The Question About Ministers And Deputy Ministers- Isaac Mwanza

DURING Zambia’s 2017 to 2020 constitutional review process, there was a strong push by some Patriotic Front (PF) Members of Parliament who sat in the back benches of the National Assembly to re-introduce the office of Deputy Minister.

This proposal by MPs stemmed from discontent which was forming and growing among PF backbenchers who complained that Ministerial offices had become personal-to-holder.

They mumbled that the then President Edgar Lungu was not affording every PF MP a chance to become a minister.

There were also subtle accusations against serving Ministers that despite all MPs being elected by the people and spending own resources to win parliamentary seats, Ministers were living more comfortable and better lives than ordinary MPs.

Clearly, many sought the prestige of a ministerial office even if it was at the lower level of Deputy Minister.

These backbenchers from the then ruling PF made threats and apparently looked ready to collapse the entire constitutional review process from the floor of the National Assembly if the National Dialogue Forum (NDF) did not adopt provisions that re-introduce the office of a Deputy Minister.

We must also remember that our excuse as a nation for abolishing the position of a deputy minister was that deputy ministers were a drain on the Treasury and had no clear job description.

Perhaps we need a detailed study to establish the validity of that argument as well, and to re-examine the structure of our government as it stands today.

In a place of deputy minister, we now have more directors employed and more than one Permanent Secretary appointed to a ministry or Cabinet Office without clear job description.

The appointment of more than one Permanent Secretary in a Ministry, to the best of this author’s knowledge, is a novel arrangement which is less practiced in the Commonwealth.

On the other hand, there was also a stronger push by civil society organisations (CSOs) for a constitutional change to allow the President to appoint his Cabinet Ministers from outside Parliament.

This demand was unpopular among Members of Parliament from the then ruling PF. Even opposition MPs from the main opposition United Party for National Development (UPND) silently opposed this proposal.

It may not be widely known but there were UPND lawmakers who, even after staying away from the NDF on the orders of their Party leadership, kept lobbying delegates to the NDF not to adopt the extra-parliamentary system of appointing Cabinet Ministers.

The collective arguments by both the PF and UPND MPs were that Zambia was not yet ready for such a copy-paste system as the final cost would even be higher than if the Ministers were appointed from within Parliament.

It is certainly a good thing to look at best practices from other jurisdictions but that should not be an end in itself.

In the United Kingdom, Ministers are chosen by the Prime Minister from the members of the House of Commons and House of Lords, as is the case is in Zambia.

It may be worth pointing out that the idea of Cabinet Secretaries is not novel. The United States of America and Kenya call their Cabinet ministers as Cabinet Secretaries.

The U.S Secretary of the Treasury is the equivalent of the Minister of Finance in other jurisdictions, or Chancellor of the Exchequer in the United Kingdom.

The difference is that in the United States of America, and now in the Republic of Kenya, the Cabinet Secretary to the Treasury, or Finance Minister, is appointed from outside parliament.

Cabinet Secretaries do not become Members of Parliament on appointment to the Cabinet.

The question that now arises are, are we ready as Zambia to make the change and appoint our ministers from outside parliament?

If so, what is the thinking behind the change and why do we want Ministers appointed from outside parliament? If not, why not?

What are the advantages of our current system of appointing our Ministers from among our Members of Parliament? What do we stand to lose as a country if we do not adopt the US or Kenyan model?

In Kenya where Cabinet Secretaries are appointed from outside Parliament, members of Parliament are well-remunerated and the Cabinet Secretaries are an additional expense on the treasury.

The question then is whether Zambia’s economy is now ready to meet the additional expenses beyond what we spend on our parliament.

Can the appointment of Ministers from outside parliament be seen as imposing an additional burden on our finances? In what way would this argument be valid?

As part of the process, every effort should be made to establish a clear consensus on whether Zambians really want Ministers appointed from outside Parliament and remain opposed to reintroduction of deputy ministers since these have just been replaced with more directors and Permanent Secretaries.

We must also rethink whether we want to abandon the current first-past-the-post system of electing Members of Parliament and councillors, which matter was extensively canvassed during the last constitutional review process.

During parliamentary debate of the Constitution of Zambia (Amendment) Bill of 2015, the National Assembly decided that these three issues will remain matters for future debate and consideration.

I wish to also warn Zambians that the more we open up our Constitution for amendments every time we notice gaps or introduce some more provisions, the more gaps we create in the Constitution.

We have and must continue to progressively clean the gaps in the Constitution through our courts of law, with support of subsidiary legislation.

Mundubile Accuses Govt of Misusing Constituency Development Funds on Non-Priority Projects

Leader of the opposition in Parliament Brian Mundubile has alleged that Constituency Development Committees (CDCs) have been ordered to spend Constituency Development Funds on Police Vehicles, Ambulances, Desks Chief’s Palaces and Rural Electrification Authority (REA) Projects and have failed to prioritise community projects.

Mr. Mundubile, who is also Mporokoso Central Member of Parliament and PF Presidential Candidate said in Kasama that while the CDF was supposed to be localized authority, this was not the case in the New Dawn government because the Ministry of Local Government was dictating on the local communities.

Speaking on Kasama Radio and broadcast on Radio Mano in Kasama, Walamo in Mpulungu and Liberty Radio in Mporokoso, Mr. Mundubile said huge projects such as Police Vehicles, Ambulances, Chief’s Palaces and REA Projects which were supposed to be funded direct by the Central government were being dictated on the local people and that the people had failed to spend the funds on needy community projects.

Mr. Mundubile said the local people failed to prioritize community projects until they procured what government had demanded.

He said in PF time, CDF was well utilized because it was directed on community projects while the Central government undertook projects such as Ambulances and Police Vehicles.

Speaking on Zambia’s foreign policy, the PF Presidential hopeful said Zambia’s position was non aligned and would continue to be so.

He said from independence, Zambia was free to associate with any country but said the UPND government had decided to go west adding that the USA meant to dilute China’s Influence and warned that no military bases would be allowed to be set up in Zambia, a non aligned country.

The PF leader advised President Haakainde Hichilema not to ignore Africa and the Regional Groupings such as SADC.

Mr. Mundubile said China built the Tazara railway at a time when no Western country was willing to come to “our aid” and said as PF, the largest opposition political party in Zambia, “our policy is very clear and that is to respect the African leadership.

He recently met with the Ambassador of the United States of America to the Republic of Zambia, His Excellency, Mr. Michael Gonzales, at his Residence in Lusaka.

“We discussed a wide range of issues related to the role of Opposition in Parliament.Ours is to continue providing quality checks and balances in the interest of the emancipation of the Republic of Zambia. God bless Zambia.

On governance, Mr. Mundubile noted that Zambia was slowly turning into a Police State where opposition politicians were being threatened everyday and that the former Head of State Edgar Chagwa Kungu was not respected.

“Zambia is now like a one party state where peace is no longer a pre-requisite, there is no direction because everywhere there is” Police” and that is how we’re living”.

Mr. Mundubile however said opposition political parties support the UPND government on genuine fight against corruption, but noted that wholesome condemnation of one political party as being corrupt without any clear case of corruption would not be condoned.

“As things stand now, there is no one facing a charge of corruption but that has been the talk of those in the UPND government” Mr. Mundubile noted.

●Lusaka lawyer Nathaniel Inambao has been jailed for twelve months together with his legal assistant over forgery of a dead man’s Will.

● Nathaniel Inambao is also in another court accused of stealing K800,000, the benefits of a deceased person, Namunji Poloto, who was an employee of Zesco.

●In another case, Nathaniel Inambao has been sued by his client, Howard Cooke, in the Lusaka High Court for squandering costs amounting to US$14,000 dollars.

● On 22nd October 2021, the Law Association of Zambia, Legal Practioners Committee finally suspended Inambao from legal practice and barred him from filing any court papers and from appearing before any courts of law or tribunal.

THE case in which Lusaka lawyer Nathaniel Inambao is jointly charged with a legal assistant over forgery of a dead man’s Will has been jailed for twelve months.

Inambao, who is also former Commissioner of Lands, was jointly charged with Mubanga Chibonga for forging a dead man’s Will

It is alleged that between January 26, 2018 and June 30, 2018, with intent to deceive or defraud, Inambao and Chibonga jointly forged the Will for the late Dominic Chimfwembe and uttered it to his widow Carol Musonda whom the latter had married after divorcing his first wife Beauty Kafwimbi.

Lusaka Magistrate Judith Chiyayika that Inambao has since forfeited the Will, which was nullified by the Lusaka High Court in 2021.

Meanwhile, Nathaniel Inambao is also accused of stealing a dead man’s benefits was recently detained at Ridgeway police station after his bail was revoked.

In this case, Inambao, aged 56, of Lusaka West is charged with one count of theft by agent. It is alleged that on March 20 last year in Lusaka, Inambao was instructed to pursue the benefit of the deceased, Namunji Poloto, who was an employee of Zesco.

Inambao in the process allegedly stole K880, 000 cash which he was entrusted to pay or deliver to Willie Mulemwa being the deceased’s personal representative. He however pleaded not guilty to the charge.

During trial, Inambao absconded two court sittings of March 22 and March 29, 2021 prompting the court to issue a bench warrant against him. When the matter came up yesterday, Inambao, who appeared before Magistrate Mwaka Mikalile told the court that he had absconded the two sittings because he went to South Africa and his passport had been stolen. Inambao told the court that he reported the theft to police but did not produce the same to court. He told the court that the passport was however found and he presented it to the court.

After his explanation, one of his sureties informed the court that he was withdrawing from being the accused’s surety and the court granted the application. Inambao then asked Ms Mikalile to grant him bail in the interest of justice and that the offence he was facing was bailable.

He was granted a K5, 000 cash bail and also ordered to provide two sureties who would be bound in the sum of K50, 000 each but in their own recognition. Ms Mikalile said Inambao would be in detention until such a time when he would meet the bail conditions.

In another case, Nathaniel Inambao has been sued by his client Howard Cooke in the Lusaka High Court for squandering costs amounting to US$14,000 dollars (K 246,346.21) which was deposited into his account.

Cooke wants the court to compel Inambao to pay him the money with interest and damages.

According to his statement of claim, Cooke said sometime in 2014 he engaged Inambao to represent him under cause No. 2014/HP/14/54 and consequently enjoyed client-lawyer relationship.

Inambao was fired by President Levy Mwanawasa as Lands Commissioner in 2003 over huge land scandals that rocked the Ministry of Lands after he assumed office in September 2002.

What is the US debt ceiling and what will it mean if it isn’t raised?

A unique rule in America’s fiscal system means that the world’s largest economy is about to run out of money.

US lawmakers have been arguing over whether to raise or suspend the so-called “debt ceiling”, which determines how much money the US government can borrow.

Treasury Secretary Janet Yellen has warned that if an impasse between Republicans and Democrats is not broken, the administration will not have enough cash to pay its debts as early as June 1.

The political stalemate over increasing it is deepening. If it is not resolved, there is a looming risk that the US government could default on its debt.The repercussions would be global and ruinous. “That is when you’re into a genuine potential financial market catastrophe situation,” says Andrew Hunter, deputy chief US economist at Capital Economics.

What is going wrong and how bad could it get?What is the US debt ceiling?
Since 1917, the US has had a law that sets a statutory limit on the total amount of debt that the Government is allowed to have. The limit was first set at $11.5bn (£9.2bn).

The ceiling is a little similar to the fiscal rules that the Chancellor sets himself in the UK, but it is set externally. “The key problem is that it is treated completely separately to the decisions on how much the government should spend and what level taxes should be,” says Hunter.

Congress passes new spending bills that will increase the debt level, but the debt ceiling is not raised until it is about to be breached.

The figure was also set as a blanket cash figure, which does not automatically change to reflect factors such as population growth or inflation, acting as a kind of gastric band.

American government debt has increased under every single president since Herbert Hoover. In response, the debt ceiling has been raised more than 100 times.

Mr. President as much as i would like to applaud your efforts with regards to, Social cash transfer and NAPSA Partial withdrawal program above all economic growth based on graphical illustrations from 1973 to 2023 am doing so hesitantly as majority citizens will agree with me that the following areas were not well addressed nor satisfactory solutions given.

1.. The impasse around KCM and MOPANI.

2.. Why are we finding it difficult to approach CHINA considering the fact that it’s the major key player in our debt restructuring program.

3.. Gross Incompetence at Ministry of Agriculture were majority citizens expected you to take decisive action to avoid a repeat of shortage of maize which triggered escalation of mealie meal Price to unprecedented levels in our country.

4.. Shortage of medicines in hospitals and measures put in place to ensure availability of medicine through straightening the supply chain.

5.. Gross Professional misconduct exhibited by Law Enforcement Agencies disregarding rule of law with impunity, denying people police bonds, infringing on people’s rights enshrined in our supreme document of our land herein referred to as the constitution, seizing people’s assets and accounts before investigations are concluded leading to massive layoffs above all artificial shortage of money in circulation.

6.. Non payment to suppliers and contractors.

8.. The use of heavy hand of the police on opposition.

They are falling and failing- but here is how we can succeed

The Economic team led by President Hakainde Hichilema and Dr. Situmbeko Musokotwane is failing and falling and is not doing anything different from its predecessors.

The cost of living has reached perilous levels, cost of fuel and essential foodstuffs is at a level that can spark social unrest.

They are relying on foreign designed and prescribed economic programmes as a solution and have ignored measures to raise resources from domestic revenue.

They are accumulating debt at an alarming faster rate, and are relying on external factors to resolve internal issues and crises.

The key sectors of health, education and agriculture are collapsing while the nation is treated to repeated false assurances.

They are fasting and praying for International charitable and benevolent actions of creditors and multilateral financing institutions.

Like their predecessors, they are stuck in a begging-bowl mentality.

The country has not been servicing foreign debt since December 2020, yet Government continues to accumulate more local and foreign debt.

