Five facts about Mahamat Idriss Deby, Chad’s new leader and Africa’s youngest head of state

It has been confirmed that General Mahamat Idriss Deby, the late President Idriss Deby Itno’s son, is taking over as president in place of his father. The Chadian army said Mahamat, 37, will be the head of a military council to replace the late president.

Idriss Déby died on the front lines of a fight against northern rebels, an army spokesman said on Tuesday. In a statement read out on State Television, army spokesman General Azem Bermandoa Agouna said Deby “has just breathed his last defending the sovereign nation on the battlefield” over the weekend.

The president was on his way to the front lines to join troops battling “terrorists”, according to reports. Deby’s death came a day after he was declared the winner of a sixth term in office.

The government and parliament have since been dissolved. The army announced that a military council will govern for the next 18 months. Mahamat, a general in the Chadian army, will be the head of the military council and “occupy the functions of the president of the republic”, according to a charter released Wednesday by the presidency. Mahamat, who had previously overseen his father’s security as head of the elite presidential guard, will also serve as head of the armed forces, the charter stated.

Under Chadian law, the speaker of parliament should have taken power after Deby’s death, experts said. But with the legislative assembly and the constitution being dissolved, the military have replaced the constitution with their own rules, analysts say.

A transition government will now lead by a military council which is tasked with an 18-month transition toward “free and democratic elections.” Members of the military council are named by the new president who will also chair the “military transition council, the council of ministers, the councils and superior committees of national defence,” according to the charter.

Here’s all you need to know about the new Chadian leader who is now Africa’s youngest head of state:

1. Mahamat, who is the commander in chief of the red-bereted presidential guard or DGSSIE security service for state institutions, was raised by his paternal grandmother in the capital, N’Djamena. He is from the Zaghawa ethnic group, which has several top officers in the army.

2. Nicknamed “Kaka” or grandmother in Chadian Arabic, Mahamat was trained at the Groupement des Écoles Militaires Interarmées du Tchad (joint military schools in Chad) during the mid-2000s. He subsequently went to a military school in Aix-en-Provence, southern France, but spent only one term there before returning home. Upon his return, he went back to training at a military school in the capital and joined the presidential guard. Soon, he rose through the command structure from an armored group to head of security at the presidential palace before assuming control of the whole DGSSIE structure, according to a report by Aljazeera.

3. Mahamat is well known for defeating his cousin Timan Erdimi’s rebels in the Battle of Am Dam in 2009. While still a young officer, Mahamat and government forces fought against the rebels who had crossed into the country from Sudan.

4. In 2013, Mahamat was appointed deputy chief of the Chadian army deployed to Mali, where he worked closely with French troops in operation Serval in 2013 to 2014. The operation was to oust Islamic militants from the north of Mali.

5. Mahamat, known in military circles as “the man in dark glasses”, married from the Sharan Goran ethnic group, where his mother is from. His wife is Dahabaye Oumar Souny, a journalist at the presidential press service. Souny’s father is a senior official who was close to ex-dictator Hissene Habre, the Aljazeera report noted. Habre was ousted by Idriss Deby in December 1990. The Zaghawa community is therefore skeptical about Mahamat’s leadership, experts say. Opposition politicians in Chad have already rejected the army’s appointment of Mahamat, saying “Chad is not a monarchy.”

“Noone understands how it feels to be Pheluna’s child,” read one on the SMSs that the FDD leader, Edith Nawakwi, received from Pheluna’s child. “It hurts and it’s hard our mother is not here”, the message continued, claimed the FDD leader.

Speaking on Red Hot Breakfast Show on Hot FM Radio, Nawakwi charged that the people that have so far been arrested by the Police in the criminal act of the kidnapping and abducting of Pheluna and Milton Hatembo, are mere surrogates of Mr. Hichilema reminding listeners that they are all UPND members hailing from Southern Province.

Ms. Nawakwi lamented that if one has reflected on what has transpired over the last nine months concerning this case and one has any semblance of empathy or kindness, it’s not possible for him or her to continue being in the UPND supporting such inhumane and repugnant acts.

Ms. Nawakwi went on to claim that Pheluna and Milton have been abducted by Hakainde Hichilema himself and have been kept at his house after reporting him at Police Headquarters over the fraudulent acquisition of the Kalomo farms. She wondered how Mr. Hichilema could behave as Head of State if he can abduct peasants whilst being a mere opposition political leader.

Ms. Nawakwi has on several occasions, over the last few days challenged Mr. Hichilema to meet her at Lusaka Central Police Station to clear the air over the Hatembos abduction but to no avail. She said contrary to assertions that the duo are running away from Ms. Nawakwi, she contended that she is the one the children contact for help and she is the one who has saved Pheluna’s house from being auctioned by UPND money lenders in Choma.

Ms. Nawakwi has challenged Mr. Hichilema to come out clean over the Hatembos’ abduction scandal and has since challenged the church, in particular the SDA, to pray hard so that Mr. Hichilema can release the Hatembos.

Meanwhile, Chief Mukuni’s wife, Veronica, is still detained at Woodlands police station in Lusaka amidst information that she will be transferred Choma, a day after she was arrested and charged with abduction of Pheluna and Milton Hatembo.

She is jointly charged with Mazabuka Mayor, Vincent Lilanda, Choma Mayor Javen Simoloka, former Local Government Minister, Ackson Sejani and business man Fines Malambo. Her lawyer Martha Mushipe said Veronica is likely to be taken to Choma this afternoon for court appearance.

On Monday, Police arrested Veronica in Livingstone and transferred her to Lusaka where she was arrested and charged.

HAKAINDE Hichilema has persevered for a long time and has now been cast in steel, ready to lead this nation, says Fr Richard Luonde.

Fr Luonde has also urged alliance members to start campaigning now as Zambians cannot wait up to 2026 to get the PF out of office.

In a statement to The Mast, Fr Luonde who is the NDC interim national chairperson has urged Zambians to open their eyes and get the corrupt PF government out in August.

“Our alliance has now cast our presidential candidate Hakainde Hichilema into steel. I say so because whatever happens between now and August will not change Zambians minds. HH is solidly on the ground and he believes in what Zambians want. Zambians today are living in abject poverty, with no hope for a better tomorrow while we have thieves in the PF who are not even employed flashing millions of kwachas,” he said.

“We are not casting HH in mutofwe which can easily melt, HH is grade one steel and won’t melt because Zambians are fed up and tired of people who are just interested in their own welfare. HH has been through thick and thin under the PF government. He has been to Mukobeko Prison for unreasonable charges of treason, but he stood his ground and came out as white as snow. Some politicians cannot withstand what HH has been through even for minute. When incarcerated for a day they opt to go back to the PF forgetting that what saves a person is evidence and not a political party.”

Fr Luonde said Zambia needs strong leaders who can withstand any weather, be it stormy or freezing, so that Zambians live a better life.

“We have suffered enough and no leader can today free us from this economic, living standards bondage apart from Hakainde Hichilema. We have decided honestly and comfortably to float him as the alliance presidential candidate because he cares for everyone and we saw it fit that there is no one who can move this country forward apart from him. And so let’s go out and campaign as though these are the last elections in our country,” Fr Luonde said.

He said Zambia needs a government and a head of state who can: “Pull us out of the misery, anarchy, and fangs of poverty.”

“If we allow the PF to rule us up to 2026, I am telling you that this country will totally collapse…the time to campaign is now. Let’s rescue this nation from the PF hands of violence, hands of criminals and fangs of corruption. If we don’t free Zambians from murderous altitudes of the corrupt, we will have ourselves to blame,” Fr Luonde said.

He called for honest campaigns so that Zambians hear the opposition.

Fr Luonde said God is kind and faithful.

“And the God who has made us cast HH in steel will lead us to the promised land and that land is Zambia. HH has been in the opposition for a long time and because he believes in that Zambia can be great again and resources can be equitably shared. Our talk will be that of development and not stealing,” said Fr Luonde

In contraposition to Munokalya Mukuni is a woman of Royal lineage by the tittle of Be-Dyango.i.e. Tribal Matriarch and Queen of sacred rites both rolled in one tittle- BE-DYANGO.

Her spouse goes by the tittle of Nedyango (consort) while the Munokalya, through his prime minister, Mwendambeli is confined to the everyday run of things; to political, judiciary and executive functions with minimum and symbolic ritual functions, BE-DYANGO is the chief priestess of the Bene-Mukuni of the Nshyungu Branch dealing with cases of land tenure and distribution, birth and death reports and all religious issues, hence she organises ceremonies connected with rain making, death rituals, epidemics and general prayers to the ancestors in times of Social stress.

The role differentiation has a structural significance, maintaining a dual composition in matters affecting the Bene-Mukuni Nshyungu society.

The Munokalya’s functions are counter balanced by those of the BE-DYANGO. Absolutism on the part of the Munokalya is kept in check; the female sex generally regarded, in most of African cultures, as of a lower status than the male sex is elevated by the representation they are given in this society through BE-DYANGO and her underlings- Bana be Dyango and Basimuse.

BE-DYANGO, who deals with the ritual life of the community, unlike Munokalya, has nothing divine about her. Her ritual power ceases with her death or removal. That this is so may be proved by the fact the this society’s religious concepts do not postulate divine beings other than dead male Munokalyas headed by a supreme being, Leza. All prayers are addressed to the Munokalya, who in turn intercedes to Leza for the people and ensure that the pleadings and wishes of their people are not ignored or unfulfilled.

Whereas Munokalya Mukuni plays a symbolic role in ritual life and an active one in the realm of the dead, BE-DYANGO play an active role in the here and now ritual matters. Her activities extend to the spheres of war, epidemics, royal successions, deaths and births. Only BE-DYANGO has the right to admonish Munokalya Mukuni for his daily errors of omissions and commissions in the day to day running of Royal office.

In that sense there is no room for absolutism on the part of the Munokalya Mukuni’s rulership.

BE-DYANGO, sitting in council with her conclave consisting Bana-Bedyango (Regional Matriarchs), Basitusiansia (Religious and Cultural officiants) and Basimuse (Village Matriarchs), determine tribal practices, norms and traditions. Thus they constitute traditional Legislature.

Where as the Munokalya may leave office only through death coming either naturally or induced by BE-DYANGO in consultation wit the Royal Establishment, BE-DYANGO may leave office either through death, voluntary or through forced resignation and in this event, she hands instruments of power to the Munokalya on Ntantala at the behest of the Royal Establishment.

In August, we’ll show PF what it feels like to be in pain – Museum workers

THEY can threaten us but come August, we will ensure we show the PF government what it feels like to be in pain, museums workers vow.

Responding to an internal memorandum written by the National Museums Board (NMB) acting director general Bevine Sangulube dated April 16, museum workers in Livingstone, Choma, Mansa, Ndola and Lusaka, who spoke on condition of anonymity via a zoom meeting, said musicians and PF cadres were living comfortable lives than public workers under President Edgar Lungu.

The workers who are affiliated to the University of Zambia and Allied Workers Union (UNZAAWU) have since been forced to cancel their intended sit-in-protest which was scheduled to commence Monday.

“We had intended to go on a sit-in-protest until the PF government paid us our salary arrears accrued as far back as 2016. We have seen what the director general wrote and our translation of her words is that they are threatening us with disciplinary action and after seeing a lot of public workers being fired by President Lungu in national interest, we fear for our families,” the workers complained.

“But the question is; for how long will we have to wait? Parliament is dissolving next month and they, as PF, will start campaigning for our votes. So they can threaten us now, come August we will ensure that we show them what it feels like to be in pain,” another worker said.

Workers also wondered when the matter regarding their salary arrears would ever be resolved, which had dragged for years.

“We, however, want to advise them to resolve it as soon as possible failure to which we will ensure that all of us in the NMB turn to the ballot paper for a solution. How on earth can a musician who sings PF songs and a cadre who does nothing be eating three meals per day while us public workers, taxpayers live in squalor?” another worker asked.

Dr Sangulube in her internal memorandum said the permanent secretary in the Ministry of Tourism and Arts advised against workers proceeding on a sit-in-protest, “as it is illegal and will attract disciplinary actions. We advise that unionised workers wait for the matter to be resolved.”

She told UNZAAWU general secretary Moonga Mupuma that resorting to industrial action when the ministry was making efforts to resolve the matter was not the best.

“NMB and the Ministry of Tourism and Arts understand and sympathise with the challenges that your members face caused by non -payment of accrued salary arrears from 2016 to 2019 respectively,” said Dr Sangulube in the memorandum to the union.

PeP STATEMENT No. 29 ISSUED ON WEDNESDAY, 21st APRIL 2021: FOR IMMEDIATE RELEASE

1. As Patriots for Economic Progress (PeP) we have noted with regret the decision by the main opposition United Party for National Development (UPND) President Mr Hakainde Hichilema to confine himself to his house for fear of being arrested. Our view is that being an opposition leader in Africa, being arrested from time to time is a normal occurrence and each arrest needs to be dealt with as and when it occurs. Therefore, it is a wrong approach for any opposition leader to impose house arrest on themselves for fear of being arrested.

2. As Patriots for Economic Progress, we wish to remind Mr Hakainde Hichilema that, as main opposition leader, a lot of Zambians look up to him for alternative national leadership. Therefore, this is a time for him to show courage and resilience as he has always done in the past. He must therefore consider spending less time in his house on Twitter and Facebook and more time on the ground meeting the people, listening to their problems and offering them hope and help.

3. As Patriots for Economic Progress, it is our considered view that if the Government wanted to arrest Mr Hichilema, they would do so regardless of the youths that are said to have camped at his house to “protect” him from a possible arrest. Therefore, it is a waste of time and energy for Mr Hichilema to confine himself to his house and surround himself with party youths as a way of preventing a possible arrest.

4. As Patriots for Economic Progress, it is also our considered view that when the State wants to arrest you, it is your duty as a law abiding citizen to submit yourself to such an arrest and not resist it. Resisting an arrest can have dire consequences and should not be encouraged, no matter how convinced someone is that they are innocent. As leaders of a civilized nation, we need to allow the due process of the law to take its course at all times. Therefore, the decision by Mr Hakainde Hichilema to mobilize youths at his house for the purpose of fighting off a possible arrest is not only wrong politically, but also reflects a lack of respect for the rule of law by the UPND President.

