I’ve been persecuted for long, I need peace – Chitotela

PAMBASHE PF member of parliament Ronald Chitotela has been exonerated by the Economic and Financial Crimes Court for acquiring a house in Lusaka’s Ibex Hill and K500,000 using ‘illegal gains’.
Upon being discharged, Chitotela said, “Don’t fight Chitotela, fight corruption. If you want to fight Chitotela naine ndimuntu ndanaka (I am also human, I get tired) I have been persecuted for long, I need peace”.


Principal resident magistrate Jennifer Bwalya has ruled that Chitotela’s exemption from prosecution by the Anti-Corruption Commission dated June 24, 2019 is still in force and prosecuting him for possessing property suspected to be proceeds of crime when he was let off the hook by the ACC upon forfeiting his property will amount to penalising him twice.


This is in a matter where Chitotela was facing two counts of possessing property suspected to be proceeds of crime contrary to section 71(1) forfeiture proceeds of crime no.19 of 2010 of the Zambian laws.
Allegations are that between May 1, 2017 and October 30, 2018, Chitotela possessed property no 3270/M, valued at K380,000 suspected to be tainted.


In the second count it was alleged that Chitotela between November 3, 2017 and December 5, 2017 received K500,000 from veil construction limited through RKC Travel and Guide Limited Account No. 62489001398 suspected to be ill gotten.
At the last sitting, Chitotela’s lawyer Andrew Kampamba Kombe made an application that the charges be dismissed pursuant to Article 18(5) of the Constitution which states that a person who has been tried or convicted on a specific offence shall not be tried on the same offence.
“A quick look at the indictment will show that the two counts were a subject of a consent settlement pursuant to section 80 of the ACC Act no.3 of 2012. The consent settlement will show count one and two of the indictment,” he said. “There was an undertaking by ACC not to institute any criminal proceedings against Chitotela in relation to the charges. We are taken aback by the ACC to indict the accused person on the same charges.”


Kombe asked the court to determine whether or not the settlement falls within the ambit of Article 18(5) of the Constitution.
In response, ACC prosecutor Martin Mayembe argued that Chitotela was not tried before any court in relation to the charges.
“Trial begins after a person takes plea and the accused did not take plea. The submission by the defence of the acquittal is misplaced. The accused never appeared before court in relation to the said charges. The question before court is whether Section 80 of the ACC Act no.3 of 2012 may result in an acquittal,” Mayembe said. “There is a way undertakings can be resolved when there is breach and the state will be ready to defend. We pray that the application be dismissed and plea be taken by the accused.”


But Kombe argued that Mayembe was blank about the consent which bordered on the matter before court.
“This is a matter that was called in court and the accused took plea. It was on that particular day when the prosecutor frowned that the settlement would be filed in court. The settlement was endorsed by the then chief resident magistrate. The settlement was imposed by the ACC and they were satisfied that the accused had met the requirements of section 80 of the ACC Act,” he said. “For the prosecutor to say that there was no trial is trying to mislead the court. The state has not given evidence in their response that the consent has been set aside or breached. The breach of this undertaking is neither here nor there. As defence we are sure that the accused was tried before a competent court which resulted in the consent settlement.”


Kombe added that Section 128 of the Criminal Procedure Code is instructive that a person cannot be tried on the same facts and it was the reason they had raised a plea in bar.
Chitotela’s other lawyer Benjamin Mwelwa said if the ACC breached the consent the right thing to have been done was to commence an action before court in order to have an opportunity to defend itself.
But Mayembe raised a preliminary issue pursuant to Rule 33 (1)(d) of the Legal Practitioners’ Rules requesting that Kombe recuses himself as he was a potential witness of the commission in the matter.


Ruling on the matter, magistrate Bwalya said Chitotela took plea in relation to the nine corruption related charges he was facing and the state made an application before court that a settlement be filed.
She said according to Section 80 of the ACC Act the commission is by law allowed to enter into negotiations with the intended or actual defendant in criminal proceedings and settlement or undertakings shall be registered and can be sued upon once registered in court if breached.


She explained that the ACC under the said provision undertakes not to institute criminal proceedings against a person who has fulfilled conditions precedent to the said undertaking which conditions maybe a full and true disclosure of certain information or a voluntary act done in furtherance of the same and that parties are bound by the settlement or undertaking.


“The ACC undertook not to institute criminal proceedings against Chitotela pursuant to section 80 of the ACC Act for the very charges that he now stands before me,” magistrate Bwalya said.


“Ronald Kaoma Chitotela having satisfied the requirements of Section 80 of the ACC Act no.3 of 2021, the Anti-Corruption Commission precluded him from prosecution and the said undertaking showed that the ACC committed not to disclose the contents of the agreement to any unauthorised person, entity including members of the public.”


She noted that ACC took into account the full and true disclosure made by Chitotela, and the settlement was given an exhibit in marking and it had taken into account the payment and forfeiture of property made by Chitotela.


“There is before me no evidence of the settlement between the parties or indeed a binding undertaking by ACC as having been set aside through any judicial process or that it was subject or order of any superior court. Proceeding with the matter whilst the said settlement remains in force will be in essence subjecting the accused to the evils of some form of double jeopardy (punishment) which the laws in Zambia frowns upon,” said magistrate Bwalya. “I find that the matter on which the accused is charged is incompetent for the above reason. I must make it clear that the view I have taken does not in any way amount to an acquittal but a discharge of the accused person. I therefore order that Ronald Kaoma Chitotela be and is hereby discharged on of the charges herein forthwith.”
Speaking after he was freed the former minister of tourism urged the commission to focus on fighting graft unlike targeting him as he was weary of being victimised.


“The law has been respected and we are humbled. Where you have a system that is burnt for persecution this is the end result but God in heaven is bigger than all of us. I knew that it is a process and it will pass but I want to appeal that please let us respect the law. We declare ourselves to be a country that is governed by the law, let us respect the rule of law,” said Chitotela. “Instead of investigating crime we are oppressing people and beginning to investigate them. Don’t fight Chitotela, fight corruption. If you want to fight Chitotela naine ndimuntu ndanaka (I am also human, I get tired) I have been persecuted for long I need peace.”

ON HIS ascendance to the office of President after a landslide victory in the August 12,2021 polls, Hakainde Hichilema promised to fulfil the party’s vision as set by its founder Anderson Mazoka when he formed the United Party for National Development in 1998. President Hichilema promised “A Zambia which is united prosperous and equitable’’. A Zambia that guarantees basic needs for all its citizens. A Zambia in which the fundamental human rights and property of its citizens are protected.” He promised a “new dawn”. President Hichilema then told a packed stadium of jubilating citizens: “Today, we begin our journey towards realising this dream.” A dream of re-uniting and re-building our mother Zambia.

It is now nearly nine months into that journey, which had six main targets: to achieve national unity, accountability and inclusion; to strengthen governance; economic transformation and job creation, as well as economic recovery and stabilisation.
The other targets were to institute public administration reforms, and to make Zambia a player in global affairs.

TARGETS MET

For a country that was tearing at the seams because of tribal talk, regionalism and political violence, national unity was paramount and it was one of the first successes Mr. Hichilema scored, first by stopping his own supporters from taking over the running of markets and bus stations, which were breeding grounds for political violence.

Following his strong stance on violence, which he has repeated many times since becoming President, political violence has, to a large extent, been curbed, and citizens are freer to exercise their freedoms regardless of the political party they belong to.

It was the first sign of regime change, and a huge departure from the old system where police, to a large extent, abused the Public Order Act to stifle dissenting voices, usually resulting in police brutality.

One of the freshest incidents of that abuse is the killing of public prosecutor Nsama Nsama during peaceful protests by UPND supporters in Lusaka.

And now Government, through Cabinet, has approved the review of the Public Order Act, promising to amend it. If the Public Order Act is repealed or amended, Mr. Hichilema will have done something that his predecessors failed to do despite public outcry.

There has also been a change regarding media freedoms.
In its latest quarterly report, Media Institute of Southern Africa (MISA) Zambia noted a marked improvement in the country’s media landscape, with far less incidents meant to suppress the media recorded.

President Hichilema has also shown willingness to be more engaging with journalists, promising to date them quarterly to answer their questions concerning the governance of the country. For instance, the President spent more than half a day interacting with journalists to mark World Press Freedom Day, something unprecedented in the history of media engagements by a head of State.

He has positioned himself as a leader with zero-tolerance for corruption and also a champion of good governance. Although there is yet to be a major conviction of those suspected to have stolen public resources, Mr. Hichilema has been unrelenting in his quest to end corruption and recover what was stolen.

In October last year, security agencies seized K65 million and US$57,000 from Faith Musonda. In addition, more than 400 properties, suspected to be proceeds of crime, have been seized. These are undergoing legal processes before they could be formally handed over to the people of Zambia.

That money that was recovered from Faith Musonda has since been channeled to support 2,200 university students from underprivileged backgrounds across the country.

Government has also set up a fast-track court to speed up the prosecution of cases involving corruption.

REVIVING ECONOMY

At the start of Mr. Hichilema’s tenure, the country’s economy was teetering on the brink of collapse, with a US$26.9 billion debt that had become unsustainable.
Zambia’s economic growth was in the negative and the government then was struggling to clinch a bail-out deal with the International Monetary Fund (IMF), while the cost of living had reached uncomfortable levels for many citizens.

In January 2021, the cost of living had skyrocketed to a new all-time high of K8,400 per month for a family of five, mainly triggered by high inflation, as reported by the Catholic think tank Jesuit Centre for Theological Reflection (JCTR).

The country had also become unattractive to new investors because of eroded investor confidence and poor rating by credit rating agencies.

In September 2020, the credit rating agency Fitch had downgraded Zambia to nearly junk status due to its mountain of debt.

The outlook could not be dimmer. Someone had to turn the ship around.
Although negotiations over Zambia’s debt restructuring are still in progress, there is now hope an IMF deal will be reached around mid-year. Last November, the country reached a Staff Level Agreement with the IMF, a major leap forward in the negotiations. And most recently, China, which Zambia owes US$6 billion, has also joined efforts to restructure the debt, giving the country and its citizens more room to breathe.

The economic outlook has since changed, and showing signs of recovery, even in the midst of another impending global crisis caused by the Russia-Ukraine war.

The annual inflation rate has declined to 11.5 percent from 23 percent last year, while the exchange rate has stabilised, and in recent days has been registering marginal improvements.

On Monday, JCTR recorded a marginal reduction in the cost of living, which has been a source of worry for many citizens.

President Hichilema has not been shy to admit that the current state of the Zambian economy is hurting many citizens. “I feel your pain,” he said at a recent press conference, commenting on the high cost of living in the country. But he has also been assuring about the country’s future, and what his government plans to do to revive its economy.

There are now signs that the country could be headed for economic recovery.
The investment climate has improved, with investors now making decisions to invest huge amounts in Zambia. Last week, for instance, First Quantum Minerals staked US$1.35 billion for Kansanshi Mine expansion, and opening of Kalumbila nickel mine.
It is the biggest single investment in a decade.

But there are also home-grown initiatives meant to spur economic growth.
One such initiatives that was recently laid on the table as a roadmap to economic recovery is the Public-Private Dialogue Forum, which will act as a platform for Government to work with the private sector to identify and remove bottlenecks to Zambia’s economic growth.

President Hichilema has also signed two key bilateral agreements with the Democratic Republic of Congo (DRC), and Angola. The agreement with the DRC is meant to create a joint value chain for the now hyped electrical vehicle sector and clean energy sectors in both Zambia and DRC. The agreement with Angola is meant to promote trade between the two neighbouring countries.

Trade agreements have also been signed with Rwanda.

The increase in CDF from K1.6 million per constituency to K25.7 million is a major milestone meant to decentralise the operations of Government by taking financial resources to the people.
The move is also expected to spur economic development by encouraging small and medium-scale entrepreneurs to access cheaper capital through cooperatives.
The funds are being released quarterly, with guidelines issued on how citizens can access and benefit, but there is now also oversight from the Anti-Corruption Commission to ensure that there is no corruption in the process to access the funds, or theft by those administering the funds.

INTERNATIONAL STATESMAN

That Mr. Hichilema has stamped his foot on the global stage is without doubt, projecting himself as a pan-Africanist, whose interest is to unite the continent around trade and promoting peace.

His most recent trip was to South Africa, where he delivered a keynote speech at the mining indaba in Cape Town, getting a standing ovation for what some described as a “breath of fresh air”.

Mr Hichilema has also been keen to forge new partnerships with progressive countries on the continent, such as Rwanda and Botswana, and has often referred to himself as the country’s number one salesman.

But, unlike his predecessor, who usually travelled abroad with huge delegations, Mr. Hichilema is a “light” traveller, only carrying a handful of staff. He is said to have cut down his delegations by up to 90 percent, resulting in serious savings for the Treasury.

SAFETY NET

Without doubt, one of the most sweeping policies of the new dawn government has been the implementation of free education from Grade One to 12 – a dream come true for many poor and low-income households that were failing to take their children to school.

Government has also paid off 128,000 pensioners who had been waiting for their money, some for as long as 10 years.

The new Government has also paid off all the 15,000 Tanzania-Zambia Railways Authority workers, plus 34,000 council workers who were not receiving monthly salaries. Over 258,000 farmers who supplied maize to Food Reserve Agency have also been paid. The recruitment of 42,000-plus teachers and health personnel is in full swing and shall be concluded soon.

I have often said that the Anti-Corruption Commission (ACC) has no capacity and morality to fight any corruption, in it’s current form.

While I widely and publicly shared this thought, many thought I was making baseless assertions.

Well, developments from courts have proved me right.

But let me add to what has already been said;

The ACC uses the feelings of few people,either at that same institution or somewhere within the line of authority to deal with people whom they drag to court ,on charges of corruption which doesn’t exist. Therein lies abuse of authority.

Firstly,a genuine fight against corruption must be waged by people who are themselves clean of the very crimes they seek to eradicate. Corrupt people can never fight corruption.

Secondly, the court of public opinion must not be used as a yardstick to determine who is corrupt and not. Many of those who are today under any form of charge sheet by ACC have been judged corrupt in the public and have been convicted by the Court of Public opinion which ACC uses to determine who must be arrested. These people sit in their offices and drink tea funded by tax payers while surfing social media to check on whom the propagandists judge as corrupt, so that they can arrest such people, grab their property using “suspected proceeds of crime” and keep people in detention for no apparent reason.

A serious and genuine corruption fight begins with investigations and moves to arrest if there is enough reasons to believe one is corrupt or acquired something corruptly. Prosecution is only successful when there is a normal way of doing things.

