State U-turns on out of court settlement agreement with Honeybee

HONEYBEE Pharmacy Limited has bitten the dust in its attempt to recover a dime from government for the ‘defective’ drugs, condoms and gloves which it supplied to the Ministry of Health in 2020.

The pharmaceutical company has reinstituted the matter in which it was demanding over US $17 million against the State in the Lusaka High for the 22,500 health kits it supplied, owing to failed negotiations.

Honeybee laments that efforts to recoup part of its investment proved futile as government has declined to enter into a bargain with it for reasons that its directors are facing criminal charges relating to the contract in question.

Four months ago, Honeybee discontinued the case against the State in order to have the matter resolved out of Court.

In its renewed action, Honeybee has insisted that the court compels government to pay it $4,998,375 for the 5,000 out of the 22,500 medical kits it supplied under contract No. MOH/SP/032/19-02, and in the alternative for specific performance of the same contract.

According to the statement of claim, Honeybee said in November 2019 it entered into a written agreement with the Ministry of Health for the supply of 22,500 health center kits under contract No. MOH/SP/032/19-02, which was approved by government and endorsed by Honeybee and the Ministry of Health on behalf of Zambians.

It said the contract was worth $17,958,150 for the supply of various medical kits and related products as requested by the State through the Ministry of Health.

Honeybee said between January and December 2020, it supplied the State with 5,000 medical kits out of the required number and they were all subjected to examination, inspection by the Zambia Medicines Regulatory Authority and Zambia Medicines and Medical Supplies Agency.

The company said verification and certificates of acceptance of goods under various invoices were issued and various delivery notes valued at $3,990,700 at the time of delivery.

“It was an express term of contract that payment shall be made promptly and expeditiously or shall not exceed 60 days from the date of submission of an invoice or claim by the plaintiff,” Honeybee submitted. “Despite the contract providing for part payment of the sums due, the plaintiff used their own funds to supply the kits and are now seeking full payment.”

It stated that the contract provided that any defective goods were to be returned within 10 days and notice was to be given to the supplier, but government has never returned or rejected any of the goods supplied and it is liable for full payment.

Honeybee said several reminders have been made by its lawyers Tutwa Ngulube and Company to the Ministry of Health but they have been ignored without advancing a reason for failure to pay as there was an express term of the contract which provided for interest on the delayed payment.

The pharmaceutical company said the Ministry of Health has not been available for meetings sought by it to have the matter resolved amicably, and has attempted to financially incapacitate the plaintiff as the money used to supply the medical kits was sourced from various lenders.

Honeybee explained that due to the request by government to attempt ex-curia settlement it withdrew the matter under cause number 2022/HPC/197.

“At a meeting chaired by Attorney General Mulilo Kabesha SC and co-chaired by Solicitor General Marshal Muchende SC, the parties agreed to have payment made based on the contract which would in due course be discarded due to perceived irregularities,” Honeybee stated. “On July 8, 2022 it was intimated that a temporal task team shall be assembled in order to make findings to ascertain the amount of the drugs supplied by the plaintiff so as to facilitate a payment on quantum merit. After further attempts to secure the payment by the plaintiff, the defendant did cause the Anti-Corruption Commission to arrest the plaintiff’s directors and commenced prosecution based on the same contract and facts…”

Honeybee said they wrote letters to the State requesting for payment and to inquire about the findings of the task team and the State responded, indicating that it shall not transact or settle the matter considering the criminal proceedings against its three directors.

Honeybee added that the contract between the parties is still valid and has never been terminated and all rights and obligations are still in force.

Kylian Mbappe feels “betrayed” by Paris St-Germain and wants to leave the club in January, says French football expert Julien Laurens.

The France forward signed a new three-year deal in May but now feels he made a “mistake”.

Mbappe, who has scored 12 goals in all competitions for PSG this season, would prefer a move to Real Madrid.

But PSG’s sporting director Luis Campos says the 23-year-old has “never talked about leaving” the club in January.

Speaking to BBC Radio 5 Live, Laurens said: “He feels betrayed by the club in the sense that all the things the club promised him when he signed that new deal until 2025 have not happened.

“The promises they would sign a new striker so he could play in his best position off the striker, that Neymar wouldn’t be there and he would be sold, that they would sign a centre-back, and he would be at the centre of the project. All of these things have not happened.

“We knew there were tensions and now he has made his mind up and he doesn’t want to be there. He feels he made a mistake by extending his contract and he should have left in the summer, now he is looking at the January transfer window at where he could go.”

World Cup winner Mbappe has lifted 11 trophies at PSG, including four Ligue 1 titles, since joining from Monaco initially on loan in 2017.

On Friday, he topped the Forbes list for highest-earning footballers – the first time someone other than Lionel Messi or Cristiano Ronaldo has been number one for nine years.

“Clearly in his mind something is broken between him and the club,” Laurens added.

“Real Madrid were prepared to come in the summer and sign him as a free agent. They must still have the money to buy him and also for the wages.

“Would Chelsea come in for him? Would Manchester City? What about Manchester United under Erik ten Hag?

“It’s one thing he wants to leave but it’s another who can afford him and how much PSG want for him. PSG are now in a strong position. He may have to stay until the end of the season and then see what happens in the summer.”

But, speaking before PSG’s Champions League clash with Benfica, Campos dismissed suggestions Mbappe is unsettled in Paris.

“I am with Kylian Mbappe every day,” he told French TV station Canal Plus. “He has never talked to me about leaving in January.

“It’s not a statement from the player, it’s [from the press], and to have such information before a match like this is very serious. That’s why I’m here, to deny and say clearly that Kylian Mbappe has never spoken to me or to the president [Nasser Al-Khelaifi] to leave PSG in January.”

Campos added to RMC Sport: “Kylian is an extraordinary professional. For example, he played sick in the last match in Reims, he made the effort for the team. I see Kylian arriving with his team-mates, happy every day and with a huge desire to work.” [BBC Sport]

The Ministry of Foreign Affairs and International Cooperation wishes to inform the Nation that Mr. Hakainde Hichilema, President of the Republic of Zambia will participate in the Swakopmund International Trade Expo (SWAiTEX) scheduled for 12th to 15th October, 2022 in Swakopmund, Namibia.

President Hichilema will be hosted by His Excellency Dr. Hage Geingob, President of the Republic of Namibia. The President will deliver a keynote address at the Expo on Wednesday 12th October 2022.

On the margins of the Expo, the President is scheduled to attend the Zambia-Namibia Business Seminar where he is expected to deliver a keynote statement. The President is also expected to engage with both potential investors and partners to advance efforts to re-establish Zambia as an investment destination of choice and set out the Government’s vision for a resilient and sustainable economy that delivers benefits for all Zambians.

The Swakopmund International Trade Expo is an annual international event organized under the auspices of the Namibia Chamber of Commerce and Industry and it attracts several investors.
This year’s Expo has been convened under the theme: “Towards a Shared Economic Vision – Our Shared Destiny” and will host exhibitors from the mining, finance, tourism, energy, transport, medical, education, fisheries, logistics, commercial and retail services, and construction, among others.

About eight (08) Zambian companies are expected to participate in the Expo. PF APPALLED BY ECZ’S DECISION TO HOLD KABUSHI, KWACHA BY-ELECTIONS DESPITE COURT ACTION

On 24th August, 2022 the Electoral Commission of Zambia (ECZ) issued a circular to the effect that those whose elections in Kabushi and Kwacha constituencies were nullified would not be allowed to contest the elections.

Our candidates went and filed their nominations which were rejected by the returning officer and we proceeded to court. The elections were stayed by the High Court and the stay is still in force.

Today ECZ has issued a statement that they will proceed with the elections in the two constituencies.

We find the decision of the Electoral Commission of Zambia (ECZ) to proceed with the by-elections in Kabushi and Kwacha constituencies without first awaiting the outcome of the court processes, an abrogation of the Constitution and gross contempt of court.

This is the very behaviour by the ECZ that caused the current legal impasse that the country is experiencing over the Kabushi and Kwacha by-elections. The behaviour of ECZ is not only illegal but extremely reckless and irresponsible and is a recipe for serious public discordant.

It is now clear to the Zambian people that the ECZ has no desire whatsoever to allow the people of Kwacha and Kabushi to have a free and fair election and vote for candidates of their choice.

ECZ and the public are fully aware that the issues of the by-elections in Kabushi and Kwacha are subject of active court processes to which the ECZ itself is part to. There are currently three court processes concerning the Kwacha and Kabushi by-elections;

1. The High Court gave a specific order, ordering ECZ to stay the elections in Kwacha and Kabushi.

2. The Court of Appeal ordered a stay of the delivery of the judgment of the High Court pending determination of the appeal filed by the Attorney General and the ECZ itself and

3. There are proceedings in the Constitution Court on the interpretation of the 90 day period set by the Constitution concerning the period of holding of by-elections.

ECZ and the public may wish to be reminded that the Court of Appeal has ruled, suspending the running of the days until it makes its ruling on the matter.

Clearly ECZ is working on the instructions of the UPND to disenfranchise Hon Bowman Lusambo, Hon Joseph Malanji and the Patriotic Front from participating in the Kabushi and Kwacha by-elections.

Zambians must brace themselves for a complete degeneration of Constitutionslim and the total breakdown of the rule of law as the UPND gets more and more desperate to resuscitate its fading popularity.

We wish to inform our members and the nation at large, that the Patriotic Front has instructed its lawyers to commence appropriate legal action against ECZ including citing the ECZ commissioners for contempt of court in their individual capacities.

When a judge nearly declares a former president to be above the law: implications for Zambia

A District Court judge in Florida, judge Aileen Cannon nearly declared former US president to be above the law. This referred to Donald Trump.

The former president transported government classified documents to his residence after he ceased to be President of the United States. Trump was intransigent, apparently in not returning the documents for one and half years until a warrant was executed at his house to retrieve the documents. In applying for the appointment of a Special Master to review the privileged status of some seized documents, Trump argued that “the investigation and treatment of a former president is of unique interest to the general public, and the country is served best by an orderly process that promotes the interest and perception of fairness”.

You steal documents from the government which you refuse to return for one and half years and then claim that you ought to be treated with kid gloves because you are an ex-president! I would have thrown Trump overboard with such a claim. He who comes before court and seeks equitable remedies must come with clean hands. Instead of throwing the book at Trump, what does a Trump appointed district court judge say, which alarmed not only leading judges of the 11th Circuit Court of Appeals and distinguished professors of law, the judges grovelled and supported Trump’s disguised claim to be above the law. Cannon stated, “As a function of Plaintiff’s former position as President of the United States, the stigma associated with the subject seizure is in a league of its own. A future indictment, based to any degree on property that ought to be returned, would result in reputational harm of a decidedly different order of magnitude.’’ See Donald J. Trump (Plaintiff) v. United States of America (Defendant) (Case 9:22-, cv-81294-AMC. After all the reputational damage Trump has done to the USA within the USA and around the world, what unfairness and reputational harm or stigma can a raid on Trump’s home or any future indictment occasion to this man? The judge was swayed by Trump’s arguments and wrote, “the court takes into account the undeniably unprecedented nature of the search of a former President’s residence”.

It is absolutely unprecedented for a judge to order cessation of an ongoing investigation. This judge ordered among others that “the government is temporarily enjoined from further review and use of any of the materials seized from the plaintiff’s residence on August 8, 2022, for criminal investigative purposes pending resolution of the special master’s review process as determined by this court”. Isn’t this placing someone above the law? Could an ordinary moneyless and powerless Jimmy or Yolanda be accorded such “royal” treatment of a suspension of a criminal investigation? The judge swept aside any government concerns about impeding an important criminal investigation by stating that “Efficient criminal investigations are certainly desirable but so too are countervailing considerations of fair process and public trust”. Judges are sometimes fond of throwing around phrases drawn from thin air to protect the moneyed and powerful. It is Donald Trump who was violating principles of fair process and damaging the public trust by stealing government documents and refusing to return them for over one year and a half.

Judge Cannon’s decision and orders were roundly demolished by the 11th Circuit Court of Appeals and derided across the spectrum of US legal opinion.

There are many lessons that can be learnt from judge Cannon’s decision; that there are certain judges who will be recruited in their thoughts and writings to support the moneyed and the powerful. A moneyed and powerful litigant can usually drag court processes beyond recognition to delay accountability and they will always find lawyers and judges to go along, without any judge placing his or her foot to say enough is enough. The government is not above this practice as well, the government usually engages in similar practices resulting in the loss of public trust. Governments, like moneyed and powerful litigants, care more about their reputation than about justice in the result. The money used in prolonged litigation in such cases does not come from the pockets of the government officials or government lawyers or pockets of moneyed and powerful litigants. It is tax payer money and in the case of Donald Trump, it is public money through donations or ill-gotten means. Donald Trump has declared many times that he has used the income tax system to amass his wealth. A civil suit against Trump by a New York Attorney General details all that Trump use and abuse of the tax system for those who want further information on this.

What is happening in the US is happening in Zambia. Individuals are claiming that immunity from prosecution of a former head of state means he must not even be criminally investigated. In essence they are saying that criminal investigation violates the former president’s immunity from prosecution. They are saying the former president, like judge Cannon’s decision in the Trump case, is above the law. They should read the law again. Even those who claim to be above the law like Trump and Nixon did, are not above criminal investigation. Criminal investigation is necessary before any criminal charges or application to remove immunity are entertained. We must insist that no one should claim or be accorded the status of being above the law. Trump and Nixon’s claims have been shot down by dozens of judges. No person in the US or Zambia, be it a judge or lawyer or prosecutor should be recruited to go along the charade that a person is above the law because of their status as head of state, former head of state or because of their money or power.

A 23-year-old woman, of Kaoma District living near where the shooting took place, has testified that he did not see the person who shot at Lawrence Banda leading to his death.

Felistus Liwakala, a general worker at the Mangango Mission Hospital, was testifying during the continued trial in the case were former PF secretary general Mumbi Phiri and Shebby Chilekwa are before the court for murder.

Liwakala said she heard the gunshot but she did not see who the shooter was.

She explained that she also took pictures of Lawrence Banda as he was lying on the ground, which she later gave to the police.

My name is Felistus Liwakala, I am 23 years old, I live in Mangango Mission, in Kaoma District, I am a general worker at the Hospital at Mangango Mission Hospital.
Prosecution: Tell the court what you know.


Felistus: It was 6 October 2019, it was on Sunday, in the morning i was with a neighbour friend, I have forgotten the name. We went to the market together, around 10 to 11 hours. While we were there, we reached the plot we found the PF distributing chitenge.
Prosecution: How did you know that they were PF?


The flag was PF and they wore PF t.shirts and chitenge materials and after sometime, I went there and collected the chitenge they were distributing. After they gave us (Me and my friend) the fitenge, we saw a motor vehicle in white colour and in that vehicle we saw PF members and some were sat behind.
The vehicle left us at the same place and went with the youths they were moving with.
Prosecution: Do you know the vehicle?
Felistus: It was a Toyota Hilux with four doors, I can’t remember the number plate. After the vehicle left, after sometime I heard noise, I didn’t know what was happening I only heard some gun-shot.


I ran to the western side, after 20 to 30 minutes, we heard the noise reducing, I went back, when I reached my place, the next plot is for Monde Nyambe, across the road that is where Chinyama lived, when I reached the other side, I came to realise that there was someone lying at the flats I was living, it was only 3 steps where he was lying on the ground. The person lying on the ground was male wearing a man-u shirt, black trousers, on the left there was a handbag which had a PF chitenge. The landlord advised us to get into the house. That is how I got pictures from the window. I was standing at the window, I was moving a mobile cell phone, after sometimes a lot of people came outside and that is how we went outside too.


When we reached outside the house, people started saying we call the police officers to come and help the person who was lying on the ground, that is how Monde and others went to call for a vehicle and when the motor vehicle came, they picked the same man and put him in the vehicle.


I don’t know where they went. After they left, we left the house around 13 we came back around 16, three people came interviewing people they found at the plot and they started asking who had pictures, I gave them through WhatsApp and they left.


I remember Chishimba and Mukelebai. On 10th October around 10 and 1030, They came to me again, they asked me questions, and gave the statement. Then after last year, some people followed me in Mangango, to ask about the same issues. They asked me if I had forgotten anything, I said yes, after the motor vehicle left, another motor vehicle came there were young men wearing PF cloths and some were wearing masks, when they came, they carried hammers, axe, chains.

A 32 year old man Bevin Sinkala has penned down a hard message to abductors of the 13 girls.

Among the 13 abducted girls, the one who was impregnated happened to be the fiance he was supposed to marry this year in August.

Mr. Bevin Sinkala says he feels betrayed by his friend after he abducted his fiance while pretending like he was sympathetic to him and the family.

He says despite being impregnated and tormented by the abductors, he will not abandon the woman of his dreams and will solemnly take care of the baby.

“You must have succeeded in abducting my fiance for almost 10 months and impregnating her but one thing you have failed to do is to break the love l have for her. Yes she has now given birth to your son but be rest assured that I will do no harm to your son. You made me to cry day and night through out the 10 months you kept my woman in torment”.

“Sikaonga I personally know you but little did I know you would betray me like that. I know where your grand father comes from in Nakonde in CHIEFTAINESS WAITWIKA’s village. You knew I was supposed to marry my fiancee in August this year but you took her by force and made her pregnant”.

“My heart is bleeding but am relieved by the fact that she is out of your captivity. What you have done to my woman is equivalent to killing someone but I won’t say much since the matter is in the hands of the State. I pray for you Mateyo Tamikanji Sikaonga that you repent in prison for God to forgive you because with God all sins can be forgiven”.

The first time I met Enoch Mwepu was September 2019 in the historic town of Salzburg, Austria.
That warm afternoon, Enoch was not kicking leather, so I sat with him in the open stadium terraces and watch his teammate Patson Daka into play.
Later, we retired back up to the secured private VIP cubicles for some ´ eats and treats´ courtesy of one of the richest clubs in the Austrian Bundesliga, FC Redbull Salzburg.


Enoch donned a snow-white shirt, blue jeans, and a dark jacket, his open face easily lit up with an effortless permanent smile.
I could feel myself being in the presence of greatness and humility or rolled into one.
Enoch was only 21, on top of his game, rising and confident when I met him.
Fans buzzed around our bench to take pictures, shake hands with him and express pleasantries he responded to in perfect Deutsch. It was like bees on honey.


I was Zambia´s Ambassador Extra Ordinary and Plenipotentiary to Germany and Austria then, so myself and our embassy Press guru Kellys Kaunda decided earlier in the year that beyond Economic, Cultural and Public Diplomacy, we must cut a niche into what we called Sports Diplomacy.


