STATEMENT OF GRATITUDE FROM SOCIALIST PARTY PRESIDENT FOLLOWING KABATA POLLS

On behalf of the Central Committee of the Socialist Party, I would like to thank our candidate, Comrade Tripher Ng’andu (Uncle T), and all the comrades who worked tirelessly in the Kabwata parliamentary by-election campaigns. This is not the outcome you wanted or you worked so hard for.

But I feel pride and gratitude for the wonderful election campaign structures that you built together in Kabwata in a very short time. You represent the best of our party.

I know how disappointed you all feel because I feel it, too. And so do many Zambians who wanted you to win. But I want you to, as always, remember this: our work in Kabwata was never about one parliamentary by-election. It was about organising and strengthening our party. We must put this result aside and look to the future. Revolutionaries don’t gloat over such things. So now our responsibility as party members is to keep doing our part to organise and strengthen our party. And I am confident we will.

I will always be grateful to the creative, talented, dedicated comrades of our national campaign team. You poured your hearts into this parliamentary by-election campaign. I want each of you to know that you are highly appreciated and valued.

To everyone who sent in contributions and kept the Kabwata parliamentary by-election campaigns going, thank you from all of us. And great thanks also to all those who voted for our party’s candidate.

Finally, I still believe, as deeply as I ever have, that if we stand together and struggle together, with strength in our socialist ideological convictions, and love for this nation, our best days are still ahead of us. You know, scripture tells us, ‘Let us not grow weary in doing good, for in due season we shall reap if we do not lose heart.’ So, dear comrades, let us not grow weary, let us not lose heart. For there are more seasons to come and there is more work to do.

UPND making Public Protector weak – Lubinda

FORMER justice minister Given Lubinda says the PF government did not avoid operationalising the Public Protector for fear that it would be used against them in the pursuing corruption issues.

Lubinda instead accused the UPND government of making the Public Protector weak.

He said people who were interested in the operations of the Public Protector should worry about the reversal of the office from a parliamentary to an Executive ombudsman by the UPND government.

He alleged that the UPND government had decided to take back the Public Protector’s office again to be an Executive ombudsman where officers would be reporting directly to President Hakainde Hichilema.

“Citizens have to be worried that we are taking 10 steps backwards in so far as good governance is concerned. The President is now in total control of the office of the Public Protector against international good practice which dictates that the Public Protector must be independent,” Lubinda charged.

He said former president Edgar Lungu assented to article 243, Act 15 of 2016 to operationalise the Public Protector on June 6, 2016 although the office was not fully operational “due to lack of funding”.

Lubinda said during the period 2016-2021, the office of the Public Protector actually took some government officers to court for maladministration.

He also noted that the powers of the Public Protector were enhanced than it was in the investigator’s general office.

Lubinda said the office was not involved with responsibilities of corruption and abuse of office as perceived by some members of the public.

He said the aim of the Public Protector’ office was to provide for the function, power, operation and financial management of the office and further provide initiatives and investigate public complaints.

Lubinda said the Public Protector is an ombudsman body of the government to protect individual interests and safeguard their rights in the quest to receive public services which are just and fair.

He said if a public worker thought they were wrongly dismissed from work the matter was supposed to go to the Public Protector.

Lubinda further said the office was also established to promote good governance in public institutions.

Caroline Sokoni is the current Public Protector director general.

“The Public Protector exercises power which is similar to the High Court judge which was not the case for the Investigator General’s office,” he said.

Lubinda argued that those who claimed that the Public Protector is not functioning because the PF government did not operationalise it, were talking out of ignorance.

‘Now I want to remind readers of The Mast Newspaper, that as late as December, 2021, the Office of the Public Protector visited North Western Province to carry out awareness programmes and conduct on spot investigations. The team was led by chief investigation officer Bwalya Tibulanda who also paid a courtesy call on North Western Province permanent secretary,” he said.

“Now how could the Public Protector team be conducting investigations and awareness programmes? If so, you can see that the Office of the Public Protector is functional but lacks adequate funding.”

Lubinda said lack of funding to government institutions was a perennial issue for almost all the countries in the world and that Zambia is not an exception.

He said the Public Protector lacked funding just like the police, Ministry of Health and many other government departments.

He said this was the greatest challenge of “its non-effective operation”.

Lubinda dismissed as malicious assertions that the PF avoided operationalising the Public Protector out of fear.

“If people have queries about the role the Public Protector is meant to play, they must go to the roles and they must not claim that the law was not operationalised by PF because it was done in 2016. And if people would like the Public Protector to play same roles of the Anti-Corruption Commission and Drug Enforcement Commission, let them say so,” said Lubinda.

“My advice to fellow citizens is that those who want to project themselves as very wise, must also take time to read because talking without doing sufficient research risks misinforming the public. I want to repeat that members of the public must not be misled that there is no Public Protector’s office. It is there and in operation. Those who feel that any public institution is not providing public services in a fair and just manner, must be encouraged to report such matters to the Public Protector’s office.”

Yesterday I got calls and news on social media about a lady that allegedly gave birth in the corridors of solwezi general hospital amd went there first thing in the morning with Doctor Msiska who is the provincial health director.
The facts on the ground are that indeed this did happen and I took time to meet a young lady who is 17 years old and this was her first pregnancy and had challenges to understand the signs of labor and transport to get her to the hospital in time. However this does not justify the fact that she was not attended to in time by the medical staff.
I would like to assure the public that as provincial administration we are handling this issue very seriously and have made some recommendations to change the entry points to the maternity ward more and easily accessible.
So that the maternity ward has its own access route.
I engaged managed on how we can objectively work together to help change the bad perception that solwezi general hospital has to the public.
Beatrice the young lady is 17 years old and a school drop out,we will follow this up as an administration to ensure that after some months,she is put back in school as she showed interest to finish school and support her.
I would like to thank each and every person that reached out through phone calls over this Matter this is what holding the Goverment accountable means and we are grateful .

Public Protector is in place, except oversight facet – Haimbe

JUSTICE minister Mulambo Haimbe says there are a number of things that have taken place in operationalising the Public Protector.

He says there is a public protector in place and the office is functioning except “of course the only aspect that seems to be lacking is the facet of parliamentary oversight”.

“There is a number of things that have taken place. I think you are aware of the background. The Public Protector, Ombudsman was previously an Executive Ombudsman but now is a parliamentary ombudsman,” Haimbe told The Mast.

“There is a public protector in place. The office is actually functioning except of course the only aspect that seems to be lacking is the aspect of the parliamentary oversight. So National Assembly is the institution which is mandated in ensuing that is done. Ours as [Ministry of] Justice is to help in that project. That is what we are doing to ensure that is done.”

He however noted that the parliamentary service commission which is a key part of ensuring effectiveness of the Public Protector is not yet
in place.

Haimbe assured the nation that there is quite a number of internal steps that are being undertaken stating that the UPND government has only
been in office for five months.

“As you are aware the parliamentary service commission is a key part of ensuring effectiveness of the Public Protector, which is not yet in place. That has to be attended to and of course there is the aspect of moving staff from Investigator General to the Ombudsman which is still underway,” he said.

Haimbe said it may not necessary be a bill that would be taken to parliament to actualize everything “as there are other internal steps that will be taken with regard to the subject matter”.

Recently, activist Brebner Changala says the Public Protector is the only government wing that can fight corruption in the country.

“I have to give you a good example. We have a fertiliser scandal which the Executive does not want to discuss because they are part of the scam. Now if the Public Protector was functional, I know that scam would have received due attention,” he told The Mast.

“The Anti-Corruption Commission, ask them whether they are looking into the fertiliser scam. Go to DEC (Drug Enforcement Commission), ask them whether they have even moved an inch towards the fertiliser scam. Go to the Zambia Police. Worse still because they are looking at who is behind this scam, what are the connections to the powers that be. And that is problem number one. And that’s where the tragedy comes in.”

Changala warned warned that without such an office being fully functional, President Hakainde Hichilema should forget about fighting corruption.

“Without a Public Protector, then President Hichilema is going to do it on the basis of a good man. And this country does not need good men. It needs good laws and strong institutions. Good laws and good institutions is what we want, not good men,” he said.

“Those good men can go to Church. The fight against corruption should not only have a political will. It must also have strong laws and strong institutions. It must not be only about good men versus bad men or bad women. It is the laws that control the dignity of any ambition to fight the scourge of corruption.”

Changala said the Public Protector is the only tool to fight corruption because the organ is free from the Executive since corruption mainly is in the arm of the Executive.

He said no corruption fight would be achieved until the Public Protector’s office was functional.

“But for the current form that it is in, the Public Protector is in good test. It is independent, it is as independent as the Judiciary. And that is the more reason we will not rest because this fight against corruption is only used against opponents because it does not go for criminals that are embedded in the Executive arm of the government. So, I appeal to the Minister of Justice, I appeal to the entire Cabinet; but most of importantly, I appeal to the conscience of the President not to talk about corruption as a story; corruption to intimidate the listeners when there is nothing happening on the background to strengthen the laws to make the institution of governance stronger and independent from the perpetrators,” said Changala.

“So, the Public Protector is non-negotiable. It must be made functional, functional like yesterday. It’s a pity it missed the first session of parliament because if fighting corruption was a priority, the Public Protector functional system should have been a priority as well.”

Harrington challenges ACC to probe Lusaka-Ndola road contract

WILLAIM Harrington says the Anti-Corruption Commission must take keen interest in the revelation by transport and logistics minister Frank Tayali that the contractor engaged by the PF government to construct the Lusaka-Ndola dual carriageway at $1.2 billion is back in the country and has agreed to do the works at 50 per cent the cost.

Harrington said the issue Tayali revealed smells of corruption and the contractor should be summoned for questioning by the Anti-Corruption Commission.

Last week, Tayali said the contractor who was engaged for the Lusaka-Ndola dual carriageway at US $1.2 billion had come back in the country and had agreed to do the works at 50 per cent lower
than demanded under the PF regime.
In 2018, the PF administration agreed to a contract to do the Lusaka-Ndola dual carriageway at a cost of more than $1.2 billion.
However, the Road Development Agency halted the construction of the road owing to financial constraints.
During a meeting with transporters from various bodies in Ndola over the weekend, Tayali disclosed that the contractor that was meant to work on the Lusaka-Ndola dual carriageway “using colossal sums of money has come back into the country and has agreed to do the works at a-50 per cent lower rate than what was demanded before”.
He said working on strategic roads to open up the country was on top of the UPND government agenda.

“The Ndola-Lusaka dual carriageway is one of the roads that we have on top of our agenda to be worked on for the transport sector to flourish,” he said.

Tayali said there was no need to put up colossal sums of money to work on one road when the same amount demanded would work on a number of roads

But Harrington, a former communications and transport minister, said an ACC investigation was necessary because had the PF won the August

12, 2021 elections, the contractor would have been paid the inflated cost of $1.2 billion instead of the real cost of $600 million.
“This whole matter smells of corruption in a dubiously awarded contract over which the contractor should be summoned for questioning

by the ACC and to show cause why he should not be arrested for what appears to be a dubious scheme to steal money from the people of Zambia in collusion with the former Patriotic Front regime through overpricing,” Harrington said

He said logically and realistically, no contractor would offer to undertake such a contract at half the original cost

Harrington warned that the UPND government should not be seen to celebrate the presence in the country of the contractor if there was scheming with the previous government to extort such huge amount of money from Zambians.

He said if it is proved that there was collusion, the contractor should be blacklisted and banned from acquiring any other road contracts in Zambia.

“The revelation by transport and logistics minister Frank Tayali is extremely frightening and our new dawn government should not celebrate the coming back into the country of the contractor who may have connived with the former regime to syphon money from our country,” he said.

Harrington further said should the Anti-Corruption Commission act on the matter as proposed, Tayali should be able to assist with investigations and provide more information.

Islamic State leader killed during raid by US special forces in Syria

The leader of the Islamic State (IS) is dead following a US raid in northern Syria that also killed a senior deputy of the terror group, US officials say.

Abu Ibrahim al-Hashimi al-Qurayshi set off a blast killing himself and his family as special forces rounded on his hideout after a gunfight.

US President Joe Biden disclosed the overnight raid on Thursday.

Qurayshi’s death “removed a major terrorist threat to the world”, Mr Biden said.

US officials did not name the IS deputy also killed, but provided dramatic details of the operation that had been months in the planning.

Several US experts told the BBC that Qurayshi’s death would be a blow to IS, but the group would ultimately regroup.

The raid targeted a three-storey residential building on the outskirts of the opposition-held town of Atmeh, which is in northern Idlib province and close to the border with Turkey.

The region is a stronghold of jihadist groups that are fierce rivals of IS, as well as Turkish-backed rebel factions fighting the Syrian government.

Intelligence reports had established that Qurayshi was living with his family on the second floor of the residential building in Atmeh from which he ran IS using couriers to despatch his orders in Syria and elsewhere.