Any arrest which puts the burden of proof on a suspect in criminal matters is merely persecution. ACC has in the recent past operated on a premise of making anyone they arrest to prove his or her innocence on a crime that has not been identified.

ACC is today capable of arresting school going children, confiscate their drinking bottles and ask them to prove how they own such things.

The Little Table

President Rupiah Banda was a creature of habits. So, as Head of State, he preferred to stay at a private lodge as opposed to the Presidential Annex at Luangwa House in Chipata. Mama Rulas – a camp site and backpackers facility – was his favorite place even before he was President. The place, situated on old Lundazi road – pass right inside my Ku-Chimpinga Farm – always relaxed him!

In the night, he loved to sneak out of his room unnoticed and join tourists at the bonfire outside for stories under moonlight. After some hours, he would then introduce himself as President of the Republic of Zambia but to the utter denial by the tourists. Twice, his portrait that was hanging on top of the bar, was brought down so that the backpackers can compare the faces in order to prove he was indeed the President. Then ululation would follow and selfies! He even spoke Swedish to some…

The President liked one room at this lodge – room seven (7) to be precise. It had a small table and four chairs. This room was designated – during his presidency – as the Presidential suite! The simple wooden furniture – bed, table and chairs – were made by the owner of the lodge at his backyard. Nothing spectacular!

So, the little dining table and four chairs, was the usual sitting place of the President, which also doubled as his office. He read reports and books on this table and received daily briefs from his staff and security. But most importantly, he held high level meetings with Heads of State and Government on the same table. The one-on-one meetings took place on this tiny table. He met Malawi President Bingu Wa Mutharika, Mozambique President Armando Guebuza, Swaziland King Mswati and South Africa Jacob Zuma on this very table. Then ministers, foreign special envoys and diplomats – all found themselves on this table. Ordinary citizens too!

He also made several decisions on this table. It was the historic room during his Presidency. It was the “RB State House” so to speak!
In the morning, aides and security people hanged around the lawn outside the room. The President would shout “names” one by one.
“Mwauka…” or good morning, he would say, before inviting everyone for breakfast at the adjacent restaurant.

So, on my recent visit to Chipata, I went to see the room.
Everything is still intact including the trademark blue and white tablecloth.
It was a nostalgic feeling.

I told the owners of the lodge – German couple – that I would love to buy this little table and the chairs. It forms part of the history of Zambia in so far as the 4th President is concerned. Every morning, we read and analyzed the daily newspapers together on this table. I was a permanent fixture in that room but especially on this table…I sat in several meetings.

Dazed Vladimir Putin splutters and retches in meeting amid chemotherapy rumours

Vladimir Putin spluttered and retched during a meeting broadcast in Russia today amid speculation he’s undergoing chemotherapy treatment for cancer.

The Russian President, 69, looked dazed and bloated as he sat across from defence giant Sergey Chemezov, whose company Rostec builds an array of military hardware.

The clip – which was broadcast on Russian state TV – shows the leader with his chin rested on his chest and his hands gripping the table during the talks with his former KGB pal.

At several points in the video, Putin is seen retching and seems unable to speak properly.

It comes as rumours swirl that the tyrant is being treated for cancer.

Last week, a secret recording of a conversation between a Putin-aligned oligarch and a Western businessman revealed the despot is “very ill with blood cancer”.

Publicly the Kremlin has stated that Putin is fit and well but his strict precautions during the pandemic and use of a long table to meet other political leaders have strengthened rumours.

But recent appearances in which his hands are seen spasming uncontrollably, or today’s clip of him sputtering, suggest otherwise.

And his decision to have waged war in Ukraine may have been due to a cancer-related cognitive impairment, an oncologist has claimed.

In the latest of many claims about the ill-health of the Kremlin leader, reports suggest he is suffering from cancer and undergoing chemotherapy and steroid treatment.

Other reports suggest Putin is suffering from Parkinson’s or early-stage dementia, but numerous experts believe he may have started cancer treatment before the war began, and so he is suffering from the effects of chemotherapy.

The condition is officially called cancer-related cognitive impairment and causes the patient to “lose focus” and struggle to remember simple things.

It can also give people the ability to make “crazy” decisions without cogently thinking them through.

An ex-Brit spy also believes Putin’s decision-making in Ukraine has been affected by an illness.

Christopher Steele, who ran the Russia desk at MI6 in London between 2006 and 2009 and worked there in the 1990s, said he had heard the president was not well.

He told Sky News: “Certainly, from what we’re hearing from sources in Russia and elsewhere, is that Putin is, in fact, quite seriously ill.

“It’s not clear exactly what this illness is – whether it’s incurable or terminal, or whatever. But certainly, I think it’s part of the equation.”

And Steele’s comments came after a Ukrainian general echoed the rumour while adding a plan is already underway in Russia to oust him.

While talking with a female bank manager she made a scary revelation to me. She told me how Nigerian bank vaults are filled with monies of dead men who kept their bank accounts secret from their wives.

She explained it was against bank ethics or policies for an account officer to inform the relatives of a deceased customer of his account (without his permission). And since the man is dead without giving his permission the bank dubiously keeps silent on the money. She told me it is rampant among many businessmen, even the Christians. She revealed many instances of dead men whose families are still suffering even though they have millions stashed in their secret accounts.

She mentioned one that happened a few months back. The man died and the wife was crying all over the place, looking for money to bury him or even do his funeral. Whereas the man had nothing less than 60 million naira in his accounts. The banker said it got to a stage that she could no longer bear, her conscience was pummeling her.

She had to go against her bank rules, got in contact with the widow, and revealed to the woman how much her husband had in his accounts and how to claim them. She also told another story of one man who escaped death but his right hand was paralyzed.

He couldn’t sign his chequbook with his left hand and he was in a desperate situation that needed him to sign papers and cheques. That was how he learned his lesson the hard way. As soon as he got better, he immediately made his wife co-signatory to all his accounts and involved her in all his businesses. What if he had died? So, that was how his family would have suffered amid plenty.

A middle-aged guy took to social media to tell the tragic story of how his 19-year-old wife deserted him and his one-year-old kid in order to elope with her boyfriend.

The heartbroken man wrote in a lengthy post wrote:

“This is a girl I signed for tailoring work, her attitude towards me this year changed drastically because of hard times am going through. I have seen her at the far end of my street standing with boys of same age with her holding her anyhow in the waist and every time I caution her that she’s no longer a small girl but a woman.

I thought maybe she will grow up, but since on Sunday afternoon she left for her mother’s place, she was supposed to come back in the evening, I waited till on Monday morning I couldn’t call her because the last time I bought phone for her, she lied she lost it, I later found out that she gave it to one guy who is a Yahoo boy, it nearly caused a big issue that the community chairman had to be involved to settle the whole matter and the money of the phone was paid back to me.

I had to go to her mother place only to see my daughter there and she wasn’t in sight. Though her mom was trying to hide it from me but I know what’s going on, this isn’t the first time she’s done something like this.

I Just left there this evening, all her mother was saying is I should take it easy.

I didn’t beat her

We didn’t quarrel, she just left on Sunday afternoon to drop my 3 year daughter at her mothers place.

I’m ashamed of the whole thing, everyone in my compound keeps asking me of her whereabouts, til it has gotten to the far end of our street.

I can’t even come out in peace, if I do they must be one person to ask me what happened just to find my mouth, and the shame of explaining everything to them of her she dumped my daughter since on sunday is not easy.

Note: please those Ladies thinking I took advantage of her, I didn’t. I’m a very educated individual, I did introductions with her parents before she came to live with me.

Then her dowry was paid.
It was my choice, every man dreams to get married to a tear rubber. If I want to remake that choice I probably do it again, this was never to discourage those who wish to a young wife.

National Democratic Congress secretary general Charles Kabwita has charged that the only achievements that the UPND administration has scored are the arrests of former ministers and Patriot Front members of parliament.

Commenting on the acquittal of PF Pambashe member of parliament Ronald Chitotela by the Lusaka Resident Magistrate, Kabwita said that the UPND government has not actualised any of its campaign promises, apart from pursuing individuals that served in the previous administration and are perceived to be “criminals.”

“This is not what President Hakainde Hichilema and the UPND promised the Zambian people. They promised to deliver development. And yet eight months of being in government there’s nothing tangible that we can physically point at that the UPND has achieved. None of their promises have been actualised. The only thing that the UPND has achieved is arresting former ministers and Patriot Front members of parliament,” said Kabwita.

He charged that President Hakainde Hichilema wants to divert the citizens’ attention from real issues by continuously labelling PF officials as “thieves.”

“On this corruption issue, the President has on many fora shown to be the complaint, the jury, the prosecutor and the judge. The President wants to divert our attention from real issues by portraying a picture that PF leaders are thieves and yet there’s no proof that they stole,” said Kabwita. “It is embarrassing that after people have made so much noise all these people perceived to be corrupt or criminals are being acquitted. This is a lesson to the UPND leadership.”

Kabwita also said that the UPND administration is interfering in the operations of investigative wings.

“There has been a lot of political interference in the operations of law enforcement agencies. The UPND government should allow the Anti-Corruption Commission, the (Zambia) Police and Drug Enforcement Commission to carry out their investigations without political interference. We don’t want this situation where you start pursuing and arresting people out of hatred. This issue of calling others as criminals is becoming boring,” Kabwita said.

Kabwita further implored Chitotela to sue the State, saying his reputation has been dented.

“I can only encourage my brother Honourable Ronald Chitotela to take this matter further. Let him sue the government so that he can be compensated. Honourable Chitotela is an MP…a respected member of parliament. But they have painted him black,” said Kabwita

By now , I know most of you friends have come to know how determined I personally am at remaining a PF member especially after noticing how Clueless the new Dawn government is as to where governance is concerned. Clearly , they have no clear road map for where they want to take this country.

That said ,I want to let you know that most revelations by the ACC and other investigative wings have been extremely perturbing.

Imagine waking up to the fact that MOST LEADERS you followed for involvement and help with projects/ideas that could sustain the party SAID ARE BROKE or simply NEVER ENTERTAINED a thought like that!

Most brilliant youthful projects aimed at building the party and making it attractive to society where either dumped or caressed into oblivion to the last hour!

Would you believe that Some of these leaders we are seeing being paraded with mansions and numerous vehicles suspected to be proceeds of crime actually pretended to be AS BROKE AS A COMMON MAN when approached for involvement with party activities ??? Activities that could have helped them remain relevant with those appointments !

Most of these kept youths you today think they eat with at arms length. The President’s office WAS COCOONED! All youth visits to State House and State Lodge were TABOOED!

We tried to cry! Only that we kept our cries in our blogs with admins spending sleepless hours to guard those cries from spilling out.

Most youths have been left pamyunga. Some with cases they can’t even understand how they got themselves involved with. Others I hear have even fled living families with noting to put a hand on for a mare meal.

Yet today , some are PROUDLY in courts of law defending their wealth. Wealth they kept amassing in secrecy whilst pretending they were the Lazaruses in the faces of the trying and begging youths.

Most offices that could have come to the aid of most youths kept promising and in most cases with shut doors.

That’s why ine kuma courts for solidarity I can only follow ECL if need arose because I KNOW HE GAVE OPPORTUNITIES TO MOST OF THESE LEADERS TO ACTUALLY DO THE WORK AND THEY LET THE MAN DOWN. It’s sad Zambians knew that the buck had to stop at his office hence our loss.

What a Wasted Presidency Indeed : A Case of the New Dawn- Sean Tembo

1. Over the past couple of decades, management gurus have tried to distinguish between a leader and a manager. But l see the distinction as pure semantics. I mean, how can you manage the people if you can’t lead them? Similarly, how can you lead the people if you can’t manage them? Others try to argue that leading is strategic whereas managing is operational, but l see it as splitting hairs.

2. Anyway, it has been almost 9 months now since the new dawn ascended to power arising from the 12th August 2021 general elections, amidst much pomp and fare. To say that President Hakainde Hichilema’s momentum for reforms has stalled like the Russian invasion of Ukraine, would be an underestimation. The education grant is released on television and yet on the ground, there is no money. CDF is released on TV and yet on the ground, there is nothing. Political cadres are said to be eradicated on television and yet in the markets and bus stations across the country, they are thriving collecting illegal taxes. The much talked about IMF loan is said to be on the way, and yet it is nowhere to be seen. The rule of law is said to have been restored and yet the President calls press conferences to discuss cases which are activated before the courts and convicts the accused even before the trial begins. His legal advisers cut deals with the allegedly corrupt and then make a u-turn thereby losing credibility in the eyes of the Zambian people. Key production inputs such as fuel and electricity are increased at unprecedented rates thereby driving the cost of living through the roof, and yet the Zambian people voted them into office on the ticket or a lower cost of living.

3. The natural question which arises is why Hakainde Hichilema’s presidency is unravelling at such a fast pace? Everything seems to crumble. Even the general mood of the people out there in the streets is extremely negative, especially given the fact that HH won the last election with such a huge landslide. There is no debate that every presidency eventually unravels and runs afoul to the expectations of the people, but it is supposed to take time before people get fatigued. But in the case of President Hichilema however, it has barely been a year. So again the question is why?

4. Different people will attribute President Hichilema’s fast-dwindling political fortunes to different factors. Others say it is because he over-promised during his campaigns and is now failing to keep his promises. Others say it is because he decided to lean toward the western powers at the expense of China, which has been a major driver of Zambia’s economy in the past few decades. Others say it is because he was not ready to govern and was instead prepared for an election petition. Others say he accumulated a huge amount of liabilities from the people that funded his prolonged stay in opposition and that now he needs to prioritize paying them back before he can think of delivering anything to the Zambian people. Yet still, others say he is not as brilliant a leader as he falsely portrayed himself during his days in opposition.

5. I think all the above factors have contributed to President Hichilema’s dismal performance in the past 9 months, but still cannot explain why he is missing the goal by so wide a margin. On the contrary, l think the President’s biggest undoing is the team that he chose to surround himself with. The travesty of life is that those who have the brawl usually don’t have the brains, and those who have the brains usually don’t have the brawl. Loosely translated in the context of opposition politics, this means that those who have the courage to stand with you throughout your trials and tribulations as an opposition leader will rarely have the brains necessary to constitute your mission-critical team that is needed if you are going to deliver to the expectations of the people, once you ascend to power.

6. But of course morality demands that you repay the debt to those who stood by you when no one else could. And l believe that it is this moral burden that compelled President Hichilema to surround himself with nincompoops, all in the name of repaying their debt of loyalty. These nincompoops shape the President’s policy and approach to the economy, governance, politics, etcetera, despite the fact that the majority lack any ounce of competence in them, let alone statecraft. For instance, the President ended up with a political advisor who speaks about squeezing a political opponent on an unsecured line and even refers to and implicates the President and his Vice by name. Surely, what kind of sound political advice can such a novice offer the President?

