BROTHER KILLS BROTHER IN LOVE TRIANGLE

 

A TRAGIC love triangle has exploded in Chongwe following the killing of a 49 year old man by his young brother for allegedly fooling around with his wife.

The elder brother of Ntanisha village in Chongwe was allegedly murdered by his young brother after he was found lying in wait for his young brother’s wife in his sibling’s house.

A neighbor, who refused to be named claims that the deceased had an affair with his young brother’s wife. It is believed that on Wednesday, June 10 the suspect Chipwalu Kandini, 37 went on a drinking spree with his wife, Mirraim Banda, 37.

The duo met Chipwalu’s elder brother identified as Raphael Kandini, at a drinking place in the same village. It is alleged that the elder brother arranged to meet his lover at her matrimonial home as they thought the younger brother was too drunk to walk home.

In unexpected circumstances the young brother kept an eye on his wife.

The elder brother is reported to have met his fate when his lover showed up in the company of her husband.

It is alleged that the young brother picked a stick and hit the brother who fell to the ground and then hit him with a stone on his head.

The young brother allegedly concealed the body in a shallow pit in his yard after he discovered that he had indeed killed him.

The suspect’s wife did not reveal the ordeal to anyone. After two days of the elder brother’s disappearance, the accused decided to dump the body along the road about 200 meters away from his house. He was helped to remove the body from the pit by his wife.

The body was discovered by a young girl in the morning of June 13. The residents who went to the scene after the young girl alerted them reported the matter to Chongwe police.

Police rushed to the scene and picked the body which was found with bruises and a disfigured head. The body was found naked and police later retrieved his clothes from the suspect’s home where they were hidden in a pit latrine.

Police spokesperson Esther Katongo confirmed the arrest of the couple who are currently remanded in police custody awaiting to be formally charged.
Meanwhile, the body has been deposited in Chongwe hospital mortuary awaiting postmortem and burial.

And Chongwe area member of parliament, Mr. Japhen Mwakalombe who accompanied the police during a reconstruction of the crime at the scene described the incident as unfortunate. He later visited the funeral home and offered to assist with burial costs. He appealed to residents to seek amicable ways of resolving their differences rather than resorting to such acts.

Chongwe district commissioner, Mr. Robster Mwanza appealed to the residents not to take the law in their own hands, but inform the law enforcers to do their job under whatever circumstance. He described the act as barbaric and bemoaned the loss of life and an apprehension from the same family.

Dear Madam,

REF: INCITING YOUTHS TO ATTACK NEWS DIGGERS

We are in receipt of your letter dated June 12, 2020 in which you, as Minister of Information and Broadcasting Services, expressed concern over what you termed as the use of a derogatory word “stupid” by ourselves in reference to one of our editorial comments.

We are grateful, Honourable Minister, that you reached out to us to express your concern and to offer your advice on behalf of government. Dialogue is extremely important between the ministry that you head and media houses.
Honourable minister, you particularly picked the word “stupid” as being unacceptable to the PF government. We find it strange that the ministry missed the press conference by the Lusaka Province Minister Mr Bowman Lusambo who referred to the youths who commented on bad governance as “stupid”, “disgruntled”, “naked”and “nonsensical”, among other words.

For ease of reference, we quote just one paragraph from Mr Lusambo’s briefing: “I want to urge Kings Malembe Malembe, I want to urge the Cameraman (Chellah Tukuta), I want to urge B-flow and his team that can you desist from bringing the name of the country, the name of government into disrepute. This is stupidity of the highest level, and we are not going to allow this here in Lusaka Province. I want to urge Kings Malembe Malembe that I am giving him 24 hours to apologise to the President for releasing those stinking nonsense…As Minister for Lusaka Province, I can assure these
boys that they are too naked to misbehave!… It is now a fashion to some of these disgruntled youths to advise the President using social media, not in Lusaka Province, that is lawlessness!”

We wonder why we have not heard of any reprimand of the Lusaka Province Minister for calling the youths who were expressing themselves on governance issues as “stupid”.

We cannot imagine that a Minister of your caliber and political acumen would fail to appreciate the fact that News Diggers was merely quoting the words “stupid” as used by
the Honourable Minister of Lusaka. The question is why would the Minister suggest that News Diggers has opened itself to attacks from the youths for the perceived use of derogatory language when you did not see the need for the same youths to retaliate against Mr Lusambo when he used the same words complained about?

As minister in harge of information dissemination, why didn’t you see anything wrong with Mr Lusambo’s threats on people‘s liberties and freedom of expression? We don’t think you expect our newspaper to apologise for quoting the words that were used by your fellow minister.

We however find that the motive of your letter was to incite youths to attack News Diggers if the newspaper does not apologise. This is a deliberate invitation on the PF youths to kneel on our necks until we suffocate like George Floyd.

This is obviously motivated by the fact that our organization has remained resilient in keeping the PF government accountable. It appears to us that after the demise of Prime TV, the government has placed News Diggers as next on the agenda for closure, and it hopes the youths can do the needful.

News Diggers has not called anyone “stupid”, we only quoted what the Minister of Lusaka said and therefore, if anyone has to apologise, it should be Mr Lusambo, not us.

But even assuming that we did originate the use of the word complained about, there is no way that you, as a minister who should care about press freedom, would incite cadres to attack a news organization. It is strange that as a Minister who was condemning the PF attacks on Iso FM radioin Muchinga Province last month, you can now suggest that it would be justifiable for youths to attack News Diggers. We wish to put it on record that any attacks on our organisation will be treated as government sponsored, at the instigation of the Ministry of Information and Broadcasting.

Honourable Minister, you say media houses in Zambia are not advocacy institutions. We say, minus one! News Diggers is, in fact, an advocacy institution and it ispart of our core
values to advocate for good governance, press freedom and freedom of expression among other constitutionally guaranteed liberties. Our newspaper is at war against corruption, abuse of office and any tendencies that threaten our cherished democratic space.

We wish to state that while there might be a burning desire by the Minister or other persons unknown, to close down News Diggers for the critical role it has continued to play in exposing bad governance, our politicians must be reminded that government positions are not permanent. Sooner or later, their time in office will end and they will need the same media houses that they now so desperately wish to close down, as
platforms for airing their grievances.

In view of what we have explained above, our newspaper is not in a position to issue an apology. But we appreciate your effort to write to us, and expressing your interpretation of our editorial opinion, skewed as it may be. We here now throw back the challenge to you to call on the youths to desist from attacking News Diggers or any other media house, if you truly and patriotically, as a journalist, stand for media freedom.

BILL 10 NOT EVIL – PRINCE MWANANYANDA YETA

Mwananyanda Yeta who is the Son to senior chief Inyambo Yeta of Mwandi Kuta, who some days ago refuted the articles that were published on both The Diggers newspaper and The Mast has today revealed that the bill 10 is not evil.

After the newspaper quoted him in supporting Bill 10 , he came on social media and refuted the allegations and said it was not true. But today he has again come out this way…

As we all know that the Constitution Amendment Bill No 10 debate will resume today in Parliament, I urge you folks to follow the proceedings as they unfold.

MY TAKE

Is the Constitution Amendment Bill No 10 of 2019 a bad Law?
Absolutely, it is a bad Law that if passes on the floor of Parliament, it may bring even further animosity currently prevailing in our country.
Is the Constitution Amendment Bill No 10 of 2019 an evil Law?

I do not think so. Something which is evil is condemned in all aspect. I have heard those opposing bill 10 recommending certain Clauses therein as progressive and good. Therefore, I don’t think calling it evil is ideal.

I therefore reiterate my earlier true meaning statement I made in Bulozi Land that, it is my earnest appeal to our traditional leaders to sit down our members of Parliament, be it the ruling PF or the opposition UPND, INDEPENDENTS and other political parties represented in Parliament to put the NATIONAL INTEREST FIRST before their political agendas.

What therefore do I mean when I say NATIONAL INTEREST? If it is the will of the Zambian People to the Bill passed, so be it. If it is the will of the Zambian People to have it withdrawn, so be it. That is being patriotic to your country because Members of Parliament exist in that house because of people who elects them. I also urge our Members of Parliament to exercise their INDEPENDENT JUDGEMENT away from their political positions. Let them ask themselves these questions, If I was to take this decision am about to make, will it be in the best interest of the country? What could be the repercussions of my decision? Etc.

In conclusion, I want to urge you colleagues to spend time to read this Bill if at all you haven’t read it yet. Get the copy of our current Constitution and the proposed Bill No 10, see what the Bill seeks to amend in the current Constitution. That way you will appreciate everything well

Lil Wayne’s new girl Denise Bidot confirms relationship on Instagram

Lil Wayne’s new girlfriend Denise Bidot surprised fans of the 37-year-old rapper on Monday by confirming their budding relationship via Instagram Story.

‘Somehow in the middle of all the madness, something special happened,’ captioned the 34-year-old model, who included three loved up photos of herself and Wayne in the post.

Bidot’s relationship confirmation comes just one month after Lil Wayne’s split from rumored fiancee and Australian model La’tecia Thomas.

In the photo booth style portraits, Denise wowed in a blue shimmering top as she and the A Milli rapper leaned in close to one another.

Lil Wayne donned a white button down and had a bevy on bling on his fingers and wrist.

In the first photo, Denise appeared to be laughing up a storm as Lil Wayne kissed the side of her head and placed his arm around her.

During the latest episode of his Apple Music series Young Money Radio with Lil Wayne, the rapper confirmed he was in a relationship as he discussed married life with fellow rapper Nicki Minaj.

‘Remember when you was telling me that I be having an attitude all the time because I needed good d**k? You was right though,’ said Minaj.

To which, Lil Wayne replied: ‘I just hope my girl heard that, that’s all.’

His prior relationship with La’tecia Thomas reportedly came to an end in May – after having dated for the majority of 2019.

Rumors regarding the pair’s engagement were initially sparked in December when Thomas was spotted wearing what appeared to be a diamond engagement ring on her wedding finger, as reported by The Rap-Up.

As if fans were not excited enough, Wayne added even more fuel to the fire when he released his rap track Not Me in late January.

In the over three-minute tune, Lil Wayne refers to Thomas as his ‘wifey from Australia.’

Ghanaian Minister Invites African Americans To Re-settle In The Country Amid Protests

Year of the Return was a successful tourism initiative designed by Ghana to encourage African Americans and others within the African diaspora to visit the country marking the 400th anniversary of the first documented arrival of slaves from West Africa to America as a hub of the Trans-Atlantic slave trade. The campaign sparked dialogue around African Americans embracing their lost roots but also if they should consider relocating to the continent to seek more opportunities in addition to escaping the systemic racism they face in the United States. Amid the recent protests over the deaths of George Floyd, Breonna Taylor, and countless others in the news, a Ghanian politician recently extended a hand of welcome to those who want to leave U.S. behind.

Last week, a ceremony honoring the death of George Floyd was held at the W.E.B Du Bois Memorial Centre for Pan-African Culture in the city of Accra. Barbara Oteng Gyasi, a local politician and member of Parliament, spoke out after the racism in the United States to offer solidarity with African Americans abroad, offering them refuge in Ghana.

“We gather in solidarity with brothers and sisters to change the status quo. Racism must end. We pray and hope that George Floyd’s death will not be in vain but will bring an end to prejudice and racial discrimination across the world,” Oteng Gyasi said, according to Newsweek. “We continue to open our arms and invite all our brothers and sisters home. Ghana is your home. Africa is your home. We have our arms wide open ready to welcome you home…Please take advantage, come home, build a life in Ghana. You do not have to stay where you are not wanted forever, you have a choice and Africa is waiting for you.”

Since the success of the tourism initiative, the government had planned to continue to build on it with a new program “Beyond the Return” which aims to encourage investment in Ghana, specifically targeting African Americans.

“We feel that given the wealth that African Americans and black Americans have, given that spending power, travel budgets of blacks in America,” Akwasi Agyeman, CEO of Ghana Tourism Authority. “We felt that it’s about time that we start that conversation that, instead of moving to any other destination, come back to where you came from.”

LUNGU ISN’T A GOOD MAN – SEJANI

ACKSON Sejani says it will be naive for anybody including MISA Zambia to sit down with President Edgar Lungu and talk about press freedom.

Sejani argues that the day, for instance, Bowman Lusambo became civil and started respecting people and their human rights he will be sacked by President lungu.

“He will be sacked because he will no longer be doing what pleases the appointing authority as per the brief. That is why I laugh at people who say that the President is himself a good man but surrounded by bad people,” he explained.

Sejani said it would be more tragic to even believe a single word coming from President Lungu about how he respects press freedom and how he intends to create a conducive environment for a free press to thrive.

“To the wise, his actions speak louder than his words,” Sejani said.

Last Thursday when he met Media Institute of Southern Africa (MISA) Zambian Chapter staff at State House, President Lungu claimed that he did not support harassment of journalists.

“We support the media, and as we go to the 2021 general elections, we will stand by you. We will ensure that our supporters are sensitised not to hinder the operations of the media. Politicians and the police need you. We would like to give the media the best environment so that they can report truthfully what they regard as newsworthy,” President Lungu said, according to a statement issued by press aide Isaac Chipampe. “What happened in these provinces (Muchinga and Northern where PF cadres invaded radio stations recently) was unfortunate. Violence against journalists is a concern to government and these acts should not be justified whether they are happening in our strongholds or not. As government we will not protect anyone breaking the law. Law breakers ought to be dealt with by law enforcers regardless of their affiliation. When crime has been committed law has to take its course.”

Reacting to the President, Sejani said the assault on free press was being spearheaded by presidential appointees in the shape of ministers, permanent secretaries and that even district commissioners had joined the fray.

