“I got pregnant nine years ago while dating my current husband and then the issue of marriage came up.
I wasn’t working then. He told my family and I that he doesn’t want a court marriage for no reason

MY parents tried talking to him, I cried and begged him severally to legalize his marriage with me but he stood his grounds not to wed me in a court.

I involved his family members to help me beg him but they said, he’s old enough to make his decisions. He even refused to do a white wedding either because my church requested for a court certificate, so we ended up doing only traditional marriage

I later got tired and gave up on the matter. I was hurt and broken but I resolved to marry him like that just to save myself and my family the shame of having a baby outside wedlock.
My dad was angry and disappointed in him but he didn’t care and because of that my dad vowed to see me a successful and independent woman with or without him.

After I gave birth to my baby, my dad helped me secure a job with a multinational company and things started to turn around for me. I could now take care of myself and secure a future.
Though I married my husband, but I never forgave him from my heart and it made me not to do anything in my husband’s name.

We currently have three kids together but all my properties are in the name of my children. I never used him as my next of kin either.

Just last month my company decided to transfer me to a branch in Texas and the company is willing to pay for my entire family to relocate with me.
My husband’s business is not doing too well and he’s willing to relocate also but we have no legal certificate to show that we are married. Now he wants us to go to the court to legalize our marriage and I have said “No”.

My dad has threatened to disown me if I ever go with him to court.
He’s been tagging me everywhere as a bad wife who is not loyal to her husband, spoiling my family also. His family members have been calling me trying to persuade me but I told them I’m old enough to make my decisions also and I have stood my ground just like he did to me nine years ago.”

1. Sean Enock Tembo (SET) was born on 30th of March 1980 in Jabu Village, Chief Kapatamoyo, Chipata District of Eastern Province of Zambia, from Mr. Gideon Tembo and Mrs. Vaida Tembo. He is the 5th born in a family of 9, of which only 4 are currently surviving. His father was a Miner and worked for Zambia Consolidated Copper Mines (ZCCM), Nchanga Division in Chingola before his untimely demise in 1989 when SET was 9 years old. President Sean Tembo grew up in Mtendere Compound of Lusaka and he started his primary school in 1986 and completed his Grade 7 as one of the best student at Chitukuko Primary School in Mtendere, Lusaka. He later proceeded to Kabulonga School for Boys in 1993. In his Grade 9 exams, President Sean Tembo was one of the best students in Zambia and was admitted to Hillcrest Technical Secondary School in Livingstone where he completed his Grade 12 in 1997. While at Hillcrest, Mr Sean Tembo was one of the best students and obtained a number of awards and also represented the school in several national JETS Olympiad competitions.

2. In 1999, at the age of 19, Mr Sean Tembo was enrolled in the Bachelor of Accountancy programme at the Copperbelt University (CBU) in Kitwe where he was consistently the best student during his 4 year tenure at the University. While at Copperbelt University, President Sean Tembo enjoyed several best student scholarships including the Citi Bank best student scholarship as well as the Bank of Zambia (BOZ) best student scholarship.

3. During his stay at CBU, President Sean Tembo was the Managing Editor of the Campus Herald Magazine, which was a student magazine with a monthly circulation of about 10,000 copies and was widely distributed to secondary schools in the entire Copperbelt Province. In his 3rd and 4th years at CBU and due to his outstanding academic performance, Sean Tembo was appointed as a Tutor for 1st year students in one of the most difficult courses in the School of Business; BS140, Mathematical Analysis. As a Tutor, he was put on the University payroll and drew a regular monthly salary in addition to the upkeep allowances that he received from the Citi Bank and Bank of Zambia Best Student Scholarships.

4. On completion of his undergraduate degree programme at CBU, President Sean Tembo was the best graduating student and was awarded the Zambia Institute of Chartered Accountants (ZICA) best graduating student award with a cash prize of K1 million (un-rebased). While writing his last examination paper at CBU, Mr Sean Tembo had 7 job offers from reputable companies and institutions including Konkola Copper Mines Plc, PricewaterhouseCoopers, Bank of Zambia, KPMG, Citi Bank, Deloitte and Copperbelt University as an SDF. He eventually settled to join PricewaterhouseCoopers which is an international audit & business advisory services firm, where he worked until 2004.

5. While working at PricewaterhouseCoopers, Mr Sean Tembo was sponsored to go and pursue the Association of Chartered Certified Accountants (ACCA) qualification by his employer at the Zambia Centre for Accountancy Studies (ZCAS), in Lusaka. While studying for his ACCA at ZCAS, Sean Tembo obtained several worldwide best student awards in various courses and walked away with more than K5 million (un-rebased) in cash prizes from the Association of Chartered Certified Accountants, before completing his ACCA qualification in record time.

6. In 2004 at the age of 24, President Sean Tembo left PricewaterhouseCoopers and founded Enosyst Associates, his own audit & business advisory services firm. In 2005, Enosyst Associates established an office in Gaborone, Botswana and in 2008, a third office was established in Johannesburg, South Africa. The firm specialised in the provision of assurance services such as statutory audits, forensic audits, operational audits etc, as well as economic and financial consultancy services to various clients including governments and quasi-government institutions in Zambia, Zimbabwe, Angola, Kenya, Botswana, Namibia and South Africa. This exposure gave President Sean Tembo a deeper understanding of the social, economic and political landscape of Zambia and the region.

7. In 2008, President Sean Tembo decided to take a short sabbatical leave from running his firm, to pursue a Master of Business Administration (MBA) Degree from the University of Derby in the United Kingdom, where he also graduated as the best student.

8. In 2015 at the age of 35 and after successfully running his firm, in three countries for more than 10 years, Mr Sean E. Tembo MBA, BAcc, FCCA, FCPA, FZICA, decided to partially retire from professional work. He now runs his firm, Enosyst AM on a part-time basis and also runs a hospitality establishment in Lusaka; Palm Valley Resort. He lives on a farm in Ngwerere, in the northern part of Lusaka City where he keeps broiler chickens with a maximum capacity of 60,000 per cycle. President Sean Tembo is happily married to Dr. Lorrita Kabwe, a Consultant Cardiologist at UTH and they have five children. He is a devoted Christian and his hobbies include fishing, safari hunting, playing golf, and is an avid gun collector. He also enjoys an occasional Mosi Lager in the company of good friends.

9. As a contribution to public service, President Sean Tembo has previously served in the Zambia Police Service, Lusaka Division as a Romeo, where he rose to the rank of Assistant Superintendent of Police, before leaving the service in 2013. Despite his limited financial resources, President Sean Tembo has also made several donations to various charities including the sponsorship of a 5 year programme to award cash prizes to best performing students every term at Hillcrest Technical Secondary School in Livingstone, as well as Gaborone Secondary School (GSS) in Gaborone, Botswana. These scholarship programmes, albeit small in nature, had the effect of motivating pupils to achieve higher levels of performance not only in the final grade 12 exams, but throughout their secondary studies.

10. After his semi-retirement at the age of 35 in 2015, and with plenty of time available on his hands, President Sean Tembo decided to contribute to the governance of Zambia by joining active politics. His initial plan was to join an existing political party which advances progressive ideas that have the potential to uplift the living standards of the Zambian people. After reviewing the plans, operations and democratic standing of existing political parties at the time, it soon dawned upon President Sean Tembo that he may have to consider starting a political party from scratch, as nothing that was available appeared tenable.

11. In February 2015, President Sean Tembo organized a number of other progressive Zambians and together they started the process of forming the Patriots for Economic Progress (PeP). The Patriots for Economic Progress (PeP) is a centrist political party that believes in a free market economy with partial Government intervention. The party was registered in the Republic of Zambia in 2016 in accordance with the Societies Act, Chapter 119 of the Laws of Zambia, and is also duly accredited with the Electoral Commission of Zambia (ECZ). On 18th November 2016, the Party went for a convention that was held at Mulungushi International Conference Centre (MICC), in Lusaka, where Sean Tembo was elected as Party President with a 5 year mandate until November 2021.

12. The Party’s four core values are Patriotism, Accountability, Competence and Courage. The Party’s vision is “to have a Zambia where the poorest person has an average monthly income of K10,000.00, inflation is below 5%, average commercial bank lending rates are single digit, the Gini coefficient is less than 0.1, Per capita income is above US$20,000, the least educated citizen has a full grade 12 certificate and Zambians having a life expectancy of not less than 80 years”. Sean Tembo strongly believes that Zambia has the necessary potential to make this vision a reality.

13. The Patriots for Economic Progress has been undertaking a number of activities to hold the PF government accountable, which include the fire tender protests of which 42 were planned and 12 have so far been undertaken. On 7th March 2018, the Police prevented the Party from undertaking its 13th protest against the $42 fire tender scandal, for no valid reasons. Mr Sean Tembo subsequently decided to take the Government to court, on behalf of PeP, under cause number 2018/HP/490, for violating the Party members freedoms, rights and liberties to association, expression and assembly as guaranteed by articles 20 and 21 of the Republican Constitution. President Sean Tembo personally represented PeP in this matter at the High Court, up against the entire Attorney General’s chambers. He won the case and was awarded a total of about K450,000 in damages and costs, which the PF Government has not paid to date. Ostensibly out of spite.

14. In addition to providing checks and balances, and unlike the majority of other opposition political parties that only point fingers, President Sean Tembo has ensured that the Patriots for Economic Progress has actively been providing alternative solutions to national problems and challenges. In this regard, PeP has so far developed and presented a PeP Alternative 7th National Development Plan, PeP Alternative National Budgets for 2016, 2017, 2018, 2019 and 2020 and is currently working on the PeP 2021 Alternative National Budget.

15. Among other key matters, President Sean Tembo has ensured that the Patriots for Economic Progress is financially self-sustainable so that it can maintain its independence and not become beholden to those individuals and interest-groups that might donate significant sums of money for its operations. To this end, the Party charges its members a membership fee of K60 per annum, except for those that are financially challenged, who are allowed to apply for a pre-approved waiver. As at August 2020, the party had more than 548,000 paid up members. Sean Tembo has also seen to it that the Party engages in a number of income generating activities through the sale of various pieces of regalia. In the 2019 financial year, the Party sold about 74,000 PeP branded t-shirts at K30 each and various other pieces of regalia is planned to be introduced to enhance the Party’s revenue generation capacity. These prudent financial measures have ensured that the Party always has adequate financial resources available to undertake its operations, as well as to build the necessary war chest in readiness for the 2021 general elections.

16. The PeP President believes that it is unreasonable for any political party to promise to come and run a financially sustainable government once they come to power when they fail to run their operations in a financially sustainable manner while in opposition. Sean Tembo will be contesting the Presidency of the Republic of Zambia in 2021 and he is expecting a very good performance. His running mate in the 12th August general elections is Mr Henry Muleya, a Lusaka Businessman and Chartered Accountant. President Tembo’s primary target group are the 5.5 million eligible Zambians that decided not to register and not to vote in the 2016 general elections because they did not believe in the leadership of either ECL nor HH. His plan is to offer himself as the reason why these 5.5 million eligible Zambians need to register and to vote in the 2021 general elections.

17. The Patriots for Economic Progress is currently inviting Zambians who wish to positively contribute to the governance of their nation to apply to contest in the 12th August 2021 general elections as either Members of Parliament, Mayors, Council Chairpersons or Councillors to apply before 20th April 2021 by submitting the following:
(i) Application Letter stating province, district, constituency and where necessary the ward;
(ii) Copy of green National Registration Card (NRC);
(iii) Copy of full grade 12 certificate with at least 5 passes and one credit or three passes and two credits or equivalent;

Only adopted candidates will be required to pay an adoption fee as follows;
(a) Member of Parliament = K1,000
(b) Mayoral Candidate = K1,000
(c) Council Chairperson = K500
(d) Councillor = K300

THERE’S KERFUFFLE OVER G12 REQUIREMENT…many people in our politics don’t seem to have it – M’membe

SOCIALIST Party president Fred M’membe says the constitutional provision of the Grade 12 certificate only goes to show the class nature, the elite domination of the Zambia society.

He says this is why this year, Zambians need to usher in a socialist government of the humble, by the humble for the humble.

In a statement, Dr M’membe noted that there was a mushrooming kerfuffle over the grade 12 minimum academic qualification required by the Constitution for one to stand as a councillor, member of parliament, council chairperson, mayor and President.

He noted that many people in the country’s politics do not seem to have the Grade 12 certificate.

He stated that in the 2016 elections there was a more loose or liberal interpretation of this constitutional requirement and it was easy to meet.

“Last week’s Constitutional Court interpretation made it very difficult for many people to meet this requirement,” he stated. “The literary interpretation of this constitutional provision given by the Constitutional Court doesn’t seem acceptable to many people. It seems to have produced an absurd result. The absurd result principle in statutory interpretation provides an exception to the rule that a statute should be interpreted according to its plain meaning.”

Dr M’membe stated that in an age of increasing debate about the proper approach to statutory interpretation, and of increasing emphasis on literal approaches, the absurd result principle poses intriguing challenges to literalism and to theories of interpretation generally.

He noted that the absurd result principle was extraordinarily powerful.

“It authorises a judge to ignore a statute’s plain words in order to avoid the outcome those words would require in a particular situation. This is a radical thing; judges are not supposed to rewrite laws. Ordinarily, such actions would be condemned as a usurpation of the legislative role, an unconstitutional violation of the separation of powers,” he stated. “Even when a genuine question exists about the actual meaning of the statute’s words, it is generally considered to be illegitimate for a judge to make the choice between possible meanings on the basis that the real-life result of one meaning strikes the judge as somehow objectionable. The absurd result principle apparently gives just that power and authority to a judge. Yet this principle enjoys almost universal endorsement, even by those who are the most critical of judicial discretion and most insistent that the words of the statute are the only legitimate basis of interpretation.”

Dr M’membe stated that the law could only work for people when laws were fair.

He stated that this grade 12 requirement, as interpreted by the Constitutional Court, had let people down.

He stated that majority of the people perceived the grade 12 requirement as outright unjust.

“This is an outright case of utilising improper means for the pursuit of an apparently legitimate goal. It has generated requirements that do not reflect the values of the underlying population,” Dr M’membe stated. “Today individuals are facing legal prohibitions that conflict with their sense of justice or fairness. Unjust laws like these can be opposed through protest. Social opposition to unjust laws may trigger social norms that can have countervailing effects on legal intervention.”

Dr M’membe stated that the inadequacies they were trying to address with the grade 12 requirement could have been dealt with differently. He stated that if there was a deficiency of language – English language – the solution was not to bar those not proficient in English but to allow them to use languages they were fluent in.

“Other things they don’t understand – economics, law, security – can be taught to them as they perform their duties as councillors, council chairpersons, mayors, parliamentarians or presidents,” stated Dr M’membe.

“This constitutional provision only goes to show the class nature, the elite domination of our society. This is why this year we need to usher in a government of the humble, by the humble for the humble – a socialist government. Only under a socialist government can we truly have justice, equity and peace.”

PURPORTED EXPULSIONS ILLEAGAL, IGNORE THEM – AKAFUMBA

The National Democratic Congress (NDC) party Acting President Rikki Joseph’s Akafumba on the 19:03:21 addressed a press briefing in Lusaka were he advised all party members allegedly expelled by the Kambwili fraction to ignore them with all the contempt it deserves.