As at December 2021, foreign debt was at USD13.04 billion and publicly guaranteed debt was at $1.5billion.

Total Public debt and publicly guaranteed debt was at $23billion.

Now in 2023

EXTERNAL:
Central Government – USD14billion,
SOEs- USD3.44billion.
Total External USD17.4b.

DOMESTIC:
Domestic currency Debt- USD14.23b.

TOTAL:
Total Debt without interest arrears- USD31.63b.

Add interest arrears of USD1.18b, totals-USD32.8b.

Minister of Finance and National Planning, Dr. Situmbeko Musokotwane says the increase in external debt stock can be attributed to new loans and continued disbursements on existing project loans, mostly from multilateral institutions and bilateral creditors to finance on-going priority projects.

Recently the Zambian authorities and IMF staff team reached a staff-level agreement on the first review of Zambia’s economic program under the Extended Credit Facility arrangement.

The staff-level agreement is subject to IMF Management approval and Executive Board consideration once the necessary financing assurances have been received.

An agreement with official creditors on a debt treatment in line with program parameters would provide the needed financing assurances.

To remove any hurdles to the timely completion of the review, Zambia needs official creditors to move forward and reach agreement on a debt treatment in line with the financing assurances they provided in July 2022.

Their master, the IMF have just given them an optimistic evaluation and states that the economy has rebounded, fiscal credibility has been restored, and, with the authorities’ continued strong reform momentum, growth is expected to pick-up further in the medium-term.

Zambia’s long-term hopes are pegged to a probable successful debt restructuring programme that would see debt reschedule, or debt cancellation or debt forgiveness.

The praise from the IMF is after the Zambian authorities removed or reduced subsidies on fuel, Farmer-Input Support Programme and Electricity (partial) and cancelled public investment in infrastructure projects.

WHAT I WOULD DO DIFFERENTLY

We would make Zambia a healthy, educated, wealthy, industrialised and prosepeorus nation, an export hub of electricity, food, finished products and skills.

How it can it be done.

1. Remove tax holidays and tax incentives unfairly provided to the mining sector. The mining sector will pay just taxes and fair mineral royalties.

2. Renegotiate unfair and corrupt Power Pruchase Agreements entered into by ZESCO and Independent Power Producers that serve to milk ZESCO of its revenue and investible resources.

3. Reform Zambia Revenue Authority (ZRA) and widen tax-base to achieve tax revenues of above 22-25% of the Gross Domestic Product(GDP). Revise taxes such as Value Added Tax(VAT) that are frequently abused and form part of tax refund abuse and fraud.

3. Empower ZCCM-IH to immediately run KCM and Mopani Copper Mine, and immediately implement a scheme to run gold and gemstone mines with artisanal and small-scale miners.

4. Increase ZCCM-IH shareholding in all large-scale mines to 49%. This means there will be an increase in revenue from royalties and an increase in state participation in mining income. However this will also ensure the mining sector has enough income to encourage foreign direct investment.

5. Many experts have stated that Zambia’s economy is far larger that the statistics of $20billion GDP and is in excess of $60billion….Together with IMF and AfDB conduct and honest, transparent and true measure of the value of the economy and its activities. This will help rebase Zambia’s GDP to its true value..This immediately dwarfs the so called debt crisis.

African countries enjoy under-stating the size of their economies in order to enjoy concessional loans and free poverty grants from multilateral institutions. This is the most lazy way of running government and serves to provide inherent relevance to these extortionist and predatory multilateral institutions that survive on the poverty and under-development of poor countries.

6. Plan and implement an immediate and robust programme to grow food and export to the 400 million people in the SADC region.

7. Reform Law Enforcement Agencies that focus on the petty, narrow and political issues. Remove laws and regulations that criminalize wealth and wealth creation. The current approach encourages illicit financial flows and externalisation of resources. It is for this reason that the wealthy in Zambia keep money in off-shore accounts and outside the country.

8. Fight corruption by reforming tender processes, remove politicians and public officials from the process and remove politically exposed persons from hijacking the procurement system.

9. All government expenditure and contracts including fertiliser, fuel and others to be awarded to citizen-owned companies. If the procurement requires specialization or international bidding promote mandatory joint ventures with citizen-owned companies.

10. Government service providers, contractors, suppliers, and consultants to be paid within 30 days after presenting verified invoices or verified interim payment certificates.

11. Promote technological advancement, boost levels of labour and capital, grow the economy, improve standards of living and eliminate extreme poverty.

12. Promote an aggressive industrialisation programme including establishing value added and value-chain industries per districts.

13. Revert Zambia to Non-aligned Policy, close USAFRICOM security offices and revert to multi-state collaboration with the USA, Russia, China, UK and France. Apply to be a member of the BRICS.

5 ARMED ROBBERS STEAL K4, 000, 000 FROM MANYANYA, AS SUSPECTS REMAIN ON THE RUN

Gun-armed robbers snatched millions of Kwacha in a broad day robbery from Manyanya group of companies in Nakonde on Wednesday Morning.

Over K4, 000, 000 has gone missing after 5 unidentified thieves attacked Manyanya group of companies manager in a booked taxi on his way to deposit the money to a bank in Nakonde.

Fordson Mwangala, a company account on his way from Tanzania to the Zambian side was ambushed in the company of a taxi driver he booked to deposit the sum of money to a bank in Nakonde.

Muchinga Province Deputy Police Commissioner, Ronald Zambo tells Nakonde Radio FM News that the incident happened as the duo reached near the company’s Nakonde branch taxi rank along the Great-North Road when masked armed robbers using a Toyota Allion silver in colour blocked the road hence looking the doors and windows.

Mr. Zambo explains that two of the robbers had guns which looked like pistols and ordered the driver to open the door which he declined leading to one of the assailants to shot at the bonnet and windscreen prompting the driver to open the car doors.

He says the duo was immediately ordered to lay on the ground facing downwards while one of the attackers grabbed two sacker bags with money amounting to K4, 000, 000 and sped off the southern direction of the Great-North Road.

Mr. Zambo further says the the victim duet attempted to follow up but, could not manage hence the accountant reporting the matter to Police.

He says Police visited the scene and picked up three bullet cartilage one for an AK47 while two for a pistol.

The Deputy Commissioner says two passer-by victims were shot at, identified as 35-year-old Brian Silungwe of Nakonde District and 33-year-old Ireen Asubisya of Tanzania who sustained abdominal gunshots and currently nursing wounds at Nakonde District Hospital.

Mr. Zambo further explains that last night the robbers abandoned two AK47 rifles and two guns including the vehicle used for the robbery in Chozi village of Nakonde and parked at the police station in the area.

He says no arrests have so far been made while investigations in the matter continues.

On Wednesday Nakonde central Business District (CBD) came to a stand still as five armed robbers clothed in masks and guns attacked an accountant from Manyanya Group of companies together with his taxi driver as residents scampered in fear for their lives after three gun shots were fired during the robbery.

Almost three years ago thieves stormed the same premises and walked away with goods and money amounting to over K80, 000, while the lead robber was arrested and slapped with a death sentence last year.

FORMER PS SUES ACC FOR DEFAMATION

Former Ministry of Higher Education permanent secretary Dr Patrick Nkanza has sued the Anti-Corruption Commission (ACC) for libel after he was prosecuted over corruption allegations for a year.

In his statement of claim filed in the Lusaka High Court, Dr Nkanza said on or about May 6, 2022, ACC arrested him on an allegation that during his tenure in office as permanent secretary of the Ministry of Higher Education he signed a contract worth K200 million without confirming availability of funds.

He submitted that without reasonable and probable cause, ACC charged him with five other suspects before the Lusaka Magistrate’s Court with the offence of wilful failure to comply with applicable law and procedure contrary to section 34 (2) (b) of the Anti-Corruption Corruption Act no. 3 of 2012 in respect of the FTJ Chiluba University, a contract he was not part of.

Dr Nkanza explained that in a letter dated September 15, 2022 he requested for a meeting prior to the date of trial to communicate his position that he was not connected to the offence as charged and by a letter dated October 10, 2022, the ACC responded to his request and proposed that the meeting be held on October 18, 2022.

On the material date of October 18, 2022 a meeting was held between him and his lawyers and two representative from ACC, where at the meeting his lawyers availed to the ACC evidence that he was wrongly indicted .

He stated that the evidence in question included documents which seemingly indicated that funds for the project were confirmed by the Minister of Finance in parliament during the budget address, among other things.

Dr Nkanza stated that despite his efforts to show the ACC that the charge against him was baseless, frivolous, and vexatious, ACC elected to proceed to prosecute him and the matter was taken to court for almost a year.

He disclosed that he was discharged of the charge by magistrate Davis Chibwili on March 9, 2023, following a successful application by his lawyers .

Dr Nkanza submited that despite being discharged from the indictment he was made to appear before a different magistrate the following day on March 10, 2023 by ACC and at the hearing thereof ACC withdrew the matter against him.

He now wants an unreserved apology published in the same manner as the publication of the libellous words and a statement by ACC to the public, to the effect that the charges against him were withdrawn.

He is also seeking costs of and incidental to this action and other reliefs which the court may deem just and equitable.

This is because, according to him, ACC prosecuted him for a year without conducting proper investigations.

Dr Nkanza said ACC also issued defamatory words after his arrest, specifically in their particulars of offence, which they issued to the media

He complained that the said words in their ordinary and natural meaning meant and were understood to mean that he personally benefited unscrupulously, and without regard to the law signed contracts worth US$225, 000, 000.00 during the period 2015 and 2017.

By reason of the libellous publication of the words refered to, he argued that he had been seriously injured in his reputation and had been brought into public scandal , odium and contempt.

He also argues that he had been defamed in a sensational manner by ACC as it had known that the allegations were untrue.

Dr Nkanza is therefore, seeking reliefs in form of special damages of K500, 000.00 as legal fees and K50, 000.00 as transportation costs.

…the poverty mentality in UPND will not take the country anywhere says Davies Mwila.

FORMER PF secretary general Davies Mwila says former mines and minerals development minister Richard Musukwa can’t fail to own property because he started making money before he became minister.

Mwila, who is former home affairs minister, says Musukwa and him were trade unionists, arguing that the UPND’s “poverty mentality” will not take the country anywhere.

And PF information and publicity chairperson Raphael Nakacinda says people in Chililabombwe can actually support Musukwa because they know how he gained his wealth.

On Tuesday, Drug Enforcement Commission officers conducted a search at Musukwa’s house in Chililabombwe and seized several assets.

The seized assets included over 10 vehicles, a firearm, stones and a house.
But in an interview, Mwila said the seized house and some of the vehicles were acquired even before Musukwa became a minister.

“This is coming from after the by-election. If you look at the figures, they were not impressive to the ruling party. Looking at those figures, if it is a general election they can’t win. They think that honourable Musukwa is the one who was in the forefront in buying that by-election. It’s total intimidation and harassment. First and foremost, they got nothing in the sense that they didn’t want to seem embarrassed because they got fuel and allowances from government, so they have to be seen like they are doing something. How do you go and get a house which someone built even before he became minister? That house was built before he became minister, when he was a general treasurer for mine workers,” he said.

“How do you get a car which he bought when he was deputy minister? When you’re a deputy minister or minister, you’re given a vehicle which you use at home. So that Prado they got, he bought it when he was deputy minister. You get a VX, do you know how he got that VX? He got it from Parliament. So some of these things they are doing are not helping the country.

They are taking us backwards. These other vehicles they’ve impounded or seized are preconditioned vehicles. These are vehicles costing 150,000. So there’s nothing they are doing, they are just embarrassing themselves. They are supposed to ask, ‘when did you build this house? When did you get this land? When did you start building?’ You can’t just seize a house which was built in 2004 [or] 2005. They have not achieved anything”.

Mwila said the poverty mentality in UPND would not take the country anywhere.

“Those things will be gotten back to Richard Musukwa once the matter goes to court because he will be able to justify. How much is the cost of the firearm? K20,000, a firearm. They even include it on the list? I’ve grown with Richard. I was treasurer for mine workers. He was also treasurer for the other union for mine workers. So I know Richard. I know when he built that house when we were together in the union. We’ve not just started now.

We were miners, we were trade unionists. We made money before we became MPs. That’s why this poverty mentality from the UPND is not taking us anywhere,” he said.
“All those vehicles they’ve impounded are preconditioned vehicles. The ones which are used by whites and Japanese. They use them and sell them to Africa. Those are not from the showroom. The vehicle that came from the showroom is the VX because he got it from Parliament when he was MP. When Richard became MP in 2011, he got a vehicle from Parliament and he also got another vehicle from the ministry. Two 4X4s. 2016, again he got two. One from Parliament and again from the Ministry. Let them publish them so that we see the vehicles. The house was built when he was in the union. Maybe they don’t know the history so I am telling them.

People didn’t make money when they were in government. We made money before we became ministers. We were trade unionists. 2022, I was getting 17,000, more than what I was getting as a minister.
What can they tell us?”

Mwila said law enforcement agencies should not only target opposition political leaders.

“I hope what they are saying is what they will be doing. A new broom sweeps well and we have every confidence in the new DEC DG. So we expect them to perform well. We expect to see good results but they should not be political. They should not only target politicians, especially in the opposition. If you look at what they are doing, it’s not right. It’s intimidation. How do you call honourable Lubinda over issues about Parliament? That’s total intimidation. Speaker of the National Assembly is not an island. We can condemn her. But when we talk about her, she should not be reporting us to the police. She’s incompetent, she’s not impartial and she’s a UPND cadre. We’ve got pictures where she has displayed the symbol of UPND. So she should not expect that we will be silent. We will talk about her and people must continue criticising her because she’s not neutral,” said Mwila.

Meanwhile, Nakacinda said people in Chililabombwe can actually support Musukwa because they know how he gained his wealth.

