Lifting Presidential Immunity

Unlike the lifting of Immunity of former President Frederick Chiluba (2002) and Rupiah Banda (2013) which was done with easy in Parliament, the law has now changed since 2016. See Article 98 of the Constitution.

In Chiluba and Banda cases, a wide range of unsubstantiated allegations were made in Parliament, which prompted MPs to lift Presidential immunity without verification of the allegations. And it was by mere simple majority vote by Parliament! But now the law has changed. The following pointers must now be followed for lifting Immunity:

1. It is the sitting President himself who should go to Parliament and present a Report detailing the specificallegations against former President. (Rupiah Banda was done by Minister of Justice).

2. The allegations must be specific and Parliament is obliged to set-up a special Committee to probe the allegations before tabling them in the House unlike in the Chiluba and Banda case.

3. The former President, unlike previous, is allowed to challenge and be heard at Parliament before lifting of immunity. So, if the allegations are fake, the Committee will inform Parliament and the whole process fails! Lawyers get involved at this stage like in the US during congressional hearing of impeachment of the President.

4. If the Committee finds that the allegations are valid, Parliament will still has to vote for lifting of immunity and the motion requires two-thirds majority unlike in Chiluba and Banda cases where you just needed simple majority.

5. Once immunity is lifted, the former President ought to charged with those specific charges or alleged offences that Parliament approved and nothing else. In both Chiluba and Banda cases, they were charged with other unrelated offences not presented to Parliament.

6. If acquitted by the Courts, immunity is given back automatically by operation of law unlike in the Chiluba and Banda cases.

The effect of the above entails that the former President must be investigated first and prima facie case found against him before contemplating to lift immunity. There is no law that stops law enforcement agencies from investigating former President but prosecution. The process has now been lengthened following the unsuccessful prosecution of Chiluba and Banda.No ordinary MP or Minister can move Parliament to remove immunity unlike in the past. It must be President.

Philippine boxing superstar Manny Pacquiao to run for president

Philippine boxing superstar Manny Pacquiao declared he will run for president in 2022, vowing to tackle poverty and corruption as he seeks to win over voters with his rags-to-riches story.
“The time is now — we are ready to rise to the challenge of leadership,” Pacquiao — currently a senator — said Sunday, as he accepted the nomination of a rival faction in President Rodrigo Duterte’s ruling party.
The eight-division world champion and beloved national hero made the announcement weeks after losing what could be his last professional fight, against Cuban Yordenis Ugas in Las Vegas.

Pacquiao, who entered politics in 2010 as a congressman before being elected to the Senate, has long been expected to make a tilt for the country’s highest office.
The 42-year-old is deeply admired by many in the archipelago nation for his generosity and hauling himself out of poverty to become one of the world’s greatest and wealthiest boxers.
But his support for Duterte’s deadly drug war, and previous comments describing gay couples as “worse than animals”, have earned the high school drop-out plenty of detractors.

“For those asking what are my qualifications, have you ever experienced hunger?” Pacquiao asked the national assembly held by the anti-Duterte faction of PDP-Laban.
“Have you ever experienced having nothing to eat, to borrow money from your neighbours or to wait for leftovers at a food stall? The Manny Pacquiao that is in front of you was moulded by poverty.”
Pacquiao’s star power in a country famed for its celebrity-obsessed politics will put him in a strong position in the presidential race.

But it will not guarantee victory.
Reaction to his announcement has been mixed, with some questioning the boxer’s suitability for the presidency.
“Seriously, Manny? You’re an inspiration in boxing but I can’t compromise to let you run my country,” said one Twitter user.
A public skirmish between Pacquiao and Duterte over the latter’s handling of the South China Sea dispute with Beijing and official graft could also erode support for the boxer.

Duterte — who is constitutionally allowed to serve only one term as president — rivals Pacquiao in the affections of many Filipinos and declared last month he would run for the vice-presidency.
A party faction loyal to Duterte also endorsed the president’s close aide, Senator Christopher Lawrence “Bong” Go, for the top job — but he has so far declined the nomination.

Pacquiao would face a formidable opponent if Duterte’s daughter, Sara, were to run for president, which she is tipped to do.
A recent poll showed the Davao city mayor — who belongs to a different party to her father — with the most voter support, well ahead of Pacquiao and other potential contenders.
The deadline for registering as a candidate for next year’s elections is October 8.

– Deep divisions –
The nomination of two candidates for president from PDP-Laban showed “how deep the divisions in the ruling party are”, said Eurasia Group analyst Peter Mumford.
“A key watchpoint will be whether most of the anti-Duterte camp falls in behind Pacquiao or whether it splits with multiple different presidential candidates,” Mumford said.
“The former would complicate Duterte’s succession plans by making victory for the eventual Duterte-backed candidate less assured.”
Pacquiao, a devout evangelical Christian, was a high-profile backer of Duterte and his controversial anti-narcotics campaign.

International Criminal Court judges last week authorised a full-blown investigation into that policy, over the alleged unlawful killing of possibly tens of thousands of people.
Pacquiao told AFP in a recent interview that he would continue the crackdown, but in a “proper way” that does not abuse “the rights of individuals”.
Asked if he would protect the current president from criminal charges if he became leader, he said: “All of us are bound to the law.”

_Republican President Hakainde Hichilema has thanked the people of Masaiti District for keeping the faith from 2015, 2016 and 2021_ .

H.E Mr Hakainde Hichilema has thanked the people of Masaiti through Provincial Chairman and Copperbelt Minister Hon Matambo who went to receive thousands of defectors from PF who have resolved to join the mighty UPND.

The Republican President said that the support and faith Masaiti showed him in 2015 and 2016 was a Springfield for the entry of the UPND into Copperbelt. H.E Mr Hakainde Hichilema stated this in a speech read for him by the Provincial Minister Hon Elisha Matambo.

Receiving the defectors the Provincial Chairman and Copperbelt Minister Hon Matambo stated that the Country should never be allowed to get into the hands of selfish leaders who brutalized citizens.

Hon Matambo further encouraged both members to have mutual respect for each other as UPND believes in oneness.

The Copperbelt Minister and UPND’s Provincial Chairman said the party has embarked on a program to continue mobilizing and grow numbers on the Copperbelt to completely eradicate PF’s presence as they can never be allowed to Govern again.

UPND currently has 9 MPs just like PF but with the advantage of 4 independents who have resolved to support UPND Ideologies and Policies. The Party has 8 out of 10 Mayors with 163 Councilors out of 253 Councilors an indicator that UPND is in control of Copperbelt Province.

In leading the defectors, Mrs Christine Chande Kalubwa who is former Masaiti PF Council Chairperson and 2021 PF Aspiring MP said they have decided to join UPND so that they can positively contribute to the governance of the Nation.

The PF’s 2021 Masaiti Aspiring MP also said the good policies and ideologies of the UPND as well as it’s visionary leader H.E Mr Hakainde Hichilema has also contributed to the team defecting to the UPND.

Mrs Christine further said the PF has destroyed Zambia through divisive rule on ethnicity and corruption. She encouraged UPND Government to fight corruption and make sure that the stolen monies by PF must be recovered so that it can be invested in Agriculture and other sectors to create the much needed Jobs and development of roads and other infrastructural projects.

Among the defectors included all PF branch officials, 19 PF Ward Chairpersons and their executives, 2021 PF Aspiring Counselors who included Mr Shimubanga, Mr Mendende, Mr John Muswili, Mr Bwalya, former DC Mr Matatiyo amongst others. She also added that all Chilolos, Headmen & Chiefs in Masaiti have all decided to support the UPND Government’s Policies and Ideologies.

The colourful defection event was attended by Provincial Vice Chairman for Politics Mr Chitambala and Provincial Vice Chairman for Administration Mr Kolala among other Provincial officials.

Masaiti District and Constituency Executives as well as Lumano Ward Officials were at hand to witness the defection event.

OF THE K65 MILLION , is Edgar Lungu’s immunity at stake?

When news broke that Austin Liato was found with K3 billion buried at his farm house, Zambians were greeted with pictures of the money. There was no doubt, the story was authentic.

When the Police announced yesterday that K65 million was found in new Kasama at the house of Faith Musonda, no pictures have been circulated showing the said money.

As hours pass, more information is emerging indicating that the Police have not even counted the money and do not know the exact figure. So where did they get the figure which was announced yesterday?

There is a problem here. First of all, the story by the Zambia Police does not make sense. Secondly, the purported letter authored by the lawyers of Ms. Faith Musondo doesn’t make sense either.

One clear thing about this issue is that, there is information gap. The more this gap exists the more speculation is rife.

However, there is a school of thought which seems to believe that this whole story is premeditated to achieve a certain goal. This school of thought believes that this issue is meant to justify the removal of immunity of the former head of state Edgar Lungu, by the Hakainde Hichilema administration.

It is justifiable to believe so after all there is enough information – however that the sources are unreliable – that the money belongs to the former head of state.

The coincidence of events from last week where the Anti-Corruption Commission (ACC) announced that they were investigating a former Councilor who is now a member of parliament for purchasing a bank worth K300 million seems to be calculatedly related to this new “scandal” of K65 million.
The logic is that, the more the public is fed with such “scandals” the more the people believe that there is something to probe about the previous administration.

The K300 million bank purchase story which was linked to the daughter of former President, Tasila Lungu, although she refuted it, has only somewhat made some people believe that there is something to investigate about the former head of state, his family and party as well as its associates.

An important coincidence about these two “scandals” is that in both cases, the Anti-Corruption Commission could not give enough details about the K300 million issue just as the Police have not provided clear information, yet, it is the family of the former President that has been thrown into a blanket of accusations.

Mkushi police arrest Mkushi MP for assault

POLICE in Mkushi on Friday have arrested Mkushi South Constituency PF member of parliament Davies Chisopa for malicious damage and assault.

According to Lusaka lawyer Anthony Kasolo, representing Sydney Chisanga, who has petitioned Chisopa’s election, the lawmaker was arrested at the High Court session.

Chisanga, the losing UPND candidate, had reported Chisopa for alleged assault and malicious damage to his vehicles ahead of the August 12 general elections.

“He fled from court because he has cases of assault and malicious damage to property; he ran away from the High Court sitting here for the petition. He damaged the cars for the candidate Mr Chisanga. He stepped out of court with a view of escaping but the kids (cadres) apprehended him,” said Kasolo.

Kasolo narrated that Chisopa who has been on the run following a docket that was opened at Mkushi Police appeared for the petition hearing but alert UPND cadres apprehended him and handed him to the police.

Chisopa has since been released on police bond pending court appearance.

And Chisanga said in an interview that he was not around when Chisopa was detained but however confirmed that he had been on the run following a police call out that was served regarding the offences that transpired during the August elections campaign.

“I was not around, was at the farm but yes I hear that he was arrested. Some time back during campaigns he was reported to the police for malicious damage and a call out was issued but he was on the run,” said Chisanga.

Efforts to get a comment from Chisopa failed as his mobile phone went unanswered.

Central Province Deputy Police Commissioner Donald Mwandila said Chisopa would appear in court on September 29.

He said Chisopa was released on police bond in line with the new dawn government’s trend of not keeping suspects in detention unnecessarily long.

“Yes, he was arrested and given bond, you know you are in the new dawn government, so we don’t want to be arresting people unnecessarily, delaying people in the cells for more than 48 hours, so we are just going by what is the trend now. We want to be following the law. The officers did a good job, I am in support of that. After they arrested him they did their job and knew that this is a bondable offence and made sure he is to appear in court and released him on bond,” said Mwandila.

Don’t over-promise, Fr Chikoya counsels HH

DON’T over promise, we are tired of excuses, Fr Emmanuel Chikoya warns President Hakainde Hichilema.

And Fr Chikoya, who is secretary general of the Council of Churches in Zambia (CCZ), says a dead civil society and a compromised church is a danger to government because there are no critical voices to provide checks and balances.

Meanwhile, Fr Chikoya has demanded the release of the gassing and arson attacks reports so that Zambians can have full disclosure as to who was really behind the acts.

In an interview, Fr Chikoya, who is also president of the Christian Churches Monitoring Group (CCMG), advised President Hichilema to show true leadership.

“Don’t over promise; we are tired of excuses that it was just political rhetoric. Walk the talk in terms of promises. Zambians’ expectations are very high,” Fr Chikoya said.

He said zero tolerance to corruption must be actualised adding that the wrath that cadres had vented at markets, bus stations and mobile money booths should be a thing of the past.

Fr Chikoya said it was high time the local authorities raised funds from these places.

“This boarders on the restoration of the rule of law and Constitutional reforms must be quickly undertaken so that we get the fundamentals right,” he said.

Fr Chikoya called on government to ensure that agriculture was made profitable so as to attract Zambians, especially the youths, to venture into the sector.

“The State should be State and let the church be the church. Don’t spend so much time trying to compromise or buying the clergy. We need to be an independent and vibrant church, we don’t need handouts,” he said.

“It does not help when the civil society and the church is gone. It is not victory for those that are ruling, it is actually a danger to the government because you do not have that critical voice to provide checks and balances.”

Fr Chikoya also advised the government to leave chiefs alone.

“We don’t want traditional leaders and Christians for this one or that one, we just want independence and very robust civil society organisations. I hope we won’t see surrogate organisations being hired, that won’t help. Prayers must be left in the hands of the church and not capturing by the military through Chaplins,” he said.

Fr Chikoya said there must be mutual respect and that the economy needed to be right.

He said no part of Zambia should be left out on development because of how they voted.

“Show a difference that you can provide leadership that is beyond petty politics and that you can liberate Zambians, faith based organisations and the media so that they thrive,” Fr Chikoya advised.

He said the police should be allowed to operate professionally.

Fr Chikoya said the gassing and arson reports should be made public.

“We really need to know who was behind these so that we don’t see a repeat. When the police work professionally, these must be nipped in the bud,” said Fr Chikoya.

TREAT public funds and treasury the way one treats or sees his mother in-law’s backside, NDC leader Josephs Akafumba has warned public officers.

He says President Hakainde Hichilema’s speech to the National Assembly was so rich unlike what the nation was treated to in the last regime.

Akafumba welcomed President Hichilema call for a fast-track court to deal with past, present and future corruption and economic crimes.

He warned all those who could have dipped their fingers into public coffers, even after they were cautioned all along, that since the money they stole did not belong to President Hichilema or the UPND Alliance administration they will be dealt with.

Akafumba said the creation of fast track courts to try all the plunderers, the economic saboteurs, had come at the right time.

“It has come at the right time so that we don’t clog the main line of the courts from subordinate to high and from High Court to wherever and to the Supreme Court,” he said. “That takes too long because it gives loopholes to these plunderers who were operating like a Mafia network to hide their money. Bring back our money that you stole is the slogan that the Zambians want. So the assurance by the President is a sit up call to all those who have hidden money elsewhere. It’s time they brought it back and owned up that really I dipped my fingers into public coffers.”

Akafumba warned his colleagues in the UPND Alliance administration and all those in Cabinet that what will happen to PF plunderers is something that may fall on them if they don’t heed President Hichilema’s word.

“They must at all times treat public funds and treasury the way one treats or sees his mother in-law, the backside of your mother in-law. You can only admire but cannot touch,” he said. “That’s what public funds are all about. But if you go deeper then you will be visited by the fast track courts. So this is warning to all of us. Public funds are for the public and must be respected the way you respect the backside of your mother-in-law. That’s exactly how you should treat public funds – admire but don’t touch.”

And Akafumba said President Hichilema’s address to the National Assembly spurred confidence not only to Zambians but the donor community as well.

He said even those that doubted President Hichilema when he was in opposition
sat back to applaud his delivery.

“To sum up President Hakainde Hichilema’s opening speech to Parliament, one would simply sit in the chair and say ‘Aba ndiye ba President, iyi ndiye speech (this one is the President, this is a speech)’ unlike what we were entertained to in the last seven years under he who should not be mentioned but people call him Edgar Lungu,” he said.

Akafumba noted that President Hichilema would not only be rhetoric but action-oriented.
He said President Hichikema’s call to a united Zambia following tribal disunity must be commended by all.

“You can see even the credibility in the speech of the President. It is inspiring even to the doubting Thomases, including those who thought President HH did not mean well for this country. I think his speech to Parliament must be the last nail on all those doubting Thomases; the man even when he was in opposition was being misunderstood because of his tribe but this time around people have come to realise that they missed the best President-ever but all is not lost. We now have him in State House and the speech which he delivered is not only inspiring to the people of Zambia, it is inspiring to the donor community,” said Akafumba.

Joe Biden cancels meeting with HH after Nalumango gay rights snub

The highly publicized meeting between US President Joe Biden and President Hakainde Hichilema has been cancelled after Vice President Mutale Nalumango told Parliament that Zambia will not entertain gay rights.

According to an earlier programme released by the Zambian Mission in Washington, President Hichilema was due to meet President Biden at the White House on Thursday but that meeting has now been called off.

On Saturday, Foreign Affairs and International Cooperation Minister Stanley Kakubo confirmed that President Hichilema will not meet President Biden but that he will only meet Vice President Kamala Harris on Tuesday in Washington.

But senior Diplomats at the Zambian Mission in Washington have revealed that the decision to call off the meeting between President Hichilema and President Biden came after Vice President Nalumango’s statement in Parliament on Friday.

The Diplomats added that by snubbing a highly publicized meeting with the Zambian Head of State, the White House wanted to send a clear message that it will take a strong stance against nations opposing gay rights.

“We understand that our colleagues are very upset with Vice President Nalumango’s answer in Parliament largely because since President Hichilema came in, indications from the Chargé d’Affaires David Young have been that Zambia is now ready to embrace gay rights with the coming in of the New Dawn but with that statement in Parliament, our colleagues here are very upset hence cancelling the meeting to send a signal to Lusaka,” the diplomat source revealed.

