THE CASE OF THE 9 MPS REMAINS ACTIVE IN THE LUSAKA HIGH COURT

We have noted a Constitutional Court judgment dated 15th October 2024.

This is a matter arising between a UPND Councillor, Belemu Sibanze, a Ward Councilor from Kabwe District whose seat was declared vacant following a criminal conviction Versus the Electoral Commission of Zambia (ECZ).

At the nomination stage in the subsequent by-election in the local government elections, Sibanze took a legal action, a judicial review process, challenging the ECZ’s decision to declare his seat vacant while he had appealed against his criminal case in the Kabwe High Court.

We have also noted that First Deputy Speaker of the National Assembly, Hon. Malungu Chisangano has reserved ruling on a point of order seeking to establish the fate of the nine Patriotic Front members of Parliament whose seats were allegedly declared vacant following this latest Constitutional Court Judgment.

The Deputy Speaker was responding to what we deem, an irregular and illegitimate point-of-order raised by UPND Katombora Member of Parliament, Hon. Clement Andeleki, who wanted to know the interpretation of the fate of the nine expelled PF Members of Parliament in light of the judgment.

First of all, the interpretive role of legal matters remains under the authority of the courts of law and not Parliament as it has been ruled in various decisions of the Speaker of the National Assembly. So this oint-of-order was irregular.

MATTERS REMAIN ACTIVE IN THE LUSAKA HIGH COURT

On 3rd July 2024, Second Deputy Speaker of the National Assembly, Hon. Moses Moyo declared vacant, the nine seats.

This was despite, an official letter by Hon.Miles Sampa, whose earlier instructions invoked Parliament’s action, renounced his own letter.

In a letter dated 27th June 2024, Hon. Sampa informed Parliament that he had reinstated the nine MPs following an amnesty he granted them and therefore, their expulsion was null and void.

Parliament ignored this letter with an absurd claim that the Speaker could only act upon a letter from Sampa’s Secretary General, Morgan Ngona.

Further the affected MPs contended that Deputy Speaker of the National Assembly acted illegally by declaring their seats vacant as they remained members of the Patriotic Front and were not expelled and further, contended that Mr. Moyo’s action was in contravention of Standing Order Number 57 clauses 1, 2, 3 and 4 of the National Assembly.

The MPs began a legal process against Parliament and the decision of the Second Deputy Speaker.

On July 10th, 2024, the nine (9) Members of Parliament were granted permission to commence Judicial Review against the declaration of their seats vacant by Deputy Speaker of the National Assembly, Hon. Moyo.

This judicial decision also acted as stay against any other action by Parliament or ECZ.

The nine affected MPs are; Hon. Mulenga Fube (Chilubi),Hon. Mutotwe Kafwaya (Lunte), Hon. Christopher Kang’ombe (Kamfinsa), Hon. Brian Mundubile (Mporokoso), Hon. Nixon Chilangwa (Kawambwa), Hon. Ronald Chitotela (Pambashe) and Hon. Stephen Kampyongo ((Shieangandu) are, therefore, sitting in Parliament following court orders.

They will continue to do so until matters are disposed of by the courts. The matter remains active before Lusaka High Court Judge Hon.Suzen Wanjelani.

In his pointo-of-order, Hon. Andeleki was requesting the Speaker to interpret the effects of the latest Constitutional Court judgment and its impact on the nine MPs.

It appears that Hon. Andeleki and the UPND wish to cross check such a reference and relationship between the mayter of Belemu Sibanze Vs ECZ amd the seprate case of the nine MPs.

If the UPND is serious about such an important legal question, it should be brought before the Constitutional Court and not before the Speaker of the National Assembly.

It is an established legal and tradition practice that Parliament does not interfere in matters seized by the Judiciary. Also Parliament doesnt intepret the law.

Therefore, the Point of Order emanating from Hon. Andeleki was highly irregular and must not be entertained and.must be diamissed.

The effects of the recent judgment by the Constitutional Court must be applied with the recognition that the case of the nine MPs is a totally separate case from this case and remains active before the Lusaka High Court.

The Judgement has just guided how the future vacancies must be treated and also rendering the “stay” obtained by the 9 expelled MPs otiose.

Art 72(8) of the constitution demands that where a vacancy occurs in the National Assembly, the Speaker SHALL, within seven (7) days of the occurrence of the vacancy, inform the Electoral Commission of the vacancy, in writing, and a by-election shall be held in accordance with Art 57.

When the 9 MPs were expelled, they went to the Constitutional Court, not to challenge their expulsion but the legitimacy of Expeller (Miles Sampa and team) leading to the dismissal of the case by the Constitutional Court for want of jurisdiction.

Their action was not in line with the provisions of Art 72(5) which guides an expelled MP to challenge the expulsion in court so that the court can either  confirm or not his/her expulsion. Since they did not do that, the provisions of Art 72 (5) that says “where a member of Parliament is expelled as provided in clause 2 (e) [of art 72], the member shall not lose the seat until the expulsion is confirmed by a court, *except that where the member does not challenge the expulsion in court and the period prescribed for challenge lapses, the member shall vacate the seat in the National Assembly*

This is the dilemma the 9 MPs found themselves in. They did not challenge the expulsion as per demands of Art 72(5) hence the dismissal of their case.

This meant that in line with Art 72(5), they vacated their seats and we’re vacant hence the speaker’s declaration of these seats as vacant.

Within 7 days the Speaker informed ECZ in writing of the existence of 9 vacancies in the National Assembly.

At the time ECZ was preparing to conduct the by-elections the 9 expelled MPs went obtained a stay against the decision of the Speaker pending leave for judicial review.

In the absence of the recent court judgement, the “stay” stopped the clock from ticking and 90 days in which to hold the 9 by-elections was frozen.

Armed with the recent judgement from constitutional Court, it goes without saying that the day the High Court will vacate the stay will.be the day 90 days will start ticking again.

In this regard, any future declared vacancy to which the ECZ is informed in writing by the speaker or council secretaries/town clerks will not be stopped by court “stays” or judicial reviews.

The High Court judge who stayed the conduct of elections should be reported to JCC for incompetence and gross misconduct in line with Article 144 for violating the constitution.

Therefore, the by-elections will be held immediately the judge who stayed the election lifts the stay. So the lapse of time does not arise as the judgement which has guided now was not there.

Lusaka Lawyer Celestine Mambula Mukandila has charged that the rule of law has been shrinking in the country causing tensions more especially on the political front.

And Mr Mukandila says there is nothing wrong with former Republican President Dr Edgar Chagwa Lungu in advancing conditions before approaching the proposed dialogue with President Hakainde Hichilema.

Speaking when he featured on Millennium Television’s The Pulse programme, Mr Mukandila observed that there is a serious breakdown in the rule of law in the country.

He said it is normal for the former Head of State to give conditions before meeting President Hichilema to dialogue as proposed by the Oasis Forum and the Church.

He said for example, there is nothing wrong for President Lungu to give a condition of restoring the Patriotic Front records at the Registrar of Societies to the way it was before the ‘illegal convention’ was held on October 24th, 2023.

“Dialogue in itself is a process of bringing parties together which will see parties coming with their own conditions because they want to acquire certain things. Remember we are dealing with an individual who is a former President of this country, he has occupied the Office of the Presidency before. He ruled this country for seven years. That should tell you that whatever y says is not coming from without as he has the full knowledge of running a country,” he said.

“President Lungu knows that the incumbent is capable of influencing and changing details at the Registrar of Societies to where they were before the 24th October, 2023. The people of Zambia are aware that the illegal convention by Miles Sampa had the full blessings of the State. For the first time in the history of Zambia, we were celebrating Independence with the visiting foreign Head of State, we had a political party undergoing a coup d’état which was extremely unconstitutional. And the police were at hand to guard that undemocratic procession.”

Mr Mukandila alleged that whatever has happened to the former ruling party is as a result of the State and the UPND as a political party.

He recalled that the former Registrar of Societies refused to change the details of the PF records and she was fired despite the State saying she was transferred.

“That in itself should tell you that the State had a hand in the whole thing. And that is why President Lungu is advancing that condition. President Lungu has been persecuted, his family has been persecuted as they are always in court,” he stated.

Mr Mukandila further said the country’s democracy is under serious threat.

He said the freedom fighters must be turning in their graves to see what is happening in the country at the moment.

Please believe me: my ruthless, vicious scientific critical assessment of our paper independence in 1964 does not mean I do not respect and treasure the sacrifices, determination, genuine hard work, courage, suffering, vision and dreams of freedom and independence from racist British colonialism all our freedom fighters exhibited during the struggles for our independence; I do hold in high esteem each and every one of them.

Among these gallant sons of Africa and Zambia is none other than Vernon Johnson Mwaanga. Vernon Johnson Mwaanga, born 25 June 1944, near Choma, is a qualified political scientist, international relations expert, diplomat, political negotiator, journalist, author, former cabinet minister in Kaunda and other Zambian regimes, businessman and many other things! While Vernon Johnson Mwaanga may not remember me, I will always recognise and respect his contributions to our struggles to return Zambia to multiparty politics.

How good and pleasant it would be for Vernon Mwaanga and many other independence generation Zambians still alive to be well looked after by the state and mined for their great wealth of knowledge and experience, of our beautiful country. They are not too many of them, the Vernon Mwaangas of Zambia, still alive today. We punish them with excruciating and humiliating poverty instead of treasuring them, making them available to all Zambians, and recording their memories and experiences for posterity. We are a people that insults and offends our roots: this way, we injure our present and damage our future by becoming a people who denigrates its history.

Vernon Johnson Mwaanga has every right to ventilate his views publicly, about the goings on in this country. I am ready, always, to defend his freedom of speech, even as I may disagree with his views, as is the case with his most recent opinions on the UPND, opposition parties and alternatives to the UPND government. It is a truism of journalism and life that once one’s views are published, one has offered themselves to public examination, discussion and criticism, of one’s views. Vernon Johnson Mwaanga, as a politician, writer, author and journalist is fully aware of all this, whenever he expresses himself in circumstances where he may be publicly quoted.

Vernon Mwaanga has widely been quoted as saying he expects the UPND to retain power in 2026 precisely because there is no credible alternative to the UPND government, in the opposition. It appears Mwaanga expects the Patriotic Front (PF) to be further weakened by 2026 as a number of its leaders will be jailed apparently because of overwhelming evidence implicating them in crimes. Although Zambians are “dissatisfied” with load shedding, this will pass as better rains will restore our hydropower generation capacity. Similarly, better rains may improve our food situation and our dissatisfaction with mealie meal prices will dissipate.

“People may be dissatisfied with mealie meal prices for now, the situation is bound to change between now and 2026. First of all, if we have a good season, as they are expecting, I was looking at the weather forecast made by the Washington Weather Bureau, which is the biggest weather bureau in the world, they said that Zambia is going to have a very good rainy season this year. So, at the end of the day, if we come to 2026 and people are dissatisfied with UPND, what is their alternative? Is it PF? The answer is a no,” Mwaanga is quoted as saying, by News Diggers.

First things first: it is now abundantly clear that Hakainde Hichilema and his UPND choir got into government by committing a massive electoral fraud: they lied to Zambians that they would drastically lower the cost of living and doing business. In government, they have become extremely arrogant and have rapidly driven up the cost of living and doing business. A more combative, militant and politically conscious population would long have violently booted Hakainde Hichilema and his pathetic, zealotic UPND political choir out of government. Vernon Johnson Mwaanga must surely know this?

Besides the extremely high cost of mealie meal and electricity, everything else that matters to sustain life in Zambia has shot up, since the UPND got into government. Vernon Mwaanga knows this, and surely must understand, as a political scientist, that the legitimacy of the UPND government has been eroded by their pathological numerous lies? Ironically, Mwaanga is encouraging the UPND government to “stick to their agenda”!