7. The President’s legal team is another total disaster, starting from the Minister of Justice all the way to the Attorney General, Solicitor General and legal advisor. The majority of these people were personal lawyers to the President and ate off his palm. What sound objective advice can such a team give to the President apart from tilted opinions and shallow schemes that will make the President happy. Lately they decided to soak the President in the Milingo sewer, leaving him very smelly. And the President cannot see all this because he is blinded by past glory of a dream team of lawyers that managed to keep him out of prison. But is that the team that he really needs if he is going to successfully deliver on his presidency?

8. The President’s economic team is another disaster. But on this front, unlike the legal front, it is a well documented fact that the current shambolic economic policies are the President’s idea and not that of his economic team. Therefore, his economic team is only guilty of failing to advise the President against his grandiose ideas of how to turn around the Zambian economy. For instance, the President has been fixated on an IMF bailout loan as the key to turning around the Zambian economy for almost half a decade now, since the days of the Opposition Alliance when l used to interact with him. Firstly he used to argue that the almost zero-interest IMF loan money will be used to replace the expensive commercial debt that the country has, such as the Eurobond. Then when we told him that such refinancing is not possible due to IMF guidelines, he changed his argument and started saying that getting an IMF bailout loan will give confidence to our creditors that we are fiscally disciplined and therefore make the creditors develop an appetite to restructure our loans.

But of late, however, the President has changed his argument and is now saying that the creditors need to agree to restructure our debt before the IMF can give us a bailout loan. Clearly, President Hichilema is fixated on an IMF bailout loan, despite the hardship that IMF conditionalities will bring on the masses such as the removal of subsidies on fuel and electricity, despite the fact that our major export earner; copper is selling at record high prices on the world market, despite all the available evidence that we do not need an IMF bailout loan. And of course, his economic team is unable to advise their all-knowing boss. Much to the detriment of the Zambian people. What a wasted presidency indeed.

NewsMakers is working on a documentary whose main objective is give insight on some activities which we judge are corrupt by the Patriotic Front administration. Of course, while we hold this view, we also find that the kind of corruption which we witnessed during the PF regime was done in such a way that it involved contractors themselves.

Contractors went into bed with corrupt elements in PF and got contracts at inflated costs. The added amounts were paid to PF officials or government officials in cash ($dollars) and sometimes through properties.

These properties have been concealed in other people and the monies have been hidden.

While it is clear that PF was a corrupt party, it is more difficult for the Hakainde Hichilema led administration to prove these allegations beyond reasonable doubt.

This documentary seek to highlight some of the dark areas which investigative wings must look at as they pursue criminal activities under the PF administration.

To give a few details, here is a summary of how things worked between PF and some of the corrupt Contractors they connived with

On 30th May 2017 the Patriotic Front administration controversially signed a contract with China Jiangxi Corporation for International Economic and Technical Cooperation for the construction of the 321 km Lusaka-Ndola dual carriage road at a cost of $1.2 billion.

The contract sum was immediately dismissed as smelling of corruption by Hakainde Hichilema. There was also public outcry but then Minister of Housing and Infrastructure Development Ronald Chitotela in a ministerial statement heavily condemned then main opposition leader Hakainde Hichilema for saying the true cost of the project was half its initial cost.

In total disregard to public outcry, the PF regime stubbornly went ahead to engage China Jiangxi.

Among key issues raised by the public is that the $1.2 billion was highly inflated and that much of the money would end up in the pockets of key government and party officials of the PF. Concerns were raised that PF was using China Jiangxi to defraud Zambians as there was no proper justification of heavily inflating the cost of the project from $600 million to $1.2 billion.

Secondly, the contractor China Jiangxi has been found to be a morally corrupt institution whose reputation is stained. This is against a background that, on January 3, 2014, the World Bank’s Suspension and Debarment Officer issued a Notice of Sanctions Proceedings against China Jiangxi Corporation for International Economic and Technical Cooperation, Mr. Zhu Hongfeng and Mr. Peter Lee pursuant to Section 4.0l (a) of the World Bank Sanctions Procedures, as adopted by the World Bank as of April 15, 2012.

The Statement of Accusations and Evidence – SAE prepared by the Bank’s Integrity Vice Presidency and appended to the Notice contained accusation that the Respondents engaged in sanctionable practices in connection with Ghana West Africa Transport and Transit Facilitation Project. It contained the •evidence gathered in support of this accusation with the specific accusation made that China Jiangxi engaged in fraudulent practices by including false past experience documentation in a bid for a construction contract in Ghana, and by later submitting additional fraudulent documentation in support of the earlier-submitted past experience documentation.

To many concerned Zambians, it was against this background that they believed that the basis of relations between PF administration and China Jiangxi was corruption and intent to swindle Zambians.

It is after change of government from PF to UPND that people got know that indeed the China Jiangxi quotation of $1.2 billion for the construction of the 321 km Lusaka-Ndola dual carriage road was nothing but pure intent to defraud Zambians.

Minister of Transport Frank Tayali revealed that following the cancellation of the contract by his administration, there are bids for the same at half the price.

And it has been stated that China Jiangxi is part of the companies that have bid for as low as $500 million to do the same road it earlier quoted $1.2 billion under the corrupt accused PF.

Former Transport Minister William Harrington says the recent revelations by transport Minister Frank Tayali that the contractor engaged to construct the controversial Lusaka-Ndola duo carriage way has offered to construct the road at 50 percent lower than the original cost of 1.2 billion dollars smells corruption.

Harrington is not the only one who feels that way. Several other people in the civil society and involved in anti-corruption crusade have stated that it is clear China Jiangxi and the former ruling party the PF were bedfellows in corruption over the contract.

Further, multiple sources within PF have revealed that financing of party activities for the former ruling party was done through contractors by giving them contracts at inflated costs whereas, the added money found itself in the pockets of senior PF officials.

According to one senior party member of the PF who opted not to be named, China Jiangxi managing Director David Wei had an open path to the secretariat of former ruling party.

With the UPND administration seemingly having cordial relations with the West, China has been technically shelved. Upon assuming office, the UPND administration embarked on halting, reviewing and halting all mega contracts issued by the PF administration.

This move is seen as targeting Chinese contractors like China Jiangxi that enjoyed the monopoly of huge contracts during the PF, such as the another controversial Kenneth Kaunda International Airport upgrade at a cost of $369,235,359 without the Attorney General’s approval whatsoever.

At the moment, the former ruling party has continued to inculcate its relationship with the Chinese and it is believed that contractors such as China Jiangxi are bankrolling their costs for the numerous corrupt related cases as well as the upcoming convention where the former ruling party hopes to replace their leader Edgar Lungu and wage a political battle against the UPND in 2026.

From the controversial Lusaka-Ndola dual carriage way and the upgrade of the KKIA, it remains unclear what role China Jiangxi and its managing Director David Wei played in the massive plunder that characterizes the PF legacy.

David Wei’s alleged continued relationship with PF and financing of their upcoming convention requiring K5 million, remains unknown.

It was predictable that the PF presidential race would knock off many confident hopefuls.

The formidable and confident Chishimba Kambwili and sneaky, flamboyant former ambassador Emanuel Mwamba were handed their early deserved defeat and exit. The question on many Zambians’ minds is: didn’t they (Mwamba and Kambili) know this technicality? Didn’t they know how subjective PF can be, when it suits them? These seemingly smart and indestructible politicians didn’t have any hints or intel? Most interesting is that their friends had already scripted the eulogies of CK and Emanuel! The beauty of this; killing two birds with one stone and same tribal birds! What the evil politicians do to others comes back to haunt them within the shortest period of time. It’s a good technical knockout worth watching again and again. It goes to show that there are intrigues in the selection of PF a president. Old habits die hard!

History repeats itself, given what had happened when PF outfoxed then acting president Guy Scott. One of the architects who hounded out Dr Scott from participating in the selection of the PF presidential candidate in 2014 after Michael Sata’s death was Kambwili. The proverbial saying is explicit, “Tasting own medicine.” Guy Scott must be laughing the loudest at the turn of events and he has good reason to do so.

The PF presidential contention is dangerously narrowing down to the extent that the party may end up with no formidable and credible candidate. We can all guess what this will finally mean: doom of course! For, PF to rebound back to power will be impossible! The PF pundits may throw in many contenders from one tribe or region on the premise that whoever wins will still be their own after all! This permutation may not still go well with the members from the other tribes and regions. They will cleverly devise a rebuttal like they did in last year’s elections and still beat PF hands down!

The importance of having a smart, formidable party president can’t be overemphasised. He or she becomes the positive face of the party and it means half the battle is won. One who can articulate the party’s vision and aspirations.

To the contrary, having a dim-wit party president means the party will have already lost before going into an election. Mind you, we have a lot of such party presidents who are totally lost and are nervously groping in the dark. They take pleasure in being called Mr president and it ends there! Such noisy characters are the ones who, more often than not, want to be rented by other dominant parties. My free advice to PF, take it or leave it, try to pick a candidate from the other regions other than Eastern or Northern. If you ignore this, pick a candidate from the power-hungry region; a candidate who could immediately, seriously and honestly denounce divisive tribalism. Not one who would repeat what Kambwili did. He is not honest and keeps shifting positions for convenience. You will recall that he had gone to Southern Province to tender an apology to one of the traditional leaders for the stance he had on tribalism against Tongas. He even gifted the chief with a big plasma TV to demonstrate his remorse! Before the ink dried on the paper the apology was written, he returned and conveniently forgot the apology and started field days insulting Tongas. He did the same to PF and ECL. He denounced the party and ECL as corrupt, rotten and vowed never to rejoin PF. Before the sunset, he was cozying up with PF! This shocked many Zambians who had trusted and saw him as a formidable politician who would challenge or replace ECL.

PF was smarter than all the loud mouths who had called PF and ECL names. Somehow these street smarts posing as politicians were blackmailed and lured back into PF. It was now easier to deal with them. None of them can salvage their political fortunes. Don’t mess with PF when it comes to intra-party elections.

ANTHONY Bwalya says the law will soon catch up with several former ministers that awarded themselves contracts, paid themselves and delivered nothing.

Featuring on Hot Seat Programme yesterday, President Hakainde Hichilema’s spokesperson said the new dawn administration’s fight against corruption was for the basic human rights of the people.

“Those less privileged in our our midst. I am going to repeat this. So those who were corrupt under the previous regime and those who think they can be corrupt under this regime as well as those who think they can be corrupt in the future, the fight against corruption is a fight for basic human rights of those less privileged amongst us and I will explain it,” he said. “When we recovered K65 million as proceeds of crime, we diverted it to supporting over 2,000 young students from under privileged backgrounds who otherwise today would have been on the streets. This is what corruption does. It gets into the pockets of the few and takes away opportunities from as many as 2,000 young men and women.”

Bwalya cited the case of the FTJ (Frederick Titus Jacob) University, where it’s alleged US $33 million was paid to contractors when no works equivalent to the sum had been done.

“The US $33 million was spent to build a project where nothing was done. That is people’s money. They are busy making noise around. They come here, they go everywhere taunting the government, taunting the President and taunting you the Zambian people about how not so corrupt they were. When the President said money was being paid to people, to contractors for providing nothing, people thought was a joker,” said Bwalya.

“Now we have FTJ there, everybody is seeing it. US $33 million! Now they are making noise again, they are saying ‘money was not paid to ourselves’. That thing was under their watch. How do you pay a contractor money when nothing has been done? The buck stops at the leadership. They know nothing was done and it was not an accident but that they intended it to be executed that way. …several ministers of the previous government the law will catch up with them very soon. They paid themselves, they awarded themselves contracts, and they did nothing. This information is known to the law enforcement agencies and they are going to move in at an appropriate time. This is not court of public opinion. We all know that the $33 million was paid.”

After becoming the first Russian soldier to stand trial in Ukraine over President Vladimir Putin’s invasion, a Russian soldier has pled guilty to allegations of war crimes.

Sergeant Vadim Shishimarin, 21, said he was guilty of killing a 62-year-old man in the head in the village of Chupakhivka during the first week of the war when questioned by a judge in Kyiv today.

He now faces the possibility of life in jail, as outlined in the section of the Ukrainian criminal code dealing with war laws and customs.

Shishimarin admitted to killing the civilian with a Kalashnikov rifle as he fled with four other soldiers in a stolen car in a village in the Sumy region on February 28, just days after Vladimir Putin ordered his troops into Ukraine on February 24.

The man was pushing a bicycle by the side of the road when he was shot in the head and ‘died on the spot a few dozen metres from his home’, the Ukrainian prosecutor general said during the opening phase of the trial last week.

Prosecutors said Shishimarin was ordered by a superior ‘to kill a civilian so he would not report them to Ukrainian defenders.’

Iryna Venediktova, the prosecutor general, said: ‘Shishimarin is actually physically in Ukraine. We are starting a trial not in absentia but rather directly with the person who killed a civilian, and this is a war crime.’

In a video shared by the Security Service of Ukraine on May 4, Shishimarin described how he shot the man.

The SBU described the video as ‘one of the first confessions of the enemy invaders.’

‘I was ordered to shoot,’ said Shyshimarin, wearing a blue and grey hooded sweatshirt. ‘I shot one (round) at him. He falls. And we kept on going.’

He was captured when his column was surrounded while they tried to return wounded soldiers to Russia. The footage then shows Shishimarin calling his father, saying: ‘They treat us well here.’

The father then tells Zolkin: ‘He is just a soldier. I don’t think he knew where he was going. You say he invaded, and we are told that they were defending the country. He didn’t know. He was told to. You hear one thing and we another.’

The clip ends with Shishimarin urging fellow Russians not to join the war effort and protest instead.

Kyiv has repeatedly accused Russian troops of committing atrocities since the invasion began on February 24. There are also allegations of mass rape, torture and execution being carried out by Putin’s forces while the occupied Ukrainian towns in the Kyiv region.

Employees of the U.S. embassy in Ukraine have raised the U.S. national flag at the embassy in Kyiv, Ukraine’s capital three months after shutting down the embassy over Russia’s invasion.

The decision to send a small contingent of U.S. diplomats back to Kyiv as part of a soft reopening of the embassy is a signal that the United States stands with Ukraine against Russia.

The US says the embassy reopening is a move U.S. lawmakers from both parties, as well as Ukrainians, have been asking for. But was delayed by Joe Biden’s administration over security concerns.