A notorious militant known as “the Destroyer”, Qurayshi – who also went by the noms de guerre Hajji Abdullah, Amir Mohammed Said Abdul Rahman al-Mawla and Abdullah Qardash – became IS leader in 2019, following the death of his predecessor Abu Bakr al-Baghdadi.

Though the terror group announced his rise to the leadership four days after Baghdadi’s death in October, Qurayshi is believed to have long been groomed for the role and kept away from the battlefield in anticipation of assuming the mantle.

US authorities had offered a $10m ($7.3m) reward for information about the veteran jihadist, who was born in Mosul, Iraq, in 1976,

How was the raid carried out?

While in Atmeh, he never went outside except to bathe on the rooftop, but an airstrike would have come with high risks of civilian casualties – another family not believed to be connected to IS or aware of Qurayshi’s presence lived on the ground floor.

A possible ground raid was studied in detail, with a dozen scenarios practised and risk assessments taken of the situation on the ground, senior administration officials said. Models were built of the residential compound and engineers studied the likelihood of the building crumbling in a blast.

Mr Biden was briefed on the details of a possible operation in December.

He gave a final go-ahead for the special forces raid on Tuesday, monitoring it in real time from the White House situation room as multiple helicopters arrived in Atmeh around midnight on Thursday (22:00 GMT on Wednesday).

Local sources said the US special forces faced stiff resistance on the ground, and that they came under fire from anti-aircraft guns mounted on vehicles. Gunfire and shelling were heard for two hours before the helicopters left.

Pentagon spokesman John Kirby said US forces were able to evacuate 10 people from the house, including eight children.

Those killed in the raid included one of Qurayshi’s deputies and his wife, both of whom had fired on US forces. Additionally, Mr Kirby said that US forces engaged a small group of people who approached the area during the two-hour mission and were “deemed hostile”, resulting in two of them being killed.

“That resulted in the end of hostile activity,” he said, adding that “it appears as if a child was also killed” nearby. Mr Kirby added, however, that the US doesn’t “have perfect knowledge of every single person who was killed”.

As the raid unfolded, Qurayshi detonated an explosive device on the third floor of the house, killing himself, his wife and two children. President Biden described it as “a final act of cowardice”.

Qurashi was later identified “through fingerprints and DNA analysis”, said Mr Kirby.

There were no US casualties. One American helicopter malfunctioned during the raid and had to be destroyed.

Qurashi’s blowing up tactic was also used by Abu Bakr al-Baghdadi when he encountered US forces in 2019.

Baghdadi killed himself and three children by detonating an explosive vest during a US special forces raid on a hideout that was only 16km (10 miles) away from Atmeh.

The White Helmets rescue service, also known as the Syria Civil Defence, said it had found the bodies of six children and four women at the house targeted in the raid.

All Americans involved in the operation returned safely, Mr Biden said.

“Hajji Abdullah oversaw the spread of [IS]-affiliated terrorist groups around the world after savaging communities and murdering innocents,” Mr Biden said, calling him “the driving force behind the genocide of the Yazidi people in north-western Iraq in 2014”.

“We all remember the gut-wrenching stories of mass slaughters that wiped out entire villages, thousands of women and young girls sold into slavery, rape used as a weapon of war.

“Thanks to the bravery of our troops this horrible terrorist leader is no more,” he said.

US foreign policy think tank specialists told the BBC that IS would be damaged by the death of Qurayshi.

Jon Alterman, from the Center for Strategic and International Studies, said: “Losing a leader makes them even [IS] more paranoid.

“We want them to be paranoid and want them to be searching for traitors in their midst. It’s totally destructive and it’s wonderful.”

Jomana Qaddour, of the Atlantic Council, said: “It’s always a good thing when the head of ISIS is taken out. But this certainly won’t be the last we see of ISIS.”

We Refuse To Accept Defeat In The Kabwata Parliamentary By Election- Sean Tembo

PeP STATEMENT No.5 ISSUED ON FRIDAY, 4th FEBRUARY 2022: FOR IMMEDIATE RELEASE

1. As Patriots for Economic Progress (PeP) we wish to categorically state that we do not accept the results in the Kabwata Parliamentary by-election as a true reflection of the free will of the people of Kabwata Constituency. This is because of the violence which was perpetrated against our members and supporters by the ruling UPND party from the very onset of this election cycle.

2. On 28th December 2021 during the first nomination process at St. Patrick’s Primary School in Kabwata, members of the PeP Womens National Choir were attacked by UPND members led by William Banda, in full view of police officers. Four of the attacked PeP members suffered serious injuries and had to be admitted to Levy Mwanawasa Hospital for more than a week. The PeP bus was vandalized, music equipment including amplifiers and speakers stolen as well as two drums. This matter was reported to Kabwata Police Station and despite the assailants being identified by the victims, the police did not effect any arrests and the docket remains open up to this day.

3. During the second nomination exercise undertaken on 20th January 2022 again at St. Patrick’s Primary School in Kabwata, our members and supporters were again attacked, this time by unknown people clad in UPND regalia right at the Nomination Centre and in full view of Zambia Police officers. This caused our people to scamper in all directions and prevented the PeP candidate Mr. Henry Muleya from filing in his nomination at the allocated time. Our people had to regroup hours later and we were only able to file our nomination after hours due to the leniency and understanding of the Electoral Commission of Zambia.

4. It is our submission that these two blatant acts of violence by the ruling UPND against our party instilled fear in the people of Kabwata and prevented them from freely associating and supporting us, for fear of being targets of the UPND violence which appeared to be endorsed by the Zambia Police Force. This was especially given the fact that the Police failed to arrest the perpetrators of the first violent incident that took place on 28th December 2021, despite those people being clearly identified by their victims.

5. In the premises above, we refuse to accept defeat in the Kabwata Parliamentary by-election as it is our firm belief that had the UPND violence against us been absent, we would have been more attractive to associate with and support, in the eyes of the electorate of Kabwata Constituency. In this regard, it is our intention to petition the outcome of the Kabwata by-election in the courts of law. An election should be won by the most popular political party and not the most violent.

PF can’t stop losing

ZAMBIA’S loud former ruling party PF has lost the Kabwata Constituency parliamentary by-election to a UPND candidate, Andrew Tayengwa, who never “opened his mouth” to campaign.

Many were called but only Tayengwa, who was silent for most part of the campaign period, has been chosen by Kabwata Constituency residents, to replace UPND’s Levy Mkandawire who died in November last year.

From whichever angle one looks at this Kabwata by-election, it is a victory for President Hakainde Hichilema, who massively campaigned for his candidate, while blowing air kisses to the crowds and, at intervals, having selfies with ecstatic supporters.

Tayengwa polled 13, 574 votes, while in second position was Clement Tembo of the once-upon-a-time feared PF, with 11,192 votes.

Socialist Party candidate emerged in third position with 1,849 votes.

The other candidates got an insignificant number of votes such that mentioning the figures will simply be noise to the reader.

Actually, the total number of votes amassed by the other candidates can easily be calculated by a primary school pupil that has a mountain-high hatred for math.

With the 11,192 thousand votes given to Tembo, the PF rank and file, especially their sulky ‘champion’ speaker Given Lubinda, will maybe dust off the shame of losing and continue evangelising about the re-branding chatter.

If the re-branding fiction fails, the leaders of the PF should simply convince their supporters and turn the party into a cooperative and start giving loans to their Chombo cha Noah nshima twekkers.

It is worthy emphasising that Tayengwa has been more or less robotic in the campaigns but the UPND camp obviously cares less; the fact is that a robot candidate has beaten the ‘popular’ Tembo who stood on the toxic PF ticket, a party whose leadership is said to be Siamese twins with first-grade arrogance.

The main faces insofar campaigns for Tembo, were Chishimba Kambwili, Lubinda, and Raphael Nakacinda. Their arguable political eloquence has been flattened by President Hichilema’s mere walk-throughs in Kabwata.

This is Tembo’s second loss in his pursuit of the Kabwata seat; he first lost when he stood as an independent candidate in the 2016 general elections.

Hopefully, Tayengwa will be making constructive noise in Parliament, as Tembo and other losers lick their wounds.

For Henry Muleya, who stood on Sean Tembo’s Patriots for Economic Progress (PeP), he emulated his president and collected a good number of zeroes at some polling stations.

He came out in last position with a mere 30 votes, probably given to him by those who made a mistake at voting stage.

Where zeroes are concerned, Muleya was competing with Fred Mubanga of Harry Kalaba’s DP and Kennedy Musowa of the New Heritage Party.

Slightly over five months ago, Zambians, from Nakonde to Shangombo, Chadiza to Lukulu, Ikeleng’i to Luangwa, Chasefu to Sikongo, Kazungula to Chililabombwe, Chirundu to Kaputa, Siavonga to Mufulira, Mpulungu to Sesheke buried the mighty PF at the now swelling political cemetery.

It initially looked impossible but it was done by 2.8 million Zambians who voted for UPND’s presidential candidate, Hichilema, defeating PF’s Edgar Lungu with a record difference of a million votes.

With a loss in its erstwhile stronghold of Lusaka Province, one can conclude that the soul of the PF has started resting in peace at the detested political cemetery.

Good evening my dear friends! The story being circulated on social media originated by the Zambian Bulletin Online Media, cannot go without comment.

First and foremost, there were no thugs at my residence last night and there has never been any on any day.

Secondly it is true that my residence was besieged by hundreds of heavily armed police officers from midnight until 07:00hours. They were driving numerous police Landcruisers and mounting anti-riot tanks. They totally sealed the road leading to our residence. It was like a war zone!

One of the videos attached to the article, in which a voice of a known cadre from a known political party is interviewing one of the so-called thugs was taken at our construction site close to our residence. We were totally unaware of any people being there in the night except for security officers who man the place.

If indeed there were thugs at either our residence or at our construction site, would the police not have arrested them during the night? Would the police have waited for 06:00 hours as purported by the author of the Zambian Bulletin article?

For any reasonable person, it must be shocking to read that the police refused to arrest thugs who were to be dispatched to various polling stations where they were expected to cause confusion and, in the process, help the Patriotic Front (PF) to sneak in ballot papers on the basis that they would do so at 06:00 hours after getting a search warrant.

In one of the circulated videos, you can hear voices castigating police for not having taken action and thereby allowing the so-called thugs to jump over the fence. There was no reason for anyone to jump any fence because the site is not surrounded by a fence but there is a long stretch without a fence. In addition, some of the alleged thugs as seen in the second video that is attached to the article, are a number of youths some running and others walking. Clearly the video was taken after dawn.
One would ask why the police could not arrest the so-called thugs. My only conclusion is that the police did not have anyone to arrest and did not have any reason to arrest them.

The only truth is that we were besieged.

PF STILL INTACT – KAMPYONGO

THE entire PF Members of Parliament are in support of the interim top leadership led by Given Lubinda and there are no glitches at all, PF Chief Whip, Stephen Kampyongo has said.

And Mr Kampyongo said just like in a soccer team, rebranding of PF did not require to get rid of all the senior party members that were at the helm prior to the August 12 2021 General Elections.

In an interview, Mr Kampyongo said contrary to the perception created that the former ruling party’s MPs snubbed the meeting called by PF acting president Given Lubinda, those that did not attend were outside Lusaka while others were attending funerals of party members.

He explained that on that material day, Mandevu MP, Christopher Shakafuswa had a bereavement and the leader of the opposition, Brian Mundubile had a funeral in the family which several of the PF members went to attend.

“The MPs that did not attend rendered apologies because they were unable to attend at that short notice as some where in their constituencies outside Lusaka except those attending parliamentary committees, while others went to attend funerals and we accepted their apologies. But trying to create an impression that the members snubbed the meeting is wrong,” Mr Kampyongo said.

He said there was nothing wrong with Mr Lubinda and acting PF Secretary General Nickson Chilangwa express their displeasure for low turnout of MPs before knowing the reason.

Mr Kampyongo said the matter was resolved after he gave an explanation as the party Whip who was given instructions to invite all MPs.

“We have agreed that we shall schedule another meeting when parliament resumes because everyone will be available and it is easy that way,” he disclosed.

On Kantanshi MP, Dr Anthony Mumba’s remarks that rebranding in the PF would have no meaning if the same people who were at the helm prior to the August 12 2021 General are brought back, Mr Kampyongo said “rebranding doesn’t always mean completely getting rid of old players.”

He said some senior party members that were at the helm prior to the August 12 election were still useful just like old players in a soccer team.

Mr Kampyongo also said it was politically wrong for Dr Mumba to think that those who lost election should not be part of the central committee.

FORMER religious affairs minister Godfridah Sumaili has urged the UPND government to have some balance as they fight corruption, saying it’s not proper for them to only focus on activities which transpired many years ago.

And Sumaili has lamented that the church is too quiet when it is supposed to speak out on the current abuse of people in the country.

In an interview, Rev Sumaili said the UPND government had not done anything about the single sourced fertiliser which was procured at an exorbitant price.

