NAPSA PARTIAL PENSION SCHEME PROGRESSIVE.

As we discuss this issue, Zambians should know that it is optional not mandatory that every employee should draw their accumulated pension.

It is undoubted that the NAPSA Pension Scheme reforms that the New Dawn Government under the able leadership of President Hakainde Hichilema is undertaking are well meant.

While in opposition, the President pledged to reform the NAPSA Pension Scheme and he is living up to his words. This move has excited the civil servants and other stakeholders despite mixed fears of unknown especially by the opposition political parties.

The reforms under discussion emanated from the cry by the civil servants that at retirement age their energy to productively use the pension would have reduced and become destitutes due to prolonged time of getting their benefits and some even die in the process while pushing their benefits.

In short, the president doesn’t want the situation where pensioners assemble at the ministry of justices to claim their money like what happened in the previous government. Equally, life expectancy in Zambia and Africa at large has drastically reduced hence the probability of the retiree surviving and being physically fit is slim.

Being a listening Government, the New Dawn upon assuming power began to actualise what the Drivers of Government business, civil servants wanted.

Under the new pension scheme, civil servants will have the freedom to make partial withdraws from their pension savings from what would have accumulated over a guided period of time.

The partial payment will move those working in the public service to entrepreneurship, a move which will create jobs and wealth for families

The pension scheme will also allow civil servants while energetic and productive to do business or invest into real estate or whatever business to have access to some funds. This has been a cry from the civil servants, that previous governments failed to actualise.

The partial pension will also give civil servants a sense of investment while they are still working.

To those who will opt to embrace the partial scheme, it will help them reduce over dependence syndrome on the yoke of loans where the majority of civil servants have been taken hostage.

The scheme has been well received by majority of civil servants as it gives them a sense of responsibility, knowing very well that the partial payment would have drastically reduced the final pension after retiring.

Here, the good investment of the funds will be cardinal especially in informal sector (SMEs).

The concerns raised by opposition political parties and other stakeholders are taken but maybe applicable in the future as pension schemes are not static but progressive.

For instance, the PF under President Michael Chilufya Sata proposed a two tier pension system in which there was to be a compulsory monthly and optional contribution scheme under which a person could withdraw their benefits while in employment and use it for investment before retirement. Presently this system cannot work as the Government is still realigning the damaged economy by the previous government.

Indeed many suggestions from stakeholders are welcome and valuable as they will contribute to strengthening the pension scheme in future.

Actor, George Clooney and his wife Amal still write love letters to each other, it has been revealed.

The Ticket to Paradise actor has recalled how his agent told him he was ‘going to marry’ the 44-year-old Amal as soon as he met her in 2013, and though the 61-year-old star was initially skeptical, the pair quickly became an item.

Appearing on The Drew Barrymore Show, Clooney said: ‘Well its funny she came to the house in Como with a friend of hers to visit and immediately I was like…

‘The funniest thing is Bryan Lourd my agent called me, he had just met Amal at some other thing and she was like, “Yeah I am going to go to Como with a friend of mine,” and he called me up and he said, “There’s a girl coming to your house that you are going to marry.”

‘I was like, “You’re an idiot. You know that’s not going to happen”. And then in comes Amal and we stayed up all night talking and I started writing her a bunch of letters.’

George clarified he meant ‘on pen and paper’ rather than digital love letters, and he revealed he and his wife – who he wed in 2014 have kept up the letter writing tradition.

The father-of-two who has five-year-old twins Alexander and Ella with Amal said: ‘Yep, we still write letters. Leave them on the pillow.’

George says he has learned to shift his priorities and focus on what matters most, by finding ‘all the things that we have in common and not worry about the little things’.

George who has previously insisted they’ve ‘never’ had an argument – recently claimed he wasn’t in any position to give marriage advice.

Speaking to E! News: ‘Because I started so late, I’m not allowed to give advice to anyone. I have to look at it as if I’m the luckiest human being alive and then just appreciate that.’

‘We agree on most things. When you’re 61, which apparently I am… As you get older, you’re kind of looking at things a little differently,’ he explained, pointing to how ‘people always worry about’ things like decorating.

He said: ‘Amal wants to paint the wall yellow. And if I was younger, I feel like that’s a stupid color. And now you just go, “I don’t care. Who cares if a wall’s yellow?” ‘

Donald Trump ordered to testify and provide documents to Jan 6 Capitol riot House committee

Former US President Donald Trump was issued an order on Friday to testify under oath and provide documents to the House of Representatives committee investigating the Jan. 6, 2021, attack on the U.S. Capitol by his supporters.

The committee said it had sent a subpoena to Trump requiring documents to be submitted to the panel by Nov. 4 and him to appear for deposition testimony beginning on or about Nov. 14.

Deposition testimony refers to closed-door, videotaped questioning of a witness on the record which could be made public and become part of a final report by the special panel.

“As demonstrated in our hearings, we have assembled overwhelming evidence, including from dozens of your former appointees and staff, that you personally orchestrated and oversaw a multi-part effort to overturn the 2020 presidential election and to obstruct the peaceful transition of power,” the committee wrote in a letter to Trump on Friday, October 21.

Trump has accused the committee of waging unfair political attacks on him while refusing to investigate his charges of widespread election fraud.

Trump might not cooperate with the subpoena and could simply run out the clock on a committee whose mandate will likely end early next year if Republicans win a majority in the House in November’s midterm elections.

The January 6 Capitol riot by Trump motivated mob saw rioters smash through glass and battle police. Five people including a police officer died during or shortly after the riot, more than 140 police officers were injured, the Capitol suffered millions of dollars in damage and Vice President Mike Pence, members of Congress and staff were sent running for their lives.

The committee announcement came just hours after Steve Bannon, a former adviser to Trump, was sentenced by a federal judge to four months in prison for refusing to cooperate with the panel’s investigation.

The House Select committee’s seven Democratic and two Republican members voted unanimously on Oct. 13 in favor of subpoenaing Trump, a move that could lead to criminal charges if he does not comply.

“In short, you were at the center of the first and only effort by any U.S. president to overturn an election and obstruct the peaceful transition of power, ultimately culminating in a bloody attack on our own Capitol and on the Congress itself,” Committee Chairman Bennie Thompson and Vice Chair Liz Cheney wrote Trump.

Federal law says that failure to comply with a congressional subpoena is a misdemeanor, punishable by one to 12 months imprisonment. If the select committee’s subpoena is ignored, the committee would vote to refer the issue to the full House. The House then would vote on whether to make a referral to the Department of Justice, which has the authority to decide whether to bring charges.

Legendary Scottish actor, Brian Cox, has spoken about the challenges of Hollywood, describing it as ‘the worst place in the world to raise female children’.

The Succession star, 76, disclosed this in a new wide-ranging interview with The Telegraph.

He said he believes Hollywood ‘exacerbates’ the many pressures already on young women as he described it as the ‘worst place in the world to raise female children’.

‘[Hollywood is] a very difficult place to live, and [it] is the worst place in the world to raise female children,’ he told The Telegraph.

‘There are so many pressures on young women already, and it just exacerbates them.’

Brian shares his two eldest children – Alan, 52, and Margaret – with his ex-wife Caroline Burt, while he also has sons Orson, 20, and Torin, 18 with wife Nicole Ansari-Cox.

In the interview, Brian went on to say that there are pressures for women to look a certain way and can be ‘sexualised’ in Hollywood as he reflected on a MeToo meeting he attended.

He also commented on the MeToo movement and how wealth can make you ‘guilty’ in the interview.

He explained that he arrived late and stood in the back as ‘intense Hollywood women’ listened to journalist Ronan Farrow speaking about his expose of Harvey Weinstein and top US media figures.

After the meeting, which came soon after Brian won his Golden Globe in 2020, he said people immediately started filming him, asking him to tell them to ‘f*** off’ as his Succession character Logan Roy.

He said he questioned whether it was ‘appropriate’ to do so straight after a MeToo meeting as he criticised the ‘tokenism’ of Hollywood.

‘This is the problem – that people do things on a tokenistic level, I find that questionable,’ he added.

The Scottish star also spoke about finding success and wealth in Hollywood, saying that although he is a huge TV star, he is not ‘one of them’ or a ‘multimillionaire’.

He said that although money makes people ‘safe’ it also makes them ‘guilty’, saying that everybody suffers from their exposure to money in some way.

Brian said he tends to ‘fly publicly’ and his vices are clothes as he spoke about what he does with his own money.

As for leaving his four children any inheritance money, Brian said he thinks his property will be divided up amongst his kids.

ACC scaremongering, trying to starve PF of funding – Chama

PF chairperson Davis Chama says the move by the Anti-Corruption Commission (ACC) to reveal that PF received funding from Glencore International “is purely a scaremongering target to instill fear in organisations that syphathise with the party so that they starve us funding”.

He has challenged the ACC to “go to every political party if they really want to be neutral because this is just meant to kill political parties. Investigate United Party for National Development and tell us how UPND has operated over the years and who has funded [it]”.

The ACC on Wednesday said it was investigating Glencore International over $3 million that was paid to “a named political
party in 2016”.

ACC corporate communication head Timothy Moono disclosed that, “ the Anti-Corruption Commission has interrogated Mr Davis Chama, former minister of defence, to help with investigations in connection with a matter in which money amounting to US $3 million was paid to a named political party in 2016 by Glencore International AG, the mining company that was operating Mopani Copper Mine. The investigations border on the circumstances under which these funds were paid by the said mining firm to a political party soon after which the firm exited Zambia under unfavourable terms to the Government of Zambia. Investigations into this matter are on-going.”
But Chama, in an interview, said it was also rumoured that the UPND were also being bankrolled by Konkola Copper Mines.