Akafumba said, first of all let me address the issue of office bearers. I could not believe my eyes when I heard, Kabwita who is listed as a committee with announcements that there are only eight members who are registered with the registrar of societies and therefore the six of them meet and expelled two members the Vice President whose myself and the Secretary General Mrs Bridget Atanga, if that is correct that there are eight members at the registrar of societies, then it means NDC should be de-registered because for a party to exist you must have ten members, but that’s not the correct, NDC has full ten members who are registered with the registrar of societies and the senior most is myself followed by Hon Mwenya Musenge and followed by Bridget Atanga and that is the order. You cannot take away the argument that no Hon Mwenya Musenge left this and that. It does not hold any water, it’s the document that speaks, the print out that am showing you is a document that was printed on 3rd March 2021, showing all the ten NDC office bearers who are registered, so that’s the position.

Remember all political parties are registered by the registrar of societies and societies act, so this business of attempting to run political parties from the pocket or on the basis of a sole trader is in conflict with the societies act. Any meeting of the office bearers must be constituted by the Secretary General who should issue notices, this is not peculiar to political parties but in all meetings including board meetings, you cannot institute a board meeting without issuing notices, therefore you cannot call to order a meeting of office bearers without a notice, we have not received any notice, I consulted Mrs Bridget Atanga she had not received any notice, I phoned Hon Musenge him too has not received the notice and straight enough this meeting is being instituted by a very junior person called Kabwita a committee member purported to expel, President, a Secretary General and Deputy Secretary General, it does not work like that. As from the word go we have been in order, we have issued a notice for the meeting of the office bearers to be held on Tuesday 23:03:21 and we circulated the notice and it appeared in the mast newspaper on the 19:03:21, that’s the orderly way of doing things. Now because our colleagues are in panic mode, they can do anything, a drowning man can even hang on a grass in order to survive and that’s what they have reached. Said Akafumba

So all pronouncements made by Kabwita on behalf of the office bearers is null and void and we are going to ignore and we have ignored. As for Tuesday meeting, after having made the requirements of issuing a notice which himself Kabwita acknowledge, we are going to proceed, those who will not come, then they will bear the consequences what ever comes of that.

Why did we call the meeting for the office bearers, if you may want to know. We called the meeting for the office bearers in good faith, it was to find a way forward because of the where the party has found itself in, we called this meeting for the office bearers to come and chat the way forward, but our colleagues acting in bad faith, they did an ambush and just called six people or four and say we have expelled you, that one is of no consequence and we do not even want to waste time on it, said Akafumba

Lastly I want to advise my young brother Kambwili to be extremely very careful especially when it comes to do with matters of law and matters of registration of societies, because by your careless talk you are going to put the party in problems and the party can face de-Registration.

KAMBWILI FEARS JAIL…his apology to Lungu not genuine – NDC

THE National Democratic Congress says the apology to President Edgar Lungu by its former leader Chishimba Kambwili is not genuine and is a betrayal to the party and its membership.

In a statement yesterday, NDC spokesperson Franklin Membe said Kambwili’s apology to President Lungu, Valden Findlay and to the public on Thursday has not come as a shock to NDC and its interim president Josephs Akafumba.

He said the apology is a selfish strategy to betray NDC members for selfish motives.

“It brings to light what we have been saying all along that CK has not been truthful to the entire party and especially the top leadership comprising the NEC. NEC recently gave him a vote of no confidence after he openly and clearly rejected the decision of the Central Committee and the demands of the people of Zambia,” he said. “Zambians throughout the country demanded the opposition form an alliance to remove the oppressive PF hearse which is headed to bury Zambia with its citizens. The NEC saw way back that Dr Chishimba Kambwili had started to go on a course of betraying the people of Zambia. For a long time now, CK had been reluctant to conclude the alliance deal.”

Membe said Kambwili failed to justify his hate for the alliance, but that even with the suspicion the party gave him a benefit of doubt.

He said Kambwili alone was responsible for the delay of the signing of the electoral pact from January 2020 to February 2021.

“With less than two months before nominations, CK throws the Alliance into panic. The alliance had to cancel plans to register a neutral name for the alliance. With clear understanding that Hon [Stephen] Kampyongo’s home affairs ministry would put up barricades in the registration of a new Alliance name, we were left with no alternative but to unanimously elect to use UPND party as an alliance name,” Membe said. “Kambwili put up a very highly professional NEC team whom he could have consulted on the issue of his posterity with regard to his numerous court cases, convictions and PF demands that he joins them. His pride in believing that he knows everything kept him away from wise counsel. NEC knew way back that CK’s rejection of the alliance was not based on principle but on betraying members of the party.”

Membe said Kambwili’s fear of jail makes him a joker in the African political arena.

“Serious leaders ought to be prepared to go to jail, placing the nation above self. Right thinking NDC members are naturally a wounded lot. We have wasted three years of our precious time and resources with a leader whose mouth was far from his heart,” Mmembe said. “He betrayed not only his conscience but all members of NDC and the country at large. CK lied to all of us that he hates PF police brutality and yet he is embracing it. He lied to the world that he hated corruption and yet in his heart he loves it. He promised to raise the standard of living of Zambians but in his heart he is something else.”

He said in reality Kambwili is strengthening the hands of the wicked for selfish reasons.

“All those members who are full of insults and full of confusion have remained with him hurling insults on all of us, displaying their professional insulting skills against their opponent,” Membe said.

Membe said the fracas in NDC has separated those who follow Kambwili from those focused on carrying out the wish of the majority of Zambians “to dislodge the murderous, corrupt and reckless Unpatriotic front government”.

This guy was in prison for over 120 days and still was not broken. Others stay in prison for a few days and they are broken beyond redemption.

Have you noticed how the mines privatization issue always comes about during elections and this is the information that is fed to the masses of people. How many times has he defended himself over this issue. The fact that the courts have never summoned him on this issue sends a very strong signal that maybe umu boys is clean.

In terms of morality, I cannot lie, no current politician either in government or opposition has the strong moral standing like this guy. _Sembe enze che na gelo mu Chawama sembe nkhani inaapya zooona._ His members have been killed the most by bullets from the police force. He himself has been driven in the bush before running away from live ammunition from the forces that protect his political rival.

It has not been easy for him.

How many people have been hired to bring this man down sure? But he always comes out clean, this leaves his political opponents frustrated all the time. But the truth is he is just a human being, with feelings and fighting for a better Zambia. One day, he may throw in the towel and there will be no one to offer checks and balances, because at the moment, he is the only one who does so.

Whether he wins or not, his loss will not necessarily be his, it will be the loss of most Zambians who are languishing in poverty and get poorer each day.

He is quiet a rich and wealthy guy and has commands a good academic standing. So, you wonder what motivation is behind the impetus to make Zambia a more prosperous nation. Is it frustration, love for the country, patriotism? The truth is since he is a big shareholder in many businesses both in and outside Zambia, the economic performance of the country eventually also affects the performance of his businesses. Thus, if he can be the person controlling the economy, this implies he will eventually affect how profitable his businesses will perform.

He did not start out on a very good note but through the years, he has slowly been gaining momentum and is learning Zambian politics as it is. He has even learnt how to interact in other local languages including saying _amalumbo_ like, _“nakuchita ububi Ch*kala iwe”_ during campaigns.

He has had to fight the tribal mark, whether its true he is tribal or not, _kaya._ But many hate him for no apparent reasons. As such, the tribalism issue remains something that must be fought at all costs. It has destroyed relationships, opportunities and lives, yet it seems tribalism is very ok for most of our influential civic leaders.

It would not be a bad idea to let this guy hold the reigns of power, but the task is an almost impossible unless just God allows him to win. He has not received a favourable political space and may not actually receive any. What if we have been rejecting a person who actually can lead this country back to economic and socio-stability? Everybody deserves a chance. Or maybe he should just lose again so that we feel the almighty PF for another 5 years.

The choice is ours!!! But the truth is _MWE LESA, ABANTU BENU BACHULA MUCHALO ZOOOOONA!!!!_ Is this the Zambia our forefathers envisioned sure?
I know I will be in trouble again for writing this but its fine!!!

Ruling patriot front(PF) has continued losing it’s membership in kalulushi constituency and the latest one was in chibuluma ward were over 100 PF youths led by it’s commander joined opposition UPND.

Peter musonda and lister mwale bemoaned the high cost of living and the continued lack of jobs for the youths in kalulushi constituency. The former PF commanders who spoke seemly in anger questioned the desperation by PF officials who are buying voter’s cards and NRCs in the community at k200 each for reasons known to themselves.

In welcoming the defectors kalulushi aspiring candidate Joseph kahembi told the former PF youths that HH has a house with 17million bedrooms and each one of them has a room and a fair cake to eat come August this year. Kahembi also advised old members to continue recruiting new members.

US Secretary said Chinese activities in places like Xinjiang, Hong Kong, and Taiwan, as well as economic coercion of US allies, threaten the rules-based order

In a scathing attack on China over its activities in Xinjiang, Hong Kong, and Taiwan, as well as cyberattacks on the US and economic coercion of US allies, Secretary of State Antony Blinken on Thursday warned Beijing of respecting global order or face a ‘more violent world’.

Blinken made these remarks after meeting his Chinese counterparts – Wang Yi and Yang Jiechi in Alaska, a key first meeting after the Biden administration came to power.

Blinken said the US intends to defend the “rules-based order that maintains global stability” without which there would be “much more violence in the world”. He said that Chinese activities in places like Xinjiang, Hong Kong, and Taiwan, as well as economic coercion of US allies, threaten the rules-based order. He also denied these affairs to be ‘internal matters’.

“Our administration is committed to leading with diplomacy to advance the interests of the United States and to strengthen the rules-based international order… That system is not an abstraction. It helps countries resolve differences peacefully, coordinate multilateral efforts effectively and participate in global commerce with the assurance that everyone is following the same rules.

The alternative to a rules-based order is a world in which might makes right and winners take all. And that would be a far more violent and unstable world for all of us,” he said.
China’s increasing aggression in the East and South China Seas and human rights abuses against Uyghur Muslims in Xinjiang, designated as “genocide” by the US, has been condemned globally. Several countries have openly rebuked China for imposing repressive national security in Hong Kong and revamping the city’s electoral system.

Blinken had earlier called China “the biggest geopolitical test of the 21st century” and that President Joe Biden has vowed to “out-compete” with the country.

The US does not plan to shift from the tough position on Beijing taken by the former Trump administration, but Biden’s team plans to apply those tougher standards more effectively with the help of allies. “The games that China has played in the past to divide us or attempt to divide us are simply not going to work here,” CNN quoted an official as saying.

Blinken along with Defense Secretary Lloyd Austin had recently visited South Korea and Japan to emphasise US unity with its Asian allies, while also taking a tough stance on China for human rights abuses. The meeting came after Russia and China announced their own bilateral gathering next week, a diplomatic show of force, highlighting their growing cooperation.

THE Patriots for Economic Progress says the August 12 general elections present a unique opportunity for real change and not artificial change.

PeP leader Sean Tembo said real change is when the country moves from bad to good whereas artificial change is when the country moves from bad to worse.

“As Patriots for Economic Progress (PeP) we feel duty bound to warn the Zambian people that the 12th August general elections present a unique opportunity for real change and not artificial change. In 2011, the country experienced artificial change because we moved from a bad MMD government to a worse PF government. The Zambian people should not make a similar mistake this time around,” Tembo said, in a statement.

He specifically cautioned Zambians who might be under the illusion that voting for UPND and its leader Hakainde Hichilema would bring about real change and national progress.

Tembo said there was nothing in such a change and that the signs are written on the wall.

“But just for the sake of those who might be adamant about the reality that the UPND and its leader are incapable of bringing about the much needed real change and national progress, here are a few facts to prove this assertion,” he said.

Tembo said one of the main reasons why people want to remove the PF and its government is that they have failed to properly manage the national economy thereby resulting in high levels of unemployment, poverty and squalor.

He noted that the PF solution to Zambia’s ailing economy is to get an IMF loan, which they have been working on for some time now.

“Just like the PF government, the UPND and its leader Mr Hakainde Hichilema are proposing to get an IMF loan as a solution to the ailing Zambian economy, should they be voted into office on 12th August 2021,” Tembo said. “This means that there will be no change in economic management approaches between the current PF government and a potential UPND government. Mr Hakainde Hichilema intends to continue on the current PF government path of borrowing, despite himself acknowledging on several occasions that our current national debt levels are too high and not sustainable as evidenced by our recent two defaults. To put it simply, a Hakainde Hichilema presidency will not bring about anything new in terms of how the Zambian economy is being run, and the existing levels of unemployment, poverty and squalor will continue unfazed.”

He argued that the UPND and its leader Hichilema represent artificial change similar to what the country got in 2011.

Tembo said another reason why Zambians would like to replace the PF government was their high levels of incompetence and failure to properly manage the general affairs of the nation.

He however said there was no evidence on record that indicates that a potential UPND government would properly manage the affairs of the nation in a competent manner.

Tembo said available evidence suggests that a UPND government would just be as incompetent and corrupt as the current PF government.

“For example, UPND-run local authorities (councils) in Southern, Western and North-Western provinces are just as dilapidated and financially unsound as PF run local authorities, with huge salary arrears to their employees,” he said. “This is despite the large revenue-earning potential that a local authority has, with revenue streams such as land rates, billboard advertising, personal levy, trade licensing, garbage collection etcetera.”

Tembo said opposition political parties in other countries are able to demonstrate that they are more competent than the ruling party.

“A case in point is South Africa where the opposition Democratic Alliance (DA) run Western Cape Province outshines all other ruling ANC run provinces in terms of facilities, cleanliness, financial soundness, etcetera,” he said. “The excuses which the UPND and its leader Mr Hakainde Hichilema are making today for failure to competently run UPND controlled local authorities in Southern, Western and North-Western provinces are the same excuses that they will be making to the Zambian people for failure to turnaround the ailing Zambian economy three years from now should Zambians make the mistake that they made in 2011 to vote for artificial change.”

Tembo said people would like to replace the PF government because of high levels of political violence perpetrated by its cadres.

“Similarly, the UPND’s appetite for political violence is well documented and evidenced by the Mapatizya formula as well as the decision by the UPND leader to appoint a well-documented political thug in the UNIP and MMD era, Mr William Tekere Banda as a senior UPND party executive official,” he said. “This means that at the earliest opportunity, a Hakainde Hichilema presidency intends to use political violence as a tool for succumbing his political opponents. Instead of real change, the Zambian people would simply be substituting the current green clad PF cadres for red clad UPND cadres in the perpetuation of political violence.”

Tembo said the fact that Hichilema would rather appoint ailing senior citizens in their late 80s such as Dr Guy Scott and William Banda to his party’s executive committee, at the expense of young vibrant youths who are the future of the nation, means that he has no real regard for youths and is only romancing them for purposes of enticing their vote on August 12.

He hopes the youths are smart enough to see through the irony of Hichilema’s contradictions and “not buy into his lie of pro-youth and its facade of Bally”.

“Only a youthful Republican president can ably and sincerely advance the interests of youths in this nation,” said Tembo.