“The people of Chililabombwe and Copperbelt know that honourable Musukwa built that house many years ago when he was serving as one of the union leaders. Beyond that, we know honourable Musukwa having been a successful entrepreneur on the Copperbelt. His track record in terms of business is known by all. Actually, you can get the entire Chililabombwe to come and testify on his behalf in terms of how he has been able to make the bit that he has for his family and his children. What is shocking is officers went with a blank legal document calling it a search warrant without specifying what they were looking for and began to record whatever they saw in that premise as what they could include as one of the things they can seize. There’s no search conducted in such a manner,” he said.

Nakacinda said the seized stones were not minerals but decorative stones.

“They’ve also seized an Allion for his wife and a vehicle for his sister. They have attempted to sensationalise this whole arrangement by saying that ‘there are so many vehicles at the residence’, to try and hoodwink gullible citizens to think that there’s something fishy. They even report that ‘we even got stones’. The stones they got are decorative stones. The ones we put in our yards. We buy these stones from the street. For him, he got them here at Sikale. These are not minerals. This is just limestone if you like. It’s in different colours, white, gray and in some cases brown and we use them for decoration. Even at my house, I have these stones. Unfortunately, that’s what we’re being subjected to,” he said.

Nakacinda said the only wrong that Musukwa might have committed was the ability to look after his property well.

“When Mr Hakainde Hichilema said ‘if I had not acquired education, possibly I’d have been so primitive that I’d have married 10’. Maybe the degree of primitivity may have reduced in the area of marriage but like we’ve said, what’s going on in this country, bututu (primitiveness).

You know, a leader ultimately produces his own kind. When you have a leader that is inclined towards prospering citizens, they encourage hard work. Honourable Musukwa is supposed to be an example of those who have done something of their own outside their service to the nation as minister, civil servant, union leader. All this put together plus entrepreneurial activities is supposed to inspire others,” said Nakacinda.

“Actually, the people that will defend honourable Musukwa are people who live in Chililabombwe because they know his track record. All of us his colleagues have been drawing wisdom from him on how we can succeed by doubling. The greatest sin that maybe honourable Musukwa has committed is the ability to look after property. Some of the people who acquired vehicles in 2011, 2016, this time they are wrecks. But because of how he polishes from 2011 up to today, the vehicles still look in good condition. That’s the problem he has but the primitiveness in the new dawn is what’s bringing this kind of situation. If there was anything wrong that could have been done by him, we’d have possibly been the first ones to raise those issues”.

DON’T think because the people of Zambia are quiet and a few of us can speak like this that they are happy, PF presidential hopeful Chishimba Kambwili tells President Hakainde Hichilema.

He has also asked President Hichilema to warn Thabo Kawana, the director in the Ministry of Information and Media, against engaging in politics stressing that “if you don’t warn him then you are the one who sending him.”

Kambwili said Kawana was embarrassing the President, the country and the ministry by his conduct of engaging in politics.

“This propensity of going to storm radio stations when opposition leaders are having radio programmes must come to an end. It’s embarrassing. In fact you are lucky, you try and come on a platform that I am, I will put you where you belong. Come and try and storm the radio station where I will be and behave the way you are behaving of late, I will put you where you belong,” Kambwili said. “I will embarrass you. I will chase you like a pig, that is anarchy. That is anarchy, stop it. Mr President tell Kawana to behave. If you don’t warn him then you are the one who is sending him because there is no way a civil servant can behave like that.”

He stressed that a civil servant should not be involving themselves in politics as the law is clear on that.

“Praise singers will forever be there but I can tell you my brother (President Hichilema) these praise singers are the first ones to jump ship. An example is that of Thabo Kawana. Thabo Kawana, we can show you videos. We have videos here of how he used to praise president Edgar Lungu and the PF. Going around all radio stations,” Kambwili said.

“Thabo Kawana, you are embarrassing the country. You are embarrassing the President. You are embarrassing the Ministry of Information. The way you are conducting yourself is not the way a civil servant is supposed to conduct himself. And the law is very clear. No civil servant must indulge in politics. A director is a civil servant just like the PS (Permanent Secretary). Very rarely that you see PSs issuing policy statements or arguing with the opposition. It’s not even your place. It’s not your responsibility. Politicians are supposed to deal with politicians. You are being partisan. Where is the change? MISA Zambia where are you? Where are the media organisations to let this Thabo Kawana be so excited and I was very surprised.”

And Kambwili said President Hichilema is expected to be above board and not gloss over important issues like those affecting his predecessor Edgar Lungu.

“Now the question is that what happened that day, is it normal people of Zambia? We expect the President to be above board. We don’t expect the President to gloss over important issues. There is no way that police can plan a raid or indeed an operation at the former president’s house without the sitting President knowing. Then the sitting President is not in charge. Then all security wings have stopped functioning,” he said. “The President mind you, is the Commander-In-Chief of all armed forces including the police. And from my knowledge every morning, first thing in the morning, the director general of the intelligence, the OP, the so called OP is the first person that interacts with the President at his office. [The] issue concerning the former head of state is a priority. If the OP director general did not inform the President, he should be fired. That I know for sure that the director general did inform the President.”

Kambwili said President Hichilema should stop misleading the country that the incident at Lungu’s residence was purely a police operation.

“Stop persecuting the former president Edgar Lungu. You need him. He needs you. The country needs both of you. The country needs the ruling party, the country needs the opposition. I am giving you this advice my brother in earnest. Stop persecuting your predecessor. What happened that day with the police is pure persecution of the former head of state, nothing else. There is no explanation to that. There is no explanation,” he argued. “Look at the Americans, [former president Donald] Trump has been charged and taken to court. Did you see a battalion of police officers being sent to Trump’s house to go and arrest him, to take him to court to go and answer to the charges that he is answering in court? Why can’t we learn? This is a civilised nation, this is a civilised era. Let’s stop these old fashioned ways of conducting politics. It’s not building anybody, it’s only destroying our country and exposing us to ridicule. And don’t think because the people of Zambia are quiet and a few of us can speak like this that they are happy. Ba (Mr) President, stop misleading the people of Zambia that you didn’t know; it was purely a police operation. You had the power to stop it, you had the power to advise. In future stop it, don’t allow that. You will be more respected Mr President because mind you, political power is very temporary. You will be former president…”

Kambwili also argued that President Hichilema was aware that Lungu had more police officers than the recommended three because of the theft that happened earlier.

“Have you see some people who were working with president Edgar Lungu associating with him today? Some of them have run away from him. The law provides that the former president will have three police officers attached to his residence but, you know as much as I know that the seven because there are seven police officers and not 13, the seven police officers attached to president Edgar Lungu’s residence – former president Edgar Lungu – there is a history to that,” he explained. “And again there is no way the police can add extra police officers to president Edgar Lungu’s house without you being told as sitting President. Then the system has collapsed. When there was a break in at president Edgar Lungu’s house the TV was stolen, there was communication from government that we are going to give extra police officers. We are going to beef up extra police officers at the residence of the former president to enhance his security. There was also an issue of the location where president Edgar Lungu’s house is located that it was not a very safe place. And that is why there was a decision to increase the police officers from three to seven with your full knowledge Mr President. Where did you get the number 13?”

And Kambwili said the government should stop misleading the country that President Hichilema is the only Head of State that is marketing the country and looking for investments as all Zambia’s presidents have been doing it.

“And by the way, when you speak to the investors, when you speak to the business, it’s not automatic that the investment will come. They do even make pledges at the end of it all you would find that maybe out of six billion, only maybe two billion or one billion is actualized. So the mere fact that the President has addressed the business community, you can’t say that investments have come to Zambia,” Kambwili explained. “There is an attempt under this government to create an impression that meeting investors, having bilateral meetings when the President goes out is only happening under President Hakainde Hichilema. Please stop misleading the people. I was minister of foreign affairs, whenever the president travels, Ministry of Foreign Affairs prepares bilateral [meetings]. You take advantage of the people that are coming to attend the meeting and arrange bilaterals for the President. And you also arrange for the President to meet investors and speaking to them. President Edgar Lungu was doing the same, but there is an attempt to mislead the Zambians that it is only President Hakainde Hichilema who is doing this. It’s the first of its kind and he’s the chief marketing officer of this country. All presidents have been doing that.”

He added that in 2026, people will start asking for results from the trips the President has been undertaking.

“Since the President started travelling, we have never seen even one announcement of an actualised investment from his trips. Be careful the way you mislead the President and President be careful the way you make these announcements because in 2026, people will be asking for results,” said Kambwili.

THE State has applied to the Constitutional Court to remove some amendments made by former Konkola Copper Mines (KCM) provisional liquidator Milingo Lungu to his petition in which he is challenging the removal of his immunity by the Director of Public Prosecutions, Gilbert Phiri.

In this case Milingo wants the ConCourt to cite DPP Phiri for contempt of court for revoking his immunity from prosecution.

Milingo argues that Phiri’s action was calculated to directly interfere with and frustrate the proceedings before the ConCourt on the immunity agreement he entered into with the State by rendering the matter nugatory and an academic exercise, thereby prejudicing the outcome of the proceedings.

He also argued that the DPP’s action was calculated to undermine the authority of the court by usurping the court’s power to consider and pronounce itself on the immunity agreement, and also calculated to obstruct or divert the course of justice.

In March this year, the court granted Milingo an application for leave to amend his petition, and on April 7, 2023, Milingo filed his amended petition.

In the amended petition, Milingo is seeking a declaratory order that the agreement between him and the DPP, granting him immunity or indemnity from prosecution, is binding on all state instructions as from the date of such grant.

He also wants an order of certiorari to quash the decision to purportedly revoke the immunity or indemnity agreement, on ground that such purported revocation is illegal and therefore null and void.

Milingo also wants an order of mandamus directed at the first respondent’s agent to release to him forthwith all documents, accounts and properties seized in the course of investigations, damages as against the first and second defendant for misfeasance in public office, interim relief by way of stay of criminal proceedings pending determination of this matter and costs.

However, the State has now argued that the leave granted to Milingo was to amend the petition as formulated in the proposed petition and not generally as he pleases.

“The petitioner (Milingo) argues that the amendments made to the petition are within the scope of the ruling of this court and have been properly made. To rebut this assertion, we have taken the liberty to reproduce the ruling of this court under paragraphs 45 and 46 to show that the permitted amendments were specific and not as suggested by the petitioner. Clearly therefore, while it is not in dispute that the court in its ruling did permit the petitioner to amend his petition, it is contended that the leave granted was to amend the petition as formulated in the proposed petition and not generally as the petitioner pleases,” the state submitted.

“In the premises, we implore the court to strike out the petitioner’s amendments introduced in form of the general title, paragraphs 3,28,34, the alleged constitutional breaches under paragraph 6 and the reliefs sought under (b)(c), (g) and (I) of the amended petition. The petitioner by his own arguments concedes that the amendments he made go beyond what the ruling permitted but insists citing a number of cases that amendments should be allowed to ensure all the issues in dispute between the parties are dealt with in one matter so as to prevent a multiplicity of actions”.

The State contended that Milingo was abusing the process of the court by ignoring the amendments he sought to effect and generally amending the petition.

“This issue is simply that once leave has been granted to amend, one cannot go beyond the scope of what has been permitted by the court. The court will grant leave to amend based on the party’s own application. The petitioner is bound by the application he made and how he formulated his proposed amendments. The petitioner has further argued that the application by the first respondent to strike out the amendments is improperly made, is frivolous, vexatious and an abuse of the process of the court,” the state submitted.

“We submit that it is in fact the petitioner who is abusing the process of the court by ignoring the amendments he sought to effect and generally amending the petition to include amendments beyond that which he had proposed to do as exhibited in his notice of motion. Clearly, a party on the grant of leave to amend is not at liberty to amend a document, in this case the petition, generally or as he so wishes. The amendments are guided by the ruling which would have been granted based on the proposed amendments. Any amendments beyond what was proposed in the application would amount to an abuse of the process of the court. We therefore implore this court to strike out the amendments made by the petitioner which are beyond what was permitted by the ruling of this court dated March 31, 2023.

The Attorney Attorney General has appealed against the judgement of the Lusaka High Court to quash the decision of the Ministry of Tourism Permanent Secretary Evans Muhanga to cancel the tender for the granting of the Safari hunting/Photographic Tourism concessions in 19 hunting blocks in various Game Management Areas.

The state has raised seven grounds of appeal.

Among the grounds, the state claims that the court below erred in law and fact in holding that it was the Permanent Secretary of tourism that made the decision and went so far in saying that he had no jurisdiction to do so to cancel the tender process for the grant of the hunting concessions when the Permanent Secretary merely conveyed the Ministerial Procurement Committee.

The appellant says the court erred in law and fact by stating that the PS held no jurisdiction when he is the controlling officer under section 26 of the public procurement Act, 2020, charged with the duty and responsibility of ensuring that the procurement process is done in accordance with the public procurement act.

In this matter, the Zambia Community Resources Board Association Limited, Mopane Safaris Limited, Kwalata Safaris Limited,MVU Safaris Limited and Ntengu Safaris Limited had sued the Attorney General, seeking judicial review of Mr Muhanga’ s decision to cancel the tender for the granting of hunting tourism concessions in 19 hunting blocks on November 13,2020 and closed on December 30,2020.

They submitted that the PS violated section 69(1) of the Public Procurement Act no.8 of 2020 which permits a procuring entity to cancel or terminate procurement proceedings at any stage prior to notification of the contract award.

And in passing Judgement, High Court Judge Sharon Newa, quashed the said decision by the Permanent Secretary dated May 4,2022.

Justice Newa also ordered the Attorney General to facilitate the performance of its Statutory Instrument function of executing the hunting concession agreements with the aggrieved parties.

She issued an order of Prohibition preventing the Ministry of Tourism and Arts from re-advertising the tender saying the applicants had followed the law and regulations governing the procurement of the hunting concession tender.

