they’ll sit down one day and study to come to understand what really happened. PF will be a case study to ensure that we don’t repeat the mistakes that we made from 2011 to 2021.”

He continued: “Madam Speaker, I was one of the victims of the PF regime – the brutality that they caused and harm on the Zambian people. I was a victim, attacked during a by-election in Nangweshi where I had to break my bone. So, the PF should not be allowed any closer to power.”

And Mufalali said Lungu should never be allowed access to power again.

He said because of Lungu’s bad leadership, the national flag was flying at half-mast during his tenure.

“Madam Speaker, the Zambian people have decided, and have decided to have President Hakainde Hichilema as their leader. And we thank God because we have been redeemed from the claws and gnashes of the PF regime under Mr Lungu, president Lungu. That leader should never be allowed any closer to power again,” he stressed. “The Zambian flag kept on flying at half-mast throughout their 10-year rule; the flag was at half-mast. We thank God, Madam Speaker, that today we are a proud nation and we have a president who is flying the Zambian flag high in the name of President Hakainde Hichilema; very proud of him, Madam Speaker.”

Meanwhile, Mufalali noted that if President Hichilema did not stop lawlessness, people would have avenged themselves against PF members.

He said people were still deeply hurt by PF lawlessness and violence.

“…so otherwise, Madam Speaker, if the President didn’t step in to correct the situation, to bring harmony to this motherland, we were going to see a lot of trouble,” said Mufalali. “We have been hurt. We have been beaten before by the PF. And some of those people who were actually pushing for us to be beaten, to have broken legs are here. They are in this very House. And yet we do no harm to them.”

DIVISIVE POSITIONS BASED ON PAST ELECTIONS’ RESULTS BY UPND ALLIANCE A DANGER TO ZAMBIA’S DEMOCRACY.

… the 2.8 Vs 1.8 debate detrimental to our democracy as it leaves out over 13 million undecided zambians…

The on going debate and positioning themselves as the “chosen children of the land” by the UPND Alliance and it’s self proclaimed staunch supporters on social media is a detriment to Zambian democracy.

This attitude is a recipe to brewing hate and heightened political violence in the country and if not checked and curtailed by the Alliance’s leader Republican President HE Hakainde Hichilema is likely to damage Zambia’s reputation as the harb of peace and unity!

Zambia is a peaceful and United country and the current youths if not careful and take a divisive approach to politicking are likely to lead this country in a “political ditch” that they will fail to pull it out from!

We need our peace and unity if we are to progress as a country in all areas, all zambians, the 2.8, 1.8 and the over 13 million people are looking forward to President Hakainde Hichilema for one reason, he is the Republican President, period!

From which ever group you fall in, remember we only have one country, Zambia and it’s our mandate to guard it’s stability jealously as it is all we have.

Campaign time is over and unfortunately it’s time to deliver the campaign promises and the victors must deliver.

However, this will call for close monitoring and demanding for the fulfillment of the sweet promises made during campaigns.

The 2.8 must realise that the 1.8 and the over 13 million zambians are watching and waiting to see what the Alliance government has to offer but also reserve their constitutional rights, to voice out on the day to day policies of the current government.

It’s our constitutional right to demand for answers from the government of the day and must be allowed to question the Alliance on it’s campaign promises.

They Alliance must tell the Zambian electorates why they made such campaign promises such as free education and why they now backing down on it’s implementation?

Instead of insults that we are subjected on daily basis for speaking out for the 1.8 decided and the over 13 million undecided zambians, we expect the 2.8 to explain the alliance’s manifesto otherwise we are made to believe it’s all about unpalatables!

We need to listen to a more detailed policy on agriculture and tourism being the best alternatives to mining and what is it that the are doing for the mines themselves!

What is it that they are doing to protect tourism from being destroyed by mining itself in the South Luangwa National Park, were we have two economical activities conflicting themselves.