I’M READY TO CHALLENGE PRESIDENT LUNGU FOR THE POSITION OF PF PARTY PRESIDENT AT THE VIRTUAL GENERAL CONFERENCE SLATED FOR 10TH AND 11TH APRIL, 2021.

Following the announcement l made in February last year 2020 to challenge the incumbent PF party President Dr. Edgar C. Lungu for the Position of PF Party President, l wish to take this opportunity to reiterate my resolve and commitment that Come 10th and 11th April next month, my name will surely appear On the PF Presidential Ballot paper.

Often times questions pop up from some of my followers asking me about the reasons that have motivated my burning desire to Challenge the incumbent ECL at the convention .

My response to these questions is very simple and l state. It is abundantly clear in my mind and the minds of many other well meaning Zambians that the reasons that have motivated me to enter the race and contest with the incumbent are overwhelming and too numerous to itemise but will for now focus and concentrate on the three most important reasons listed in order of priority.

And to tackle these questions, l wish to briefly and categorically explain to the nation the three main reasons why l courageously decided to enter the race and contest with the incumbent and these are issues l feel deep inside my heart that l can perform exceedingly better than what President Lungu has done so far both in the party PF and Government and these are;

1. The Fight against corruption – The corruption cases in Zambia have now reached alarming levels that we would no longer call corruption but the best term to use could be public funds embezzlement, money laundering and outright theft. To genuinely fight this scourge, when lm elected as both party President and Republican President, Zambians please mark my words and rest be assured that l will bring back the good and uncompromised UNIP economic sabotage watchdog called SITET [ Special Investigation Team for Economy and Trade] Yes there some of brilliant and progressive UNIP policies that were abandoned by the FTJ MMD government for their selfish gains that we will definitely resuscitate.

2. Discipline both in the party and Government – When you look at the prevailing situation in our country today any meaningful Zambian would agree with me that there is total breakdown of order and rule of law in our country. Just look at the way unruly the so called PF cadres have become in this country today and quick to mention that not only PF cadres but also UPND cadres. So immediately l take over the leadership of both the PF and government as President , l will ensure that discipline is instilled with the sense of speed. And also quick to mention that under my leadership as President of this country, is the only one that can unite this country which is currently divided into tribal and ethnic groupings into truly one Zambia one nation state.

3. Change of Governance system. All these prevailing problems Zambians are facing and complaining about today, can only be resolved by the change of Governance system which we currently have in our country of heavy centralised system of government . Under my leadership as President come August 2021, just after being sworn in as Republican President, we will immediately embark on Constitutional reforms that will see the transformation of Governance system from the current heavily centralised system of government to a Federal system of government and this will be done without comedy it shall be by executive order within 90 days of our leadership and ofcourse will be subjected to approval and ratification by the two thirds majority of Members of parliament.

KAMBWILI’S APOLOGY NOT GENUINE AND IS BETRAYAL TO NDC AND ITS MEMBERSHIP

Dr. Chishimba Kambwili’s apology to President Lungu, Mr Findley and to the public has not come as a shock to NDC and it’s President JR Akafumba. It’s not a genuine apology but a selfish strategy to betray NDC members for selfish motives.

It brings to light what we have been saying all along that CK has not been truthful to the entire party and especially the top leadership comprising the NEC. NEC recently gave him a vote of no Confidence after he openly and clearly rejected the decision of the Central Committee and the demands of the people of Zambia. Zambian throughout the Country demanded the the opposition form an alliance to remove the oppresive PF hearse which is headed to bury Zambia with it’s citizens.

The NEC saw way back that Dr. Chishimba Kambwili had started to go on a course of betraing the people of Zambia. For a long time now, CK had been reluctant to conclude the alliance deal. He clearly failed to justify his hate for the alliance. Even with this suspicion we gave him a benefit of doubt. CK alone is responsible for the delay of the signing of the electral pact from January 2020 to February 2021. With less than two months before nominations CK throws the Alliance into panic.

The alliance had to cancel plans to register a neutral name for the alliance. With clear understanding that Hon Kampyongo’s Home Affairs ministry would put up barricades in the registration of a new Alliance name, we were left with no alternative but to unanimously elect to use UPND party as an alliance name.
Kambwili put up a very highly professional NEC team whom he could have consulted on the issue of his posterity with regard to his numerous court cases, convictions and PFs demands that he joins them. His pride in believing that he knows everything kept him away from wise counsel. NEC knew way back that CKs rejection of the alliance was not based on principle but on betraying members of the party.

His fear of jail makes him a joker in the African political arena. Serious leaders ought to be prepared to go to jail, placing nation above sellf. Right thinking NDC members are naturally a wounded lot. We have wasted 3 years of our precious time and resources with a leader whose mouth was far from his heart.
He betrayed not only his conscience but all members of NDC and the country at large. CK lied to all of us that he hates PF police brutality and yet he is embracing it, he lied to the world that he hated corruption and yet in his heart he loves it. He promised to raise the standard of living of Zambians but in his heart he is something else.

In reality he is strengthening the hands of the wicked for selfish reasons.
Surprisingly this shake up in NDC has been used by God to separate goats from sheep. All those members who are full of insults and full of confusion have remained with him haulling insults on all of us displaying their professional insulting skills against their opponents.

The fracas has separated those who follow CK the man no matter how he betrays them from those focussed on carrying out the wish of the majority of Zambians to dislodge the murderous, corrupt and reckless UNPATRIOTIC FRONT Government.

If Zambia descends into large-scale political unrest after the 12 August 2021 general election, there are three major factors that would have driven the country to that outcome. These include the public’s increasing lack of trust in (and outright contempt for) formal institutions – like the Judiciary, the Electoral Commission of Zambia and the police – as arbiters of the contest between those who wield state power and those seeking to acquire it.

Another is a high-stakes election featuring two ruthless groups of political elites. One wants to perpetuate its stay in power in order to continue accumulating and to escape possible prosecution and imprisonment. The other seeks to win power to prevent a crushing end to its members’ political careers. Leaders and supporters of both groups see the August election as a matter of life and death and are likely to violently rebel against an outcome that does not favour them – especially if it lacks credibility.

What has emboldened these two factors is the third: the incriminating silence of international, mainly Western, institutions and actors who once spoke out against human rights violations and murderous attacks on democracy and exercised some kind of leverage on the actions of the political elites in power. A key reason for this quietness is the decline in funding to Zambia from major world powers. For example, the United Kingdom, as part of its post-Brexit foreign policy centred on developing close ties with South East Asia, has ‘deprioritised’ all but a few African countries, and Zambia has seen a 70 percent reduction in UK funding this year alone. These huge cuts in support might explain the diminishing influence of the UK and other Western powers on governance issues in Zambia.

At the heart of why Zambia may burn, however, are the first two factors. These have been greatly shaped by the reprehensible actions of President Edgar Lungu’s authoritarian regime, which has:

  1. made a mockery of Zambia’s democratic tradition and effectively eliminated constitutional and lawful means of political competition for the occupation of government.
  2. effectively destroyed the vestiges of autonomy in all state institutions outside the executive arm of government for the purposes of establishing an authoritarian regime and a slide into a fearful dictatorship. The President has carried out this task with considerable ease, impunity and skill, employing a line of political rhetoric and well-concealed hypocrisy that went unrecognised until it was far too late.
  3. loaded the courts with loyal judges.
  4. turned the police into a political tool to be unleashed on critics and political opponents and armed it to the teeth.
  5. collapsed the economy, turning millions of Zambians into fearful beggars easy to corrupt and bribe.
  6. deeply polarised Zambia on ethno-regional and political lines.
  7. weakened the trade union movement to a point of rendering it useless to the working class.
  8. generated mass youth unemployment, massively grown prostitution, youth dependence on alcohol and drug abuse, swelled the ranks of street kids and orphans, exploded the statistics of violent crimes, increased youth remand and imprisonment, and produced a generation of young people without hope eager to be deployed for political violence.
  9. paved the way for bribery and corruption to thrive on a widespread scale and to destroy even the moral fibre of the leaders of the Church, many of whom have been converted into party cadres.
  10. destroyed some and weakened and intimidated most of the private media.
  11. used sustained neglect, financial strangulation and bullying to turn public universities led by the University of Zambia into upgraded secondary schools and ghost institutions.
  12. created a new, dubious voters’ roll to make it nearly impossible for Lungu to be evicted from government through elections.
  13. enacted a punitive cybercrime law to police the use of social media, legalise spying on citizens and arrest free speech.
  14. recreated “party cadres” as the informal police out to terrorise citizens who do not toe the line or identify with the wishes of those in power. These cadres have become perfect tools for the corrupt and violent political elites to deploy against their political opponents. Sadly, mass unemployment provides an endless supply of desperate, impoverished youths as “party cadres” for the violent political elites to deploy as they see fit.
  15. stockpiled weapons to kill potential protesters in the event of a flawed election outcome.

The net result is a country waiting to explode because of collapsing institutions, deep polarisation, mass poverty, intolerable levels of unemployment, extreme inequalities, restless violent party cadres, and desperate political elites. In this context, a flawed outcome of the 12 August 2021 election may turn out to be the spark that lights the simmering discontent. The risk of unrest is greater in urban areas such as Lusaka and the Copperbelt where the effects of economic decline are more acute. What we have before us, in short, is a powder keg, a bomb, being primed to explode. The good news is that this horrible potential fate for Zambia is not inevitable. We need to intervene and interrupt this equation. It can be done.

By we, I mean ‘we the people’ – particularly those in whose heads and soul the pitiful state of our subhuman existence has struck a chord; a movement, a mass movement of anger critical of any “saviour” dressed in any of our typical political clothes. We need to reclaim our agency in our own cause, our own liberation from oppression, domination and exploitation. I recognise that this is a tall order considering that we are now thrust too deep in narrow ethnic, regional and political identities to come anywhere close to being a ‘people’. But we must rise above these confines and unite to ensure the that drivers to the post-election violence as elaborated above have been sufficiently dealt with. Otherwise, we must wait for the rivers of blood and broken skulls. How can we avert this nightmare, this painful and disastrous fate?

The first step is to stop Lungu from securing an unconstitutional third term in office. The governing Patriotic Front and the Constitutional Court have the responsibility to do so and help prevent the dangerous slide into chaos. The next step would require us to confront the question of a successor to Lungu. If the status quo is a nightmare, the challenge is how do we wake up from it? I come from a background where to be against wrong is to stand for what is good, but what is good must be created or named.

This would require us to objectively and honestly examine the manifestoes, policies, internal democratic cultures and practices, and the quality of leaders of all existing political parties and measure them against how far they promise to take us away from the status quo that has reduced us to rubble. We owe this exercise to ourselves. I do not subscribe to only saying “no more” to something without at the same time saying “yes” to what must replace it. Without this dialectical thinking and practice, we are condemned to always lurching from one horrible political experiment to another. This is not the way.

No matter how unpopular and weak the alternative to the status quo is, it remains its alternative. It is the duty and full responsibility of a genuine and progressive individual to be fearless and think about practical, better alternatives that could move us beyond the current dependent economic system – with its roots in our colonial capitalism – which breeds the likes of Lungu in the first place and a pathetically timid, apathetic and impoverished population. Anyone who seeks to consolidate this system must be fought against with the tenacity of a wounded tiger.

I feel sad to see how some people are struggling to understand the former NDC interim President. As far as we are concerned, he has made a very brilliant move for himself and his family. Any reasonable parent and husband would do that. If I may ask,What do you want him to do/say to the Zambian people? Anyway, you need political discernment to understand this.

Our brother has been having very serious cases which took him to prison for a month and currently surviving on an appeal. An appeal is not an acquittal. This is too dangerous for him and his family. I remember him issuing out a statement to complain that Zambians kept quiet when he battled it alone. He has a family to look after.We all know that if he supports the PF then his cases will be dropped, If he supports the Alliance he will straight go to prison. Between the two, I can also choose my freedom. Boma in boma bane. Bare with him for once. Kuti mwaletelela umunenu. Politics in Africa are very dirty.

Not long ago, CK complained about being fixed in terms of businesses, legal charges and finances, of which he is okey now as we speak. You will notice that all the right thinking NDC members have given CK space because the battle he is in is not a small battle. The PF Government has promised him freedom if he disturbilises the Alliance. This we all know. If I were CK I would go quiet and avoid unnecessary entanglements politically. There is still hope for him in future and not now the way things stand.

Our support for the Alliance is not in anyway a betrayal to CK. Himself knows this. Are you telling me that the whole MCC members; the acting President Mr Rikki Akafumba who has always stood with him throughout his court sessions, the SG madam Atanga, the National Chairman Fr Luonde, Roan MP hon Chishala, acting Veep and former spokes person for CK Mr Edward Mumbai, King G and almost all the structures countryside all hate our brother? Not really! He is our brother and we do sympathize with him except We do not agree with him on the Alliance. We are not worried in anyway because we know that many people take time to understand legal matters.

I feel for the blind followers who are in the dark. Our message for now is that let’s give people enough time to understand the current happenings. I am also happy to announce that a lot have come on board and are fully supporting our timely decision to rally behind the UPND Alliance. Yesterday the 19:03:21 when the National Democratic Congress (NDC) Acting President Rikki Josephs Akafumba held a press briefing in Lusaka on reaction to the meeting held in Luanshya by Kambwili’s illegal fruction, the NDC leader Akafumba said the apology that was rendered by Honourable Kambwili, was taken as a personal apology and of cause bearing in mind that Dr Kambwili is facing a number of charges, two which are on defence level and the other one is coming up for a case to answer.

Akafumba further said, only human being made of flesh and blood bend. That apology that was made was made for his own survival and we want to leave it at that.

As NDC we have not as a party asked Honourable Kambwili to live like Nelson Mandela who refused to denounce violence and choose to go to the gallows for the sake of his people and for what he believed. We are also not asking him to be like President Hakahinde Hichilema who was facing treason charges, whose net result was for him to be hanged and stayed in prison for 127 days for what he believed was right and that he did not commit any offence, he was given an opportunity to apologize but he refused, we are not asking him to do that because the “bar” maybe to high for him. We appreciate and it’s our wish that the powers that be may listen to him and accord him what he wants. But as a party in a nutshell we take that as his personal apology and it has very little and nothing to do with us.

The followers of NDC followed Honourable Kambwili and took what ever he said as gospel truth and as a result of following what he was saying, some of the members have even died, in the cause of following a leader who they believed his word was coming from his heart but to the contrary, they were all wrong.

Lastly going forward, I would like to appeal to you the press to be extremely careful when reporting what comes from Honourable Kambwili, because it may land you in problems, therefore even the general membership of NDC and followers please be on the look out and take extra caution in what comes out of the mouth of once (IMBWILI) which has changed its colors.

Zambia ‘may burn’ in absence of credible polls, warns Sishuwa

SISHUWA Sishuwa has warned that the country may burn after August 12 if the elections will not be credible.

In his reflections, Dr Sishuwa, a senior research fellow in democracy at the University of Cape Town in South Africa, says President Edgar Lungu and team have removed lawful means of competing for power.