“Nigeria was recently threatened with financial and travel sanctions over the same issue of gay rights and we will not be too surprised if Zambia gets the same bashing from the US over Vice President Nalumango’s statement,” they said.

When answering a question from Kabushi Member of Parliament Bowman Lusambo on government position on gay rights, Mrs Nalumango categorically stated that the Hichilema administration will not accept gay rights.

Mr Lusambo wanted to know if there was a change in Zambia’s stance on gay rights following the election of President Hichilema.

“When it comes to government position, we respond to official statements that we have made. Social media can say what they want, that is not our position. We have to find it as a fact for us to start finding time on that. I will not come here and start discussing the American President’s statement. The issue of how other nations handle the issues of rights is not exactly how we do it,” Mrs Nalumango said.

She added, “It is very sad that members of this August House know we are members of the international community and within the international community, there is sovereignty of each country and each country has its own laws, rules, regulation, traditions and culture.”

“For these Honourable Members to start thinking because we are friends with one particular nation or we are members of one organization then we pick everything, aint we members of SADC, I will not complete because the Honourable Member who is asking understands exactly what I mean. Nations within the SADC have different positions on gay rights, different members of UN have different positions on gay rights, so is the AU.”

Mrs Nalumango reiterated that Zambia is a Christian Nation and that the declaration will remain on the country’s statutes.

“We are a Christian Nation and that remains on the books. If this government at any one time wants gay rights, you will be the first to know but we are a Christian Nation, we continue to be who we are,” Mrs Nalumango said.-LT

PRESS STATEMENT BY THE CHIEF GOVERNMENT SPOKESPERSON ON THE DECISIONS MADE BY CABINET AT ITS 1ST (SPECIAL) CABINET MEETING HELD ON FRIDAY, 17TH SEPTEMBER, 2021 AT 14:30 HOURS, AT STATE HOUSE

The President of the Republic of Zambia, Mr. Hakainde Hichilema, on Friday, 17th September, 2021, chaired his first (Special) Cabinet Meeting at State House to deliberate on the Budget Policy Concept Paper on the 2022-2024 Medium Term Expenditure Framework (MTEF) and the 2022 National Budget.

During the Meeting, Cabinet approved the Concept Paper which gives the strategic policy direction, macro-economic and fiscal objectives as well as targets for the 2022-2024 MTEF and the 2022 National Budget as outlined in the official opening address of the First Session of the 13th National Assembly by the President.

Cabinet approved the 2022 Budget framework which will focus on restoring economic growth and safeguarding livelihoods for a prosperous and equitable Zambia through Economic Transformation and Job Creation, Human and Social Development, Environmental Sustainability and Good Governance Environment, and that all policies and interventions shall be in line with the broader strategic focus areas to be articulated in the 8th National Development Plan.

Under Macroeconomic Framework, Cabinet approved that the MTEF and the 2022 Budget should aim to attain growth in GDP, reduce and sustain inflation, raise international reserves, increase domestic revenue, reduce the fiscal deficit, significantly dismantle domestic arrears and curtail accumulation, reduce the pace of debt accumulation and ensure sustainability, and overall, accelerate the diversification of the economy.

The emphasis is to grow the economy in order to create more jobs and generate wealth as key to turning around the economy.

Cabinet also agreed that under the Fiscal Framework, Government shall focus on revenue mobilisation and broadening of the tax base, removing distortions, streamlining tax incentives and rationalizing concessions.

Cabinet also approved to enhance public expenditure rationalisation, prudence and discipline through the strengthening of public finance laws and regulations that ensure credible, transparent and accountable spending decisions, safeguard public expenditure on pro-poor programmes by enhancing budgetary spending on sectors such as education, health and social protection, including addressing the plight of pensioners.

With regard to Revenue Measures, Cabinet approved that the budget implementation should involve improving efficiency in the collection of fees and fines by ensuring full roll-out of the Government Service Bus (GSB) digital platform, and exploiting the Information Technology advancements in order to modernise and strengthen the capacity of revenue administration thereby easing both administrative and compliance costs.

In conclusion, Cabinet approved that the Minister of Finance and National Planning, should engage with various stakeholders in drafting the 2022 National Budget in order to ensure that the Budget responds to the needs of the Zambian people and should also be based on the vision of the New Dawn administration, putting the Zambian people first.

CASH WITHDRAWAL RESTRICTED AND THE 65million Kwacha discovered

Just after the elections, banks saw unprecedented over the counter withdrawal of cash. Towards the end of august, the country began experiencing a shortage of cash on market which affected mostly the informal sector who trade in cash transaction. The government responded by putting restrictions on over the counter withdrawals. The government also encouraged the general public to use electronic payment systems to reduce the pressure on banks. Banks initiated measures which included a 24hrs notice to be given to a bank for cash withdrawals. Account holders wishing to withdrawal cash were also required to explain the intended use of the cash.

We believe that some criminal elements, sensing a risk that their accounts would be frozen were behind the unprecedented cash withdrawals. We are not surprised that Faith Musonda was holding 65 billion kwacha in her house. Faith is a business women with several bank accounts in Zambia and abroad. Her lawyers have pointed that the money came from the Sale of emeralds. We believe that their transactions should have gone through the bank with payments immediately deposited. However, if their money wasn’t clean, they were likely to pay her in cash. Her receiving cash suspected to have been a proceeds of crime makes her an accomplish. I am not a lawyer, but I believe that selling a property to a person whose source of income cannot be explained is a crime. In the Uk, it’s a crime to sale a property to someone whose sources of funds are deemed to be proceeds of crime.

There is no one who can pay for emerald in cash with more than 1m K. There is no doubt that financial criminal activities were a hallmark of the PF. The unfortunate part of it is that we do not have well qualified financial crime prosecuting lawyers. This case would be lost just like that of Austin Liato who had k2b.

We are of the opinion that it will be in the interest of the public finances to let her come back and use the money to pump it back into the economy. Starting a case which we cannot win will simply be a waste of our resources. In the end, only lawyers will benefit. We reiterate that some of these cases requires us to reach a deal with these suspected perpetrators of crime. USA frequently reachers such deals. The USA government makes around 20b $ a year in such deals.

FORMER Mansa Mayoral Aspiring candidate for the Patriotic Front (PF) Nsama Musonda Kearns has observed that the former Ruling Patriotic Front Party has turned out to be a nightmare on many Zambians.

In a post on Dynamic Analysis Zambia (DAZ) WhatsApp group this morning, Mrs. Kearns likened the PF to food which has left a bad taste in the mouth.

She said the Patriotic Front (PF) compromised the characters of innocent people who aligned themselves with them.

And Mrs. Kearns said the PF should on moral grounds cease to exist to allow the police to investigate every suspicious character and make conclusions before Zambians can hear the word PF again.

Good Morning DAZ and Happy Sunday, the Former Ruling Patriotic Front Party has turned out to be a nightmare on many Zambians especially the 1.8 million that gave our former leaders a benefit of doubt.

They have left a bad taste in the mouth and compromised the characters of innocent people who aligned themselves with them.

What’s most surprising and painful is that there are people who are still thinking of reviving or awakening this nightmare by thinking of going to a convention.

At this stage, this Party should on moral grounds cease to exist to allow the police to investigate every suspicious character and make conclusions before we even hear the word PF again.

I would be adding salt to injury if I start citing cases that need governments intervention but went unanswered such payment for retirees who even camped at ministry of justice, former Mansa Battery workers, the most vulnerable people of our society who depend on social cash transfer, children on the streets

All these would have had better lives had people not decided to stack away money.

As if not enough we are supplied rotten medicines, like we don’t care who dies, our forests got vandalised, our wildlife displaced, our peace disturbed.

Those who tried to mention these things were victimized, harassed and headed for jail.

It was either you support them or they turn your life into he’ll and labelled you a spy for the opposition.

Then today someone still wants to remind us of this nightmare by mentioning the same parry that turned us into idiots, zombies, laughing stock! PF my foot! Close this terrorist group already, lift the immunity and take aware the diplomatic status of these terrorists who paraded as leaders and investigate them thoroughly.

They cannot keep getting tax payers money when the tax payers survived by the grace of God.

Fix it Bally, Faka pressure. These thieves deserve no mercy of anyone.

Why Edgar Lungu must be stripped of immunity

Quiet lately, there’s been a crescendo of calls to have Edgar Lungu stripped of his immunity so that he can have his own day in court to account for some of his deeds or misdeeds whilst in office as Republican President.

There are still a myriad of questions that beg express answers – the gassing fiasco, burning down of markets, procurement of fire tenders and ambulances at inflated prices, contracting construction of roads at exaggerated prices, the mukula tree scandal, 48 miracle houses, theft of millions of dollars at KCM, ransacking of our GOLD at Kasenseli mine, failure to hand over power to the speaker, hounding out people from civil service in so called national interest…..of course the list goes on and on.

If the investigative wings were to start sniffing around today for any transgressions of those in the previous administration, we wouldn’t be shocked if the trail of investigations pointed to the previous occupant of Plot # 1 Independence Avenue since the buck stopped at him as former President and commander of armed forces! How is Lungu expected to be questioned when he’s still clothed in the bullet proof of immunity from public prosecution?

Lungu mustn’t be allowed to escape being probed for any atrocities he committed while in office to serve as a warning to the incumbent President and indeed those who are yet to come. In case we’ve forgotten, Lungu stepped up on a podium at Heroes Stadium and proceeded to raise the Bible aloft and solemnly swore to protect and defend the constitution of the Republic of Zambia. If overwhelming evidence exists that he somehow breached the constitution in any ways, he must be held accountable, pronto!

One of the pitfalls we keep on suffering as a nation, is our inherent inability to make our former leaders account for their misconduct whilst in office. The danger of such failure is that we seem to give tacit approval to politicians, be it Presidents and ministers alike, to dip their magnetic hands into our coffers knowing that their SINS would easily be forgiven once booted-out of office in the spirit of national reconciliation. What nonsense!

When MMD lost power to PF for instance, some of the ministers notorious for ‘nchekelemo’ in the previous regime crept into PF before the dragnet could set in. They were duly awarded with lofty positions as ministers! Those who had active cases before the courts like ‘balya bamayo’ even had their court cases expunged from the roll.

Since it is part of their DNA, we have no doubt these characters had little trouble continuing on the same trajectory of looting our treasury. What do you make of their magical accumulation of wealth when the economy was virtually in a coma – awe-inspiring double-storied mansions here and there, impressive fleets of vehicles in their backyards and putting their kids in business class to attend elite schools and universities abroad!

Some of them even had the audacity to mock the Kaunda children for remaining poor when actually their father was Republican President. They went on to brag that a couple of thousands of Kwachas was nothing to them, but pocket money which they easily gifted their children without any qualms about it.

Now that PF has lost power to UPND, we hear they are plotting to sneak into the ruling party when no one is looking……well, if they haven’t already done so! Here’s our warning to them: please, stay right where you are and wait for DEC, ACC or the police to come knocking on your doors!

As for ba Edgar Lungu, there are no two ways about it…….his immunity must be lifted with lightning speed so that he can account for his conduct in office or lack of it thereof. Chapwa!

It is obvious that President Edgar Lungu and his cronies turned this country into Katondo Street.

His ministers and close associates knew his weakness – ka money, and they ransacked this country and paid royalty for his mfwiti mfwiti cover. He covered them well and looked the other way. It can not be mfwiti mfwiti unless you are are part of the scheme of things. The evidence was right before your eyes but you chose patronage.

It is for this reason that i say non of his cronies should be anywhere near leadership in PF. They have an option to resign or be forced out, which we can actualize because we have the industry to do so.

We shall indeed bounce back as a united Patriotic Front meeting the aspiration of the millennials, our mothers and the old alike but first we must cleanse ourselves of the undesirables.

Like Levy Patrick Mwanawasa, we say this to you. If you have elected thieves to represent you, we can’t do anything about it but they will not be part of leadership in the new, cleansed Patriotic Front.

Do not mistaken our criticism for an exit from the PF, No! We are stuck with PF as one of the few voices of reason. We have built a character over the years which must remain consistent as we have followers from the 2.8 million who ushered in HH and the UPND. Our consistuency is Zambia.

Our support for Edgar Lungu was more spiritual than physical. It was never about the outward appearance but something hidden. In any case, what we perceive as sin is not sin to God. And before you shot at me know this. God can even use a donkey to carry out his will.

PF lost the election more than a year ago and we are on record calling for radical changes and the firing of the SG among others.

Patriotic Front must survive for democracy’s sake. We are not short of young leaders to carry the PF’s vision in the aquarian age.

We are equal to the task presented in a time, times and a half.

Pf still remains the alternative government under new and young leadership.

Our people can believe again.

3 Church mother bodies were against creation of religious ministry – Bishop Alfred Kalembo

THE Church needs to continue to minister to the spiritual, physical and social needs of the people they serve, says Bishop Alfred Kalembo.

And Bishop Kalembo says the government must allow the Church to regain its lost place of organising national events by the Church mother bodies working with the office of the Secretary to the Cabinet.

Bishop Kalembo who is the current presiding Bishop for Pilgrim Wesleyan Church said he had followed the disbanded ministry of national guidance and religious affairs discussion.

“First of all, the freedom of expression I sense in this discussion confirms the UPND government’s commitment and promotion of one of the fundamental human rights which is that of freedom of expression in our country. Therefore, this discussion is proving that people are free to express their views,” he said. “In the same spirit I would like to add my voice to this discussion first as a former president of the Council of Churches in Zambia (CCZ) when the said ministry was proposed and introduced and as a presiding Bishop of the Pilgrim Wesleyan Church, which has been working with government since 1930 through our church schools, rural health centres, hospital, orphanage and community development. And I also believe that the current government supports the declaration of Zambia as a Christian nation.”

He said the Church had always worked with the government during colonial days and after independence.

Bishop Kalembo said political leaders worked with and respected the prophetic voice of the Church.

“There was no ministry created then specifically for national guidance and religious affairs. Our founding father, the late Dr Kenneth David Kaunda tried to introduce Scientific Socialism, but the three Church mother bodies provided counsel against it and the government listened to the voice of the Church. At the beginning of the MMD government the religious desk was created but that didn’t do much and was done away with,” he said. “In 2016, the PF government sought the support of the three Church mother bodies in the creation of the ministry of national guidance and religious. I served as president of the Council of Churches in Zambia, Bishop Paul Mususu was chair of The Evangelical Fellowship of Zambia (EFZ) and Archbishop Telephore Mpundu was president of Zambia Conference of the Catholic Bishops (ZCCB). The three church mother bodies clearly, very uncompromisingly advised the government not to create the said ministry.”

He said the three Church mother bodies felt there was no need for it because the Church was already working with the government in various line ministries such as education, health, community development.

“I know some of you know the primary schools, teacher training colleges, nursing schools built by churches and Church mother bodies in partnership with the government but for those who do not know let me mention just a few namely: Njase Girls Secondary, Choma Secondary School, Canicius Secondary, Chasa Secondary, Mukinge Girls Secondary, David Livingstone College of Education, Malcom Moffat College of Education, Mongu Teachers College, Mwami College of Nursing, Chikankata Secondary and College of Nursing, just to mention a few. Churches Health Association of Zambia which works very well with the government is self- explanatory.”

Bishop Kalembo said unfortunately, the PF government did not listen to the Church and went ahead and created the ministry.

He said instead of working with the Church bodies, the government started engaging churches who were members of the church mother bodies and those who did not belong to any mother bodies.

“I remember in an effort to ensure that a ministry is established, a meeting was called at Cabinet Office in the Vice-President’s office where we were all called as leaders. The government had invited individual church leaders as well as the three Church mothers. The three Church mother bodies still maintained their position of not supporting the creation of the Ministry of National Guidance and Religious Affairs,” he narrated. “However, in that meeting it was indicated that the rest of the church had agreed but that was not so. However, we know that the government continued and went ahead to establish this ministry.”

Bishop Kalembo said it was clear after that meeting that the government had managed to divide the church because some church leaders strongly supported the creation of the ministry while the three Church mother bodies and some churches did not support the move.

He said some of the things that resulted were that the functions that were always organised by the Church were removed from it.

“For example, independence celebrations before, the Cabinet and the three Church mother bodies worked on the programme of celebrating independence. National days of prayer for the nation they were organised by the three Church mother bodies. However, the three Church mother bodies stood together and there it is on record that they did not support the creation of the ministry but obliged once it became law,” he said. “As a nation, we saw a paradox. There was increase in the construction of Casinos in the history of Zambia. Alcohol consumption increased, especially among our young people. In compounds like Kanyama where I minister, we saw the emerging of drinking and rough young people called ‘junkies’.”

Bishop Kalembo said arising from the historical perspectives, the Church must be involved in meeting the social needs of the people they serve and not only look on the spiritual side of the people.

“This is also known as the integral mission. We need to meet the social, emotional, economic needs of the people. This is the way the Church will be a true light and salt of the world as said by Jesus in Matthew 5:13-14. Be involved in those areas that meet the needs of people practically. In the gospel Jesus mentions many ways His followers…The teaching ministry – be involved in setting up schools, use your connections to build schools in Zambia and use your connections to be involved in meeting the health needs of our people,” he said. “When the Church is involved in meeting the educational and health needs of the Zambian citizens, they will be able to relate to the government ministries that are involved in education and health. In Matthew 25:34-46, Jesus outlines a number of his expectations of the Church. He commended those who were involved in the social needs of the people and condemned those who were not. His invitation was, ‘Come, you who are blessed by my Father; take your inheritance, the kingdom prepared for you since the creation of the world’.”

Bishop Kalembo said the Church must be involved in supplementing the government in food production.

He said the Church must supplement the government’s effort in the provision of safe water by drilling boreholes.