5. As Patriots for Economic Progress, we wish to take this opportunity to remind the UPND leader that he is not the first opposition leader to be arrested by the Government. The late former President Michael Sata, while still in opposition, was arrested several times by the then MMD Government. Each time, Mr Sata submitted himself to an arrest without instructing his youths to fight off those seeking to arrest him. That is because Mr Sata knew that if he sought to be President of Zambia, then he must respect its laws and due process. Therefore, Mr Hakainde Hichilema should stop conducting himself like a rebel leader and start conducting himself like an aspiring presidential candidate of a democratic republic. Otherwise his reckless conduct has the potential to destabilize the nation, especially during this volatile election period.

Chad: President Idriss Deby’s State Funeral Set for Friday

Chad President Idriss Déby Itno State funeral will take place on Friday, military officials announced on Tuesday, hours after news broke of his death on the battlefield.

Mr Deby, President of Chad since 1990, died on Tuesday, a day after leading his army’s fighting against rebels. Officials said he died from injuries sustained in the Monday morning attack.

The shock announcement came only the day after the 68-year-old was proclaimed the winner of a presidential election that had given him a sixth term in office.

A statement from the new military council that took over after his death said the funeral will take place “in the presence of heads of state and government of friendly countries”.

It will be held in Ndjamena, the capital, before his burial in his native region in the far east, the presidency said.

The countries were not named but Chad has enjoyed close relations with neighbours Cameroon, with which it shared an oil pipeline, and Nigeria with which it shared a counterterrorism programmes alongside other neighbours in the Sahel region.

Condolence messages

Among those who eulogised Deby was Félix Tshisekedi, President of DR Congo and current President of the African Union.

President Tshisekedi said he was “appalled” and that the death is “a great loss for Chad and Africa as a whole”.

The African Union also sent a condolence message, calling Deby an pan-Africanist.

“The late President played a key role in promoting the African Union’s agenda to promote peace and security, and was an ardent supporter of the union’s efforts to create an environment of security and stability, especially within the Sahel region,” it said in a statement.

“The African Union stands in solidarity with the government and the people of Chad during this difficult time and joins them in mourning the loss of a champion of Africa’s endeavours to provide a peaceful, secure and stable continent.”

Deby’s former Foreign Minister Mousa Faki Mahamat is the current Chairperson of the African Union Commission, the secretariat of the continental bloc based in Addis Ababa.

France’s message

The French presidency said Deby was a “courageous friend” of France and a “great soldier” who worked tirelessly for the security of his country.

The statement from the Elysee Palace also emphasised the importance of “stability and territorial integrity” for Chad while urging that the post-Deby transition take place in “peaceful conditions”.

Following Deby’s death, the army suspended the government, the Constitution and Parliament.

The army has also installed Mahamat Deby, the son of the slain leader, as the country’s President for 18 months.

Freshly re-elected for a sixth term, Deby succumbed to injuries while leading army operations in the face of a rebellion from Libya, as confirmed by the Chadian army.

Police is dysfunctional with no credibility – Prof Ndulo

MUNA Ndulo says government officials should be made to account for the injustices committed against citizens by police officers.

The US-based constitutional law professor says the conduct of the police in Zambia in the last five years has been pathetic.

He says there is no way the State can run away from illegal acts of its agents such as the police.

“In the advent of a change of government, we must make those under whose watch violence was perpetrated and people were denied their rights accountable,” he said in a write-up titled ‘Political violence in Zambia and the police: a tale of weaponised and politicised Police Service’. “That is the only way Zambia will cross the bridge from dictatorship to a new society that respects human rights and dignity of all people regardless of their tribe, colour, gender, and political persuasion. The country cannot tolerate these wrongs, because it cannot survive their being repeated.”

He expressed concern that police violence has intimidated citizens to a level where they can no longer speak out.

Prof Ndulo cited incidents where police have killed and maimed citizens without being punished for such injustices.

“It is sad that in today’s Zambia the people are afraid of their government and its violent surrogates who are inflicting violence and anguish on people who are merely exercising their constitutionally guaranteed rights of freedom of speech and assembly,” Prof Ndulo noted. “In terms of the future, we advocate that those that bear the gravest responsibility for the violations (the leadership in the police and government) must be held accountable if not now in the future whenever the future permits if respect for human rights is going to underpin our democracy now and in the future.”

He dismissed police claims of carrying out investigations on cases where they already have evidence.

“In the last five years, Zambia has witnessed escalating levels of political violence. The violence is typically perpetrated against those expressing opposite views to those of the Patriotic Front party (PF) and its government. Persons perceived to be opponents of the government are brutally assaulted, and their meetings disrupted,” he noted. “Cadres use violence against customers to demand levies from markets and bus stops. Shamefully, the police are at times the targets of these vigilantes. Horrendous acts of violence in the form of gassing innocent citizens have taken place without any serious investigation by the police. The police with impunity have killed opposition party members.”

Prof Ndulo noted that all “these things happen while police look on”.

“All this is happening while an incompetent and highly compromised police command looks on. Indeed, the deterioration of the police as an institution affects all aspects of Zambian life,” said Prof Ndulo. “What clearer evidence of the collapse and partisanship of the police do you need than a police force which instead of ensuring citizens are enjoying their rights deploys its resources on pursuing a private allegation of fraud against an opposition leader at the behest of a delusional new ‘lawyer’ in town who defines fraud in a manner that even a first-year law student would recognise as fundamentally flawed. The truth is the Zambia Police Service is dysfunctional and has lost credibility with the public. It is perceived as weaponised by the government in their efforts to harass and intimidate opponents.”

Rebels vow to take capital after Chadian president killed

Chad’s president of three decades died of wounds suffered during a visit to front-line troops battling a shadowy rebel group, the military announced Tuesday, just hours after he was declared the winner of an election that would have given him another six years in power.

While the military quickly named President Idriss Deby Itno’s son as the country’s interim leader, the rebel group claiming responsibility for his death vowed to continue its fight for the capital — setting the stage for a potentially bloody battle for political control of the oil-producing central African nation.

“Chad is not a monarchy. There can be no dynastic devolution of power in our country,” the rebels said in a statement late Tuesday. “The forces of the Front for Change and Concord are heading toward N’Djaména at this very moment. With confidence, but above all with courage and determination.”

The circumstances of Deby’s death remained murky and some observers immediately questioned the events leading up to Tuesday’s stunning announcement, raising the question of whether the military handing over power to Deby’s son instead of following the constitutional provisions in place amounted to a coup. Others raised fears of violence in the days to come.

“There is a great deal of uncertainty around how events in Chad will unfold: Whether the army will stay loyal to Deby’s son and continue the effort to repel the advancing rebels?” said Cameron Hudson with the Africa Center at the Atlantic Council.

Chadians fed up after 30 years of Deby’s rule could also align with the calls for change, he said.

“Either scenario presents a high risk of civilian casualties and a likelihood that fleeing civilians or soldiers could export Chad’s instability to neighboring states.”

Deby’s 37-year-old son, Mahamat, is best known as a top commander of the Chadian forces aiding a U.N. peacekeeping mission in northern Mali. The military said Tuesday he now will head an 18-month transitional council following his father’s death.

However, Chad’s constitution calls for the National Assembly to step in when a president dies while in office.

The military called for calm, instituting a 6 p.m. curfew and closing the country’s land and air borders as panic kept many inside their homes in the capital, N’Djamena.

“In the face of this worrying situation, the people of Chad must show their commitment to peace, to stability, and to national cohesion,” Gen. Azem Bermandoa Agouma said.

The circumstances of Deby’s death could not immediately be independently confirmed due to the remote location of the fighting.

The government has released few details of its efforts to put down the rebellion in northern Chad, though it did announce Saturday that it had “totally decimated” one rebel column of fighters.

The rebel group later put out a statement saying fierce battles had erupted Sunday and Monday. It released a list of five high-ranking military officials who it said were killed, and 10 others it said were wounded, including Chad’s president.

The army only said Tuesday that Deby had fought heroically but was wounded in a battle. He was then taken to the capital where he died of unspecified wounds.

The United Nations has about 1,800 staffers in Chad and spokesperson Stephane Dujarric said in New York that the U.N. was “watching the situation hour by hour.”

Some residents of the capital said they feared there was more to the story of Deby’s demise.

“The rumors that are going around about the transitional council give me the impression that some information is false,” Thierry Djikoloum said. “They are already talking about dissolving parliament … So for me, I’d say it was a coup d’etat. He was killed.”

Some foreign observers also questioned how a head of state could have been killed, saying it cast doubt on his protective guard. The Chadian military has only acknowledged five deaths in weekend fighting in which it said it killed 300 rebels.

“We still don’t have the whole story,” Laith Alkhouri, a global intelligence adviser, told The Associated Press. “It raises concerns regarding the security forces’ assessment of the clashes and their intelligence regarding the severity of the situation.”

Deby, former army commander-in-chief, was a major French ally in the fight against Islamic extremism in Africa, hosting the base for the French military’s Operation Barkhane and supplying critical troops to the peacekeeping effort in northern Mali.

French Defense Minister Florence Parly expressed her condolences to the Chadian people, in a news conference with her German counterpart in Paris.

“What’s central to us now is that a process of democratic transition can be implemented and the stability of Chad preserved,” she said.

“For the rest, she added, French authorities need “a bit more time” to analyze the situation.

Earlier, the French presidency called Deby “a courageous friend.”

Chad is losing “a great soldier and a president who worked non-stop for the security of the country and the stability of the region for three decades,” it said in a statement.

Deby first came to power in 1990 when his rebel forces overthrew then-President Hissene Habre, who was later convicted of human rights abuses at an international tribunal in Senegal.

Over the years Deby had survived numerous armed rebellions and managed to stay in power until this latest insurgency led by the Front for Change and Concord in Chad.

The rebels are believed to have armed and trained in neighboring Libya before crossing into northern Chad on April 11. Their arrival came on the same day that Chad’s president sought a sixth term in an election several top opposition candidates boycotted.

There seem to be belief among people in both the Patriotic Front and United Party for National Development that, this year’s election is just a two-horse race. Many political spectators share this view.

I hold a different view. I think there is a third force which on face value looks too insignificant but in reality, is a force that may shock people during elections.

While there exist many parties doing some sort of mobilization activities, the mere actions do not confirm the effectiveness of such. You can take part in a race but is your speed and subsequently, your prowess enough to win you that race?- is my question. From the look of things, it is like Socialist Party is growing at unprecedented speed. They have finished adopting all candidates from councilor to Member of Parliament in due course than every other party. They have all of the sudden registered visibility in all the parts of the country. And what is more is that, they have structures all across the country.

Their pioneer Dr. Fred M’membe has on several times said that he would rather spend more time talking to people in communities and rural parts than spend his time on radios and televisions being interviewed. This seems to be working.

One greatest gift we cannot take away from M’membe is the fact that, the man is a great thinker and a strategist. Save for his shortcomings, you do not underestimate M’membe. He is that one person who will accept to lose the battle in order to retreat and regain composure then strike you hard to win the eventual war. The man may turn out to be a serious problem for both PF and UPND.

The greatest strength, it seems, that forms the basis of Socialist Party’s sudden visibility in across Zambia is the numerous roots of Fred M’membe. He identifies himself with the Lozi where his mother comes from. He is also Bemba where his father come from. The man has Tonga blood where one branch of his grand parents hail from. Then, he has traces of Northwestern blood. He can fluently speak languages found in all these provinces without difficulty.

Underestimate such a person at your own peril.

48 houses owners drag ACC back to court after discontinuing matter

TANZANIAN Uziel Bashire and three others claiming ownership of the 48 houses have recommenced the matter in which they are challenging the seizure of the said properties in the Lusaka High Court by way of originating summons.

Bashire, his cousin Zuberi Bigawa and Zambian Charles Loyana, a senior accountant at the Ministry of Finance, have sued ACC for forfeiting their property to the state, seeking a declaration that Loyana had and has a requisite power and authority to purchase, possess and own property in his name for his own benefit and any other person.

They want damages for breach of Statutory duty imposed on ACC in that the arbitrary seizure and continuation of holding on to the properties despite the claim made by the rightful owner was a breach of that duty and was unlawful and illegal.

The trio is seeking an order that Bashire had an interest in the properties bought by Loyana and the latter as the purchaser of the 48 houses be granted possession of the same.

The plaintiffs want an order that ACC accounts and pays Bashire or Loyana all the rentals from the date of seizure to the date of the order or in the alternative mesne profits.

According to an affidavit in support of originating summons, the plaintiffs explained that in 2011, Bashire decided to invest in real estate in Zambia.

They said upon acknowledging that Bashire was not qualified to own property in Zambia in his own name because he was a foreigner, he decided to partner with Loyana, who qualified to purchase and own land in Zambia, and that Bashire would fund the purchase of land and construction of estates.

“Through a Power of Attorney dated November 25, 2011, he (Bashire) appointed his cousin Bigawa and gave him power to nominate and delegate to a trusted Zambian to purchase and develop real estate properties in Zambia for which Bashire would have interest and would in future be the beneficial owner and or subsequently as an absolute owner, while upon purchase, Loyana would own and possess the properties,” the three claimed.

Bashire, Bigawa and Loyana stated that it was agreed by all the parties that Loyana would receive a commission of 5 percent for any property purchased and register and own the properties in his name or any nominees.

The plaintiffs said Loyana received K60,000 from Bigawa on May 26,2012 which he paid to lombe Bwalya and associates to buy plots 36 H and I at K30,000 each.

They said on May 29, 2012 Loyana was given K120,000 by Bigawa to Pay Lombe Bwalya and Associates to buy plots 36 N and O and 36 D and E.

Loyana on July 23, 2012 received K885,000 for the purchase of more plots where the 48 houses are erected.

The plaintiffs said Loyana’s wife Susan Sinkala assisted to apply for connection of electricity at Zesco for 24 units which were registered in her name.

Bashire, Bigawa and Loyana said Chali Chitala, a Kitwe based lawyer, was paid K200,000 to register ownership of the property in favour of Bashire.

The plaintiffs said that on August 24, 2018, the ACC issued a gazette notice to Loyana and six others, his wife, Chitala, Bruce Shikakhu, Messers Lombe Bwalya and Associates, Ishmael Zuneid Yousuf and Khankara and company, where ACC claimed the properties had different plot numbers adding that they had been recovered during investigations and would be forfeited to the state if no one claimed the houses within three months.

The plaintiffs said in 2019 they learnt, through the newspapers, that ACC director general Rosemary Khuzwayo, during an interview revealed that Chitala had disowned the properties and ACC had taken over the 48 houses.

They said Loyana and Bashire were interviewed by ACC to which Bashire said the 48 houses belonged him as he was the beneficial owner of the same but ACC has continued holding on to his houses without legal justification despite a claim being made.

