The New Dawn administration has stretched out desperate measures to rig 2026 general elections , Patriotic Front- PF Secretary General Hon. Raphael Mangani Nakacinda has hinted.

Speaking during the installation of Mr. Sturdy Mwale as Copperbelt Provincial Chairperson in a fillled to capacity Secretariat in Ndola , Mr. Nakachinda said the current government has embarked on NRC and voter registration in their perceived strongholds.

He said what was shoking was that government was rolling-out such an exercise secretly without announcing to all Zambians .

He expressed worry that the exercise had been rolled-out in Southern Province, Western Province, North Western Province with extention in some parts of the copperbelt.

But he urged party members and Zambians at large to stay alert and ensure that they all register for them to participate in all elections.

Mr. Nakachinda further disclosed that another UPND’s ploy to rig the 2026 election is by curtailing opposition political parties’ freedom of assembly and speech.

He urged PF members countrywide to remain steadfast and kick out a government that has subjected them to high poverty levels.

Meanwhile Mr. Nakachinda has thanked party members who have hailed his appointment but was quick to mention that those who were opposed to the decision must not judge him quickly .

He has since called on serious party mobilisation and discipline.

Meanwhile newly appointed National Chairperson Hon. Bowman Chilosha Lusambo
has called on all members of parliament to respect the party’s position on National matters.

He said it was utter indiscipline for Members of parliament to have parallel communication channels.

He categorically singled out Kanchibiya Member of Parliament Hon. Sunday Chanda who was quick to coment on Constituency Development Fund- CDF when the party had noticed serious irregularities in the distribution.

And MCC Chishimba Kambwili who was also present called absolute participation from all member if the party is to retain power in 2026.

He called on the party leaders at all levels to exhaust all mediums of communication to point out ills in the UPND.

The former Copperbelt Provincial Chairperson Nathan Chanda who has been elevated to the Central Commitee has since handed over his position to Mr. Sturdy Mwale.

Mr. Mwale has called for unity and coordination in the party.

He was of the view that all differences must be put aside for the good of the party .

Socialist Party (SP) Deputy Secretary General Antonio Mourinho Mwanza has slammed the ruling United Party for National Development (UPND) over their habit to use the police to oppress their opponents.

He told journalists yesterday at Chelstone Police Station that the manner in which police have handled the case involving party’s National Youth Secretary Elias Gabriel Banda is strange.

“It is extremely strange. 21:00 yesterday the legal team was here and the police had assured us that Gabriel was in custody. Later on we received intel that they had taken him to Lilayi. We went to Lilayi we couldn’t find him,” he said.

“And what is strange also is that if the suspect is moved, the rule of the police is that they are supposed to put it in their log book, to show that the suspect has been removed. There is no record in their log book to show that he has been removed, and to show that he has been moved and what time he was moved.”

Mr Mwanza said the primary concern for the party is the safety and security of Mr Banda.

He said he could only assume that Mr Banda is safe “but we are very doubtful, because we don’t know what they did to him in the night when they moved him.”

“We cannot rule out the issue of torture because this has been done before by the police, where the police have been accused of torturing suspects. We are very very worried on whether he was taken in a manner that respects his rights as a citizen or as a suspect.”

Mr Mwanza who is also former UNZASU President added that the charges Mr Banda is slapped with are absurd.

“Because to begin with, the university of Zambia is a public institution which can be accessed by anyone. There is nothing of security nature that stops any citizen from accessing the University of Zambia,” he said.

“There is no evidence, whatsoever that Gabriel Banda instigated the students, or he was at the university of Zambia when the riots were taking place…even if he were at the University of Zambia, the University of Zambia still remains a public institution. Anybody can be found at the University of Zambia.”

Meanwhile, Mr Mwanza disclosed that what is obtaining regarding the matter in question is targeted at the party president, Dr Fred M’membe.

“But we know, all this thing is centered on Dr Fred M’membe, that is the target. So Gabriel is being used to get to Dr Fred M’membe. We are very much aware that this government is cooking up a lot of cases against Dr Fred M’membe, tramped up charges, and their goal is to ensure that he is not put on the ballot paper in 2026.”

“There are schemes by this government to lock up Dr Fred M’membe on unbailable offences. And all this is part of the buildup. There are so many cases given to Dr Fred M’membe. Cases that when we go to the police or we go to court, the police are not ready to produce the evidence. We know the target here is Dr Fred M’membe and they want to get to him, and Gabriel is just one of the people that they are using to get to Dr Fred M’membe. What they are trying to do is to force Gabriel to say that Dr Fred M’membe is the one who funded the operations of the students at the University of Zambia.”

He argued that students are intellectuals with their own fresh minds and they cannot be influenced by anybody.

“We suspect that Gabriel has been tortured, that is our suspicion as a party, that he has been tortured and that the aim of that torture, according to our suspicion, is to force him to implicate Dr Fred M’membe in the riots at the University of Zambia,” he said.

THE SOARING PRICES OF MEALIE MEAL IN ZAMBIA : A CONSEQUENCE OF FLAWED POLICIES

It is not wise to introduce crude policies in the running of the affairs of the nation and then when those policies backfire to decide, in the presence of the whole world, you put the blame on outside forces who have had nothing to do with what you brought down upon yourselves.

In 2 years, Zambia has experienced a significant Critical issue that affects the daily lives of its citizens: The skyrocketing prices of mealie meal, a staple food that holds a critical place in the nation’s diet. This has raised concerns among all stakeholders such as the Church,political parties and the entire nation.

The primary reason for the soaring prices of mealie meal in Zambia is the introduction of untried policies in the running of the national economy by the government. Policies related to agriculture, trade, and subsidies as implemented have resulted in an unprecedented rise in the mealie meal prices on the market. The poorly conceived policies have disrupted the production, distribution, and pricing of mealie meal and consequently burdening the citizens with high cost of living while their incomes are below poverty datum line.

The unchecked removal of restrictions on the export of maize, a key ingredient in mealie meal production, has also stifled the supply chain in the domestic market. You cannot export everything you have including stocks from the reserves and expect a stable and reliable supply chain. Lack of due diligence research on introduction of free for all export of maize has compounded the challenges the nation faces in the distribution and marketing of maize.

As if this is not enough the deliberate confusion in the farmers’ support programmes as a result of FISP removal as the means of subsidising the peasant farmers as main producers of maize has compounded the market place as the farmers now need more financial resources to produce the same quantity of maize required in the market place.

On the other end, Zambia’s agricultural sector, including maize production, has not received adequate investment and modernization. This lack of investment has resulted in lower yields and increased production costs, impacting the availability and affordability of mealie meal. Insufficient resources allocated to farming communities and outdated agricultural practices have further contributed to the rising prices of mealie meal.

While heavy investment in the mechanised farming industry may hold the hope for future mass production of the staple food, unresearched frequent changes in government policies, coupled with uncertain economic conditions, have discouraged investment in the agricultural sector. Such unpredictability disrupts long-term planning and affects the overall production and pricing of mealie meal.

The government must reassess its approach to agriculture, trade, and subsidies, ensuring that policies are effectively executed to support local farmers, encourage investment, and enable a secure affordable mealie meal for its citizens. Addressing these policy challenges will be crucial in alleviating the strain on consumers and fostering a more sustainable and secure food market within the nation.

LUSAKA- MINISTER of Finance and National Planning Situmbeko Musokotwane has
proposed to spend K177.9 billion in the 2024 National budget whose
theme is unlocking Economic Potential of the country.

Dr Musokotwane said through this year’s budget, Government makes a
commitment to provide the policy framework, resources and incentives
to unlock the economic potential of our country.

He said the budget is a clear demonstration of the commitment to
unlocking the economy, uplifting the livelihoods of the people and
providing a conducive
Dr Musokotwane was speaking when he presented the 2024 National budget
at Parliament buiding this evening.

The Minister has also announced an increase of K4.8 billion to the
Constituency Development Fund (CDF) translating into K30.6 million for
each constituency.

Dr Musokotwane said the increase is meant to ensure that more
resources are directly provided to communities for local development,
including basic services such as clean and safe water, maternity
wings, and school desks,
“I propose to increase the allocation to CDF to K4.8 billion.

With this increase, each constituency will receive K30.6 million from the
current K28.3 million,” he said.

And Dr Musokotwane said that to promote entrepreneurship among
people,Government has proposed to allocate K391.9 million to the
Citizens Economic Empowerment Commission (CEEC).

He said this is in addition to other empowerment funds under CDF,
Gender Division, and the Ministries of Community Development and
Social Services, and Youth, Sport and Arts.
And to improve air transport and to ensure that Zambia becomes a
regional hub for air connectivity, Government has proposed to spend
K700.7 million on Provincial Aerodromes.
He also said that the allocation is earmarked for the rehabilitation
and upgrade of Mansa, Mbala, Mongu, and Solwezi Airports and the
development of Chinsali, Choma, and Kasaba Bay Airports.

Government has also allocated K769.5 million to the tourism sector for
the development of tourism infrastructure, marketing, wildlife
management, and development of tourism products, among others.

Meanwhile Dr Musokotwane said to improve access to affordable loans
for public servants, Government has allocated K150.0 million to the Public Service Microfinance Company.

“The amount will go towards the recapitalization of the institution to provide affordable loans and other innovative financial solutions to public service workers across the country,” he said.

The minister has also proposed to spend K1.9 billion on grants to
schools in line with the free education policy.and in addition,
government propose to increase the allocation to the School Feeding
Programme to K111.7 million from K39.4 million to increase coverage
and improve the quality of meals.

“This provision is very important for next year, in particular, and is
part of the response measure to the escalated food prices. 200, to
continue with the program of completing abandoned secondary schools, I
propose to spend K338.3 million,” he said.

He has also proposed an allocation of K70.0 million for equipping
TEVET training centres with modern equipment to enable them provide
quality and relevant vocational skills.

Let’s go back to the Budget.

Minister of Finance Dr. Situmbeko Musokotwane’s budget of 2022 and 2023 achieved little or nothing.

The 2023 will likely suffer the same fate.

The biggest crisis Zambia has is rising poverty levels, high unemployment rate, disease burden, and slow economic growth.

Currently the population is faced with the highest cost of living in decades and suffering high prices of essential foodstuffs, commodities and high energy bills.

There is failure or little improvement in critical sectors of health, educational l, social protection, and agricultural services.

Despite funding to the health sector, there is a persistent shortage of drugs, medical supplies, and laboratory re-agents. There is equipment and diagnostic machines failure.

What measures or mechanisms have been deployed to resolve these national crises?

For example ordinary workers will contribute K23 billion through Pay as You Earn (PAYE) tax while the mining sector that is generating billions of dollars a year, will pay K10billion only as Mineral Royalty Tax!

Now poor people will pay tax on every mobile money transaction, reducing incomes for the poor further.

Despite the fanfare and excitement that characterised the presentation of the 2023 Budget last year, look at its achievement;

■ The economy is projected to grow by 2.7 percent in 2023 compared to 5.2 percent in 2022.

■ Inflation has shot upwards to 12.0 percent in September 2023 from 9.9 percent in December 2022.

■ The Kwacha depreciated by 10.9 percent against the US dollar to K20.05 per US dollar between January and August this year.

A budget should be a tool to spur economic growth, attend to the needs of the people while fostering an environment to create jobs and opportunities, and develop infrastructure for the country.

• Constituency Development Fund (CDF) Enhancement: The government has allocated an impressive increment of K4.8 billion to the Constituency Development Fund (CDF). This signifies a substantial boost, with each Constituency set to receive K30.6 million in the forthcoming fiscal year.

KAOMA- Republican President Mr Hakainde Hichilema this afternoon officiated 1017 Zambia Correctional Service warders and Wardresses recruits who completed their training at Nyango Training Institute in Kaoma of Western Province.