“These appointees serve at the pleasure of the President. If the President is not pleased with what they are doing he will fire them. So when you see the likes of Bowman Lusambo, Dora Siliya and others harassing the media, they are doing so at the pleasure of the appointing authority,” he said. “They are following the brief they were given by the appointing authority. The moment they depart from this brief they will be sacked. If, for example, Mr Lusambo became civil and started respecting people and their human rights he will be sacked by Mr lungu. He will be sacked because he will no longer be doing what pleases the appointing authority as per the brief. That is why I laugh at people who say that the President is himself a good man but surrounded by bad people. This is a foolish argument to make! The President freely chose his team without anyone twisting his arms. As for Mr Lungu he even brought back some characters that were discarded by Mr Sata. He brought back proven wrong doers. How can anyone, therefore, today claim that the President is a good man surrounded by bad people. If the appointees are bad people doing bad things but are kept in their positions by the appointing authority, it means only one thing that the appointing authority is worse. Given what I have said it will be naive for anybody, including MISA Zambia, to sit down with Mr Lungu and talk about press freedom.”

Sejani, who served as local government minister in the Frederick Chiluba administration, said a government that literally urinates in the mouths of journalists to stop them from speaking freely cannot claim to respect press freedom.

“The unfortunate journalist who experienced this strange way of honouring press freedom in Chipata will agree with me. A government that holds the continental record for most harassment and closures of media houses cannot claim to respect press freedom,” he stressed. “Give me a dictator, even the most vicious, in Africa who has harassed more media houses than Mr Lungu. The Post newspaper and Prime TV can attest to this. Under Mr Lungu Muvi TV and many radio stations have had their experiences at the hands of this great champion of press freedom. It is only in Zambia where an opposition leader is forced to escape through the roof of a radio station to escape lynching from an intolerant regime.”

Sejani noted that recently the nation witnessed frightening levels of intolerance where radio stations were attacked for hosting a voice of an opposition leader.

“Strangely in all these incidents not a single person has been brought to book. Feeble statements are produced from time to time by some government officials to give an impression that someone is concerned when in fact not. It’s all just to make citizens believe so,” said Sejani. “A government that consciously sits down to draw a strategic plan for purposes of gagging the press cannot claim to respect press freedom. Under its four-year strategic plan, the PF is setting up a media intelligence centre to be fully equipped and supported with permanent bloggers, hackers, reporters and others. The purpose of this centre is to dominate media space and control all air waves in Zambia. The actions of all these PF operatives are not therefore isolated incidents of indiscipline by them but they are actions informed by this well scripted action plan.”

Chipenzi questions ECZ ‘eminent’ persons’ observatory, advisory team appointment

McDONALD Chipenzi has asked who defines the ECZ’s eight-member observatory and advisory team as eminent persons and whether or not they are conversant with the electoral process.

He is wondering whether those in the observatory and advisory team are able to perform as commissioners for the Electoral Commission of Zambia (ECZ).

During a media briefing at the ECZ offices in Lusaka on Friday, Patrick Nshindano, the Commission’s chief elections officer, announced the names of the ‘eminent’ Zambians, who are believed/expected to be politically impartial.

Those in the observatory and advisory committee are General Benjamin Mibenge (retired), Professor Enala Tembo-Mwase from the University of Zambia (UNZA), Professor Owen Sichone from the Copperbelt University (CBU), Professor Edwin Zulu from Justo Mwale University and Reverend Emmanuel K Mwale from the United Church of Zambia (UCZ).

Others are Mirriam Munyinda, Hellen Samatebele from the civil society and Willie Sweta.

Nshindano said the ECZ hopes that the team would render services to enhance the credibility of the country’s electoral process.

“We do strongly believe in their capabilities and objectivity and this has been done in line with the law and the Commission is in order putting up such a structure,” said Nshindano. “This happens in many other management bodies around the world and on the [African] continent, including different bodies such as the UN, Commonwealth. They do set up such bodies which are observatory as well as advisory to the existing structures.”

But in a statement, Governance, Elections, Advocacy, Research Services (GEARS) Initiative Zambia executive director Chipenzi said his organisation was very saddened by the ECZ’s decision: “to unilaterally appoint an electoral observatory and advisory group of eminent persons.”

He stated that he was aware that the group’s mandate was to advise the ECZ on electoral matters like electoral violence.

Chipenzi, however, argued that the appointment of those ‘eminent’ persons was contrary to the provisions of the ECZ Act No. 25, as amended by Act No. 5 of 2019 section 4(3) (b).

He said the citation guided the Commission that: “it may, in furtherance of its functions, undertake consultations, public hearings and inquiries for purposes of performing its functions under the Constitution and this Act.”

“This appointment of the electoral observatory and advisory group of eminent persons by the Commission is one that needed serious consultations among stakeholders to get buy-in and approval so that the so-called eminent persons make majority electoral stakeholders comfortable,” Chipenzi stated. “Are these eminent persons eminent because of their educational background, their role in electoral process or their age, gender or work histories in government, NGOs or private sector? What makes them eminent?”

He added that the appointment of: “the so-called eminent persons” was a very bad, strange and an unwelcome development and idea in an electoral process, and in contrast with the above cited provisions and that it may be an alien practice in the SADC region.

Chipenzi stated that while the GEARS Initiative was aware of the provisions of Section 7 of the ECZ Act No. 25 of 2016, as amended by Act No 5 of 2019, that empowers the Commission to appoint committees for the purpose of performing its functions under this Act, “the appointment of this group of eminent persons is highly questionable.”

Section 7 says the ECZ may establish such committees as it considers necessary and delegate to any of those committees such of its functions, as it considers fit.

Chipenzi, an electoral expert, further asked if it meant that Zambia would now have two sets of observatory and advisory bodies; one full-time led by ECZ chairperson justice Esau Chulu appointed by and reporting to President Edgar Lungu and another part-time observatory and advisory body of ‘eminent’ persons led by: “someone else to be known soon appointed by and reporting to justice Chulu-led Commission?”

He noted that both the ECZ’s advisory bodies would be entitled to government allowances that would be accrued whenever those persons sat, as per provisions of section 8 of the ECZ Act No 25 of 2016, as amended by Act 5 of 2019.

“It’s like we will have two observatory and advisory bodies at ECZ, which is unnecessary and duplication of advisory services as the Commission already has advisory committees established under section 7 of ECZ…” he stated, adding that such would be too costly to the ECZ, that claims to have no money to sponsor stakeholders to observe printing of ballot papers in Dubai. “The current advisory committees at the Commission include the National Voter Education Commission (NVEC), National Conflict Management Committee (NCMC) and Political Parties Liaison Committee.”

Chipenzi asks whether all those advisory committees have failed to offer advisory services on electoral violence, voter education and political parties’ cooperation to the ECZ for it to decide to appoint another advisory and observatory group of ‘eminent’ persons.

“It is our considered view, as GEARS, that the establishment of the new observatory and advisory group of eminent persons by ECZ is unnecessary, lacks stakeholders’ consultations and buy-in and criteria on what constitutes an eminent person and therefore, must be rejected,” he stated. “If the current body of commissioners, we understand is of eminent persons, has failed to guide on electoral matters, end electoral violence and feel they have lost public trust to be listened to, it is honourable for them to resign and allow the said eminent persons who command public trust to take up their place.”

Chipenzi’s statement continued: “who are those eminent persons, anyway? Who define them as eminent persons and are they conversant with the electoral process and able to perform as ECZ commissioners?”

He insisted that the decision to co-opt in ‘eminent’ persons was unproductive and a drain on the national treasury, unless….

“The Commission is clearly sending an admission of failure message to the nation and appointing authority that the current commissioners have failed to provide these observatory and advisory services to the ECZ management and cannot be listened to by stakeholders,” Chipenzi stated.

“Why should the commissioners give away their statutory advisory responsibilities to another body of eminent persons, even when the electoral process Act No. 35 of 2016 guides that: ‘the Commission may delegate any of its powers to a member, employee or officer of the Commission, excluding the power to prescribe anything under the Act or make an appointment…?’”

He stressed that if the current ECZ commissioners had failed or were unable to perform the function of observatory and advisory to the Commission’s management, “they might as well resign and pave way for those eminent persons to take their positions.”
“Don’t the ECZ commissioners realise that they are not in management but an observatory and advisory body in their current form and are expected to provide advisory services or oversight on Patrick Nshindano and his colleagues in management,” asked Chipenzi.

British PM Boris Johnson said colonialism in Africa should never have ended

Opposition MPs in the UK are not happy with Boris Johnson over comments supporting Britain’s colonial activities in Africa. While a Tory MP, Johnson wrote in a 2002 article that colonialism in Africa should never have ended, arguing that Africans would not have grown the right crops for export if Britain had not directed them.

“The continent may be a blot, but it is not a blot upon our conscience,” he wrote while editor of The Spectator magazine. “The problem is not that we were once in charge, but that we are not in charge any more.”

In the wake of global anti-racism protests that have targeted monuments connected to slavery and colonialism, the British prime minister argued this week that such colonial-era figures should not be toppled because they “teach us about our past with all its faults”.

However, his 2002 article shows that Johnson has held the belief that British colonialism wasn’t a disaster while dismissing Britain’s role in slavery.

“Consider Uganda, pearl of Africa, as an example of the British record. Are we guilty of slavery? Pshaw. It was one of the first duties of Frederick Lugard, who colonised Buganda in the 1890s, to take on and defeat the Arab slavers,” the former journalist and columnist says in the article cited by the Independent.

“And don’t swallow any of that nonsense about how we planted the ‘wrong crops’. Uganda teems, sprouts, bursts with vegetation. You will find fruits rare and strange, like the jackfruit, hanging bigger than your head and covered with green tetrahedral nodules. Though delicately perfumed, it is, alas, more or less disgusting, and not even Waitrose is pretentious enough to stock it.”

“So the British planted coffee and cotton and tobacco, and they were broadly right. It is true that coffee prices are currently low; but that is the fault of the Vietnamese, who are shamelessly undercutting the market, and not of the planters of 100 years ago.

The loud and controversial former London Mayor and UK foreign secretary further writes: “The best fate for Africa would be if the old colonial powers, or their citizens, scrambled once again in her direction; on the understanding that this time they will not be asked to feel guilty.”

Johnson is yet to state whether he still stands by the comments he made in the piece as pressure mounts on him to come clear on his views.

Touted by some as ‘the British Trump’, Johnson has many times made infamous comments about Africa that denigrated the continent.

In 2002, before the then UK Prime Minister Tony Blair visited the Democratic Republic of Congo, Johnson wrote in the Daily Telegraph: “No doubt the AK47s will fall silent, and the pangas will stop their hacking of human flesh, and the tribal warriors will all break out in watermelon smiles to see the big white chief touch down in his big white British taxpayer-funded bird.”

His comments were condemned as racist and Johnson was compelled to apologize when he ran for mayor of London six years later.

Writing on former British Prime Minister Tony Blair’s visits around the world, Johnson used the term “piccaninnies,” a racist term used to describe black children.

He wrote in the Daily Telegraph in 2002: “What a relief it must be for Blair to get out of England. It is said that the Queen has come to love the Commonwealth, partly because it supplies her with regular cheering crowds of flag-waving piccaninnies; and one can imagine that Blair, twice victor abroad but enmired at home, is similarly seduced by foreign politeness.”

THE PF REPORTS SEER 1 TO NIGERIAN GOVERNMENT

Ruling Patriotic Front youths have written to the Nigerian government over alleged defamatory remarks by Andrew Elimadu popularly known as Seer 1.

In a letter of protest to the Nigerian Embassy which was signed by all provincial party chaipersons, PF youth chairperson Kelvin Sampa stated that Seer 1 has been running a sustained hate and propaganda campaign against President Lungu and his government.

He has called on the Nigerian government to act on the matter.

“It is my singular honor to write to you, your Excellency. Kindly accept my utmost regards and consideration. Your excellency, I write to protest in the strongest terms the sustained unwarranted inflammatory, malicious, slanderous and criminally defamatory attacks by the said Mr Andrew Elimadu populary known as Prophet Seer 1 against His Excellency President Edgar Chagwa Lungu, President of the Republic of Zambia and his government,” Mr Sampa stated.

“Mr Ejimadu, the founder of Christ Freedom Ministries, once lived in Lusaka, Zambia and was arrested and deported in 2016 for allegedly raping a teenage girl among other numerous allegations against him. For months on end, Mr Elimadu has been running a sustained hate and propaganda campaign via social media and Television platforms against President Lungu and his government. He has been using these platforms to maliciously and criminally defame and malign President Lungu and his senior government officials.”

He stated that remarks by Seer 1 were highly offensive to the government of Zambia.

He stated that Seer 1 was aiming at raising hate and anger in the Zambian people so that they can rise against President Lungu and his government.

“As national youth chairperson for the ruling Patriotic Front Party, and as a bonafide citizen of the Republic of Zambia, I find Mr Ejimadu’s utterances and conduct highly offensive, repugnant and an affront to the sovereign and territory authority of our state, Zambia. It’s been observed that Mr Ejimadu’s attacks are aimed at raising hate and anger in the Zambian people so that they can rise against a legitimately elected President and his government. This is totally unacceptable and cannot be allowed to continue. Your Excellency, it is for this reason that I write you this protest letter and strongly beseech your honorable office to take appropriate action to censure and reproach the said Mr Ejimadu for his unbecoming conduct. President Edgar Lungu should sleep with a free conscious on Bill 10-Ndoyi

Outspoken Youth leader Prince Ndoyi says Republican President Edgar Lungu should sleep with a free conscious on Bill 10 as he has left the process to be driven by stakeholders without interfering with the content.

And Ndoyi says it is time to make progress as regards the mixed member provision included in Bill 10 saying those who absconded their responsibilities at NDF process do not have new ideas apart from finding faults in the Bill.