“Political parties are organisations registered under the laws of our country just like churches, other organisations and these organisations from time to time receive funds from partners, supporters, symphathisers and members of that organisation just like in our case, we received various donations. I was just reading the statement, and I was surprised that they were trying to release details of the investigation. They are releasing details whilst they are investigating. So you can only suspect what is the motive of this?” he wondered. “Every organisation even the ruling party right now have been supported by a lot of people. It was even rumoured that KCM was bankrolling their campaign, Anglo American and a lot of other symphisers. This is a targeted smear campaign. It is a targeted smear
campaign because they cannot start releasing piecemeal information in the middle of an investigation. This is purely a scare mongering target. They want to instill fear in organisations that syphathise with the PF so that they starve us funding.”

Chama said ACC was acting unprofessional and political.
“This is purely unprofessional because in that statement, they are saying they are still investigating. So if they are investigating, why are they naming organisations because this information was gotten from the
bank. Actually the bank system is such that the person sending you money will be indicated on the statement. And the recipient will also be indicated. That money from Glencore did not come under my personal account, no. It came in the bank account for the Patriotic Front political party. So they are basically investigating a political party. I was only secretary general at the time in 2016. Remember, the party received not me but of course I was the secretary general then,” Chama said. “So I received on behalf of the party which party had a president, vice-president. It had a national chairman, it had a national treasurer and a central committee. I was running the party on behalf of everyone.”

He challenged the ACC to also investigate the sources of funding for ruling UPND.
“So this is what they have started. So they should go to every political party if they really want to be neutral because this is just

meant to kill political parties. Let ACC go and investigate United Party for National Development and tell us how UPND has operated over the years and who has funded [it]. They should go to MMD, UNIP and all the other political parties and let them also go all organisations registered and the societies Act, then there will be no suspicion that
this is witchhunt,” he said.
And Chama said the donation had nothing to do with Glencore’s exit from
Mopani.

“Glencore exited well after the 2016 elections. They did not exit in 2016. I was minister of defence – that was I think towards 2020 or
2021. It was after the election of 2016 or the presidential by-election of 2015,” said Chama.
“Anyway they said they would call me back. So I am around, and I am not going anywhere. Maybe my arrest is what it is leading to but some of us have already been arrested before and we are appearing in court.
We slept in cells.”

PF MPs Vow Not To Welcome Kwacha And Kabushi Parliamentarians

We the members of Parliament will be reluctant to welcome to parliament the people who will be elected in the Kwacha and Kabushi by-elections, Mpika Member of Parliament Francis Kapyanga has said.

Mr Kapyanga was speaking during a media briefing by members of the opposition at parliament in Lusaka yesterday.

He said MPs both from the opposition and some from the ruling UPND have expressed displeasure with the disregard that the government institutions are giving to the laws that members are enacting.

Mr Kapyanga called on the Commissioners at the Electoral Commission of Zambia (ECZ) to stop being toothless and work to protect Zambians.

“The commissioners at the ECZ should not protect the interests of political parties but those of Zambians who they are mandated to protect,” Mr Kapyanga said.

Mr Kapyanga said the commissioners should adhere to the principles that the ECZ is an independent body with a very big responsibility which when mishandled can bring chaos.

And Shiwang’andu MP Stephen Kampyongo said the opposition MPs will not sit back and watch the constitution being raped.

Mr Kampyongo said the circus was not over as PF would make sure to challenge the winners of the elections.

And speaking at the same briefing, leader of the opposition in parliament, Brian Mundubile, said the desire by the UPND to change the constitution should worry Zambians.

Mr Mundubile said it was unfortunate that the courts themselves participated in the injustice that occurred around the two by-elections.

He said the fact that ECZ as an institution openly disobeyed a court order twice and the courts chose to watch was unfortunate.

He said it was a known fact that the judges were going through a lot due to the existence of the Judicial Complaints Commission which was filled with UPND cadres who were mistreating and putting them under pressure.

Mr Mundubile said the turn of events in Kabushi and Kwacha was expected.

He said this was because a government which ascends to power using illegal means would continue using such methods as they went forward.- Daily Nation

GOOD governance activist Brebner Changala has charged that dismissed Director of Public Prosecutions (DPP) Lillian Siyunyi is a victim of the State’s manoeuvres.

“We must not take people for granted. Let alone, we must not abuse our offices to attack the very integrity and the foundation of our national unity. We are not supposed to use our offices to assault the Constitution in order to draw benefits. This must stop,” he said. “We are not going to bury our heads in the sand while injustice is slowly becoming the order of the day.”

Last Friday, President Hakainde Hichilema relieved Siyunyi of her duties following a recommendation by the Judicial Complaints Commission (JCC).

“President Hakainde Hichilema has with immediate effect, acting on the recommendations contained in the report presented to him by the Judicial Complaints Commission, removed Mrs Lillian Siyunyi Fulata, S.C. from the office of Director of Public Prosecutions. The removal of Mrs Lillian Siyunyi Fulata from the office of Director of Public Prosecutions is in exercise of the powers vested in the President pursuant to Articles 182(3), 143(b) and 143(c) of the Constitution of the Republic of Zambia,” read the statement from the President’s spokesperson Anthony Bwalya. “Meanwhile, President Hichilema has in exercise of the powers vested in him pursuant to Article 180 of the Constitution of the Republic of Zambia, appointed Mr Gilbert Andford Phiri as Director of Public Prosecutions subject to ratification by the National Assembly.”

Commenting on the dismissal, Changala warned Phiri against being used by the State to punish political opponents.

“Madam Siyunyi is a victim of a well-orchestrated political manoeuvres inspired by the executive. And this must not be allowed to go on. And I must warn the new DPP (Gilbert Phiri) coming that the foundation has been laid that if he’s going to that office to be used by the appointing authority, he will disgracefully be treated in the same manner,” he said. “If I was him I will ask very clearly as to what do they want me to do on behalf of the people of Zambia other than on behalf of the UPND. He must not go there as DPP to victimise the people of Zambia in form of revenge and avenge because this is what is going on. UPND as a party and Mr Hakainde as an individual were badly treated and mistreated by the previous regime. But he will not be allowed to use his constitutional office as President of the Republic of Zambia to avenge and revenge because that is the beginning of serious problems for the country, later on for this administration.’’

Changala said leaders should not use their offices to assault the Constitution.

We are not supposed to use our offices to assault the Constitution in order to draw benefits. This must stop,” he said. “And my call is, can we have a serious statement disclosed from the executive. What role did [President Hakainde Hichilema’s senior private secretary Bradford] Machila play in the [former KCM liquidator] Milingo [Lungu] saga? What role did [presidential legal advisor Christopher] Mundia play? What role did [Solicitor General Marshal] Muchende play, and what role did the Attorney General play? We need to know. We are not going to bury our heads in the sand while injustice is slowly becoming the order of the day. It’s totally unacceptable?”

Changala said he did not expect the new dawn government to mistreat Siyunyi the same way the PF mistreated then DPP Mutembo Nchito.

He urgued against what he termed harassment of constitutional officeholders.

“The case of Siyunyi is a very sad recurrence. After the chaotic departure of Mutembo Nchito from the DPP Chambers, one would have thought attacks on a constitutional office bearer will be sanitised. And the worst was to expect this action from the new dawn administration which had suffered so much under the previous government,” Changala said. “The framers of the Constitution knew very well the DPP had to have security of tenure and enjoy almost 90 per cent or close to that of the security benefits of a sitting judge. That the judge is independent and the judge must operate within the realms of the Constitution. And it’s from that premise that everybody from independence realised that the office of the DPP was well secured, yet highly sensitive when it comes to the dispensation of justice in the Criminal Procedure Code.”

He explained why he felt the DPP’s office had become a political target whenever there was a change of government.

“However, it has come into public domain that that office is the target of a newly elected government. For it wants to assume a relatively friendly DPP not for national interest, but for the interest of an elected government to sweep things under the carpet. There was no reasonable cause at least to understand the removal of Mutembo Nchito. And that’s why even the tribunal report has been kept as a state secret. It has never been exposed to the victim,” Changala said. “It’s because the previous tribunal was a kangaroo tribunal that perpetuated injustice in order to revenge on the DPP for whatever he could have done in the past against certain members of the tribunal. But the tribunal was fortified through the Executive’s misconduct.”

He challenged the UPND to explain when they developed intentions to remove Siyunyi.

“Fast forward, we have the case of the DPP Lillian Siyunyi being removed from office. One would ask a legitimate question as when did the desire to remove the DPP arrive? Is it when they won the election? Were there any movements towards the DPP to vacate the office and become a judge of Court of Appeal?” he asked. “And when that failed, wasn’t there a Milingo debacle where a nolle was entered, but before the nolle where an immunity had been entered? And who organised the movements towards Milingo’s immunity or indeed the nolle? This is where the injustice of Madam Siyunyi comes in because there was a premeditated desire to have her removed from office. The people who made the move towards the sitting DPP Siyunyi was the Executive.”

Changala recalled how State House used some of its agents to force then Konkola Copper Mines provisional liquidator Milingo Lungu relinquish his office.

He outlined names of people that were involved in negotiations with Lungu on behalf of State House.