“My worst fear is that with collapsing institutions, a collapsed economy, a deeply divided society and an impoverished population, Zambia may burn after 12 August in the absence of a credible election. It is the nagging idea that it is the violence which may deliver victory to any of the main political elites vying for State House, not votes,” he said. “Whether the country can endure this without civil war is another matter only our future can determine. What is not in dispute is that Zambia is a powder keg, a bomb, being primed to explode. This is because President Edgar Lungu and his friends in power have effectively eliminated constitutional and lawful means of political competition for the occupation of government…”

He highlighted other deficiencies President Lungu has brought on the country’s governance system.

“…loaded the courts with loyal judges; turned the police into a political tool, and armed it to the teeth; made a mockery of Zambia’s democratic tradition and reduced supposedly independent state institutions (ECZ, ACC, DEC, etc.) into toothless branches of the party in power to be unleashed on critics and political opponents,” Dr Sishuwa added. “…collapsed the economy, turning millions of Zambians into fearful beggars easy to corrupt and bribe; deeply polarised Zambia on ethnic and political lines; generated mass unemployment and weakened the trade union movement to a point of rendering it useless to the working class.”

He said President Lungu’s administration has generated mass youth unemployment, and has massively grown prostitution.

Dr Sishuwa said the current government has also promoted youth alcohol and drug abuse, swelled the ranks of street kids and orphans, among other vices.

“…exploded violent crimes, increased youth remand and imprisonment, and produced a generation of young people eager to be deployed for political violence; paved the way for bribery and corruption to thrive and destroy even the moral fibre of the leaders of the Church and converted some into party cadres,” Dr Sishuwa said. “…destroyed some and weakened and intimidated most of the private media; used sustained neglect, financial strangulation and bullying to turn public universities led by the University of Zambia into upgraded secondary schools and ghost institutions.”

He observed that President Lungu has also created what he termed a dubious voter’s roll to his advantage.

Dr Sishuwa added that the Head of State has also turned PF cadres into State police.

“…created a new, dubious Voter’s Roll to make it nearly impossible for Lungu to be evicted from government through elections; enacted a cybercrime law to police social media,” he said. “…recreated party cadres as the informal police out to terrorise citizens who do not toe the line or identify with the wishes of those in power. With mass unemployment and widespread poverty, both in our urban and rural areas, ‘party cadres’ given birth to and grown during the Kaunda era, matured under Chiluba and have now become perfect tools for our corrupt and violent political elites to deploy against their political opponents.”

He noted that sadly, mass unemployment provided an endless supply of desperate impoverished youths as ‘party cadres’ “to our violent political elites for use as they see fit”.

Dr Sishuwa charged that the PF government has also “stockpiled weapons to kill potential protesters in the event of a flawed election outcome”.

“A cocktail for civil war has thus been brewed: mass poverty + a restless violent party cadre + rigged elections + desperate political elites + collapsed government = Civil War. This is the dangerous end to which Mr Lungu and his friends are taking the country,” he warned. “It is not inevitable; there is no fatalistic reasons why it must actually take this route, our history. We need to intervene and interrupt this equation. It can be done. By we, I mean, the people, a movement, a mass movement of anger critical of any ‘saviour’ dressed in any political clothes.”

He called for a reclaim of people’s civil and political rights, adding that the country was founded on democratic principles.

“We the people need to reclaim our agency in our own cause. I recognise that this is a tall order considering that now we are thrust too deep in narrow ethnic, regional and tribal identities to come anywhere close to being a people,” said Dr Sishuwa. “But we must rise above these confines and unite. Zambians, unite! Otherwise, we must wait for the rivers of blood and broken skulls. How can we avoid this nightmare, this painful and disastrous fate?”

Lungu’s love for me is immeasurable – Chitotela

THE amount of love that President Edgar Lungu has for me is immeasurable, says tourism and arts minister Ronald Chitotela.

Featuring on MUVI TV’s national matters programme, Chitotela recalled that when people called for his blood following his arrest on corruption charges and concealing property suspected to be proceeds of crime, President Edgar Lungu stood with him and believed in his innocence.

He said he has vowed to give reciprocal love and loyalty to President Lungu whom he said risked his popularity not to heed to people’s call to fire him when he was arrested.

Chitotela was acquitted by Lusaka magistrate David Simusamba on July 11, 2019.

“This is the man who was social booed, who was humiliated, who was called a criminal and then the President Lungu risked his popularity by standing with me. He believed in my innocence…surely that level of love, that level of trust that the President expressed to me it immeasurable. People called for my blood, people demanded that President Lungu must sack honourable Chitotela but he had evidence and the only thing he didn’t want was to interfere with the legal process. He said ‘I will give you the support’…tried, taken to court and proven…” he said. “…Because I took an indictment to him that look I have been arrested for things that I became a minister in the Ministry of Works and Supply, the indictment is there and even on Radio Phoenix I repeated yesterday that the biggest problem is that we don’t want to follow facts. I was charged for things that happened in the Ministry of Works and Supply between 16th January 2016 and 29th June 2016. I was busy in Pambashe campaigning and my substantive ministry was Ministry of Youth and Sport as deputy minister. Surely he looked at that and said I will not interfere, those words he told me and said go to court, let them prove.” Chitotela recalled that out of certain people’s desire to soil his reputation there was an allegation of him having stashed millions in Dubai in offshore accounts but all that was not true.

He said the Auditor General and the Anti-Corruption Commission on several occasions undertook investigations at the Ministry of Housing and Infrastructure to find him with a case to but that all that drew a blank.

Chitotela said President Lungu has had a soft spot on him because he is “clean like a one-day old baby”.

“The President knew that Chitotela was arrested for things that happened before he became a minister. How do they arrest me for things that happened between 16th January 2016 and 29th June 2016 when I was deputy sports minister?” he wondered.

Chitotala vowed to quit politics if President Lungu does not contest the 2021 general elections.

“People pressed him to say no maybe it was a tactic that if you frame him up the President will fire him the following day or maybe to kick Chitotela out of the political space. Then the President said no, ‘I lost Kambwili in a similar circumstance. If this man is guilty as charged take him to court and prove it’. I know even you, media houses, booed President Lungu,” he said. “I was booed and called names. He stood with me, obviously the reciprocal type of relationship I must give back is unquestionable loyalty. Unquestionable loyalty that even if he is sleeping he must be comfortable that I have somebody that can stand by me, and I stand by that. It is not just you that I told, even him I told him that Sir, if you chose to (retire) I am also going. Nkalaisa ku farm, bana Lungu balesalula imbalala tulelya (I will be coming to the farm and Mrs Lungu will be roasting groundnuts for our consumption).”

Chitotela said there must be people in Zambia that live by their words and mean what they say.

He said he intends to be among the few that will be counted that he said something and lived by it.

Chitotela said he did not join politics for personal gain but to sanitise the way politics is done.

And Chitotela said he was motivated to join politics during the time of Mundia Sikatana, Dr Brian Chituwo and Felix Mutati, among others, whom he saw debate on national issues in parliament devoid of emotions.

“I believe that politics is not about name calling, insulting, victimising and deceiving people but integrity. I am a Christian and have stated even on other platforms that it not easy in the Seventh Day [Adventist] and a serving elder to be elected. I was elected as member of parliament in 2011, I was a serving elder at Buchi Adventist Church in Kitwe and records are there,” said Chitotela.

Putin reacts to Biden after Accusing him of Being a killer

Russia’s President, Vladmir Putin has reacted to US President Joe Biden calling him a killer and saying that he would “pay a price” for 2020 US election interference.

When asked about Biden’s comments during a video call on Thursday March 18, that was aired on Russian state TV, Putin said he wished his counterpart in Washington good health and was saying that “without irony”, but charged that the comments reflected America’s own troubled past.

The Russian leader who praised the American people, said the legacy of slavery and the country’s treatment of Native Americans weighed heavily on its dealings abroad. He added that for Biden to call him a killer, it takes one to know one.

Putin said;

“In the history of every people, every state, there are a lot of hard, dramatic and bloody events. But when we evaluate other people or even other governments, we always look as if into the mirror. We always see ourselves in it.

“I remember when I was young and I got into fights with my friends, we always used to say ‘whoever calls names is called that himself.

“It takes one to know one.

“And that’s not just a children’s joke. The meaning is quite deep psychologically. We always see our own qualities in another person and think that he/she is like ourselves. And coming from that, evaluate his/her actions and evaluate him/her overall.

“As he [Biden] said, we know each other personally. What would I reply to him? I would say: I wish you health. I wish you health. I say that without any irony or joke.”

Konstantin Kosachev, Deputy Chairman of the Russian parliament’s upper house, had also said that Moscow would likely take further steps “if the American side does not offer an explanation or apology”.

Kosachev said Biden’s comments “were not acceptable under any circumstances” and sent any hopes of an improvement of relations under the new administration “down the drain”.

Russia also recalled its ambassador to the United States on Wednesday for “consultations” just hours after Biden’s remarks, which the Kremlin later said were “very bad” and without precedent.

Law Association of Zambia (LAZ) has backed the recent constitutional court ruling in the 2019/CCZ/005 case.

And LAZ says it expects the constitutional court decision will be adhered to without any exception.

Meanwhile the legal body has welcomed the Electoral Commission of Zambia confirming its intention to strictly follow the prescription set out by the Constitutional Court.

LAZ has further called upon all aspiring candidates from across the political divide who do not possess a grade twelve certificate as defined by the Constitutional Court to steer clear from attempting to file nomination papers for the election as Member of Parliament as they will be doing so in breach of the Constitution of Zambia.

Below is the full statement

According to Article 70(1)(d) of the Constitution of Zambia as amended by Act No.2 of 2016, a person is eligible to be elected as a Member of Parliament if that person has obtained, as a minimum academic qualification, a grade twelve certificate or its equivalent.

The Law Association of Zambia (LAZ) has noted the recent decision handed down by the Constitutional Court of Zambia in the matter between BIZWAYO NEWTON NKUNIKA v LAWRENCE NYIRENDA AND ELECTORAL COMMISSION OF ZAMBIA – 2019/CCZ/005, in which the Constitutional Court defined the phrase “Grade twelve certificate or its equivalent.”

The Constitutional Court declared that the term “Grade twelve certificate” employed in Article 70(1)(d) of the Constitution means the same as a School Certificate.

The Court went on to declare that the word “equivalent” to a grade twelve certificate relates to qualifications that are of similar value to the school certificate and should neither be inferior nor superior to the said school certificate.

The Court also elucidated that a General Certificate of education (GCE) is equivalent to a grade twelve certificate if the number of subjects passed and the grades obtained satisfy the requirements of obtaining a school certificate.

LAZ notes that the Constitutional Court declared that a tertiary, vocational, craft, trade or apprenticeship certificate is not equivalent to a grade twelve certificate.

It is the expectation of LAZ that the decision of the Constitutional Court will be adhered to without any exception.

LAZ welcomes the press statement from the Electoral Commission of Zambia confirming its intention to strictly follow the prescription set out by the Constitutional Court and calls upon all aspiring candidates from across the political divide who do not possess a grade twelve certificate as defined by the Constitutional Court to steer clear from attempting to file nomination papers for the election as Member of Parliament as they will be doing so in breach of the Constitution of Zambia.

LAZ also calls upon the Examinations Council of Zambia to diligently examine qualifications prior to certifying them as legitimate. Our very democracy leans heavily on the need for the law to be observed in the election to office of Members of Parliament.

Zambia’s External stands at $ 12.74 billion, and not $ 27 billion-Ministry of Finance

The government has said that Zambia’s external debt remains at 12.74 billion dollars, contrary to claims that the debt was 27 billion dollars as of 2019.

The Ministry of Finance said that the 12.7 billion dollars was as of end of December 2020.

A statement availed to to the media by the Ministry in Lusaka today said that some media reports made the 27 billion dollars debt claim, following a misrepresentation by the World Bank’s International Debt Statistics published in October 2020.

The statement noted that the 27-billion dollars debt refers to all external debt including debt held by the private sector such as mining companies, banks, and other corporates which government is not in charge.

The Ministry notes that government has no liability for debt held by the private sector, adding that the World Bank’s report makes it clear that government external debt was around 11-billion dollars in 2019 similar to what the government reported.

The Ministry further noted that Zambia engaged in positive and constructive virtual talks with the International Monetary Fund earlier this month, making clear progress towards an agreement on a policy package and path to fiscal and debt sustainability.

The statement further stated that the country hoped the current engagements with various multilateral stakeholders will contribute to its goal of restoring public debt sustainability.

Meanwhile. ZCCM-IH Chief Investments Officer Brian Musonda has said that Mopani Copper Mine (MCM) will significantly contribute to Zambia’s economic revenue, now that the mine is in the hands of Zambians, adding that the mine will have something to show to the nation as positive things will be actualized.

Speaking during Radio Icengelo programme in Kitwe yesterday, Mr. Musonda said that ZCCM-IH working with Mopani management have worked on a strategy to turnaround the mine and make it profitable and that ZCCM-IH financials show that under Glencore the mine has been recording losses since privatisation.

Mr Musonda said that Zambians who have been operating the mine since April last year are upbeat about growing the company and will ensure it is run professionally.

Mr Musonda said that ZCCM-IH management is optimistic that things will be handled well by the Zambians.

“We are very sure that something positive will come out from Mopani because Zambians will ensure that the mine contributes something to the country,” Mr. Musonda said.

“Mopani will continue to produce results and we will give them support as shareholders, the performance of Mopani has improved and the financial status of the mine is encouraging,” he said

The acquisition will result in ZCCM-IH taking full ownership of Mopani. The transaction is scheduled to be fully consummated by 31 March 2021 after the ZCCM-IH Extraordinary general meeting on 30 March 2021 in which ZCCM-IH shareholders will vote on the transaction.

FOREIGN Affairs minister Joe Malanji on Sunday threw diplomacy to the wind, telling off the opposition that State House is not a toilet for one to ask President Edgar Lungu to come out so that they can enter.

Malanji was addressing PF members at Livingstone Lodge.

He urged party members not to be cheated by the opposition.

Malanji also appealed to PF members to start mobilising the party because: “You need an MP who is equal to the task and has organisational abilities and can engage the community and business houses.”

He said instead of 40 years, Zambia has had four presidents in a short space of time.

Under the Constitution, a president in Zambia can only serve two five-year terms of office.

“President Edgar Lungu is getting back into State House…wina akamba ati chooka ningenemo, ni mu toilet? Ngati wadwala diarrhoea sakila toilet inangu (someone is saying ‘come out so that I enter’; is it a toilet? If you have developed diarrhoea, look for another toilet),” said Malanji.

And PF member of central committee Kebby Mbewe threatened to push for the dissolution of Livingstone PF structures following confusion over the adoption of a parliamentary candidate that has led to divisions in the ruling party.

Mbewe said the PF would send independent people to help in the selection of a parliamentary candidate.

“President Edgar Lungu is winning whether there is an MP or no MP. Therefore, we don’t expect the district to be divided because of candidates. You structures I want to warn you as MCC, don’t divide the party. These candidates found the party and they will leave the party otherwise you will force us to dissolve you,” Mbewe warned.

He said the PF in 2016 paid the price because of confusions over a candidate.

“Independent people will tell us who the people want. If you want us to sideline your recommendations, continue doing foolish things,” Mbewe said as a PF cadre shouted “go deeper”.