Bishop Kalembo said the Church should be involved manufacturing and trade to have the means to provide clothing for the need in society.

“Visiting those who are in prison (Ministry of Justice). He said to his followers. The Scriptures contains all the ministries that are outlined by the government. The Church, in our provincial capitals must come together and invite stakeholders including the government for such meetings like prayer breakfasts. The Church must be the convener and one in charge to pray for the various needs of the nation,” said Bishop Kalembo. “The government must allow the Church to regain its lost place of organising national events by Church mother bodies working the office of the Secretary to the Cabinet.”

FLAMBOYANT LUSAKA PREACHER, PASTOR CHOOLWE MUDENDA ALLEDGEDLY INVOLVED IN SEX SCANDALS!

Senior Pastor of Gospel Envoys Pastor Choolwe Mudenda is embroid in sexual scandals that have rocked social media in the past 72 hours.

Pastor Choolwe who is a protege of Pastor Chris Oyokhilomo is built his ministry using Pastor Chris template.

Mercy Song was first to begin this conversation that has lead to more victims of sexual abuse begin to open up. She wrote,

“It is not in my place or authority to say this. But it is a concern, what to do if you find out that your senior Pastor and his junior pastors have a tendency of sexually abusing girls in the Church and having sexual relationships with them?”

Notice that Mercy didn’t mention the name of the Church, or name of the Pastor(s) involved but that didn’t stop the church from ordering members who commented on the post to delete their Comments. The post was reported to Facebook and Mercy Song was blocked on Facebook for 24 hours.

Mercy asks the question; what do you do when your senior Pastor is sexually abusing ladies together with his junior Pastors.

It raises the question; to whom are our Papas accountable to? Pastor Choolwe is the Founder, CEO, and alpha and Omega of Gospel Envoys. You can’t report him to himself.

The difficult with the Churches today is that they don’t have structures within the local church that has authority on matters of disciplining the pastor.

Even in situations where there is a church counsel, the members of the Church counsel are actually spiritual sons and daughters of Pastor Choolwe. Which son or daughter in these churches have the courage to discipline their Pastor when he is in doctrinal error or moral failure?

This gentleman wrote to me;

“I am glad people are now coming out about Gospel Envoys. I left that church in 2016 and the man ensured all members unfriended me, even those that I took to his church. I held a very senior position but tables turned when I started calling out the wrongs. In case you need more evidence, I still have a lot”

Now this is a typical example of Paparism. Members including the ‘leaders’ cannot challenge anything wrong in the institution.

Paparism demands absolute, unquestionable obedience to the set man of the house.

And if you dare question any moral or ethical issues they will not only show you the door but isolate you.

Some one then says, “Lawrence is there another way of dealing with this instead of using social media? No there isn’t!

Sources close to Bread of Life informed me in confidence that Pastor Choolwe Mudenda at one point was invited as a key note speaker at a conference by Rev. Oscar Mumba.

But certain members of the clergy that were preview to Pastor Choolwe sexual shinaniganis, protested against the move.

Though flyers were posted already with Pastor Choolwe, he was unceremoniously dropped as a speaker at that conference.

The majority of the people talking to us are not even shocked by the revelation, instead they confirm that this behaviour defines Pastor Choolwe even in his days at the Copperbelt university.

These affluent Papas know how to bribe our fathers in the faith with gifts and planting seeds they call it.

When a scandal like this happens they quickly lean towards respected fathers in faith in the city or country or even abroad.

When they are publicly seen in the presence of respected men, the the gullible Christians will trust them by association and disregard the scandals around them.

Why am I getting involved in this particular issue. Honestly I don’t care how many extra-marital sexual relationships he has.

I don’t care if he pays rent, and bought a car for his mistress and supports the mistress well enough.

Because that borders on consential adult sex relationship and it is not a criminal issue in the laws of Zambia.

He is accused of demanding oral sex to be performed on him and wants anal sex. He is has a deprived mind and need rehabilitation.

However, when there are women who were coerced into sex by virtue of his ministry authority and position or by use of spiritual manipulation forced his hands on the opposite sex that becomes the issue of injustice in church.

We must distinguish sin from crime. When a sister in the Lord is sexually violated, this is not a church discipline matter, it’s a criminal matter. We can’t call the victims of sexual abuse in churches in the corner and ask them to forgive the Man of God.

By so doing we as fellow Pastors have become enablers of sexual violence in Church. Yes some sins are not crime, some crimes are sins we ought to know at what point does the church report the matter to relevant authorities.

We have seen this repeat itself; when sexual abuse happens within the boundaries of a church, the members in the church run to the corner of the most powerful man in the church to support and cover his nakedness. While the victim is left alone, isolated, stigmatized, demonized and even blamed for leading the man of God into sex. She the victim becomes the Jezebel that is out to destroy the anointed spiritual father.

Apart from the testimonies of ladies opening up that #ItHappened2Me2 is a sad story that lead to death.

This young woman was pregnant by Pastor Choolwe. It is alleged that Mamfundisi Mrs. Choolwe forced this young lady to abort in order to protect her husband and the ministry. After the abortion this lady consequently died! This is how far these churches go to protect their infidelities. Sadly the Pastor’s wives are indoctrinated to believe it is the duty of the wife to cover the infidelities of the husband.

We need answers to what happened to that girl. Perhaps even an equest into her death. But perhaps she can rest, but those who can’t rest are those who are dealing with the trauma of church rape, the fear of the curses from the man of God, and they fear to speak out.

The first thing we do in Gender based Violence is to first believer the victim. Then find the victim help and then seek for justice. Church abuse is the abuse that go unpunished. The perpetrators know too well they are untouchable. The case of Pastor Timothy Omotoso revealed how senior police officers bowed down before the sex pest Pastor Omotoso. These guys of the cream of our society, intellectuals, lawyers, Prosecutors and Journalist. Haven’t you wondered why the media houses in Zambia are mute? Most of them are captured maybe inside Gospel Envoys or by association.

Do our fathers in the faith know that Pastor Choolwe’s weakness is sexual immorality? Oh yes definitely they do. So why do they invite him? Because these cliques are financially beneficial. It’s like a stokvel or ichilimba.

Pastor A invites Pastor C to preach. Pastor A tells his leaders “we need to bless this man of God with K50,000”. Pastor C goes back to his house with a tax free cool 50G! Now it’s the turn for A to receive, Pastor C tell his church I was blessed in Pastor A’s church with K50,000 we must out-give that Church. Pastor A now goes home with K65,000 tax free. The reasons our fathers don’t speak out against these things it’s because they are receipients of dirty bribes.

Most of the people are saying Pastor Choolwe and Gospel Envoys is a cult. I have a little problem with the cult language. When we say it’s a cult who raped the girl, we are actually saying the pastor himself is a victim under the influence of cultism. We need to use the perpetrators name as a subject in sexual abuse cases.

The battle lines are now drawn. We are very aware that there will be a fight-back and also back door negotiations that involves paying off victims to buy their silence, but also the usual threats and intimidations.

We also know that they will try to report this post, but those with data can just share the story from my blog site.

We encourage those who are silenced, scared of their man of God anywhere in Zambia to COME OUT and say; IT HAPPENED TO ME TOO!

DETAILED ANALYSIS: SOMEONE POWERFUL AUTHORISED WITHDRAWAL OF K65M FOUND IN NEW KASAMA – DR NEVERS MUMBA

POLICE in Lusaka have recovered K65,330,000 cash and over US$57,000 suspected to have been stolen or unlawfully obtained from a house in Lusaka’s new Kasama area belonging to Faith Musonda.

And MMD president Nevers Mumba says someone powerful enough must have authorised the withdrawal of K65,330,000.

In a statement, Saturday, Police Spokesperson Esther Katongo said the Central Bank was engaged and counted the money in the presence of caretakers as the alleged owner, Musonda, was reported to have run away from the house.

She said a further search was conducted and the team discovered a safe containing $57,350 Dollars which was later seized and handed over to Bank of Zambia for safe keeping and further investigations.

“Police in Lusaka have recovered K65,330,000 suspected to have been stolen or unlawfully obtained from a house in Lusaka’s new Kasama area. The money was recovered in an operation conducted yesterday 17th September, 2021 after a tip off from members of the public. During the search, police discovered 30 travelling bags containing Zambian Kwacha notes. Bank of Zambia was engaged and counted the money in the presence of caretakers as the alleged owner Faith Musonda is reported to have run away from the house. A further search was conducted and the team discovered a safe containing USD57, 350 which was later seized and handed over to Bank of Zambia for safe keeping and further investigations. A manhunt for the suspect has been launched,” said Katongo.

And in an interview, Mumba said security wings should up their game because Musonda’s house cannot be the only location where money has been hidden.

“I have urged the security wings of government to up their game by employing speed in the manner in which they handle the issue of the fight against corruption. Any delay and any loss of a day or week will give space to the criminals to hide, bury or externalize the money and destroy evidence. So to see that the institutions of government have recovered over K65 million and 57, 000 US Dollars, it is gratifying except we must know that this is a warning shot to just remind the investigative wings and the Zambian people that there is more to where that came from. That location for Faith Musonda cannot be the only location where money has been hidden,” Mumba said.

“It is a fact that homes and farms are now being used to hide vehicles, materials. Homes are also being used to store money like we have witnessed today. This is happening every day and this is not a simple corporation and I think that the ACC, DEC, police and all those that are supposed to protect the resources of the Zambian people must be more vigilant to be aware that as we speak, these things are happening. We also want to assure the Zambian people that this fight cannot be won without their involvement. Any unusual thing they see in their neighbour’s house, they should report it to the police otherwise, and they become accomplices to that kind of theft and corrupt behaviour.

Mumba asked law enforcement agencies to investigate who may have authorised the withdrawal of such huge sums of money.

“We thank the agencies for doing what they have done, but we want them to know that to get that kind of money in cash, it means there are more powerful people involved because you cannot get that cash across the bank desk. That has to be drawn from higher places such as big banks and hopefully not Bank of Zambia. Somebody big enough must have authorized that money to come off and out of the system. ACC needs to find out on our behalf who that is,” he said.

“The punishment for such should be stern and there should be no lukewarmness in fighting this type of corruption. This is not just corruption, these are people who hate Zambia and would like to see Zambians suffer. They would want to see the multiplication of poverty and yet they themselves are eating and living like kings around the world. This is an opportunity to send a strong message to anyone including those who have come in government that we are not in government for this but we are in government in order to facilitate for the wellbeing of an ordinary Zambian.”

Mumba said Zambians needed to be alert and report any suspicious activities, adding that keeping such kinds of money was not just greed but “demonic”.

“This thing of going into government to steal really stinks and we should find a way to stop it. You cannot stop it by sending these light sentences like you go for three to 10 years. These people should be removed from society and set aside in another place. You cannot take K65 million when retirees have not been paid, when people are dying because they do not have simple medicines in hospitals and then you have it in boxes to consume it upon what?

That is not greed anymore but that is demonic. What are you going to do with that kind of money alone and it is not yours?? And if it is yours how did you get it? So I think ACC, DEC, the police and all the agencies responsible for preserving and protecting the resources of the Zambian people must demonstrate that they are equal to the task.

We are also aware that they cannot do it alone. Every Zambian needs to be alert and ensure that we provide as much information to these agencies as possible. I am confirming that we are able to win this fight if all of us put our hands on deck,” said Mumba.

SOME years ago when she could not get the job she desired at the Zambia National Broadcasting Corporation (ZNBC), Faith Musonda packed her bags and headed to South Africa.

She only had the physical address of the radio station where she wanted to work, and a lot of determination. But then, this is what has always driven Faith – determination.

“When I arrived in South Africa, I went to where TransAfrica Radio offices are. When I told them why I was there and what I wanted, the man I found laughed at me in disbelief,” says Faith.

But Faith was not one to back off or stand down easily. She got the job.
Before she went to South Africa, Faith worked as a volunteer-broadcaster straight from school.
“I wanted to be a reporter but back then, being a TV presenter was just an entry point and was not a respectable position,” says Faith, who now runs her own TV station.

Faith was told to wait until an opportunity opened up, but she decided to leave and follow her dream into uncharted waters.

Born and raised in Northmead, Lusaka, Faith is one of six siblings. Her father was a Sunday school teacher, cell-group leader, while her mother was involved in the Christian women’s ministry.

She attributes her strong character and perseverance to her strong Christian background.
“My siblings and I are very hardworking because of how we were raised. We saw our mother work hard after our father died. We saw how we had to depend on God because there was nothing or anybody else. So trusting God and believing He can make the impossible happen was a strong reality for me,” says Faith.

Her career in broadcasting and marketing now spans 18 years.
Faith started her primary education at Nkwazi Primary School before attending at St Mary’s Secondary School, where she completed her grade 12.
Then she became a volunteer for ZNBC Radio 2.
She says her biggest inspiration in broadcasting was her own uncle and well-known broadcaster, Fred Chunga.

“I have always wanted to be a broadcaster,” says Faith, who started horning her broadcasting skills while still studying at Evelyn Hone College.

The she had a small stint with Mondo Music, a record label owned by Chisha Folotiya.
But she still continued as a volunteer broadcaster at ZNBC.
“I volunteered at ZNBC with Nabwalya Bwalya every weekend for four years until I got an internship,” she says.

Then she also worked for Choice FM radio, before moving to 5 FM radio, but she did a full circle and found herself at ZNBC as a reporter during her internship.
After her internship, Faith applied for a job at ZNBC but was instead employed under programmes as a presenter, a move that prompted her to relocate to South Africa.
“My knowledge about TransAfrica Radio was through my time at Choice FM radio. I worked there for a while with Chilu Lemba showing me the ropes about media in South Africa,” she says.
After that, she joined Southern Sun Pretoria where she worked in Guest Relations for two years.
Her biggest break in South Africa was when she joined the South African Broadcasting Corporation (SABC) as a TV news anchor and producer, making her the second Zambian to work there after Maureen Nkandu.

“I later decided to return to Zambia because they needed a South African for that position and I wanted to come back to further my studies. Back in Lusaka, I started pursuing my bachelors of science in communication,” she says.

The mother of two later joined Airtel (then Zain) as a presenter for the Abaleya Show with popular comedian Bob Nkosha on ZNBC TV and then another show called Beyond Limits.
Somehow, she found herself at ZNBC, but was never satisfied with her pay, so she decided to start a laundry business, catering to busy young career women in her neighbourhood.
“I went back to ZNBC and started as a TV presenter, the same thing I ran away from. I was later made producer with TV2. While there, I started Debate Time and Faith Gospel Hour on Sundays,” she says.

She was later promoted to commercial producer under the marketing department after they commercialised Debate Time programme. She rose through the ranks to become head of channel for TV2 before she was moved back to marketing as creative and promotions manager until she eventually left ZNBC.

While at ZNBC, Faith started the One Voice Choir competition and Junior President.
“I enjoyed doing projects that impacted people’s lives,” she says. “My belief in media communication is that what we do ultimately must improve someone’s life practically.”
But Faith had her eyes set on something of her own; she started working on the licencing of a TV station.
One of Faith’s inspiration was media morgue Strive Masiyiwa.
When she left ZNBC, she joined Econet media as public relations and branding marketing manager.

She says the move to leave ZNBC was so she could go into another competitive environment because that was pay TV in order to learn the business.
The death of one of her closest friends, Faith Kandaba, also inspired into establishing her own TV station, Life TV.

“I left Econet to set up my own TV station, Life TV, on Topstar channel 112. Life TV started as a ministry through sermons from international preachers and gospel music then we commercialised it to ensure its sustainability. We currently have 20 members of staff,” she says.
Faith, who was recently appointed as Zambia Development Agency (ZDA) communications and public relations manager, credits a lot of people who have shaped her professionally.

She says working with Standard Chartered Bank head of corporate affairs Christine Matambo helped build her public profile, professional persona and taught her professional etiquette and networking at senior management level.

Other people who have had a big influence on her include Frank Mutubila, the late Mateyo Phiri, late Ben Kangwa and Caristo Chitamfya.

“The person who has groomed me in my career is Kunda Mando. She literally held me by the hand and introduced me to the world of broadcasting straight out of school. All these experiences have built me up to this place where I saw a scripture come alive that ‘Your gift will bring you before kings’,” she says with a smile.

Quoting her favourite scripture in the Bible that “No eye has seen, no ear has heard and no mind has perceived what God has in store for you”, she believes that how far a person can go in life is not close to the plans God has in store for each person.

To crown her career, Faith is the recipient of the 2017 CO Global Africa’s Most influential woman in media for Southern Africa.

The award under South African Leadership Organisation identifies women who have excelled in their field or career in different countries in Africa.
“The experiences in my life, especially when growing, up taught me to be humble, accountable, and taught me that the little things count in life. It has taught me that there is no substitution for hard work,” she says.

Firstly, our client wishes to clarify on your baseless assertion that she is currently on the run. She informs us that on the 9 of September, 2021, she left Zambia for business meetings in USA with her business partners who currently have business portfolios in emerald and diamonds mine in Zambia. For avoidance of doubt, kindly verify with South African Airlines ticket 22 under passport ZXY 20137853. She further informs us that she is scheduled to return to Zambia on 13 October, 2021 .

Secondly, the money in question is ZMW 65 330 000 and USD 57 350 are monies that were legitimately obtained as proceeds from the sale of minerals through the Mines Chamber of Commerce. Kindly note that our client did participate in the auction of emerald held at Mulungushi were through her partners she secured emeralds valued at USD 6 million. All the statutory fees,royalties and taxes were duly paid and transactions recorded by Bank of Zambia.
The money found in the house was meant to be deposited on Monday to which the informant was well aware and took advantage by reporting the police due to the dispute he had with our client. In sum, the money is not tainted with any illegallities.