He wondered what new ideas would come form their proposed constituent Assembly when in fact the National Democratic Forum was an all inclusive platform which they deliberately chose to stay away and misled people.

“So we want to comfort President Edgar Lungu that in so far as fulfilling all righteousness on Constitution Amendment Bill No. 10, and he can sleep with a free conscious at night on Bill 10. He has left the process to be driven by stakeholders and has at no point hinted any hidden personal desires.

“I want to use the words of Hon. Given Lubinda, that the train has left the station and those that chose to come late when the train was waiting for them for 42 months, can chance the next train. Who knows, we may have another window of opportunity,” he said.

Ndoyi said as advocates of Bill 10, they will continue to sensitize people across the country so as to ensure that the real issues are brought out as opposed to malice and propaganda being spread by those opposed to the enactment of the Bill.

“As Bill 10 Advocates, we are just preparing ourselves to go to Monze as an entry point into Southern Province to distribute local language material which we have translated into 7 local languages in sensitizing the people on Bill 10. We finished Eastern province and partly Muchinga.

“We want to do this before Parliament tables the Bill and hopefully even after to remove the contamination from the people. We welcome government’s decision to gazette the position of government on Bill 10. Let’s see now whose telling lies. We cannot have a country whose primary source of information is speculation and propaganda,” he said.

And Ndoyi has expressed disappointment with the Ministry of Information for failing to enlighten people on the contents of Bill 10 saying the Ministry with all it’s resources at it’s disposal had allowed propaganda and lies to out run the facts on the contents of the Bill.

“I also want to express my disappointment with the Ministry of Information which had lamentably failed to adequately inform and educate the people on Bill 10. With all the resource and infrastructure we have let the lies carry the day. Propaganda has travelled faster than the entire Ministry of Information. They can do better. ZNBC has failed to provide platforms to engage to the citizenry on Bill 10, hence the opposition narrative has contaminated people,” he said.

When people with common interests band together, their voices can be heard and their chances of influencing the political debate increase. That is what is expected of a healthy democracy. Democracy is more than the sum of government institutions operating freely. A healthy democracy depends, in large part, on the development of a democratic civic culture. Culture in this sense does not refer to art, literature, music or dance, but to the behaviours, practices and norms that define the ability of a people to govern themselves. But Zambia is not a democracy any more.

President Edgar Lungu and his Minister of Home Affairs have basically issued instructions to the police to arrest the youths who are seeking to demonstrate against bad governance. We are not surprised. By that action, the Head of State is saying no to freedom of speech and no to freedom of assembly. Again, we are not surprised. President Lungu doesn’t want people to govern themselves. To us, that looks like a dictatorial approach towards national governance. A leader who says no to a citizenry that wants to govern itself ceases to be a servant of the people. Ultimately, he becomes the master and his electors turn into slaves. This is not surprising.

Two days ago, we published a brief editorial opinion in which we were describing the qualities of a dictator. Under a dictatorship, protestors of bad governance are punished harshly. Political power is concentrated in the hands of few people or just one person. Media freedom is systematically obliterated; leaving newspapers, radio and television as tools of indoctrination. State-sponsored violence and other human rights abuses are used to control the population. Citizens are not allowed to check the ruler’s power; people’s complaints are condemned and regarded as sponsored sentiments of regime change. Under a dictatorship, the right to private property is easily abolished. Dictators weaken institutions of governance, and compromise law enforcement agencies to protect individuals in the ruler’s inner circle.

We are not calling President Lungu a dictator, we don’t have to. People just have to look around and see for themselves what kind of leader he is. The youths who voted him into office are now being threatened with arrests if they complain or comment on bad governance. Look at what is happening to media houses that have offered a platform for divergent views. We see a heavy handed police shooting citizens whom it is supposed to protect. Law enforcement agencies are covering up for criminals in government, and taking instructions from the President’s inner circle on whom to prosecute.

One would say President Lungu has changed; that he is no longer a humble man, he is no longer a soft spoken God fearing leader. But that is not true. This President has not changed. Those with a good memory will remember that he said, at the beginning of his tenure in 2015, that he would fall on anyone who comes in his way like a tone of bricks. He said he moves with a long stick to whip anyone who questions his authority. “Don’t look at my small body, those who want to dare me will have themselves to blame when I fall on them,” said President Lungu.

If democracy has been obliterated under his reign, we must not say Lungu has become a dictator, we must instead say we have become aware of his true colours. And that is the problem that we have with the people of this country who are complaining about President Lungu’s leadership. We have stated before that President Lungu is one of the most honest leaders this country has ever had. He told us just about everything that we needed to know about him, but we elected him. Not once, but twice!

It’s good that the youths who danced so vigorously to Dununa Reverse are here to see for themselves where that ecstatic campaign euphoria has brought them. It’s good that the same gospel singers who had abandoned God to start worshiping politicians in exchange for money have now seen how this regime regards them. “Stupid, naked, disgruntled youths”. That’s what their leaders are now calling them. We hope they learn a lesson. – Diggers

Bill 10 Cannot be Withdrawn-Lubinda

Minister of Justice Mr Given Lubinda says he cannot withdraw Bill 10 of 2019 and incorporate the views of the select committee of parliament.

Speaking on ZNBC’s Sunday Interview hosted by Grevazio Zulu, the minister said he did something very unprecedented by proceeding with the Bill because some members of Parliament wanted him to withdraw it.

“This is unprecedented because we live in unprecedented times. We have parliamentarians who when you say this is your bill, come and debate it, they say ‘no we are not going to debate it because these people won’t move the amendments that they say they will move’,” Mr Lubinda said.

“I went to Parliament again; I did something very unprecedented. Ordinarily Mr Zulu, when a minister presents a Bill, that becomes the property of parliament. The Bill is referred to a committee, the committee comes back to parliament and presents that report of that committee after the minister presents the Bill for second reading. After the debate in the second reading, then the vote is called for second reading. It goes into committee stage. It is at committee stage where the minister says I listened to what they said in second reading. I am going to present these amendments in conformity with what they submitted.”

He said the reason he did was because the people who said were going to debate the Bill walked out of parliament and wanted the Bill withdrawn.

“They wanted the Bill withdrawn, get the committee report, and merge the two and present another Bill. That is totally wrong. I cannot withdraw a Bill and incorporate the views of the committee and present it in the same session, I can’t. And I am saying this with authority. It is not illegal to withdraw a Bill. We are not talking about withdrawing ordinarily. They are saying withdraw the Bill, get the views of the committee, put them together and bring back the Bill. I will not bring back Bill 10 of 2019 in that format, no. The law is very clear, standing orders are very clear Mr Zulu,” Mr Lubinda said.

He said there was consensus from the time the process started, adding that he accepted eight out of the 10 proposals by the committee.

“I accepted eight of their recommendations and we compromised on one and we objected on one. Now if we accepted eight, compromised on one and said no on one, surely, can somebody say we were not willing to build consensus? We listened to their 10 issues. Around the NDF, around the process, there was total consensus,” Mr Lubinda said.

He further said a bill could not be amended outside Parliament and that he did not break any procedure in the entire process of the Bill.

Don’t give Lungu pressure, Lusambo tells taxi drivers

DON’T give Edgar Lungu pressure in the name of youth activists, Kabushi PF member of parliament Bowman Lusambo has said.

Lusambo said this when he addressed more than 200 taxi drivers drown from Kabushi Constituency at his residence in Ndola yesterday.

“No youth should go on media and say they are youth activists, no. There is no time for that. Don’t give Edgar Lungu pressure, he is looking at us and saying the youth do not appreciate,” he said.

“If you have seen bad in PF, that is you problem. If you have seen good in UPND, that is your issue. If you see good in NDC, that is your issue. For me here, it’s working for Kabushi Constituency. This meeting of taxi drivers is not something new. It is a continuous programme that we have for Kabushi Constituency. This is not the time for politics, it’s time for working together and changing the lives of people,” Lusambo said.

He said today there were no youth activists because President Lungu had opened the doors for the youth.

“You are youth activists, for what? The President Edgar Lungu has opened the doors. All the youths are inside. Here it is not about Edgar Lungu, he has opened the doors. So those youth activists, it’s an old style, it’s old fashioned. They don’t mean anything, it’s scrabble,” he said.

He said no one would be forced to support PF in Kabushi Constituency.

“We will never force anyone to work and support PF and President Edgar Lungu. It is a personal decision [to support] if you see what the PF, Edgar Lungu and Lusambo are doing is good. Development at any level is done by the people,” said Lusambo.

“[MMD] Die Hard was a strong movement which had an agenda. We agreed that the country has been over ruled by old people and we started the fight for young men and women to be incorporated in the development agenda as MMD Die Hards.

Our agenda attracted a lot of support from all stakeholders. After this agenda in 2015, I sat with Edgar Lungu and he said his governance system, he will include the youth,” he said.

Lusambo said there was a lot of freedom of expression in the country.

“Freedom of expression, everyone has in Zambia. But what is important is discipline. If there is discipline, you will see all things to be good. Democracy is very nice, but if you get it on the wrong side, it’s bad,” said Lusambo.

I see an uprising by youth-Sichula

OPPOSITION NDC Copperbelt chairman George Sichula has warned that if the concerns of the Zambian youth remain unaddressed, protests will become more extreme, petitions will become strikes, and marches will become violent uprisings.

In a statement titled ‘Three signs to show that Zambian is on a brink of a revolution’, Sichula noted that major revolutions are preceded by substantial increases in the number of protests, both physical and verbal and resistance becomes a daily fact of life.

“See how the Zambian youths have become vicious and fearless! Populations display their displeasure and voice their grievances via marches, petitions and protests. Once the population is convinced that the system is not working, and their grievances will remain unheard then almost anything can set off a political explosion. Lastly, Zambia is a failed state. This poor economy we are experiencing today will eventually lead to famine in this land,” Sichula said.

The NDC Copperbelt strongman further noted that political scientists had historically been bad at foreseeing the most important developments.

He recalled that few people guessed the end of MMD and politicians like Dora Siliya refused to accept that PF was coming to power in 2011.

Sichula said before a momentous event occurs, there were numerous possibilities and different ways events could unfold.

“After it happens, however, it will appear inevitable. And after it happens, we will be very good at explaining why it had to happen. Only civil servants are good at predicting change of government because they see and discuss it in offices. I am happy to note that many of us are now predicting the socio-political situation in Zambia, and the only way out for PF is Bill 10,” he said.

Sichula, the former PF Chingola district commissioner, said after years of learning about protests, uprisings and revolutions, he was convinced that Zambia was currently showing all the signs political scientists and historians would identify in retrospect as conducive to a revolutionary uprising.

“What brings about a revolution…? Of course, every revolution is unique and comparisons between them do not always yield useful insights. But there are a few criteria we identify in hindsight that are usually present in revolutionary explosions,” Sichula said.

He said that the first sign of a revolution is tremendous economic inequality.

Sichula said another sign of revolution boarders on a deep conviction that the ruling classes serve only themselves at the expense of everyone else, undermining the belief that these inequalities would ever be addressed by the political elite.

“Third, and somewhat in response to these, there is the rise of political alternatives that were barely acceptable in the margins of society before. Combined, these factors create a deeply felt and widely shared sense of injustice, an almost palpable conviction that the system is not working for the majority and only for the very few who abuse their positions of privilege. These qualities weaken any regime’s claim to legitimacy,” said Sichula.

We’re tired of covering up Chilfya’s inadequacies, says PSZ

PRESIDENT Lungu should remove lunatics from the Ministry of Health who are giving contracts to companies that do not exist, says pharmacist Jerome Kanyika.

Kanyika, the Pharmaceuticals Society of Zambia (PSZ) president, has expressed concern and shock that the Ministry of Health has given a $17 million contract to a retail outlet that has no record of supplying to the institution.

“Mission Pharma, the owner of the contract, was owed $11 million by Ministry of Health but it goes to offer the same contract to another company which was not the cheapest and has no tract record leaving out Pharma, which also participated and was among the cheapest with a good track record and quality products,” Kanyika lamented in a statement.

He wondered how a normal workforce would do the aforesaid when the country was grappling with serious shortages of essential medicines.

Kanyika said his association was now tired of covering up the Minister of Health’s inadequacies by lying to the public every time he appeared on camera stating that the country was well stocked while they have serious shortages.

“We are failing to understand how a normal and competent person can supervise such works. It’s only a lunatic that can do that. Currently, we have serious shortages of essential medicines, theater drugs, pethidine, anti-diabetics such as insulin and antihypertensive, which are lifesaving drugs. We want to state also that we are tired of covering up the Minister of Health for his inadequacies by lying to the public every time he comes with cameras that we are well stocked while we have serious shortages,” he said.

Kanyika has further asked President Lungu to drop Dr Chilufya so that the damage could be controlled.

The News Diggers last week revealed that the government, through the Ministry of Health, last year awarded a $17 million contract for the supply of health centre kits to a company called Honey Bee Pharmacy Limited, which does not exist.

According to News Diggers, the Ministry disregarded the existing supplier of drugs and centre kits, Mission Pharma, who it owed $11 million.

Allowing PF to continue beyond 2021 will be suicidal – Luonde

NEWLY appointed NDC national chairman Richard Luonde has schooled President Edgar Lungu and his Lusaka minister Bowman Lusambo that Zambia is a nation of rights and any form of infringement on any of these amounts to disregard of the supreme law of the land.

And Fr Luonde said allowing the PF to continue in government beyond 2021 will be suicidal.

In his maiden statement following his appointment to the National Democratic Congress’s central committee, Fr Luonde reminded the PF that one would fool some people some time but certain not fool all the people all the time.