“And I must mention here that in the matter of Milingo, the movers of the treacherous desire to have Milingo relinquish his position as a liquidator was a matter that was around State House. It is not a hidden fact that the special assistant to the President for legal affairs Mundia was involved, the senior private secretary Mr Bradford Machila was involved, the Solicitor General Marshal Muchende was involved,” Changala explained. “And Marshal Muchende there’s a letter where he is asking the DPP to go to court and ask for an adjournment. And this is where the DPP gets entangled because the DPP by law is not supposed to receive instructions from anybody. Now when it comes to punishment, Christopher Mundia is not discussed and is free; Bradford Machila is not discussed and is free; Marshal Muchende is not discussed and is free. The only time action must be taken is against the DPP, in exclusion of the major players in this illicit abuse of office by the Executive.”

And Changala wondered why Siyunyi was only tried on two cases out of the 11 that were submitted against her to the JCC.

“Fast forward, 11 complaints were submitted to the JCC. And those complaints include the Attorney General, it includes Madam Mary Chirwa the director general at DEC, it includes Pilato. Now, the movement towards the JCC was on the basis of the Milingo debacle because that has a national character. What do we see? When Madam Siyunyi goes to JCC, for whatever reason, the matters are delayed back and forth, back and forth,” said Changala. “Chances are reduced to two complaints: the judgment by justice [Edward] Musona and MMD motor vehicles. The Milingo debacle is dropped, and yet that is the most serious matter. They go for MMD motor vehicles of the [Felix] Mutati-[Raphael] Nakacinda faction. Then there’s a judgment where certain people have complained about justice Musona’s judgment against the DPP. And they use that to remove Madam Siyunyi from office. My take on this is that the issue of Milingo should not be buried for political expedience. That is a matter that should have unfolded to its full extent in the JCC. And this is a matter that should have been used as a bedrock when finding Madam Siyunyi wanting.”

UPND VICTORY FACES CHALLENGE…as Makebi says credible elections not possible because ECZ is compromised

We will never have credible elections in Zambia for as long as the Electoral Commission of Zambia (ECZ) is not independent of the Executive, Makebi Zulu has warned.

And Mr Zulu has cautioned that democracy is under threat in Zambia and that there is a real danger that citizens could resort to self-help if the United Party for National Development (UPND) government will continue manipulating the electoral system.

Meanwhile, Mr Zulu, the former Patriotic Front (PF) Malambo Member of Parliament has said the former ruling party is going to challenge the outcome of the Kabushi and Kwacha parliamentary by-elections because the grounds for the petition were plenty and potent.

In an interview yesterday, Mr Zulu who is a lawyer in the Bowman Lusambo and Malanji cases said it was clear that the ECZ was not independent and that the credibility of any election conducted by the Commission shall be questionable.

He said if nothing was done to change the status quo and make the ECZ independent, Zambia was likely to end up in a serious chaotic situation, stating that it was his prayer that the country should never degenerate to such levels of lawlessness.

“What is clear is that the Electoral Commission of Zambia is not independent. So the credibility of the elections conducted by the ECZ will be questionable at any given time. And if nothing is done to ensure the ECZ reclaims its independence, we are likely to end ourselves in a very chaotic situation. But if people no longer trust institutions of democracy, they resort to self-help…and God forbid we should head that way,” Mr Zulu said.

Mr Zulu has however said the remedy to avert chaos in the country’s governance system was for Zambians to demand the independence of the ECZ which had subordinated itself to the manipulation of the executive.

The Lusaka renowned lawyer stated that it was clear that there had been connivance on the part of the Executive and the ECZ on the build up to yesterday’s by-elections in Kabushi and Kwacha.

“…and as long as the status quo remains, we will never have credible elections in this country,” Mr Zulu said.

On Thursday and in a turn of events, Acting Chief Justice Royda Kaoma adjourned all the matters involving the Attorney General from October, 19th to October, 21st, 2022.

“I refer to your letter of today’s date that all courts with matters involving the Attorney General from 19th October, 22 to 21st October, 2022 adjourn such matters as the State Advocates will be attending the arbitration course with the Chattered Institute of Arbitrators. Note that your request has been granted,” Justice Kaoma said.

After Justice Kaoma had made an announcement postponing all matters involving the Attorney General, the Court of Appeal sat and observed that the High Court Order that had stayed the Kabushi and Kwacha Parliamentary by-elections was in fact still in effect.

While the drama was still unfolding, The Constitutional Court was making a decision to annul the High Court Order that had stayed the Kabushi and Kwacha parliamentary by-elections and ordered that the elections should go ahead scheduled by the ECZ.- Daily Nation

According to the Patriotic Front, they claim they have already taken over the grassroot.

Historically,Social Media has been used as an effective tool for change across a broad spectrum of society.

We saw how Social Media played an important role during the Arab Spring.

Zambia too has had its fair share of using social media fostering change especially during the 2021 general elections.

It is an open secret that without effective influencers on social media our party was not going to scoop the previous general elections.

Whoever underplays the importance of social media does that at their own risk…

We should not forget that the owners of Trade Kings are Muslim but James and his team have succeeded in creating a bridge between the owners and the rest of the country by rolling out affordability as well quality driven by a liberal sophisticated media campaign.

If Trade Kings wanted their own way they could have been using Imams and beautifully veld virgin Muslim girls to run and appear on media campaigns.

Was that strategy going to be welcome by the average Zambian consumer? The answer is an obvious NO..

That’s were tact comes in and James and his team have managed to deliver that.

The choice and use of models, actors and diverse personalities in their advertising campaigns is exemplary.

The acting not only delivers appropriate messages but the overall objectives of the business at play.

Because of that,there has been some kind of symbiotic relationship and reciprocal royalty between Trade Kings and it’s customers that is going to stand a test of time.

THE PATRIOTIC FRONT PREDICAMENT.

After falling from grace the Patriotic Front is slowly mastering the art of exploiting social media.

One can easily smell the presence of the Patriotic Front footprints all over social media.

As the Bemba adage says ukopoka ichinsenda kunkoko kunakilila . Hope I have said that right.

The PF are now on almost every local and international platform posting and responding to almost everything from jokes, sex, sports, arts, economics, business, religion, politics, arts ,education etc.

Their ultimate goal is to win the hearts and minds of the Zambian voter.

The Patriotic Front has succeeded in cohabiting with Zambian netizens but they have not succeeded in marrying the Zambian voter. What is preventing a successful social media marriage by the PF with the Zambians is its bad history of mischievousness..

Zambian’s will take a lot of time to heal from the heartbreak that was caused by the PF.

The Patriotic Front can and will never win the trust of the Zambian voter because of it’s bad historical record of corruption and disorder.

Zambian’s on social media may be willing to have conversations with the PF but they are not ready to take the PF hand in marriage for now. But like a consistent boy asking for a girl out the PF has kept on pushing without giving up.

The PF is taking advantage of a number of factors and weaknesses on the part of the UPND.

The PF has come to realise that the UPND is slowly losing grip with the grassroots based on the biting economy and other factors such as inactivity and disconnected party functioneries with the grassroots.

THE UPND

The UPND has very good planners and managers but we lack structures and tools that are privileged with the ability to engage with the grassroots.

We are also short of extroverts with the right vocal cords and charisma to engage with the Zambian people. These are important requisites in any marketing campaigns.

Most of our ministers are so quite like they work in the mogue. Politics is more about meeting people than it is about locking yourselves in offices.

Muyopa Chani?

The other biggest problem is the fact that our leaders prefer burying their heads in the sand, living in denial and not accepting that this is a big discrepancy.

The know it all attitude by our leaders is hugely affecting our political standing.

There is a school of thought within the party claiming that most of the UPND media platforms are underfunded.

That is true to some extent.

However, that does not take away the fact that our platforms are still operating like we are still in opposition..

Most of the articles and posts being churned out by our media platforms lack tact, are divisive, provocative ,offensive, poorly researched and mediocre in most cases.

We can’t win the hearts and minds of the Zambians with such approaches.

We need to pull our socks and churn out material which is based on objectivity,professionalism and most importantly highlting our achievements.

I can state with confidence that a good number of the posts on the UPND platforms are responsible for decampaigning the President and party as a whole.

Look at how we have failed to highlight and expose most of our achievements on social media.

There is a lot that the party in government is doing but information is not filtering through for the political benefit of the party.

Take for instance free education. I expected to see both government and party media platforms going on the ground and interviewing beneficiaries of free education and Skills burseries.

Our Members of Parliament have also not exploited the use of social media when it comes to the issue of CDF.

All they do is hold ceremonies handing over Checks and it ends there. There is lack of innovation in handling social media.

We should be following through by showing the people benefiting from CDF and how these funds are helping our communities and contributing towards community economic emancipation.

Our platforms seem to be concentrating on which civil servant has not been fired to be replaced by our own cadres..

CONCLUSION.

We have a lot to learn from Trade Kings as a party on how they have been handling their media campaigns.

We might have very brilliant ideas but how those ideas are channelled makes a big difference.

Let us learn to admit our weaknesses and appreciate the importance of using the right people and right tools in our publicity endeavours.

UNTIL we realise the importance of the impact of social media we will continue to bleed political numbers.

Business magnate and President of Dangote Group, Aliko Dangote has advocated for jail terms for dealers in foreign textile materials in order to discourage imports and boost local production in the textile industry.

He also called for legislative backup, seeking the enactment of a law prohibiting the sale of imported fabrics in the country.

He spoke as Guest Speaker at the landmark 50th Annual General Meeting of the Manufacturers Association of Nigeria (MAN) and the 2nd Adeola Odutola Lecture held yesterday in Lagos.