In addressing the new officers President Hakainde stated that there is need to help those that are in various detentions to realise that being in jail does not mean the end of life and also that anyone is a potential customer of detention facilities, and therefore when such a one is placed under their custody, they must ensure safety of such citizens.

“We have been to these detentions before and drew a lot of lessons, among them the need to modernise these facilities so that they can be more habitable,” he Said.

And Commissioner General, Fredrick Chilukutu thanked the President for the support being given to the facility and urged security wings to participate in agriculture to increase mealie-meal production.

Meanwhile Nyango Training Centre commander, DCP James Nkoloma said Nyango training Centre received 1025 recruits but of that number 8 were dismissed due to indiscipline.

The recuits started their training on 16th December, 2022 will finally become the Second newest officers in the County after department of Immigration graduated 347 Immigration Assistant on Wednesday 27th September, 2023.

The Kabwe Regional Immigration Office has secured the conviction of Bydon Mwambi, a 45-year-old Zambian, for aiding and abetting prohibited immigrants.

He was handed over to the Chibombo Immigration Office by the Police on 16th July 2023 after the Police intercepted a containerized Volvo Truck and Trailer he was driving, carrying 57 undocumented immigrants from the Horn of Africa.

The group, comprising 44 Ethiopians and 13 Somali nationals, was intercepted at Chisamba Police Check Point following a tip-off from a concerned member of the public.

On 26th September 2023, the Kabwe Magistrate, Honourable Kunda, convicted Bydon Mwambi for aiding and abetting prohibited immigrants and sentenced him to a fine of K 60,000 or, in default, two years imprisonment with hard labour.

The Truck and Trailer have since been forfeited to the state.

The Katete Immigration Office, on 20th September 2023, secured the conviction of Ephraim Banda, a 25-year-old Malawian national, for illegal entry and engaging in employment without a Permit and Nedson Tembo, a 35-year-old Zambian, for employing the undocumented Malawian.

The duo was apprehended by the Katete Immigration Office on 13th September 2023, at Chavuka One Section in Katete District at Nedson Tembo’s House, following a tip-off from members of the public.

Investigations revealed that Ephraim Banda entered the country illegally on unknown dates, but between 10th June 2021 and 13th September 2023, and in June 2023, he stayed at Nedson Tembo’s House and was employed as a laborer on Tembo’s farm in Gileya Village.

In the count of unlawful entry in Zambia, Ephraim Banda was sentenced to 18 months imprisonment with hard labour.

In the count of engaging in employment without a permit, the Court sentenced him to 18 months imprisonment with hard labour in addition to a mandatory fine of K 500. Meanwhile, Nedson Tembo was sentenced to six months imprisonment with hard labour for employing a foreigner whose status does not authorize that person to be employed.

The Isoka Immigration Office, on 22nd September 2023, secured the conviction of a 42-year-old male Somali Driver for failing to comply with the conditions of his Employment Permit contrary to section 34 (c) and 56(1) of the Immigration and Deportation Act No. 18 of 2010 of the Laws of Zambia.

Particulars of the offence are that Bare Sungule Ali, on 14th September 2023 in Isoka District, being a Somali national employed under Shire Motors Limited as a Truck Driver, was found driving a Volvo Fuel Tanker belonging to Rass Transport Limited, thereby going against the condition of his Employment Permit which only permits him to work for Shire Motors Limited.

He was sentenced to pay a fine of K 7,000 or, in default, nine months simple imprisonment. The Kabwe, Katete, and Isoka court outcomes bring the number of convictions secured by the Department of Immigration between 19th and 28th September 2023 to 119.

During this period, the Department apprehended 165 persons for various immigration offences, removed 128 illegal immigrants from the country, and refused 34 foreign nationals entry.

The Department wishes to warn members of the public to desist from aiding, abetting, and harbouring illegal immigrants.

We also want to advise holders of various immigration permits to comply with the terms and conditions of the permits to avoid being penalised.

Government Proposes 177.9 Billion Kwacha Budget for 2024

Finance and National Planning Minister Situmbeko Musokotwane presented the proposed national budget for 2024 to parliament , revealing that the government intends to allocate nearly 177.9 billion Kwacha for the fiscal year.

Of this proposed budget, Minister Musokotwane disclosed that 141 billion Kwacha will be generated through domestic resources, while an additional 3.4 billion Kwacha will come from grants.

One of the key highlights of the proposed budget is the revision of the Pay As You Earn (PAYE) exemption threshold. Dr. Musokotwane announced that the threshold will be raised to 5,100 Kwacha from the current 4,800 Kwacha in the upcoming national budget. This adjustment aims to alleviate the tax burden on citizens, especially in light of rising living costs.

The Finance Minister emphasized that this change in the PAYE threshold is in direct response to concerns raised by Zambians regarding the high cost of living and the resulting impact on their finances.

In addition to the threshold revision, Dr. Musokotwane proposed a reduction in PAYE rates from the current 37.5 percent to 37 percent. This move is designed to provide further relief to workers and promote economic stability.

The proposed budget also allocates significant funds for infrastructure development and sector-specific improvements. Notably, 701 million Kwacha has been allocated for the upgrading and rehabilitation of provincial airports in Mansa, Mbala, Solwezi, Choma, and Kasaba Bay, aiming to enhance transportation accessibility across the country.

Furthermore, 770 million Kwacha has been earmarked for infrastructure improvements within the tourism sector. This allocation aims to attract more tourists to Zambia, boosting the country’s tourism industry and economic growth.

Local government has not been overlooked in the proposed budget, with an allocation of 1.4 billion Kwacha for the Local Government Equalization Fund. This fund is intended to support the remuneration of Councillors, contributing to the efficient functioning of local governance.

The Economic Sector is set to receive 39.8 billion Kwacha, with specific allocations for various areas. Eight billion Kwacha will be directed towards road construction projects, while 13 billion Kwacha will be allocated to the agriculture, fisheries, and livestock sectors. Additionally, 8.6 billion Kwacha will be used to support one million farmers under the Farmer Input Support Programme, bolstering the agricultural industry and ensuring food security.

The proposed budget for 2024 now awaits further deliberation and approval in parliament before becoming official policy.

Government has increased constituency development fund (CDF) allocation for 2024 to K30.6 million—from the current K28.3 million.

“Madam Speaker, to ensure that more resources are directly provided to communities for local development, including basic services such as clean and safe water, maternity wings, and school desks, I propose to increase the allocation to CDF to K4.8 billion. With this increase, each constituency will receive K30.6 million from the current K28.3 million,” announced the Minister of Finance and National Planning, Situmbeko Musokotwane.

Dr. Musokotwane announced the increase on Friday September 29, 2023, in the capital, Lusaka, when he presented the 2024 national budget to the National Assembly.

The minister, who described CDF as a game-changer, added that “As at [the] end of August 2023, a total of 3,132 classrooms were built under the CDF.”

The ambitious increase comes at a time when many constituencies across the country have been seen failing to identify and dedicate CDF towards their respective competitive edges.

This failure has caused some of the constituencies to spend the funds on duplicate, expensive equipment, such as graders—which many of them do not even need to buy.

For instance, why would two constituencies sharing boundaries buy the same equipment separately?

Need for plan-based CDF allocation

One of the notable objectives of the 2024 national budget is to reduce government expenditure, which, according to Dr. Musokotwane, directly translates into fiscal discipline.

“Madam [Speaker], I am happy and proud to report that in the two years that this Administration has been in office, fiscal discipline has been very high. As I just reported, revenues and expenditures are nearly spot on as authorised by this august House,” he announced.

Talking of discipline. Is it discipline when a parent dishes out huge sums of money to his or her children without asking what their respective, immediate financial priorities are?

That’s where the issue is. Before the Government allocates a penny to any constituency for its development, it needs to compel the requesting constituency to undertake a development needs assessment.

This requisite assessment should understand threats, opportunities, areas of urgency, and identify possible project benefits.

The assessment should also produce a baseline document (which will act as a reference point after implementation), in addition to, finally, producing a justifiable, itemized budget.

Once these steps have been exhausted, that’s when the Government can decide how much a particular constituency actually needs for its development projects.

The Government should also make it a tradition for every constituency to produce progress reports either quarterly or after every fiscal year.

These reports should be a solid basis for releasing or not releasing additional funding to complete projects which would have not been completed.

Until such measures are introduced by the Government, the so-called fiscal discipline would be a far-fetched idea, which will only exist on paper.

In addition to strengthening fiscal discipline, plan-based CDF allocation will help ensure that the funds are allocated to projects that align with the central government’s priorities and timelines.

Otherwise, the current Good-Samaritan’s CDF allocation approach promotes only impulse shopping among constituencies.

LEADER of the Opposition in Parliament Hon Brian Mundubile has charged that all well meaning Zambian Parliamentarians stand ready to defend the constitution.

Hon Mundubile who is also Mporokoso Member of Parliament says that as peoples representatives, opposition members of parliament will fight to defend the constitution even if it means defending it from the President.

He says that it is extremely appalling that the entire head of state would attempt to ignore the law in making appointments.

“It is extremely shocking to us that the President is irritated when there is a call to follow the law and government process that are outline and enshrined in our Republican President” Hon Mundubile said.

Hon Mundubile who is also a constitutional lawyer by profession says that the republican constitution exists to discipline airing governments like the new dawn.

He says that whether President Hichilema likes it all not he and his government will have to govern within the law and no Zambian will seat idle and allow him and his cohorts to ignore procedure and law.

“ President Hichilema must understand that our Republican constitution is supreme and he has no choice but to follow it to the later, we are not asking him for a favor by imploring him to follow the law, he has no choice but to follow the law and government procedure not how irritating it may be to him” Hon Mundubile charged.

Hon Mundubile, a PF Presidential aspiring candidate insisted that Mr Hichilema sets aside his personal feelings when it comes to making decisions that require strict adherence to the law and government procedures.

And Hon Mundubile says that it is an extreme joke that the police would want to curtail President Edgar LUNGU’s routine fitness run.

He says that government has no right to curtail President Edgar LUNGU’s free movement as there is no law that empowers the current inspector general of police with powers to pause restrictions on the former head of state.

Hon Mundubile has since called on all well meaning Zambians to spare to time to pray for the Inspector General of Police as his way of policing leaves much to be desired.

1. More than two years after forming Government, President Hakainde Hichilema has finally made the first reshuffle of his Cabinet by firing the Minister of Information and Media and replacing her with the Southern Province counterpart. But how meaningful is this reshuffle really?

2. When you are President of the Republic, a reshuffle of your Cabinet is supposed to address areas of weakness where you have failed to deliver to the expectations of the people. Any objective person who looks at Mr. Hakainde Hichilema’s Government will agree that the two key areas of weakness are the Ministries of Finance and Agriculture.

3. The Ministry of Finance has failed to grow the economy. It has failed to create employment. It has failed to stabilize key variables such as the exchange rate, inflation, prices of key production inputs such as fuel etcetera. The Ministry of Finance has failed to put a stop on over-borrowing, having grown our foreign debt from around $11 billion in 2021 to the current almost $15 billion, and having more than doubled our domestic debt from around K96 billion in 2021 to the current almost K207 billion. The Ministry of Finance has further shrunk our monthly withholding tax collections from the mines from an average of $400 million in 2021 to a paltry $80 million at the moment, because of its funny policies such as tax holidays and the swap deal of withholding tax for dividends made in 2022 with First Quantum Minerals, which was one of the major contributors of withholding tax among the mines. The Ministry of Finance has almost doubled the cost of living in the past two years, according to the JCTR (Jesuit Center for Theological Reflection) basic foods basket index, which has moved from around K5,000 for a family of six in 2021 to about K9,400 in 2023. Indeed, there’s no doubt in my mind that the Ministry of Finance is a failed Ministry, and if President Hakainde Hichilema was serious about addressing the plight of the Zambian people, his reshuffle should have covered this Ministry so that fresh blood is injected and we see what we can achieve as a country thereafter.