He recalled that when Zambia got its independence from colonialists, the nation wanted its inhabitants not only to have the freedom of movement but also economic freedom and see the rule of law.

Fr Luonde said his party would not tolerate the ‘nonsense’ of mistreating Zambians.

“The NDC will not tolerate PF protecting of foreigners more than they are protecting indigenous Zambians. We say abash to this type of governance. When we got independent, we got it for the benefit of every Zambian, rich, poor, uneducated, educated, physically challenged, able bodied, freedom for all Zambians. As a party, we shall continue to fight until we overcome and achieve this objective,” Fr Luonde said.

He warned that no Zambian was above or superior to the other as was being witnessed under the PF regime.

He recalled that the constitution of Zambian, which President Lungu swore to protect guarantees freedom of expression to all, which cannot be taken away by selfish leaders.

“Just because someone is fighting for a third term, which in my view and many Zambians will not come, the PF want to intimidate voices of reason. Zambians are intelligent enough to know what is right and wrong. To think by breaking the law they are going to achieve their evil plans, NDC and like minds will not accept anything less…. We shall fight for the continued freedoms of our people,” Fr Luonde said.

“When our forefathers fought for independence, they knew that they wanted this nation to be free, generations to come to be free and taking us back to bondage, ba PF we are saying that twakana.”

Fr Luonde said intimidating the youths who were the majority Zambians was a total fallacy and a dry joke that would not work.

“Aba bana bafyalwa munda shabafyashi babo to live in Zambia because Zambia is their land. How then do you begin to suppress their voices when you know that the majority in Zambia today are youths? The youths that have nothing to do, the youths that have nothing to look to and when they speak in expressing their views, you begin to threaten them! Ba Lusambo don’t start insulting the youths and their intelligence as it amounts to insulting the Zambian people and God who created them,” Fr Luonde said.

The former Anglican priest urged Zambian youths not to fear or be intimidated, stating that their voice should be heard.

Fr Luonde further noted with regret that a lot of youths had graduated from colleges and universities with very good results but cannot find employment.

“This is not Lusambo’s country, this is not President Lungu’s country, it is our country together. What is wrong honourable Lusambo for our youths to say ‘please don’t misuse our gold, let the Zambians benefit from it?’ A lot of these youths are expressing how we the old generation is destroying them because they cannot attain the education they desire, which they would have attained with support from government,” Fr Luonde said.

He noted that education in Zambia had become very expensive and was now a preserve of those in government and the rich due to their capacity to send their children to affluent schools.

“Nga nati njipushe, ba Edgar Lungu abafyashi benu bali niba millionaire? Your father was a poor person but you came from a poor background and knew what you needed to lead a better life, you made sure that you excelled in school and that’s why today you are a lawyer and President of Zambia, so why should you mistreat and threaten the youths when they are only crying for what is right?” Fr Luonde asked.

He further reminded President Lungu that there was no employment in Zambia today thus he should not expect youths to keep quiet.

Fr Luonde said the best thing elders and leaders in Zambia would do is to support and agree with the youths that what they were saying is true and promise to endeavor to create employment for them.

He further urged the youths not to apologise to anybody for their actions as they have not broken the law nor injured anybody in their cause.

“Your cry is genuine; I encourage you to speak more. Ba PF you cannot turn Zambia into a one party state, the journey of one party state ended in 1991 and therefore don’t send Zambia back to that era, it will not work. Improve our economic welfare so that every Zambian can benefit from it,” he said.

Fr Luonde further lamented at the PF’s denial of freedom of assembly to the opposition when the members of the ruling party were traveling all over the country to mobilise their structures.

He warned that allowing the PF to continue after 20021 would be suicidal for Zambians.

He urged citizens to escort PF to their resting place.

Since PF has remained mute on the issue that involved loss of lives; people have now safely concluded that there is something big that PF is hiding. Silence means consent. Be magnanimous and tell Zambians the truth, otherwise the innocent people that were gassed will teach you a lesson in 2021 elections. Only the truth shall set you free.

Since you are a very un caring Government, you have just de campaigned yourselves. Whatever people will be told about gassing will be taken as the Gospel truth. When the gassing started in Chingola, Ba PF and your Police gave very misleading and meaningless statements on the issue. At one time we were told that human beings were turning into cats, such nonsense can only come from a Wizard and not a trained Police Officer. Again you lied to us that samples have been taken to the lab to analyze the contents of the gas being used. Is your lab so ancient to take you this long?

Police informed the public that the gassing master minder has been arrested. Are you still processing the docket to take this terrorist to Court? Remember, if you choose to weave a web of deceit sooner or later you are caught in it. You looked very clever when you were cheating us, now you are caught between your lies and the truth.

Zambians are now relying on raw information from the streets; such as, gassing was meant to implicate HH in order to eliminate him from the 2021 elections. Assuming the information on the streets is true, what made you start gassing your own people? If all these allegations are not true, then give us the side of your story. Is it not strange that the entire Government machinery failed to know who was behind the whole saga that caused so much fear and alarm in the Country? Remember zero option and black mamba, who was behind these evil schemes?

Concourt Has No Jurisdiction To Hear Petition On Deregistering Parties That Have Not Held Elections Since 2016 – Submits UPND

The UPND has told the Constitutional Court that it has no jurisdiction to hear the petition where an advocate of the High Court is seeking an order to direct the Registrar of Societies to deregister all political parties that have not held party elections since 2016.

The party through its Secretary General Stephen Katuka, has submitted that the petition is wrongly before the Constitutional Court for lack of jurisdiction and is supposed to be taken before the High Court.

In this petition, Benjamin Mwelwa, a Livingstone based magistrate has petitioned the Constitutional Court asking it to order the deregistration of political parties that have not held party elections since 2016, as required by the amended Constitution.

Magistrate Mwelwa is seeking a declaration that any political party which was registered and in existence as of January 5, 2016 and which has not promoted and practised democracy through regular, free and fair elections, within its political party, has breached article 60(2)(d) of the Constitution of Zambia (Amendment) Act no. 2 of 2016 and therefore, such a political party ceased to exist as a political party in Zambia on January 4, 2017.

Mwelwa has since cited Attorney General Likando Kalaluka and the Electoral Commission of Zambia (ECZ) as the respondents in the petition.

Last week, the Constitutional Court joined UPND as an interested party to the petition, stating that the party had sufficient interest to join the case while the Patriotic Front has also asked to be joined as an interested part.

The UPND through its Secretary General Stephen Katuka has now asked the court to dismiss the petition for want of jurisdiction, because it does not disclose any violation of the Constitution.

In an affidavit to struck out the petition and dismiss the matter, Katuka submitted that Mwelwa’s petition did not meet the requirements for the matter that should be brought before the Constitutional Court.

“Upon perusal of the petition and affidavit verifying facts and taking advice from my advocates, it has become apparent to me that they do not meet the requirement for actions that ought to be brought before this court,” Katuka submitted.

He argued that the petition was founded on an act of Parliament.

Katuka also stated that the petition was therefore, wrongly before the Constitutional Court for lack of jurisdiction and was supposed to be taken before the High Court.

He stated that neither the petition nor the affidavit verifying facts disclosed any alleged the Constitutional Court to exercise its jurisdiction must indicate the violations of the Constitution that are alleged to have been committed and how they were committed or the provisions that require interpretation.

He stated that failure to that, there is no way the court can be moved to pronounce remedies in favor of such a party.

“A perusal of the petition reveals that that the petitioner alleges that the respondents and all political parties have contravened the Constitution by breaching Section 18 of the Constitution of Zambia Act no. of 2016. “Clearly the petitioner requires the honorable court to interpret an Act of Parliament, the interpretation which falls outside the jurisdiction of this court. The matter which the petitioner seeks interpretation can only be determined by the High Court,” submitted Katuka.

The hearing for the application to dismiss it has been set for June 15.

The Decision By ECZ To Allow Prisoners To Vote In 2021 Should Be Condemned

THE DECISION BY ECZ TO ALLOW PRISONERS TO VOTE IN 2021 SHOULD BE CONDEMNED.
I would like to express my displeasure at the decision made by the Electoral commission of Zambia (ECZ) to allow prisoners (inmates ) to vote in the 2021 General elections. I feel this is a bad move that should be condemned. I base my argument on the following reasons;
1. Some people say prisoners are humans and they have rights. well, Prison is meant to be a punishment. A prison sentence has always resulted in loss of freedom and loss of democratic rights for the duration of a prisoner’s sentence. Why change that?
The main point of a prison sentence is to show the offender and society as a whole that criminal behaviour results in loss of freedom.

2. We don’t let children, the mentally incompetent and non-citizens to vote, Why? Because we don’t trust them and their judgment. Prisoners also belong to this category. I honestly feel People who commit serious crimes have shown that they are not trustworthy hence should not be allowed to vote.

3. Opposition parties will not have easy access to prison facilities in order for them to campaign, this then favors the ruling party since all prisons are under the stewardship of Hon stephen Kampyongo (A minister in PF).

4. Prisoners are in a confined place (they literally dont know whats happening outside the prisons). How then do you expect them to judge whether the ruling party has delivered according to expectation or not?
5. I feel some prisoners will be promised to be pardoned if they vote for the ruling party, this then disadvantages the opposition.

6. One of the qualifications of voting for a member of parliament or councilor for example is that a voter should belong to a certain constituency/ward. Now Imagine someone arrested in Mazabuka and then transferred to Lusaka central Prison, which Mp then do they vote for? Garry Nkombo (Mazabuka Mp) or Margaret mwanakatwe (Lusaka central Mp)? And am asking this question taking cognisance of the fact that some prisoners are serving life sentences.

ALL ALONG, PRISONERS WERE NOT ALLOWED TO TAKE PART IN ELECTIONS..WHY CHANGE THINGS NOW, WHATS SO SPECIAL ABOUT 2021 GENERAL ELECTIONS?

Davis Mwila Warns PF Members against Early Campaigns for Adoption

PF Secretary General Davis Mwila says party members holding premature campaigns for the 2021 adoption will be expelled as candidates for the coming general elections will only be picked on merit.

He said when he addressed Luanshya District PF members that he is aware of people that want to use money for adoptions and cause confusion in the ruling party.

“All sitting MPs, Mayors, Councillors must deliver, or they must forget about adoption. If you do not deliver, if you do not work, forget about adoptions. If you are a Councillor and you have failed, forget about adoption,” Mr Mwila warned.

He said only party members who have worked hard for the party must be rewarded for the work they have done.

“Do not recommend appointments based on personal relationships or friendship but on hard work and commitment to the party. Everyone wants to be an MP. You have only been a Councillor or Mayor for few years and you are already destabilising the party structure with your campaigns to be an MP. We shall kick you out and you shall not even enter your promised land. We have heard you what you are doing. You are Constituency Chairman, you want to be MP and you start suspending people who are not supporting you. We will not accept that. If someone is a Civil Servant and you want to contest, why disturb a sitting MP? Resign and join politics,” Mr Mwila said.

He said some of the impatient PF members will get frustrated and join other political parties because they are in a hurry for top leadership.

Mr Mwila further warned Mufulira PF members who are fighting members of parliament.

“We cannot have an ordinary member fighting a Cabinet Minister. This is the first time in my life that I have seen an ordinary party member fighting a Cabinet Minister and we are just watching. People in Mufulira will face our wrath before we head back to Lusaka. Enough is enough with this behavior,” Mr Mwila said.
He also told party members to prepare for voter registration which will commence this October.
“Electoral Commission of Zambia has announced that there will be Voters Registration starting in October 2020. All of us must be ready to take people for registration. Not just playing around. Whichever political party which will register more members will win elections. You must start with NRCs, start from branches, wards and constituency. All your children and community members without NRCs must get NRCs and register as voters. No everyday fighting to be Councillor, Mayors, MPs, positions you will never even get,” Mr Mwila said.

Many Names in Lusaka were Changed

I have seen a lot of posts questions demanding renaming of residential areas and towns and roads.

This exercise was done nationwide in 1964 to 1970. In Lusaka Chelston is actually Chakunkula, the name which a school in the area is named, Fairview is Maluba. Northmead is Mutambe while Olympia is Chiwalamabwe.

Livingstone was supposed to be renamed and was supposed to be called Maraamba or Linda after a local headman. A strong campaign by the LOCAL people refused to change the name and successfully ensured it stayed Livingstone. The Victoria Falls are officially Mosi O Tunya. However there is some dissent locally because even Mosi O Tunya is not Toka Leya but actually Lozi !!! The Toka Leya name is actually Shungu Mutitima and the Mosi O Tunya came from the Lozi guides who took David Livingstone to the great falls. Chuma a Lozi man was to stay faithful to David Livingstone even up to death.

But a while raft of towns changed names

Garneton became Itimpi (It was a separate town until Kitwe convinced the Government to absorb it in 1971).

Chelston became Chakunkula (It was a separate town until Lusaka annexed it in the late 1960s)

Bancroft became Chililabombwe

Fort Jameson became Chipata

Fort Roseberry became Mansa

Abercon became Mbala

As for roads basically every road in every town and city was renamed. Anyone getting a 1960s map can attest to this.

Some of the roads are named after people who died after Independence. Omelo Mumba was a UNIP official who was murdered in inter party violence after Independence. Maina Soko was a lady gunned down by the Rhodesian Army as she paddled down the Zambezi River.

Sometimes old names were kept because the colonialists were considered to have positive qualities. Sir Alfred Beit from his massive fortune built roads, hospitals, bridges and even government buildings all over Zambia and Zimbabwe his trust to this day from that fortune has scholarships, runs hospitals etc. For instance the old Kafue and Chirundu bridges were built by him. Hence the Beit Roads one finds tucked away in corners.