The ultimate use of loved sports identities as a Soft Power bait and allure to win hearts and souls. Enoch and Patson were ´diplomatic gold´, they still are, just like the Great Kalusha Bwalya before them, the GOAT.
The simple reason is that in their early 20s, filling up stadiums with over 50, 000 people of totally different cultures, Enoch and Patson where perfect diplomats to fly Zambia´s flag high and give it a good name. They were Rocksters in Bundesliga, I fully believed only the sky would limit them.

´Die Roten Bullen´ is a multi-billion-euro soccer company founded almost 90 years ago, it´s the gift that keeps on giving the town of Salzburg, without disappointing, Enoch and Patson were a part of it.


After that, we instantaneously became ´family´ members, either Kellys or me would engage the lads, even if it meant just checking on them. Enoch and Patson became semi-permanent fixtures as “Sports Diplomats” on our embassy page, they were, are a national treasure.
It was therefore heart wrenching when I first read that the bubbly humble and symbol of affection (Enoch) had a heart condition that could affect his future in kicking leather. We pray for him.

Is the Enoch´s Glass half full or empty?

While everybody wore knightly colours today and beat their fists on their chests, however, I recalled something in the smile and the determination tone I picked from Enoch, the first time I met him. He´s got chutzpah.
“Is the glass full or empty?” as I always confess, I am an incurable romantic who believes that ´the sun will rise and shine again´, life always gives you a ´fresh start´ where the second chance is elusive, it shall be for Enoch.


I believe, maybe because of the “Power of the Holy Ghost y áll”! God is not through with using Enoch for the best of Zambia, for himself and family.


I believe out of this temporary medical set back will emerge an even bigger Enoch—a GOAT and juggernaut that shall shock many with success and inspiration, thanks to an early diagnostic report, new medical, technical advancements, and the power of God.

The Fastest Woman on Earth: Wilma Rudolph

If you are not from the 60´s like I am not, you may not know the fastest woman on earth, I don’t mean Wonder Woman.
I am talking about Wilma Rudolph she got the name after striking gold at least three times in track and field events in the Olympics of 1960.
One of Wilma´s legs was smaller than the other being paralyzed with the deadly polio virus.
Wilma wore a brace on the deformed part of the leg when she achieved the unachievable and later recovered fully except for the size of the leg studies say.


Rudolph survived several other illnesses by the time she was 12years, whooping cough, scarlet fever and measles to mention but a few.

Venus Williams the Tennis Dazzler

Venus Williams was in 2011 diagnosed with the ´Sjogren’s syndrome´. I know it sounds alien if you are Zambian like me but it’s a serious ´autoimmune disorder´.
It causes ´fatigue and joint pains ‘that can be unfathomable for a star athlete of Venus creed et al, it forced her to ´hang up her boots´ temporarily and withdraw from major tourneys in 2011.
After that Venus returned to tennis with a new diet and modified training programs and won games.
Like Bono´s U2 would croon, “through the storm we reached the shore,” better things will happen to Enoch after this temporary setback.
Me myself personally, I believe a great future lies ahead of our lad, one of the best Sports Diplomats Zambia has had and will continue having given his youthful age of only 24.


Remember Kirk Franklin´s award winning song ´Today´s a New Day, ´ folks, “even though I hurt see I smile…I know God´s working so I smile.”

Catholic Bishops say Malawians’ daily struggle for survival has deepened under Chakwera

Bishops of the Roman Catholic Church have called out the Lazarus Chakwera administration for failing to fulfill campaign promises saying Malawi is worse off than what people were promised while neighbouring countries are registering meaningful human and economic progress.

The Bishops under the Episcopal Conference of Malawi (ECM) yesterday released a pastoral letter titled “A Call to Hearken to the Cry of Poor Malawians”

Chakwera and the Tonse Alliance promised to create one million jobs, provide loans to women and youths, reduce presidential powers and to stabilize the Malawi economy.

The bishops in their letter say their verdict and that of many Malawians is that the much touted promises of change are far from being realized and the daily struggle for survival for the vast majority of Malawians has only deepened under the Tonse Alliance.

They added that the cry of the poor gets louder and louder in Malawi each day amid worsening general inflation with biting food price increases, rising youth unemployment, rising school fees, inadequate medical services, the fuel crisis driving up transport costs, exploitation by unscrupulous traders and business people, foreign exchange shortages, and lack of effective consumer protection.

“Even when such challenges as the hurricanes, the pandemic and the war in Ukraine are factored in, our humble but honest submission is that we have missed out on leadership to seize opportunities, policy direction and intervention critically sought for at such times. The end result seems to be a Malawi worse off than what we were promised and looked forward to in a region where most of our neighbouring countries, affected by the same challenges, are registering meaningful human and economic progress,” the Bishops say in their statement.

In the letter, the Bishops have spoken about the vice of corruption, defective service delivery systems, inconsistent government austerity measures, bleak picture of the oncoming crop growing season, and the Tonse Alliance’s retrogressive way of governing.

According to the Bishops, Chakwera’s administration is characterized by internal bickering, jostling for political clout, cronyism, nepotism, focusing on narrow selfish political interests and disjointed stances on public policy by alliance partners.

“The situation is a serious cause for worry as it undermines meaningful development which would enhance the lives of people, especially the poor in Malawi. Malawians are tired of politicians who keep fighting for political power before, during, after and in between elections without regard to the development needs of the electorate,” reads part of the letter.

The Bishops have since called upon the Tonse Alliance partners as national leaders to collectively guide the people to the attainment of a better Malawi for all.

“Tonse Alliance partners should desist from worthless and needless politicking focusing attention on 2025 General elections and instead focus their attention on governing Malawi in a way motivated by fairness for all and true development of the country,” reads part of the letter.

The Bishops in the letter have also faulted Chakwera for deviating from his government’s expenditure control measures which were introduced earlier this year.

According to the Bishops, Chakwera is supposed to be exemplary on the expenditure control measures and should listen to Malawians’ concerns over unnecessary internal and external travels which are sometimes undertaken with large entourages.

Bishops who have signed the letter include President of the Episcopal Conference of Malawi Most Reverend George Desmond Tambala, Vice President of ECM Right Reverend Montfort Stima and Most Reverend Thomas Luke Msusa of Archdiocese of Blantyre.

Others are Right Reverend Peter Musikuwa of Diocese of Chikwawa, Right Reverend Martin Mtumbuka of Diocese of Karonga, Right Reverend John Ryan of Diocese of Mzuzu and Right Reverend Peter Chifukwa, Diocese of Dedza.

Ginimbi’s Rolls Royce Burns Again 2 Years After Accident, Months After Mysterious Warning

The late businessman, Genius “Ginimbi” Kadungure’s Rolls Royce vehicle burned again over the weekend following a fire which engulfed the parking bay at the Vehicle Inspectorate Department (VID) in Eastlea, Harare.

The luxury vehicle burned again almost two years after the tragic accident which claimed Ginimbi’s life.

The flamboyant businessman died on November 8, 2022, at the age of 36, after his Rolls Royce Wraith was involved in a high-speed crash, which resulted in the super vehicle bursting into flames. The luxury car went off the road and exploded after colliding with a Honda Fit vehicle.

Socialite Michelle “Mimi Moana” Amuli and two other associates died in the burning car when the doors failed to unlock due to the impact of the collision.

Ginimbi’s Rolls Royce Wraith was one of the accident-damaged vehicles burned by the fire, whose origins are yet to be established.

However, it is suspected that the fire was started by scavengers who were hunting for recyclable material for resale.

Firefighters and VID officials managed to move some impounded vehicles outside the holding bay to prevent them from catching fire as well.

An onlooker who spoke to The Herald said,

“Once the fire got inside the VID premises, it started by torching timber which was in a trailer. The trailer itself then caught fire and it spread, burning the other seven vehicle wreckages in the yard before the fire brigade came,”

Another eyewitness said,

“I do not know the cause of the fire but it started behind the precast wall and we were shocked when we saw a trailer full of timber burning. The fire then spread to nearby cars before the fire brigade came to contain the fire,” he said.

This incident comes a few months after an unidentified woman, who appeared to be in a trance, warned Ginimbi’s sister Nelia that she needed to perform some important rituals.

Speaking at Nelia’s 25th birthday at Dreams Nite Club, the woman said,

“You were supposed to buy three beasts that were supposed to be killed for cleansing purposes at this nightclub before any show. Failure to do so will certainly invite trouble in the form of misfortunes like more mysterious deaths. Ginimbi died on his way from a birthday bash and the same can happen if you don’t listen to me.”

During an Instagram Live session with Choke No Joke, 50’s eldest son Marquise Jackson claimed that the $6,700 in monthly child support ($81,000 a year) he received from his famous father wasn’t enough to comfortably support his lifestyle in New York City.

A doctor at the Kaoma District Hospital, Stan Israel Kaputula, who attended to late UPND member Lawrence Banda on the 6th October, 2019, has revealed that two bullets could have killed Banda and not one.

Dr. Kaputula who at the time was incharge of the Kaoma Hospital, has testified in the Mongu High Court that he shaved Banda and found two entry points and not one.

Dr. Kaputula has contradicted the testimony given earlier by a Doctor from UTH, Pathologist Dr. Adam Mcheleng’anga, who said there was only one entry point on the head.

DAY THREE 06 OCTOBER, 2022.

Stan Israel Kaputula, aged 36, I am current the Health Director Nyangweshi Hospital, in Sioma, Medical Doctor, I have been working for 7 years, trained Ridgeway Campus UNZA, Bachelor or Surgery and Medicine.

Worked from Lewanika Hospital for two years, transferred to Kaoma District Hospital as Director Officer in Charge for about 3 years.

My general responsibility at Kaoma General Hospital, was running both administrative and clinical of the hospital. Then later on transferred to Siaoma General Hospital as Director where I am now.

Prosecution: Yes, in October 2019 where were you?

Dr Kaputula. In Kaoma at Kaoma District Hospital.

Prosecution: Do you recall what happened on 6th?

Dr. Kaputala: Yes, I do. On the same date I was coming from Church and when going home you have to passed through the hospital and I noticed that there were a lot of commotion at the hospital, I am not sure but that was after 12 hours.

I went to investigate and sort to know what was happening, I went to the outpatient department and I found that there were a lot of people and as I was attending to some of them, a victim was brought on the stretcher and brough to the OPD. He had…

I noticed there was bleeding and had blood all over his body, I decided to investigations what was the source of this bleeding. Upon examination I noticed that the blood was from the head. I shaved his head; I noticed some puncture wounds and I decided to suture the wounds and sent the person to the Xray after suturing.

As he was leaving another victim came, who also seemed to have a wound on his upper arm, I examined him and saw that his wounds were not very serious and sent him for xray.
The first victim retained who was wearing a red t shirt who had the head injury, the x-ray revealed some fragments. Which I concluded that where bullets fragments which had entered into his head.

I then cartelised and sent him to the ward, cartelisation is to put a tube for him to urinate. And sent the x-ray to my seniors. To the Saigon here at Lewanika. Then I proceeded to the ward and was joined in by Dr. Makawo, and proceeded to attend to the patient and reviewed him once more over his head injury. We noticed that the pupils were not dilating equally, which indicates pressure in the head, so we released some of sutures that I had made earlier on to release the pressure.

The bleeding continued and we failed to arrest it. As well as we were attending to the patient the power collapsed. Because of the commotion that was around the hospital we decided not to inform the people that he had died. Those who were making noise where members of the UPND and the PF. About an hour later, was advised to airlift both victims by Dr. Makawa.

So, we took both patients, the one with the head injury and the one with the arm injury to the transportation bay. The Plane came and we took both patients with injuries on the plane. We delayed a bit putting the victims in the plane because we had a debate. Because we couldn’t transport the dead one too without alerting them.

So after they consulted the flying Doctors, they allowed to transport even the dead body. That is how I went back to attend to other patients at the Hospital.

Prosecution: You said you had a debate, what was the debate about?

Dr: Kaputula: The issue was there was no need to airlift (evacuate) a dead body.

Prosecution: You said the patient with a head injury was sutured, why was he sutured?

Dr. Kaputula: The head was still bleeding, and to reduce the excessive bleeding a decision was made to suture him.

Prosecution: Apart from suturing if there is any other medical method of stopping bleed, kindly, state whether there is another method to reduced or arrest the bleeding?

Dr. Kaputula: We cover the head that is head dressing in order to compact the wound. We also use some drugs.

Prosecution: Which part of the head was sutured?

Dr. Kaputula: I can’t remember the exactly position.

Prosecution: that will be all my lord for this witness.

Cross examination by the defence now…

Changano: Doc, what time did you attend to Lawrence Banda?

Dr. Kaputula: The exactly time I am not sure that is why I am saying after 12hours.

Changano: After 12 hours. I have mentioned the name, did you know the name of the person?

Dr. Kaputula: I didn’t know the person.

Changano: You didn’t know him personally, personally meaning interaction with someone is it what you mean?

Dr. Kaputula: Yes, my lord.

Changano: You said they were two victims even the other you one you don’t know that person?

Dr. Kaputula: No, my lord.

Changano: So, the person you are saying he died afterwards, how was he dressed?

Dr. Kaputula: The only distinction was a red t-shirt.

Changano: Doc, you have 7-years’ experience, not so?

Dr. Kaputula: Yes, my lord.

Changano: Doc, the victim you are saying he was brought to the hospital was alive, not so?

Dr. Kaputula: Yes, my lord.

Changano: There were no females?

Dr: Kaputula: Males.

Changano: The person you are saying he died after wards how was he dressed?

Dr: Kaputula: The distinction was he wore a red T-shirt.

Changano: Doc, you have seven years’ experience, isn’t it?

Dr: Kaputula: Yes.

Changano: The victim you are talking about you found them when you were coming from church, he was brought to the hospital because he was arrive?

Dr. Kaputula: Yes.

Changano: So many people injured in so many ways, but doctors can make that person live, you can do that isn’t it?

Dr: Kaputula:Yes

Changano: You are aware of situations in this country where you bring patients but doctors delays and nurses delays and that someone dies. Have you got that experience in your seven years?

Dr. Kaputula: Yes

Changano: Yes, you see that is where the problem is. Even if it is alleged that Lawrence Banda was shot at by unknown person but he was gotten from the scene to Kaoma hospital not dead.

Dr. Kaputula: Yes.

Changano: Before you attended to these patients did any doctor or medical person attend to them?

Dr. Kaputula: No…

Changano: How did you know that no one attended to that person?

Dr. Kaputula: On arrival that patient was brought direct to me.

Changano: That is not my question…how did you know that no one attended to that patient?

Dr. Kaputula: The patient was brought direct to where I was upon arrival.

Changano: Okay… What was your first step to the one you said died?

Dr. Kaputula: To identify the source of the bleeding.

Changano: You identified the source of bleeding. If you doctor with the (level) of your education you say let me identify the source of bleeding, your aim was to prevent the bleeding, isn’t it?

Dr. Kaputula: To stop the bleeding.

Changano: And if you are training as a doctor to take care of our lives, you knew that bleeding can be stopped.

Dr. Kaputula: Yes, my lord.

Changano: Yes, if you don’t stop (the bleeding) seven years, as a doctor it means that doctor has failed to stop the blood. Yes or No?

Dr. Kaputula: No

Changano: If your answer is no, in this case did you stop the blood?

Dr. Kaputula: Yes.

Changano: And the idea with that, when you stop the blood (he is corrected) the bleeding my lord, the idea is for someone to survive isn’t it?

Dr. Kaputula: No.

Changano: So if you stop the bleeding the idea is that someone’s life must be revived.

Dr. Kaputula: Yes.

Changano: In this case you failed?

Dr. Kaputula: No, my lord.

Changano: So, if you didn’t fail, where is Lawrence Banda?

Changano: And the idea as a doctor well trained for seven years doctor, stopping the blood, is making sure that you needed the life of Lawrence Banda.

Changano: Doctor, I heard the third method of stopping blood or bleeding, what do you call that?

Dr. Kaputula: Dressing.

Changano: Dressing, when you did the dressing, the idea was that we should have him Lawrence Banda in whatever circumstance of the injury, isn’t it?

Dr. Kaputula: No……

Changano: When you where dressing the head what was the idea?

Dr. Kaputula: To stop further bleeding and other infections.

Changano: You see, in fact I am very interested in an infection. As a doctor you know that the infection can kill, you know that doctor, am I cheating?

Dr. Kaputula: You are not cheating.

Changano: You see doc, what infection where you preventing? I want to know maybe I know a little from my biology.

Dr. Kaputula: The infection in general as a secondary ….

Changano: You know primary is the starting point and secondary you must understand it, so it is the level, what were you preventing, secondary or primary infection?

Dr. Kaputula: Secondary infection.

Changano: Definitely I will agree you with you my doctor, I am not here to torture you, but you know that even secondary infection is dangerous to this body. Yes or no?

Dr. Kaputula: Yes.

Changano: Even in the secondary you realised you can serve life of the victim, isn’t it?

Dr. Kaputula: Yes

Changano: Was he served from this secondary one?

Dr. Kaputula: Yes

Changano: Doctor, we had a doctor yesterday from Lusaka, a pathologist, he said he had some officers who went there, he did not show us the BID report from police that he was Brought In Dead in UTH, do you have the BID report that went with the report to Lusaka?

Dr. Kaputula: No

Changano: So, you have no evidence to prove that he died in Kaoma before this court that Lawrence Banda died in Kaoma?

Dr. Kaputula: No.

Changano: Let me leave because you have said that, I want to leave chance to others. So, Doc, the negligence was between you and UTH Lusaka, isn’t it?

Changano, you said the pupils were not operational equally?

Dr. Kaputula: Yes

Changano: Doc, it is your evidence in this court which I want to understand, you had sutured this person to put more pressure for him not to operate properly and you had to remove some sutures to release the pressure, is it not true?

Zimba: At the time you got to the hospital both patients where alive, is that your testimony? Isn’t it?

Zimba: From the history you were given, you can confirm that what you were told that two political parties were involved in a fight, isn’t it?

Zimba: You were also told that there was a use of a gun in that incidence, isn’t it?

Zimba: Where you also told that a person that had a gun was a person on a motor bike?

Zimba: Would I also be right to state that after the incidence of the 6th October, 2019, which is today 3 years after, you did hear that this person was actually taken to Court in Kaoma?

Zimba: The reason for him going to court is that he had fired the fired gun, isn’t it?

Zimba: Doc, my view is that the job you do is noble one, I pray that God increase your days. Now please tell the Court who gave you the history you have told Court today?

Zimba: What you said was that when you got to the hospital, you got the history as regards to the patient, who gave you that history?