During the AGM, themed: “An Agenda for Nigeria’s Industrialization for the Next Decade”, where a Blueprint for the Accelerated Development of Manufacturing in Nigeria 2.0 was unveiled, Dangote expressed optimism, noting that with the collective effort of all stakeholders, it was feasible to move Nigeria from “developing nation” to “newly industrialized nation”.

The business magnate also identified priority investments in infrastructure and core industries among other recommendations, as vital panaceas to boost Nigeria’s economy to its desired level among contemporary nations and in the world overall.

Against the background of the declining fortune of the manufacturing sector, Africa’s wealthiest man urged the Federal Government to employ strategically prioritized investments in infrastructure to reverse the trend and boost Nigeria’s economy to its desired level among contemporary nations and in the world over.

Dangote said it waz imperative that the familiar challenges limiting the pace of industrialisation are frontally addressed while setting a clear-cut agenda for the next 10 years. According to him, “the experience in various parts of the world has shown that industrialization drives economic growth & development, which improves living standards as evident by the high output and per capita income in industrialized countries.

“The rate of industrialization in Nigeria has been slow as evidenced by the low contribution of manufacturing to GDP, poor capacity utilization and constrained export of manufactured products within and outside the continent. For instance, Nigeria’s share of world output of 0.41%, ranked 29th in the world which is unimpressive, considering its size and resource endowments. It ranks poorly, when compared with India at (3.1%), South Korea (3.0%) and China (28.7%).

“Nigeria’s industrialization process has been greatly challenged by structural and institutional constraints, particularly funding. These factors have over the years cumulatively contributed to its disappointing performance. For instance, in the last decade, average share of manufacturing value added to GDP in countries like China and Malaysia stood at 41% and 38% respectively; compared to 25% in Nigeria.

“In terms of capacity utilization, a major performance indicator which reflects the ability of manufacturing companies to meet rising demand without increasing cost, Nigeria achieved a rate of 55% compared to 76% and 78% in China and South Africa respectively. The country’s dwindling industrial performance has significant socio-economic implications, as poverty and unemployment continue to rise.

“From 1960 to 2003, the development trajectory of China by far outpaced that of Nigeria within the same period even though Nigeria began on a seemingly better footing. It is therefore important to track back to where Nigeria “dropped the ball” with a view to repositioning the country to the path of growth, development, and social upliftment.

“Based on the comparative analysis of Nigeria and China, one can safely make the following deductions (i) the numerical strength of a nation (population) can indeed be translated into economic wealth (ii) steady growth in manufacturing output is possible when the operating environment is conducive; (iii) no nation can easily transit from “developing” to “newly industrialized” without a vibrant manufacturing sector; (iv) effective implementation of long term plans backed with policy consistency will promote enduring economic growth and development”, the industrialist added.

According to Dangote, “Nigeria’s manufacturing sector is dominated by light manufacturing with only a few firms operating in the heavy segment of the sector. There are several factors that need to be in place to accelerate the growth of the manufacturing sector in Nigeria. These include: security and rule of law, industry-oriented government policy; adequate infrastructure; industry-oriented Research & Development (R&D); a well-developed SME sector; building of human capacity, and embrace of technology to improve efficiency through automation of manufacturing processes”.

On current status of the manufacturing sector, Dangote noted that manufacturing was singled out in the Nigerian Industrial Revolution Plan (NIRP) as the driver of industrialisation and economic growth.

“The contribution of manufacturing to Real GDP in Nigeria contrasts with what was obtained in countries like China (27.16% in 2019); Germany (19.11%); Japan (20.74%) and South Africa (13.53%). To drive industrialization and sustained economic growth in Nigeria, it is important that deliberate policies that are manufacturing-specific should be designed to support manufacturing activities and address the perennial challenges of the sector. It is important to note that the current government policies, if fully implemented, are good enough to address most of the challenges we are now facing,” he said.

Among manufacturing challenges, he identified acute shortage of forex; dearth of long-term funds; limited infrastructure; policy inconsistency/implementation/ enforcement; over-regulation; multiple and high taxes for the industries (the manufacturing sector is beset with over thirty statutory taxes, levies, fees, etc. charged at multiple tiers of government), and insecurity.

ABOUT WEAPONIZING THE JUDICIARY: A CASE OF THE KABUSHI AND KWACHA PETITIONS

1. The world over, an independent, objective and competent judiciary has a major role to play in not only promoting peace and unity but also in fostering economic development. When people quarrel in the community, they need to be assured that if they take their quarrels to authorities, they will get justice. Without such assurance about the independence, objectivity and competence of the judicial system, people will not waste their time taking their conflicts to the authorities for resolution. Instead, societal conflicts will be resolved using underhand methods of revenge, ostensibly using violence. That will take us back to the pre-civilization times when violence, murder and mayhem was the standard way of resolving societal conflicts.

2. That said, the behavior of our senior courts in the handling of the Kabushi and Kwacha petitions leaves much to be desired. Three courts were involved in these petitions; being the High Court, Court of Appeal and the Constitution Court. The first to take a bite at the apple was the High Court, which nullified the two elections. As per provisions in the Constitution, the High Court is the court of first instance for election related matters, and any appeal has to go straight to the Constitutional Court, not the Court of Appeal nor the Supreme Court. So subsequent to the nullification of their seats by the High Court, Bowman and Malanji went to appeal at the Constitutional Court.

3. The Constitutional Court decided to uphold the judgement of the High Court, which is fine. Nothing wrong with that. However, in upholding the nullification of the two seats, the Constitutional Court failed to clearly state in it’s judgement whether Bowman Lusambo and Joseph Malanji were eligible to stand in the by-elections which had been caused by a nullification of their seats. That was problem number one. At this juncture, allow me to state that judgements of the Constitutional Court are traditionally vague and either lack clarity or create additional debate and confusion. Whenever the Constitutional Court issues a judgement, litigants are often left wondering who has won the case! Time and again, this has resulted in additional litigation as was the case with Former President Lungu’s eligibility matter. The Constitutional Court has often failed to bring matters before it to a finality, despite being a court of final instance. Why this Court behaves in this manner has always been a wonder to me. But l am inclined to believe the submissions of Counsel John Sangwa which he made at the very inception of the Constitutional Court, that the judges of this Court lack the necessary qualifications and experience. Indeed, there appears to be very little competence at Constitutional Court level and it is only by the grace of God that they have not plunged this country into a constitutional crisis.

3. Anyway, back to the issue at hand. So in upholding the nullification of the two seats, the Constitutional Court omitted to state in their judgement whether Bowman and Malanji were eligible to stand in the upcoming by-elections. This prompted another lawsuit by the two, before the same ConCourt. In the second matter, the Constitutional Court ruled that nullification does not amount to disqualification, meaning that the fact that Bowman and Malanji’s seats were nullified does not mean that the two are disqualified to stand in the upcoming by-elections. In a properly functioning democracy, this second pronouncement by the Constitutional Court would have put this matter to bed once and for all. But not under the current regime.

4. A few days later, the Electoral Commission of Zambia (ECZ) issued a statement that it will not accept nominations from individuals whose seats were nullified in Kabushi and Kwacha constituencies. This statement by ECZ was contrary to the second judgement of the Constitutional Court which made it clear that nullification of the two seats did not mean that Bowman and Malanji were disqualified from re-contesting.

5. As a result of the ECZ statement, Bowman and Malanji approached the High Court and commenced judicial review proceedings against the Electoral Commission of Zambia for their decision to ignore the judgement of the Constitutional Court and try to exclude Bowman and Malanji from filing in their nominations. As the matter before the High Court was being allocated, ECZ proceeded to conduct the nomination process for both Kabushi and Kwacha, and true to their word, they refused to accept nominations from Bowman and Malanji. A few days after the nominations, the High Court, after constituting a panel of three judges, granted the Applicants leave to commence judicial review proceedings against ECZ, which also acted as a stay of the elections. In other words, the elections could not take place until this matter was concluded.

6. A few days later, the Government through the Attorney General applied and was joined to this matter as a Respondent. Immediately thereafter, the Attorney General approached the Court of Appeal and obtained a stay of all proceedings in the High Court. This was despite the Constitutional requirement that only two courts will deal with election related disputes; the High Court and the Constitutional Court. The Attorney General as learned as he is, knew or should have known that the Court of Appeal had no jurisdiction in this matter, and that if he wanted to appeal the High Court ruling in the judicial review proceedings, he should have approached the Constitutional Court and not the Court of Appeal. Similarly, the judges of the Court of Appeal, as learned as they are, knew or should have known that they had no jurisdiction to hear this matter, let alone grant a stay of the proceedings of the High Court. But both the Attorney General and the Court of Appeal decided to proceed with their illegality.

7. In issuing it’s illegal stay of the judicial review proceedings before the High Court, the Court of Appeal also claimed to have stopped the 21 days from running. Judicial review proceedings need to be concluded by the High Court within 21 days, otherwise the whole proceedings are considered null and void. But the Court of Appeal claimed to have stopped those 21 days from running, despite not having the jurisdiction to hear this matter and not having the authority to stop a statute-established timeline from running. Additionally, after the Court of Appeal stopped the proceedings before the High Court, they did not go on to expeditious hear the appeal which the Attorney General had filed before it, so that the appeal could be determined and the stay on the High Court proceedings can be lifted. Instead, the Court of Appeal just stopped the High Court proceedings and went on holiday waiting for the 21 days to expire!