Others were kept for idiosyncratic reasons Birdcage Walk has a counterpart in London. It is said the Zambian town planner behind renaming roads kept the name because it reminded him of his time in London.

Sometimes the strange foreign names have a reason. Los Angeles, Addis Ababa, Dunshanbe and Kamloops are sister cities of Lusaka. Los Angeles and Kamloops both donated traffic lights, street lights and stocked libraries in Lusaka.

So before we call for renaming etc let us do some research.

He’s a white collar worker who left the comfort of a corporate job to toil on a farm. And engineering graduate Gyavira Bwalya (49) is one of several farmers to do just this.

Farming is Gyavira Bwalya’s first love, and he had no choice but to divide his time between the job he studied for, and his passion for farming. Until now, when he left his corporate job to take up full time farming.

In 2005, armed with capital of K30 000, Bwalya and his wife Mwenya ventured into growing tomatoes. These days he has a lucrative operation which includes poultry farming, a piggery and the growing of tomatoes.

Farming proved to be lucrative, but it did come with several challenges. And to overcome some of these he turned to his engineering skills. Bwalya says successful farming is underpinned by having sufficient scale and market knowledge – a skill needed to produce and price products cost-effectively, while still managing risks.

THE BEGINNING

Bwalya graduated from the University of Zambia (UNZA) with a bachelor of science degree in electrical engineering in 1991. He was immediately recruited by power company ZESCO and later earned a post graduate diploma in electrical power distribution systems from the University of Trondheim Norway in 1995.

In 1999 he left ZESCO to join the Botswana Power Company (BPC) and in 2005 he rejoined ZESCO. At his Kwa-Botswana farm in Mungu in the Kafue district, 45 kilometers south west of Lusaka, Bwalya tells africanfarming.com more about himself and the farm he established.

“I had acquired this piece of land for farming when I was still working in Botswana. The locals christened my farm Kwa-Botswana, because of my absence during my years working in Botswana,” he explains. “I am an electrical engineering graduate, but farming is what I enjoy most.”

His passion meant dividing 10 years of his 25 year working career between the job he studied for, and farming. Last month this all changed when he left his full-time job as a senior manager at Zambia’s power utility company, ZESCO.
“I opted to grow tomatoes as it is a common vegetable consumed by every household every day. There is an available market and the returns are way better than other crops,” he says.

Describing himself as someone who came from an agrarian background, Bwalya says his father, Vernacious, a now retired train driver, used to cultivate all sorts of crops in the family orchard. “It was natural for my siblings and me to get the hang of things. Gardening formed an important part of our duties at home. Getting into growing tomatoes was a natural fit with what I enjoyed doing.”

When the cultivation of tomatoes boomed, Bwalya had already identified ways to land attractive supply chain partnerships. He took advantage of the high degree of liquidity resulting from the sale of tomatoes grown on a hectare – two fields of half a hectare each.

Using his understanding of the power industry’s value chain, he used drip irrigation kits he acquired in Botswana to take advantage of economies of scale in tomato production. This resulted in year round production of tomatoes and other vegetables such as cabbage, onions and spinach.

“Cash flow is king in any business, and the demand for tomatoes put me in a position of high liquidity. For example, on a single pick we could sell 200 boxes of tomatoes at between K180 AND K200 per box.”

BRANCHING OUT

Concerns about maintaining healthy cash flow saw Bwalya introducing a fowl house with layer chickens, and piggery alongside the tomatoes. He believes branching out from horticulture into livestock and eggs to spread the risk was the best decision he’s made since he started farming.

He observed that successful incumbents in poultry and pig farming had efficient production and marketing practices and his engineering background came in handy, especially in planning and tracking progress.

Bwalya’s position in managing the supply chain of power in his corporate job made it easier to manage the risk of setting up the poultry and piggery side of his farm. “The dictum “you can’t control what you can’t measure” guides every engineer, and it has been useful in the expansion of our farming activities,” he says.

To save costs when setting up the bird cages, Bwalya hired a man and his grandchildren who camped on his farm for a month and half. It seemed like a risky decision. There was the question of quality and reliability, but by acting as “consulting engineer” to the builders, Bwalya helped the team to build cages in accordance with industry standards.

The gamble paid off, and the first cages accommodated 4 500 laying birds. Using his experience in tomato cultivation, Bwalya rapidly increased profits from the poultry, by diligently matching production to demand.

In the poultry industry – where input costs can increase rapidly and demand for a fragile product can be fickle – Bwalya cut costs by raising his own chicks. Soon the promise of real benefits kicked in. Bwalya reinvested profits to expand the poultry operation to 13,000 birds.

His system works with two flocks of 6500 birds each – the flock in the first cage is 30 weeks old and the flock in the second cage 60 weeks old. At 90 weeks the second flock of layers will be decommissioned to bring in the other flock that would have reached 60 weeks. Simultaneously, new chicks raised to a point of lay will be introduced in the first cage.

Bwalya worked out according to the demand that 330 trays per week at K23 per tray could translate into attractive earnings.

“The key was to manage input costs and shrink lead times,” he explains.

BRINGING IN THE PIGS

In addition to poultry, Bwalya also developed a 54m x 9m piggery – and it’s doing a roaring trade. His piggery of 55 sows and three boars churns out about 100 weaners per month, weighing between 20kg and 30 kg. It results in good income and assuaged fears about the huge initial investment when setting up.

With a kilogramme of pork going at K32 in retail , the income is enough to independently sustain the piggery.
Bwalya also hopes to do value addition in future. “My plan is to start packaging and exporting the poultry and pig products.”

With this comes marketing. Currently, Bwalya sells most of his pork and eggs directly to retailers, who buy in bulk from him on a weekly basis. The retailers bear the cost of the delivery and they buy the live pigs from him, since slaughtering on the premises poses health risks.

He also sells his eggs and great volumes of his other products at the Soweto market in Lusaka. Individual buyers, who order on a weekly basis and pick up the products from a central point, help save delivery costs.

Bwalya also saved on input costs by growing his own maize to feed the pigs. The combination created a sustainable system: the poultry farm and piggery supplies the maize field with organic manure.

“You incur huge costs when building infrastructure and running the operation. Of great importance is building a sustainable entity and this requires close collaboration among participants in the supply chain,” he says.

CHALLENGES

Although the venture is lucrative and changed his life, farming certainly has its challenges. Bwalya uses the example of the Tuta absoluta disease, which wreaked havoc among tomato crops, as one of these challenges. “Controlling diseases such as Tuta absoluta is capital intensive. A liter of chemicals costs K3000,” he says.

He also expressed concerns about unexpected competition in the form of so called dumping from international markets. Dumping is the practice of putting products on the market at below cost.

‘…if you keep waiting for the all clear signal, others will block your road to the future’

Zambia’s poultry industry, for example, is threatened by cheap imports. The same is true for tomatoes, with the price of local produce plummeting by as much as K150 per box, after dumping from neighbouring countries. “This is not good for anyone, and will have a cascading negative effect on the economy.”

The third major challenge was finding skilled labour. Bwalya says in recent years, he invested in the training of his 10 man work force at huge cost.

“Farming dynamics such as climate change and technology will require players to develop new skills.”

With any new venture, things sometimes go wrong, and in hindsight, some things could have been done differently. Bwalya said he wished they prospect for water before operations began. Only once they started farming, did he realise there was not enough water – and then the process had to begin. This resulted in extra costs, and the problem is still not completely solved.

But despite the hurdles, Bwalya says his decision to take up farming left him with no regrets. “A long and winding road lies ahead, but if you keep waiting for the all clear signal, others will block your road to the future,” is Bwalya’s final advice to anyone venturing into farming.

Withdraw Bill 10, it threatens Zambia’s democracy, insists LAZ

Law Association of Zambia president Eddie Mwitwa has insisted that government should withdraw Constitution Amendment Bill number 10 of 2019 because it threatens the country’s democracy.

Speaking when he featured on a Pan African Radio programme, Sunday evening, Mwitwa wondered why government was in a hurry to amend the constitution, insisting that some clauses would have dire effects on Zambia’s democracy.

“Our view as the Law Association of Zambia is that if there is a genuine case for amending the Constitution, Bill 10 should be withdrawn and let’s go back to the drawing board. Part of that drawing board could be, let’s look at what the stakeholders that participated or made representations to the Select Committee said about Bill 10, take out those issues or contents of Bill 10 that the majority of the stakeholders that appeared before the Select Committee said they did not agree with and the text that you have, take it back to the people and let the people say whether they agree with those contents. I am not sure why the government is in a hurry to amend the Constitution,” Mwitwa wondered.

“I do not know what challenges or how adversely affected the people will be if Bill 10 is not enacted into law. So yes, there will be a lot of problems if Bill 10 in its current form is enacted into law and I think the report of the Select Committee has made it very clear that there are a number of things that need not be in Bill 10. But the Select Committee report is just a recommendation to Parliament. The Minister of Justice has been very sincere that there is no guarantee that the recommendations in the Select Committee’s report will be taken on board.”

Asked if he was implying Zambia would no longer be a democratic state if Bill 10 went through, Mwitwa said; ” Not as it is now because what Bill 10 is potentially going to do is to give the ruling party of the day an upper hand over other political parties. There are provisions of the creation of Parliament, Bill 10 is saying create Parliament but don’t say how many seats you are going to have. So a ruling party with the majority members of parliament in power can simply decide, ‘guys, let’s create such and such seats in this particular province where we have a stronghold. Let’s remove certain seats where the opposition have a stronghold, reduce their chances of being elected by increasing our chances of being elected’.”

He insisted that Bill 10, if enacted, would allow government officials to campaign using government resources.

“And remember, this issue about deputy minsters, there is another provision which talks about ministers remaining in office until the date of the next general election. What this means is that these ministers will have unlimited access to government resources. They will be allowed to campaign freely until the date of the next election which will disadvantage other political parties. The current constitution says Parliament will dissolve 90 days before the general election which according to the ConCourt judgement in the LAZ Vs the 64 ministers said even Cabinet ministers must vacate office when parliament is dissolved. But Bill 10 is saying ‘No, Constitutional Court, I think you were wrong, we will amend the law and give ourselves the right to exist until the next election. What this means in practice is that ministers will be driving their GXs, flying the national flag to their campaign areas, whereas opposition political parties will not have that benefit. So Bill 10 threatens our democracy and also increases the chances of the ruling party manipulating the electoral system,” Mwitwa said.

“There is also a provision where the President is being given power, unrestricted by Parliament to create provinces and districts. I mean, all those are things are things that have a danger of giving the ruling party, on whatever day it will be an advantage over other political parties.”

He highlighted other Bill 10 proposals which LAZ believed were problematic.

“There’s a proposal to expand Cabinet by including provincial ministers, that means again more money being paid to the Ministers, there is even a proposal to include government Chief Whip to be part of Cabinet, again that’s a bloated Cabinet. I have concerns also with the proposal to declare Zambia a Christian in Article 4(3). That for me is a dangerous path because you are potentially promoting one religion over other religions and we know what happens in the Middle East, in Islamic states where you cannot express your religion freely. If you are not a Muslim in a Muslim state, you are not allowed to practice your religion freely and we may be thinking that we have got a government that right now is caring, is liberal, it allows other religions to come and say what they want but what if you have a dictator who will want to come and ride on the christian nation provision to promote one religion over other religions?” asked Mwitwa.

“The Executive will be allowed to borrow freely without parliamentary oversight. You’ll have an increased Executive, Cabinet will be bloated, I have talked about the challenges that you’ll have with political parties disseminating their own information on social and economic programmes, Bill 10 will in the long run make our constitutional order different from what we know it. This issue of a President being elected by majority citizens as we know it, will no longer be there. Right now, we decide as Zambians who our President should be but Bill 10, if it goes through as it is means a coalition government. What does that even mean in our context?
We have a presidential system so how do we move into a coalition government?”

Urging police to break protesters’ bones is unacceptable

We are saddened by and deeply concerned about Tutwa Ngulube’s call on the police to break the bones of protesters.

And this is in line with the threats and other intolerant pronouncements made by Stephen Kampyongo and Edgar Lungu himself.

Urging the police to break people’s bones is disturbing and unacceptable.

Police abuse and excessive use of force during peaceful protests is inexcusable at any time but it is especially distressing when demonstrators are precisely calling for accountability.

Breaking protesters’ bones will not silence them.

It only reaffirms the urgency of the struggle to defend our human rights and political freedoms.

Protests play an important part in the civil, political, economic, social and cultural life of our country.

Historically, protests have often inspired positive social change and the advancement of human rights, and they continue to help define and protect civic space. Protests encourage the development of an engaged and informed citizenry. They strengthen representative democracy by enabling direct participation in public affairs. They enable individuals and groups to express dissent and grievances, to share views and opinions, to expose flaws in governance and to publicly demand that the authorities and other powerful entities rectify problems and are accountable for their actions. This is especially important for those whose interests are otherwise poorly represented or marginalised.

It is therefore not right to treat protests as either an inconvenience to be controlled or a threat to be extinguished.

The right to protest formally involves the exercise of numerous fundamental human rights, and is essential for securing all our human rights.

Protests constitute a fundamental pillar of democracy and complement the holding of free and fair elections.

Protests offer us the opportunity to stand up for our civil, political, economic, cultural and social rights, struggle against repression, fight against poverty, protect the environment or demand sustainable development, and thereby contribute towards progress.

Participating in protests enables us to individually and collectively express dissent and seek to influence and strengthen government’s policymaking and governing practices, as well as the actions of other powerful entities in society.

It is very important to understand that the right to protest embodies the exercise of a number of indivisible, interdependent and interconnected human rights, in particular the rights to freedom of expression, freedom of peaceful assembly and of association, the right to take part in the conduct of public affairs, the right to freedom of thought, conscience and religion, the right to strike, the right to take part in cultural life, as well as the rights to life, privacy, liberty and security of the person, and the right to freedom from discrimination.