MAPULA Catholic Parish Priest John Fulele in Milenge District has cautioned youths in the church against involving themselves in beating up witchcraft suspects.

Speaking when he addressed young people during a youth camp, Fr. Fulele said the habit of beating up witchcraft suspects after they are located by a coffin of the deceased should not be condoned.

Fr. Fulele explained that the act of making charms so that the coffin of the deceased can locate the suspected killer is a common practice in most parts of Milenge and church members should desist from such acts.

He noted that what is more saddening is that most of the people who are in the forefront whenever such activities are taking place are the youths and among them Catholics.

Fr. Fulele indicated that such activities are not just inhuman but they have the potential to continue dividing the community as people will be suspecting each other of witchcraft acts thereby subjecting those suspects to severe beating and in some instances even being killed.

“Some of you will be arrested by the police and end up spending your entire lives in prison because killing someone on suspicion of witchcraft is illegal,” he noted.

“If one of our relatives has passed away, there is nothing that we can do to bring them back apart from just praying for them to rest in eternal peace,” he said.

Fr. Fulele observed that if such activities in the area continue, it will be difficult to develop the area as most people will be shunning to come and invest hence it will continue to lag behind.

In some parts of Luapula Province there is a ritual which is practiced called (Ichitaleme) where some charms are made so that the coffin of the deceased can move pallbearers to locate whoever is suspected to be involved in the death of the person.

The community members end up beating those who are located by the coffin and others have even been beaten to the point of death.

JUDICIARY WANTS TRIBUNAL FOR ERRING JUDGES

AGAIN, during the 2017 to 2020 constitutional review up till the National Dialogue Forum (NDF), the Zambian Judiciary and civil society organisations (CSOs) made proposals on what they sought to be reviewed in the current Constitution.

One of the many proposals the Judiciary made was a merger of the Constitutional Court and the Supreme Court into one apex court.

The proposal was for the original jurisdiction in constitutional matters to be restored or reverted back to the High Court, under a Constitutional Division.

The Judiciary’s arguments were that placing original jurisdiction in constitutional matters in the Constitutional Court denies a litigant the opportunity to have the decisions of the court reviewed and tested by another court in a moment where a litigant is dissatisfied with the decision of the court of original jurisdiction.

The Judiciary also wanted the review process to delete provisions on the processes of removing judges from office.

It was their view that the new provision of using the Judicial Complaints Commission should be replaced by reversion to the previous process which was in place before the 2016 Constitutional amendments.

In their preferred process, a judge would be subjected to a disciplinary hearing before a Tribunal of his or her own peers just as legal practitioners sit before Committees comprising of their peers at the Law Association of Zambia.

On the part of the civil society, there was a strong push during the NDF for adoption of the Mixed Member Proportional Representation (MMPR) System which would provide for more women and youth representation in the National Assembly and Councils.

This was met with resistance from major political parties who claimed that smaller parties and CSOs wanted to use the back door to enter Parliament and local councils.

The opponents of the MMPR system argued that this system would be unfair as it would allow certain groups free passage into the Parliament and local councils.

They stated that candidates for traditional political party are required to spend considerable resources on campaigning for their elective seats in the same parliament.

The counter-proposal by those who were opposed to the MMPR system was to include a provision in the proposed Political Parties Bill which would compel political parties to adopt more women and youth.

Adopted candidates would, in turn, compete on the same terms as all others who aspire to the office of Member of the National Assembly.

This counter-proposal was rejected by the CSOs who then threatened to shoot down the entire constitutional review process which had climaxed at the NDF.

Other institutions such as the Electoral Commission of Zambia made submissions that called for removal provisions from the Constitution which limit the number of parliamentary constituencies to one-hundred-and-fifty and place them in an Act of Parliament.

The intention was that said the number of seats in the National Assembly should easily be increased or decreased when circumstances arise and at the whim of the National Assembly or government without the need to amend the Constitution.

This proposal attracted a mixed reaction with some delegates viewing it as a move by the then ruling Patriotic Front to create more seats in its strongholds for purposes of gaining greater control of Parliament.

We must acknowledge that the exercise of legislative power based on numbers is one of the pitfalls of representative democracy.

The party in power or indeed any other party, if it has numbers in parliament, can move amendments any legislation and the Constitution itself regardless of the wider public opinion.

Naturally, the issues raised by the Judiciary, Civil Society Organisations and the Electoral Commission, when viewed objectively, give rise to the question of whether or not there is an urgent need to amend the Constitution in view of those issues, as has been done in other countries?

The biggest challenge with Zambia’s approach to constitution-making is that it is driven by what is happening in other countries.

We tend to review our constitution not because we have our own original ideas which reflect our own national circumstances.

We usually invite so-called foreign experts to come and tell us about what is in their constitution and what must be in our Constitution.

Some of the issues which may be considered for amendment or removal from the Constitution have not been fully tested to see how they work over an extended period of time.

As a matter of fact, some provisions were deliberately placed in the Constitution in order to “protect” such provisions from the whims of the party in power using its parliamentary power to amend Acts and change the law at its own convenience. Are we ready to revert to our old ways?

Of course, this author believes our Constitution does indeed have some lacunae and ambiguous provisions which ought to have been cleared and clarified with other provisions.

But no Constitution in the world is perfect, including the world’s oldest written Constitution of the United States of America whose twenty-nine amendments, so far, are testament to its imperfections.

The fact that a constitution is not perfect is the reason why we have courts specialised to deal with problems that emerge from the lack of clarity in a constitution.

The best approach to removing ambiguities and redress matters which its drafters never thought would arise is to allow the Constitutional Court to broadly interpret the Constitution.

Unfortunately, our Court has been the first one sending invitations to Parliament, through its judgments, to open the Constitution up for further amendments.

Our Court must emulate its sister Supreme Court of the United States of America to never duck, weave and push back the Constitution to the people and Parliament.

It is the duty of our Constitutional Court to develop this country’s constitutional jurisprudence without any need for further amendments to the Constitution.

This is all because its better this match not go through than to promote the Kalu fame according to Kamanga’s ego and no use of FAZ present kit minted or mixed with 2012 flavour like Barca team will be. On the other hand we have alot of negative energy from political elites mainly UPND the ruling party demonising Kalusha Bwalya accusing him of plotting a FAZ comeback through the ministry of sports.

In all these its the Zambians that want that game badly and the marketing of nation as a choice tourist destination at stake.

Zambians do reserve the respect for Kalu as a living legend from our past who messed up his integrity by contaminating himself with politics. Political elites are not having anything good about the game especially the involvement of Kalu as they see him as a politician of PF. This must serve as a warning and a lesson to all living figures in the football world and other sporting discipline to stay away from politics no matter the temptation because time may come when the public will not forget.

How is Zambia’s relationship with its neighbors? Is he convinced that it is at its best? 2. You have been fighting corruption related to the previous government. But what about the Corruption in your government? Why do you punish whistle-blower and victims but protect Ministers and others?

3. Inefficiency, bureaucracy, ineptitude and failure characteristics service delivery in your Government, will you make changes? When will you stop blaming civil servants and the Patriotic Front for this and ensure that the job is done and service is delivered?

5. FRA sold and exported almost all national strategic reserves. Currently FRA has 246,000metric tonnes(one month supply) to the point of food insecurity. Levy DNA lab has already dealt with 5 paternity cases – IG Musamba

INSPECTOR General of Police Graphel Musamba says the newly-commissioned Forensic DNA Laboratory at Levy Medical University (LMMU) in Lusaka has already dealt with five paternity cases.

The police chief made the revelation during the launch of the country’s first ever Forensic DNA Laboratory.

Before the launch of the K11 million Laboratory, Zambia used to send DNA samples to South Africa for examinations.

But the Laboratory set in the country, Musamba said DNA evidence had revolutionised the way Zambia Police Service approached investigations by providing evidence that links suspects to crimes and exonerates the innocent.

Musamba said lack of DNA facility in the country led to alarming increase in sexual and Gender Based Violence (GBV) cases.

He pointed out that in 2022, 33,536 GBV cases were reported as compared to 29,540 in 2021 representing a 73.3 per cent increase.

“Since the establishment of the cases submitted for analysis. Eight of these sexual offenses, 22 were murder cases, five were paternity cases, three were robberies and four were human identity inquiry cases, Musamba revealed.

And Minister of Home affairs and Internal Security, Jack Mwiimbu thanked the United States of America, United Nations, Ireland and Sweden for the rendered support towards the Lab’s establishment.

“My ministry is disheartened by the increasing number of sexual crimes and the high number of unresolved cases due the unavailability of DNA evidence, it is therefore a relief to government to know that such a huge problem can now be locally resolved for our people and by our own people,” said Mwiimbu.

This development will help Inspector General of Police Graphel Musamba and his men to stray away from asking the who, what, where, how and when questions for a long time in order to solve a criminal case, as he confirmed that the lack of a local DNA facility in the country is what led to the alarming increase in sexual and GBV cases.

Meanwhile, United Nations Resident Coordinator, Beatrice Mutali said DNA evidence provided crucial support to survivors’ testimony or witness statement in court.

To make this a success, the United States procured lab equipment costing a whooping US$600,000 (K11 million) while the United Nations Development Programme (UNDP) financed the partitioning of the lab and procured the first DNA reagents.

THABO Kawana is working against President Hakainde Hichilema on the issue of rule of law, says Advicates of People’s Prosperity (APP) secretary general Felix Bwalya.

“Fire him or transfer him to the Ministry of Home Affairs so that he can talk on issues of political party registration under the Registrar of Societies,” he said.

Bwalya condemned Kawana, who is director in the Ministry of Information and Media, for storming a radio station and disrupting a programme featuring PF presidential hopeful Emmanuel Mwamba.

“President Hichilema has been preaching on the rule of law, but Thabo Kawana is not walking this talk. He has been talking of the deregistration of the PF as if he is from the Ministry of Home Affairs [and Internal Security]. He is not a government spokesperson, not even a UPND spokesperson,” he noted.

“Political parties do not need to report to Kawana. Who is he? He is just a civil servant. So let him be retired from the civil service so that we face each other instead of him doing wrong things under the watch of President Hichilema. This man needs to be curbed because he is working against HH’s stand on the rule of law.”

Bwalya said Kawana is fueling political violence adding that had there been PF cadres at Mwamba’s radio assignment he would have been clobbered.

He appealed to President Hichilema to counsel Kawana, “fire him or transfer him to the Ministry of Home Affairs so that he can talk on issues of political party registration under the Registrar of Societies”.

“We, as opposition political parties, are there to offer checks and balances and we will condemn any move to try and deregister our colleagues the PF. What Kawana is doing is total abuse of office and I expect Honourable Cornelius Mweetwa who is the UPND spokesperson to come out and put Kawana in order because he is out of order,” he said.

Bwalya said Zambians voted for change because of the break down of the rule of law.

He noted also that President Hichilema has continuously talked against break down of the rule of law under the PF government.

“This is what Kawana is bringing back,” said Bwalya.

Police in Chisamba District arrested four suspected criminals among them a Police officer for the offence of Aggravated Robbery which the suspects staged on May 7, 2023 around 19:30 hours at Chipembi Business Trading area in Chisamba District.

One suspect is still on the run.

The suspects, five in number and armed with one AK 47 Assault Rifle, attacked a named man while in his shop at the Business Trading area.

Four of the suspects pretended to be from the Department of Immigration.

They are alleged to have stolen at gunpoint money amounting to K5,000.00, a Toyota Regius bearing registration number ABV 5968 and one Samsung cellular phone.

The suspects are also alleged to have abducted the victim aged 48 and another female person aged 38 from a different shop.

Police officers were alerted and pursued the suspects who were also driving an unregistered Toyota Sienta. They were intercepted at Munano Council Security checkpoint in Chisamba area. Two were arrested including a Police officer while three managed to escape.

During interrogations, the suspects were identified as
Joel Kambayi aged 36, a Police officer based at Chelstone Police station in Lusaka, Choolwe Matonka aged 32 of Chelstone area in Lusaka.

The following stolen items were recovered K5,000.00, Samsung mobile phone, a Toyota Regious and one AK 47 Assault Rifle with three rounds of live ammunitions.

The unregistered Toyota Sienta was also impounded.

The two suspects were detained in Police custody while a manhunt for the three other suspects was launched

On May 9, 2023, one suspect identified as Mweemba Matonka aged 19 of Chudleigh in Lusaka was arrested after his parents handed him over to Police in Chisamba. This was after information went out that Police were looking for him together with the other two who escaped at the checkpoint.

Investigations continued and on May 10, 2023, Police arrested the other suspect identified as Mando Mwanda aged 23 also of Chudleigh area in Lusaka.

Police are still looking for the other suspect only identified as Soko of Ngwerere area in Lusaka.

All the four suspects are detained in Police custody.

■growth in domestic credit slowed down to 12.1 percent, year-on-year, from 18.7 percent in December 2022.

■Concerns related to delays in external debt restructuring negotiations, tighter global financial conditions, higher maize prices, risks to the growth outlook, elevated energy and food prices.

Inflation declines in first quarter of 2023, but pressures to persist

Inflation declined further in the first quarter of 2023, albeit marginally. However, it remained elevated and is projected to stay above the target band of 6 – 8 percent over the next eight quarters (the forecast horizon).

In the first quarter of 2023, inflation averaged 9.6 percent compared to 9.8 percent in the fourth quarter of 2022. Dissipation of base effects in a broad range of items in the consumer basket and sustained reduction in the prices of oils and fats, due to lower costs of imported inputs, were the key drivers.

Notable items in the consumer basket in which base effects dissipated were road passenger transport, fish, fuel, bread and cereals, as well as rent. Accounting for the reduction in prices of oils and fats was the decline in the international soybean prices.

In April 2023, inflation rose to 10.2 percent from 9.9 percent in March. This was mostly driven by strong regional demand for maize grain and maize meal and the lagged pass-through from the depreciation of the Kwacha against the US dollar.