8. About a week ago, and despite the High Court stay of elections still being in force, the Electoral Commission of Zambia announced that it will hold the Kabushi and Kwacha by-elections on Friday, 21st October 2022. President Hakainde Hichilema then proceeded to go to Kabushi and Kwacha to campaign. A day before the scheduled date for the elections, the Court of Appeal scheduled a hearing of why the Attorney General had obtained a stay of the judicial review proceedings before the High Court. However, the lawyers from Attorney General’s chambers did not show up, because, according to a memo from the Acting Chief Justice, all the lawyers were attending a workshop and all matters involving the AG needed to be adjourned.

9. On the same day however, the Constitutional Court sitting in Ndola ruled that the Court of Appeal had no jurisdiction to stop the judicial review proceedings that were before the High Court, because any appeal of an election related dispute is supposed to go to the Constitutional Court and not the Court of Appeal. The ConCourt further ruled that the Court of Appeal had no authority to stop the 21 days from running. However, l do not believe that this ruling by the Constitutional Court came as a surprise to both the Attorney General and the three judges of the Court of Appeal.

10. I strongly believe that the judges of the Court of Appeal knew fully well that what they were doing was an illegality, but decided to do it anyway, in order to subvert the course of justice and allow the Kabushi and Kwacha by-elections to take place without Lusambo and Malanji being heard by the High Court. Knowingly defeating the ends of justice is a serious criminal offense, and it is for this reason that l call for the arrest and prosecution of the three Court of Appeal judges who knowingly defeated the ends of justice in this matter. If the police do not act, we will consider private prosecution in this matter.

SEER 1 ON ‘THE DORA SILIYA PHENOMENON’

When Seer1 tells President Bally about learning something from departure of Dora Siliya from the former ruling parties to the new party, his sentiments must be understood just like that and not be underestimated.

He is right: PF largely lost an election because of selfishness, many who worked with former President Edgar Lungu and were in position to shape decisions cared more about themselves, their interests, than they did with ordinary people in their party structures and ordinary Zambians generally.

Their relationship with the former ruling party was about the benefits they could get, that is what kept them closer to the former ruling party and the Leader.

Immediately, PF lost these very people who portrayed themselves as darlings of the party and the President chameleonically moved on and are looking for opportunities to transform themselves from Green to Red. When time comes, they will portray themselves as more Reds than the actual people who fought for the Red to come into power.

The list does not exclude Independent MPs. The biggest mistake those that surrounded former President Lungu made was to think that by supporting independent candidates, the strategy would help them gain numbers to remain in government. Independent candidates who were supported by those that surrounded President Lungu had more resources, party materials and vehicles than their own candidates on the party list.

But among these independent MPs who won and thrived on the support they received, how many have remained grateful and loyal to those who supported them? Only Munir Zulu, the man who was not even supported is standing with them.

The many independents who received support are now behaving as if nothing ever happened. They are busy working out opportunities to dine from the King’s table with both hands. They can and will probably do anything to even support the prosecution of those who supported them to become independents all in the quest to be seen as the good ones. This is a test of loyalty.

What lessons are in this which Seer 1 would like President Bally to learn:

  1. The ivory you see from people’s smiles can be fake and temporal, be loyal to those who helped you on your way up because you will need them sooner when you on your way down. Those closer to you wont tell you the truth about the political outlook on the Copperbelt, Lusaka, among others;
  2. Defectors will always come to you, nicely dressed in your regalia and standing next to the very riches they amassed while they worked against you, their intention is not because they believe on you but they believe in the power you possess that has capacity to continue changing their lives.
  3. At most, be loyal to those who were loyal to you. A man’s and woman’s true loyalty is defined when one is struggling or in trouble. There are politicians who don’t just love the idea of staying in opposition as you did but seek a smooth path all the way. They need to protect their businesses and continue living a good life. These will bring you down.
  4. People in institutions such as the Electoral Commission of Zambia will help you get some temporal victories, as it has happened in Copperbelt, because that is the nature these Commissions under any executive arm but it usually dawns that soon they may not manage to deal with peoples pressure. The election in Copperbelt must be an eye opener than being considered a victory.

Remember, be good to the people who were with you on your way up the ladder, you will need them on your way down, that’s the way it is

NAPSA PARTIAL PENSION: WHAT I KNOW AND WHERE WE’VE COME FROM

THE fact that it has divided the nation speaks volumes. The decision by the New Dawn government to implement the policy of allowing workers to access their pension before retiring is the bull elephant in the room.

Those who are supporting the policy have been savagely mauling anyone with a different view.

Eminent economists Lubinda Habazoka and Chibamba Kanyama, and opposition politician Sean Tembo have been victims of cruel trolling and dragging on social media at the hands of government supporters, some corporate communication practitioners and mostly prospective beneficiaries of the reform for merely offering their expert opinions.

Whether it is good or bad does not mater to me because I am peacefully enjoying my full life pension which comes in form of a monthly salary. It can’t buy me a private jet but it is enough to meet the basic needs of my family. I can’t complain.

I just want to contribute to the debate by sharing what I know so that people can engage from an informed perspective.

Reforming the country’s social security policy and legal frameworks to make them more responsive to present circumstances and meet the evolving needs of pensioners was one of the top priorities of the Patriotic Front (PF) party’s manifesto while in opposition. It was one of its leader late Michael Chilufya Sata’s campaign promises before the 2011 general elections.

After winning the elections Mr Sata wanted his promise to be immediately implemented.
In 2013 a technical team headed by then Ministry of Labour and Social Security permanent secretary Trevor Kaunda was appointed to develop a communication strategy for the national pension reforms.

I was in the media sub-team with seasoned journalist Berry Lwando. Our task was to craft an effective national communication campaign aimed at educating citizens on the long-term benefits of the reforms. Instead of getting a lump sum of their pension as had been the case pensioners would be receiving a monthly salary for the rest of their lives.

The PF government had come up with a two-tier system where employees would be required to make monthly contributions to a statutory (compulsory) pension scheme (NAPSA) and an optional scheme under which they could access their benefits while they were still in employment.

They could use the money to build a house, start a business or invest in education without tampering with their life pension at NAPSA because it was for their survival after leaving employment.

To come up with these reforms the government had appointed a technical team which had travelled to various countries within Africa, in Europe, United States and other parts of the world. The aim was to study their pension schemes, look at the best practices and make recommendations to the government on a system that could be most beneficial to the Zambian worker.

The team also toured Zambia widely to obtain an empirical picture of the living conditions of pensioners. The reforms Mr Sata’s administration was introducing were a response to the recommendations contained in the technical team’s report.

In the National Pension Reforms Communication Strategy Technical Team Mr Lwando was responsible for electronic media while I was in charge of the print media component. We were therefore privileged to have access to the report. One of the key findings was that the system of giving lump sums upon retirement had wrought havoc on the lives of pensioners and their families.

Many cases had been cited in the report. Many Zambian pensioners had been investing their lump some benefits in businesses when they had never done any business before. As a result, the businesses collapsed leaving them without an income to survive on.

Some had used their pension to build houses. In some cases, the house construction project would gobble the entire pension creating a situation where the pensioner and their family had a house to live in but without an income to live on.

In fact, in many cases the money finished when the house was only at window or roof level. Even after selling the incomplete house the family remained without a source of livelihood. It did not help matters.

Yet some recklessly squandered their entire pension on self-indulgence and ended up without any money to survive on. Many of these pensioners became destitute and ended up either losing their mental balance, dying of depression or committing suicide leaving behind widows, widowers and orphans.

Without any means of survival many pensioners and beneficiaries became a burden on the government. Social cash transfer and food security packs became their sole source of survival. This put unnecessary pressure on the national Treasury.

In the years the monthly salary pension regime has been in operation pensioners have had a reliable source of survival because they are assured of an income every month despite being unemployed.

We are now partially reverting o the old regime that existed before the PF ascended to power because almost every eligible worker will be queuing for their partial pension. This will reduce their monthly life pension after retirement.

President Hakainde Hichilema had promised that his government would reform the national social security system so that workers could withdraw part of their pension from NAPSA instead of waiting until they retire. Like Mr Sata Mr Hichilema is merely fulfilling his promise to the voters.

However, it has raised a tempest and left the country rent in the middle. Two extreme camps have emerged: those in support and those who are against the reform.

We need a sober, intelligent debate in the interest of posterity. It is important for both sides to listen to each other and not bully those who don’t agree with us.

So far, most of the arguments I have seen on social media have been based on emotions and not reason. In the end it will be up to an individual worker to decide, although the lure of cash is almost irresistible.

My advice is that we look back at history and see what lessons it can teach us. It is for the good of our nation.

US, Russian defence ministers hold rare call as Ukraine advances

Russia’s defence minister held rare telephone talks with his US counterpart Friday, after pro-Kremlin officials said they were turning Ukraine’s southern city of Kherson into a “fortress” as Kyiv’s forces advance.

Few details emerged of the conversation between Russia’s Sergei Shoigu and US Defense Secretary Lloyd Austin, but both sides confirmed they had discussed Ukraine.

“Topical issues of international security — including the situation in Ukraine — were discussed,” said Russia’s defence ministry.

“Secretary Austin emphasized the importance of maintaining lines of communication amid the ongoing war against Ukraine,” a US military spokesman said.

It was only the second call between the ministers since Moscow invaded Ukraine on February 24. Back in May, Austin had urged Moscow to implement an “immediate ceasefire”.

At the time, Russia’s invading force had been beaten back from the capital Kyiv but were making steady gains in the eastern Donbas and Kharkiv regions and had consolidated their position in the south.

Six months on, however, Ukraine’s forces have pushed back.

Kyiv’s forces in recent weeks — aided by Western weapons — have been advancing along the west bank of the Dnieper river towards the region’s main city Kherson.