Zimba: Let me move away from that, when you noticed that the pupils were not dilating equally and died, did you certify the person dead?

Dr. Kaputula: I just declared him dead but I can’t remember if I certified him dead.

Zimba: The ordinary procedure is that the file is open, vitals are taken …. What was your conclusion?

Dr. Kaputula: That the end, that person was admitted, catheterised because he was still alive.

Zimba: When this patient came and you were making observations, did you prescribe liver test or alcohol test?

Makebi: I know time has passed and you may have forgotten. Do you remember you gave a statement on 14th October, 2019, right?

Makebi: The statement was taken by Mr. Mwaala a police officer, right? You can’t remember the name…

Makebi: In you statement, I have noted that you said that you were at the hospital at the time the patient was brought, right?

Dr. Kaputula: Yes.

Makebi: But in your statement here you said that you got to the hospital and found commotion. When you got to the hospital you found that there was someone who was wounded. Right?

Dr. Kaputula: yes, there were some victims…

Makebi: It’s not that the person who was wounded found you in the hospital.

Dr. Kaputula: Yes.

Makebi: So, it is not correct to say that the patients were brought direct to you, because you found them there…

Dr. Kaputula: I am not sure because I was already…

Makebi: In your statement you said, you work as medical Doctor and on your way from the Church and when I went to the hospital I found two male patients.

Dr. Kaputula: Yes

Makebi: So, you found them. Right?

Dr. Kaputula: Yes Yes Yes.

Makebi: And obviously you started attending to them.

Dr. Kaputula: Yes.

Makebi: Confirm that you observed bleeding from the person who was wearing a red T-shirt?

Dr. Kaputula: Yes

Makebi: And you proceeded to shave?

Dr. Kaputula: Yes

Makebi: And found two puncture holes on the head?

Dr. Kaputula: Yes

Makebi: And you being as trained as you are, you would have suggested that the two puncture holes may have been made by something that entered and came out.

Dr. Kaputula: Yes

Makebi: If not that, of the puncture were on those two positions differently? Right?

Dr. Kaputula: Repeat the question.

Makebi: The nature of the two puncture holes that you saw was there a point you saw that there were entries or exit?

Dr. Kaputula: Two entries.

Makebi: Two entries. So, if there were two entries it mean that ordinarily we have to find if he was shot two bullets in the head if he was shot, right?

Makebi: And you can confirm that you carried out an X-ray?

Dr. Kaputula: Yes.

Makebi: And that X-ray reviewed to you that there were fragments of a bullet.

Dr. Kaputula: Yes

Makebi: That of two bullets, fragments that you say you found…

Makebi: Have you come with the X-ray?

Makebi: And you will agree with me that there was no surgical procedure that was conducted to remove the fragments.

Makebi: As a matter of fact, in Kaoma there was nothing?

Makebi: You have not come with the X-ray, right?

Dr. Kaputula: No

Makebi: The X-ray could have assisted us to confirm the testimony that you have said, right?

Makebi: If someone came and said there were no bullet, fragments in the head, it may not be the same person that you examined, right?

Dr. Kaputula: No.

Makebi: Because you are very certain that there were fragments in the head, right?

Dr. Kaputula: Yes.

Makebi: And the next route will take obviously is the view of that person’s skull is like?

Dr. Kaputula: Yes

Makebi: And the entries that you saw were consistently on the skull that they were two entries on the skull, right?

Dr. Kaputula: Yes.

Makebi: Was there any fracture on the skull?

Dr. Kaputula: On that one I can’t recall.

Makebi: If we had an X-ray it could refresh your memory right?

Dr. Kaputula: Yes.

Makebi: But what was so clear about the skull is that there were two entry points. Right?

Dr. Kaputula: Yes.

Makebi: And the two entry points were distinct right?

Dr. Kaputula: The exactly distance can’t tell, but there were two…

Makebi: Yes, my lord, What I am trying to tell is if you are able to tell the distance between the holes.

Makebi: Approximately how many inches were apart?

Dr. Kaputula: I can’t really say,

Makebi: That is why I am asking you to approximate.

THE PF will be affected if Edgar Lungu’s immunity is lifted, warns Luxon Kazabu.

Kazabu, who served as deputy livestock and fisheries minister in the Michael Sata administration, noted that Lungu got motivated to says things he should not be saying each time his PF colleagues go to visit him.

He challenged Lungu to entice his members of parliament to support the motion to lift his immunity “if and when it is tabled in the House so that he can have his day in court”.

“Edgar Lungu’s knows the consquences of his immunity being lifted and it will not only end up with him but his vehicle the Patriotic Front. One can only imagine what will happen to the PF if his immunity is lifted and it is very easy all he has to do is to tell his MPs to support such a motion so that a two-thirds majority is attained then we will see what happens when the matter goes to court. But definitely you can tell that it will affect the PF as a party,” Kazabu said.

He said he almost gave Lungu a mark for retiring into a quiet corner but had to withdraw it after “Lungu’s rantings over his immunity and other issues”.

“Lungu gets motivated each time his colleagues got to visit him and tell him that they are with him and will give him solidarity. He gets motivated and this is how he begins to say things he shouldn’t be saying. What he says is depriving him of the statesmanship. He is the only surviving former head of state and so he has all the space to win the support of Zambians as a person who once held the highest office,” said Kazabu. “But if he continues to get excited each time his colleagues go to visit him he will not attained the statesmanship status which entails all Zambians to go to him and seek counsel. I think he is still politically tilted.”

Last Thursday Lungu said he is ready to face the law if he stole during his tenure as president.

He is unhappy that he, as well as his former government officials and family members, have been subjects of investigation for crimes allegedly committed when he was president.

Lungu was particularly displeased that the Drug Enforcement Commission went to a piece of land that he owns to carry out investigations.

He appealed to his successor Hakainde Hichilema to start the process of removing his constitutional immunity from prosecution so that he can clear his name.

“He who alleges, must prove and we will defend ourselves,” Lungu told PF members of parliament and supporters from who visited him. “My urge is that may the president institute the lifting of my immunity by going to parliament to lay a case so that he can eventually prove what crimes I committed.”

BABY, 3 OTHERS DIE IN AMBULANCE AND MOTORBIKE COLLISION

A 1-year-old baby has died in a road traffic accident involving which happened after a motor bike collided with an ambulance where the baby was.

Police spokesperson Rae Hamoonga said in a statement issued to the media today that the accident happened yesterday around 19:30 hours at Kasama village of Chief Mwamba in Kasama District along Lukupa Road.

Mr Hamoonga disclosed that three other passengers from the same ambulance died on the spot.

“Three people died on the spot and One female Juvenile later died at the hospital whilst Twelve others sustained injuries after a T-Better Motor bike Unregistered and a Toyota Land Cruiser Registration GRZ 661 CR a Ministry of Health Ambulance collided yesterday around 19:30 hours at Kasama village of Chief Mwamba in Kasama District along Lukupa Road,” he said.

“The Four have been identified as Abel Mwila aged 25 a Rider of the Motor bike and his Pillion Christopher Mwaba aged 30. The other deceased were passengers from the Toyota Land Cruiser identified as Gladys Mwansa aged 39 and a female juvenile aged one. Amongst the deceased persons, the two Males are from Kasama Village whilst the female and a Juvenile are of Chief Mwamba area.”

Meanwhile, the driver of the ambulance and 11 others have sustained injuries.

“The twelve injured include the following:1. The Driver of the Toyota Land Cruiser Sylvester Katongo aged 32 who complained of chest pains. 2. A Nurse Lydia Mutale aged 29 who sustained a fractured Left arm and Leg. 3. F/Chanda Mwila aged 26 who complained of Backache. 4. F/Rosemary Mutale aged 22 complained of body pains…” he disclosed.

“5. F/Rhoda Ngoma aged 22 complained of chest pains. 6. F/Given Chishimba aged 22 who sustained head injuries. 7. F/Irene Mumbi aged 52 sustained head injuries. . A female a Juvenile aged seven who complained of severe body pains. 9. A female Juvenile aged three who sustained head injuries. 10. A female Juvenile aged two who sustained body pains. 11. M/ Wisdom Kabwe aged 22 who sustained head injuries. 12. M/Moses Bwalya aged 30 a Zambia National Service (ZNS) Officer who complained of chest pains.”

Mr Moonga said all the injured are of Chief Mwamba, except the ZNS officer who is from Makeni in Lusaka and are all admitted in Kasama General Hospital.

He explained that the accident occurred when the Rider who was moving in the direction of South to North (Kasama Town to Kasama village) suddenly turned right without due care, thus cutting in the way of the Toyota Land Cruiser which was coming from the opposite direction of North to South (Mwamba Clinic to Kasama General hospital).

“Consequently, the Motorbike was hit by the Vehicle which later on raced off the road on the western side and overturned. Both the Motor bike and the Toyota Land Cruiser were extensively damaged. The bodies of the deceased

His Excellency Dr. Elias Munshya, High Commissioner of the Republic of Zambia to Australia presented his Letters of Credence to His Excellency Hon. David Hurley (Retd), Governor-General of the Commonwealth of Australia.

During the ceremony in Canberra, the Governor-General stated that Australia stands ready to strengthen its bilateral relationship with Zambia to improve the livelihood of its citizens.

The Governor-General stated that Australia looked forward to strengthening its economic diplomacy with Zambia.

For his part Dr. Munshya noted that the Zambian Government looked forward to growing its relations with Australia in various sectors.

The High Commissioner conveyed the most cordial greetings and best wishes to the Governor-General from Mr. Hakainde Hichilema, President of the Republic of Zambia.

Heart condition stops Mwepu’s football career

Enock Mwepu has been forced to end his playing career following the diagnosis of a hereditary heart condition.

The condition, which can worsen over time, would put Enock at an extremely high risk of suffering a potentially fatal cardiac event, if he were to continue playing competitive football.

Club chairman Tony Bloom said, “We are all absolutely devastated for Enock. He and his family have had a traumatic few weeks and while we are just thankful he has come through that period, he has seen such a promising career cut short at such a young age.

“As a club we will give him all the love, help and support we possibly can to make a full recovery, and then as he decides on the next steps in his life.”

Head coach Roberto De Zerbi added, “I am so sorry for Enock. Before I arrived I looked at all the squad, and he was a player I was so excited and looking forward to working with. We will do everything we can to help him.”

Head of Medicine and Performance, Adam Brett explained, “It is a terrible blow for Enock, but he has to put his health and his family first and this is the right choice, however difficult it is to quit the game he loves.”

Enock was taken ill while on a flight to join up with Zambia during the international break and after a period in hospital in Mali he returned to Brighton to undergo further cardiac tests and ongoing care.

These tests have concluded that his illness is due to a hereditary cardiac condition, which manifests later in life and was not previously evident on regular cardiac screening. Sadly this can be exacerbated by playing sport so Enock has been advised that the only option, for the sake of his own safety, is for him to stop playing football.

Adam continued, “Of course, given this is Enock’s career and a decision which can’t be taken lightly we have taken our time to be as thorough as possible, completed advanced cardiac investigations and collaborated with clinical experts to gain the best second opinions for Enock.

“We will be helping him make sure the condition is managed with the appropriate treatment for him to otherwise live a long and healthy life.’”

1. Yesterday’s statement from the Minister of Community Development; Hon Doreen Mwamba that the UPND Government had decided to maintain custody of the 13 kidnapped girls after their release from hospital, and that the Ministry had since put them in a shelter, makes very sad reading.

2. These rescued girls are not orphans but belong to families and should be reunited with their respective relatives so that they can begin the process of psychological and physical healing from the sexual abuse that they were subjected to by their kidnappers.

3. If the UPND Government was sincere in this matter, why didn’t they give each of the 13 girls an option of whether to go home to their families or being kept in a Government shelter like orphans? Why did the UPND decide to railroad all the 13 girls into a shelter against their wishes? Why has the UPND Government decided to cut all communication between the 13 girls and the outside world?

4. The definition of kidnapping is holding someone against their will, and in this instance we can safely say that the UPND Government has kidnapped the 13 girls for the second time. Why is the UPND Government afraid of allowing these 13 girls to go home and tell their stories? Are they afraid that the girls might implicate someone important in Government, hence their second kidnapping? Where are the civil society organizations which are supposed to fight for the rights of the vulnerable in our community?

5. My message to President Hakainde Hichilema is; please Mr. President, do not kidnap these girls for the second time. Let them go home to their families. From a psychological point of view, the shelter you have put these girls in will soon start resembling the kidnappers house in which they lived in for more than 6 months. Before you realize it, you might find cases of suicide among the girls due to a psychological breakdown. Please sir, release the girls from this unlawful detention by Government. They have already gone through enough. Stop it now sir !!!

We All Have A Duty To Support The Police In Their Duties- Miles Sampa

WE ALL HAVE A DUTY TO SUPPORT THE POLICE IN THEIR DUTIES

As I exit this topic of the 13 girls rescused, we all should be thankful they were found alive. The worst could have easily been the case.

Next is to state that as MP, my major role is to speak for the voiceless in my constituency and when need be, nation at large. This abduction case is unprecedented in our history and instead of apportioning blame on anyone, we should unite as a nation so as to establish the truth and nothing but the truth. This so to then help ensure measures are put in place to prevent this ordeal from occurring again in any district or constituency of Zambia.

At least I don’t wish it to ever happen in Matero and understanding why and how it occurred a stone throw away, is one step in preventing it from happening in our homestead.

So this is not about pointing fingers at the Zambia Police, IG or entire Government. This is about complementing them to find preventative solutions. We see it time and again in the USA when rogue youths shoot and kill innocents kids at a nursery or primary school. Partisan politics is put aside and everyone instantly hold hands to console families and deal with the problem.

What we seeing here is those in authority being defense and gaging us even inside Parliament in the name of ‘active investigations’.

The abductors were not asking the girls which party they belonged to and neither where those that played a role in rescuing the girls. It’s one of those ‘ you abduct one of the Zambian girls, then you have abducted all of our daughters and sisters’.

I know the risks around talking or discussing such matters and been victims of it before. Those who make a living on cooking propaganda are quick to slander ‘why is he seemingly interested. He is tryin to cover himself. He was one of them’. Lol. In our ‘modern’ status quo some most gullible even proceed to believe such propaganda.

This article will however not discuss circumstances and fate of the 13 victims as their case is apparently “still under active police investigations “.
When and if the Police make their final report on the matter, then may comment accordingly.

Away from the girls, here is what I now understand may have happened on that day based on listening to those that state or claim were on site. So the Zambia Police had zeroed in on the exact area where the girls where being held hostage. This I guess from abductors phone signal out of ZICTA. The abductors who were about to capture another victim that arrived at their location after duping her.

The captive opened the gate in ‘business as usual’ mode but noticed the girl at the gate had hint of police decoy. He banged the gate and run inside the yard to the abducted girls house. It was a rented house in one area of the wall fence away from the landlord house who was also a single and relatively young man.

The abductor ran into the house to grab his treasured items and can imagine a phone and wallet. He then bolted by jumping the wall fence for his safety. The abducted girls then sensed trouble for the abductors and instant opportunity for their freedom.

They followed abductor actions dashing to the wall fence to jump out as well. Most managed and ran to nearby houses screaming for help.

They stated some girls were still inside and need to be helped out. A few boys encountered rashed back into the captive yard to rescue the ones that had remained. It was two pregnant girls and one heavily so. Attempts to help them out through by now open gate were futile as one the heavily pregnant girls insisted to exit by jumping via the wall as well. She cried and opposed using the gate route as in her mind it may have lead to her death given thats where the abductors would arrrive from.

Once all girls were all out of the danger yard, the community the gave them water and also phones to make calls to their mothers or relatives. In the same period the C5 rapid response Police unity arrived.

The Police and residents of the area should both be commended. Nowhere in the World does the Police work effectively without community participation. Police work is made easier if neighbours of law breakers volunteer information. This is a given fact and Zambia actually once hard a very solid neighborhood watch programme.

Emmasdale and Makeni areas were well known for their solid neighborhood watch programmes. They arrested criminals by the time the Police would arrive be it a few second later. I gather it was abolished after some began to abuse the same neighborhood watch errands to commit crimes.

That said we still need to enhance solid partnership between the Police and communities. The two are symbiotic and heavily depends on each other to meet their aspirations. We should desist from vilifying those that assisted the police towards, during and after in the rescue of the girls. We should actually make them heroes so as to encourage residents of our communities to be vigilante in helping neighbours raised by criminals.

This will encourage residents to wake up quickly in the middle of the night and out of their houses to help each time they hear late night compound shouts of ‘ kawalala kuno’( there is a thief in our yard).

ZP has always had operational challenges time immemorial but a united comminty, can still help them curb usual and these latest strange unZambian crimes.

Well done everyone one that acted brave to get the girls rescued. Every incident is a lesson for us to help better future security for all citizens.

As for the rewards, it will not be released to anyone until Police investigations are officially completed and hopefully sooner. We don’t wish used as scapegoat and cited for interfering in the ‘police active investigations’.

As for anyone telling me to shut up, it’s exercise in futility as that also my ‘talanta’ (calling) to speak for those unable to even when they have acted in heroic manner and no one is noticing their effort. Happy to give them a platform to be noticed by those that voluntarily wish to reward them.

The topic is not and should not be a them (in government) and us matter. It’s a matter for all of us to deal with. It’s a matter for the safety of all Zambians and more so the girl child.

Stoping us the public or the rescued girls from speaking out will not do. Openness and even some apology if need be is what will heal the nation out of this unprecedented ordeal.

Being defensive just goes to accelerate the anger from citizens especially all of us parents of girls.

Let’s face the problem to and unite to resolve the puzzle and ultimately curb such crime from ever occurring in Zambia.

FORMER home affairs minister Stephen Kampyongo says his arrest over property Anti-Corruption Commission claims is suspected to be proceeds of crime valued at K29 million is just mischief.

He says his wife Wanziya Chirwa, who is chief planner at the Ministry of Youth, Sport and Arts, was being vilified because she was married to him.

Kampyongo told The Mast that it did not require a quantity surveyor to ascertain the real values of the property in question.

“You know what, the media will be invited to go and see those properties so that they can compare for themselves if value translated into those concocted figures,” he said. “Have you not seen the way they sensetionalise on others? They even take videos and pictures but in my case, they did not do that. So we shall date you the media to go and see those properties so that we are on the same page because this kind of circus won’t take us anywhere. I am telling you.”

Kampyongo said it did not need a quantity surveyor to establish that the figures provided by the ACC had been concocted.

“You need to view the properties first to understand what I am saying. You see I am not bothered. I know they have gone to fish everywhere I have worked. They found nothing. So now they started looking for property. Whose value are they using? Because even you as an ordinary person you don’t need to be a quantity surveyor to see that there is mischief,” Kampyongo said. “That is why I am not bothered.”

