FIVE Constitutional Court Judges have recused themselves from hearing the appeal case in which the Kabushi by-elections have been petitioned following the Constitutional Court Judgement that Bowman Lusambo and Joseph Malanji were eligible to contest the election but instead the Electoral Commission of Zambia barred them.

Those that have recused themselves are Judge Martin Musaluke, Judge Annie Sitali, Judge Palani Mulonda, Judge Mungeni Mulenga and Judge Judy Mulongoti.

The source has disclosed that with this action, only the newly appointed judges will hear and preside on the matter when it comes up.

According to the source, State House had issued instructions to the Constitutional Court judges to ensure that the appeal over the Kabushi and Kwacha parliamentary seats did not succeed.

When the appeal hearing came up on Tuesday morning, all parties including Journalists were ordered leave the court room and judges remained for a prolonged period where they were informed about the instructions from State House.

The Sources said the Bench was informed about the instructions not to overturn the High Court decision to declare both Bowman Lusambo and Joseph Malanji ineligible to participate in the by elections.

The source said it was clear that State House did not want to see Lusambo and Malanji on the ballot paper in Kabushi and Kwacha elections respectively.

The instructions caused the division with five Judges threatening to recuse themselves from handling the appeal case on professional grounds.

The sources disclosed that Judge Martin Musaluke, Judge Anne Sitali, Judge Palan Mulonda, Judge Mungeni Mulenga and Judge Judy Mulongoti are the five that threatened to abandon the appeal hearing.

The sources said the five Judges hold the view that the Kwacha and Kabushi elections were void.

They said it will be suicidal for them to go against their earlier ruling that nullification of a seat does not amount to disqualification of a candidate.

The High Court sitting in Ndola failed to preside over the matter conclusively and referred all questions that the aggrieved parties presented to them to the Constitutional Court.

The Constitution Court had earlier ruled that nullification does not constitute disqualification making it difficult for the High Court to pronounce itself on the matter.

JOINT STATEMENT BY TI-Z AND COF DEMANDING FOR AN OPEN, INCLUSIVE, AND TRANSPARENT CONSTITUTIONAL REVIEW PROCESS

Since we obtained our independence in 1964, Zambia has undergone several constitutional review processes that have been driven by the competing interests of ruling parties trying to attain more power against the interests of the people seeking constitutional emancipation. Since the return to multi-partyism through the 1991 constitution, attempts to make meaningful constitutional reform have resulted in piecemeal amendments to the Constitution with Parliament, led by ruling party majorities, determining the final content of such constitutional amendments. For example, approximately 70% of the recommendations made by the Zambian people in the 1996 Mwanakatwe Commission’s report were rejected by the Government in the Bill presented to Parliament. In the most recent attempt to amend the Constitution in 2019, the United Party for National Development joined hands with civil society in rejecting attempts by the previous government at gerrymandering and consolidating power for its own ends.

When the UPND formed government in August 2021, it committed itself to improving the livelihoods of the people of Zambia and ensuring respect for the rule of law, through the enhancement of the institutions of governance, and the review of the constitution in accordance with the will of the people.

In his speech during the opening of the first session of the 13th National Assembly in September 2021, President Hakainde Hichilema spoke on the need for constitutional reforms, a commitment he had later made in June 2022 in his address to the European Parliament and during the Summit for Democracy held in March 2023 in Zambia.

Given this background, Transparency International Zambia and Chapter One Foundation are deeply concerned about the inertia on the part of the Executive to facilitate the provision of a comprehensive and clear road map on the constitutional review process in consultation with relevant stakeholders. We are equally concerned about the lack of communication from the government around this issue. Democracy is meant to promote and protect good governance of the people, by the people, and for the people.

Substantial piecemeal amendments to the Constitution through the Enacting legislation without the necessary stakeholder engagement takes away the opportunity for Zambian citizens to have a meaningful people-driven constitution.

In the absence of a clear statutory framework that protects the process and the content of the final draft constitution from manipulation, the process of debate of the Bills in Parliament risks altering the nature and character of what the people of Zambia wish to see in the final constitution. If that happens, it is the Zambian people who will be the losers once again.

We therefore make an earnest appeal to the government in general, and the Ministry of Justice in particular, to provide this clear direction on how the Government intends to engage the people of Zambia on this issue without further delay. In the same vein, we wish to urge the UPND administration not to fall prey to the machinations we have been subjected to in earlier constitution review processes in which previous administrations have pursued narrow political interests over and above those of the wider public good. Constitutional review is an important and sacred process and one that must be devoid of any narrow political interests. The process should rather harness the collective consensus of the Zambian people. We challenge the UPND administration to show that they will do things differently by ensuring a legitimate and independent constitutional process that will respond to the wishes and aspirations of the people of Zambia, who deserve nothing less.

According to the report, Mwamba emphasized that Lungu deserved to rest and enjoy his retirement without being dragged back into the political arena.

However, Mr. Mwamba has refuted these claims, stating that he did not say what ZNBC allegedly reported. He has neither confirmed nor denied whether Lungu will be returning to active politics. It is important to note that attempts were made to reach out to Mwamba before this article was shared, but he did not respond until it had already gone viral.

Recently, Zambia has witnessed a remarkable display of principled leadership in its opposition ranks, as the opposition leader has taken a bold stand to uphold the principles of fairness and accountability within the nation’s Parliament.

Leader of the opposition Honourable Brian Mundubile, whose name resonates with those who value transparency and justice, has emerged as a vocal champion for the rights and dignity of the people they represent. He has consistently demonstrated the courage to challenge the status quo and has been unwavering in his commitment to holding the government accountable for its actions.

One of the most significant battlegrounds for this opposition leader has been the Parliament itself. In a parliamentary system, the effectiveness of an opposition leader depends not only on their ability to articulate concerns but also on their capacity to ensure that the legislative process remains fair and impartial. Magistrate Orders Arrest And Prosecution Of Three Police Officers For Causing Death Of Suspect In Nyimba

MAGISTRATE ORDERS ARREST AND PROSECUTION OF THREE POLICE OFFICERS FOR CAUSING DEATH OF SUSPECT IN NYIMBA

IN a rare development likely to be welcomed by human rights defenders, a magistrate has ordered the arrest and prosecution of three police officers at Nyimba Police Station in connection for torturing a suspect who later died.

Chipata senior resident magistrate Felix Kaoma, sitting as a coroner in Nyimba District, directed that the three officers be charged with manslaughter in connection with the death of 32-year-old Acklass Zulu.

The police officers in question, Charles Phiri, Simeon Mwanza and Clive Museka, all constables, allegedly tortured Mr Zulu on suspicion of stealing a cell phone.

Mr Zulu died on March 12 this year, three to four hours after he was allegedly beaten by the three officers while in police custody.

The man died on the way to hospital from the police station where he had earlier been seen crying in pain after being beaten.

After hearing an inquiry into the death of Mr Zulu, magistrate Kaoma, who is also the coroner for Chipata District, found that the victim did not die of natural causes.

“I find evidence connecting Constable Charles Phiri, Constable Simeon Mwanza and Constable Clive Museka all of Nyimba Police Station.

“I, accordingly direct that the same be arrested and charged with the offense of manslaughter contrary to section 199 of the Penal Code Chapter 87 of the laws of Zambia,” Mr Kaoma said in the verdict.

During hearing of what led to the death, the coroner heard that Mr Zulu died on March 12 between 20:00hours and 21:00hours on the way to the hospital from police cells.

“His body was positively identified by Joseph Ngulube his brother on 15th day of March, 2023, before post-mortem,” Mr Kaoma said.

The court heard that on the day Mr Zulu died, he had been in good health and never complained of any sickness to his wife or close associates.

“However, his wife was the first to be picked by a police officer she identified during the inquest to be one of the witnesses in jeopardy and was detained in police cells in connection with a stolen phone,” Mr Kaoma said.

Police used the woman’s phone to corner her husband, Mr Zulu, who was subsequently apprehended by the three officers.

“According to his [Mr Zulu] wife, when the deceased was brought to the police, he was taken to the office she identified to be the CID office in which the three officers took turns to beat him with short buttons while he was crying in her full view,” the verdict reads.

The woman was later released while her husband was taken in the cells.

“Two witnesses were called from those who were in cells who confirmed to have heard a person crying from the offices.

“The [crying] person was subsequently brought by the cell door and one of them was asked to lift him into the cell and he did so. The person was identified as the now deceased Mr Zulu,” Mr Kaoma said.

The court heard that Mr Zulu continued crying while in cells until his voice started diminishing before he eventually passed out.

Mr Zulu had asked for panadol and water but he failed to drink the medicine.

“This is how the deceased met his death as he was being taken to the hospital,” the verdict reads.

A postmortem revealed that the cause of Mr Zulu’s death was bleeding within the skull.

With evidence of assault, Mr Kaoma found that the three police constables appear to share in the blame for the death.

THE 60 days ultimatum given to all opposition political parties to hold conventions is aimed at deregistering the main opposition party the PF.

Party information chairperson Emmanuel Mwamba has disclosed the scheme was planned as way back as April, when the Chief Registrar of Societies Thandiwe Mhende warned that the PF would be deregistered.

Mwamba who is among the PF presidential hopefuls says what was worrying by the conduct is the use of institutions of governance to fight political battles.

“On 25th April, 2023, the Registrar of Societies wrote to the PF warning that the party will be deregistered for failure to comply with an earlier order issued on 21st March, 2023 to avail a full and complete list of the office bearers. Chief Registrar of Societies, Thandiwe Mhende, claimed that the PF had only submitted 3 office bearers instead of 10 as required by the law,” he said.

He said that particular statement was just a political mischief as the party had submitted a full list of names of office bearers as approved by the conference that took place in 2021 ahead of the elections.

And Mwamba has announced that the PF will this weekend hold its extra ordinally Central Committee meeting at which various issues will be discussed and among them the holding of the constitutional conference.

Meanwhile, Mwamba has also revealed that the appointment of Mwangala Zaloumis and Mcdonald Chipenzi as commissioner and chairperson for the Electoral Commission of Zambia (ECZ) has compromised the institution as both were UPND members.

He said Mwangala and Chipenzi were known UPND cadres whose impartiality is compromised.

“Further the appointment of Hon Maria Kawimbe to the ECZ advisory committee on election management is a matter of concern. We are also not pleased with the transparency and publicity awareness surrounding the continuous voter registration exercise that started in June, 2022,” he said.

Further, Mwamba revealed that the party has received numerous information that the UPND government is conducting a secret NRC issuance in the UPND stronghold.

While we wait for Mr Hakainde Hichilema to respond to our challenge for a public debate on national television regarding the UPND administration and State House’s involvement with gays and defenders, protectors and promoters of gay rights, we would like to ask the following questions:


(1) What role is the National HIV/AIDS/STI/TB Council (NAC) playing in promoting the LGBTQ agenda?
(2) Didn’t NAC launch an LGBTQ programme and workshops for peer educators held with some facilitators being gay persons?
(3) Didn’t the NAC in collaboration with selected government hospitals and clinics, dealing with those in charge of clinics and hired

counselors conduct workshops, which were aimed at sending crews to identify members of the LGBTQ community?
(4) Were they not using the term Key Population in place of LGBTQ in the programme?


(5) Is it not true that this administration has established a position of Technical Director in charge of Key and Vulnerable Populations and the position is funded by USAID/PEPFAR Fund?


(6) Is this the reason why for the first time in this country and under Mr Hichilema’s presidency, in May 2022, EU embassies hoisted gay pride flags in support and commitment to gay rights on Zambian soil?


(7) Could this also be reason why the French government sent a Mr Jean Mafart, an openly gay man whose male husband is a convicted drug trafficker, as French Ambassador accredited to Zambia?


( What is Mr Tony Blair, the former British Prime Minister and renowned gay rights Ambassador frequenting Zambia for?
For those of our people who may not know, Key Populations include populations that live in poverty and squalor without access to necessities such as safe housing, water, sanitation and nutrition.


As indicated above the term also include persons such as sex workers, gay men and other men who have sex with men, transgender people, people who inject drugs, and people in prisons and other enclosed settings.


In the meantime, we wait for Mr Hichilema and his newly installed mouthpiece, vuvuzela Mr Cornelius Mweetwa to answer the questions raised above.

LUSAKA- The Independent Churches of Zambia (ICOZ) President, Bishop David Masupa says the National Day of Prayer, fasting, repentance, and reconciliation is not a political day but a day when people should speak to their God with love peace, and unity.