“So, just stick to this agenda which you have because that agenda is beginning to produce results especially after this debt restructuring which was a major problem. The people will know what to do. For me, I don’t care whether Edgar Lungu, whether the courts decide that he should stand, the voters will know how to deal with him. So, just stick to your programmes. Carry on working, work hard and produce results which is what people are looking for and at the end of it all, they will not be interested in the noise which is coming from other parties. They are looking at… and you will be able to say this is what we have done since we came into office. The list is growing and that’s what matters in politics, the results.”

This is dangerous nonsense to the extreme, coming from Vernon Mwaanga’s mouth! Hakainde Hichilema and the UPND are raping and ripping apart the very foundations of Zambia, its Constitution, courts, Executive and Legislature, and all state institutions, in their ruthless efforts to cling to power. And Vernon Johnson Mwaanga does not “care whether Edgar Lungu, whether the courts decide that he should stand, the voters will know how to deal with him.”

Holy Mother of Jesus! Was this man truly with us when we fought to restore our full political rights during our struggles for multiparty democracy? Why is Mwaanga ripping apart his proud reputation as a fighter for democracy and multipartyism? It matters terribly, absolutely, existentially, what the courts will say about Edgar Chagwa Lungu’s eligibility to stand in the 2026 elections and beyond. At this point in time, this is a definitive moment for our judiciary: it either affirms its relevance in our country or forfeits its right to exist, as it is.

Hichilema and the UPND promised to be far more superior to the Patriotic Front in developing and advancing our freedoms, Constitution and democracy. As in all things, in this too Hakainde Hichilema and the UPND lied, and are therefore an imposter and illegitimate government surviving in government because Zambians are a very tolerant people, and extremely peaceful people. Why is Vernon Johnson Mwaanga not encouraging Zambians to rectify the humongous political mistake they made on August the 12th, 2021, by electing political frauds, cheats, into government? The truth and principles matter, all the time, especially for political veterans.

There is something chillingly cold and sadistic in these opinions, expressed by an individual who participated in our struggle for independence, early independence government, and above all, in our gruelling long struggles against the one party state and for multipartyism, for “alternatives” in government. No freedom fighter, genuine liberator, can tell a suffering people such as Zambians have been reduced to, today, that they have no alternative to their suffering than to retain in government their tormentors, precisely because “they have no alternatives”! This is a profound moral, philosophical, ideological and political repudiation of everything a true liberator believes in: absolute trust and faith in the people to be their own true liberators, and to always sort out their tormentors. For genuine freedom fighters, the people always have alternatives to suffering, injustice, autocracy, dictatorship and the inevitable lies, corruption and all forms of oppression and exploitation.

Tellingly, Vernon Mwaanga says this, about the Socialist Party (SP), quoted in the same newspaper: “Is it Socialist Party? No. They (Zambians) had enough of socialism under UNIP and it brought misery. So, what is the alternative? There is no alternative at the moment. There’s no alternative, so, you colleagues who are in government, just work hard and produce results because come 2026, I expect this government to get back into power because there is no credible alternative available”. Mwaanga was speaking when Minister of Water Development Collins Nzovu apparently paid “a courtesy call” on him at his residence. Mwaanga told Nzovu that even if people were dissatisfied with the UPND in 2026, “there was no credible alternative to elect into power.”

Now, Vernon Johnson Mwaanga understands and knows that there are many kinds of socialism: he is a political scientist, educated thus, in the UK. Vernon Mwaanga must find time and educate himself on the fundamental differences between Kaunda and UNIP’s “socialism” and the “socialism” of the Socialist Party. His reckless and mindless dismissal of the SP reeks of opportunism, ingratiating and a fawning attitude to the governing party, with a view to carelessly undermine the SP. Again, in a country saturated with right-wing and all kinds of capitalist political parties, why is Vernon Mwaanga trashing one of the extremely few, openly socialist alternatives to all the capitalist parties on offer to Zambians? I am shocked at the mindlessness with which Mwaanga has rubbished perhaps the only real ideological alternative to the UPND and all other political parties Zambians have: the SP.

“You look at the opposition parties which are there, which one? PF, they have not even had the elections to elect the president. You know how many past presidential candidates there were? Nine. After the elections, the party split even more. So, you just have to stick to the lane where you are, continue giving solutions. People are interested in giving solutions. They are not interested in the noise which is coming from UKA or whatever they call themselves. One day this is the secretary general, they wake up the next day, you find there is another. Following day, these ones have split from UKA, they’ve gone,” Mwaanga told Nzovu.

Mwaanga, it has been reported, “encouraged the UPND government to stick to its developmental agenda, adding that people were not interested in hearing the noise which was coming from the United Kwacha Alliance (UKA),” News Diggers has reported.

Of course the US and its Western allies and institutions such as the World Bank and the International Monetary Fund will support Hichilema as he is their very willing puppet. The extreme and punitive austerity they have unleashed upon Zambians to ensure they can collect their enslaving debt and loot and plunder our natural resources is the programme Mwaanga is encouraging Hakainde and his UPND not to abandon: how patriotic and anti-imperialist! Zambians have a responsibility to themselves: to sort out their tormentors, oppressors and exploiters, whoever their supporters are, including political veterans like Mwaanga!

Our minister Haimbe, kindly reply to M’membe over Zambia’s alleged support for Morocco’s occupation of Western Sahara

I suggest that our able foreign affairs minister Mulambo Haimbe fully replies to opposition leader comrade Fred M’membe’s allegation that Zambia is supporting Morocco’s ‘invasion’ of Western Sahara just because President Hakainde Hichilema (HH) is an American puppet (Zambian Observer, 2 June, 2023).

I already showed in my last two Monday articles that HH is not a Western puppet. My point today is that our foreign ministry must explain more about reasons behind our foreign policy positions. First, any president accused of being a puppet risks being a target of armed rebels like those that have taken over Western Africa in Mali, Burkina Faso and Niger who hide their irresponsible behaviour in the name of removing puppets. Western Sahara is near that region, and also seeks support. Let us remember that the current Zambia-Zimbabwe diplomatic rift is also coming from Zimbabwe’s ruling ZANU-PF lie that HH is a Western puppet, as evidenced when its President Emerson Mnagagwa told Russian President Vladimir Putin.

Second, our foreign ministry’s explanations will help Zambian diplomats to take clear positions at international fora. Third, it helps us, pro-UPND writers, to elaborate government positions without risking contradicting our own government. As party members we are bound by collective responsibility. And collective responsibility requires that every member has detailed reasons justifying the agreed upon position, so that every member can defend and coherently elaborate that collectively agreed upon position.

So far, our diplomats and we writers have faced problems on how to defend Zambia’s diplomatic positions. In March 2022, Zambia joined the majority vote in the United Nations General Assembly (UNGA) to ‘reprimand’ Russia for invading Ukraine. I supported this in my two articles entitled, ‘Zwa mu Ukraine Putin, Nanga NATO niya anyoko’ (The Mast, part one on 18th April 2022 and part two on 25 April 2022). Only to be discouraged later when the then foreign affairs minister Stanley Kakubo said, ‘we are not against Russia. We are only against the war’. I wondered, ‘Umm, boss! If you are a judge, are you going to jail the stealing but not the thief? Let us make pragmatic statements! If a world war breaks out, Zambian soldiers will have to be ordered by our commanders to shoot at either the Russian or Ukrainian enemy. They won’t be ordered to shoot the war!’

Another case. In July-August 2023, President HH was invited by, and met Israeli President Isaac Herzog and Prime Minister Benjamin Netanyahu. President HH does not like meddling in international disputes. So, he mainly appreciated Zambia’s religious heritage from Israel and potential agro-tech mutual benefits. But the escalating Israeli-Palestinian war, with the US increasing its military aid to Israeli, puts Zambia in a dilemma. In late September 2024, many UNGA delegates walked out in protest against Netanyahu’s address.

Dear reader of this article, suppose you were Zambia’s representative in the UNGA that day? If you walked out, how would you have known whether President HH would be displeased that you are messing the good relationship established with Netanyahu during his visit? If you stayed, how would you know that he would be displeased that you have abandoned the UNGA members with whom Zambia voted against Russia?

Western Sahrawis are indigenous. Their ancestor never created centralised government because of conquests and a nomadic lifestyle. Because of this, some are in Morocco while some Moroccan tribes are in Western Sahara. Spain claimed their territory at the Berlin Conference in 1884, and began ruling it as a protectorate in 1912 while France claimed Morocco, making it its protectorate. In 1956, both Spain and France began the process of leaving these ‘protectorates’. So, the Organisation of African Unity (OAU) (now African Union) admitted Western Sahara as an independent nation. But Morocco annexed it in 1975 and left the OAU. Morocco also rejected the International Court of Justice (ICJ) ruling against its occupation of Western Sahara.

Then the conflict went global. During the border war between Morocco and Algeria, Algeria was receiving Russian support while Morocco received American support. Inspired by Algerians’ war-victory against French colonialism with the help of Russia, Western Sahrawis also mobilised to fight off the Moroccans. The 1991 UN-brokered ceasefire promised a referendum for Western Sahara. But Morocco is frustrating this referendum.

Meanwhile, because America needs Arab support in its support for Israel, it persuades Morocco to also support Israel. Morocco is even getting natural gas from Western Sahara and selling it to Isreal.

The wide reader comrade M’membe is aware of all this. This is what he interprets as President HH being an American puppet. He thinks US is recruiting HH to support Morocco in fighting both Palestine and Russia.

But international matters are complex. So, we as Zambians must debate them thoroughly within our parties before we form governments. Even comrade M’membe himself has problems remaining consistent. For instance, he supports Russia’s invasion of Ukraine to ‘prevent an armed hostile neighbour’. Yet, he opposes Isreal’s invasion of Palestine for the same security reasons. He supports the independence of Western Sahara, yet he rejects the independence of Barotseland.

Even Kenneth Kaunda did not consistently follow his non-alignment. He agreed with OAU ban on secessions, yet he and Tanzania’s Julius Nyerere supported the 1966 secession of Biafra from Nigeria. My fellow Mast columnist Professor Hamalengwa, did you not tell us in your book, ‘Thoughts Are Free’ that it took you as UNZA students to force Kaunda to stop supporting American-backed UNITA Rebels in Angola so that he supports Russian-backed MPLA?

So, minister Haimbe, Zambia has the right to take any diplomatic position, even against the OAU/AU and ICJ in the case of Western Sahara. What we need are detailed reasons so that we rally behind you without Zambia being accused of merely obeying American orders.

THE Economic and Financial Crimes Court has heard that former High Court judge Wilfred Muma breached procedure when he wrote to the Zambia Army commander asking him to surrender title for the land in Chikoleka forest, in woodlands area which he issued to the Patriotic Front.

A commissioner of lands yesterday narrated that the Patriotic Front was issued 6.0352 hectares of land for a period of 99 years, as a medium residential plot yet such a huge chunk of land can only be issued for a small holding or commercial property.

In this matter, the former adjudicator is facing two counts of wilful failure to comply with the law and applicable procedure relating to the allocation and disposal of public property, and abuse of authority of office.

Muma is alleged to have grabbed land from the Zambia Army which is a portion of Chikoleka Forest, on Chitukuko road in Woodlands area and issued it to the Patriotic Front in 2018 when he served as Commissioner of Lands.

Lynn Habanji, in her testimony before judges Pixie Yangailo, Ann Ononuju and Mwanajiti Mabbolobbolo said the Ministry of Finance which was the title holder of the land in Chikoleka Forest on behalf of the Zambia Army, was kept in the dark about the request to surrender and cancellation of the tittle.

“They indicated that the request for cancellation of the certificate of title should have been deposited with them in their repository,”she said.

Habanji said instructions from the President to repossess tittle should be put in writing.

She said the land was leased to the ministry of Finance on behalf of the Zambia Army by former President Edgar Lungu in May 2016 for 99 years, and was registered on May 30.

Hibanje narrated that the Army was asked to expire the lease and certificate of title pursuant to Section 94(f) of the lands Act.