In the first quarter of 2023, the Kwacha depreciated by 16.8 percent to an average of K19.52 against the US dollar.

The key drivers were excess demand, adverse market sentiments associated with protracted external debt restructuring negotiations, and tighter global financial markets conditions.

To support the market in meeting some critical imports, such as, oil and agricultural inputs, the Bank provided US$377.0 million, of which US$186.0 million was from mining tax receipts.

The aforementioned support to the market, multilateral debt service, and Government uses contributed to the decline in gross international reserves to US$2.9 billion (equivalent to 3.3 months of imports cover ) at end-March 2023 from US$3.1 billion (equivalent to 3.8 months of import cover) at end-December 2022.

In April, the Kwacha appreciated against the US dollar by 16.8 percent to K17.73, mostly driven by improved supply of foreign exchange mainly from quarterly corporate tax obligations.

The reaching of the Staff-Level Agreement on the first review of the International Monetary Fund Extended Credit Facility (IMF ECF) arrangement created expectations that external debt restructuring would soon be concluded. This positively changed market sentiments and also contributed to the appreciation of the Kwacha.

Pressures in the foreign exchange market have, however, re-emerged, mostly due to excess demand for foreign exchange from a broad range of sectors, chief among them the wholesale and retail, financial, as well as electricity, gas and water supply. As at May 16, 2023, the Kwacha was trading at K18.53 per US dollar.

The inflationary pressures observed in April are expected to persist over the forecast horizon and keep inflation above the target band despite declining slightly relative to the February 2023 forecast.

Underpinning the current forecast are largely the impact of the recently approved electricity tariffs and elevated maize prices, particularly in 2023, as anticipated in the February forecast. In this regard, inflation in 2023 and 2024 is projected to average 10.5 percent and 8.4 percent compared to 11.1 percent and 10.5 percent in the February 2023 forecast, respectively. In the first quarter of 2025, inflation is forecast to remain at 8.4 percent.

Current account balance to rebound as the global economy recovers

The current account deficit narrowed in the first quarter of 2023 as deficits on both primary and services accounts reduced. The primary income deficit reduced on account of lower investment

income following a decline in dividend payments on foreign direct investment. Similarly, the services account deficit narrowed, reflecting lower expenditure on transportation attributed to passenger travel.

In the medium term, the current account balance is poised to post a surplus due to a faster rise in exports relative to imports on the back of the recovery in global growth.

The recovery is underpinned by a rebound in growth in China, unwinding supply-chain constraints, and subsiding disruption to food and energy markets.

Credit growth slows down, money supply expands, and economic growth to rebound in the medium-term

In March 2023, growth in domestic credit slowed down to 12.1 percent, year-on-year, from 18.7 percent in December 2022 following reduced lending to Government.

However, over the same period, credit to the private sector continued to grow—35.9 percent compared to 34.2 percent.

Money supply grew further by 30.0 percent in March 2023 compared to 24.5 percent in December 2022 due to increased credit to the private sector and valuation effects relating to US dollar denominated credit.

The economy is projected to slowdown in 2023, and rebound in 2024. This is underpinned by the recovery in agriculture and mining sectors as well as sustained growth in information and communications, manufacturing, transport, and financial and insurance sectors.

However, a slowdown in global growth, tight global financial conditions, adverse weather conditions, due to climate change, and elevated energy and food prices related to the ongoing Russia-Ukraine war continue to be key downside risks to the growth outlook.

Preliminary data from the May 2023 Bank of Zambia Quarterly Survey of Business Opinions and Expectations and the Stanbic Bank Zambia PMITM point to a moderation in economic activity in the first quarter of 2023.

This was largely attributed to the depreciation of the exchange rate and increase in fuel pump prices.

Monetary Policy Committee Decision

The Monetary Policy Committee, at its May 15-16, 2023 Meeting, decided to raise the Monetary Policy Rate by 25 basis points to 9.50 percent. The decision was informed by the projection that inflation will continue to be above the target over the forecast horizon.

The Committee also took into account fragile growth, and lingering vulnerabilities and risks in the financial sector.

Observed budgetary discipline and continued implementation of fiscal consolidation measures overall, including broader economic reforms outlined in the Eighth National Development Plan (8NDP), will remain important anchors to achieving lower inflation and macroeconomic stability.

Decisions on the Policy Rate will continue to be guided by inflation outcomes, forecasts, and identified risks, including those associated with financial stability and external debt restructuring.

The next MPC Meeting will take place on August 21 and 22, 2023.

The Minister has affirmed that the implementation of the 2023 budget is on course as all major budgeted programmes are now being funded, considerably.

He has also appealed to members of the public (individual and corporate) to actively participate in the formulation of the 2024 National Budget and the 2024 to 2026 Medium Term Expenditure Framework (MTEF).

Dr Musokotwane was commenting in connection with the April 2023 funding report whereby the Government released a total of K11.4 billion for developmental programmes and public service delivery.

“Of the K11.4 billion, K2 billion was released for transfers, subsidies and social benefits, whilst K2.2 billion was spent on debt service (domestic and external) and dismantling of arrears, and K3.6 billion was spent on the public service wage bill. In addition, the Government released K3.2 billion for implementation of various government programmes and general operations, while K359.7 million was spent on road infrastructure,” he said.

“From the K2.2 billion released for debt service and dismantling of arrears, a sum of K1.6 billion went towards both domestic and external debt payments to multilaterals while the component related to dismantling of arrears for suppliers of goods and services, got K627.4 million.”

Notable expenditure items under this category, included:

1) K388.3 million as grants to schools;

2) K275.3 million for the Farmer Input Support Programme;

3) K209.9 million for the nationwide Social Cash Transfer Programme;

4) K436.5 million for the operations of hospitals, other grant aided institutions under various Ministries;

5) K221.2 million for the Public Service Pension Fund (PSPF) for pensioners financing gap and grant;

6) K100 million for the Local Authorities Superannuation Fund (LASF) financing gap;

7) K115.1 million for university grants to ensure smooth operations; and,

😎 K111.6 million to the Local Government Equalization Fund.

K3.2 billion was released to facilitate service delivery under various public institutions. Under this aspect, notable expenditure items included:

1) K436.7 million for the procurement of drugs, medical supplies and equipment (Ministry of Health);

2) K22.4 million for TAZAMA workers’ salaries;

3) K125 million for the Compensation and Awards Fund;

4) K42.5 million targeted at youth skills development through the Skills Development Fund;

5) K24.6 million Tourism Levy for development of Infrastructure in tourist locations; and,

6) K2.7 billion for general operations of Ministries, Provinces and Agencies (MPA’s), of which K631 million went towards public, health, education as well as water and sanitation infrastructure.

Patriotic Front Chairperson for Information and Publicity Raphael Nakacinda has described the conduct by the Drug Enforcement Commission at the residence of Former Mines Minister Richard Musukwa as a clear Trespass.

Yesterday, the DEC conducted a search at Hon Musukwa’s residence which resulted into seizure of Some vehicles, Stones and A House in Chililabombwe.

But Hon Nakacinda said what is shocking is that the officers went with a blank document called a search warrant and began recording in the premise whatever they saw as something they could include as some of the things to be seized.

He said it is a shame that the the DEC even seized decorative limestone and not precious Minerals as sensationalised by some section of society.

Hon Nakacinda said It is laughable that the UPND is determined to inculcate a mentality among citizens that promotes poverty other than prosperity.

He said the property that they have seized from Hon Musukwa, most of it was acquired before he even became a Politician.

Hon Nakacinda said it is therefore unfortunate that the purported search party went to conduct criminal activities at the residence of Hon Musukwa.

“The Stones seized at Hon. Richard Musukwa house are decorative limestone not precious minerals. The House searched and seized was bought by Hon Musukwa before he became a politician.

The property they have seized is a property people know that Hon Musukwa built many years ago when he was serving on some unions. They have sensationalised report that now they got stones. But the stones they confiscated are the lime stones we put in the yards. They are not minerals. A vehicle he acquired when he became member of Parliament. They have even seized an allion for his wife,” he said.

He said that what is more disheartening is that Hon Musukwa is a successful entrepreneur whose track record in terms of business can be seen by all.

From what is transpiring, Hon Nakacinda said it is clear that citizens under the current Government are sentenced to not having property.

Citizens First (CF) president Harry Kalaba has described as irresponsible and cruel to small-scale farmers the announcement by the government that it will not buy any soya beans this year.

Mr Kalaba also says the new price of a 50 kilogram bag of maize announced today by the Food Reserve Agency (FRA) will lead to further increases in the prices of mealie meal because of the absence of subsidies.

“The increase in the price of maize without a safety net will cause more suffering to citizens because the price of mealie meal will be out of the reach of an average family. Government is being irresponsible,” he said.

He said this in a statement issued in Lusaka, Wednesday.

The FRA announced today that it will be buying a 50kg bag of maize at K280 from K180 but said it will not buy soya beans because it has enough stock from last year.

It also said it will buy only 500,000 tonnes for strategic reserves.

Mr Kalaba made the following observations:

1. The price of mealie meal is expected to rise further following the announcement by FRA that it will be buying a 50kg bag of maize at K280. The last price was K180.

This means farmers will also demand that the private traders buy the grain at K280.

Without any government subsidy, millers will be forced to sell the mealie meal at commercial prices to recoup the cost of maize and make a profit. The price of mealie meal may shoot to between K300 and K350 for a 25kg bag. So, citizens should brace for higher prices of mealie meal.

2. The FRA has thrown small-scale farmers under the bus by announcing that it will not be buying any soya beans this year.

“This is irresponsible and will bring misery among small-scale soya beans farmers who will be stuck with the commodity or be forced to sell it to the cruel private buyers at give-away prices,” Mr Kalaba said.

He noted that because of the chaos in the distribution of fertiliser in the last farming season, many farmers did not grow maize to avoid losing their crop but opted for soya beans, which the FRA used to buy at K650 last year while private buyers insisted on buying it at as low as K400.

“For example, in Mumbwa very few farmers grew maize because of lack or late delivery of fertiliser. Majority of them grew soya beans. FRA has now left these poor farmers at the mercy of private buyers who are already offering K280 for a 50kg bag. It’s an insult for the private buyers to offer such a ridiculously low price,” Mr Kalaba said.

He is worried that the continued mismanagement of the agriculture sector by the New Dawn government was posing a threat to the country’s food security.

It is extremely painful to see how state organs are abusing citizens each time there is a difference of opinion between and among citizens on the one hand, and the State on the other.

In the end, we have a situation where those elected to govern, have, in under 20 short months after taking power, descended into a worrisome state of insecurity. We now have a state of insecurity in the place of democracy underpinned by the 2.8 million votes. This figure one would have thought gave the UPND government unfettered legitimacy for people to be repaid through good governance practices.

In all this, only the gullible would be fooled that the current government is acting within the law each time they arrest an opposition leader. To the contrary, what is at play is LAWFARE, the use or abuse of legally established organs of the state to inconvenience citizens who hold different views from those in power. This is a clear dawn of the most sustained crackdown on dissent, only comparable to the authoritarian one party state of the UNIP era. It is not surprising in response to the visit by the Communist Party of China, the UPND said they wish to learn on how the UPND can institutionalize the party just as it is institutionalized in China! Are we going back to the One Party State of UNIP days? Then the Director of Information at the ministry of Information, my good brother Thabo Kawana responds to to political activism of the opposition PF that, “If we here you, telling lies we will come for you!” How can a the civil service go for political issues?

The executive through the police brutalize, maim and take away peoples’ lives at will. The police are used to deny people the freedom of speech, movement and association and fair participation in elections. Elections are a cardinal conduit for peoples’ participation in governance and politics being the activityby which groups reach binding collective decisions through attempting to reconcile differences among their members is health in our contemporary democracy. Politics must presume an initial diversity of views about goals or means or both. It is said that, were we always in agreement all the time, politics would be redundant. Politics involves reconciling such differences through discussion and persuasion and not weaponising state institutions against dissenting citizens.

The Judiciary seems to have an insatiable appetite to take away peoples’ liberties at will, deny people justice, or take away their hard earned wealth through incompetent or corrupt rulings. By her own admission, Justice Chibesakunda as Acting Chief Justice, told the nation that the judiciary was corrupt. And indeed we have seen in the recent past the dismissal of a number of judges and other officials from the judiciary.

The legislature is another institution involved in double standard practices against citizens simply for pointing out bad practices. It is like politics is a plague in this country and for as long as someone who is practicing it is not in government, then they are a pariah to the state and must be dealt with brutally! Did given Lubinda deserve to spend time in police custody for the perceived misdemeanor for which Parliament did not complain against? Cry my beloved country and HELL NO!

It is embarrassingly bizarre, that Parliament, the very bastion of our democracy, must itself lead in the campaign to gag citizens in the most draconian manner one can ever imagine in a democratic society.

How can verbal differences between an opposition leader and Parliament turn into criminal defamation for which an alleged offender must face criminal sanctions?

Let us not forget that in 2012, I chaired Mr. Speaker’s Select Committee that considered the ratification of Mr. Mutembo Nchito as DPP. Following his ratification, I was concerned with his actions that led me to write to Mr. Nchito, President Sata, the Attorney General and the ACC Director general as follows and I quote:

“I have perused through Cap 12 of the Laws of Zambia and come to the following clauses that are critical to the Mutembo Nchito case:

16. Any person who before the Assembly or any authorised committee intentionally gives a false answer to any question material to the subject of inquiry which may be put to him during the course of any examination shall be guilty of an offence against section one hundred and four of the Penal Code.

In this case, I wrote, Mr Mutembo Nchito gave a false answer to the Committee which had shared concerns with him that given that it was the PF government’s wish that Mr Banda’s immunity be lifted, Mr Mutembo Nchito’s assertion that Mr Banda targeted him and that the downfall of Zambian Airways, a company so dear to his heart, was a consequence of that targeting, would compromise his position.