He said he had spent the whole day, on Thursday, at ACC where he was being interrogated.

And Kampyongo said his wife was being inconvenienced because she was married to a politician.

“There is nothing like joint ownership. The only crime she has committed is to be married to me a politician. She is a qualified civil servant who has worked diligently and has never been implicated in any thing. She has never had any disciplinary charge. So here the only crime is to be married to a politician. I have served in government as a minister. I want you people to see the property being talked about,” said Kampyongo.

On Thursday ACC chief corporate affairs officer Timothy Moono announced that Kampyongo and his wife were arrested and charged for “possession of properties valued at K29,552,513.00 suspected to be proceeds of crime contrary to section 71 (i) of the forfeiture of proceeds of crime Act No. 19 of 2010”.

It’s a tragedy!

My last night into early this morning was spent at Levy Mwanawasa University Teaching Hospital, a close friend of mine had an emergency and they were rushed there.

I was greeted by fresh blood strewn along the floor from the entrance right through to the consultation rooms on your right. Initially, I thought an accident patient had just been brought in and the clean up of the floor would soon follow. Once I was there close to an hour I got concerned how we were side stepping or jumping over fresh blood as we walked from the entrance through to the corridor a distance of slightly close to 25 metres.

Eventually, I took it upon myself to ask for the blood to be cleaned off the floor! The Medical personnel didn’t look bothered at all. So I asked the guard to get someone to attend to it urgently. It took a while to get done by a gentleman who looked sleepy, lethargic and unbothered, he just run the mop over the floor and off he went… What kind of people are we really, how and when did it become a normal sight to have blood on the floor for hours.

LMUTH is a new hospital on paper, a dirty hospital it is in reality… Whoever is contracted to clean the hospital is doing a terrible job of it, the floor is stained (ukukowela) as if they clean it with dirty water. You would think it will take years before we would see such sharp decline (Hell NO…) It has taken less than 18 months.

An expensive gift (China to Zambia) been looked after badly…

The service was pathetic but that’s the story for another day. Just observing the happenings at this Hospital my heart was deeply troubled.

They cry for jobs at every turn, even toy-toying to get a chance at serving patients only to get employed then the mockery and rudeness starts… doing things with no care or sense of urgency!

Newly recruited civil servants resisting rural areas risk being replaced – HH

President Hakainde Hichilema has warned newly recruited civil servants declining to report in rural stations that Government will not hesitate to replace them with others waiting to be employed.

The President said Zambians in all parts of the country be it rural deserve to receive health and education services like those in urban areas.

Mr Hichilema noted with concern the high number of reported incidences were teachers and health workers deployed in rural areas are requesting to be redirected to institutions in urban areas.

He said lack of accommodation should not be given as an excuse for refusing to work in rural areas as Government was doing everything possible to improve housing for civil servants serving in rural communities.

The President has since announced Government intention to recruit extension officers under the Ministries of Agriculture and Livestock respectively with the directive that those to be recruited should serve where they are sent.

Meanwhile, President Hakainde Hichilema has committed to unifying the country in order to actualize the goals of the visionary leaders who fought for Zambia’s independence.

The President says his administration is determined to honouring the peace efforts of the fallen heroes who risked their lives meeting under the Samu Lya Moomba tree in Monze strategizing on delivering the country from colonial rule.

The President was speaking in Monze yesterday when he graced the Samu lya Moomba traditional ceremony of Tonga – Ila people of Chief Choongo in Southern province.

President Hichilema has since pledged to maintain the unifying spirit of the event which the country’s fore fathers recognized as a pre – requisite to national development.

The Head of State highlighted government’s commitment to implement projects aimed at bettering the lives of the Zambians as envisioned by the country’s freedom fighters.

Mr Hichilema has since assured the people of Monze that government will complete the construction of the Monze – Niko road whose works have stalled over the years.

And speaking earlier, Chief Choongo who spoke through a representative, appealed to government to consider constructing a university in Monze that will be biased towards livestock and agricultural trainings.

He said livestock farming is main economic activity for the people of Monze and Southern province as a whole hence the need to have a university in the region.

Meanwhile Southern Province Minister, Cornelius Mweetwa has commended President Hakainde Hichilema for becoming the first President to recognize the role Samu lya Moomba played in the country’s political history.

And Minister of Tourism, Ronald Sikumba said his ministry will continue marketing the ceremony domestically and internationally.

A gathering in See Car Zay of educated police officers was underway. Named after a renowned linguist, a whole platoon of Mphombozi was reviewing a rescue mission for a woman abducted six months ago. Their plan was to apportion blame on the previous uneducated officers called Kapasos for their cadre mentality.

“Gentlemen” although the gathering had female officers, “we have to put a stop to these abductions” said a huge figure of a man named Car Jobber, who had carved a career chasing cars. The entire See Car Zay camp was home to traffic officers, whose irises were inseparable from cars and money.

To help solve this mystery we have invited Zee International Company for Tracking Activities (ZICTA), he shouted nonchalantly while handing over to a zee TV official. “As long as the abductors use smart phones, their days are numbered, the bespectacled official thundered. The next speaker, a highly decorated officer insisted that since the last TV thief wore a green shirt, the team should concentrate on anything green. Hooray! Eureka!

Just then a phone rung from Car Lala saying they had found the abductors. What ensured at See Car Zay was chaotic! Where is ray to shine our way? What about Zero Breaking News Corporation? Do we have enough tear gas? Nanga full well. The scene in slow motion segued to the final lap as gun totting officers scrambled to board dozens of armored vehicles.

On arrival, the swat team was pleasantly surprised to find a slim teenager mistakenly paraded as commander. He had pinned one red and not green shirted abductor while being accosted for an interview by fearless Costa! Like Costa he picked words with finesse, knew the geography of the area and triumphantly said he was unfazed when the other abductors vanished in thin air. When asked about the abducted young woman, he corrected the Mphombozi by saying it was actually a dozen plus one.

After ransacking the entire crime scene, the jigsaw puzzle was unraveled. It looked like the search party concentrated on cyber-crimes and smart phones when abductors were using Nokia 33 phones hidden in a casket. Now the feared disciplinary committee is pushing the heroic youngster to start training ba Mphombozi, who wasted their time shooting videos and taking selfies at the crime scene! Police have responded by saying Robby is an impostor.

DURING his free time, Ministry of Health senior health promotion officer Brighton Sinkala graced events either as a master of ceremonies or guest artist who left his audience with his rib-cracking jokes.

At the weekend, Sinkala made the 400 kilometer journey to MC a wedding of Aston Kalutwa and Suwilanji Sichembe at Kitwe’s Garden Court Hotel on Saturday evening.

Wezi Siwale, a Kitwe based photographer tooka the last photos of Sinkala doing what what he was well known for – MCing.

On Sunday morning, Sinkala started off for Lusaka but had had an accident that ended his life on Great North road near Mulungushi bridge in Kabwe yesterday.

Central province police commanding officer Daniel Moola has confirmed the incident.

“Involved in the accident were Brighton Sinkala 53 a comedian of Lusaka who was driving a Mercedes Benz car registration number AID 6019 from North to South directions with one passenger on board Musa Yusuf aged 78 years of Ndola.

Another vehicle was a Nissan bus registration number 6321AA25 which was been driven by Rashid Shabani aged 47 of Tanzania from South to North directions with 45 passengers on board and a freight liner truck registration number BCC4195 and AEB 2641 which was stationed on the middle of the road due to a break down whose driver was Sakala Emmanuel aged 43 years of hse # A25 garden house house Lusaka”, Moola said.

He said the accident happened when Sinkala hit into the stationed truck due to excessive speed and later spined and collided with the bus which was coming from the opposite direction.

“Due to the impact the first motor vehicle rested on the left side off the road.The driver of the first motor vehicle sustained painful right arm and general body pains,his passenger had painful swollen left leg,back and chest pains.All passengers from the bus escaped unhurt.The first motor vehicle was extensively damaged,the second motor vehicle had front right bumper and fender damaged while the third vehicle had damaged rear right bumper and lights,” he said.

ZIMBABWE’S military incursion into the Mashonaland Central province for a routine training exercise is part of efforts by the Zimbabwe Defence Forces (ZDF) to familiarise itself with the area as the Southern African country stands on the verge of discovering oil reserves along the Zambezi basin.

The operation is meant to secure what may turn out to be oil reserves in Muzarabani.

Before publication, efforts to contact the Invictus Energy management drew blanks.

In e-mailed responses to questions posed by the Zimbabwe Independent, the ZDF confirmed that it had notified stakeholders in Mashonaland Central ahead of the training exercise and was committed to protecting everything inside the country.

ZDF, the statement further read, was well positioned to defend the country.

“All government ministries, the provincial leadership, traditional leaders and all stakeholders in Mashonaland Central province were engaged during the planning stages of the exercise.

“At the commencement of the exercise, the whole nation was then informed through a press release issued on September 23 2022,” ZDF said.

Responding to whether ZDF would be ready to secure and protect Zimbabwe’s oil fields if ongoing exploratory work turns out to be positive, the ZDF said it would be resolute in protecting, “everything within the boundaries of Zimbabwe”.

“The constitution of Zimbabwe Amendment (No.20) Act 2013 Section 212 provides that, ‘The function of the Defence Forces is to protect Zimbabwe, its people, its national security and interests and its territorial integrity. What is implied in the constitution is that the ZDF must protect everything within the boundaries of Zimbabwe’,” the ZDF said.

As part of its adventures in Mashonaland Central, ZDF noted that it was collaborating with all state security agencies charged with the constitutional duty of protecting the country’s territory.

“The defence and security of our nation is not the preserve of the ZDF alone but encompasses the role played by other security agencies.

“Therefore, the act of defending the country’s territorial integrity naturally requires the highest level of coordination between all the defence and security agencies which is achieved through joint training activities such as the training exercise currently underway in Mashonaland Central province,” the ZDF added

In August, Australia Stock Exchange-listed energy explorer Invictus Energy started drilling the first of two test wells at its Cahora Bassa claims, expressing optimism that exploration data indicated that Zimbabwe could potentially strike oil.

The company was awarded rights to prospect for oil along the Zambezi valley in 2020, which was followed by negotiations between the firm and the government to come up with a Production Sharing Agreement (PSA).

At that time, independent estimates indicated that the prospect could potentially yield 1,3 billion barrels of equivalent (BOE) oil or 206 billion litres of oil in the Zambezi valley basin.

Last month, the ZDF announced that it was embarking on a month-long training exercise in Mashonaland Central, which would culminate in the movement of a sizeable number of troops and military vehicles from Harare into the area as optimism rose that Invictus Energy’s efforts would transform Zimbabwe into an oil-producing country.

The troops are being deployed to six districts, namely Bindura, Mbire, Muzarabani, Rushinga, Mt Darwin and Shamva. Invictus is conducting its operations in Muzarabani.

The training exercise, which comes after ZDF conducted routine military drills in Masvingo last year, is set to end on October 21 as the army gears to “sharpen and perfect its operational skills so as to enhance the Zimbabwe Defence Force’s capability to fulfil its mandate”.

Petroleum and security sources told the Independent that the ongoing military drills in the province which borders Zimbabwe with Zambia and Mozambique were primarily meant to “safeguard what could potentially turn out to be Zimbabwe’s oil treasure at a time the country is on a drive to turn around its fragile economy”.

The sources, in separate briefings, told this publication last week that the military, in line with its constitutional mandate, also wanted to stamp its presence in the area and avoid the situation deteriorating into chaos as was the case when Zimbabwe discovered a lucrative diamond treasure trove in Manicaland, which was projected to satisfy 25% of global demand at the time.

Over a decade ago, as Zimbabwe was reeling under unprecedented economic turmoil, the country stumbled upon alluvial diamonds in Chiadzwa, which triggered informal mining activities by illegal miners.

The ZDF later deployed soldiers into the area to maintain order as the illegal mining activities often degenerated into violence resulting in death, in some cases.

As the government, through the ZDF, moved in to foster order in the area, the military also secured shareholding in some of the mining companies licensed to extract the gems. ZDF holds equity in Chinese diamond miner Anjin.

“As prospects remain bright that Zimbabwe petroleum exploration activities will yield positive results, the military should also be geared to ensure that any future oil mining activities will be orderly and not turn out to be chaotic as was the case in Chiadzwa when the country discovered huge diamond deposits in 2010,” a petroleum industry source told the Independent.

Rural district council sources in Mashonaland Central province told the Independent that the excursion of the military into the area stretched into Zimbabwe’s territorial border zones with Mozambique and Zambia.

In neighbouring Mozambique, a deadly insurgency flared up in the country’s resource-rich Cabo Delgado province, displacing over 570 000 people and claiming thousands of lives. The insurgent outfit known as Al Sunnah WaJaama, with Islamic inclinations, escalated violence in Cabo Delgado, triggering fears that the insurgency could spill over into Zimbabwe and disrupt the country’s security and key imports such as fuel which are shipped through the Port of Beira.

The militants have disrupted freight movement along the Mutare-Beira trade corridor which gives Zimbabwe the shortest route to the sea and poses a serious threat to the economically strategic Beira-Harare fuel pipeline, commonly known as Feruka.

Zimbabwe shares a border with Mozambique and Zambia in Kanyemba which is in the Mbire District of Mashonaland Central.

The source added that ZDF, apart from the public notice it issued in August, had also formally notified key businesses operating in Mashonaland Central, particularly Invictus Energy.

“ZDF advised notable businesses operating in Mashonaland Central, particularly Invictus Energy, of the one-month long training operation underway in the province and along the border with Zambia and Mozambique,” a source who spoke on condition of anonymity told this publication.

With the military exercise already underway in Mashonaland Central, Invictus Energy this week announced, in an update, that it was targeting “20 trillion cubic feet plus 845 million barrels of conventional gas condensate (gross mean unranked),” at one of its two test wells known as Mukuyu 1.

“Mukuyu is one of the largest oil and gas exploration prospects to be drilled globally in 2022 targeting a combined prospective resource potential of 20 trillion cubic feet and 845 million barrels of conventional gas condensate, or about 4,3 billion barrels of oil equivalent on a gross mean unrisked basis,” read the company’s statement.

It said its second test well, known as Baobab, displays “similar structural characteristics to the play opening Ngamia discovery in Kenya’s Lokichar basin, which resulted in subsequent discoveries in the ‘String of Pearls’ along the basin margin”, Invictus said in its latest update

WHO WILL DEFEND PUBLIC INTEREST?

In March 2022, 15 UPND cadres who were accused of burning Lusaka’s City Market took the State to Court demanding K8 Million in compensation for false imprisonment and malicious prosecution. In May, a UPND cadre who was accused of attempting to assassinate former President Lungu sued the State demanding compensation for false imprisonment and malicious prosecution amounting to K5 million.

In August this year, four UPND cadres sued the state in the Lusaka High Court seeking damages for false imprisonment under the PF on a charge of possession of offensive materials and weapons. This month, October, 22 UPND members who were arrested for unlawful assembly in April last year have sued the State in the Lusaka High Court demanding special damages for unlawful detention.

There are other suits too numerous to mention but the ending has usually been the same: consent judgements between the suing parties and the Attorney General followed by payment of huge sums of money from the treasury to those that had sued.

Why is the Attorney General Mulilo Kabesha, who himself has known ties to the UPND, eager to award huge monetary damages through consent judgements to UPND members in all cases where such members, represented by UPND aligned lawyers, have sued the state for malicious imprisonment unlawful detention or wrongful prosecution that occurred under the PF? Isn’t this a form of organised looting of state resources? What is preventing the Attorney General from defending public interest by way of allowing these cases to proceed to trial where the petitioners’ claims can be put to the test or challenged? How does the public even know with certainty that these claimants exist and that they are not hired people masquerading as UPND cadres who are being used to reward party cadres or mobilise financial resources for the party?

Where is the new dawn they keep singing about? How different is this organised banditry from what the PF did with Lewis Mosho over the Shoprite case? Those who have followed these cases may note that so many have been filed, but usually only one at a time. A new one is only started after the existing case has been disposed of via a consent order. To our knowledge, not a single one of these cases has ever gone to trial. Why? Is the UPND indirectly fundraising for the party or ‘empowering’ its cadres using state resources?

There is a wider lesson here: the cost of appointing party loyalists to key government positions, the same thing that happened under the PF. The only difference is that the PF were more transparent about this practice. The UPND is doing the same but make it appear like they are hiring non-partisan professionals who are apolitical or not UPND aligned. This is merely a smokescreen. Like the PS without portfolio Patrick Mucheleka at Cabinet office, Levy Ngoma, the Special Assitant to the President for Political Affairs, holds a position in the UPND leadership. How can these civil servants be expected to rise above their party interests in cases where these are threatened? Is it surprising that Levy, alongside the Home Affairs PS Josephs Akafumba, was implicated in a telephone scandal in a matter that involved the interests of the UPND as party and which had nothing to do with public interest?

And even when the public complained about Levy’s conduct and abuse of state resources to advance the interests of the UPND, nothing happened to him because he was, as he said in the leaked audio, acting in furtherance of the interests of the ruling party and on the instructions of his principal. (And by the way, how far has the police gone with the investigations into the leaked audio scandal? It has been nearly ten months now! Or is the Inspector General of Police waiting for members of the public to share their findings on the case before Mr Lemmy Kajoba can claim credit and praise himself?)

The issue we raise of appointing party functionaries to important government positions that require independent minded professionals is not a small matter. It is an important issue that is likely to assume even greater significance when appointments to the office of the Director of Public Prosecutions and the leadership of both the civil service and the Electoral Commission of Zambia are made. Those in doubt that party functionaries will likely be appointed to these positions should wait for the long delayed but imminent announcement of the new DPP, ECZ CEO, ECZ chairperson and deputy chairperson and Secretary to Cabinet.

When one looks at positions such as Special Assistant to the President for Legal Affairs, Minister of Justice, Attorney General, Solicitor General, ACC Director General and even Speaker of the National Assembly, they will realise that these public positions are all filled with individuals who are linked to the UPND and possibly members. How can these be expected to retain fair or independent judgement and defend public interest in matters that involve or affect UPND members? Can these officials really rise above their possible partisan interest and allegiance to the UPND since its potential loss of power would denote their own removal from these positions?