By reason of the foregoing, we have strict instructions to demand as we do the return of the money within 48 hours to be paid to our firm.

In an event that you fail to adhere to the demand setforth above, our client and her partners shall commence court process in international court and as an interim measure, all assets belonging to the Republic of Zambia situated in foreign countries will subject of a freezing order to secure their interests.

HH Should Be Judged Properly By His 2022 Budget – Siabutuba

YOUTH Development Organisation executive director Partner Siabutuba says the 2022 national budget is the only key tool Zambians can use to assess President Hakainde Hichilema’s commitment towards fulfilling his campaign promises.

In an interview, Siabutuba said there was a tendency by governments to make very good pronouncements which were not backed by resource allocation, thereby rendering them mere rhetoric.

“Key to his intention is the 2022 national budget and that is what we are looking to. Because there is a tendency by governments to make very good pronouncements; very well intended plans to a point where very well-established policy proposes [are] put together but at the point of public resource allocation, this is where most of them have gotten it wrong,” he said.

Siabutuba said the existing good political will of the UPND administration required prioritisation in terms of financial disbursement or allocation.

He said without financial commitment to all programmes, the government’s intentions would amount to nothing.

“We would like to see this government commit not only on policy position but should go as far as ensuring that money is made available to these intentions, then they can yield the anticipated results,” Siabutuba said. “We have noted that the President has established a very strong foundation going into his leadership and his first five-year term. He seems to have stuck to his campaign promises by knocking down some of the key campaign promises. For example, he has exhibited or demonstrated his fight against corruption. He has gone further to propose legal framework like establishing fast-track courts to deal with corruption and economic crimes. That alone is going to cure corruption cancer that we have had in the country for a long time, undermining our economic progress that we had gained in few years over a long time but had lost it in few years that we had PF in government.”

And Siabutuba reminded President Hichilema that despite his good pronouncements, citizens were watching him.

He warned the Head of State that some of his officials could also frustrate him.

“He is also doing this when several binoculars have been set up by the likes of Raphael Nakacinda, Sean Tembo and others. He should also be alive to the fact that whilst he is doing all this, there are a lot of factors that can potentially frustrate his efforts. So he needs to be steadfast and remain focused,” Siabutuba added. “In the previous governments, ministers had the tendency of frustrating good government intentions by way of exhibiting their incapacity to deliver. So what the President’s task right now should be is to ensure he has a team he should keep his eyes on for the purpose of delivery.”

He suggested that President Hichilema should further outline his key expected tasks to each ministry like he did with the Ministry of Finance.

Siabutuba said this would enable citizens track the progress made by ministers.

“It was very exciting when he appointed finance minister [Dr Situmbeko Musokotwane]. He outlined five economic indicators and I think it is important that he should go and do the same to every other ministry. Then the public would be helped not only to celebrate that this minister is in that position but we should be able to see what we are expecting from the Minister of Youth, for example,” said Siabutuba. “Like what are we expecting basically from the Ministry of Agriculture? I think it would be important for government to go as far as highlighting to the public what they expect to see from each ministry because sometimes the ministers may lack in a number of areas. And this in itself can be an opportunity for failure by government to succeed.”

Sishuwa Sishuwa: Should Zambia’s new president fire all his predecessors appointees?

The last few days have seen mounting calls from many Zambians for President Hakainde Hichilema to dismiss senior civil servants appointed by his predecessor. Those behind these calls argue that such officials cannot be relied upon to implement the new president’s vision because they were either complicit in the worst excesses of the previous administration or are still loyal to former president Edgar Lungu.

It is easy to sympathise with these demands. Zambians generally agree that Lungu’s presidency was an unmitigated disaster, hence Hichilema’s landslide election victory last month. The reason for the temptation to remove the old administration’s appointees en masse and replace them with a new tranche of officials is clear. However, the case for a clear-out of Lungu’s networks in the executive and civil service is not clear-cut. While superficially appealing, a clear-out policy would present several dangers.

The first is practical. We know from successive Auditor General’s Office and Financial Intelligence Centre reports that large amounts of money were looted under Lungu’s rule. One of Zambia’s pressing issues is to get this money returned so that it can be spent on the many pressing issues that the country faces, but what we don’t know is where the stolen funds have gone – that is apart from the appointees and senior government officials from the Lungu era.

Unlike President Levy Mwanawasa who focused on prosecuting suspected plunderers on coming into office in 2002, Hichilema’s priority appears to be recovering stolen funds. His administration may yet press criminal charges, but with Zambia’s watchdog institutions lacking investigative capacity and its judiciary compromised, his approach for now seems to be centred on creating fast-track courts as a more effective way of getting back looted wealth. For this mission to be successful, it will require the cooperation of some of those who know where the bodies are buried, metaphorically speaking. Sacking them will not help.

The second point relates to averting potential chaos. The removal of almost all senior officials at the same time could effectively paralyse the operations of the state. However skilled new appointees might be, it would take time for them to settle in and master their briefs. Moreover, the incumbents in these positions are employees, mostly with contracts. Dismissing them at would cost the treasury a significant sum, which Zambia can ill afford. A better approach would be to either transfer the officials to different roles within the civil service or let their contracts, many of which may be set to expire soon, run down.

The third point is perhaps the most important: political party loyalty should not determine somebody’s job. I am painfully aware that under Lungu’s rule, hundreds of Zambians lost their jobs for alleged association with the then opposition United Party for National Development (UPND). The worst-affected were Zambians from Southern, Western and Northwestern provinces – a factor that might explain why voters from these areas emphatically rejected Lungu and the Patriotic Front (PF). If the UPND were to remove people from their jobs for suspected links to the political opposition, they would be no different from the PF on this score.

It is worth noting that many of those demanding the removal of PF appointees are UPND supporters who expected to be rewarded following Hichilema’s victory. They believe it is their turn to eat and that they deserve political jobs because of their loyalty. This is completely the wrong approach. The expectation of rewards based on political affiliation is one reason why Lungu’s presidency was so disastrous, and his removal is a great positive outcome for all Zambians. We must not repeat the same mistakes.

In this debate, I believe that the basic questions we must answer are: Are the people appointed by Lungu able to do their job? Are they competent, experienced, and qualified professionals? If they are, and they have not been involved in blatant criminal activities, then there is no reason to fire them. Sacking people based on their perceived political affiliation has unfortunately been commonplace in Zambia. Readers will recall that Michael Sata and the PF did the same in 2011 on replacing Rupiah Banda and the Movement for Multiparty Democracy. Are we going to do this every time there is a change of government? Who will want to work for government knowing that their employment is only secure as along as their perceived political party of choice is in power?

It is heartening to see so many Zambians engaging in the democratic process and holding Hichilema and his new administration to account. In a sense, this renewed interest in governance issues demonstrates that people are tired of the incompetence, venality, and waste that characterised Lungu’s time in office, and they want change. At the same time, it is important to bear in mind that Hichilema has been in office for less than a month. He cannot be expected to work miracles in that time.

What Hichilema does need to do, however, is to clearly communicate his approach and explain his decisions. Otherwise, rumours and accusations will start to fly. In my view, the growing irritation against the continued presence of Lungu’s appointees in government has little to do with the disapproval of Hichilema’s decisions by his supporters; it has much to do with the lack of clear knowledge and understanding about what is going on, why the president is taking his time, or the motivations behind some of his decisions. To avoid alienating himself from his support base and to help manage public expectations, it is important that Hichilema develops an effective public communication strategy.

Here Is Why President HH Has Been Invited To The White house By Biden

President Hakainde Hichilema has been invited for a meeting with President Joe Biden and Vice President Kamala Harris at the White House while in the US attending the United Nations General Assembly. This is rather unprecedented for a newly elected African President, hardly a month in power.

During the same period, whilst in the United States, he will hold high level meetings with the International Monetary Fund Managing Director, Ms.Kristalina Georgieva, World Bank President Dr. David Malpass, World Bank President, Senate Foreign Relations Committee Chairman Robert Mendez, and other high level meetings.

As Zambians, we should be proud of the White House invitation and the other high level meetings our President will hold because it shows the general recognition by the international community of the rare feat of the peaceful transfer power from an Incumbent to the Opposition that we have achieved for the third time in 30 years. However, care must be taken by not looking at these gestures from the superficial angle but rather recognize the underlying motivations. These are undoubtedly geopolitical and economic in overtones involved, and it is that context that the visit should be looked at also.

The United States of America has paid insufficient attention to the African continent at the highest levels of government in recent years. China has taken full advantage of this and emerged as an economic and political power house on the continent. In Africa, China’s growing economic influence is there for all to see. Beijing has mobilized its vast government financial resources and invested in infrastructure projects in exchange for natural resources. China has extracted multiple layers of benefits from these investments which include service contracts for Chinese firms, creation of jobs in China through raw material supplies for projects, creation of a market for Chinese finished goods, political favours from African governments on foreign policy issues at multilateral forums such as the United Nations, and a positive international image of China being a friend of Africa who provides aid with no strings attached. China’s approach to Africa has posed a challenge to U.S. interests in promoting democracy, good governance and sustainable development in Africa.

On taking over, the Biden administration recognized this increased Chinese influence in the World including Africa. And in response, they have enacted the Strategic Competition Act of 2021 and are resetting the US African Policy. The Strategic Competition law is designed to counter China’s growing influence around the world. It frames Beijing as a “political, diplomatic, economic, military and ideological power” and a strategic competitor to U.S. and its partners

The entire US government machinery has been uneasy about the Chinese influence in Africa and Zambia is no exception. President Biden outlined his concern about China’s influence in the World during his first press conference after being sworn in.

“I see stiff competition with China. China has an overall goal — and I don’t criticize them for the goal. But they have an overall goal to become the leading country, the wealthiest country in the world and the most powerful country in the world,” Biden said. “That’s not gonna happen on my watch,” he said.

He was supported by the Chairman of the Senate Foreign Relations Committee Robert Menendez, the Democrat of New Jersey, who described the Strategic Competition legislation as an unprecedented, bipartisan effort to mobilise all American strategic, economic, and diplomatic tools to enable the US government to compete effectively with China and the challenges it poses to its national and economic security for decades to come.

“China is strategic competition. China today is challenging the United States and international community across every dimension of power – political, diplomatic, economic, innovation, military, even cultural – and with an alternative and deeply disturbing model for global governance,” said Robert Menendez, and the committee’s chairman who is one of the people that President HH will have a meeting with.

In view of China’s success in Africa, there appears to be a growing realization in the U.S that Africa is more than conflict and poverty but it represents important opportunities in trade and investment.
The African American Congressman who has been concerned and very vocal about Chinese influence in Africa and wanted US to be more involved in the continent to counter China, is Congressman Gregory Meeks of the New York’s 5th District who is the Chairman of House Foreign Affairs Committee.

“The United States sees strengthening US-Africa economic ties as a priority. America’s capital markets, pension and investment funds, and financial institutions are leaders among their global peers, and are uniquely positioned to play a key role in meeting Africa’s capital needs. In our absence, African nations will continue to seek capital, assistance, and technology from those who do not share our values and priorities for democracy, good governance, human rights, and environmental protection. America has every economic, strategic, and national security reason to prioritize our relationships with Africa,” he said.

The World has seen the erosion of democracy and human rights in the past five years as autocratic leaders have been emboldened by the former President Trump’s administration and China. Zambia has been one of the countries whose democracy was under threat before the August 12, 2021 elections.

According to Varieties of Democracy Project based at the University of Gothenburg, Sweden, Zambia had been one of the fastest eroding democracies in the world. The country registered a remarkably rapid decline in the quality of democracy since 2016 until the PF lost this year’s elections.

It is common knowledge that the US has made the promotion of democracy and human rights as the number one foreign policy objective as part of its competition with China which supports Authoritarianism. In July, 2021 the Secretary of State Antony Blinken was reported by Politico to have issued a cable to all embassies to make the promotion of human rights and democracy a priority, even in countries with abusive governments that happen to be U.S. allies.

Zambia happens to be one of the closest countries to China in Africa. The Chinese influence in Zambia went up a few notches in the past ten years. The level of Chinese investment and debt has increased. There are more than 600 Chinese companies operating in Zambia employing about 50,000 locals. The Chinese population in Zambia was estimated at 80,000 in 2019, according to the UN World Population study.

The Chinese influence was also demonstrated by the Zambian government attempt to recruit Chinese Nationals in the Police service in 2017.And more recently, in 2020, the enforced apology of former Lusaka Mayor, Mile Sampa to the Chinese community for trying to make them abide by Zambian laws was further evidence how China held sway in Zambian affairs. These events and other events did not go down well with Zambians. The local cynics even nick named Zambia as “Chambia”. There are also some international analysts who have called Zambia as China’s poster Child in Africa. Although the issue of China did come up on the campaign trail, it was clearly there under the radar and in voters’ mind. There is no doubt that one contributing factor to the PF’s loss was its perceived capture by the Chinese.

It against this background of the geopolitical ecosystem obtaining currently, that the invitation of President Hakainde Hichilema should be seen. And in the light of Zambians’ successful removal of the Lungu dictatorship through democratic elections, and the peaceful transfer of power, the US saw this as part of its success in the promotion of democracy and human rights and its fight against authoritarianism. The US invitation of President Hakainde Hichilema to the White House, is therefore, in a nutshell, simply the implementation of the Strategic Competition Act of 2021 and the US Reset of African policy to counter Chinese influence.

President Hichilema has made good governance through the promotion of democracy and human rights, rule of law, fight against corruption and the freedom of the press as the centre piece of his administration. The President’s speeches since he was elected, have been well received in the democratic world and by the financial markets. Zambians are also feeling freer no longer in fear.
There is a word of caution, however, that the new dawn administration of HH should be aware of. It would be unwise to give the impression that Zambia is expressly taking sides between China and USA/West. Zambia should welcome the competition for influence between the United States of America and China as it can bring a lot of developmental benefits to the country. We should not choose one from the other as the two are complementary. Zambia ought to develop its own development model based on copying and adapting the good features from both models – Washington Consensus and the Beijing Consensus-to fit in its unique environment.

Although, it may appear as self-promotional, as a Patriot, I would be failing in duties to make certain timely recommendations to our President. I would edge President Hakainde Hichilema, Foreign Minister Stanley Kakubo, Special Assistant to President Antony Bwalya and other Senior government officials in the foreign service to read a few selected and relevant Chapters in my book: China-West battleground in Africa: Debt ridden Zambia, before they go to the United States.

The book will provide them with fast track knowledge on how to handle Zambia’s relationship with the current economic super powers – China and the USA- based on very current information as demonstrated by this article’s attributions. The book has been accepted to be catalogued in the United States Library of Congress, the largest library in the World with 170million publications. The library does not just stock any publication unless it is adding value to the body of knowledge that it currently has. It follows that the book’s credibility cannot be doubted.-LT

ABSA Bank Zambia has awarded its workers a K2, 500 salary increment across the board effective 1st April, 2021.

ABSA bank PLC has effected a 21 percent increment to all its workers in order to cushion the challenges employers have been facing due to the tough economy.

ABSA bank PLC Managing Director, Mizinga Melu disclosed that the bank with the Zambia Financial and Allied Workers Union (ZAFIAWU) and the Bankers Union of Zambia (BUZ) have agreed to give all members of staff K2,500 increment per month with effect from April 1, 2021

Ms Melu noted that the bank will also give employees an exceptional discretion, one off payment of K12, 500 in addition to the 21 percent increment.

“Our employees will all walk away with a discretionary management payment of K12, 500, in addition to the 21 percent that we are giving them that amounts to K2, 500increment across the board with effect from the first of April,” she said.

Ms Melu stated that the bank will also enhance the conditions of service for ATM custodians as well as the card acquiring merchants by giving them additional allowances.

She also expressed happiness that the board has approved and signed a new early retirement scheme that allows members of staff who would like to retire early to do so.

“Despite the challenges we may be facing, our people need to be taken care of, that’s why we have continued to have negotiations to grow the bank to a bank of choice in the country,” she added.

She expressed happiness that the bank together with ZAFIAWU and BUZ has managed to effect strides that will better the members of staff.

Ms Melu said this during the signing ceremony of the 2021 collective bargaining agreement with ZAFIAWU and BUZ held in Lusaka today.

She also mentioned that the bank did not lay off any employees during the name-changing transition process of the bank, but instead, created more employment.

Speaking at the same event, ZAFIAW Secretary-General Chingati Msiska expressed happiness that the collective agreement was signed and actualized.

Mr Msiska said the union will adopt the government’s goals to enhance productivity by meeting all workers’ aspirations.

“Many times, we look at the good and the benefit the members are going to achieve as they remain your worker. The Union would like to see this institution do better and prosper, provided that the interest and rights of members are safeguarded,” he added.

Meanwhile, BUZ Deputy Secretary General Mwape Chanda expressed gratitude to ABSA management and ZUFIAU for agreeing to move forward and work together for the betterment of employees which will in turn make them more productive and improve the economy of the country.

Lawyers accounts and money laundering: has LAZ failed to regulate and discipline its members?

The most critical issue right now regarding lawyer regulation in Zambia is not about whether some lawyers have become kelenkas. The most egregious thing is that the regulator of lawyers in Zambia seems to have no plan and has completely failed to rein in its members. In its current form, the Law Association of Zambia has wholly failed to provide, to Zambians, lawyers that have the utmost integrity to serve our country. Indeed, the sacred profession of the law has now been overtaken by criminals, thieves, and kelenkas. And it is really not that these thieves have infiltrated the profession, but that the LAZ, as presently constituted, has failed entirely and miserably to bring order.

And so, the association has become a laughingstock. It cannot control its members’ appetite for a quick buck. The lawyers have become johns, pimping their trust accounts – a very sacred account- to the highest bidder. And so, a lot of money laundering and crime is going on in some of those trust accounts, and LAZ seems to be completely powerless to do anything meaningful about it.