“The fight against corruption has to be systematic. There has to be justice involved in this and there has to be balance. There has to be some consistency as you fight corruption. As a Christian nation, we are resolved to make sure that there is no corruption anywhere.

This government has to have justice in the way they fight it. I do not think that it is proper for them to be concentrating only on the allegations of corruption of many years ago when today people have raised issues on a number of things that have happened which are of suspicions,” she said.

“We are talking about the issue of fertiliser, what have they done about it. Fertiliser was single sourced at an exorbitant price. What has this government done about it? We want to see justice, balance and consistency. They have to be honest about corruption. Corruption is not only when you take something but even through your words you can corrupt the minds of people and cheat them.

They can be deceived in the way that you are communicating to the people. If you are speaking things that you know you shall not do, that is corruption. If you say mealie meal will be K50 but you know in your own heart that it is not possible. that is corruption. So we want to see consistency.”

Rev Sumaili said the church should rise and ensure that governance was founded on righteousness and justice.

“And to the church, I want to say that the church is mandated to ensure that there is social justice in the nation. They have to ensure that there is integrity in the way governance is done so they should have a voice. Let the church arise. The church is too quiet.

Things are happening, there is abuse of people, people are being arrested without being charged. They are being kept in cells without being charged but the church is quiet. The church also has to be consistent. They have the mandate to ensure that governance is founded on righteousness and justice,” said Rev Sumaili.

KASAMA DAO NARRATES HER ORDEAL IN COURT

Trial in the infamous case of assault, theft and criminal trespass involving suspected political cadres from the United Party for National Development, or UPND, today 3rd February 2022 finally commenced in the Kasama Magistrates Court, with the victim, Beauty Namukoko – who is Kasama District Administrative Officer, narrating her ordeal on what transpired on the fateful day.

The case commenced with a heavy presence of uniformed police officers keeping vigil of the Court premises and nearby areas in a bid to ensure that any form of disturbance like what was witnessed on Tuesday last week, was not repeated.

Narrating her ordeal, Beauty Namukoko, 53, told the Kasama Magistrates Court that on 21st January, 2022 at about 08:13 hours; whilst in her office and on a phone call, a group of men stormed her office and within a split of seconds, snatched the phone and started beating her up, the beating which included several punches and slaps, as she cried for help and begged the attackers to stop.

Ms. Namukolo adds that on the material day, the alleged attackers, who have since been identified as Andrew Sichimba, 27, Boniface Kaonga, 30, Nathan Phiri, 23 and Costen Kalimwengo, 24, walked away with her hand bag.

And Ms. Namukolo has further told Principal Resident Magistrate, Osward Chibalo who is presiding over the case, that three-days prior to her fateful day, the said attackers visited her office asking for youths empowerment forms and when she did not give them, explaining that the forms have errors requiring corrections, the overzealous group unleashed insults and threats on her life.

The Court has since adjourned this matter to 3rd March, 2022 for continuation of trial.

On Tuesday last week, trial in this matter could not start due to some supporters of the UPND being at the Court premises while clad in their political party regalia, a scenario which made the Court adjourn the matter.

Meanwhile, appearing for plea before Principal Resident Magistrate, Osward Chibalo, on Monday 24th January, 2022, the accused; Andrew Sichimba, 27 of Mukulumpe township, Boniface Kaonga, 30 of Musenga township, Nathan Phiri, 23 of Amini village and Costen Kalimwengo 24 of Winberg suburb, pleaded not guilty.

On 21st January 2022 and a few days that followed, a video went viral where visibly identifiable people, suspected to UPND political cadres, are captured mercilessly attacking the Kasama District Administrative Officer, or DAO, Beauty Namukoko.

Exactly 10 years ago, on 3 February 2012, the Patriotic Front (PF) government questioned former first lady Thandiwe Banda at the Zambia Police headquarters in Lusaka.

Mrs Banda is the wife of former president Rupiah Banda who had lost in the general elections held on 20 September 2011.

The Joint Government Investigation Team (JGIT) interrogated Mrs Banda in relation to the source of funding for the Mpundu Trust villas in lusaka.

An hour later, the JGIT conducted a search at Mrs Banda’s aunt’s house in Nyumba Yanga residential area in Lusaka.

Mrs Banda’s aunt is Ms Esnart Kapufi.

I was there as the search, which began at 10:00 hours and ended at 18:00 hours, was being conducted.

The chief government spokesperson at that time was Given Lubinda who is, currently, PF acting president in opposition.

Against the law, Lubinda had fired media heads at the Times of Zambia, Zambia Daily Mail and Zambia National Broadcasting Corporation (ZNBC).

At the Times of Zambia, managing director John Phiri was replaced with Godfrey Malama while Isaac Chipampe took over from Evans Milimo at the Zambia Daily Mail.

Other victims were Wallen Simwaka and Ndubi Mvula at the Zambia Daily Mail.

At ZNBC, Joe Chilaizya was appointed director-general, taking over from Eddie Mupeso.

Chilaizya, then, decided to fire Oswald Mutale, Inutu Himanje and Doris Mulenga, among others.

At the Times of Zambia, the PF government fired young junior reporters who included Bob Sianjalika, Patson Phiri, Obert Simwanza, Whitney Mulobela, Richard Mulonga and Abel Mboozi.

Weeks before that, the PF government had questioned, among other Movement for Multiparty Democracy officials, former Minister of Finance Situmbeko Musokotwane, former minister of Education Dora Siliya and former Mines minister Maxwell Mwale.

That was just under six months of the PF assuming power.

Another one who had been searched within four months of the PF in office was former vice-president Nevers Mumba.

Much earlier, former senior private secretary at State House, Robinson Nkonde, had also been questioned.

Three months later, former vice-president George Kunda was interrogated by the Drug Enforcement Commission.

Not only that.

Mr Kunda had undergone another ordeal.

Mr Kunda’s 84-year-old indisposed father, Njonamo Kunda and mother Eginala Mwelwa, were subjected to a harrowing experience of watching helplessly as a Zambia Police squad conducted a search in the wee hours of 10 February, 2012 at their farm in Serenje.

Kunda’s father had been recuperating from a stroke that had even led to his admission to the University Teaching Hospital when heavily-armed police officers raided the farm around 05:00 hours.

“It was very demeaning. The police officers searched everywhere, including where my parents sleep. The police were there until after 13:00 hours and, during that time, my parents never ate anything,” Mr Kunda would, later, tell me.

Today, Given Lubinda wants to tell the world that he and his friends are being harassed when only he and Bowman Lusambo have been questioned since the PF was voted out ín August 2021.

Doesn’t hé know that the Zambian people are upset at the slow pace of probing the PF criminal gang?

State Opposes Davies Mwila, Antonio Mwanza’s Civil Suit

THE state says the law suit commenced against it by former PF secretary general Davies Mwila over his interrogation by the DEC is an attempt to challenge the Commission’s statutory authority to conduct criminal investigations against members of public.

The office of the Attorney General says reliefs Mwila is seeking are aimed at curtailing the ongoing criminal investigations, which involve some members of the PF, through civil proceedings.

In this matter, Mwila has sued the state over the decision of the Drug Enforcement Commission to quiz him and Antonio Mwanza regarding the party’s source of funds during campaigns prior to the August 12, 2021 general elections.

Mwila, who has commenced the action on behalf of the party, wants damages for intimidation and harassment of PF members by the Drug Enforcement Commission (DEC).
He is seeking damages for discrimination, misrepresentation and defamation of character.

Mwila also wants the court to declare that the party cannot be compelled to disclose its source of income and that the same was not laundered.

However, the state has asked the court to determine whether Mwila’s action is an attempt to circumvent the DEC’s statutory authority to conduct criminal investigations relating to allegations of money laundering against members of the public through the use of civil proceedings.

According to a notice of motion to dismiss the action on a point of law sworn by Highton Chilela a DEC investigations officer in the anti-money laundering investigations unit, the state said criminal investigations were on-going.

Chilela said Mwila was in total disregard of the law and procedure by deliberately and wrongfully disclosing information that related to such investigations in the guise of civil proceedings.

“The plaintiff’s pleading cannot be sustained by this court as it is otherwise an abuse of court process.

I verily believe in the interest of justice and public policy to allow investigative authorities to carry out their statutory duties without being curtailed by frivolous civil proceedings such as the one before this court,” said Chilela.

GEARS Initiative shocked with K1m expenditure on ECZ new logo

The Electoral Commission of Zambia-ECZ- May have acted extravagantly on its expenditure of K1m on rebranding the new logo for the Commission.

GEARS initiative agrees with George Mpombo on his observation in Mast Newspapers that spending K1m on a new ECZ Logo by ECZ was toe-curling act.

However, Mr Mpombo’s argument that the K1m was have been on electoral law reform may not be accurate because it is not the ECZ that must push for the review of the electoral laws as suggested by Mr Mpombo but the Government and other stakeholders like CSOs or NGOs, political parties.

It is indeed toe-curling act for ECZ to rebrand its logo in an excess of K1m.

It is our considered view that rebranding a corporate logo must not even have been a priority for the Commission.

This expense is unbelievable for an institution that has failing to respect the provision of the law since 2016 on account of limited funding.

Provisions of the law which the ECZ has disrespected on a claim of having no money include, section 7 of the electoral process Act on registration of voters on a continuous basis and Article 229 of the Constitution on decentalising the operations of the Commission to provinces and progressively to districts.

Currently, ECZ borrows poll staff from ministries of Education and Local Government respectively, most of them have questionable loyalty to the Commission but their parent miniseries.

The hired poll staff usually getting excited to work with ECZ for an extra allowances and exposed to political interference especially at recruitment stage.

It is clear that the reasons for not embarking on the decentalising its operation to provinces and failure to undertake continuous voter registration exercises are not limited funding now but limited political and institution will.

This is a misplaced priority by the ECZ the institution has undertaken as a public body.

Wouldn’t K1m enough to create offices in the 10 or at least 6 provinces of this country to easy its operations and avoid hiring govermemt workers to do its job?

Or wouldn’t it be enough to reopen the closed officepoints and make them permanent offices in Lusaka and the Copperbelt for the continuous registration of voters to show some commitment on the demands of the law for continuous registration of voters ahead of the 2026 General Election?

Spending K1m public money on rebranding a corporate logo and justifying it is being insensitive and an unaccountable to the public demands for efficient, prudent and accountable use of public funds for quality electoral service delivery.

Who complained against the previous corporate logo for the Commission to prioritise its change so quickly after the general election for it to attract an expenditure of K1m for a new logo?

Are there no priority areas and complaints on ECZ operations lodged to the Commission which it has not acted on due to the claim of limited resources or poor funding?

Is it that now the Commission is well funded to an extent of being such an extravagant spending agency of government with a hopping K1m for a new logo?

The public expect better use of public resources than this surely. Only for a new logo whose impact on the electoral process is nil to gobble K1m?.

Government must help its institutions to avoid such acts in future where possible so that they are not wasteful because the K1m the Commission has spent on the new logo is a clear act of wastefullness of public funds.

It is a disgusting expenditure truly speaking.

This kind of exaggerated expenses is what makes the electoral process dummy expensive in Africa and Zambia in particular.

No wonder as a country we still take pleasure to print ballot papers in most expensive places like the United Arab Emirates (Dubai) with excitement deliberately refusing to do it locally.

We must come down to our level of economic development for us to do the right things and compete with equals not with unequals.

‘He Didn’t Learn Anything From Professional Football’ – Egypt Coach Unhappy With Eto’o’s ‘War’ Comments

Egypt coach Carlos Queiroz is unhappy with former Cameroon striker Samuel Eto’o’s comments that compared the Africa Cup of Nations semi-final between the two countries to a war.

A video published on the official Cameroon Football Federation (Fecafoot) Facebook page shows a speech by Eto’o, who is now its president, where he uses the word ‘war’ more than once when referring to the game.

The former Barcelona striker, 40, was talking in the Cameroon dressing room shortly after the quarter-final win over The Gambia, but his choice of words has not gone down well with Queiroz.

“It’s a very unfortunate comment, a very bad approach, a very bad message to the people of Cameroon,” the 68-year-old said.

“To make this declaration of war before one game [shows he] didn’t learn anything when he was in professional football.

“Football is not about war. Football is about celebration, it’s about joy, it’s about happiness.”

Alluding to the fatal crush at the Olembe Stadium which killed eight people on Monday, 24 January, Quieroz added: “He forgot that people died at the stadium [a few] days ago.”

Egypt face the Indomitable Lions on Thursday (19:00 GMT).

Afcon ‘should create honour and dignity’

The comments from Eto’o, who was elected Fecafoot president in December, come as Cameroon’s south-west region continues to be affected by armed conflict.

Since 2017 local militants have pursued a separatist agenda, hoping to form a breakaway state called Ambazonia, and more than a million people have been forced to flee their homes.

Queiroz, who has managed Real Madrid, Portugal and Iran as well as an as assistant manager to former Manchester United boss Sir Alex Ferguson, says he and his team have their own answer to the comments.