One just has to listen to the Minister of Justice whenever he speaks on issues of public interest that affect his party. He sounds like a UPND Secretary General! Can the current ACC Director General sanction the investigation of Maurice Jangulo’s company in relation to the procurement of fertiliser when Maurice has strong ties to the appointing authority, with whom the DG has very close client-patron ties stemming from their time in opposition? Is it any wonder that the ACC has never found any single case of corruption in this government? We know of the corruption involving some of the presidential aides at State House. If the ACC does not know, then they are simply not up to the challenge. If they know, how come they have not summoned those involved for interrogation? The only time the ACC should be taken seriously is when they start to touch members of the inner circle of this government. Look at the contradictions coming from the Attorney General’ office on the honeybee scandal! Why isn’t the ACC getting involved in this matter? Isn’t it because some of the culprits involved in the behind the scenes negotiations pertaining to honeybee are their colleagues at State House, even though some praise singers will falsely claim that it is actually State House that blocked the payment to honeybee?

Some of these officials we have mentioned above run law firms that are still doing business with government. Like their principal who has not only refused to publicly reveal his assets and declarations in the spirit of transparency but made it clear that his businesses are still doing business with the government, they don’t see any conflict of interest in their dealings. Take the current cases, for example. Those suing the State for malicious or wrongful prosecution are UPND cadres. Those representing the litigants are lawyers connected to the UPND. Those who have the responsibility to put up a fight on behalf of the state and in defence of public interest are connected to the UPND. Those deciding the huge amounts to be awarded to the petitioners are officials connected to the UPND. Doesn’t a consent order in this case benefit everyone involved: the cadres, the lawyers, the officials, and indeed the party, if some of these resources end up there? We are not saying those suing have no case. We are asking a simple question: can these officials really vigorously defend public interest against the ruling party members making the claims, even if these cases go to trial?

Zambia, we have been duped! These people in power today are not who they claim to be. They say one thing in private and another in public. They are wolves in sheep’s skin. The other problem is that many in civil society have been co-opted. With the exception of one or two people such as Brebner Changala, John Sangwa and Archbishop Telesphore Mpundu, those from civil society who held to account or criticised the excesses of the previous administration are now serving in government bodies. With food in their mouth, they can no longer speak. Whenever they speak, it is to lead the choir of praise in such sycophantic fashion that they end up doing a disservice to those they support. Since they are incapable of embarrassment, one can only be embarrassed on their behalf. It is sad to see people with previously illustrious careers in civil society reduced to the role of praise singers.

The same problem of co-optation is noted in relation to Zambia’s public intellectuals. This group was instrumental in promoting progress and to political change prior to the 2021 election. By intellectuals, we do not mean those who display their educational attainments for anyone to see. We mean men and women attached to a university who have acquired a certain level of education that enables them to produce, disseminate and apply new knowledge to the analysis or resolution of the problems of society. Intellectuals who use this specialist knowledge to comment on public issues in their areas of specialisation through mass platforms such as newspapers, television or radio stations are called public intellectuals. Those who merely confine themselves to teaching and research in a university are called academics.

In many societies, especially those that place a premium on thinking, public intellectuals are role models. Since intellectuals play powerful legitimising role, their criticism of the government has implications for the standing of the government in the eyes of the public. In Zambia, intellectuals have been frustrated by poor conditions of service and their expertise has generally remained unsolicited and often underutilised. This may explain the extreme penchant, among our intellectual elite, for opportunism and willingness to be silenced in return for an appointment on a government board. So, when a few stand out and condemn injustices, that is worth celebrating.

Before 12 August 2021, there were several intellectuals who risked their careers and even lives to express outrage against the many wrongs that were happening under the previous government. There was Dr Grieve Chelwa from University of Cape Town, whose opposition to the economic reform measures sponsored by the IMF and World Bank was conveniently ignored and often frustrated. There were others like Ms Felicity Kayumba, Dr O’Brien Kaaba and Dr Pamela Sambo found in the School of Law at UNZA whose constant criticism of the judiciary and the executive were thought to be a matter of principle, not sheer opportunism. One or two such as Dr Julius Kapempwa and Dr Cleopas Sambo from the School of Humanities and Social Sciences provided illuminating insights that raised public awareness and fed greater understanding of the government’s policy failures.

And who can forget the courageous voice of Dr Sishuwa Sishuwa who was subjected to threats on his life, faced the threat of prosecution for sedition and was disowned by his employer, the University of Zambia, over his critical writings in both print and online media? There was also Dr Munyonzwe Hamalengwa at Zambia Open university and Professor Muna Ndulo in the United States of America who never missed an opportunity to criticise the government especially on matters that touch on human rights and the violation of the law. Even UNZALARU, the body of lecturers and researchers, at UNZA, recovered its voice and appeared to regain its lost credibility on matters of public interest such as Bill 10.

Which of these intellectuals who stuck their necks out to challenge undemocratic practices and confront human rights violations have continued with the same spirit or zeal of holding the government to power today? Except for one or two such as Dr Chelwa and Dr Sishuwa who continue to identify with the suffering of the people and have remained generally critical of the same things they condemned under PF, the intellectuals who previously spoke truth to power have become willing collaborators in the wrongs of the UPND. The record is there in the public domain for all to see. Today, most of these intellectuals have joined the incriminating silence of those who cannot speak with food in their mouth because they are enjoying the perks that come with serving on several government bodies, though they will go to great lengths to convince unsuspecting victims that it’s not about the money or that the money is actually very little.

Other intellectuals are now deathly silent and simply looking away when wrongs occur because of a certain allegiance to the party in power, one that has anointed itself with the sanctity of a religious faith. If some of the wrongs occurring in this government had happened under the previous administration, these intellectuals would have been in the forefront of speaking out against such vices. Can anyone imagine these academics keeping quiet under president Lungu if ordinary people were jailed for insulting the president, or PF cadres took turns to sue the state for malicious or wrongful prosecution under the MMD and the Attorney General rushed to reach a minimum of K500, 000 settlement with each of them and even more money paid to their PF aligned lawyers?

Those who yesterday were in the front seat of condemning wrongs and injustices whenever they occurred are the ones who are today giving legitimacy to and rationalising the wrongs and injustices of the UPND. Some within group even say, ‘things are not yet as bad as they were under PF’, as if the PF wrongs are now the threshold we must reach before raising our voice against injustices. Others shamelessly say ‘there is no county or government that is immune from wrong doers’! How can people lose their self-respect and dignity this way? Anyway, as former president of South Africa Thabo Mbeki once said, empty stomachs can be good or bad teachers. The problem with our African intellectuals is that they too have stomachs, in addition to their excellent brains.

A Single bullet shot at UPND member Lawrence Banda, in 2019, in Kaoma District led to his death, a Pathologist Adam Mcheleng’anga has told the Mongu High Court.

In his testimony: Dr. Adam Mcheleng’anga said he examined the body of Lawrence Banda at the University Teaching Hospital (UTH) at the behest of Coroner Mwaka Mikalile.

He said from his findings, Banda died of a bullet wound inflicted on him during the Kaoma by-election.

My name is Dr. Mcheleng’anga Adam, I am 43 years, I reside in Lusaka’s Salama Park.

Prosecution: I apply that the list of witnesses be amended that we add the name of Dr. Adam Mcheleng’anga for now.

Defence: No objection.

Dr. Mcheleng’anga: I am a State forensic expert, I am employed by the Zambia Police Service, and based at UTH, where my duties are to investigate deaths, and investigate sudden death and un expected death, deaths in custody to mention but a few. Among my academic qualification I hold a post graduate certificate in forensic pathology (And other many academic qualification).
At the moment I have conducted about 3000 post-mortems, and in addition to that I am involved in the academics in the teaching of forensic pathology to pathologists in Zambia. I am an author of academic papers and journals and on the subject …

Prosecution: Witness, kindly state why you are in this court for?

Dr. Mcheleng’anga: I conducted the postmortem examination in 2019 in October to be more specific, on the 9th October 2019. I received an order for postmortem examination, from a coroner at a time Honourable Mikalile that was brought to the University Teaching Hospital (UTH), by police officers from Zambia Police at Headquarters and the attending officer was detective constable Nyondo.

My Lord there were other police officers and relatives as witnesses from who I obtained the history of the deceased. My Lord history was obtained from officers whom I referred to as attending officers and from other police officers from the service and the relative who identified the body.

And the history was that the body of the deceased was involved in an alleged shooting in Kaoma after which the body was taken to the hospital and died.

After that I proceeded to conducted the postmortem. The procedures I carried out to conduct the postmortem included the photographing of the body, external examination of the body, I removed the cloth of the deceased he was wearing which I handed over to the officers, I conducted the standard internal examination.

By internal examination of the body, I mean the cavities of the body were examined, that means the head, the chest, and the abdominal cavities. I did not conduct the CT scan, after conducting these procedures, I might say that the significant findings, were limited to the head, firstly I must say that on examination, there was signs of medical intervention, so there was a catheter , a tube that is inserted to the penis to the bladder to help urinating, and then I noted that there was a wound on the head that had sutures, I removed the skin from the skull and again I noted that the skull or the bone that covers the brain, on the front of the head was,… had a defect, in other words there was a hole within the bone of the head and then a lot of fractures, breakage of bone, moving from the central area.

After I removed the top part of this bone, I refer to as skull I also observed that the brain had a lot of haemorrhage referee as subarrachiod, this is bleeding underneath, on the tissue that covers the brain. My Lord I took pictures of all these procedures I am talking about. After that I went further to remove the brain and again examined the bone that houses the brain. My line in doing this I also looked for the projectile, after I finished examining the brain, and the head I did not find any projectile, from there my lord I shifted my attention to examine the chest. I examined the abalone the chest cavity in fact, and found that these areas where unremarkable. They were within normal, my lord I proceeded and collected blood and stored it, and went further to conclude that based on the circumstances and my postmortem findings, the cause of death was a gunshot wound to the head.
My lord and that the entry wound and exit wound were at the same point. And that phenomenal where the entry continues with the exit wound, we call that key hole deformity. I also, I am of the opinion that the death was, the body was struck by one bullet, and that the wound, the injury was incapacitating. That means that the deceased was not able to carry any voluntary activities. After I did all these procedures, then went ahead and authored a report, and I compiled photos, that were handed over to the investigating officers.

Prosecution: Witness the examination was done on whose body.

Dr Mcheleng’anga: On a 24-year-old man identified by a relative as Lawrence Banda.
Prosecution: You said you got pictures and prepared an album?

Dr. Mcheleng’anga: I will be able to identify both my postmortem report and the photo album I prepared.

Prosecution: Tell the Court the features that will help you identify both the report and album?

Dr. Mcheleng’anga: I will begin with the post-mortem report, it is on a letter head, coat of arms and police…… for the photo album, has a post-mortem number…my signature too, which I signed.

Prosecution: My lord that suffices, may this witness look at the documents he has told Court about…

Dr. Mcheleng’anga identifies the documents.
Prosecution: And what would you want to do with the documents you have identified?

Dr. Mcheleng’anga: I would like to tender these as my evidence.

Court: The Defence

Makebi: No objection my lord.

Prosecution: And witness, you speak to the content of the photos you would like the Court to be aware of…

Dr Mcheleng’anga: My Lord on the second page, page two, of the photo album, shows the appearance of the male that I received at UTH. And on page three, shows the bone that has been broken, and my lord it shows at the point at the front of the head the exit where it entered at the same point. My lord the entry and exit point of the bullet was the same point.

Cross Examination by the Defence:

Changano: Dr Mcheleng’anga: Good afternoon?

Dr. Mcheleng’anga: Good afternoon my Lord?

Changano: The skull fracture, it is your testimony which we need to understand? Clarity to us, the question is where is the front bone? (Pointing at the forehead)

Dr. Mcheleng’anga: It is on the front bone, as opposed to the forehead.

Changano: You opened the skull and skin; you take it back as a doctor and a police officer watching you indicate that the entry point was here or there…explain where exactly you want us to understand the bullet entered from?

Dr. Mcheleng’anga: The picture shows exactly the point where the bullet entered from.

Changano: Which part was the entry point? How do we understand?

Dr. Mcheleng’anga: (He explains where the bullet entered while pointing above the forehead) Skull.

Makebi: How many types of autopsies are there?

Dr. Mcheleng’anga: One clinical postmortem examination and this is generally requested by either the relatives or the doctors treating the deceased. Then there is forensic, and the forensic postmortem examination is conducted at the behest of the police. And authority to conduct postmortem by the coroner. And the objective of the forensic postmortem is based on the inquest act to determine the cause of death and identify the person who has died and find out the circumstances the person died.

Makebi: Start with verbal autopsy.

Dr. Mcheleng’anga: Verbal autopsy is verbal through interview from informants and this is a tool that has been developed by public health or WHO, to pick out causes of deaths aggregated cause of deaths in persons who are brought in dead. And there is no medical certificate of the cause of death, so when they tick the boxes, they answer against the question and there are many questions asked, it can be automated or a physician can interpret the cause and come up with what we call a probable cause of death.
My lord, there is nothing, referred to as a complete autopsy, is that which answers pertinent medical problems, as an example, if …we don’t do that because we want to minimise investigation ….

Makebi: You no longer do complete autopsy?

Dr. Mcheleng’anga: It’s not that….

Makebi reads to the Court the article Dr. Mcheleng’anga wrote on causes of deaths on one of his research papers.

Makebi: Doc, do you remember writing that article?

Dr. Mcheleng’anga: Yes, a consortium of doctors did and I was part of that.

Makebi: So doc this is a very fair question, without the inquiry from Kaoma Hospital could you conclude that the person was dead at the time he was taken to Kaoma Hospital?

Dr. Mcheleng’anga: My lord it is…I can make reference from the postmortem findings.

Makebi: Doc it is a very very fair question, I asked you in what state was he in at the time he was taken to Kaoma Hospital? And your answer was no. If you didn’t inquire then you would not know whether he was dead or alive?

Dr. Mcheleng’anga: My lord this is why I am saying it is a very difficult question

Makebi: (Interrupts) You wouldn’t know, isn’t it?

Dr. Mcheleng’anga: Unfortunately, it is not a yes or no answer my lord.

Makebi: Would you know whether we are talking about verbal autopsy without asking the necessary questions?

Dr. Mcheleng’anga: So, as I said, I don’t.

Makebi: (Again) Doc you will have an opportunity to explain my colleagues you will take you through, for now you can answer the questions as I put them to you (pointing at the prosecution). Would you know without being informed?

Dr. Mcheleng’anga: I have answered….

Makebi: Very well I will move on, you have indicated that there were some sort of intervention and the medical intervention was on the part of the head, such medical intervention, only carried out if the person is satisfied that there could be a life in that body. Right?

Dr. Mcheleng’anga: Yes.

Makebi: Meaning that there could be a life in that body, yes or no? Meaning that he was alive?

Dr. Mcheleng’anga: (Wants to clarify but Makebi the defence lawyer insist that he answers, he will have an opportunity to clarify through the prosecution)

Makebi: The time they were suturing, the time they were trying to stop the blood means that he was still alive, right?

Dr: Mcheleng’anga: Yes.

Makebi: So, if you do not know you can’t then conclude that he was dead at the time he was taken. Right?

Dr. Mcheleng’anga: No.

Makebi: You can’t conclude that he was dead at the time he was at Kaoma Hospital.

Dr. Mcheleng’anga: I was not there…

Makebi: So, you can’t conclude not so?

Dr. Mcheleng’anga: No.

Makebi: I will take you to page 5 of the postmortem report, and the photo album. Doc if I said that the injury was caused by the force of some object and caused trauma, will you agree with me?

Dr: Mcheleng’anga: Yes my lord.

Makebi: You have answered it not so? And the reason you had concluded that it was a gunshot wound is because of the history you were given. Right?

Dr. Mcheleng’anga: No.

Makebi: Did you find the projectile?

Dr: Mcheleng’anga: No my lord.

Makebi: But what you know is that the frontal part of the head was impacted. Right?

Dr. Mcheleng’anga: What I know is that it was a gunshot wound and that would by the gunshot at the frontal of the head was caused by a projectile.

Makebi: Is it your submission that such a wound can only be cause by a projectile?

Dr. Mcheleng’anga: (fails to answer).

Makebi: It is your conclusion that a projectile can only be a bullet?

Dr. Mcheleng’anga: It depends in the context of this.

Makebi: A projectile cannot only be a bullet, right?

Dr. Mcheleng’nga: (Keeps quiet, thinking)…

Makebi: It can be a missile, it can be a stone, right?

Dr: Mcheleng’anga: no not a stone.

Makebi: A stone can be a projectile to, it could be.

Dr. Mcheleng’anga: No.

Makebi: It could be a spear…

Dr. Mcheleng’anga: A projectile is something that is propelled by a burel (force) duct…that is what I mean in this sense.

Makebi: In this sense we are not talking, because we are not restricted. A projectile can be any moving object towards a target. Right?

Dr: Mcheleng’anga: That is correct.

Makebi: As much the fact a person moving at a speed and hit into a stationary object the injury that may be caused maybe similar to the injury which is caused by the projectile. Right?

Dr. Mcheleng’anga: That is not true my lord. You are over simplifying….

Maklebi: no no no Doc doc allow me to over simplify if I have to. That man has been charged with murder and he may be hanged if we don’t get this correct. Even if I over simplify this and I am correct, you have to say it is correct. So it must be a moving object, there must be velocity somewhere either by the object or a person or both right?

Dr. Mcheleng’anga: My Lord ask the question.

Makebi: Doc I ask a question that if a large object is stationary and I run into that large object the injury caused because of my movement or velocity maybe be similar to that caused by a projectile to an object which may be stationary at that point, right?

Dr. Mcheleng’anga: The answer to that is no, we see people falling ….

Mabeki: You say no, Doc do you know these two phrases, the cause of death and the manner of death?

Dr: Mcheleng’anga: Yes, may Lord.

Makebi: What is cause of death:

Dr. Mcheleng’anga: The cause of death is any injury or disease that leads to caseation of life.

Makebi: Ok…and a manner of death?

Dr: Mcheleng’anga: is injuries of circumstances in which one dies and there are five manners of death and are man homicide, natural, accident, suicide and undetermined.

Makebi: That is manner of death? And what was manner of death in this case?

Dr. Mcheleng’anga: Manner of death is this case was suicide.

Makebi: And the cause of death:

Dr. Mcheleng’anga: The cause of death was natural.

Makebi: If I told you that the cause of death was hemorroges, can that be correct?

Dr. Mcheleng’anga: We don’t have cause of death called hemorroges, hemorrage is a macehnism…

Makebi: So, in this case what was the mechanism of death?

Dr. Mcheleng’anga: My lord is the mechanism in this particular case if the vital disruption of structures in the head.

Makebi: Doc, you told this Court that you took blood and stored it, do you have results from the blood samples you took?

Dr. Mcheleng’anga: I am not sure, because I have not seen the results.

Makebi: So, the blood sample would tell us if this person was intoxicated, right?