4. The Ministry of Agriculture is the second most chaotic and under-performing Ministry in Zambia. In the past two farming seasons that it has presided over since UPND formed Government, they have consistently failed to deliver farming inputs on time or in the right quantities or in some cases at all. The upcoming 2023/2024 farming season appears set to be a repeat of the 2022/2023 and 2021/2022 disastrous farming seasons, with their signature cancellation of fertilizer tenders repeating itself this year, all over again. The Ministry of Agriculture has failed to recapitalize Nitrogen Chemicals of Zambia in Kafue so that we can produce cheap fertilizer locally since we have all the raw materials here in Zambia, instead preferring to import the commodity at ridiculous prices as high as $1,000 per tonne. The end result has been that the cost of production for maize which is our staple food, is very high and when the farmer passes over that high cost of production to the consumer, the mealie meal becomes unaffordable to most Zambians since most people’s incomes have not only remained stagnant, but have dwindled due to inflation, thanks to another underperforming Ministry, the Ministry of Finance.

5. Therefore, any Cabinet reshuffle done by President Hakainde Hichilema, which does not address the underperforming Ministries of Finance and Agriculture, is superficial, meaningless and unresponsive to the needs of the Zambian people. The fact that the President decided to only reshuffle the Ministry of Information and Media and excluded the other two biggest non-performing Ministries, means that the President is not listening to the cries of the Zambian people when they say that the cost of living is unbearable. But perhaps it is not the Ministries of Finance and Agriculture which have been underperforming, but President Hakainde Hichilema himself. In which case, it is the duty of the Zambian people to reshuffle Mr. Hakainde Hichilema out of State House in 2026.

“Greetings Mr President . I hope you are well.

I imagine you have read this malice, published by Koswe, a Facebook page run by State House individuals who are known to you. This malice is aimed at scandalising me over my criticism of some of your leadership actions. I request that you prevail on your officials to avoid taking this path of character assassination or personal attack. I have never turned personal in any of my public criticism of our leaders, both you and those who came before. I am always respectful and civil and I always stick to the issues that matter most.

You and your supporters have the right to criticise my opinions on any topic. What you don’t have is the right to maliciously scandalise me especially on rogue pages that are linked to State House.

Attacking my person does not address the content of the criticism, risks undermining your administration’s democratic credentials and puts me in harm’s way including by way of political violence, especially in a society where many have been encouraged to believe that criticism of the government is not only wrong but should also attract punishment.

No democracy is without critics and no government anywhere in the world believes itself to be perfect. If your officials believe l am mistaken on any issue, they should argue the merit of their case rather than attacking my person and my apparent motives. A more helpful response to my writings would be to pay attention to the content of my criticism and address the identified flaws, or to employ competent people who can respond or explain your or the government’s actions. Political speech and debate should be respected and protected as you yourself promised you would do once you ascended to leadership.

Successive ruling parties and their supporters fail to realise my simple approach to public commentaries: to hold to account elected public leaders in office, whoever these may be. Once they exit, my attention shifts to the failings of the new leaders. This often makes me appear like I am working with the opposition. As a result, successive sitting presidents tend to mistake me for an opposition supporter when all I do is to share my opinions on matters of governance.

When I pointed out critical failings of the state under president Rupiah Banda, I was accused of supporting the opposition PF led by Michael Sata. When I pointed out critical failings of the state under president Sata, I was accused of supporting the opposition UPND led by you. When I pointed out critical failings of the state under president Lungu, I was again accused of supporting the opposition UPND led by you. Today, whenever I point out critical failings of the state under your leadership Mr President, I am accused of supporting the opposition.

In all these instances, my supposed support for any of the presidential candidates are a matter of public record, making this characterisation entirely false. I regard my writings as an indispensable part of our democracy and l will continue playing my role the same way I have been doing in the past and present.

I would like to believe that I have been consistent in my criticism of the failings of our leaders, starting from Banda, to Sata and Lungu, and now you. And I am never personal in my criticism of our leaders. I focus on the issues that matter most and use respectful and civil language.

I am not there to change regimes. I only share my opinions on governance issues. I am a requited lover of Zambia, a defender of democracy, and a critic of all politicians and their political parties, in and outside government, when I think they are straying from the path of democracy and the promotion of the common or public good. That is all. You, our leaders and your supporters, will do well to engage the substance of what I say as opposed to attacking my person. As I said, a more fruitful relationship is to exploit my independent criticism and opinions while protecting my independence.

I implore you and your team, Mr President, to learn to appreciate the importance of feedback on government performance by citizens. Contributing to national affairs through public commentary and discourse is not a partisan affair; it is civic or patriotic duty.

The effectiveness of any government is amplified when it has the support and guidance of its academics, political economists, policy analysts, and other data-driven stakeholders. These professionals and academics play an important and critical role in steering discourse and promoting accountability towards enhancing government functions and delivery. They help bridge the gap between politicians and citizens by providing crucial feedback about the effectiveness of government actions, programs and policies. This kind of feedback is crucial.

I conclude by repeating that contributing to meaningful discourse is not partisan, but essential in promoting accountability and transparency towards enhancing government peformance. I hope my communication to you will align your actions to protecting this critical role of citizen speech as you promised during your campaigns.

A prominent Member of the Patriotic Front – PF has dispelled assertions that there is a leadership Crisis in the party.

Featuring on KBN TV’s Flashback Programme, Tuesday, Celestine Mambula Mukandila said the PF has a functional Central Committee which is the heartbeat of the Party.

Mr Mukandila said every decision made in the Central Committee binds every member.

He said it is therefore disappointing that some People such as Miles Sampa want to challenge the decision to appoint Hon. Raphael Mangani Nakacinda as Secretary General by the Central Committee through the Vice President Given Lubinda.

“It is disappointing that we have conducts of certain individuals who showed that they lacked the leadership qualities following the appointment of Hon Nakacinda. If you are not happy with it, burry your pride,” he said.

Meanwhile, Mr Mukandila has condemned the usage of the word hijackers on some Patriotic Members of the PF.

He said the mentality of saying true greens and hijackers must never be tolerated.

“This does not also warrant one to attack the secretariat. The behaviour of Miles Sampa, the leadership in Matero have sent a petition that Miles be expelled… But we believe we are a peaceful party…. Any individual is free to conduct themselves in a particular manner provided they do so within the democratic principles and not damaging property….,” he said.

He said the behaviour of Sampa does not place him in good standing with the party.

Mr Mukandila said if Miles Sampa continues on his agenda, he is ready to refund him the K200,000 he paid as nomination fee for the PF Presidency.

“If he continues with his behaviour, we are more than ready to refund him his money. We are a peaceful party we do not want that behavior exhibited by Miles at the Secretariat….,” he stated.

Meanwhile, Mr Mukandila also commented on the changes made at the Ministry of Information and Media which sees Chushi Kasanda replaced by Cornelius Mweetwa while Thabo Kawana has been elevated to Permanent Secretary Position.

“Hopefully Kawana will not be overzealous. We are hopeful Mr Kawana will not be storming Media Houses like he did in his capacity as director spokesperson. Hopefully he will also be able to work hard in hand with his Minister because Kawana can be arrogant..,” he stated.

And Mr Mukandila has defended the PF borrowing during their tenure.

While the Current regime continues to refer to the PF as having left a huge debt of about $9 billion, he has explained that the money was put to good use.

“On the debt mountain of 9 billion. We saw 650 health posts constructed countrywide from scratch , more than 200 primary schools, Roads, more than 5 universities. This Government has also borrowed more than 6 billion in 2 years, what have they done with it?” he said.

LUSAKA- Lusaka youths have questioned the motif behind the continued political and public appearances by former Republican President, Edgar Chagwa Lungu.

Mr Lungu, who since exiting public office in August 2021, has been seen jogging along Leopards Hill Road in Ibex, mostly with a horde of PF cadres, resulting in the disruption of traffic and public order, a habit that most Zambians see as aimed at staging a political comeback.

A number of Lusaka District UPND placard-carrying youths this morning held a match past from Broads Road through Provident Street to the UPND Lusaka Province headquarters where they expressed their grievances at Lungu’s politically-motivated activities.

And addressing the Press later, Lusaka District Information and Publicity Secretary-IPS-Matomola Likwanya challenged the former Head of State to state his political position.

Mr Likwanya, who was flanked by Kamwala Ward 5 Councillor, Mainda Simaata and the IPS drawn from the seven (7) constituencies of Lusaka District, wondered why the PF, whom they accused of being behind the spate of violence that led to the death of notable political figures from the opposition wanted a political come back.

Mr Likwanya charged that the brutal murder of Mapenzi Chibulo, Grayzer Matapa, Nsama Nsama and Lawrence Banda among others at the hands of the PF had condemned the former ruling party into filling the definition of being “cold blood murderers” who wanted to continue butchering Zambians once re-elected into public office.

He further stressed that the PF were blood stained killers who should never be allowed back into the corridors of power, further urging the investigative wings of the State to take keen interest in investigating the murders that rocked the country during the PF’s 10-year rule.

Mr Likwanya also charged that time had come for Parliamentarians to move a motion to remove Mr Lungu’s Immunity so that he could be investigated, adding that, “most criminals were hiding behind the Lungu’s Immunity to escape from the full wrath of the law”.

Patriotic Front Members of the Cental Committee, Prof Nkandu Luo and Hon. Sylvia Bambala Chalikosa have dismissed assertions that they were in the entourage of the Vice President, W.K Mutale Nalumango during her tour of duty in North Western Province.

The assertions are factually incorrect.

HON. Nalumango was in North-western Province to commission Rural Electrification Authority(REA) projects.

On the other hand, Prof Nkandu Luo, Hon. Chalikosa along with Hon. Yamfwa Mukanga and Hon Eileen Imbwae, were in the province as active participants at the annual CAPAH Expo program in Kabompo District.

CAPAH stands for the Coalition of African Parliamentarians Against HIV and AIDS, an organization of considerable importance to which the current Vice President is a founding member, along with Professor Nkandu Luo, and comprises membership of both current and former Members of Parliament.

This was a Parliamentary program outside the Vice President’s official program.

It is therefore understandable to see the excitement by the Prime TV Reporter who must have been thrilled to see the presence of senior Patriotic Front members at the CAPAH Expo.

However, it is essential to note that the Reporter combined completely separate programs in his reporting omitting to mention the important CAPAH activities which Hon. Nkandu and others were attending.

The interaction with the Vice President and the former Ministers as seen in the video clip was limited to a courteous exchange of greetings.

Both Hon. Luo and Hon Chalikosa stated that;

“We hope that this statement provides the necessary clarification and dispels any misunderstandings implying that we were part of Her Honour, Vice President W K Mutale Nalumango’s entourage.”

“We remain committed to the cause of combating HIV and AIDS through our involvement with CAPAH and no one should doubt our loyalty and commitment to the Patriotic Front Party.”

Top Cleric Pushes For Mnangagwa, Chamisa Govt of National Unity (GNU) Talks

By News24-A respected Zimbabwean religious leader has proposed incarcerating its president and his opposition rival in the name of peace.

It would take “courage and wisdom” for Zimbabwean President Emmerson Mnangagwa and his rival, Nelson Chamisa, to put the interests of the country ahead of their own, but locking them up could help, Roman Catholic cleric, Father Fidelis Mukonori said.

In Conversation with media personality Trevor Ncube, Mukonori, suggested the following to solve the impasse between the two:

Let’s do it the Catholic way and put them in a house and they discuss and decide until they’re true.
Give them food inside, they eat, we lock the room, and you don’t come out until you are done.
He said Mnangagwa and Chamisa “know me well now” after he interacted with them separately over the years.