“To the war that was proposed by Mr Eto’o – we are going to answer with the best football, the best attitude, the best quality because this what the people expect from us,” Queiroz insisted.

“This is what the world wants – the Africa Cup of Nations to create honour, dignity – it cannot be a war – give me a break.

“I think it is something I will leave to Caf [the Confederation of African Football] because one comment like this deserves a red card.”

Former international Samuel Eto’o is now the president of the Cameroon Football Federation
Queiroz called on Eto’o to retract his use of the word war.

“I am making an appeal to Mr Eto’o, who played professional football, to correct his words because this cannot be a war,” he continued.

“Football is a celebration, it’s happiness and we have the honour to put the hands together with Cameroon and produce a fantastic football show – that’s our job.”

In the same interview Queiroz criticised some section of the Egyptian media for trying to undermine the squad and insisted that his team are united despite what he called “too many rumours and lies”.

He went on to say his team were playing for the Egyptian fans and they should “not be used by the media”.

A fine and a rejection

Meanwhile, the Egypt Football Association has been fined $100,000 by Caf for breaching media protocols and directives.

The sanction was imposed after Egypt failed to appear for a press conference on 29 January to preview their quarter-final tie against Morocco.

Half of the fine has been suspended, provided the Pharaohs are not found guilty of a similar breach at this year’s Nations Cup.

Caf has also rejected a request from the EFA that Gambian referee Bakary Gassama should not be in charge of their semi-final game against Cameroon.

The EFA had not elaborated on why it was unhappy with his appointment but Caf has confirmed he will take charge of the match.

“The committee will choose its best referees to play big games. Just like the team will play with their best players,” a Caf source told BBC Sport Africa.

“The referees committee is an independent body who decides. We remain focused to deliver a good performance.”

THE battle is on, the people of Kabwata in Lusaka are exercising their right to vote to choose a new Member of Parliament after the death of Levy Mkandawire of UPND.

They should count themselves lucky and blessed because they will be the first ones to cast votes under the one million Kwacha Electoral Commission of Zambia (ECZ) new logo.

Kabwata constituency has 108, 729 registered voters, one of the highly populated areas in Lusaka, housing Chilenje, where there is the famous maploto as well as the Kenneth Kaunda’s historical residence, Chalala, Jack Compound (once MMD’s infested Ghetto) Libala, Kamwala – second class trading area and the mighty Kabwata township, known for bars and prostitution.

It has five wards namely Chilenje with 40 polling stations, Kabwata 18, Libala 22, Kamwala 27 and Kamulanga 24.

Much of Kabwata Constituency has middle class citizens, a combination of employees and business people. It is not short of bars and lodges, which we can conclude that it’s one of the major businesses.

Nine candidates are battling it out.These are Clement Tembo of the immediate past ruling party, once the mighty PF, Tripher Ngandu of Socialist Party, and Andrew Tayengwa of the ruling UPND.

The Self proclaimed public lawyer and the man who imported a wife and boasts of having the best moment of his life as a married man with his slogan, “families must come first” Chilufya Tayali of EEP has also weighed in with hopes of scooping the seat.

Others in Kabwata battle are Little known Henry Muleya of PEP, Sydney Zyambo of PAC, Self rule party and the only female candidate in the race Myzece Engiwe of UNIP, the first ruling party after Zambia got it’s independence under the leadership of the late Kenneth Kaunda and Fred Mubanga of DP which is embroiled in comfusion and political turmoil.

All the candidates have expressed hope of scooping the seat which has been vacant since November last year.

Initially, the by election was supposed to take place on 20 January 2022, but was postponed after a UPP candidate Francis Libunda withdrew after filing his nomination, much to the annoyance of stakeholders and opponents.

Political analysts say the battle is among PF, UPND and Socialist Party and maybe Chilufya Tayali of EEF.

Generally, campaigns to the run up to the by election have been peaceful, despite a few reports of violence. The notable one is the one made by Socialist Party Leader, Fred M’membe who wrote to ECZ alleging that his supporters were attacked in Jack Compound.

Kabwata still have challanges of garbage collection, water, unemployment and poor roads is some townships.

The new MP should look into these issues as promised during campaigns.

Let the best candidate win.

And this behaviour of theirs is well explained in Matthew 23:1-12.
“Why don’t you practice what you preach?” Have you ever said those words? Maybe someone has said them to you. Hypocrites are people who pretend to be something they are not. They may say one thing and then do the opposite. They may act one way in a certain setting and then act another way in a different setting. It is very important that as Christians, we follow the example of Jesus Christ. It doesn’t matter where we are or who we are with. The words we speak and the things we do should always reflect our faith. Sometimes we are good at telling other people what they should do and how they should live, but we fail to follow our own instructions. We need to, as the saying goes, “walk the walk, not just talk the talk.”

In Matthew 23, Jesus tells the crowds and his disciples to do what the Pharisees and the scribes teach them to do, “but do not do as they do, for they do not practice what they teach” (Matthew 23:3). In other words, the leaders talk the talk, but they don’t walk the walk. Why is it important to practice what we preach? The most basic reason is the integrity of our faith.

In Matthew 5:14, Jesus tells us, “You are the light of the world. A city built on a hill cannot be hid.” People should be attracted by the light of the way we live and the words we speak. Whether we like it or not, people are watching us and seeing how we respond to the ups and downs of everyday life.

What evidence do we offer of our profession of faith? Are our responses any different from those of persons who don’t profess to know Christ? How do we practice what we preach? One way is to be careful about the words we speak. You can tell a lot about a person by the words they use. James tells us the tongue is very dangerous. It can set a great forest ablaze. We can tame all kinds of animals, but we cannot tame the tongue (James 3:3-6).

People are listening to the words we speak. The words we speak should match the person we claim to be. What you see is what you get. Political ideas are worthless if they aren’t inspired by noble, selfless sentiments. Likewise, noble sentiments are worthless if they are not based on correct, fair ideas.

What is relevant to this discussion is that Rasputin wormed his way into the household of Tsar Nicholas II by promising, largely via Tsarina Alexandra, that he could cure their sick son of hemophilia.

He proceeded to use his new position to attract to himself many dubious benefits, resulting in many believing that he had the Russian royal court spellbound by some special powers.

The amount of press that Alfa Commodities owner Maurice Jangulo is getting, and the government’s failure to explain why he was given a fertiliser contract worth $50 million and paid immediately, without open tender, is beginning to suggest he has a strange hold on the New Dawn government, especially as regards his near mythical qualifications as Zambia’s fertiliser supremo now seemingly destined to hog the lucrative government fertiliser supply contracts space.

Like Rasputin promised Tsar Nicholas II and Tsarina Alexandra a cure for their son, Jangulo is reported to have assured President Hakainde Hichilema and the Ministry of Agriculture that he had capacity to end the immediate fertiliser supply problems plaguing Southern Province, and thereafter ensure steady, efficient supply countrywide.

To kick off his fertiliser supply coup, it is understood he “recommended” the single sourcing of a private company, known as MVC Consultants, to conduct a forensic audit of the government fertiliser supply contracts of the past decade, and especially the last contracts given by the previous government, zeroing in on the Fertiliser Support Programme for 2021/2022 season.

So far there the government has given no credible information to prove there was a transparent process to engage this firm to do the audit.

But there is a letter by Ministry of Agriculture Permanent Secretary Green Mbozi to all Provincial Agricultural Coordinators to give MVC Consultants unfettered access to the data they sought.

‘’…This serves to inform you that the Ministry has engaged MVC Consultants to help with monitoring of the Farmer Input Support Programme (FISP) programme implementation for the 2021/2022 season.

The consultants are currently in the field in all provinces following up the implementation of FISP. You are all being urged to support the consultants’ activities as they carry out their work.

This is the audit that Socialist Party President Fred M’membe said was manipulated by Jangulo to point accusing fingers at all the other major fertiliser suppliers of greater capacity than his own Alfa Commodities.

That some of them were found not to have completed delivery of their consignments was used to “blacklist” all of them, including those that had delivered on their contracts, and still have not been paid in full for their work.

By this hatchet job Jangulo is said to be angling to position himself to be installed as the chief fertiliser supplier to the government, despite the miniscule capacity of his company Alfa Commodities.

Testimony of this is the fact that Alfa Commoditoes has struggled to supply the 37, 000 tonnes contracted for Southern PRovince, and resorted to buying the commodity from some of the same “discredited” competitors.

Some of this fertiliser supplied by Alfa Commodities has been found to be substandard and underweight.

M’membe and others have asked the government to explain this matter but the Ministry of Agriculture has remained silent.

Part if the explanation sought is why Alfa Commoddities has been allowed to supply fertiliser to the government at $1,407 while the competitors the audit sought to discredit supplied at $1,000.

The failure of government to explain these facts has now led to speculation that Jangulo is now the power in the Ministry of Agriculture, and is running the fertiliser power axis running from Alfa Commodities, Permanent Secretary Mbozi (said to have also been recommended by Jangulo) and State House.

The sooner the government comes out with credible explanations about this contract, the better for all concerned.

Otherwise speculation and innuendo regarding the power of Jangulo will continue to grow, much like Rasputin in the Russian royal court.

Because of his constant presence in the royal court, whispers grew that Rasputin was acting as a puppet master over the royal couple, wielding great power as an adviser, helping in appointing his own church ministers and other public officials.

If Jangulo and Mbozi both once worked together in high profile agribusiness operations would you blame those suggesting that the former recommended to latter for his current job, which is critical in processing the much sought after fertiliser contracts?

A minor point in this saga may be the actual timing of the signing of the contract between the government and Alfa Commodities, a point being canvassed to give the New Dawn government a minor escape route.

But this would be minor indeed, considering that in the only explanation Minister of Agriculture has given thus far, he stated categorically that the government decided to give a contract to Alfa to supply 37,000 tonnes.

Rasputin’s behavior and influence came to symbolize everything negative in Russian politics and society at the time.

Just like Rasputin, Jangulo, much like Kaizar Zulu in the Patriotic Front government, is emerging as a symbol of the kind of dealings that give Zambian governments a negative portrayal and a bad name.

Much like the tale of his murder, the aftermath of Rasputin’s death has been mythologized over the years.

According to legend, after Rasputin’s poisoned and shot body was thrown into the ice-cold river, he was fished out by a group of passersby, who found that he was still alive when they dragged his body to the shore of the river.

However, the truth is that after Rasputin’s already deceased corpse was thrown into the Malaya Nevka River, it took days for the police to find the body because the water had already frozen in the sub-zero Russian winter.

Jangulo too, is coming back from some kind of business death or failure. He was at the helm of what should have become Africa’s largest fertiliser supply company called Nyiombo.

Details of the plunder of that firm, the birth of Zambezi Airlines, and the eventual demise of both, is one whose facts are the subject of a different discussion.

I HAVE been dealing with a delicate situation of galvanising members of parliament, says Patriotic Front parliamentary whip Stephen Kampyongo.

“Yes, we could have our shortcomings but we will stand despite what we are going through. It is disturbing to be invited to go for investigations,” says Kampyongo.

The Shiwang’andu PF member of parliament was commenting, in an interview, over PF acting secretary general Nickson Chilangwa’s complaint that most party MPs’ support is pathetic.

“I have been dealing with a delicate situation. I have members who have been sent out of parliament. Nine of them. We have got those with election petition appeal cases whose predicament they don’t know,” Kampyongo said.

“It wouldn’t be fair to head count in terms of those who were not present. There could be one or two who deliberately missed.”

He said members of the party were appreciative of the party’s efforts in bailing out their legal fees.

“I am certainly happy with the support. We are working for the party under difficult circumstances because getting lawyers to represent you cannot be underrated,” Kampyongo said.

“I can tell you people like hon (Brian) Mundubile (Mporokoso member of parliament) has got a bereavement. Hon (Christopher) Shakafuswa (Mandevu member of parliament) has also got bereavement. So we allowed a few members to go and be with these. We won’t betray Zambians. Yes, we could have our shortcomings but we will stand despite what we are going through. It is disturbing to be invited to go for investigations. Some of my colleagues have been visited in their homes, with different homes, different call outs and searches.”

And Kampyongo, a former home affairs minister, said he would ensure he schedules another meeting with opposition alliance partners where all members of parliament would be present.

“You can understand the [acting] president’s [Given Lubinda] frustration. He wanted all the members of parliament present. I am whip and responsible for all the PF MPs and that is why I was responding like that,” he said.

“It’s understandable because you don’t always expect people to baby-sit you. The Veep [Lubinda] has been in the opposition for over 10 years and in government for 10 years. So you can’t take away his experience. He was with King Cobra [late Michael Sata] in the opposition. He has been MP in a cosmopolitan constituency [Kabwata] for 20 years. We are just MPs in the third term. It’s very rare that you get like that. A constituency like Kabwata is not like a village constituency where people can flow with you. So when he is talking like that, you know what he is going through.”

On Sunday, Lubinda and Chilangwa expressed anger after several MPs shunned a meeting held with the party’s alliance partners.