The American embassy’s reopening was confirmed by Secretary of State Antony Blinken in a statement on Wednesday, May 18 after the U.S. flag was once again raised at the facility.

He called it a “momentous step.”

“The Ukrainian people, with our security assistance, have defended their homeland in the face of Russia’s unconscionable invasion, and, as a result, the Stars and Stripes are flying over the Embassy once again,” Blinken said. “We stand proudly with, and continue to support, the government and people of Ukraine as they defend their country from the Kremlin’s brutal war of aggression.”

Blinken said the Biden administration has “put forward additional measures to increase the safety of our colleagues who are returning to Kyiv and have enhanced our security measures and protocols.”

According to reports, the Embassy would resume functioning only in a limited capacity and that consular services will not be offered.

Chargé d’affaires Kristina Kvien, currently on leave, was not present at the reopening ceremony, where a small contingent of diplomats raised the American flag over the embassy’s gated compound.

Also U.S. Marines are reportedly not present at the embassy rather the compound is being guarded by diplomatic security and Ukrainian national guard and police forces.

A woman has told of her embarrassment after she had to visit a hospital when she had a vibrator stuck up her bum.

The woman took to TikTok to reveal the X-ray she had done before undergoing surgery to remove the vibrator from her body.

The TikTok User named Sophie shared a video documenting her ordeal with the caption: “I got a vibrator stuck up my a**e.”

Russia has said nearly 700 more Ukrainian fighters from the beseiged town of Mariupol, Ukraine have surrendered.

The statement from Russia comes after two months of fighting the Ukranian soldiers known as the ‘Azov Regiment’ from the Azovstal steelworks plant where they have been hiding for months.

It also comes after the Ukranian government announced last week it had ordered its garrison in Mariupol to stand down and surrender to Russia.

A pro-Russian separatist leader said commanders on Wednesday May 18, still said some soldiers were still holed up in tunnels beneath the giant Azovstal steelworks.

Ukrainian officials have also not made any public statement about the fate of fighters who had made their last stand in the steelworks plant, one of the largest plants in Europe.

Russia’s ministry of defence said 694 more fighters had surrendered overnight, bringing the total number of people who had laid down arms to 959. The leader of pro-Russian separatists in control of the area, Denis Pushilin, was quoted by a local news agency DNA as saying the main commanders were still inside the plant. Russian state media released photos of the Ukranian fighters being carried away with buses guarded by pro-Russian separatist fighters.

More than 50 wounded fighters have been brought for treatment to a hospital in Russian controlled territories while others have been taken to a newly re-opened prison, in towns held by pro-Russian separatists. Reuters journalists have filmed buses bringing some captured fighters to both locations.

The Kremlin says Putin has personally guaranteed the humane treatment of fighters who surrendered.

Ukrainian officials had confirmed the surrender of more than 250 fighters on Tuesday. But they did not say how many more were inside or what might become of them.

“The state is making utmost efforts to carry out the rescue of our servicemen. Let’s wait. Currently, the most important thing is to save the lives of our heroes,” Ukranian military spokesman Oleksandr Motuzaynik told a news conference. “Any information to the public could endanger that process.”

“Unfortunately, the subject is very sensitive and there is a very fragile set of talks going on today, therefore I cannot say anything more,” said Mariupol Mayor Vadym Boichenko. He said President Volodymyr Zelenskiy, the Red Cross and the United Nations were involved in talks, but gave no further details.

The final surrender of Mariupol would bring a close to a near three month siege of the once prosperous city of more than 400,000 people, where Ukraine says tens of thousands of civilians have died under Russian bombardment. Russia decided to attack Mariupol so as to get a crucial land corridor linking annexed Crimea to the Donbas region of Luhansk and Donetsk.

Ukrainian officials have spoken of hopes to arrange a prisoner swap for Mariupol defenders they describe as national heroes. Moscow says no such deal was made for the fighters, whom Russian president, Vladimir Putin has refered to as ‘nazis’

Europe unveils plans to spend $221 billion to ditch Russian gas, oil and coal

The European Union has unveiled a €210 billion ($221 billion) plan to completely shed itself off Russian oil, coal and gas.

Since Russia invaded Ukraine in February, the EU has sought to reduce its dependence on Russia’s vast energy exports which has helped fund Vladimir Putin’s military in its war against Ukraine. The EU agreed to ban Russian coal starting in August, and by last month had cut Russia’s share of EU natural gas imports to 26% from 40% last year.

But a lot of European countries are dependent on Russian energy, with Hungary and Germany saying plans to wean itself of Russian energy could destabilize their economy greatly.

Now the EU has unveiled a plan aiming to quickly ramp up imports of liquefied natural gas from the United States and Canada, and increase flows of pipeline gas from Norway while also setting up a platform to enable countries to jointly purchase energy, with the aim of helping to bring down rocketing prices.

Presenting its “REPowerEU” plan on Wednesday, May 18, the European Commission said it would attempt to slash consumption of Russian gas across the bloc by 66% by the end of this year — and break its dependence completely before 2027 by saving energy, finding alternate sources and speeding up the transition to renewables.

“We are taking our ambition yet to another level to make sure that we become independent of Russian fossil fuels as quickly as possible,” EU Commission President Ursula von der Leyen said in a Wednesday press briefing.

“When Europe acts together, it has more clout,” von der Leyen said of the joint procurement program. “This way we can secure energy imports we need without the competition between our member states.”

The plan also emphasizes energy-saving tactics as the “quickest and cheapest way” to address the crisis. Europe will encourage citizens and businesses to curtail their energy use — such as by switching off lights and using less air conditioning /

Going forward the European Union will lift its target of having at least 40% of its energy coming from renewable sources to 45%. The bloc plans to dramatically cut down the amount of time it takes to get permits for new renewable energy projects.

Much of the €210 billion ($221 billion) in new investments envisaged between now and 2027 would be financed by drawing on the EU pandemic recovery fund.

The plan would require approval by EU member states — while others are recommendations.

The EU leader also said EU countries are working on an oil embargo for landlocked states that rely heavily on Russian oil delivered via pipelines to find alternate supplies.

Hungary — which got about 40% of its oil imports from Russia last year, according to the International Energy Agency has so far said it wont support such a move agaisnt Russian energy.

Germany, Europe’s biggest economy, is particularly reliant on Russia’s gas, but has managed to cut Russia’s share of its imports from 55% to 35% since the invasion, Economy Minister Robert Habeck said last month

On behalf of the North Western province Youths, we would like to express our displeasure and dissatisfaction over the acquittal of Hon chitotela which we feel is a disaster and lacks meritorious.

We want call on the Ant_Corruption Commission (ACC) to put its house in order and stop exposing it’s inefficiency to the public over it’s failure to promote and defend the integrity of the institution.

We demand that the ACC must stop granting immunity to those who plundered public resources and are hiding in the immunity which doesn’t equate to the resources they stole from the people of Zambia.

It is embarrassing situation to see well known corrupt masters being acquitted on account of signing concerts based on thieving matters when those who got chickens are convicted.

We would like to call on the Minister of justice Hon Haimbe to seriously monitor officers in his ministry because the negative outcomes of court cases are clearly showing that we still have wrong office bearers but most importantly the ministry of Home affairs under ACC who have continued to serve their old masters against the will and wishes of the Zambian people.

The fight against corruption must not be left to the president a lone but that we must put our hands together and fight for what belongs to our citizens.

The current outcomes of court cases shows that our president is fighting corruption alone which is a clear indication that the system has failed the Head of State to deliver the justice the people of Zambia voted for and that if not worked on and the system must be cleaned now.

It is our long standing view that the current crop of some officers are a danger to the fight against corruption and have failed to protect, promote and defend the integrity of the institutions.

Remember if you don’t change the system, the system will change you and will not entertain such after suffering so much in the hands of PF criminals.

First and foremost, I would like to thank my Church “SDA”,the Clergy, friends, family, the people of Pambashe and everyone else for standing with me during this period of persecution, which I can best describe as a “cremison tide” in its nature.

And my solely adjuration to the government’s Investigative wings is for them to practice professionalism in their execution of duties, because the whole episode shows that they’re fighting me with the intent of bringing my reputation into disrepute.

The Anti-Corruption Commission (ACC) treated me like a common miscreant and yet there were no charges leveled against me.They followed me in Kawambwa where I had gone to appear before the magistrate court over ersatz charges.They brought me to Lusaka, kept me in the waiting room from 4 am to 3 pm without charges.When one of the officers came to me, he made it clear that the instruction given to them was to detain me.When I asked the officer how possible is that without charges.Sadly and grisly so, the officer had no definite answer but only to tell me that was the instruction given.

I was kept captive from 4 am to 5 pm and when I was formally charged after 3 pm on the matters which were already disposed by the Court, the ACC officers refused to grant me a bond.The lawyers tried what they could but their noble calls for bond were not heard, hence they took me to Ridgeway Police Post till the following day when I appeared before Lusaka magistrate court where I was then granted a bond.

The law is clear one can’t be tried twice on the same charges.I thank God that justice has prevailed.The discharge of today’s cases by magistrate Jennifer Bwalya should make the investigative wings to always investigate matters professionally without attaching one’s political affiliation or the depth of Political grips.

I have endured years of contempt and obloquy by the ACC and I feel it’s time for them to allow me to rest as they’ve tried all possible ways of bringing me down but God has always been on my side for He is greater than them.

Seeking Leadership Is Part Of Our Bemba Tradition – Kambwili

Butambi bwesu to seek leadership, says PF presidential aspirant Chishimba Kambwili.

But UPND chairperson for mines Percy Chanda said “the visit to the Chitimukulu by a bunch of shameless tribalists to seek tribal sympathy and solidarity from His Majesty is a dangerous gimmick that has potential to set this nation on fire.”

But another PF presidential aspirant Emmanuel Mwamba said by now people know that tribalists and those that rely on ethnic-driven politics see everything in their lenses.

During a meeting with the paramount chief of the Bemba people, Chitimukulu yesterday when several PF officials, members and presidential aspirants visited him at his palace for what they termed consultations on the state of the nation, Kambwili, chipping in to what the Chitimukulu said about how leadership in Bemba land was established through a vigorous process, described the scenario where a lot of Bembas are seeking to lead the party as intambi.

During the meeting, Chitimukulu said it was important to exchange ideas with all stakeholders, including the government and those in the opposition as Zambia belonged to all.

“We are Zambians and this is our country, a party just rules. This party comes and reigns and goes, another one comes in. But this is our country. We the Zambian people are the owners of this country…that is why we need to reflect on where exactly our country is going because this is our country,” Chitimukulu said, adding that if problems were being noticed it was wise to dialogue on how best to resolve them. “There is no use, abantu nkabaletekafye, baletekafye. Peace ifwile ukuba kubantu abengi…we have to make sure the one Zambia one nation is working and how is it working.”

He insisted that this country belongs to Zambians and not to a political party, hence the need to unite.

Chitimukulu said tribal wars finished a long time ago, and therefore tribal divisions could not be entertained now, saying Zambians had a lot of things in common, including inter-tribal marriages.

He said unlike in other countries where people identified themselves through things like the wearing of hats, such was very uncommon in this country as people have integrated well.

He said problems only arose when people felt burnt out politically and now started exploring other things such as tribe, when politics is supposed to be based on ideas as opposed to tribe.

“These things are not very very good. We have lived in Zambia very peacefully with each other but it will be bad if we start bringing in conflicts. We need these consultations, we need to be meeting,” Chitimukulu said.

He leadership was formed out of conflict rather than just following, saying the country tried the one party state but there were always pockets here and there thinking differently as people don’t always think the same way.

“They are different, let them express what they want,” Chitimukulu said, saying even in Bemba land leadership was birthed through a vigorous process.

Kambwili then chipped in saying people were wondering why there were so many Bembas seeking the presidency of PF.

“But iyo mukwai butambi bwesu (It’s part of our tradition),” Kambwili said.

Continuing, Chitimukulu said said democracy was there in the country therefore those who win must become leaders for all the people.

“Twala umfwanafye ngafilya tumfwana, ni change fye (we continue on the same unity path. What has happened is simply change). But it does not mean that the people have changed,” he said.

Kambwili said the consultation would not end with the paramount chief but would extend to the other Bemba areas and other provinces.

But the UPND’s Chanda accused those who visited the chief as wanting to plunge this country into tribal wars to cover up their crimes.

Local Farmers In Kalumbila District Have Threatened To Block The Road Leading To Their Farms Where Barrick Lumwana Is Doing Some Explorations If The Mine Fails To Meet Their Demands

Speaking during a meeting organized by Kalumbila district farmers association, the visibly angry affected farmers expressed their anger at barrack Lumwana mine sustainability manager Christopher Mukala who was called to hear the cries of the local farmers who have stopped farming activities due mining explorations.

The farmers vowed to take law into their own hands should the mine go ahead with mining activities after explorations are concluded in July as they will not allow their traditional land which was given to them by Chiefs to be grabbed from them by the mine.

The farmers who reached to an extent of blocking the road with logs due to frustrations after premature conclusion accused barrack Lumwana of playing with their minds.

Barrick has told farmers in the affected areas to venture into vegetable production and stop cassava and any other crop cultivation to allow the mine do some mining explorations in a bid to open a new mine.

But responding to queries from the affected farmers’ Barrick Lumwana mine sustainability manager Christopher Mukala said the mine did not force itself to start explorations in the mentioned land but sat and agreed with Chief Mumena, Chief Mukumbi, Chief Matebo, stakeholders and the government after discovering copper in the area in 2005.

He said the mine has also managed to dig two bole holes after concerns were raised by local people on water pollution in the stream due to mining drillings.

He called on the affected farmers to remain calm and wait until explorations are done in July.

Speaking earlier Kalumbila District Farmers Association Chairperson Nsubula Hachipabeenda said they were forced to organize the meeting after noticing that Barrick Lumwana has started entering people’s land without their consent.

He said farmers will suffer terribly because their livelihood depends on agricultural products they produce like maize, cassava and others crops are on halt due to mining drilling currently going on and called on relevant authorities to look into the matter

30,000 teachers being recruited expected to be in class by July – Minister of Education

The government says the 30,000 teachers that are being recruited by the new administration are expected to start working by July 2022.

Minister of Education, Douglas Siakalima said money to pay the teachers once they are recruited is readily available.

Mr. Siakalima said the education sector in Zambia has a deficit of 115,000 teachers.

He said the committees have taken long time to complete the recruitment process because the ministry had underestimated the process in which the exercise was supposed to be completed.

Mr. Siakalima was speaking when he met the District Human Resource Management Committee (DHRMC) in Chipata yesterday.

