LUBINDA WALKS TO FREEDOM AFTER COURT ACQUITS HIM
LUSAKA senior magistrate Sandford Ngobola has acquitted former Patriotic Front(PF) vice president, Given Lubinda in a matter he was facing four counts of possession of property suspected of being proceeds of crime.
The court said the state failed to prove that Lubinda acquired the properties through proceeds of crime.
These directionless reporters! When did Given Lubinda become “former” PF vice president! If he’s not the vice president of PF, then who is? If it’s that Hichilema/ Hasampa project which is making you pretend not to remember who the VP for PF is, you are reminded that that one is a failed project! Edgar Lungu is president of PF, his vice is Given Lubinda. Nobody outside PF can change that! And now Hichilema and Upnd have brought more problems to themselves by sponsoring a Tonga chap to sue for legality or illegality of Edgar Lungu standing for 2021 elections! So if the Concourt says it was illegal, a change from their previous rulings, then the 2021 elections will be declared invalid, and fresh elections will have to be held. Meaning all appointments Hichilema has made from 2021 to date are invalid! So we revert back to those who were in office before 2021 elections! This is what desperation from Hichilema and his Upnd will cause! Their aim is to bar Edgar Lungu from standing, only to find themselves pushed out of government! That’s how God works! Through human beings! God help us! Twachula!

If a team or country fields an ineligible player in the World Cup or any FIFA game regardless of the outcome,that will attract sanctions and nullification of the result. If a trophy or cup had been won, it will be withdrawn and awarded to the runners up. With the ECZ the election would be re-run whether Lungu won or not, with another PF candidate running against the other presidential candidates.
The constitutional court if it has discretion may rule otherwise and keep HH in power.This would be the outcome even without judicial discretion as the courts are now under Executive control.
Which law states that the election would be invalid?? In law there’s no common sense you just have to state what the laws says. If one candidate is disqualified that does not invalidate the process.

When an innocent person walks to freedom justice is done, when a guilty person is jailed justice is done, when a guilty person walks to freedom, injustice is done and when an innocent person is jailed injustice is done. Good investigation, good prosecution and good adjudication enable justice to be done. Has justice been done in the Lubinda criminal prosecution? To be honest, I do not know. But I hope there are members of the Judiciary who are asking how a country with very little mortgage lending has a real estate boom.
So everyone is getting acquitted, or being given a Nolle, or immunity.
No one is going to jail.

Maybe, the person who is subsequently ruled ineligible to have participated has their results nullified. In this case it would be an academic exercise. The status of the person standing who is subject to a court review would be in question not the whole election.