If he were to meet them again over the current political impasse, he would remind them that between 70 000 and 100 000 lives have been lost due to political contestations as far back as the war of independence in the 1970s, he said.

“Why should they play with human lives? This kind of ‘you stole my votes’, ‘I didn’t steal your votes’ can end up with people wanting to go back to the bush [to fight],” he said.

Mukonori has been a constant feature in Zimbabwean politics since the struggle for independence in the 1970s, and is credited with some of the country’s biggest negotiated breakthroughs.

He was involved in brokering the 2009 to 2013 Government of National Unity (GNU) that brought together Robert Mugabe and Morgan Tsvangirai.

While Nelson Chamisa remains a popular figure in Zimbabwe, his ability to bring about the change he promises has become questionable. The country is in dire need of effective leadership to steer it out of its current predicament. Whether Chamisa is the leader to do this remains to be seen. For now, Zimbabweans can only hope for a better future, while grappling with the harsh realities of the present.

Company backed by Bill Gates and Jeff Bezos Aims to Start Copper and Cobalt Production in Zambia Within a Decade

California-based KoBold Metals, supported by prominent figures like Bill Gates and Jeff Bezos, is pursuing ambitious plans to commence copper and cobalt production at the Mingomba project in Zambia within the next ten years. The company is investing approximately $150 million to expedite its quest for additional deposits in this area along the renowned African copper belt.

Additional studies and exploration activities at the Mingomba project are scheduled for completion by 2024, according to Mfikeyi Makayi, the Zambian CEO of the Silicon Valley startup KoBold Metals. Makayi expressed confidence in the project’s potential, stating, “It’s a very attractive project, and we have said within a decade we would want Mingomba to be a producing mine.”

KoBold Metals employs artificial intelligence to search for essential metals such as copper, cobalt, nickel, and lithium, vital for the clean energy transition and the growth of electric vehicles. Backed by Breakthrough Energy Ventures, a climate and technology fund with support from influential figures like Richard Branson and Ray Dalio, KoBold acknowledges the urgency of securing supplies of these metals.

“It’s basically a crisis,” Makayi noted, emphasizing the critical global need for these materials. The extended timeframes associated with mine development align with the commitment of the company’s unconventional backers.

KoBold Metals also collaborates with industry giants BHP Group and Rio Tinto on projects in Australia. Stakes in the Mingomba project are held by commodity investor EMR Capital and Zambia’s ZCCM-IH.

The United States is exploring alternative sources of critical metals supply, and American investors have enabled KoBold to intensify its exploration efforts. The company aspires to discover deposits in Zambia as substantial as Mingomba and explore opportunities in Botswana, Namibia, and the Democratic Republic of Congo.

Makayi refrained from confirming potential partnerships with BHP and Rio Tinto for the development of the Mingomba project, emphasizing that KoBold’s internal capacity could suffice. Discussions with partners regarding the project’s future direction are yet to take place.

The Mingomba deposit boasts a defined resource of around 247 million tons of ore with an average copper grade of 3.64%, equating to an estimated 9 million tons of copper.

Moodys downgrades Vedanta

Moody’s Investors Service downgraded Vedanta Resources’ Limited (VRL) corporate family rating (CFR) from Caa1 to Caa2 over elevated risks of debt restructuring over the next few months. With the current downgrade, the outlook remains negative for the parent company of Vedanta Ltd, as per the global ratings agency.

Moody’s has also downgraded to Caa3 from Caa2 its rating on the senior unsecured bonds issued by Vedanta Resources and those issued by Vedanta Resources’ wholly owned subsidiary, Vedanta Resources Finance II Plc, and guaranteed by Vedanta Resources.

Moody’s Investors Service defines a Caa3 rating as one judged to be highly speculative and with the likelihood of being near or in default but some possibility of recovering principal and interest. A Caa2 rating is within speculative grade and is judged to be of poor standing and subject to very high credit risk.

“The downgrade reflects elevated risk of debt restructuring over the next few months because VRL has not made any meaningful progress on refinancing its upcoming debt maturities, in particular the $1 billion bonds maturing each in January 2024 and August 2024,” says Kaustubh Chaubal, a Moody’s Senior Vice President and lead analyst on VRL.

“VRL’s consolidated debt/EBITDA leverage was 3.7x as of March 2023 – substantially strong for its Caa category CFR. Still, the company continues to face challenges in refinancing its debt, a reflection of reduced appetite from the lending community, and a key credit concern,” Moody’s said in its note.

Moody’s said VRL sold a 4.3 per cent stake in August 2023 in key subsidiary Vedanta Limited for around $500 million to stave off some of the pressure arising from the holdco’s imminent cash needs.

“Vedanta Resources Ltd.’s concentrated ownership with the sole shareholder, Volcan Investments, keeps the risk elevated for related party transactions to the detriment of creditors. In addition, several senior management departures in recent years pose risks to continuity and stability of its operations,” Moody’s Investors Service wrote.

The negative outlook reflects VRL’s persistently weak liquidity profile and Moody’s concerns over the company’s ability to address the imminent cash needs, especially at the holdco, Moody’s said.

Earlier this year, Moody’s had downgraded Vedanta Resources’ CFR to Caa1 from B3. It had also downgraded the ratings to Caa2 from Caa1 on the senior unsecured bonds issued by VRL. The rating agency had highlighted that holdco VRL has paid down around $2.0 billion of its debt during fiscal 2023.

Moody’s had said Vedanta’s liquidity remains persistently weak with management fees and dividends from operating subsidiaries insufficient to meet its looming debt maturities.

However, the agency considers that maintaining liquidity and proactive liability management are more pertinent in preserving VRL’s credit quality, as opposed to debt reduction, given its Moody’s-adjusted consolidated gross debt/EBITDA remains around 4.0x, comfortably below the previous downgrade trigger of 5.5x.

We’re A Nation Of Hypocrites; Selfish Individuals!

The other day, a deafening uproar erupted when a strong rumour from the gossip mill wound its way on social media suggesting that a strip club was about to be opened at Lewanika Mall in Lusaka. Of course, some self-righteous individuals couldn’t waste time burning their precious calories by scaling Mt. Kilimanjaro to pontificate about morals: “How can Lusaka City Council give a green light to such a satanic practice? This is immorality of the worst kind! We’re a God fearing people; a Christian nation for that matter!”

Many of us would be shocked to learn that most of our citizens are actually regulars at strip clubs whenever they’re in Johannesburg for business. We are not by any means endorsing the idea of a strip club, but rather concerned about our hypocriticy on many issues.

What’s the proper definition of “a christian nation,” anyway? Is there really anything christian about the behaviour or conduct…..especially on the part of some of our politicians or the clergy? In Islamic states, they’ve a clear definition of who they are and indeed they stand for. For instance, actions such as cursing, fornication, murder and not honouring ones parents is haram (forbidden.) In the same breath, certain foods and drinks such as pork and alcohol are not permissible.

Sadly, immorality seem to be the order of the day in our christian nation and in certain instances priests and pastors are culprits. Some clergymen seem to have no qualms ‘feasting’ on other people’s wives while teenagers have no trouble ‘enjoying’ the forbidden fruit before marriage. Isn’t quite embarrassing that the spread of HIV/AIDS in our so called christian nation remains high compared to Islamic States? And when it comes to our politicians, the level of hypocrisy is shocking; one would attend church service on a Sunday and proceed to steal from our people on a Monday!

May we now digress and tackle another controversial topic – gay rights. Many of us consider gay people as worst sinners that don’t deserve to walk the face of the earth; we can’t even share a cup of tea with them. Ironically, we are more than happy to accept donations for our HIV/AIDS related projects from individuals who are openly gay such as Sir Elton John. Isn’t this a contradiction? If we are so clean and righteous as we want the world to know, why do we still accept his ‘dirty’ donations? A muslim would never do any business with a company that produces anything they consider to be haram such as alcohol! A few years ago for instance, a Cricketer in South Africa refused to don on a jersey emblazoned with a South African Breweries logo as his faith forbids him from doing do so.

May we now come to vulnerable people in society. If indeed we are a christian nation as we want to proclaim, do we obey what the Bible teaches about the same? James 1 vs. 27 is very clear: “Religion that God our Father accepts as pure and faultless is this: to look after orphans and widows in their distress and to keep oneself from being polluted by the world.”

Again, the Muslims are far ahead of us on this one. Alms giving (zakat) is one of the pillars of Islam. Muslims are expected to give 2.5% of their wealth to charity. Every Friday afternoon, street kids, the blind and generally the poor would swarm businesses owned by Muslims to receive the mandatory help from them. Apart from the Catholics, who by the way didn’t endorse the declaration of Zambia as a Christian nation, how many churches run hospitals, orphanages or indeed provide support to vulnerable people in society apart from depriving the very poor people of the little they have through tithes and offerings? How many rich folks or even pastors are willing to share with those that are in need? Very few indeed, and yet you still want to insist we are a christian nation. My foot!

LUSAKA, Wednesday 26th September,2023: Greetings to all MISA Zambia Members and all other stakeholders. I am writing to announce a significant change in my role at MISA Zambia.

Effective September 30th, 2023, I will be stepping down from my position as the Board Chairperson of MISA Zambia. This decision has arisen from my new responsibilities assigned to me by my employer, (a teaching role at St. Joseph’s Theological Institute in South Africa), which demand a substantial amount of my time and attention, making it impossible for me to continue serving as the Board Chairperson.

I want to express my sincere gratitude for your unwavering support during my tenure as Board Chairperson. Your dedication to our shared mission has been inspiring, and it has been an honor to work alongside all of you.

During my tenure as MISA Board chairperson, we saw a number of positive developments within MISA Zambia like increased membership, online information sessions, increased number of projects that came on Board (which is a sign of increased donor/stakeholder confidence).

We also showed resilience and steadfastness that drew our current government through the Ministry of Information and Media, IBA, and ZNBC to increased consultative collaboration in matters of policy formulation and implementation.

Others include increased capacity building for our members and radio stations. Since January 2023, MISA Zambia has conducted over 54 capacity building workshops, in-house training and Virtual trainings. Without your support, this would not have been possible. It is my prayer that you will continue supporting the remaining Board members and secretariat so that we can achieve more for the good of our media sector.

While my time as Board Chair comes to an end, please know that my commitment to MISA Zambia’s values and goals remains steadfast. I will continue to support the organization in any way I can.

As I transition into this new role, I extend my best wishes to all of you. Your dedication to media freedom and freedom of expression is vital, and I am confident that MISA Zambia will thrive under new leadership.

Pro-junta protesters in Burkina Faso hold big night rally amid coup rumours

Hundreds of people poured into the streets of the Burkinabe capital, Ouagadougou on Tuesday evening (September 26), with reports stating that they were engaged in a pro-junta march.

The march comes in the wake of rumours that the Colonel Ibrahim Traore-led junta was facing an internal coup.

Even though some media outlets claim the coup was organized by some insiders in the junta, GhanaWeb is unable to independently verify that claim.

Videos and photos sighted by GhanaWeb showed a mobilization that was dominated by men, few women and fewer children at a roundabout in Ouagadougou, some chanting slogans, others singing whiles others simply looked on.

People are heard tooting their horns while others blow whistles and rubber trumpets in the busy intersection.

Burkina Faso is one of four West African countries that have experienced a coup in recent years.

The first was the removal of Christian Roch Marc Kabore from office in 2022 by then junta leader Sandaogo Damiba, who six months on was also deposed by the Ibrahim Traore-led junta.

Insecurity was one of the main trigger factors for the last two coups, the spate of killing has not abated since Traore took over.

Burkina, Mali and Niger (all currently under juntas) are currently in an Alliance of the Sahel Nations aiming to combat spreading terrorist violence.

‘France takes us for fools’ – Nigerien protesters

Niger, a country in West Africa, has a high number of deadly attacks by jihadist groups. After a takeover by the military in July, people are worried that if the order is given for 1,500 French soldiers to leave the country, it could make the rebels feel more confident and stronger.