Speaking today at Cathedral of the Holly Cross, during the Official Launch of this year’s National Day of Prayer, Fasting, and Repentance which will be commemorated under the theme: Building Zambia for Greater Development Through Prayer, Unity, and Hard Work, Dr. Masupa charged that the church remains focused to making Zambia a peace-loving and united country towards social and economic development.

ICOZ president has further called on all political party leaders to manage their members on this day in order to safeguard the country’s peace and unity.

“It is my humble appeal to all political parties to ensure peace is maintained on the forthcoming National Day of Prayer, Fasting, and reconciliation as we all know that peace is important for economic development,” said Masupa.

Speaking at the same event, national chairperson organizing committee Prophetess Esther Jani said this year’s theme is very important because it Highlights hard work, which is a necessary component for both personal and National development.

While quoting from Bible in Proverbs 14:23, which “All hard work brings a profit”. Ms.Jani said hard work does not know any religion, race, or any political affiliation.

She further encouraged Zambians to understand the hard times the country is going through.
and embrace the Spirit of love, prayer, and hard work to change their living standards.

“In this year’s National Day of Prayer, we are calling to the Nation to reflect on the following;
We need to humble ourselves before God and look to him for solutions and intervention in

ZAMBIAN GOVERNMENT URGES UNHCR AND OTHER INTERNATIONAL ORGANISATIONS TO EMPLOY MORE ZAMBIANS

Zambia has appealed to the United Nations High Commissioner for Refugees (UNHCR) and other international organisations to employ more Zambians to work for their organisations.

Minister of Home Affairs and Internal Security, Honourable Jack Jacob Mwiimbu, MP, made an appeal through UNHCR High Commissioner Mr. Filippo Grandi saying that Zambia has qualified citizens to work for international organisations but only few were recruited.

The Minister made an appeal when he met Mr. Grandi on the sidelines of the ongoing 74th Session of the Executive Committee of the High Commissioner’s Programme (EXCOM) in Geneva on 11th October, 2023.

Mr. Mwiimbu informed the High Commissioner that it was disheartening to learn that very few Zambians were given opportunities to serve in international organisations like UNHCR both locally and internationally despite the country being a member state of the organisations.

The Minister further expressed concern over the continued trimming of the operational budget for refugee management provided by UNHCR to the Government when the country was hosting a huge number of asylum seekers and refugees.

He said the continued trimming of the operational budget had greatly affected the operations of Ministry of Home Affairs and Internal Security in refugee management and appealed to the High Commissioner to consider increasing the budget.

Responding to the Minister’s concerns, Mr. Grandi assured Mr. Mwiimbu that he would look into his request considering that Zambia has been an all-weather friend of the UNHCR and that the country has been hosting refugees since the 1940s.

The High Commissioner also informed the Minister that UNHCR was looking at ways of ensuring the operational budget was increased by lobbying other international donors to consider allocating more funds for refugee management in Zambia.

Mr. Grandi said UNHCR would lobby other international organisations to increase resource allocation to Zambia especially that the country is implementing the Modernisation of Refugee Host Communities and Settlement Approach (MORHCSA) which would not only benefit refugees but host communities as well.

26 YEAR OLD CHADIZA MAN FINED K1, 500 FOR CLOBBERING 40 YEAR OLD MAN

The Chadiza Magistrate Court in Eastern Province has fined a 26-year-old man of Zingalume compound, K1,500 or in default be imprisoned for 13 years for assaulting a 40-year-old man.

The court heard that Benjamin Simoya 26, of Zingalume Chiefdom mercilessly beat up Nelson Banda 40 also of the same area, for whipping his brother together with other boys whom he found stealing sugar canes from his garden.

Brief facts of the matter are that on 24th September 2023, Banda at around 16:00 went to water his garden when he caught some boys cutting sugar canes.

Mr Banda then got a whip and caned some of them before they finally scampered in different directions.

The action infuriated Simoya who went to beat up Banda in retaliation for whipping his younger brother including the other boys.

The court further heard that Simoya descended on Banda heating him with fists until he sustained a deep cut on his head and swollen leg, bodily harm with bruises.

Simoya left Banda lying in a pool of blood which attracted some sympathizers to help the victim.

They took him to Chadiza Police Station and immediately they were issued with a medical report form to take to Chadiza district hospital.

A docket was opened and Banda was discharged yesterday (October 10, 2023).

In passing judgment, Magistrate Fred Musaka told Simoya that he had no right to beat up Banda no matter the circumstances, hence charging him with assault contrary to Section 248 of the Penal Code Chapter 87 of the laws of Zambia.

Judge Musaka advised Simoya that he could have taken the matter to other authorities such as headmen and Police as assault on children is not condoned and punishable by law.

In mitigation Simoya pleaded with the court to show him leniency.

Simoya was fined with K1, 500 or in default 13 months simple imprisonment of which K1, 350 would be given to the plentiful while K150 will be deposited to the Ministry of Finance.

TWO thousand young Zambians drawn from all the 10 Provinces of the country are expected to report to various Police training colleges in two weeks following their successful recruitment.

The names of the successful candidates were finally published in today’s edition of Zambia Daily Mail after close to a year of waiting.

The Zambia Police Service issued a clear directive for the successful candidates to report to their designated Training centers on Sunday, October 22, 2023.

A grace period of one week has been graciously extended, providing a deadline of Monday, October 30, 2023, for those that won’t be able to make in two two weeks time.

The distribution of recruits across training facilities is as follows: Lilayi Police College: 767 candidates, School of Public Order Maintenance, Kamfinsa: 683 candidates and at Godfrey Mukuma Training School (Paramilitary): 550.

The recruits have been given a set of important guidelines to adhere to upon reporting:

All recruits are required to strictly adhere to pandemic regulations as directed by the Ministry of Health. It is essential that they carry an adequate supply of toiletries, including bath soap, washing soap, and hand sanitizers for personal use.

Recruits are advised to carry sufficient pocket money for personal expenses.

A non-refundable fee of K1,000 is to be paid, with a breakdown as follows:
Medical Fees: K500
Examination Council of Zambia (ECZ): K100 for screening expenses.
Government Fingerprint Screening Fee: K150
Registration Fee: K250

Candidates must also bring along original and certified copies of their credentials, including certificates, statement of results, and National Registration Cards (NRC).

Recruits should carry a personal bucket for their use and sufficient beddings, plates, cups, spoons, and forks.

Furthermore, fatigue attire, including work suits and safety boots, should be part of their luggage.

Police also expect candidates to carry 10 hardcover books and an ample supply of pens and pencils.

And adequate sports attire is also a prerequisite.

No proof that president of Nigeria fabricated college record

The BBC’s Global Disinformation Team has found no proof that the diploma submitted by Nigeria’s President Bola Ahmed Tinubu to the country’s electoral commission was fake.

Claims that President Tinubu’s educational credentials were fraudulent became widely shared on social media after Chicago State University (CSU) made his academic records public last week.

We have examined some of the most popular statements that are widely spread.

The president’s academic papers are being made public because of a court case that started in August. Atiku Abubakar, one of the president’s opponents in the presidential election, filed the case.

Mr Abubakar wanted the winner to be disqualified because he said that the person faked their diploma in Business Administration from CSU in 1979, which was submitted to the electoral authority (INEC).

Mr Abubakar asked a US court in August to make CSU give him Mr. Tinubu’s school records as evidence for his case in Nigeria. This is done through a process called discovery, where both sides share information and documents before a trial.

Mr Tinubu’s lawyers didn’t want the discovery application to happen because they were worried about privacy. However, the US court decided that it should still go forward.

Mr Abubakar asked for certain papers.

You can get a copy of any diploma that was given out by CSU in 1979.

In 1979, Mr. Tinubu received a diploma from CSU.

Diploma copies that look like the one Mr. Tinubu got from CSU in 1979, with the same writing style, official stamp and signatures, and the same words on it, were given to other students too.

Jamar Orr, who worked at CSU, certified documents for CSU between 1 August 2022 and the next 12 months.
CSU provided seven diplomas for different areas of study as requested. The names of the students were removed. The university’s registrar says that the students did not pickup these diplomas.

CSU said they couldn’t find Mr. Tinubu’s diploma from 1979 because they don’t keep copies of diplomas once they have been given to students.

CSU added that, they made a new diploma for Mr. Tinubu on June 27, 1979. It also gave out diplomas to other students that looked similar to Mr Tinubu’s diplomas.

As a response to request four, CSU provided additional academic documents that were confirmed and released by Mr. Orr

Atiku Abubakar is disagreeing with Bola Tinubu’s win as president, because Atiku came in second place in the February 2023 elections.

Following the judge’s decision, Mr. Abubakar’s lawyer, Angela Liu, asked Caleb Westberg, who is currently the registrar at CSU, some questions during a legal session.

Mr Abubakar’s spokesperson, Phrank Shaibu, allowed the BBC to see and use the deposition transcript.

Some people on social media in Nigeria claim that the evidence from CSU shows that Mr. Tinubu’s diploma given to Inec was fake. Last week, one of Mr Abubakar’s lawyers, Kalu Kalu, said the same thing at a press conference.

We didn’t find any proof for this statement.

The CSU gave out a bunch of certificates from 1979 to 2003. We looked at all of them.

In our analysis, we talk about three diplomas belonging to Mr. They are different from each other.

The first version of the text, made in 1979, which he previously mentioned that he lost while living away from his home in the 1990s.
He submitted another diploma to Inec, which was supposed to be a replacement for his original diploma from CSU. This diploma resembles the ones that CSU issued in the 1990s.
Moreover, CSU has an extra diploma for Mr. Tinubu which they believe was issued in the early 2000s, but he never picked it up.

People on social media are saying that Mr. Tinubu’s document that he gave to Inec is similar to the diplomas from CSU in 1979.

During Mr Westberg’s statement, Mr Atiku’s lawyer paid attention to the diploma given by President Tinubu to the electoral commission and argued that it was different from any of the diplomas issued by CSU.

But, Mr Westberg agreed with Ms Liu that the diploma does not resemble the samples from 1979. However, he said that the certificate actually looks similar to three of the diplomas CSU gave to Mr Abubakar. Our study says the same thing.

The reason why the diploma looks different is because it was re-issued in the 1990s.

MrWestberg mentioned that the design of CSU’s diploma has been changed many times in the past. He said if a student wants a new diploma, it would look like the template at the time they request it, regardless of when they graduated.

So, if Mr Tinubu had requested a replacement for his diploma in the late 1990s, the new one would have looked like the diplomas from that time.

CSU gave out diplomas to students in 1998 and 1999. The diploma from 1998 looks exactly the same as the one Mr Tinubu gave to Inec.

CSU submitted three diplomas from the 1990s that were like Mr.

One of them, which was from 18 December 1998, is exactly the same (except for the names, degree class, and dates) as the diploma Mr. Tinubu gave to Inec.

Mr Westberg also said that CSU doesn’t keep track of when a graduate asks for a new diploma, so Mr. Tinubu’s request for a copy of the diploma wasn’t written down.

The copy he gave to the election commission was missing part of the university logo. Westberg said in his statement that it may have been “cut off” during photocopying.

We looked at the diploma. It looks like the bottom of it was not copied.
The BBC asked Mr. Tinubu’s team for a copy of his diploma. They sent the only copy of the diploma that they claimed existed. This is a black and white copy of the document that was given to Inec.

Another organization in Nigeria that checks facts claimed that Mr. Tinubu’s diploma was not from CSU because CSU’s diplomas do not say “with honors” under the degree title.

But the BBC discovered that although this was not shown in the other diplomas published by CSU, it does exist in Mr Tinubu’s diploma given in the early 2000s, which was confirmed by Mr Westberg during his statement.

The text means that the words “with honors” on the diploma match the information submitted by the president to INEC.
Mr Tinubu’s diploma, which was requested again in the 1990s, is still with CSU because he did not pick it up.

Mr Westberg said that the school could confirm that this specific diploma is real because the school still has it since nobody has come to get it.

Not all students finish university with honours. Tinubu completed his studies at CSU and received high marks, according to court documents reviewed by the BBC.

The BBC asked CSU about its diplomas and CSU directed us to a statement that said they are confident that Tinubu met all the requirements for attending and graduating from CSU.

There is a claim on social media that someone named Bola A Tinubu, who went to CSU, is actually a woman.

