ZAMBIA – SLEEP WALKING INTO A POLICE STATE – A CLARION ALERT!

As the New Heritage Party (NHP), a party that lives up to its name of upholding our Zambian democratic heritage, we are deeply concerned at the break down of the rule of law in the country.

We say this after noting with dismay that this penchant to disregard the law is happening almost on a daily basis, as well as the insipid introduction of a fascist order, under the leadership of the United Party for National Development (UPND) headed by President Hakainde Hichilema and who is taking the country back to the one party state in all but name.

As a party that cherishes our heritage as a regional model of peace that we have enjoyed for more than half a century, we are speaking for the voiceless Zambians who invested massively in the change of government from the leadership of the former ruling party, the Patriotic Front (PF) to the UPND.

While it is common sense to every Zambian that what characterised the governance of the PF is unbridled corruption, political thuggery and mismanagement of the economy, we are grossly disappointed that the UPND has its own brand of bad governance that, if left unchecked, will rank Zambia as a failed state in the same league with some war torn countries in our region and beyond.

We have observed with disquiet the increasing number of arrests, of a number of prominent Zambians, especially those from the former rulling party the PF, and in recent times some prominent business persons, some on very questionable grounds – but for the reason that most of these cases are still in court we would have actually cited specific cases. Suffice to say that what we are witnessing through these indiscriminate arrests, is an escalating show of intolerance for divergent views and dissent in general, which in the normal course of things are the hallmark of a democratic dispensation.

The other worrying bad governance trait that is reminiscent of fascist regimes the world over is the deliberate imasculation of and surbodination of the democratic governance institutions such as the courts, the elections body, the police and other state security institutions, the church and other civic bodies, trade unions ,the student movement, traditional authorities and most importantly to the media.

We have in recent times in our country witnessed the removal under unexplained circumstances, of key and senior members of the Electoral Commission of Zambia, thereby leaving this critical governance institution without legitimate leadership, leading to the complete manipulation and abuse of the electoral process in the recent Kabushi and Kwacha by elections.

We can also cite the recent dismissal of the Director of Public Prosecution (DPP) Lillian Siyuni, an action that has drilled holes in the independence that this cardinal office has in the delivery of justice. The glaring anomalies of her dismissal, based on the partisan, partial and illegally constituted, Vincent Malambo led Judicial Complaints Commission (JCC) is a disgrace to the nation and the judiciary of our country.

We note also with dismay, the contemptuous conduct of the executive branch, through the office of the Attorney General towards court decisions and orders, such as the stay which the high court put on elections in Kabushi and Kwacha but which were totally ignored by both the state and ECZ, clearly making the separation of powers a big joke and, in a similar vein, making the independence of the judiciary and it’s decions in so far as the UPND government is concerned, of no consequence.

This should alarm progressive Zambians since we feel something rotten is being incubated in the UPND hatchery that is not only divisive but destructive to the wellbeing of the populace.

We sound this clarion call knowing that this is not happening in the first and second republics when Zambia was a police state subsisting under a perpetual state of emergency, necessitated by the fact that Kenneth Kaunda was starting a new nation coupled with the serious internal and external security threats to the nation caused by the interparty political violence mainly between the ANC and UNIP on one hand and the on going wars of liberation aiding neighbouring countries like Zimbabwe, Mozambique, South Africa and Namibia which were under colonial rule, on the other.

After the 1968 Choma Declaration of the almagamation of ANC and UNIP into one party and the 1991 change from one party rule to plural politics and the eventual attainment of independence in neighbouring countries, Zambia had no further need to continue being a police state and the successive leaders to Kaunda from Frederick Chiluba, Levy Mwanawasa, Rupiah Banda and Michael Sata acknowledged this progressive status quo.

Alas! The UPND seems to be blind to this pacifist history and is shepherding the country back to the days of the police state characterised by the over empowering of security wings, intolerance to opposition and concentration of power in the executive and other draconian forms of autocratic governance.

All this is being done to prepare, the Zambian population to quitely accept to live in fear of the rulling party through the state coercive forces of the police, DEC, ACC, Army and other security agencies. The real targets for this intimidatory project of the UPND, is the Zambian masses who must be forced into submission so that the foreign sponsors of the UPND can continue to plunder our nutural resources freely, without the fear of rebellion from a harrased and cowed citizenry.

We can safely say that with the state capture of ECZ and the constitutional court, any upcoming elections whether parliamentary or presidential would only favour the ruling party.
These injustices cries to the heavens high and should prompt any peace-loving and progressive Zambian to protest, since it is an affront on our wellbeing and dignity as human beings.

The New Heritage Party, which speaks for the people, is calling on peace loving Zambians to resist and strongly condemn these attempts at state capture of our governance institutions and the base attempts to disempower them for the benefit of foreign individuals and other corporate entities which are in control of the UPND.

Zambians should know that this so called fight against corruption by the UPND is nothing but a ruse through which they are abusing the sacred mandate of the Zambian people to settle scores with their enemies, real or imaginary and that when they are done with the “corrupt PF” they are coming for the ordinary Zambians. They have already demonstrated their hatred for poor Zambians in Kasompe, Chingola where they razed poor people’s homes and in Lusaka where the poor telephone booth operaters where again they demolished the only source of income for these unemployed youths.

Zambians, the New Heritage Party, calls upon you to wake up to the UPND’s schemes and say enough is enough. In ending this Clarion alert we leave you with this timeless quote by pastor and theologian Martin Niemöller who famously said

” First they came for the Socialists, and I did not speak out—
Because I was not a Socialist.
Then they came for the Trade Unionists, and I did not speak out—
Because I was not a Trade Unionist.
Then they came for the Jews, and I did not speak out—
Because I was not a Jew.
Then they came for me—and there was no one left to speak for me.”

Its Nonsensical To Accuse Me Of Grabbing Things I Donated In Kwacha– Malanji

I CANNOT punish the people of Kwacha twice, says former foreign affairs minister Joseph Malanji.

Malanji, who had vowed there would be no by-election in Kwacha Constituency if he’s not allowed to stand, said claims that he was on rampage grabbing valuable items that he donated to communities when he served as member of parliament such as Bulangililo Clinic was political propaganda by UPND against him.

Some UPND members have gone on social media alleging that Malanj has grabbed equipment he donated to Bulangililo clinic and two buses from a named church.

“That is propaganda, they are trying to peddle around. The people of Kwacha have spoken, if you go and campaign all those days and then you get 10 per cent votes, and even that 10 per cent vote where was the 6,000 people because we did not see the people queue? Where were the 6,000 people?” he asked. “I am sure even from your informers, you can tell that they did not find three people, four people or five. There were even officials that were sleeping because there was no work to do. So surely how can I punish the people of Kwacha twice, [people] who have demonstrated loyalty to me by not going to vote because of injustice? How do I do that? All the projects which I started, I will finish them.”

Malanji said his team was working on tiling the clinic according to the specifications prescribed by the Ministry of Health.

“They told us the clinic must be well tiled. We are going to do that and handover the clinic to the community. In any case, I have given a lot of things in the constituency. How many things can I grab then? These things are still working and they will continue working for the people because we are looking at the majority, the 58,000 who stayed home. Those are the ones who we are looking at and I will render service to them because from the word go the mission statement of our constituency is community–pioneered development,” he said. “I will work with the community and make sure that we achieve our goals as per our initial intention.”

Malanji said that the decision by 58,000 voters to not turn up to vote was a protest.

“They have never seen an institution like ECZ overriding what the court has said. They have never seen that. You can actually get worried about where we are going. We must all get worried,” he said.

Malanji said he would issue a comprehensive statement very soon regarding the “hullaballoo” about him on social media.

He said he would soon engage the media on whether he would contest the PF presidency, whose applications closes on October 28.

And Malanji expressed shock after two UCZ churches in Kwacha East called to inform him that a group of police officers had arrived and demanded to see buses he had donated.

“A bus is not a VX worth a hundred thousand dollars. Those buses are worth K200,000. Can you not keep money and buy? I was a minister, did I not get a salary to keep and buy what I want for the church?” asked Malanji. “The Reverend is wondering why they should go to church to look for buses. They went to UCZ in Kwacha East and they have gone to UCZ Ipusukilo as we speak. So it means they have been given instructions to grab whatever was donated to the church. They want to claim it is proceeds crime. This is unacceptable.”

50,000 Burkina Faso Civilians ‘Volunteer’ to Fight Jihadists

The Burkina Faso military this week launched a drive to recruit 50,000 civilian defense volunteers to help the army battle jihadists, the authorities said. The country, one of the world’s poorest, has been battling a protracted deadly jihadist insurgency.

Military rulers in Burkina Faso have confirmed the launching of a drive to recruit tens of thousands of civilian volunteers to help fight Islamist extremists.

Just before being designated minister of territorial administration, Colonel Boukare Zoungrana announced more civilians would be enlisted to push back the armed groups.

“Recruitment has been launched for 35,000 volunteers for the defence of the nation” from different districts, he said.

Their mission “will be to protect the population and belongings of their districts alongside the security forces,” he added.

The commander of the force who will be referred to as Volunteers for the Defence of the Fatherland, said the aim was to enlist 35,000 new members. According to Africa Today News, New York the sworn candidates will receive two weeks of military training before taking part in operations across the country, which has been battling a jihadist insurgency since 2015.

The authorities on Monday had already announced it would build a force of 15,000 other volunteers “who could be deployed across the whole of the national territory.”

The so-called “volunteers for the defence of the nation” have legally existed since 2020. Recruits usually receive training for a fortnight before being handed weapons and means of communication.

Many have been killed in jihadist attacks, especially in the north and east of the country. Beyond the civilian volunteers, the military is also looking to hire 3,000 more soldiers to boost its ranks. Meanwhile, the United States has warned the ruling military junta that its close association with Russia is the chief cause of the insecurity rocking the country.

Jihadists control around 40 percent of Burkino Faso’s territory. In the latest assault on Monday, at least 10 Burkina Faso soldiers were killed in the northern city of Djibo. The recent deadly attacks by the insurgents have necessitated the move by the Junta to fish out military personnel from the civilian pool, military analysts claim.

Burkina Faso has been rocked by two military coups since the start of the year, with each new leader accusing the previous of having failed to quell the violence and to ensure restoration of order. Captain Ibrahim Traore was the latest to seize power late last month, naming a new transition government on Tuesday evening.

The 34-year-old leader toppled Lieutenant-Colonel Paul-Henri Sandaogo Damiba and rose to the top echelons of power. However, the most peculiar thing about the coup leaders is that both of them have promised to end violence, an endemic that the citizens have grown weary of.

The young army captain, Traore will on Friday be inaugurated as interim president, according to a statement made public by the constitutional council. It is understood that the Junta members had already disclosed that he would take over the role of transitional president, however, the official investiture will take place on Friday.

The constitutional council had on Wednesday disclosed that it ‘officially notes the vacancy of the presidency,’ adding that Traore had been designated as ‘president of the transition, head of state, supreme chief of the national armed forces’ by a national meeting of the country’s forces.

Earlier on, the council said it took note of Damiba’s “resignation”.

Damiba himself had seized power only in January, forcing out Burkina’s last elected president, Roch Marc Christian Kabore.

The race to lead the mighty Patriotic Front (PF) has just gotten more interesting as Hon Greyford Monde, a former Cabinet Minister and former Member of Parliament for Itezhi Tezhi has submitted his application to contest the top position.

Prior to his application, two other credible politicians, leader of the opposition in Parliament Hon Brian Mundubile and Lunte Member of Parliament Hon Mutotwe Kafwaya successfully submitted their applications this morning.

And addressing the media at the party secretariat today, Hon Monde said many Zambians today, like the prodigal son, are saying they were better under the PF.

He added that people had three decent meals under the PF regime and that there was money in circulation.

The wishful party president also highlighted that hospitals under the PF had medicine, as opposed to the prescriptions people are subjected to under the New Dawn Administration.

The former lawmaker mocked the UPND Administration as he stated that it is a failed project.

He charged that the only thing that the UPND has succeeded is arresting people, “bundling” them out of Lusaka to distant places.

Hon Monde said the ruling party came into power on a premise of lies and wondered if the trajectory the government has taken will in any way benefit Zambians.

Meanwhile, Hon Monde said as other have called themselves Bally, he is offering himself to be the people’s guy.

“Many Zambians today, like the prodigal son they are saying they were better under the PF. They were eating three meals a day, the hospitals had medicines as opposed to prescriptions being given today, there was money in circulation,” he said.

“Others have called themselves Bally, I am offering myself as your guy. A guy that you can freely interact with, criticize freely and you can easily access…Leadership is servant-ship to the people.”

He stressed that “it is easier said than done” adding that the changing of government has not worked.

The PF has set 28th October, 2022 as the deadline for receiving of application letters for those desiring to contest the Party’s top job.

More aspiring candidates are expected to apply for the top position before the deadline hits.

UPND Resorting To Violence Because They Can’t Genuinely Win Elections- Davies Mwila

UPND RESORTING TO VIOLENCE BECAUSE THEY CAN’T GENUINELY WIN ELECTIONS- FORMER PF SG MWILA

FORMER PF secretary general Davies Mwila has charged that UPND has resorted to violence in the ongoing Mwense Council Chairperson by-election campaigns because they have realised that they cannot win the elections due to lack of popularity.

But Luapula Province Minister Derrick Chilundika has advised UPND members to refrain from reacting to provocations from PF, arguing that the former ruling party is just trying to seek sympathy from Zambians.

On Tuesday, alleged UPND cadres attacked the PF camp in the ongoing Mwense Council Chairperson by-election campaigns.

In an interview, Mwila lamented that police had not arrested anybody despite the culprits being known.

“The UPND cadres attacked our people at Mwense bus station. The driver of the truck decided to go to the police and they followed him. That is where they were now firing gun shots at the police. The police were just watching. I don’t know where we’re going. Statements were given, our candidate gave a statement and honourable [David] Mabumba as well. The police are quiet but I don’t know what they are doing now. The people that were firing gun shots at the police are known. I have said that when UPND sees that they are not winning elections, they resort to violence. We are not going to allow that because they cannot win. So they want to force themselves on people,” he said.

“We did nothing to them but they just followed us and attacked us. When the driver decided to go to the police and they started firing gun shots at the police station and police officers were watching. That is anarchy. We cannot allow that. They should not resort to acts of violence because we don’t want politics of violence. We want clean campaigns. If they are popular, let them campaign and win. But they know that they cannot win. UPND is not there in Mwense and they are losing. So they are so desperate but our party is popular and we are getting more popular everyday.”

Mwila said PF had taken advantage of UPND’s failure to deliver farming inputs on time, among other issues.