They stated that ACC had arbitrarily continued holding on to the properties illegally and without any lawful justification, despite Bashire explaining that he had interest and was to be the beneficial owner of the properties, and that they were purchased through Loyana.

“Bashire, through his lawyers then Messrs Hobday Kabwe & Co. wrote to ACC twice requesting for removal of the seizure notices on the properties in Chalala but the defendant has neglected, ignored and or refused to hand back the properties to the owners and they continue to claim that they do not know of any owner, when in fact they had been aware of how the properties were purchased by Loyana from Messrs Lombe Bwalya and Associates, and the existence of the claims made to them from the time they issued notices related to the said properties, and that the claims were made within the period prescribed by law,” said the three.

Bashire, Bigawa and Loyana are further seeking a determination on whether ACC did not breach the statutory duty imposed on it by section 60 of the Anti-Corruption Commission (disposal of recovered property) Regulations, 2004 and all other enabling laws, by purporting to forfeit the 48 houses to the State despite the owners claiming the properties.

They want a declaration that ACC breached the statutory duty imposed on it by section 60 of the Anti-Corruption Act Regulations 3 of the Anti-Corruption Commission (disposal of recovered property) Regulations 2004 and all other enabling law by forfeiting the 48 houses to the state notwithstanding there was a claim of the properties by the owners.

The composition of aspiring Parliamentary candidates in this year’s election tells so much about how National Assembly as a law making institution has been reduced to something that any type of characters can occupy.

A very long time ago, to be called an Honorable was something that came with value. Those days, those who managed to go to Parliament were persons of high moral fabric and people you would look up to as a moral campus in our society. Today, we cannot say the same about our Parliamentarians or those aspiring to become one.

If, for all intent and purposes, a party like the Patriotic Front (PF) can settle for a person like Iris Kaingu to represent the people of Mwandi Constituency in Parliament and make laws that govern this country, then what sort of moral fabric can we reasonably expect from Parliament?

We mean not to sound anachronistic and holier than thou but opting to adopt Iris to represent a section of our society is disgraceful. This is someone whose behavior, character and history isn’t attuned with the integrity that National Assembly demands. Iris has no integrity worth talking about.

If a person of Iris’s caliber can be selected as the best contender to represent people in Parliament and to make laws for this country, then, there is no honor due to Parliament and those occupying it. When they are discussing issues to do with pornography and how to curb it, what will be Iris’s own contribution? When they are discussing about punishing offenders who stripe and flaunt naked pictures of their bodies, what will be Iris’s own contribution to all this?

No doubt PF has cheapened the bar by adopting Iris to represent the people of Mwandi. Of course none has no sin. Everyone, other than divine authority, is imperfect. However, imperfection should not be misinterpreted for immorality. The things that Iris has done in the recent past are immoral and have nothing to do with man’s imperfection in the eyes of divine authority.

We should not reduce our law making house to such nonsense. If Iris is okay for the PF, let it remain like that for themselves but not for Zambians. These are our honest views and we are entitled to them. If Zambians in general and people of Mwandi Constituency in particular feel such a person with a stink of pornography is okay to lead them, who are we? If electing Iris to Parliament is something that they are okay with, The Candidates can only watch in despair how cheap Parliament is becoming in Zambia.

Prophet Embarrassed By Baby Mama During Wedding To Pregnant Fiance

There was drama over the weekend when a self-proclaimed prophet was embarrassed by his baby mama who gate-crashed his wedding to his pregnant fiance.

25-year-old Ezekiel Rufaro Chivasa of the Rehoboth International Ministries church whose father is also a prominent clergyman was getting married to his sweetheart, Tafadzwa Mukanganga who is reported to be pregnant.

News of the pending nuptials appears not to have gone down well with Chivasa’s baby mama Jacqueline Mbangami. The two have a child together who is now 2-years-old. According to Jacqueline, the man of the cloth has been neglecting the child and not sending any money for his welfare

Mbangami and her relatives gate-crashed the wedding ceremony just before the two lovers were about to say their wedding vows. The wedding ceremony was taking place at the home of Prophet Chivasa’s in-laws in Budiriro.

Presiding marriage officer, Bishop Jerdan Paradise, was forced to halt the proceedings as the Mbangami family laid out their grievances. During this time, the Bishop asked the DJ to entertain the wedding guests with music as he tried to resolve the issues.

In the end, the Bishop had a meeting with the Chivasa and the Mbangami families. The groom was forced to leave the wedding ceremony to attend to this impromptu emergency family meeting.

Members of the Chivasa family professed ignorance saying that they had no idea that Ezekiel had a two-year-old child. They insisted that they were just as shocked as everyone else to learn of the child.

Some members of the Chivasa family initially moved for the wedding to be stopped and held at a later date after the prophet had resolved his issues. However, this was vetoed due to the huge costs already incurred in hosting the wedding on Saturday.

In the end, the Chivasa family paid a fine of US$500 to the Mbangami family to be allowed to continue with the wedding ceremony. According to local publication, H-Metro, the Chivasa family also pledged to support the two-year-old baby going forwards and to meet some of the costs which the Mbangami family had incurred in the last two years.

After almost half an hour of negotiations, the wedding ceremony was resumed with the blessing of the Mbangami family.

Award-winning gospel musician Jonah Chivasa who is the prophet’s brother said that the family was deeply embarrassed by the events which transpired. He told H-Metro,

“We nearly cancelled the wedding date and his unresolved issues have left us with egg on face especially for my father who is a pastor and myself as a musician.

“The incident has affected our mother more considering that she has not been well for the past months.”

Speaking after the wedding ceremony, Jacqueline made it clear that she never intended to stop the wedding ceremony. She said that she only wanted to highlight that Prophet Ezekiel was delinquent in not taking care of his child.

“We did not come with the intention to stop the wedding but took the opportunity to seek attention because Ezekiel has not been supporting the child for the past two years.

“Ezekiel only facilitated the acquiring of the child’s birth certificate and that was that; kwavakutozonzwa kuti akaitisa Tafadzwa mimba saka mai vake varikuda muchato nekukasira.”

South African teen commits suicide after video of her being bullied goes viral

A 15-year-old South African student, who was assaulted by her fellow mates in school, reportedly took her own life after the video of the bullying incident went viral, local news outlet TimesLIVE reported.

The deceased teen, identified as Lufuno Mavhunga, was a student at Mbilwi Secondary School in the province of Limpopo. The South African Human Rights Commission (SAHRC) and the victim’s brother told the news outlet she was assaulted by the two bullies after one of them took issue with Lufuno blocking her on WhatsApp and Facebook. The deceased teen took that action because the bully had been sending her insulting messages on both platforms.

In the video of the April 12 incident, the two bullies are seen confronting Lufuno with one of them slapping her multiple times. Lufuno is seen trying to shield herself from the abuse and is heard telling the bully, “You are hurting me.” The bully, however, disregards her pleas and continues beating her. During the assault, other students who witnessed the incident can be heard cheering the bully.

In the aftermath of the assault, the victim’s brother, Dakalo Mavhunga, told TimesLIVE she contacted him crying and narrated what had transpired. She also told him she might have failed a test because the assault left her devastated. The school’s principal allegedly did not pursue the issue after it was also reported.

“When she explained the incident to me she sent me a WhatsApp message and I felt that when I knocked off [from work] I should call her. She kept on sending texts … crying. I told her I would try to call her,” Dakalo said.

“I asked her what was happening and she said no-one even tried to help. When I called her she told me she couldn’t write and thinks she failed and the school didn’t get involved. The principal was told about the issue but he didn’t attend to the matter.”

Following the assault, authorities said Lufuno went home and overdosed on tablets. She was later found unconscious by her mother. “The victim reportedly went home in the afternoon and, on arrival, locked herself in the room and consumed an overdose of tablets,” Police spokesperson Brig Motlafela Mojapelo said. “She was apparently found by her mother lying unconscious and was taken to Siloam Hospital, where she was certified dead on arrival.”

The 15-year-old bully was arrested two days after Lufuno’s death. “The arrested child will be dealt with in accordance with the Child Justice Act,” Mojapelo added.

Authorities also said the perpetrator was a serial bully and had been involved in previous altercations. “The perpetrator was involved in fighting before. She is known to be a bully and started this [behavior] while she was still in grade 8,” office manager for the South African Human Rights Commission in Limpopo, Victor Mavhidula, told TimesLIVE.

Mavhidula added: “What we are going to do is to get more information. We also want to investigate if the department of education was aware of this incident and what is it that was done, because if a learner assaults somebody the principal or teachers must assist the learners to open a case with the police and that was not done. The principal was aware that there was a fight.”

Meanwhile, Lufuno’s family said they want justice for the deceased teen. Her brother, who said her name means “love”, described her as a peaceful person. “She was a very peaceful person and she had love, as her name suggests. She didn’t fight back when she was being slapped, she only tried to explain. But the girl didn’t even give her a chance,” Dakalo said. “As a family all we want is for Lufuno to find justice from what she has faced, maybe after that her soul will rest in peace.”

Lufuno was buried on Saturday.

ARRESTING INNOCENT CITIZENS BY GUESS WORK AND ASSUMPTIONS -IS IT HIDING OR ABDUCTION?

The behaviour by some police officers to accept to be used as political tools will one day backfire- do not say you were not warned.

what a politician does in times of vengeance has no regard to who sent you but sweeps through all those who were part of the scheme.

We are looking for men and women in uniform of high integrity. Men and women who cannot be bought, men and women who are ready to resign for purposes of defending this country’s democracy. In any case, nobody has ever died of hunger after resigning on moral grounds.

The idea to arrest the Queen ,Mukuni is a serious indictment on the traditional leadership of this country.

Sadly, many traditional leaders are quiet- they are allowing it…soon it will catch up with them. This is very unfortunate. Today, it is Queen Mukuni ,tomorrow it will be Queen Mpezeni, Kazembe, Musele or Litunga etc.

We are ,undoubtedly ,sowing a seed of discord in the country by drawing the traditional leadership into our spheres of political blackmail.

Let me draw my inference from social media discussions as a cause of the arrest …that there are issues of the Hatembos….From whatever angle you look at it, the Hatembo matter is a political matter aimed at getting to HH ,but it is now sour grapes. This is a political maneuver which ,for some people, must be sustained for political expedience . But it is a failed project from the point of law.

Let us assume, police have got it right on Queen Mukuni; the first question would be , is it abduction or hiding? Let us assume police got it right on Sejani, and Mazabuka Mayor, the question still remains- is it abduction or hiding?

These are critical questions the people pursuing the matter must answer.

The other question which begs an answer is… are the Hatembos criminals ? who wants them seen at all cost?

Only ECL can answer these questions …

It is difficult for a lawyer to decipher the project aimed at stifling the national election agenda; It is a costly exercise which President Edgar Lungu must calculate very well, if at all he has advisors.

If ECL handlers have done a survey like some of us , across the country, to ascertain the political atmosphere , he will immediately drop the agenda being propagated and then seek for truce and reconciliation.

Under the circumstances, what is being done is an experiment in futility. ECL must start redeeming the lost time and reunite the country. The approach those power hungry handlers are giving him is too costly to explore.

Further, you cannot force a court process against opponents using political gymnastics. Let lawyers be lawyers, let politicians be politicians., and let the corrupt remain in corruption. Corrupt people must pay as such.

ECL should not accept to carry the cross of other people who willfully engaged themselves in dirty activities; cilamuntu neciwa cakwe.

The political upheaval some police officers are embroiled in is failed blackmail. we must sober up as a country and practice politics of integrity. we cannot continue sowing terrorism in a country for the sake of our political survival.

Millions of Zambians are living in abject poverty, yet government is not giving any hope to the ailing economy. Citizens are hoping for salvation from above ,as many strategies have been overtaken by politics.

Government have exhausted their economic strategies- they have no solution to Zambia’s debt mountain. and they have failed to engage the international financial institutions. This failure to run the country has brought fear and anxiety in view of the fast approaching general elections.

ECL and friends are so scared of losing power and now believe their future lie in a political crack down of opponents. In Southern Africa, no country is run that way.

The earlier ECL and friends prepare for a possible exit in August ,the better for themselves. They need to start redeeming time and start reconciling with their opponents.

Our biggest enemy in Zambia is poverty and not political opponents.

The new Nathan Chanda Police Post started in a container which was donated by Roan Antelope Mining Corporation Plc (RAMCOZ) in 2000.
The donation of the container was necessitated by the community outcry due to an increase in criminal activities such as stealing of merchandise in Roan market, violence, burglary, sabotage of Zesco installations and other related activities within the community of Roan township.

It was at this point that the then major corporating partner, Roan Antelope Mining Corporation of Zambia Plc (RAMCOZ) through it’s Corporate Social Responsibility came to the aid of the community and donated the container which was then modified to provide for a temporal compulsory holding cell and a reception by Zambia Police.
Fast forward in 2012, Cllr Nathan Chanda, was elected as Councillor for Lumumba Ward 17, and subsequently voted as Mayor of Luanshya at a age of 25; breaking history as the youngest mayor ever in the history of Luanshya.175524423_2907767309490252_1622027466568370820_n
When he assumed office of Luanshya Mayor, Cllr Nathan Chanda realized that the population of Lumumba Ward 17 and Roan Township in general had grown significantly, and therefore, saw the need to construct another police post to help curb the increasing rise of reported criminal activities around the market and in the community as a whole at the time.
Arising from the foregoing, the mayor expeditiously engaged the local authority to seek land upon which the police post would be constructed.

A few months later land was identified by the local authority and accordingly to Lumumba Ward Development Committee for the construction of the police post.
Within the same year, the project was implemented by the Lumumba Ward Development Committee in conjunction with the His Worship Nathan Chanda.

FUNDING OF THE PROJECT:
The construction of Nathan Chanda Police Post was solely funded by the current Luanshya Mayor, His Worship Nathan Chanda using personal resources.

However, the mayor along the way run out of resources and decided to engage a corporating partner, CNMC-Luanshya Copper Mines Plc (CLM), who unhesitatingly took over the works and completed the structure.

Meaning, therefore, that the project was jointly funded by His Worship the Mayor of Luanshya, CNMC-Luanshya Copper Mines through it’s Corporate Social Responsibility and CNMC-Luanshya Copper Mines which contributed more than half of the total cost of the project.

NAMING OF THE POLICE POST:
In coming with the most suitable name for the police post, Lumumba Ward Development Committee after a tedious series of seatings unanimously resolved to name the new police post after the current Mayor of Luanshya, His Worship Nathan Chanda.