She said the land was later leased by the President then to Linus Eya and three others, suing as a firm and Nickson Chilangwa who sued as acting secretary general of the PF for 99 years.

Habanji said the land whose size was 6.0352 hectares was supposed be issued to the registered trustees of the Patriotic Front.

“It was not supposed to be like this because, the lease between Linus Eya and three others suing as a firm and Nickson Chilangwa as acting secretary general of PF, were are not eligible to own land, as they are not a body corporate eligible to own land,” Habanji said.

“Entry no. 5CT_4867 in term of title holder is referring to Linus Eya and three others and Nickson Chilangwa in his capacity as SG under normal circumstances it was supposed to show PF trustees are registered owners.”

The commissioner said while there was a land register referring to Eya and three others, There was another land register which was showing the tittle holder as PF registered trustees and showed the President then, as the leaser and leassee as PF registered trustees.

“At entry number 6, there’s a caveat registered on November 4, 2021 registered on the same day. The caveator in this place was ECB legal practitioners on behalf of Chazya  Chileshe Associates limited claiming an interest fee for remuneration and project consultancy rendered,” Habanji said.

“There was a court judgement giving the sale of the property from PF to Allianz investment limited thought, the name shows Linus EYA. On entry no. 8 the property was sold from Allianz Investment to PF at K8. 851 million and the date of assignment of registration is March 3, 2022.”

She disclosed that the offer letter for the land given to PF was issued as medium residential.

“When it comes to the size, the standard size for a medium residential property is around 30×20, 30×30 meters these are residential medium sized properties which we find in Chalala,” Habanji said.

“It is unusual for medium residential properties to be sized in 6.0352 hectares. That’s the size of a small holding or commercial property. Medium cost residential properties would be in the range of K4000 and a commercial property of this size would be in the range of over K500,000 as consideration fees.”

She explained that the procedure used to have the army let go of its land was wrong.

“With regard to procedure, requesting the Army Commander to surrender land was flawed, the letter should have been written to the minister of finance who was the title holder,” said Habanji.

“The offer letter to the PF registered trustees under the use, instead of being zoned as medium residential, it should have been zoned as commercial considering the fact that the application was with regard to building an office block for the party. There should have been an application to change the use of land from government to the intended use.”

During cross examination by Muma’s lawyer James Mataliro, the commissioner said she was not working at the ministry of lands in 2018.

She confirmed that she can’t speak to the issue that transpired in real time.

Asked if she was aware that the Zambia Army commander requested for a meeting regarding the cancellation of the tittle, Habanji responded in the negative.

She also confirmed that the Zambia Army applied for the lease of the land and not ministry of finance.

The matter comes up on November 11 for continued cross examination.

SEOUL, Korea, Wednesday 16th October, 2024 – Former Secretary General of the United Nations His Excellency Mr. Ban Ki Moon has commended the Government of His Excellency Mr. Hakainde Hichilema, President of the Republic of Zambia, for the commitment to green growth initiatives.
Mr. Ban, who is the President and Chair of the Global Green Growth Institute (GGGI), praised Zambia during a meeting with Minister of Green Economy and Environment Hon. Mike Elton Mposha at the Global Green Growth Week 2024 in Seoul, Korea.


Mr. Ban expressed gratitude for Zambia becoming the 46th member of the GGGI.
Mr. Ban commended Hon. Mposha for highlighting Zambia’s green growth initiatives and the interests of the African continent during ministerial panel discussions.


Hon. Mposha informed Mr. Ban that under the leadership of President Hichilema, Zambia is committed to combat climate change.


The Minister further briefed Mr. Ban about the severe impact of climate change-induced drought in Zambia.
Earlier during a bilateral meeting, GGGI Director-General Dr. Frank Rijsberman also praised Zambia for its legal frameworks and policies that enhance resilience to climate change.


Dr. Rijsberman assured Zambia of GGGI’s continued support.
Hon. Mposha told Dr. Rijsberman that Zambia was thankful to GGGI for its financial and technical support, which has been crucial in advancing Zambia’s green growth initiatives.


“This year, GGGI supported the Ministry of Green Economy and Environment in developing its
Green Growth Strategy, which was launched in April 2024; GGGI assists the Government
through Supporting Preparedness for Article 6 Cooperation (SPARC6) programme on carbon
market readiness and provides technical assistance in preparing bilateral agreements,” Hon.
Mposha said. “We are scheduled to sign agreements with Sweden and Norway at the 29th
Conference of the Parties to the UN Framework Convention on Climate Change (COP29) in
Baku, Azerbaijan.”


The Minister said Zambia aims to increase engagement in the “Africa and Middle East Safe” initiative, focusing on climate-resilient agriculture and food security.


Hon. Mposha highlighted ongoing efforts with the Green Climate Fund (GCF) and emphasised Zambia’s commitment to deepening cooperation with GGGI and international partners.


Hon. Mposha also briefed the GGGI Director-General on Zambia’s worst drought in decades, affecting over six million people. He explained that President Hichilema declared the drought a national disaster and emergency in February this year. Additionally, he said the drought has led to hydropower supply challenges, considering that over 80 per cent of Zambia’s power is generated from hydropower.


The Minister said despite these challenges, Zambia is keen to accelerate green interventions in energy and agriculture, and reduce deforestation.


The GGGI, a treaty-based international organisation formed in 2012, is dedicated to promoting sustainable economic growth in developing countries and emerging economies. It has 48-member countries and is headquartered in Seoul, Korea. Zambia joined GGGI in 2023.

The Zambia Police Service has revealed that during the third quarter of 2024, a total of 8,970 road traffic accidents were recorded compared to 9,888 in 2023.

The Service says of these, 469 were fatal accidents, resulting in 550 deaths.

Zambia Police Service Spokesperson Rae Hamoonga says a further 879 serious injury accidents were reported, leaving 1,412 individuals seriously injured, while 1,974 slight injury accidents resulted in 2,597 minor injuries.

Mr Hamoonga added that 5,648 accidents were classified as damage-only, causing property damage but no injuries.

“The majority of road traffic accidents occurred along the line of rail provinces.

  • Lusaka Province recorded the highest number with 4,714 accidents (52.6%).
  • Copperbelt Province followed with 1,155 accidents (12.3%).
  • Central Province registered 835 accidents (9.3%).
  • Southern Province accounted for 556 accidents (6.2%),” he disclosed.

“The remaining provinces recorded the following:
o North-Western: 459 accidents (5.1%)
o Muchinga: 300 accidents (3.3%)
o Eastern: 288 accidents (3.2%)
o Luapula: 287 accidents (3.1%)
o Northern: 205 accidents (2.9%)
o Western: 171 accidents (1.9%).”

In terms of monthly distribution, Mr Hamoonga said the highest number of accidents was recorded in July with 3,092 accidents, followed by August with 3,023 and September, with the lowest at 2,855 accidents.

“The total number of road traffic accidents decreased from 9,888 in 2023 to 8,970 in 2024, reflecting a reduction of 918 accidents. However, while fatal accidents increased by 9, from 460 in 2023 to 469 in 2024, the number of fatalities decreased from 581 to 550, a reduction of 31 lives lost,” the ZP Spokesperson said.

“Similarly, serious injury accidents decreased from 941 in 2023 to 879 this year, with the number of seriously injured persons dropping from 1,791 to 1,412—a reduction of 379 casualties. In contrast, slight injury accidents rose from 1,930 to 1,974, although the number of minor injuries decreased from 2,758 to 2,597. Damage-only accidents also saw a notable decline, falling from 6,557 in 2023 to 5,648 in 2024—a reduction of 909 accidents.”

Mr Hamoonga further said out of the 4,559 casualties recorded in the third quarter of 2024, 375 were children under the age of sixteen.

He stated that tragically, 62 children lost their lives, while 108 sustained serious injuries and 205 suffered minor injuries.

“The most vulnerable groups in these accidents were:

  • Pedestrians
  • Motor vehicle passengers
  • Drivers
  • Motorcycle drivers and passengers
  • Cyclists and cycle passengers
    Road and Driver Analysis. Most accidents occurred on highways (3,535), followed by streets (1,539), other roads (1,357), avenues (1,210), closes (756), and crescents (73).
    The section recorded 12,071 licensed drivers, while 1,260 drivers were found to be unlicensed,” he indicated.

“Among these, 10,477 were male drivers, and 2,846 were female drivers. Hit-and-run incidents remain a concern, with 45 fatal accidents, 91 serious injury accidents, 117 slight injury accidents, and 274 damage-only accidents recorded under this category.”

Meanwhile, Mr Hamoonga further disclosed that a total of K18,241,710 was collected as admission of guilt fees during the third quarter of 2024, compared to K11,625,496 collected in the same period in 2023, representing an increase of K6,616,214.

Disgraced music mogul, Diddy has been accused of raping a woman as ‘payback’ for claiming he ordered Tupac Shakur’s murder.

Ashley Parham is suing Sean ‘Diddy’ Combs for the alleged rape she claimed happened in 2018 after she accused him of the infamous murder over FaceTime.

Ashley alleged that Diddy sexually assaulted a woman with a TV remote after she accused him of ordering Tupac’s death before he then gang-raped her with his friends.

Rapper Tupac Shakur was gunned down in his car in Las Vegas on September 7, 1996, in an assassination that was never officially solved.

Diddy, whose Bad Boy Records was in a feud with rival Death Row Records at the time, was widely rumored to be involved.

The $50million lawsuit, filed in the District Court of Northern California and obtained by DailyMail.com, claimed she met Shane Pearce, a friend of Diddy’s, at a bar in February 2018.

Pearce called Diddy, who was at a gathering with family, on FaceTime, and showed people at the bar ‘attempting to impress the people with his famous friend’.

Parham claimed she told Diddy she believed he was involved in Tupac’s murder, and Diddy told her she would ‘pay’ for her accusation.

The lawsuit claimed Pearce invited her to his home in Orinda, near Oakland, about a month later on March 23, 2018, asking for help with his cancer drugs ‘because he stated he was weak and unable to open his medications’.

But not long after she arrived, Diddy was there allegedly waiting to take revenge.

She claimed he told her ‘she thought she would never see him in person’ and held a knife to her face, threatening to cut her cheeks into a ‘Glasgow smile’.

Parham claimed she was saved from this grisly fate by Diddy’s longtime assistant Kristina Khorram, who told him not to as they could sell Parham for sex.

The lawsuit claimed Khorram threatened to ship her overseas, never to be heard from again.

Diddy then ripped off her clothes and covered her body in an ‘oil or lubricant’ and violently shoved the TV remote into her vagina, the lawsuit claimed.

‘Diddy, while violently raping [Parham] with a television remote, told Plaintiff that her life was in his hands and that if he wanted he could “take her” and she would never be seen again,’ the lawsuit claimed.

After raping her with the TV remote and threatening her life, the lawsuit claimed Diddy told Pearce to turn her on her stomach ‘seemingly tired of hearing the Plaintiff’s blood-curdling cries’.

After her ordeal, Parham claimed she was eventually recovered enough to get up, cover herself in a shirt, grab a knife, and go to escape.

However, Diddy was in her away, and said he was surprised she was up and about because he gave her ‘enough drugs to take out a horse’.

Parham claimed Diddy told her it was ‘so much fun’ partying with her, but when she told him it was rape, he offered her money to say the sex was consensual.

When she refused and said she would report him to police, the lawsuit claimed Diddy told her no one would believe her, and threatened her family.

One of his friends then showed her what appeared to be a livestream of the front of her sister’s house, the lawsuit claimed.

Parham claimed Diddy them called his mother Janice Combs to convince her to drop the whole thing, demanding she not ‘hurt her son’ and dismissing her claims of rape.

Diddy told her he got away with worse crimes, referring to Tupac’s murder, but this upset one of the other men with him, who drew a gun.

The man pointed the gun at Diddy, demanding he repeat what he said about Tupac’s murder, until Parham tried to grab the gun and it went off.