He warned that officials profiting from aspiring candidates were slimming the chances of candidates being adopted.

“You already did your adoption process at district level, yours now is to keep quiet. Even if you go to Lusaka to see ba Yamfwa [Mukanga], ba [Joe] Malanji or ba Kampyongo, the first MCC they will call is me. You are wasting your time, us we are going to put a candidate that the people of Livingstone want,” said Mbewe.

And Mr Imenda says the Party is aware of issues affecting Zambians especially youths who despite having skills and education attained have been left on the streets without jobs.

Speaking during the press briefing held at the party Secretariat this morning, Mr Imenda said testimonies by youths and retirees are real and need a government that has the interest of people at heart .
” President Hakainde Hichilema’s experience in politics has revealed his dream and vision to serve the people of Zambia and protect the country’s economy from total collapse.

Mr Imenda, after welcoming ambassadors of change expressed sadness that the hard economic tide in the country has forced majority of youths to abuse of alcohol and drugs.

He told the youths that President Hichilema did a lot as a youth because government at that time facilitated and created a conducive environment for him to develop his career.
” He feels indebted to the people of Zambia and therefore wants the youths to have the same opportunity he had when he gets into office.” said Mr Imenda.

He assured the youths that hope and help was on the way and that President Hichilema was more than ready to deliver the country from suffering and misery.

“To the youths, don’t despair because Bally, our Moses, is coming to give you quality education and health care.Those with skills will venture into entrepreneurship while graduates will have jobs after their training,” he said.

Mr Imenda, also accused the Examinations Council of Zambia (ECZ) of deliberately frustrating aspirants who have been made to spend days on the queue at the ECZ offices.
Meanwhile, UPND deputy secretary general for Political Affairs, says those who paid the initial fees prior to the downward adjustments would be refunded.
“Those who paid the initial amounts will be refunded after being processed accordingly,” he said.

The revised fees are now as follows for the various applicants:
1. Councillors (rural)-K50 from initial K300;
2. Councillors (urban)-K150 from initial K300;
3. Council Chairpersons (rural)-K1, 000 from the initial K3, 000 and
4. Council Chairpersons (urban)-K1, 500 from initial K5, 000.
However, for Mayor and Members of Parliament (MPs), the fees remain pegged at K5, 000.

Aaron Ng’ambi: will UPND be in perennial opposition beyond August 12, 2021?

The United Party for National Development (UPND) has been in existence since December 1998 when it was founded by the late Anderson Kambela Mazoka. In less than three years, the party went on to contest the general elections of 2001 in which its performance was extremely impressive for a newly formed opposition political party. There are many schools of thought with regards to the outcome of the disputed general elections of 2001. However, I will not dwell much on this topic because after many years in court during the election petition, the Supreme Court of Zambia ruled in favour of the then ruling party the Movement for Multi-Party Democracy (MMD). Despite the ruling by the courts, one thing which is clear, based on the performance of the UPND at the time, is simply that Anderson Mazoka was both an effective mobiliser and an organiser. The distinction between the two must be properly understood for our people to know the greatness of the late Mazoka, and how he was able to penetrate the political landscape in a short space of time as an opposition leader.

In clear terms, a mobiliser is someone who is only concerned with issues, while an organiser is someone who is preoccupied with primarily challenging or upsetting the system. Therefore, a mobiliser can bring people together around the high cost of living, issues of corruption or high mealie-meal prices, and even entice those people to rally in protest for any cause. Unfortunately, this act in itself of rounding up people only constitutes a mobilised effort, which is not permanent but temporary by nature. On the other hand, an organiser is someone who has organisational intelligence and skills, someone well positioned to bring down the system. Also, has to be someone who is capable of establishing the much-needed structures of a given organisation or political party across the entire country. An organiser should be able of commanding consistent respect and following within an institution or political party because of their leadership skills. To be an organiser, one must be a mobiliser first; but you can be a mobiliser without being an organiser. And certainly, Mazoka’s leadership demonstrates that the man was both a political mobiliser and organiser.

Since the demise of Anderson Mazoka in 2006, the party has been led by none other than President Hakainde Hichilema (HH). Therefore, from 1998 to 2021 the UPND has officially been in the opposition for 23 years, and the question that begs an answer on the minds of many Zambians is as follows; will the UPND be in perennial opposition beyond August 12, 2021? In an attempt to answer this question, we have to look at the performance of this largest opposition political party in the recent past. There are only two possible outcomes in any election for all participants.

However, with regards to this year’s general election, there is a strong indication that the UPND can carry the day and win the elections without any difficulties. For example, in 2016, the ruling Patriotic Front (PF) won the two-horse race election between them and the UPND with only a margin of 100,000 votes which was less than 1 per cent of the total votes. It is, therefore, possible for the UPND to close up this gap in this election through the following means: a seriously well-organised grassroot structures, a relevant message to resonate with the people and finally orchestrated strategic voter education programme throughout the country.

Also, the UPND has many other factors working in their favour, including but not limited to the struggling economy, the high levels of corruption within the PF government, and gross elements of incompetence and misconducts by most of the government officials. It is our prediction that the UPND will win Western Province, North Western Province, Southern Province, and possibly Central Province by a landslide. And of course, the PF will win in Muchinga Province, Luapula Province, Northern Province and Eastern Province thereby creating a situation where Copperbelt Province and Lusaka Province will be the battleground for the soul of this nation. The truth is that when the fundamentals of the economy are not aligned as they should, it is the people in urban areas like Lusaka and the Copperblet who feel the unbearable effects of an economy in free fall. Hence, this can be a huge determining factor concerning the outcome of the elections on August 12, 2021.

The other possible outcome in this year’s election would be that the UPND loses the election, thereby providing an affirmative answer to the question of whether the UPND will be in perennial oppositions beyond August 2021. Let us consider the factors at play which may bring about such a disturbing reality for the opposition UPND if they do not stay awake throughout this entire process. First of all, the new voter registration as computed by the Electoral Commission of Zambia is extremely concerning. We have observed that the numbers of registered votes in Western and Southern provinces have significantly diminished in comparison to the older voter register. At the same time, the numbers of voters registered on this new roll has gone up quite substantively in areas where the ruling party seems to have an upper hand. The implication of this new reality is that you will have more votes cast in the so-called PF strongholds as opposed to UPND strongholds. If this be the case, then one would expect to see an election outcome that would lean towards the PF government.

Another factor, which could negatively affect the UPND is the lack of having strong and committed members on the ground in Copperbelt and Lusaka who can win parliamentary seats for the party. It is not enough to just focus on getting president HH to State House, but rather the party needs to win more seats in Parliament from the urban cities. As things stand right now, the UPND does not even have one member of parliament from the Copperbelt except what we call Copperbelt rural like Lufuwayama. The same thing applies to Lusaka, the largest opposition party does not have a member of parliament from the urban areas of Lusaka except for Kafue which is Lusaka rural. Therefore, it is crucial to make sure that the UPND wins as many seats as possible for members of parliament in Lusaka and Copperbelt if they are to secure a landslide victory on August 12, 2021. Otherwise, the failure to take up parliamentary seats in these two critical provinces will make it even harder for president HH to get to plot one. Lastly, the other recipe for the UPND to lose this election is the temptation of feeling or thinking that “we have already won this election” even before polling day. This temptation must be avoided at all costs because it creates the feeling of complacency among the party members which makes them not to work as hard as they should because of these misguided thoughts.

To be an opposition leader and run a vibrant opposition political party in Africa, especially in Zambia is not an easy thing. We have witnessed so many candidates and opposition political parties across the continent become perennial due to the unfair advantage created by their opponents in power. For example, the likes of Raila Odinga in Kenya, who has been a perennial candidate for decades. Also, the MDC party of the late Morgan Tsvangirai, which is now led by Nelson Chamisa in Zimbabwe, the UDC of Duma Boko in Botswana, and the opposition Renamo of Mozambique, are just a few of the many political parties which have achieved the status of being perennial opposition parties. However, the UPND has been a credible Zambian opposition party in the face of so many challenges and therefore, this election offers them a unique opportunity to be victorious by any means or else they risk being a perennial opposition party.

ECZ REVISES ELECTION CALENDAR
The Electoral Commission of Zambia (ECZ) has revised the election Calendar to accommodate the provisions of the dissolution of Parliament set for May 14, 2021.
ECZ Chief Electoral Officer Mr. Patrick Nshindano says the nominations should be held after dissolution of Parliament and that the nomination period has been revised in line with these requirements.

Speaking during a media briefing in Lusaka earlier today, Mr. Nshindano said the payment of nomination fees will be done from 1st to 9th April 2021.
He said candidates will be required to pay the nomination fees in advance to allow for processing of supporters and make the exercise smooth.

*Mr. Nshindano said the Presidential nomination will be held from 17th to 20th May 2021 while National Assembly nominations will be held on 17th May 2021.*
*He said Mayor and Council Chairperson nominations will be held on 18th May, 2021, while Ward Councillor nominations will be held on 19th May, 2021.*

Mr. Nshindano said the campaign period will start earlier than the nomination period and will run from 12th May to 11th August, 2021.

And Mr. Nshindano said the Commission has increased the number of Wards from one thousand six hundred and 24 to one thousand 8-hundred and 53.
He said the polling districts have been increased from 7-thousand 7 hundred to 8-thousand nine hundred and 99.

Mr. Nshindano said the review of Constituency boundaries was concluded and the delimitation exercise report has been resolved.
He said the number of Constituencies has however remained at one hundred and 56 as provided for in the Constitution.

Meanwhile, the Commission says all aspiring candidates will be required to have their Grade Twelve Certificates or Equivalent as validated by the Examinations Council of Zambia or the Zambia Qualifications Authority.

*Mr. Nshindano said qualifications from Tertiary Institutions such as Trade Certificates, Diploma or University Degree are not equivalent to a Grade Twelve Certificate and will NOT be separately accepted without a Grade Twelve Certificate.

He said aspiring candidates should ensure they obtain supporting letters from Institutions validating their Certificates which should be presented together with the nomination papers and verified Certificates on the Nomination day.

And Examinations Council of Zambia Director Mr. Michael Chilala clarified that a school certificate implies a pass in Six Subjects including English and that one of the six subjects must be a credit or better.

ACC raises preliminary issue in 48 houses case

THE Anti-Corruption Commission has argued that Tanzanian Uziel Bashire and three others claiming ownership of the 48 houses have wrongly commenced the matter challenging the seizure of the said properties and the court has no authority to entertain it.

This is in a matter where Bashire, his cousin Zuberi Bigawa and Zambian Charles Loyana, a senior accountant at the Ministry of Finance, have sued ACC in the Lusaka High Court for forfeiting their properties to the State.

According to their amended statement of claim, the three are seeking a declaration that Loyana, had and has the requisite power and authority by law to purchase, possess and own property in Zambia in his name for his own benefit or for the benefit of any other person.

They want an order that Bashire, who is currently residing in Norway, has an interest in the properties bought by Loyana and was to be the ultimate beneficial owner of the 48 houses and Loyana as purchaser of the properties should be granted possession of the same.

According to an affidavit in support of notice of motion to raise a preliminary issue sworn by Gloria Chisambisha, a senior prosecutor at ACC, the commission intends to raise preliminary issue.

Chisambisha said the ACC’s preliminary issue was based on the amended statement of claim in which the plaintiffs alleged that the ACC did not comply with the provisions of the Anti-Corruption Commission (Disposal of Recovered Property) Regulations, 2004.

Chisambisha said since Bashire, Bigawa and Loyana were challenging the decision making process of ACC by using the words “did not fully comply with the law” and “null and void ab initio” as well as “unlawful and illegal”, the matter should have been commenced by way of judicial review and not writ of summons.

In its skeleton arguments in support of notice of motion to raise preliminary issue, ACC said the plaintiffs’ claim was concerned with the decision making process; whether the correct procedure was followed by ACC in forfeiting the 48 houses as opposed to the merits of the decision.

“The plaintiffs raise the issue of illegality in the manner in which the defendant exercised its powers, thus questioning the decision making process of defendant. Accordingly, this process should have been commenced by way of judicial review,” Chisambisha said.

She said a declaration of an action to be null and void invites the court to quash the decision made by ACC on the ground of illegality and such an action was only achievable by an order of certiorari granted by the court.

Chisambisha said Bashire, Bigawa and Loyana were imploring the court to quash the decision to forfeit their properties and such a relief was only granted through judicial review.

“The court has no jurisdiction to hear this matter on the basis that the mode of commencement was irregular,” she said.

“When an action is commenced wrongly as is the case herein, the court has no jurisdiction to entertain the matter. The judgment emanating from a court acting without jurisdiction is a nullity and can be set aside by a superior court.”

Chisambisha prayed that the matter be dismissed with costs in a point of law as it is a proper case for judicial review.

Lubinda sues LCC over delay to confer him with honourary Alderman title

MINISTER of Justice Given Lubinda has commenced judicial review proceedings in the Lusaka High court against the Lusaka City Council’s delay to confer him his Aldermanship title.

An Alderman is a senior member of a local council elected by other councillors to represent people in their ward at council meetings.

In modern days, Aldermen are refered to as councillors.

Lubinda is seeking an order of mandamus compelling the local authority to implement its resolution to confer him his honorary title.

In an affidavit verifying facts relied on for leave to apply for judicial review, Lubinda, who has been Kabwata Constituency member of parliament since 2001, stated that he served as a councillor of the Lusaka City Council for 15 consecutive years from 2001 to May 11, 2016.

Lubinda explained that on May 5, 2016, the Lusaka City Council, by way of resolution C/137/05/16 decided to bestow him the status of Alderman.

“Despite the LCC’s resolution being passed, as far back as May 5, 2016, I was only informed of the said resolution on June 23, 2017 by way of a letter from the town clerk. By way of the said letter, the council informed me that the official implementation of its resolution was to be held on June 27, 2017 and further that my attendance was required,” Lubinda said.

He stated that some time after June 23, 2017, LCC, through the town clerk, informed him of the postponement of the official implementation of its resolution to a later date to be advised.

Lubinda said that on June 25, 2018, he wrote to the council requesting it to implement the resolution and that he later engaged it on several occasions over the past years, but to date, the council had refused or neglected to confer him his honorary title of Alderman.

He said on February 10, 2021, his advocates sent a letter to the Lusaka City Council demanding the implementation of the resolution and on February 15, 2021, he was replied to and the council requested for an extension of time within which to comply with the said demands.

Lubinda stated that his lawyers wrote to the council and extended the time in which to comply with his demand by 10 days but it has not responded to him.

He complained that that the Lusaka City Council’s delay to confer him his honorary title was unreasonable and irrational and made without justification.

He further lamented that the delay by the council to confer him the status of Alderman had adversely affected him as the council has acted unfairly by not giving him reasons for its reluctance to implement the resolution.

Lubinda further stated that the council’s decision to indefinitely defer the implementation of the resolution was illegal as it was not based on any provision of the Local Government Act Cap 281.

“During the period that the council has not implemented the resolution, the applicant has suffered loss of income from sitting allowance and discounted ground rates,” Lubinda stated.

He added that he was entitled to a claim of damages within this application.