Mayeni Jones from the BBC was able to visit Niger and talk to the government, people who support it, and people who are against it.

Adama Zourkaleini Maiga speaks quietly, but her eyes show strong determination.

The single mother has two children and lives in a peaceful area of Niger’s capital city, Niamey. However, she comes from Tillabéry, a region that has been severely affected by violence.

“She told me during lunch that my mom’s cousin was the leader of a village named Téra. ” “He was killed just seven months ago. ”

The bad people were searching for him, and when they discovered that he had borrowed a car to escape, they caught him and ended his life. They cut his throat. Our whole family was really surprised.

Adama holds France responsible for not being able to control the violence, even though they had 1,500 soldiers in the area to fight against Islamist militants.

“She says that they are not able to say that the French army was victorious. ” “I don’t get how they can claim to be aiding people in fighting terrorism, but the problem keeps getting worse each year. ”

Niger was considered the final Western friend in the Sahel, a mostly dry area that has become the main location of violent extremism. France and the United States both have military soldiers in Niger. Niger is also where the United States has its largest drone base.

However, when France declined to acknowledge the new military government in Niger, the existing anger towards what the people saw as unwanted French involvement in their country’s affairs became intense.
Many people in Niger think that France has had special access to the country’s leaders and natural resources for a long time. They view the coup as an opportunity to start fresh, regain control over their own country, and remove the influence of France.

Adama says that the army in Niger has never remained in control for a long time. He is talking about the five times where the army took over the government since the country gained independence from France in 1960.

“The military will eventually go back to their bases and give control to a more effective civilian government that will lead Niger to its future,” she says.

People in France got very mad when they said no to Niger’s new leader. This got worse when the people in charge told their soldiers and ambassador to leave the country.

French President Emmanuel Macron at first said no, but now he says he’s decided to say yes to the demands of the junta because the Nigerien authorities are not interested in fighting terrorism anymore.

‘France thinks we are stupid’

Hundreds of people have been staying outside a military base in Niamey that has French soldiers. They have been there for many weeks and are preventing supplies from reaching the soldiers.

The protesters gather and sit in prayer on Fridays. In the hot afternoon, Imam Abdoulaziz Abdoulaye Amadou tells the people to wait calmly.

He tells the people that just like it takes time for a man and a woman to get a divorce, it will also take time for Niger to separate from France.

After he finished speaking to the people, I asked him why the people of Niger are very mad at the French even though they worked closely together for many years.

He says that Niger is the best partner for France in the entire Sahel region. France is not agreeing with what we want and that is causing tension.

France had the option to leave without causing any trouble after the coup, and then returned later to have discussions with the people who staged the coup. Why is Emmanuel Macron currently saying that he does not acknowledge our authorities, when he has previously supported coups in other nations such as Gabon and Chad.

During the prayers, there is a lot of noise and excitement because a large car with armed guards arrives.

The recently chosen leader of Niamey, General Abdou Assoumane Harouna, commonly referred to as Plaquette, goes outside. He is a very tall man, measuring 6 feet 5 inches, and he is wearing clothes typically worn by soldiers and a green hat.

As we try to talk to him for an interview, he points to my producer and says to everyone: “Some people claim that we don’t like white people, but that’s not true. We actually welcome them warmly. ”

He says that the people in Niger want a country that is successful, proud and in control of its own decisions, and that those from other places should honor their desires. When I ask if the junta can make sure his country is safe from terrorists, he says that the Nigerien forces have always kept their people safe, and can continue to do so without any help from other countries.

But people who don’t support the government are really worried that if French troops leave, it could be really bad for Niger and the surrounding area.

Idrissa Waziri, who used to speak for the removed President Mohamed Bazoum, tells me through Zoom that France is an important ally in the battle against terrorists. They provide the majority of the information that helps us defeat the terrorists.

The French leaving quickly has made safety in Mali and Burkina Faso worse. Nowadays, people are using France as a target to blame for all the issues we face, which causes protests on the streets.

Fahiraman Rodrigue Koné, who manages the Sahel project at the Institute for Security Studies in South Africa, says it is too soon to determine if France leaving will cause more insecurity in Niger and the Sahel region.

In Mali, after foreign and UN troops left, there has been an increase in violence from both Islamist insurgents and rebel groups. But Mr Koné says the countries are very different from each other.

He says that the French army helped the troops in Niger in a smaller way compared to how they helped the troops in Mali. The Nigerien army has had a lot of practice battling terrorist groups, particularly against Boko Haram in the eastern region.

He says that the military of Niger is more spread out throughout their land than the military of Mali. In Mali, there were areas in the northern part of the country where the government and army were not present and terror groups took control of a significant amount of land.

After Ecowas said it would invade Niger if President Bazoum was not returned, Mali, Burkina Faso, and Niger formed an alliance on September 16th.

In the Sahel security alliance, the countries have agreed to support each other when there are fights against their governments and attacks from outside forces. Koné believes that this could make a significant difference in the situation.

He said that one reason why terror groups could easily move from one place to another was because the three countries did not work together. These three countries have already worked together in two or three military operations. This increased team effort is making things very difficult for the rebels.

He believes the alliance could share good ideas from Niger with the other two countries.

According to the Global Terrorism Index, there was a 79% decrease in terror-related deaths in Niger last year. However, Mali and Burkina Faso, which are close by, experienced the highest number of terror attacks. Around 90% of the violence that happened last year in the Sahel region was connected to Islamist extremism, and it mainly occurred in two countries.

Mr Koné says that the Bazoum administration was able to reduce deaths in Niger because they used a well-rounded approach. This approach included using military strategies, involving the community, and focusing on improving the socio-economic conditions.
However, even though this process was somewhat successful, not everyone liked it. Some people in the military thought that it made the government seem weak on terrorists and that it encouraged lawlessness. We don’t know if the junta will keep going in the same direction.

It’s difficult to know how many people in Niamey support President Bazoum.

Many people are upset that he is very close with the French government, but we had a hard time finding any of his supporters or people against the decision to kick out France, who would talk to us on the record. Most people seemed really afraid of what might happen because of their actions.

The junta watched the BBC team closely and knew what the people we interviewed were saying, and this wasn’t helpful.

France leaving doesn’t automatically mean Niger won’t work with western countries anymore. There are soldiers from other countries, including the United States, who are still present in Niger.

On Monday, US Defence Secretary Lloyd Austin said in Kenya that his country hadn’t made any important changes to its military presence in Niger yet.

However, he mentioned that they will keep looking at how things are going there and any actions they take in the future will focus on both their goals of supporting democracy and maintaining security.

The Sahel is in the front line of the war on terror. The choices made by the ruling groups there will be very important for the spread of Islamist extremism to other nearby areas.

Major trips to Saudi Arabia and Israel as negotiations advance

A group of important Saudi officials is in the Israeli-controlled West Bank for the first time since Israel took over the area from Jordan in the war in 1967.

Shortly after it came, the tourism minister of Israel traveled to Saudi Arabia for a United Nations event.

Haim Katz, an Israeli minister, led a group of people to the Gulf country, which was the first time it has happened, according to his office.

The important journeys happened after leaders from Saudi Arabia and Israel spoke favorably about efforts to create friendly relations between the two countries.

The US has been helping arrange difficult talks between two of its friends in the same area.

If the powerful states make an agreement, it would be a big change in Middle Eastern politics and a big win for US President Joe Biden’s foreign policy.

On Tuesday morning, Nayef al-Sudairi, Saudi Arabia’s ambassador to Jordan, arrived in the West Bank for a two-day visit, marking the first time any Saudi envoy has officially visited the Palestinians. He entered through the Karama crossing. Israel is in charge of who is allowed to enter the country at the border. They had to give permission for his arrival to happen.

The Palestinian government says that they have achieved an important step in their relationship with Saudi Arabia, which they consider to be a significant accomplishment.

The Saudi diplomat arrived in Ramallah with a lot of excitement, where the Palestinian Authority has its main offices.

He went to the presidential compound and saw a group of soldiers waiting to welcome him. They played the anthems of Palestine and Saudi Arabia.

Then, he gave his official documents to the Palestinian President, Mahmoud Abbas, at a special event.

Mr Sudairi talked to reporters in order to give Palestinians confidence about the current happenings. He talked about the interview that Saudi Crown Prince Mohammed bin Salman recently gave to Fox News.

Prince Mohammed stated that his country and Israel are moving closer to reaching an agreement on normalizing their relationship. However, he emphasized that the Palestinian issue remains an important aspect of the discussions.

The crown prince has always been interested in the Palestinian cause. The ambassador said that he wants the entire region and the world to be peaceful and secure. He believes that this will have a positive impact on everyone globally.

Haim Katz’s visit to Riyadh was a surprise because it was not announced beforehand.

He will be in Saudi Arabia for two days to go to a special event for the UN World Tourism Organization called World Tourism Day.

Mr Katz’s office stated that he said, “Tourism helps connect different countries. ” Working together with others on tourism issues has the potential to bring people closer and lead to economic success.

I will try to form connections with others to encourage people to visit Israel and improve our relationships with other countries.
Last week, during a meeting at the United Nations General Assembly in New York, Israel’s leader, Benjamin Netanyahu, stated that his country was very close to making an agreement with Saudi Arabia. He believed that this agreement had the potential to greatly change the situation in the Middle East.

However, officials in the United States have warned that there is still a lot of work to be done in the talks.

If they agree in the next few months, it is expected that there will be a defense agreement between Riyadh and Washington and support for Saudi Arabia’s civilian nuclear program.

The US and Saudi Arabia both want to see important improvements made on the Palestinian issue. Many people are requesting a new peace process that will result in an independent Palestinian state existing alongside Israel.

The US helped organize peace talks between Israel and the Palestinians, but they have been stopped since 2014.

Lately, the situation has become more tense between the two groups because there has been increasing violence, especially in the West Bank.

President Abbas talked about the chance of Saudi Arabia and Israel making peace at the United Nations. He said that there can’t be a new agreement for peace in the Middle East unless Palestinians are given all their rights.

When he talked in New York, the foreign minister of Saudi Arabia also asked for the two-state solution goal to be brought back to life.

UK police begins investigation into sexual assault against Russell Brand

London’s police are looking into old allegations of sexual offenses in the UK. This comes after news that comedian Russell Brand has been accused of rape and sexual assault.

The police in London have received reports of sexual crimes after an investigation was done by Channel 4’s Dispatches and The Sunday Times. This was stated by the police force on Monday.

We have also been told about several claims of sexual crimes that happened in other parts of the country. We will look into these claims and investigate them. The crimes happened a long time ago, according to the statement.

The brand said that the allegations are not true and also accused the UK government of trying to silence him.

Detectives from the Metropolitan Police’s Central Specialist Crime Command, led by Detective Superintendent Andy Furphy, will conduct the investigation, as stated by the Metropolitan Police.

“We want anyone who thinks they may have been a victim of a sexual crime, no matter how long ago it happened, to get in touch with us,” the statement stated.

We know that it might seem hard to do, but we have a group of expert officers who can help and guide you.

After the accusations came out, YouTube stopped allowing money to be made from Brand’s channel, and his live tour has been delayed.

The Sunday Times, The Times, and Channel 4’s Dispatches did research and found that four women accused Brand of sexually attacking them at different times from 2006 to 2013. One of the girls said she was 16 years old and Brand was 31 years old when the supposed assault took place in London.

The women decided not to reveal their names in the report, as stated by The Times. CNN cannot confirm their statements on their own.

At least two of the reported attacks happened in Los Angeles. According to the report, a woman went to a rape treatment center on the same day she was reportedly assaulted.

The police were informed by the center, but the woman decided not to officially report the incident because she believed that her words wouldn’t hold any value compared to the attacker’s, as noted by the rape center notes shared with The Times.