It was also pointed out to him that the prosecution of Dr Mathani, whose bank he was indebted to, was awaiting the new DPP’s instructions. Mr Mutembo Nchito allayed these fears by stating that he would not personally prosecute Mr Banda and that he would declare interest in any matters involving Dr Rajan Mathani.

He however went on to enter two nolle prosequi in favour of Dr Rajan Mathani who in turn discontinued claims against him for the money owed to Finance Bank. Dr Mathani was caused to commit possible corporate fraud when he illegally used company proceeds to pay for his sins.

He also evaded tax payments as a result of lost interest income from which the public should have earned tax. Dr Mathani committed corporate fraud and frustrated ZRA’a ability to collect tax from the bank’s transactions.

By stating the above highlighted falsehoods, Mr Mutembo Nchito was in breach of Section 16 of Cap 12 of the Laws of Zambia which is an offence under section one hundred and four of the Penal Code.

Following the above-mentioned letter, I further sought guidance from the Speaker on how I needed to proceed if Mr. Nchito failed to exculpate himself. I was ignored and rumor had it that I was going to be suspended from Parliament for expressing concerns bordering on public interest. My seat was later nullified.

Parliament never responded nor acted on my observation.

A short while letter Mr. Hichilema as an opposition leader was about to be summoned by Parliament to go and be sanctioned for comments Mr. Speaker was not pleased with. I wrote to the Speaker reminding him of more serious criminal acts regarding Mr. Nchito, which the Speaker ignored. He abandoned the planned action against HH:- What an act of institutional arrogance and insincerity!

Fast forward, Hon. Lubinda was incarcerated for apparently ignoring Parliament summons. But then, this is the same Parliament that ignores people when they seek redress from the Institution – double standards!

Recently, I wrote to the Speaker asking her to operationalize the Office of the Public Protector. Nothing has happened, not even an acknowledgement of receipt of the request.

When the citizens proposed to have that Office in the constitution they enacted for themselves, nobody has the right to ignore them especially those that swear to uphold it. Maladministration, which that Office is supposed to deal with, has continued unabated by the UPND government at great cost to the nation’s development agenda. Cry my beloved country!

Zambia Must Prosper Party (ZMP) President, Kelvin Fube Bwalya popularly known as KBF has stressed that the country’s biggest problem is the lack of leadership by the UPND Hakainde Hchilema led administration to deal with the problems of KCM and Mopani Copper mines on the copperbelt.

He says President Hichilema has been on the Copperbelt province more than three times but has failed to tell the people in the region any good news regarding the way forward about the two mines therefore the numerous challenges stating that ZMP has a plan which will be shared when the party launches its manifesto.

Mr. Bwalya says it is a shame that the UPND government is applying the same solutions they were condemning when PF was in office to address the KCM and Mopani Copper mines difficulties.

The ZMP President was responding to questions from journalists when he paid a courtesy call on Economic Front Party President Wynter Kabimba in Lusaka.

And Mr. Bwalya says the recent raid on former President Edgar Chagwa Lungu’s residence by a battalion of police officers welding a grinder ready to bring down the gate to gain entry into the premises was unnecessary and a psychological harassment of the former first family.

He says the drama was unnecessary as all that needed to be done was to send a callout to the former first lady to appear before the police than what transpired in a country claiming to be democratic and whose President has postured himself as a respecter of the rule of law.

Meanwhile, Mr. Bwalya says ZMP party is making proposals for a possible alliance with other opposition political parties ahead of the 2026 general elections and that the country will be informed in due course when the plan is concretized and was quick to indicate the need for such an alliance.

On the purported resell of government VXs as directed by President Hakainde Hichilema to secretary to the cabinet, Mr. Bwalya described the move as a news headline stunt by President Hichilema saying it is devoid of being realistic and will hurt Ministers and Members of Parliament from rural constituencies whose geographical terrain may not allow use of small vehicles such as Toyota Vitz, Toyota Allion or “Tuma Yango”.

Speaking earlier, Economic Front Party President Wynter Kabimba has scoffed at insinuations that the UPND government has delivered by employing teachers and health workers, saying Zambians voted for the UPND on the promise to reduce issues of food and high cost of living.

And Mr. Kabimba says it is a shame that foreign embassies accredited to Zambia are not speaking on the ills of the UPND government, such as arrests of opposition political party leaders.

He says President Hichilema must be kicked out of office in 2026 because he has sent the country to hell and not the promised heaven through, among other failures, continued tribal appointments.

“WHO STARTED THIS” LIE” AND WHY?….”NATIONAL HEROES UNFIT TO HOST INTERNATIONAL MATCHES”

It is a well-scripted, coordinated, rehearsed and timed lie meant to derail a noble national cause.
It is clear to all and sundry that the release of the “lie” is well-calculated and planned.
It is easy to decipher who started the lie and the motive.
To understand this, let us look at the following:

1. National Heroes Stadium hosted a CAF Qualifier, Zambia Vs Comoros, on 7th June, 2022. What has happened between 7th June, 2022 and now for Heroes Stadium to be declared unfit?Have we been fined or censured by CAF on any concerns raised about Heroes Stadium? As far I can remember, we have not heard anything to the effect that the stadium is not fit to host international matches.

2. It is a FIFA /CAF requirement that about three to four months before any qualifier that the host nation informs CAF of the stadium they plan to use for the next game. In turn CAF considers the stadium being proposed as venue. CAF also considers among other things facilities like hotels being proposed to host visiting team. Distance between the airport where the visiting will land and where the match will take place is also considered.

Once CAF or FIFA okays the proposed venue for the match, the details are fowarded or shared to the visiting team. If a country has two (good) stadia like the case of Zambia, CAF will only respond or comment on the stadium that was proposed by host Football Association. The question is did FAZ submit Levy Mwanawasa stadium or Heroes Stadium as the planned stadium to host the next Qualifier next month or did FAZ submit two venues?

3. CAF approval is for a specific game or games. Once the host FA has submitted the venue to CAF or FIFA, the approval of the venue is for a specific match or matches. The approval for the next Qualifiers read “This list is specific for the Africa Cup of Nations Cote d’ ivore 2023 group stage Qualifiers, match day 5”. This means that FAs that will be away on match day 5 will have to inform CAF again about the stadium they plan to use in June even if CAF had allowed them to use the very stadium in March, 2023.

4. When CAF inspectors came to inspect facilities following our Afcon 2025 bid, we happily took them to Heroes. Have we forgotten what was said when the CAF inspectors were around?

5. If CAF had /has any reservations or concerns on Heroes, has FAZ communicated to the Ministry of Infrastructure so that the concerns can be addressed?

Having considered the above, it is clear that the release of the news claiming that the Heroes Stadium is unfit was not done in good faith. We can only make a hazard guess that the very misleading information was another attempt to derail the match between Chipolopolo Legends and Barcelona Legends slated for next week Thursday.

It is being orchestrated by known individuals hell bent on manipulating Zambians or always playing victim. They desire to appropriate good to themselves and bad to others.

But we believe that since the misleading information was not hatched by our FA, at the right time FAZ is expected to clear the air regarding the process of how venues to host Qualifier games are arrived at and whether they submitted Heroes to CAF.

Gold Mafia: Uebert Angel Cleared of All Charges By The Reserve Bank Of Zimbabwe

Zimbabwe’s Ambassador-at-Large to the Americas and Europe Uebert Angel can breathe a sigh of relief after being exonerated of all gold smuggling and money laundering allegations levelled against him.

On Monday, the Reserve Bank of Zimbabwe’s Financial Intelligence Unit announced that his accounts, along with those of other individuals embroiled in the notorious Gold Mafia Documentary by Al Jazeera, have been unfrozen.

This recent turn of events serves as a vindication for the diplomat, who has repeatedly maintained his innocence since the documentary was released.

The Financial Intelligence Unit has conducted an extensive investigation and has concluded that Angel and the other individuals mentioned in the documentary were not involved in any financial crimes, putting to rest any lingering doubts about their innocence.

Following the broadcast of Al Jazeera’s documentary series titled “The Gold Mafia” the Financial Intelligence Unit (FIU) issued a directive on 31 March 2023 directing financial institutions to identify, freeze and report bank accounts and other financial assets owned and/or controlled by individuals who were alleged to have played key roles in alleged acts of money laundering and other financial crimes.

The FIU exercised its temporary freezing powers to ensure that any illicit proceeds connected to the allegations in the documentary would not be dissipated or disposed of by the persons concerned and prejudice potential future investigations.

The FIU, working in close collaboration with law enforcement agencies, has since concluded its analysis of the four episodes of the Al Jazeera documentary and has also analyzed the financial assets and transactions of the persons implicated in the documentary and has determined that there is no good cause for the freezing order to remain in place. The FIU has not identified transactions/assets linked to money laundering and related financial crime connected to the allegations in the Al Jazeera documentary.

In view of the above, the FIU has directed financial institutions to unfreeze all the accounts and other financial assets that had been frozen pursuant to the directive of 31 March 2023. The unfreezing action is without prejudice to any further investigations that law enforcement agencies may wish to commence or continue against any of the persons involved.

Some of the allegations in the documentary relate to money laundering and financial crimes alleged to have taken place outside Zimbabwe’s borders. The FIU, if so requested, stands ready and is indeed mandated to cooperate with any international investigations against any of the persons or entities mentioned in the documentary.

Ghana to get first $600m from IMF after Wednesday

The Minister of State at the Finance Ministry, Dr Mohammed Amin Adam Anta, has confirmed that the first tranche of $600 million will be disbursed immediately after the Executive Board of the International Monetary Fund (IMF) approves Ghana’s request for an extended credit facility (ECF).

Confirming to Reuters in a phone interview on Sunday, May 14, the Karaga Member of Parliament (MP) said a second tranche of the same amount will drop by end of year with the rest disbursed in equal tranches of $360 million after semi-annual reviews.

“We expect a deal on Wednesday,” the former Deputy Energy Minister is quoted as saying.

“With the disbursement, there is going to be $600 million as a first tranche just immediately after the approval.”

The first tranche is expected to be received by the country within a week after the Executive Board’s approval.

This development follows the massive support given to Ghana on Friday, May 12 by the Paris Club.

It was at its meeting co-chaired by China in Paris.

“The creditor committee examined the macroeconomic and financial situation of Ghana, including its long-term debt sustainability, and its formal request for a debt treatment under the ‘Common Framework for Debt Treatments beyond the DSSI’ endorsed under the Saudi G20 Presidency in November 2020, which was also endorsed by the Paris Club,” the Paris Club said in a statement on Friday.

“The creditor committee supports Ghana’s envisaged IMF upper credit tranche (UCT) program and its swift adoption by the IMF Executive Board to address Ghana’s urgent financing needs. The creditor committee encourages Multilateral Development Banks (MDBs) to maximize their support for Ghana to meet its long-term financial needs.”

This brought joy to President Nana Addo Dankwa Akufo-Addo, who talked highly of the “last hurdle” crossed when he met the Ghana Catholic Bishops’ Conference at the Jubilee House.

“Today is a very special day in the recent history of Ghana. At long last today, we have been informed that the last hurdle towards our agreement with the [International Monetary] Fund has been overcome, which is that the Paris Club met today in Paris with the creditor’s committee co-chaired by China and has okayed and approved Ghana’s request of the IMF.”- 3news.com

LOVE TO CHILDREN & SPOUSES OF RIVAL POLITICIANS

I have come to witness some unwritten rule in politics be it in Zambia or elsewhere. Never attack your opponent’s family (wife and children). You will therefore never hear me attack any politician’s family and glad to have observed that most of our past and current President can be said to do that.

About 2008 late then opposition PF President Michael Sata (MCS) had a funeral. His son Mulenga lost a beloved daughter. I remember being at the funeral house (Mulenga’s home) and a message came that President Rupiah Banda (RB) would visit at a particular advised time. President Sata tasked me to welcome President RB when he does arrive. When the convoy approached I got there to welcome the RB entourage led by then Minister Hon Catherine Namugala. I ushered them to the tent where MCS was seated.

Within seconds of passing condolences from RB to MCS, the tent became some insaka of laughter with the two reminiscing their young lives away from politics. I ushered back the RB entourage to their vehicles some 40 minutes later but by then it was evident the RB visit had managed to cheer up MCS, Mulenga, wife and all mourners that were present. Their burden was made lighter but needless to say that it was only a week or two later before President RB and Opposition leader MCS were back in news boxing each other in the political arena.

I have come to read today that when then President Edgar C. Lungu (ECL) was marrying off daughter then Councillor Tasila Lungu, HH posted a congratulatory message. Today we woke up to a good gesture from the former President ECL of a congratulatory card addressed to the daughter (Miyanda) of President HH and her husband Meenda on their wedding over the weekend. This is commendable given the evident tension between the President and former President since 2021 general elections.

Shall it be so that children and spouses of political leaders are respected and not dragged into political shenanigans or abuse of each other. One may however point out that what if the children or spouse themselves enter the political arena should they fall on this unwritten rule of being shielded. Subject to debate.

For today I commend President ECL for showing love to the children of President HH. Meenda and Miyanda must be the happiest and not to be brought into political kick boxing as they are not politicians but children of a politician. May we all emulate ECL and show love to families of fellow politicians be it within same party or rival parties.

PRELIMINARY REPORT ON PIPELINE RUPTURE AT KM 839 SWAYA, NEAR M.U.S.T. IYUNGA MBEYA

Background

Tazama Pipelines Limited is aparastatal owned by the governments of Zambia and Tanzania by shares 67% and 33% respectively.

It operates a 1,710 km pipeline transporting finished products from the port of Dar es Salaam to receiving terminal at Ndola, republic of Zambia.