We therefore call on all Zambians of good will to voice out their abhorrence at this government’s threats of brutal repression of protests, including the unnecessary, excessive and unlawful use of force to break protesters’ bones.

We are deeply concerned by legal, policy and law enforcement measures that deter, prevent or obstruct protests, including detention, harassment and intimidation, and disproportionate criminal, administrative and civil sanctions against protesters.

This government must fulfill its obligation to respect, protect and facilitate the enjoyment of the right to protest without discrimination of any kind, to avoid unlawful, unjustified or unnecessary restrictions, and to ensure accountability for violations.

UPND urges ConCourt to dismiss magistrate Mwewa’s petition to deregister political parties

THE UPND says the petition by Livingstone magistrate Benjamin Mwelwa does not disclose any violation of the constitution by any political party, the Attorney General and the ECZ.

UPND secretary general Steven Katuka has since asked the court to dismiss the petition for want of jurisdiction because it does not disclose any violation of the constitution.

Katuka said the Constitutional Court has no jurisdiction to hear the petition where a magistrate wants the court to direct the Registrar of Societies to deregister all political parties that have not held party elections since 2016.

In this matter, magistrate Mwelwa wants the court to order the Registrar of Societies to deregister any political party which came into existence following the Amendment of the Constitution on January 5, 2016 and has not promoted and practiced democracy through regular, free and fair elections within its political party.
He is also seeking a declaration that any political party which was registered and in existence as of January 5, 2016 and which has not promoted and practiced democracy through regular, free and fair elections, within its political party, has breached article 60(2)(d) of the Constitution of Zambia (Amendment) Act no. 2 of 2016 and therefore such a political party ceased to exist as a political party in Zambia on January 4, 2017.
In an affidavit in support of application to strike out petition and dismiss the matter, Katuka said magistrate Mwelwa’s petition does not meet the requirements for a matter that should be brought before the Constitutional Court.

“Upon perusal of the petition and affidavit verifying facts and taking advice from my advocates, it has become apparent to me that they do not meet the requirement for actions that ought to be brought before this court,” Katuka said.

“The petition is founded on an act of Parliament and is therefore wrongly before the Constitutional Court for lack of jurisdiction but instead it was supposed to be taken before the High Court.”

Katuka said that neither the petition nor the affidavit verifying facts disclose any alleged violation of the constitution on the part of the Attorney General, the ECZ or any political party as alleged.

He stated that any person who approaches the Constitutional Court to exercise its jurisdiction must indicate the violations of the constitution that are alleged to have been committed and how they were committed or the provisions that require interpretation.

Katuka argued that failure to do so, there is no way the court can be moved to pronounce remedies in favour of such a party.

“A perusal of the petition reveals that that the petitioner alleges that the respondents and all political parties have contravened the constitution by breaching Section 18 of the constitution of Zambia Act no.2 of 2016,” said Katuka.

“Clearly the petitioner requires the honorable court to interpret an Act of Parliament, the interpretation of which falls outside the jurisdiction of this court. The matter which the petitioner seeks interpretation can only be determined by the High Court.”

The Court has set June 15 to hear the said application.

Kanganja a ‘cheat’, say police officers

KANGANJA is a cheat who is eating and living lavishly with the PF, say police officers.

And Southern Province UPND secretary Winnerson Ng’uni says the statement by the Inspector General of Police Kakoma Kanganja is a confession that he would do anything that the PF instructs him to, even if it is against the rule of law.

Some Livingstone police officers mobbed this reporter yesterday to protest against their IG’s statement.

On Thursday, Kanganja in a statement said the PF had made work of the police ver easy.

He said since PF came to power the police were no longer working under difficult conditions.

“My brother, if we had a union, we would have called for a sit-in until the man (Kakoma Kanganja) resigned. He is a cheat. Why tell the entire nation that we are no longer working under difficult conditions when small boys in the name of being PF cadres are giving us instructions?” one officer asked. “They insult us at will and many of our brothers have lost their jobs all because of the PF lies, the list is endless. The man is a total failure, a cheat, who is eating and living a lavish life with the PF. He is the one protecting PF thieves and harassing innocent Zambians who just want the best for all citizens.”

Another officer fumed, saying that Kanganja was a “disgrace” to the police service, while another said the officers’ working environment was still as it was under UNIP.

“The man is a disgrace to us all and I want officers to stop calling him KK because it’s disgracing Dr Kenneth Kaunda. Go round to all central police stations in the country…tell me, which one is computerised from the inquiries section? Check out the furniture we sit on! It is the one left by UNIP. In other instances, it is the one left by the Britons in 1964,” the officer complained. “I leave home to sit on a chair that can break any second under my weight. When we cross into neighbouring Botswana, a police station inquiry section is worth a guest house or hotel lobby and the man says we are working in good conditions!”

And Ng’uni asked Kanganja to resign on moral grounds for letting down his officers.

“His talk confirms why we have been tormented as an opposition party. Our leader Hakainde Hichilema is a victim of Kanganja and the PF. There is no rule of law whatsoever under Kanganja,” said Ng’uni.

Meanwhile, former Livingstone district commissioner Paul Sensele said Kanganja was just protecting his job by praising the PF.

Sensele said he did not blame Kanganja because the man had to eat.

“I remember that under one IG, MMD cadres had threatened to gang rape Edith Nawakwi and kill a Mongu Diocese Bishop, but the then IG, I think it was, [Francis] Kabonde, said we can’t arrest anyone until a crime is committed. So please understand him (Kanganja) he is unprofessional and wants to eat and remain IG,” said Sensele.

IF a leader repeatedly shows poor judgment, even in little things, people start to think that having him as the leader is a real mistake, says George Sichula, the NDC Copperbelt chairman.

Meanwhile, Sichula says the PF has been issuing propaganda statements that NDC leader Chishimba Kambwili is already in talks with the ruling party with a view of rejoining his former gathering.

In his statement titled ‘Lungu does not learn from a warning, he learns from an example’, Sichula recalled that in 2015, all the PF members except a few believed that President Lungu was anointed to take over from president Michael Sata.

He, however, noted that it now looked like his ‘anointing’ was still not enough to push him for a third term.

“We initially had some doubts about him wanting a third term until he spoke about his running mate in Chirundu. And this confirms that he is behind all the public endorsements from the members within the PF. He sends people to endorse him just like he sends Bowman [Lusambo] to mistreat people, that’s how it looks like, except we know one thing, these endorsements are all meant to win favour from the President. They are not from genuine and God fearing hearts. How do you endorse the President in public but complain privately about his misrule?” Sichula wondered.

He said many PF members today were deeply disappointed about the third term song but were afraid of coming out in public due to intimidation from the cadres.

Sichula prayed that President Lungu finds his way on the ballot in 2021 so that he could be taught a lesson that he was and has never been an anointed one.

He concluded that all endorsements within the PF were influenced by President Lungu himself.

Sichula, however, noted that being a smartest lawyer he claims to be, President Lungu knew that he doesn’t qualify to stand under the current constitution thus is trying to push for a well calculated document, the Bill 10, knowing that time is limited.

“Our prayer as the NDC is that let President Lungu stand in the next year’s elections so that we can teach him a lesson using a ballot. It is like he never learns from a warning but from an example. The nation had no hint that he was behind Bowman Lusambo’s evil behaviour until he openly supported his ways of mistreating innocent Zambians publicly. If I were him, I would have rebuked Lusambo openly to win the support of the young people. But you see, Zambians are watching his political schemes closely. You have managed to sort out all the presidential aspirant challengers within the PF; KBF (Kelvin Bwalya Fube, CK (Chishimba Kambwili), HK (Harry Kalaba). Others are simply mourning inside in fear of being fired because everyone regards Lungu like a small god in the PF. One question remains: are you going to sort out Zambians too? This election coming is unriggable,” Sichula said.

He recalled that one PF member of the central committee openly disclosed to him that it was impossible to relinquish power to any other political party next year.

Sichula said the said PF senior member stated that UNIP ruled for 27years, MMD was in power for 20 years and wondered how PF could stay in government for only 10 years.

He said the named MCC vowed that PF was going to fight tooth and nail to return power.

“But you see, you cannot compare UNIP and MMD to PF. I can only assure the PF on one thing, this PF you see now, you shall see it no more,” Sichula said.

And Sichula said say NDC leader Chishimba Kambwili is returning to the PF was purely a hoop-la stunt meant to cast doubts in the minds of those that would love to join the NDC family.

He said the NDC leader was a principled man, who could not be compared to the likes of the former UPND vice-president Geoffrey Mwamba, whose ‘soul’ was for financial survival.

“You cannot compare GBM to CK. Principles separate a male from a man. CK is a man while GBM is a male. Putting on a trousers and having a baby doesn’t make a man. Women put on trousers, does it make them men? Men never sell their principles and birthrights no matter what, for the sake of ‘Sebana wikute programme’. We need men like CK who stick to principles and not males like GBM who can sell their birthrights just to win a contract to survive. A leader who practices the law of victory have no plan B. That is why they keep fighting,” Sichula said.

He said it takes a leader to create momentum and that Kambwili was such a leader.

“NDC is growing everywhere because we have a focused leader. As NDC, we believe in the law of focus. What you focus on the longest in life becomes your strongest. Our main focus is to sell our ideologies to the Zambian people to kick out the PF,” he said.

“My message to all those that would love to join NDC is that our President remains focused as NDC president and has at no point confessed having accepted going back to the capsizing titanic.”

Sichula noted that the heart of good leadership was sacrifice as he invited all to join NDC.

LEARN FROM KBF, KAMBWILI …will Catholic Lubinda, Luo, Ng’andu, Kapata and others defy their faith on Bill 10 – Kalala

JACK Kalala is asking if Given Lubinda, Professor Nkandu Luo, Dr Bwalya Ng’andu, Sebastian Kopulande, Sydney Mushanga and other PF members of parliament and ministers will defy their Catholic faith and support Bill 10.

“Will the Catholic MPs stand by their faith like Joseph did in Genesis 39:1-23? Will they resist temptations as Jesus did in Matthew 4:1-11 and Luke 4:1-13?” Kalala asked. “We will see how they will demonstrate their faith and obedience to the Church. Will they be obedient to the call of the Church or will they defy the call? Remember, when the hierarchy has made a decision on any point Catholics are bound to obey their directives.”

He says Bill10 is dictatorship, “lilomba, once created it will turn against anyone, including PF Cabinet ministers and members of parliament, who will try to stand in its path and devour them”.

Kalala urged supporters of Constitution (Amendment) Bill No.10 of 2019 to learn from what has happened to Kelvin Fube Bwalya (KBF).

“He [KBF] did everything possible to make [Edgar] Lungu become President. Today KBF has gone from a trusted ally to an ostracized outcast simply for expressing his democratic right to wish to challenge President Lungu at their convention,” noted Kalala. All those who toiled to make Lungu to go to State House are today eating the bitter fruits of the tree they planted, namely Chishimba Kambwili and Harry Kalaba. They are not even allowed to visit their own villages.”

In a statement, themed ‘The Pastoral Letter Vs Bill10’, Kalala said PF and President Lungu should not take people for granted.

He said the Catholic Church leadership should be highly commended for issuing a pastoral letter calling for the withdraw of Bill10 from the floor of Parliament to allow for genuine consultations with all stakeholders to arrive at a common consensus on the constitution.

Kalala said a republican Constitution is a document for all citizens and was different from the constitution of a political party that serves partisan interests.

“While the national Constitution is inclusive, the constitution of a political party is exclusive. Unlike a party constitution, the national constitution is a sacrosanct document that carries the aspirations of the people of a particular country and its provisions cannot be breached without severe consequences,” he said. “People who serve in public institutions swear to be loyal to it and to defend it. A President can be impeached for breaching its provisions. That is how sacrosanct a national constitution is. It is for this reason that its formulation should be taken seriously, and the process should involve every citizen to reach a collective consensus. It should not be taken lightly or used for selfish motives.”

Kalala said it was because of its grave importance that the Catholic Church leadership found it necessary to issue a pastoral letter calling for the immediate withdraw of Bill10 from the floor of the House, which is due for the second reading.

“The Catholic Church has acted timely to speak for the voiceless silent majority. In addition, the pastoral letter is a policy decision by the Catholic hierarchy, which is binding on the faithful as stated in Mater et Magistra, the Encyclical Letter of His Holiness John XXIII. #239 states that: ‘…Needless to say, when the hierarchy has made a decision on any point Catholics are bound to obey their directives. The Church has the right and obligation not merely to guard ethical and religious principles, but also to declare its authoritative judgment in the matter of putting these principles into practice.

#240 states: These, then, are the educational principles, which must be put into effect. It is a task, which belongs particularly to our sons, the laity, for it is their lot to live an active life in the world and to organize themselves for the attainment of temporal ends,” Kalala noted. “#241 states: In performing this task, which is a noble one, they must only be well qualified in their trade or profession and practice it in accordance with its own proper laws, they must also bring their professional activity into conformity with the Church’s social teaching. Their attitude must be one of loyal trust and filial obedience to ecclesiastical authority. They must remember, too, that if in the transaction of their temporal affairs they take no account of those social principles, which the Church teaches, and which we now confirm, then they fail in their obligations and may easily violate the rights of others. They may even go so far as to bring discredit on the Church’s teaching, lending substance to the opinion that, in spite of its intrinsic value, it is in fact powerless to direct men’s lives’.”

He said given that encyclical, the bishops’ pastoral letter was a call to order and a binding guidance to members of the Catholic faithful on Bill 10.