Downing Street said that the claims made in the documentary are very serious and worrying.

The Metropolitan Police has requested that if anyone thinks they have been a victim of sexual assault, they should come forward and talk to the police. Prime Minister Rishi Sunak’s spokesperson said this in an official statement after the documentary was shown.

Last week, The Met said they are looking into a claim about a sexual attack from 2003.

A spokesperson for the Metropolitan Police said that they know about news reports from The Sunday Times and Channel 4’s Dispatches about accusations of sexual crimes.

On Sunday, 17 September, the police were told about a sexual assault that was said to have happened in Soho, a neighborhood in the center of London, in 2003. The police are talking to the woman and will help her.

While I have reservations about these recommendations, I reluctantly acknowledge the merit in the proposal to consolidate the Constitutional Court into the Supreme Court.

Nonetheless, it is prudent to engage in a thoughtful examination of the motivations behind the notion of dismantling the Court of Appeal and merging the Constitutional Court with the Supreme Court.

It is noteworthy that Mr. Malila’s statements coincide with a recent judgment delivered by the Constitutional Court concerning judicial appointments.

But the question should be, is this proposition by the Chief Justice driven by concerns that cases which must be appealed to the Supreme Court from the Court of Appeal are not reaching their intended destination, the Supreme Court, rendering the Supreme Court unproductive?

Alternatively, are there reservations regarding the competence of judges at the Constitutional Court compared to their counterparts at the Supreme Court?

Another perspective to consider is whether this is an administrative measure aimed at redistributing the caseload, given the position of the Chief Justice within the Supreme Court.

Regarding cases transitioning from the Court of Appeal to the Supreme Court, there are pivotal factors that deter litigants from pursuing appeals at the Supreme Court.

The process involved in appealing decisions from the Court of Appeal is intricate.

It entails the submission of an application for leave to appeal to the same Court of Appeal, which then assembles a full bench to deliberate on the merits of the application for leave to appeal.

This procedural intricacy often leads to delays, with numerous pending applications awaiting resolution.

The pursuit of justice in Zambia carries a substantial financial burden, particularly for individuals endeavouring to assert their legal rights.

As an example, workers who faced unfavourable decisions in the Industrial Relations Court, could historically appeal directly to the Supreme Court.

Nonetheless, the extended time it takes to reach a resolution at the Supreme Court level, coupled with the substantial workload and the complex legal documentation required for appeals particularly when the appeal process is initiated by unrepresented litigants, compound the problem.

This, in turn, leads to disinclination among individuals not to pursue their cases to the Supreme Court, primarily because of these protracted delays.

Furthermore, there are instructive insights to be gleaned by our chief justice and former chief justices from the procedures followed by the Supreme Court of the United States of America (SCOTUS).

In most instances, SCOTUS does not automatically entertain appeals; instead, parties are required to submit a formal request to the Court known as a “petition for a writ of certiorari.”

It is the established practice of the Court to grant this writ, commonly referred to as “granting cert,” when at least four out of the nine Justices concur that the case warrants their consideration.

Out of the approximately 7,500 certiorari requests made annually, the Court typically grants cert to fewer than 100 to 150 cases. These are typically matters that the Court deems of significant importance, meriting its review.

Consequently, the decisions issued by the 12 Circuit Courts of Appeals throughout the nation, along with the Federal Circuit Court, stand as the final rulings in a multitude of cases.

Addressing the predicament arising on our Supreme Court because of the creation of the Court of Appeal does not necessitate dissolution of the Court of Appeal but a prioritized endeavour to simplify the appellate process, particularly when seeking leave to appeal to the Supreme Court.

The requirement for such applications to await review by a full bench of the Appeals Court should be revisited.

Furthermore, measures should be implemented to enhance the affordability of legal proceedings.

Concerning the proposed merger of the Constitutional Court with the Supreme Court, I am aware that members of parliament have been discussing quicker ways of amending the Constitution.

These talks may also revolve around the possibility of dissolving the Constitutional Court and integrating it into the Supreme Court structure, thereby creating two divisions: one for criminal matters and the other dedicated to constitutional issues.

Such a transformation would entail a piecemeal constitutional amendment process initiated by the executive and directly presented to parliament for approval.

This piecemeal route was vehemently opposed by the now ruling party in the last 4 years.

It is imperative, however, to differentiate between the motivations behind public support for this merge of the courts and what may be his Lordship underlying rationale.

The inclination by the public towards the merger of the Supreme Court and Constitutional Court primarily stems from the belief that decisions from the Constitutional Court lack the depth of constitutional analysis exhibited by the Supreme Court in its judgments, especially given its responsibility for establishing binding precedents in constitutional matters.

Furthermore, there is a prevailing perception that the Constitutional Court has failed in holding the executive branch accountable.

This perception, rooted from what happened under the previous administration and still persists to new administration, is the suspicions that the court may continue to favour the executive, as the appointing and dis-appointing authority of judges.

Yet, a crucial question surfaces: Will this merger significantly alter the manner in which a new division at the Supreme Court level will approach constitutional cases that directly affect the executive branch, delivering judgments enriched with profound constitutional analysis?

It is conceivable that such a transformation may not yield substantive changes, apart from potentially greater detail in written judgments and rulings.

The judges presiding over both courts are still appointed through an opaque process shrouded in mystery involving the executive, which raises concerns about their impartiality.

And judges are also removed by a simple process spearheaded by some commission appointed by the executive and without the full participation of parliament that ratified the judges.

The real imperative lies in reforming the judicial appointment process to ensure that judges are not beholden to their appointing authorities and can dispense equitable and well-reasoned judgments.

In their most recent judgment in the case involving the appointment of 20 judges, it is my considered opinion that the Constitutional Court missed an opportunity to fully assert itself by refraining from articulating clear guidelines on how the principles of “merit and equal opportunity” and a “competitive process” should influence appointments of judges.

The law is written in black and white that the values and principles in Article 173(1) of the Constitution apply to appointments in the Judiciary as a State organ.

But the Court felt comfortable to transfer this responsibility, by merely recommending to Parliament with no timelines as was the case in the earlier Judgment involving financial independence, when Parliament had already delineated these guiding principles in both the constitution and the law.

Ultimately, the dissolution of the Constitutional Court may not be imperative if the court vigorously upholds constitutional values and principles for which the Court is enjoined by the Constitution to protect, and the bill of rights, which underpin all constitutional interpretation.

This adjudicative approach is what has propelled Kenyan courts to prominence in safeguarding their constitution.

However, until the appointment system undergoes reform, the public’s scepticism regarding appointed judges’ willingness to impartially adjudicate against the entities that appointed them and also possess the final authority to remove them when any misconduct is observed on the part of a judge, will persist.

Legal proceedings, even in constitutional matters, can impose a substantial financial burden on litigants. Individuals frequently expend personal resources on legal representation, rendering access to justice a costly endeavour.

While this may contribute to democracy, we get to suffer a drain in resources and also carries risks, as some perceive those who litigate against the government as adversaries, potentially affecting their personal and professional opportunities as I have come to experience over time.

Because of how petty politicians can be, persons who litigate against government are usually denied opportunities to do business with government nor work in or with government.

Moreover, there exists a potential risk of orders for costs being issued, even in constitutional matters, when cases are lost against the executive.

Pursuing legal action against the government requires significant fortitude, particularly when appearing before judges appointed by the very entities who are called upon to adjudicate against alleged unconstitutional behaviour by the executive.

These judges possess wider discretionary powers to impose legal costs, and individuals may find themselves discouraged from pursuing legal redress due to this daunting possibility.

This was evident in the case of Sinkamba and myself when we were warned of the potential for incurring costs in future while pursuing court intervention to rectify the contentious Kwacha and Kabushi parliamentary by-election, which notably involved the judiciary itself.

In conclusion, the recommendations by Chief Justice Mumba Malila should ignite a broader conversation about the state of the judiciary, judicial appointments, and access to justice in Zambia.

The matters brought forth by the Chief Justice necessitate meticulous examination, broader discourse, and well-grounded adjustments to safeguard the credibility, effectiveness, and availability of the legal system for ordinary citizens.

These suggested modifications should not be driven solely by the desire to provide our Supreme Court judges with opportunities to also participate in issuing judgments, especially when actions reaching the Supreme Court may not be necessary as can be seen from the practice in the U.S.

Bishop Malambo, if you’re ever contemplating a career change, perhaps a job application would be more fitting than telling the Opposition Parties what to do. After all, it seems you might need a refresher on the essential role of opposition in a thriving democracy.

In any healthy democracy, the role of the opposition is not merely to stand in contrast to the ruling party but to act as a crucial check and balance on government actions. Zambia, like many democratic nations, has experienced the ebb and flow of political power, with different parties taking turns at the helm. It’s important to understand that robust opposition is a cornerstone of a thriving democracy.

It’s worth noting that President Hichilema, during his time in opposition, was anything but silent. His vocal criticism of the government’s policies, especially regarding the prices of fuel, mealie meal, and other commodities, resonated with many Zambians who were grappling with economic challenges.

One of the main points of contention during Hichilema’s time in opposition was the rising cost of living. The prices of essential commodities, such as fuel and mealie meal, were spiraling out of control. Hichilema and the UPND consistently pointed out these issues, arguing that the government needed to take decisive action to alleviate the burden on the citizens.

In a democracy, the opposition’s responsibility is not to remain quiet but to amplify the voices of those affected by such issues. By doing so, they put pressure on the government to address these concerns effectively. While the prices of commodities have continued to rise under Hichilema’s presidency, it’s important to recognize that these issues are making our citizens live a hand to mouth kind of arrangement.

Remember Bishop Malambo Mr Hichilema once said ” WHEN YOUR STOMACH IS FULL, YOU’LL ASSUME THERE’S SOMETHING WRONG WITH THOSE COMPLAINING OF HUNGER.”

In a parliamentary democracy like Zambia, the legislative process is where the ruling party and opposition parties engage in rigorous debates over policies and laws. The reminder of policy in Parliament is not a sign of inefficiency but an essential aspect of the democratic process. It ensures that proposed policies are thoroughly scrutinized and refined, ultimately leading to better governance.

In a thriving democracy, the opposition plays a vital role in holding the government accountable, voicing the concerns of the people, and fostering a healthy environment for policy discourse. President Hichilema’s past as a vocal critic while in opposition should not be seen as a contradiction to his current role as the head of state but as a testament to the robust nature of Zambia’s democracy. The challenges the country faces require cooperation, dialogue, and collective effort to overcome. In the end, it’s the responsibility of all stakeholders, including the opposition, to work together for the betterment of Zambia and its people.

So, Bishop Malambo, next time you’re tempted to suggest the opposition keeps quiet, remember that in a democracy, you often reap what you sow. A vibrant opposition is the pulse of democracy, and President Hichilema’s own history serves as a reminder of that fact.

1,300 REGISTERED LEGAL PRACTITIONERS AGAINST 18

In Zambia, there are over 1,283 registered as legal practitioners with the Law Association of Zambia.

Yesterday within hours of the contraversy of the so-called rights of gay persons in Zambia emerging, we saw 18 Legal Practitioners issue a joint statement to support Chief Justice Dr. Mumba Malila SC’s position.

They quoted the Bible, the Constitution and the law.

TAKE TIME TO EDUCATE YOURSELF ON LGBTQIA, BEFORE YOU ARGUE FROM IGNORANCE – THESE PEOPLE ARE HUMAN, LET’S ACCEPT THEM

A good number of people that speak negatively, and at times diabolical, do so from ignorance. I urge you to do a bit of research around this subject, so that you can engage from an informed position.

Firstly, let’s ask this question, “Is sex orientation a choice or natural?”.

A number of research have been done and results show that sexual orientation is likely caused partly by biological factors that start before birth.

