Police have turned police reserve William Shawa into a state witness while Francis Chipyoka, the alleged mastermind in the murder of Independent Broadcasting Authority director general Guntila Muleya, has been charged with murder.

They didn’t say he is free Boss, they just specified who have been charged with murder, there are many charges and this reserve will have his share, otherwise he is not walking away free from this. You are very right by saying he is an accomplice
Bean, a state witness can’t be prosecuted. The police have circumstantial evidence but no witnesses. It’s very difficult for them to prove beyond reasonable doubt without a witness. The state witness is the person who was approached by the accountant and he then contacted the other accused to commit the crime. He was further present when the murder took place and I believe he informed the IBA account when the did was done.
Sadly, he will walk away free and cannot be pursued for his role in this even in the future.
Aaaaaah, is that how it will be? Then our laws are different, I watch from crime investigations and see the person who ‘hulula ‘ (witness and accomplice) gets less charge or even charged the same as others. My apologies for the error Mr Katwishi.
The information obtained from him does not let him off the hook yet.He would have not particited in the killing by reporting the scheme to relevant Officers. All the information he gave you wont bring Muleya to life. Hang him too.Dont be biased in this case.Why didn’t you turn Zulu into state witness ?

Let one offender and squizz 3 offenders.Yes, murderers have gone free in our world after committing serious murder cases because the courts usually want convincing facts to prove beyond reasonable doubt that the offenders or accused really did commit the murder.A witness plays a very serious role he is the fulcrum or pivot to lead and give that elusion or true picture not by imagination but step by step understanding how the whole murder was planned up to the excusion point.And outlining the role each accused person played.The actual or true person who nugged the trigger shall be known.And the judges always want to know the intensions of the acts and roles played and of course the prescription given to such offenders according to the books of law.The police or procecutors try by all means to close loop holes to avoid the freeing of offenders.The offenders have a tendency of changing goal positions, at police they agree to anything at court they disagree to all trying to secure their freedoms.Read the story about O.J Simpson’s murder case.USA.
Its not absolute that the turned to state witness offender may go scot free it all depends on details in the bargaining! For example if he’d been the one that pulled the trigger in the murder which could earn him a hanging the bargaining could be for a lesser sentence a time incarceration or other saving him from the noose, lethal injection or, electric chair!