Reports abound from both FIC and the Auditor General. Lawyers’ trust accounts and general accounts are being used to launder money. Thieves are hiring lawyers to hide their loot. And even if this publicly available information is brought to the association’s attention, it does nothing meaningful with that information. Instead, it lets thieves walk. Everyday. Where else can the people of Zambia turn to if they cannot trust this sacred profession and its institution?

But the rot goes beyond mere trust accounts. Indeed, we have seen lawyers venturing into various businesses. Nevertheless, lawyers’ ethics do not end when a lawyer starts making bricks or liquidating KCM, as an example. The professional duty to be forthright, candid, and honest must follow the lawyer wherever that lawyer goes. But isn’t it the case that kelenka politicians have used several lawyers to start businesses and use those businesses to steal from the Zambian people? Some of the proprietors of the companies that did grievous harm to the people of Zambia were lawyers. And yet, when these acts of theft and professional sabotage were committed, LAZ was completely mute on these thieves.

How then can you explain what is going on? I hold a belela membership in this association. It is our association. It is an association that belongs to the people of Zambia. The LAZ Act does not belong to the Council of LAZ, it belongs to the people of Zambia, and our people have the right to find out why this council should tolerate kelenkas among its ranks. What should it take for LAZ to act against these thieves?

If LAZ, as presently constituted, is unwilling to assist the people of Zambia in stopping illicit inflow and outflow of dirty money – then the best thing the honourable members of this association must do is to ask the UPND government to disband this association and perhaps build a fresh one. For a professional association that cannot bring effective discipline on its members is not worth its salt or its onion.

The people of Zambia are tired of professional bodies that want to be and do everything but be professional. We cannot be directing our salvo towards the corrupt political establishment when professional bodies are being used to perpetuate the same rot, theft, and corruption. The institutions leading our country must account to the people of Zambia.

In the Law Association of Zambia – it appears like it is an association that has been created to protect its members even when they flout the rules, steal, and use their trust accounts to launder money. It is not an association that protects the public or the public interest. LAZ is perhaps the only organisation with the statutory mandate to play a socio-political role in our country by being involved in politics and criticising the government. And yet, to carry out this statutory duty – our association must adopt zero-tolerance towards theft, corruption, and the pimping of lawyers to launder money.

What has LAZ done? Or what will it do to its members named in projects that scammed our people? What will it do with lawyers who stole their clients’ funds? Perhaps it will constitute a false hearing, do a “belela” suspension, and while we are all dozing, reinstate the thieves right back into the fold, to scam the next victims.

Is there hope? Of course, there is. But this hope lies with an association that is clear about its role. The association must have a fearless leadership that is willing to confront the rot no matter the political status of those involved. We understand that those who are connected to the ruling party or to the political class go scot-free. How can our association live with itself, knowing full well that it will not hold its own members accountable? The association cannot discipline anybody or take away anybody’s licence because somebody is somehow connected to the politicians.

There is a hidden rule in professional associations. It is an unwritten rule of sorts. You do not rock the boat, and you support the association no matter what. While I only hold a belela membership as an associate member – I cannot stomach the idea of holding the government accountable when it is open season in my association. I cannot live with that kind of double-dealing. It is time for LAZ to look itself in the mirror and account to the people of Zambia why some of the association’s members have become trust account pimps!

Indeed, it should be emphasized here that not all lawyers are laundering money. But we have enough of them to tarnish the good image of the association. But the key here is that the association itself seem to be completely powerless to control the few that are bringing the association into disrepute.

Of course, “self-regulation” is the only standard for lawyer regulation in common law countries. But if some lawyers continue with acts of impunity against their professional responsibilities, what can the nation do? If lawyers won’t regulate and govern and discipline themselves, who will discipline, govern, and regulate them?

YES, BALLY CAN FIX IT…but can’t do it alone – Michael Kaingu

MICHAEL Kaingu says it is the job of every Zambian to ring the bell so that the President is told even what he knows already to achieve inclusive national development.

Dr Kaingu said, “yes, Bally can fix it but he cannot do it alone” hence he needs others to share his vision.

“It’s our job, us who are in the industries like tourism to ring the bell so that the President is told even what he knows already. He must be reminded. The President may know some of the things we are saying but he is one person. He might forget some of the salient matters involved in sectors like tourism,” he said.

Dr Kaingu said it was unfortunate that when people like him share their thoughts about how sectors like tourism can be enhanced are mistaken to be looking for jobs and are mocked that they are too old.

“We are not talking about getting appointments as ministers. I mean why should I be? If I wanted to be a minister, I should have participated in the elections. I declined and for somebody to say ‘why come today!’ You are in Choma, my nephew, you know how much Choma Maanu helped UPND. At onetime government was threatening to close it and the same people who are talking now are the same ones who were saying Choma Maanu was a mouthpiece for the opposition,” he said. “I have more than 50 workers and are all in Southern Province so there is a likelihood that they voted for HH. So my vote alone may not be necessary because if more than 50 workers voted for him, how do you condemn me? So if the economy is good then I will employ more.”

Dr Kaingu expressed sadness that some people were agitated whenever he makes a contribution towards national development following his daughter’s participation in the last general elections.

“Do you throw dirty water together with the baby? It’s natural that any other person would have not left their child to go it alone. What was I going to do? I’m a politician, my daughter goes into politics and then I say no you are a naughty one, you go, no! And I have no regrets in any case. I helped my daughter, she failed and I want to encourage her to continue with politics. She can even join UPND,” he said.

Dr Kaingu, who held several ministerial positions in both the MMD and PF governments, urged Zambians to just focus much on national development than petty issues.

“And us who are active in all these industries like tourism and agriculture are willing to contribute and we are employers. Then how can some people say we are too old? Do they want us to run away with our knowledge? We should pass the knowledge to them – our youths,” he said.

“How did I manage to get the United Nations World Tourism Organisation (UNWTO) conference here to Zambia? Bringing it again means we would have to work hard as a nation. It was not easy. How did I manage to come up with Northern circuit? Now we are talking about Western circuit. So this knowledge must be passed on instead of when we talk people think we are looking for jobs as ministers, no.”

Dr Kaingu said it was from the President’s focus and determination to change things in the country that has attracted contributions from him and others that wish to see an improved economy.

“And that’s why under late president Levy Mwanawasa tourism was doing fine because he gave us free hand to come up with policies which were discussed in cabinet and that’s why I was able to bring the UNWTO to Zambia,” he said.

“When you talk about Kavango Zambezi Trans frontier (KAZA) under Western circuit which houses about five countries in the Southern region, we established Uni-visa where if you get a visa in Zambia you don’t have to get a visa from Zimbabwe,” he explained. “But you see the idea was to make the whole area…so that when you get one visa you have access to all five countries in the KAZA. But up to date we have only managed to do Zimbabwe and Zambia. So we need to move to other countries because that would have made tourism cheaper.”

Dr Kaingu explained that tourism was not a stand-alone sector but multisectoral in nature.

“I don’t think we are doing enough. There is mining-tourism, agriculture-tourism. There is hospitality, so when you look at tourism there are so many business avenues imbedded in there. When you look at tourism as a nation we are still discussing the Northern circuit when we should have long ago developed the Northern circuit and moved to other circuits like Western,” he said. “I’m the one who coined the Northern circuit as then tourism environment and natural resources minister. I’m the one who came up with the Northern circuit and popularising it. I even took the then acting PS to Durban to market it. But we cannot continue focusing our attention on Northern circuit. This country is endowed with a lot of natural resources in terms of tourism. For me by this time we should have moved from Northern circuit to Western circuit.”

He said the Western circuit has five countries through KAZA.

“It has unbelievable ecosystem estates which can actually bring more tourists. The KAZA transfrontier is very big than Germany.

“It’s twice the size of the United Kingdom. It’s from Angola. For Zambia we have Liuwa National Park, Sioma, Kafue National Park, Musi-o-Tunya but that’s not all,” Dr Kaingu noted. “It has got unbelievable cultural heritage because it gets people from different nationalities. So when we talk about the Western circuit it’s not only about tourism driven by animals but culture of people too. If you look at the Kuomboka ceremony, you know, that could also be a tourist puller. We have one that happens in Lealui or Limulunga. There is one in Nalolo, there is one in Kalabo. There are three Kuomboka ceremonies.”

He said Western Province alone contributed 35 tribes out of the 72 in Zambia.

“So it means we have more cultural diversity meaning that even when it comes to the way people live, traditional ceremonies, you have more than 35 in Western circuit because other tribes practice more than two ceremonies. We have also people in Namibia for example the Mbundas, they are also in Angola. They are also in Namibia. So you are able to bring the Mbundas together and you can have a very big ceremony,” he said. “When you look at the Subiyas, we have them in Namibia and Zambia. We have Tongas in Zambia and Zimbabwe, so the Western circuit is much richer than even the Northern circuit where we seem to have stuck for a long time as a country.”

Dr Kaingu wondered why the nation should still be focused on the Northern circuit when it should have moved to either Nyika forestry which separates Zambia and Malawi.

“We have game reserve. We have the prestigious Nyika forest. That also offers tremendous tourism potential. Tourism when I was minister contributed three percent of GDP from the seven per cent that we have had. And that was not even enough. Tourism alone can run this country economically. There are so many countries that are sustained by tourism,” said Dr Kaingu. “Let’s come to timber for example, a lot of money was lost through Mukula tree (rosewood). We have simply failed to manage our natural resources otherwise Mukula and Mukwa could actually sustain our economy. Right now timber in Western Province has been lost and when you look at economic realisation it’s almost nothing. I propose suspension on timber cutting because really the country has lost trees without turning into meaningful economic contribution. For me having been in charge of forestry, I would have loved President Hakainde Hichilema to suspend timber cutting because I know what is happening.

The wanton cutting of trees is unbelievable.

Natural resources can develop this country. This country is rich when you look at natural resources.”

 

UPND Govt With PF Structures A State Sabotage On The Horizon!

UPND GOVERNMENT WITH PF STRUCTURES A STATE SABOTAGE ON THE HORIZON! PLEASE GET RID OF THEM AND REDEEM PUBLIC TRUST AND RESPECT.

One of the functions of the CIC platform is to monitor the social media environment which consistutes 89% of Zambia’s online community environment. The firing of service chiefs raised UPND public rating beyond victory celebration to an incredible 300%.

UPND government in whatever shape or form ought to write it’s own story and make it’s own mistakes then face the electorates in 2026.
However prolonged stay of PF structures has eroded public rating faster and it’s getting worse.

Currently nothing justfies the stay of PF aligned structures in government not constitution, not political, not spiritual, not finances. The Zambian constitution provides for elections every after 5 years Zambians can decide whether to keep the rulling in power or vote any other party of their choice. The constitution was alive to the fact that when one is elected as a president they have the authority to assemble their own team in whatever form and deliver as per their promises.

Slowly but sure PF is rising with confidence and strength of saying they are innocent and they are not going anywhere. This is not us talking but the public rating not good currently they want those people gone it doesn’t matter whether the government has money to pay them or not they just have to go.

UPND will face the electorates in 2026 damage caused often takes longer to clean than destroying an already positive made impression.
UPND members are now being insulted and mocked for being incompetent and useless if we can quote Rainbow Party President Mr Wynter Kabimba. That surely hurts to someone who greatly suffered and reading such statements. It’s a betrayal.

Economic transformation, restoration of rule of law and making Zambia a beacon of peace in Africa can not be achieved with PF structures in government who don’t understand the UPND manifesto, vision or plans. These are people that heavily criticized then the opposition UPND saying they can’t win and messed things up for the previous administration.

Republican President Mr Hakainde Hichilema is known to be one of the craft person full of surprises we only hope there is something coming up that Zambians will be shocked with towards this issue otherwise the public discontent is growing at a faster rate and it’s not good at all.

Sabotage is one key that UPND administration will likely to suffer ranging from the ongoing investigations and service delivery to the people. The PF structures will empower their own team and continue their own deals for two reasons that includes corrupting even weak officials if they are able to. One reason is to secure their interest or destroy evidence of corruption.

We have heard that those who will be found clean may continue while those who will be found wanting may face the law. This is where anger from the public is generating from. Clearly you must be a fool to be found wanting while you are under investigations and you are still serving. This is a mishap betrayal of the highest order.

The Republican president has good intentions which we all undoubtedly trust but his strength is from the public the same public that are asking him to get rid of PF structures in UPND administration they are annoyed and we agree with them. Otherwise the damage will be so huge and it won’t be traced to them but to the president. Some ministers will start failing their duties not because they are failures but compromised chain of operations can be dramatic and PF are not boasting for nothing they know exactly what they are doing.

Owner Of 48 Houses Reappears, Wants His Houses And His Job

OWNER OF 48 HOUSES REAPPEARS, WANTS HIS HOUSES AND HIS JOB

Alleged owner of the infamous 48 houses has reappeared from his self-imposed exile.

Charles Loyana, a former Accountant at the Ministry of Finance has returned to the country.

Loyana, who is a nephew to the Minister of Finance, Situmbeko Musokotwane, says he wants his property and his job at the Ministry back.

Loyana had fled to Tanzania fearing for his an arrest and his life.

Loyana is among the three people who have sued the Anti-Corruption Commission (ACC) over the 48 houses in Lusaka’s Chalala area.

He recently submitted to the Court that he as Charles Loyana, a senior accountant at the Ministry of Finance, remains qualified to own property in Zambia using funding from any legal sources of his choice.

In this matter, Uziel Bashire, Zuberi Bigawa (both Tanzianians) and Loyana have sued ACC in the Lusaka High Court, seeking declaration that Loyana had and has the requisite power and authority by law in Zambia to purchase, possess and own property in his name for his own benefit or for the benefit of any other person.

They also want the court to order that Bashire, a Tanzanian but currently residing in Norway, has an interest in the properties bought by Loyana and was to be the ultimate beneficial owner of the properties bought, and such Loyana as purchaser of the properties should be granted possession of the said properties.

But in its defence, ACC argued that Loyana did not challenge the forfeiture proceedings that were instituted by the commission despite being served with the notice of intention to have the said properties forfeited to the State.

ACC added that Loyana in a statement to it dated May 16, 2018, told the commission that he owned only two properties, that is, one in Chilenje and the other in Chalala.

Meanwhile, ACC submitted that there was no record of either Bashire or Bigawa (both Tanzianians) being granted an investment permit to enable them to invest in Zambia.

However, in their reply to ACC’s defence, the three argued that there was no law in Zambia that proscribed a foreigner from funding a local person who qualifies to own property to purchase property or to fund any such investment to require them first to have an investment permit.
They argued that thus, ACC’s understanding of the requirements of an investment licence to justify its illegal seizure of the properties was out of context and remains unjustified at law.

The three further argued that neither does there exist any law in Zambia that proscribes a foreign national from having an interest in any investment or property owned by qualified persons under the law in Zambia.

They stated that what the law prevents was owning the property in the foreigner’s name if that foreigner does not meet or does not qualify to own land in his/her name as required by law.
“Further, a transaction regarding sale and purchase of property between private parties as was the case herein was and remains a private contract between the parties to the transaction and the defendant (ACC) was never a party to the transaction.

The third plaintiff (Loyana) remains qualified to own property in Zambia using funding from any legal sources of his choice and cannot be deprived of the said properties in the circumstances of this matter,” the three plaintiffs stated.

They maintained that ACC did not comply with the law in the process of seizing the said properties and would duly prove that at trial

We will deal with the Constitution but priority is job creation- HH

President Hakainde Hichilema says his administration will initiate Constitutional amendments to deal with issues that are not clear. President Hichilema however stated that the main priority for his administration is to create jobs and business opportunities for Zambia.

He said Constitutional review process will be consultative and will not be handled like the Bill 10 process.

President Hichilema was speaking in Lusaka on Thursday when he met a group of senior citizens under the umbrella of Our Civic Duty Association (OCIDA), an organisation that promotes good governance and economic development for all and led by Archbishop Telesphore Mpundu.

“On the Electoral processes raised by the senior citizens, just like during our address to Parliament, our being in State House is largely due to the Youths out there who we are now calling as a ‘New generation of the Liberation Struggle’ and pioneers of their future,” President Hichilema wrote on Facebook.

“We have put in place expeditious plans for jobs, business opportunities, education and quality health care services for all and in a matter of time, this will be actualised. Under this score, we also stated that whilst in office, we will ensure an independent Electoral Body,” he said.

Meanwhile on matters related to the Country’s constitution as raised by the senior citizens, President Hichilema emphatically stated that this will be looked at and that issues that are not clear and eventually leading to a sitting Head of State going for a third term, will be amended to make it clear and strict that a sitting Head of State should only run as per the Constitution requirement and that’s two terms only.

“We also stated that under this exercise, we will ask you, the citizens on what should be contained in the Constitution and that we will not in any way go the direction of the past Bill 10. This will be a consultative exercise,” he said.

“However, we did underscore that top on our agenda is now job creation, business opportunities, education and quality health care services for all and paramount to these also is the lowering of the cost of living.”

President Hichilema stated that the corruption crusade is actually in effect and that there shall be no sacred cows.

“We also stated that the process to recover all stolen government assets is in motion and that sooner than later if not already, those involved in the plunder of public resources are and will be already crying victim. In recovering the stolen assets, we will need every hand and support. And once all these resources are recovered, our People will rejoice and we will channel all this stolen wealth to developing the Country for the betterment of all our citizens,” he said.

“However, we will not use a political hand in this fight against corruption but will instead allow institutions mandated to do so to pursue these crimes independently. We therefore call on all Zambians to support them by any means necessary. We also reiterated that those who will be found wanting will be taken through the set rules and laws and that no one should be arrested before investigations are done, and that when they are arrested if the cases will be bondable or bailable, this should be made available,” he said

He added, “We further expressed our hope that the Judiciary must expeditiously be dealing with these matters because we are in a hurry to develop the Nation but we will be methodical and systematic in the way we shall run the affairs of our Country.”