However, it is not clear what causes those biological factors, which in my view, is part of God’s plan, like we have people born with different physical features.

Can a person change his or her sexual orientation?

People don’t decide who they’re attracted to, and therapy, treatment, or persuasion won’t change a person’s sexual orientation.

Of course there are people that have chosen to pretend to either be heterosexual or otherwise, for various reasons, but they remain with their natural sexual orientation.

However, it is possible for ones desires and attractions to shift to the other side, due to experience, eg a woman who is brutally raped by men may hate men and feel secure being in another woman’s arms and allow herself to be fiddled for sexual pleasure.

This is called “fluidity.” Many people, including sex researchers and scientists, believe that sexual orientation is like a scale with entirely gay on one end and entirely straight on the other. Lots of people would be not on the far ends, but somewhere in the middle.

What is the danger of accepting LGBTQIA in our society?

As it stands, the danger is negligible in accepting them, however, the risk is very high on the other side.

Firstly, LGBTQIA people don’t force anyone to be like them, because as a matter of fact, they can’t, because sexual orientation is natural.

It is possible for LGBTQIA to be attracted to a straight person, but all you have to do is politely turn them down, instead of going about scandalizing them.

Usually when this happen, LGBTQIA people are abused and treated like outcasts. In some cases they are even violently abused. Which is why laws must be there to protect them, just like we have laws protecting women and children, because they are in the minority and therefore vulnerable.

On the other hand, if a heterosexual man proposes to a LGBTQIA woman and she refuses, the man will not back-off but insist and in some cases exposes her abuse.

The point is, why can’t we have a situation where LGBTQIA just come out as they are and we respect it other than them hiding.

Should Zambia legalize gay marriages?

I think that would be too much of a shock to our society, let’s leave that aside, but at least, let’s give them respect and rights to be who they are instead of treating them like outcasts.

Appointment of Dr. Ron Mwambwa as Auditor General is Unconstitutional and illegal on Account of Age

On Monday 25th September 2023, President Hakainde Hichilema announced the appointment of Dr. Ron Mwambwa as new Auditor General.

However, Dr. Mwambwa is not eligible for appointment on account of being over age.

Article 252(1) of the Constitution of Zambia states that the Auditor General shall retire from office after attaining the age of 60 years.

Article 252 (2) further states that the Auditor General shall retire with full benefits at age 55.

Hon. Dr. Ron Mwambwa is 63. How do we know his age?

In his complaint dated 23rd of June 2023, to the Judicial Complaints Commission against the former Auditor General, Dick Chella Sichembe, Dr. Ron Mwambwa, in paragraph 2, stated his age was 63 years old.

Having complained against his predecessor, leading to the resignation of his predecessor, President Hakainde Hichilema has since appointed Dr. Ron Mwambwa as Auditor General subject to ratification by the National Assembly.

If President Hakainde Hichilema was properly guided as to the provisions of the Constitution, he would not make this appointment.

Dr. Mwambwa is not eligible for appointment on account of the age limit of the office.

The issue of age and eligibility to serve on contract or full time was extensively canvassed and ruled by the Supreme Court.

In 2012, in a similar matter the Supreme Court ruled that Judges, who retired at 65, were not eligible for appointment to higher office; therefore neither the current acting Chief Justice Lombe Chibesakunda nor her Deputy Florence Mumba could be appointed to the positions they were acting in because they retired as Supreme Court Judges- the positions to which they were serving on contract.

Both Chibesakunda and Florence Mumba were not available to be appointed as Chief Justice on account of age.

It is imperative that President Hichilema checks with his Attorney General on the legal status of this appointment before Dr. Ron Mwambwa’s name is processed any further.

The most arrogant party to have ever existed in Zambia is the Patriotic Front (PF). This is a party that never listened while it was in power. Even now in opposition, the PF has continued on the very arrogant trajectory.While this party has this natural but stupid arrogance, it listens and rewards jackals, hyenas. It rewards political prostitutes of all sorts.

This is why today, a number of these dishonest political elements have risen against them. When you look at the elements who have suddenly become hostile towards the PF, they are the very characters whom this party stubbornly listened to, while in power and in opposition. These are the same people that have drawn gigantic benefits from associating with PF.

We vividly remember how PF was advised against appointing Kelvin Sampa as National Youth Chairman by many people. We remember how Maxwell Chongu fought this appointment but as usual, PF senior leader shielded Kelvin and castigated, isolated Max. Today, now that PF is not in power, Kelvin has leaped and is in the forefront of insulting this party. The very Maxwell whom PF crushed is still in PF suffering and struggling with the leaders of this party.

Look at that dog of the wind Chilufya Tayali. This is someone whom almost every member of PF has been praising and getting advice from. Today, Chilufya is busy insulting, attacking the very people who have been putting food on his table, for his family to eat. Without PF, Chilufya owns nothing. Whatever this political pendulum, this political nomad owns are proceeds facilitated by PF.We remember how this dog of the wind- as Munir Zulu calls him – joined hands with Emmanuel Mwamba to malign The Candidates and those associated with it.

When we defended former Director General of Drug Enforcement Commission (DEC) Mary Chirwa, Emmanuel and Tayali launched a scathing attack on us. They alleged among other things that, the editor of The Candidates was having a sexual affair with Mary. They said this editor was facing a fraud case with DEC and was defending Mary because other than sl33ping with Mary, we wanted protection from her. Now that Mary is not at DEC, where is the case they alleged we are facing? Of course, this was a malicious attack that Emmanuel through the Patriotic Front page and Tayali launched against us for simply not agreeing with them over those leaked pornographic videos that went viral on social media. Today, this very dog of the wind, this very hyena Tayali has gone after Emmanuel and his friends in PF and there is no one to defend them.

PF is reaping what they have been sowing for a very long time. They sowed malice, and they are being served malice. When you disagree with PF on principle, they will concoct, they will manufacture all sorts of lies against you and use unprincipled political elements like Tayali to malign you. They made Tayali feel very important, too significant a person that, today, the very dangerous animal they set on others is out to destroy them. Whether PF likes it or not, Tayali will damage them.

KASAMA HIGH COURT GRANTS CHILANGWA BAIL

THE Kasama High Court, sitting in Lusaka, has granted bail pending trial to Kawambwa PF member of parliament Nickson Chilangwa.

Chilangwa has been in custody at Kawambwa correctional facility since July 17, 2023.
In June this year, the Kawambwa Magistrates’ Court issued a bench warrant against Chilangwa after he eight times failed to present himself before court in a criminal matter.

This is in a matter where Chilangwa and six others are facing a charge of arson and malicious damage to property, and they are all on police bond.

When Chilangwa appeared in court on July 17, the magistrate was not satisfied with the accused’s reason for failure to attend court on the scheduled date.

The magistrate therefore revoked Chilangwa’s police bond, hence his incarceration of slightly over two months.

But Chilangwa through his lawyers from Andrew & Partners challenged the subordinate court’s decision in the Kasama High Court.

In his affidavit, Chilangwa argued that the offence he was charged with was bailable.

He explained that he could not appear before the lower court on the scheduled day because he was also appearing in the Lusaka High Court in another matter.

Chilangwa submitted that in view of his explanation, the decision to revoke his police bond was done in bad faith as he had a reasonable explanation for his absence before court.

He further said he was of fixed abode and was willing to abide by any conditions that may be imposed on him.

Chilangwa said the Criminal Procedure Code allows the High Court to grant bail to any person charged with a criminal offence pending trial and determination of such offence.

He further said in the subordinate court he stands charged with a bailable offence for which he was on police bond.

But the state filed an affidavit in opposition on September 15, 2023, arguing that Chilangwa breached bond conditions when he failed to appear before court on the scheduled date of hearing.

The state said thereafter, Chilangwa went into hiding and could not be located.

The state said the High Court should not grant Chilangwa bail because his liberty would be a danger to the administration of criminal justice.

The state further said Chilangwa missed a total of eight sittings in the subordinate court; hence a bench warrant was only issued against him after he failed to appear on June 26.

The state said after the issuance of the bench warrant, Chilangwa went into hiding and the police failed to locate him until he surrendered himself to police in Kawambwa.

The state argued that due to the explained circumstances, if granted bail, Chilangwa was a flight risk despite being of fixed abode.

The state therefore beseeched the High Court to take judicial notice of the subordinate court record of proceedings to satisfy itself with why Chilangwa’s police bond was revoked.

But in response, Chilangwa’s lawyers argued that their client had demonstrated that he was not a flight risk being an elected member of parliament.

The lawyers said his failure to attend court on the scheduled date was not deliberate as submitted in the affidavit.

They reiterated their prayer that Chilangwa be granted bail pending trial so that he could have an opportunity to prepare his defence.

And in his ruling dated September 25, 2023, judge Mathew Zulu said legally, every person is considered innocent until proven guilty.

‘’…Be that as it may, the Court should never lose sight that the presumption of the Law is that one is innocent until his guilty has been established in Court. The Court will therefore ordinarily grant bail to an accused person unless this is likely to prejudice the ends of justice. It is my considered view that when adjudicating a bail application, the presumption of innocence operates in favour of an applicant even where there is a strong prima face case against him…,’’ said judge Zulu. ‘’…In view of the foregoing, I come to the conclusion that the circumstances of his case favour the granting of bail pending trial. The Respondent has not demonstrated that there is any congnisable indication that the Applicant will not turn up in Court to stand trial if released from custody. For the reasons I have given above, I exercise my discretion in favour of the Applicant and admit him to bail pending trial. The bail conditions are as follows:
i) Cash bail in the sum of K10,000.
ii) Two sureties of traceable abode in the like sum in their own recognisance.
iii) The Applicant to surrender his passport to the Senior Assistant Registrar at Lusaka for onward transmission and custody at Kasama High Court.
iv) The Senior Assistant Registrar at Lusaka to scrutinise the sureties.’’
v)
Chilangwa’s lawyers have since written to the officer-in-charge at Kawambwa Correctional Service to present him in Lusaka for completion of bail processing.

LAWYERS representing former Konkola Copper Mines (KCM) Provisional Liquidators, Milingo Lungu this afternoon expressed shock and surprise at the turn of events where Constitutional Court justices who had earlier recused themselves have been brought back to hear the same matter.

In February this year the then Constitutional Court deputy president Margaret Munalula recused herself from presiding over a matter in which former KCM provisional liquidator Milingo Lungu was challenging the revocation of his immunity from prosecution.

However, when the matter came up today, Justice Munalula was part of the panel of judges to hear the matter, a situation which left Lungu’s lawyers shocked and surprised.

The matter was scheduled to address a petition Lungu submitted before the Constitution Court to have three more judges recuse themselves from handling his matter as he was a lawyer for individuals who questioned the appointment of Constitutional Court judges.

Justice Munalula, now ConCourt President was part of the panel scheduled to hear Lungu’s petition seeking three justices to recuse themselves.

Lungu had applied to have three judges namely Kenneth Mulife, Mudford Mwandenga and Arnold Mweetwa Shilimi recuse themselves from hearing his matter following a fresh Notice of Motion filed.

The petitioner’s lawyer Sakwiba Sikota asked the Court to adjourn the matter to allow his client file a new Notice of Motion to add other judges that had been added to the panel as their impartiality was questionable.

In his appeal, State Counsel Sikota informed the court that he was confused and shocked with the appearance of a judge on the panel who had recused herself from the matter and that of the expanded panel.

The panel which had an additional number of Judges bringing it to 11, included new judges to the matter who he said may be in the same position as the Three that his client applied to have recused from his matter.

State Counsel Sikota said allowing the matter to continue without the concerns raised addressed would be departing from the rule of law.

“To my surprise the same judicial officer, who had recused themselves is now back on the panel, I’m sure that my Ladies and my Lords will understand why this brings about confusion. My understanding is that once a judicial officer has recused themselves, they play no further part in those proceedings,” he said.