“UPND hasn’t delivered fertiliser up to now and you expect people to vote for them in rural areas? That is their problem. Problems have been created by themselves and we have just taken advantage of that. We’re telling the people that we used to bring fertiliser in June but this is October and they have not brought fertiliser. So it is desperation of the UPND cadres. Their leadership is also desperate. However, the police must be firm and deal with all the culprits that are involved,” said Mwila.

But in a separate interview, Chilundika advised UPND members to refrain from reacting to provocation from PF.

“All they want is to paint UPND like it’s violent when it is not violent. We’ve been conducting peaceful campaigns and elections. You can contact the police on the number of incidences recorded relative to violence, you will notice that it’s not there. When you look at what transpired, you will be able to tell that they were trying to provoke the situation so as to seek sympathy from the people which should not be the case. They know very well that this government has done extremely well in the province so far. We are the first administration that has provided capital to ordinary Zambians in forms of grants. It has never happened in the history of Zambia here in Luapula,” he said.

“This is the party after UNIP that has brought back free education. It’s the government after UNIP that has brought in bursaries. It’s the only government after UNIP that has brought increased CDF to conduct various projects. So our colleagues are aware of those and they know that the people of Zambia, particularly Luapula and Mwense, have acknowledged that. In a bid to seek sympathy, because Zambians are so sympathetic, they can even sympathise with a criminal, so to seek sympathy, they’ve got to provoke a situation so that they sympathise with them.”

Chilundika said Zambians should not buy into PF’s cheap politics.

“My message to the people of Mwense is that do not buy in such cheap politics. You need this administration to deliver a bit more. How can a party fail to be popular on the ground when they are ruling? How can a ruling party fail to be popular? What popularity are you talking about? If you go in any corner of Zambia, all corners on Mwense, ask them which government is ruling and they will tell you it is UPND. So who says it’s not popular?” asked Chilundika.

“If it’s not popular, where did they get those numbers they are claiming to have attacked them? It’s the people within there. They are provoking the other camp of UPND, that is the position. My advice to the people in UPND is let’s improve on refraining from reacting to these provocations. We are a peaceful government and we want to ensure that every Zambian is respected with their rights. Our chances of winning are extremely high.”

If Mary Chirwa was not questioned on porn video, why call Vubwi MP – Emmanuel Mwamba

PF deputy chairperson for publicity and information Emmanuel Mwamba says his party has shunned the invitation to Independence Day celebrations because President Hakainde Hichilema was allegedly participating in damaging state institutions.

And Mwamba says as long as the state favours Drug Enforcement Commission (DEC) director general Mary Chirwa over her alleged involvement in the production of a pornographic video, it will be difficult to investigate Vubwi PF member of parliament Ackleo Banda over pornography.

Mwamba told The Mast that the conduct of President Hichilema in the Kabushi and Kwacha parliamentary by-elections, which were scooped by the UPND, were unacceptable.

“Our view is that people should celebrate from home in their own spaces. We think that the conduct recently of President Hakainde Hichilema leaves much to be desired. You know his keenness to break the law, break the Constitution and disobey the Constitution has left us wondering because this is one man who is supposed to protect the Constitution. We have seen that there’s an active court order stopping the elections in Kabushi and Kwacha, all knew that the court through the High Court had said there should be no elections until the matter is determined. They were two courts that commented about that matter but ECZ proceeded to even issue a calander when there was an active court case. ECZ proceeded to call for campaign period when there was an active court order stopping the elections,” Mwamba said. “The President spent many days campaigning on the Copperbelt contrary to what the court order stated. So a man who breaks the law with impunity, how does he help celebrate independence? He shouldn’t be participating in the damage of those institutions.”

He said the PF would petition the Kwacha and Kabushi elections.

“We are appealing. We will challenge those elections in the courts of law. We hold that those elections were illegal and its outcome is illegal. We don’t recognise those candidates,” he said.

And Mwamba said as long as the state favours Chirwa over her alleged involvement in the production of a pornographic video, “it will be difficult to investigate Ackleo Banda.

A video has emerged in which Banda is captured fondling his private parts in unexplained circumstances.

“We do not have an official report that honourable Akleo Banda, the member of parliament for Vubwi is the one in the pornographic video because we just received this matter today. We are aware about it. We will be speaking to him to understand the issues surrounding the video. The party works through institutions and that just happened yesterday [Sunday],” he said. “We had earlier called for action against Mary Chirwa, the Drug Enforcement Commission (DEC ) director general. We were very resolute on that matter and for the failure by the state to handle the issue of Mary Chirwa makes it difficult for subsequent cases. How do you treat subsequent cases if you favour certain people before the law the way Mary Chirwa was favoured where there was no official report on her matter. There was no official investigation. Mary Chirwa was never called to the police. So it creates a very difficult precedence for subsequent cases to be death with. If Mary Chirwa was not called to the police, why should they call the MP for Vubwi. If Mary Chirwa was not questioned, why would you call any other offender to question them on this matter because then you will be selective in your approach.”

A group of business executives from South Africa’s Western Cape and Cape Town will today commence a 5-day trade mission to Zambia to promote trade and investment partnerships in various sectors.

WESGRO which is the official tourism, trade and investment promotion agency for Cape Town and the Western Cape is leading the trade mission to Lusaka from 26th to 29th October, 2022. The business executives will engage their Zambian counterparts to forge economically viable trade and investment opportunities in agriculture, manufacturing and other sectors.

“We want our South African companies to trade with Zambia and support the country and the new government to add value to Zambian resources and create jobs through partnership that may arise from this Trade Mission,” said Ms. Santos. “The purpose of the mission is to promote trade and investment between South African and Zambian businesses as well as create partnerships between the two counterparts.”

The mission will be structured in Networking Sessions and Business to Business meetings arranged for delegates.

WEGRO Export Manager Tatiana Dos Santos, expressed excitement that the Zambian Government is undertaking economic diversification to reduce the country’s reliance on the mining industry.

Ms. Santos acknowledged that the Government was exploiting other components of Zambia’s rich resource base by promoting agriculture, tourism, gemstone mining, hydro power generation, energy, and manufacturing.

The Trade Agency noted that these sectors had experienced exponential growth in recent years and were expected to continue to grow due to the numerous investment opportunities available in the country.

The Trade Mission to Zambia forms part of WESGRO’s International Trade and Outward Investment Mission Programme for 2022/23.

And Zambia’s Acting High Commissioner to South Africa Ms. Inonge Mwenya, indicated that the High Commission is excited about WESgro’s visit to Zambia, especially that that the programme also included Business to Business meetings.

She encouraged South African Businesses to also look at Zambia as an investment destination, adding that there was need to enhance Market Access for Zambian products to South Africa and address challenges faced in this regard.

The Acting High Commissioner cited the challenge Zambian honey and several other products had in accessing the South African market. She stated that the Mission remained hopeful that such matters would be resolved soon in order to further enhance mutual bilateral trade relations.

Ms. Mwenya stated that the Mission was working on a reciprocal trade and investment mission to South Africa which is scheduled for 2023.

Malawian Woman Burns Her Degree Certificate

Bridget Thapwile Soko, a young Malawian woman, has had her degree from Exploits University revoked after she posted a TikTok video where she burnt her degree certificate.

In the video, Soko sings songs whose lyrics make mockery of the inability to get long-promised jobs after completing one’s degree. She playfully expressed her frustration at the apparent lack of value of the degree and capped it off by saying she was sticking to her marriage certificate.

“You reach a point of getting tired. Whenever I see this degree, it gives me fake promises that I will get a job,” she ruefully expressed in Chichewa.

The video went viral on the social media platform, garnering support and scorn alike. Those who did the latter deemed the act irresponsible and pointless.

Exploits University – a Malawian top 20 university – responded by stripping Soko of her degree. They expressed their disappointment with the video in a letter addressed to her, signed by University President Dr Bikoko dated 21st October, 2022.

“We have learnt with disappointment that you recorded a video clip burning a degree that we awarded to you upon completion of your studies with Exploits University and posted on social media. It is our interpretation that you did this to disgrace and tarnish the image of the university.

“The university is therefore revoking the degree of business administration awarded to you. Our decision will also be made public through the media. Consequently, you are no longer a graduate of Exploits University and as such, your degree certificate is invalidated with immediate effect.”

The university has since been under fire as Malawians have taken to social media to lambast their decision to revoke Ms. Soko’s degree.

Facebook user Kondwanie Chirembo said, “For me, the reaction of the university actually brings the institution into disrepute! This was an opportunity for the university to show the country (and the world) that it’s not as useless as it claims the girl made it feel. Revoking an awarded degree is a serious matter that cannot be driven by emotions. This has been a big fail by the university IF that letter is genuine.”

In the same vein, other Facebook users said the wiser step for the university to take would have been to employ her and prove that her degree was not useless.

“If I were a top administrator at the University, I would have facilitated the employment of the destitute and frustrated female youth”, wrote Elia Mwalwanda.

Some have urged Soko to sue the university as she earned the degree, and it is hers to do with as she pleases. There were no grounds for the revocation as this was not an honorary degree which could be terminated in the event of improper conduct. This was a degree that she invested her financial resources and 4 years of her time into.

Consequently, some opine that it is only right that the university refund all her tuition fees.

Ms. Soko is not the only one to suffer unemployment in the East African country. Malawi’s unemployment rate reached a peak of 7.02% in 2021, according to Statista. For context, countries like the UK and US have unemployment rates below 5%, while Qatar has an unemployment rate of 0.3%, the lowest in the world.

Malawians have called on the government to intervene and find ways to tackle rising unemployment in the country.

Harry Kalaba has been appointed and installed as President of Citizens First political party

Former Democratic Party (DP) leader Harry Kalaba has been appointed and installed as President of a new political party called Citizens First (CP).

Mr. Kalaba, the former Foreign Affairs Minister, last July resigned from DP after internal wrangles over the party presidency.

During a briefing at Southern Sun Hotel in Lusaka on Wednesday morning, Mr. Kalaba said he has accepted to lead CP as President after his efforts to register a political party called Liberty was allegedly frustrated by President Hakainde Hichilema.

In his speech, Mr. Kalaba said President Hichilema should focus on addressing the many challenges that the people of Zambia are faced with rather than fighting him.

“You will recall that I applied to the Registrar of Societies for the formation of the Liberty Party. It was brought to my attention that the Republican President had taken keen interest in my application and instructions were given from his office to ensure that all efforts are made to delay the approval of the Liberty Party until at least a few years before elections. It is sad that while the President has gone around the world parading himself as the restorer of peace and democracy in Zambia, the evidence on the ground however is pointing in the opposite direction. Sooner rather than later these lies will be exposed and made bare for all to see someone for who they really are,” Mr. Kalaba said.

“While a few elements within the state machinery were busy trying to frustrate the cause of the Liberty Party, the Citizens First Party was formed and its leadership has appointed me to be its President and torch bearer. I have wholeheartedly accepted this responsibility and trust that we will work together with the leadership of the CFP and other opposition political party leaders to ensure that we address the challenges the country is currently faced with,” he said.

Mr. Kalaba called for unity of purpose among Zambians to fight various challenges affecting the nation.

“It is my prayer that if there is anything this announcement will accomplish; it is to send a message to the Citizens out there that help is on the way. Help is on the Way! That help will not just come from Harry Kalaba alone, but when all these leaders here present put their collective effort and wisdom together we will certainly correct the course of this nation and bring us back to the path of productivity. We will be able to arrest the subjective fight against graft that has characterized the current government while they continue to abuse national resources. We will be able to assure youths that they do not need to change their name or use their middle name to get employed. We will be able to reassure them that it is ok to trust but they need to trust the right people who will not betray them and sell them off along with national assets to the highest foreign bidder. We will be able to assure the mother that their dignity will be restored, all they need to do is wait a little while longer, help is on the way. 2026 may seem far off, but the journey has to start now,” Mr. Kalaba said.

He said it was awkward that after 58 years of independence, the majority of Zambians are still wallowing in abject poverty and can barely afford one meal a day.

The price of essential commodities continues to rise at an alarming rate and are beyond the reach of most Zambians and yet those in leadership seem to be preoccupied with the quest of driving a tribal or regional wedge in order to further divide the nation while creating opportunities for foreign interest at the expense of the majority Zambians. Never before has Zambia been this polarized,” he noted.

“Finally, I want to call upon well-meaning Zambians to join our movement as we seek to work together with all political players, civic leaders, the church, the madrasa’s, the civil servants, the youths who were fed a lie during the 2021 elections, the farmers who were promised timely delivery of inputs, the retired officers who were used and abandoned and all men and women of goodwill to join us so that we can sing an anthem of unity together as one as we set ourselves on that path to restore and live the One Zambia One Nation Moto. I thank you and God Bless You and God Bless the Republic of Zambia,” Mr. Kalaba said.

Opposition political party leaders that attended the briefing included Wynter Kabimba of Economic Front, New Heritage Party’s Chishala Kateka, Sean Tembo of PeP and Chilufya Tayali of Economic and Equity Party.

Meanwhile, Mr. Kalaba predicted that 2023 shall bring with it serious hardship through price hikes following the removal of subsidies on fuel at the end of the year.

“As I take up the mantle of leadership of the CFP, I would like to remind the Republican President and P.S Matembo to focus on addressing the many challenges that the people of Zambia are faced with rather than fighting Harry Kalaba. The challenge this country is faced with is greater than Harry Kalaba. As you can see by the people present today, we in the opposition have come to realize that there is more that unites us than that which divides us. We are therefore seeking to have a common ground through which we shall address all manners of political vices and challenges with civility and unity of purpose. I accept the honor bestowed upon me as President of the Citizens First Party and I want to call upon the people of Zambia to seek hope in the face of despair. I also want us to remind ourselves that we need to brace ourselves as we get into 2023 which shall bring with it serious hardship through price hikes following the removal of subsidies on fuel at the end of the year, but do not despair, let’s be more united than ever before and through unity of purpose we shall overcome all the challenges,” Mr. Kalaba said.

GOOD governance activist Brebner Changala has warned that there will be more chaos under UPND than there was in the PF government.

He says the UPND has started abusing the law more than the PF did.

Changala cited the Electoral Commission of Zambia (ECZ) where President Hakainde Hichilema has not yet appointed the chairperson and the vice despite not extending the contracts of those who were there.

“Now, PF we knew it was a criminal organisation and I still believe that very strongly. One thing that pains me is that I didn’t expect the new dawn administration under Mr Hakainde Hichilema to walk the same route. He’s a man who campaigned on the restoration of the rule of law. What has happened to the DPP is the same chaos he has created at ECZ, the Electoral Commission of Zambia,” he said. “How do you remove commissioners before you find replacements? How do you place the chief administrator of ECZ, forced to resign and leave a vacuum there, basically allowing the Executive to run an electoral body? They are running it and they cannot deny. There will be more trouble than Edgar Lungu did if they are not careful, because they keep on believing that they are smart. I don’t think that’s the way you can abuse the law. And I don’t think that is a smart way of abusing the law.”