“During the meeting, we also stated that we are resolved to ensuring that national resources are distributed fairly, equitably and across the Country and that during our budget, we will ensure that decentralisation of resources is done and this will be superintendent upon by constituencies and officers to handle this will not be drawn from the National headquarters as that would be another source of corruption among others.”

President Hichilema reiterated that his administration is firmly committed to delivering the much desired change for all and in a matter of time, this will begin to be felt and indeed seen.

“We remain grateful to all of you Zambians out there for this opportunity you gave us and all your concerns are being methodically and systematically receiving the much-needed attention and we are optimistic that the benefits will at least be pleasing to all.”

A COMPETENT, impartial, and courageous judiciary is the bulwark of democracy. Such a judiciary serves as the guardian of the Constitution, defends the weak and disciplines the government. According to the Advisory Panel of Eminent Commonwealth Judicial Experts: “The judiciary must be the one bastion where citizens may go to challenge the arbitrary or oppressive actions of the State. It must be the safe haven where the most impoverished or abused citizen may find support for his or her legal rights when they conflict with those of the rich and powerful in society.”

Zambians elected a new government on 12 August 2021 which marked the end of the Patriotic Front (PF) era. Under the PF reign, the country experienced the worst form of partisan judicialisation of politics by the PF government and its allies. The incoming United Party for National Development (UPND) government has promised, as a priority, to restore the rule of law, among other governance interests. We opine that the restoration of the rule of law should prioritise judicial reforms, and in particular, address, with utmost urgency, the existence of the Constitutional Court. We urge the new administration to abolish the Constitutional Court and rebuild the entire judiciary from scratch by requiring all judges to under-go a mandatory vetting process and dismissing all the judges who will fail the vetting process. In the specific case of the Constitutional Court, we highlight two reasons in support of our argument for its abolishment. The first reason is centred on the constitution and the jurisdiction of the court while the second focuses on the quality of the judgments rendered by the court.

With regard to the constitution and jurisdiction of the Constitutional Court, the idea of establishing a Constitutional Court in Zambia goes back to the 1991 Constitution making process. This initial suggestion, however, did not elaborate the detail of how the proposed Constitutional Court would relate with the already existing courts. In spite of this omission, a stand-alone specialised Constitutional Court was finally established following the 2016 constitutional amendment.

The Constitutional Court as established, has original and final jurisdiction to hear any matter relating to the interpretation of the Constitution; violation or contravention of the Constitution; the election of the President and Vice-President; appeals relating to the election of members of parliament; and any matter concerning the court’s jurisdiction. The Constitutional Court, however, does not have jurisdiction to enforce the constitutional Bill of Rights. This is because the Bill of Rights was not amended in 2016 and, the provision on the enforcement of the Bill of Rights, Article 28, still vests jurisdiction over the enforcement of the Bill of Rights in the High Court and the Supreme Court.

When a constitutional matter, within the jurisdiction of the Constitutional Court arises in any other court, that court is required to refer such matter to the Constitutional Court. A decision of the Constitutional Court is final and not appealable to the Supreme Court. Confusingly, however, Article 121 of the Constitution ranks the Constitutional Court and Supreme Court equivalently. It is open to argue that Article 121 is based on a complete misunderstanding of the structuring of Constitutional Courts within the hierarchy of existing courts in a common law system like ours, where stand-alone constitutional courts have been the norm. Article 121 appears to have been based on a manifest misunderstanding of the civil law tradition where, as a matter of fact, constitutional courts are ordinarily not part of the judiciary but exist outside the judicial hierarchy. This approach was tried but eventually abandoned in South Africa because it is unworkable and leads to contradictory jurisprudence.

The emergence of contradictory jurisprudence is a real problem for a country like Zambia which follows and strictly applies the common law doctrine of precedents, where such precedents are seen as having the force of law. Supreme Court judge Mumba Malila has previously warned of this danger: “There is also the additional risk of the Constitutional Court overruling the Supreme Court on matters that it decides on the basis that a constitutional issue was ignored, or misapprehended by the twin apex court. This has the potential of undermining the twin apex status of the Supreme Court, and, in fact, relegating it to an inferior status relative to the Constitutional Court.” A number of cases from the Supreme Court and the Constitutional Court already demonstrate the materiality of contradictory precedents. It would appear that what is needed in the specific case of the Zambian judiciary is not a stand-alone Constitutional Court, but a special constitutional committee within the existing judicial hierarchy. Such a special constitutional entity could be tasked with hearing important constitutional matters more efficiently in line with slightly relaxed procedural rules. There is nothing magical and extraordinary about having a Constitutional Court.

Many countries with progressive judiciaries, such as Kenya, Namibia, Canada, the United Kingdom and the United States, do not have a separate constitutional court. In the UK, for example, the House of Commons in 2014 inquired into the desirability of establishing a separate Constitutional Court. After consulting leading experts and senior judges, the House concluded that “there would be no need for a separate constitutional court.” One of the respondents, Lord Lester QC, indicated the following convincing reason for rejecting a separate constitutional court: “Once you have a constitutional court, first of all, you are separating something called constitutional issues from ordinary law. I believe that constitutional issues are not so specialised that they require a court specially appointed to deal with them. You cannot be a good public lawyer or constitutional lawyer if you cannot interpret a contract. It is very important that the judges who are interpreting the Constitution know and understand general law, about tort or contract law, criminal law and so on, and bring all that knowledge and experience to interpret the Constitution.”

The second justification for our proposal to abolish the Constitutional Court emanates from our preliminary analysis of the quality of decisions so far made by the Constitutional Court in selected cases. By way of setting the context, a functional judiciary sets the tone for the rule of law in the country. When a judiciary is not committed to the rule of law, it inevitably sends a clear message that impunity is acceptable and such a judiciary or court is deemed to be weaponised against both the people and the values that it should foster. Instead of defending democracy, such a court cultivates a climate of lawlessness and leaves the country in a state of crisis. In relation to the pre-2010 governance crisis in Kenya, a report by Africa Watch, for example, observed that: “At the heart of the human crisis in Kenya is the lack of an independent judiciary. Courts are used to dispose of political opponents and critics. On a broader basis, the courts have become a weapon for the powerful and wealthy to settle personal vendettas and local disputes.”

This is exactly what the Zambian Constitutional Court has reduced itself to in recent years. It became an acolyte of the corrupt and lawless. The Constitutional Court was unabashedly biased in favour of the executive and the ruling party cadres in its judgments. The Constitutional Court went to the extent of disregarding well known and established legal principles and standards of legal reasoning expected of a competent court interpreting the supreme law. Examples include the decisions of the Constitutional Court to vacate the 2016 presidential election petition without hearing it; deliberately misinterpreting the Constitution in order to allow former President Edgar Lungu to run for a third term of office; the refusal to enforce the constitutional provision requiring public loans to be approved by Parliament; paving the way for desecration of the Constitution by allowing the Constitutional Amendment Bill No. 10 of 2019 to proceed; refusing to amend the presidential candidates’ affidavit to make clear the presidential two-term limits and condemnation of the petitioner, John Sangwa, to costs in the same case; approving the manifestly dubious and lawless removal of DPP Mutembo Nchito, and many other similarly bewildering cases.

In some instances, yet, the Constitutional Court simply ‘sat’ on the cases, rendering the ultimate outcome an exercise in futility. A great example is the case by Chapter One Foundation filed in August 2020 challenging, among other things, the legality of the decision of the Electoral Commission of Zambia to abolish the existing voter register and conducting voter registration within 38 days. Almost a year later, the Constitutional Court had not heard the matter.

Almost all the time, the Constitutional Court has disappointed the country when it was needed the most to check government actions and stall the then rapidly growing autocratisation. The judges of the Constitutional Court by their judgments, with the exception of a few dissenting opinions notably by Justice Margaret Munalula, were the negation of the values a judge should live by, as articulated by Lord Bingham: “strong character, powerful intellect, great learning, courage, wisdom, eloquence, [and] robust common sense.”

Although we firmly believe that the Constitutional Court should as a priority be abolished, we hold the view that reforms to the judiciary should not end there. There is need to overhaul the entire judiciary. Such an approach would help “fix” some of the many problems faced by the judiciary today, such as the appointment and promotion of questionable characters to higher judicial office. The judiciary is now staffed by many pliant judges appointed not for their competence, professionalism, or integrity but for narrow political reasons. We propose a new start, something akin to what was done in Kenya through the 2010 Constitution. This approach would initially require all judges and magistrates to undergo a mandatory vetting process and those who fail, based on their competence to hold judicial office, must vacate office. The vetting process should be credible and structured to accomplish two things: not only facilitating the removal of unsuitable judges because they damage the integrity of the entire judiciary and undermine public confidence in the judiciary; but also ensuring that the vetting process is not used to remove or penalise judges for making credible but unacceptable decisions to the executive or ruling party. This would be a necessary step in order to weed out incompetence, corruption and laziness, which is often manifest through inefficiency and poorly reasoned decisions. There is further need to abandon the current executive-driven secret process of recruiting and employing judges in favour of a public process where vacancies are advertised and candidates are interviewed openly. All this can be achieved through a well-tailored constitutional amendment.

HH & the mounting political baggage

During the run up to the just concluded August 12 general elections, we saw the then incumbent and now former President Edgar Lungu’s campaign being anchored on showcasing infrastructure projects that his administration had implemented.

Some political commentators and some of former President Lungu’s critics said he had no vision, that he had no fresh promises to make, no grand ideas to promise. This was despite that the man had served about seven years as head of state and had full access to superior information sources some of which is held as state secrets. Lungu was simply low on grand promises.

On the other hand, our current President Hakainde Hichilema, then main opposition rival went on to campaign on the pedestal of being visionary. He went on to make grand promises which are now making headlines and a subject of daily social media discourse.

Some of the few but big promises making daily discourse today is the provision of free education from Primary to University, the selling off of the Gulf Stream Presidential jet which was then considered an extreme luxury for a poor country like Zambia, the upholding of the debt swap arrangement for civil servants, the restoration of meal allowances for University students and appointing a cabinet on principles of meritocracy.

We are not saying that all these promises are not attainable, no. The issue here is there has not been coordinated communication on how these promises will be fulfilled or implemented. What has been communicated so far is pointing most citizens, including those that supported the ruling UPND that there is no clear plan or pathway to fulfilling these promises.

With the growing social media access and its powerful storage capability of information, every time one goes on social media, they are bombarded with screen shots of these promises by President HH which are one by one, being confirmed as not being feasible for implementation.

What is shocking is that one would have at the minimum expected even a medium term plan for implementing some of the key promises, but there is non. If it’s there, we are yet to see and have access to them. Please share them if available.

What we are seeing are growing voices of disappointment, frustration and despair. Even some of the most die hard UPND supporters are retreating and running out of social and political responses or excuses to questions being asked about the feasibility of implementing the big promises.

The risk with all this is that as President Hichilema ploughs through and makes more political appointments, dissent even within his own rank and file will only grow. For every appointment he makes, tenfolds of disappointed and expectant appointees are inadvertently created. These are even more dangerous enemies within than known opposition political opponents.

Even some of those that have been given for instance provincial ministerial positions, even those that will be given lesser ranked political appointments in government that eyed full cabinet ministerial positions, get their egos hurt in the process and lose their raw zeal that had propelled their blind and full support before the UPND formed government.

This is perhaps the burden of leadership world over that HH finds himself today. And our people are no exception to vanity, they are also just human with wild and unbridled ambitions.

Experienced political hands will tell you that it’s not storage therefore to find that even people that were mere body guards to one of HH’s entourage’s wanting to become Police IG’s, Army or Air-force Commanders even when they have no discernible experience or qualifications needed to hold such high ranks. Such are common sores or boils that fester as time goes on.

Well, HH wanted to be President for a long time before he finally got announced as winner of the 12 August vote, this period will be his biggest and toughest test ever. He may have experience running big businesses and corporates, but running a country is a bigger test due to a higher complexity, more dynamism and ever evolving multiple interests.

One thing that is clear so far is that those in opposition and those that aspire to lead our beloved country Zambia need to ensure that they watch what they post and share on their personal social media pages, ensure that personal pages posts are vetted before being shared where the page is delegated to media staff.

It would be a lie or tantamount to taking an Ostrich approach to not truthfully state that the HH campaign promises will haunt his presidency if not handled carefully. The promises and consequent indications that they will not be implemented which are being replayed daily are a mounting political baggage that needs expert hands to help navigate.

Some have said it’s too early to point out these holes, but any genuine person who is on social media or living in Zambia today will tell you that the drift and perception is that HH is backtracking on his major promises.

The other day, we saw police officers force workers at Chambishi on the Copperbelt back to work when the demonstrations were largely violence free and peaceful. Tomorrow, it will be another thing which is known that would have been condemned by HH had he been in opposition. The double standards are what leads to loss of political capital.

One thing which is clear is that it’s easy to point out wrongs than to implement solutions. Dear ZBT reader, What is your take on this matter?

PARAMOUNT Chief Mpezeni says it is now time to change goal and play another game.

And Eastern Province UPND chairperson Johabie Mtonga says the new government will respect and work well with traditional leaders and civil servants.

Speaking when Mtonga and some members of the UPND provincial executive committee paid a courtesy call on him at Ephendukeni palace on Monday, Mpezeni said traditional leaders work with government of the day.

“Kaili chitukuko manje chili namweo, nanga ungayende kusebenza na opposition, kulibe munthu angasebenze na opposition. Chitukuko sichingabwele ngati usebenza na opposition. So ndiye chifukwa chake apa lomba, so manje tili namweo! Vonse vila venzokambika ofanikila game izisintha, osati muli na game imodzi naimodzi kuti kapena bwanji. Bola izisintha, apa manje ni change goal, mwachita manje change goal tiyeni manje titeye bwino bola osati kungolatana vikumo (Now development is with you. You cannot start working with the opposition. No one can work with the opposition. Development cannot come if you work with the opposition. So this is the reason, this time we are with you! All those things that were said, the game should change. You cannot play the same game. The game should change and we are now at change goal. You have changed the goal, so let’s play the game well not finger pointing),” he said.

Mpezeni said there was need to pay attention to development.

“If we continue finger pointing, development will lag behind. There will be no development here in Eastern Province. Let’s not waste time finger pointing each other. Let’s work hard. Like you know, we don’t have mines here in Eastern Province. Ours is agriculture,” he said. “I am happy because today when I was listening to Radio Maria news, agriculture minister Reuben Mtolo said he did not do any work in his life apart from working in the agricultural sector. I am hopeful that this sector will perform well under him.”

Mpezeni implored the government to pay attention to the agricultural sector so that the country could develop.

“Like what Hon Mtolo said that he will ensure that fertiliser distribution under Farmer Input Support Programme is flagged off as fast as possible, things can be okay,” he said.

Mpezeni said to every election there was always a winner and a loser adding that the UPND are the winners.

“Everything ended and we have a new government. And it’s the same, all the chiefs are no longer working with the old government but the new one,” he said. “We are going to work with the new government. We cannot fail to work with the new government.”

Mpezeni said what transpired in the past was mere politics.

“A knowledgeable person will work with the person who is there. The one who has power and not those without power. That’s when development can come. Development can come if you work with the government of the day,” he said.

And Mtonga said the provincial committee saw it prudent to visit the traditional leader and assure him that they would work with him.

“You are the one with people. All those who were voted into office are your children and they were voted into office by your people. For development that we talk about to happen, we all need to work with our traditional leaders and respect them,” he said. “This is the reason why we have come and as the UPND government, we want to respect traditional leaders, the general citizens and civil servants.”

Mtonga said the UPND wants civil servants to work freely and not to be intimidated.

“Development cannot come if we intimidate each other. There should be freedom of movement, people should visit each other, tribe by tribe, so that we share ideas on how we can development our country,” he said.

Mtonga said although problems are always there, certain problems can easily be sorted out with the involvement of traditional leaders.

“When we sit with you here, we can identify the challenges that people face and we can take those issues to MPs, councillors up to the President so that they attend to them,” he said. “We know that chieftainship will remain there and will always be useful to the governance system.”

Mtonga was accompanied by provincial vice-chairperson Mike Tembo, provincial treasurer Alex Phiri, provincial vice-treasurer Lucky Matongo and provincial youth chairperson Lyson Nyirenda, among others.

President HH Meets Senior Citizens

This morning we were joined at State House by senior citizens of our Country under the umbrella of Our Civic Duty Association (OCIDA), an organisation that promotes good governance and economic development for all and led by Archbishop Telesphore Mpundu.

During the meeting, we stated that the corruption crusade is actually in effect and that there shall be no sacred cows.

We also stated that the process to recover all stolen government assets is in motion and that sooner than later if not already, those involved in the plunder of public resources are and will be already crying victim.

In recovering the stolen assets, we will need every hand and support. And once all these resources are recovered, our People will rejoice and we will channel all this stolen wealth to developing the Country for the betterment of all our citizens.

However, we will not use a political hand in this fight against corruption but will instead allow institutions mandated to do so to pursue these crimes independently. We therefore call on all Zambians to support them by any means necessary.

We also reiterated that those who will be found wanting will be taken through the set rules and laws and that no one should be arrested before investigations are done, and that when they are arrested if the cases will be bondable or bailable, this should be made available.

We further expressed our hope that the Judiciary must expeditiously be dealing with these matters because we are in a hurry to develop the Nation but we will be methodical and systematic in the way we shall run the affairs of our Country.

During the meeting, we also stated that we are resolved to ensuring that national resources are distributed fairly, equitably and across the Country and that during our budget, we will ensure that decentralisation of resources is done and this will be superintendent upon by constituencies and officers to handle this will not be drawn from the National headquarters as that would be another source of corruption among others.