“This is a fundamental point with regards to the rule of law, the much talked about rule of law. Recusal is to ensure that we do have the rule of law, recusal is to ensure that not only is justice done, but that is it also seen to be done.”

He further said, no instructions have been given by his client after the new development prompting to request for an adjournment.

“No instructions have been obtained from our client with regards to this new turn of events, unexpected turn of events but I’m pretty certain that it will cause great distress to our client,” he said.

The 11 judges are Justice Prof Margaret Munalula, President of the Constitutional Court, Justice Arnold Mweetwa Shilimi – Deputy President of the Constitutional, Anna Sitali, Palan Mulonda, Mungeni Mulenga, Mathews Chisunka, Martin Musaluke and Judy Mulongoti.

Others are Justices Mudford Mwandenga, Maria Kawimbe and Kenneth Mulife.

The matter has been adjourned to a date to be communicated.

MP’s UNDERGO TRAINING IN SECTOR BUDGET ANALYSIS

Members of Parliament participated in a training workshop on Sector Budget Analysis at the Lusaka International Convention Centre at Bonanza Estate, Lusaka on 23rd and 24th September, 2023.

The workshop aimed to enhance the capacity of Members of Parliament (MP) to effectively analyse and make informed decisions on the national budget, and heads of expenditure (sector budgets) particularly in the Ministries of health, education, and agriculture, among other sectors.

The Speaker of the National Assembly of Zambia, Rt. Hon. Nelly Mutti, MP who was also in attendance stated that the budgeting system had undergone reforms in the last few years changing from an activity based to output based budgeting and integrating the planning and budgeting processes through the enactment of the National Planning and Budgeting Act of 2020.

Speaking at the opening of the workshop, Speaker Mutti said that the training was important in analysing the budget by sectors as it’s not just one of the means of strengthening the role of Parliament in the budget approval process but also making it more effective.

T he training was facilitated by experts from the Zambia Institute for Policy Analysis and Research (ZIPAR) and the Parliamentary Budget Office (PBO). The topics covered included an overview of the budget process, budget analysis techniques, and the role of MPs in budget oversight, Implications of debt restructuring on the outlook of social sector financing and Social Sector: The Constituency Development Fund. The MPs were also taken through a number of case studies on sector budgeting.

The workshop was organised by the National Assembly of Zambia in partnership with the Zambia Institute for Policy Analysis and Research (ZIPAR), United Nations International Children’s Fund (UNICEF) and Support to the National Assembly of Zambia -European Union Project Phase 2 (NAZ-II EU).

In his opening remarks, the Clerk of the National Assembly, Mr Roy Ngulube, emphasized the importance of the training, stating that it would enable MPs to better understand the budget and make informed decisions on behalf of their constituents. He also urged the MPs to actively participate in the training and to use the knowledge gained to effectively represent their constituencies.

The training workshop is part of the National Assembly’s ongoing efforts to strengthen the capacity of MPs to effectively carry out their legislative and oversight functions. The Assembly recognizes the importance of an informed and engaged Parliament in ensuring transparency, accountability, effective and efficient use of public resources.

STATEMENT BY HON CHUSHI KASANDA, MP, MINISTER OF INFORMATION AND MEDIA AND CHIEF GOVERNMENT SPOKESPERSON ON THE LATEST POVERTY ASSESSMENT REPORT BY ZAMSTAT

Government is aware of the latest report by the Zambia Statistics Agency (ZAMSTATS), entitled, “Highlights of the 2022 Poverty Assessment in Zambia,” which report may be misconstrued by some sections of society.

It is important that this report is understood in its proper context. The report is the eighth Living Conditions and Monitoring Survey (LCMS), conducted in June/July, 2022. It captures trends in living conditions based on what has been happening in the economy and its impact on living conditions between 2015 and August 2021.

The statistics in the report reflect not what had happened in six months of the UPND implementation of its first budget but the accumulation of what had been happening before.

When this survey was being conducted, the first budget of the new dawn administration had only been in place for six months.

The period between 24th August, 2021, when the UPND assumed office, and December 2021 was dedicated to organising the new government.

Government wishes to assure the people of Zambia that the report only confirms what UPND always knew, namely, that the conditions of living, prior to the UPND commencing implementation of reforms, were poor because the policies that were being pursued did not have an impact on the wellbeing of the Zambian people.

When the New Dawn Administration announced that it was going to reset the economy, it was for purposes of embarking upon a new set of public policies that would place it on a new footing where the wellbeing of the Zambian citizens would become the area of focus.

It is the contention of the new dawn administration that if public policies do not address the wellbeing of its primary beneficiaries, the people, they must be changed and replaced by others. This is what our administration promised to do and that is what is going to happen.

Government wishes to thank ZAMSTATS for its continued work of monitoring trends in one of the most important aspects of public policy.

As you may be aware, the fight against poverty is a major area of focus by the new dawn administration, hence our collective tireless efforts in resetting the economy so that it is anchored on prudent management of public resources and job creation.

As you may also be aware, the fight against poverty is part of international public policy as reflected in the 17 Sustainable Development Goals, SDGs, of which Zambia is a part.

Therefore, any work that shines a spotlight on poverty, especially highlighting trends, is welcome to make government assess the impact of its policies.

Government calls on the Zambian people to study closely government public pronouncements, as they contain the policies intended to address the concerns that matter the most to them.

We urge everyone to resist the temptation of dwelling on issues that have no value whatsoever. We do not want citizens to miss opportunities being created in the policy pronouncements that government continues to make.

COURT RULES IN FAVOUR OF ITAL TERRAZZO IN LAND DISPUTE

In a recent development, the Lusaka High Court has ruled in favor of Ital Terrazzo and ordered the demolition of properties built on its land.

This decision comes after a lengthy court process that resulted in the eviction of several families from the disputed land. It should be noted that Zambezi Portland Cement Company, which was erroneously reported to be involved in the litigation, is actually not part of the case.

High Court judge Gertrude Chawatama issued the eviction and demolition order, which applies to Ital Terrazzo’s land and not that of Zambezi Portland Cement as erroneously stated by some media outlets.

A check at the court documents reveals that the Supreme Court dismissed the appeal filed by the appellants on October 20.

In its ruling, the Supreme Court found the appellant’s motion to be improperly and incompetently before them, leading to its dismissal. The court also dismissed the appeal that had survived, stating that it would have failed on the merits.

The court’s decision marks a victory for Ital Terrazzo, which has been embroiled in a legal battle over the land for years. The company had petitioned the court to evict the families and demolish the illegal structures built on its land.

While the company would have been entitled to costs incurred in the legal process, the respondent’s counsel informed the court that the appellant was not in a position to pay them. As a result, the court did not award any costs.

The ruling has far-reaching implications for individuals and companies that develop properties on disputed lands without proper documentation.

It serves as a reminder to all landowners to protect their properties from illegal encroachment through proper documentation and legal protection.

The Ital Terrazzo case underscores the importance of adhering to the country’s land regulations to avoid costly legal battles, property loss, and eviction.

As the case comes to a close, Ital Terrazzo can now proceed with its project development plans on its land without hindrance. Meanwhile, the evicted families must now find alternative accommodation elsewhere.

Speaker of Canada’s House of Commons apologizes after praising war veteran from Ukraine

The speaker for Canada’s House of Commons expressed remorse for commemorating a Ukrainian soldier associated with a Nazi-affiliated faction during World War II.

Speaker Anthony Rota praised 98-year-old Yaroslav Hunka during a speech on Friday. Hunka was recognized as both a Ukrainian and Canadian veteran during Ukrainian President Volodymyr Zelensky’s visit to the Canadian parliament.

The person speaking praised Hunka as a brave soldier who fought in the First Ukrainian Division. They said Hunka fought to protect Ukraine from the Russian attackers in the past, and still supports the military today.

“I recently found out more information that makes me feel sorry for my choice,” stated Rota in a message his office released on Sunday. He said, “I am very sorry to Jewish communities in Canada and around the world. ”

Many groups that support human rights and the Jewish community have criticized the acknowledgement, stating that Hunka was a part of a Nazi military group called the 14th Waffen Grenadier Division of the SS.

According to a statement from Jewish human rights organization B’nai Brith Canada, Hunka, who moved to Canada after being in the 14th Waffen SS, a Nazi group that supported Adolf Hitler during World War II, got a big round of applause from the members of Parliament and senators who were there.

The CEO of B’nai Brith Canada, Michael Mostyn, said in a statement that the parliament’s acknowledgement of Hunka is “extremely shocking. ”

We must not let history be distorted. Canadian soldiers fought and lost their lives in the battle to liberate the world from the cruel and oppressive actions of the Nazis,” Mostyn mentioned.

The 14th Waffen Grenadier Division was a group that was part of the Nazi SS organization. The International Military Tribunal in Nuremberg declared this organization a criminal group because they had done bad things during war, like committing war crimes and crimes against humanity.

B’nai Brith criticized the Ukrainian volunteers who joined the military unit for being extreme nationalists who wanted Ukraine to have only one ethnic group and supported the idea of removing other ethnic groups.

The human rights group wants parliament to say sorry.

Rota said he is fully responsible for recognizing Hunka, who he said comes from his voting area.

“I want to emphasize that before I spoke, nobody, not even my fellow parliamentarians or the Ukraine delegation, knew about my intention or the things I was going to say,” Rota explained. “I took this initiative by myself because someone from my area caught my attention. ”

France to withdraw its troops from Niger by the end of 2023 – Macron

French President Emmanuel Macron announced on Sunday that France will withdraw its military from Niger by the end of 2023. This decision comes as the relationship between the two countries has been strained since a military junta took over Niger in July.

“We are stopping our military cooperation with the people in charge of Niger because they don’t want to fight terrorism anymore,” Macron said about the military leaders who took control of the northwest African country.

France does not accept or acknowledge Niger’s military leaders. They still consider Mohamed Bazoum, who was removed from power in the coup, as the only rightful leader of the country.

Macron said we are ending our “cooperation” because we don’t want to be involved in their internal politics and be controlled by the military group.

He said that the withdrawal will be planned and arranged in the weeks ahead.

“They will return in a well-organized way in the upcoming weeks and months, and we will work together with the rebels because we want this to happen peacefully,” stated Macron.

Niger’s military government said it is happy that France will remove its soldiers from the country. This was mentioned in a statement on Niger’s state television, Tele Sahel.

This Sunday, we are celebrating another progress towards Niger’s independence. French soldiers and the French representative will be departing Niger before the year ends, as mentioned in the statement. We do not want imperialist and neo-colonialist forces in our country anymore.

“We will continue to strongly oppose and confront any organization or system that tries to question or go against the best interests of our country. ”

France decided to send soldiers to Niger because it is a peaceful country in a troubled region with lots of political problems and terrorism. The soldiers are there to help fight terrorism. This information was reported by CNN.

About 1,500 soldiers are still present.

Macron said that by the end of 2023, there will be no more French soldiers in Niger.

CNN reported earlier this month that the United States might start taking its soldiers out of Niger soon. About half of the around 1,100 US troops in Niger may be removed from the country, according to two officials.

The president of France also mentioned that he has chosen to bring back the country’s ambassador to Niger, Sylvain Itte, to France.

Macron said that France has decided to bring back its ambassador. In a few hours, our ambassador and some diplomats are coming back to France.

Just over a week ago, Macron said the ambassador was being kept against their will at the French embassy and food could not be delivered to the embassy in Niamey, the capital.

After the military took over in July, they told Itte to leave the country. Later on, they canceled his permission to stay and told the police to kick him out.

But according to the French president, the diplomat stayed where they were, and the French government said again that they do not accept the junta’s power.

Earlier this month, the French Foreign Minister Catherine Colonna said that Itte is still working. She also mentioned that he will continue working for as long as we want him to. Moreover, she stated that Itte’s return was a decision made by Macron.