The first major city to fall to Moscow’s troops, retaking it would be a significant prize in Ukraine’s counter-offensive.

Kyiv said Friday it had retaken a total of 88 towns and villages in the region since launching its offensive to retake Kherson in the late summer while President Volodymyr Zelensky welcomed the capture of Russian arms by his forces in the region.

– Kherson ‘fortress’ –

Moscow-installed authorities in the region on Friday accused Kyiv’s forces of attacking a bridge being used by civilians.

“Four people were killed,” pro-Moscow official Kirill Stremousov said on Telegram. “The city of Kherson, like a fortress, is preparing for its defence.”

Russian investigators said later two of the dead were journalists and that 13 people had been wounded.

A Ukrainian military spokeswoman Nataliya Gumenyuk denied Kyiv’s forces were responsible, saying they did not target local populations.

Kyiv has denounced the organised movement of Kherson residents to Russia and other Moscow-controlled regions as “deportations” of Ukrainian citizens.

Zelensky told European leaders Thursday that Russian forces had mined the nearby Kakhovka hydroelectric power plant with the intent of blowing it up.

Its destruction could cause flash-flooding for hundreds of thousands of people, he warned.

On Friday, Ukraine’s Prime Minister Denys Shmygal called for an international monitoring mission to deploy at the dam.

Cutting water supplies to the south could also hit the cooling systems of the Zaporizhzhia nuclear power plant, Europe’s largest, he added.

Both sides have accused the other of repeatedly shelling the nuclear facility, endangering operations.

– Grain shipments ‘delayed’ –

Ukraine’s push in the south comes after a sweeping counter-offensive in the northeast Kharkiv region that has badly impaired Russia’s supply routes and logistics corridors in the eastern Donbas region.

But Russian forces have continued shelling the region’s largest city, Kharkiv, and the presidency said six people were wounded Friday when “industrial infrastructure” was hit in the city.

Also Friday, the Ukraine presidency said Russian forces were shelling sections along the entire front line of Donbas and that two had been killed in the Donetsk region.

And later Friday, Zelensky accused Russia of “deliberately delaying the passage of ships” exporting grain from Ukrainian ports bound for countries in Africa and Asia.

“Russia is doing everything to ensure that at least hundreds of thousands of these people become forced migrants, who will seek asylum… or die of hunger,” he said in his nightly video address.

More than 150 ships had been affected, he said, listing Algeria, Bangladesh, China, Egypt, Indonesia, Iraq, Lebanon, Morocco and Tunisia as among the countries hit by the delays.

In late July, Turkey and the United Nations brokered a landmark deal with Moscow and Kyiv that designated three Black Sea ports for Ukraine to send much-needed grain supplies through a Russian blockade.

Russia has complained its own exports have suffered and contended that most deliveries were arriving to Europe, rather than poor countries where grain is most needed.

Moscow’s forces have carried out a series of strikes targeting Ukrainian cities and energy infrastructure in recent days with drones the West says were supplied by Iran — an issue France, Britain and Germany said Friday should be investigated by the United Nations.

The UN ambassadors of the three countries wrote in a letter that they were “deeply concerned by the transfer of unmanned aerial vehicles (UAVs) from Iran to Russia in violation” of a Security Council resolution.

“These UAVs are being used by Russia in its war of aggression against Ukraine in attacks against civilian infrastructure and cities across Ukraine, leading to the death of innocent civilians,” they wrote.

Ghana’s economic woes continue as the country seeks International Monetary Fund (IMF) support for the 17th time. The bailout was necessary after the new electronic transaction levy (e-levy) – a 1.5% tax on all electronic transfers above GHS100 – failed to yield the expected results.

Previous IMF programmes have improved macroeconomic stability in Ghana. Fiscal discipline in the country often depends on these programmes, as self-imposed controls are rare. Nonetheless, the solution to Ghana’s crisis lies with its government and people.

The economy has suffered significantly since early 2022, plunging the country into a full-blown economic recession. Inflation rose from 13.9% in January to 37.2% in September, and some analysts believe the actual level is more than twice the official rate – possibly as high as 98%. Petrol and diesel prices have jumped by 88.6% and 128.6% respectively. Most public transport fares have increased by over 100% since January.

Likewise, water and electricity tariffs have risen by 27.2% and 21.6% respectively this year. According to the World Bank, Ghana has the highest food prices in sub-Saharan Africa, with prices soaring by 122% since January.

The country’s interest rate of 30% and lending rate of 35% are the highest in Africa. Bloomberg says the Ghana cedi is now the worst performing currency globally, and the IMF revised Ghana’s projected growth rate for 2022 from 5.2% to 3.2%.

Problems began when international credit rating agencies downgraded the country to junk status due to its unsustainable and growing debt. The relegation denied access to global capital markets, and prevented the raising of the US$2-3 billion Eurobond required to service its debts and support the Ghana cedi, which then went into freefall.
The major problem now is rising debt, which stands above 80% of GDP and is projected to reach 104% by the end of 2022. Ghana has been thrust into debt distress as 70% of its total revenue must go towards debt servicing. This leaves little room for other statutory obligations or investment in education, health and infrastructure.

While the government blames the economic crisis on the pandemic and Russia’s invasion of Ukraine, the political opposition and some civil society organisations believe state mismanagement is largely responsible.

Several structural problems must be fixed. For instance, the country’s inability to produce for export and its reliance on imports for daily consumption has led to a perpetual deficit in its balance of trade. That means the Ghanaian currency is fated to be inherently weak compared to the dollar, leading to high import prices that hit consumers.

Poor public financial management is also a factor, especially the high levels of unproductive and profligate government expenditure. From 2017 to 2020, Ghana – a small country – had over 120 ministers and 1 000 presidential staffers. These lucrative appointments drained the public purse.

The crisis was further aggravated by government spending on flagship programmes that didn’t yield the expected results, such as NABCO (a graduate apprenticeship programme) and One Village, One Dam.
The 2018 financial sector clean-up cost Ghana about US$4 billion in borrowed funds, says the government – a figure experts believe could have been less had implementation been more efficient. Debt was also driven by the 2014 capacity charges agreement that enabled independent power producers to address energy shortages. The government says the country paid US$937.5 million in capacity charges between 2017 and 2020.

Ghanaian governments also have a history of large fiscal deficits in election years. In 2020, the deficit was 15.2% of GDP compared to the 8% average from 2017 to 2019.

Domestic revenue mobilisation is also weak due to tax exemptions for large corporations, government cronies and corruption. The country loses about GHS2.2 billion (US$300 million) annually this way. According to the Auditor-General, public sector irregularities from 2016 to 2020 amounted to about GHS48 billion (over US$8 billion). And a recent report to Parliament flagged GHS17.4 billion (US$3 billion) in financial irregularities in 2021, 36% higher than in 2020.

To achieve macroeconomic stability, the government has applied for a US$3 billion IMF bailout programme starting in the first quarter of 2023, with discussions focused on debt restructuring to give the government fiscal space. Meanwhile, the state can boost public confidence in the economy through other measures.

Having over 120 ministers and 1 000 presidential staffers was a drain on Ghana’s public purse

First, the Fiscal Responsibility Act capping government deficit at 5% of total revenue that was suspended in 2020 due to the pandemic should be restored. Second, measures are needed to drastically reduce government’s size, including allowances and bonuses. Foreign travel and new vehicle purchases should be banned unless vital. Initiatives such as the Free Senior High School programme must be reviewed to improve their efficiency.
Third, revenue mobilisation measures are needed. The newly passed tax exemption bill, which has clear eligibility criteria and provides for monitoring and evaluation, should be implemented. The new bill could reduce tax exemptions to at least GHS500 million (US$66.7 million).

Using technology, the government could improve property tax collection, which has been sporadic and low due to poor information about ownership and accurate valuations. The extractive industry could bring in revenue if the tax regime is tightened and properly implemented. The government must also seal the leaks at ports to realise more from excise and import duties.

Parliament should enact legislation to establish a debt limit and cap government borrowing to prevent the crisis from recurring. Constitutional amendments to limit the number of ministers and appointees in government, abolish ex-gratia payments and review emoluments to public servants must be considered.

Finally, Ghana needs a national industrialisation plan anchored in its strong manufacturing sector with links to agriculture. The country must establish import-substitution and export-driven industries based on its comparative advantages. The One District One Factory industrialisation agenda should be reviewed and better implemented. These measures can improve the country’s trade balance and government revenue.

Over 155 killed in tribal violence in Sudan’s Blue Nile region

(KHARTOUM)At least 155 people were killed in three villages on the outskirts of the Wad al-Mahi locality on Wednesday night and Thursday morning, as a result of a continuing bloody conflict between Hausa and the Berta tribes of Blue Nile.

As of October 6, the inter-communal fighting in the Blue Nile which, started in mid-July, resulted in the deaths of 149 people and the displacement of 64, 800 people.

“155 people were killed as a result of the armed clashes on Wednesday night and early Thursday morning, according to the preliminary statistics,” Wad al-Mahi’s Commissioner Abdelaziz al-Amin, told the Sudan Tribune.

“Most of the victims were killed by live bullets,” he further stressed.

Al-Amin pointed out that the brutal attacks took place on Wednesday night in three villages despite the curfew, ban on gatherings and prohibition on carrying firearms in public.

He described the situation in the region as dangerous and requiring concerted efforts to quell what he called a “sedition”.

The local official added they issued strict instructions to the security and military services to immediately disarm any armed groups and disperse tribal gatherings.

