This afternoon High Court Judge S. Chocho has thrown out Hon Brian Mundubile injunction application against Miles Bwalya Sampa (MBS) as the duly elected President (until 2026) of the PF after last month PF extra ordinary general conference in Lusaka.
So in what capacity did this Mundubile go to seek this injuction or its just another show of pf arrogance? So tomorrow it will be HH has ordered the court ?????
Courts are open to anyone who feels aggrieved. They have to listen and then decide although the Constitutional Court has in the past refused to hear some matters properly brought before it.
You see, a few days ago I warned PF members to be wary of the arrogance and lies of Given Lubinda and Nakachinda. I stated that these two men were misleading the members into confusion. They defied the court orders restraining them from masquerading as top office bearers of the PF. They went ahead and breached their own party constitution just to create space for Edgar Lungu. Miles Sampa saw through their foolishness and seized the opportunity. He used the party constitution to take over leadership. By law Sampa is on firm ground.
The Registrar of Societies, the courts and the Speaker of the National Assembly are bound by the law in this case. Their decisions and rulings in this saga is base on law. It’s just unfortunate the Lubindas are on the wrong side.
Blaming President Hakainde Hichilema and the UPND government is totally unfounded. Blaming the Speaker is equally unfounded.
These PF MPs should actually be very careful. They may do something stupid that may make Miles Sampa to expel them. If that happens, the courts will accept that.