Changala questioned the rationale of removing ECZ chairperson justice Esau Chulu and his vice Emily Sikazwe when the President did not have alternatives.

“What was so urgent that judge Chulu and Emily Sikazwe must be hounded out without replacements? What was so urgent other than treachery on display,” he wondered.

On proposals to change the system of appointing the Director of Public Prosecutions (DPP) so that the office bearer operates like the Attorney General who leaves office together with the appointing authority, Changala refused vehemently.

He said the nation cannot allow such, insisting that the DDP shall remain a constitutional office just like judges.

“That will not be allowed. That is exactly what these politicians want. They want a user-friendly DPP. That cannot be allowed and it’s never worked that way all over the world. The DPP must see through all administrations like the judge. Once they win the way they are doing it, attacking the DPP, finding complainants and financing complainants to the JCC… By the way, the JCC is loaded with UPND sympathisers,” Changala charged. “Do you know the danger? They are going to attack now the bench. They are going to isolate a certain judge, and I’ve seen it has started. Isolate a certain judge, report them to the JCC and from JCC they will not survive. And there will be a purge on the bench. Watch the space. These are criminal syndicates that are being organised behind the scenes. I have seen judge Mungeni [Mulenga] is under siege and being called a PF surrogate. And it’s not going to end, get it from me. They will find a useful idiot to go to JCC, knowing very well that at JCC Mungeni will be crucified. She’ll be hanged dry there because that JCC, the composition is equally worrisome.”

Changala alleged that there are UPND cadres at the Judicial Complaints Commission (JCC) who are given assignments to carry out.

“There are party officials there, hardcore UPND, who are loyal to the party president. And when the party president gives them assignments, they are going to mutilate the Constitution,” Changala said. “So, when they succeed on the DPP chambers they are going to invade the judiciary and judges there will have a tall order. And the DPP chambers cannot be aligned to the term of office of a sitting President, no. It must override every administration because it has no business with the Executive.”

Asked why the position of DPP has been politicised since the country’s return to multipartism, Changala cited selfishness of politicians.

“The office of DPP has been highly politicised. It has been politicised by the Executive to be used only by the Executive. For the Executive, any individual that they perceive to have a problem either through criminality, corruption for their hatred, they want the DPP to prosecute that person at all cost even when the independent mind of the DPP says otherwise. The political and executive pressure on that office is becoming too evident, and the DPP’s office is under attack,” Changala explained while giving an example dating back to the Levy Mwanawasa administration. “When Mukelabai Mukelabai was DPP, there was a task force [on corruption]. That task force, and this is what put Mutembo Nchito in problems. That task force was an ad hoc assembly of lawyers and law enforcement officers. There was a substantive DPP there whose constitutional power was to see which matters go to court and which ones don’t go to court. And this is where they started accusing Mukelabai Mukelabai that he was meeting privately with the accused; one of them being Xavier Chungu.”

He recalled what happened after Mukelabai was removed from the position of DPP in 2003.

“Fast forward, Mukelabai was hounded out. And there came Caroline Sokoni, then the current judge Chalwe Mchenga. Mchenga was DPP from Mwanawasa, through [to] Rupiah Banda. When Mr [Michael] Sata came to power in 2011, he negotiated the movement. It was a decent move for Mchenga to move from the DDP’s office to the bench. There was no controversy or animosity,” Changala said. “Now, the incompetent Edgar Chagwa Lungu had a team of criminally minded lawyers who plotted against Mutembo Nchito and they managed to convince the Executive to have Mutembo Nchito removed. But he was not only removed legally or in a decent manner. He was dragged to the police – the police that he controlled – was made to rise against him using the dirty Executive hands. And Mutembo Nchito was hounded out and the tribunal report hidden from the nation. And yet they claimed they were doing it in public interest. How do you hide what is in public interest?”

He also explained how the recently removed DPP Lillian Siyunyi came into office under former president Lungu’s PF.

“And Siyunyi was brought in conveniently by the previous regime. And when she came in I’m one guy along the way who was not happy in the manner she was throwing nolles like confetti at a wedding. Nolles became the order of the day. Nolles defined our justice system,” noted Changala. “When somebody has been taken to court, he’s exhausted financially and abused, before the judgment comes into play a nolle is entered. Not a full discharge but a nolle so that you can’t go and claim compensation for wrongful detention or wrongful imprisonment!”

OUT of good faith and patriotism, President Hakainde Hichilema recognised former President Edgar Lungu and his wife Esther in his salutation at the National Honours and Awards Investiture Ceremony held at State house on 24th October 2022 albeit in absentia.

Mr Hichilema’s recognition of Mr Lungu was not out of duty but respect, love and full appreciation that only collective wisdom will build Zambia and underscored this year’s theme : Promoting Inclusiveness towards a Sustainable Social Economic Recovery.

With only two of the seven Republican Presidents to have superintended over the affairs of this country in the last 58 years,President Hichilema is fully aware that he and his predecessor were the only beacons on which the country’s socio-economic transformation agenda lies.

As a result President Hichilema takes it that all official invitations to the former President are in order with the country currently at its critical third phase of socio-economic development.

The first phase was political independence which later birthed the second phase of education which anchored as foundation for white collar jobs.

But, the third phase of economic independence shall be made possible through unlocking the economy and promoting the Small Scale Medium Enterprises.

During the same occasion, Mr Hichilema also recognised the former vice Presidents; namely, Mr Enock Kavindele, Dr Guy Scott, Dr Nevers Mumba and Ms Inonge Mutukwa Wina.

In the spirt of inclusiveness, Mr Hichilema appealed to the organisers of state functions to ensure that former Vice Presidents sat together with the incumbent to share experiences and strengthen the Vice Presidency network.

It is common knowledge that what President Hichilema desires for the office of the Vice President he desires for his office at President of Zambia level.

“Remember we only have one former Republican President and the serving one who is President Hichilema which calls for love, unity and guidance among them.”

Mr Hichilema has only Mr Lungu to reach-out to during both good and difficult times in the manner they both reached-out to late President Rupiah Banda for the better good of mother Zambia.

PROS AND CONS OF CONCRETE ROADS

During the commissioning of Dangote Industries in August last year, President Edgar Lungu challenged the Road Development Agency ( RDA) and its engineers to come up with a possibility of constructing concrete roads in Zambia.

The President said, “As you may be aware, my government has traditionally relied more on bitumen for the construction of roads.

This has proved to be not only very expensive but roads have shown that they deteriorate at a faster rate, making it very costly for Government to engage in such projects.
With the reasonable pricing of cement now, we should be able to use more of cement to construct our highways.

This will ensure that the lifespan for our roads can be pushed to over 50 years.

At this point, may I urge the Road Development Agency (RDA) to urgently explore the possibility of putting up roads that are more durable and affordable by utilising more of cement and less of bitumen.I expect a report from RDA in the next three months.

The RDA and the Engineering Institution of Zambia (EIZ) should seriously take up this gauntlet, with the price of cement having drastically reduced as Dangote and Zambezi Portland Cement have played a major role. Apart from doing a cost benefit analysis (CBA) of the two options, i.e. concrete roads vs asphalt roads, we need to also look at the pros and cons of one against the other. Concrete is the most widely used man-made product in the world.

Without going into details of the CBA, the paving cost of concrete roads is a little higher compared to asphalt paving in the sense that it is quicker to do an asphalt (bituminous road) because bitumen has fast setting properties than concrete, which takes 28 days to cure before it can be ready for use.

When you factor in annual maintenance, though, asphalt pavement can cost four to seven times as much money to maintain as compared to concrete, which consequently saves you costs in the long-term on repair and maintenance.

PROS

● Lifespan of 30 to 40 years, whereas asphalt roads last for 10 to 15 years.

● Moreover, concrete roads do not require frequent repair or patch work like asphalt roads.

● Rigid concrete is more durable than asphalt.

● This means that roads paved with concrete are less likely to have potholes compared to bituminous (asphalt) based roads.

● Street lighting is also better with concrete roads than asphalt roads.

● Concrete roads have better resistance to damage caused by automobile fuel spillage and extreme weather.

● Unlike asphalt roads, concrete roads do not get damaged by the leaking oils from the vehicles or by the extreme weather conditions such as excess rain or extreme heat.

● As far as the environment is concerned, asphalt (bitumen) produces lots of highly polluting gases at the time of melting it for paving.

● Likewise, less fuel consumption by a vehicle running on a concrete road means less pollution.
Some of the disadvantages of concrete roads are as mentioned earlier.

CONS

● The cost of paving a concrete road is slightly higher than that of asphalt road.

● Another one is the problem of maintenance.

● In case of defects arising on a concrete road such as cracks, the whole concrete slab may need to be replaced, whereas in the case of asphalt roads, repairing just a part of the asphalt road is easily possible.

● Asphalt roads can be re-layered over the existing layer.

● Asphalt is a recyclable material which can be used again and again by melting it.

● As for safety features, for instance in rainy and the winter season, vehicles tend to slip or slide on concrete roads due to rain and/or snow rain or extreme heat.

● As far as the environment is concerned, asphalt (bitumen) produces lots of highly polluting gases at the time of melting it for paving.

● Likewise, less fuel consumption by a vehicle running on a concrete road means less pollution.

Some of the disadvantages of concrete roads are as mentioned earlier.

We now look up to our engineers at the RDA and EIZ to tell the nation whether the presidential challenge is feasible or not, and if it’s feasible, when can we start implementing the directive on a full scale?

In marking the 58th independence celebrations,His Excellency the President of the Republic is Zambia Mr Hakainde Hichilema,in his sound wisdom recognized and awarded Pilato and Caveman at the National Honours and Awards Investiture Ceremony held at statehouse.

Pilato and Caveman who are both musicians, were deservingly awarded the President’s Insignia for Bravery and Meritorious Achievement respectively.

However, as as often as expected in a society where divergence of opinions is central,others view these uncommon, special presidential awards as more politically accorded than they are deserving.
Therefore, for avoidance of undermining the independence of thought of every individual,both negative and positive views are to be respected.

However, it is also imperative to critically isolate certain groups of critics of these awards; members of the immediate former rulling party,the PF.
Country men and women,even if today, Jesus himself descended and told members of the PF to congratulate Polato and Caveman on their deserving recognition,they would rather opt for HELL than HEAVEN!


There is no earthly reason for the PF to appreciate and congratulate the duo.
ALL the attributes that led to Pilato and Caveman being recognized are due to the PF’s iron-fisted,brutal, reckless and dictatorial rule!
So,for the PF,even when they actually know that the two musicians deserve it, expressing joy and jubilation about these awards would be seen as public confession of their atrocities.


The PF can’t accord any relevance to these two awards as they view the duo as contributors to their painful downfall!

Now,to the citizens,we are to begin to view and even celebrate those who put their lives on the chopping board when it is not fashionable to do so.


Pilato and Caveman are musician activists of good governance and rule of law.
Pilato and Caveman used their music intellectualism to fearlessly compose songs that spoke about the bad PF rule!
These are heroes!


These two identified themselves and left their comfort zones, risking and speaking about economic meltdown,bad Governance,cadrism, corruption,reckless borrowing coupled with bad spending tendencies during the PF!


When majority of us were dead scared of being arrested,being fired,being expelled from Universities,the duo braved the odds and sailed!

UPND Government is Working & Cannot Fail to Pay Teachers

There are some misguided opposition elements spreading rumours over the government’s handling of some newly recruited teachers. These are the people who don’t know that you rush, you crush.

When government is now working in an organized and methodical manner, they are not happy because they want shortcuts and chipante-pante way of doing things.

In just 4 years from 2017 to 2021, 10 million Kwacha was found in diverted salaries into their personal accounts and other accounts belonging to individuals who are not in public service. 9,800 ghost workers were found with over 700 million Kwacha paid to these ghost workers.

There are those who benefitted from the confusion created by PF who want to paint a false hope of dununa reverse coming back and they spreading fake news against government for their own selfish reasons and not for the good of the country.

The UPND government is working and already it has employed more teachers and other civil servants in one year than the PF ever did in ten years.

There is a process, which some teachers are failing to follow and to understand the correct way of doing things. The new recruit has to be introduced on the payroll system; they must be verified, vetted and approved.

Their bank accounts must also be verified that they are valid and active to be able to be registered as the salary pay point. Mind you, 30,000 teachers who were recruited is not a small number.

Currently, the Ministry of Education payroll also needs to be cleaned up and audit queries have to be resolved because no one is going forward with the same disastrous situation in the teaching service.

This came to light barely two months ago, when the Auditor General published the report on the audit of the government payroll for the financial years ended 31st December 2017 to 2021.

Have you taken time to read this report? Its findings were a damning indication of the mess in the payroll management of government ministries.

The mess in the teaching service was particularly scandalous. Irregular recruitments were the order of the day, such that the UPND government is now working day and night to bring sanity in the teaching service payrolls.

From 2017 to 2021, the Ministry of Education overshot its budget for salaries by over 3 billion Kwacha. There are also thousands of schools, which were operating without being gazetted, and without having establishment registers.

In 2021 alone, over 300 teachers were introduced on the payroll by the PF government as teachers without authority from the Teaching Service Commission and were paid salaries.

Furthermore, when the Teaching Service Commission undertook a verification exercise, over 500 teachers were found with fake school certificates.

Shockingly, the Ministry delayed taking action on 243 officers found in possession of fake certificates, resulting in the officers who were not even working, being paid salaries amounting to 26 million Kwacha by 2021. Payments were being made to officers with forged certificates.

Over 13 thousand officers in 108 districts were on the payroll but not on the staff returns, and they were paid over 800 million Kwacha.

In 60 selected districts, almost 2 thousand teachers were not accounted for in that the Ministry did not know the officers and neither was it aware of the whereabouts of the officers but they were paid salaries totaling over 100 million Kwacha by the PF government.

Under PF, irregular recruitments and diversion of salaries Was the order of the day. Imagine in Eastern Province in 2017, someone at Payroll Management and Establishment Control Department introduced 290 teachers on the payroll in Eastern Province and attached seven (7) bank accounts with a minimum of forty-one (41) employees sharing one account. By the time this was being discovered and corrected, government had already lost six hundred thousand Kwacha and has since failed to recover the funds.

This brings us back to the issue of the recruits; these recruits should understand that there are still people in the government system who are attempting to continue the old behavior of redirecting funds to person’s accounts, gain interest then send it back in the system.

Supervising authorities need to be on top of the game. The other possibility is that recruitment process was hijacked at the end of the process and infused in names that were not approved and government is now busy trying to normalise the payroll of new recruits.