However, when mayor Chanda got wind of this development, he vehemently objected the idea citing volatile and animosity in the political atmosphere of Luanshya in which even projects meant to benefit the same residents are unnecessarily politicised.

Nonetheless, the seemingly determined and decided Ward Development Committee discreetly applied to Zambia Police Command for the approval of the name “Nathan Chanda Police Post”.

The mayor was only informed of the approval of name by Zambia Police by the Ward Development Committee on the eve of the official opening and subsequent hand over.

RECOGNITION OF OTHER UNSUNG HEROES:
During the official opening and subsequent handing over of the police post to government, His Worship Nathan Chanda reassured residents that all those that have served the people of Luanshya in different portfolios, whether dead or alive, will still be recognized in a similar manner through various projects that government and the local authority have continued to construct in the district.

“In my initial speech, I thanked the Ward Development Committee for naming the police post after me. Indeed this is how it should be because from time immemorial, we have been wrongly conditioned to only appreciate someone when they are dead and then give very long speeches at the burial. For example, we are building a first ever school in Chisokone which I would personally like to be named after our fallen heroes such as Late Cameroon Pwele and others,” said Mr. Chanda.

In my conclusion, starting from the time the community started using the container as police post, Roan Constituency has had six members of parliament none of whom ever bothered to rectify the situation. These former and present members of parliament include, Hon Vernon Mwaanga, Late Cameroon Pwele, Hon Joseph Chilambwe, Hon Chishimba Kambwili and last but not the least the incumbent Hon Joseph Chishala.

Wife to an outspoken Zambian Monarch, Senior Chief Munokalya Mukuni XIX, Veronica Mukuni, has been detained by the Zambian government in unclear circumstances but suspected to be connected to her husband’s vociferous crusade, against President Edgar Lungu’s escalation on human rights abuses and corruption.

Queen Veronica a dashing woman in her early forties, was issued a Police call notice early Monday, for what the Livingstone Police claimed was a routine interview, but never reported back to the Palace, and according to reports by witnesses, by evening was bundled into a Police vehicle and driven the whole night to Zambia’s Capital Lusaka, 500km north of the Victoria Falls City of Livingstone.

The Lion King as he is referred to by tourists, had two days earlier issued a stern communique to the Zambian government, in which he demanded that President Edgar Lungu allow his main political rival Hakainde Hichilema of the UPND Party, unconstrained guarantee to freedom of assembly and association, to canvass for support from Zambians in the incoming the elections.

In August Zambia chooses new leaders for another five years. The call by the King came in the wake of reports of an impending arrest of Hichilema by Lungu on what many believed would be trumped up charges to prevent the opposition leader from contesting in the election. Hichilema has been detained a staggering 17 times by government.

Zambian lawyers are currently entangled in a controversial constitutional debate that casts legitimate doubt on Lungu’s eligibility to run for another term of office. The President has been sworn in office twice and according to the constitution, the third run would violate the law that limits the terms to two.

President Edgar Lungu has been accused of unbridled corruption and intolerance against political opponents, and many abroad fear Zambia is sliding into a full blown autocracy and on the brink of losing her democratic ranking that she has held in Africa since the 90s. Coupled with dictatorship, Zambia’s economy is on its knees with inflation galloping at plus minus 22%.

And the traditional leader says he shall soon reveal his past efforts to have Zambia as a nation of peace and unity with the former presidents Levy Mwanawasa and Rupiah Banda.

Meanwhile, Mukuni of Kazungula and Livingstone says he once warned UPND vice-president Geoffrey Bwalya Mwamba when he was arrested at Lusaka Central Police that in an event that Hakainde Hichilema was declared winner of the 2016 elections, he and other traditional leaders in Southern Province were going to stand for President Edgar Lungu or any other PF leader if the UPND was to seek vengeance.

In an interview at his Lumpasa Palace, Mukuni said he had always cherished the values of peace, unity and non-violence just as Nelson Mandela did.

Mukuni said.

He said calls for his degazzetion were absurd because his chiefdom had been in existence even before independence.

“In our tradition, which dates as far back as the 7th Century, a chief can only be replaced upon death either induced or natural…after all I don’t receive any government funding, they stopped a long time,” Mukuni said

He added that he had always been there for anyone close to him when in problems.

“When the Nkosi [Mpezeni, the paramount chief of the Ngonis] had problems with the law, I drove all the way to Chipata and even had an audience with president Levy Mwanawasa”, Mukuni said.

He said what Hichilema was going through could not be equated to what Mandela went through.

“After 27 years, he came and forgave the white regime, that is what I told GBM in cells at Lusaka Central Police. I said if he was to arrest anyone in the PF, I was to be the first to visit them (PF), be it Mr Lungu,” said Mukuni.

“I once visited Banda in South Africa when he was nursing his wife Thandiwe with a message of him running for presidency but he told me he did not want to be a second option always after the death of a Head of State. This was after Michael Sata died because he took over after Mwanawasa’s death.”

Patriotic Front (PF) Lusaka Province Chairperson Kennedy Kamba says chief Mukuni has reduced himself to a political cadre but he will not be allowed to incite violence or to propagate tribalism and divisions in the run up to the August general elections.

He says it is very disappointing that a traditional leader who has been tolerated and respected could issue serious unfounded and unwarranted allegations that the PF government wants to poison the UPND leader Hakainde Hichilema.

Mr Kamba who is also a member of the Central Committee says he traditional leader further alleged, in a statement and a sound recording that the PF has been issuing statements claiming that Mr Hichilema is sick.

“This is very disappointing and unfortunate that chief Munkuni could stoop so low and put up such weired allegations and further incite violence through hate speech,” he says.

“The PF has never ever issued a statement about or against the reported illness of Hakainde Hichilem and that’s not even our business.

As a ruling we have no time or any agenda agaist Hakainde Hichilema because we have more important things to deal with that affect peopl’s livelihood,”.

Mr Kamba says the PF under the able leadership of His Excellency President Dr Edgar Lungu has a serious agenda of delivering development to Zambians and has no time for petty politics.

“We have been following keenly the political activities of chief Mukuni of Southern Province with utmost discontent. Chief Mukuni does not mean well for the PF and this he knows deep down his heart. Our plea has always been that chief Mukuni must appeal to his conscience and begin to carry out his duties with due diligence and integrity befitting a Senior Chief.

Leadership requires that we face reality and speak the truth. We should not pretend and do things for news cameras and political rhetoric,” Mr Kamba says.

He says it is sheer hallucinations and futile attempts to paint the PF black by chief Mukuni who is making weird claims that the ruling party has plans to harm Mr Hichilema.

He says this claim is ridiculous.

Mr Kamba says”In our traditional set up, we are all supposed to be chief Munkuni’s children regardless of political affiliation, but look at these hateful claims and attacks that come from chief Mukuni.

Mr Kamba says the traditional leader speaks bitterly on issues without due regard for President Lungu and the integrity he posesses.

The MCC says chief Mukuni has embraced Mr Hichilema of the UPND and do not want anything to do with the PF.

” His language has been of hate and we have asked him on several occasions to apologise to President Lungu over these weird claims he has been making,”he says.

Zambia Police always look the other way when PF cadres are assaulting political opponents – Sean Tembo

1. As Patriots for Economic Progress (PeP), we are saddened by the recent incident in which a senior Civil Servant was harassed by alleged PF cadres in front of the Permanent Secretary of the Ministry of Works and Supply. We have further taken note of the condemnation and arrest of the perpetrators by the Government and Zambia Police Service respectively. We have also noted the denials from the PF party that the perpetrators are not their cadres. Our view on this matter is that for about 10 years now, the PF and its Government has allowed, tolerated and to a large extent facilitated and encouraged its cadres to break the law and harass innocent citizens with impunity and without consequences.

2. As Patriots for Economic Progress, we wish to remind the PF and its Government that it is PF cadres led by their Lusaka Province Youth Chairman that disrupted a panel discussion and harassed participants at Intercontinental Hotel in Lusaka in full view of armed police officers who did nothing. It is also PF cadres led by its then Lusaka Province Chairman that attacked a PeP procession along Cairo Road and assaulted innocent PeP Members with impunity and again in full view of police officers. The PF and its Government should also be reminded that it is PF cadres that stormed the offices of the Law Association of Zambia (LAZ) in Rhodes Park and threatened violence against its then President. The PF and its Government should further be reminded that it is PF cadres led by its Eastern Province Youth Chairman that stormed the Lusaka Central Police Station and assaulted police officers in uniform and got away with only a slap on the wrist by the DPP.

3. As Patriots for Economic Progress, we wish to challenge the PF and its Government to tell the nation what has now changed for them to suddenly start condemning and arresting their cadres when they go on rampage to harass and assault innocent citizens as the case was at the Ministry of Works and Supply. It is important for the PF and its Government to explain to the people of Zambia if they have changed their policy regarding encouraging the lawlessness and impunity of their cadres, because we, the citizens of this nation had gotten used to being harassed and assaulted by PF cadres in full view of the Police.

Most citizens do not even report incidents of lawlessness and violence by PF cadres because there simply is no point in doing so, as no action is ever taken by either the Zambia Police Service or the Government. Therefore, if the PF and its Government have now decided to stop aiding and abetting the lawlessness and impunity of its cadres, then they need to formally inform the Zambia people.

4. As Patriots for Economic Progress, our view is that the PF Government’s policy of using the Zambia Police Service to protect and in some cases facilitate the lawlessness of its cadres in harassing and assaulting innocent citizens is unlikely to have changed.

The actions by the Secretary to Cabinet to condemn the Ministry of Works and Supply incident, as well as the actions by the Zambia Police Service to arrest the perpetrators constitutes mere grandstanding. It is not founded on sincerity and honesty. The only reason why the PF and its Government were compelled to act against the culprits in this particular incident is because they were vividly captured on video and they had no room to deny the occurrence of the incident, as they always do.

5. As Patriots for Economic Progress, we wish to take this opportunity to appeal to President Edgar Lungu, in his capacity as Commander in Chief of the Armed Forces, to have a change of heart regarding the use of the Zambia Police Service to facilitate political violence perpetrated by PF cadres against political opponents in the upcoming general elections.

It is a well documented fact that the Police always look the other way when PF cadres are assaulting political opponents, but when the victims defend themselves, the Police quickly arrest them. It must be noted that the facilitation of political violence by a state organ such as the Zambia Police Service constitutes state-sponsored terrorism. It is terrorism against innocent citizens, on the basis of their political affiliation, and is prosecutable as a crime against humanity by the International Criminal Court. The President must take heed now.

Personally you are one individual, I have always liked and openly stood up even against others, I like too for making you a centre of ridicule and unfounded allegations. Yet I will not shy away from stating things and facts, as I see them with you and you free to do the same about me…. Wasn’t myself for years not a centre of all sorts of malice from both PF and UPND members? Worst of all they both daily used their aligned online newspapers to publicly slander me calling me a UK prostitute and white bum cleaner etc yet with time, consistency, transparency and accountability etc , I triumphed over all of them, because truth always wins? But that does not mean some aren’t still on my back with those same malice…..

Has the person whose behalf you condemning the entire UPND over also told you how she made me and many others such as respectable elders like ba Doreen Mwamba a target of bullying, insults and ridicule etc in WhatsApp groups? Never wanted to listen to any counsel thinking is above everyone else? Is Iris Kaingu cocky, despite the open dent in her past!! Maybe if you removed your bias lenses and do your own underground investigations you will get to know the real reasons your friend lost right from primaries up to the provincial level. Maybe then you will give her the right advise, so that next time she can go about things in a different way, unlike leaving people feeling you are not humble because of having a cocky attitude despite empowering them with eggs😂😂😂😂😂😂😂… Humility is key in every undertaking especially politics. UPND WELCOMES USA DECISION AGAINST RIGGED ELECTIONS AND DICTATORSHIP
The UPND welcomes the US rejection of Yoweri Museveni’s rigged January 14 2021 Presidential elections, and imposition of Visa travel sanctions on those believed to be responsible for, or complicit in undermining the democratic process in Uganda, including the country’s January 14 general elections, and the campaign period that preceded it. The persecution of the main opposition leader Bobi Wine, the ruthless violence against his supporters, the shut down of the internet during the electoral period, and numerous other injustices by the Museveni regime did not go unnoticed by the US Government.

We are encouraged and inspired by the decision taken by the US Administration against the Ugandan dictatorship, for it sends a clear message to those dictators, who like Museveni believe they can fraudulently continue to stay in power through rigged elections. We commend the US decision because it is a warning to dictators that violations of human rights and disrespect for the rule of law shall no longer be tolerated or taken lying down, in a democratic and civilised world. It is an indictment to those dictators, who thrive on persecution of opponents, falsehoods, political violence, and intimidation; and a crystal clear message that such dictators shall bear the consequences of their impunity.

We in the UPND are breathing a sigh of relief, that once again the United States of America under the Joe Biden Administration is beginning to take its rightful place as a key player on the global scene against abuse of power and lawlessness. This is as it should be, for unless clear messages are sent, and action taken against those who thrive on gross human rights violations, disrespect for the rule of law, and persecution of opponents, they will continue to do so with impunity.

For Zambia this is a timely warning as we go through the current electoral period leading to the 12 August 2021 general elections, that the violence, intimidation, human rights violations and abuse of the law which characterised the 2016 electoral period, must not be allowed to show their ugly heads ever again. It is a stern warning that the killings, such as those of Grazier Matapa, Mapenzi Chibulo, and others who lost their lives or got maimed during the electoral period for simply exercising their democratic rights, shall no longer go unchecked.
We are however mindful that unless the international community stands together to speak with one voice, decisions such as taken by the US Administration against the Ugandan dictatorship, shall have challenges in achieving the intended full effect.

We therefore take this opportunity to call upon the rest of the international community to join the US and speak with one voice against electoral fraud and human rights violations, which have accompanied, not only the Ugandan elections, but several other elections on the African continent.

Specifically, as Zambia advances through the current electoral process towards August 12, we call upon the international community to speak with one voice, and to provide the required support to ensure that the electoral process is free and fair, for the sake of peace and stability in the country. The continued persecution of the leading Presidential contender and UPND leader, Hakainde Hichilema by the ruling PF regime must stop, while a repeat of the activities that led to the highly contested 2016 general elections and ensuing post electoral crisis, must be equally prevented at all costs.

Has Lungu appointed three new ConCourt judges as secret weapons in his unconstitutional third term bid?