He said the committees took a long time to finish as evidenced everywhere because they were only given six days, when the whole recruitment process had a lot of things to do.

“This is why I’m trying to more than thank them because the work was too huge. I think they became overwhelmed and that might delay my roadmap but if the provinces can catch up then we will still have the same roadmap,’’ Mr. Siakalima said.

Mr. Siakalima said government spent six months planning for the teacher recruitment exercise because the system was broken by the previous regime.

Mr. Siakalima further said there is a current deficit of teachers in schools because of the free education policy that the government has implemented.

“There are about 60,000 teachers who are unemployed while the government is only employing 30,000.The other 30,000 has been left while the country has a deficit of 115,000 teachers,” he said.

Mr. Siakalima said the real terms on the deficit of 115,000 teachers means there not enough teachers in the country.

“Now, what was going to happen in the next 30 years is that we were going to have a real deficit of teachers, we were to start importing teachers abroad because parents are not sending their children to colleges of education,” he said.

Mr. Siakalima disclosed that Khwame Nkruluma University in Kabwe did an analysis which indicated that from time the government was not employing teachers, there has been drop in enrollment.

“So we were going to face a real deficit but now with the 30,000, everybody wants to go for teaching. There is excitement now and if the President didn’t do this 30 years from now we were going to have a total deficit of teachers ,’’he said .

Meanwhile, Mr. Siakalima said his office has information on some teachers that went to campaign for a named political party during the 2021 general elections.

He further said the new dawn administration is cleaning the ministry because of the politics that had engulfed the education sector in the last ten years

“When these teachers came back from campaigning and the head teachers wanted to discipline them, they said they were connected. Am touching all the teachers no one is connected to anyone anymore. You are connected to the work and to your pupil,” he said.

Earlier, Chipata District Human Resource Management Committee Chairman, Thomas Bwalya informed Mr. Siakalima that the shortlisting of names for teachers in the district was completed on Monday.

Colonel (Retired) Bwalya said the district received a total of 618 applications with some names found to be appearing twice.

“Sir, I would like to inform you that from the 618 applications, the numbers dropped to 599 out of which the 203 slots was given to the district. In the middle of the selection process, we had to categorise them and open envelopes and at times you find that one envelope had two application letters for two different people,” he indicated.

ABOUT STATECRAFT: A CASE OF THE NEW DAWN

1. Over the past couple of decades, management gurus have tried to distinguish between a leader and a manager. But l see the distinction as pure semantics. I mean, how can you manage the people if you can’t lead them? Similarly, how can you lead the people if you can’t manage them? Others try to argue that leading is strategic whereas managing is operational, but l see it as splitting hairs.

2. Anyway, it has been almost 9 months now since the new dawn ascended to power arising from the 12th August 2021 general elections, amidst much pomp and fare. To say that President Hakainde Hichilema’s momentum for reforms has stalled like the Russian invasion of Ukraine, would be an underestimation. The education grant is released on television and yet on the ground there is no money. CDF is released on TV and yet on the ground there is nothing. Political cadres are said to be eradicated on television and yet in the markets and bus stations across the country, they are thriving collecting illegal taxes. The much talked about IMF loan is said to be on the way, and yet it is nowhere to be seen. The rule of law is said to have been restored and yet the President calls press conferences to discuss cases which are actively before the courts and convicts the accused even before trial begins. His legal advisers cut deals with the allegedly corrupt and then make a u-turn thereby losing credibility in the eyes of the Zambian people. Key production inputs such as fuel and electricity are increased at unprecedented rates thereby driving the cost of living through the roof, and yet the Zambian people voted them into office on the ticket or a lower cost of living.

3. The natural question which arises is why Hakainde Hichilema’s presidency is unraveling at such a fast pace? Everything seems to crumble. Even the general mood of the people out there in the streets is extremely negative, especially given the fact that HH won the last election with such a huge landslide. There is no debate that every presidency eventually unravels and runs afoul to the expectations of the people, but it is supposed to take time before people get fatigued. But in the case of President Hichilema however, it has barely been a year. So again the question is why?

4. Different people will attribute President Hichilema’s fast dwindling political fortunes to different factors. Others say it is because he over-promised during his campaigns and is now failing to keep his promises. Others say it is because he decided to lean towards the western powers at the expense China, which has been a major driver of Zambia’s economy in the past few decades. Others say it is because he was not ready to govern and was instead prepared for an election petition. Others say he accumulated a huge amount of liabilities from the people that funded his prolonged stay in opposition and that now he needs to prioritize paying them back, before he can think of delivering anything to the Zambian people. Yet still others say he is not as brilliant a leader as he falsely portrayed himself during his days in opposition.

5. I think all the above factors have contributed to President Hichilema’s dismal performance in the past 9 months, but still cannot explain why he is missing the goal by so wide a margin. To the contrary, l think the President’s biggest undoing is the team that he chose to surround himself with. The travesty of life is that those who have the brawl usually don’t have the brains, and those who have the brains usually don’t have the brawl. Loosely translated in the context of opposition politics, this means that those who have the courage to stand with you through out your trials and tribulations as an opposition leader, will rarely have the brains necessary to constitute your mission-critical team that is needed if you are going to deliver to the expectations of the people, once you ascend to power.

6. But of course morality demands that you repay the debt to those who stood by you when no one else could. And l believe that it is this moral burden that compelled President Hichilema to surround himself with nincompoops, all in the name of repaying their debt of loyalty. These nincompoops shape the President’s policy and approach on the economy, governance, politics, etcetera, despite the fact that the majority lack any ounce of competence in them, let alone statecraft. For instance, the President ended up with a political advisor who speaks about squeezing a political opponent on an unsecured line and even refers and implicates the President and his Vice by name. Surely, what kind of sound political advice can such a novice offer the President?

7. The President’s legal team is another total disaster, starting from the Minister of Justice all the way to the Attorney General, Solicitor General and legal advisor. The majority of these people were personal lawyers to the President and ate off his palm. What sound objective advice can such a team give to the President apart from tilted opinions and shallow schemes that will make the President happy. Lately they decided to soak the President in the Milingo sewer, leaving him very smelly. And the President cannot see all this because he is blinded by past glory of a dream team of lawyers that managed to keep him out of prison. But is that the team that he really needs if he is going to successfully deliver on his presidency?

8. The President’s economic team is another disaster. But on this front, unlike the legal front, it is a well documented fact that the current shambolic economic policies are the President’s idea and not that of his economic team. Therefore, his economic team is only guilty of failing to advise the President against his grandiose ideas of how to turnaround the Zambian economy. For instance, the President has been fixated on an IMF bailout loan as the key to turning around the Zambian economy for almost half a decade now, since the days of the Opposition Alliance when l used to interact with him. Firstly he used to argue that the almost zero-interest IMF loan money will be used to replace the expensive commercial debt that the country has, such as the Eurobond. Then when we told him that such re-financing is not possible due to IMF guidelines, he changed his argument and started saying that getting an IMF bailout loan will give confidence to our creditors that we are fiscally disciplined and therefore make the creditors to develop appetite to restructure our loans. But of late however, the President has changed his argument and is now saying that the creditors need to agree to restructure our debt before the IMF can give us a bailout loan. Clearly, President Hichilema is fixated on an IMF bailout loan, despite the hardship that IMF conditionalities will bring on the masses such as the removal of subsidies on fuel and electricity, despite the fact that our major export earner; copper is selling at record high prices on the world market, despite all the available evidence that we do not need an IMF bailout loan. And of course his economic team is unable to advise their all-knowing boss. Much to the detriment of the Zambian people. What a wasted presidency indeed.

Patriotic Front Presidential Aspirant Emmanuel Mwamba has reported Ministry of Tourism and Arts Permanent Secretary, Mr. Evans Muhanga to the Anti-Corruption Commission.

Mr. Mwamba has stated that the decision by Mr. Muhanga to cancel a validly processed tender related to hunting concessions was a violation of the Zambia Procurement Authority Act of 2020 and other laws.

Mr. Mwamba stated that information has publicly emerged that Mr. Muhanga blatantly defied legal advice from the Attorney General and cancelled the tender.

Mr. Muhanga also annulled the subsequent Hunting Concession Agreement.

Mr. Mwamba stated that another decisions by Mr. Muhanga to fire the Director General of the Department of National Parks and Wildlife, Dr. Chuma Simukonda constituted gross abuse of authority as he refused to participate in the illegalities being perpetrated by the Permanent Secretary.

Mr. Mwamba he had copied his letter of the complaint to the Secretary to Cabinet that he considers effecting immediate administrative action against the Permanent Secretary for gross violation of the law, and breach of public service regulations.

He said the action by Mr. Muhanga will cost government huge sums of money when the affected parties take the matters to court.

He urged the Anti-Corruption Commission to investigate and arrest Mr. Muhanga for abuse of office and related charges.

RE; GROSS UNLAWFUL PRACTICES BY PERMANENT SECRETARY OF MINISTRY OF TOURISM AND ARTS-EVANS MUHANGA

I am deeply troubled by events occuring at the Ministry of Tourism and Arts.

Information has emerged of two matters that clearly constitute illegalities, abuse of power and possible criminal conduct.

The Permanent Secretary, Mr. Evans Muhanga on 4th May 2022 wrote a letter to cancel a legally and legitimately procured tender related to Hunting Concessions and proceeded to annul Agreements produced to that effect.

According to information now in public, Mr. Muhanga wrote a letter to the Attorney General Reference No. MTA/54/14/2 dated 15th December 2021 in which he sought an opinion on his consideration to cancel the Hunting Concession Agreements.

The Attorney General Mr. Kabesha Mulilo advised that doing so would be illegal and would eventually cost government huge amounts of money in damages.

And the Attorney General, in his capacity as Chief Legal Advisor and Principal Advisor to Government rendered an opinion in a letter dated 5th January 2022 to the President of the Republic of Zambia, Mr. Hakainde Hichilema, highlighting the dangers of such a cancellation.

Despite these actions by the Attorney General which are designed to safeguard public resources and promote the rule of law, Mr. Muhanga proceeded to cancel the awarded tenders, annulled the Hunting Concession Agreements and ordered in a MEMO dated 22nd April 2022 to the Director of National Parks and Wildlife, Dr. Chuma Simukonda, to re-advertise the tender.

He also informed the bidders in a letter dated 4th May 2022 that he had cancelled the tender and had annulled the Agreements.

And sadly we have just learnt that Mr. Muhanga has unilaterally terminated the contract of the Director of the Department of the National Parks and Wildlife, Dr. Chuma Simukonda in a letter dated 10th May 2022.

This is because officers such as Dr. Simukonda have refused to participate in these profound and clear illegalities being perpetrated by Mr. Muhanga.

Dr.Simukonda is a world-renowned environmentalist and he has represented Zambia’s national parks and wildlife policies at various local and international forums including to the USA Congress and to the United Nations.

DEMANDS

It is clear that the Permanent Secretary is engaged in illegalities, wide breaches of the law as shown in these cases.

The PS may NOT be excused or absolve himself that he is following presidential directives or orders as public service officers are obliged by law and Public Service Regulations, to strictly adhere to principles guiding their offices.

It is hoped that Dr. Simukonda will be reinstated to his position at the Department of National Parks and Wildlife as he is a victim of excessive abuse of office by his superior and that the legal liability and cost of the cancellation of Hunting Concession Agreements must be borne by Mr. Muhanga to serve as a deterrent to officers that wilfully break the law with impunity.

For the Anti-Corruption Commission, it is envisaged that criminal charges of abuse of office or Authority and unlawful practices by Mr. Muhanga will speedily be investigated and prosecuted.

A SEX-worker in Mazabuka district in Southern Province is worried about two things.

Her first worry is that there is a high number of young girls joining the sex work business. #Kalemba finds sense in this concern.

Her second worry borders on the economic concept of demand and supply – that there are too many sex-workers chasing few male clients. Hilarious! But read on.

Commercial sex work continues to be a secret undertaking, especially during the night when only mosquitos are awake to disturb a love-making session.

Nobody wants to be called a sex-worker or a prostitute, yet prostitution is said to be the oldest profession on earth, and it’s not about to stop.

Actually, Internet has pushed prostitution into an orgasm because one can ‘buy’ online what they want to chew or to directly swallow.

Probably because of being a Christian nation, Zambia has fruitlessly tried to stop the vice of prostitution.

There have been workshops, empowerment programmes and all sorts of initiatives by both the government and non-governmental organisations (NGOs) to nip prostitution in the bud.

But it seems as though every such effort just emboldens prostitution to become a legal act where members of the profession can gather courage to even form a union and affiliate it to the Zambia Congress of Trade Unions (ZCTU).

But this story is not about high-class unionism – the Leonard Hikaumba way, back in the years. It’s rather about Ruth Mwite (not real name) of Mazabuka town.

Ruth is an experienced sex-worker who started engaging in the nocturnal trade on the streets of the holy/evil Lusaka city.

When she saw that Lusaka city has so many sex-workers competing for not-so-many big boys, Ruth made up her “business mind” by re-locating to Mazabuka.

Unlike others, she didn’t go to Mazabuka to engage into sugarcane cutting at Zambia Sugar in Nakambala area; she went there to look for more sweeter things in life.

Ruth continued with her sex-work business in the small but sweet town of Mazabuka where stuff can be displayed and seen, with relative ease, by those who want to buy and eat.

But no! There is something that is worrying Ruth about this prostitution work.

According to her narration to #Kalemba, the risky profession of prostitution has seen a large number of young girls and, in some instances, married women joining.

Ruth said commercial sex work in Mazabuka town is sharply increasing.

She regretted that many young girls and married woman are joining the business for an easy way out of poverty.

Ruth said the number of young girls who are throwing themselves into the act is worrying.

“There are girls as young as 17 years old who are joining,” Ruth said, with a countenance of regret.

“The rapid increase in the business has made men scarce because there are a lot of prostitutes and less men.”

Meanwhile, Ruth indicated that some sex workers get abused by their customers but that not much is done when such cases are reported to police.

“I am doing this to find capital for a business, of which afterwards I will leave and start a decent life,” Ruth said.

Ruth said she gets shocked to see how older men go for the services of younger sex-workers, instead of being their counsellors.

Whatever the case, one can only wish for prostitution to drastically reduce in Zambian towns and cities. After all, it’s even difficult to tell whether people who work in this profession do white-collar or manual work.

GOVT CALLS FOR PROTECTION OF OVER 160,000 MOBILE MONEY AGENTS

Technology and Science Minister Felix Mutati has disclosed that the ministry is closely collaborating with security wings, financial institutions and other key sectors to ensure the protection of the over 160,000 mobile money agents.