He revealed the evacuation of large numbers of families to Al-Rusyaris and called on the UN and aid groups to provide humanitarian assistance to the affected civilians and displaced people.

Activists posted horrific images on social media of victims, most of whom were burned to death inside their homes, including women, children and the elderly.

For his part, Osman Jano, a Hausa traditional leader, said that the number of dead people is higher than what said Wad Al-Mahi commissioner.

“The victims of the events on Wednesday and Thursday exceed 200, most of them in area 4,” Jano told Sudan Tribune.

“What has happened over the past two days is genocide and ethnic cleansing, Berta groups have used heavy weapons and some are carrying machetes,” he added.

The tribal leader added that a large number of victims were slaughtered and others burned inside homes and pointed an accusing finger at the region governor saying he is still unable to control the situation.

UN censures ban on movement

The UN Humanitarian coordinator Eddie Rowe issued a statement on Wednesday saying that “At least 1,200 people have been displaced and an unconfirmed 170 people have been killed and 327 have been injured”.

Rowe further regretted a decision by the Blue Nile governor prohibiting the movement of civilians using trucks in the Dam towns 1-7 within Wad Al Mahi locality.

“This restriction on freedom of movement prevents people from seeking safety and accessing life-saving services, thereby endangering their right to life,” he said.

The Humanitarian Coordinator reminds all parties to the conflict to comply with their obligations under international humanitarian law and ensure the protection of civilians and civilian infrastructure, further read the statement.

Joe Biden to review sanctions on Zimbabwe ‘to make them current’

The United States (US) government has threatened to review its targeted sanctions on Zimbabwe to make them current by adding more individuals if the regime continues with more violations of human rights ahead of the 2023 harmonised general elections.

US Department of State Sanctions co-ordinator James Obrien on Wednesday said sanctions against Zimbabwean leaders and entities linked to the State would not be removed if human rights abuses are not stopped.

“People who commit human rights abuses should be identified. We are going to review our sanctions on Zimbabwe to make sure that they are current.

“If these individuals continue to be violent, [perpetrating] human rights abuses and corruption — there would be additional interest in extending the list as well,” O’Brien said while addressing an Africa Media Hub digital Press briefing on Wednesday

US Sanctions Policy and Implementation director Jill Millinax said the measures were targeted at human rights abusers.

“We use these sanctions programmes to disrupt the activities of human rights abusers, terrorists and other bad actors’ ability to undermine democracy, to stoke instability and to provoke violence.

“The ultimate goal of our sanctions, I have to say, is not to punish these individuals but to bring about a positive change in behaviour,” Millinax said.

Recently, the US Department of State issued a statement saying they were removing 11 individuals on their sanctions list.

The Zimbabwe sanctions regime provides restrictions on supplying arms and related services to designated companies, restrictions on providing assets to designated persons or entities and restrictions on dealing with the assets of designated persons or entities (requirement to freeze assets).

Zimbabwe is facing an acute socio-economic and political crisis. The ruling Zanu-PF party blames the problems on the sanctions.

The US imposed the targeted restrictions two decades ago with the aim of forcing the Zanu-PF regime led by late former President Robert Mugabe to respect human rights, property rights and end corruption.

Mugabe was ousted from power in November 2017 through a military coup by the current President Emmerson Mnangagwa and his deputy Constantino Chiwenga.

But human rights violations are still persistent as evidenced by the suppression of the dissent through the frequent arrest of journalists and opposition activists.

We know that UPND does not have politicians, but businessmen ready to sell Zambia to the highest bidder, but what has happened in Kwacha and Kabushi shows that UPND just lacks think-tanks that can help the party make sound decisions that are good for them and the country at large.

Never before have we seen a head of state go twice to campaign in a by election in another province and stay in a Constituency so many days, begging people for votes and then on Poll Day people refuse to come out including members of his party.

It is a fact that Mr. Hakainde Hichilema’s style of leadership is not inspiring. And the autocracy, stubbornness and disregard shown in these two by elections just to win the two constituencies at all cost, has put a dent on the already questionable governance and leadership style of the Zambian President Mr. Hakainde Hichilema and his team.

Zambia is not a business, it’s a nation, it’s not a company, its a country and heaven knows its not a company board, its a state. People power is the real and ultimate power and you cannot force your will on people like that. After this, the UPND will try to do damage control, but the truth is that they will never repeat the maneuvers that they did in these two constituencies, unless their levels of shame and integrity are at zero. The shame attached to these elections and the way the people have thrown the last blow shows that indeed people know their rights and that is why even the UPND members in these two Constituencies did not turn up to vote in these sham of elections.

How does the head of state keep embarrassing himself like this? Where are his advisors or even just friends? We know that we have a very stubborn president who listens to no one but himself, but can people that care for him, the UPND and the country at large gather even two percent courage, look their boss in his eyes and tell him to stop the rot. He can’t continue to do things they do not make sense like what happened in these shameful elections.

People of Kwacha and Kabushi, you are the real heros. We salute you. Let it be known even to the future generations that there lived a King/ President who forced elections 58 years after Zambia got independence. He totally disregarded the Courts and the Constitution to have his way or no way. But the people stood up and showed him that they can’t be forced to vote for people they don’t want. We really need to watch and pray, otherwise Zambia as we know it will be a shell of itself in just a year and a few months of this autocratic regime.

THE Zambia Police Service high command has effected staff transfers and appointments in the provincial and other divisions.

Substantive commanding officers have been appointed.

At State House, Justine Molo is the commanding officer and senior assistant Shapa Wakunguma, who is President Hakainde Hichilema’s Aide-De-Camp (ADC), has been promoted to the rank of deputy commissioner of police, State House division.

Copperbelt Province acting commanding officer Sharon Zulu has been transferred to Northern Province as the substantive commanding officer.

Retired deputy commissioner of police Peacewell Mweemba has been recalled from retirement and appointed as Copperbelt Province commanding officer, on contract.

Luapula Province acting commanding officer Daniel Mseteka becomes the deputy for Mweemba.

Western Province acting commanding officer Fwambo Siame has been confirmed in that position there and will be deputised by Faula Namalongo.

David Mukuka Chileshe has been recalled from retirement and appointed as the Central Province commanding officer, to be deputised by Charity Munganga, who has been Western Province deputy commanding officer.

Luapula Province will have Gloria Mulele as the commanding officer and will be deputised by outgoing Kamfinsa School of Public Order and Maintenance (SPOM) commanding officer Patrick Bili.

In Muchinga Province, Paul Achiume, who has been Lilayi Police College commanding officer, will be the new commanding officer, with Stephen Mayoko as the deputy commanding officer.

Protective Unit headquarters commanding officer Limpo Liyali is the new Eastern Province commanding officer and his deputy is Buumba Munkondya, who has been Muchinga Province acting commanding officer.

Retired assistant commissioner of police Fred Hamaamba is recalled from retirement, promoted to the rank of deputy commissioner of police and appointed protective unit headquarters commanding officer.

In Southern Province, retired Mubanga Kaunda has been recalled and appointed the commanding officer, to be deputised by outgoing Eastern Province acting commanding officer.

Dennis Mola is the new commanding officer in North-Western Province and will be deputised by former Southern Province acting commanding officer Alfred Nawa.

In Lusaka Province, the deputy commanding officer, Creto Kaanza, has been promoted to be the commanding officer and his deputy is Mubita Nawa.

Nawa is an accomplished police officer of many years in the Service and, until this appointment, has been the Criminal Investigations Department (CID) deputy director at the police headquarters.

Nawa’s rank has since been upgraded from senior assistant commissioner of police to deputy commissioner of police.

Other appointments have seen outgoing North-Western Province deputy commanding officer Robinson Moonga becoming the airports division commanding officer, on contract.

Auxensio Daka has been recalled from retirement and made to act, on contract, as commissioner of police in charge of administration at the police headquarters.

Tresford Kasale, who has been undeployed, has been appointed as the director – medical at police headquarters.

Mass demos against Chakwera’s incompetence set for October 27 in Lilongwe

The much awaited mass demonstration against President Lazarus Chakwera’s incompetence is slated for October 27, 2022 in the capital Lilongwe.

The country’s civil rights groups under the banners Action Against Impunity, a network comprising Civil Society Organizations (CSOs), Human Rights Defenders (HRDs), Concerned Citizens, Human Rights and Political Activists, Non- Governmental Organizations, Faith Based Organizations (FBOs), Labour Unions and the University Students are behind the demos.

Addressing the news conference on Friday, October 21 in the capital Lilongwe the rights groups leaders observes that Chakwera is the chief architect and beneficiary of the major corruption scandals that have marred his two years in office.

“President Chakwera and his cronies are swimming in opulence when inmates in our prisons are starving to death due to acute food shortage; when Malawians cannot afford basic necessities such as Maize, sugar, cooking oil, bread, water and electricity due to skyrocketing cost of living; and when his government has failed to provide a safety net!

“While the economy is on its knees due to forex crisis, his two advisors were seen posing while admiring and showing off over a million US dollars which the private sector wished they lay their fingers on,” reads in part the statement.

The statement adds, “As result of the poor leadership and President Chakwera’s involvement in corruption, Malawi has turned into a crime scene with multiple crises and disease outbreaks.

“It is for this reason that we are calling upon Malawians of all walks of life from all corners of the country to join us in the peaceful demonstrations to be held on Thursday, October 27, 2022, from 09:30hrs.”