It is my opinion that President Edgar Lungu has all of a sudden appointed three new judges to the Constitutional Court of Zambia in order to fortify his position in his unconstitutional bid for the third term of office.

Lungu, as always, is on all four cylinders to ensure that he muscles his way to remaining in power using all weapons, open or secret, legal or illegal, constitutional or unconstitutional, known or unknown. It is my opinion that one of those powers he has used or tried to use, is the judiciary centred in the Constitutional Court. I have no direct evidence of his use or attempted use of the ConCourt as his secret weapon to assume power or remain in power. But that direct evidence will one day come out. All I have is educated and speculative circumstantial evidence. Sometimes circumstantial evidence is stronger than direct evidence. Sometimes circumstantial evidence is all you have and by making logical inferences, it becomes clear that the only inference that can be drawn from the circumstantial evidence leads to that very conclusion and no other conclusion but that one, is possible.

This article opines that Lungu has a history of creating institutions including creating judicial institutions, or creating or attempting to create legislation (think of Bill No. 10 of 2019), appointing judges or other people (think of the change of governor at the Bank of Zambia); or issuing threatening statements against the judiciary (think of the Solwezi Airport statements just before the ConCourt issued the decision on his eligibility to run for a third term), or issuing sugar-coated statements like the recent announcements on judicial appointments; any time close to events that could decide Lungu’s fate whether he remains President or not.

In other words, Lungu always engages in serious maneuverings listed above and more just before events that could undo his fortunes happen. The major events include election outcomes or decisions whether he is eligible for an unconstitutional third term. It doesn’t matter whether some of these moves are buried within a mountain of other events or disguised in their operations or intentions, they are discernible to the discerning eye and to Lungu and his advisers. Pure gold and silver are extracted from rock and rubbish. Nuggets of truth can be hidden deep into lies and deception. So are Lungu’s moves which can be disguised and mixed with otherwise genuine or ingenuine moves.

Take the example of the recent judicial appointments to the ConCourt. They happened at the same time Lungu appointed three judges to the Court of Appeal and one judge to the Supreme Court. You would be lulled to sleep and you would never even suspect or summon a critical eye to analyse the confluence of events to inquire into the hidden maneuverings that Lungu appointed three judges to the ConCourt to act as his secret weapons in case his unconstitutional third term bid is challenged. Have you even thought about this? It appears so innocent, done in good faith and proper, isn’t it?

Lungu even talked about appointing more women for gender-balance, he even talked about considering finding resources to pay for judicial entitlements and building more courts and enhancing working space for judges and support staff. This is all good and commendable. But Lungu has been President for seven years. What has he done about judicial resources and building courts? During the same period he has wasted resources building show-case projects of flyovers and expanding roads towards where the rich live in Kabulonga and Woodlands, tearing down old environmentally friendly trees but without building proper pedestrian sidewalks where mainly the poor travel.

PF cadres are flash with cash and ministers donate cash like manner from heaven. The President has dished out bicycles, oil tankers, millions of dollars to his supporters and the partially inclined churches, they have bought overpriced ambulances and built chiefly palaces and his ministers have built college-like houses. Yet, it is only three months that Lungu has started talking about assisting the judiciary. The youth remain unemployed. Empowerment has gone to the cadres. All or most of that money could have gone to the judiciary, a very important arm of government in a democracy.

Lungu is quoted as stating the following: “The role of the judiciary particularly this year when our country is going to the general elections on 12th of August, will be critical as most political players and other stakeholders will seek different forms of court relief….”. So, election is upmost on Lungu’s mind but why appoint new judges barely four months before this very important election in which these very new judges will be required to make fundamental decisions of a constitutional nature?

New judges at any court level are inexperienced and tend to defer to current judges, are intimidated and tend to favour the executive; they don’t want to rock the boat and generally wish to please the appointing authority to whom they are indebted for their appointment. Unless they are a Thurgood Marshall, Antonin Scalia, Brian Dickson and other giants in the law, Lungu hasn’t given these judges breathing room to learn and become confident. Study after study demonstrates that new judges are timid most of their initial months in office, just like lawyers, teachers, engineers, MPs, doctors etc. It is human and natural.

Lungu unleashed a new judiciary at the ConCourt a few months before the election in 2016. The first decision was disastrous and we are still living with the consequences. They refused to issue an injunction against Ministers staying in power. The next major decision on the election petition was disastrous. They decided on a technicality even when Article 118(2)(e) says “justice shall be administered without undue regard to procedural technicalities…”. Is Lungu imposing three new members to get the same results favourable to him like before?

University of Zambia law professors have persuasively written that the ConCourt jurisprudence is strange. My view is that that court was imposed so suddenly before an election and their inexperience hobbled them from the beginning. It is my opinion. They have never recovered. Lungu is revisiting his strategy here again. It is my opinion.
Lungu appointed six judges in 2016, not seven as he now claims. The seventh judge was only appointed in late 2017 shortly before the court was to issue the eligibility for a third term decision. My opinion was and is that that judge was appointed to rescue Lungu from any negative decision. And Lungu issued threatening statements to the judiciary just before that decision.

Lungu acknowledges that the ConCourt is supposed to have 13 judges. Why hasn’t he appointed the full complement since 2016 or at least since 2017 when he appointed the seventh justice? Appointing three now on the eve of the election is circumstantial evidence that he wants an inexperienced judiciary that is malleable. Further, why can’t or didn’t he appoint all remaining complement to make it 13? Because he wants to appoint more a few weeks before the election or after the election to bail him out with their inexperience? This is my opinion.

Go back even to the beginning of Lungu’s presidency. He immediately appointed chief electoral commissioner, justice Ireen Mambilima, who later declared Lungu as President, as Chief Justice. He was already using the judiciary as his secret weapon to save him in case there were future challenging presidential petitions. This is my opinion.

The judiciary need not connive with Lungu. They need not know his motives but this is circumstantial evidence of his intentions and intended results and so far, he has succeeded one hundred per cent in his designs. But this is where the ball of success ends. Trump appointed three secret weapons but they sided with the Constitution and not Trump. The Supreme Court and Constitutional Court judges respectively of Kenya and Malawi chose the Constitution rather than the appointing authority; so will Zambian ConCourt judges henceforth, in my opinion.
Article 122 of the Constitution (2016) dictates: “(1) In the exercise of the judicial authority, the Judiciary shall be subject only to this constitution and the law and not be subject to the control or direction of a person or an authority” It is written in the Constitution that a person who has twice held office is not eligible for election as President. It is written in the law and in the skies. Guided by the law and Article 122(1) even a new judge in 2021 shall not be subject to the control or direction of a person or authority. Ceterisbus.

DR TASILA’S ALLEGED KILLER HAD A MENTAL DISORDER AT A TIME HE COMMITTED THE OFFENCE

DOCTOR Tasila Tembo’s alleged killer, Zambia Army officer, Lieutenant Nigel Mwaba had a mental disorder at a time he committed the offence, a mental assessment report has revealed.
Consultant psychiatrist from Chinama hospital, Dr Patrick Msoni said the personality disorder was further precipitated by imminent loss.

Dr Msoni however, said that Mwaba is fit to make a plea, stand trial and follow the proceedings in court.
Facts of the offence are that between October 24 and 26, last year in Lusaka, Mwaba, 33, did murder Dr Tembo, alleged to be his lover.

Mwaba’s lawyers on February 1 applied that the accused under go a mental check up at Chinama Hospital condition or conditions of disruptive, impulse-control and conduct disorder. This is a disorder that can cause a person to behave angrily or aggressively toward people or property.

“On the basis of the above information, observations and findings Nigel Musonda Mwaba has Borderline Personality Disorder characterised by unstable interpersonal relationships, variable moods and impulsivity. He may have been predisposed to the disorder by environmental factors and the disorder maintained by his drinking repertoire. At the time of the alleged offence of the act may have been precipitated by an emotional decompensation consequent upon an imminent loss,” said Dr Msoni.

“It is my opinion that he had the above disorder at the time of the alleged offence. His cognitive (thinking) process is normal and has no perceptual disorders. He has insight,” he concluded.

Judge Wilfred Muma read the report when the matter came up for commencement of trial. Mr Justice Muma then ordered for Mwaba to take a fresh plea and he again denied killing Dr Tembo.
The matter could not however proceed to trial because Mwaba’s lawyers from the Legal Aid Board were not ready and applied for an adjournment.

“ We are unable to proceed owing to the fact that we were served with four new witness statements on Friday and considering that there was a weekend in between, we were unable to confer with the accused in order to get instructions,” Dr O’ Brien Kaaba told the court.
Dr Kaaba in accordance with the law, said the State was supposed to serve the witness statements 14 clear days before the date of trial.

He said the new evidence served on them will have an impact on what the defence team has already prepared therefore the 14 days should apply.

“And considering the seriousness of the offence the accused is charged with, it is proper that he is given enough time to prepare. The lead counsel in the matter is not also before this court. In the circumstances we are unable to proceed, therefore asking for an adjournment,” Dr Kaaba said.

Director of Public Prosecutions (DPP) Lillian Siyuni said that although the State had prepared four witnesses to take the stand, they would not object to the defence’s application for an adjournment.

“The nurture of the case warrants that he be given enough time in order to defend himself. On that ground we have no objection,” Ms Siyuni stated.

Mr Justice Muma granted the application and adjourned the matter to April 28 and 29 for commencement of trial.

And the State applied for the addition of four more witness to the list bringing the total number of witnesses in the case to 37, which the Judge granted. -MILLENNIUM RADIO 90.5 FM

Another Kalomo resident sues HH over farms his siblings sold to the UPND leader

A KALOMO resident Misheck Hambwalula has sued UPND leader Hakainde Hichilema in the Lusaka High Court on allegations that he illegally possessed 1500 hectors of his late father’s farm 21 years ago.

Hambwalula is seeking an order that the alleged sale of Farm no. 3275 and 801 in Kalomo to Hichilema is a nullity for failing to comply with the Intestate Succession Act Chapter 59 of the laws of Zambia.

The complainant who has sued Hichilema in the Livingston High Court over the same matter, wants an order for possession of Farm no.3275,801 and 803 and an order of injunction restraining Hichilema, his servants and agents from carrying out farming activities , erecting structures, cutting down trees and entering on the said farms and interfering with the beneficiaries quiet enjoyment.

In his statement of claim Hambwalula who is suing as an administrator of the estate of the late George Hambwalula said Hichilema is a trespasser and an illegal occupant of Farm no. 3275, Farm no.801 and Farm no.803 in Kalomo District southern province which form part of the estate.

Hambwalula stated that his father died intestate on July 1998 in Kalomo District southern province and following his death he left his mother and siblings in occupation of the said farm.

He said in 2015 he visited his siblings in Kalomo District and to his surprise he learnt that in 2000 Hichilema had trespassed, fenced and illegally occupied farm no.3275 and later in 2015 he occupied farm 801 and 803 in Kalomo.

Hambwalula stated that whilst gathering information, Hichilema called him on his cell phone and he asked him why he had illegally occupied his father’s estate without informing him as the eldest son but he allegedly responded that he paid his younger siblings some money whom he knew as administrators and was in the process of paying more money so that he could buy the said farms.

“During the phone conversation, I begged the defendant not to entice my siblings with money as the farms were not for sale. I informed him that my father was hurried on Farm no.801 and Mr Hichilema responded that he likes dealing with young people because they are a problem and like money,” Hambwalula alleged.

“The defendant insisted that young people are the ones who could give him what he wants since they don’t know the value of land. Mr Hichilema responded that he did not care about the grave of y father and will go ahead and get all the land including the gravesite.”

Hambwalula stated that in 2016 the Kalomo local court ruled that the estate of the late George Hambwalula had no administrator from the time of his father’s death.

He claimed that the Court’s ruling proved Hichilema to be a liar because he alleged that he bought the farms from the purported administrators Louis Hambwalula, Overt Hambwalula and Constance Hambwalula.

The complainant stated that there is no court order that was obtained to allow for the sale of the farms to Hichilema as provided by law.

Hambwalula claimed that Hichilema in a bid to fraudulently alter the the lands register and convert farm no.3275 into his names placed a caveat on the farm on April 13, 2005, and did the same on farm no.803 on September 1,201 as the intended purchaser.

“Hichilema ought to know the provisions of the law that a court order is required by an administrator before selling immovable property of a person who died intestate,” Hambwalula stated.

He contended that Hichilema is a neighbor and owns another farm in Kalomo and he should have known that his father died without leaving a will and had more than one wife and many children who needed to be consulted before any sale or purchase could be undertaken.

Hambwalula added that Farm no.801 was mortgaged to Lima Bank and the mortgage registered on January 12,1989 by his late father for K10,6000 and interest and that Hichilema knew about the farms in question because his senior partner at Grant Thornton Christopher Mulenga was the receiver of Lima Bank.

He further wants an order for the removal of caveats, mesne profits for illegal occupation of the farms and damages for fraud and mental distress, anguish and surgery as a result of stroke

Kambwili narrates theft of his US$160,000 from a safe hidden in his bedroom

CHISHIMBA Kambwili has told the Lusaka Magistrates’ Court that his former employees would not have been prosecuted if they had returned the US$160,000 stolen from him.

The former Roan Constituency member of parliament said it was unbearable to only recover US$30,000 out of $160,000.

This is in a matter where his five employees – Rodney Ntanga, Esther Munyeka, George Bwalya, Millan Chembe, Charles Kamutengo – are facing a charge of theft by servant involving US$160,000

In another count, David Zimba, a retired police officer, Ian Kalunga, a police officer based at Police Force headquarters under the fingerprints department, and Jacob Sinadambwe, a soldier and student Stacey Jones, are facing a charge of theft involving the US$160,000.

Kalunga and Zimba have each been given another charge of possessing vehicles suspected to be proceeds of crime, which they denied.

It is alleged that the two between December 14 and 27, 2020 possessed a Toyota Runx registration no. BAR 4326, a Toyota Noah of registration no. ALF 4409, a Toyota Regius registration no. ADC 1009, K10,000 and a Toyota Corolla registration no. ADD 731, suspected to be proceeds of crime.

Testifying before magistrate Nthandose Chabala, Kambwili said he runs Mwamona Engineering and Technical Services Limited which had running contracts with several miming firms.

He explained that in 2016, Mwamona obtained a contract from Mopani worth US$11 million and would be paid in dollars for the services it offered.

Kambwili said money was deposited in the company’s account at Atlas Mara to which he withdrew part of it and kept in his safe at home which he had hidden in his bedroom, inside his wardrobe.