A visibly annoyed Lubinda said: “Hon chief whip pretence will not take us anywhere. The fact that the chief whip called all members of the party to come means all of them should have been here.”

“To show people out there that all MPs, MCCs (members of the central committee) are here will be lying to yourselves. I know you don’t want to be embarrassed as MPs. I know that but the truth of the matter is you are not here. All the 60 MPs would have been here. Those of you who are here, sorry for being the ones who are receiving my harsh voice,” said Lubinda.

“It is meant for those who are not here. To smokescreen and tell the world that all the 60 are here when they are only 15 of you is also not right. Had I my way I would have said those who are not here, your names be exposed. You are first a member of the party before being MP.”

For his part, Chilangwa said the support that the party was receiving from members of parliament was pathetic.

“I should hasten to say I am very disappointed the number of members of parliament here today does not represent PF. This is the reason why we are having challenges as a party. The last 48 hours, me and Hon Lubinda, Hon [Brian] Mundubile have been working to try and liquidate the dues that we owe the lawyers for all your cases and what kind of support are we getting from you, hon members of parliament? You can’t tell,” Chilangwa said.

“Yesterday [Saturday], we finished after 22:00 hours. The other day [up in arms. They are saying, ‘if we don’t pay, we shall sue individual members of parliament’. We don’t want a situation where each member of parliament is being sued individually. We are doing a lot for our party every day to ensure that we look for resources so that you can do your work without too much problems. But the kind of support that we are getting from members of parliament is pathetic.”

Chilangwa said he was aware that some members of parliament were not in their constituencies.

Lusaka: 02. 02.2022 – ZDA Applauds United Capital Fertilizer Zambia Limited for Actualising Pledged Investment.

The Zambia Development Agency (ZDA) is elated with the speed at which United Capital Fertilizer Zambia Limited which is part of the Wonderful Group of Companies is moving at in constructing the Fertilizer Plant.

The company acquired an Investment Certificate from the ZDA in the last quarter of the year 2021 for the construction of a Fertilizer Plant at a projected cost of USD 308 million and already they have hit the ground running in constructing the Plant.

Speaking during a familiarization tour of the construction works, ZDA Acting Director General Albert Halwampa said the Agency is happy with the progress and that it will continue to support the project till its fruition.

Mr. Halwampa said the Agency is also pleased that the company is not only looking at servicing the local market but is also looking at the export market which will increase the country’s foreign exchange reserves.

“We want to make sure together we create wealth and employment for the people of Zambia,” he stated.

Mr. Halwampa noted that the Agency does not want to see the project fail as everybody was waiting for the commissioning of the project.

The ZDA chief added that what makes the project more appealing is the fact that it is environmentally friendly without carbon emissions and makes it eligible for the Green Fund.

Meanwhile, United Capital Fertilizer Company Limited Board Member Roy Mwamba said the company is way ahead of the planned schedule.

Mr. Mwamba said the test operations of the plant are expected to start in June this year adding that the plant is scheduled for an official launch in July this same year.

He revealed that the company intends to manufacture fertilizers that are customized to cater for the specific needs of the soils in the three agro-ecological regions of the country.

He stated that currently, the company has created 450 jobs for local Zambians and will need an additional 150 workers by March this year.

The Plant whose capacity is about 300, 000 metric tons per annum is expected to reduce the cost of fertilizer on the local market as the key raw materials in the production process will be sourced locally.

It is hoped that the reduced cost will ensure that local farmers are able to easily access affordable agricultural inputs.

The ground-breaking ceremony of the United Capital Fertilizer Zambia Company Limited was graced by the Republican Vice President Mutale Nalumango in November 2021.

How careless can one receive proceeds of crime through Zambian account – Lubinda

GIVEN Lubinda signed an MOU with a Chinese entity at the time he was minister of agriculture, then days later $50,000 was wired to his account by the same entity, a source has revealed.

The source warned the acting PF president, Lubinda, against misleading the nation and his
supporters with claims that his company got a loan from another company.

But Lubinda said, “The money that is being spoken about was actually transferred to my account in 2018. I became minister of justice in 2016 as you remember. How careless can one be to receive proceeds of crime through an
account in Zambia?”

On Monday upon being warned and cautioned by the Anti-Corruption Commission on allegations of corruption, Lubinda said he was surprised that the entire State machinery was investigating him on a matter his company borrowed money from another company.

“I wonder when it became an offence for a director of a company to borrow money from another company. I wonder when this became a
corrupt matter. I was thinking that they will tell me whether when I was minister of agriculture I may have sold fertiliser which was for the State or that I awarded a contract dubiously.

They invite me here to come and tell me that ‘in 2016 you entered into a loan agreement with a Chinese company and that Chinese company gave you a loan’. I am yet to go to court to go and hear when obtaining a loan became an offence,” said Lubinda.

“The one thing I would like to say and say it very clearly is that the investigating officer said to me that ‘I have instructions that this matter must end. I have to go to my supervisors’. We know why institutions, investigative wings, of government were transferred from being independent to be put at State House. We know. So we know that the supervisor is no other than the occupant at State House [the President].”

But a source close to the matter clarified that Lubinda, as agriculture minister signed an memorandum of understanding with
a Chinese entity to enhance agriculture development in Zambia and a few days later “this same Chinese body ‘lent’ him money”.
“What sort of loan is that? He signed an MoU as minister of agriculture on behalf of government and a few days later they wired him $50k [US $50,000] but now he claims it was a loan,” wondered the source.

When contacted over the revelations that he
received a bribe, Lubinda said there will be a lot of fiction and a lot of stories created to try and dent the image of the members of PF.

“When the Anti-Corruption Commission tried to do an indictment, in their indictment they will not mention anything with me signing any
kind of MoU or if I had any transaction to do with the government of Zambia,” he said.

“The documents that Anti-Corruption Commission showed me yesterday (Monday), the documents which they showed my legal team yesterday are in respect of a loan agreement between my company and a Chinese company. So whoever is spreading that information that an MoU was entered into as minister of agriculture must check their facts.”

Lubinda said the issues being talked about are transactions that occurred when he was no longer minister of agriculture but was at Ministry of Justice.
“I would just like to allay the fears of citizens about all these innuendos and I know that all those pursuing me and all people in PF will not stop at anything. They will continue to bring whatever issues just to create an impression. Obviously all those that want to see the
downfall of PF were shocked when I revealed the way I was called by ACC and think of it, if it was something to do with an MoU between the
Zambian government through the Ministry of Agriculture why would my daughter be called?” he asked.

“What did my daughter have to do with it? My daughter is being brought into this because the matter these people are bringing up are to do with family property and that property is
our company?”

Lubinda added that there is no relationship between the rumour that is being created and the reason he was called by the ACC.

He said those who want to create an impression that there was wrongdoing would try to add to the narrative.

“The money that is being spoken about was actually transferred to my account in 2018. I became minister of justice in 2016 as you remember. How careless can one be to receive proceeds of crime through an
account in Zambia? I would have preferred the money is sent to me through an off show account isn’t it, like all criminals do?” said Lubinda.

The Absurd Decision To Allow Mining In The Lower Zambezi National Park Can Lead To A War With Zimbabwe

…as the Lower Zambezi National Park has a transboundary impact on the lucrative Mano Pools of Zimbabwe.

Government says the open pit mining project in the Lower Zambezi National Park will go ahead but under strict adherence to measures set by the Zambia Environmental Management Agency (ZEMA) to limit damage to the environment to a minimum.

As the Green Party, we know for a fact that ZEMA lacks capacity to limit damage to a sensitive ecosystem like a park. If ZEMA has failed to limit damage of lead poisoning in Kabwe; the devastating sulphur dioxide emissions in Kankoyo; and the massive environmental to the Kafue riverine system by KCM, to name but a few cases, how the hell can they manage to limit damage to a transboundary ecosytem like the Lower Zambezi National Park?

The argument advanced by the Green Economy and Environment Minister Collins Nzovu that the whole redress process is exhausted since the courts dismissed an appeal by CSOs to stop the proposed large scale open-pit mine for want of prosecution, is hollow.

A Government that has committed itself to green economy can not surrender its mundane duty and responsibility to protect the environment on the ground that civil society action was defeated for want of prosecution. That is an absurdity.

Furthermore, the position of government on the matter is not only hollow and absurd but also contradictory. On one hand, government claims it is ONLY left with the option of monitoring the situation to ensure the developer operates within strict conditions.

On the other hand, it claims it will take the necessary decision if its detailed report shows that the mine has failed to adhere to provisions of ZEMA’s decision letter, and if the risk of environmental degradation becomes high and further that, strict and adequate conditions are already in place but only lacked enforcement by the previous regime.

If there is no option to stop the project now, how come there is an option to stop it after destruction has been occassioned? What this contradictory position entails is that UPND lacks an understanding of green economy principles, one of which is the precautionary principle.

Furthermore, this is proof UPND government lacks an understanding of the international implications of the project. The Lower Zambezi Park has transboundary impacts on Mano Pools in Zimbabwe. The Mano Pools are a very lucrative economic and environmental asset of Zimbabwe. One thing for sure is that Zimbabwe will react aggressively because the project will harm their economy and environment. Allowing the project is therefore a reckless decision that can lead to a war with Zimbabwe. Lets avoid stalking a war on a hopeless short term project like this one.

If really it is the copper we need to mine, let’s focus on resolving, with concerted efforts, the issues surrounding Mopani, KCM, Chambishi Metals, Chibuluma and other mines on the Copperbelt.

Finally, Government needs to be reminded of the resolve of international conservationists on this project. They have made it very clear that should this project be allowed, they will lobby across the world to boycott Zambia as a tourist destination. If this is done, Zambia stands to lose in a big way because revenue from tourism by far exceeds revenue expected from the project. In any case, the project benefits are short-lived. Tourism is forever.

We therefore urge government to rescind this absurd and dangerous decision.

The president of Guinea-Bissau has said he survived a coup attempt after being under heavy gunfire for five hours.

Umaro Cissoko Embaló said the attackers tried to kill him and his entire cabinet at the government palace.

He said many others had been killed in the fighting on both sides, but that he did not know exact numbers as he had been trapped “between fire and iron”.

The attackers were linked to drug trafficking in the country, he said, without providing further details.

Gunfire erupted near government buildings on Tuesday in the capital of the West African nation, where the president was attending a cabinet meeting.

A security source, who did not want to be identified, told the BBC that gunmen in civilian clothes had opened fire and a police officer had been killed. Some initial reports also said that the cabinet had been captured.

Mr Embaló, however, said the attackers failed to break into the cabinet meeting.

“What I can guarantee is that the situation is under control,” he said.

One of the poorest countries in the world, the former Portuguese colony has seen nine coups or attempted coups since 1980.

Struggling with a massive foreign debt and an economy that relies heavily on foreign aid, the country has also become a transit point for Latin American drugs, leading it to be dubbed by some as Africa’s first narco-state.

Mr Embaló said the attackers were an isolated group, and that they were linked to drugs in the country.

“When I was elected president of the republic, I promised to [fight] two things: corruption and drug trafficking. And this is also linked to that, and I knew what the price was, but the fight continues,” he said.

West African regional leaders described the incident as a coup attempt and urged troops to return to barracks.

THE support we are getting from members of Parliament is pathetic, says PF acting secretary general Nixon Chilangwa.

Speaking during a meeting with the former ruling party ‘alliance partners’ on Sunday, Chilangwa who was flanked by party acting president Given Lubinda said response and contribution of members of parliament was very disappointing.

“I should also hasten to say I am very disappointed the number of members of parliament here today does not represent PF. This is the reason why we are having challenges as a party. The last 48 hours, me and Hon Lubinda, Hon [Brian] Mundubile have been working to try and liquidate the dues that we owe the lawyers for all your cases and what kind of support are we getting from you, hon members of parliament? He said it was disappointing that those MPs were not present to campaign for the party in the Kabwata Constituency by-election.

“You know that 80 per cent of members of parliament are in Lusaka. They are right here in Lusaka, but they are not here. They are not in Kabwata. They are not in their wards,” he said before he realised that his party media team was broadcasting the programme live. “Are you broadcasting? Anyway truth be told. Members of parliament are not doing what they are supposed to be doing. And it’s totally unacceptable. So that was not meant for broadcasting.”

And alliance partner Saboi Imboela said there was need for a strong PF. “We need a strong PF. I am sure everybody in the country and those that voted for them [UPND] can see now that what they promised, so many things. It is clear each and every day that they are unable to fulfil those promises. But if there is no alternative it’s going to be difficult for people to make a decision in 2026,” said Imboela of the Chishimba Kambwili NDC faction.

“It’s unheard of that you don’t have a member of parliament in 2021 and form government in 2026 – just over a period of five years. The PF have 60 MPs. That is not a joke. So all of us are relying on you. Stay united and stay strong. Do the right thing. You are carrying all of us as opposition.”