So those who are trying to take advantage of some desperate recruits are wasting their time. The same government, which recruited the teachers, is now paying them. The days of the Zambian people being used by selfish politicians are behind us, and no amount of anti-government propaganda can erase the successful and strong foundation, which the UPND is laying for our country to achieve the Vision 2030.

Petitioning The Kabushi And Kwacha By-elections Outcomes: By Law, Who Is Eligible To Petition An Election?

PETITIONING THE KABUSHI AND KWACHA BY-ELECTIONS OUTCOMES: BY LAW, WHO IS ELIGIBLE TO PETITION AN ELECTION?

IT has been reported that Peter Sinkamba, Isaac Mwanza and Institute of Law, Policy Research and Human Rights have petitioned the ConCourt to declare the election held on 21st October, 2022 in Kwacha and Kabushi as unconstitutional, illegal and null and void.

In as much as I agree with petitioners exercising their constitutional right enshrined under Art 73 of the Constitution and section 96 of the electoral process Act to petition an election and its outcome and seek those reliefs, I feel, the trio suffers from the lack the electoral legal locus standi on this matter.

It would make sense if it was Joseph MALANJI, Bowman Lusambo, any voter registered or who voted in these constituencies or indeed the Attorney General to have questioned through an election petition the election of Abel Mulenga and Benard Kanengo for Kwacha and Kabushi respectively.

I will not delve much into the nitty-gritties of the petition and its merits as that will be the job of the petitioned court to digest and discharge.

My article will mainly dwell on the legal legitimacy and eligibility of the petitioners who, I believe, are all Lusaka based who were neither voters, candidates, Attorney Generals nor elected, during the Kabushi and Kwacha parliamentary elections.

May be if it was a nomination petition under Art 52(4) it would have made sense as it empowers any person to challenge a nomination of a candidate while an election petition has owners prescribed in the subsidiary law-electoral process Act Sec 96 and 98 with reliefs outlined in Sec. 99.

To support my argument, Section 96 (1) aggressively advises that a question that may arise on the election of Member of Parliament may be heard and determined by the High Court upon an application made by any person to whom the question relates; or the Attorney General

Further, Sec. 98 of the Act illustratively guides that an election petition may be presented to the High Court by one or more of the following persons

(a) a person who lawfully voted or had a right to vote at the election to which the election petition relates [I doubt if Isaac Mwanza and the institute guys and Peter Sikamba are voters and voted in the just ended Kwacha or Kabushi by-elections]

(b) a person claiming to have had a right to be nominated as a candidate or elected at the election to which the election petition relates [I am very sure that all the petitioners had no right to be nominated as and were not candidates or elected in the just-ended Kabushi and Kwacha parliamentary elections];

(c) a person claiming to have been a candidate at the election to which the election petition relates [none of them was a candidate in Kabushi and Kwacha parliamentary elections respectively]; and

(d) the AttorneyGeneral [none of them was the Attorney General during the by-elections to assume the locus standi to petition out of 4 scenarios presented above].

Effectively, section 96(3) argues that, Subject to any rules of court, the powers, practice and procedure of the High Court in respect of the trial of an election petition shall apply, with the necessary modifications, to the hearing and determination of such applications

Sec 97(1) instructs that An election of a candidate as a Member of Parliament shall not be questioned except by an election petition presented under this Part-which is through the High Court not the CONCOURT.

Also the grounds for nullifying an election for a member of Parliament are well spelt out in sec 97(2) of the Act.

These include proven at trial stage to the satisfaction of the High Court, that a corrupt practice, illegal practice or other misconduct were committed in connection with the election by a candidate; or with the knowledge and consent or approval of a candidate or of that candidate’s election agent or polling agent; and the majority of voters in a constituency were or may have been prevented from electing the candidate in that constituency whom they preferred; and also
non-compliance with the provisions of this Act relating to the conduct of elections, and appears to the High Court that the election was not conducted in accordance with the principles laid down in such provision and that such non-compliance affected the result of the election; or the candidate was at the time of the election a person not qualified or a person disqualified for election

Clearly, sec 97(4) puts a caveat against nullifying an election based on commission and omissions by the Electoral commission of Zambia (ECZ) and its officers which seems to be one of the prayers of the petitioners.

The section states that An election shall not be declared void by reason of any act or omission by an election officer in breach of that officer’s official duty in connection with an election if it appears to the High Court that the election was so conducted as to be substantially in accordance with the provisions of this Act, and that such act or omission did not affect the result of that election

Apart from the technicality that may be arise in the face of the petitioners for by-passing the High Court to want their case heard and determined direct by the CONCOURT despite it being the first court of instance on election related petitions, the petitioners suffer from lack of legitimacy to undertake the exercise they have embarked on.

In addition, the grounds being advanced by the “petitioners” are far from being the grounds outlined in the enabling Act to warrant a trigger of a nullification of an election of an elected member of parliament by the High Court.

Further, questioning the power of the the ECZ to make regulations for better management of any election in this country is being naive to the fact that the law e.g. Constitution Art 57(3) and the Electoral Act Sec 125 empowers the ECZ to do so and trying to gag the ECZ not to make regulations it is supposed to do by any person is an illegality in itself and an abrogation of the Constitution and enabling Act

May i be allowed to refer the petitioners to Section 125 of the Act regarding the wide-ranging powers of ECZ to make regulations.

It guides that Subject to the provisions of the Constitution and this Act, the Commission may, by statutory instrument, make regulations providing for the procedure and manner of conducting elections

So how does one fault the ECZ for undertaking its constitutional and legal mandates. Let us not flood the Courts with straightforward things that need no court interpretation.

I see this petition highly likey being tossed out as brought in dead (BID) before the Concourt and for being in the right court at the wrong time or luckily, being referred back to the High Court for trial before heading to the Concourt on appeal and hope that the petitioners and their supporters will not accuse and call the Court names afterwards.

1. Hakainde Hichilema is the most fake president that Zambia has ever had. He always tries to project a false image that his Government is performing well, and yet it is a total disaster.

2. The recent revelation that about half of the newly recruited teachers have not been paid their salaries for 3 months now, adds to the long list of people who have provided goods or services to Hakainde’s Government and have not been paid.

3. Farmers who sold their maize to Government through FRA have not been paid. This includes his praise singers who are always in our inbox with messages of “tikambilenkoni”

4. Youths who were employed as Enumerators by Government through Zamstats during the just ended census exercise have still not been paid. It’s been 2 months now. Government keeps on changing its statement on this matter, monga nimukazi wamene bagwila uhule.

5. The athletes who represented the country during the commonwealth games a few months ago were never paid their allowances. Instead, Ministry of Youth and Sport Permanent Secretary, Kangwa Chileshe decided to insult them by telling them that they can be replaced anytime. The DSA allowances we are talking about was just about $300 per night. The entire UPND Government has the foul language of a Kachasu Brewer. Competing namanyozo with us in the opposition.

6. All suppliers who were owed by Government when UPND took over, have not been paid a single Ngwee, under the pretext that they are still being audited. Hakainde does not understand that there has to be continuity of Government despite changes in administrations. The business community needs to have confidence that the Government of the Republic of Zambia will honor its financial obligations regardless of who the President is.

7. As the biggest player in any economy, the business practices of a Government has a direct impact on the economy. Here in Zambia, we now know that Hakainde’s Government doesn’t like to pay nkongole, even to small creditors like peasant farmers, youths who conducted the census, athletes who represented the country at commonwealth games etcetera.

8. Indeed, Hakainde Hichilema is the equivalent of a father who is always smartly dressed to the public and smelling of expensive perfume but ninshi kunyuma akangiwa kugula unga mambala.

Dear readers, for a starter, do you even know who this Angela Muchinshi is?

In case you don’t know, Angela Muchinshi is a PF’s Smart Eagles Facebook page Reporter who up to today is still on the PF payroll.

This is a girl who has aborted Six (6) pregnancies of different top PF officials. And unfortunately, News Diggers can’t read between the lines that this is a plant set on them by Chitalu Chilufya, Bowman Lusamba, Stephen Kampyongo, Joe Malanji, Kennedy Kamba and Antonio Mwanza.

In addressing this girl, we would like to advise her to continue helping her party PF in a more organised and smart manner as opposed to turning News Diggers into her toilet tissue paper unless she is being sent by its management working with the past, present and future corrupt elements in this country.

Young Girl, Angela Muchinshi, abusing your body to get a job at News Diggers and PF is not an achievement for you to further allow abuses even from named rogue individuals. Keep that body busy with productive activities as opposed to lifting legs like swinging pendulum at PF’s Ndozo Lodge and some names PF apartments.

Koswe has seen President Frederick Chiluba come and go: President Levy Mwanawasa come and go: President Rupiah Banda come and go: President Micheal Sata come and go: President Edgar Lungu come and go: and it has seen President Hakainde Hichilema come into power and Koswe will also see President Hakainde Hichilema leave office after his two terms as per Constitution. In short, Koswe was there, is here and will be there because Silelo Tayamba!

Serena Williams says she has ‘not retired’

In her first public appearance following her emotional farewell at this year’s U.S. Open, Serena Williams said she’s actually yet to hang her racquet and her chances of returning to the court are “very high.” According to The San Francisco Standard, the 41-year-old tennis great touched on her career and made the clarification during an appearance at TechCrunch Disrupt in San Francisco last Wednesday.

“I am not retired,” she said. “The chances [of me returning] are very high. You can come to my house and [see] I have a court.”

The last competitive tournament Williams played was September’s U.S. Open. She bowed out of the competition following a third-round defeat to Ajla Tomljanovic. And though it was initially thought Williams was going to take a permanent breather after the competition, she told TechCrunch editor Jordan Crook that there’s a likelihood of her returning to the court. Williams was at the event to promote her Serena Ventures investment company. The firm secured outside funding to the tune of $111 million this year.

“I started this company a while ago, so I just jumped right into that,” Williams told Crook. “I didn’t even think about the whole retirement.

“I still haven’t really thought about it. But I did go on the court the other day and [realized] for the first time in my life that I’m not playing for a competition and that felt very weird,” she added. “It was like the first day of the rest of my life, and so far, I am enjoying it. But I’m still trying to find that balance.”

Prior to the U.S. Open, Williams penned an essay in Vogue where she talked about hanging up her racquet after playing competitively for almost 3 decades.

“I have never liked the word retirement,” Williams wrote. “It doesn’t feel like a modern word to me. I’ve been thinking of this as a transition, but I want to be sensitive about how I use that word, which means something very specific and important to a community of people. Maybe the best word to describe what I’m up to is evolution.”

She added: “I’m here to tell you that I’m evolving away from tennis, toward other things that are important to me.”

Whether Williams returns to the court or not, her status as one of the greatest and most decorated tennis players in history cannot be overestimated. Off the court, the tennis great through her Serena Ventures has invested in over 34 startups over the past five years. The majority of the investments have gone to companies founded by women and minorities.

“It was supposed to be about creating opportunities for others,” Williams told Crook at TechCrunch Disrupt. “But it ended up being sort of the opposite.”

“We’re looking for founders with a personal connection to the problem they are trying to solve,” she added. “I want to know that [the founder] is not doing this to fill in a space or take advantage of an opportunity, but because it is near and dear to them.”

Economic and Equity Party – EEP President Chilufya Tayali has called on Zambians especially opposition political parties to be part of an Alliance that will lead to the formation of the Government of National Unity whose agenda is to put Zambia first.

Mr Tayali said that the unity of the opposition political parties is very real, as they have been having discussions and interactions on the Alliance, and he is happy that a lot of people have welcomed the idea of forming an Alliance where they put Zambia first.

“Things are going on very well, am encouraging Zambians to be part of the Alliance, as we are all gifted differently and some of you are intellectuals who are learned and understand things from a different perspective, am also encouraging the young people to be part of this Alliance and offer whatever they can. Let us all unite by putting Zambia first,” Mr Tayali said

He mentioned that looking at the agenda of the Alliance which is to put Zambia first, people should forget about the political party affiliations which they belong to but everyone at this point in time should come together irrespective of the different political ideologies, and affiliations.

“From my point of view, am very grateful with a number of opposition party leaders who have shown positivity in this and are willing to work together, am so humbled and praying that we succeed in this Alliance,” he said

Mr Tayali has urged members of the ruling United Party for National Development (UPND) who have seen that President Hakainde Hichilema doesn’t mean well for this country are free to come and join the Alliance as the Alliance is not excluding the UPND but rather including reasonable UNPND members to come forward.

“I know in UPND there are some people that mean well for this country, and those who are indoctrinated by not thinking properly should continue staying in UPND,” Mr Tayali said

“Whether President Hichilema likes it or not, his going as he has failed and the UPND is gone,” he added

He explained that the independence that we are celebrating now means that, this country belongs to all Zambians who are supposed to be part of the leadership of this country, the independence that the fore father won meant that people have attained that self-rule, as they were being ruled by the colonizers the British but the forefathers fought by saying they want to rule themselves and 58 years ago they lifted the flag of independence to say they have attained self-rule, that is what independence means.

Mr Tayali said that because of this independence that was attained, young people should not relegate the responsibility of running this country to only a few individuals, all the young people are supposed to be part of the governance of this country.

“Am emphasizing that all the young people are supposed to be part of the leadership of this country, don’t seat back and wait for President Hichilema to appoint you or give you a join in the government and now you will feel like you are part of the governance, no, by the fact that you are born Zambian, you are supposed to be part of the leadership of this country, don’t allow a few individuals to take this country into oblivion and disaster,” Mr Tayali mentioned

He disclosed that young people can be part of governance by making sure that they speak out on the issues relating to the governance of this country, young people should not shun away from this by stating that they don’t talk about politics or anything related to politics, everyone should talk about the governance of the country as politics affects everyone including the church.

“All of us are supposed to talk about politics and the affairs of this country,” he said

Mr Tayali has since called upon all church leaders not to sit back and let the affairs of the country to only be in the hands of the politicians as the church is also a part of this country and therefore leaders in the church should also contribute in the affairs and the running of this country.

“The issues of politics should not be relegated, even the church and Pastors should be free to discuss politics,” he stated

He noted that the intervention of the church through prayers and advice will help the politicians to come up with ideas that will be of great benefit and work for the country.

“Am encouraging church leaders to come forward to talk to politicians and pray for us, we need to heal, and unite this country which is highly broken,” Mr Tayali said

Electric Bus Unveiled in Kenyan Capital

A Nairobi-based green mobility company on Wednesday unveiled an electric bus its inventors hope will encourage environmentally friendly commuting in a city where smog-belching minivans are a far more familiar sight.

The brightly painted bus pulled out into the notorious morning traffic in the city of nearly five million, which lacks a state-run transport network — even though it is the capital of East Africa’s economic powerhouse.