In the Southwest transcript, it shows that a person who is identified as female attended the school. This has made people say that the person named Mr. Tinubu took the identity of that woman. Atiku’s lawyer, Mr. Kalu, mentioned this during a press conference last week.

However, Westberg made it clear during his statement that there was no doubt that the person who went to CSU was a man named Bola A Tinubu. He said the university used additional things besides the name to make sure the student was who they said they were.

He said that the Social Security Number (SSN) in the transcript from Southwest College is the same as in other documents where the student’s gender is clearly noted as male.

But the documents that were made public made people wonder about Mr. Tinubu’s real birth date and which secondary school he went to.

According to one document, Mr Tinubu went to Government College Lagos in 1970. However, the school website says that it was started in 1974.

Other than the difference in gender, the birth dates mentioned in some of the released documents don’t match President Tinubu’s official birth date, which is 29 March 1952.

The document from CSU shows that he was born on 29 March 1954. The form he used to apply for college asks for his birthday, and he wrote down March 29, 1955.

During Westberg’s questioning, Mr. Atiku’s lawyer stated that Mr. Tinubu had provided his birth date as March 29, 1952 on the forms submitted to Inec.

During questioning, Mr. Westberg said that the differences might have happened because someone made a mistake.

We reached out to Mr. Tinubu’s team to ask about these differences, but instead of giving us a response, a spokesperson told us to contact his political party, the All Progressives Congress. We spoke to Festus Keyamo, who is both Mr. Tinubu’s spokesperson for his campaign and a minister in the government. He ignored our calls and messages.- BBC

Poland’s top army generals resigns prior to crucial elections

Poland’s top military leaders have stepped down right before an important election and while the war in Ukraine is happening nearby.

The top military leaders, General Rajmund Andrzejczak and General Tomasz Piotrowski, did not explain why they made their decision.

According to the news, people are concerned that the right-wing government is trying to use the military for political purposes before the upcoming general elections on Sunday.

The government says the claim is not true.

It also denies claims from Poland’s opposing party and the European Union that it is using the country’s courts for political gain and restricting media rights.

General Rajmund Andrzejczak has handed in his resignation. His spokesperson, Col Joanna Klejszmit, informed the AFP news agency that this happened on Monday.

“She said that he has the right to quit his job without explaining why, just like any other soldier. ”

Gen Piotrowski also quit his job.

Poland’s popular newspaper, The Daily Rzeczpospolita, said that two military leaders were arguing with Defence Minister Mariusz Blaszczak. They disagreed about how politics were influencing the military, and there was also a dispute over a Russian missile that flew over Poland last year.

In May, Mr Blaszczak mentioned that Gen Piotrowski did not tell him in December that the missile entered Poland from Belarus and flew a long way before crashing in a forest.

The missile was found in April by someone who is not part of the government, which made the minister feel very embarrassed.

Mr Blaszczak and the two generals have not said anything publicly about the Rzeczpospolita report.

On Sunday, people in Poland will be voting in a very important election, according to opposition leader Donald Tusk. He says it is their most important election since 1989 when communism ended.

The United Right coalition, which is led by the Law and Justice party under the leadership of Jaroslaw Kaczynski, is trying to stay in power for a third time.

However, the difference between the right and centre has become smaller after a very bitter election campaign.

Poland has been a strong supporter of Ukraine since Russia’s big invasion started in February 2022. They have taken in over a million Ukrainian refugees and given Kyiv weapons worth more than $3 billion.

However, the campaign against a Polish ban on Ukrainian grain imports has caused strain in the relationship.

Chamisa calls for political dialogue with Zanu-PF

Citizens Coalition for Change (CCC) leader Nelson Chamisa has called for a dialogue with Zanu-PF following “a constitutional crisis” which saw 15 opposition MPs and 17 councillors being recalled.

The MPs and councillors were recalled by one Sengezo Tshabangu claiming to be CCC’s interim secretary general citing they had ceased to be opposition members. Speaker of Parliament Jacob Mudenda acknowledged Tshabangu’s letter and notified the Zimbabwe Electoral Commission of vacancies.

Chamisa, at a press briefing on Wednesday, blamed Zanu-PF for choreographing the existing controversy adding there is a need for dialogue.

“Zimbabwean citizens across the whole country are demanding an immediate resolution of the legitimacy crisis, but how are we going to resolve the legitimacy crisis?

“To lead you need a mandate. A mandate comes from a vote. That mandate is disputed.

“Therefore there has to be a political settlement, a political dialogue immediately, to be able to deal with the issues of the disputed election and it is in this spirit mandated by the citizens and the national assembly, we have written to SADC, the SADC secretariat, the SADC chair and the heads of the state…and we have communicated the same to resolve the dispute and stalemate in Zimbabwe.

“We have copied Zanu-PF because you know it takes two to tango. We have also reached out to Zanu-PF in their various organs to say we have to resolve the issue of a disputed election because even if you go by the clearly disputed elections, it is almost a half-half or 50 50 meaning to say that the sentiment in the country in terms of the declared ZEC results which are flawed, the sentiment is divided,” said Chamisa.

CCC demanded for a fresh election after Zanu-PF leader, Emmerson Mnangagwa was declared the winner of the contested polls.

The opposition complained that the entire electoral process was flawed, further demanding the disbanding of the Zimbabwe Electoral Commission (ZEC).

Chamisa said these are some of the things that have to be discussed to avoid the repetition of flawed electoral processes in Zimbabwe.

“We are putting on notice all key stakeholders including Civil Society, SADC, the AU and the UN that we have a constitutional crisis and a disputed election in Zimbabwe.

“We are going to run a campaign diplomatically, politically in a peaceful manner in a constitutional manner because there are remedies within the constitution and we are going to exhaust them,” he said.

Meanwhile, Chamisa said his lawmakers and councillors will be disengaging from duty until Parliament reverses the recalls.

He added it was wrong for Mudenda to act on an impostor’s instructions while ignoring the letter he wrote to him stating only he had the power to make decisions affecting the legislators.

Russia fails to reapply to UN Human Rights Council

Russia did not win the election to stay on the UN’s human rights council.

The country was kicked out of the important organization for protecting people’s rights last April because they sent their troops to invade Ukraine.

They expected that getting a new three-year term would make clear the differences of opinions among UN member states on whether to continue supporting Ukraine or not.

But Bulgaria and Albania got the two seats that were meant for Eastern European countries instead.

The vote happened a few days after a Russian missile attack that caused the death of 52 individuals in a village called Hroza in northeastern Ukraine.

Russia got 83 votes from the UN’s general assembly members. Bulgaria got 160 votes, and Albania got 123 votes.

Before, the ambassador of Albania, Ferit Hoxha, had stated that it was crucial for member countries to demonstrate that they were not willing to accept someone who starts fires as a firefighter.

Russia said it would find suitable answers for human rights problems and wanted to prevent the organization from being controlled by a certain group of countries, likely referring to the West.

Diplomats said they want to regain some international trust after being accused of violating rights in Ukraine and their own country.

Russia believed that it would gain support from many countries, especially those that are still developing, in a confidential voting process. It suggested that these countries privately agreed with Russia but did not express it openly in order to avoid upsetting Western countries.

According to reports, Russia has been actively trying to persuade smaller countries by giving them grain and weapons in exchange for their votes.

The Russian ambassador to the United Nations, Vassily Nebenzia, said that the United States is trying to prevent Russia from rejoining the council.

In April 2022, the state was kicked out of the human rights council. 93 UN general assembly members voted in favor of the suspension, 24 voted against, and 58 chose not to vote.

The council will be made up of these countries starting in 2024 for three years: Albania, Brazil, Bulgaria, Burundi, China, the Ivory Coast, Cuba, Dominican Republic, France, Ghana, Indonesia, Japan, Kuwait, Malawi, and the Netherlands.

Politics in US affected by Israel-Hamas war

Israel’s conflict with Hamas after the militant group‘s unexpected and deadly attack is also causing a stir in US politics at home.

The crisis is causing new problems for President Biden’s administration. It is making people pay more attention to the current chaos in Congress and could make the 2024 US elections more uncertain.

The American people usually don’t pay much attention to events happening in other countries. However, when they see terrible pictures of innocent people dying in the Middle East, especially when Americans are involved, they will definitely be interested in and concerned about this story.

The argument and accusations start.

Joe Biden‘s critics are already blaming him for the violence in Israel.

They have blamed Iran for planning the attack and claim that US actions towards Iran, such as letting them sell more oil and access frozen assets, in exchange for freeing American prisoners, showed American “weakness”.

A high-ranking government official said on Saturday that the accusation was silly. They explained that only groups not from Iran have been able to use the $6 billion, and it can only be used for helping people in need.

Former president Donald Trump said in a speech in New Hampshire that he wants to bring back all US punishments on Iran and impose a travel ban on all predominantly Muslim countries affected by terrorism.

Mr Trump highlighted his achievement of negotiating the Abraham Accords between Israel and two Gulf states as an example of progress towards peace in the Middle East.

But some experts think that by not addressing the Palestinian issue, the agreements between Israel and Saudi Arabia and the efforts by the Biden administration to improve their relations could have made the Hamas attack more likely.
One of the people running against Mr. Trump for president, Governor Ron DeSantis from Florida, said that Democratic administrations have been too lenient on Iran.

“Florida Governor Ron DeSantis said that this was ultimately an attack carried out by the Iranians. ” Both Biden and Obama had a positive view of Iran in their US policy.

Most Republicans criticized Mr. Biden the most, but there were also some disagreements within the party about their views on intervening in foreign affairs, which used to be a common practice among Republican presidents.

Former vice-president Mike Pence took the opportunity to criticize some of his Republican rivals for having views that he believes are focused on protecting their own country and being separate from the rest of the world.

“We must definitely speak up and criticize the leaders in the Republican Party,” he stated in a message sent out by his campaign. “Donald Trump, Vivek Ramaswamy and Ron DeSantis are individuals who promote peaceful settlements, but I think their ideas go against our party’s long-standing belief that America should take charge as the leader of the free world. ”

A House divided

On Monday morning, Kevin McCarthy, who used to be the Speaker of the House, joined other Republicans in blaming Mr. Biden’s decisions for making the attack possible.

Mr McCarthy was affected by a revolt among conservative individuals with right-wing beliefs, and his removal has stopped the chamber from making any progress until Republicans can come together and agree on a new speaker – a process that might take a few more days at least.

Florida Congressman Matt Gaetz, who came up with and led the effort against the then-speaker, said that he doesn’t believe his actions made it harder for the US Congress to help Israel. He pointed out that America gives Israel $3 billion in military aid each year.

Israel is not requesting anything that we cannot do. It will take us a few days to choose a new speaker. People don’t think too much about Mr. McCarthy’s political career.
It was a chance for Mr. McCarthy’s supporters to criticize a colleague they strongly dislike again.

“I observe the world and the various dangers present,” said Michael McCaul, head of the House Foreign Affairs Committee, on Sunday. “What are we showing our opponents when we can’t lead, when we’re not working well, when we don’t even have a Speaker of the House. ”

The Biden administration has stated that they don’t think it’s necessary to have a aid package for Israel approved by Congress right now. However, two important people informed US senators today that they believe new help should be given alongside ongoing support for Ukraine, all in one package.

Some Republicans are against giving more money to Ukraine. We don’t know if this disagreement will make it more likely or less likely for the aid package to pass. The post on social media by Senator Josh Hawley, who is a member of the Republican party, appeared to indicate this.

He said that Israel is in great danger and could potentially cease to exist. “Money for Ukraine should be given to Israel right away instead. ”

Currently, people who believe in democracy are supporting widely.

If the Israel crisis has shown divisions among Republicans, the same cannot be said for divisions among Democrats – at least for now.

The Democratic Party used to strongly support Israel, but that has changed as the party has moved left. They now criticize the right-wing government of Israel and its aggressive building of settlements in the occupied territories.

In January 2023, a survey by Gallup found that more Democrats felt supportive towards Palestinians (49%) than Israelis (38%) for the first time in the 22-year history of the poll.

However, the violent and on-going attack by Hamas on innocent Israeli people has made it difficult to notice these differences within the group.

Some very liberal groups have shown support for the Palestinians, but most Democrats have been vocal in their support for Israel and quick to criticize any disagreement from their own party.