The lawsuit claimed Diddy fled and Parham chased after him with a knife and he begged for his life when she caught up to him.

Parham ‘raised the knife, in a rage from the events that just transpired and with the intent of driving the knife into Diddy’s back’ before he turned and begged.

Instead of stabbing him, she ran for the door, but claimed Diddy again blocked her path and she sliced at his abdomen as she escaped.

Parham claimed she ran to neighbors for help, as Diddy’s car sped away from the house.

The lawsuit claimed she told a deputy from the Contra Costa Sheriff’s Office, who responded to the 911 call, that she was ‘violently gang raped’ by Diddy and his friends.

She claimed the deputy told her several neighbors called in noise complaints and to ‘find a way to get home’.

He ‘did not offer to take [Parham] home, nor did he call for emergency services including an ambulance, nor any offer to take [her] to the hospital, nor any offer to help [her] recover her clothes or effects’,’ the lawsuit claimed.

Parham went to the doctor three days later, but didn’t go to hospital until three weeks after that because her injuries were still painful.

Hospital staff administered a rape kit after she told them what happened, and called the local Walnut Creek Police.

But when it was time to give a statement to she was too scared to tell them it was Diddy who allegedly raped her because she didn’t think they would help.

Instead, she left his name out of the report ‘because she believed she would be ignored… and/or would be further harmed by defendant Diddy if he discovered she named him to police’.

Parham claimed she also reported the crime to the Orinda Police Department, ‘but again was too afraid to name Defendant Diddy as one of her assailants’.

The lawsuit claimed none of the police she made a report to opened an investigation.

Parham is suing for sexual assault and battery, abuse, false imprisonment and kidnapping, demanding a trial by jury.

Music producer Dr. Dre and his close pal, Snoop Dogg, have introduced a new alcoholic beverage brand.

The product called Still G.I.N. By Dre and Snoop was announced on Monday, October 15, and is described as the first item by the two businessmen to enter the “pure premium-spirit” market.

It is said to follow the success of the Gin & Juice canned cocktail previously announced by the hip-hop stars. A release tagged the new alcohol brand as “modern and elegant.”

NDOLA DEPUTY MAYOR GIVES MAYOR 7-DAY ULTIMATUM TO APOLOGIZE OVER DEMOLITION OF MOBILE MONEY BOOTHS

Ndola Deputy Mayor Luckson Chisenga has given Ndola Mayor Jones Kalyati a 7-day ultimatum to apologize to the residents of Ndola for claiming he was not aware of the council’s decision to demolish the booths in the CBD.


Speaking at a press briefing held at Ndola District UPND secretariat today, Mr. Chisenga said Mr. Kalyati should apologize to the residents for misleading them, as he is fully aware of the decision and chaired the meeting, as an ex-official, which was held on 31st December, 2023, in the council chamber at Civic Center.

Meanwhile, in a video posted on his Facebook page, Ndola Mayor Jones Kalyati claimed that he was not aware of the council’s decision to demolish the mobile money booths in the CBD of Ndola.

Mr. Chisenga maintained his stance that the meeting resolved that the mobile money booths, especially those that were non-operational, needed to be removed from the CBD in order to enhance sanity in the city, but that tables and umbrellas could be used by mobile money operators.

Mr. Chisenga, however, emphasized that if the mayor does not apologize, punitive measures will be taken and disciplinary actions will be undertaken.

And speaking at the same event, United Party for National Development (UPND) Ndola District Chairperson Onesmus Mudenda said the party is very disappointed with the manner in which the council demolished the mobile money booths, adding that the local authority should have engaged the operators.

Mr. Mudenda implored the council to always engage the people and find the right solutions, further calling on the need to compensate the affected operators.

Meanwhile, UPND-Ndola District Secretary Mubita Ikashakala has accused the mayor of being behind the breaking of the mobile money booths in the CBD, further urging him to stop taking politics into the council, which he says is interrupting the progress of government programs in the city.

Ukraine denies supplying drones to Mali rebels

Ukraine has denied allegations that it had supplied drones to rebels fighting against the Malian army and Russia-backed mercenaries.

It comes after Paris-based Le Monde newspaper reported reported that Ukrainian drones were providing support for the Tuareg rebels “who are benefiting from discreet but decisive support from Kyiv”.

Mali ‘s junta-led government ended a long-running alliance with former colonial power France in 2022 in favour of Russia in a bid to tackle a years-long insurgency in the north.

But it has been unable to quell the unrest and recently suffered heavy losses, alongside its Russian allies.

Mali and its neighbours Niger and Burkina Faso, where the military is also in charge, have since accused Kyiv of supporting terrorism in the Sahel after a Ukrainian official said earlier this year that the country had offered support to the rebels.

But on Monday, Ukraine’s foreign ministry said in a statement that the country “strongly rejects the accusations that have recently been released by the international media outlets about the alleged involvement of our state in the supply of UAVs [unmanned aerial vehicles] to the rebels in Mali”.

It also denied allegations by Malian and Nigerien officials that Ukraine was arming, providing information and giving “support to the terrorist coalition”.

It called for an end to “spreading of the false information that repeats the fake narratives of the aggressor state Russia’s propaganda”.

In late July, at least 84 Russia-backed fighters and 47 Malian soldiers were reportedly killed following days of clashes with Tuareg separatist rebels and fighters linked to al-Qaeda at Tinzaouten, in northern Mali.

It was seen as the heaviest-ever African defeat for the Wagner mercenary group, which has since been renamed Corps Africa.

A spokesman for Kyiv’s military intelligence service, Andriy Yusov, then said that the rebels in Mali had “received necessary information” to successfully carry out the attack.

Le Monde newspaper reports that since Yusov’s statement, the Mali rebel commanders “have been forced to reluctantly acknowledge a co-operation they would have preferred to keep secret”.

The paper says that the rebels have admitted having “links” with Kyiv, although “they were not forthcoming about the provenance of their drones”.

Mali cut diplomatic relations with Ukraine in August, in the wake of Yusov’s remarks, with a top official accusing Ukraine of violating the country’s sovereignty.

Russia invaded Ukraine in 2022 and has been waging a devastating war since then.

Facing isolation by Western countries because of the war, it has been seeking to gain influence in Africa by establishing political and security links, including in Mali.

The 2024 BET Hip Hop Awards

The BET Hip-Hop Awards, which celebrates black excellence in music, culture, and sports, were distributed on October 8 at Drai’s Beachclub & Nightclub in Las Vegas. However, the ceremony was not telecast live on any cable network; instead, it aired as a taped event on BET and VH1 on Tuesday, October 15.

Diddy lawyers have filed a motion requesting the identities of the music mogul’s accusers

Sean “Diddy” Combs’ lawyers have filed a motion, requesting the identities of the music mogul’s accusers in his sex trafficking case.

In a letter to a Manhattan federal court judge, Combs’ legal team argued that he needs to know the names of the alleged victims so he can sufficiently prepare for his May 5, 2025, trial.

“This case is unique, in part because of the number of individuals levying allegations against Mr Combs due to his celebrity status, wealth, and the publicity of his previously settled lawsuit and the grand jury leaks and false inflammatory statements by the DHS agents, as outlined in our previous motion,” the letter signed by Combs’ lawyers Marc Agnifilo and Teny Geragos, and shared with Variety, reads.

“This has had a pervasive ripple effect, resulting in a torrent of allegations by unidentified complainants, spanning from the false to outright absurd.”

The motion seemingly refers to the Nov. 16, 2023, lawsuit filed by Combs’ ex-girlfriend, singer Cassie Ventura, accusing him of physical abuse, rape and sex trafficking. Although the lawsuit was settled the following day, it triggered a wave of legal action against Combs from women and men he allegedly assaulted.

Combs’ lawyers also note the six additional sexual assault lawsuits that were filed on Monday by anonymous accusers.

“Counsel for these accusers recently convened a press conference at which he claimed to represent 120 accusers making outrageous and deeply prejudicial allegations, including violent sexual assault and sexual abuse of minors,” Combs’ lawyers said in Tuesday’s letter.

“This publicity stunt, broadcast on Instagram, included a ‘1-800’ number that reportedly received 12,000 calls in the first 24 hours.”

The lawyers continued: “These accusations came on the heels of more than a dozen lawsuits previously filed and currently pending, several of which have already been discredited but only after irreparably damaging Mr Combs’ character and reputation. These swirling allegations have created a hysterical media circus that, if left unchecked, will irreparably deprive Mr. Combs of a fair trial, if they haven’t already.”

Combs, who was arrested by Homeland Security in Manhattan on Sept. 16, is facing federal criminal charges of sex trafficking and racketeering.

He is currently incarcerated at the Metropolitan Detention Center in Brooklyn, N.Y.

Fuel scarcity hits Malawi: Transporters reveal forex woes as root cause

Malawi is grappling with a severe fuel scarcity, leaving many citizens stranded and concerned.

The Transporters Association of Malawi (TAM) has shed light on the underlying issue, pointing to a crippling foreign exchange shortage that’s hindering fuel importers from paying their suppliers.

According to TAM Spokesperson Frank Banda, the country’s fuel importers, Petroleum Importers Limited (PIL) and National Oil Company of Malawi (NOCMA), are struggling to settle outstanding payments with their suppliers due to the unavailability of foreign exchange.

This has resulted in a logjam at ports in Beira, Mozambique, and Dar es Salaam, Tanzania, where Malawian trucks await fuel cargo.

“Our trucks are currently at the ports, but they’re delayed because of the outstanding payment issues between fuel importers and suppliers,” Banda explained. “It’s crucial for the government, through the Malawi Energy Regulatory Authority (MERA), to understand the logistical requirements for fuel importation and avoid spreading misinformation.”

MERA Public Relations Officer Fitina Khonje attributed the fuel scarcity to delays in accessing foreign currency by transporters.

However, TAM’s revelation suggests a more profound issue, underscoring the need for urgent intervention.

Malawi’s forex woes have been exacerbated by the country’s reliance on imports, a dwindling export base, and dwindling donor support.

The scarcity has far-reaching implications, affecting not only the transport sector but also businesses, industries, and households.

Economist Dr. George Lazaro warned, “The forex shortage is a ticking time bomb. If left unaddressed, it will paralyze the economy, fueling inflation, and exacerbating poverty.”

The government has been urged to expedite measures to stabilize the forex market, including diversifying export channels, promoting local production, and improving revenue collection.

The fuel scarcity has sent shockwaves across various sectors, with taxi and bus operators struggling to maintain services, farmers facing challenges in transporting produce to markets, manufacturing and production slowing due to fuel shortages, and ambulances and medical services being compromised.

Economic experts emphasize the need for a multifaceted approach to address Malawi’s forex challenges, including promoting non-traditional exports, encouraging local manufacturing, improving tax collection and revenue management, and establishing efficient forex management systems.

The government has assured citizens that measures are being taken to address the forex shortage.

MERA has initiated emergency fuel imports, while the Reserve Bank of Malawi has pledged to increase forex allocation for fuel importers.

As Malawi navigates this economic challenge, transparency, coordination, and swift action are essential.

The government must work closely with stakeholders to stabilize the forex market, ensure fuel availability, and safeguard the country’s economic future.

Addressing the forex shortage requires a concerted effort from the government, private sector, and citizens.

Only through collective action can Malawi mitigate the effects of this crisis and pave the way for sustainable economic growth.

British photojournalist, Paul Lowe ‘st@bbed to de@th by his son’ while hiking

An award-winning British photojournalist was allegedly m*rdered by his son at a popular hiking trail in California.

Paul Lowe, 60, who covered conflicts including the siege of Sarajevo during the Bosnian war, was found de@d on October 12 in the San Gabriel Mountains.

He had been st@bbed in the neck, records at the County of Los Angeles Medical Examiner show.

Mr Lowe’s 19-year-old son Emir has been charged with one count of m*rder and is set to make his first court appearance on Wednesday, October 16, at the West Covina Courthouse.