The city only has one charging station and electric vehicles remain a rarity on its roads, despite the government slashing taxes to try and spur their uptake.

But that has not deterred Roam, the Kenyan-Swedish company behind the 77-seat bus, which sees its debut as something of a milestone for Nairobi.

“This represents a shift towards better transport where we can have people ride in comfort and enjoy the ride with a clear conscience, because we are talking about zero emissions,” Roam’s project coordinator Dennis Wakaba indicated.

The company says its flagship model is the first equipped to ply Nairobi’s rapid transport system, which provides priority lanes for buses to get around the city.

The electric bus has a top speed of 70 kilometres per hour (43 miles per hour) and a battery pack allowing it to travel 360 kilometres before requiring a recharge.

It takes just two hours to fully charge the battery.

Most commuter transport is privately operated in Nairobi and Roam said fares on the electric bus would rival those offered by its smoggier competitors.

‘Towards a greener future’

Eighty percent of Nairobi’s commuters use matatus — minivans that are poorly regulated and maintained, and known for hair-raising manoeuvres and trails of black smoke streaking behind battered chassis.

“For a long time, Nairobi was known as the green city under the sun. That glory has been fading away, but we want to bring that life back,” said Wakaba.

“Nairobi has been seen as a leader of innovation and we see it as a good start point to deploy these buses.”

Kenya sources most of its energy from renewable resources and is seeking to cut CO2 emissions by 32 percent by 2030.

The transport sector accounts for 12 percent of Kenya’s emissions footprint — though that figure rises to 45 percent in Nairobi, according to government figures.

It is estimated that less than 500 of Kenya’s 3.5 million cars are electric, despite the government making them cheaper than ever to purchase.

Roam — which also manufactures electric safari vehicles and motorbikes — says it plans to roll out 100 electric buses over the next year.

Earlier this year another electric mobility startup, BasiGo, unveiled a 25-seater bus with a 250-kilometre range for Nairobi’s roads.

Paul Njokah, sitting behind the wheel of the new electric bus, said cleaner vehicles would go some way towards improving pollution in the city and its associated health problems.

“Kenya’s transport industry is sobering up. We will see more electric vehicles and civility on the road,” clarified 60-year-old Njokah.

AZWELL Banda says the UPND and Hakainde Hichilema have demonstrated extreme naivety and shocking ignorance about the state of the world and the global balance of power.


Reflecting on our Independence Day, Banda, a Zambian practicing Marxist and lifelong trade unionist, said today for Zambia “it could not have been at a worse time to be saddled with a pro-Western, pro-US and neoliberal government such as President Hakainde Hichilema and his UPND”.


“The UPND and Hakainde have so far demonstrated extreme naivety and shocking ignorance about the state of the world and the global balance of power, and how a poor but resource rich post-colonial country like Zambia must navigate the current volatile and completely unpredictable world,” he said. “Rather than place Zambia and Zambians at the heart of all their policies and programmes, they have prioritised the IMF, the US and the EU – all institutions dominated by a US whose wanning global hegemony and power is being challenged by Russia, India and China, and all self-respecting non-Western European powers.”


Banda said by August 12 last year when Zambia held its elections, “it was very clear that the US and the Western European dominated global capitalist economy was experiencing severe and terminal systemic and structural crises”.


“And that the world was poised for major wars, including a possible Third World War – a nuclear war – if the crises in the global capitalist system were to be dissolved, temporarily,” he argued. “There has never been a worse time for any post-colonial country to align itself with the US and the West than today. The US and the West have not only plunged the world into a global economic crisis which will punish poor countries like Zambia more and horribly, they are proving every day that they have no moral, philosophical, intellectual, ideological and political leadership capable of moving the world capitalist system out of its irresolvable crisis.”


Banda said the chaos in the British and US political systems are “a reflection of economic and social crises which have been brewing in these major capitalist and imperialist countries for a long time”.


“None of the political parties in the US or the UK can resolve these crises. And so, they resort to the only means they know best: wars to distract their local populations from the deep vicious domestic and international social and economic crises they have generated in the first place. From these wars, they hope to both profit massively, and re-engineer the geopolitical status of the world in their interests,” he said
Banda said proof that President Hichilema and the UPND are puppets of the US and the West, “and not good for Zambia is evidenced by the fact that neither the US nor the West will protest seriously at the erosion of the little democracy in the country by HH and the UPND government, as witnessed in the illegal, chaotic and thoroughly unconstitutional and undemocratic by-elections in Kabushi and Kwacha constituencies”.


“Historically, both the West and the US, in pursuit of their national interests in the post-colonial world have happily connived and worked with murderers, dictators and all sorts of undemocratic politicians and governments. UPND Chitambo District Commissioner Pastor Evans Chola, has been repeatedly cited for a habitual tendency of; using the state police and government resources, to pursue, muzzle and perhaps indict any potential individuals or party officials in the ruling party, who seem to hold dissenting voices or opposed to his way of administration.

In a latest development, UPND newly appointed Chitambo District Chairman Mr Paul Ndaibamba, has become the latest victim of what seems like, an autocratic habit by the District Commissioner, to silence leaders, party members and even civil servants in the district, barely two weeks of the UPND Chairman being appointed chairman on 5th October 2022.

In a telephone interview with our reliable sources, Mr Paul Ndaibamba (48), has reported that he fell prey last Friday on 21st October 2022, when his residential home was visited by Five (5) police officers from Serenje Zambia Police command to deliver a summon or police call out, demanding for his appearance at Serenje Police Command, on Tuesday 25th October 2022. At the same time, his son Paul Kababa (22) to whom the police officers purported as the owner of the summon but was not available, as he was attending a funeral service in Serenje on the material day, a fresh accusation of insulting the District Commissioner, sometime last month in Gibson area of Lulimala ward, also came up.

”We have been reliably furnished with the information that, the Chitambo District Commissioner, sanctioned and instructed the police, using government resources, to deliver the summon and the content of the summon, was “Asking Mr Ndaibamba to report or avail himself and help in the ongoing investigations with very vague message, creating anxiety and leaving the chairman to panic””, our source disclosed.

What even makes more interesting reading is that, such summons are not happening for the first time in Chitambo District. Therefore, Chitambo Times has taken keen interest in this particular matter, as history seems to be repeating itself. The first victim to these police intimidations, interrogations and even unlawful detentions, was an employee of a named manganese mine in Nakatambo Ward of Chitambo, who was arrested, bundled in a police vehicle and arrested like a common petty thief, on tramped charges, by simply overstepping his bounds or threatening the DC’s interest. Were Chitambo DC’s interest is threatened, he is not afraid and willing to go to greater lengths and depths, to imprison just anybody. As though that is not enough, Chief Chitambo (V) of the Lala speaking people was also incarcerated and locked up in police custody, Six months after UPND formed government under the instructions of Pastor Evans Chola.

Our greatest concern and interest in this circus is that, how in the world, can a District Commissioner, reduce himself to be pursuing personal vendettas using state machinery and resources, at the expense of the same taxpayers, to settle scores with them?? Is this the New Dawn kind of administration that people voted for? Are we made to believe that, the District Commissioner a direct interface of state house with the electorate, is doing this with the full blessing of President Hakainde Hichilema? If not, then we are interested to see and actually invite the Anti-Corruption Commission and other investigative wings, to pursue Pastor Chola, before TARNISHING THE IMAGE OF THE PRESIDENT. Otherwise silence over this matter, will be taken as, it has the full blessing of state house.

Other independent members of the community and the civil servants within Chitambo District, have also expressed great disappointment and dissatisfaction, with the attitude of the District Commissioner, as he has been conducting himself in a very unprofessional manner.

However, we shall give you more updates today, as the UPND Chitambo District Chairman appears before the police, in obedience and response to the statutory police call out.

Adidas has ended its partnership with Kanye West

Adidas has officially ended its partnership with Kanye West over the rapper’s antisemitic comments.

The brand came under intense pressure to end the collaboration after West, known as Ye, claimed in a since-deleted interview with Drink Champs podcast that he could make antisemitic comments and he would still have Adidas’ support.

In a statement released on Tuesday (25 October), Adidas said: “Adidas does not tolerate antisemitism and any other sort of hate speech.

“Ye’s recent comments and actions have been unacceptable, hateful and dangerous, and they violate the company’s values of diversity and inclusion, mutual respect and fairness.”

Adidas joins Balenciaga in cutting ties with West, as well as Vogue, in the aftermath of his comments. Balenciaga announced on Friday (21 October) that it “no longer has any relationship nor any plans for future projects related to this artist”.

Shortly afterwards, a spokesperson for Vogue told Page Six that neither the publication nor editor-in-chief Anna Wintour intended to work with the rapper going forward.

“Anna has had enough,” the source was quoted as saying. “She has made it very clear inside Vogue that Kanye is no longer part of the inner circle.”

“The thing about me and Adidas is, I could literally say antisemitic sh*t and they can’t drop me,” the rapper is seen saying in the video. “I could say antisemitic things and Adidas can’t drop me. Now what?”

Last week, Twitter and Instagram locked West’s accounts due to posts that were deemed antisemitic, including a tweet in which the rapper said he would soon go “death con 3 on Jewish people”.

According to the AP news agency, the now-removed tweet added: “You guys have toyed with me and tried to black ball anyone wheoever opposes your agenda.”

On Instagram, West posted a screenshot of a text message exchange between him and Sean “Diddy” Combs in which he suggested the latter was being controlled by Jewish people.

It came after Diddy posted a video on Instagram urging his fans not to buy West’s “White Lives Matter” T-shirts, which he debuted in his Yeezy runway at Paris Fashion Week.

West’s ex-wife Kim Kardashian also condemned his remarks and said publicly that she “stands together with the Jewish community”.

In a tweet on Monday (24 October), she wrote: “Hate speech is never OK or excusable. I stand together with the Jewish community and call on the terrible violence and hateful rhetoric towards them to come to an immediate end.” – The Independent

FIXING THE PUBLIC ORDER ACT: SOME EXPECTATIONS.

To be free is the greatest human right one can enjoy. One must be free from oppression and enjoy his or her freedoms of movement, assembly, association and expression. One must also be free from poverty, hunger, disease and ignorance.
The political freedoms are currently enshrined in our Zambian Constitution. Never again should Zambians go back to colonial days to start fighting for basic fundamental rights and freedoms of assembly, association, movement and expression. Let us enjoy the rights and freedoms that our forefathers and foremothers fought for prior to independence in 1964.

However, in trying to enjoy these rights and freedoms, there is still a colonial piece of legislation called the Public Order Act which is hindering the full enjoyment of fundamental rights and freedoms of the people of Zambia. It is good that the New Dawn Government of the United Party for National Development agreed to repeal and replace the archaic Public Order Act.

The proposed new Public Order Act should reflect and provide for the elimination of areas or issues that bring conflict and work against the realisation of public order.

1. Political party branches in markets, bus stops and other public amenities such as hospitals should be prohibited in order to de-politisize these places.

2. Political party flags at public places such as bus stops and markets should be prohibited.
3. The wearing of political party regalia such as t-shirts, caps, chitenge and other clothing in public should be allowed under the Act. But the wearing of masks and clothing that resemble military uniform should be prohibited. Anybody who victimises someone wearing party regalia should be punished under the law.
His Excellency President Hakainde Hichilema should be commended for banning caderism in markets and bus stops. People are now free to trade and wear party regalia in public. But this remains an administrative measure which is not bucked by law. Another leader might emerge in future who may allow caderism again. There is need for legislation against caderism.

4. The use of vehicles without number plates in an election process should be prohibited. Similarly, the use of many vehicles with the same number plate should be prohibited.
5. Wherever a dispute arises over the use of a venue, time, road or airspace, regard should be
given to the principle of ” first come, first served “.
6. Aircraft flying permits should not be denied during elections to disadvantage a competitor from campaigning.
.
7. A meeting of a competitor shall not be denied on the basis that there is another meeting of another party in the same town or province provided that there is no clash on the venue.
8. In policing a public event, a police officer shall not wear masks or hide his/her identity or face.
9. The use of heavy weaponry and live ammunition against defenceless and peaceful civilians should be prohibited to avoid extra-judicial killings.
10. The use of teargas to disperse civilians in rooms or enclosures should be prohibited to avoid suffocating people to death.
11. Indoor meetings such as press conferences, workshops, seminars, in-house institutional gatherings and board meetings should be exempted from the provisions of the Public Order Act. I recall some incidences where press conferences by the UPND at Chainama Hotel were disrupted by the police during the PF regime because there was no “permit”.

Similarly, the Act should exempt Members of Parliament , Mayors, Council chairpersons, Councillors and other Constitutionally elected officials from being required to notify the police during the discharge of their duties.
12. A person or group of persons shall not plan or disrupt the assemly, procession, peaceful demonstration or meetings of another party or grouping.

13. The Act should be amended to delete the requirement for a police permit and replace it with notification to the police in writing. This is in conformity with the Supreme Court ruling in the Christine Mulundika case.
14. A police officer shall not deny or stop any procession, assembly or public meeting for which a notice was properly given by the converners.

15. Where a seven days notice has been given by the converners, police should respond to the notice at least five days before the event. If no response is received by the organisers two days after receipt of notification, the notification should be deemed to have “no objection “. Where police have an objection, they should provide an alternative date,time snd place within 10 working days or any other later date, time and venue agreed with the organisers.

In the past, police would wait ,after giving them notification , until a day before the event to object to the notice. This created problems because the organisers had already spent time and resources organising the event. Even if a go ahead is given in the eleventh hour, it becomes difficult to adequately organise the event, resulting in failure in the event taking place. This strategy was used by the police to make the opposition fail to hold rallies.
16. After the police have given a “no objection ” response, they should have no further power and authority to stop the event from taking place. This is actually in conformity with the ruling of the Supreme Court in the matter of the Resident Doctors Association.

17. A police officer or any public officer who acts professionally to apply the Act in an unbiased manner and without fear or favour shall not be victimised, demoted or dismissed as a result of his or her decision or action. Similarly, an officer who fails to act in accordance with the provisions of the Act should be deemed to have committed an offence and liable to punishment.

In conclusion, I wish to state that we should make laws that will cure problems in society rather than protect the interests of an individual or group of individuals who may be occupying public office at present. The country is lucky at present to have President Hakainde Hichilema who is committed to respecting human rights and freedoms. In future, Zambia may have a rogue who will not respect human rights and freedoms. It is therefore incumbent upon us to make laws that will stand the test of time and develop institutions that will protect and defend people’s rights and freedoms of assembly, association, movement and expression.