Congresswomen Rashida Tlaib from Michigan and Cori Bush from Missouri, who are known for openly criticizing Israel, expressed their condolences for both Israeli and Palestinian civilians who have been killed. They also urged for the United States to stop providing financial support to Israel. Some people in the same political party criticized their comments.

Congressman Josh Gottheimer of New Jersey expressed his strong disapproval of the Israeli people having to mourn their family members who were shot in their homes. He criticized the idea of Congress removing financial support from Israel, a country that is considered a democratic ally of the United States. The congressman thinks this would only lead to harm and suffering for innocent civilians.
Ms Bush and Ms Tlaib are currently not supported by most people in their political group. Bernie Sanders, a leader of the progressive left, strongly condemned the terrible attack and expressed his disapproval in a statement on Saturday.

“There is no reason for this violence, and many innocent people from both sides will suffer greatly as a result,” he wrote on social media.

As more news focuses on the Israeli ground campaign in Gaza instead of Israeli civilian deaths, Democrats may start to feel the same way they did earlier this year.

The situation in the Middle East has changed a lot in just a few days. The current crisis in the US is likely to have unpredictable effects on domestic politics due to the existing conflicts and divisions among different groups.

THE UPND are fearful of political comeback of former president Edgar Lungu because that will undermine President Hakainde Hichilema’s bid to win the 2026 general elections, Human Rights Activist Sishuwa Sishuwa has charged.

And President Hichilema has committed economic genocide against the poor people whose lives depended more on street vending by removing them out of the street without giving them a place to trade from.

Featuring on Hot Red Breakfast Show on Hot fm this morning, Dr. Sishuwa a Historian lecturer in South Africa said President Hichilema was having sleepless nights because he was scared of former president Lungu.

“That is why you see these court action now because they are afraid of that possibility of Lungu coming back into politics. UPND devised this strategy at a three-plan level, the first level was the appointment of judges at the Constitutional Court to beef up the numbers in support of the UPND and in April this year we saw President Hichilema fulfilling this plan by appointing four more judges in the constitutional Court. The second stage was to prepare the mind of Zambians that the previous ruling in the eligibility of President Lungu was not final and that it is possible to have a new challenge which will overrule the old ruling and possibly remove Lungu completely from participating in any election in the country,” he said.

He further explained that the UPND will not allow former president Lungu contest the 2026 election no matter what happens.

“And by September this year we saw the Minister of Justice Mulambe Haimbe, fulfilling that statement by telling a local tabloid that sooner than later Zambians will ask for a decisive answer to that question of eligibility. The latest court action you have seen only confirms what Haimbe said that they will find someone to put across that petition and that one is acting on behalf of the UPND. Currently, there are 11 judges on the Constitutional Court, and if UPND is to secure a favorable decision they need six judges to deliver a ruling that Haimbe calls the correct one. If you remember in 2021, nine judges sat and delivered a judgment in that matter, and of those nine who were appointed by the former President, 8 ruled that Lungu was eligible and justice Munalula is the only one who dissented. And out of the 8 who ruled in favour of Lungu, one has died and one was retired and about six are in favour of that judgement and this year HH appointed four new judges, I think there is Kenneth Mulife, Mudson Mwandenga, Anord Chilimi and Maria Kawimbe and by going their logic using arrogant of numbers these four are expected to rule in favour of the UPND.

And if they are joined by Justice Magrete Munalula, they will bring the number to five and even if it is to base the judgement on the 2021 ruling, they will still have to sit, will the six go against the judgement they made in 2021? And if they did that, what will be the interpretation of their conduct by the people of Zambia and many others? Their decision will only confirm how much interference is at the Constitutional Court. Any judgment in favour of the UPND in this matter will completely destroy and damage whichever is remaining in the constitutional court., how could the same judges rule against their own ruling two year past? Even if the UPND lost at court they will still come up with an amendment bill which will stop Lungu at all cost from contesting the election in 2026, this is a known fact seeing how fearful our colleagues are in the UPND. They are preoccupied with this phobia of Lungu and even if they allowed his to stand, I can’t see Lungu winning, but the UPND are so scared of Lungu and they will not rest until they see him bared by the law from standing and the other person, they are afraid of is Fred M’membe of the Socialist Party,” he said.

And Dr. Sishuwa said the biggest Challenge President Hichilema has to deal with is committing economic genocide against Zambians who were trading on the streets across the country.
He said ever since vendors were removed from the streets; poverty has grown to unprecedented levels.

Dr. Sishuwa said the major weakness that might lead to President Hichilema losing power in 2026 is failure to change and listen to the cries of the people of Zambia.

“The major weakness that may lead to HH losing power in 2026 if he doesn’t change. Those black people around him who work with him say the President cannot listen to anyone local advising him. He listens to people far away from North America and Americans. President Hichilema needs to fight corruption in his administration and this interference of State House should come to an end. The high cost of living is also something that will; make Hichilema lose power in 2026. President Hichilema leadership prioritizes foreigners at the expense of poor Zambians, and Zambians can see that on their own. The removal of street vendors has affected many people in so many ways, people can’t meet their daily basic needs. People have been parked in compounds, they can’t sell, wheel borrow pushers can’t work anymore because they have parked their wheelbarrows. This President has committed economic genocide by removing street vendors from the streets, he is killing poor people who now have nothing to do. Landlords are evicting people every day because they can’t pay rentals,” said Dr. Sishuwa.

KEEP AWAY YOUR ANARCHISTS AND IMMATURE POLITICS FROM CHAMA NORTH CONSTITUENCY;

First and foremost I want to respond to what happened on monday this week in chama north constituency where Mr Miles Sampa sent his discredited henchmen to decampagn me in the constituency.

Therefore I wish to sound a strong warning to the matero law maker who is also PF presidential hopeful Miles Sampa to desist from exporting his confusions from Lusaka to chama north by sponsoring his henchmen to bring confusion in the district.

It is unacceptable and highly misguided for a person who aspires to be the President of the party and possibly being elected as republican president to exhibit such kind of unorthodox behavior by sponsoring his supporters to embark on the campaign to destabilize the party in chama north constituency for selfish reasons.

It must be known very clearly that chama north is not an area to export such unbecoming behavior because the people are more preoccuppied with fostering development as evidenced from a number of developmental projects taking place in the constituency not petty and cheap politics and as such his henchmen who were sent to the area to decampagn me were almost clobbered by angry residents and had it not because of quick action by the chama police and the Council Chairperson Mr Gift Kumwenda his henchmen were going to be harmed and therefore I want to thank them for being proactive otherwise the situation should have become ugly.

It is in light of the foregoing that Sampa should be told in no uncertain terms that he should focus on matero constituency where people need his representation and possibly on his failed presidential bid because as far as the people of chama north are concerned he is just a comedian and not a presidential material and as such any further incursion in chama north constituency by undesirable individuals hell bent at sowing seeds of divisions shall not be tolerated as such elements shall be flushed out no sooner than they go into the constituency.

Further,Sampa must respect my political opinion and that of others who do not support his political activities which are iminical to the interest of the party in line with dictates of democratic norms.

Furthermore I want to salute the youths in chama for always being vigilante and ensuring that all undesirable elements are flushed out from the constituency and I hope this serve as a lesson to those individuals who are popularly known for breeding confusion and using unpalatable language against the party leadership as chama north is a no go area for such barbaric behavior.

In conclusion I want to also take this opportunity to provide wise counsel to all those peddling a notion of calling members who came from other political parties as hijackers as such has the potential to undermine party unity therefore they should stop it.

The Establishment of an Advisory Committee on Election Management has shocked Citizens First Leader Harry Kalaba.

The committe is headed by Judge Maria Mapani Kawimbe, believed to be the Niece to Republican President Hakainde Hichilema.

Mr Kalaba has since written to the Electoral Commission of Zambia (ECZ) to respond to the mentioned concerns, in a letter also copied to President Hakainde Hichilema, Chief Justice, all opposition political parties, SADC and all diplomats accredited to Zambia.

He wants to know the law used to establish the body in question, its role, and how the members were nominated and the reason key stakeholders such as Political Parties were left out of the decision.

Addressing the Media today, Mr Kalaba said the actions taken to set up Election Management advisory body is a breach of the Republican constitution.

He said the Citizens First will not sit idle and watch machinations aimed at laying a ground work for disputed 2026 elections because of the fast diminishing popularity of the UPND.

Mr Kalaba has demanded that the action be rescinded because it will spark nationwide protest to compel the commission to follow the law by which it is established.

“Illegalities such as the estaishment of the advisory body does not add to the credibility of an institution that is viewed as being compromised and polarised,” he said

Meanwhile, Mr Kalaba said failure to hire a Chief Electoral Officer at ECZ may affect the level of preparedness for the 2026 General Elections.

“We trust you appreciate the significant role of Chief Electoral Officer and your failure to replace the key position a year down the line is cause for concern. This gap is also affecting the commission’s ability to have quarterly meetings with stakeholders on the management of elections as well as implementing some of the changes to the election process including the such things as the utilisation of biometric voting in future elections so as to enhance the integrity of our electoral process,” Mr Kalaba stated.

THE DRAGGING of former president Edgar Lungu to the Constitutional Court by a youth activist known as Michelo Chizombe seeking a declaration that the former wasn’t eligible to contest the August, 2021 presidential vote, and that he isn’t eligible to contest future elections can’t pass without a comment. We need to salute this youth activist for his brave gesture as it is purely aimed at correcting a past wrong which may possibly create law if not correctly adjudicated upon.

This youth has impressed us as a party here in Chilanga district because he has raised a very pertinent and crucial issue that deserves the attention of the legal system, and the entire nation. His argument that the former president’s inclusion on the 2021 presidential ballot was unconstitutional, and that he isn’t eligible to contest future presidential elections under the current constitution as read with the now-repealed 1991 constitution among other reliefs isn’t a matter some closed minds should look at as political witch-hunt, but a noble cause that can prevent wars in future. Our constitution clearly states that if one has held office twice, or have held office twice, that person isn’t eligible for third attempt.

At a time when progressive legal minds like John Sangwa SC openly opined that ECL wasn’t eligible for the 2021 presidential ballot, rifraffs in PF called him names. If you recall very well, even ECL had to intimidate the judges. He had to go to North Western province to warn Concourt judges here in Lusaka against entertaining the issue of eligibility which was blowing hot at the time. He warned that he was going to deal with whoever was going to stop him from contesting the 2021 presidential vote.

You see, rule of law demnds that nobody is above the law, but under ECL, anything was possible. These guys had completely replaced the rule of law framework with the rule of the jungle. This was very, very, very bad for the country’s administration. No wonder our mothers at Soweto market would pay levies to PF carders as opposed to paying to council. PF carders would strangle anyone resisting their many illegal schemes with impunty. On the political front, PF carders would follow opponents at graveyards and cause mayhem without being answerable for their atrocities. PF carders in police uniform would shoot or teargas people opposed to the then ruling party without being questioned. They did all this because they were inspired and powered by ECL. If you look at their party regalia of all the PF carders who used to beat or kill people, it has an inscription which reads ‘Powered by ECL’. They did all this because they knew that ECL, who did not handover power to the speaker when there was an active presidential petition in our courts in 2016, was going to protect them because he was above the law.

As Chilanga, we feel this move by this young man is very welcome. It’s good that as a country, we now have an opportunity to revisit the wrongs that were perpetuated by ECL and his cronies in the judiciary. I say so because there will be two lessons here; i) no future president would ever want to switch to jungle law after swearing to protect the constitution, and ii), these past wrongs won’t become laws once corrected. If we are not going to correct ECL’s past wrongs, other presidents will copy these wrong things, and when you say a thing about a certain issue, they will be referring to ECL and saying ‘munzathu munamulekelela.’

In conclusion, allow me to once more express my gratitude to this Chizombe guy. This move will prevent wars in future. We can’t ignore such serious breaches of our statute. A nation that closes its eyes to the evil of the past can never meet its future with fairness.

What Sunday Chanda, the Kanchibiya Member of Parliament, has done in the National Assembly will definitely be engraved in the history of Zambia and the law maker will no doubt be viewed as the real law maker.

For starters, over the years and since most Zambians who follow Parliament could remember, the movers of bills or amendments to laws have always been the preserve of Government Ministers.

Opposition members of Parliament or their ruling party counterparts have always restricted themselves to moving motions urging Government to do something about a particular challenge in the country or the law or indeed shouting either in the affirmative or in the negative.