In Tanzania, Tazama owns a 6 storage tanks tank farm with capacity of 231,000,000 litres, and 5 booster pumping stations situated at Kigamboni, Mikese Morogoro, Elphons Pass Kilosa, Mbigili Iringa, and Inyala Mbeya.

There are 2 booster pump stations in Zambia, Chinsali and Kalonje.

Source of Rupture

On 15th May, 2023, at around 13;40 hrs, a contractor, working on behalf of Tarura, was carying out road works at the said area, and while grading the road, he ruptured Tazama pipelines causing serious damage to the pipeline and spillage of over a milion litres of Low sulphur gasoil [LSG] which gushed out of the ruptured pipeline.

Action taken by Tazama

At around 13;10 hrs, operator on duty noticed an abnormal change of parameters [a rapid pressure drop] downstream the pipeline.

Immediatel, the station ordered a line survey to the walking patrols along the line and at about 1340 hrs the Swaya ward councillor rang Tazama to inform about the rupture.

An emergence response team was organised and sent to the site. All procedures put in place were caried out like isolating the problematic section by closing the valves at Km 799 and km 856 Songwe.

On arrival at scene at around 14;30, the team assessed the situation and started procedures for containing the leak. Because of the abnormality of the rupture, [big hole caused the the Motor grader blade] the team requested assistance from Dar es Salaam regional office, for more machinery/equipment assisted repairs.

By the time of writing this report, the team with their equipment is on the way to the site.

Costs associated with this rupture

Preliminary cost includes, about 1.0 million litres of spilled LSG, cost of repairs consisting of mobilization of manpower and equipment, supervisory and administrative costs to be worked out after repairs are completed and demobilization is done.

In addition to the above costs, idle time cum loss of business as a result of this will also be calculated. Environmental degradation associated costs will also be calculated.

Conclusion

It is estimated that operations will resume in 2 days’ time on completion of repair works and environmental clean-up. It is also worth noting that the pipeline Right of way is very welI located but it seems the contractor neglected the markings.

Who Owns Afcon 2012 Jersey?

Who owns the jersey that was worn by the 2012 Afcon champions – Zambia? This question has triggered a very healthy debate in the country. It is good that issues of Intellectual Property (IP) rights are now becoming part of our debate.

So, the answer to the question is twofold.

Firstly, as any lawyer will tell you, the answer is found in the contract between the sports wear company Nike and the Football Association of Zambia (FAZ). Ordinarily, in most of such contracts, the IP rights remain with the sportswear company like Nike but the contract may provide something else. That is the easy answer to the question of ownership of the jersey.

Secondly, the answer can also be very complicated. Four different pieces of legislation comes into play and I will briefly touch on them below.

1. Trademark – the FAZ logos, shapes like the Nike mark and all that on the jersey will be protected under the trademark law. In Zambia, it will be the Trade Mark Act, Chapter 400 of the Laws of Zambia. For them to be protected, they must be registered as such at PACRA.

2. Industrial Design – the design of that jersey, the colors, patterns, stripes, shape, lines, ornament and all, will be protected under the design law. In Zambia, it will be under the Industrial Designs Act No 22 of 2016. I have been reliably informed that the jersey was designed by former FAZ President and our football icon Kalusha Bwalya. So, on face value he can claim the design rights but did he register it with PACRA? Or he handed it over to Nike? In short, the design must be registered in order to be protected.

3. Copyright- the jersey may also contains some write ups, graphics, pictorials or sculptural features. These will be protected by another law – copyright. But hear me here – copyright subsists in the original works of authorship when fixed on the jersey. So, there is no need to register with PACRA – rights are protected automatically! In Zambia copyright is governed by the Copyright and Performance Rights Act, Chapter 406 of the Laws of Zambia.

4. Patent – If that jersey contains some unique and special scientific discovery in its fabric or how it works on the body of the players, then it can also be protected by patent law. This is very rare but some have patented jerseys. In Zambia, patents must be registered at PACRA fir one to claim the invention. This is done under the Patents Act No 40 of 2016.

So, four different laws deal with one simple jersey as demonstrated above. That is way bigger brands will simply insert a clause stating that “all IP rights belong to Nike” meaning that whomever was involved with development of the jersey gives up the rights. This is usually in exchange for cash! Sometimes, the IP rights can be shared.

So, who owns the 2012 Afcon jersey?
The answer lies in the contract between Nike and FAZ! The Kalusha Bwalya executive that signed contract with Nike may shed more light as to whether they gave away the IP rights or not…(I wish I can see the contract and the IP rights clauses). I hope FAZ secretariat have copy in achieves.

By the way, this has nothing to do with wearing of the apparel by citizens at any event so long as it is not counterfeit. You are free to wear them anytime…

Anyway, Zambians are only interested in watching the game between their Legends and Barcelona FC. The team can even play shirtless we do not care…it is the players we are interested in!

Edgar Lungu’s Immunity does not extend to his wife and Children- UPND Deputy SG Gertrude Imenda

Gertrude Imenda, the Deputy Secretary General of the United Party for National Development (UPND),has asserted that the immunity enjoyed by former Zambian President Edgar Lungu does not extend to his wife and children. Imenda emphasized that they can be subject to investigation and legal proceedings if any wrongdoing is suspected.

Imenda’s comments came in response to remarks made by Brian Mundubile, a presidential aspirant from the Patriotic Front (PF), who claimed that Lungu was unjustly treated by the UPND government, alleging that he had not committed any actions to warrant such treatment.

Responding to Mundubile’s assertions, Imenda clarified that Lungu was not being harassed by the UPND government, as implied. She reiterated that the investigation into Lungu’s alleged misdeeds was carried out in accordance with the rule of law and due process.

Imenda further explained that presidential immunity, which shields former heads of state from prosecution for acts committed during their tenure, is limited to the individual holding the office. The immunity does not extend to the immediate family members, such as the spouse and children.

Yesterday, Ho Mundubile, a presidential aspirant from the opposition Patriotic Front (PF) party, expressed his disapproval of the treatment received by former Zambian President Edgar Lungu at the hands of the ruling United Party for National Development (UPND) government. Mundubile questioned the justification behind the treatment and accused the government of infringing on Lungu’s rights as a citizen.

Mundubile specifically referred to Justice Minister Mulambo Haimbe’s statement regarding Lungu’s continued enjoyment of benefits despite alleged misbehavior. He questioned the notion of misbehavior and urged the government to clarify the actions they were referring to. Mundubile emphasized that as a citizen of Zambia, Lungu is entitled to all the rights and freedoms accorded to him, and any attempt to control his behavior would be an infringement on his rights.

Furthermore, Mundubile drew a parallel to the respectful treatment of former presidents in neighboring Kenya, particularly mentioning President Uhuru Kenyatta’s respect for former President William Ruto. He called upon the UPND government to learn from this example and urged ministers and the head of state to show similar respect towards Lungu.

The opposition aspirant criticized the alleged harassment and humiliation that Lungu has endured, particularly by the police and the UPND government. Mundubile argued that there was no justification for such treatment, and the government’s contradictory statements and activities concerning the former president’s office raised suspicions. He called on the UPND to reflect on their actions, stating that their treatment of a former head of state was drawing negative attention globally.

Mundubile suggested that Lungu’s harassment stemmed from the UPND government’s fear that his interactions with citizens would expose their failures in fulfilling their promises. According to him, the government’s sensitivity arose from their realization that they had not delivered on their commitments to the Zambian people. Mundubile cited potential topics that Lungu might address, such as drug shortages, agricultural sector challenges, compromised judiciary appointments, and concerns within the Electoral Commission of Zambia (ECZ).

Meanwhile, Mundubile challenged Justice Minister Haimbe’s assertion that a former head of state’s treatment was based on their conduct while in power. He accused the UPND government of handling the matter in a childish manner, calling for a proper legal process if they had any case against Lungu, including laying charges, removing his immunity in Parliament, and prosecuting him in a dignified manner.

MR PRESIDENT – THERE’S A LIMIT TO RHETORIC

President Hakainde Hichilema, there comes a time when what needs to be said must be said before things fall apart.

You are the President of Republic of Zambia. You are the most powerful person in Zambia. You are the one who is not taking action; so don’t blame the bureaucracy and embarass us in London by telling them foreigners that delay in reforms is because of bureaucracy. You are what you do, not what you say you’ll do. Mr President you talk a good game, but the fact remains that you have been unable to deliver any meaningful reforms since your inauguration. You say you are methodical but in reality you are the opposite.

Mr President, our people are looking to you to make things better in their lives so that they can thrive and let the private sector create jobs and revenue for the government. Today less than 20 companies contribute 90 per cent of the tax revenue that the government generates. You say you listen but you don’t hear. There is real frustration in the air. There is a growing disappointment amongst the citizens and businessess.

Whilst the international community think you are a rising star and shower you with accolades as you continously showcase yourself as their blue eyed hero in Africa and bask in the glow, here at home there is an increasing feeling it’s all talk and no substance. Life for ordinary citizens is tough. Cost of living is high. There are no jobs. Hand -outs will only go so far and in the long run are non-productive. The NAPSA hand-out will be spent soon, then what? Creating government jobs is not sustainable either. Government needs increased revenues and investment. There are so many things that need fixing.

Mr President, you warn your Cabinet ministers not to undertake too many foreign trips, whilst you remain a prolific frequent traveller. We have fact checked: there is no other President in Africa or elsewhere who has made as many foreign trips in less than two years in office as you have. Your Minister of Finance had to go to parliament to get authority for increased expediture for State and Presidential Affairs. The appropriation Act of 2022 states under Cabinet Office that for “State and Presidential Affairs” an additional amount of K344,178,779 was needed to be approved, in addition to what was originally approved under the 2022 budget. That is about US $19 million. For the year 2023, Public Affairs and Summit meetings has been allocated K322 million (about US $17 million). You have to be kidding Mr President.

Mr President, to add insult to injury, you then take a delegation from State House and the ministers of commerce, mines, energy and several other government officials to attend the Invest Zambia Forum in London to hear you preach about the utopian Zambia that does not exist. Reading through your endless tweets in the past 10 days would make every Zambian scratch their heads for thinking whether you have understood the realities in Zambia, based on the illusory Zambia that you are trying to market to potential investors. Mr President it is you who needs a reality check. You tweet, “We showcased Zambia’s land linked position as ideal for production, processing and distribution hub, focussing on minerals, tech and innovation”. Why did you not tell them about the chaos at Kasumbalesa border post and other border posts; about the road blocks and the need to pay “ka something”? Why didn’t you tell them about the insane regulatory framework and the inconsistent policies?

Your advisor Greg Mills last year released a video where he bemoans the road blocks in Zambia, perhaps you should see it.

Zambians will not be fooled by words. One of your special assistants on social media is prolific in trying to make us citizens think there is an El Dorado in the making. This motor-mouth in your team once tweeted, “The Zambia story of it’s move from potential to prosperity is being written, and we are on the verge of an enormous breakthrough”.

In London you said, “Zambia is ready for business hence the country is creating strong institutions that support an enabling environment for investment”.

Unbelievable! This in Tonga is called “kulota, eechi nchiloto” – pure daydreaming. It bears no resemblance to actual reality. Please give us a break from all this rhetoric. Please! It’s all just an elaborate illusion, people are seeing through all this. Mr President if you and your team continue with this rhetoric you will lose all credibility.

Despite all the rhetoric and platitudes things are not going right in your government. There is dysfunction which citizens can see but you are unable. And if you are able to see it, then you have chosen to do nothing about it. For all the number of record breaking foreign trips and meetings that have been undertaken, what is there to show when the business enviornment is not changing at home?

Mr President you have carefully created a persona as man who means business and wants to create change in the economic well being of our country. This has become your motivating chant. Where are the deliverables of economic reforms and as you describe the removal of rigidities, even a few of them, so that people and business can see and feel the change? Only in February this year, the straight talking US Senator Lindsey Graham reminded your ministers that “I like what you are saying but you need to deliver”, and he was right to say so.

The employment Act is a disaster for business. Yet there is silence from the government. Mr President you through IDC approved the establishment of Zambia Airways, when you explicitly said that it was a bad idea. US $30 million public money was pumped into Zambia Airways, what is it doing today? Have you not noticed what a private sector airline, Proflight is doing and succeeding with far, far much less than US $30 million investment? How many of the IDC owned companies are profitable? Would you keep unprofitable companies that are draining money in your private investment portfolio? We doubt it. So why keep them at IDC?

You were at the forefront of getting the First Quantum Mines deal which the public is unaware of its details. Why? Is it not in public interest to be transparent? In Panama, the government published the draft agreement with FQM for public discourse. You say you want to learn from successful countries, then why not do just that? You once said you will send a delegation to Indonesia to learn how they have managed their natural resources. From what we already know the Indonesian government does not allow mining without value addition. In Zambia we do. Are you now going to send a delegation to South Korea after your London meeting with the South Korean Prime Minister Han Duck-Soo?

You have begun decentralisation, yet not a single council has published accounts as required by law. How will they be made accountable? Your ministers of mines and commerce say that the government has already procured land to set up a Electric Vehicle Battery Plant, when only a few weeks ago the same ministers were officiating at a function to “launch a pre-feasibility study” for such a plant! This is irrational, if not incompetent discourse to say the least.

Mr President, you talk of good corporate governance and you have been the chairman of IDC for over 18 months, but there is none at IDC and all its affiliates. None, including IDC have published their accounts as required by law. Will PACRA fine and sanction IDC? Yet, if it was a privately owned company, PACRA, SEC, LuSE would have moved in. Zambia is not an animal farm where some are more equal than others. There is political interference from your own staff at State House at IDC and ZCCM-IH and you stay quiet? You talk of investments coming in billions of US dollars in the energy sector, yet this sector is riddled with roadblocks by Zesco and rigidities in policy and regulations.