Dr. Mcheleng’anga: That is correct my lord.

Makebi: If we conclude that the person was intoxicated it could help us explain how the person died, right?

Dr: Mcheleng’anga: on mechanism…when you testing blood you are looking for a specific…(Makebi interrupts no no no doc, we will get to that. For now, answer that)

Makebi: I want to ascertain whether this person at the time of death consumed alcohol because it could have affected his behaviour at that time and we want to know. So behaviour as a result of intoxication can contribute to circumstance leading to death.

Dr: Mcheleng’anga: That is correct my lord.

Makebi: And prudence would require that in submitting such a report we are able to rule out that fact whether there was alcohol in the system or not, right?

Dr: Mcheleng’anga: There is no yes or no answer because they are… circumstances in the case…

Makebi: Doc, in this case the circumstances…it could have been good for you to bring us results to know whether the person was intoxicated or not, don’t you think so for our purposes right?

Dr: Mcheleng’anga: Police are the ones who take samples, I don’t have control.

Makebi: So they never brought you results from the blood text?

Dr: Mcheleng’anga: No my lord.

Makebi: If they brought you the result it could have been part of this report (you have brought before court right?)

Dr: Mcheleng’anga: My lord that could have been part of the report.

Makebi: So that is what is missing in this report, right?

Dr: Mcheleng’anga: Not really.

Makebi: Is it not missing? Is it there in this report?

Dr: Mcheleng’nga: no, the fact that it is not there doesn’t mean that it is missing.

Makebi: Doc, don’t rush to death, I am talking about the alcohol, so that we get to a conclusion. That is why we are talking about complete autopsy according to your article doc…how they arrive at a conclusion and in this case whether the results of alcohol are before this court or not, right? Are they results before this court?

Dr: Mcheleng’anga: No, my lord.

Makebi: How do you determine whether the person was poisoned or not?

Dr: Mcheleng’nga: ….(not answering)

Makebi: Let me cut the chase, did you subject the liver to an examination?

Dr: Mcheleng’anga: Yes.

Makebi: Did you include the results of those tests in your report? Did you examine the liver?

Dr: Mcheleng’anga: My lord if you say did you examine the liver, my understanding is different my lord…

Makebi: So you examined the liver by sight? By looking at it?

Dr: Mcheleng’anga: Yes my lord by looking at it:

Makebi: And according to you, you thought it was okay. Right? I have looked at the report.

Dr: Mcheleng’anga: It was unremarkable…

Makebi: And to ascertain the level of intoxication you should have subjected the liver to tests, right?

Dr: Mcheleng’anga: ….my analysis were that a person was not poisoned…

Mekebi: In this case did you test the liver?

Dr: Mcheleng’anga: I examined the liver.

Makebi: Doc, did you test the lever if at all he was poisoned?

Dr. Mcheleng’anga: No my lord.

Makebi: Did you test the liver to know whatever medication was put in his body?

Dr: Mcheleng’anga: No, my lord.

Makebi: Did you test his liver to see if whatever medication was given to him reacted at Kaoma Hospital?

Dr: Mcheleng’anga: No, my lord.

Makebi: You did not. And that is missing in this report, right?

Dr: Mcheleng’anga: It is not missing.

Makebi: Because you concluded that toxicology has nothing to do with a death, right?

Self-Styled “Social Media Disciplinary Committee”, Be Mindful Of Market Distortions You Might Create (The Case of Mobile Services Providers).

Unfailingly, I have been following sporadic pronouncements by the self-styled “Social Media Disciplinary Committee” on thematic issues on social media. Claims have been made, that they disciplined the former ruling political party PF and some celebrities for not keeping in line with the allegedly desired norms of the masses. I will be the first one to concede that the said is true to a significant extent.

As a politician, scholar and entrepreneur I understand the power of social media and what it’s capabilities. It’s a great tool for creating narratives or trends of interest in a target host community.

Given the above, my discourse anchors on the approach of the disciplinary committee towards bidding for improved quality of service delivery and pricing among mobile services providers. Admittedly, across all network providers, poor quality of service delivery and lack of value for money for the services has been the order of the day.

However, the approach in dealing with the matter has been my point of departure. Yes, it could have worked well for the political and entertainment arena, I believe in the business arena, much as we might get what we want using this approach, it might create some market distortions.

My argument is that this approach can potentially cause market distortions. Unlike the political arena, business craft has a way of doing things. There are business environment factors and market drivers that dictate how a business will position itself in a market, and how it will enter, penetrate, and grow market share. Regulatory bodies (legal environment) are on hand to protect the citizens’ interest, as it relates to the quality of service delivery, money for value, and unfair competition.

Yes, they could be a social pressure movement under the culture/social factor in the business environment. However, that’s where the pressure point is, there is a likelihood that social trend that is hostile to business might entrench themselves to the detriment of business advancements.

Before I propose an alternative route, allow me to depict some of the market distortions that might arise due to the approach that has been taken;

a) The current business environment, across industry sectors, customers demand, high-quality services and timely delivery, at a lower price . Companies that have succeeded to meet their customers’ demands have done so through, innovation, continuous improvement, and total quality management (TQM) among other things.

Therefore, if the quest succeeds, in the long term, companies might not prioritize being a customer-centric entity, thus reducing the budget line toward innovation, continuous improvement, and TQM. The order of the day would be a conspiracy between some members of the disciplinary committee, who are social media influencers, and companies with the bid to grow business market share. This is an unsustainable, unconventional way of doing business and must be checked.

b) If the quest succeeds, it might create an undesirable culture/social trends in the business environment. Today, it could be mobile services providers under fire; tomorrow it will be the finance and banking sector. Imagine, someone fails to pay off a loan, goes on social media platform, and screams, “ commercial bank interest must fall”. Doing so with know or lack of it, that bank interest rates are a product of Monetary Policy Rates, set by BOZ to contribute toward the attainment of specific macroeconomic objectives. Depending on the magnitude of the social media push; the power that be, if populist, will yield and the rest of the story is history. This has the potential to distort financial markets and a lost opportunity to attain set macroeconomic objectives. Possible trickle down effect would be reduced foreign direct investments (FDI) inflows.

The other distortion would be that, in long term, various business market bases would become runny and unstable. Because a social media call, targeted at a specific business sector market and specific business entities, would to a significant extent influence market share shift in favor of a company or companies of interest. This in the long-term would pose challenges for planning and forecasting for the businesses, thus incurring losses, reduced income and investments.

The above are, but just some of the market distortions that the proposed course of action might cause. The actions seem noble and harmless but without foresight, this could be disastrous for businesses and the economy in the long term.

Here is my simple advice to the “Social Media Disciplinary Committee”, get yourself structured as a social movement; you don’t have to be necessarily registered. Let your online interventions be clear, coordinated, and informed. In the case of social media interventions in the business environment, identify regulatory bodies, business sector associations, and business entities of interest, and engage them on the grievances of citizens as it relates to poor service delivery and lack of value for money in their pricing.

Besides, as a nation we know what you are capable of, but use your power in a structured manner and contribute to the development of your country.

As for business entities, which want to take advantage of the said social media interventions; take a step backward, rethink, innovate, invest in continuous improvement, and total quality management among other things. Provide improved quality service delivery and at relatively lower prices to the market and conventional wrestle the market share from your competitors. Avoid unfair competition, and take heed of the advice.

In the event that your business increase its market share base using this unfair competition, I am told a new kid is coming in the telecommunication sector; you might end up being the greatest loser, mark my words. When the new kid launch their mobile services products on the market, your market share base will be eroded in a month because you gained the through unconventional, and unsustainable means.

The Central Committee of the Patriotic Front (PF) met yesterday to deliberate on a number of issues of concern to the Party and the nation.

The official opening of the meeting was graced by six opposition party presidents who encouraged the Patriotic Front to be resolved as the main opposition political party in the country and save the nation from the current crises the country is battling with, ranging from the high cost of living, rising youth unemployment, chronic lack of liquidity in the economy, the total break down of the rule of law, wanton abuse of state institutions by the ruling party, the deep moral decay that has given rise to cases of homosexuality, sodomy and a general rise in crimes as evidenced by the rising cases of serious crimes such as murder and abductions.

The Central Committee made a number of resolutions which include but not limited to the following;

1. APPOINTMENTS

The Central Committee has ratified the appointments of the following individuals as Members of the Central Committee (MCC) of the Patriotic Front;

a) Madam Mpasa MWAYA, Kitwe Mayor
b) Madam Theresa KOLALA, Kasama Mayor
c) Mr Patrick CHISHALA, Kabwe Mayor

2. ADOPTIONS

The Electoral Commission of Zambia (ECZ) has prescribed Friday 4th November, 2022 as the date on which to hold by-elections for three (3) Council Chairperson and 18 Ward Councillor by-elections.

In view of the above, the Central Committee has adopted the following individuals to contest as Council Chairperson candidates on the Patriotic Front Party ticket;

a) MKUSHI
The Central Committee has adopted Mr. MABVUTO NYIRENDA as the PF candidate for the Mkushi Council Chairperson by-election.

Hon Geofrey Bwalya Mwamba (GBM) has been appointed campaign manager and he shall be deputised by Hon Godfridah Sumaili, Hon Sydney Mushanga, MP and Mr Billy Sichamba.

b) LUSANGAZI
The Central Committee has adopted Mr. PATRICK BANDA as the PF candidate for the Lusangazi Council Chairperson by-election.

Hon Richard Musukwa has been appointed campaign manager and shall be deputised by Hon Elias Daka (Eliboma), MP, Hon Masauso Tembo (Kazungula), MP and Hon Brenda Nyirenda, MP.

HONESTY, INTEGRITY AND GOOD FAITH: BASIC QUALITIES OF A GOOD POLICE SERVICE

1. Once a political party is voted into office and forms Government, it almost has unencumbered authority over the people. They’ll control the legislature through the Speaker, who decides how the business of the house must be conducted. They control the judiciary through the Chief Justice and sometimes the Minister of Justice, who is in the habit of leaning on individual judicial officers. And of course they control the Executive which includes law enforcement agencies. Therefore, it is critical that the conduct of a Government must be based on honesty, integrity and good faith. But does the UPND administration posses these qualities? Or more specifically; does the Zambia Police Service posses the qualities of honesty, integrity and good faith?

2. With regard to the Executive arm of the UPND administration, the recent case of the 13 kidnapped girls has revelled to common citizens what some of us knew a long time ago; that law enforcement agencies under the New Dawn lack integrity and honesty. First of all, it is a well documented fact that the girls were rescued when the kidnappers forgot to close the door and one of the girls seized the opportunity to jump over the fence and call for help from neighbors, who entered the kidnappers house and fred the girls, after which the police were called and they took about 50 minutes to get to the scene. We know this for a fact because we saw the videos which the rescuers took while in the kidnappers house and this version is further supported by one of the kidnappers who was interviewed after being arrested in Kaoma.

3. Initially the Zambia Police through the Inspector General of Police, Mr Lemmy Kajoba claimed that the rescue of the girls by neighbors coincided with the investigations which the police were doing, but yesterday Kajoba changed his position and claimed that it is only the Police who rescued the girls and that anyone else who claims to have rescued the girls risked being arrested!! Well, l have a few questions for Lemmy Kajoba; if it is the Police who rescued the girls and they were in control of the crime scene from the word go, then why did they allow the boys in the neighborhood to enter the crime scene and take videos which showed an empty coffin, among other things? What law enforcement agency in the whole world would allow such a contamination of the crime scene? Evidently, Lemmy Kajoba’s claim that the Police rescued the kidnapped girls and we’re in control of the crime scene from the word go lacks merit and is nothing but a desperate attempt by a shamelessly incompetent Inspector General of Police to get credit for a job that he failed to do for more than 6 months.

4. But something else was more worrying in Kajoba’s statement released yesterday. Kajoba says there are no other persons who came into contact with the kidnapped girls other than the two boys. This statement by Kajoba directly contradicts the version given by the girls as outlined in a News Diggers article a few days ago in which the girls said they were forced to drink tujilijili before being raped by as many as 8 men per night! If the girls themselves said they were raped by as many as 8 men per night, then why was Lemmy Kajoba quick to say that there were no other people involved other than the two boys that were arrested in Kaoma, even before police investigations are concluded? Who is Lemmy Kajoba trying to shield and why? Why is Lemmy Kajoba quick to issue threats of arrest to anyone who asks questions about this kidnapping? Why are the Zambia Police Service finding it difficult to be honest and transparent regarding this kidnapping case? Who are they protecting?

5. It is common knowledge across the world that kidnappers will commit their crime for the purpose of soliciting a ransom from the family of the victim, so there is always a commercial motive. But in this case, other than Pamela Chisumpa, the kidnappers are not on record to have reached out to the families of the other 12 girls to demand a ransom. However, they just kept their victims in bondage and fed them reasonably well as they did not appear malnourished. It is a common fact that those boys who were arrested in Kaoma are unemployed, so then the question is how and why did they feed a group of 13 adults for more than 6 months? Where did they get the money? If they were not caught, how much longer did they intend to keep the kidnapped girls? Indeed, these circumstances indicate the possibility of other people being involved in this kidnapping. And yet Lemmy Kajoba was very quick to announce that only the two boys were involved, and that if anyone asks questions they risk being arrested! I ask again; who is Lemmy Kajoba trying to protect?

6. The more troubling part of the situation at hand is that as Inspector General of the Zambia Police Service, Mr Lemmy Kajoba only has one boss; the President of the Republic of Zambia, His Excellency Mr. Hakainde Hichilema. Therefore, if Lemmy Kajoba is trying to do a police cover up regarding this case of the 13 kidnapped girls, he can only do it either with the permission of or under the instructions of the President of the Republic of Zambia. Speaking of the President, why hasn’t His Excellency not issued any statement to express his joy over the recovery of the 13 kidnapped girls? Why the loud silence from State House? Or if the President has been very busy, why couldn’t he instruct his Spokesperson Mr. Anthony Bwalya to issue a statement to express the President’s joy at the safe recovery of the 13 kidnapped girls? Or is it that the President is unhappy that the 13 kidnapped girls were rescued? If the President is unhappy, then why is he unhappy?

Ministry Of Community Development Takes Over Care For 13 Girls Who Survived Abduction

Ministry of community development takes in 13 rescued girls

The Ministry of Community Development and Social Services have taken over the welfare of the survivors of abduction following the completion of their medical examinations.

The 13 young ladies who were rescued from the abductors last week had been undergoing medical check ups in Lusaka to ascertain their health statuses and establish the extent of their sexual exploitation and abuse.

The victims aged between 17 and 28 are currently in the custody of the Department of Social Welfare who have provided a place of safety as mandated in the provisions of the Anti-Gender Based Violence Act No.1 of 2011 and Anti-Human Trafficking Act No. 11 of 2008.

Minister of Community Development and Social Services, Doreen Mwamba has disclosed through a statement that the traumatic experience of the abductions has huge psychological effects on the mental health of the survivors, hence the need to subject the young ladies to a trauma and psychosocial therapy in a place of safety as part of the healing process.

“The Case Management processes which will be carried out by the social workers from the ministry alongside other professional psychologists from Chainama Hospital, will focus on psychological wellness and general welfare on case-by-case basis” Mwamba has said.

She has further said that the families of the survivors have since been informed of the planned interventions, and Government has requested for more time with the survivors before they are eventually reintegrated into their families.

She also disclosed that the families that travelled from other towns outside Lusaka to see their daughters will be provided with support by the ministry through the Lusaka District Social Welfare Office until the survivors are discharged from the Place of Safety.

“The families will also undergo counselling to ensure that they are in good state of mind to provide care and support to their daughters.The planned interventions require concerted efforts with various stakeholders and the Ministry is working closely with Gender Division as well as Non-Governmental Organisations to ensure that all supplies are provided to the survivors in order to safeguard their stay in the Place of Safety” Mwamba has emphasized.

She has assured that the ministry will keep the general public informed of the next steps of rehabilitation as the girls journey on the road to recovery.

Mwamba has also appealed to the media and the general public to desist from any publication of the identity or personal information of the survivors to avoid further victimization and traumatization of the young ladies.

CORPORATE GOVERNANCE- A VEXING PROBLEM IN NEW DAWN

In past four weeks, two Chairpersons of public sector boards separately told me they planned to step down. They had serious concerns about the invisible hand that interfered in their work. They feared their continued stay as directors of the respective institutions compromised their ability to professionally provide oversight. They accepted to be part of the respective boards believing that the new government was serious about professionalizing governance systems in the public sector.

I advised strongly against stepping down. The new Government was still in a transitional stage with a lot of things still falling in their rightful place. If the motivation to resign was purely on ethical grounds, I encouraged them to resign. However, if the reason for resigning was purely because of bad governance practices and procedures, it was easy to fix concerns with time.

As British politician Baroness Lynda Chalker once said, ‘‘Corporate Governance does not exist in a vacuum. It is profoundly influenced by the political and economic environment of each country.’ It is, therefore, expected there will be teething problems for the new government as it seeks to stabilize the governance systems in the public sector.

To its credit, the new government has, to some extent, done its best to bring on board quite well qualified individuals to oversee the performance of the public sector as independent directors. This is in line with the party manifesto that states in part on corporate governance, “In light of rising cases of abuse of office in both the private and public sectors, a key focus of our effort will be legislation aimed at improving the corporate governance environment in the country. This will include strengthening qualifications for directors and board appointments, insolvency laws (qualification and appointment of practitioners) to guard against recent cases of blatant abuse of the process by political players.’

In the past year, there has been a significant roll out of training programmes on corporate governance for newly installed directors in the public sector. As a corporate governance practitioner myself, I felt hugely motivated offering mentorship to these men and women on the belief the political environment was well set to support good governance practices in the public sector.

Unfortunately, I am beginning to be anxious about the level of seriousness that the New Dawn Government attaches to corporate governance. I am equally concerned some of those we have trained and capacitated as directors are still confused about their roles and responsibilities on the respective boards. Three issues are of concern:

INEXPERIENCED DIRECTORS

Not everyone appointed to these boards has basic appreciable competence and stamina to execute functions of director at board level. Parastatals, statutory bodies and other government agencies anchor the success of the country. Most of these institutions define the success of the private sector. A well governed Energy Regulation Board, Zambia Environmental Management Agency, National Roads Fund Agency or any other institution reflects in how the private sector efficiently does its own business.

You cannot, therefore, afford to appoint individuals without any track record of leadership and management at a reasonably high level to these boards. Ministers should look beyond friends in appointing directors. It is accepted any government that comes to power would have had individuals that may need to be compensated for their contribution. That compensation can be in any other areas but not on boards.