The closest memory drive one can get to was in 2002 when an attempt was made by Lusaka lawyer, Sakwiba Sikota who was UPND Livingstone Member of Parliament to move a motion on the Freedom of Information bill.

The end game was that the MMD administration took over the proposed media bills and since 2002, the media organisations have been fighting without success for the Freedom of Information law which now has been renamed as Access to Information draft bill.

This was some 20 years ago.
But now Mr Chanda has probably done the unthinkable in the minds of most Members of Parliament.

Using Article 64 of the Constitution which states as follows; A Member of Parliament or Minister may introduce a Bill in the National Assembly”, Mr Chanda has submitted before Parliament the Fisheries Amendment Bill of 2023.

The Kanchibiya law maker has not even used the Attorney General who is used by the President’s administration but the bill is under his signature.

The object of this bill is to amend the Fisheries Act of 2011 so as to provide for the appeal process for those found in breach of the law pertaining to fishing.
At the moment, the Fisheries Act of 2011 in Section 19 sub-section 2 does not provide for an appeal.

It states as follows; A person who contravenes (fishing) subsection (1) commits an offence and is liable, upon conviction, to a fine not exceeding five hundred thousand penalty units or to imprisonment for a period not exceeding five years, or to both.

This is what Sunday Chanda wants to change if he is supported by other ordinary Members of Parliament including the ministers.

He wants those suspected to have breached the Fisheries Act to be provided the following reliefs;

That; The principal Act is amended in section 19 by— (a) the insertion of the following new subsections immediately after subsection (1):

(2) A person aggrieved by a decision of the Director under subsection (1) may, within fourteen days of receipt of the decision, appeal to the Minister.

(3) A person who is aggrieved by a decision of the Minister under subsection (2) may, within thirty days of receipt of the decision, appeal to the High Court;

For now it is a wait and see affair whether Mr Chanda will be given chance to read the bill for the first time on the floor of Parliament.

Indeed, Law making is an interesting journey, if one is really a law maker.

Chamisa seeks High Court intervention  in an attempt to reverse 15 controversial Parliamentary recalls

THE Citizens Coalition for Change (CCC) has approached the High Court in Bulawayo in an attempt to reverse 15 controversial Parliamentary recalls by Sengezo Tshabangu.

Tshabangu recalled the CCC legislators alongside 17 councillors citing the members had ceased to be their members.

The Matebeleland North politician claims to be CCC’s Secretary General, a position contested by party President Nelson Chamisa.

Mudenda, after receiving Tshabangu’s communication proceeded to notify the Zimbabwe Electoral Commission (ZEC) of vacancies in the 15 mainly Matebeleland constituencies.

Tshabangu has been labelled an impostor, funded by Zanu-PF to destabilise CCC and ensure a two-thirds Parliamentary majority for the ruling party.

A Declaratory and Consequential Relief filed on Monday by the opposition identifies Tshabangu as First Respondent, and Speaker of Parliament Jacob Mudenda as the Second.

“Plaintiffs’ (CCC) claim against the Defendants is for a declaratory and consequential relief as follows; an order declaring that the Plaintiffs’ have a right to remain in, and be recognised as Members of Parliament by virtue of having been so elected in the general elections held on the 23rd and 24th of August 2023 and having been so sworn on the 7th of September 2023.

“An order declaring that 1 Defendant has no authority to communicate, engage, or correspond with the 2nd Defendant purporting to represent the Citizens Coalition for Change (CCC) in respect of the Plaintiffs’ positions as Members of Parliament,” reads High Court papers filed by CCC.

“An order declaring that the 2nd Defendant has no obligation to act on the basis of any communication or correspondence addressed to him by the 1st Defendant purporting to communicate any information pertaining to Plaintiffs’ membership of the Citizens Coalition for Change (CCC) or in respect of the Plaintiffs’ position or status as Members of Parliament

“Consequently, the letter written by the 1st Defendant dated 3rd October 2023 and any other communication or documents incidental thereto addressed to the 2nd Defendant communicating that the Plaintiffs have ceased to be members of Citizens Coalition for Change (CCC) be declared null and void and of no force and effect.”

If the recalls are upheld Zimbabweans will, barely two months after a general election, be expected to re-choose Parliamentarians in the 15 constituencies.

Having denied Zanu-PF a two-thirds majority, the elections could give President Emmerson Mnangagwa an opportunity to finally claim it and give him enough power to amend the constitution in his favour as feared by CCC and analysts.

Ramaphosa still engaging Mnangagwa on Zimbabwe’s sham polls

SOUTH African President Cyril Ramaphosa continues to engage President Emmerson Mnangagwa over the political lockjam in Harare arising from a shambolic election, with the latest engagement having been a meeting with the embattled Zimbabwean leader on the border of the two countries on Thursday.

Ramaphosa has so far met Mnangagwa three times inside a month — in Harare, New York and in Beitbridge — as he pushes his behind-the-scene engagement on Zimbabwe.

He took the opportunity to again engage Mnangagwa in Musina on the sidelines of an event held to launch the Border Management Authority (BMA), an integrated border enforcement agency between Zimbabwe and South Africa meant to curb illegal goods smuggling, illicit drugs and cover up porous border concerns.

It was the third time that Ramaphosa was using public diplomacy skills to engage Mnangagwa over the political crisis in Zimbabwe, in the aftermath of the discredited 23 August elections largely condemned by Sadc observer mission and other international blocs.

Ramaphosa first engaged Mnangagwa at his low-key inauguration ceremony in Harare last month and also at the United Nations General Assembly (UNGA) in New York soon afterwards.

At UNGA, Ramaphosa acknowledged to the media that Sadc election observer mission led former Zambian vice-president Nevers Mumba had documented challenges in the Zimbabwean elections and promised that the regional bloc’s leaders would discuss the issue.

Mnangagwa, in turn, used the opportunity to attend UNGA to engage regional leaders and try to douse the surmounting pressure on him after the shameful elections whose results were rejected by his main rival Nelson Chamisa of the Citizens’ Coalition for Change party.

CCC is demanding fresh elections.

The Sadc secretariat and the bloc’s council of ministers have already blasted the Zimbabwean government over its stance to rubbish the elections observer mission report which said the polls were shambolic.

Some Sadc leaders are pushing for an extraordinary summit on Zimbabwe as they resolutely dig in on Harare’s disputed elections although others are willing to let the matter go to rest.

Although diplomats have raised concern that not much is being done from key stakeholders in Harare to empower regional leaders to put more pressure on President Emmerson Mnangagwa, calls for special summit are growing.

There is consensus in Sadc that the 23 August general elections violated Zimbabwe’s constitution, Electoral Act and Sadc Principles and Guidelines Governing Democratic Elections as highlighted by the regional body’s election observer mission (EOM).

Diplomatic sources said minutes of the Extraordinary Meeting of the Sadc Organ Troika Ministerial Committee held on 26 September 2023 captured the thinking of Sadc leaders. The ministers, diplomats said, cannot reflect their own opinions but express the views of their leaders.

The minutes showed that the ministerial committee defended the report produced by the Sadc EOM which was headed by former Zambia vice-president Nevers Mumba.

The ministers slammed senior Zanu-PF and government officials for vilifying Mumba and Zambian President Hakainde Hichilema after the observer mission, for the first time, gave an adverse report on the polls.

They said attacks from Harare had the potential of undermining Sadc processes and credibility while insisting that the report reflected the opinion of the regional observers and not Zambia as wrongly portrayed by Zanu-PF propagandists.

Diplomats told The NewsHawks that the ministers reflected the Sadc opinion which was expressed in a way that heads of state would not do.

Hichilema chaired an online Sadc organ on politics, defence and security cooperation troika meeting which discussed the political and security situation in the Democratic Republic of Congo, Zimbabwe’s recent disputed elections and the upcoming polls in Eswatini.

Tanzania was represented by Vice-President Phillip Mpango and Namibia by Deputy President Nangolo Mbumba. DRC Defence minister Jean-Pieþ secretary Elias Magosi and secretariat staff, including Elvado Santos and Barbara Lopi, who is head of communication and public relations, also participated in the meeting.

A communiquè released after the meeting revealed that the Sadc EOM had presented its final report to Hichilema who was preparing to hand it over to Mnangagwa and the Zimbabwe Electoral Commission.

Minutes of the ministerial meeting however gave a reflection of Sadc leaders’ thoughts.

“The EO-MCO Troika noted that the SADC Electoral Observation Mission (SEOM) was deployed to the Republic of Zimbabwe to observe the Harmonised Elections which took place on 23rd-24th August 2023. In accordance with the SADC Principles and Guidelines Governing Democratic Elections, the Chairperson of the Organ, His Excellency Hakainde Hichilema, President of the Republic of Zambia, appointed Dr. Mumba, to lead the SEOM to Zimbabwe.

“The EO-MCO Troika also noted that the SEOM is mandated to observe elections in terms of the SADC Principles and Guidelines Governing Democratic Elections which all SADC Member States signed and adopted, and have been operational since 2004 . . . . The EO-MCO Troika further noted that all SADC Member States send individuals to serve as observers under the SEOM each time another SADC Member State conducts elections.

“For the purposes of the August 2023 Harmonised Elections, observers were seconded from the Republic of Angola, the Republic of Botswana, the Kingdom of Eswatini, the Republic of Malawi, the Republic of Mozambique, the Republic of Namibia, the Republic of South Africa, the United Republic of Tanzania, and the Republic of Zambia.”

The EO-MCO Troika noted that the Sadc EOM issued its preliminary statement on 25 August 2023, as stipulated by section 11.8.1 of the Principles and Guidelines.

The meeting said the SEOM was meant to produce its final report within 30 days, adding this had been done.

In terms of section 11.8.2, when SEOMs officially submit their election reports, member states which held elections may consider the recommendations advanced by the SEOM for improving the conduct of elections; submit to the chair of the Organ, a response to the SEOM report.

The ministers then blasted Zimbabwe over its conduct.

“The EO-MCO Troika also noted with concern, the personal attacks and threats on the media that have been directed at the SEOM Head of Mission Dr Nevers Mumba and the Chairperson of the Organ, His Excellency Mr Hakainde Hichelima since the Zimbabwe SEOM released its Preliminary Statement on 25th August 2023.

“The attacks were made by individuals in both the ruling Zanu-PF political party and some in high level positions in the Government of Zimbabwe,” the minutes read.

“The narrative in these attacks have been that the SEOM Preliminary Statement on the Zimbabwean elections was personally authored by Dr Nevers Mumba.

“The EO-MCO Troika further: (i) noted that such attacks undermine the SADC Principles and Guidelines Governing Democratic Elections and might have a negative bearing on the SEOMs that are to be deployed in the future elections, especially with another election coming on the 29 September in the Kingdom of Eswatini; and (ii) reiterated that SEOMs are in line with the SADC Principles and Guidelines Governing Democratic Elections, and that reports are produced by a collective of the Member States observers, led by the Organ Troika and supported by the Secretariat.

“The EO-MCO Troika noted that there is a risk that if unchecked, further attacks on the leadership of the Organ and of the SEOM have the potential to damage the credibility of SADC as an institution.”

Ministers commended the secretariat for taking the initiative to issue media statements that clarified the procedures that are followed by the SEOM, as they rebuffed Zimbabwe’s position, while protecting the credibility and leadership of the Organ and the SEOM.

Some Sadc leaders have been pushing for an extraordinary summit to deal with the Zimbabwe crisis. Only three leaders attended Mnangagwa’s inauguration, in what was seen as a snub to Mnangagwa following the controversial polls.

Mnangagwa however used the United Nations General Assembly in New York to lobby Sadc leaders as the pressure mounted.

Although there is consensus that the Zimbabwean polls were shambolic and not free and fair, Sadc leaders are divided on what action to take.

“Sadc’s position has been further complicated by lack of a push by key stakeholders in Zimbabwe, including political parties. With each passing day, Mnangagwa’s hand is evidently getting strengthened,” said a diplomat.

Zanu-PF denies conference meant to endorse Mnangagwa ‘bid’ for third term

Zanu-PF has refuted allegations that its upcoming annual people’s conference, scheduled for the end of the month, has the intention of endorsing President Emmerson Mnangagwa’s perceived efforts to secure a third term, among other things.

In a break from tradition, Zanu-PF will hold its conference in Gweru from October 28 to 29 instead of the usual December schedule. Furthermore, President Mnangagwa has directed that the number of delegates be reduced to less than 3,000, a departure from the 4,000 who attended last year.