Christian Coalition president Dan Pule said: “We stood with you when you were in government. We are standing with you. Make no mistake, the 2026 elections will be more fierce. You remember how UNIP preserved some seats in Northern Zambia and Eastern Zambia and the following election, they lost virtually all of them. So let us remain united and focused.”

“President HH (Hakainde Hichilema) is a weak President to defeat,” said Pule who sponsored the petition before the Constitutional Court that allowed Edgar Lungu contest presidential polls for a third time.

And Citizens Democratic Party leader Robert Mwanza said it was disappointing to note the poor attendance of MPs at the meeting.

“What happens between now and convention and going forward will determine where PF is going. If things are being handled in this manner, we will have a problem in 2026. The ball is in your court,” noted Mwanza said. “If you are disintegrated tough luck.”

Zambian Republican Party president Wright Musoma said PF would rise again.

“PF failed last year in August but PF is a champion. And those thinking otherwise are mistaken,” said Musoma. “What is important is just to undo the tag that has been thrown at you…records are meant to be broken.”

And New Congress Party leader Peter Chanda said the PF should win the Kabwata by-election at all costs.

“This will send a message to the UPND. The battle is still between the UPND and Patriotic Front. The battle is not over,” said Chanda.-The Mast

CHIEFS in Muchinga Province are furious that their attempts to meet with President Hakainde Hichilema have been repeatedly blocked.

Council of chiefs chairperson, Chief Katyetye has heaped the blame on presidential handlers, whom he said, were blocking his group.

Chief Katyetye said President Hichilema’s handlers will be the source of his downfall if he does not act now.

Chief Katyetye said the President should be careful with his aides who are leading the cartel of those blocking chiefs and other stakeholders wanting to see him.

The chief lamented that there were a lot of issues that the traditional leaders in the province would want to bring to the attention of the President but were being blocked

“We are very worried as traditional leaders in Muchinga with the manner, people surrounding the President are behaving. Why should they make the President we were talking to almost every day while in opposition, be inaccessible to chiefs,” he said.

Chief Katyetye cited plans by some corrupt individuals at the Ministry of Mines to hand over Nkombwa Mine to an investor as compensation for some unfinished business, as one of the burning issues he would like to discuss with President Hichilema.

He said it was unfortunate that the Ministry of Mines would want to give away Nkombwa Hills Mines to an investor without the knowledge of the traditional leadership.

Chief Katyetye has advised the Presidential handlers to open up the Presidency and make it accessible not only to party cadres but traditional leaders who have matters to bring to the attention of the Head of State.

He warned that current happenings at State House where aides were blocking people from accessing the President is a time bomb and a recipe for corruption.

“The situation of blocking people from seeing the President is a time bomb and a recipe for corruption because, some individuals may want to corrupt the aides to see the President,” Chief Katyetye warned.

LUSAKA, Feb 1 (Reuters) – Zambia expects an International Monetary Fund (IMF) debt health check to be finalised this month, to strike a restructuring deal with creditors by April and get a formal agreement with the fund signed off in May, its finance minister said.

“I have to be optimistic, because in the absence of optimism where can Zambia go?” Situmbeko Musokotwane told Reuters in an interview on Tuesday. “We are a serious group determined to make sure that this issue of debt that’s been dogging us for years and years, we are determined to put this behind us.”

In 2020, Zambia became the first pandemic-era sovereign default and it is buckling under a debt burden of more than 120% of gross domestic product (GDP). It reached a staff level deal on a $1.4 billion three-year extended credit facility with the IMF in December and now wants to nail down a formal agreement.

Sketching an ambitious timeline for the restructuring the debt of Africa’s biggest copper producer, Musokotwane said he expected the IMF’s debt sustainability analysis, which forms the basis of the restructuring plans, by the end of February.

Having to renegotiate its debt with a multitude of official and private sector creditors, Musokotwane said he hoped to reach an understanding with them in March or maybe April, which would in turn would pave the way for a formal IMF agreement.

“We’re hoping that we can do this by May of this year,” he told Reuters.

Analysts say the timeline is ambitious as the group of Paris Club creditors and China have yet to form a creditor committee.

China, which has lent heavily to African resource exporters in recent decades, will play a key role in the debt overhaul. Zambia owes more than $6 billion, or 40% of its total publicly guaranteed and non-guaranteed external debt, to Chinese lenders.

“We have reached out to the Chinese authorities asking them to be part of this process. In principle they have agreed, on the specifics those are details to be worked out,” Musokotwane said. “In the end, I feel very confident that the Chinese authorities and the Chinese institutions that lent us money will play along to get us out of the problems.”

‘CARRY SOCIETY ALONG’

Musokotwane announced in December that Zambia had agreed with the IMF to remove unsustainable subsidies on energy and agriculture as part of its reform programme.

“The petroleum sector was in a sense not making sense anymore,” he said, adding that the cost of fuel subsidies alone used to amount to $800 million a year.

Savings from the ending of subsidies would shift to social spending, including education, something also advocated by the IMF, but no timeline has been set for phasing out support.

“You must not be too fast. You must carry society along with you, because these are shocks that we are introducing to society before they actually see the benefits of what we are doing,” Musokotwane said.

High global copper prices, meanwhile, should help attract the investment needed to allow Zambia to boost its annual production to about 3 million tonnes over the coming decade from an estimated 800,000 tonnes in 2021.

First, however, the government must find an investor to take a minority stake in Mopani Copper Mines and fund a planned expansion, Musokotwane said.

State-owned mining investment firm ZCCM-IH (ZCCM.LZ) bought Mopani from Glencore (GLEN.L) a year ago.

The government is also seeking to end a dispute over Konkola Copper Mines (KCM).

Zambia’s previous government handed control of KCM to a provisional liquidator in May 2019, triggering a legal battle with India’s Vedanta Resources (VDAN.NS), KCM’s parent.

“There is a lot that is going on behind the scenes. I cannot go into details of those, because the negotiations are very delicate. But I can assure you that it is happening.”

Investigative wings after Edgar Lungu- Given Lubinda

WE all know that the investigative wings are after former President Edgar Chagwa Lungu and that they are targeting all those people who are close to him, acting PF vice president Given Lubinda has said.

Mr Lubinda said this when he reported at the Anti-Corruption Commission offices in Lusaka yesterday after being summoned with his daughter.

He said that it was clear that they were indirectly going after Mr Lungu through his associates like him.

“Even former President Lungu has said that he knows who they are looking for and instead of going directly to him they are targeting everyone close to him including people in shanties whose houses had been broken down,” he said.

He challenged PF members to be ready for more hardships as they were going to be raided at one point.

Mr Lubinda said that they were going to harass more members of the PF but that they needed to remain strong.

He said it was unfortunate that they had not prosecuted any individual who they were investigating which sent a very wrong impression.

Mr Lubinda said that it was shocking that the ACC had summoned him over a loan which his company got from another Chinese firm.

He wondered how getting a loan had become a crime and that if he failed to settle the loan it was him that would sell his assets to offset it.

“Initially they did not give me the reason I was summoned but after I reached I was shocked because I was told that in 2016 my firm got a loan from a Chinese company but I will find out from the courts when getting a loan became a crime,” Mr Lubinda said.

Meanwhile, ACC Spokesperson, Queen Chibwe confirmed that the warned and cautioned Mr Lubinda, 58, in connection with allegations of being in possession of property reasonably suspected to be proceeds of crime.

Ms Chibwe said in a statement that Mr Lubinda appeared before the ACC offices for interrrogations in the company of his three lawyers.

She said in a statement that Mr Lubinda was summoned to the Commission as a suspect and as such all procedures related to summoning of a suspect by an investigating agency were dully followed.- Daily Nation

Changing the logo will not change the bad characters at the Electoral Commission of Zambia, Lusaka youth Dillion Mayangwa has charged.

Commenting on the ECZ’s new logo launched last Friday, Mayangwa said despite the regime change, Zambians have not forgotten on how biased the commission had been on the past elections.

“ECZ doesn’t need new logo, it needs new management. Let’s not pretend as if everything is going well at ECZ. There are a lot of bad characters their (ECZ) who were employed for the purpose of favouring the Patriotic Front (PF),” he charged.

“Some people there are not suitable for the job. There is need for a total clean up at ECZ if all forms of unfairness or corruption was to be uprooted.”

Mayangwa said the ECZ needs a new and independent management to oversee the affairs of elections in Zambia and not change of logo.

“Let’s not pretend, ECZ was a branch of the PF. If not a constituency! For the institution to gain trust, there is need to make some changes at the top management and then at the lower level,” he said.

Mayangwa said people have issues with the commission because of how the institution conducted itself in the recent past adding that some individuals were not fit to be at the electoral body.

“ECZ in its currently form cannot be trusted by Zambians. We need voter protection from the referee, not what we saw! Lives were lost. Families who lost their loved ones are still nursing the loses. The past record is not glitter that is why I am saying that we should go backto the drawing board and rebrand ECZ management. Not changing the logo,” said Mayangwa.

“Don’t expect us to smile and clap for the new logo, no. We won’t laugh and smile! We shall clap when ECZ is cleaned. We have a lot of people at the commission who are not even supposed to be there. They can’t come here to preach rebranding and new logo. Rebranding will be done yes! But by new management who will understand the duty ECZ has for mother Zambia. Not what we saw in the past 10 years, where ECZ saved the interests of the ruling party.”

Findlay, wife and Companies petition State over seized accounts

FORMER president Edgar Lungu’s associate Valden Findlay, his wife Dessislava and his four companies have petitioned the state in the Lusaka High Court for seizing their accounts on the pretext that Findlay was a crook, committed fraud, among various financial crimes.

Findlay, a businessman, Dessislava Findlay trading as D Findlay and Associates, Twatotela Properties limited, Chrismar Earth Moving Equipment Limited and Greenview Service Providers say the secretive freezing of their accounts by the DEC without communication is a violation of their rights to be informed about the allegations they face before DEC takes an arbitrary action and for them to have representation to obtain reliefs from punitive measures taken.

Findlay claimed that wealth grabbed from him by the Drug Enforcement Commission was clean as it was amassed from rentals and various business activities which he was engaged in with tax liabilities having been duly paid and the same can be easily verified and explained.

He said that the money in the law firm’s account belong to clients and was received by his wife for distribution and transfer upon the clients’ requests during business operations.

The plaintiffs are seeking a declaratory order that the seizure notices on their accounts are illegal.

They want a declaration that the freezing of the accounts without notification and being given an opportunity to legal representation violates their rights to the presumption of innocence and fair hearing before punishment is meted on them.

The plaintiffs are seeking an order that the accounts be released.

They are further seeking orders for renumeration of the seized accounts, damage to property and unlawful conduct by the DEC aimed at painting Findlay black without giving him an opportunity to be heard.

The plaintiffs said on August 16, 2021 after the announcement of the 2021 general election results, the Financial Intelligence Centre (FIC) directed the freezing of two Kwacha accounts Twatotela Properties limited (account no.101023160002 and D. Findlay and Associates (account no.1010231001 and 1010231004) domiciled at First Alliance Bank Zambia limited without notice or formal communication.

They said on August 30, 2020 their advocates, Messrs Makebi Zulu Advocates, wrote to FIC to provide details and supplementary documents of the transactions on the accounts belonging to the law firm of Findlay’s wife and Twatotela Properties.

“On August 20, 2021 the Drug Enforcement Commission issued a public statement circulating on various internet social media platforms that Findlay’s bank account had been frozen,” the plaintiffs said.

“There has never been any communication, public or private, to any of the other petitioners by DEC or any other law enforcement agency.”

The complainants stated that a number of false, malicious and defamatory publications appeared on numerous internet social media platforms against Findlay alleging that he had perpetrated financial crimes, money laundering and should be subjected to investigation and prosecuted for the alleged crimes and had abused his acquaintanceship with Lungu.

They said on September 3, 2021, they received formal communication from First Alliance Bank that their accounts were seized by the DEC pursuant to Section 15 of the prohibition and prevention of money laundering Act no.44 of 2010.

Findlay, his wife and companies contended that they are unable to make transactions on the said accounts.

They said there are no reasonable grounds upon which the DEC can believe that the funds were laundered or obtained from illegal activities.

“Your petitioners believe that their rights to be presumed innocent until proven guilty have been breached as they have been punished, condemned and punitive measures taken against them without any trial,” the plaintiffs said.

The businessman stated that in October 2021 the Anti-Corruption Commission searched his house in new Kasama and farm in Chisamba and caused damage to their property but himself and his wife have never been summoned, warned, arrested and charged by the ACC neither have they been informed of the investigations.

The Findlays charged that the searches conducted by ACC without a valid search warrant were illegal, and in violation of their Constitutional rights.

The plaintiffs further stated that their advocates wrote to DEC to release their funds but the Commission declined as investigations were still ongoing.

No One Is Being Targeted, Just Explain Your Wealth, Michael Kaingu Tells Former Ministers

FORMER education minister Michael Kaingu says he sometimes wonders how some individuals who served in government for only five years are able to own various properties when he failed to buy even one house after serving for 10 years.