On the Electoral processes raised by the senior citizens, just like during our address to Parliament, our being in State House is largely due to the Youths out there who we are now calling as a ‘New generation of the Liberation Struggle’ and pioneers of their future. We have put in place expeditious plans for jobs, business opportunities, education and quality health care services for all and in a matter of time, this will be actualised. Under this score, we also stated that whilst in office, we will ensure an independent Electoral Body.

Meanwhile on matters related to the Country’s constitution as raised by the senior citizens, we emphatically stated that this will be looked at and that issues that are not clear and eventually leading to a sitting Head of State going for a third term, will be amended to make it clear and strict that a sitting Head of State should only run as per the Constitution requirement and that’s two terms only.

We also stated that under this exercise, we will ask you, the citizens on what should be contained in the Constitution and that we will not in any way go the direction of the past Bill 10. This will be a consultative exercise.

However, we did underscore that top on our agenda is now job creation, business opportunities, education and quality health care services for all and paramount to these also is the lowering of the cost of living.

We are firmly committed to delivering the much desired change for all and in a matter of time, this will begin to be felt and indeed seen.

We remain grateful to all of you Zambians out there for this opportunity you gave us and all your concerns are being methodically and systematically receiving the much needed attention and we are optimistic that the benefits will at least be pleasing to all.

IT WAS A SETUP TO EMBARRASS HER AS PF LAUNCHES STRIKE FROM WITHIN STRATEGY.

CIC has established that the documents given to the minister of Information Hon Chushi Kasanda where poorly done and so blared words not visible enough to read properly.

Chushi Kasanda a business academia by profession who once saved as Manager at Zambia’s leading telecoms can’t fail to read a two paged document which was poorly written with the sole intention of embarrassing her.

CIC obtained the said speech it was shocking not even Soweto Printers could print such especially for a cabinet Minister to read.

The documents went further examinations by CIC editorial department certain words where not visible and clear enough a clear proof of what the Minister went through while live on Camera.

Section of the society have condemned her citing taht she can’t read. In the PF WhatsApp groups calls are coming in to mock the minister but truth has been established that the document in question was poorly written and prepared at shot notice.

Efforts to get full details from her office secretarial proved futile.

Meanwhile UPND members have accused the staff at her office for staging a sabotage to prove a point. Frank Mwansa (not real name) inboxed CIC private WhatsApp line explaining the operation that has been launched to frustrate and embarrass Ministers especially that many Permanent Secretaries are still the PF members paying allegiance to PF leaders while serving a UPND government.

It has taken so much time to get rid of all the PF officials in government a time bomb anger which is blewing on the horizon.

Rainbow Party President has further mocked UPND that it is not wrong for President Hakainde Hichilema to work with PF members if his own people are incompetent and useless. This statement has angered many UPND members who have heeded to the presidential directive to.wait for further actions. CIC predicts today’s saga at ministry of information to prove a point raised by Mr Wynter Kabimba when the reality of the matter is the nature of the document in question was poorly typed and not visible properly for a ministerial standard.

DEMAND TO FIRE EVERYONE LEFT OR APPOINTED BY THE PF AND REPLACE THEM WITH UPND APPOINTED OFFICIALS IS GOVERNANCE RETROGRESIVENESS!

Yes PF was corrupt, lawless and practiced maladministration to the core and, in accordance with the provision of the party constitution, employed partisans in these state positions such as PSs, LEAs and other state institutions and parastatals.

I personally find the demand on President HH to fire all PF appointed government officials and diplomats almost immediately as irrational and against the spirit and tenets of good governance.

The reasons being advanced for such a dramatic and drastic measure is, to a large extent, selfish and confrontational Which undermines the spirit of smooth transition.

The new Dawn government has been in power for just 30 days out of the 5 years mandate it has been given by the people of Zambia.

Those who have been appointed directors before to head an institution will agree with me that you don’t just get into the institution and start overhauling staff overnight.

The hiring and replacement is done gradually after due diligence and for the preservation of institutional memory until as CEO, you are finally done with old staff.

Over the fear that the new appointees are vetted by the old system and undermining the new administration, I beg to differ because, despite the system being intact with old staff, the UPND as a party is an institution which has been in existence for the past 23 years and must have a system it has been using to vet officials esp in adoption as candidates and also appointment to National Management Committee.

Therefore, am of the view that a duo vetting system can be applied before someone is finally appointed perhaps the reasons some appointment have questions here and there because UPND may be overriding the state vetting systems due to various reasons.

To this end, President HH must be given space to appoint people, not in haste, but with due diligence than forcing him to overhaul the establishment which may create institutional memory deficits.

Even when the old regime and appointees are in charge, the new dawn government system could have already infiltrated the state system and knows who is who and who is not.

The thirsty and hunger for jobs in government among diehard supporters of UPND, after being in opposition for 23 years, may be real and justified but forcing your leader to do things haphardly is more dangerous to him and the nation at large.

IN essence, as the country embarks of reforms, transition must be for 5 months I.e. from August to December 31.

The new government must start work in January preceding an election to pave way for smooth handovers, acclimatisation of appointed staff and those appointed by the new government will referred to as Minister designate, PS designate, Ambassador designate etal until January.

This will enable the new government deal with issues of staff appointments, vetting and ratifications, swearing in and oath taking and approval of the creation of new ministries and departments than the haste we are seeing now as if the mandate is ending in a day.

It will also allow the new government present its budget in readiness for execution in January when the financial year starts than expecting execution of another administration’s budget to fulfil electoral promises.

I am A Victim Of Politically Induced Corruption – Chitotela

PAMBASHE PF member of parliament Ronald Chitotela says the politically induced fight against corruption by law enforcement agencies like the Drug Enforcement Commission will not take the country anywhere.

Delivering his maiden speech and contributing to the motion moved by Vice-President Mutale Nalumango on the approval and establishment of government ministries and departments, Tuesday, Chitotela disclosed that some offices from the Drug Enforcement Commission apologized to him and explained that they were instructed to pursue innocent people.

“Politics of retribution will not take us anywhere. We sat and did what we did to the best of our ability. We are looking forward to a Zambia that is united, not Zambia of persecution, not a politically induced corruption fight where people begin going to Kawambwa to investigate a green 2,000 state-owned farm that it belongs to Chitotela and Lungu, shame. Where you start getting pictures of a house built in 2012 and you are telling Zambians that you are fighting corruption, shame. We are looking forward to a situation where you must be able to…how can building a house…? Let me come to the motion laid on the table by her honour the Vice-President,” Chitotela said.

“We know that Zambians hate corruption but Madam Speaker, corruption of character assassination will not take us anywhere or the fight against corruption through DEC which is politically induced will not take us anywhere. Let the institution of governance perform. I am speaking like this because I have been a victim where today officers come to apologize and explain how they were instructed to pursue innocent people.”

And Chitotela said people could not talk about infrastructure development in Zambia without mentioning him or former president Edgar Lungu.

“Let me also thank His Excellency the president for giving me the opportunity to serve in various capacities as a minister. Mr president Dr Edgar Chagwa Lungu, you are a statesman, you must walk with your head high. We cannot talk about infrastructure development in Zambia today without the mention of president Dr Edgar Chagwa Lungu and honorable Chitotela. Talk of the international airport at Kenneth Kaunda, it will go down in the history of Zambia bearing his name and my contribution.

I remember in 2018 we went to China, the Chinese government gave us a grant to put up Mulungushi International conference centre at the cost of US$ 31 million and Zambia next year will be hosting the African Union because of the hard work. I can boast that we have done a number of things for the good of this country. Sir you have delivered, I am talking about president Lungu,” he said.

Meanwhile, Chitotela supported the creation and merging of ministries, but added that domestic tourism should not be killed.

Losing An Election A Setback….but Do Not Despair, Kampyongo Tells PF Members

SHIWANG’ANDU PF member of parliament Stephen Kampyongo has encouraged his party members not to despair despite losing elections, but to continue with the dream left behind by Michael Sata.

And Kamfinsa member of parliament Christopher Kang’ombe says there is need to justify the abolishment of the Ministry of Chiefs and Traditional Affairs.

Delivering his maiden speech in parliament, Tuesday, Kampyongo said being voted out of government could be a setback but that was what democracy was about.

“I want to urge the members of the Patriotic Front that we shall continue with the dream left behind by Michael Chilufya Sata. Losing an election in terms of government could be a setback but this is what democracy is. We should not despair because it is time to look forward and prepare ourselves and unite as members of the Patriotic Front. To the people in Shiwang’andu that we shall continue the prudent use of the constituency development fund,” Kampyongo said.

“You have seen us put up a number of projects in the critical sectors such as the education, health and indeed road sector. To the people of Shiwang’andu, my commitment is that I will ensure that we shall continue working together. Indeed you may be concerned that after you had cast your vote, you could be hearing us going to the courts again but that is part of the justice system but your votes are your votes and do not worry about what happens.”

And Kampyongo said the PF would not be antagonistic but would offer effective checks and balances.

“We take note that His Excellency did take note of the omission of getting his Ministers sworn in before this motion was moved to this August House. I hope we have learnt lessons from there and we want going forward this institution to perform its duties without fear or favour. Article 92 provides for the executive functions of the President but similarly, Article 94 also provides that this institution does its work where there is need for the approval of parliament in terms of executive functions of the President. We are going to make sure that we give you offside checks,” he said.

“We will not be antagonistic but we shall offer you effective checks and balances. We had issues on Friday which we could have raised but we decided that we needed to be progressive because some of the colleagues that were being sworn in today as a remedial measure by the speaker should have been sworn in before taking seats in this August House. We could have treated them as strangers in this August House on Friday. So learning from this madam Vice-President, it is important that we follow the procedures through and ensure that this institution is given the respect it deserves.”

Meanwhile, in his maiden speech, Kamfinsa MP Christopher Kang’ombe said there was need to justify the abolishment of the Ministry of Chiefs and Traditional Affairs.

“My first observation is the many government Ministries that have to be realigned to ensure that the new Ministries perform their intended duties. I will be interested to get feedback on how soon the realignment process will be concluded. Obviously, with so many departments needing realignment, we do not want these Ministries to take forever before they begin performing their duties. Secondly when a Ministry is abolished or created, obviously there are reasons that are given. It will be necessary to amplify the reason for abolishing a very important Ministry called Chiefs and Traditional Affairs. The bigger majority of Zambia still remains under traditional leadership. So even as we support the creation of new Ministries we need justification for the abolishment of this very important Ministry,” said Kang’ombe.

PeP STATEMENT No.74 ISSUED ON THURSDAY 16th SEPTEMBER 2021: FOR IMMEDIATE RELEASE

1. As Patriots for Economic Progress (PeP) we agree with President Hakainde Hichilema that there was a lot of theft of public resources under the PF administration and that those resources need to be recovered and the perpetrators prosecuted.

However, we are of the considered view that the existing heads of law enforcement agencies and investigative wings such as Anti Corruption Commission (ACC), Drug Enforcement Commission (DEC) and Financial Intelligence Centre (FIC) are not the right people to champion the fight against corruption that took place under the PF administration as they themselves were in the middle of that corruption.

2. As Patriots for Economic Progress, we know for a fact that these investigative wings were very quiet during the PF administration, which makes them accomplices to the looting that took place.

The problem with having these same heads of investigative wings continue in their positions is that they are now too excited to please their new masters and are now even acting unprofessionally by disclosing intimate details of on-going investigations such as the alleged purchase of a bank by a Ward Councillor for K300 million. Instead of carrying out proper and professional investigations that can actually stand in court, these investigative wings are now in the business of grandstanding, trying very hard to get noticed as hard workers by the new administration. The problem that will arise from such an approach is that these investigative wings will end up bungling up these corruption cases such that the cases will be tainted and not prosecutable in court.

3. As Patriots for Economic Progress we wish to appeal to President Hakainde Hichilema to consider appointing new heads of investigative wings as soon as possible so that professionalism can be restored in the manner that criminal investigations are undertaken. If the President does not act quickly in this regard, there will be no corruption case left to prosecute and no stolen public resources to recover because all the cases would have been tainted and not prosecutable. When this happens, it is the Zambian people that will be the biggest losers.

High Court strikes out HH, others compensation for false imprisonment case from active cause list

HIGH Court judge Pixie Yangailo has struck out from the active cause list the matter in which President Hakainde Hichilema and his aides sued the State demanding compensation for false imprisonment.

According to an order dated September 14, judge Yangailo dismissed the matter for want of prosecution by the parties with liberty to restore it within 30 days.

“This matter is scheduled for status conference. The notice of hearing was issued on July 13, 2021 and served on the parties’ respective advocates on record.

Both parties are aware of today’s hearing but are absent. No reason has been advanced for their absence. A perusal of the record reveals that both parties have not complied with the order for directions,” read the order.

“This clearly shows that the parties are not willing to prosecute this matter. Accordingly, this matter is struck off the active cause list with liberty to restore within the next 30 days from the date hereof. Unless this matter is restored within the period stated, it shall stand dismissed for want of prosecution.”

President Hichilema, Hamusonde Hamaleka, Pretorius Haloba, Wallace Chakawa, Laston Mulilanduba and Muleya Hachinda wanted the Lusaka High Court to compel the state to indemnify them damages equivalent in value to the money and personal belongings lost when they were apprehended at the Community House in new Kasama in 2017.

The six were falsely imprisoned on allegations that they committed treason when the President’s convoy allegedly failed to give way to his predecessor Edgar Lungu’s motorcade on the Mongu-Limulunga road in April 2017.

According to a notice dated July, 2021 judge Yangailo had threatened to strike out the matter from the active cause list within seven days if the six did not take any step.

The plaintiffs asked the court to enter judgment in default of appearance against the State.

The court refused to enter judgment in favour of the six and ordered that it would hear the matter on September 14 and guided on how to proceed with the matter.

But the parties did not adhere to judge Yangailo’s order for directions nor appear before her for hearing, prompting her to throw out the matter.

President Hichilema, who was in opposition then, was seeking compensation for the money he lost and property that was looted, damaged and destroyed at his home four years ago during the unlawful April 10 and 11, 2017operation to arrest him.

The Head of State and his aides further wanted compensation for unlawful detention, unlawful prosecution, assault and battery, special damages for loss of income during the entire period of their incarceration, and damages for injury.

They also want damages for trespassing, loss of use of motor vehicle, a Toyota Hilux ALZ 2757 and ALZ 2710 for 34 days when they were in detention, among other reliefs.

President Hichilema, Hamaleka, Chakawa, Mulilabduba and Hachinda stated that they were jointly charged with treason, disobeying lawful orders and statutory duty while Haloba was not told the reason for his detention.

The six contended that their prosecution and the unsanitary and inhuman conditions they were subjected to during their detention humiliated and disgraced as well as brought them into ridicule and contempt both in Zambia and internationally.

“The plaintiffs will aver that they were wrongly imprisoned and deprived of their liberty, they were maliciously prosecuted, greatly injured in their credit, character, reputation and they suffered considerable mental and body pain, anguish, considerable trouble, inconvenience, anxiety and expense that they have been greatly injured in their business and they have suffered loss and damage,” they said.

The plaintiffs said particulars of malice were that the treason charge lacked overt acts as it was not thoroughly investigated.

They added that the admission by the State that the charge of treason was bad at law while insisting to prosecute them was malicious, an abuse of the criminal justice process and injurious on their dignity.

John Sangwa says HH may end up becoming a life President

Introduction

The 12 August 2021 general election was held in an imperfect environment and yet the outcome is so perfect that it is hard to believe that it is a product of voters that were voting independent of each other and in secret.

To avoid a second ballot, and all the attendant uncertainties, the voters gave fourteen (14) opposition political parties 2.21% of the votes cast, which was exceeded by the rejected votes of 2.55%. Former President Edgar Lungu (ECL) received 37.72% of the votes while President Hakainde Hichilema (HH) received 57.51% making it impossible for ECL to challenge the results. ECL and HH received a total 95.24% of the votes cast.

Whilst the outcome of the presidential election is absolute, the same cannot be said about the parliamentary election.

The Patriotic Front (PF) headed by ECL won 38% of the seats, while the new ruling party the United Party for National Development (UPND) headed by HH secured 53% of the seats. The independent candidates combined won 8% of the seats.

The people gave UPND enough votes to push through its economic policies and govern the country, but they denied it the two thirds majority required to alter the constitutional framework or to sanction the criminal prosecution of ECL as former President.

Similarly, even PF working together with all the independent members of the National Assembly cannot undermine the UPND government.

In a world where democracy has been in regression the outcome of the Zambian election has renewed hope in the democratic experiment. It is being studied by both pro-democracy movements and undemocratic governments, especially in Africa.

Opposition parties on the continent want to understand how Zambians secured such a spectacular electoral outcome and oppressive governments have the same interest but for different reasons: to ensure that what happened to ECL and the PF does not happen in their own countries. This workshop, which is titled “Review of the 2021 General Election and Challenges Facing the UPND Government” is therefore very opportune.

As we celebrate the outcome of this election and the resultant improved standing of Zambia as a democracy, possibly with no equal on the African continent, the celebrations must be tempered by the reality of what we may have unintentionally

created through the ballot. There is a possibility that Zambia has birthed a political party (UPND) that is likely to be in power longer than any other in history and a President (HH) who is likely to be the de facto life President.

The 12 August 2021 general election is likely to the last democratic election in Zambia for a long time to come. The very election that renewed our faith in the democratic experiment is likely to kill or undermine it. There are a number of factors that have led to this dark possible conclusion, which I have explored below.

The Rise of HH as Possible Life President

Trauma Inflicted on the People by ECL and PF Makes HH The Messiah.