Lubinda is further seeking a declaration that the council’s decision to defer the implementation of its resolution is illegal and constitutes abuse of process.

He also wants consequential orders and costs.

I was the first victim of Kambwili’s tribalism – Akafumba

KAMBWILI is a self-confessed tribalist, NDC interim president Josephs Akafumba has charged.

And the party’s vice-president Edward Mumbi says even in PF Kambwili is a liability.

Addressing journalists in Lusaka yesterday, Akafumba said he was the first victim of Kambwili’s tribalism after he was elected NDC vice-president in Luanshya in 2017.

“I was touched, really, when I heard Mr Kambwili talk about tribalism and ourselves being planted by the UPND as a surprise to me. But I thought my brother had grown over this because he’s a self-confessed tribalist who went to Southern Province to go and apologise; and this is in public domain,” he said. “I, Josephs Akafumba, was the first victim of Dr Kambwili’s tribalism when I was elected as vice-president in Luanshya. By the way, I was not appointed by him, no. I was elected by the central committee. After my election, he went to the then secretary general who was in good standing with the party, Mr Mwenya Musenge, and said ‘we cannot put a Lozi as vice-president, tukesa mufumyapo (we shall remove him) as we go on’.”

Akafumba explained that he was later informed by Musenge who equally was not happy with Kambwili’s tribal remark.

He equated tribalism to primitivity associated with stone age politics.

“And Mwenya Musenge came to tell me. I was very upset because I’m not a tribalist. Being tribal is being primitive and practicing early stone age politics. I confronted ba Kambwili,” Akafumba added. “I said, Mr Mwenya Musenge who is our secretary general has told me that you have put me there because you cannot accept a Lozi to be your vice-president, is it true? He said, ‘no, ba Musenge babufi (Mr Musenge is a liar); I didn’t say that’. I said, no, no, let’s call him he’s our secretary general. He said no, namwishiba ifyakulandalanda ifi… (let’s avoid bickering) let’s just forget about him’; I’ve not forgotten that.”

He said each time he met Kambwili he cautioned that tribalism would not help him.

Akafumba further cautioned participants at what he termed the sham NDC provincial conferences that those activities were illegal.

He warned that at the right time, those being deceived by Kambwili would dance with him because he stood expelled from the party.

And Mumbi said Kambwili was being used by the PF to ambush UPND leader Hakainde Hichilema during nominations.

He said PF has got lawyers who know very well that Kambwili is a convict who cannot stand for public office.

Mumbi challenged PF to state if they can make Kambwili running mate to their presidential candidate.

“Mr Kambwili is not decent, and that his moral behaviour does not befit a leader. Two things he should have known if indeed he holds a PhD: he should have known that in PF there are also astute legal brains that know every well that Kambwili is a criminal convict. He’s not a civil convict. He’s a criminal convict who cannot hold public office. They knew and they know,” he said. “And if picked as a running mate to Hakainde Hichilema they were going to celebrate because this could have happened at a time when they needed it most. And if he was picked as a running mate to Hichilema, they will have celebrated to cause Hakainde Hichilema to have no running mate at an appropriate time. There are lawyers in PF and they know that a criminal convict cannot hold public office. And this appropriate time would have entailed a legal technical knockout for Hakainde Hichilema’s presidential race.”

Mumbi charged that PF were going to let Kambwili stay in the alliance deliberately and cause Hichilema’s disqualification at the last minute.

“On a technicality he (Hichilema) was going to lose it because they were going to let Kambwili hang on as running mate to Hakainde up to a certain time. They were going to go to court and say ‘that’s a criminal convict, how can he be a running mate?’,” said Mumbi. “Then they would have succeeded in their scheme which they had planned, which to me, if Kambwili holds a PhD he ought to have known very well that at one point that’s how they had agreed it will happen. And I’m challenging the PF to tell me if they can make Kambwili a running mate, let them say it.”

National Democratic Congress (NDC) president Chishimba Kambwili has unreservedly apologised to Republican President Edgar Chagwa Lungu for issuing damaging remarks against him.
Speaking during media briefing, Thursday morning, Dr. Kambwili unreservedly apologised to President Lungu and his family for remarks made in the past.

“The issue I am going to tackle this morning is one that Reverand (Serge K Changa) has been talking to me about and wanted to see this issue and other issues surrounding this are resolved amicably…., one of the people that I should also recognise, pertaining to this issue is the late Father Chilinda, may his soul rest in peace, what I am going to say today is what Fr. Chilinda wanted to see,” he said.

“Let me start by saying is that I am a Christian like many of the Zambians who believe in truthful, reconciliation and forgiveness, during my self imposed political hibernation I have reflected on a number of issues that I thought I should address today,” he added.
Dr. Kambwili specifically singled out a press briefing he held where he questioned the association of President Lungu and Mr Valden Findlay.

“As many of you maybe aware, our offices as politicians are viewed as voices of the people and a lot of information verified and unverified is passed on to us. In about August, September 2019 my office was availed with some complaints and at that time I thought it is only right that I bring this information to the public. I have however realized that I should have cared enough to engage the people involved or even take time to verify the raw information that came to my attention in the line of my political duty as an opposition leader,” he stated.

“Having said this, I want to unreservedly apologise to the President of the Republic of Zambia Mr Edgar Chagwa Lungu for the misunderstanding that he is a drug dealer as insinuated by some sectiond of the media then. I shall be also be quick to mention that at know time did I verify the information I was given regarding Mr Valden Findlay who I also unreservedly apologise to.”
Dr. Kambwili said that in October last year he tendered an apology to the Head of State and thinks it is his duty to once more clear the matter which in his view has created a lot of tension among the involved persons.

“It is only right that we flip a new page as a sign of brotherly love and genuine reconciliation. Further let tender my apology to the immediate families of His Excellency the President Mr Edgar Changwa Lungu and Mr Valden Findlay who could have been directly or indirectly affected by my statement.” He said

He added that ordinary he would have quietly approached the aggrieved persons privately because the matter has been in public domain he thought it is only right that he uses the same medium he used then to share this information.

“My prayer is that His Excellency Mr Edgar Changwa Lungu and Mr Valden Findlay find it in their hearts to forgive me. I am however reminded by the Zambian singer Ephraim’s song ‘ndi muntufye, limo limo naine ndanaka’ to error is human and to forgive is divine…… I tender this apology, without any prejudice or malice” He said.

Meanwhile Mr Kambwili has announced to the NDC general membership that at an appropriate time time, the membership will be told the party’s political direction after the failed alliance with the UPND.

UPND REVIVES OPERATION WATERMELON FOR 2021 ELECTION
The United Party for National Development (UPND) is reviving its watermelon concept ahead of the 2021 election.
The idea is that voters can appear to support the Patriotic Front (PF) by being green on the outside, when really they are red (UPND) and will vote for the opposition on August 12th.

The strategy hopes to reassure voters who are scared of the intimidation and threats they may receive if they are vocal in their support for the opposition. Past elections have seen those wearing UPND regalia targeted by PF cadres. In the run up to the 2016 polls tensions were also high between police and opposition supporters, notoriously culminating in the fatal shooting of UPND Mapenzi Chibulo who was gunned down by police during the campaign period.

The watermelon concept also encourages UPND supporters to take advantage of the PF giveaways ahead of elections as the PF once did when it used the donchi kubeba slogan to boot out MMD. The ruling party has already been giving out gifts such as bicycles, with the opposition and civil society questioning how they are funding such gestures at a time when the economy is failing, and many are struggling with the increased cost of living.

“We call upon all well-meaning Zambians to unite and use the watermelon concept to kick out PF. There is nothing wrong in eating whatever PF is giving you now, but on 12th August do a watermelon on them. Think of your future and that of your innocent children first. We all have the responsibility of kicking out PF. Throw away the green part of the watermelon on 12th August. Enter the polling booth as PF but come out smiling as UPND,” the UPND’s Percy Chanda has advised voters.

Chanda reassured voters that the poll is secret and that because they will be alone in the polling booth the PF will not know who they have voted for.

“Through the watermelon concept we can reclaim our once prosperous and peaceful Zambia. UPND will restore the respect that Zambians enjoyed before. HH and his team will create jobs and stabilize the economy by revamping the dead industrial base. Under PF Zambia has become a dumping ground of sub-standard goods because we can’t manufacture even a toothpick. Our industries are warehouses for imported sub-standard goods. PF has induced poverty in order to control Zambians, we must unite and kick out PF,” Chanda continued.

Parliament To Dissolve On May 14, Says ECZ

The Electoral Commission of Zambia has announced that Parliament will dissolve on May 14th ahead of the 12th August, 2021 general elections.

And ECZ Chief Electoral Officer Patrick Nshindano has insisted that those that wish to contest in the forthcoming elections should meet the minimum Grade 12 certificate constitutional requirement or its equivalent.

Addressing the media, Wednesday, Nshindano said that those without the constitutional requirement of Grade 12 certificate or its equivalent will not be considered for the August elections.

And Nshindano said the Commission has set 14th August, 2021 as date for the dissolution of parliament.

He said according to the law, nominations for various offices should be done after the dissolution of parliament.

“We would like to inform you and the nation that the calender has since been revised to accommodate the provisions of the dissolution of parliament which has been set for 14th May, 2021. Procedurally, nominations should be held after the dissolution of parliament, therefore, the nomination period has been revised in line with these requirements. The rest of the activity dates remain unchanged,” said Nshindano.

Nshindano announced additional activities too to help aspiring candidates to mobilise and prepare ahead of the election.

He said the Presidential nomination will take place from the 17 to 20th of May, while, for parliamentarians the date has been set for 17th May, adding that Council Chairpersons and Mayoral nomination will be held on the 18th.161456343_254206716185031_1810326548292312082_n

Nshindano explained that local government elections nominations will be held on the 19th, while, the commencement of campaigns will be the 12th May to 11 August, 2021.
The ECZ CEO says the nomination petition will have to be submitted and concluded between 15th May and 11th June, 2021 before the election on August 12.

Meanwhile, Nshindano has explained that the commission has since increased the number of wards from 1, 624 to 1, 853, with the polling districts increasing from 7,700 to 8,999.

“The review of the constituency boundaries was also concluded and the delimitation report has been concluded. However, the number of constituencies has since remained unchanged at 156. This means that the 2021 general election, the ECZ will have to work within the number of constituencies provided for in the Constitution,” said Nshindano.

THE PEOPLE of Southern Province are so fade up with the opposition UPND and its leadership that they opted to boycott the just ended voter registration exercise in favour of the ruling party says Patriotic Front (PF) Deputy Media Director Mr Antonio Mourinho Mwanza.

Speaking when he featured on Millennium Radio’s Tuesday Edition of ‘The Interview’ Radio Program, Mr. Mwanza observed that instead of wasting their energy on opposition politics, majority of eligible voters in Southern Province spent their precious time accessing ongoing government support programs.

And Mr. Mwanza noted that instead of going for voter registration, what the people of Southern Province were doing is that they were busy collecting Fertilizer, Seeds, Birds and Animals provided by government under the farmer support initiative.

“The registered numbers of UPND in Western Province have gone down. The registered numbers in terms of voters in North Western have gone down. In Southern Province, it is the worst! And you know why the people in Southern Province refused to go and register, it was very simple; No. 1. They said badala, we are tired of voting for a perpetual loser – we are tired of wasting our votes so they boycotted and didn’t go to register,” said Mr. Mwanza.

“Now Southern Province gave UPND the highest number of votes in 2016; 527,000 votes for Mr. Hakainde Hichilema! Those votes have gone because people did not go to register, why, they are tired of voting for an individual and a party that has no capacity to win. No. 2. People in Southern Province have realized the developmental projects that have been undertaken the last 10 years. They have seen the Schools, the Hospitals, the Roads, the Electricity, the Deep Tanks and government support in terms of farmer input were they are being given Animals, Birds, Fish and Agriculture in Southern Province under Patriotic Front has boomed.”

He said reason No. 3 as to why the people of Southern Province refused to register as voters in their numbers is that UPND has outdated members of Parliament who are tired and have failed to offer leadership.

“So they have resolved to stop voting for these same members of Parliament who have failed to change their lives. They are saying ba Jack Mwiimbu, you have been in Parliament for 20 years yet in Monze there is nothing to talk about. They say moneni umunenu Given Lubinda who has been in Parliament the same number of years – look at how beautiful Kabwata constituency is. All member of Parliament receive 1.6 million CDF, they have equalization fund and other resources! What has UPND MPs done with all that money in Southern Province, nothing. How can they manage an entire country when they have failed a Province?”

The PF Deputy Media Director said Western Province can no longer be described as an opposition stronghold going by the outcome of the 25 by-elections held in the last 36 months with UPND losing 19 of them. He emphasized that come 12 August, 2021 general elections, Eastern Province will cancel Southern Province while the ruling PF will secure victory in Luapula, Northern, Muchinga, Copperbelt and Lusaka Provinces.

“As we are speaking right now, Western Province has 19 constituencies; we have 108 people that have applied to contest and compete against 19 seats. You can see how competitive and how attractive and popular PF is,” said Mr. Mwanza

1. As Patriots for Economic Progress (PeP), we have noted with regret the efforts by the ruling PF party in general and President Edgar Lungu in particular to buy votes ahead of the 12th August general elections.

Almost on a daily basis, President Lungu is donating millions to certain privileged individuals in the name of empowerment, the latest being 52 fuel tankers worth more than K200 million that were donated to selected youths a few days ago. These disparate gestures on the part of President Lungu are not only a violation of the Electoral Process Act No.35 of 2016 and the Republican Constitution, but are an insult to the dignity of the citizens of this Republic.

2. As Patriots for Economic Progress, we wish to advise Mr Lungu that if Zambians were a gullible type of people that could sell their votes in return for gifts and donations, then the MMD Government would still be in power today. However, the majority of Zambians are upright individuals who care deeply about their future and that of their children and who will only give a vote to a political grouping that has the potential to take this country to greater heights of national development.

President Edgar Lungu and his PF party should further be reminded that the Zambian people have been very gracious with them. Despite not showing any tangible signs of potential, the Zambian people gave Mr Lungu a vote in 2015 and made him President. A year later in 2016, despite very poor performance in the intervening period, the Zambian people were again very gracious and decided to give Mr Lungu the benefit of doubt that perhaps the one year period that he had been President was too short to judge him fairly.

3. However, after a full five year period that has been characterized by haphazard economic policies, blatant corruption, total disregard for the rule of law and ceaseless political violence, there is now no doubt in the minds of all reasonable Zambians that Mr Edgar Chagwa Lungu has dismally failed to properly discharge the duties and functions of the office of Republican President and should therefore be retired in the national interest, while this country still has a chance to make a full recovery.

Should the Zambian people make the mistake of re-electing President Lungu and his PF party, there will not be any Zambia left to talk about at the end of his additional 5 year tenure.

4. By 2026 under a continued Lungu presidency, the economy would have completely collapsed such that we shall be carrying money in wheelbarrows to go and buy a loaf of bread at a nearby grocery shop. Zambia would have produced its first dollar billionaire being one of the PF Ministers, due to incessant corruption. and Any opposition leader with a dissenting voice will either be in prison or in exile.

And PF cadres will be managing police stations on a full time basis, in the same manner and fashion that they are currently managing bus stations and markets. The future of Zambia will be very dark and gloomy.