“I have been saving money in my safe since 2012. I keep the money and at the same time, sometimes in December I had US$ 160,000. Going by the bank of Zambia laws, you can only withdraw $5000 so we would withdraw money in Kwacha change it into dollars and I would save it in my safe,” Kambwili said.

He told the court that before the festive season last year, the ceiling board in his bedroom was damaged and he asked his driver Bwalya to find someone to fix it.

He said Bwalya brought a man of Kalingalinga and recommended that he would fix the ceiling board in the kitchen and bedroom.

Kambwili alleged that on the day he was leaving for the Copperbelt, he gave his houseboy, Ntanga, and Bwalya the keys to his bedroom and directed them to monitor the men who were fixing the ceiling until they were done and that they surrender the keys to his daughter Chanda.

“l told them to monitor those men for one reason; in the past I was losing money in my bedroom and the two had access when I was around. Every time I lost money, Rodney and Bwalya would blame each other because they are the only ones who entered my room and I told them to monitor the men fixing the ceiling to avoid such an issue and left for the Copperbelt,” Kambwili said.

He told the court that the safe was in one of the corners of his wardrobe and he would hide it by folding clothes on top of it, and that Rodney had knowledge of the safe in his bedroom because he used to clean the room and fold his clothes.

Kambwili narrated that after spending Christmas with his children, he decided to check his the safe on December 27 and to his surprise, he found a different safe in his wardrobe.

He said his safe was green but it was exchanged with an empty black one.

“Immediately I saw this, I knew I was in trouble. I got it and put it on my bed. I shook it and it was empty. I called my private secretary Fabian Mutale and told him to do thorough investigations because it looked like an inside job because I left the two men in the bedroom and my daughter and Stacey were home,”Kambwili narrated

“My first suspicion was that maybe my daughters had tampered with my safe. I called them and they showed ignorance but were quick to say at one time they had their friends in the house. There were three boys with Stacey, they had a brai and the key was left with Chanda and one of them might have gotten the key.”

He claimed that he instructed his daughters to call their friends but Stacey did not show up as she was in Livingstone for a holiday and she posted pictures on her Facebook page with her boyfriend at a very expensive pleasure resort.

“Stacey is an orphan. I treated her like my own daughter. She used to complain that the reason she stayed with us was because her sisters never treated her well. My daughters suspected her because she had never gone anywhere without them and the Highland was an expensive resort. We called Stacey to come back from Livingstone and she came after two days. I interviewed her and she denied but I saw her tremble. I told my daughters I did not want to see Stacey near my house,” Kambwili said.

He narrated that whilst in the UK, a whistleblower told him that Bwalya stole money together with other employees and Stacey.

“The safe was transferred using Stacey’s boyfriend’s vehicle into Arackan Barracks to Esther’s house and Esther’s husband, Jacob, told them not to leave it in his house because if it had a tracking device, he would be tracked because he was a soldier and he advised them to go and have it opened at Chilenje market,” Kambwili said.

“I called Rodney because Esther had stopped coming for work. I asked him about the money, he refused. I called Esther and she gave me directions to her mother’s house in Chalala but when I went there, she didn’t pick up her phone. I went to her mother’s home but she was not there. Esther later called Rodney and I noticed he was unstable. I asked him who he was talking to and he

claimed it was his wife. I grabbed the phone and discovered it was not his wife. I talked to Esther but she cut the phone.”

Kambwili said he sent his secretary to Esther’s house and they were told by the neighbour that the couple had fled their home.

He recounted that whilst they were having lunch the following day, Rodney escaped with help of Chembe despite instructing him to keep an eye on the houseboy.

“I went to his house and Rodney’s wife explained that he bought a TV, chairs and he lied to her that he had won Bola bet but what surprised her was the vehicle he bought. She said two police officers went to their home with Rodney, got some dollars and gave the officers who had papers for change of ownership,” Kambwili recounted.

“She said Rodney later disclosed that they had stolen money in your house. Esther bought a car and household goods and the rest of my employees and Stacey got some money. She said the officers from Woodlands tortured Esther and Rodney saying they had stolen money but they denied.”

He said the whistleblowers tip and information he got from Rodney’s wife collaborated and he reported the matter at Chilenje police station and not Woodlands because he was afraid that the two officers might interfere.

He added that six vehicles, two houses US$30,000 and some kwachas were recovered from Rodney, Esther, Bwalya and Chembe as Kamutengo was at large.

He also wondered how Rodney furnished a house and set up a bar from a salary of K1,200 per month.

When asked by state prosecutor Sammuel Zulu how much his employees were getting as their take home pay, Kambwili said he paid his workers in the range of K1,000 and K1,200 every month except from Bwalya who got K5,000 every month.

“The accused are family men and women. I pleaded with them to bring back the money and I wouldn’t want them to undergo punishment. I am not a sadist. I would have let them go. There was a time when someone stole my money, they brought it back and I let them go but in an instance where $160,000 goes missing and they only return $30,000 it becomes unbearable,” said Kambwili.

During cross- examination by Ntanga, Kambwili was asked whether or not he disclosed to him that his daughter Chanda had a spare key to the safe but he denied.

When asked about the whereabouts of his daughters when the incident occurred, Kambwili said told Ntanga that he was aware that the children were rarely at home.

Asked why he would continue working after stealing the money, Kambwili said, “it’s typical of thieves, you wanted to deceive me that you did not steal the money, that’s why you did not leave when I went to England.”

Munyeka asked Kambwili if she had access to his bedroom but he denied.

When asked by Bwalya’s lawyer Agrippa Malando if he saw his client steal the money, Kambwili denied.

He confirmed that no employment contract was produced before court neither did he pay Bwalya’s statutory obligations as a worker.

And Chembe asked Kambwili why he was not paid his salary arrears but Kambwili explained that his guard was employed by the NDC, therefore, it was not his duty to clear arrears on behalf of the party.

The matter comes up on May 10 for continued cross-examination.

PLANS TO SUMMON HH NOT TRUE – IG Kanganja

INSPECTOR General of Police Kakoma Kanganja says it is not true that the police are planning to summon UPND leader Hakainde Hichilema.

Mr Kanganja stated that this was far from the truth.

“In the same vein, another falsehood was propelled that the Police have plans to summon UPND leader Hakainde Hichilema which is far from the truth,” Kanganja stated.

He stated that in instances where the police had intentions of summoning any person for any reason, they did so transparently because they have nothing to hide.

“It is with this back ground that I want to caution politicians to be responsible as they do their politics as opposed to engaging in misconduct that may cause public disorder,” he stated.

The Inspector General of Police has warned that anyone that would be found wanting for inciting the public through publication of falsehood or alarming statements, would be dealt with in accordance with the law.

And Mr Kanganja stated that it was appalling to note that some politicians wanted to take a route of using propaganda and falsehood to gain sympathy from the electorate as seen from the conduct of Mkushi North Constituency, UPND aspiring candidate Topson Kunda who raised false alarm that he had been shot in the foot.

He stated that Mr Kunda’s allegations almost sparked protests in Itala Compound.

Mr Kanganja stated that politicians should bear in mind that his command would not tolerate irresponsible conduct which may bring about public disorder.

“It must be understood that giving false information to a public officer is a prosecutable offence; therefore, anyone found wanting shall not be spared,” Mr Kanganja stated.

On Thursday, April, 15, 2021 around 23:53 hours, Mr. Kunda gave false information to the Police that he had been shot at whilst in Itala Compound and had sent someone to report on his behalf to police while he remained in a motor vehicle which was parked at the police station.

However, when some officers spotted him, they requested to see where the gun wound was as they could not spot any injury on his left foot.

Mr Kunda was advised by police to get a medical report form for him to be attended to by Health authorities but he turned down the advice stating that he could not be treated at a Government Hospital.

But he later became unruly and left after refusing to get a medical report form saying he would be attended to at a Private Health Facility.

According to Mr. Kanganja, the aspiring candidate conduct almost sparked riots among members of the public in Itala Compound who were swayed into believing that the person in question was shot at when infact not.

If the position of Veep and SG was elective, someone else was going to win as SG and Vice President was going to a different person. The Myth and Deception of ‘Smart Cities’ in Africa

It is certainly not wrong to think in futuristic terms that attempt to paint a utopian picture of life in African urban areas. What is wrong however is being oblivious to the immediate contexts surrounding African societies not only in urban areas but in rural areas as well. Africa has abounded with narratives of smart cities but without fixing the fundamentals of existence, it remains completely meaningless.

This should be gleaned from the context of radically urbanizing Africa, taking notes and blueprints from much of the developed world. A particular example is Akon’s sustainable smart city called Akon City, to be located in Senegal. It will use a cryptocurrency called Akoin and will cost a mammoth $6 billion to be brought to life. The futuristic metropolis (a total of 2,000 acres in size) will include a luxury resort, condos, offices, a hospital, a stadium, and an artificial intelligence data center. The details of Akon City are sketchy, including its investor and how it will be constructed.

Another smart city, developed along science fiction lines, is Eko Atlantic City in Lagos, Nigeria. Work has already begun – a grand project that will require 140 million tons of sand as it is being constructed on land reclaimed from the Atlantic Ocean. And of course, the environmental concerns are being disregarded since the building is already underway.

Other cities going the smart city route include Cape Town and Nairobi. Other projects include Hope and King City in Ghana, Vision City in Kigali, Rwanda, Kenya’s new tech hub Konza technology city, and Waterfall City in South Africa.

The International Telecommunication Union defines a smart city as an “innovative city that uses ICTs [information and communication technologies] and other means to improve quality of life, the efficiency of urban operation and services and competitiveness.” All these mentioned cities are high sounding, but the nuances of Africa’s complexities when it comes to equitable distribution of wealth are lost.

The rate of rapid urbanization in Africa will continue to reign supreme. Such urbanization is being fetishized without paying proper attention to the current problems bedeviling nearly every city in Africa. Such plans for these futuristic smart cities can only make sense if put in the broader picture of giving every African citizen the right to basic services.

Already, African urban centers are under enormous pressure to deal with the ever-growing tide of urbanization. Public services are a nightmare in African cities. There is a lack of adequate access to clean water and sanitation. Public health is in disarray as the majority cannot access such services. Education is still drawn in the context of inequality where the poor bear the brunt of governments failing to provide such for everyone.

Mobile internet penetration rates in African countries are terribly low. This is aggravated by abysmal public transport services, making life in urban centers a survival of the fittest. The poor are left out in the narratives of smart cities, noble as they may sound.

It becomes useless to advocate for these futuristic plans when basic services in urban and rural areas are only for an elite few. This has been due to decades of neoliberal capitalism which selfishly advocates for privatization, austerity, deregulation, de-industrialization. And all of this is at the behest of global private capital and its gatekeepers such as the World Bank, the International Monetary Fund, and the World Trade Organization. The inequality caused by this is inhumane, an affront to humanity and at its core worships consumerism over the welfare of human beings.

To develop a smart city such as Akon City is in all honesty meaningless. Inequality is rising more than ever. Without transforming rural areas first, all these plans are empty and will continue to assault the dignity of the majority of Africans. Such money should be reinvested in making life comfortable for everyone not only for the elite bourgeoisie. The current context of smart cities does not include poor people at all.

The fantasy of smart city concepts should not remain unfettered. These concepts should be challenged for the cruelty they inspire. Fundamentals of existence should be fixed first before any talk of smart cities. And neither should smart cities be viewed as alternatives to the problems of urbanization unless they promise basic services to everyone.

Some will argue it is a better form of capitalism but in reality, it just worsens the inequalities Africa suffers from as a result of colonial injustices and post-independence neoliberal policies. The urge to fit in the capitalist order of globalization should not make us blind to the realities that exist on the ground.

THE LUSAKA STRANGLER – a ghastly World record Zambia holds

ZAMBIA holds a nasty world record. Zambia was the home of the Lusaka Strangler who killed more victims in a shorter period than any serial killer before or since. He killed one person per week from January to September 1980.

During the school holidays of the Christmas break of 1979 to 1980, the first victim of the Lusaka Strangler was found. It is not known who phoned the police on 5th January 1980 that a dead body was lying in the bush just behind Lusaka Boys football pitch. The area is now part of the Complex of Villas erected for the OAU Conference next to Intercontinental Hotel.

When the police led by an Inspector Gondwe arrived at the scene a crowd of school boys were already at the scene and their game of holiday football was horribly interrupted.

Two days later Woodlands Police were also phoned by an anonymous caller to the effect that a dead body of a young woman was lying in the bushes near Chitukuko Road.

A KILLING SPREE

For nine months, once a week like clock work, the strangler killed a woman. Dead bodies started being found in a wide area around Lusaka and the newspaper headlines were full of the attempts by the police to catch the serial killer.

The Lusaka Strangler was to kill at least 29 women. The police launched Operation Rosemary to capture the killer. By the time the Strangler was caught, the official list of victims was 31 with 2 victims surviving.175944303_1008375413033345_8399714569941066269_n

The police worked out the Modus operandi of the killer after some intensive investigation. His technique was simple, approach a woman, seduce her, take her for a drink, rape and strangle her. The other variation was to offer accommodation. He would then dump the body at a place where it would be found easily.

He also played games with the police. Arranging items like bottles around bodies, leave coins on the body and notes and so on.

Some bodies were found in the bush now occupied by Manda Hill, some others where Arcades is, others were found in the bush where Winners Chapel is in Libala, others were found in the NIPA area and another in the bush in Longacres near where the Zambia Airways Head quarters (now Ministry of Health). Another body was found at the gates of Woodlands Stadium. As if to mock the UNIP government one body was found lying at the Freedom Statue. Another body, found near Chibolya, had a gloating cardboard sign with a message for the police. Another body was left at what is now the TEVETA headquarters behind Intercontinental Hotel. One of the victims was an off duty policewoman and the killer left her ID lying on her body. One horrific murder involved the rape and strangulation of an 18 year old girl whose naked body was found hanging on the NIPA fence. This was the murder that so upset Assistant Comissioner Mr. Sinyinda

The spate of murders scared the whole of Lusaka. He killed six women in January, five women in February, five women in March, three more in April, two in May, three in June, two in July and the last two in September.

The victims were picked up from the Old Kamwala Intercity bus terminus, the Lusaka Railway Station and the UBZ coach station. The police also noticed something. Quite a lot of the victims identified by the national registration cards he left on their bodies were Lozi or Lozi speaking.