There is need to search deeply in the market to find individuals who are better qualified to perform the function of director. The moment you have individuals without an iota of leadership acumen in the public sector, problems emerge, and they need to be addressed.

POLITICAL INTERFERENCE

There are indications the invisible hand is still alive in the governance of public bodies. The debate along governance technocrats lately has been whether the government in power shouild completely maintain a hands-off approach on the performance of public entities soon after appointing the board of directors. The position by some of my colleagues is that ‘government input’ is necessary. I have no problems with that if input is given under acceptable governance procedures and processes.

Procedurally, government input is given to the organization through the board of directors and this happens in two ways. First, government usually has representation on these boards. The reason is to facilitate for government (shareholder) input. Second, the annual general meetings exist for this government input.

My concern is that some government officials are ignoring this, giving instructions directly to management. In one case, the Chief Executive Officer carried out a serious activity without board approval. When approached by the Board, he replied the directive was given by the minister. This should never be allowed in the New Board. It frustrates Board members.

MICROMANAGEMENT

It is not only the Ministers or other government authorities causing tension in governance systems of public entities. I have also come to realize some directors do not know their boundaries.

It is a pity some Board chairpersons have turned themselves into operatives, executors of their own directives, demanding more in terms of personal compensation from the institutions than they are expected to. This is the reason public sector boards are beset with challenges despite induction programmes facilitated for them.

Anything that borders on micromanagement is a serious compromise to acceptable corporate governance standards. We can surely do better than this under the New Dawn Government. Apparently, Dr. Situmbeko Musokotwane, the Finance and National Planning Minister, plans to address dysfunctional governance systems in State Owned Enterprises as per the 2023 National Budget.

Ndola student nurse died in a lodge in Kitwe

NDOLA STUDENT NURSE/PROPHETESS DIED IN A LODGE

POLICE on the Copperbelt says Eunice Namuchimba, a Ndola Central Hospital student nurse was found dead in the room of a lodge where she spent a night with her Tanzanian boyfriend.

According to reports, the 29-year old was murdered at Sato Guest House in Kitwe’s Second Class Trading Area.

Copperbelt police commissioner Sharon Zulu says the body of the deceased Eunice Namuchimba was found tied with a black rubber belt from a used tire around the neck but had no physical injuries.

Ms. Zulu in a statement to ZNBC News in Kitwe disclosed that the naked lifeless body of Eunice was found lying on the floor facing up with a yellow chitenge material covering her.

She said the deceased Eunice arrived at the lodge in the company of a male companion suspected to be Tanzanian national identified as Omaria Daniell Saidi who booked the room yesterday afternoon.

She added that the two had lunch and later proceeded to room 9 with the man who was dressed in a Muslim attire Jalabia covering his face.

Ms Zulu however said when a cleaner went to clean the room this morning, there was no response and when she peeped through the window, she saw the body of a female lying on the floor.

The police commissioner further said police where called and after searching the room they found a black bag with different types of documents including a passport, NRC, and voters card bearing the names Eunice Namuchimba.

Ms Zulu said the deceased has been identified by the uncle and the body deposited at Kitwe teaching hospital mortuary while the Tanzania companion is missing.

AS A FOLLOW UP TO OUR EARLIER STATEMENT ISSUED ON 3RD OCTOBER, 2022 CONCERNING THE RESCUE OF THE THIRTEEN LADIES WHO WERE HELD HOSTAGE IN CHALALA AREA, WE NOW WISH TO GIVE AN ACCOUNT THAT LED TO THEIR RELEASE.


PRELIMINARY INVESTIGATIONS INDICATE THAT BETWEEN 17TH MARCH AND 18TH JUNE, 2022, FOUR FEMALE MOBILE MONEY AGENTS WERE ABDUCTED NAMELY; FAITH MULUTI AGED 28, PAMELA CHISUPA AGED 21, PAXINA CHANDA AGED 22, AND MACWANI NALUKUI AGED 21. AND BETWEEN 15TH AUGUST AND 20TH SEPTEMBER, 2022, NINE NURSING STUDENTS FROM A NAMED UNIVERSITY IN CHILANGA DISTRICT WERE ABDUCTED FROM THEIR BOARDING HOUSES.


MEMBERS OF THE PUBLIC MAY WISH TO NOTE THAT NOT ALL THESE CASES WERE REPORTED TO THE POLICE AS PARENTS THOUGHT THEIR CHILDREN WERE IN SCHOOL WHILE THE SCHOOL AUTHORITIES ASSUMED THAT THE STUDENTS HAD GONE HOME.

AS INVESTIGATIONS INTENSIFIED, INTELLIGENCE GATHERED LED TO THE APPREHENSION OF A NAMED TAXI DRIVER ON SUNDAY 2ND OCTOBER, 2022 AROUND 22:50 HOURS, WHO WAS ONCE USED BY THE ABDUCTORS TO DELIVER A LAPTOP BELONGING TO ONE OF THE ABDUCTED LADIES AS COLLATERAL FOR A SOFT LOAN FROM A MONEY LENDER IN MATERO’S SHADRECK COMPOUND.


THE TAXI DRIVER WAS LATER PICKED BY POLICE AT FAMILY 24 ALONG LUMUMBA ROAD TO HELP WITH INVESTIGATIONS.
UPON BEING INTERVIEWED, THE TAXI DRIVER REVEALED WHERE HE HAD PICKED THE LAPTOP WHICH TURNED OUT TO BE CHALALA CHOPPIES MALL AREA WHERE OFFICERS HAD BEEN CONDUCTING SURVEILLANCE FOR SOMETIME. THIS INFORMATION PROMPTED OFFICERS TO INTENSIFY PATROLS AROUND CHALALA’S CHOPPIES MALL INCLUDING GREG LUNGU AND AUGUSTINE LUNGU ROADS.
ON MONDAY, 3RD OCTOBER, 2022, THE SOCIAL MEDIA PROFILE FOR ONE OF THE SUSPECT WAS IDENTIFIED THROUGH WHICH A LADY WHO WAS FREQUENTLY COMMUNICATING WITH THE SUSPECT ON FACEBOOK WAS ALSO IDENTIFIED. IN THEIR COMMUNICATION, THE SUSPECT HAD TRIED TO LURE THE LADY TO VISIT HIM AND HE SHARED HIS LOCATION USING ONE OF THE ABDUCTED LADY’S PHONE WHO AT THE TIME WAS NOT REPORTED TO HAVE BEEN ABDUCTED.


ARMED WITH THIS INFORMATION, OFFICERS IN THE COMPANY OF THE LADY AND THE BROTHER WENT TO THE SAME LOCATION. UPON REACHING THE VICINITY, SHE WENT TO THE GATE WHERE SHE MET THE SUSPECT WHO WAS WITHOUT A SHIRT AND ENGAGED INTO A CONVERSATION WHILST POLICE OFFICERS WERE MONITORING FROM A DISTANCE.


UPON REALISING THAT SHE WAS ACCOMPANIED BY A MALE PERSON, HE ANGRILY SHOUTED AT HER SAYING HE HAD INSTRUCTED HER TO COME ALONE. HE THEN SENSED DANDER, QUICKLY CLOSED THE GATE AND RAN BACK TO THE HOUSE WHERE HE PICKED A SHIRT AND HURRIEDLY SECURED THE HOUSE WHERE THE ABDUCTED LADIES WERE HELD BEFORE JUMPING THE WALL-FENCE INTO THE NEXT YARD AND POLICE PURSUED HIM.


UPON NOTICING THE PANIC OF THE ABDUCTOR, ONE OF THE LADIES, DORCAS CHUNGWE CEASED THE OPPORTUNITY TO BREAK AND OPEN THE DOOR. WHEN THE DOOR WAS OPEN, DORCAS CAME OUT FIRST AND JUMPED THE FENCE AND THE REST OF THE LADIES CAME OUT EXCEPT THE OTHER THREE WHO COULD NOT MANAGE TO WALK.


ON THE ROADSIDE, DORCAS MET A GOOD SAMARITAN, MR. ELLAM SINKALA OF SHANTUMBU WHO WAS DRIVING ALONG GIVEN LUBINDA ROAD WHO TOOK HER TO GODFREY MIYANDA POLICE POST WHERE SHE REPORTED THAT SHE WAS AMONG THE LADIES THAT WERE HELD HOSTAGE. POLICE IN THE COMPANY OF THE VICTIM AND MR, SINKALA DROVE BACK TO THE SCENE WHERE THEY FOUND THE OTHER LADIES AND PEOPLE HAD GATHERED.


BY THIS TIME, THE OTHER TEAM OF DETECTIVES (PLAIN CLOTHED POLICE OFFICERS) WHO HAD CHASED THE SUSPECTED ABDUCTOR RETURNED TO THE HOUSE FOR INQUIRIES. UPON REACHING THE HOUSE, OFFICERS FOUND THREE BOYS WITH TWO WOMEN WHO WERE HELPING THE REMAINING VICTIMS WHO WERE UNABLE TO WALK ON THEIR OWN. THE ACTIONS OF THE HELPERS CAME AS A RESULT OF THE COMMOTION AND DISTRESS CALLS FROM THE ABDUCTED LADIES.


LATER ON, IT WAS DISCOVERED THAT THE MAN WHO HAD RUN AWAY WAS ONE OF THE SUSPECTS, MATHEWS SIKAONGA, APPREHENDED IN NKEYEMA TOGETHER WITH HIS FELLOW ACCOMPLICE, JAMES BWALYA MULENGA, IN CONNECTION WITH THE ABDUCTION.
WE ARE APPEALING TO THE PUBLIC TO CONTINUE COOPERATING WITH US AS WE STILL HAVE A MAMMOTH TASK OF ARRAIGNING THESE SUSPECTS BEFORE THE COURTS OF LAW.


WE HAVE FURTHER NOTED WITH CONCERN THE CONTINUED SPECULATIONS AND FALSEHOODS BEING PEDDLED ON SOCIAL MEDIA WHICH HAS THE POTENTIAL TO JEOPARDISE THE ON-GOING INVESTIGATIONS.


WE FURTHER WISH TO WARN PERSONS OR ANYONE MAKING FALSE CLAIMS TO HAVE PLAYED A ROLE IN RESCUING THE VICTIMS AND ARE SOLICITING FOR MONEY OR FAVOURS TO STOP FORTHWITH AS THIS AMOUNTS TO AN OFFENCE THAT IS PROSECUTABLE UNDER OUR LAWS.


SO FAR, PRELIMINARY INVESTIGATIONS INDICATE THAT THERE WERE NO OTHER PEOPLE WHO INTERACTED WITH THE LADIES WHILST IN CAPTIVITY OTHER THAN THE TWO KEY SUSPECTS, MATHEWS SIKAONGA AND JAMES BWALYA MULENGA.

PERSONALITY PROFILE OF THE WEEK

SENIOR COUNSEL MAKEBI ZULU.

Former Malambo MP
Former Minister Eastern Province.

The path to success for Makebi Zulu was not a rosy one . It was one which involved determination, dedication, sacrifice hard work and resilience.

He was born on the 25th of December 1981.

Raised in a Christian home with a Pastor for a father, he grew up with deep rooted values of humility, integrity and hard work.

He did his Primary School Education at Lusaka Boys from 1989 to 1995, then proceeded to Munali High School for his Secondary School Education.

Coming from a humble background in Lusakas Kaunda Square compound, Makebi Zulu sold freeters and Ice blocks among other things to raise money to pay for his school fees.

Those that went to school with him at Munali Secondary School testify that they never would have guessed that the ever smiling, ever smart and bubbly young man doubled as a trader to enable him pay for his education.

In 2001, Makebi Zulu made it to the University of Zambia were he would study for and graduate with a degree in Law four years later.

In Jan – Feb of 2004, Makebi Zulu interned at the Legal resources Foundation in Livingstone.

Upon Completion of his Bachelor’s Degree In Law at the University of Zambia, he then worked at the Ministry of Justice from April 2006 to December 2007.

In 2007, he graduated from the Prestigious Zambia institute of Legal Education ZIALE .

He then worked for the Legal Aid board as Legal Aid Counsel from Jan 2008 to December 2009.

His duties included rendering Legal advise to Clients, drafting legal documents , representing clients in litigation in the Magistrate Court, High Court as well as the Industrial Relations Court and any other tribunal or dispute resolution committee.

In January 2010, Hon Zulu joined Ferd Jere and Company Advocates as an Advocate. His duties and responsibilities included, litigation , Corporate Advisory, Acquisition and Mergers , Banking and Finance Law Advisory.

In 2013 Hon. Makebi Zulu Opened his private law Practice , Makebi Zulu Advocates.

At this point, the Son of a Pastor who had once nurtured ambitions of being a Pastor himself when growing up, descided to look for a platform that would enable him to serve humanity. He descided to Join politics and vyed for the Malambo parliamentary sit in the eastern Province during the August 2016 General elections were he emerged victorious as Malambo Contuency Law Maker.

The then Republican President of Zambia . Edgar Chagwa Lungu would then appoint him to the position of Provincial Minister for Eastern Province.

Hon. Makebi Zulu would then dedicate 5 years to serving the people of Malambo .

In 2021 , he went back to his Law Practice after not retaining the Malambo seat .

Mr Zulu is Married with Children .

He is fluent in French and during his free time which isn’t often, he loves reading, watching soccer, playing golf and swimming.

They say destiny is for those that are bold enough to achieve it. Hon. Makebi Zulu is living proof of that adage

A young man who has beaten tough odds to be were he is today. Indeed he is a role model. One worth emulating.

FDD leader Edith Nawakwi says President Hakainde Hichilema is practicing nothing but ‘Kadansa economics’.
Nawakwi told The Mast that she had hoped that being young and fresh, President Hichilema would exhibit a proper master plan to get majority citizens out of poverty.


“The economics of Hakainde are upside down. We are just ploughing to start planting, he loads the fuel with another one to K3 on top. People are harvesting wheat, he is moving fuel prices like he is playing chase. A business person has a lifespan of 12 months to plan. You cannot go to the bank every after two days to ask for an overdraft. Look, the whole thing is Kadansa economics. Yaja yoyimilila mu street ushawuta (the kind where you are in the streets shouting)’ . There is nothing. If anyone touches energy, that person is anti-development because energy is to our economy what blood is to our bodies,” Nawakwi, who served as energy and finance minister in the Frederick Chiluba administration, said.


She said it was even worrying what economic situation tourists who were being attracted by waiving visa fees would find.
“You attract a tourist from Benjing, are they going to find food? Is there a waiver on cars for Zambians to ensure there is transport for our tourists? You have given incentives on Safari vehicles, how many people are in Safaris? Chiefs are saying we want concessions, he has taken them away from them. Can I get a hunting concession myself?” Nawakwi asked. “In Zambia there are no businesspeople. There are just hustlers and survivors. Insurance in this country is a nightmare and a scandal of the centuary. Try to bash your vehicle and try to claim insurance, you have to suffer and you want to attract someone from Beijing? When are we going to change the structure of Kalikiliki? What is the plan for kwa Goerge?”
She said the UPND government was entrenched in the colonial mentality which perceived Africans as labourers as opposed to owners of the means of production.


“There is nothing on how we can get a graduate of Mpika College of Agriculture or Monze or Mwekera or ZIAH to be an entrepreneur. This rhythm of ‘job, job’…tied to that is the new Kampompo (bread for miners) in the name Social Cash Transfer. When you get your K500 Social Cash Transfer, you are supposed to buy mealie meal, cabbage and cooking oil. You cannot even buy toilet paper. You cannot even save from it to build yourself a ventilated pit latrine. You are trapped. I don’t even know whether those on this programme qualify for the Farmer Input Support Programme because you are already receiving,” Nawakwi noted. “There is no plan to move people from poverty to wealth creators. I have no problem with us looking after the elderly. The state must look after them but I have great difficulty in putting an able-bodied adult on a hand-out. I would rather teach them how to fish. Most of the young people you see getting social transfer we can turn them in an army of entrepreneur by a stroke of a pen. And Hakainde’s kampompo is social cash transfer. I was thinking that now we have a young person with fresh brains, he will give us creative ways of how to create wealth but he is following the same way of colonising the mind of an African and making poverty the opium of the masses and it is dangerous.”


Nawakwi urged President Hichilema to borrow from Brazil’s Inacio Lula da Silva’s plans for development.
“I invite Hakainde to be a student of Lula who put a deliberate plan that every year, half a million Brazilians should move from poverty to middle income and he achieved that. He put a description that I want each Brazilian to have house, running water. He was getting them out of the sharks. Now here we simply need to say every year, we will get 300 young people from standing on the streets to being entrepreneurs and define how we should do it ,” She said. “They (government) are saying they investing in farming blocks. When you go back to KK we had farm blocks. Where have we gone? What have we achieved? The Mkushi Farm block, the Mukonchi Farm Block, we have had them. They were even better structured. We have the Mulli Coffee Scheme in Nakonde where you have people in one block. They are growing coffee. We have Mbesuma Ranch now. The whole point is you can’t do things a million times and it does not work.”
She said the US $300 million loan government wants to borrow and invest in farm blocks could get half a million Zambians into productive employment.


“…not just in farming but all spheres of our economy. How much are our labourers getting from these so-called investors whether they are Vedanta or what? We have been swindled for far too long. Look at Vedanta. Look at Glencore. How much money are they making and how much are they leaving on the Copperbelt? How do you want to follow the same useless model?” Nawakwi asked.


“This is purely an expansionary, consumption budget. We should have gone full out to push productive sectors. There are projects we can push to the extent that we will not need the useless IMF on our doorstep. There are crops like coffee, macadamia, cashew nuts, beans, honey. Rwanda a country that had come from war is selling macadamia on Alibaba.”


On CDF, Nawakwi said the government was clueless on how to actualise returns on it and that it would end up being a scandal.
“In fact this is going to be the scandal of the century because already the Minister of Local Government [Gary Nkombo] has gone to different constituencies to tell them ‘five per cent is your administrative cost. Come to Lusaka for a conference, take money from your administrative cost and send to Lusaka so that we can book your hotels’. The same minister says ‘we are going to buy you Land Cruisers. We have centralised the procurement’. You mean Nakonde cannot buy their own vehicle? Maybe they want Tuku Tukus,” said Nawakwi. “The mentality of ‘we must eat something’ is still prevalent. They can call their friends corrupt but this smacks of corruption and theft. The reason for corruption in this country is over centralisation. You don’t bloody tell me you are running from corruption, when you are leaking it.”

SUSPENDED Director of Public Prosecution Lillian Siyunyi has named Ackson Sejani, Senior Chief Mukuni’s wife Veronica Munakasale Mukuni, Speaker of the National Assembly Nelly Mutti as some of the prominent Zambians for whom she had entered nolle prosequi.