You talk of shortages of mealie meal, yet your government is at odds with what and how to support a free market in the agriculture sector. How are commercial farmers to plan and invest when there is no consistency or clarity? The Food Reserve Agency was created for strategic reserves and not become a market player, so we thought. The Minister of Health talks about private sector investment in the sector, yet it’s a punitive regulatory nightmare. This scenario is played out in every economic sector.

Mr President, despite your publicly stated frustration the tourism sector still needs multitude of licences to operate, as do many other sectors. You often talk and encourage Zambian businesses to export, but there are bureaucratic and regulatory obstacles in the way, and little investment in the infrastructure that is required. Mr President you continously talk of diversification and value adition for exports. Where is the enabling enviornment for this? Your own Minister of Commerce in February 2022 said and we quote, “Zambia has requested more time before committing to the African Continental Free Trade Agreement, as government needs to fully engage the private sector. The accord as it stands favours countries which already have well establshed value adding activities.” The Minister in this rare instance is right, however we are not aware what consultations he has had with the private sector or done about it to fix it.

Bally and his government has to first fix things in the local manufacturing enviornment, before one pontificates value addition, diversification and exports. Mr President, you chair the Public Private Dialogue Forum to deal with business related reforms. After 18 months, it has delivered ka nothing.

Like a scratched record on repeat, every other week your Minister of Mines announces that the KCM and Mopani deal will be concluded very soon, and then silence. Firstly, ZCCM-IH is the shareholder in KCM and Mopani. Why is ZCCM-IH not leading the negotiations? Why at the very initial stages of negotiations were Greg Mills, Valentine Chitalu amongst others involved in the negotiations? Now ministers and bureaucrats are leading the negotiations. It is also a known fact that one of your Special Assistants has been soliciting for Vedanta. ZCCM-IH reports to IDC of which you are the Chairman, is it not? Is ZCCM-IH not a listed company and therefore requires a transparent process and full disclosure? One cannot politicise a business decision of a publicly listed company. Why are the regulators, SEC and LuSE quiet? No wonder Dolika Banda, the chairperson of ZCCM-IH has now resigned, a person you selected. Mr President have you asked yourself why she has resigned? Good people are now starting to leave you.

This is the chaos and reality that any investor, be it local or foreign will find in Zambia today. So, Mr President what will you say to the foreign investors when they come here and face rigidities, regulatory and policy hurdles instead and not the glowing business enviornment that you help create in their minds?

There is no communications plan or strategy at State House or in government. Almost anyone is a spokesperson and say what they wish. Some have even begun behaving like thugs gatecrashing radio stations because they don’t like what they hear from the opposition. And more often than not, when they do communicate it makes little sense or has any positive impact. This is a receipe for disaster and that is what it is; a disaster. You said you were to have regular Press Conferences, instead you start and stop, and when you do have a press conference, it goes on for three hours. Yet you have on your staff a “State House Communications Specialist”. Your own office is dysfunctional.

“Bally Will Fix It” is becoming rhetorical. It just remains a slogan. What, instead, that needs to be fixed is the way affairs of the state are managed. Everyone by now knows that your Special Assistants are bickering amongst themselves and are amateurs, and one in particular is a smooth talking glory seeker. Some of them have either given themselves a new job description or that at the time of their appointment were not made known. Recently, we saw a letter signed off by Dr Lawrence Mwananyanda, who was appointed as the Special Assistant to the President for Project implementation and Monitoring is now also signing off as the National Security Advisor? When did this happen? What experience does he have in national security matters? When we googled his name his biography reads that he is a Clinician/Scientist with a wealth of experince in conducting medical and public health research. And surely if such an important appointment was made it should have been made known in public interest. Whilst we understand that it’s your prerogative to appoint whomsoever, at least appoint experienced people. Mr President, they are all making you look bad. Some ministers we have talked to say that they have no regard for any of your Special Assistants. What does that say? And how will the rest of government respond?

Leaders who don’t listen will eventually be surrounded by people who have nothing to say, and Mr President you are in even a worst position because you have surrounded yourself with people who don’t even know what to say or do, they lack experience, as do several other ministers. We implore upon you to introspect; to listen and fix things before things go pear shaped.

Barrack Obama said, “You can’t let your failures define you. You have to let your failures teach you”.

National Action for Quality Education in Zambia (NAQEZ) has called on government to devise the same cut-off point for male and female pupils in schools.

NAQEZ executive director Aaron Chansa says this will promote healthy academic competition among pupils.

‘’As we remain with only five months before Grade 7 candidates sit for their final examinations and as the nation will practically be doing away with 100% automatic progression to Grade 8, the National Action for Quality Education in Zambia (NAQEZ) is strongly proposing a system of equating the cut-off point for boys and girls,’’ he said in a statement.

‘’To promote healthy academic competition and equality between boys and girls, there is need for the Ministry of Education to put only one cut-off point. Lowering academic targets for girls at this level is perpetuating a false and old narrative that boys are more intelligent than girls; that girls can only be second best. The girls of Zambia have proved this notion wrong by consistently outperforming boys in examinations.’’

Chansa said having the same cut-off point will remove inferiority complex in girls.

He said research has so far proved that in recent years, girls have performed better than boys in final examinations, hence the need to have the same cut-off point.

‘’In the past few years, statistics have clearly indicated that girls in Zambia have been performing much better than boys at primary level in almost all subjects. Last year, more girls passed with Division One certificates than boys did. Despite these facts, ,girls are still given a lower cut- off point for passage to Grade 8. This practice cannot be justified,’’ said Chansa.

‘’Putting the same cut-point for both boys and girls will put away the dangerous inferiority complex that has been fed to the girls for many years, wrongly convincing them that they are academically inferior to the boys with whom they are at same Grade level, e.g. Grade 7, 9 or 12. Finally and very importantly so, we look forward to the way the Ministry of Education will handle the 2023 Grade 7 learners who will need to undergo vocational training in January 2024.”- The Mast

UAE and WHO deliver air lift of critical medical supplies to Sudan

The United Arab Emirates (UAE) and the World Health Organization have delivered 30 tons of urgent medical supplies to Sudan today. A plane carrying supplies for injury treatment, emergency surgeries, and essential drugs arrived in Port Sudan Airport early this morning.

The shipment, valued at US$ 444 000, is the first that WHO has been able to deliver by air to Sudan since the outbreak of the conflict. WHO distributed supplies to heath facilities prior to the escalation of conflict. These were exhausted after a few days given the number of injured.

The dispatch of the aircraft comes as part of the UAE’s continuous relief efforts in support of the Sudanese people and reflects its deep relations with Sudan, particularly in light of the current situation the country is facing. The relief is also an extension of the UAE’s humanitarian vision and underscores its relations with other countries based on human fraternity and its commitment to assisting others during crises and emergency situations.

Dr Reem bint Ebrahim Al Hashimy, Minister of State for International Cooperation, said that the UAE “continues to work closely alongside the World Health Organization to ensure the successful deployment of the critical logistics operations to send urgent medical and food aid to help address the current crisis in Sudan. In parallel with calls for all sides of the current conflict to immediately cease hostilities and de-escalate a situation that is causing untold suffering for the Sudanese people, the UAE is steadfast in its commitment to providing aid and assistance to countries in times of need. The UAE is particularly focused on providing for the most vulnerable groups affected by the situation in Sudan, especially the sick, children, the elderly, and women who are most at risk from the ongoing concerning conflict – and these relief flights will directly address the most pressing gaps in medical and food provision. The UAE’s deeply held humanitarian values have meant that it has ensured it has continued to communicate to the world its robust and unrelenting dedication to strengthening peace, security and stability, not just regionally, but also worldwide, whilst alongside its partners and the international community, the country continues to assist the Sudanese people in times of crisis.”

The health supplies include enough trauma, emergency surgical supplies, and essential medicines to immediately reach 165 000 people who are in desperate need of humanitarian aid. Health facilities across the country report they have run out of basic health supplies and that national medical stores are no longer accessible due to the security situation. Among other support, WHO is deploying two emergency logisticians travelling with the cargo to ensure that these supplies are immediately distributed to 13 major health facilities to support healthcare workers and extend care to those in need.

WHO has another 30 metric tons of supplies for malaria and noncommunicable diseases like diabetes and hypertension, conditions that can become deadly if left untreated. These and about 23 000 blood bags are being readied within the WHO global logistics hub in the International Humanitarian City, and WHO is currently exploring all possibilities for delivering these supplies to Sudan as quickly as possible in collaboration with the Sudanese Ministry of Health.

Dr Michael Ryan, Executive Director, of the WHO Health Emergencies Programme, said, “The WHO Global Logistics Hub in the UAE has become a centerpiece of rapid supply response to acute events globally. Supporting over 140 countries across all 6 WHO geographic regions, the hub provides a lifeline to Member States experiencing health emergencies arising from outbreaks of diseases, disasters such as floods and earthquakes, and the impact of conflict on health systems. The support provided by the UAE enables WHO to be at the forefront of these health emergency responses – delivering specialist medical aid to those in need wherever and whenever it is needed. As part of efforts to strengthen the global architecture for health emergency preparedness, response, and resilience the UAE, WHO, and partners are working hand-in-hand to deliver supplies to reach the world’s most vulnerable in their time of greatest need.”

For his part, Dr Ahmed Al-Mandhari, WHO Regional Director for the Eastern Mediterranean, said, “The World Health Organization continues to coordinate with the Sudanese health authorities to deliver essential health supplies through all available pathways. Due to the conflict, hospitals, pharmacies and primary health care facilities have stocked out of essential, life-saving medicines. The arrival of an additional 30 metric tons of trauma and emergency surgery supplies as well as essential medicines will enable WHO to support 13 major health facilities and re-establish health care services for those in need. A Youth activist, Wamuwi Mushokabanji led a horde of youths to protest at the United Church of Zambia (UCZ) “All Saints Congregation” in Mongu, against the use of Bemba language in sermons and songs at the congregation.

His Grace, UCZ Bishop Roy Kanchele is accused of using Bemba language in his sermons.

This vigilantism must immediately be stopped. There are far better mechanisms to resolve these historical and century-old distortions.

Besisdes churches use intepretation services, and most of the issue of the use of dominant languages is related to the areas of the Churches founding in Zambia.

It’s like stopping the SDA singing tonga songs in Chipata or Kasama or Choma stopping the Catholic Church from singing bemba songs.

The matter brewing in Mongu is sensitive, dangerous and has capacity to spread across the country and must be handled well and the deployment and threat of using youths and vigilantees to force changes must be curbed.

The Christian God was introduced to Africans and were made to accept through the language of English, Latin, French, Portuguese, and Spanish!

A Brief History of the Church in Zambia

Churches in Zambia have a history and heritage, hence the current dominant use of certain languages in their sermons and songs.

The Seventh Day Adventist missionaries W.H. Anderson and his wife traveled to Zambia and established the mission at Rusangu in Southern Province in 1905.

The Catholic Church was introduced in 1895 when the White Fathers Missionaries under Bishop Joseph Dupont established the first mission at Kayambi in the Northern Province.

There were earlier catholic incursions by Portuguese Dominicans in 1730 and later jesuit missions in Livingstone and Broken Hill (Kabwe) in 1927.

The Western region was first evangelised in 1931 when Italian Franciscan came to Ndola and the Irish Capuchins opened in Missions in Livingstone and Mongu.

Earlier, Henry Depelchin, a Belgian Jesuit, led a band of jesuits, while waiting for authority to enter Barotseland, in 1880, arrived in Chiefdom of Mweemba of the Tonga people of Southern Province.

Chief Mweemba gave them permission and granted them land at Siameja Village. When Lewanika finally gave the Jesuits permission to meet him, the King is said to have refused their permission to establish a mission in Mkn3gu and the the area, which resulted in the failure of the mission.

George Henwood Mkandawire, a Nyasaland native, moved from Capetown to Livingstone to found the first New Apostolic Church congregation in Northern Rhodesia in 1928 Henwood was the first Community Elder.

Presbyterians entered Zambia through the work of the Church of Scotland in 1899.

The first Anglican Missionaries arrived in 1861 but established the first missionaries in 1911 and 1912 at Msoro and Mapanza, respectively

Explorer and missionary, David Livingstone representing the London Missionary Society(LMS),was the first Protestant missionary Zambia and later making three trips to the country in1851,1853 and 1873 and died at Chitambo, in Serenje.

Frederick Stanley Arnot,a Plymouth Brethren Missionary, settled in Barotseland,Lealui, in 1882.

The first London Mission was also set up at Nyiamukolo, Kawimbe, and Fwambo(Modern Day Mpulungu and Mbala) in 1883.

The Paris Missionary Society led by François Coilla, accompanied by his wife and Sotho evangelists, and established his first mission at Sefula, Sesheke and Kazungula.

The Presybeterian Missionary Society (PMS) entered through Nyasaland establishing their first mission in Northern Rhodesia at Mwenzo near Tanzania in 1894 at Lubwe and Chitambo.

The four protestant church organizations namely the London Missionary Society, the Primitive Methodists Missionary Society(PMMS) (a break-away from the Wesleyan Methodist Church), the Paris Missionary Society(PMS), the London Missionary Society(LMS) and the Presbyterian Church formed the United Church of Zambia(UCZ).

The United Church of Central Africa and now part of the United Church of Zambia owes its work from the London Missionary Society and the Church of Scotland from Nyasaland.

Lubwa Mission in Chinsali was the first outpost of the Church of Scotland in 1905.

A mission school was opened in 1905, run by a Nyasaland couple, David Kaunda and Hellen Kaunda (parents of Zambia’s first Republican President).

The work to unite the two missions started in 1945. In 1958, the act of union was signed. In 1965, the church united with the Methodist Church and the Church of Barotseland to form the United Church of Zambia.

The church mainatins its roots with Methodist Church in the United Kingdom, the Church of Scotland, the United Church of Canada, and the Global Ministries of the United Church of Christ in the United States.