OPERATION ROSEMARY

The Police investigation caused friction within the force. Political pressure was intense from the top, with politicians demanding results, meanwhile Force Headquarters Police Command did not want to interfere with the Lusaka Division Command investigations. However Assistant Commissioner of Police, Mr Sinyinda was forced to officially rebuke Lusaka CID for their poor investigation methods. The police had instituted a huge round up of all known sex offenders and murderers. They had detained dozens of people without result. Lusaka rumour had its own suspects.

What incensed Mr Sinyinda, a seasoned detective, was the failure of the police to interrogate a crucial witness properly. A security guard at Premium House had seen a woman walking past Premium House late at night with a soldier in uniform. He was upset that when the guard offered this information the lead was not followed up as the very same night a body appeared in the vicinity !!!

After this gaffe, the Police Command took over and assembled a Special Investigation Team composed of all the best detectives and investigators from around the country.

The breakthrough came when one person survived an attack by the strangler. In July 1980, Nora Soko survived an attack by the strangler and gave police a description of him as a dark man in military uniforn with tribal marks on his face speaking English and Nyanja with a Lozi accent. She had been lured from the bus stop by the Strangler when he grabbed her bag and walked out of the station. She followed him to try and retrieve her bag and he engaged her in conversation. She was saved from death when in the bush near the Olympic Swimming Pool in Rhodes Park she was attacked but screamed for help. Guards at the nearby ZSIC flats came to her rescue. A police detective had seen the two talking at the Kamwala Intercity Bus Terminus and had assumed they were a couple. He had however noted the couple in his notebook and his report had included a description of the killer.

The police subjected both the survivor and the detective to intensive questioning and both their descriptions tallied and both agreed they would be able to identify the serial killer.

The police now knew they were looking for a soldier or soldiers. The three statements of the Premium House guard, the detective’s report from Kamwala and the survivor’s tale all corroborated this.

The killer seemed to have noticed the heavy detective presence at railway and bus stations. This was because in August he did not strike. It is said the police even planted Lozi speaking female detectives at various stations to look like travellers however the killer never approached them.

THE STRANGLER IS FINALLY CAUGHT

He then struck again in September 1980 and in the process was arrested. A Mrs Mutakasha arrived in Lusaka. She was in company of a young lady going to Petauke. They arrived late in Lusaka and fearing the serial killer decided to spend the night at the station.

During the night, two soldiers approached them. The soldiers tried to convince the two women to go with them to a guest house. Mrs Mutakasha refused and so did the young girl. One of the soldiers picked up the girls bags and walked out with them. The young girl followed. Mrs Mutakasha never saw her again and it is not known if she too was a victim.175524415_1008375309700022_5443734257392717526_n

After an hour one of the soldiers came back and persuaded Mrs Mutakasha to come with her to the guest house. She relented and followed the soldier. She was attacked and woke up in the bush at 0300. She was attacked in the bush near Kamwala Secondary School. Her last memory was drinking a Fanta the soldier bought for her. She staggered to a house in Madras and called for help.

She too provided a clear description. After a month, the police then set a trap. Using the two survivors as bait they sent them back to the bus station.

The strangler fell into the trap. When Mrs Mutakasha was at the station, a soldier approached Mrs Mutakasha and began talking to her. Detectives closed in and arrested him.

Corporal Milton Mufungulwa Sipalo was the name of the suspect. He was taken to Central Police and interrogated. He was identified by the Detective who saw him speaking to Nora Soko, by Nora Soko and Mrs Mutakasha as well.

Three days of intensive interrogation followed. An accomplice
a Lance Corporal Kenneth Kaluwe was arrested. He was later released as no evidence was found linking him to the murders.

However Sipalo’s Arrakkan barracks home was full of the posessions of numerous victims. He also led the Investigators to many sites where bodies had been picked up. When caught he was even wearing a watch for Mrs Mutakasha.

THE STRANGLER ESCAPES JUSTICE

The story ends in a final macabre twist. While transferring Sipalo to a conference room for interrogation he escaped the officers escorting him and rushed to the roof of Lusaka Central Police Station. He then stood on the roof and threatened to throw himself off the roof. Despite hours of pleading from police, the fire brigade and onlookers, he plunged off the roof top to his death.

Thus ended the life of the most prolific serial killer in Zambian history. He had killed women at a rate of one a week except for the pause in August. For nine months he terrorised Lusaka. Nurses slept at UTH or clinics for fear of the Strangler. Fewer women could be found in bars or clubs. It was said prostitutes charged more. He mocked the police. He caused friction in the ranks of the police as to how best handle his case. The police threw unprecedented resources at the case.174606456_1008375349700018_6760593530891207977_n

There are still unresolved issues. If Lance Corporal Kenneth Kaluwe was not his partner in crime then who was the other soldier he seemed to have done his dastardly deeds with ? How many women did he really kill ? Indications are there were several bodies never found. What were his motives for the murder spree ? Why did the Government refuse offers of help from the FBI and Scotland Yard and opt to use its own resources to solve the case?

Zambia was brought to a standstill anxiety last evening when the state operation to arrest the opposition UPND leader Mr Hakainde Hichilema in connection with the Hantembo family went viral in a spate of minutes.

Internet went frenzy as operation was confirmed beyond propaganda that the UPND leader was poised to be arrested. This prompted a sharp response from UPND as they responded rapidly with a massive mobilization of youths within a short time and surrounded the house in new Kasama with over 3,000 youths .

High tempers and excitement to defend and protect HH kept the entire nation awake with youths daring the police to bring it on.

Lusaka province UPND youth Chairperson Mr Anderson Banda was at the time of the interview the lead leader said the 2017 history will not repeat itself this time around as police would have to go through the youths before they touch HH, Mr Banda warned that the entire nation will not seat down and keep watching their leader being unfairly mistreated while they watch.

” we are here and are ready to die for HH if that’s what it means, I have communicated to all my provincial youths countrywide to be on STANDBY wherever they are in ensuring that we don’t allow Dictatorship of Mr Edgar Chagwa Lungu towards our leader. We will brave the night if it means shifting to protect him day and night we are ready we regret not protecting him in 2017 the story will not be the same this time around” Mr Anderson Banda said.

And Lusaka province youth coordinator Mr Brian Mulenga said if Mr Mr Edgar Chagwa Lungu wants peace he must behave himself before he plunges the country on fire because UPND youths have had enough of intimidation not anymore. Mr Mulenga says it doesn’t make sense that life is so unbearable instead of people doing practical things to sustain their lives in the hash economic environment they found themselves guarding HH the whole night.

And Mr Trevor Mwiinde the National Deputy youth Chairperson Administration was part of the delegation of the youths and Mr Gilbert Liswaniso who is the lead National youth Chairperson the dual refused to comment saying they have no time to talk but wait for the police.

The government through the Zambia Police could not manage to execute the operation to arrest HH due to the hyper tension the country went into. Among the cases he is to be charged includes the missing of the Hantembo families to which he is being accused of keeping them. The UPND has warned of massive nationwide resistance at whatever cost towards the arrest of their party leader should their leader be touched. By morning this time the party has taken over security protection as the house will now be under 24/7 surrounded with the youths. Police spokeswoman Ms Esther Mwata Katongo is yet to address the press this midmorning about the situation.

Katuba MP’s wife sues Interpol over seized Isuzu D-max given to him by Malanji

UPND Katuba member of parliament Bampi Kapalasa’s wife, Fanny Madzi, has sued the state demanding that the police releases her motor vehicle which was gifted to her husband by Minister of Foreign Affairs Joseph Malanji.

Madzi has commenced judicial review proceedings in the Lusaka High Court against the decision by the Interpol theft of motor vehicles criminal investigations department, Zambia police headquarters Lusaka, to seize her Isuzu D-max of registration no.BAP 6744ZM.

She is seeking a declaration that the decision, omission and neglect made by the Zambia police service on December 10, 2020 to seize her motor vehicle is null and void ab initio.

In her affidavit in support of ex-parte summons for leave to apply for judicial review, Madzi explained that in June 2020, Kapalasa gifted her the motor vehicle in question.

She said when she questioned her husband on how he bought the gift, Kapalasa disclosed that it was given to him by Malanji, who is also Kwacha Constituency member of parliament, for the good relationship they shared.

Madzi contended that she had been using the motor vehicle peacefully as an absolute owner for her personal and business activities until the relationship between her husband and Malanji went sour because Kapalasa refused to support the infamous Constitutional (Amendment) Bill no.10 of 2019.

“On December 10, 2020, the theft of motor vehicles, criminal investigations department, Zambia police service headquarters Lusaka, unjustly seized the vehicle,” Madzi contended.

“The motor vehicle was seized on account that my husband got the car on credit from a company called Swift Cargo limited whose proprietor is Goodward Mulubwa and had failed to pay for it.”

She said she asked Kapalasa to be honest on how he obtained the motor vehicle and he maintained that it was a gift from Malanji and he denied dealing with any agent from Swift Cargo or its proprietor.

Madzi stated that upon further inquiry on the happenings, she discovered that Swift Cargo presented a fake sale agreement between itself and Kapalasa which it solely relied on to claim ownership of the motor vehicle.

“From the time the motor vehicle was seized, there has not been any communication and progress on the said matter and that my motor vehicle is depreciating as it is being exposed to the sun and heavy rains,”Madzi said.

“Despite writing to the Zambia police for the temporary release of the motor vehicle which I use for personal and business purposes, there has been no action to have this matter resolved amicably.”

Madzi suggested that if Kapalasa actually obtained the vehicle on credit from Swift Cargo limited, the said company should have sought the right remedies before the correct forum and not using the police to inconvenience, victimise and intimidate her.

She further stated that the conduct by the police is in excess and was unreasonable as it was done in bad faith and malice.

Madzi added that the state will not be prejudiced in any way if leave is granted and the same should operate as a temporary release of the said motor vehicle.

She is further seeking an order of mandamus compelling and directing the police to permanently release the vehicle.

There has been a serious trend when elections are near by some small political parties emerge to create propaganda over president HH , recently the revolution party leader resurrected from the ashes of doom to say the UPND party is for the Tongas , it is very unfortunate that people are used to castigate others for the invisible benefits we don’t see during these situations .The UPND recently held the most successful democratic convention ever held in Zambia ,the tribal composition of the national management committee is well balanced and can’t be compared . Zambians were going to respect people rejoining the ruling party if they said they were taking new ideas to the party to improve on the standard failures which have brought numerous challenges to the people , it is not an assumption that PF has failed to implement policies which are supposed to transform this country ,there is no translation to the common people ,the future is bleak because there is no wealth creation for the country to secure the future ,given the position of the national debt and the failure to repay on due date .

I consider these coming elections as an academic one , some of these ancient political strategies of just trying to demonize president HH and thinking that is the best way to win an election is just something of the past , we know others are coming on board because they know benefits come through condemnation of the person who is the front runner to scoop the coming general election , fortunately Zambians have their eyes open and they understand the dynamics of criminal politics , it is only good leadership which this country needs to move out of the deep valley of life challenges and poverty , it is possible electing poor people in public office has been a cause for the corruption and plunder of state resources ,we don’t need a leader who has never rared even one single chicken ,we need a God fearing person and not social night clubers .

Zambia still has the potential to secure the future if only the people can realise why politicians team up to demonize just one person in the name of president HH , Zambians need to understand that there is substance in president HH , an example of the former bank of Zambia director who was dropped on political reasons and later appointed by the world bank , many people we think are not useful in the country are internationally recognised with merit and excellence , why don’t we see that when electing leaders of our own country?, let’s not be districted easily by noise makers who scream for their own benefits . we have seen this culture grow and the country has continued on the path of leadership bankruptcy . This coming election is to erase the authority of carderism and ensuring the return of our lost values, Zambia is still a model in Africa if only Zambians can move together in unity and elect a govt that will represent the people and the nation to foster development and reduce the challenges that affect the majority people today and prevent mortgaging the future. Patriotic Front (PF) Member of the Central Committee (MCC) Joseph Malanji has urged people of Mufumbwe district in North-Western Province to rally behind the PF under the leadership of President Edgar Lungu ahead of the August 12 general elections.

Mr Malanji who is also Foreign Affairs minister said government means well for the people of Zambia because of the development programmes being spread across the country.

He urged people in the region to vote for PF candidates in the August 12 general elections to accelerate social and economic development in the region.

Mr Malanji said the PF has penetrated the province which was regarded as an opposition stronghold as evidenced by the victories recorded in the by-elections that were held in the region.

“Now we want uniform, councilor PF, Member of Parliament PF, council chairman PF and President PF,” he said.

Mr Malanji , who is also PF national mobilization committee member, was speaking when he addressed public rallies at Kashima east and Kyamwina Primary Schools in Mufumbwe constituency yesterday.

It is important for people to vote for PF candidates who will be able to lobby for development from President Lungu because Zambians have resolved to give him a fresh mandate in August this year, he said.

“For developmental projects I can assure you that we are not going to end where we are but we are going to continue,” Mr Malanji said.

He also commissioned the construction of a one by three classroom block at Kashima east Primary School to increase on classroom space to enable pupils learn in a conducive environment.

Earlier, Mr Malanji addressed another mobilization rally in Kanyama chiefdom in Mwinilunga district where he commended people in the area for accepting to work with the PF Government.

“We already have the support that we want from this chiefdom,” he said.

Mr Malanji also assured the people of Kanyama that government will continue with the empowerment programmes especially in the livestock sector.

“On the road network the Government has already signed a contract to do the Mutanda-Mwinilunga road and the contractor will be on site very soon,” he said.

He said works to upgrade Mutanda-Mwinilunga road which has been in a deplorable state for a long time will be commissioned soon.

Mr Malanji also said Government has engaged Zambia National Service (ZNS) to work on feeder roads and bridges in Kanyama chiefdom.

When Bob Marley dated Pascaline Bongo, daughter of Gabonese dictator Omar Bongo

Bob Marley‘s career after he broke out as a young Jamaican musical sensation spanned just ten years yet his global fame was apparent before he turned 30. Marley, via Bob Marley & The Wailers, was already known to many in the Caribbean, the United States and the United Kingdom before an attempt was made on his life in Jamaica in 1976.

By the late 1970s, he was playing in Africa, a continent he espoused so much love for. He was in Kenya and in Ethiopia in 1978. Of course, Ethiopia, the home of the Rastafarian saint Haile Selassie, was always going to be on Marley’s list of destinations. He was also in Zimbabwe where he was the special musical guest to mark that country’s independence in 1980.