5. As Patriots for Economic Progress, we wish to take this opportunity to remind all well-meaning citizens of this Republic to remain steadfast in their resolution to retire President Lungu and his PF party in the national interest. They should not be swayed by the donations and gifts that the President and his party officials dish out on a daily basis. We all know that President Lungu has no personal financial resources to talk home about, and neither does his party, the Patriotic Front.

Therefore, it is reasonable to conclude that the billions of Kwacha which the ruling PF party has so far donated is ostensibly taxpayers’ money that is being pilfered from the treasury. The Zambian people would be so naive to allow their votes to be bought with stolen money. Money which belongs to the people themselves in the first place. And money which will be recovered by the PF through additional theft of public funds, should they be re-elected into office. Let us think critically and vote wisely in the upcoming general elections.

I’ve Never, Can Never And Will Never Defame The President Lungu- Kambwili

I AM a taxpayer, I have the authority to question how taxes are utilised, I have never, I can never and I will never defame the President, Chishimba Kambwili has told Court.

This is in a matter where New Congress Party leader Peter Chanda has taken Kambwili to court for questioning President Edgar Lungu’s association with Lusaka businesman Valden Findlay whom he accused of being a drug dealer.

It is alleged that between September 1, 2019 and September 12, 2019, Kambwili, with intent to bring the name of the President into hatred, ridicule and contempt, published defamatory matter affecting the President by word of mouth to which he was quoted saying “what business do you have with Findlay because we see when you go abroad, when coming out of the plane, the next person to come out is Findlay. Now allegations by the people of Zambia and world over are that maybe the Presidential trips and plane is now being used to courier drugs.”

“There is no way a President worth his salt can be moving and associating with a person who was locked up for drugs, a person who was mentioned in America by a well-known world drug dealer in the name of Goswami and when I say this, is without…you know, it’s with not impunity but I am tying to protect you, President Edgar Lungu. There is no way, my brother wingakwata icibusa no muntu wamusango ifi, (you cannot have friendship with such a person) and I am appealing to the Americans, please come and pick up this man….”

When the matter came up before Lusaka magistrate Felix Kaoma, Kambwili said he was the president of the opposition National Democratic Congress and his job was to provide checks and balances to the government of the day.

He said his other duties were to inform government about the complaints by Zambians and against those in governant and any other issues the people of Zambia were not happy with in terms of the way they were being governed.

When asked why he offers checks and balances by his defense lawyer Keith Mweemba, Kambwili said he is a taxpayer.

He said the government was run by taxes therefore he had the authority to question property acquired using taxpayers’ money and how taxes were utilised.

“As an opposition leader, I research by reading newspapers and articles on social media, listening to the radio and watching news on tv, both international and local, and through that I hear the complaints of Zambian people and I receive correspondence letters written to me asking me to intervene on different issues affecting the country and to communicate to government about the complaints,” Kambwili said.

He said between August and December 2019, he received various letters from all over the country and the particular issue of the said letters concerned Valden Findlay with regards to what had been said in the American court where Vijay “Vicky” Goswami, a drug lord of Indian origin, had mentioned Findlay in his drug dealings.

“The letters were addressed to me and other party members requesting that I comment on the matter involving Findlay’s association with the President,” said Kambwili.

At this point, Kambwili, who had earlier inforned the court that he was unwell, said that his condition had deteriorated as he developed a hand tremor.

“I am not feeling well, I need to rest,” he said.

Magistrate Kaoma said he would give Kambwili a benefit of the doubt because there was slight progress in the matter.

Earlier, magistrate Kaoma refused to adjourn the matter on reasons that Kambwili was unwell every time as such would turn the court into a circus.

Kambwili’s other lawyer Gilbert Phiri sought an adjournment on grounds that his client needed to seek medical attention.

Phiri said that the defense was ready to proceed with defense but he learnt of Kambwili’s illness in the morning.

He said Kambwili’s defense was lengthy and that he could not take the stand as he needed to see a doctor.

However, Jonas Zimba, who is privately prosecuting the matter, lamented that the prosecution team had never occasioned any adjournment in the matter since its inception in 2019.

“We have religiously attended court and discharged our duties. It is a notorious act which I invite this court to take judicial notice of that high blood pressure and diabetes are lifestyle diseases. They are subject to control and elimination,” Zimba submitted.

“If we shall continue adjourning this matter on the basis of these diseases, we shall never make progress in the matter. For this reason, as the state, we are of the view that if medication is taken now, the accused will be ready to open his defense this afternoon. We have no objection having the matter come this afternoon. We say so because every time an adjournment has been obtained at the instance of the accused.”

Zimba said the explanation by Phiri that he was unable to attend court in the afternoon; there are three lawyers on record who by section 85 of the legal practitioners Act chapter 30 volume 4 of the Laws of Zambia were officers of court and subject to direction by the court and hold a higher duty to the court.

“One of the duties is to ensure a speedy conclusion of matters such as this one. We request that the court orders that the matter proceeds this afternoon and defence counsel should be present with their client,” he applied.

Another private prosecutor Charles Changano complained that it would be unfair for the defense to delay the case as justice required that matters of this nature end in time.

“There is nothing before you to warrant an adjournment. I would advise counsel to make the defense short and stick to the indictment,” said Changano.

In his response, Phiri disagreed with Zimba’s arguments that Blood Pressure and diabetes were lifestyle diseases as none of them in the room was a doctor.

He said when an accused indicates that he is unwell, he needs to be given the benefit of seeking medical help and the benefit of recovery.

“Taking medication and appearing before court in the afternoon, BP and diabetes being diseases related to the endocrine cannot be downplayed and it is on the accused to indicate how he feels. We were ready to proceed, we learnt of the accused’s predicament this morning,” he said.

“The accused is intrested in a speedy trial with regards to how long the matter has taken. Counsel Changano has not cited the law that cases of this nature should end in good time. Even if the matter is adjourned to the afternoon we cannot say that he will conclude defense.”

Phiri said he could not speculate what Kambwili’s doctor would advise with regards to the illness and prayed that the accused is given a benefit of doubt to seek medical attention.

In his ruling, magistrate Kaoma said the matter was being privately prosecuted and every adjournment was a cost on the part of the prosecution team.

“This matter was adjourned at the instance of the accused’s sicknes and today the same sickness has been advanced without documentation. If I allow the adjournment, there is a danger of turning this court into a circus,” said magistrate Kaoma.

“The presumption of innocence that the accused enjoys, justice is for both the accused and the state. The objection is sustained and I direct that we proceed.”

The matter has been adjourned to April 16, 19 and 20, this year.

Towards the Philosophy of Interpreting the Zambian Constitution – Given the grade 12 requirement

The state has access to all the resources one could ever think of when drafting a constitution. In its employ is the crème de la crème of the best legislative drafters and lawyers. Further, Parliament has famous busy bodies dotting the government house walls. Also, parliamentarians are mature fathers and mothers who should be presumed to know what they are doing. For sure, it is preposterous that under this imbalance of power, courts of law should be siding with those in power when interpreting vague provisions in the very Constitution created, drafted and passed by the same parliamentarians.

At issue here is what Parliament passed in 2015. Shortly afterwards, in 2016, President Edgar Lungu signed into law Act number 1 and Act number 2 of 2016, establishing the new amendment of Zambia’s Constitution. One provision is at issue today – the so-called Grade 12 minimum requirement. According to Constitution 2016, one could qualify as a candidate for Councillor, MP, and President if they had “as a minimum academic qualification a Grade 12 school certificate or its equivalent”. These words should be clear and straightforward. They are not controversial at all. The minimum presumes that there is a maximum, and if I were to present a top qualification, I should be presumed to have the minimum, unless this presumption is rebutted. There should be no duty to prove I meet the minimum educational qualification if, indeed, I have the maximum educational qualification. To read this constitutional provision as stating that “the only qualification is the Grade 12 certificate” is wrong. It makes no sense. To put it simply – this is just not what the Constitution says. Had the Constitution intended to make the Grade 12 certificate the only qualification, it would have clearly and unambiguously stated so. All it stated was that a person needed to have a minimum academic qualification, a Grade 12 certificate: leaving the maximum open.

The way some Zambians now understand this Grade 12 requirement has led to a diversity of interpretations and, therefore, the ambiguity. And, of course, we all turned to the courts to see how they would look at this “ambiguity”. The first judge to have had a go at this question was Kabwe High Court Justice Dominic Sichinga in 2016. In a case brought by one Sibongile Zulu; Justice Sichinga held that Constitution 2016 did not say that one had to show a Grade 12 certificate, but rather that the requirement was a range of qualifications with the Grade 12 as the minimum, but tertiary, professional, and college education, being higher than the secondary school Grade qualification, was superior. Justice Sichinga ruled in favour of Zulu and ordered the Electoral Commission of Zambia to accept candidates with academic qualifications superior to the Grade 12 School Certificate.

The Sibongile Zulu v. AG (2016) case was governing law, well, until last week when the Constitutional Court decided to muddle the waters and confuse itself and all of us in the process. At issue, in my opinion, was the lack of adherence to constitutional principles by the court that is supposed to uphold the Constitution itself. First, the Constitutional Court should have recognised and appreciated the absurdity and ambiguous nature of this Grade 12 requirement, as interpreted by several players. Second, having noted this ambiguity, the court had the duty to then interpret this ambiguity in a more inclusive way than exclusive. If the Constitution’s drafters had wanted to make the Grade 12 the only qualification, they would have simply said so. They did not. And since they did not explicitly state that the G12 was the only qualification, it should not have been left to the Constitutional Court to impose on the Constitution what the drafters in plain language did not impose. In other words, constitutional statutes should be liberally interpreted to include as many people as possible. Given a choice between two interpretations, one that would restrict more people to run for office and one that would encourage more people to run for office – the constitutional court should have erred towards inclusion rather than exclusion. Inclusion is a far safer bet towards constitutionalism than exclusion – particularly when faced with a perceived absurdity in the language.

Third, even if we used the mischief method of interpretation. That method would still lead us to a more liberal interpretation than a restrictive one. Using the mischief method, one could argue that Parliament decided to have the Grade 12 requirement to have parliamentarians who could carry out meaningful debate in Parliament. This is the language that the majority uses in the Nkunika v. Nyirenda case. Indeed, people like Sibongile Zulu, who do not possess a Grade 12 certificate but have accessed higher college and professional education, could be as brilliant parliamentary debaters as Grade 12 certificate holders. There is no analytical study that has concluded that 21, or 35-year-old people who skip Grade 12 but have college education cannot be as intellectually astute as those who hold Grade 12 certificates. Suppose there is a mischief to be cured here. In that case, this mischief can be remedied by having a much more liberal approach to academic qualifications because of the perceived ambiguities rooted in Constitution 2016’s grade 12 requirement.

Fourth, we must deal with one more important thing. Even if I have dealt with the mischief rule above – I must add one more thing. The intention of Parliament is expressed in its written text. In other words, we must turn to the text itself first before we begin using psychic powers to discern what Parliament intended. Parliament intends to pass the laws that it writes and passes. We should not be burdened with the senseless duty of trying to read the minds of parliamentarians. If they noted that a minimum is qualification X – all those with qualifications higher than X should have no problem meeting the law’s requirement.

The next time the Constitutional Court is called upon to interpret our Constitution, I just hope it will strive to be much more constitutional than exclusive. A liberal interpretation of rights is a better bet.

Enock Tonga condemns G12 ‘ruling’

LET the educated or the holders of credits in five O’ levels or better as a school certificate vote for themselves as they seek public political office, says 3RD-Liberation Movement president Enock Tonga.

Tonga said unless one was mad, why would they cast a vote for a system that embraces draconian and discriminatory law such as five O’levels credit or better requirement for one to seek public political office.

“In Matthew 8:22 Jesus said, ‘Let the dead bury themselves.’ Likewise, let the educated or the holders of credits in five O’levels or better as a school certificate vote for themselves as they seek public political office. Fools!” he said.

Tonga said Zambia had a very poor education system, which only supports the rich to access quality education based on their ability to pay.

“And that is when a bad and very discriminatory clause is slotted in our supreme law of the land. Please note that leadership comes from God, and people’s support in a particular ward, city, district, constituency; let alone the nation is enough qualification at present to allow one seek public political office,” he said. “Whose interest were those thickhead drafters of this useless clause serving? Now, you want us to start exporting candidates from the city to go and stand in some ward based in a particular village. What would a holder of credits in five O’levels or better be doing in a typical village?”

Tonga said it was an insult of the worst kind, right in the face of a voter, to be asked to vote or consider a particular position which he or she cannot aspire for simply because of such a cruel slot of a clause.

“What sense is there for a poor villager, uneducated, who is clearly being told that you are not worthy of a being to aspire for public office to go and cast a vote for the educated? You hypocrites!” Tonga said. “We shall see how many voters out of those six million registered voters of yours have credits in five O’levels or better will come and cast a vote for any of you the educated. Example given: It is neither practical nor feasible, for one to setup or establish an incompetent body to be responsible for choosing qualified candidates for a particular position – To simply mean that, the most uneducated, the have-nots, the so called grade twelve certificate, as voters in line with or in the face of this useless and draconian law, are an incompetent body of voters to choose or elect the educated – the grade twelve certificate haves.”

He said it was all animal farm and manipulation of highest order.

“We may as well want to know the marks which those President Edgar Chagwa Lungu’s appointed judges at his Constitutional Court scored at grade twelve to come and study law and later adjudicate over matters of Constitution interpretation,” Tonga asked. “The sole reason why there is mature entry in studies – so, why should we discriminate other good people to seek public political office based on a useless grade twelve piece of paper, even when the system has terribly failed to provide affordable and quality education for all?

Well, for us, it is easy, simple and straight, knowing so well that the majority voters on the current [ECZ chief electoral officer Patrick] Nshindano and [chairperson Esau] Chulu’s compiled Voter’s Register do not have credits in five O’levels or better.”

MMD alliance with PF would be treacherous, says Kalala

JACK Kalala says it will be outrageous, treacherous and a betrayal of Zambians for MMD president Nevers Mumba to go into an alliance with the destructive PF.

The Mast last Thursday quoted Mumba saying if the party’s discussion, for a possible alliance with the PF, takes a route that incorporates the plight for most Zambians, then he is game for it.

Mumba featured on a special interview programme on Diamond TV last Tuesday.

He, however, stressed that he was on the side of Zambians, who were overwhelmed with socio-economic despair.

Mumba said he did have a position, on whether or not to go into an alliance with the PF, but that such a position would be expressed fully in the MMD’s national executive committee (NEC) meeting and at the March 20 national convention.

“If the national executive committee decides that we go with the Patriotic Front or any other political party, that becomes our preference,” said Mumba.

Responding to Mumba, Kalala, who was president Levy Mwanawasa’s special assistant for policy and project implementation and monitoring, advised Mumba against being tempted by the glamour and enjoyments of political power.

He said his motivation should rather be service to the people.

“It is honourable and noble to play the role of providing checks and balances and be the voice of the hurting voiceless,” Kalala said in a write-up availed to The Mast. “The MMD president, Mr Nevers Mumba has been reported that his party is discussing going into an alliance with the PF. If it is true, it is outrageous, treacherous and a betrayal of the people of Zambia.”