MY STANCE ON THE AWARD OF THE ROAD

Yesterday I asserted that the award by the Road Development Agency and the PPP Council for the Ndola-Lusaka Dual Carriageway Project has already been given to AVIC Consortium, which is officially called Macro-Ocean Investment Consortium (Messrs AVIC International Project Engineering Company, Zhejiang Communications Construction Group Co Limited and China Railway Seventh Group Co Limited) or the MOIC Consortium. I indicated that the announcement has delayed because a lot of wrong things were being done around the whole tender awarding process. I made my submission and I am making this one because we need the tender either redone so when AVIC gets the concession Zambia does not lose our or it is given to Velos Consortium, who are a Zambian entity and have followed the tender guidelines. I have no problem with AVIC getting this done if the right things are done. Right now we are in trouble!

As expected, our friends from the PF party attacked me and called me names for stating the obvious. Now Let me reiterate what I have saying for the last 5 months or so. As a proud praise singer, I always remained constant and consistent on these matters. I believe the best bidder for this project was and remains the Velos Consortium. This is mostly because they are local. Local is Lekker. Secondly, the companies in the Velos Consortium have been successful in their PPP projects thus far in Zambia and have the money to do the road. But I believe RDA, Ministry of Infrastructure and others have been biased, wrongly, towards AVIC. This, in the long run, won’t help us as a nation at all. Underline, I believe. So don’t sue me or attack me for my personal beliefs. When I started writing these development topics, I knew I would create enemies and could even be violently attacked for it but I soldier on for a better Zambia.

And have you noticed how our PF friends, who always sing songs that UPND are puppets of the West and of other foreigners and so give business for foreigners, have switched to singing that on this Ndola Dual carriageway, this Zambian consortium should not get the business? They are not singing their usual anthem of supporting local suppliers so we can keep all the money within the country. They have been advocating for contracts to be given to Zambians that are capable. When this looks possible on this road, they are now complaining. Why? Their benefactor AVIC getting this project favours PF. I believe that AVIC International is too close to PF to be treated with kid gloves. The same soft approach of leaving enemies behind has always come back to hit UPND hard. Government is simply funding PF by giving this project to AVIC. Lessons should be learnt.

Personally I don’t have a problem with AVIC having the tender. What matters is whether the award is free from blame and the deal is good for the country. But will a Chinese entity be willing to play the long term game of waiting for 25 years to get back its investment? Will the Chinese entity treat Zambians well as employees in toll gates and during construction and later rehabilitation works? Won’t AVIC hold this road for ransom seeing that it is owed more than USD 500m by the government from deals done during the PF era? Isnt AVIC proposing to lay off half the current toll-gate workforce and force government to pay redunduncy packages?

If we have to give AVIC the contract, let us not do it because we have to please China for helping us restructure debt in order to get the IMF deal. Lets give it to them because they are the best concessionaires. Otherwise we are better off giving it to the Velos Consortium, which is by Zambians and will benefit more Zambians in the process.

I have always said, remember that strategic decisions should always override everything else when doing such projects. This is President HH’s flagship project for his first term. RDA, PPP Council and Ministry of Infrastructure should not mess this up.

RDA, the PPP Council and the Ministry of Infrastructure have not done enough to give locals an advantage especially allowing tendering to be a clean game with no hidden incentives. The fact that funding is coming from within Zambia and not entirely from china makes it possible a local consortium to do the job. On this project, despite the local bid looking more attractive, the government evaluators seem to have had their minds were made up way before and broke all rules and also lost their sense of shame to award AVIC.

Detailed confidential reports have been submitted to the PPP council by the RDA on the proceedings of the ongoing negotiations. These reports have been compromised and have found their way in the hands of the MOIC consortium, who have been compromising some members of the PPP Council as well as within members of NRFA to accept their proposal which includes a Reduction in the Scope of Works, and the transfer of Design, Specifications, Operations and Maintenance Risks to the government.

Additionally, legal opinions have been provided to the PPP Council in the Negotiation Reports concerning the consequences of accepting the adjusted Concession Agreement provided by the MOIC Consortium, but the PPP Council seems to think otherwise.

It is not surprising therefore that the MOIC consortium has been stating that the Lusaka – Ndola Dual Carriageway Project has already been given to them by the Government of Zambia, even before the Negotiation procedures have been concluded. This means that they have influenced some members of the PPP Council, who have been compromised.

The MOIC Consortium also seems to be taking advantage of Government’s hurry to start rehabilitation works on the road and are holding them to Ransom. They are adamant on the Variant Bid, which they have submitted and are standing their ground on the deleted provisions of the Concession Agreement and Schedules whose risks they are forcing the Government to assume. Some senior members of the Government Negotiation Team have been threatened with dismissal by their superiors if they do not move to conclude the negotiations in favour of the MOIC Consortium. The fact that these team members are working under duress will definitely pave way for a Concession Agreement, which will disadvantage the Government and in future cause Zambia to suffer financial losses and suffer serious financial claims from MOIC, who would have put no Foreign Direct Investment in the project.

There are many problems with this project set-up apart from no FDI being involved and other issues I raised yesterday.

MORE ISSUES WITH THE AVIC BID

Yesterday I had a lot to write but that would have meant a longer article and less readers. So let me continue in this part 2. We have highlighted some of the concerns which make me uncomfortable with this proposed PPP project. I will continue with more so we all have a healthy discussion on this

1. AVIC BID IS NOT COMPLIANT: Yesterday I demonstrated that the AVIC bid was non-compliant because it did not respond to the specific terms of reference as outlined in the Request for Proposals (RfP). AVIC submitted a variant proposal which was still allowed surprisingly. Normally, alternative proposals, if permitted, should only be considered if the bidder has first submitted a compliant bid, which satisfies all the requirements of the RfP. If their compliant bid is the best evaluated, then the alternative bid can be considered. In this case, the AVIC bid just ignored what we Zambians want and they have arrogantly stuck tot heir plan and still insist on getting the job and deny government of revenue for many years.

2. UNDERPLAYING PROJECTIONS: Yesterday I highlighted that AVIC had underplayed figures in projections. This is dangerous as it will leave us a a poor road which can even survive the 25 years of the concessionaire and worse wont give us anything to use beyond the concession. For example, with regard to the Projected Equivalent Standard Axles (ESAs), the Lusaka-Ndola Dual Carriageway should be designed to probably carry between 60 to 80 million Standard Axles over the 25 year concession period. But AVIC says 20 million is adequate over 25 years! How? The other risk which should ordinarily be allocated to the private sector is traffic volumes over the concession period. The Chinese do not want to take this risk and so they have decided to downplay the figures to be on the safer side but we end up losing a lot in reality as they will mint as a result. And someone within government will sign off this, retire to their farm and leave the rest of us carrying this tab for the next 25 years!

3. THE CHINESE DO NOT WANT A PROPER PPP: I already explained yesterday that the Chinese don’t want going into a PPP proper i.e. a Build Operate and Transfer (BOT) model. Meanwhile we as Zambians want a PPP to save the country from more debt. The Chinese are used to Engineering, Procurement and Construction Contracts (EPC Contracts), occasionally known as a “Turnkey Contracts”, where they make their money and walk away after 4 or 5 years. In an EPC Contract, the contractor (“EPC Contractor”) holds the responsibility towards the design, procurement, construction, commissioning and handover of a project. This, the Chinese love because they are then in charge of procurement, supervision etc and use their materials from Chinese, their staff etc and little of local materials and staff get engaged as a result. The risk of operating the Ndola-Lusaka Dual Carriageway road project for 25 years is too high for the Chinese to get into such a long-term deal. This is why you see them trying hard to transfer the risks onto the Zambian government. And we have touched on some of the risks which are inherent to PPP projects in the Road Sector.

4. ABUSE OF NAPSA AND WORKERS’ COMPENSATION FUND MONEY: Taking of risks and risk taking, we have to remember that a PPP is fundamentally an allocation (or sharing) of risks between the private sector as well as the public sector. The rule of the thumb dictates that each risk is best allocated to the entity which is best suited to handle it. Messrs AVIC international coming into this partnership as a private entity should be allocated the financial risk. They should bring capital with them and not access NAPSA funds which are already a public sector funds. Using NAPSA and Workers Compensation Fund funds is as good as government or the public funding this project. And why should we use public funds and not allow government to get any share of the revenue due to some cunning projections made in the contract? Those in the government negotiating team must protect the government the public. Note further that road tolls are generally exempt of taxes so GRZ would only impose taxes on profits. Imposing taxes on road tolls would be double taxation for motorists. So does it make sense then for AVIC to be getting toll-gate fees without taxes for many years despite not giving us the design of the road we want because they want to save funds and take less risks?

5. THIS IS NOT A GREENFIELD PROJECT: This is not a greenfield project as there is an already an existing carriageway, albeit not in a very good condition, This carriageway is sufficient to be added as equity for the public entity (government). This existing thoroughfare already has tool gates on it and is already making money. Therefore, those negotiating should question the Financial Proposal by AVIC and demand that the projected toll revenues are shared between the public and private entity, The sharing can even be as low as a 10-90 percent as the ballpark figure for consideration as this is a brownfield PPP road project. The next day after inheriting the road, the concessionaire will be making money from toll-gate without having done anything yet. A revenue share is therefore not negotiable. Those signing this deal must make sure there is revenue sharing from day one.

6. LACKING LOCAL CONTENT AND WILLINGNESS TO PAY TOLL GATE FEES: As you I highlighted in my previous analysis, any local private proponents should have been given priority points against foreign concessionaires as part of affirmative action. PPP projects tend to carry sociopolitical risks which later affect Acceptability and Willingness to Pay (WTP). We may have heard last week on social media sentiments that GRZ had “sold” the Toll gates. This can be negative if the ownership of the project is not properly handled. People will end up shying away from paying and this will dismally affect the viability of the project. Such sentiments and willingness to pay are what led to the collapse of the Zamtel Lapgreen PPP and the RTSA Speed cameras with Austrian firm Kapsch. When Lapgreen came in as a foreign concessionaire without any local content, the agreement was marred with resentment and socio-political antagonism. Same with Kapsch PPP despite Kapsch being a renowned firm which handles highly technologically advanced PPP road projects in the USA and in Europe. They partnered with Lamasat who were not regarded as professionally local. It is very important that the proposed concessionaire has the following attributes: local content and representation in shareholding and if they’re foreign, they should bring their own foreign capital through an escrow account to be regulated through the central bank. These two points will always increase acceptance of PPP projects and WTP not only in Zambia but also in other jurisdictions. Anything else will not help the situation.

7. AVIC MAY NOT BE FLEXIBLE TO OTHER ROADS TO CB: AVIC has proposed doing the road in phases, Shockingly they are also proposing to doing components on certain conditions coming into play. These proposed variations remove from the picture by-pass roads and fly-over bridges at the beginning. The challenge is for the negotiating teams to marry the need for the investor to recover the investment within the period of the concession as advertised while also there is flexibility everyone to gain. AVIC may not allow flexibility should we try to open up new road connections along the same route. PPP projects is not properly handled end up locking investment in other areas the way the Kasumbalesa concession had stopped the development of Mukambo and Sakanya borders. We need the flexibility whereby GRZ is not locked in the deal, so that if need arises for another road network to easy movements, the concessionaire consortium should be compensated for the loss in revenue and the new development should go ahead. We don’t want to go the Kasumbalesa border way where we agreed not to develop Mukambo and Sakanya borders. We can’t develop these two borders until the Kasumbalesa concessionaire has recouped its investment as agreed.

8. NO SUBCONTRACTING BENEFIT: Experience of working with AVIC, which is the lead member of the MOIC Consortium, shows that they never give away sub-contracts to Zambian Contractors. So no benefit will come to any small contractor even though the law indicates at least 20% sub-contracting. In fact from my intel, they want to only have 5% for sub-contracting locals and even then they will not give anything to anyone and little will be done to them.

Aston Villa comfirm Unai Emery as their new manager just four days after sacking Steven Gerrard

Premier League club, Aston Villa have confirmed Unai Emery as their new manager, and is expected to take over next month pending the outcome of his work permit application.

Villa made the move on Monday to pay Villarreal the £5.3million clause to release Emery from his contract, and he is believed to have agreed a three-year deal to succeed Steven Gerrard.

Emery is poised to return to the Premier League three years after he was sacked by Arsenal, where he was in charge for a little more than a season.

Caretaker-boss Aaron Danks will again be in charge for Saturday’s game at Newcastle while Emery waits for his ‘work permit formalities’ to be completed. Emery looked set to take charge of Newcastle last season only to have a last-minute change of heart.

‘Aston Villa is delighted to announce the appointment of Unai Emery as the club’s new Head Coach,’ Villa said in a statement.

‘Unai joins from Villarreal, whom he led to Europa League success by beating Manchester United in the final in 2021 as well as the semi-finals of the Champions League last season.

‘A highly experienced top level coach who has managed over 900 games, Unai has also previously managed in the Premier League during a spell with Arsenal, leading the Gunners to a Europa League final.

Pakistani news anchor, Arshad Sharif is shot dead in Kenya months after fleeing his home country over his support for ousted PM Imran Khan

A top Pakistani news anchor has been shot dead in Kenya just months after he fled his home country to avoid arrest over sedition charges.

Arshad Sharif, a frequent critic of current Pakistani Prime Minister Shahbaz Sharif and the nation’s powerful military establishment, was also a supporter of former prime minister Imran Khan, who was ousted in a parliamentary no-confidence vote in April.

‘I lost my friend, husband and my favourite journalist today, as per police he was shot in Kenya,’ his wife Javeria Siddique tweeted.

Kenya’s Independent Police Oversight Authority (IPOA), a civilian watchdog, has started an investigation into Sharif’s killing, IPOA’s chairwoman Ann Makori told journalists in a news conference today.

‘There’s an alleged police killing of a Pakistani national at Tinga market, Kajiado county, last evening. Our rapid response team has already been dispatched,’ she said.

Pakistan’s foreign ministry said its high commissioner in Kenya was in touch with Kenyan police and the foreign office and a police report is awaited.

In August Sharif interviewed senior opposition politician Shahbaz Gill, who said that junior officers in the armed forces should not follow orders that went against ‘the will of the majority’.

The comment led to the news channel being briefly taken off the air and an arrest warrant being issued for Sharif, who then left the country. The channel ARY later said it had ‘cut ties’ with him.

Gill was detained following the interview and Khan’s criticism of the judiciary for the detention led to his own court appearances.

Pakistan has been ruled by the military for several decades of its 75-year history and criticism of the security establishment has long been seen as a red line.

‘ARY anchorperson Arshad Sharif embraced martyrdom after he was shot dead in Kenya… the local police is investigating,’ ARY TV tweeted Monday.

Pakistan’s foreign ministry confirmed the incident.