Ms Siyunyi has rubbished assertions that she is aligned to the Patriotic Front (PF) declaring that she has never been a member of the former ruling party nor belonged to any political party in her entire professional career.

She complained that it was malicious that she was being aligned to the PF, a political party she has never associated herself with as she was but a professional civil servant throughout her career as a prosecutor.

Ms Siyunyi has challenged those accusing her of having worked with the PF to have the courage to disclose the number of nolle prosequis she had given to the former ruling party and the governing UPND so that Zambians compare who had the most of the nolles.

Reacting to leaked documents in which she is said to have proffered immunity to Mr Amos Chanda, the former State House press aide, Ms Siyunyi said there were many prominent citizens who had been offered immunity from prosecution after they were arraigned before the courts.

Ms Siyunyi who has been suspended by President Hakainde Hichilema and is now appearing before the Judicial Complaints Commission (JCC) over an array of accusations from the governing UPND, opposition MMD and other interest groups denied ever having been bought a motor vehicle by Mr Ronald Chitotela.

“I have never been a member of PF. I should not be aligned to any political party, not even PF. The PF found me. I was deputy to Chalwe Muchenga. The UPND found me and I have never belonged to any political party in my entire professional career. I want to challenge those that are accusing me of being PF disclose the number of nolles given to the PF and those that were given to the UPND and we will see who had the most of it. Mr Ackson Sejani, the wife to senior chief Mukuni was given a nolle. They are talking about Amos Chanda who was PF and want to align me with the former ruling party, that is malicious,” Ms Siyunyi said.

Ms Siyunyi said it was shocking that she was being aligned to the PF when the UPND while in opposition used to praise and glorify her that she was a professional DPP.

She said it was a concoction of lies that that Mr Chitotela, the PF Pambashe Member of Parliament purchased a motor for as an inducement for her to enter a nolle prosequi for him.

She also named President Hakainde Hichilema as one of the citizens who were sitting on a nolle prosequi because she had never been selective in the performance of her duties.

Ms Siyunyi said other senior UPND members like Mr Ackson Sejani and even Senior Chief Mukuni’s wife were other notable individuals that were handed nolle prosequi.

Ms Siyunyi stated that very few PF members had ever received favourable judgements by virtue of being familiar with her and that it was disheartening that the governing party was maliciously aligning her to a political party.

Ms Siyunyi said those accusing her should have the courage and decency of exhibiting proof that she executed immunity for Mr Chanda as it was with former Konkola Copper Mines (KCM) Liquidator Milingo Lungu.- Daily Nation

A CHAT WITH MADAM EDITH NAWAKWI ON LOCAL ENTERPRISES AND POVERTY REDUCTION

After reading the submission made by madam Edith Nawakwi on- dismantling of domestic arrears, supporting local enterprises and poverty reduction- my response is as follows:

1. DISMANTLING DOMESTIC ARREARS
The past 10 years domestic arrears have been building reaching K48.1 billion at the end of 2021. If we include outstanding ZESCO bills and fuel arrears, the figure was K79.9 billion. What this means is that we were accruing more arrears than we were dismantling. What is the current situation? In just 6 months of 2022, the stock of domestic arrears has started going down. Domestic arrears excluding ZESCO bills and fuel have reduced from K48.1 billion at the end of 2021 to K44 billion by June 2022.

Domestic arrears including ZESCO bills and fuel have also gone down from K79.9 billion at the end of 2021 to K76.4 billion at the end of June 2022. This is a good indicator because we have halted the increase and now working on bringing it down. It should also be noted that the allocation to dismantling of domestic arrears has increased from K2.8 billion in 2021 to K6.8 billion in 2023.

2. SUPPORTING LOCAL ENTERPRISES
I will highlight six initiatives government is implementing to support local enterprises:

Initiative One: Government has put the private sector at the centre of its economic rebuilding agenda. This requires that the private sector as a key partner is involved in the formulation and review of policies aimed at improvement the business and economic environment. The public private dialogue forum will help achieve this.

Initiative Two: Local entrepreneurs are at different stages . At the very basic level, small businesses and entrepreneurs at constituency level will be empowered through increased Constituency Development Fund (CDF) allocation which in essence is meant to stimulate economic activities at local level. People might be facing challenges in accessing CDF but this does not take away from the merits of the initiative.

In CDF there is a component of community projects which will be done by local SMEs, this will help them grow so that they can compete for bigger projects. There is also a component of economic empowerment for community groups. All these are meant to uplift entreprises at grassroot level.

Initiative Three: Entrepreneurs whose business ventures are bigger than what is being offered under CDF can access funds under the Citizens Economic Empowerment Commission where K397 million has been allocated in 2023 in addition to the K350 million allocated in 2022. This comes with training, business mentorship and market linkages across 7 entreprises being promoted. An additional K50 million has being allocated to support small scale mining.

Initiative Four: The fourth initiative is for those entrepreneurs that have outgrown empowerment funds and can deal directly with commercial banks. Government has cut down on domestic borrowing by K8.9 billion, a move which will trigger a reduction in interest rates and allow the private sector to borrow and invest. The World Bank and USAID are supporting government through trade facilitation projects aimed at promoting exports. Government has further stepped up economic diplomacy targeting joint ventures between local and foreign firms.

Initiative Five: Government spending has actually gone up. While the total budget has gone down from K173 billion in 2022 to K167.3 billion in 2023, this is largely due to a K33.1 billion reduction in external debt service. Spending on economic affairs, education, health, social protection, housing and community amenities, recreation, culture and religion- increased both in absolute terms and as a percentage of the total budget. There is also an increase in domestic debt service and dismantling of domestic arreas. This spending is good for the economy, it helps put money into the economy to support economic activities.

Initiative Six: A stable macroeconomic environment is key to the success of local entreprises. Inflation is way lower than it was in 2021 and kwacha has not only appreciated but stabilised around K15 to K16 per dollar. The price of fuel is high but there is no government that can address all problems at once. From January to August 2022, government lost about K11 billion from zero rating of VAT and suspension of excise and customs duty on fuel.

3. POVERTY REDUCTION
With regards to poverty reduction, about 70% of Zambians are employed in the agriculture sector and it is the source of income for most of the people in rural areas. Therefore any poverty reduction strategy should be designed such that it addresses constraints being faced in the agriculture sector. It should address low productivity and profitability.

Over the years we have focused so much on inputs neglecting agriculture extension which should essentially help farmers plan, implement and market their produce better. To this effect government has increased the agriculture budget to K11.2 billion, with the FISP budget increasing to K9.1 billion in 2023 from K5.3 billion in 2022.

To improve agriculture extension, in 2023 government has allocated K790 million. This will help in recruiting extension officers and supporting them with kits, tablets and transport and rehabilitating facilities.Government has also accessed USD300 million from World Bank to support farm block development and irrigation. This, coupled with increased CDF and social protection budgets will help bring down poverty levels.

No country can achieve everything in a single year, we are definitely making the right investments.

PF have a hidden agenda to discredit and distract President HH and his New Dawn Govt

Copperbelt-based UPND member and business executive Mellbin Simangolwa has advised President Hakainde Hichilema not to allow the Patriotic Front (PF) to stand in his vision of making Zambia a more prosperous nation.

Mr. Simangolwa said the PF have a hidden agenda to discredit and distract President Hichilema and his New Dawn Government from it’s vision.

He said President Hichilema must remain focused on national development because the PF is dead regardless of it’s propaganda against the UPND regime.

Mr. Simangolwa said under the leadership of President Hichilema, Zambia has seen positive development such as the appreciation of the kwacha, good leadership and job creation.

“Just like the devil after defeat, PF is moving like roaring lion in it’s deception and propaganda. President Hakainde Hichilema must remain focused on national development because love it or hate PF dead.From the time United Party for National Development (UPND) formed government under the leadership of President Hakainde Hichilema, we have seen positive development in our country. Our currency, the kwacha has become world’s best performing currency and moved from 10th to 4th strongest currency in Africa. This is not magic but evidence of good leadership.After years of financial mismanagement and over borrowing by the previous regime, President Hakainde Hichilema and his team have managed to restructure the debt and this has allowed more money to go towards social spending. As result of this, we have seen the introduction of free education, massive employments, payment of redundant TAZARA and Indeni workers, Payment of retirees, increased beneficiaries of social cash transfer and reintroduction of students meal allowances among many other things,”Mr. Simangolwa said.

He said many Zambians are appreciating the efforts of President Hichilema and his New Dawn government.

“Reintroduction of meal allowances for our students in public institutions mean parents and guardians can now save a lot money and at the same time we are saving our female students from being exploited in exchange for food. This is what a good leader does not buying a private jet when there’s no money for education.These positive achievements are being appreciated by majority of our citizens and the defeated enemy is not happy. These achievements in just year has exposed that the 10years of Patriotic Front (PF) reign was wasted time for the country. Instead of apologizing and appreciating President Hakainde Hichilema and the UPND, the PF has embarked on well calculated propaganda aimed at discrediting the good works of government. A scheme which will end in shame,” he said.

Mr. Simangolwa charged people should not expect anything good to come from the Patriotic Front just like nothing came out of their 10 year rule.

“Shamelessly, PF is spreading a list of people who have been summoned by the Anti-Corruption Commission. This is the same people that arrested Hakainde Hichilema more than 17 times before we can add other people like Obvious Mwaliteta who spent long time in prison not this summoning where people are released on bond before the interrogations even starts. The PF has also failed to mention that as much as many people have been summoned, we have not lost any life like the case of Nsama and Joseph Kaunda.In any case we don’t expect anything good to come from the Patriotic Front just like nothing came out of the their 10 years in power. This is the reason why we are advising our President Hakainde Hichilema to concentrate on delivering development and ignore distractions from a dead snake,” he said.

Mr. Simangolwa stated Zambians should continue supporting President Hichilema saying better days are coming.

“The people of Zambia and the global community is appreciating the good leadership of President Hichilema. The bitterness, Jealous and the pain of losing power is evident even in the forming foundations that they never thought when they had power.Let all we meaning Zambians let us continue supporting President Hakainde Hichilema. We have better days ahead. God bless you all,”Mr. Simangolwa added.

But Leadership Movement(LM) President Richard Silumbe says it is sad that the UPND administration has continued to pursue what he termed as colonial policies.

Dr Silumbe refused to recognise the UPND administration as a capitalist Government because it has continued to follow colonial policies.

“This is why as Leadership Movement, we are saying that the ‘New Dawn’ Administration has continued to pursue policies of colonialism and not policies of capitalism. They call themselves capitalist but we do not believe that they are capitalists. They are colonised…they are behaving like a colonised Government,” he said.

Dr Silumbe said a capitalist Government ensures that it engages in production to raise funds for the people.

” What we are seeing in the ‘New Dawn’ Government, whilst we have all these natural resources, they are going for loans and if you look at their budget, most of it is funded from external resources,” the opposition leader regretted.

He added: “They are getting loans from the International Monetary Fund(IMF) and the World Bank and using semantics to cover up for these loans…soft loans or hard loans but it comes to one thing, they are loans. When that loan is used for consumption purposes as it is in this budget, where will the money come from to settle the debt?”

Dr Silumbe insists that Zambians are not benefiting from the natural resources the country is endowed with.

“Every minute that passes, one track leaves the country loaded with copper yet the money paid for that copper is in externalised accounts. What comes into the country is money only meant to pay workers. We are not getting anything…the idea of continuing to give these foreign investors tax holidays is detrimental to the development of our country and detrimental to the development of the future generation. Remember, this copper is a wasting asset… It continues going out of the country but we are not getting anything in return,” he said.

Three police officers arrested and detained for allegedly assaulting a 24-year-old woman

Three police officers of Kamuchanga Police Station in Mufulira have been arrested and detained for allegedly assaulting a 24-year-old woman of Chibolya Township.

The three police officers and one member of the community crime prevention unit were only apprehended and detained in custody ten days after the incident.

Copperbelt Province Police Commanding Officer Sharon Cheelo Zulu has confirmed that the four suspects were arrested on Thursday over the incident that occured on 26th September 2022 in Chibolya Township.

Ms. Zulu, however, did not identify the four suspects in police custody.

She said the four suspects have been charged for assaulting Alice Kachense and will appear in court next week.

“I wish to state that a report of assault was lodged at Mufulira District Police in which female Alice Kanchense of RC Chibolya reported that she was assaulted by four police officers based at Kamuchanga Police Station.The same incident happened on the 26th September 2022 around 09:30 hours at House Number 649 RC Chibolya,” Ms. Zulu said.

Ms. Zulu warned that the police command will not tolerate bad conduct from officers.

“I further want to assure the members of the community and family member to the complainant that this case is not laying idle as from yesterday, the 6th of October 2022, three officers who that assaulted the same lady were detained in custody and one CCPU (Community Crime Prevention Unit) member and they gave been jointly charged and arrested for assault or ABH (assault occasioning actual bodily harm) and they will appear in court possibly on Monday which is 10th of October 2022. We will not condone officers behaving in such a manner. The truth of the matter is that everyone has the right to be told of the offence they have committed when they are being apprehended. They have that right they need to be told why they are being arrested,” she said.

Last month, a Police officer of Mufulira was sentenced to 17 years imprisonment with hard labour for raping and impregnating a 13-year-old girl who went to seek refuge at a police station.

Maxwell Ludaka of Sikalangwe Police Camp in Mufulira, had sex with the minor, a pupil, in 2020.

The girl, who resides in Chambeshi, had gone to visit her grandmother, who lives in Kamuchanga Township in Mufulira, when the man of the law took advantage of the situation.

She however said because it was late, she went to Mufulira Central Police station to ask for help.

Between October 8 and November 11, 2020 in Mufulira, Maxwell Ludaka 44, of house number MD/3 Sikalangwe police camp in Mufulira had unlawful carnal knowledge of a woman without her consent.

Political | Analysis: Eliminating Political Opponents Through The Illusion Of Truth – Part I.

Repetition makes a fact seem more true, regardless of whether it is or not. Understanding this effect can help you avoid falling for propaganda. “Repeat a lie often enough and it becomes the truth”, is a law of propaganda. Among psychologists this is known as the “illusion of truth” effect. If repetition was the only thing that influenced what we believed, we’d be in trouble, but it isn’t.

Our minds are prey to the illusion of truth effect because our instinct is to use short-cuts in judging how plausible something is. Often this works but it can be misleading. In this narrative, I labour to explain how the general public is deliberately made to ignore the political rivalry variable to the corruption allegations equation in arriving at a guilty verdict in the court of public opinion.

In the case of Barnabas vs Jesus, the court of public opinion was not moved by the truth and that is how falsehood momentarily defeated the truth but surprisingly enough, not even people in a Christian Nation have taken time to learn from that judgment. The illusion of truth is not inevitable. When armed with knowledge, we can resist it. Let’s seek after knowledge.

In Zambia, today, we rarely take time to question the validity of negative statements we come across involving public figures so it’s easier for politicians to use corruption allegations to get rid of their political opponents instead of engaging in competitive debates at the level of developmental ideas. This article seeks to lay foundation to further articles I shall present on why Zambians must this time be smarter ahead of the 2021 general elections.

I have been gathering data to present our followers, who seek after the truth, with a very special report that should give us a gleam reality of politics of deception in which corruption is used, often times involving a cartel of the press, planted whistle blowers, CSOs and prominent civil servants to ensure that whatever is presented is made to appear as credible as it could ever be.

Allow me to take you a little bit back to the issue of political persecution in the corruption case of former President Frederick Chiluba vs the People of Zambia. What was believed to be a water tight case has since proved only to have been a malicious political fight initiated by enemies of Chiluba and supported by the late President Levy Mwanawasa.

President Levy Mwanawasa addressed Parliament and presented a series of allegations that former president Chiluba had committed offences against the state while in office. Five days later, Parliament had hastily passed a resolution lifting Mr. Chiluba’s immunity against prosecution. There was jubilation in the country.

Chiluba’s enemies had done all they could to destroy his name in the court of public opinion dubbing his case the ‘Chiluba’s matrix of plunder’. Parliament’s move was largely a response to rising protests over the government’s failure to act against the high-level corruption allegations levelled against the former Head of State.

Hundreds of demonstrators marched the streets of Lusaka, chanting and waving anti-Chiluba messages and swarmed the Parliament premises ahead of the special hearing.

“Chiluba is worse than HIV/AIDS”, one angry placard proclaimed. “Chiluba is a devil incarnate”, charged another. Several others carried similar but strong and moving messages. One can just wonder what was going on in the mind of the late President at the time. But as it was in the case of Barnabas vs Jesus, once hatred has been established, noone wants to hear any defence of the guilty one.

Mwanawasa alleged that millions of dollars, including US $20.5m earmarked for arms purchases, were diverted from public coffers for the personal benefit of the former President, his family and associates. It was further alleged that over US $7m was diverted from the HIPC funds to a dubious arms deal with Katebe Katoto, alias Raphel Soliano, a Congolese rebel leader in the DRC. With all these and many more, and that they were coming from the Head of State himself, Chiluba was guilty in the court of public opinion.

Surprisingly, when the matter went to court, all the prominent allegations especially the arms purchases and the diversion of HIPC funds proved to be unfounded and dropped off and Chiluba found himself facing a possibility of a jail term over a paltry US $500,000 from the multitude of millions that necessitated the removal of his immunity by Parliament. By the nation was coming to grips with the truth.

In 2007, the prosecution tried to save face by taking Chiluba’s case to a hired British judge, Peter Smith, who ordered Chiluba to pay back US $58 million to compensate for money he was suspected of stealing while he was in office. Chiluba just laughed it off. The prosecution knew that the judgement, technically, could not even be registered in Zambia. Two years later, however, Lusaka Magistrate Jones Chinyama said the prosecution team had failed to prove the case against Chiluba.

“I find that the accused is not guilty on all counts,” Chinyama said.

“Those who thought I am a thief should know now that that I am innocent. As a Christian Nation, we do not steal but the devil will accuse you of stealing,” Chiluba told a news conference after the verdict was handed down.

Chiluba’s innocence came after the political motives of the cartel against him had already been achieved. So to avoid similar situations where political enemies can achieve their short term political objectives through the elusion of truth, President Edgar Lungu has often refused to take decisions based on the court of public opinion. So what has changed in the case of the former Minister of Health, Dr. Chitalu Chilufya? We shall soon find out.

Join me in the next part as I look at the recent case of the missing ARVs at Medical Stores in which it was alleged by enemies of the former Minister of Health that he was behind the theft and, consequently, had put the lives of Zambians at risk through drug shortages. The illusion of truth is not inevitable, when armed with knowledge, we can resist it.