The Los Angeles County Sheriff’s Department said: “The homicide bureau presented the case to the Los Angeles County District Attorney’s Office for filing considerations today.

“The District Attorney’s office filed one count of murder on suspect Emir Lowe for the murder of his father Christian Paul Lowe.

“There is no additional information at this time.”

The alleged attack happened at around 3.28pm on Mount Baldy Road, near Stoddard Canyon Falls.

A statement from the sheriff’s department said officers responding to an assault with a deadly weapon call found a “white male adult suffering trauma to his upper torso”.

It added: “San Bernardino Fire Department personnel responded and pronounced the victim dead at the scene.

“A white male adult was seen driving away from the scene and was subsequently involved in a solo traffic collision a few miles away. The male was detained pending further investigation.

“The investigation is ongoing and there is no additional information at this time.”

King’s College London, where Mr Lowe was a visiting professor in war studies, said the award-winning photojournalist would be “deeply missed”.

A statement posted on X, formerly Twitter, read: “It is with deep sadness that we received the news of Professor Paul Lowe’s passing.

“Paul was a Visiting Professor in the Department of War Studies, a Professor of Photojournalism at the University of the Arts London, and an award-winning photojournalist with VII Academy. A friend, colleague and collaborator whose work had a huge impact in shining a spotlight on the Siege of Sarajevo and addressing its legacy, we were privileged to work with him on several projects related to art and reconciliation.

“His boundless energy, warmth, creativity, initiative and enthusiasm were contagious and uniquely inspiring. He will be deeply missed.

“We send our deepest condolences to his family at this difficult time.”

Kenyan deputy president’s impeachment trial begins

Kenya’s parliament has begun the final step to remove Deputy President Rigathi Gachagua from office.

An overwhelming majority voted in the National Assembly last week to approve his impeachment, setting the stage for the two-day trial in the Senate that decides whether or not to oust him.

The deputy president faces 11 charges including corruption, inciting ethnic divisions and undermining government – all of which he denies.

The row follows his recent fallout with President William Ruto, who has remained silent about the matter.

Gachagua’s trial is being conducted before the full house of the Senate after it abandoned a process to set up an 11-member committee to investigate the charges.

The deputy president stood before the chamber for the charges to be read out to him as proceedings got under way – pleading not guilty to each one.

Analysts expect the deputy president’s impeachment to be upheld as the ruling party senators are likely to be backed by those from the main opposition as happened when the the lower house voted on the case.

Later on Wednesday, evidence by the National Assembly against Gachagua, including any witnesses, will be introduced and examined for three hours followed by another two hours of cross-examination.

On Thursday, the trial will resume to deal with the evidence and witnesses from Gachagua’s side until late afternoon.

At the conclusion of the process in the evening, senators will debate the motion for about two hours and then take a vote – scheduled to happen on Thursday night from 20:30 local time.

The Senate can decide to extend the process to Friday, the last day it can legally extend the matter.

At least two-thirds of the 67 Senate members must approve the motion for Gachagua to be removed from office.

Should that happen and his impeachment stands, he would be barred from ever holding public office.

He is expected to challenge the impeachment in the courts if it passes.

The deputy president has made numerous unsuccessful attempts to stop the impeachment process, with at least 26 court cases having been filed so far.

On Tuesday, a judge ruled that the court would not interfere and said the Senate should proceed with its constitutional mandate.

And just before the process began on Wednesday, a three-judge bench also declined a similar request.

Some of the grounds for Gachagua’s impeachment include accusations that he acquired assets worth 5.2bn Kenyan shillings ($40m; £31m) in the two years since he became deputy president – allegedly acquired through corrupt means.

He has explained, including during his trial at the National Assembly, that most of the properties in question were from his late brother’s estate.

The deputy president is a wealthy businessman from the vote-rich central Mount Kenya region.

In just five years, he rose from being a first-time MP to become the number two in Kenya’s leadership, after Ruto picked him as his running mate in the August 2022 election.

At the time, he was battling corruption allegations in court which were later dropped after he came the deputy president.

His impeachment trial has dominated the discussions of many Kenyans and the media in recent weeks.

Some see the high political drama that the matter has elicited as a distraction from the economic concerns of the majority of Kenyans struggling with the high cost of living.

In June disgruntled Kenyans went to the streets in deadly protests that erupted over unpopular tax hikes, and which exposed a deep rift between Ruto and Gachagua.

Gachagua now stands accused of undermining the work of the security agencies in the wake of remarks he made at the time blaming the intelligence agency.

Man reveals how he survived 66 days at sea in a small boat after losing his brother and nephew in fishing trip

A Russian man who survived 66 days adrift at sea in a small inflatable boat, spoke about his ordeal on Wednesday, October 15 from his hospital bed.

Mikhail Pichugin, 46, was rescued by a fishing boat on Monday off the coast of the far eastern Kamchatka peninsula, more than two months after he set off on a boat trip with his brother and 15-year-old nephew, both of whom died aboard.

Pichugin comes from Ulan-Ude in Siberia but was working on the far eastern island of Sakhalin as a driver.

He set off from the coast of the Khabarovsk region on August 9 with his visiting brother Sergei, 49, and nephew Ilya, 15, on a crossing to Sakhalin meant to take a few hours.

When they failed to arrive, Russian rescuers surveyed the area by helicopter and plane, suspecting the boat had drifted towards Kamchatka, but found nothing and the search was eventually called off.

The boat was found around 1,000 kilometres (670 miles) from its starting point.

Taken to a hospital in the city of Magadan, Pichugin was well enough to speak briefly to journalists while lying in a hospital bed.

Looking pale, he gave a few details of how he managed to survive in the Sea of Okhotsk.

“With God’s help, how else? If a boat called Angel saved me,” he said, smiling, referring to the name of the fishing boat whose crew spotted him.

“I collected rainwater,” he said. He also credited a sleeping bag filled with camel hair for helping him survive.

“It’s wet, it doesn’t get dry but you crawl under it, you wriggle around a bit and you get warm.”

“I had no choice. I have my mother at home, my daughter,” he added on his motivation to live.

Magadan city deputy governor Tatiana Savchenko said his condition was “satisfactory”.

She said the administration would pay for Pichugin to fly home and for relatives to visit.

Pichugin may have survived because of his portly 100-kilogramme (220 pounds) stature, according to his wife. Russian television reported he weighed only 50kg when found on Monday.

His wife Yekaterina told RIA Novosti news agency:

“It’s a kind of miracle”. She said the men had taken enough food and water to last only two weeks.

Russian television reported the men should have taken a satellite phone, the only means of communication in the Sea of Okhotsk. Police say they will give a press briefing after concluding investigations into the incident.

A recent lawsuit filed against Sean ‘Diddy’ Combs could shed light on why 1,000 bottles of baby oil were found by cops when they raided his home earlier this year.

According to the court documents, the rapper used baby oil laced with date rape drug GHB to make assaults easier.

The lawsuit, which was filed on Monday, suggested that the drug was absorbed through the victims’ skin after applying the baby oil to make them drowsy.

In it, a man known only as John Doe, accused the rapper of assaulting him when he was just 16 at a party in 1998.

He also shared a photograph of the pair together at one of the rapper’s famous White Parties. Diddy has denied the accusations against him.

‘There existed something sinister, a dark underbelly of crime, sex trafficking, forced labor, kidnapping, bribery and prostitution,’ the court filing stated.

‘Combs is a menace to society, women and children.’ Diddy denies the allegations against him.

According to the new filing by Tony Buzbee, who says he is representing as many as 120 credible Diddy victims, it was also central to his alleged offending.

‘[He] would tell victims, ”this is what it takes to be famous, what are you willing to do to become a star?’

John Doe was 16 and living in New York City when he received a highly sought after invitation to the 1998 White Party in the Hamptons.

When he received the invitation, he felt like he finally had the opportunity to rub shoulders with the who’s who of the industry. He thought it could be his chance to break into the music industry,’ the court filing read.

‘As John Doe entered, he spotted countless celebrities and A-listers who form the music and entertainment industry. He recognized faces he had seen on TV and on the big screen.’

The young boy was making his way through the crowd and heading toward the restroom when he ‘unexpectedly bumped into Combs,’ the filing states.

‘Shocked, John Doe found himself face to face with Combs, a titan in the music industry, standing right in front of him at his own party.’

The picture shared in the court filing was allegedly taken at this moment, during this interaction.

The filing states: ‘Combs took an interest in John Doe and wanted to talk to him. They walked to a more private area near the portable restrooms brought in for the party.

‘There, John Doe told Combs he was a big fan of Combs and shared his dreams of becoming a star. Combs smiled, telling him he had potential and ‘the look.’ When John Doe admitted his voice was not great, Combs assured him that did not matter.

‘Combs abruptly told John Doe that he needed to drop his pants.’
John Doe was allegedly caught ‘completely off guard’ by the request, and asked Diddy to repeat himself.

‘Combs made himself clear. He instructed John Doe to drop his pants and expose his penis so that Combs could inspect it, explaining it was a rite of passage and the route to becoming a star, and also as a way to prove himself.

‘Out of fear, anxiety and the imbalanced power dynamic between himself and Combs, John Doe then dropped his pants and exposed his penis as Combs previously instructed.’

The filing states: ‘Combs moved closer and grabbed John Doe’s penis and genitals with his hand. He firmly cupped and held onto John Doe’s genitals for an extended period of time.

‘During this time, Combs moved his hand in such a fashion to manipulate John Doe’s genitals, squeezing and feeling them. Doe was only sixteen.’

Buzbee has repeatedly stated more high-profile people could soon be named in suits and vowed to pursue the cases against any offender ‘aggressively’.

Of the 120 people he is now representing, 25 claim they were minors at the time they were allegedly abused.

In the filing, Buzbee said Diddy was able to target young, vulnerable people ‘through a criminal enterprise built on his success as a rapper, record producer, and record executive.

‘Combs is one of the wealthiest musical artists in the world.

‘As part of his pattern of abuse, Combs manipulated both men and women to participate in highly-orchestrated performances of sexual activity with both commercial sex workers and unsuspecting partygoers.

‘Combs has a profound contempt for women and a desire to dominate both minors and other men.

‘His conduct shows a longstanding practice of denigrating, defeating and attempting to humiliate men, women and children.’

Combs’s attorney issued a statement.

‘The press conference and 1-800 number that preceded today’s barrage of filings were clear attempts to garner publicity,’ they said.

‘Mr. Combs and his legal team have full confidence in the facts, their legal defenses, and the integrity of the judicial process. In court, the truth will prevail: that Mr. Combs has never sexually assaulted anyone—adult or minor, man or woman.’

He was charged with a host of sex trafficking and racketeering offenses following his September 16 arrest with his trial scheduled for May 2025.

Manchester City defender, Kyle Walker’s estranged wife, Annie Kilner has reportedly filed for divorce from the footballer a few years after the couple said ‘I do’ following the ongoing scandals surrounding his infidelities.

Kyle, 34, who wed childhood sweetheart Kilner, 33, in 2021, has been involved in a paternity scandal after he secretly fathered two children with influencer Lauryn Goodman during ‘brief flings’.

Annie had taken the footballer back after his first affair but struggled to keep up appearances after he went behind her back for a second time with Lauryn.

She discovered Lauryn’s second child was her husband’s after she was sent a devastating text on December 27, while pregnant with her fourth baby with the defender.

In the message, Lauryn said: “Hey it’s Lauryn. I just wanted to quickly tell you that Kyle is the father of our daughter.”

Shortly after Goodman confirmed the paternity of Kinara, 1, Annie and Kyle briefly separated.

Now, sources claim it is finally over for the couple who met while at school and Annie isn’t holding back as she’s gearing her lawyers to allegedly fight for half of Kyle’s whopping £27 million fortune.

Reports claim that Kyle and Annie are no longer on speaking terms and the England national team vice-captain has also instructed his own legal aids.