However, it was in Gabon that year that Marley found love in the embodiment of Pascaline Mferri Bongo Ondimba, the daughter of El Hadj Omar Bongo Ondimba, born Albert-Bernard Bongo. The Bongo name has been synonymous with Gabon for so long because Omar ruled that country from 1967 to 2009, only to be succeeded by his son, Ali.

Marley became intimately close to Pascaline but according to the latter’s own version of events, their actual first meeting was in 1979 in the US, making the meeting in 1980 a reunion of a sort.

“The first time I met him was in America in 1979 and when we went backstage when he saw me, he said “Gosh you’re ugly”,” Stephanie said in the Ken MacDonald-directed documentary Marley (2012). Stephanie was in the States with her father and went to see Marley perform in Los Angeles. She managed to secure a backstage pass to meet the musician who was unfortunately not impressed by her looks.

However, according to Bob Marley and the Dictator’s Daughter written by Anne-Sophie Jahn, it was Pascaline who invited Marley to perform in Gabon. It would seem even after Marley’s rude remark, the 23-year-old’s spirit had not been broken on that night. Her invitation was welcomed by some members of The Wailers who had never seen the motherland they sang of.

Marley and his crew were not received by Omar, the head of state who also went by the unofficial title of “king”. Omar sent future president Ali to meet Marley and his company. This snub was not lost on The Wailers since they were essentially on a state visit to play at Omar’s birthday party. It later also dawned on them that Omar was a dictator who developed the parts of Gabon that mattered to him while the rest of the country laid in abject poverty.

However, according to Pascaline, Marley was not personally offended by Omar because “he [Marley] told me that my father had been the only one to suggest that Haile Selassie move to Gabon after he was dethroned. And that the Rastafarians felt that this was a strong act that deserved their respect and admiration”.

Perhaps, Marley’s ability to transcend the immediacy of the disappointment that confronted him in Gabon, to give Omar the benefit of doubt, endeared the musician to the “king’s daughter”. In MacDonald’s film, Pascaline did present Marley as a deeply thoughtful and philosophical man. They were in love, she revealed. It was known among The Wailers and many others yet it was not everyone’s to know.

Marley had many lovers, including 1976 Miss World Cindy Breakspeare, mother of singer Damian Marley. He married Rita in 1966 but by his own account, it was possible some of his children were unknown to him. He knew he had fathered eleven by seven women.

Pascaline reveals that knowing who Marley was, she was on the pill. She liked him and wanted to be around him but “[h]e was a Rasta and his philosophy was to share everything. And it wasn’t his fault that the girls jumped on him. They all knew he was married… but he was a superstar.”

The president’s daughter was in Marley’s life even until the latter days when Marley’s skin cancer gave doctors a hint that the reggae legend did not have much time to live.

PF RESPECTS INDEPENDENCE OF INSTITUTIONS BUT HUMAN RIGHTS COMMISSION SHOULD BE IMPARTIAL

The independent civil societies among the Young African Leaders Initiative (YALI), the Consortium of Political Parties, the church and the media have all agreed that the circumstances under which the Hatembo siblings are held away from the public eye is a national issue.

On another hand, there has been dead silence from the police regarding the issue while the Human Rights Commission (HRC) claiming they are not hiding.

The question any well meaning would ask the Commission is “why then are they not allowed to enjoy their freedoms among them the freedom of association?”

It is also a fact the Human Rights Commission has been proactive and quick to make comments on matters that are partisan in nature while on one hand their lips been tied on matters affecting the vulnerable people.

The case the dual clearly shows a helpless poor citizens who are entrapped in the jaws of the unknown host.

While ours is to promote institutional independence of state institutions, we demand fairness and impartiality the Commission makes public comment on matters of human rights violations.

The last time the Hatembos were seen in public was when they were paraded before the cameras to denounce their lawyers and discredit their own court processes where they are pursuing a claim for trespass.

Just like any other citizens, the Hatembos brought an action against UPND leader Hakainde Hichilema and the action was dismissed on the basis of the statute barred and being disenchanted with the decision they filed a notice of appeal at the speed of light.

Ever since their “miracle disappearance” a number of events have transpired which require their personal attendance.

Among them includes the prolonged sickness of the daughter to Phelluna and a bereavement which occurred within the family.

Missing these important events is not what a voluntary disappearance can be.

There are some institutions that are consistent in discussing matters that a controversial.

Most of the self proclaimed activists are only biased toward making comments that are partisan in nature and little attention has been given to the issues affecting the vulnerable people.

We also understand the police intends to use the missing dual as witnesses in the ongoing criminal investigations over the subject that has not been disclosed. This us enough ti attest that their safety is indispensable and a priority.

Even in the midst of this controversy, there are a few voices that have consistently pleaded that the missing persons be availed or Atleast their whereabouts be made known so that possible speculations can be brought to rest.

Chief Cooma in whose territory their last known residence is situated has fumed with dire desperation demanding that his subjects be brought Whether dead or alive.

The church have equally echoed similar concerns about this unprecedented event of the vulnerable people disappearing in unusual circumstances.

Apparently, the pleas have been wantonly been disregarded with brazen impunity.

This is a litmus test on whether similar occurrences will be regarded as business as usual or there would be any patriots that would take proactive steps to arrest the situation.

Standing As An Independent Mp In Zambia Is As Easy As Inhaling Oxygen

STANDING AS AN INDEPENDENT MP IN ZAMBIA IS AS EASY AS INHALING OXYGEN.

Many people have been calling me enquiring whether they can stand as independent candidates after failing to secure adoptions from their respective political parties.

This is in view of a constitutional clause demanding that one qualifies to file in as an independent candidate if that candidate “has not been a member of a political party for at least two months immediately before the date of the election*

Meaning one has to resign from his/her political party 2 months immediately before the date of the election though the catch word on this provision is that of one not being a member of any political party.

My honest response has been in affirmative as the constitutional provision does not affect any aspiring candidate who is currently a member of political party and aspiring to be adopted as such by that political party to stand as an independent .

Article 51 guides that “A person is eligible for election as an independent candidate for a National Assembly seat if the person—

*(a) is not a member of a political party and has not been a member of a political party for at least two months immediately before the date of the election*”

However, this article still implies that at the time of NOMINATION, one must not belong to any political party but does not give a timeframe when one shouldn’t be a member of a political party.

This means that one’s resignation is only effected 2 months before an election date, not outside the 2 months to ELECTION date, in this case August 12, 2021 and due date of not having a party membership is June 12, 2021.

On nomination date, one must not belong to any political party for him/her to qualify to file in as an independent.

The ineffectiveness of this Article is that no adoptions or nominations take place 2 months immediately before the date of election.

Nonetheless the first part of the Article 51(a) saves the situation as the provisions that demands that “the person [must] not [be] a member of a political party…”

Instead, adoptions and nomination happen 3 months to the election date which makes everyone elligible to stand as an independent candidate as long as one claims does not belong to any political party at nomination.

The implication then is that the law on 2- months-no-party membership barring one from standing as an independent member and file in nominations to stand as an independent candidate before the 2 months to the election date is due is a redundant clause.

As to those wanting to stand as independent Councilors (Mayor, chairperson or ordinary council), the law does not demand of them to belong to any political party or resignation but can just freely independents as Article 51 (a) only applies to MPs.

They need not to be sponsored by any political party if they don’t wish to do so and there is no harm in them to stand and contest on any political party ticket.

With the foregoing, political parties must handle the adoption of candidates processes cautiously to avoid aggrieved aspirants from opting to stand as independents which is an open woodland.

Hope those who were asking me the questions on independent standing for elections as MPs and Councilors are made clear from this Article.

PF THUGGERY, HOW IT ALL STARTED

It all started back in the time of late President Michael Sata and commissioned in 2014, at Mulungushi Rock of Authority in Kabwe, during the PF convention.

The cadres were unleashed on those who opposed Dr. Edgar Chagwa LUNGU, the chosen one.

In a few months that PF had occupied power, the cadres had become accustomed to intimidating state security personnel in the presence of senior leaders, including President Michael Sata himself. On many occasions the cadres were seen shoving aside Police Officers, even Soldiers, in the presence of the President Sata, unrestrained. Yes, cadres fought to become the first line of protectors of the President and they got it. Their confidence was established when uniformed military personnel started to ‘salute them, while civil servants, regardless of their high position, also froze before them. They saw a loophole to become more powerful than State Security personnel by capitalizing on the superiority of the civilian authority over the Military, as provided for under the Constitution of Zambia.

In addition, the cadres learnt that Michael Sata himself trusted them more than the state security personnel and so they realized they had backing of the most powerful man in the land just as they still do today.

To avoid being considered or labelled sympathizers of the opposition, since they were aware that the new government considered them ‘ba muselelakwakaba’ (people who shift their allegiance), the security personnel and civil servants gave way to the cadres. They even started to salute them just to make sure the cadres did not put them on the list of those to be retired in national interest. They had to do it anyway, if they wanted to maintain their jobs. We all know what it is under PF. If you cross paths with PF cadres, you’re likely to lose your job. Ask Police Officers and other civil servants they will whisper to you the fears that engulfs them when picked on by PF cadres.

In a traditional authority set up anywhere in the world, more so in Africa, children to those occupying positions of authority are supposed to be treated with the same reverence and respect accorded to their parents. I believe it doesn’t have to be like that in a legal rational authority set up, or maybe it should, after all we remain Africans. Am sure this sounds familiar isn’t it?
So the uniformed security personnel just gave in and started saluting the cadres too.

Well the above is what created the PF Cadre monster tormenting us today. This is how PF cadres became strong. Am seeing the culture remain that way for many years to come. They can beat anyone now apart from President Lungu and his known family members.

I used to believe that Cabinet Ministers being the closest to President Lungu, by virtue of their positions and closeness to him, would be accorded the same respect by PF cadres as they do to him, I was wrong. If you are arguing ask Honourable Given Lubinda, Minister of Justice.

These PF Ministers you see are toyed around by these cadres. In Zambia today, the cadres can easily get a minister fired than the Intelligence system. That’s how powerful the cadres are. The cadres simply walk into any government offices including Ministers’ offices and homes, make demands for money, fuel etc, any Minister who cashed them excuses is threatened with blackmail to the President and for fear of being sucked, and knowing how much they have stollen the Ministers simply comply.

To open your eyes, look at the. Minister of Land, what is she to PF cadres when it comes to sharing and selling reserved state land. The Minister of Local Government, what is he to PF cadres when it comes to collection of market and Bus station levies. The Minister of Mines, what is he to PF cadres also known as Jerabos when it comes to looting Zambia’s underground minerals on the Copperbelt & now Northwestern. By the way, the looting of Gold from Kansenseli Gold mine in Ikeleng’i is still going on.

This is the more reason the Chinese who are scavenging for everything they can loot from Zambia, after quickly spotted the loophole, are working harmoniously with PF cadres to access whatever they want. Through the PF cadres the Chinese are well connected to whoever has the authority to give them whatever they want, from business licences to coordinated passage into and around Zambia, as they transport their loot through to China and as they bring whatever they have to bring into the country to help them loot more and fast.

The Chinese easily secure passage out or into the country for anything they have to transport, be it gold, copper, ivory, vehicles, machinery or US Dollars in suitcases, even through KK International Airport. They just use their connections with PF cadres.

All that the cadres do, including those working at State House is simply use the name of the President. They just claim to be doing the President’s errands and any government official who refuses to favour them with what they want is easily labelled as pro opposition UPND and boom they are fired in national interest.

The same applies to heads of government departments, the cadres demand to be be supplied with fuel for party activities and when they refuse then they are blackmailed as pro opposition. This is what has earned many civil servants retirements in national interest. Civil servants that come from Western, Northwestern, Southern, Central and Copperbelt rural are a threatened specie under this particular circumstance.

Unknown to many when the cadres offered to fight any competitor to Lungu at Mulungushi Rock of Authority, during the process of electing a Presidential Candidate for PF was the fact that the cadres and looters foresaw and were very sure that once Dr. Edgar Chagwa Lungu assumed the Republican Presidency they would be able to exploit the introvert trait that they had observed in him to do as they pleased.

President Lungu had no input in his rise whatsoever, the cadres & looters did it for him. All he had to do was sit back and watch everything unfold, assuredly so, in his favor. What followed after the dribbling and the intimidation was him being sworn in as President of Zambia, and again for the second time.

However, the man only has power to inflict pain on opposition leaders whose only crime is daring to legally exercise their constitutional rights and to enjoy their freedoms that include the freedom to assemble, freedom of speech, for political mobilization purposes and exercising their democratic right to seek public office. He can’t punish PF cadres, supporters and Ministers who continue to commit wrongs.

The cadres collect market and bus station levies on a daily basis, money that was supposed to go into public coffers to develop Zambia. PF cadres get the money and channel it to their superiors in the hierarchy of the ruling party. The question is who is the ultimate recipient of this money? Who is the godfather in all this looting? Surely the ultimate recipient of the monies collected by cadres from poor Zambians must be some an untouchable godfather somewhere. That’s why no law enforcement wings have ever tried to arrest the known cadres who are sent to do all these things.

Almost a year ago, there was a revelation alleging that former PF Lusaka Provincial Chairman was chewing money collected from Kulima Tower bus station alone. They also mentioned thousands of Kwachas collected from other markets & bus stations on a daily basis and all this money goes to the party in power not into the state coffers. President Edgar Lungu has never done anything to stop this looting and this inaction is baffling.

There are many ways the PF as a party could be benefiting from this. One way is that the money is used to run the ruling party and also to sustain the cadres through commissions for their upkeep.

With such remuneration and state protection the cadres are ready to maim, bruise or kill for President Lungu with or without instructions from anyone, knowing very well that nothing will happen to them. That’s the reason why PF cadres are so ruthlessly violent such that even Ministers fear them.

The cadres even have a direct phone line access to State House, the more reason even Security and Defence Chiefs fear them. Inspector General of Police is an errand boy to PF cadres. They easily command him and the only thing he does is to ask them what they want him to do exactly, when, where and how they want it done. Actually at some point, our Ministers feared cadres more than President LUNGU himself.

Only Mwanwasa managed to grow his own skin and successfully termed cadres.

The good news is that we still have chance to correct this situation. We simply need to put aside our tribal voting pattern and vote for honest, knowledgeable, serious, patriotic women and men with proven integrity to lead us. We can do that on 12 August 2021. Let’s give HH a chance. Forget his Tonga persona thing that PF keep bringing out, because it is just meant to divide us on tribal lines. Let’s remove the tribal spectacles that PF had covered many of you when they received Do As I say Powers.

Let’s save mother Zambia from the hands of unruly cadres and looters of Zambia’s resources.