“These include the Catholics faithful who are in the PF government, namely Honourable Given Lubinda, Professor Nkandu Luo, Dr Bwalya Ng’andu, Hon. Jean Kapata, Hon. Sebastian Kopulande, Sydney Mushanga, and, in indeed, many other PF Cabinet ministers and MPs who are practicing Catholics,” Kalala said. “The pastoral letter is a call to choose between Jesus Christ and Barabbas. Will the Catholic MPs stand by their faith like Joseph did in Genesis 39:1-23? Will they stand by their faith as Daniel did in Daniel 6:1-28? Will they remain faithful as Daniel’s three friends in Daniel 3:8-25. Will they resist temptations as Jesus did in Matthew 4:1-11 and Luke 4:1-13? We will see how they will demonstrate their faith and obedience to the Church. Will they be obedient to the call of the Church or will they defy the call? President Lungu who also claims to be a Christian, will he listen to the Church’s call? It is a litmus test of their faith. PF members of parliament, ministers inclusive, should be wary of consequences of their action and draw lessons from past experiences. Adam and Eve ignored the advice given to them by their Creator. They subsequently reaped the fruit of their choice.”

He said those Catholics in the House would receive the rewards of their choices.

“I am surprised that Dr Bwalya Ng’andu and Hon. Sebastian Kopulande should be supporting the reintroduction of dictatorship through Bill 10 when in 1990/1 and in 2001 they were among those that gallantly stood up to fight the one party state and the third term attempt. What is their conscience telling them?” Kalala asked. “The PF members of parliament should be mindful that if they proceed to create a monster in Bill 10, it would turn around to destroy not only the democracy and the opposition parties but the country and themselves as well. Do what is right and you will get good results. If you create a monster you will live to regret it. You will find yourself in “Mwamona nomba!” as Chishimba Kambwili would say.

Kalala, a special assistant to president Levy Mwanawasa – Policy & Project Implementation and Monitoring, said the pastoral letter on Bill 10, having come from a neutral and non-partisan source, was a timely counsel to the promoters and supporters of the bill. “It has been given in good faith and in national interest. Those who are concerned should take it seriously. It would be imprudent of them to destroy the democracy that put them in power. They should not abuse the privilege and honour that the people of Zambia extended to them in good faith,” urged Kalala.

 

REGAZETTED BILL 10 OR ARE THEY AMENDMENTS TO BILL 10?

I had gone into serious reading and studying of the regazetted Bill 10 or are they amendments to the Bill 10 under the Gazette Notice published on 12 June, 2020.

Sadly, and sadly indeed, the government has not listened fully to the demands of the people but only attempted to listen.

Other than the Bill 10 objects remaining the same and the numerous typos in the regazetted amendments, it contains only about 5 changes to the contentious issues.

These include 1) removal of a coalition govt, 2) removal of the 3 year term for an inheriter of a presidential term; 3) retention of 14 days to hear and determine a presidential petition; 4) retention of parliamentary approval to contraction of loans, agreements, contracts and treaties and 5) retention of a clause on retirees to remain on payroll until paid their dues.

The rest remains the same way they are presented in the original Bill 10 e.g. public officers to resign 2yrs before an election when they want to participate in elective politics; ministers to remain in office until the next general election; president to create, divide a province without parliament approval as prescribed;

Others include: the composition of Parliament to be relegated to subsidiary legislation to be determined by a party with majority in Parliament; parliament never to dissolve on its own as is provided currently under Art 81(3);

the mayors/chairpersons and their deputies to be elected by their fellow Councilors and their of office term reduced for mayors/chairpersons to 21/2 years; chiefs to be recognised either by custom, tradition and culture or by President (confusion in the making);

MPs and ministers to be back into councils as Councilors; bloated govt still retained with the inclusion of deputy ministers, provincial ministers, Chief whip of the ruling party;

The president has been empowered to effect appointment despite parliament refusal or delay to ratify the nominee and the constitutional directive for the President to refer such a refusal or delay to ConCourt deleted;

The definition of a chief now includes those chiefs only recognised by govt and not custom, culture and traditions, among many undemocratic articles.

In essence, the regazetted amendments/changes have changed nothing to the Bill to say the least.

Withdrawing is the answer if truly this govt means well on this Bill 10. We can’t continue with this drama, fiasco and chaos associated with the Bill 10. It is embarrassing indeed.

Sir I hope you find strength in every breath you take during this episode of your life. I am a human being and my humanity is tempted to feel sorry for you. I would have loved to visit you even for a minute and shake hands with you once again but that may not be possible for me to do right now. Sir, if ever you get to read this letter please read it not with your mind but with your heart because this is not a product of my intellect but of my heart. Mr. Hakainde sir, please cherish this period of your life as everything you have dared to stand for is being put to test. I do not feel sorry for you at all but i admire you sir. You are lucky and blessed.

Sir, think about the tallest building, before the last brick was put, the builders first had to dig deeper. Think about the tallest tree sir, before the tree reaches its highest peak it first goes under with the roots. Think about Jesus Christ, before his ressurection he first had to be buried. Everything that has ever gone up has always dwelled under.

Think about the labour ward where our sisters and mothers give birth to life, its the place of pain but the joy that awaits is greater do you notice that the grave has the best flowers than the labour ward? Sir, the prison is such a terrible place, its a place of pain and misery but thats where great minds find inspiration. If Jesus Christ who raised the dead, healed the sick and fed thousands was chained and condemned to death who are we to escape the mediocrity of humanity.

Mr. Hakainde sir, you are in the labour ward of dreams whilst the grave yards are glistening with flowers of comfort and illusions of freedom. While you spend each minute reflecting those outside that prison are losing themselves in pleasure. I do admire you sir, your story shall be told with great detail. Do not lose hope, do not u-turn on your dreams. While it may appear hard and impossible, it is not. There are those who find comfort in calling you the Nelson Mandela, i find that insulting to you for you are not a copy of any other person but your own. Your story is not to become like Mandela but to become the Hakainde Hichilema from a little village in Monze.

Lastly, as difficult this period may be to you and your family, i think its a moment to rejoice. Those who believe in the future can see beyond the smoke.

THE NDC ECONOMIC VISION AND JOB CREATION PLAN

Maximizing economic growth in Zambia has never been more paramount than now. Especially with the population explosion as more people need a share of the national cake. As NDC we believe that growth alone without economic development cannot solve all the problems of unemployment, poverty or inequality, but accelerated economic growth is essential for creating sustainable jobs and as a precursor for economic development. Zambia’s moderate growth rate for the past 10 – 15 years has not been sufficient to catch up to constant rise in the number of unemployed persons. As NDC we believe that for our country to achieve the levels of employment needed and to reduce poverty, the economy needs to grow at a minimum of 9% per annum.

The NDC does not advocate for a form of capitalist system associated with the absence of state involvement. State involvement should be minimal to the level of regulation through independent institutions that report to select committees in parliament. In a bid to create a welfare state, we do not advocate for state interventions that unreasonably limit the growth potential of the private sector and entrepreneur growth to create jobs.
Raising capital in Zambia is very difficult for new entrants into the economy and we need to remedy this if we are to promote entrepreneurship. This is because agriculture and manufacturing have a higher job potential. In order to create a vibrant economy, the NDC when elected shall embark on the following:

Improving liquidity and lowering interest rates to policy rates of less than 4%, which is critical for the development and survival of small and medium size businesses and this as NDC shall be priority in the economic sector. High Interest rates are a challenge to the development of small and medium size business.

As NDC we shall motivate the SMEs and cooperatives sector and focus on developing them into large companies that can create jobs and effectively participate in stock exchange markets, especially for the women and youth.

As earlier mentioned, the introduction of a bank to be called “AGRICULTURAL INDUSTRIAL BANK”; SME BANK AND COOPERATIVE BANK shall give easier access to capital and loans to smaller businesses ventures that have cooperated to convert agricultural produce to finished products hence creating linkages between agricultural sector and industrial sector. Especially slicing, packaging, winery, canning, and dicing, production of juice, sauces, preservatives etc.

In addition, we shall also create a leasing organisation that shall not give finance but materials, equipment and machinery to do business operations. This organisation shall collaborate with the banks referred above for credit purposes.
We shall also Implement Fiscal and monetary policies that reduce financial outflows by ensuring that export proceeds are remitted back into Zambia’s circulation before being externalised.
Interlink the various sectors of the economy and bridge the gap between the formal sector and informal sector.

FOREIGN DIRECT INVESTMENTS

The NDC believes foreign direct investment (FDI) has not benefited Zambia positively. The FDI we shall attract as NDC government shall aim to achieve four things:
create Real jobs:

real job are jobs that will enable, the labour force earns a decent pay that will enable them get mortgage loans, car loans, and other financial facilities. A decent job also entails that the jobs being created will be in the category of formal employment.
increase tax revenue,
government should be able to collect various taxes through pay roll and various taxes to provide service.
promote supply chain industries
our FDI policies will enable the creation value chain addition to our final products. This should be a requirement for investors to illustrate on how their investment will promote other sectors of the economy
Improve Balance of payments.
Our FDI will also improve the balance of payment and improve liquidity, reduce the cost of borrowing money and financial out flow, through companies that establish industries that produce the most goods and services that we import as a nation.
We shall revise the five-year tax rebate under Foreign Direct Investment Policy (FDI) and replace it with a tax rebate based on projected and actual cash flow or sales, and when the initial investment creates more 350 Real Jobs.
We shall reserve certain businesses strictly for Zambians or Zambian companies whose shareholding is 50% or more by Zambians. These may include businesses such as Broiler and Layers production, Brick making, etc.
Amend the Zambia Development Agency (ZDA) Act to ensure that FDIs partner with local private sectors and list their shares on Zambia’s securities and exchange market at an appropriate time.
We shall create capacity and business opportunities by putting in place a policy to compel government ministries, spending agencies and government Parastatals to strictly buy and contract not less than fifty per cent (50%) of its goods and services that are manufactured within the country from empowered groups.
We shall undertake national business trading reforms by opening domestic trading hours to 24 hours a day. We shall review archaic laws that were developed to keep black people away from the central business districts, by allowing transport and business to trade 24 hours a day and encourage for increased trading hours for all businesses and legislate for mandatory sectors and selected business to operate 24 hours.
Zambia has many unskilled learners and this has resulted into unemployed youths and an economy that is not knowledge-based. We shall radically improve our skills base through a variety of measures such as content specialization at early stages as outlined in the education sector of this manifesto, to have better educational outputs. The current skills shortages hampers growth.
As NDC we will ensure that our country has more than, 5 months of import cover, an economy that is resilient to international crisis. This will make our nation borrow at lower prices than the current government because of investor confidence and the low risks associated with lending to our government. This is critical because government needs to refrain from clouding out the economy from local investment if interest rates will be less than 4%.

State House deletes Lungu’s condolences message to Nkurunziza after negative feedback

STATE House has deleted President Edgar Lungu’s message of condolences in which he eulogised Burundi’s outgoing President Pierre Nkurunzinza which was posted on the Head of State’s official Facebook page after getting negative feedback.

President Lungu said Nkurunzinza’s demise was a tragedy and that he would be remembered for spearheading infrastructure projects aimed at making water and electricity more accessible to the people of Burundi.

“I am deeply saddened by the deaths of outgoing Burundi President Peirre Nkurunzinza who died on Tuesday following an illness. I learnt of Mr Nkurunzinza’s death with deep sorrow and his demise is shocking because he was unwell for a short period. He was to democratically hand over power to that country’s President-elect General Major Evariste Ndayishiye who emerged victorious following a milestone democratic presidential election held in Burundi recently. The demise of President Peirre Nkurunzinza is a tragedy. I recall that President Nkurunzinza played a significant role in successfully ushering Burundi into the East African Community Economic Bloc in November 2006,” posted President Lungu.

“He will also be remembered for having aided the reformation of the economic community of the Great Lakes Countries, the trade organization that comprised Burundi, the Democratic Republic of Congo and Rwanda in April 2007. Further, he will be remembered for spearheading infrastructure projects aimed at making water and electricity more accessible to the people of Burundi. On behalf of the government of the Republic of Zambia, the people and indeed my own behalf I wish to convey sincere and deepest condolences to your Excellency to the government of the Republic of Burundi and the bereaved family on the death of outgoing President of the Republic of Burundi Mr Peirre Nkurunzinza. May the Almighty God comfort the bereaved family and the entire nation. As we join the rest of the world in commiserating with the people of Burundi, please accept your Excellency the assurances of my highest consideration.”

But President Lungu’s followers however reacted negatively to the post.

“Too bad it’s a wrong country,” posted Melvin Makumba.

Another follower, Sarafina Nthenga, seemingly ‘admired’ the people of Burundi.

“Utunensu (Our friends),” commented Nthenga.

And Dumiso Mawere hoped that God would answer Zambia’s prayers.

“Some countries are blessed, anyway God will answer our prayers too,” said Mawere.

Chongo Mcdonald said he waited for another African leader, who was a dictator, to die.

“Remember him just as government alone, not including the people, there is nothing good to remember about [a] dictator. Us the people are just waiting on whose next,” wrote Mcdonald.

Another follower, Clement Sikazwe, said the ‘angel’s’ mission had not yet been accomplished.

“Very sad indeed, it’s good that the angel is still roaming in Africa. The mission hasn’t been accomplished yet,” said Sikazwe.

Innocent Kangwa said God was blessing other countries.

“See what God is doing for other countries,” posted Kangwa.

Meanwhile, Keith Moono likened Nkurunzinza to President Lungu for trying to run for a third term

“Nkurunzinza was a dictator who manipulated his country’s constitution to run for a third term just like the way to impose Bill 10 on us,” said Moono.