So in early 2016 I allowed myself to be trusted out of the PF by known elements. Not, by then, President Lungu though. I formed the Democratic Front (DF) but which in no time was deregistered for no reason by those in power at the time. I then became an alliance partner to the Opposition Leader HH & GBM of the UPND towards the 2016 general elections.

Our presidential campaign activities countrywide were coordinated by a calm soft voice on a daily morning call, informing me where I was needed to travel to within Lusaka for campaigns and it would be with HH, GBM, Dr Cannicius Banda, Dr Maureen Mwanawasa (MHSRIEP) in the chopper to this and that place for rallies.

If I was unable to make it, I would also call the lady on the phone and alert her that I would not make it so that she informs the other leaders. I never met the Adminstrative lady on the call and never bothered to ask her name.

Dipak Patel would call on our out of town movements. Elections passed and only years later I came to learn that the admin lady name was Chipo Mwanawasa.

When I became the Mayor of Lusaka in 2017, I formed BOBA TV which was a personal social media (first of its kind in Zambia) to reach out to the vulnerable in communities but also got to advertise products of youth Entrepreneurs. I remember advertising young Mwizunkanji’s tshirts at the Boba door and also Chipo Mwanawasa’s mobile butchery of prepacked meat packs ready for the pot. This was a gesture to many others be it artists, designers, traders etc

Fast forward in 2024 the President is HH and she is his advisor at Statehouse. So easy to tell how she got the job as she must have earned it while in opposition as highlited above. I have only been to statehouse twice under President HH. First was as Team Leader for the Zambia contingent to the Pan African Parliament and second time was as Chairperson for APNAC (Africa Parliamentarians Network Against Corruption) Zambia Chapter.

On the second and last visit, I led the APNAC Africa President from Benin to pay a courtesy call. He is also the Speaker of the Benin Parliament. We were seated in the boardroom and it was announced the President would arrive in a moment. Then there was realization that the guest from Benin only spoke French and an Interpetor was needed. Before I could blame myself for having not carried one along, Chipo calmly said she would do it. The President and the Benin Speaker effectively communicated thanks to Chipo as interpretor to and from French or English. Very fluent actually. I was impressed with her confidence, abilities, professionalism and diplomacy at this high level meeting.

So when kachepa hit social media that Chipo Mwanawasa was expecting and more so from a VVIP, I took interest not only as an opposition leader but also as I have know her from the past event I pointed out above. The rumor is so ripe that my old women MCCs in Matero bana Levy & Bana Salah called me to alert me of something ‘big’ in the nation. I laughed at them when they told me this same gossip.

Chipo is actually like a niece or young sister to me as her uncle Blessed Nkunika was an associate back in the day when she was a little girl and her Father was President of Zambia. Ideally non of anyone’s business if she is expecting ,except she works at the public arena plot 1 called Statehouse as advisor to President HH and his name was finding itself in inuendos.

In my capacity as Oppostion leader, I made contact with the President on the rumour to check its authenticity. He laughed it off and said that him and his wife are used to absurd kachepa around them since the time he was in opposition. ” I am the most abused politician in the history of Zambia but I have learned to just ignore such things. I ignore and just keep working for the people of Zambia”.

I told him my wife and I always use their marriage as a reference point for a good marriage when we have challenges. She tells me that I should be like HH who takes his wife everywhere he goes for work. I have failed to convince her that government pays for the First Lady on the trip as she is entitled while MPs’ spouses are not. I tell her how I ‘forgot to steal’ when was in government otherwise I would have stash of cash to carry her along abroad every time on duty. Then I tell to be like the First Lady and escort me to farming activities at our Kantemba farm and get her hands dirty.

So our marriage role models would have disappointed us if it was true that there was infidelity in the mix.

I also got intouch with Chipo yesterday and posed 2 questions to her. I can confirm that she is not pregnant and she is also in a serious relationship, but not with any workmate but a single gentleman away from statehouse.

May the young lady be left to do her job. May we have empathy on her and more so that she became an orphan a few months ago. We must all give her support for the good of our late former President and late First Lady.

We shall give the President checks and balances but this will not include personal unsubstantiated kachepa. We shall actually reach out to tell the truth as we have done now.

An Excerpt from the Judgement

.the Constitution and relevant legislation provide that matters to do with councilors are the preserve of local govt election tribunals (LGETs), It is apparent that the judicial review process is not only misconceived, but is a nullity for lack of jurisdiction on the party of the High Court.

On Pg 12, the court has this to say, we now turn to the substantive issue. In doing so, we wish to make it clear that the matter having come by way of our interpretative jurisdiction, we will not delve into any personalized or contentious questions arising from the constitutional provisions. Our intention is to prevent a violation of the constitution from occuring in accordance with our mandate under Article 128 (1) (a) of the constitution.

The originating summons sought among other interpretations :

  • Whether pursuant to Art 57 of the constitution, the prescribed period of 90 days within which to hold or conduct a by-election can stop running by virtue of a stay arising from an application for judicial review or any other application;
  • Whether the High Court has jurisdiction to circumvent the provisions of Art 52(4) through a judicial review application
  • Whether a conviction is a criminal proceedings amount to misconduct…
  • Whether an appleal without a stay of execution from criminal conviction stays the period for holding by-election as envisaged in Art 57 (1) of the Constitution….

On Pg 15, the Court guides that

  • …the only constitutionally mandated legal challenge which may be mounted during the 90 day by-election process is a NOMINATION CHALLENGE. It must be determined within the specific timelines set for such a challenge. Hence the election process once triggered by the vacancy must run its course until the election and there is no provision for its extension or re-alignment outside of the provisions of the constitution the sum total the two provisions (Art 57(1) and Art 52(4) is that the entire process of a by-election must take place within 90 days from the date when a vacancy occurs.
    When does the vacancy occur?

“A casual vacancy in the office of the MP, Council Chairperson or Mayor or Councilor occurs on the date the ECZ receives notification either from the Speaker or the Council Secretaries/ Town clerks* and the 90 days in which to conduct the by-election process ticks in”

” The law does not contemplate any other processes being undertaken during the 90 days let alone permit those processes to undermine the constitutional time limits.””….Hence once the applicant [ECZ] receives notification of a vacancy having arisen, it is under compulsion to set in motion the by-election process and conclude it within the 90 days in Art 57″.

Contrary to claims of widespread disapproval, largely made by some Zambians abroad, President Hakainde Hichilema continues to enjoy strong support from the local population. His policies, aimed at addressing the nation’s challenges, have bolstered his approval ratings during some of Zambia’s most difficult times.

A recent piece by Stephen Lock, published in the Daily Nation on October 14, 2024, and featured on the International Policy Dialogue website, highlights a growing trend of commentary detached from the realities on the ground. This article exemplifies the spread of poorly researched opinions that fail to reflect true public sentiment in Zambia.

*The Misinformation Narrative*

Lock’s article is a prime example of biased writing, carefully weaving distorted facts into a particular narrative. While Lock presents himself as an authority on Zambian politics, his detachment from local realities is glaring. Without firsthand interaction with Zambians in markets, buses, and other public spaces, Lock is ill-equipped to gauge the president’s true popularity. In fact, evidence suggests that Hichilema’s approval is growing, especially among grassroots communities benefiting from his decentralization efforts, such as the expanded Constituency Development Fund (CDF).

Lock frequently cites “critics” but fails to identify who these individuals are, thereby weakening the credibility of his argument.

*Economic Management and Debt: A Selective View*

Lock’s claim that Hichilema’s government has accumulated $18 billion in debt lacks context. He omits the crucial fact that much of this debt was inherited from the previous administration when Hichilema assumed office in 2021. The country was nearly bankrupt and had defaulted on its foreign debt. A fair analysis would have started by examining the dire economic state left by former President Edgar Lungu.

Lock’s assertions about inflation and economic growth also lack depth. Under the previous administration, inflation reached 15.5% by August 2020, driven by rising energy and food prices. Hichilema’s Finance Minister, Dr. Situmbeko Musokotwane, has since laid bare the reckless borrowing and unsustainable spending that characterized the Lungu era. The fiscal challenges of that period were severe, yet Lock seems intent on placing the blame for Zambia’s current economic woes on Hichilema’s shoulders without considering the broader context.

*Unfounded Law Enforcement Claims*

Lock’s allegation that Hichilema uses “lawfare” to silence political opponents is both lazy and unsupported by evidence. His claim that arrests have increased under the now-repealed defamation law is without merit. In fact, Hichilema was instrumental in repealing this law, which had been in place since 1968, underscoring his commitment to reform. Furthermore, the Human Rights Commission confirmed that there is no data to support Lock’s claim of an increase in arrests under Hichilema’s administration compared to his predecessor.

*The Interpol Election and Misrepresentations*

Lock’s commentary on Zambia’s failed bid for the Interpol Secretary General position is yet another example of how his article leans on rumor rather than fact. He neglects to mention that the Zambian candidate, Mubita Nawa, was the African Union’s agreed candidate, signaling significant continental support. Lock instead chooses to focus on baseless allegations, which, if true, would have disqualified Nawa from even being considered for the role.

*Misleading Analysis of Resignations*

Lock also criticizes Hichilema’s handling of the resignation of the Anti-Corruption Commission (ACC) Director General, suggesting it was mishandled. In reality, the resignation was not voluntary but rather a graceful exit after public admonishment by Hichilema for the DG’s poor performance. Lock’s failure to understand the cultural and political nuances of such resignations further diminishes the credibility of his critique.

*Conclusion*

Stephen Lock’s article is riddled with misrepresentations, selective facts, and unverified claims. His failure to engage with ordinary Zambians and his reliance on questionable sources result in an analysis that lacks balance. Hichilema’s leadership, focused on long-term solutions and reform, continues to win the confidence of many Zambians. As one young Zambian, John Zulu, put it, “Hichilema plants a tree for future generations to enjoy the shade. Only a foolish man will not recognize and appreciate that.”

Zimbabwe has reaffirmed full support for Dr. Samuel Maimbo for the presidency of the African Development Bank

Zimbabwe has declared its full support for Dr. Samuel Maimbo, Zambia’s candidate for the presidency of the African Development Bank (AfDB). Zimbabwe’s Ambassador to Zambia, Charity Charamba, reaffirmed her country’s backing for Maimbo, who is the Southern African Development Community’s (SADC) sole nominee for the top post at the AfDB.

Speaking to ZNBC News, Ms. Charamba praised Zambia’s 60th Independence Anniversary milestone and expressed optimism about the region’s united support for Dr. Maimbo’s candidacy. The endorsement aligns with a resolution made during the 44th SADC Summit of Heads of State and Government held on August 17, 2024, in Zimbabwe. The summit urged all SADC member states to campaign actively for Dr. Maimbo.

However, regional support for the Zambian candidate has become contentious, with South Africa departing from tradition by nominating its own candidate, Ms. Bajabulile Swazi Tshabalala, for the same position. Tshabalala, currently the senior vice president at the AfDB, is seen as a continuity candidate following the tenure of outgoing president Akinwumi Adesina. Her nomination has stirred debate, with many advocating for her leadership as an opportunity to appoint the first female president of the AfDB.

In a recent statement, Bowman Lusambo, former Lusaka Province Minister and Patriotic Front official, criticized Zambia’s handling of Dr. Maimbo’s candidacy, alleging mismanagement by the Ministry of Foreign Affairs. Lusambo claimed that South Africa’s decision to field Tshabalala reflects frustration with Zambia’s foreign policy, which he described as disorganized and inconsistent.

Lusambo expressed concern that Zambia’s diplomatic standing within SADC and beyond is declining, referencing the failed bid of Prof. Chaloka Beyani, a Zambian scholar, for a seat at the International Court of Justice (ICJ). According to Lusambo, perceptions of Zambia’s unreliability played a significant role in that electoral defeat, and similar challenges could jeopardize Dr. Maimbo’s chances at the AfDB.