‘I am deeply saddened by the shocking news of journalist Arshad Sharif’s tragic death,’ Prime Minister Sharif said on Twitter.

Former prime minister Imran Khan also condemned the death and said Sharif had been murdered for his journalistic work. He called for a judicial investigation into the incident.

Earlier this year, a court in Islamabad ordered Pakistan’s intelligence agency and the police to stop harassing Sharif after his lawyer petitioned the court, saying his client’s fundamental rights were being violated by security officials.

Sharif’s lawyer, Faisal Chaudhry, said judge Athar Minallah, chief justice at the Islamabad high court, also summoned police representatives and those from the Federal Investigation Agency to appear before him to explain their position.

The order by Athar Minallah, chief justice at the Islamabad High Court, followed petitions from Sharif and two other journalists Sami Abrahim and Moeed Pirzada, who are known as critics of the military and were fearing arrest.

LEGALITIES OR ILLEGALITIES OF KABUSHI AND KWACHA BY-ELECTIONS: WHAT IS THE TRUTH

The just-ended by-elections in KABUSHI AND KWACHA have attracted mixed reactions from mainly political and social comentators not contestants.

With others calling the by-elections as a sham, others, an illegal while others arguing that they were exclusive

The by-elections legally and constitutionally held under Art 57(1) triggered legal challenges in accordance to Art 57(4) but unfortunately, the end results of these legal battles was failure to stop the election process in Kabushi and Kwacha.

Legally, some of the principles of an electoral process include that elections are free and fair and that elections are free from violence, intimidation and corruption (Art 45) while Electoral Process Act 3 (q) and (s) further talks impartial handling of election complaints and timely resolution of electoral disputes* among others.

By free election it denotes freedom of the contesting parties and candidates to freely campaign, associate, express and assemble while a fair election means an election the rules of the game i.e the provisions of the code of conduct, electoral laws and constitution are respected

It is agreed that the Kabushi and Kwacha by-elections were heavily contested legally which legal battle was aimed to timeous resolve electoral disputes.

Lawyers for ECZ, Attorney General’s Chambers and those for duly nominated and duly rejected candidates trotted from one courtroom to another in an effort to exercise their right to electoral justice.

However, apathy characterised the two by-elections, causes factors I will discuss in my next article.

Having visited and exhausted all legal options, the Kabushi and Kwacha parliamentary elections had to proceed legally and constitutionally.

The illegalities, in my view, were committed by the Court which uniterally declared its power to stop the time which decision was unconstitutional and the decsion to stay the by-elections beyond the 21 days meant for the Court’s judication on any nomination matter which was illegal and unconstitutional.

Coming to the stay by the High Court as rightly observed by the CONCOURT, it elapsed IMMEDIATELY the 21 days fell due as per specification under Art 52(1-5) which only awards 30 day maximum (Art 52(5) to complete the process of nomination from nomination challenge to the determination.

In this regard, the nomination happened on 25 August and aggried candidates were given 7 days to challenge the nominations which 7 days expired on 31 August and the nomination challenge by Joe Malanji and Bowman Lusambo were done on 30 August.

As per dictates of Art 52(4), the 21 days started ticking immediately the nomination challenge’s lodgement was filed in court on 30 August, 2022.

The 21st day after the nomination challenge lodgement was 21 September 2022. This date was way outside the date the ECZ announced the decision to set a new date which on 11 October.

This was 20 days after the collapse of the High Court stay on the by-elections due to want of time. This makes the decision of the ECZ not only legal but Constitutional correct and right as per guidance of Art 57(3).

However, on 12 and 13 September respectively, two independent candidates each from Kabushi and Kwacha respectively “resigned” from the election process triggering the possibility of ECZ calling for new nominations and the hold for fresh election as per guidance under Art 52(6).

On the 9 Sept, Malanji and Lusambo filed in a lawsuit in the High Court to stay the by-elections which was granted on the 13 Sept, 2022, three days later the independent candidate for Kabushi resigned i.e. 12 Sept and a day after the one for Kwacha [i.e 13 September] also “resigned” on the very day the High Court actually granted a stay on the two by-elections.

As can be seen in the chronological of events, the purported “resignations” of the independent duo happened after the lodgement of a lawsuit to stay the elections by Malanji and Bowman Lusambo tying the ECZ from canceling the election as a result of the “resignation” of the duo as there was no election to cancel at the time.

On 6 Oct the two resignees rescinded their decision to “resign” while the High Court “stay” on the by-elections was seemingly not yet discharged though already expired on 21 September 2022 by the operation of law

Consequently, because the High Court was stop by the Court of Appeal to rule on the by-elections which would have lifted the stay, the illegal stay remained but without force of law on time prescribed in the Constitution

From the foregoing, it is clear that the elections in Kabushi and Kwacha were NOT a sham nor were they illegal but legally and constitutionally constructed

Instead the illegalities and unconstitutionalities were/are visibly seen in the various decisions of the various courts trotted to and these are the institutions that might have committed the illegalities in their various decisions due to seemingly failure to properly interpret the Constitution on time and also on appeal.

However, this was redeemed by the CONCOURT’s last ruling on 20 October, 2022 admitting that the High Court Stay on the Kabushi and Kwacha parliamentary elections was annulled by time lapse and that the Court of Appeal was wrong to have handled the appeal on elections instead of the CONCOURT and also that Court of Appeal was wrong to claim to fixate time specified in the Constitution and also to Stay the stay from the High Court

To this end, the truth is that the Kabushi and Kwacha parliamentary elections, despite the low voter turnout, were legally and constitutionally constructed, held and properly conducted by the ECZ and the electoral disputes resolved within 90 days by the Courts enough time for the holding of the by-elections as specified under Art 57(1)

Therefore, the truth is that the claims of illegalities, exclusiveness and shamness are dismissed with the contempt they deserved.

The truth is that the newly elected duo were properly and duly elected and any question on their legitimacy can only be done by dragging the provisions of Art 73(1-4) of the Constitution and as per specification under Section 96 of the electoral process Act.

ZAMBIA AT 58 LOOKS LOST AND UNSURE OF ITSELF THAN IT WAS AT 18, 28 AND 48 YEARS OLD

As National Democratic Congress, NDC, we today take time to briefly reflect on Zambia’s political and economic trajectory from birth, the time it was a teenager, all the way to adulthood at 58 years old today.

Born on 24th October, 1964, Zambia only had 100 graduates at independence and our forefathers were left with Western systems that their own people could not effectively run unless they embarked on an ambitious program to educate their people, get expatriates and also use whatever home grown talent or expertise that they could find. Our GDP in 1964 was $0.84B, Per Capita income was $242 and our growth that year was an amazing 12.21%. This was further pushed to 16.65% growth just the following year in 1965, but sadly a good number of the UNIP years were characterised by negative growth after that.

At 18 years old in 1982, Zambia was a teenager that had just reached adulthood.The party in power then was still the liberation party called the United National Independence Party, UNIP, led by our first President Dr. Kenneth Kaunda. The GDP of Zambia was $3.99B, Per Capita income was $638 and unfortunately the percentage of growth in this year was -2.81%. This was despite the fact that the economy had grown by a whooping 6.17% just the previous year in 1981 and 3.04% in 1980.

By the age of 28 years in 1992, Zambia was led by the second ruling or governing party the Movement for Multi- party Democracy, MMD, led by the second Republican President Dr. Frederick Titus Jacob Chiluba, popularly known as FTJ. The MMD took over power from UNIP after a 27 year reign of the first President. So at 28, Zambia was more optimistic and ready to concur the world. The MMD embarked on very ambitious liberalisation and privatisation programnes to try and deal with the stagnation that had been caused by some of the One Party State policies of UNIP. Despite the adverse effects of the Structural Adjustment Programmes, SAPs, that came with privatisation, people were able to own private properties like houses and it also dealt with the issue of many retirees becoming destitute due to lack of home ownership and the like.

Politically, Zambia, in 1991, also moved from Socialist policies to Democratic or capitalist ones. The GDP of the country by 1992 was $3.18B, the per Capita income was $376 and the growth that year was at -1.73%. By 1993, MMD had pushed the growth to 6.80%.

Zambia at the age of 48 years old had another ruling party the Patriotic Front, PF under Michael Chilufya Sata who was the 5th President of the country. Power had just changed hands the previous year in 2011. So at 48 years in 2012, Zambia’s GDP was $25.50B, Per Capita income was $1,763 and growth was 7.60%.

Last year in 2021, the GDP of the country was $21.20B, Per Capita was $1,121 and growth was at 3.57%. Zambia is now 58 years old and political and economic reform programmes that made us see the figures above are not very clear. It has to be mentioned that for us to develop, we need to have a constant or sustained growth of over 6%, China started growing at an average of 11% per annum and that is why it is the way it is today and a marvel to watch by other economies. So growing at less than 3% and in negatives is not good for Zambia.

The UNIP led government prioritised nationalisation, import substitution programmes, building infrastructure, giving its citizens good quality free education, etc. The MMD anchored its programmes on privatisation and allowing free market forces to run the economy. The PF embarked on an ambitious infrastructure development programme and direct empowerment programmes of some selected groups of women, youth and even men.

The UPND has made pronouncements that are yet to be verified. They claimed to have inherited empty coffers from the PF, but the very first budget they made just two months after forming government saw them increase Constituency Development Funds, CDF, which is given to all 156 Constituencies of Zambia. They increased it from K1.6B to K25.7B per Constituency in the 2022 budget and further increased it to K28B in the 2023 budget. They further claimed to have employed over 30,000 teachers and over 11,000 health workers. So much for empty coffers. But most importantly, their recruitments are something that no one can verify, as two months ago, the government announced that over 17,000 teachers have been put on the payroll and we are still waiting to see if all of them will be put on the payroll or if the 17,000 and 30,000 figures were genuine in the first place.

The UPND seems to be wholly dependent on the IMF for its economic recovery plan. The optimistic plans they shared while in opposition seem to have disappeared into thin air. Some people, including their ministers, say that they need more time. But this is one year after they came into office and we do not know where we are going. Liz Truss in the UK had to resign just after 44 days on the job because our friends know that someone has to hit the ground running when they get into these jobs than asking for time even one year later. This is because they were voted for on account of ambitious programmes or manifestos that they pretended to want to implement for the country once sworn into office. We cannot get there in one day, but we need to be assured of the journey and how we shall get there, because currently the UPND seems not to even have a campus or direction for the journey.

Former State House press aid Amos Chanda explains the arrest for allegedly stealing and burning a court document

PRESS STATEMENT ON MY ARREST

1. I was arrested on Thursday,19th October,2022 at 15 hours by the Drug Enforcement Commission (DEC) officers.

I was asked for the two sureties and I presented the two sureties that are on record with DEC in another matter in which they re-arrested me last month but has not been taken to court for three weeks now.

DEC demanded new letters from employers of my sureties.The same people,same address and same details but only to go and change the date.

By 16 hours,the two letters were presented at DEC the two men presented themselves physically.

2. Five DEC officers then stormed the interview room as one of them announced that I had to be detained because bond will not be given as per very strict superior orders from the DG of DEC Mrs Mary Chirwa.

My lawyers drew the attention to the provisions of the law and my rights under Article 18 of the Constitution,but the officers insisted that BOND was discretional and therefore the DG-DEC has exercised that discretion not to issue the BOND.

One of them later came to advise that in the light of a sick note for Mr Chanda that he had now become aware of,it is possible that DEC would reconsider thier position.As he was talking to my lawyers on this possibility,two rude and provocative officers stormed the room and insisted that instructions are clear that I have been locked up at Kabwata Police from where I can count for any relief that I wanted because as far as the DG-DEC was concerned,I was to be in custody without bond.

3. When I was still in state house as Special Assistant,I attended all call-outs and interviews they requested.I attended two summons and one interview.I was never charged for any offense because they said they were only asking to help with investigations.

4. In 2019,shortly after I resigned from office,I was informed verbally that I needed to see the DEC and when I made contact,I was told there was not need.

In November 2019,DEC issued two call-outs and I answered both leading to my arrest on a trumped-up charge of proceeds of crime.

This case was never taken to court until the following year in 2020 after various protestations from my lawyers to the DEC to present the matter before court.

It has to be stressed here that this case was engineered by Mary Chirwa(at that time Mary Tshuma) as DG of Financial Intelligence Center (FIC).As DEC under Alita Mbawe as DG and NPA tried to investigate and properly question the suspects,Mary Tshuma engaged Kaizer Zulu,Hibeene Mwiinga and Simon Miti to ensure that the case was pushed to court.

Simon Miti called Alita Mbawe to find out the status of the case because Mary Tshuma wanted to see the President (Edgar Lungu) about this matter.When the case did not move to court in November and December 2019,Mary Tshuma engaged the Director General of the Zambia Intelligence Service,the late Samuel Nkhoma to help push this case to court and ensure that President (Edgar Lungu) was “properly briefed”.

5. The DG OP Mr Nkhoma showed some inordinate interest in this matter and regularly approached the DPP Lillian Siyuni pushing her to prosecute the case.

She told him that I was so remotely connected to the case and that no reasonable court or tribunal can convict.He said he would help to provide evidence (very strange offer indeed from such an office).

DEC,Police ACC and other statutory bodies are lawfully mandated to investigate and present these matters to the courts.After this level of interest,the DPP directly contacted me on what I knew about the case.Most of my conversations with her are subject to constraints of OATH OF OFFICE and OFFICIAL SECRET LAWS.

6. The case finally took off in January,2020 and by the time it was closed via a nolle prosequi,not a single witness had named me in the case.

The case was closed via a nolle and subsequent action by the DPP.This is now the matter Mary Chirwa has purportedly reopened but for three weeks she has not presented the case before court.

7. This is a matter which alleges has missing court records dating back to 12/05/2020!.

8. There are operational matters hinging on state operations between myself (as press aide) and Mary Chirwa (Tshuma) then as FIC Director-General which she seeks to hide behind the lawful power vested in the office she now holds.The various cases of possible criminal conduct and other abuses on her past that came into my possession by virtue of office cannot be used to victimize me.

9. I will further put before court a detailed chronology of events to show and possibly stop this witch hunt.

There’s nothing illegal to call for early elections, if anything, it’s within our rights to remove, democratically, a President who has failed like President Hichilema.

Today, Independence is only at State House where President Hichilema and his colleagues will be celebrating the fact that they won the elections over PF and now they have power to make money, engage in corruption, eat nice food and drink expensive beverages and alcohol.

They have powers to exclude some opposition candidates during elections and arrest those of us who oppose them.

Meanwhile Zambians got nothing out of their victory of 2021 general elections. Many expectant Zambians are suffering more than they were, during PF or indeed any other previous Govt.

President Hichilema can make his long speeches counting emptiness of success, but majority Zambians are suffering including those who cooked and prepared for the event where they will be enjoying themselves.