And Kaingu says government is not targeting any person and that people should simply substantiate their wealth.

In an interview, Tuesday, Kaingu wondered how former PF ministers were able to acquire wealth in a short period of time which some former MMD ministers failed to do.

“Now we wonder that a person who is a Minister has got three, four houses, I am not sounding jealous but even me I also wonder how could I serve for 10 years and I failed to buy a house and my friend who served only for three years, for five years, they have bought five houses, six houses, how is it possible?

I can’t come to Lusaka there because I don’t have a property other than where I am here, but we just wonder how others managed. Maybe they were saving, maybe they were clever than us, maybe we were chewing everything,” he said.

“We shall not blame others, there are those who are clever. Maybe you give him K10,000, he makes K1 million because when you look at the salaries of a Minister at our time, I don’t know how much they are getting now or how much they were getting in the past five years, when you look at the salary of a Minister, it is very meager and the responsibility is very high.

For us we were only [living in] Minister’s houses. Most of us, just check, find out how many houses Magande has, how many houses Dr Chituwo has, just ask them you will find out that they are exactly like myself. But how did our friends all of a sudden, maybe their salaries (were high)? So that is what I can only say, I want to rest but I hope I am not antagonising, I am just making observations as a citizen.”

Kaingu said those who claim that they are being targeted should simply explain their earnings.

“Well, this government told us that there were people who were corrupt and that the last government was very corrupt. Up to now we haven’t seen [any action] really. For example, there are Ministries where there was a lot of talk about corruption. In the Ministry of Infrastructure, there was a lot of talk. In the Ministry of Tourism, we were told that there were animals which were being lifted, in the Ministry of Local Government there were the fire tenders.

All of us were reading these things and we were being told by the current government when they were in opposition that they knew very well that there were some people who were corrupt. But now we are not seeing much talk about [that] or action which is connecting that campaign talk to what is happening now,” he said.

“I don’t agree that there are some people who are targeted today. I think if somebody is queried, all it is, is to substantiate what you are being accused of. For me, I strongly believe that anybody who is doing very well must substantiate your earnings. We know each other, we lived in the same compounds, we knew how this person was living before he became a Minister.

Then he becomes a Minister within one year, two years, he has got three houses, he has got four houses. The question that you have is that [if] what you have doesn’t seem to match with your earnings, just explain to us how this could have come [about].

If today somebody came to Kozo Lodge and asked me [about] the development of Kozo lodge, all I need to do is to walk to that person and say ‘here I borrowed and this is what I did’, I think you should be able to justify what you are doing. I don’t know whether people are being targeted.”

Kaingu said in his time, the ministers believed that wealth belonged to the people.

“I am not in government, but for me everyone who was in government might have that tag of how did you acquire this. So if you are being asked I think it is a question of answering that. I have been in government for 10 years, I don’t have [another] house other than where I am living. I have never acquired not even a plot, I never even got a plot, not even from any council.

Because what I believed in my time is that these things belonged to the people, so we were serving. You know, as a minister, I would have had plots in Sesheke, plots in Livingstone, plots in Choma, plots in Lusaka, plots in Mongu, plots in Kaoma, I have never got any single plot. In our time we believed that these things belonged to the people,” said Kaingu.

Little-known facts about how Tony Elumelu rose from salesperson to multimillionaire philanthropist

Tony Elumelu is a Nigerian entrepreneur and investor who owns major shares in Transcorp, a publicly traded Nigerian conglomerate with interests in hospitality, agriculture, oil production and power generation.

The Nigerian business mogul first came into the limelight in 1997 when he led a small group of investors to take over “a small, floundering commercial bank” in Lagos, according to Forbes. He would grow the bank to become United Bank for Africa with branches across Africa, the United Kingdom and the U.S.

Before starting his banking career, he was a salesperson. “I started my career as a salesman, a copier salesman to be specific, young, hungry, and hardworking, but the reality was that I was just one of thousands of young Nigerian graduates, all eager to succeed. How did I get from there to where I am now? Of course, hard work, resilience, a long-term vision – but also luck,” Elumelu said.

His career in banking started at Allstates Trust Bank. At the time, he had just completed his master’s degree in Economics from the University of Lagos and he saw a job ad by Allstates Trust Bank. Although he did not have the required qualification then, he applied.

“I know I may not have met the qualifying criteria for the advertised roles, but I am intelligent, driven, ambitious and I will make the bank proud. My 2:2 degree does not demonstrate the full extent of my intelligence and ability, and I know I can do so much more,” he wrote on his cover letter.

Elumelu was shortlisted and subsequently hired by the bank after going through several interviews and tests. At Allstates Trust Bank, he started as an entry-level analyst. Within a year, he became the youngest branch manager at age 27 by dint of hard work.

“I was hardworking, energetic, creative and prioritised getting things done, but it was also good fortune that my bosses Toyin Akin-Johnson and Ebitimi Banigo took notice, and then, believed in me,” Elumelu recounted. “They took a chance on me by appointing me as branch manager after an incredibly short time in the bank. They recognised in me the raw materials needed to make a good leader and were prepared to invest in me and my ability. My rise to Branch Manager within a short period is a great story but I know in my heart, I was lucky, as well as deserving.”

By 1997, he had led a group of investors to take over Standard Trust Bank, a Lagos-based commercial bank. He turned the fortunes of the company around and in 2005 he merged it with the United Bank for Africa. The bank came to have over seven million customers while operating in 19 countries in Africa.

In 2015, Forbes reported that Elumelu also owns extensive real estate across Nigeria and a minority stake in mobile telecom firm MTN Nigeria, among other assets. He is currently also a philanthropist and has over the years donated towards many charity causes.

He founded the Tony Elumelu Foundation to develop the next crop of African entrepreneurs. In 2016, he invested $100 million in emerging African entrepreneurs. The year before that, 1000 young entrepreneurs from across Africa were selected into a program by the foundation and were equipped with mentoring, business training and start-up capital, according to Forbes.

The businessman is married with children. According to Forbes, he is worth $700 million. He had previously been featured on Forbes as a billionaire but fell off the billionaire club.

He sits on a number of public and social sector boards including the World Economic Forum Community of Chairmen and the Global Board of UNICEF’s Generation Unlimited. He was named in the 2020 Time 100 Most Influential People in the World, recognized for his business leadership and economic empowerment of young Africans.

DR Congo court sentences dozens to death over UN experts’ murder but unanswered questions remain

Last Saturday 29 Jan. a military court in DR Congo sentenced 51 people to death over the killing of two United Nations’ experts Zaida Catalan, a Swede and Michael Sharp, an American who were assassinated while investigating armed conflict in Kasai province nearly five years ago.

Ms. Catalan and Michael were killed while investigating violence between government forces and an armed group called Kamwina Nsapu in March 2017. They were stopped by armed men and marched into a field to be killed, according to media reports.

Despite the end of the high profile trial that took years and the sentencing of dozens of people to death, some remain sceptic over the trial as answered questions over the assassination that shocked the world remain. Minister for Foreign Affairs of Sweden Ann Linde said via Twitter that she notes the verdict in the case of heinous murder saying it can be appealed and opposed the death sentence.

“Sweden strongly opposes the use of death penalty in all circumstances without exception”. According to Linde, it is crucial that investigation concerning others involved continues to further uncover truth and bring justice. “We encourage DR Congo authorities to fully cooperate with the UN mechanism.”

Some observers said the trial did not shed the light on the murder especially the role of government agents and three Congolese victims who accompanied UN experts. One Congolese victim was an interpreter; the others were two motorcycle operators who drove UN experts to the field.

Jean-Mobert Nsenga, a researcher at Amnesty International hopes one day the truth about the murder will be known.

The 49 convicted to death are mainly former militia members from ‘Kamuina Nsapu’ sect. Colonel Jean de Dieu Mambweni who is accused of conniving with militias in a trap by sending UN experts to unsafe field and having armed assassins has been sentenced to 10 years in prison.

Mr. Nsenga stated that there are many unanswered questions about the high profile murder focusing on Congolese victims. Nsenga was quoted as saying “Congolese justice has never really taken an interest in their fate (of the three Congolese). There were reports at one point of a grave they were buried in, but justice never went further to find out what their fate had been.”

The bodies of victims were found in a village on March 28, 2017, 16 days after they went missing. Congolese officials have blamed the killings on the Kamuina Nsapu armed group.

Unrest in Kasai province was sparked by the killing of a local traditional chief. According to media reports, about 3,400 people were killed, and tens of thousands of people fled their homes, before the conflict ended in mid-2017.

During the trial prosecutors demanded death sentence against 51 of 54 accused, 22 of accused were tried in absentia. The charges they faced include “terrorism”, “murder”, “participation in an insurrectional movement” and “the act of a war crime through mutilation”.

Catalan’s sister, Elisabeth Morseby, criticized the case after the verdict saying that testimony in the case was of dubious reliability given how much time the defendants had spent together in prison and stated the conviction of Mambweni was a cover-up.

Morseby told Reuters News agency that “In order for the truth to emerge, all suspects, including those higher up in the hierarchy, need to be questioned, which has not yet been done”.

Insecurity remains one of key challenges the mineral-rich country faces especially in the troubled Eastern provinces. Recently security forces arrested suspects in the murder of Italian ambassador Luca Attanasio, one of most recent high profile assassination in the volatile region.

CONCOURT SETS MARCH 9, AS THE JUDGEMENT FOR SPEAKERS DECISION TO EXPEL 9 PF MPs

THE Constitutional Court has set March 9, 2022, as date of judgement in a matter where the Law Association of Zambia (LAZ) has petitioned it to interpret the provisions used by the Speaker, Nelly Mutti, to expel from the House nine PF MPs whose seats was nullified by the High Court.

On December 7, 2021, Ms Mutti sent away Nine Patriotic Front (PF) Members of Parliament whose elections results was nullified and had appealed to the Concourt challenging the High Court’s judgements.

The nine MPs are Bowman Lusambo (Kabushi ), Joseph Malanji (Kwacha) , Mutotwe Kafwaya (Lunte), Sibongile Mwamba (Kasama Central), Luka Simumba(Nakonde), Allan Banda (Chimwemwe), Taulo Chewe (Lubasenshi), Kalalwe Mukosa(Chinsali) and Christopher Chibuye (Mkushi North).

LAZ in its petition seeks the Court to interpret the provisions of Articles 72 (h) and 73 (1) (2) and (4) of the Constitution of Zambia. The association cited the Attorney General as respondent in the petition. When the matter came up for hearing yesterday, LAZ president Abyud Shonga said that an interpretation to the provisions used by the speaker would put an end to the debate of whether an MP whose seat has been nullified following an election petition may lawfully remain in the House pending appeal to the Concourt. Mr Shonga reiterated that the association’s involvement in the matter was not to take sides but because it is of public interest.

However, Solicitor General Marshal Muchende argued that the effect of the nullification by the High Court was to create a vacancy in the National Assembly, and that if there is no appeal, the Speaker can communicate to ECZ for fresh elections.

Mr Muchende stated that an appeal to the Concourt does not operate as a stay, therefore, the affected MPs should have obtained stay from the High Court.

He contended that an MP whose seat had been declared null and void cannot continue to hold that seat in the absence of a stay ,unless if the high court that nullified the seat grants the stay.

Meanwhile, the ConCourt has reserved February 15, 2022 , as the date on which it will rule over an application by Mr Malanji on its jurisdiction to hear a petition by Governance Elections Advocacy Research Services Initiative Zambia Limited (GEARS) when there is an appeal against the High Court’s decision to nullify the seats .

GEARS , seeks a declaration that the nine having been declared by the High Court as not duly elected MPs , by attending sessions of the National Assembly and participating in Parliamentary business breached the constitution and the Electoral Process Act.

APPROVAL OF MINING IN THE LOWER ZAMBEZI NATIONAL PARK

The Government wishes to make it clear that NO NEW DECISION has been made by the UPND Government in relation to mining in the Lower Zambezi National Park.

In respect of this serious matter, there are legacy issues that have to be addressed stemming from the decision by former officials under the Patriotic Front government to overturn the initial decision by the Zambia Environmental Management Agency (“ZEMA”) to reject the proposal.

This government is still committed to ensuring that all commitments made, including greening the economy are adhered to, but this will be done in a legal manner and we will therefore not interfere with any institution of governance.

Government will ensure that it exhausts all proper channels to secure a resolution in line with its commitment to the sustainable management of Zambia’s resources.

This means activity that contributes to the economic, environmental and societal development of the country.

Background

In March 2012, Mwembeshi Resources Limited conducted an Environmental Impact Assessment (“EIA”) to undertake Large-Scale Mining activities under Licence No. 15547-HQ-LML in the Lower Zambezi National Park (“the Project”).

The proposed project was considered and rejected by the Zambia Environmental Management Agency (“ZEMA”) on August 31, 2012.

Being dissatisfied with the decision of ZEMA, Mwembeshi Resources Limited appealed against the rejection in accordance with the provisions of section 116 of the Environmental Management Act No. 12 of 2011.