“SADC holds about 14% of the voting rights within the AfDB group, and with the region divided, Dr. Maimbo’s candidacy faces significant hurdles,” Lusambo said. He suggested that Zambia should consider withdrawing Maimbo’s candidacy to avoid further diplomatic embarrassment.

Lusambo urged the Zambian government to repair its strained relations within SADC and appoint a respected statesman to lead efforts to rebuild regional goodwill. He further pledged support for Tshabalala, saying, “It is time for Africa to have a strong woman leading the AfDB.” Lusambo called on Africans to rally behind Tshabalala, emphasizing her integrity and track record of fostering development on the continent.

Kambwili brothers have died as patriots and noble men- Edgar  Lungu

Good morning fellow citizens,

The past two days have been tragic, sad and heartbreaking for Zambia due deaths caused by road accidents. On 14th October, 2024, five (5) people died along Great North Road in Chisamba around 07:20 hours when a Sino truck water bowser and a Toyota Vitz following a head-on collision. Bwalya Kasonde, a 32-year-old resident of Chilanga who was the Toyota Vitz driver and four of his passengers all died.

On 15th October, 2024 at around 04:30 hours near the Kafue Boys Secondary School, Zambia recorded a fatal Road Traffic Accident (RTA) involving a South Africa bound Marcopolo bus which overturned and killed 4 passengers while 29 individuals were left with serious injuries.

As if the above sad news was not enough, I learnt with a heavy heart last night that one of my former cabinet ministers and PF Member of Central Committee, Hon Chishimba Kambwili and some of his biological brothers were involved in a fatal road traffic accident yesterday approximately at 17:45 hours at Lubushi area, about 65 kilometers from Luwingu Town along the Luwingu-Kasama road.

This accident involved five (5)  passengers namely Mr. Kennedy Mwila, aged 43 (the driver), Hon. Chishimba Kambwili, aged 55, Mr.Mwamba Kambwili, Mr. Mutale Kambwili, and Mr. Kennedy Mambwe, aged 43 (their lawyer). While Hon. Chishimba Kambwili, Mr. Kennedy Mwila, Mr. Kennedy Mambwe sustained various head and body injuries, it is regrettable to learn that Mr.Mwamba Kambwili and Mr. Mutale Kambwili sustained fatal head injuries and were pronounced dead on the spot.

The Kambwili brothers have died as patriots and noble men because they were escorting their elder brother, Hon. Chishimba Kambwili who was scheduled to appear before the court in KASAMA today. It is my prayer that the untimely loss of the Kambwili brothers will help the court system in Zambia to consider hearing cases of suspects in their locality in order to avoid a recurrence of such family misfortunes.

In times like this, we often search for answers and ask for God´s strength and guidance to set us onto the right path as we try to figure out why such unfortunate things occur to all of us on earth. In the book of John 16:33, Jesus Christ said: “I have told you these things, so that in me you may have peace. In this world you will have trouble. But take heart! I have overcome the world”.

Let me conclude with John 16:22: “So with you: Now is your time of grief, but I will see you again and you will rejoice, and no one will take away your joy”. This is my word of encouragement to the Kambwili family and all Zambians who are mourning today. May The Souls of Our departed brothers Rest In Peace and wish Hon. Kambwili and everyone in hospital God’s mercy and quick recovery!

May God bless you and your families during this hard time. We stand with your families both in tears and prayers!

Speeding BMW driver admits endangering chief justice Mumba Malila’s life

A Zambia Revenue Authority examinations officer  who was behind the wheel of the speeding car that rammed into the official vehicle of country’s chief justice, has admitted to endangering the life of justice Mumba Malila and other road users.

Philemon Dyamini explained that he did not intentionally hit into justice Malila’s Mercedes Benz as his car breaks failed on the motorway.



The 35- year old of house no. 11572/M Lilayi Road, is charged with two counts of dangerous driving contrary to Section 155(1) of the Road Traffic Act No. 11 of 2002 of the Laws of Zambia and Failing to change ownership of a motor vehicle contrary to Section 13 of the The Road Traffic Act No.11 of 2002 of the Laws of Zambia.

According to the particulars of offenses in the first count are that, Dyamini August 30, 2024
drove a BMW registration no. BAP 3706 on independence avenue a public road at a speed in a manner that was dangerous to the public and other road users having regard to all the circumstances of the case, condition, use of the road and amount of traffic which was reasonably expected to be on the said road,  lost control of the motor vehicle due to excessive speed and endangered other road users.

In the second count it is alleged that Dyamini on August 30, 2024 drove a BMW registration no.BAP 3706 on independence road a public road when he failed to effect change of ownerhip of the said motor vehicle.

Appearing before magistrate Maloto Phiri, in the fast track court,  Dyamini pleaded guilty to the charges.

He said he drove the car dangerously after the breaks failed and he was not aware that they had malfunctioned.

When asked if he had documents to show that his vehicle had a fault, Dyamini denied.

“I was not aware that the breaks would fail, it was not intentional.I take responsibility for change of ownership, it (the car)had been parked for a while,”Dyamini said.

Public prosecutor Victoria Mtonga requested that the matter be adjourned to today, for facts and sentencing.

Magistrate Phiri granted the adjournment.

Justice Malila sustained a fractured leg and other injuries, after his official vehicle was extensively damaged.

His driver Newton Ndhlovu also sustained injuries, prompting government to evacuate them both to South Africa for further medical care.

The chief justice is currently recuperating from the effects of the accident.

Winter Muvombo, Director of the Muvombo Development Initiative, applauded the Royal Highnesses from across Zambia who convened at the Samu Lya Moomba Traditional Ceremony in Southern Province. He praised their demonstration of unity and mutual support, seeing it as a true reflection of the national motto, “One Zambia, One Nation.” Muvombo commented, “These leaders, despite their busy schedules, have shown solidarity with their counterparts in Southern Province. If this isn’t a testament to our national unity, what is?”

Shifting focus to former President Edgar Lungu, Muvombo made a heartfelt appeal for him to reconsider his political stance. He emphasized that Lungu’s current path was becoming increasingly untenable. “While Lungu’s priority is to protect his family, it’s clear that the system is slowly but surely closing in on him. Everyone, including Lungu himself, can see this,” Muvombo stated. He advised Lungu to act wisely and avoid further public embarrassment, adding, “Even if conceding brings some shame, it’s the right and dignified choice.”

Lungu no longer has the influence he once held and the sooner he accepts this reality, the better it will be for him,” Muvombo noted.

Close allies of Lungu, speaking on condition of anonymity, have expressed their concerns about his political trajectory. They believe Lungu is pursuing an impossible goal, yet they feel constrained from advising him to abandon it due to his unwillingness to listen. One source shared, “If only he would heed the advice of those closest to him, including his wife, he could avoid unnecessary conflict and ensure a more graceful exit from politics.”

These sources further highlighted the growing challenges Lungu faces in his opposition to President Hichilema. “The road ahead is steep and time is not on Lungu’s side. The sooner he acts with wisdom, the better his chances of avoiding further humiliation,” one ally warned, pointing out that while the system operates slowly and methodically, it is closing in. Their hope is that Lungu will open peaceful negotiations with President Hichilema and state lawyers, potentially working out an agreement that would protect his legacy.

A 36-YEAR-OLD married woman of Lusaka’s Midlewest area has proven to be a reason why the country needs the national day of prayer, fasting and reconciliation after the court heard that a brick layer used his skill to lay a seed in her because she was unsatisfied with her husband bedroom workouts.

Magistrate Lewis Mwewa of Matero Local Court listened to the testimony of 48 year old Thomas Mwale who was narrating the ordeal of his wife, Marvis Chileshe and how she would sleep with their bricklayer, under her husband’s nose, leading to the pregnancy.

Mwale said that last year, their house needed some plastering and building of a toilet, so he hired their neighbour, Evans Zulu, aged 55 who just stayed two houses away from theirs.

But unknown to Mwale, his bemba wife’s weakness were older men. So aside from building his toilet, Zulu also started helping him build his home as ‘a good Samaritan’ who stepped beyond his boundaries.

Each time Mwale left for work and Zulu was home building, Chileshe’s body would automatically vibrate just by watching a 50 year-old would energetically mix cement, until she started wishing that he would use his finishing trowel to plaster her body too.

And before their spouses could notice, the two were playing hide and seek in each other’s matrimonial beds, until Chileshe fell pregnant.

Mwale said the pregnancy shocked him because for a long time, he had never made his wife shout ‘apopene’ in bed, especially after his erectile dysfunction, which he suffered in 2016, which affected his bedroom permanence.

“So my wife started complaining that I was not satisfying her and she would compare me that they are better men who know how to touch her. later I was just supprised that she was pregnant and asked me that I should forgive her because the pregnancy was not mine and likely to have been for Zulu,” said Mwale.

He added that the couple had been ‘happily’ married for 11 years with three children together, with her fourth being the 2 weeks old baby belonging to Zulu that she just delivered.

As a co-defendant in the adultery case, Chileshe admitted to have been sleeping with her neighbour adding that she only revealed the truth about the pregnancy to her husband after a prophet prophesied to her that she risked losing the child or her life if she kept lying.

“ We stopped having sex in the house with my husband and that’s the reason why I got pregnant for another man. Zulu and i used to sleep at his house when his wife had gone for work, sometimes at my house or we would book a lodge . We had met several times and I knew him a long time ago,” said Chilufya.

And the man of the moment,  Zulu who first began by denying the claim, later accepted and apologised to Mwale, adding that his wife didn’t know about the pregnancy until she received summons that her husband was sued for adultery.

‘I’m asking for forgiveness from Mwale for impregnating his wife,” said Zulu.

After hearing the statements from the three parties, the court findings were that indeed, Zulu was ploughing Mwale’s field, and even planted some winter maize, which he already harvested.

“Claim upheld, First defendant (Zulu) to compensate Plaintiff (Mwale) with K10,000 by k1,000 monthly while second defendant (Chileshe) will compensate him with K5,000 all effective October 30, 2024,” said Magistrate Lewis Mwale.

Chadwick Boseman sadly passed away four years ago, but Lupita Nyong’o continues to feel her friend’s absence. The Oscar winner reflected on Boseman’s death and paid tribute to him when a snippet of their Black Panter movie was shown to her at a BFI London Film Festival event on Monday, PEOPLE reported.

Boseman died on August 28, 2020, at the age of 43 after battling colon cancer. Prior to his death, the Ma Rainey’s Black Bottom star’s medical condition was not publicly known.

“The grief is just the love with no place to put it, right?” Nyong’o emotionally said before she refused to be shown another video. “I don’t run away from the tears or the grief, you know? You just live with it. That experience will never be separate from the love that was formed,” the 41-year-old added.

Nyong’o and Boseman are remembered for co-starring in Black Panther. She portrayed Nakia, a Wakandan spy and King T’Challa’s love interest. Nyong’o while talking about Boseman also said she was yet to re-watch the box-office hit movie after his death.

“I watch this clip and I’m filled with grief and I don’t know whether I’ll ever be done shedding my tears from losing my friend,” she said. “But I’m like, we get to see him alive. And that’s so wonderful.”

On the fourth anniversary of Boseman’s death, Nyong’o similarly paid tribute to him in a post on her Instagram page. “Grief never ends. But it changes. It is a passage, not a place to stay. Six or seven years ago when his agent suggested he do a documentary, Pharrell wasn’t really interested. Then his agent had another idea: “He was like, ‘Why don’t you just look at the [Lady] Gaga one [2017’s Gaga: Five Foot Two]? I mean, look how she did it.’ I’m like, ‘Okay, cool.’ And I saw it, and that was one of the things I was most impressed with when I did see it. I was like, ‘Oh, I saw her fingerprints all over this.’”

Pharrell just had two conditions. The first one: “I was like, ‘But I want to do it with Morgan Neville,’ because he had done 20 Feet from Stardom, and he had just done the Mr. Rogers [documentary], which was crazy,” Pharrell recalled. “And I was like, ‘Man, I can’t believe I get to work with the same guy.’ “

The second condition: “I said, ‘But I want to do it in LEGO.’ “

Pharrell’s project takes an innovative approach by using animated LEGO characters instead of traditional interviews, featuring custom LEGO representations of A-list friends like Justin Timberlake, Gwen Stefani, JAY-Z, Snoop Dogg, and Busta Rhymes.