The trauma of living in a near failed state characterised by economic and social collapse caused by mismanagement, wastage, corruption, incompetence and in certain instances blatant theft of public resources at all levels of government is real. Any President that rescues the electorates from such a traumatic existence is likely to be viewed as a messiah.

To a saviour there may be no strict adherence to the constitutional term limit. The debate around such a messianic presidency is likely to be why he should not continue in office but not why he should stay in office beyond his term. Instead of laws being respected they may be lawfully amended to permit his continued stay in power.

There is already an example of such a president in Africa in the form of Paul Kagame of Rwanda.
Whilst the Rwanda genocide cannot be compared to what Zambians experienced under ECL, nonetheless the ravages of ECL’s rule still has an enduring impact on Zambians.

Some Zambians have remarked that they feel liberated. They are free once again. The electorates will embrace any leader that frees them from such misery. All the ingredients for the possible emergence of a de facto life President are present.

Weak Institutions. ECL and PF did not just leave behind a collapsed economy but also a weak constitutional order which may favour the rise of HH as a de facto life President.

The combination of an economy destroyed by corruption, mismanagement and wastage, and constitutional and statutory institutions and offices run by unqualified and corrupt individuals gives HH a free reign in the design of his agenda which prioritises the damage caused by ECL and PF whose scale is yet to be determined.

The holders of the corrupt institutions at all levels of government having debased themselves to serve ECL lack the moral capacity to check on HH. In the face of the strong mandate given to HH by the electorate their continued stay in their respective offices is dependent on HH. They are ready and willing to serve the new head of state and government to atone for their misdeeds for their own personal survival.

A traumatised people desperate for any improvement in their lives may see no harm in changing the law to allow HH continue in office beyond the two five years limit.

To such a people the departure of HH may mean the possible return to the dark days of lawlessness and plunder of public resources by ECL and FP.

HH Used His Money to Gain Political Power. There are unique qualities that HH possesses, which may cause the people to trust him to stay in power for as long as he may desire. He is the only person, although the extent of his financial wealth is unknown, who was not poor going to office of President.

All his predecessors were poor at the time of assuming the office of President, and used political power to gain some measure of wealth or financial comfort. On the other hand HH has used his wealth to gain political power.

In fact, the quest for the presidency has been at a great financial cost to him personally. He can legitimately claim to have ascended to the office of President to serve the people.
HH’s Focus on the Presidency. Also to be factored in this equation is his singlemindedness in seeking the presidency. It legitimises his claim to serve the people.

No President has spent as much time as leader of an opposition political party as HH. UNIP was founded in 1959 and in January 1964, Kaunda, its President, became Prime Minister and President on 24 October 1964.

The founding of Movement for Multi- Party Democracy (MMD) in 1990 and election of Chiluba as President in 1991, was an historical event birthed by internal and external factors, which cannot as an example. President Mwanawasa was an anointed successor of President Chiluba.

President Banda was a person in the right place at the right place following the demise of President Mwanawasa. The ascension of Sata to the office of President, arose in response to President Chiluba choosing Mwanawasa as his successor.

Sata was in opposition for ten (10) years and his pursuit for the presidency had no clear agenda other than to prove that like Kaunda, Chiluba and Mwanawasa he could also be President of Zambia.

HH was in opposition for more than fifteen (15) years before being sworn into office as the seventh President of Zambia. During that period he turned down a union with President Mwanawasa in 2006 general election.

He equally refused to work in an alliance with President Banda in the general election of 2011.

The offer by Sata for HH to be his deputy in an alliance for the purpose of 2011 general election, did not dissuade him from his mission to be President of Zambia on his terms. He instead countered that he should be the President of the alliance with Sata as his Vice- President despite the PF holding more seat in the National Assembly than UPND.

His refusal to succumb to these offers shows his disdain for opportunism and legitimises his claim to serve the people. Therefore, unlike ECL and PF who had a parasitic relationship with the people, HH is likely to have a symbiotic relationship with the people.

He may remain in the office of President as long as he satisfies the needs of the people that elected him. Once the needs of the people are met the debate

is likely to be why the Constitution should be amended to remove the term limit and not why the Constitution should be respected.

The Possible Rise of UPND as a Dominant Political Party

Political Fatigue. Since the return to the multi-party constitutional order in 1991, more political parties have been created than in any other period in the life of the Republic. However, most of them are defunct and of those that have survived the majority are briefcase political parties than viable political parties likely to threaten UPND’s hold on power.

The voters are tired of such political parties and the proof of that lies in the fact that the presidential candidates of the fourteen (14) political parties combined received 2.2% of the votes cast in the 2021 general election and the one (1) seat, which is essentially a UPND seat. It is therefore unlikely, should HH and the UPND meet their campaign promises to the people, that in the next ten years that a political party will emerge that is likely to challenge the UPND.

The last thirty years has shown that it is the people and not the founders that determine the life of a political party.

Political parties are not ideologically defined or driven and their electability is determined by how well they have identified the pressing needs and aspirations of the people and their response. The people will rally behind such a party and will abandon it when they are betrayed.

UPND’s hold on power is, therefore, likely to continue and allow it to morph into a dominant political party unless it fails to deliver on its commitment to the people.

PF More of a Crime Syndicate Than a Political Party. Although ECL received 37% of the votes and the PF won 59 seats it is unlikely that the party will survive long enough to grow and challenge the UPND.

Under ECL the PF ceased to exist as a party and became a vehicle for personal enrichment. The only thing that united its membership, including at a lower level, was its parasitic relationship with the government and government related institutions.

No effort was made to grow PF financially and structurally so that it can survive as an opposition party. With its flow of funds cut off, it is unlikely that it will survive and grow strong enough to challenge UPND.

Deliberate Campaign to Destroy the PF.

Zambia’s Presidential Parliamentary system of government is founded on the tenet that an opposition party is necessary for the proper working of the system.

The structure is supposed to operate on the premise that there exists some shared standards and rules of the game that permit peaceful inter-party collaboration or compromise in the process of political interaction. Unfortunately this idea has not taken root.

A political party on coming to power does not hesitate to employ its organisational weapons and exploit all options to deal with its opponents or members of the opposing party.

On ascending to power in 1964, Kaunda and the UNIP proscribed all opposition political parties that threated their hold on power. In 1972 the UNIP became the only legally recognised political party in Zambia.

After losing power to the MMD in 1991 general election the UNIP became the opposition party.

Through the amendment of the Constitution in 1996, the MMD destroyed the UNIP.
On attaining power in 2011, President Sata and the PF made the existence of MMD impossible.

The party that championed the return to a multi-party political order is now a political party in name only: it has no seat in the National Assembly.

The UPND has not restrained it from pursuing the same strategy. It has taken steps to destroy PF by petitioning for the annulment of the election results in more than 50 constituencies won by the PF.

With a compromised judiciary, the possibility of UPND winning most of these cases cannot be discounted. It only needs to win at least 18 more seats in the by-elections to secure two-third of the seats in the National Assembly and have enough votes to alter the Constitution should need arise.

There is a possible second phase in the quest to secure two-third of the votes in the National Assembly before the next general election in 2026, if UPND does not win enough seats in the by-election.

Most of the PF Members of National Assembly are likely to be arrested, indicted and convicted for various offences touching on theft of public funds before the end of 2026. That should force another set of by-elections, which UPND is certain to win.

Even if UPND does not secure two-third of the seats in the National Assembly during the life of this Parliament, but meets most its promises to the people, it is likely to win more than two third of the seats in the 2026 general election.

HH and UPND’s Focus on the Economy

Most post-colonial African countries, including Zambia, have had four major pressing needs on attaining independence.

The first has been to forge “the bonds of unity and nationhood, and to foster wider loyalties beyond parochial, tribal or regional confines.” Through the elections HH this need appears to have been met. His election was possible because the electorate was united beyond tribal or regional lines.

The second need entail converting a largely subsistence economy into a modern cash economy without unleashing social turbulence and economic chaos.

The third necessity is to industrialise the country and introduce a sophisticated system of agriculture. The ultimate end is to erase poverty, disease and illiteracy, raise the standard of living of the people, and in short create a modern state with all its trappings.

All incumbent Presidents and ruling parties were removed from power (President Kaunda in 1991, President Banda in 2011 and ECL in 2021) because they failed to meet these needs.

The Economic Experience Under Kaunda and UNIP.

The experience between 1964 and the end of the 1980’s shows that the electorate cares less about who is in power as long their basic needs are met. This partly explains why President Kaunda remained in power for nearly thirty (30) years.

His government took care of the people literally from the cradle to the grave.

It was partly for this reason that the people were able to vote in the referendum of 1969, in favour of the removal of the entrenched provisions of the Constitution meant to protect and benefit them.

It was on account of the economic well-being of the country that President Kaunda was confident enough, in 1972 without consulting the people or debate, to designate United National Independence Party (UNIP) as the only lawful political party in Zambia.

The people remained unmoved when the Independence Constitution was replaced by the one-party constitution of 1973.

It was also for the same reason that the country remained under a state of emergency from 1964 until 1991, when President Kaunda’s reign ended.

The existence of the state of emergency rendered the enjoyment of the rights and freedoms guaranteed by the Bill of Rights, as a discretion of those who wielded political power. There was no campaign calling for the end of the state of emergency.

Although external factors, such as the collapse of the Soviet Union and the emergence of unipolar world played a role, the end of the Kaunda presidency was caused largely by the collapse of the economy.

The social and economic infrastructure established in the few years immediately after independence lay in ruins.

The road network had collapsed, hospitals had no medicines and schools lay in a state of disrepair. The unemployment levels soared and people’s buying power tumbled.

The country’s external debt soared to an all-time high. By the middle of the 1980s the International Monetary Fund (IMF) had lent more money to Zambia than to any other country in Sub-Saharan Africa.

The country’s total external debt was about US$3.5 billion at the end of 1984. By 1986 it had risen to US$5.1 billion and US$6 billion by 1988. The impact of the debt was graphically presented on a per capita basis. It represented a debt in excess of US$700 for every Zambian, just about the worst in Africa at the time.

The Economy Under President Banda and MMD. After years of dutifully implementing the structural adjustment programme dictated by the international lending institutions, Zambia qualified for debt forgiveness based on the terms set by the G8 Summit at Gleneagles in Scotland in 2005. Its debt of over US$7 Billion was reduced to less than US$1 Billion.

By the end 2010 the economy had stabilised. The cancellation of external debt and the improvement in the price of copper helped the country financially.

The government was able to meet its budget without external assistance prompting President Banda to tell some of the diplomats that if they were not happy with the way things were in Zambia they were free to leave the country.

Despite these improvements the economy and corruption were some of the factors that led to President Banda losing power in the election of 2011.

Although the economy had improved there was no trickle-down effect to the people. The suspected award of government contracts to President Banda’s children and suspected direct involvement in the governance of the country did not sit well with the people.

That the MMD had been in power for twenty years did not President Banda.

It was time for change.
Sata was also able to convince the electorate that they had a raw deal under the MMD and he was their saviour. In desperation the people bought into the promise of “more money your pocket”, without questioning how this was to be realised.

There is no doubt that years of strict implementation of the structural adjustment programme had taken its toll on the people.

The mere promise of better economic opportunities was enough for them to vote in favour of Sata and PF.

Collapse of the Economy Under ECL and PF. The PF inherited a robust economy.

As of September 2011, when President Sata was sworn as President the exchange rate between the US$ and the Zambian Kwacha was about US$1 to about K4.00 (rebased); inflation was around 8% and the external debt was less than US$2 billion.

However, President Sata convinced the people that he could do better.
In ten years PF managed to wipe out all the gains the country had made in the twenty years of belt-tightening under the MMD rule.

At the time of the election on 12 August 2021, the admitted external debt was US$13 Billion and with the population at 18 million, the PF government managed to restore the debt per capita to the pre-1991 level of more than US$700 per person.

Debts were contracted and projects where undertaken and funded by government not on the basis of how they would benefit the economy and the people but how much those who wielded political would benefit.

Given this scenario and the experience of President Kaunda in 1991 and President Banda in 2011 it was impossible for ECL and PF the to win the 2021 general election. It was therefore difficult to comprehend the source of ECL’s and the PF’s confidence that they would win the election.

A win was possible only if ECL and the PF were to openly and blatantly steal the election. Fortunately, this they failed to do.

HH and UPND understand the nexus between the economic and social well-being of the people and the President’s and his party’s hold on power. They are unlikely to make the same mistake.

The indications are that they have given priority to the economy and they have international goodwill.
Renewed International Support and Interest in Zambia. There are strong indicators that despite the country’s high external debt, HH is likely to grow the economy to levels never seen before in the history of the country.

The optimism is borne out of a number of factors. ECL set a very low bar in the management of the economy and country in general. HH inherits power from a very corrupt and incompetent administration. The very prospects of the HH election win was enough to see the local currency gain its strength.

HH’s election has brought renewed confidence in the Zambian economy and simply arresting wastage, blatant theft of public resources the improvement to the economy is likely to be felt by the people.

HH has been elected at the time when there is renewed interest in democracy by Western countries and international organisations. Zambia is surrounded by countries with dominant political parties where competition for political power is more intra-party than inter-party.

Elections do not result in the change of the political parties in power. There is therefore cause to make Zambia an example of democratic success.

The Appointment of Musokotwana as Minister of Finance. That HH’s first ministerial appointment of Musokotwane as Minister of Finance shows that he has learnt from the mistakes of his predecessors and prioritised the economy.

Temptation to Remove Presidential Term Limit.

Whilst there is no limit to the number of years a political party can be the dominant party, the Constitution limits the number of times HH can hold the office of President.

It will require a high moral restraint on his part to resist the temptation to repeal Article 106(3) of the Constitution and remove the term limit.
So far no President in Zambia has exercised or exhibited such restraint.

Despite ruining the country’s economy during his 27 year rule Kaunda was determined to stay on as President. Even after losing the election of 1991, Kaunda was still strong- minded to contest the election of 1996.

Despite the existence of express constitutional provision limiting the number of times one could contest for election to the office of President, President Chiluba entertained the possibility of removing the term limit and contest for election to the office of President for the third time in 2001.

Again, notwithstanding the express provision in Article 106(3) of the Constitution that “A person who has twice held office as President is not eligible for election as President” ECL with the help of a Constitutional Court he packed managed to secure his name on the presidential ballot paper.

Conclusion

To maintain the vibrance of the Zambian democracy there is need to counter the possible emergence of UPND as a dominant political party and ensure that HH holds the office of President twice only.

The starting point on this mission is to revitalise the constitutional order decimated during the reign of ECL and the PF by ensuring that constitutional institutions and offices are occupied by people that are qualified.

This demand must be driven by people.

The renewal of the constitutional order must be coupled by a deliberate and conscious decision to birth a strong opposition party to rival the UPND.

Thereafter the right to govern should be given to the presidential candidate and party that will meet the needs and aspirations of the people.

Finally, there is also need to change the voters’ mindset.

They need to embrace the notion that politicians are elected to serve them and when they do improve their well- being that achievement should not be perceived as a favour but as their entitlement. They should always ask for more from those they give the mandate to govern.

ACC Investigating Secret and illegal Account used to Siphon Millions of Kwacha at Finance Ministry

The Anti-Corruption Commission (ACC) says it has received a total of 87 reports of suspected cases of corruption since the just ended general elections.

ACC Spokesperson Queen Chibwe says of the 87 cases, 55 relate to high public interest cases some of which involve politically exposed persons.

Speaking during a media briefing at the ACC offices in Lusaka today, Ms. Chibwe explained that the Commission is investigating a senior public official at a quasi-government institution in a matter involving the alleged purchase of 12 motor vehicles worth K33.6 million used during the last general election campaigns.

She said ACC is also investigating a matter involving an alleged secret and illegal account at the Ministry of Finance purportedly used to siphon millions of Kwacha.

Ms. Chibwe further said the Commission is also investigating former senior government officials at the Ministry of Health for allegedly awarding contracts for the purchase of pandemic protective equipment to businessmen without following procedure.

“This is a new case and is different from the Honey Bee case,” she said.

The ACC spokesperson stated that the Commission is investigating two former senior police officials into illegal trading of mukula trees that were transported to unknown destinations.

Ms. Chibwe said investigations are underway against officials at the Ministry of Local Government into alleged illegal awarding of contracts for roadworks worth over K10 million to two private companies which did not execute the works in Central Province.

She added that ACC is also investigating the alleged illegal purchase of six houses in one of Lusaka’s low density areas and owning property which include a fleet of motor vehicles suspected to be proceeds of crime by a senior public official.

Ms. Chibwe explained that a former government official at the Ministry of Foreign Affairs is being investigated for allegedly acquiring seven houses and other property reasonably suspected to be proceeds of crime in one of Lusaka’s low density areas.

She said an investigation against one of the senior managers at a development Bank of Zambia (DBZ) is underway for alleged abuse of company financial resources which were used to pay for school fees both locally and abroad worth over K1 million.

She further said a former ward councillor of Lusaka is being investigated for the suspicious purchase of a named bank together with all of the bank’s assets worth K300 million.

Ms. Chibwe disclosed that officials at DMMU are being investigated for allegedly buying an unknown number of Toyota Land Cruisers using pandemic funds and other resources meant for disaster relief for political activities in the last general elections.

She explained that the cases were reported to the Commission by members of the public after a change of government.

She has since appealed to the public to take advantage of government’s commitment to the fight against corruption by reporting suspected cases of corruption.

The Commission has commended President Hakainde Hichilema for his stance to allow the investigative wings to work without interference.

Ms. Chibwe noted that President Hichilema’s pronouncement on zero tolerance to corruption gives the Commission impetus and vigor to confront the scourge of corruption head on and continue developing and implementing enhanced strategies to stem out the vice in both public and private institutions.