He explained that Mumba, being: “a former eminent pastor” and former Republican vice-president, had a moral responsibility to be a role model of ethical, virtuous and principled conduct.

Kalala said Mumba, Zambia’s former high commissioner to Canada, should be a shining star and source of inspiration to Zambians.

“He should keep away from relationships that would tarnish his image and standing in society. He should know that even without being Republican President, he has an important role to play in national building as [an] opposition leader,” Kalala noted.

He also recalled that in 2011, Zambians overwhelmingly decided to vote out the MMD for having failed them.

“They decided to vote for the PF, which had promised them more money in their pockets and pro-poor policies. Unfortunately, PF has proved to be a disappointment,” Kalala said. “It has failed to honour their promises to the people of Zambia. The PF has been pathetic and worse than the MMD in performance and meeting people’s expectations. Their performance has been a total disaster to the nation.”

He said instead of putting more money in the pockets of people, “the PF leaders have been enriching themselves and their surrogates.”

“People, who were poor before they became government leaders, have turned into instant millionaires within a very short time. Not only that, they have failed to provide effective and credible leadership,” he said.

Kalala further highlighted a number of marked failures of the PF regime.

“The kwacha has depreciated from about K5 to more than K22 to one dollar. The inflation rate has moved from eight per cent to 22.2 per cent since PF came into power,” Kalala noted. “The economic conditions and cost of living have deteriorated to miserable and unbearable levels.”

He complained that under the PF regime, it had been scandal after scandal, like the scandalous high cost of the reconditioned fire trucks and ambulances.

Kalala also said under the PF, Zambia had experienced the collapse of the rule of law and that President Edgar Lungu himself has shown no regard for the Constitution.

“The nation has had nasty experiences such as the gassing that traumatised the nation, the unwarranted killings of innocent citizens, namely Vespers, Mapenzi, Banda, Nsama, Kaunda to mention but a few,” he said. “The nation has been subjected to dreadful vices such as criminality, brutality and tribalism than ever before. Under the PF regime the nation is hurting.”

Kalala then asked: “under such circumstances, how could a normal thinking person, aspiring to become a national leader, imagine to go into an alliance with such a notorious party?’

“What has president Mumba got on his mind to want to team up with PF?” asked Kalala. “Does he want to join the plunderers in order to also dubiously become an instant millionaire, while subjecting Zambians to socio-economic adversities and tribulations?”

The prediction by Political Analyst Sishuwa Sishuwa that President Edgar Lungu will stay in office after August polls appear to be extremely correct but not because of the reasons he mentioned but because the numbers themselves say it all, says Governance Activist Isaac Mwanza.

Politics is a game of heart played by mind. It all depends on what people feel about the leaders. Public perception matters the most in deciding the fate of any political leader. As the general elections are closing in, political circles are abuzz with speculations about the outcome.

“While Mr Hichilema is sees himself as having already won the August 2021 election, despite biting the dust for five times in a row, President Edgar Chagwa Lungu’s popularity has steadily been raising over the last seven years he has kept a grip on the Presidency within and outside his party,” said Mwanza

He said the UNZA don may need to remember when President Lungu stood first became President in 2015, people did not know him very well back then. He was still adopted as the PF candidate, with great majority by the Patriotic Front. President Lungu’s popularity has been only growing. The phenomenal infrastructure work he has done in the country and the transformation he brought about speaks for itself. It does not need any publicity.

“If we look at the growth trajectory of President Lungu’s popularity, the picture gets crystal clear. There is a definite and consistent upward trend in the popularity of President Lungu. Today he is a household name in Zambia. He is so popular that every child knows him. The popularity will have an impact on the voters when they go to polling booths in August,” he said.

The voting trend in the country since 2015 shows a clear inclination towards Edgar Lungu. Despite being relatively unknown and being adopted by party as Presidential candidate, he managed to win by 20,000 votes and shortly thereafter, when people got to know the man who was adopted as President in 2015, by the ruling party, he won by 100,000 votes in 2016.

“In 2021, given the increase in the number of votes and his popularity, he is bound to increase his margin win to around 400,0000 votes. Going by the voting trend so far, August elections would be a easy walk for Edgar Chagwa Lungu,” said Mwanza

Zambia is undergoing ‘social menopause’ – Msoni

NASON Msoni says Zambia is undergoing a social “menopause” where nothing is moving and working for the vast majority.

He says the PF and President Edgar Lungu should realise that what is at stake for Zambia is far greater than just an individual’s insatiable appetite and political ambition.

Msoni, the All People’s Congress (APC) president, criticised relentless pursuit of political power for the sake of it.

“The country is undergoing a social menopause where nothing is moving and working for the vast majority of the people. Youth unemployment has reached emergency levels requiring a quick solution,” Msoni said in an interview. “The ever rising high cost of living is driving the majority of our people into abject poverty and destitution.”

He charged that the fact that PF leaders had mercilessly looted State coffers with impunity did not necessarily mean that everyone was able to sustain themselves, given the prevailing harsh economic situation.

Msoni also pointed out that the PF, without President Lungu, was rendered moribund and extremely vulnerable.

“But we must respect what the Constitution says. It is absolutely wrong for the PF to attempt to bulldoze their way into government through the sponsorship of a candidate who is clearly barred by the Constitution,” Msoni said. “And yes, we agree that without President Lungu on the ballot, the PF risks losing political power. But that’s entirely their own political misfortune.”

He added that there was no dispute that the PF was extremely vulnerable in the forthcoming elections.

“But the choice cannot be to recycle a candidate who is constitutionally barred,” he argued.

“There is also a moral dimension to all this; for a person who swore to protect and defend the Constitution and then should he start to dismember and cannibalise the very document he swore to protect and defend!”

He wondered whether circumventing the Constitution, in order to illegally contest an election, was actually protecting and defending the document.

“And after circumventing the Constitution, should the person swear to defend the same Constitution?” Msoni asked. “Zambians, let us get more serious with the governance of our country. Leaving Zambia in the hands of criminals will certainly leave all of us bruised and abused.”

He further noted that the collective tragic failure of Zambians would be to vote back into office a political party that had clearly shown no interest or concern for the welfare of the people.

Msoni said no sane government in the world could procure expired drugs for its own citizens and allow perpetrators to go unpunished.

He regretted the high level corruption in the PF government that: “has become a daily feature and the modus operandi of running government.”

“Extravagance and the willful looting of public resources with impunity is going unabated and is encouraged and tolerated by those who ordinarily have the power to stop it,” Msoni complained.

“We are in a very serious moral dilemma and it couldn’t get any worse than this. We are all victims of a bad government and we must urgently reach out to all our citizens and make a case for regime change.”

He also indicated that it was absolutely depressing that the very victims of a bad government were, in fact, the very ones in the forefront cheering for looters with clinched fists raised in solidarity with the criminals.

Kambwili has branded UPND as a tribal and selfish political party

CHISHIMBA Kambwili has branded UPND as a tribal and selfish political party.

But UPND spokesperson Cornelius Mweetwa says people should forgive Kambwili over what he says as he is a prisoner of politics.

Addressing the Eastern Province NDC elective conference that was held in Chipata via telephone, Kambwili charged that the UPND is only interested in using other political parties for its selfish political advances.

Kambwili informed the delegates that he had wanted to work with the UPND but the party believes in itself and where it originates from.

“First and foremost, I want to thank you for being magnanimous and refuse people who have always wanted to use other people for their own personal and tribal gain. As your leader I would not want to support a grouping that is going to divide this country,” Kambwili said. “We formed NDC to serve the people of Zambia, to give them hope and unite them but there is a certain political party which just believes in themselves and where they come from. When we went to work with them, where I come from they say ‘ukupesha ilungu kwendamo’ (for you to describe a situation accurately, you have to experience it). When people are saying these people are like this, you better go and be close to them and really find out if you can help change them but I can tell you, I failed.”
Kambwili said even the people he was with in NDC who pretended to belong to the party were actually UPND but wanted to sell his party to the highest bidder.

“I am grateful that today you are going to have your elections to elect leaders who cannot be easily bought or cannot be easily compromised. Let me thank the outgoing executive led by the provincial chairman who came to Luanshya, the provincial chairman…who came to attend our central committee to endorse our position that well done and now it’s time to work so that we can build our country. I thank you and God bless you,” said Kambwili.

Earlier, Fabian Mutale, who is Kambwili’s private secretary and deputy NDC mobilisation chairman, informed Kambwili that the conference in Eastern Province had just dissolved its previous executive and delegates were heading into elections for a new one.

“… [delegates] have unanimously agreed that after this election they are going flat out to grow NDC and they are not ready to go and work for UPND who wanted us to go and field all our candidates on UPND [ticket]. They are supporting you and want to hear your voice …” said Mutale.
But Mweetwa advised people to forgive Kambwili.

“The man is a prisoner of politics; what he is going through right now is what HH has gone through, is what all of us will go through, except that we react differently to such kind of political incarceration,” Mweetwa said.

He sympathised with Kambwili.

“From his tone, this is not the Kambwili we know, this the Kambwili who is in some kind of situation which does not permit that he should speak his mind; he is not speaking his mind,” he said. “So no one should politicise what Kambwili has said.”

Mweetwa said the UPND still valued Kambwili as a political leader in the country and the association his party enjoyed with him.

“We do not take lightly the situation he is in and therefore we wish him well and that these issues to do with 2021 should not be individualized. Where we are now is no longer bet6ween UPND and PF; it is the people versus the PF government, those are the battle lines,” he said. “There will be many people who will be heard saying things that appear to favour PF. It doesn’t mean those people believe in PF. It’s just that PF has been too brutal and ruthless that sometimes they have managed to break some individuals’ spines.”

Mweetwa advised people not to be quick to demonise Kambwili saying “he is our brother in the struggle”.

He said one day freedom shall come to Zambia for all.

Mweetwa said currently issues that need debate relate to the national debt, the kwacha at K22, which had thrown many people out of business, and unemployment.

THE Socialist Party says its democracy is not for sale.

Socialist Party general secretary and first vice-president Cosmas Musumali also says the poor have been betrayed for too long and that those in the leftist party are standing up and saying enough is enough.

Dr Musumali unveiled 37 Socialist Party adopted parliamentary candidates and a Kitwe mayoral candidate, Karen Kampinde, at Kingfisher Garden Court in Lusaka yesterday.

He branded the adopted team as dedicated men and women from all the provinces: “of our homeland.”

“We have Northern Province giving us seven today, Luapula three, Lusaka three, Southern six, North-Western three, Central one, Muchinga two, Eastern six, Western three and Copperbelt is giving us three,” Dr Musumali said. “Out of the three from the Copperbelt, we have a mayoral candidate for Kitwe. In the next weeks, we’ll wind up with the adoption of the MPs and also adopt mayors. All those from the bigger towns, the adoption is going to be done centrally and then the other it will be decentralised, especially for the council chairpersons.”

He said those adopted were very humble and that 19 were women and another 19 were men.

“Again, this is history in the making. From the very beginning, we said we are for equity and we are walking the talk. We also committed to the youth [because] these are the majority of the population,” Dr Musumali said. “Amongst the 38 candidates today, we have eight of them below the age of 30. This is history in the making! Out of these eight, two of them have just attained the age 21 and they are both female. We have a third candidate that has just 22. So, we have three women in this group that will be going to Parliament at the age of 22, at the age of 21.”

Among those adopted is a female bricklayer, Lubinda Silishebo, 39 for Nalikwanda, a 21-year-old a hair dresser, Lindiwe Mawere for Kawambwa Central and: “we have a young comrade who sells tomato.”

He added that there were also a number of peasant farmers.

“We have about three trained teachers that are unemployed and that are sustaining themselves through peasant farming. None of these comrades can be called a big fish. It’s not the big fish that needs change,” Dr Musumali said. “It’s not the elite of this country that seek better lives for themselves and their children. The poor have been betrayed for too long and in the Socialist Party they are standing up and saying enough is enough. They want to lead themselves!”

He noted that the poor wanted to be part of that change process that was going to take place in the country, come August 12 this year.

“The Zambian Parliament will never be the same with this crop of people. The time for the suffering masses to delegate political power is gone,” Dr Musumali noted. “Zambia is entering a new phase, it’s a new challenge but full of hope. We are setting a path for the rest of Africa and humanity.”

Meanwhile, Dr Musumali explained that the Socialist Party would be closing the adoptions of members of parliament two weeks from now.

“To be specific, on the 27th of this month, the Socialist Party would have adopted 156 members of parliament. 50 per cent of them would be women,” he said. “This is again history in the making. We look forward to the other political parties, the other political actors to imitate our example.”

Dr Musumali also indicated that adopting women in the Socialist Party was not just the issue of mere gender parity.

“We are giving an example as to what people’s democracy looks like. If democracy has to make sense, then it has to be the government of the majority, for the majority. Power, democracy cannot be delegated to another group, another class of people, that do not understand your pain, your sufferings and your aspirations,” Dr Musumali explained. “The example we are showing is that if you have carpenters, we want to see carpenters in Parliament, if you have bricklayers amongst the workers of Zambia, the people of Zambia, we want to see those bricklayers in our Parliament. Marketeers play a huge role in our lives. We want to see those marketeers in Parliament.”

He noted that: “democracy in the Socialist Party is not for sale.”

“Our representation of the people in the Socialist Party does not go with size of the pocket. It goes with truth, genuine, justifiable people’s representation,” said Dr Musumali. “We look forward to welcoming you two weeks from now as we close this chapter of adoptions. We will go ahead with adoptions of our mayors, of our councillors and this is the process that should be complete within the next 40 days.”

Those adopted are Roydah Mulenga Chongo for Kaputa, Mark Mpundu for Chilubi, Marian Chisela for Lupososhi, Twiza Sikazwe for Mpulungu, Dorcas Mulenga for Mporokoso, Mavis Mutale for Lukashya, Judith Ngo’nga for Chimbamilonga, Lindiwe Mawere for Kawambwa, Paul Davis Musenge for Mambilima, Lukas Mwansa for Lunga.

Others adopted are Jacob Chimfutwe for Nchelenge, Juliet Nalwimba for Isoka, Morris Nkata for Chama South, Pastor Jack Yobe for Rufunsa, Ben Malupande for Chongwe, Morris Njepa for Chilanga, Eviness Chipatika for Choma, Beckham Mudenda for Magoye, Sampson Siabwengo for Gwembe, Willies Michel for Moomba, Melody Buumba for Mbabala and Margaret Moono for Monze Central.

The rest are Espina Chulu for Solwezi East, Chishimba Kapungwe for Mkushi North, Amos Wambili for Solwezi West, Kevin Kanyama for Manyinga, Fridah Mbewe for Malambo, Dominic Mbewe for Vubwi, Marie Jesy Banda for Lundazi, Learmore Lungu for Nyimba, Nkhumbwiza Banda for Sinda, Mathews Mwale for Milanzi, Kerryne Kampinda for Wusakile, Joyce Mubanga for Kitwe Mayor, Dennis Mulenga for Mpongwe, Lubasi Liuma for Sesheke, Sharon Sinonge for Mulobezi and Lubinda Silishebo for Nalikwanda.