The minister disclosed this yesterday at a joint briefing with AYO, a subsidiary of MTN Zambia, offering insurance products to Zambians using mobile money platforms.

Mr Mutati said in addition to the awareness campaign that government will continuously undertake, the insurance component will answer to some of the challenges of cyber security affecting mobile money agents.

Mr Mutati implored mobile telecommunication providers to assure the mobile money agents across the country that their monies are protected through insurance as a solution that addresses the country’s digital transformation strategy.

“We have over 156,000 mobile money agents. We need them to feel comfortable when they go to work that their money and earnings are protected so that whatever happens, somebody will be able to cover them. Let’s look after our mobile money agents, they need to be protected” Mr Mutati said.

And Mr Mutati observed that the low insurance penetration in Zambia which is currently at around 5 percent is attributed to challenges around affordability, access and availability, thereby having majority of the nation not insured.

He said while the acquisition and ownership of mobile phones amongst the people has increased, there is still a lot of work that has to be done in the aspect of financial inclusion which requires solutions and products that will create customer happiness.

Mr Mutati said even as the country embarks on the development of a digital strategy which should encompass insurance as a component, there will be need to address affordability, availability and access of services.

Mr Mutati also called on all players in the insurance industry to emulate AYO on their strategy especially that majority of their market segment is focused on the ordinary Zambians, enabling them access insurance products on mobile phones.

“Availability, access and affordability is at the heart of our digital strategy. Even as we look at insurance as a component of that digital strategy, it has to fit into the three A’s so that at the end of the day, we are looking at what the customer is expecting from the transaction” he said.

Speaking at the same meeting, AYO Group Chief Executive Officer Marius Botha said Zambia has a lot of opportunities for economic growth.

Mr Botha said about 80 percent of the customer base on their platform that are able to access insurance cover using the mobile money platforms are from low income households such as marketeers among others.

Meanwhile, AYO Zambia Limited Chief Executive Officer Andrew Nkolola disclosed that AYO insurance platform now has in excess of 2 million individual subscribers on board using MTN sim cards.

DP president Harry Kalaba says the country should be worried because it has a President whose agenda is coming from outside the country.

He says President Hakainde Hichilema should come out and state his agenda.
“He is busy talking to the Anglo-American, Oppenheimer, because they are the ones that procured his presidency and they funded his presidency,” Kalaba said when he featured on Kapiri Mposhi’s KBC Radio on Sunday. “…so we know the relationship that is there. You can dupe others and not us. But the truth is that the President is not being sincere with the Zambian people. He has done it too early. He has shown his true colours too early and that is sad.”


Kalaba wondered why Anglo-American returned to the country just after President Hichilema became the Head of State.
“You should be worried not just me as former foreign affairs minister but the country should be worried. You have a President whose agenda is not with him. He’s agenda is coming from outside. The fact that the President dances when he hears an invitation coming from the Oppenheimer Foundation or group should make you very worried. Why should the President go for a book launch for Oppenheimer…in South Africa? He left whatever he was doing here and went for a book launch in South Africa. You have been doing here, choirs sing here in Kapiri, a lot of choir people are doing album launches, and they write to the President. The President has refused to come to Kapiri for an album launch where they just voted for him…You gave him so many votes but he doesn’t care about Kapiri Mposhi,” he said. “The President’s heart is to go to Oppenheimer. Even when he went to Cape Town [for the Africa Mining Indaba], we saw that he reached earlier than the President of that country [Cyril Ramaphoas]. He was not even in the opening session but our President was already there. So it is worrying us. The president needs to tell us the agenda. What is he talking with Oppenheimer? What is his relationship with [former Nigerian president Olusegun] Obasanjo? Why is it that when he has come Anglo-American has also back into Zambia?”
Kalaba said President Hichilema is not being sincere with Zambians.
He noted that President Hichilema has started showing his true colours early.


“I mean, has the President gone ahead to privatise our country. Is that what is happening? Because honestly what we are seeing now is that this country is now going for the rich, by the rich and the President doesn’t even care about the poor people in this country. He is interested, he is busy talking to the Anglo American, Oppenheimer because they are the ones that procured his presidency and they funded his presidency. He has to show gratitude. Me, I thought that he would show gratitude to Zambians who voted for him overwhelmingly and removed the PF and put him,” Kalaba said. “But I think that is not happening. I think that is sad. We would want the President to be very categorical and you are the journalists, you should be able to ask him when you find him at the airport when he is coming back from the Oppenheimer Foundation. Ask him, ‘where you are coming from, why have you liked going there all the time?’ You just became President and one of the guest speakers we had was Obasanjo. How did he find himself here? We know him and Oppenheimer, he sits on that board of Brenthurst. So we know the relationship that is there. You can dupe others and not us. But the truth is that the President is not being sincere with the Zambian people. He has done it too early. He has shown his true colours too early and that is sad.”
And Kalaba challenged the UPND government to publish the memorandum of agreement between Zambia and AFRICOM.


“I met the lady in charge of politics at the American Embassy on the European Union day. And I did bring this to her attention that for us, we have written a letter to them. We have tried to engage the American using quiet diplomacy that is why you have not heard Harry Kalaba or any of my colleagues talking about AFRICOM so much. It is because we have written to them. AFRICOM is a very serious thing and so just talking and ending it might not be there. So we had to write to them to enquire further. They promised to get back to us. We would want for them to get back to us,” said Kalaba. “We are talking to them. Why did you not publish the memorandum of understanding of AFRICOM and the Zambian government? And according to the Americans, they do not have a problem with it and they said ‘it is not ours, our job, to release that document. I think the Zambian government should be the ones because they are the ones who deal directly with you the public’. So we are expecting the chief government spokesperson, again you are the members of the press who should speak to Madam Chushi Kasanda to give us the MoU between the Zambian government and AFRICOM. My worry is, normally if you have an embassy in a country, the way the American Embassy is here in Zambia, there should be no need of a memorandum of understanding because the Embassy itself has already done that. We did that MoU with America in 1964 when we got our independence. If something has changed, then there will be an MoU. So we want to see what addition has been done. Is it a base, is it a desk? Are they bringing a full combat team here? Or is it just a desk for them to coordinate their security issues within the framework of Zambia as a country? Those are the issues we need to understand and they can only be understood if we had sight of the MoU.”

Our Honourable Members of Parliament (MPs) from the United Party for National Development (UPND), the Patriotic Front (PF), the Party for National Unity and Progress (PNUP), Independents as well as nominated ones, we are compelled to address ourselves directly to you on an urgent matter of national public interest and concern.

We have the very grave issue of the Africa Command (AFRICOM), which is one of unified combatant commands of the United States Department of Defense that our President has allowed to set up an office here in Zambia.

We are of the view that you, as Members of Parliament, should have approved the authorization of the entry of AFRICOM as you directly represent the interests of the Zambian people dotted in various constituencies.

Sadly, and to the detriment of desirable national consensus on many similar matters of national public interest, MPs have tended to serve the interests of their respective parties or other political considerations instead of placing the people and national interest first. We need to move away from this scenario and begin to place our constituents, who elected us, first and above our parties. These are the people we represent.

We would therefore like to request and at the same time appeal to you, our Honourable Members of Parliament, to consider and act on behalf of us the Zambian people and do the right thing on this matter regardless of whether you are a UPND, PF, PNUP, Independent or even nominated Member. Zambia must come first.

It is our view that you, as representatives of the Zambian people, should seek further clarification concerning the establishment of a Command Office for AFRICOM in Zambia.

The following questions, amongst many others, need to be raised with our President, as soon as possible, by yourselves, for the avoidance of any further doubt and for the sake of transparency:

1. Has the Agreement with the Americans been signed?

2. If so, why was Parliament or any other arms of Government – apart from the Executive – not involved in the approval of this Agreement?

3. If already signed, when was the Agreement signed?

4. Zambia has had military cooperation before with foreign countries (including the USA) through their Military Attaches but we have so far not seen the necessity for setting up Command Centres for those nations in-country. Why has it been deemed urgent and imperative to set up such a Command Centre for the USA now?

5. What deficiencies have we identified in our existing cooperation Agreements and those we have had with the USA in the past that will be rectified only by the bringing of AFRICOM to set up their office here?

6. What threats are we seeing now and/or in the foreseable future that necessitate this move?

7. How have we accessed training and and technical assistance in the past without infringing upon our sovereignty?

8. Could we have full disclosure of the contents of the Agreement, to the Zambian people through Parliament, in keeping with the need of absolute transparency and accountability in matters of national strategic importance, such as this one? The people, even if it is only through you as their Members of Parliament, deserve to know the detailed contents of the Agreement signed if at all, with AFRICOM.

9. What benefit does Zambia derive from this Agreement?

10. Was the signing of this agreement in the manner that it was, Constitutional?

Our Honourable Members of Parliament, you will note that according to the website of the US Embassy in Zambia, AFRICOM was established to represent and advance US (not Zambian) national interests. Please recall also that American presence in countries such as Afghanistan, Somalia, Iraq etc., has not left anything but a trail of blood and longterm chaos. Is this what we want for our peaceful nation Zambia?

We would like to ernestly appeal to you, our Honourable MPs to serve Zambians first before your parties or indeed any other interests. Zambia needs you more than at any other time to be patriotic for the sake of our generation and for the sake of our children and their children generations after them.

Manchester City fans beg Yaya Toure to lift Champions League ‘curse’

Supporters of the English champions urged the former midfielder to ‘forgive’ Pep Guardiola so that the club can win the European title

Manchester City fans have taken to social media to request former midfielder Yaya Youre to lift the ‘curse’ so that their team can win the Uefa Champions League in future.

Toure was a top trending topic last week when City were knocked out of the Champions League by Real Madrid, having been seconds away from sealing a second straight final.

Many blamed the heartbreak on comments made by the ex-player’s agent that ‘African shamans’ will never allow manager Pep Guardiola to win the competition because he treated the Ivorian ‘unfairly’ in his final season at the club.

This came to the fore again on Monday when City were marking four years to the day Toure since made his final appearance for the club.

The Premier League champions posted a photo of the player alongside his elder brother Kolo, also a former Citizen, celebrating his achievements that include three league titles, as many Carabao Cups and the FA Cup.

“Lift the UCL [Uefa Champions League] curse,” @311_hozu told Toure with @swastiksharma_ adding: “Tell him to reverse the curse pls [please].”

Some supporters wondered just what City might need to do for Toure to lift the ‘curse’.

“Maybe if we put a statue of him we can win the Champions League,” said @idrissthehabibi.

“Pep say sorry to him, I beg you,” commented @damian_manev with @sushruth2902 also feeling that Guardiola might need to apologise “Pep apologise right now.”

A section of supporters felt the Manchester club was sanitising itself with the Toure tribute.

“They’re trying to rid themselves of the curse,” replied @adineelamana.

“Ahah they really trying to get rid of the curse man left on the club,” said @kunal__kaul.

“Y’all [you all] tryna [trying to] get him to forgive us,” observed @iamtoxicisland.

Others wondered why the club was even celebrating Toure’s achievements.

“Farewell to a guy who cursed us?” posed @sky_t.21.

“A legend whose agent put a curse on us,” commented @robin_j_wagner.

With Toure already receiving respect, some fans think it is time the same is extended to his agent to end the bad blood.

“We have treated you well, now where can we find your agent?” commented @creativesoul.jd.

But some fans chose to focus on what Toure did for the club instead.

“He deserves to be a legend,” @cityzens_city said with @professor_gerald concurring “He will forever remain in our hearts.”

“What a career mate, well done lad,” replied @unknown71992.

Toure joined City from Barcelona in July 2010 and went on to make 316 appearances while scoring 79 goals, many of them in decisive games.

Tucker Carlson, the controversial FOX news TV host has blamed the Buffalo, New York shooting on mental illness of the shooter and US president, Joe Biden.

On May 14, 2022, a mass shooting occurred in Buffalo at a Tops Friendly Markets store, a supermarket in the Kingsley neighborhood on the eastern side of the city.

Ten people were killed, and three others were injured; 11 of the victims were black. The shooter, livestreamed the attack on Twitch.

The accused, identified as 18-year-old Payton S. Gendron of Conklin, New York, was taken into custody and charged with first-degree murder.

In an online manifesto, Gendron claimed the right-wing conspiracy theory that white people are being taken over by minorities. But Carlson, has now come out to blame plenty of other factors for the weekend shooting that left 10 people dead.

In the past Carlson has repeatedly theorized that minorities are trying to take over the US, and called the shooter a mentally sick person who shouldn’t blame his shooting ok racism.

“Gendron’s screed, which laid out careful plans to kill as many Black people as possible, as well as Jewish people in New Jersey, isn’t actually a racist manifesto, Carlson argued.

“It’s definitely racist, bitterly so. Gendron reduces people to their skin color and that’s the essence of racism and it’s immoral. But what he wrote does not add up to a manifesto. It is not a blueprint for a new extremist political movement, much less the inspiration for racist revolution. Anyone who claims that it is is lying or hasn’t read it.”

Instead, he said, the 180-page document is “a rambling pastiche of slogans and Internet memes, some of which flatly contradict one another.”

“The document is not recognizably left-wing or right-wing; it’s not really political at all.

“The document is crazy. It’s a product of a diseased mind.” Carlson said.

“He writes like the mental patient he is — disjointed, irrational, paranoid. Now, that’s true, not that it makes the atrocities he committed easier to bear. If your daughter was murdered Saturday in Buffalo, you wouldn’t care why the killer did it or who he voted for.”

Then, Carlson blamed the Democrats, including President Joe Biden, for a “coordinated campaign to blame those murders on their political opponents.”

The Fox News host also blamed the spread of white identity politics on race politics, comparing it to the Rwandan genocide.

“All race politics is bad, no matter what flavor it is. It’s poison. It subsumes the individual into the group. It dehumanizes people,” he said. “It elevates appearance over initiative and decency, and all the other God-given qualities that make people unique yet morally equal to each other.”

The solution, he said, is to move toward a “colorblind meritocracy” where we ignore races.

For the first time in 50 years, The US Congress held a congressional hearing on UFOs also known as unidentified flying objects or unidentified aerial phenomena, with the Pentagon saying the mysterious sightings are a ‘national security concern’

On Tuesday, May 17, the Deputy Director of Naval Intelligence Scott Bray and Under Secretary of Defense for Intelligence and Security Ronald Moultrie showed declassified footage during his opening remarks at a historic open House hearing on unidentified aerial phenomena.