But why LEGOs? “Well, it’s what I always played with when I was young,” Pharrell explained. “It’s what I would get for Christmas. And then when [he and wife Helen Lasichanh] had our first [child], Rocket, I would always send him little LEGO sets or whatever, and pick them up from different places around the world.”

“And then right around that time [that he started thinking about the documentary], we had just had the triplets, and I knew that I wanted the triplets to hear and understand my story too. So, it just all made sense. You know what I mean? I wanted it so that they could see Dad tell his story.”

French giant, PSG has hit back at Kylian Mbappe after he appeared to accuse his former club of having some involvement in spreading r@pe allegations that he has dismissed as ‘baseless’ and ‘fake’.

According to local media reports, Mbappe was accused of r@pe and s3xual harassment at a Swedish hotel where he stayed with friends last week.

Mbappe hit back at the reports on X on Monday afternoon, as he posted: ‘FAKE NEWS! It’s becoming so predictable, just before the hearing as if by chance,’ alongside a winking face emoji.

The post appeared to be a dig at PSG amid his ongoing payment dispute with the Ligue 1 giants.

The French superstar is chasing almost £50m in unpaid wages and bonuses after leaving PSG in the summer to join Real Madrid, and a meeting between Mbappe, PSG, and the appeals committee is due to take place on Tuesday.

PSG have now responded by blasting Mbappe’s comments.

‘It’s a shame. We will keep our class and our dignity,’ a source close to PSG said, as quoted by RMC Sport.

‘PSG is responsible for everything with him. He didn’t score any goals (apart from penalties) for Madrid? It’s PSG. He missed the French national team matches….. even though he says he did, but he’s not injured? It’s PSG.

Mbappe’s entourage also released a statement in response to the accusations made against the footballer in Sweden as they vowed to take legal action to clear his name.

In a statement sent to AFP, they wrote: ‘Today, a new slanderous rumour begins to set the web ablaze, starting from the Swedish media Aftonbladet.

‘These accusations are totally false and irresponsible, and their propagation is unacceptable.

The statement did not make any mention of PSG having any involvement in the allegations, but Mbappe’s X post has threatened to further sour his relationship with his old club.

Get to know David Steward, a tech entrepreneur who is now the richest Black person in America with an estimated net worth of $11.4 billion, up from $7.6 billion last year and $6 billion the year before that, as per Forbes.

He toppled Robert F. Smith to become the richest Black man in the U.S. Smith founded the private equity firm Vista Equity Partners in 2000, which focuses exclusively on investing in software companies. The Denver native and philanthropist made headlines when he paid off the student debts of Morehouse’s graduating class in 2019. Smith is now the second richest, with an estimated net worth of $10.8 billion.

Self-made billionaire Steward started his entrepreneurial journey from a humble background and worked his way up the ladder to become successful. Born in Chicago in 1951, Steward grew up in segregation with his seven siblings, and at one point, he was the only Black boy in his school. His father worked as a janitor, mechanic, and trash collector.

Steward obtained a B.S. in business in 1973 from Central Missouri State University. He was also awarded Honorary Doctorates of Humane Letters by Harris Stowe State University in 2002 and Lindenwood University in 2010.

Today, the company is one of the largest Black-owned IT providers in the U.S. with more than 20 locations across the world. The company provides services for both the American government and private organizations.

WWT notes that it has more than 8,000 employees and generates more than $14.5 billion in annual revenue, according to Bloomberg. The technology services provider specializes in cloud capabilities, data center, and virtualization, security, mobility, and networking technologies along with voice, video, and collaboration solutions.

Steward is also the founder of Kingdom Capital, a values-driven private investment firm with a focus on early-stage companies with technology-based health and medical solutions. The sixth President of Zambia Edgar Lungu has a ´big and forgiving heart´ that gives him the ability to act beyond vengeance compared to successor Hakainde Hichilema says Kelvin Bwalya aka KBF in an explosive ´no holds barred´ interview on Millenium TV in Lusaka.

The prominent Lusaka lawyer and president of Zambia Must Prosper (ZMP) said he has undisputed evidence based on the demeanour of the two leaders, number six, and number seven of Zambia.

KBF gave an example of three Zambian politicians that fell out of favour with Lungu, crossed the line but later returned to the ruling party where President Lungu embraced them without qualms.

These are Geofrey Bwalya Mwamba or GBM, Chishimba Kambwili and Miles Sampa.

“My older brother ba GBM and my younger brother Chishimba Kambwili including Miles Sampa said a lot of hurtful and unpalatable things against President Lungu when they quit the PF,” said KBF.

He said, “when they found that the grass wasn’t greener on the other side and decided to return to the ruling party Dr Lungu embraced them unconditionally.”

KBF said forgiveness, a huge trait or characteristic in a leader distinguishes positively, president Lungu compared to seventh President Hakainde Hichilema who has “umufimbilwa” or cruel and “unforgiving” heart.
“If you are enemies with HH who is my friend he will punish you to the end he will do anything to end you he keeps a list of enemies he is unforgiving ´alakwata ulupato´ (he has a cruel heart),” said KBF in the live interview gone viral.

The charismatic lawyer recalled personally, a meeting he attended with late President Rupiah Banda and two foreign heads of states to persuade Edgar Lungu to hand over power in 2021 and protect Edgar Lungu and family from persecution.

“HH when we got to Community House told me after the meeting that they want me to leave Edgar Lungu alone I have reluctantly agreed but I will go for all the others and that is what he is doing right now with glee,” said KBF.

The tactical lawyer and strategist known for winning some of the most complicated cases in Zambia said he felt his skin move when he noticed the taste for vengeance in Mr Hichilema.

“HH kept telling me about how angry he was at having been arrested 15 times under Edgar Lungu ´I was arrested 15 times mwana´ he kept saying and I said ´you can’t move on if you can’t forgive and forget,” said KBF.

KBF warned that the arrest of GBM, Chitotela, Chilangwa and the targeting of Edgar Lungu´s family is but the beginning of President Hichilema´s trail of revenge, Zambians must brace for more.

“He has a list its just Zambians forget fast, but he used to read a list of people he would target for punishment once he wins power HH won power to revenge for his 15 arrests and not for Zambians wellbeing,” said KBF.

He added that, “if it was up to HH, all of us opposition leaders, ZMP, PF and everyone must be in cages before the next elections so that he stands alone but we won’t let that happen and neither will Zambians.”

KBF reaffirmed his desire to join hands with President Lungu, civil society, and other opposition leaders to stop Mr Hichilema from completely diminishing the democracy of Zambia and avoid a dictatorship in the making.

KBF urged Zambians to always recall as the 2026 polls approach that Edgar Lungu has a bigger heart for the people compared to President Hichilema who is vengeful by birth and nature.

It is evident that under Mr Hakainde Hichilema and the UPND, tyranny is rising as good governance, democracy and constitutionalism sharply diminishing. This is happening day by day without shame or restraint. 

Clearly, we have a leadership that is set to govern the country through intimidation, persecution, malice, and terror. The police and other law enforcement agencies are being used to abuse, pursue, and mistreat Mr Hichilema’s political opponents and private citizens under the guise of safeguarding peace and national security. They have unashamedly planned to suppress our rights, freedoms, and way of life to prevent us from holding them accountable.

Mr Hichilema is aware that his numerous failures have exposed him as an incompetent and incapable leader who is unable to fulfil the vast campaign promises he made to our people. And now that he can no longer manipulate and deceive the people, he wants to dodge responsibility by muzzling his political rivals, private citizens and other critical voices, through repression, victimization and abuse of state institutions, and systems. They are mercilessly choking everybody and everything that dares to stand in their way. They can no longer hide or pretend about their ruthless style of governance.

But we want to counsel Mr Hichilema and his league to realise that political contentment, national prosperity, peace, growth, and stability are directly linked to the moral character of any nation’s leadership. In essence, every single nation’s peace, justice, stability, and good fortune entirely rest on the quality, type, and spiritual outlook of the leadership they elect for themselves. If those elected into leadership are acquisitive or money-oriented, nonspiritual, insensitive, and cold-hearted, then that nation is destined for disaster. No matter how hard the leadership tries to entrench itself on the people, such a nation has no realistic chance of transitioning to tangible and sustainable democracy, peace, and prosperity.

As Christians, we must also not forget that leaders are representative or an echo of their spiritual life, beliefs, and upbringing. There is no single person in this world who reproduces what is not in the heart. Mind you, what is in the heart is a creation or sum total of one’s spiritual journey, beliefs, and childhood. In a nut shell, human beings are a product of what lies deeper inside them, mainly the awareness, recognition, or belief that there is a supernatural being (God) greater than themselves.

Therefore, no matter how resolute they attempt to disguise their narcissism, brutality, tribalism, and corruption; genuine and Godly leadership is not hard to discern, distinguish, and respect. As the Bible says in Proverbs 29 v 2: “When the righteous are in authority, the people rejoice: but when the wicked man rules, the people mourn and lament.”

In this scripture, the Bible guides us that the one who rules matters! We therefore ask these questions: Do the people ruling us today possess any noticeable traits of compassion, honesty, decency, justice, or equity? It goes without saying that at present, the nation desires a God-fearing, truthful, compassionate, sober, mature, and virtuous leadership. Of which, Mr Hichilema and his league fall far short of these capabilities.

The recent months have been filled with escalating tensions between Zambia and some of its neighboring countries, and as a journalist, diplomat, and international business expert, my instincts have been awakened. It is crucial for us to be informed about these events, which could potentially lead to a silent trade war brewing between Zambia and its neighbors.

First, let us understand what a trade war is. In simple terms, it is a retaliatory action taken by one country against another by imposing restrictions or raising import tariffs.

These actions often have adverse effects on the economies of both nations involved.
In August of this year, the Democratic Republic of Congo (DRC) imposed a 12-month ban on importing goods such as beer, soft drinks, lime, earthenware, and tiles from Zambia.

In retaliation, Zambia closed three of its borders with the DRC. The Zambian government defended its actions by stating that the riots and looting in the frontier towns of the neighbouring country had caused insecurity along the border.

After diplomatic discussions, the issue was resolved, and trade between the two countries seems to have normalized. However, this incident serves as a reminder of the delicate balance that must be maintained in international trade relations.

In the same month of August, operators responsible for trucking fuel to Zambia’s Copperbelt region started avoiding Zimbabwe due to a newly imposed duty to combat in-transit theft of tanker cargo. Additionally, the rigid cargo scanning regime instituted by the Zimbabwe Revenue Authority (ZIMRA) has become another non-tariff barrier (NTB) for trade, causing cross-border operators to shy away from a transit that has reverted to past problems such as bad congestion. This has also resulted in disruptions in the supply chain, leading to fuel shortages in Zambia.

These events highlight the need for diplomatic tact and careful consideration to resolve such issues. As a country heavily reliant on imports, the disruption of supply chains can have severe consequences for Zambia’s economy. The use of NTBs and retaliatory actions could also harm the already-existing trade agreements and partnerships between the countries involved.

It is crucial for the authorities to address these issues promptly, through dialogue and cooperation. The use of diplomatic channels and finding mutually beneficial solutions is essential in maintaining peaceful and prosperous trade relations between Zambia and its neighboring countries.

In conclusion, the recent events between Zambia and its neighboring countries serve as a reminder of the fragility of international trade relations. The use of retaliatory actions and non-tariff barriers can have detrimental effects on the economies and partnerships between nations. It is vital for the authorities to address these issues with diplomatic tact, understanding, and a focus on finding mutual solutions, rather than escalating tensions. Let us hope that these incidents serve as a lesson for future trade negotiations, where both parties can benefit and thrive.