SOLUTION: WE NEED TO CUT THE CONTRACT OF HH AND USHER IN A GOVT OF NATIONAL UNITY

The Independence we celebrate today, is about self-rule, that we are not ruled by foreigners. However, some Zambians like President Hichilema are mentally and politically colonised.

So while Zambians voted for them as Zambians, they have relegated the responsibility to form policies to foreigners, which only benefits them (the imperialists) while Zambians are getting nothing.

Governance is about forming policies, he who forms policies governs the Country. IMF, Brentrusts and other imperialists form our policies, while President Hichilema just stamps to certify them.

Therefore, people (Zambians) must call for early elections so that we liberate our Country from the imperialists who are ruling this Country through President Hichilema and his UPND.

We need Zambians to come together and take charge of this Country, if it’s to mess it up, let us mess it up, it’s our Country than suffering for foreigners.

My message as President of Economic and Equity Party (EEP), is that, we need to kick out President Hichilema out of power through an early election.

Don’t be indoctrinated, praising things that doesn’t make sense or don’t benefit you. You also deserve a good life like President Hichilema and his colleagues who are enjoying today. They are Zambians just like you, demand for your fair share.

Don’t cry, enjoy being in opposition – Nalumango

VICE-PRESIDENT Mutale Nalumango has urged opposition parties not to cry but learn from the UPND that was in opposition for 23 years.


During the Vice-President’s Question Time in parliament yesterday, she urged the opposition to focus on delivering credible checks and balances to the UPND which she said would be in power for the next 50 years.


She was responding to Gwembe UPND member of parliament Tyson Simuzingili who wanted to know the advice she would give to the opposition who he referred to as crybabies.


“My question your honour, having weathered the storm for 23 years in opposition, what advice do you have for our colleagues who are crybabies because they are failing to get the candidates…Your honour, what is your advice to our disorganised opposition parties?” asked Simuzingili.


Vice-President Nalumango said there was no permanent position in the House stressing that when given an opportunity leaders must do things right.


“Let me join him in one thing, this time and I think I am right Madam Speaker to congratulate the people of Gwembe and the UPND for going through unopposed [in local authority by-elections]. Here I join in to congratulate them and we congratulate you honourable member for working very hard. What advice do I give to the opposition? I would say don’t cry. Learn from the UPND which was in opposition for 23 years and they will give this very sincere advice. Listen to me colleagues, when you are in government do things right. Because there is no permanent position in this House. I think that’s why you start imagining things, the things you did that others are also doing them,” said Vice-President Nalumango. “What am saying is that you are in governance. You have been given the opportunity by the Zambian people. Do it well like we are trying to do it well. One day after 50 years when we sit there (opposition side in parliament), we would have set a very good precedence and learn to be in opposition. Some of them have never been in opposition and for me I do understand because one time I sat here without having been in opposition. So this is a learning curve colleagues. You are not abandoned, you are part of governance except you are in opposition. Take that position strongly, calmly and enjoy being in opposition. To give correct checks and balances, that is your role for the next 50 years.”

NELSON MANDELA ONCE SAID THAT THE BRAIN HAS TO DOMINATE EMOTIONS TO GOVERN A COUNTRY WELL- HH NEEDS TO LEARN FROM THAT

When people talk of the legacy of Nelson Madiba Mandela, they are normally quick to talk about the ultimate sacrifice of spending 27 years in prison. And rightfully so. He refused to separate his freedom from that of his people and he only became free when the people’s freedom was guaranteed.

To me, without disregarding the 27 years incarceration, the legacy and iconic status of Madiba is further solidified by the things he said and did. He was that voice that not only spoke for his country, but the entire Africa. Until Mandela became President, that voice that resonated well across Africa and could be heard by citizens of other countries was no longer there.

Post colonial Africa, many people like Kwame Nkrumah, Leopold Senghor, Julius Nyerere, Kenneth Kaunda and Thomas Sankara, among many others, were the voice of hope and guidance on the continent. It is no wonder Africa’s foreign policy was shaped in accordance with what was best for the individual countries, their region and Africa as a whole. They endeavoured to drive a strong Pan African agenda where they became each other’s brother’s keepers.

However, many years after independence, many of our leaders overstayed in office, they clamped down divergent voices, became dictatorial and just lost the legitimacy to speak a message that could be heard and respected by all sons and daughters of our beloved continent, regardless of nationality.

So Mandela was that breath of fresh air and once again Africa had a voice that they could listen to regardless of where one came from. And Madiba never disappointed, he spoke well and represented the continent admirably.

He guided us well and left brilliant quotes on education being the answer for Africa; not making other people’s enemies our enemies, etc, but today I will dwell on the one he said that ‘the brain has to dominate emotions for a leader to govern a country well.’ This quote is very important today because we have a President that needs to get counsel from it.

President HH is too vindictive and emotive in the way he runs national affairs and deals with political opponents. The President should know that being in the driving seat comes with a lot of pros and cons and he should learn how to deal with both without resorting to using state power to deal with his real and perceived political enemies.

So in the words of Mandela, may the brains of the current leaders, especially President HH dominate their emotions so that this country is governed well. Otherwise the picture we are seeing now where their hearts are leading their brains will only get worse if we don’t remind them to take heart and be leaders for all, despite who they love or hate, or who annoys them or makes them happy.

THE AWARDING OF THE NDOLA-LUSAKA DUAL CARRIAGEWAY PROJECT TO AVIC IS BAD FOR ZAMBIA AND THE FUTURE AND SHOULD BE STOPPED OR REDONE

AVIC ALREADY AWARDED

The Road Development Agency and the PPP Council won’t tell you this but they have already awarded the Ndola-Lusaka Dual Carriageway Project to AVIC Consortium, which is officially called Macro-Ocean Investment Consortium (Messrs AVIC International Project Engineering Company, Zhejiang Communications Construction Group Co Limited and China Railway Seventh Group Co Limited) or the MOIC Consortium.

They haven’t announced because there are many wrong things being done around the whole tender awarding process.

COMPARISONS OF VELOS AND AVIC BIDS

At bid evaluation, the MOIC Consortium was declared a preferred bidder with the Velos Consortium being declared the next best evaluated bidder.

1. VELOS CHEAPER: The Velos Consortium Bid was initially slightly more expensive. Macro-Ocean Investment Consortium (Messrs AVIC International Project Engineering Company, Zhejiang Communications Construction Group Co Limited and China Railway Seventh Group Co Limited) had a bid of 649,950,804.00 while Velos Consortium (Velos Enterprises Limited, Graduare Property Development Limited, Yamene Financial Services Limited and Hillary Construction Pty Limited) had a bid of 700,000,000.00. The impressive thing about the bids is that both bids were around USD 700m, which is more than half the price the PF wanted to construct the same road i.e. USD 1.5 billion. However, since the Velos Consortium is a Zambian entity, it qualifies for a citizen discount under the CEEC provisions. This brings the bid amount for Velos below that of AVIC.

2. AVIC CHANGES BID PRICE: The only reason the MOIC Consortium bid was lower than the Velos Consortium bid is that MOIC submitted a variant bid (which has a reduced scope of works). The Velos Consortium had stated in their bid that they would abide by the RFP terms and Conditions and have included the entire scope of works according to the RFP at their bid price of US$700,000,000.00. During negotiations, it was observed that the MOIC Consortium actually do not want to add the omitted structures within their price but would like to increase the price if the Government insists that these structures should be included. During negotiations, the MOIC consortium in August, 2022 indicated that they would like to increase the cost by US$134,329,598.09 to US$784,280,402.09 (more than US$84million over Velos Consortium’s Price). Thereafter in October, 2022 during the ongoing negotiations, MOIC Consortium yet again increased their cost by US$160,515,975.26 to US$810,466,779.26 an increase of US$110,466,779.26 over their bid price. But corrupt elements within RDA and the PPP Council see nothing wrong with this increase or that it is getting closer to the PF price and UPND will be seen in a bad light. This increase, if allowed, would bring their bid price to be higher than the Velos bid price and this would dismantle the claim that AVIC was cheaper. The corrupt entities within the system want the bid to pass at this lower price and then allow the variation later on as an addendum.

3. AVIC’S BID NOT COMPLIANT: A source close to the Evaluation Committee of the Ndola-Lusaka Dual-Carriageway Project revealed that the Velos Consortium bid was superior to MOIC Consortium bid in terms OF concept. The Velos bid is a better fit in terms of PPP as they have demonstrated ability to raise the funds needed and coming up with a model that will run the project over the tenure of the concession. The MOIC Consortium submitted a variant bid (which has a reduced scope of works) which was not in line with the Request for Proposal or the Terms of Reference. AVIC doesn’t want to construct by-passes of Kabwe and Kapiri, dual carriageway roads through Kabwe and Kapiri, grade separator of urban roads in Kabwe and Kapiri etc. Now, it is either AVIC didn’t really understand the bidding process to be that of a PPP or they just wanted to bulldoze the situation and get the usual contracts where the Zambian government pays for the works. They also seemed to want a kind of project where the Chinese contractor is backed by government guarantees. This makes sense when you remember that the Chinese do not do concessions and always prefer being hired and paid. Strictly speaking, MOIC Consortium aka AVIC Consortium did not comply with the tender terms and guidelines. They should have been disqualified. But the reason given by those handling the tenders for allowing them to go through is that there were only two bidders and the PPP Act allows this. (See attached hereto the details of the scaled down scope and costings thereof.)

4. AVIC DOESNT WANT GRZ TO GET PART OF TOLL-FEES: The bid, which these RDA and PPP Council guys want to pass, will not allow GRZ to get any revenue of the road unless the actual revenue collected exceeds 150% of the target revenue on annual basis. The bid also doesnt want the grade separators to be built unless the income exceeds 165% of the budgeted revenue. However, the 150% and 165% revenue increases are not attainable in the near future with the projected traffic volumes and as such the above-mentioned omitted infrastructure may not even be built during the concession period of 25 years or more. Does it make sense to have the current Kabwe and Kapiri roads legally locked away from being developed better than they are for the next 25 years?

5. AVIC WONT BRING MONEY FROM OUTSIDE ZAMBIA BUT WILL EXTERNALISE PROFITS: MOIC intends to source the majority of their working capital from within Zambia. This money will come from NAPSA, Stanbic Ban Zambia and Workmen’s Compensation Fund. They will then externalize their profits in US$. This means that they will put pressure against the Kwacha. In turn this will trigger an increase in the Toll Fees as per their demand to review the Toll Fee bi-annually. This project will have little or no Foreign Direct Investment as they intend to utilize the Toll Fees collected to construct part of the facilities during the Operations and Maintenance Period of the project. However, they will be provided with Duty Free and zero rated concessions to import their Capital Equipment as well as materials during the construction period.

Based on the above comparisons (I have left out many other comparisons), if MOIC Consortium is given the Contract, they will provide less infrastructure at their original bid price.

Further, they have also changed the Concession Agreement considerably and would want the Government to assume some major risks such as Specifications and Design Audits/Reviews (at Design Stage), Performance Standards, and Operational Requirements and Maintenance Standards connected with the Operation and Maintenance phase of the project. Does it make sense to have government take all these risks but be locked out of the income from the same profitable road? The cash-cow of roads?

There is also a bigger concern of the AVIC bid, which is the underestimated Traffic projection, which has a huge detrimental effect on the Pavement Design of the road. The acceptable Engineering standards in estimating traffic projections is to use the GDP (estimated to be 3.6% for 2022) combined with population growth trends. However, using GDP is considered in most cases as there is a direct correlation with the growth rate of vehicular traffic. Despite exponential population growth and expect ability to drive by more Zambians, AVIC has made a growth rate assumption of 2% for the first 2 years, 1.5% for the period 2025 to 2034 and 1.0% for the period 2034 to 2045. This works out to an average of 1.3% over the 25 years of the Concession. This is understated to reduce on the design needs and hence do bare minimum is construction works. An underestimated traffic projection means an inferior design of the Road Foundations layers which will cause the road to deteriorate to serious levels much, much earlier than the 25 year proposed concession period. The estimated total traffic loading carried out by various studies indicate an Equivalent Standards Axle Loading of 60million over the 25 year concession period while the MOIC predictions are at 20million (MESA). The MOIC Consortium is influencing some members of the PPP Council, RDA and the NRFA to accept their sub-standard proposal, which if Government accepts has the potential to backfire drastically as the inferior pavement design suggested by them, coupled with the omitted structures will not help to bring down the cost of construction but simply ensure a poor road which wont last for years.

Zambia is Independent and a Great Foundation for Economic Liberation is being laid; let’s all celebrate 58 years of freedom.

As the country sets in motion to toast to 58 years of Independence, we reflect on the great things our Republic has achieved.

Our forefathers, whose torch bearer was Dr. Kenneth Kaunda, secured us freedom of assembly, freedom of speech, and association, among others. We as youths immensely appreciate their sacrifice. We know, this did come at a price. Many died. Man lost families and many went to jail so we could enjoy this freedom. We thank them.

It feels good to celebrate this year’s Independence under a new President, a President who has led his team in liberating institutions of democratic governance. A President who has restored the rule of law that previously lost meaning.

Most importantly, it is of great value to mention that, as we celebrate this year’s Independence Day, we have a President in Mr. Hakainde Hichilema, who is concerned about young people who for a long time had been neglected and excluded from actively participating in the emancipation of their lives from the jaws of economic slavery.

Our people know that, handouts that were a common feature previously, were a recipe for economic slavery. Those with money never wanted to give the youths long lasting economic solutions.

They only gave youths money when they wanted to use them for wrong things. The young people were given peanuts so they could go back to their masters for more handouts. This President has said no to ka samfin. He has empowered the young people. The young people are now in charge.

The young people are no longer duped with statements of them being future leaders or leaders of tomorrow. Under this President, young people are leaders of today.

President Hakainde Hichilema has gone beyond brought and brought in a different trajectory. Young people are beginning to own industries. The young people are beginning to own cooperatives. The economy is now beginning to be controlled by young people. The poor are now part of economic activities.

Through an increased and robust constituency development fund, we’re seeing young people owning the wheels of the economy. Young people are being employed without looking at their names. They’re getting jobs provided they qualify and are Zambians. Many thanks to His Excellency, Mr. President Hakainde Hichilema who has taken economic emancipation, as a serious endeavour and to a whole new level.

Going by the above, I urge all young people, to continue rallying behind this President. I urge all structures of our party to encourage all young people to turn out in numbers and celebrate this year’s Independence Day, it is a unique celebration, a totally new celebration.

As young people, we are celebrating this Independence Day in a new way because of the economic emancipation foundation that Mr. President, Hakainde Hichilema has put in place. Let’s all celebrate.