The presentation happened in a House Counterterrorism, Counterintelligence, and Counterproliferation Subcommittee with the Pentagon showing declassified photos and video of UFOs including a flying object without a “specific” explanation” – as lawmakers pressed military officials on the mysterious sightings.

In one brief and shaky video, a small object appeared to zip past a military pilot. In a separate video and a similar photo taken at a different time, glowing triangles can be seen in the night sky.

Bray, while presenting the images and videos, said the video and photo of the glowing triangles remained unresolved for some time, but was eventually identified as unmanned aerial vehicles. But that the military does not know what the object in the first video could be.

The Pentagon also said it doesn’t rule out space aliens while other possible explanations are “airborne clutter” like birds and balloons, “natural atmospheric phenomena,” like ice crystals, highly classified U.S. government programs, or “foreign adversary systems” from Russia, China or other countries.

“I do not have an explanation for what this specific object is,” Bray said in an exchange with Intelligence Committee Chairman Rep. Adam Schiff, D-Calif.

Bray also said Tuesday that there have been at least 11 “near misses” between U.S. military aircraft and UAP. He also said the U.S. military hasn’t tried to communicate with UAP, including the unexplained object in the video shown earlier in the hearing which “may or may not be in controlled flight.”

Lawmakers warned that the Unidentified Aerial Phenomena (UAP) are a serious national security threat.

“Unidentified Aerial Phenomena are a potential national security threat. And they need to be treated that way,” subcommittee Chairman Rep. Andre Carson, D-Ind., said Tuesday.

“For too long, the stigma associated with UAPs has gotten in the way of good intelligence analysis,” Carson added.

“Pilots avoided reporting, or were laughed at when they did. DOD officials relegated the issue to the back room, or swept it under the rug entirely, fearful of a skeptical national security community.”

On Tuesday 17th May 2022, the Swedish and Finish Embassies flew the flags, on their premises, of the Lesbian, Gay, Bisexual, and Transgender (LGBTQI). The bassies stated that they did this in support and commitment to LGBTQI rights.

We demand answers from the Ministry of Foreign Affairs and International Cooperation.

Zambia has not recognised LGBTQI rights and the practice of homosexuality remains a criminal offence in Zambia. This issue raises serious traditional, cultural and religious concerns and the Zambian people have constantly rejected this matter everytime it has come up for both debate or policy consideration.

It is therefore surprising that these embassies chose to fly these flags at their premises without due regard to the law and cultural sensitive of Zambians and Zambia to the matter..

Under the 1961 Vienna Convention guiding Diplomatic Relations, Diplomats are mandated to respect the law of the receiving State and it is a serious breach of the Convention to break the law of the host country.

Similarly their premises, although enjoying immunities and privileges, must not be used for other purposes other than the approved and agreed purposes as guided by the Convention and host country.

Article 41 of the Vienna Convention provides that;

(1.) “Without prejudice to their privileges and immunities, it is the duty of all persons enjoying suchprivileges and immunities to respect the laws and regulations of the receiving State. They also have a
duty not to interfere in the internal affairs of that State.”
And
(3) “The premises of the mission must not be used in any manner incompatible with the functions ofthe mission as laid down in the present Convention or by other rules of general international law or byany special agreements in force between the sending and the receiving State.”

It is imperative that the Ministry of Foreign Affairs and International Cooperation resolves this blatant disrespect of Zambian laws and the culture of its people and the utter disregard by these Embassies for the Convention regulating Diplomatic Relations between Zambia and their States.

” It would be folly for me to sit on the other side and oppose the implementation of some of the very policies that I helped the UPND craft and adopt,” says Charles Kakoma as he sends a passionate apology to Republican President Hakainde Hichilema,his wife Mutinta and the greater UPND family on his decision to defect and join the PF last year.

And UPND Secretary General Batuke Imenda has urged arm chair critics of the UPND mobilisation strategies to assist his office with workable and practical methods of growing the party without receiving citizens wanting to join the party.

Meanwhile,former Chilanga UPND Member of Parliament Captain Cosmas Moono says it will be hypocrical of him to remain in the terraces at the time when the UPND were implementing workable solutions for the good of the country.

Mr Kakoma who rejoined the UPND at a Media briefing this morning said he was part of the team that spent sleepless nights in crafting the party’s free Education policy which has seen an increase in the number of learners in public schools while the recruitment of 30,000 teachers and opposing such policies that have proven popular so far would be rendering a disservice to the nation.

“I have today made up my mind to come back to my political home. It became a challenge for me to sit there and oppose the very policies I helped in crafting.This is I’m here to ask the Secretary General to find space in his heart to allow me to rejoin the UPND. Why should I start opppsing what is good for the Zambian people?” asked Kakoma.

He further added that government under the leadership of President Hakainde Hichilema was working at providing workable solutions in stabilising the economy which was in its doldrums and he felt the need to rejoin the ruling party at the time the country was going through hardships as it tried to stabilise itself.

Mr Kakoma who was the party’s longest serving chairman of information before the 2021 intraparty elections said the decision by the government to let go of the expensive black market borrowing of capital in preference for the cheaper and flexible IMF was the correct way of doing business as the past way of doing business had suffocated the country leaving it in debt.

He also took time to apologize to President Hakainde Hichilema, the First Lady, Mutinta Hichilema and the general UPND party membership for leaving them at the eleventh hour out of frustration.

“I wish to offer my sincere apologies for injuring many of the people in the party in particular the President of the Republic of Zambia. As most if you know, the President has been a friend and for me to have left him at the eleventh hour would have been injurious to him. SG, please convey to his Excellency that Mr Kakoma is very sorry. Also convey to Mutinta Hichilema that I am very sorry. She was very welcoming to me each time I visited Community House. She was I believe hurt that the person that she trusted so much had betrayed her husband”,he said.

He further apologized to the National Management Committee-NMC-members, the party’s National Executive Committee-NEC-and the rest of the party hierarchy across the country.

And first UPND Chilanga member of Parliament and Chairman for Security and Defence, Captain Cosmas Moono said he has decided to officially rejoin the party so that he can participate in the country’s developmental agenda which he described as being on the right trajectory.

Captain Moono who left the UPND in 2015 before losing the Chilanga seat on the PF ticket in 2016 and subsequently losing as an independent candidate under Choma Central in 2021 says the new policies under President Hichilema and his administration such as the fight against corruption, payment of retirees benefits and other arrears had prompted him to openly rejoin politics.

“When you’re a politician and things a happening…like, when UPND formed Government in 2021 and started implementing progressive policies, I decided that i had to officially rejoin the UPND so that I could be part of the party’s development agenda. With the trajectory on which the New Dawn is moving, I see Zambia becoming a prosperous nation,” he said.

Meanwhile,Secretary General Batuke Imenda who welcomed the two party founder members says it was a pity that he had been receiving alot of negative publicity from online bloggers who mostly are never found in the campaigns to witness first hand challenges campaigners were going through.

Mr Imenda says in as much as he welcomes negative criticism,it was be imperative that such criticism is accompanied by solutions that would help grow the party in readiness for 2026 other than accepting both new and old members into the party.

“We have to understand that no person is bigger than the party and the coming back of Mr Kakoma and Captain Moono is a clear indication that one is safer inside than outside. These two gentlemen were there at a time when it was unfashionable to belong to the UPND. They stood their ground in 2006 when the party had disintegrated. If they were not strong at that time, there would never have been a UPND-led Government,” he said.

“We know what they did when the party was struggling and at the rock bottom. When am criticized for bringing such people back into the party, I keep quiet because I know where the party has come from. If our policy as a party was that we would not receive anyone, the party would have gone down.These men were there at the founding of this party. They strayed and we must feel that when one is lost, we have to find ways of reconciling.These are the epitome of the UPNDs institutional memory and it is just prudent that we welcome and accept them back home where they belong”,the UPND chief executive officer said.

State House Scandals Will Affect Imf Program- Trevor Simumba

STATE HOUSE SCANDALS WILL AFFECT IMF PROGRAM-TREVOR SIMUMBA

ECONOMIST Trevor Simumba says the bad headlines, State House official scandals, among other issues are sending a wrong signal to the IMF.

And Simumba says President Hakainde Hichilema must reset his government to show that he believes in the rule of law, accountability and transparency.

Meanwhile, Simumba has described government’s statement that it has no Plan B away from the IMF programme as wrong and scary.

In an interview, Simumba said the IMF was observing all the happenings in the country and wondering if Zambia had indeed transformed to a nation which upheld the rule of law.

“The thing is this, the people who make the decisions at the IMF in terms of these programmes it’s the executive board. And the executive board is representing all the members of the IMF and so those executive board members, they scrutinise these issues carefully. And remember that all the bad headlines that we have been seeing in the last two months, three months in this government, these executive board members are seeing them,” he said.

“When they are seeing opposition politicians being arrested for defamation, they are hearing the President threaten citizens because he feels that those citizens are criticising too strongly, they begin to ask themselves the questions is this really a change in Zambia? Is this really the government that believes in the rule of law? When they see that the State House and senior officials are involved in deals with the provisional liquidator of KCM, it sends the wrong signals.”

And Simumba asked President Hichilema to reset his government to show that believes in the rule of law, accountability and transparency.

“And for me, it’s very important that the President resets his government. He needs to reset his government, he needs to show clearly by his actions not just by words, by his actions, that he believes in the rule of law. He believes in accountability and he believes in transparency and allow the police, the anti-corruption commission and the DEC and all these law enforcement agencies to do their jobs effectively so that this corruption fight is not seen as partisan. At the moment, unfortunately, it is seen as partisan. At the moment for example, Milingo Lungu, suddenly he is a hero when we all know that that whole liquidation process was done very unfairly,” he said.

“It was not for the benefit of the country, it was to the benefit of individuals and many other interest groups within the Patriotic Front.”

Meanwhile, Simumba described government’s statement that it had no Plan B away from the IMF programme as wrong and scary.

“It is very wrong and it is very scary because there are no guarantees with the IMF. I will recall Greece, if you recall some years ago, Greece was in serious trouble. I remember the first time they started talking between the IMF and Greece, they were talking about a 20 billion line of credit. Suddenly by the time decisions were made, it went down to 10 billion. And actually, all it did was to create more debt for Greece and it took Greece a long time. In fact, the finance minister lost his job because of that failure of the first IMF programme. So Dr [Situmbeko] Musokotwane, I would advise he is skating on thin ice,” Simumba said.

He said government should treat the economic recovery plan developed by the previous administration as a Plan B.

“If you recall, both ministers are in this government – Mutati and Musokotwane. When Mutati was minister of finance, remember that Mutati developed the Zambia Economic Recovery Programme. And that programme is there in the Ministry of Finance and that programme was based on Zambia acquiring a $1.3 billion loan from the IMF and getting on a programme. So what is wrong with using that programme as a basis at least? Of course the UPND would want to add their own nuance to it, their own tax to it but it is there. The Zambia Economic Recovery Programme is there so I would urge you to ask the Minister of Finance, send him a query, the minister said there is no Plan B but what has happened to the Zambia Economic Recovery Programme? Because that would be a good Plan B of course taking into account the latest data, it would help,” Simumba said.

He insisted that as Zambia pursued the IMF programme, it needed to develop a plan on how it would grow the economy while on the programme.

“So we need to have a programme of growth. A programme of how we are going to grow the economy because you cannot just get this money from the IMF and then sit back. It does not work like that. We need to create an environment that will attract investment not just in primary production like mining agriculture, but in value adding because that’s a real game changer. If we can have more manufacturing across the country, adding value to our primary products, then we are going to have much more employment and also linking our SME to the sub supply chains into the agriculture sector into mining. We should be seeing Zambians supplying Zambeef, supplying all these big agricultural companies, national milling. Zambians should be supplying KCM, Mopani, First Quantum Minerals,” Simumba said.

“You know, First Quantum has announced a big expansion of one point something billion dollars. I would love to see in that expansion, a guarantee that 40 percent of that 1.3 billion will go to Zambian suppliers, contractors, labour and all this.”

Simumba also said government should quickly find a solution for KCM and Mopani.

“And for me, I would really love to see a solution to KCM and more importantly also Mopani. A strategic investor should be found. ZCCM should increase its shareholding in Mopani and also possibly in KCM. We should see more senior management in KCM that are Zambians. This thing of bringing people from India, and in fact, India is not even a mining country compared to Zambia, let us have credible Zambians to run KCM and they can run it efficiently. And one thing I forgot to mention, there were a number of senior Zambian managers at KCM removed by the provisional liquidator, those people should be brought back without condition, get back their jobs because they were unfairly treated,” he said.

Simumba said PF left the country in a mess.

“We know the mess that the PF left this country in. It is important for us, we have a new government, it is important to focus on solutions and the solutions require transparency, accountability and the rule of law. That is all we need from the government. If the government decides that for example, they don’t want Vedanta they want to bring someone else, explain to us clearly why you have taken that decision and how you are going to manage that process and how you are going to select those new investors. Because we also don’t want single sourcing,” said Simumba.

“We do not want let’s say, ‘let’s just give it to Anglo America, you know these are our friends they used to be here’, no! Let the process be clear and transparent and competitive. And that ensures that we get the best deal out of it for Zambia because the responsibility it is to us Zambians first, not foreigners.”

HH has tried and convicted me publicly, Lusambo tells court

KABUSHI PF member of parliament Bowman Lusambo has asked the Constitutional Court to determine whether President Hakainde Hichilema acted in excess of his powers to question the source of his wealth during a press conference last month.

Lusambo argues that President Hichilema has tried and convicted him publicly with the full knowledge that the matter is active before court.

This is in a matter where Lusambo is facing 10 corruption-related charges before the Economic and Financial Crimes Court; among them one count of corrupt acquisition of public property, five counts of possessing property suspected to be proceeds of crime, three counts of tax evasion and one count of conspiracy to defraud.

He is jointly charged with his wife Nancy Manase for possessing four houses in Silverest Gardens, Chongwe which were suspected to be procceds of crime.

When the matter came up before magistrate Faidess Hamaundu, Lusambo’s lawyer Makebi Zulu submitted that on April 25 the Head of State during a press conference questioned where Lusambo got US $150,000 to buy a house when he was just a die hard cadre who could not afford a first class ticket

Zulu said the matter, being active before court, precludes any person from making comments touching on the case.

He submitted that Section 116 (1)(d) of the Penal Code provides that any person who comments on matters active before court capable of prejudicing any person is guilty of contempt of court and liable to imprisonment for six months or a fine amounting to 750 penalty units.

“The statement by the President was unfortunate and falls squarely within the supervision. We are aware that he is immune to prosecution and as such cannot be cited for contempt. Article 91(3) makes it incumbent on the President to protect and promote the rights of the accused person before you,” Zulu said. “The accused person was tried and convicted by the President publicly in a matter where he was surely aware was before court. He questioned why people were rushing to the Constitutional Court and their fear.”