The Minister of Lands, Natural Resources and Environmental Protection (as the ministry responsible for the environment was known at the time), Hon Harry Kalaba on 17th January, 2014, allowed the appeal and thereby overturned the decision of ZEMA.

However, Vincent Ziba, Morgan Katati, Noah Zimba, Robert Chimambo, Kasampa J Tembo and David Ngwenyama (the Appellants) filed an appeal to the High Court against the Minister’s decision and obtained a stay of execution of the Minister’s decision (the stay of execution) pending the determination of the appeal.

On 17th October, 2019, the High Court dismissed the Appellants’ Appeal for want of prosecution and further discharged the Stay of Execution.

The effect of the High Court’s ruling was that Mwembeshi Resources Limited was no longer constrained from conducting mining activities in the Lower Zambezi National Park.

The Appellants later lodged an appeal against the decision of the High Court before the Court of Appeal and the same was dismissed on 25th February, 2021.

At the end of the Court process, the approval granted in 2014 had lapsed following the failure to commence project implementation activities within three (3) years from the date of approval.

Mwembeshi Resources Limited therefore re-registered its intention to proceed with the proposed project in accordance with the provisions of Regulation 30 and Part VIII of the Environmental Protection and Pollution Control (Environmental Impact Assessment) Regulations, Statutory Instrument No. 28 of 1997.

ZEMA proceeded to consider the submission by Mwembeshi Resources Limited in accordance with the provisions of the Environmental Management Act No. 12 of 2011 (“the Act”) and the EIA Regulations and accordingly approved the project subject to strict conditions under Decision letter No. ZEMA/EIA/EIS/726.

The Decision for Mwembeshi Resources Limited was therefore granted by the PF government.

Decisions taken by previous governments are binding.

The New Dawn Government wishes to assure the nation that there is no cause for alarm as there is NO NEW DECISION HAS BEEN MADE.

Zanu-PF claims CCC ‘means being used by the devil or the beast’

Zanu PF has labelled Nelson Chamisa’s Citizens Coalition for Change (CCC) party “evil”, amid reports that the ruling party is panicking over the momentum that is accompanying the new opposition party.

Chamisa and his followers last week dumped the MDC Alliance party after Douglas Mwonzora grabbed its name. This is despite the fact that Mwonzora had his own MDC-T party.

To get rid of the name and party controversies the main opposition leader dumped MDC Alliance and its red colour and formed the CCC. The new party adopted the yellow and gold colours and its reflectors ahead of future elections.

With by-elections around the corner, the CCC party has started popularising the name and colours.

But Zanu PF has also started bad-mouthing its rival calling it an “evil party”, and that the CCC stole its colours.

Yesterday, at the launch of the Zanu PF by-election campaign in St Mary’s, Chitungwiza, the party’s acting youth league secretary Tendai Chirau, provincial chairperson Godwills Masimirembwa, deputy national political commissar Omega Hungwe told dozens of party supporters that Chamisa’s party must be ignored as it had nothing to offer, including the yellow colour.

They also described CCC’s pointed finger symbol as “satanic”.

Chirau said the yellow colour belonged to Zanu PF since the liberation struggle.

“When the liberation struggle was fought, it was Zanu PF that mobilised the masses and one of the key fundamentals was the fight for mineral resources, the fight for independence and that is why Zanu PF chose yellow as (one of) its colours.

“The reason was because it was symbolising the national resources in terms of mineral wealth,” Chirau said.

“So these minerals we still have them up to this day and this explains why Zimbabwe has the largest number of artisanal miners and indigenous people who own minerals.

“Yellow, to us, represents wealth, it’s not just the colour that we took on ourselves, but most importantly, you should also take the fact that we have four colours, (that is) green and yellow, red and black.

“These colours will never change because of someone who wants to take them. They remain our colours, they symbolise the importance of the rich minerals that we have.”

Masimirembwa meanwhile claimed the CCC party had grabbed Zanu PF’s colours.

“They want to shine with the yellow colour. Yellow has always been a Zanu PF colour. It is our special colour as Zanu PF because we brought independence. Yellow represents the wealth of the country. The wealth of this country was brought in the country from whites by Zanu PF and not by CCC,” he said.

Hungwe said: “Voting for MDC or CCC shows that you are lost. Do you know what CCC means? It’s an animal that was spoken about in the book of Revelations and it means being used by the devil or the beast,” she claimed.

In response to the Zanu PF claims, CCC spokesperson Fadzayi Mahere said Zanu PF was in “panic mode so they are desperately trying to dampen the spirits of the people.

“Yellow is a colour that symbolises hope, energy and a fresh start. The CCC citizen movement has thrown Zanu PF into panic mode so they are desperately trying to dampen the spirits of the people who are ready to win the nation for change.

“They won’t succeed. CCC is here to stay. CCC is here ready to lead. CCC is ready to secure victory,” Mahere said. -Nehanda Radio

15 facts finder signs that demonstrate deepining cracks between Chakwera and Chilima

I was reluctant to comment on the worsening relationship between President Chakwera and his vice President Chilima. These people thought that they were wise and clever for withholding information contained in their alliance agreement. Little did they realise that truth has its own way to set itself free. But here are the fifteen signs that show that their relationship is not that all rosy:

  1. When Saulos Chilima pronounced that leadership of Tonse Alliance would take turns and Chilima would be the next torchbearer for Tonse Alliance in 2025, President Chakwera categorically refuted that he was not part of that agreement and that Chilima was just expressing his own opinion.
  2. President Chakwera went ahead again to refute the wishes of the Vice President Saulos Chilima that he would be the Minister of Finance. In fact, President Chakwera proved his vice Chilima wrong by appointing him Minister of Economic planning and development instead leaving Chilima mouth agape and bamboozled.
  3. Furthermore, President Chakwera has just exercised his prerogative by stripping the Vice President of his ministerial position of economic planning and development. It never rains but it pours for our Vice President Saulos Chilima.
  4. President Chakwera has been saying all the time ‘ Dr Chilima and I’ meaning that they were working together. However, there is a change of tune by our president. He has recently asserted himself as the sole driver of the nation. He addressed the recently instituted cabinet as ‘my cabinet’ and ‘you are my ministers’.
  5. President Chakwera has also directed that all ministers must directly report to him. If UTM ministers thought that it was Chilima who initiated their appointment, Chakwera categorically said it was President Chakwera who appointed them. Their allegiance are to President Chakwera and not to any other person on planet earth. This is interesting.
  6. President Chakwera deliberately ignored Chilima’s public sector reform report. He has not acted on the report for over six months now leaving Vice President Saulos Chilima dismally frustrated.
  7. The recent socioeconomic recovery plan engineered by the Vice President Saulos Chilima has not been implemented at all. We are yet to see.
  8. The absence of the Vice President Saulos Chilima at an important event where ministers and deputy ministers were sworn in speaks volumes of his gargantuan frustration.
  9. Malawi Congress Party continues to enjoy lion’s share in public appointments including Cabinet. It is not surprising that some disgruntled UTM diehards like Bon Kalindo have expressed their disappointment with the current regime by holding nation wide demonstrations.
  10. During campaign period Dr Chilima hinted that power would be shared between the President and the Vice. As of now, the office of the Vice President remains a delegated one. There are currently no plans nor a bill to change the constitution to accommodate this notion.
  11. At one point in time, the Vice President Saulos Chilima embarked on series of tours to inspect road construction projects. Weeks later, President Chakwera followed suit to inspect the very same projects already visited his Vice trying to outdo and outsmart each other at the expense of taxpayers’ money.
  12. President Chakwera promised Malawians that he would reduce his presidential powers. Nothing has been done. In fact, he is gaining more power. He boasted having power over the removal of ACB Director. He has been assigning duties to the Vice President on a podium such as In-charge of SADC preparation summit, public sector reform Programme, etc.. There are currently no plans to reduce presidential powers. No bill has been drafted yet.
  13. The bad relationship between President Chakwera and his vice is reflected in their supporters. MCP and UTM supporters are always antagonistic to each other on both social media platforms and on the ground. And yet they belong to the same Tonse Alliance government. It was unfathomable for MCP and UTM supporters to hack each other in Karonga by-elections. Surprisingly, neither President Chakwera nor Vice President Saulos Chilima came in the open to condemn their supporters’ primitive, uncivil and undemocratic behaviour.
  14. Very rare does President Chakwera delegate his Vice to perform other duties. Of course, there was a time when President Chakwera delegated vice President Chilima to an international conference following a public outcry.
  15. As an alliance, people expected the President to consult party leaders when formulating a cabinet. It is alleged that the Vice President was not consulted when instituting this cabinet reshuffle. Chilima only heard about cabinet reshuffle on the radio like any other citizen when he was conducting an official meeting in Blantyre as the Minister of economic planning and development. He had to cancel the meeting abruptly as he was dropped from the ministerial position. Wonders never cease.

‘Consistency is key in struggle for democratic change in Africa’- Chamisa

Zimbabwe’s main opposition leader Nelson Chamisa believes that consistency is critical when fighting for democracy in Africa.

Chamisa who has been in the opposition MDC since its inception around 1999, commands a huge support base in Zimbabwe and abroad.

In the last plebiscite in 2018, the current President Emmerson Mnangagwa won 50.8% of votes, compared to 44.3% for Chamisa. The opposition leader never endorsed the results.

The country will hold the next election in less than 11 months. Chamisa has since dumped the party he contested under during the last election following controversy over ownership of the party.

He rebranded his party to the Citizens Coalition for Change (CCC).

In an interview with Sunday Oyinloye, Publisher, Green Savannah Diplomatic Cable this week, Chamisa touched on several issues affecting Africa.

Chamisa was asked to articulate lessons he learnt from Zambia last year when then opposition United Party for National Development (UPND) leader Hakainde Hichilema (now President) won the presidential race that overthrew Edgar Lungu, by more than a million votes.

The former Minister of Information Communication and Technology responded saying he learnt that the Zambian electoral body was ‘strong and independent’, hence he advocated for the same to happen in Zimbabwe.

Chamisa said he noted that Hichilema was consistent until his victory in August 2021.

“There are a number of lessons to learn, but I will just stick to four. Number one lesson; it’s important to have institutions that are strong, institutions that are independent and professional.

“If you don’t have an independent electoral commission, you will see such commission throwing away the wishes of the people. That is a lesson from Zambia. The institutions of the state are very independent and professional and they allowed for power transfer,” Chamisa said.

“Number two; the participation of the citizens was impressive, especially the young people. Young people in Africa must participate in the political process and determine their destiny.

“Lesson number three is this. If you are in the opposition, you have to be consistent. President Hichilema was in the opposition and ran for elections many times and even when he was being cheated he was persistent until his time came.

“Nobody misses their moment. Africa can do it; Zambia has demonstrated that democracy is workable and could flourish.”

He added: “The challenge of the continent is that those who are in office want to terrorize those who are out of office and those who are out of office want to topple those who are in office, so there has to be that understanding that we have a stake in the development of our countries and that there is no reason for vindictiveness. That is how to build a great African society. Those are the lessons from Zambia.”

ACC officer narrates how Chanda’s wife demeaned officer searching their house

ANTI-CORRUPTION Commission investigations officer Christopher Siwakwi has told the Lusaka Magistrates’ Court that he lost the zeal to execute his mandate after he was belittled by Amos Chanda’s wife, who called him a grade 12 failure.

This is in a matter where Chanda, a former special assistant to the president for press and public relations, his wife Mable Nakaundi and sister in-law Ruth Nakaundi are facing charges of using insulting language against officers of the Anti-Corruption Commission (ACC) and obstructing the law enforcement officers from performing their duty.

It is alleged that the trio on October 27, 2021 uttered derogatory words against ACC officers, an act which provoked them and would have caused them to breach peace or caused them to make an offense and blocked the officers from searching their properties.

Testifying before chief resident magistrate Dominic Makalicha, Siwakwi said prior to conducting the search at Chanda’s premises in the State Lodge area, he noticed the media had camped at the gate.

He said when he asked the media about their presence during such an operation, one of the journalists informed him that Chanda had invited them to witness the said operation.

“I told them that they were not welcome as they would jeopardise our investigations,” Siwakwi said.

“When Mr Chanda arrived at the property, he attempted to access the premises with the the premises with the journalists but we told them that they could not come in and he used demeaning words such as idiots, criminals and said we were corrupt in full view of journalists. I felt very bad because the video went viral on social media and it was embarrassing to me and my family.”

Siwakwi told the court that when the investigations team proceeded to conduct another search at Chanda’s home on Elm Street in Woodlands area, the accused requested that he conducts a body search on the officers.

“Whilst he was searching me, I told him I only had my wallet in my pockets and he said ‘I don’t want your fucking money’. After he searched us, he then took us to the second house which he claimed was his as he did not know the owners of the first house,” Siwakwi said.

“Whilst searching his house, his wife issued demeaning words that I am a grade 12 failure and I am poorly paid. I felt very bad such that I almost lost focus on the search.”