President Lungu’s handlers were forced to delete the post. This is the second post to be deleted in a space of a week. The first post which was deleted was a video in which the Head of State ordered police to sort out youths who were planning to protests against various governance issues.

A 30 year old Lusaka Man has taken to social media to cry after being dumped by his fiancee. Prophet Kelvin Mumpangwe lamented that he sacrificed everything for her long time lover, only to be disappointed, something he never expected. For the past four days now, he has refused to eat or drink anything due to the heartbreak. He is now in the bush crying and has vowed never to eat or drink anything until 30 days of hunger strike. It is reported that his longtime girlfriend dumped him after his best-man to be (Brian Mumba) propose to her and slept with her. The heartbroken man was scheduled to marry his longtime (4years relationship) girlfriend on 4th July 2020; but now she is no longer interested after sleeping with one of his friends……Sad Indeed!

Lubinda’s utterances on Bill 10 undermine Matibini – Nkombo

GARY Nkombo has written to Speaker of the National Assembly Patrick Matibini over justice minister Given Lubinad’s “contempt of the House and breach of parliamentary privilege”.

In his letter dated 22 May 2020, the Mazabuka Central UPND member of parliament says Lubinda’s continued utterances that debate on Bill 10 would continue once the sitting of the House resumes pre-empts and undermines the Speaker’s ruling on the issue.

“I write to officially lay a complaint before you, Mr Speaker, against Hon Given Lubinda, the Honourable member of parliament for Kabwata Constituency and Minister of Justice, regarding his utterances as quoted in the media regarding National Assembly Bill Number 10 (“Bill 10”) despite there being a pending ruling over the same,” he stated. “Mr Speaker, you will recall that before the House adjourned sine die on 18th March, 2020, I had raised a point of order regarding the continued debate by the House of Bill 10 in the face of court proceedings that have been commenced in the Constitutional Court which relate to one of provisions which is subject of Bill 10. On that occasion Sir, you retired to consider the matters raised in my point of order before returning to adjourn the House sine die without delivering any ruling on my said point of order.”

Nkombo said in that regard, “your ruling, Mr Speaker, is still pending and as such parliamentary practice and privilege demands that all members of the House desist from discussing, debating or otherwise making any innuendos in relation to the matters subject of the pending ruling aforementioned.

“It has thus come to me with a sense of deep concern that the Honourable Minister Mr Lubinda has issued and continues to issue running commentary on the continued debate of Bill 10 which he claims will continue once the House resumes sitting, notwithstanding the pending ruling,” he said.

Nkombo said Lubinda was quoted by the News Diggers on May 7, 2020 saying the debate on the bill would continue once sitting of the House resumes, “thereby pre-empting and undermining your ruling on the issues”.

“In my considered view, the utterances by Honourable Lubinda, if correctly reported by the said newspaper, are prejudicial to the proceedings of the House and are intentionally disrespectful of you, Mr Speaker, given the aforementioned circumstances,” said Nkombo. “To this end, I write to seek redress against Hon Lubinda pursuant to Section 19 and 28 of the National Assembly (Powers and Privileges) Act Chapter 12 of the laws of Zambia as amended by the Act No.13 of 2016. I further seek your indulgence, Sir, that you direct all other persons, be they members of parliament or otherwise, to desist on making running commentaries on the process of enactment of Bill 10 pending delivery of your ruling on the point of order raised as allowing them to do so has the potential to demean the processes of this August House. I look forward to your further guidance on the subject matter of this letter and indeed on the point of order raised once parliament resumes sitting on the 9th June, 2020 as announced by the Clerk of the National Assembly recently.”

Parliament is set to resume deliberations next Tuesday.

Select committee is expected to support Bill 10 – Lubinda

JUSTICE minister Given Lubinda says he expects all members of parliament who sat on the select committee on Bill 10 to support it.

Several stakeholders, including the Zambia Conference of Catholic Bishops and Transparency International-Zambia have called for the withdrawal of Constitution (Amendment) Bill Number 10 of 2019, arguing among other concerns that it is divisive and lacks consensus.

Lubinda, however, says the practice in all Commonwealth parliamentary jurisdictions is that committees operate on the basis of conscience.

“Are members of the committee allowed to go against the report of their committee? The practice in all Commonwealth parliamentary jurisdictions, all of them without exception, is that committees operate on the bases of conscience and there is no provision for minority reports unlike in the courts where judges can give opposing judgment,” he said. “For Parliament when a committee of ten sits, they have to be guided by conscience and if then they don’t all agree they can even vote and once they vote, they are held in by a doctrine of collective
responsibility, which therefore means that if a committee says we reject this particular position, even the one who strongly supports it is bound by the decision of the majority.”

Lubinda said ordinarily members cannot oppose the position taken by the committee.

“So even in the position of Bill 10, those who sat on the select committee are expected to support the position that was taken by their committee,” said Lubinda.

But on Monday, Professor Muna Ndulo said according to Commonwealth practice, a parliamentary select committee report does not gag its members.

The US-based constitutional law professor argued that members of the select committee were in fact free to vote against the bill, depending on their political party position.

“As pointed out earlier, a Select Committee Report does not gag its members. It does not operate to deprive a member of parliament of his or her liberty to debate and vote in any way he or she wishes to. Where a party instructs its Members of Parliament to vote according to the party’s position on an issue before Parliament, it typically issues what is called a ‘three-line whip’,” he explained. “Breach of the instruction will normally have serious consequences. There is nothing dictatorial about this, it is simply upholding the policies of the party to which a member of parliament freely subscribes. The punishment is restricted to the member’s status in the party. The party is simply saying you cannot be our member and disobey party instructions. The member is not being punished for voting in Parliament but for disobeying the party and that is why the punishment relates to party status.”

He challenged the PF to stop lying to the nation about parliamentary practice.

“In a desperate attempt to pass Bill 10, surrogates of the ruling party have resorted to releasing a myriad of lies and distortions of legal principles relating to parliamentary practice. One of their main untruths is what exactly is the correct Commonwealth Parliamentary procedure relating to voting of members of parliament,” said Prof Ndulo. “Recently, they have argued that members of parliament who have been members of the Parliamentary Committee to consider Bill 10 cannot vote against a Bill that went through a Select Committee of which they were a part. In essence advancing the bizarre argument that membership of a parliamentary committee has the effect of gagging a member of the Committee and does not allow them to vote otherwise than support the Parliamentary Committee Report.”

Youths, Sport and Child Development Minister Hon Emmanuel Mulenga has assured youths in the country that President Edgar Lungu values them and will prioritize their welfare.

The Minister said this in Lusaka on Friday afternoon when he engaged the youths from four provinces to discuss how to enhance youth participation in available economic opportunities in mining, construction, agriculture/aquaculture and manufacturing.

The meeting was organized by the Ministry of Youth, Sport and Child Development in partnership with the National Youth Development Council.

Hon Mulenga disagreed that the meeting has been hurried according to social media reports and said government has instead responded to the cry by the youths to be heard.

“We heeded your call to dialogue. I want to ensure that these meetings are held every two months,” he said.

He directed the National Youth Development Council Secretary David Musonda to ensure that such meetings are spread to all the provinces of the country.

He said even those that have shunned the meeting are welcome and find amicable ways to engage the government on issues affecting them.

He reaffirmed President Edgar Lungu’s commitments to the concerns, challenges and recommendations of the youth.

“His Excellency President Dr. Edgar Chagwa Lungu, President of the Republic of Zambia is growing our youth population into responsible and productive citizens. Therefore, the government is providing a conducive environment for the youths to full actualize their full potential,” said Hon Mulenga.

“I wish to inform this gathering that the government of His Excellency President Lungu is aware of the challenges faced by the youths which include; youth unemployment, limited access to affordable loans, user friendly business financing, limited participation in governance among others.”

Speaking earlier, Ministry of Youth, Sport and Child Development Permanent Secretary Joe Kapembwa said the government has provided a platform for youths to engage with the state on issues affecting them.

Mr. Kapembwa said the meeting was called to hear from youths as they called on government to listen to them through different platforms such as social media, print and electronic media.

 

If you don’t deliver, forget about adoptions, Mwila tells PF aspirants

PF secretary general Davis Mwila says any party members holding premature campaigns for adoption will be expelled from the party.

Mwila said the 2021 PF adoptions shall be on merit and according to performance.

He said he was aware of people that want to use money for adoptions and cause confusion.

He said this when he addressed the Luanshya district PF members.

“All sitting MPs, mayors, councillors must deliver or they must forget about adoption. If you do not deliver, if you do not work, forget about adoptions. If you are a councillor and you have failed, forget about adoption,” Mwila said.

He said only party members who have worked hard for the party must be rewarded for the work they have done.

“Do not recommend appointments based on personal relationships or friendship but on hard work and commitment to the party,” he said.

“Everyone wants to be an MP. You have only been a councillor or mayor for few years and you are already destabilising the party structure with your campaigns to be an MP. We shall kick you out and you shall not even enter your promised land. We have heard what you are doing. You are constituency chairman, you want to be MP and you start suspending people who are not supporting you. We will not accept that. If someone is a civil servant and you want to contest, why disturb a sitting MP? Resign and join politics,” Mwila said.

He said some of the impatient PF members would get frustrated and join other political parties because they were in hurry for top leadership.

He warned Mufulira PF members who were fighting sitting members of parliament.

“We cannot have an ordinary member fighting a Cabinet minister. This is the first time in my life that I have seen an ordinary party member fighting a Cabinet minister and we are just watching. People in Mufulira will face our wrath before we head back to Lusaka. Enough is enough with this behaviour,” said Mwila.

“Electoral Commission of Zambia has announced that there will be voter registration starting in October 2020. All of us must be ready to take people for registration. Not just playing around. The political party which will register more members will win elections. You must start with NRCs, start from branches, ward and constituency. All your children and community members without NRCs must get NRCs and register as voters. Not everyday fighting to be councillor, mayors, MPs, positions you will never even get.”

 

ON PF INSULTING CHURCH LEADERS

It is seldom good politics for the PF leadership and their surrogates to resort to attacking the church and the bishops for demanding the withdrawal of Bill 10 .

Undoubtedly Bill 10 is a bad piece of legislation and it stinks.

Constitutional matters are not a personal preserve or private issue but are everyone’s business and to arrogantly assert that the bishops should concentrate on church matters is in essence displaying ignorance and lack of understanding of the important role that the church plays in the life of a nation.

A good piece of legislation to amend the constitution should be one that is people driven and consensus built around it with all stakeholders.

The uncouth venomous tirade thrown to the church and the bishops by the Minister of Justice is unacceptable and absolutely shocking and shameful.

We think that decency demands that he should withdraw his statement and apologise to the church and the bishops.

The intended amendment to the constitution is not a private affair or a PF matter but is a national affair.

We think that it is absolutely shameful and naive to openly assert that the church should stay away from speaking against the wrongs and injustice in society.

The God given role of the church is not just about spiritual guidance but speaking out openly for the weak and the vulnerable in society.

We think that it is extremely being narrow minded for the PF leadership to only remember the relevance of the church in times of desperation for votes.

Abusing the church and the bishops on a poorly crafted bad piece of legislation will not help the PF leadership and those who are dangerously desperate on clinging onto political office with nothing to offer Zambians save for personal aggrandisement.

It is common sense to everyone that when you offer money to Members of Parliament to solicit for a vote on a particular bill in parliament in essence even you the prime mover of this Bill recognise that it is a bad piece of legislation hence paying out money corruptly for the numbers.

The truth is that the whole Bill 10 stinks deception and skullduggery and as such must be withdrawn forthwith.

A proposed bad piece of legislation cannot be fixed by abusing and threatening those opposed to the bill.

We urge the PF government to inculcate civility and dignity in their desperate push for bill no 10.

Miles Sampa prohibits Matero MP from entering Matero stadium

MAYOR of Lusaka Miles Sampa has told Matero member of Parliament Lloyd Kaziya that Matero stadium is a no go area for him

In a video that has gone viral, Sampa has urged Kaziya not to step foot at Matero stadium as it is a private land which he owns through a lease he got when he was Matero member of parlliament.

Sampa has also banned the Matero Tigers Football Club from entering the stadium.

“Since this is a private entity, now the right of admission is reserved and restricted. I hereby say that certain people should not be allowed when they come, starting with the MP Kaziya mumuziba (You know him). This is a private premises, even the MP is not allowed to walk in…. And I have a court case against the MP, which I won, it’s a defamation about this stadium, the rulling is in my favour. I am just waiting for the costing to know how much he is going to compensate me. [I] will tell my lawyers to put a Fieri facias on his gratuity, so that when his gratuity is out, we will use it to finish this same stadium,” he said.

“Ba executive ba Tigers, tell them when I was MP and patron for Lusaka Tigers, we moved the team from division one to the premier league. Where was the MP? Now it’s in division what? That’s the fact they cannot change. I didn’t say I was the one sponsoring the team, any one who did can raise a hand, but the fact is that I was MP when we brought that team into premiere.”

Sampa alleged the Lusaka Tigers executive is being used for politics.
“Don’t allow then here but the coach, the players are innocent, allow them to play here and the money from here share equally with Tigers and Matero United,” he said.

Sampa has also banned all those who want to stand as MP in Matero from entering the stadium.

“Then those who are ambitious and want to be MPs, tell them this is not an area for politics, they should not be coming here to do their donations, let them go to Matero Hall or they go to Zingalume at Muchinga ground and rebuild it, so they should not be coming here that I am donating, donating, no sir this a private entity….”

Sampa also challenged all those who want to invest on the stadium to refund him his K10 million.

Lusaka Tigers executive has been fighting to have the stadium put back in its hands as it is currently in the hands of the mayor through a ten-year lease that comes to an end next year.