He said the statement by the Head of State was an abrogation of the Constitution as Article 122 (4) provides that a person holding cabinet office shall protect the independence, dignity and effectiveness of the judiciary.

Zulu requested that the matter be referred to the Constitutional Court for determination on whether or not the statement amounts to violation of the Constitution.

“The court should deal with the contempt first by purging the contempt and then the matter can be dealt with. By reason of Article 98 of the Constitution which gives immunity to the President, the only route available to this Court is to refer the question to the Constitutional Court as to whether the conduct and speech of the President was in contravention of the constitution,” said. “The Court should determine whether Article 98 allows the President to breach the law. We pray that the Court refers the matter to the Constitutional Court as the person at the Centre of the contempt is not an ordinary person but a person who wields executive authority.”

In response, state prosecutor Martin Mayembe said the preliminary issue was misplaced and was not supposed to be raised before Court.

He said the statement was made outside court, and the alleged contempt could not be construed as contempt.

Mayembe submitted that the defence should have brought the issue before court in a different manner.

“Suggesting that the application will prejudice Lusambo is unfounded as the judiciary is independent and not subject to control from any person with authority. The contempt being alleged under section 116 of the Penal Code is civil in nature. This is an attempt to have the proceedings arrested and delay them further,” said Mayembe. “The issues being raised can be separately dealt with without undermining the proceedings before Court.”

Another prosecutor Tyson Mudenda submitted that the issues raised border on allegations against the President when the Constitution has provided guidelines on actions to be taken by people aggrieved with the actions of the President.

“The entire case cannot be referred to the Constitutional Court but only the issues raised by the defence ought to be referred. Whatever actions those aggrieved by the President take cannot be a basis to abort criminal prosecution.
The nature of the complaint is civil and cannot arrest criminal proceedings,” said Mudenda.

Zulu clarified that the application was not bordered on contempt but the interference of the independence and performance of the judicial function by the President as he drew a conclusion that Lusambo was guilty.

He said no civil proceedings have been instituted as the application was made under the criminal proceedings.

“The application is for a constitutional reference and a determination that will guarantee the protection of the rights of the accused to a fair trial. We could have made an application for the court to censure the President but it will require interpretation on such abhorrent conduct that impugn the right to a fair trial, so that it is nipped in the bud,” said Zulu.

Magistrate Hamaundu adjourned the matter to May 20 for ruling.

The Lusaka Playhouse and the case of our collective destructive gene as…

The destruction of the Lusaka Playhouse, I am afraid, represents a pattern I have seen across the country and among us, as Zambians; the effortless ability to destroy anything in our path, including indestructible things.

I have come to the painstaking conclusion that perhaps, as Zambians, collectively and individually, we possess a unique gene that destroys things, a destructive gene.

Years ago, I brought to the attention of the nation the decay and squalid state of the Playhouse in two articles – ‘Rape of the Lusaka Playhouse’ and ‘Deeper into the loot and rot of the Lusaka Playhouse.’ I detailed the destruction and concluded it should be coded as a crime against humanity. In response, the Lusaka Theatre Club management took me to court, and later withdrew, seeking relief for allegedly painting them in the same light as the former Liberian President, Charles Taylor, who had been charged for war crimes.

Between then and now a lot has happened at the Playhouse, now it is about to become a filling station.

But this is not the most disturbing part.

When the Lusaka Playhouse was built in 1958, it was registered as a cooperative society owned by members belonging to the Lusaka Theatre Club. It was a collective and public good, with membership open to all. This has been its status for more than five decades, until recently.

In the last five years or so, the Lusaka Playhouse was re-registered from a cooperative society belonging to all, to a closed one, belonging to 26 individuals who christened themselves as founders and shareholders.

In short, the 26, now ‘own’ the Lusaka Playhouse.

There was no consultation, participation, inclusion nor consensus of the larger art community and stakeholders to change ownership from collective, to private. In fact, the whole takeover was shrouded in secrecy.

It is these 26 founders and shareholders, who now want to lease part of the Lusaka Playhouse to turn the carpark into a filling station, supposedly, to help run it and bring returns to the shareholders. During a crisis meeting on Thursday held in the wake of the public backlash, the Board Chair — and one of the 26 shareholders — Henry Phiri, could not disclose the details of the contract nor the plans of the 25-year lease, nor explain how exactly a filling station would add value to the historical and cultural landmark.

There are many questions that will need to be answered in the next weeks and months.

The Playhouse, where our collective destructive gene finds its most vivid expression, once had everything it will ever need to stage a play.

It had a breath-taking library filled with hundreds of classic and contemporary works by poets, authors and playwrights from Shakespeare, Chaucer, Ngugi, Blake to Kipling, Faulkner, Biko, Keats, Elliot, Achebe, Seneca, Neruda, Soyinka, Yeats, Tolstoy, an endless list of books, upon plays by Greek, Latin, African, Asian, American and British authors. Where the library once stood as a shrine of knowledge is now amatebeto-style restaurant. And the books? Thrown away, most of them burnt to ashes, some rescued and taken by actors.

The lighting room at the auditorium entrance could transform the mood at the hands of gifted and trained lights men. It had a massive room known as the wardrobe, filled with hundreds of costumes and props that it would ever need to stage any play.

The wardrobe had fascinating costumes bought, donated, and collected since its opening in 1953. The wardrobe had lifelike crowns of kings, thrones, wedding dresses, colonial uniforms, army regalia, relics, boats, furniture, beds, shoes, everything and anything to stage any play under the sun.

Most stunning was the massive backstage with hundreds of switches, ropes, pipes, steel, timber and iron bars, curtains, each built with a specific function geared towards recreating an entire world that each play will ever need. This is the Playhouse where in 1979, President Kaunda hosted Prince Edward to watch performances by the national dance troupe among others.

The stage itself could be transformed into anything, including underground bunkers and a river. Legend has it that when it was exclusively for the white population, it had switches that could produce rain and snow on stage. The stage was equipped with in-built microphones and world-class acoustic standards. Even today, in its lifeless state, the Playhouse boasts some of the best acoustics in the country.

All the costumes have been emptied, the lights broken, the curtains pulled down. And you should see the third-grade job ‘renovations’ from the ZMK750K Youth Empowerment Fund. The contractor could not find or bother to replace the seat covers for the two rows of seats to match the rest. As for the toilets, – I pledge to renovate the ladies.

Again, what is it about us Zambians that destroy things?

Don’t take my word for it; go to the Post Office in Cairo Road. When you are done, go to Findeco house, Mindeco or just about any building – deplorable.

Go to any government building, starting with the Cabinet Office, if that is not enough, go to State House, and let me know if what you will find represents the best of any nation.

The two-kilometre traffic island from north-south end on Cairo Road, now squalor, was once a lush, beautiful park canopied by giant trees and palms right in the heart of the city.

Forgive me for asking, but what is the state of the public library in Katondo Street, opposite the Development Bank of Zambia?

Last year in June, at KKIA, in one of the offices, starched in the corner, was a masterpiece sculpture of Kenneth Kaunda, a priceless work of art, the kind western museums would pay millions for, and treasure till the end of time. But in our custody, it stands in the corner of some ticketing office, facing a wall, with bits broken and serving as a handbag hanger.

I would appreciate information from the National Airports Company where that sculpture is.

I recently visited three universities: Stellenbosch (South Africa), Al-Farabi Kazakh (Kazakhstan) and UNZA; the contrast is painful. Two of the universities are spectacular and cities in themselves, acquiring properties around them, while one keeps slicing itself away.

When I read about certain lodges in lower Zambezi not wanting ‘us’ on their properties, stories of Lusaka joints relocating to the furthest obscure hard-to-reach corners of the city to avoid us, I rage with anger about such blatant racism.

But then again, look at the Playhouse, the Lusaka Museum, the national stadium and a thousand other places; I pose and ask myself if this is entirely about racism or something else.

What is it about us Zambians that burn books, wreck schools, damage hospitals, break toilet cisterns and windows, uproot rail sleepers, hit traffic lights, remove stadium seats, throw litter from car windows, block drainages, break anything and everything?

President Hichilema Supports Genuine Hustlers Not Stealing Of Public Resources

PRESIDENT HICHILEMA SUPPORTS GENUINE HUSTLERS NOT STEALING OF PUBLIC RESOURCES

As opposed to claims by clique of thieves that Hakainde Hichilema is jealous of those who are getting rich, The President has created a peaceful business environment for any genuine business to survive but not through looting of public resources.

Patents and Companies Registration Agency (PACRA) has registered more than double the number of businesses in the first quarter of this year compared to this time last year. This is clear evidence of the confidence people of Zambia have in the New Dawn Government to provide a good business Environment. In addition to this, President Hichilema has launched the Public Private Partnership Dialogue (PPD) forum which shall work towards the quick registration of businesses and make it less bureaucratic and more decentralized.

President Hichilema has also increased Constituency Development Funds (CDF) which means more local investment, more jobs and a better life for all Zambians. This not a President who is jealous of anyone.

We should never mistaken stealing of public resources to hardwork. You can’t steal money meant to construction of public universities and call that hardwork. Efforts to undermine the fight against corruption through propaganda and insults against the head of state will not be entertained. Any public servant is accountable to the people. Hakainde Hichilema made his wealth before joining Government and since becoming President has not received his salary because he understands that public office is meant to serve the people not to loot public resources.

As you UPND youths we support the President and Government’s efforts to uplift the living standards of our people and we also support the fight against corruption. We appeal to law enforcement agencies to increase the pace of their investigation because justice delayed is justice denied. The people of Zambia want justice on the FJT scandal and many other cases of corruption.

Lawyer Zaza, 2 others committed to High Court in defrauding case

THE Lusaka Magistrates’ Court has committed lawyer Mcqueen Zaza and two others, among them a police officer, to the Lusaka High Court for trial on allegations that they defrauded Big Eye Limited proprietor Roy Musonda of his K40,600.

Zaza, 40, of Plot Number Q1 Azurite Apartments in Meanwood Ibex, detective constable Bwalya Chilufya, 27, of unknown house number in lbex Hill, and Richard Phiri, 29, a ZRA officer of unknown house number in Ibex Hill are charged with attempts at extortion.

It is alleged that the trio on October 15, 2022 solicited for K40,600 from Musonda.

The three were committed to the superior court by magistrate Nsunge Chanda.

According to a statement issued by police spokesperson Rae Hamoonga, Yvonne Shakantu, a business lady of House No.31, Chitimukulu Road, PHI Lusaka, reported Zaza and his accomplices to the law enforcement agency on behalf of Musonda of Plot No. 30, Bird’s View, Silverest, for allegedly swindling the latter of K40,600.

Hamoonga said Musonda, who has a contract with the Ministry of Defence to supply military attire and bulletproof vests, on October 14 around 17:00 hours received a message from Zaza who claimed to be President Hakainde Hichilema’s legal advisor, and requested that they meet.

He said Musonda, in the company of his friend Webby Kasalu, drove to a named car wash in the vicinity of Garden City Mall to meet Zaza and his accomplices.

Hamoonga added that Chilufya introduced himself as a police officer based at Simon Mwansa Kapwepwe Police Station while Phiri introduced himself to Musonda as an employee of the Zambia Revenue Authority (ZRA) in Kasama.

He explained that the suspects asked Musonda and his friend to accompany them to Simon Mwansa Kapwepwe Police Station.

Hamoonga said whilst at the police station the trio told the businessman that they had spotted him at the Ministry of Defence and inquired about how he obtained the contract.

He said Zaza is alleged to have demanded payment of K1 million from Musonda in order to secure the contract on the pretext that he (Zaza) was associated to Minister of Home Affairs and Internal Security Jack Mwiimbu and Minister of Local Government and Rural Development Gary Nkombo, among others.

Hamoonga said it was reported that Musonda borrowed a K40,000 from business partners and paid Zaza, leaving a balance of K10,000 as he had earlier demanded a K50,000 as down payment.

It is further alleged that Zaza and his accomplices continued to pester Musonda for the balance until October 15 around 20:00 hours when he was nabbed by police officers when he went to collect the balance.

A K24,000 is said to have been recouped from the suspects after they surrendered it to the police and was seized as an exhibit.

According to a letter addressed to the Director of Public Prosecutions early this year, Musonda wants to have the charges against the accused dropped on reasons that their family members and friends pleaded with him to pardon them and reimbursed what was ‘ravaged’.

Turkey has given Russian president, Vladimir Putin a boost by saying it wont support Finland and Sweden’s bid to join Nato accusing both countries of being a ‘hatchery’ for terrorist organisations.

Speaking on Monday night, May 16, Turkish President Recep Tayyip Erdogan told delegates from Finland and Sweden not to bother visiting Ankara for planned negotiations to address Turkey’s concerns.

It is a welcome news for Putin, who has claimed any expansion of Nato could be seen as a sign of Western aggression.

Sweden and Finland have submitted their bids to join NATO, a transatlantic military alliance created to defend the west against threats by the Soviet Union. In the past both countries have been military unaligned but said Russia’s invasion of Ukraine on February 24 changed their mindset and puts the country at a security risk.

Swedish Prime Minister Magdalena Andersson said on Monday that the nation hoped its membership bid would be accepted quickly, adding: ‘We are leaving one era behind us and entering a new one.

‘Nato will strengthen Sweden, Sweden will strengthen Nato.’

The country’s application came a day after Finland said it would also join Nato, putting pressure on Russia, with which it shares an 830-mile border.

But Turkey’s opposition plunges the applications into doubt, as decisions on Nato enlargement must be approved by all 30 members.

Turkey believes Sweden and Finland harbour terrorists, including members of the Kurdistan Workers’ Party and followers of Turkish scholar Fethullah Gulen, whom Erdogan accuses of a 2016 coup attempt.

‘Neither of these countries have a clear, open attitude towards terrorist organisation,’ Erdogan said Monday. ‘How can we trust them?’

Swedish authorities said representatives from Sweden and Finland said they would to travel to Turkey for talks about its objections.

However, Erdogan retorted: ‘Are they coming to convince us? Excuse me, but they should not tire themselves.’

Putin responded to Sweden and Finland’s desire to join Nato by claiming that they were not a threat to Russia.

But he warned other members against bolstering the two nations’ military capability. ‘As to enlargement, Russia has no problem with these states – none,’ he said.

‘So in this sense there is no immediate threat to Russia from an expansion to include these countries.

But the expansion of military infrastructure into this territory would certainly provoke our response.’