President Mnangagwa, who assumed power through a military coup in 2017, is currently in his second and final term as permitted by the country’s constitution.

While President Mnangagwa has not publicly revealed his political aspirations beyond his current term, there are strong indications that his recent actions might be interpreted as efforts to secure his position and possibly pave the way for a third term bid.

Despite controversial election results in August, Mnangagwa has largely maintained his previous cabinet and has supported the expulsion of over a dozen opposition legislators through the sponsorship of recall orders by an individual claiming to be the CCC interim secretary-general.

Any attempt to secure a third term would require a constitutional amendment, necessitating a two-thirds majority vote in parliament.

In the August elections, Zanu-PF fell short of the required two-thirds majority, making it unlikely to push through any constitutional amendments, even if all of its MPs voted in favor.

To safeguard his position, President Mnangagwa has strategically placed loyalists in key roles, including the Attorney General, Prosecutor General, National Assembly speaker, and Chief Justice.

Sources within Zanu-PF suggest that President Mnangagwa is also using the upcoming conference as an opportunity to silence and remove dissenters within the party.

Farai Marapira, Zanu-PF’s acting information director, dismissed these claims, asserting that they stem from a misunderstanding of the distinction between a conference and a congress.

He clarified, “These claims arise from a lack of understanding of the terms. Those making these claims do not comprehend the difference between a Zanu-PF conference and a Zanu-PF congress. This year’s event is a conference, where people will gather. There will be no elections, and no changes in party positions. As Zanu-PF, we cannot respond to allegations of internal conflicts from external sources. These rumors should be disregarded with the disdain they deserve.”

BRIAN Mundubile has vowed that he is ready to be punished a thousand times for as long as Speaker of the National Assembly, Nelly Mutti and her second Deputy Speaker Moses Moyo shall continue to exhibit biasness in their conduct of business in the house.

Mr. Mundubile, the Leader of the Opposition in Parliament says for as long as there shall be no Parliamentary democracy, he was going to fight for what is just and does not care how many times Speaker Mutti and her second Deputy Speaker Moyo were going to threaten him with punishment.

But both Speaker Mutti and the government Chief Whip have threatened that they would not tolerate Mr Mundubile for what they have termed as misconduct for trying to defend the Parliamentary Standing Orders which guide the conduct of both the presiding officers and the lawmakers.

Mr Mundubile said until Zambians are able to see and experience Parliamentary democracy, those threatening him should know that his desire to restore decorum in the House was not a battle he was ready to lose.

“Against all those threats from both speaker Mutti and second Deputy Speaker Moyo, let them know I am not moved an inch…I am ready to be punished a thousand times unless the decorum of Parliament is restored. I will not stop at anything. For as long as there is no Parliamentary democracy in the House, I am going to fight.”

“I will fight for what is just and I do not care. how many times they are going to threaten to punish me. I will stop at nothing short of Parliamentary democracy.

Those threatening me should be told that this is not a battle I am ready to lose and I will do all it takes until the opposition Members of Parliament start debating freely in the House,” Mr Mundubile said.

Mr Mundubile said he was not going to take any threats trom any of the presiding officers on the floor of the flouse because what was guiding the behaviour of both the MPs and the presiding officers were Standing Orders.

“When someone, including the presiding officers breach the standing orders in their conduct, then the standing orders are at large and the presiding officers cannot run back to the same rules and punish a member after breaching the rules governing the House, Mr Mundubile said.

Mr Mundubile said for as long as the presiding officers did not become impartial in conducting the business of the House, there Shall be disquiet in Parliament stating “I am only but one messenger but there could be many more others. So, all those threats against me wil not stop me in my bid to bring sanity in Parliament”.

HON. NZOVU FINDS WORST POLLUTION EVER AT JINFA STEEL LIMITED IN KALULUSHI

Kalulushi, Wednesday, 11th October, 2023

Minister of Green Economy and Environment Hon. Eng. Collins Nzovu MP says he has seen the worst pollution ever at Jinfa Steel Limited in Kalulushi District of the Copperbelt Province.

Hon. Nzovu, in the company of the Zambia Environmental Management Agency (ZEMA) and the Forestry Department visited Jinfa Steel Limited, a steel manufacturing company that manufactures steel bars for concrete reinforcement of different sizes from scrap steel as raw material.

The Honourable Minister said it was shocking that people were working in such an environment without Proper Protective clothing.

The company was found violating both environmental and labour laws. Hon. Nzovu observed that there is no internal air emission monitoring system (monitoring device) or pollution control system installed on the smelter stack to monitor the quality of emission discharged into the open environment.

There were a lot of fugitive emissions at the furnace section area.

Workers at the furnace section were not provided with adequate Personal Protective equipment thereby exposing them to fine dust and smelting fumes.There were no hazardous waste receptacles and the few observed were not labelled. Spillages of hydrocarbon (used oil) was observed on open environment (unconcreted surface).

There were no dust suppression measures observed in the working environment. There was no signage warning workers on hazardous nature of the working environment and raw material are stockpiled unsystematic with sharp metals all in the walk pathways.

ZEMA ordered the facility to immediately cease all operations at the plant and comply with the Decision Letter and Licence conditions issued.

At Rongxing Investments Limited in Mufulira, Copperbelt Province, an operator of copper ore processing plant whose end products include copper cathodes and copper concentrate, the company has no qualified personnel in the field of Metallurgy, Mining and Environment. The tailings dam walls have not been rehabilitated.

Monitoring wells have not been drilled for monitoring of possible ground water pollution. There are no dust suppression measures employed on site and dust emission was high at the tailings dam.

ZEMA directed the facility to immediately suppress dust on the roads within the facility by putting laterite and a binder such a molasses and remove the tailings from two coffer dams by 31st October, 2023.

At Sino Metals Leach Zambia Limited in Kalulushi District, the company in July reported the dam wall failure of the tailings dam to ZEMA. The incident involved the discharge of waste process material into a drain leading to Lulamba stream, a tributary of Lukoshi stream which drains into the Kafue River.

During the site visit with the Honorable Minister, the tailings dam walls had not been rehabilitated fully and was prone to collapse. Huge volumes of the contained material were discharged from the dam wall opening into Lulamba Stream. It was stated that Sino Leach Zambia Limited took approximately two hours to stop the discharge of the material.

During the time of inspection, there was no flow coming from the Tailing Storage facility. However, there was heavy discharge of untreated industrial process water into the Lulamba Stream.
The water in the Lulamba stream was affected resulting in the colour change to blue. The pH was low (acidic at the time of inspection).

Some small-scale farmers growing vegetables on the banks of the Lulamba stream were affected.

Sino Metals Leach Zambia Limited is still serving a Compliance Order which was issued on October 11, 2022 which directed the facility to cease discharging acidic effluent into the aquatic environment, complying in full with the Decision Letter Conditions in general.

The company was ordered to compensate the farmers along the Lulamba and Lukoshi Stream for the loss of their vegetables, stop discharge of effluent into lulamba stream, monitor the quality of effluents and water in Lulamba stream up to Kafue River and summit weekly reports to the Agency.

Hon. Nzovu said the levels of pollution on the Copperbelt were getting worse but Government will not allow the situation to continue.

ZEMA Acting Principal Inspector Mr Silvester Ng’uni said the Compliance order issued to the facility will only be lifted after satisfying the Agency’s (ZEMA) directives.

Gordon Thornton, the ex-husband of Real Housewives of Potomac star Mia Thornton, has disclosed that he gave his estranged wife permission to explore relationships with younger men to address her unmet needs.

Gordon, who is 71 years old, expressed his understanding that there might come a time when he could no longer satisfy the desires of his 38-year-old former spouse in the bedroom, which led him to grant her the freedom to date other people.

In an interview with TMZ this week, Gordon explained, “I know there’s going to come a time when I probably won’t be able to satisfy all of her needs.” He claimed to have communicated to Mia, “I want you to know that I am okay with you finding what you need elsewhere.”

Gordon asserted that he was content with Mia pursuing new relationships as long as she kept them private. However, he now believes that she is leaving him due to financial reasons. He disclosed that he no longer has access to the financial resources he once did, while Mia’s new partner is considering purchasing a new home for them and engaging in business ventures together.

Gordon remarked, “I absolutely believe that she’s leaving me because she sees an upgrade. She’s mentioned to me that they’re going to be buying a house together and doing businesses together, which tells me that the interest is based on monetary gain from the relationship.”

Gordon, who recently underwent surgery to treat prostate cancer, admitted, “I do agree that Mia married me for my money and the future she thought I could provide.”

In response to their separation, Mia issued a statement back in September, saying, “Like all marriages, our has had its ups and downs. Caitlyn Jenner has finally revealed what she knows about the release of her stepdaughter, Kim Kardashian’s infamous 2007 sex tape.

The 73-year-old former Olympian claimed in Sky’s new docuseries House Of Kardashian that she had almost no knowledge of the tape’s contents or release and she tried to keep it that way.

‘Whatever’s going on, I don’t know what it is and I’m gonna go to the golf course,’ she recalled thinking at the time that her family was overwhelmed by controversy.

‘To be honest with you, I just stayed out of it,’ she continued.

Caitlyn claimed to have played no role in the release of the tape, which was released in 2003, after her ex-boyfriend Ray J told Mail Online in May 2022 that Kim’s mother Kris Jenner had watched two different sex tapes before deciding on which one to release.

However, Kris and Kim have always denied that they played any part in releasing the sex tape, and they have long contended that it was leaked without their knowledge or consent.

‘Kris never talked to me about it. I never talked to Kimberly about it. I don’t know what happened, why it happened,’ Caitlyn continued in the documentary, via E! News.

The transgender icon was quizzed on whether Kim and Kris had worked ‘together to release’ the sex tape.

‘I have no idea,’ she claimed.

‘I never, ever once had that conversation,’ she continued, before adding: ‘Nor did I want to have that conversation.’

Kim’s sex tape was ultimately released after her family’s reality series Keeping Up With The Kardashians was already in the works, but before it had been filmed.

Much of the series premiere was spent addressing the tape amid Kim — and her family’s newfound publicity and fame.

In that episode, Kris didn’t say if she was involved in the release of the tape, though she admitted to trying to make the best of an awkward situation.

‘When I first heard about Kim’s sex tape, as her mother, I wanted to kill her,’ she declared in the episode. ‘But as her manager, I knew that I had a job to do and I really just wanted her to move past it.’

In May of 2022, Ray J spoke with DailyMail about the Kim Kardashian, Superstar tape and said there were three different videos considered for release, of which two were sex tapes starring him and Kim.

He also alleged that Kris had viewed the tapes including the two videos featuring her daughter having oral sex and intercourse with Ray J in order to determine which would be released.

The R&B singer claimed that Kim has always been in possession of the original tapes and that she currently has the second unreleased tape.

He added that he had never had possession of any of the tapes, though he was allegedly in a business relationship with his ex and her mother.

‘I’ve never leaked anything. I have never leaked a sex tape in my life. It has never been a leak,’ he said. ‘It’s always been a deal and a partnership between Kris Jenner and Kim and me and we’ve always been partners since the beginning of this thing.’

He admitted to having the original idea to release a sex tape, and Kim agreed, though she has claimed that she was always against the idea of releasing a sex tape.

Ray J admitted to having years-long regrets over the release of the tapes, as he received much of the criticism for releasing the tapes, but he said he was prevented from publicly defending himself by the contract he signed which he claimed he agreed to without legal advice.

He said he decided to speak out after an episode of Keeping Up With The Kardashians featured Kim’s claims that she was worried Ray J would leak more explicit material featuring her.

Her then-husband Kanye West subsequently acquired a laptop from Ray J that allegedly had more adult content, and the rapper said his family would no longer be ‘extorted.’

But Ray J painted a different picture, claiming that he handed the laptop over for free after hearing that Kim and Kanye were concerned about the content possibly being leaked.

Mutale shared that she’s emotionally drained in some areas of her life because of personal things and is not as happy as she used to be.

“It’s got nothing to do with maturity in a sense, but it’s just that sometimes you stay away from socials just to take five which will help me to think because I need to figure myself out especially with what’s happening in my life”, she explained in an interview with Diamond TV’s Chimweka.

“I have a company ,Mutale Mwanza Media, so I have to exercise a certain maturity in order to experience alot more growth that God is doing in my face which I also don’t understand”, she further explained.

“The public figure also stipulates that she can’t walk away from the meeting and sound like a big chick then go onto Facebook and do the contrary”.

“Life has placed Mutale in a place where she needs to be matured based on her brand, and being a media owner, but also in her life, she is just not in a happy place, hence not just being posty because shes just going through a number of things” she revealed.

She also feels opening up to anyone including a therapist may be toxic because she believes they might later go out and put things to the public unless they sign an Non Disclosure Agreement.

She also admitted that another reason of shunning therapy is not to walk in a therapy session and act like a dictator, but would rather drink alot and talk to God.

Popular trust in National Elections Commission remains weak, but majority of Liberians trust voter power

Only one-third of Liberians say they trust the National Elections Commission (NEC) as the country approaches general elections in October, according to the latest Afrobarometer survey.

One of the NEC’s tasks is to manage the country’s transition from manual voter registration to the use of a biometric voter registration system.

While public trust in the NEC has declined by 10 percentage points since 2018, most Liberians think their last national election was free and fair, and most express confidence in the secrecy of their ballots and the power of their vote to affect the country’s future.

Key findings

1. Only one-third (34%) of Liberians say they trust the National Elections Commission “somewhat” or “a lot,” a decline of 10 percentage points since 2018 (Figure 1).

2. Six in 10 citizens say elections do not work well to ensure that members of the House of Representatives (61%) and senators (60%) reflect the views of voters. But a majority (55%) think that elections in general (not regarding any particular election) do enable voters to remove elected officials who don’t do what the people want (Figure 2).

3. More than three-fourths (78%) of Liberians say political parties that lose an election should cooperate with the government, while only 22% say the opposition should instead focus on holding the government accountable (Figure 3).

4. Almost three-fourths (73%) of citizens think it is unlikely that powerful people can find out how they voted (Figure 4).

5. An overwhelming majority (85%) of citizens say the 2017 elections were “completely free and fair” (59%) or “free and fair with minor problems” (26%) (Figure 5).

Afrobarometer surveys

Afrobarometer is a pan-African, nonpartisan survey research network that provides reliable data on African experiences and evaluations of democracy, governance, and quality of life. Nine rounds of surveys have been completed in up to 42 countries since 1999. Round 9 surveys (2021/2023) cover 39 countries. Afrobarometer conducts face-to-face interviews in the language of the respondent’s choice.

The Afrobarometer team in Liberia, led by the Center for Democratic Governance, interviewed a nationally representative, random, stratified probability sample of 1,200 adult Liberians between 15 August and 7 September 2022. A sample of this size yields country-level results with a margin of error of +/-3 percentage points at a 95% confidence level. Previous surveys were conducted in Liberia in 2008, 2012, 2015, 2018, and 2020.

Protests for democracy in Guatemala immobilises country for second week

There is growing tension in Guatemala because supporters of President-elect Bernardo Arévalo have been protesting for a second week.

The protesters want Attorney-General Consuelo Porras to step down from her position.

They say that Ms Porras planned to stop Mr Arévalo, who promised to fight corruption, from becoming the leader.

On Monday, some of the protests that were calm before became aggressive.

Some people wearing masks threw rocks and broke windows at a protest near the National Palace of Culture in Guatemala City.
Efe news agency reported that around 200 troublemakers joined the peaceful protest and caused problems. These troublemakers threatened the protesters, press members, and got into clashes with the police.

A person in the government, Napoleón Barrientos Girón, later said that the violence was caused by “groups of people who had joined secretly”. “MrBarrientos said that we are running after them and catching them. ”

The fights happened on the eighth day in a row of demonstrations by Mr Arévalo’s followers. He had won the presidential election in August by a big margin.

Just a few hours after he won by a large margin, the political party he leads called Movimiento Semilla (Seed Movement), was temporarily stopped by Guatemala’s top election authority, the Supreme Electoral Tribunal.

Many people believe that his political party suspended him in order to prevent Mr. Arévalo, who is not an experienced politician and has been fighting against corruption, from becoming officially recognized in January as previously planned.
MrArévalo himself called it a coup d’état. His followers are now going out to the streets to ask for the removal of Consuelo Porras, who they believe is trying to stop Mr Arévalo, from her role as attorney-general.

Ms Porras is saying that Mr Arévalo’s party did not follow the proper procedures to become officially registered. However, some people who disagree with her say that she only started looking into this issue after Mr Arévalo did well in the first round of the election and secured a place in the next round.

The protests got worse last week when protesters stopped cars from using important roads all over the country. The blockades have made it difficult for people to get fuel and food in some areas. It has also stopped traffic on important roads.

In a TV speech to the country, the president who is leaving his position, Alejandro Giammattei, asked the protesters to remove the blockades. He said the blockades were against the law, causing a shortage of supplies and endangering the lives of Guatemalan people.

He also requested Mr. Arévalo to meet with mediators from the Organization of American States (OAS) to make sure that the transfer of power on January 14th, when President Giammattei’s term ends, happens peacefully.

Deadly clash at Israel-Lebanon border

An important Israeli officer was killed in a fight with armed group on the border with Lebanon on Monday, according to Israel’s military.

The military said that soldiers and planes killed two “terrorist infiltrators” who entered Israel’s land.

Palestinian Islamic Jihad said that they were a part of it.

Afterwards, the military attacked places in Lebanon because mortar fire was happening, resulting in the deaths of three militants from Hezbollah movement.

On Tuesday, a group called Hezbollah claimed that their soldiers shot a special missile at an Israeli army vehicle in the Avivim area.

The military said that no one got hurt and that a helicopter attacked one of the group’s lookout spots because of what they did.

The Palestinian group Hamas said they launched rockets from Lebanon towards Israel’s western Galilee area.

The Israeli military said that the rockets either got stopped or landed in empty places. In response, they attacked two more Hezbollah observation posts.

For three days in a row, there have been attacks coming from Lebanon, while at the same time, Israel and Hamas were fighting in Gaza.

The United States has told Hezbollah, a strong military group in Lebanon that fought against Israel in 2006, to stay out of a situation.

On Monday, there was a lot of violence. Some armed men came into Lebanon near a town called Dhayra. Israeli soldiers, with help from helicopter gunships, killed these armed men.

It said that two of the fighters died and one went back to Lebanon and got away.

Palestinian Islamic Jihad said that the infiltration was a part of their plan called “Operation Al-Aqsa Flood”. This plan was carried out by the militant group Hamas and involved a large attack on southern Israeli communities from Gaza. It started on Saturday and there are reports that at least 900 Israelis have been killed.

The Israeli military said their helicopters attacked Hezbollah spots in Lebanon, which included two observation posts. This was done in response to two mortar bombs that were fired into Israel, but luckily didn’t cause any injuries.

Hezbollah said that three of their fighters were killed in attacks by Israel on towns and villages in Lebanon. The group fought back by shooting rockets and shells at two places where Israeli soldiers live.

On Sunday, the group called Hezbollah launched several shells and rockets at the Israeli army’s locations in the Shebaa Farms/Mount Dov region, claiming it was showing support for the Palestinian fighters.

The Iran-backed group, which has very strong rockets that can go far into Israel, has said they will get involved in the Israel-Gaza conflict if certain limits are crossed. They say that Israeli troops entered forcefully.

On Monday, a high-ranking US defense official spoke to reporters. They said that they are really worried about Hezbollah making a bad choice and deciding to start another part of the fight.

THE harassment of former President Edgar Lungu by the New Dawn Government is due to his eligibility to contest the 2026 presidential elections, Patriotic Front (PF) Chairperson for Information and Publicity, Emmanuel Mwamba has said.
Meanwhile, the PF has proposed an amendment to the Former Presidents Benefits Act to include Vice-Presidents as running mates who are now elected by Zambians.


Speaking when he featured on 5FM’s Hot Seat Programme, Mr Mwamba who is also PF presidential candidate, said former President Lungu was in almost identical circumstances with late former President Rupiah Banda who was subjected to harassment because he was eligible to contest the 2016 presidential elections.
“President Rupiah Banda lost elections in 2011 but he was eligible to stand in 2016, you saw the harassment that came to him not because he had done anything wrong but because there was a possibility that he could stand in 2016… that was his only crime.
“We have almost identical circumstances with former President Lungu. If he wants to stand in 2026, he can, it is not the PF’s fault, it is the law, he is eligible. That is why you are seeing all this flurry of harassment,” Mr Mwamba said.


He said Dr Lungu was qualified to contest the 2026 elections under the PF or any other political party.
Mr Mwamba said it was sad that the United Party for National Development (UPND) administration had subjected Dr Lungu and the former first family to harassment since he lost power in August 2021 and handed over to President Hakainde Hichilema.
“It is very humiliating in the manner that we treat our former Presidents. Personally, I am very sensitive about issues of former Presidents, you are aware that I worked for 10 years for former President Dr Frederick Jacob Titus Chiluba who was our second President of the country.
“So, President Edgar Lungu is our only surviving former Head of State after we lost President Rupiah Banda and Dr Kenneth David Kaunda just two to three years ago. So, we must treat our Presidents with a lot of respect, he was President for seven years, I think he did his part, he contributed to the development of our country and he reserves that special place as a statesman,” Mr Mwamba said.
On calls by some ruling UPND members that Dr Lungu should refund the benefits paid to him because he is still in active politics, Mr Mwamba said Dr Lungu announced his resignation in 2021 and that nothing had changed.


“Why would he refund his benefits, why? They are being paid to him as a former President. Is he not a former President? I know there was an amendment done in 1998, the amendment was done when first President Dr Kenneth David Kaunda came back into politics, but he was still getting benefits. He became UNIP President and he became the Presidential candidate for UNIP. So, in 1997, Government decided to withhold the benefits from Dr Kaunda saying he had gone back into politics but the law was very clear that those benefits accrued to Dr Kaunda because he was a former President,” Mr Mwamba said.


And Mr Mwamba says the PF was proposing an amendment to the Former Presidents Benefit Act to include Vice-Presidents as running mates who should be taken care of after retirement.


“Now that a running mate is also elected by the people of Zambia, we have called for an amendment to the Former Presidents Benefits Act to include the Vice-President, that the Vice President must receive similar benefits as the President or the current Vice-President because now you have a Vice President who is elected across the country like the President, they go as a team. So, it is not acceptable that you should deprive the Vice Presidents of these benefits so we call for immediate amendment,” Mr Mwamba said.


He called on Minister of Justice, Mulambo Haimbe to expeditiously work towards amending the Former Presidents Benefits Act to include Vice-Presidents instead of planning illegal amendments to the constitution.

Patriotic Front (PF) member and Lusaka Lawyer Celestine Mambula Mukandila has prayed that fuel prices should not exceed K30.

Speaking when he featured on Munati Television yesterday, Mr Mukandila agreed with President Hakainde Hichilema who said the monthly fuel price reviews are chocking Zambians.

He said one cannot plan when fuel is being reviewed every other month.

“Today we have seen the swearing in of the permanent secretary in the ministry of energy and the President is on record indicating that the citizens are now chocking with the reviews in the fuel prices on a monthly basis. Because it is literally impossible for us to plan as businessmen,” he said.

“You cannot plan when fuel is being reviewed every other month. This month you don’t know, as an oil trader for example, you don’t know whether you are going to make a loss or not. Because you don’t know whether government is going to increase the price of fuel…I have got colleagues that have made losses beyond understanding any business concept because today, if fuel is trading at K26, tomorrow, God forbid, it goes to K32…I hope and pray it doesn’t because from the way things are looking, it is highly possible.”

He said UPND does not understand how the process regarding fuel works.

“So, the swearing in of the PS in the ministry of energy today has shown to the Zambian people that clearly and truly, our colleagues did not know how the energy sector is run. They are on record, they told the Zambian people that the reason that the reason fuel is at K17 under PF, it is too expensive, it is because there are middlemen there and these middlemen are getting is K3 or K4,” he said.

“When we get into government we will ensure that fuel gets back to K10. Now, this is a complete 360 turn around where we are seeing fuel becoming almost double the amount it was in 2021. When you via for a position, you need to understand what it takes to be in that position. Firstly, the UPND gave us a scenario that the moment they get into government, they will reduce the cost of fuel.”

Mr Mukandila recalled that President Hichilema gave Zambians mathematical charts and graphs to say the reason fuel is at “this amount” is because there are middlemen.

“That is what they were telling us. At some point we told them there are global factors that have to be put in place because fuel, we do not produce that in Zambia. They literally refused, they said no, these guys are just stealing,” he said.

“Now the question that the Zambian people are asking today is if there was a middle man during the PF time and fuel was at K17, does it mean that we have three middlemen who are stealing money here? The cost of living is extremely high because of the ripple down effects on the cost of fuel. You cannot move a commodity at a price you expected from Muchinga farms to Lusaka or from Ngabwe to Kabwe, or from Dundumwezi to Lusaka. So the prices have started skyrocketing because of the fuel prices.”

He said Zambians have now seen that they are in trouble under UPND.

“The fixer is fixing the Zambians…Why are we here? The answer is very simple. Our colleagues wanted to fix what was not broken. You and I my brother are being fixed. The fuel we were using last month is different from the fuel we use this month,” he said.

In the heart of Africa, where the Zambezi River flows majestically and Victoria Falls roars with all its splendor, lies a nation that is both beautiful and resilient. Zambia, a land of diverse cultures, rich traditions, and an abundance of natural resources, has always held the promise of a brighter future for its people. Today, however, the biggest expectation from the common people of Zambia, who are the majority and hold the highest political decisions, is the unbearable cost of living.

In 2021 August, the United Party for National Development (UPND) ascended to power on the premise that they were the better solution than any other party, including the then-ruling Patriotic Front (PF). The citizens of Zambia had placed their hopes and dreams in this new government, believing that it would bring about a positive change, one that would alleviate their daily struggles and offer them a better life.

Yet, what we are witnessing today almost three years (3 years) is entirely the opposite. The promises made during the electoral campaign seem to have faded into oblivion, and the hopes of the people have been shattered. The UPND government, which was supposed to be a beacon of hope, now seems to be engulfed in a cloud of disappointment and disillusionment.

The cost of living in Zambia has become unbearable for the average citizen. Basic necessities such as food, rent, Transportation & fuel, University tuitions and cost of healthcare because government facilities have no medication have become increasingly unaffordable. The very people who lined up for hours to usher in this government are now grappling with the harsh reality that their lives have not improved as they had hoped.

The collective integrity of the poor citizens of Zambia is being undermined, and their faith in the political system is wavering. The gap between the promises made and the reality on the ground is growing wider if not totally the opposite, and the people are left to wonder if their voices truly matter in the corridors of power or only at a time of casting Votes.

It is essential to remember that Zambia is bigger than all of us, all together. It is a nation with a rich history of resilience and unity in the face of adversity. The challenges we face today are not insurmountable, and the dreams of a better Zambia can still be realized.

The UPND of Mr Hakainde Hichilema must heed the cries of the Zambian people today, even those in the UPND grassroot structures are complaining and asking Government to take actions to address the issues that are plaguing the nation. The much spoken about Transparency, accountability, rule of law and a genuine commitment to the welfare of the citizens are the pillars on which a strong and prosperous Zambia can be built.

In the end, it is the collective responsibility of every Zambian, from the highest offices of power to the grassroots, to work together in the spirit of unity and common purpose. Only then can we truly make Zambia a nation that lives up to its potential and promises—a nation where the well-being of its people is not just a slogan, but a reality.

Today the Minister of Information and Media and Chief Government Spokesperson Hon. Cornelius Mweetwa, MP held a press briefing at which a number of issues were discussed.
Here are the highlights:

• He dismissed as fake, a video circulating on social media with a manipulated image of President Hakainde Hichilema and an audio mimicking his voice saying he will not contest for the 2026 general elections.

• He described the video as political manoeuvres by the opposition and urged Zambians not to take it seriously. The Minister urged those involved in political propaganda to stop using social media as a tool to manipulate the innocent Zambians.

• The Chief Government Spokesperson also announced that Government through the Ministry of Water and Sanitation that repair works on the Lolanda One Water Treatment Plant in Kafue were completed as of Friday, 29th September 2023. He said the spillage point has been sealed and within the next few days there will be water circulation in Lusaka and other affected areas. He called for calm as final processes to normalize the situation are underway.

• He recalled that yesterday, the 9th of October, the President Mr. Hakainde Hichilema directed the newly appointed Permanent Secretary in the Ministry of Energy Mr Peter Mumba to interrogate the fuel monthly reviews and come up with a better model that will work for the Zambian people. He said as a listening Government, the President was responding to calls by many citizens to help them plan properly in a predictable manner.

• The Minister also stated that it was unreasonable for the Patriotic Front (PF) to state that they subsidized fuel and therefore, should be remembered for their legacy. He stated that to the contrary, the PF were not being honest with the people of Zambia because they never paid for the fuel they claimed to have been subsidizing leaving the country in a debt amount to over $700 million which Government is currently offsetting.

• He also disclosed that yesterday, Government through the Ministry of Infrastructure and Urban Development hit another milestone by signing the first ever concession agreement for the reconstruction of the Katete-Chanida road stretch worth $79.8 million. He said the project will be undertaken through the Public Private Partnership financing model. He stressed that the project is a clear indication that the PPP model Government is promoting is working. He expressed Government’s happiness that the project will be done by a Zambian construction company, an indication that Zambians are ready to take the construction industry to another level.

• The Chief Government Spokesperson also indicated that Government has taken the public pronouncement made the Patriotic Front (PF) Deputy National Chairman for Mobilization Mr Bowman Lusambo that former President Edgar Lungu is still the President of the Patriotic Front (PF) and that he will be returning to active politics, seriously. He stated that necessary and relevant considerations and legal ramifications will be taken on the pronouncements adding that the nation will be kept informed on the matter.

THE Lusaka Magistrate’s Court was yesterday heard a testimony from a woman who narrated how her husband’s ex-lover went to see a witchdoctor and asked him to either kill her or make her run mad so that she can get back with her spouse.

Hope Chinyimba-Nkomanga, a teacher, testified that the witchdoctor then asked Mainess Mumba to leave the former’s phone number so that he could perform the ritual of killing or making her insane.

She was testifying in a case Ms Mumba has sued her and her husband Burton Nkomanga, a banker, for assault occasioning actual bodily harm.

Ms Mumba narrated that the couple beat her up on March 20 this year after she concluded conducting prayers around 01:30hours at Crossroads, Chelstone Obama.

Earlier last month, the victim, a 28-year-old businesswoman of Chamba Valley, testified that Ms Nkomanga, 33, also accused her of bathing in charms and attempting to kill the couple.

But during continued trial yesterday, Ms Nkomanga said on March 19 this year around 12:00, a witchdoctor from Kafue phoned her.

“I asked where he got my number and he told me that he got it from Mainess. The witchdoctor narrated to me that Mainess Mumba told him that she wanted me dead or run mad so that she can remain with my husband,” she said.

The court heard that the witchdoctor also informed her that he had viewed her in his magic mirror carrying a baby the time Ms Mumba gave him particulars of the person she wanted dead.

“The witchdoctor said he noticed that Ms Mumba’s intentions were not pure. He then tricked her and asked her to leave my phone number and other details with him so that he can put it in a calabash and work on killing me or make me to go mad so that she can be with my husband,” she said.

Ms Nkomanga told the court that she had audio recordings and video evidence.

She also earlier narrated how Ms Mumba was found naked outside the couple’s house on March 20 this year.

“On the material day, I woke up heading to the Kitchen around 01:00hours to make baby formula. I heard guys making noise and banging an object against the gate,” Ms Nkomanga said.

She said when her husband and a neighbour, Mr Kennedy, went to check what was happening, the found Ms Mumba.

“I also went outside, Ms Mumba had clothes in her hands. I was shocked and asked what she was doing there and she couldn’t explain and started crying,” Ms Nkomanga said.

She said Ms Mumba knelt and apologised for dating her husband, whose phone number she got from a home shop owner in the neighbourhood before the two started communicating.

“I told her to dress up,” Ms Nkomanga said.
Trial continues on October 30 this year.

‘It’s time for a revolution’ – CCC party threatens, following recall of 15 MPs

The main opposition Citizens Coalition for Change (CCC) is contemplating launching massive protests against the controversial recall of its Members of Parliament by a shadowy individual calling himself the party’s interim Secretary General.

Sengezo Tshabangu, last week, wrote to the Speaker of Parliament Jacob Mudenda claiming to be the party’s Interim Secretary General and that he intended to recall 15 CCC lawmakers and 17 councillors.

Despite Mudenda having earlier received communication from CCC leader Nelson Chamisa telling him to ignore Tshabangu’s letter, the Speaker on Monday wrote to the Zimbabwe Electoral Commission (ZEC) announcing 15 parliamentary seats vacant.

The affected MPs are Pashor Raphael Sibanda (Cowdray Park); Ereck Gono (Lobengula-Magwegwe); Nicola June Watson (Bulawayo South); Desmond Makaza (Mpopoma-Mzilikazi); Obert Manduna (Nketa); Sitabile Mlilo (Proportional Representation); Jasmine Toffa (Proportional Representation); Janet Dube (Proportional Representation); Evidence Zana (Youth Quota); Morgan Ncube (Beitbridge West); Nomathemba Sibanda (Proportional Representation); Velisiwe Nkomo (Proportional Representation); Prince Dubeko Sibanda (Binga North); Bright Moyo Vanya (Lupane East) and Febion Munyaradzi (Mabvuku-Tafara).

Without explaining how they want to retaliate, Promise Mkwananzi, the CCC national spokesperson said they are going to fight for the right to vote.

“We will not accept such disdainful conduct against our constitution and our democracy in Zimbabwe,” he said.

“We are lodging the fight for the right to vote, the right of choice and the respect and supremacy of our constitution.

“Zanu PF has undermined and subverted the will of the people for far too long. We have to stand up now.”

Prince Dubeko Sibanda who was also recalled from Binga North said “it’s time for a revolution.”

“On October 1, 2020, they recalled me for ceasing to be a member of the MDC-A, which I won under in 2018. We left it and formed CCC. I won by-elections on March 26, 2022, under CCC. I did so again in the general elections on August 23, 2023. Today, they recalled us again. It’s time for a revolution,” he said.

Meanwhile, 13 CCC MPs in Bulawayo filed a High Court application seeking an order declaring that they have a right to remain in parliament and that Tshabangu has no authority to recall them. The party has described him as an “impostor.”

They are seeking: “An order declaring that the Plaintiffs’ have a right to remain in, and be recognized as Members of Parliament by virtue of having been so elected in the general elections held on the 23 and 24th of August 2023 and having been so sworn on the 7th of September 2023.

“An order declaring that 1” Defendant has no authority to communicate, engage, or correspond with the 2nd Defendant purporting to represent the Citizens Coalition for Change (CCC) in respect of the Plaintiffs’ positions as Members of Parliament.

“An order declaring that the 2nd Defendant has no obligation to act on the basis of any communication or correspondence addressed to him by the 1″ Defendant purporting to communicate any information pertaining to Plaintiffs’ membership of the Citizens Coalition for Change (CCC) or in respect of the Plaintiffs’ position or status as Members of Parliament.”

Exiled former Zanu-PF cabinet Minister Walter Mzembi argues that the recall of CCC members was being influenced by the ruling party in its quest for a two thirds majority.

“As long as this man Jacob Mudenda is a Zanu PF Politburo Member reporting to President Mnangagwa and is whipped by his Chief Whip during Zanu PF caucuses there will be no separation of powers between the Executive and Parliament.

“He will facilitate anything Zanu PF wants including a 2/3 Majority for its Third Term Project.

“He will also through the tortoise on the fence post Tshabangu recall CCC MPs at will in batches until the few remaining in Parly recognise Tshabangu as SG, agenda being splitting of this Party.

“Already “the please don’t recall me SG ” pleas seem to be in motion from the intelligence at hand,” he said.

Mzembi also points out that decisions to be taken by CCC in this particular matter will be critical.

“So the first wave has hit, there will be a second one and so forth. CCC has decided to go to Court, Zanu-PF is happy with this response which recognises the Courts after their invalidation when this Party did not contest its dispute of the Presidential Ballot result,” the former Tourism Minister added.

“The legitimacy question is being settled . Bulawayo had a fair chance at the Courts during the Caretaker phase of this administration now they have fully assumed power. Beware the ides of Baghdad!

“A Political or Legal response or both is the big question? Can CCC move its Parliamentary and Council Reps out of their new comfort zones without consequence is the next big question?

“What will be the arguments for and against some painful decisions which clearly need to be considered. Is this about CCC only or about the Voter, and What is the Voter saying?”