“Since the issues raised require executive powers to be resolved, the demonstrations in Lilongwe will start from the Lilongwe Community Ground passing through Mchesi, all the way to the Kamuzu Central Hospital Roundabout and parliament building via the Presidential drive up to the Kamuzu Palace, just 100 meters away from the palace’s main gate where a petition will be presented to President Chakwera.

Meanwhile, all well-meaning Malawians are kindly being requested to join the demonstrations in solidarity in the following areas; Mzuzu, Blantyre and Zomba,” concludes the statement.

The Action Against Impunity, a network comprising Civil Society Organizations (CSOs), Human Rights Defenders (HRDs), Concerned Citizens, Human Rights and Political Activists, Non- Governmental Organizations, Faith Based Organizations (FBOs), Labour Unions and the University Students, that do not tolerate state institutionalized corruption, incompetence and impunity, is hereby challenging President Lazarus Chakwera that he has failed to use his executive powers to provide the much needed change that Malawians badly need now, just like the way they needed it two years ago!

This is clearly mirrored through endemic corruption, institutionalized incompetence and his insensitivity to the dehumanizing poverty that is threatening the survival of millions of vulnerable and marginalized Malawians.

Instead of walking the talk on the zero-tolerance against corruption and the promise to fix the country, the President has mastered the art of saying one thing in the public and doing exactly the opposite behind the scenes.

Gauging by the nauseating corruption levels, it is very clear that Chakwera is the chief architect and beneficiary of the major corruption scandals that have marred his two years in office.

Malawians that care would agree with us that apart from the usual Public Relations (PR) stunts characterized by unwarranted outbursts to the helpless Anti- Corruption Bureau (ACB) Director Martha Chizuma, the President has shown all the signs of a captured leader.

If President Chakwera was really serious about fighting corruption in the country, then the investigations involving British business person Zuneth Sattar would have reached their logical conclusion by now. Evidence is there that the ACB Director lacks political will and commitment from her boss, the state President.

To put it bluntly, the forex, fuel, electricity and the acute shortage of essential drugs and medical supplies crises point to a larger problem of failure by Chakwera to use his executive powers to call for order and sanity. This simply means Malawi is in leadership crisis.

Almost all the high-profile scandals in the Tonse Alliance government point to either the State House or President Chakwera himself. Here is the basis of our actions;

President Chakwera’s former Chief of Staff Prince Kapondangaga and his own Vice President, Dr. Saulos Chilima, were mentioned by the President as some of the individuals that were named in the ACB report in relation to the Sattar investigations. There is now way the President can be spared
from these alleged corruption scandals.

Dr. Chakwera’s friend and advisor Pastor Mainja was named in the MK6.2 billion pandemic funds that were unaccounted for. The President cannot lie that he was not aware about this.

The President’s own friend and advisor Pastor Martin Thom was implicated in the loan authorization bill that was smuggled to parliament. There is no way Dr. Chakwera can claim that he was not informed.

Malawi Congress Party (MCP) Secretary General Hon. Eisenhower Mkaka is still serving in cabinet as Minister of Forestry while the President is fully aware that the minister is under probe by the ACB over the alleged purchase of a Mercedes Benz.

Malawians do not understand why President Chakwera is keeping Minister of Mines Albert Mbawala, Director of Public Prosecutions (DPP) Dr. Steven Kayuni, Accountant General (AG) Jean Munyenyembe and IFIMIS Director Felix Zagwazatha Sato after they were implicated in the
unjustifiable accumulation of allowances when 35 junior civil servants were arrested and interdicted over the same.

President Chakwera and his cronies are swimming in opulence when inmates in our prisons are starving to death due to acute food shortage; when Malawians cannot afford basic necessities such as Maize, sugar, cooking oil, bread, water and electricity due to skyrocketing cost of living;
and when his government has failed to provide a safety net!

While the economy is on its knees due to forex crisis, his two advisors were seen posing while admiring and showing off over a million US dollars which the private sector wished they lay their fingers on

More recently, Malawians were disturbed with revelations that government had been swindled a whopping MK30 billion meant for the Affordable Input Program (AIP). Now here we are risking lives of millions poorest of the poor.

As if this was not enough, the MCP connected business people are smuggling truckloads of Maize from the Agriculture Development and Marketing Corporation (ADMARC) to Zimbabwe and the East African countries.

As result of the poor leadership and President Chakwera’s involvement in corruption, Malawi has turned into a crime scene with multiple crises and disease outbreaks.

It is for this reason that we are calling upon Malawians of all walks of life from all corners of the country to join us in the peaceful demonstrations to be held on Thursday, October 27, 2022, from 09:30hrs.

Since the issues raised require executive powers to be resolved, the demonstrations in Lilongwe will start from the Lilongwe Community Ground passing through Mchesi, all the way to the Kamuzu Central Hospital Roundabout and parliament building via the Presidential drive up to the Kamuzu Palace, just 100 meters away from the palace’s main gate where a petition will be presented to President Chakwera.

Meanwhile, all well-meaning Malawians are kindly being requested to join the demonstrations in solidarity in the following areas; Mzuzu, Blantyre and Zomba. Finer details will be announced in due course.

It is important to remind all District Commissioners (DCs) and some overzealous MCP supporters that Malawi became a multiparty democracy in June 1993, therefore holding peaceful demonstrations is a constitutional right that is nonnegotiable.

US must prepare now for China invasion of Taiwan- Admiral Michael Gilday

The US military must be ready to respond to a potential invasion of Taiwan as soon as this year, a senior admiral said Wednesday, signaling heightened alarm over Beijing’s intentions towards the island.

Admiral Michael Gilday, chief of US naval operations, is the latest senior official in Washington to raise concerns that China’s President Xi Jinping may be much more willing than previously thought to seize Taiwan.

His comments came as Taiwan’s top security official warned any attempt to invade the island would fail and turn China into an international pariah.

Xi is on the cusp of securing a third five-year term at the helm of the world’s most populous nation, delivering a landmark Communist Party Congress speech on Sunday where he restated his vow to one day “reunify,” or forcefully take, Taiwan.

In a discussion with a think-tank, Gilday was asked about Xi’s speech and whether he agreed with comments by another US admiral that Beijing would be ready to take Taiwan by 2027.

“It’s not just what President Xi says, it’s how the Chinese behave and what they do,” Gilday told the Atlantic Council.

“And what we’ve seen over the past 20 years is that they have delivered on every promise they’ve made earlier than they said they were going to deliver on it.”

“So when we talk about the 2027 window in my mind, that has to be a 2022 window or potentially a 2023 window,” he added.

“I can’t rule that out. I don’t mean at all to be alarmist by saying that. It’s just that we can’t wish that away.”

– ‘No chance’ –

China’s Communist Party has never controlled Taiwan but it claims the self-ruled island as its own.

Taiwan is not a treaty ally of the United States, but Congress is bound by law to sell Taipei defensive weapons and there is bipartisan support for protecting what has become a progressive democracy and vital global trade partner.

Beijing’s stance has long been that it seeks “peaceful reunification” with Taiwan but reserves the right to use force if necessary, especially if the island formally declares independence.

The rhetoric and actions towards Taiwan have become more pronounced under Xi, China’s most assertive leader in a generation, and the military has ramped up equipment purchases aimed at pulling off an invasion.

Xi has tied taking Taiwan to his vision of the “great rejuvenation of the Chinese nation” and said the goal of reunification cannot continue to be passed indefinitely from generation to generation.

Russia’s recent invasion of Ukraine, which China has not condemned, has also raised fears that Beijing might take similar moves against Taiwan’s 23 million people.

Military analysts have long warned that even with strength in numbers invading Taiwan is a difficult task, given its location and terrain.

Taiwan’s national security chief Chen Ming-tong echoed that sentiment and delivered his own warning to Xi.

“I want to solemnly tell the Beijing authorities that there is no chance of winning to attack Taiwan by force,” he told reporters on Thursday in Taipei.

“It would lead to international economic sanctions and diplomatic isolation, ruining his (Xi’s) ‘great rejuvenation of the Chinese nation’ and making him a sinner of the Chinese nation.”

On Monday, US Secretary of State Anthony Blinken warned that Beijing wants to seize Taiwan “on a much faster timeline” than previously considered, adding that “a very different China” had emerged under Xi.

Blinken also warned any war over Taiwan would have an “enormous” impact on global trade. AFP

The Kwacha and Kabushi parliamentary by-elections have been characterized by low voter turnout.

In kwacha constituency, the majority of the 91 polling stations had not yet reached 50 voters as at 11:00 hours this morning, with over 64,000 eligible and registered voters.

Most of the polling stations visited by Phoenix News in some of the 7 wards among them Ipusukulo, Musonda, Kwacha, Lubwa and Riverside wards, were yet to finish the first strip of ballot papers that has a total of 50 with the highest, 43 voters at valley view stream 02, which has a total of 745 registered voters.

For kwacha resident Manford Mwenda, the election has seen huge voter apathy because most residents feel their candidate of choice is not participating in the election.

And speaking after casting his vote at valley view school at 10:35 hours, UPND candidate Charles Mulenga lamented the low voter turnout and attributed it to a lack of sensitization by the Electoral Commission of Zambia-ECZ- and a lack of understanding by the electorate that staying away only disadvantages them.

Meanwhile, Leadership Movement candidate Professor Oliver Silumbe says it will be challenging for whoever will win the election to work with the people because of how the election has been handled from the postponement, alleged unprofessionalism from the judiciary, selfish motives by some politicians and a lack of sensitization of the electorate, all leading to low voter turnout.

And Economic Freedom Fighters candidate Ashan Jayawardene did not cast her vote as she is not a registered voter in kwacha while independent candidate Lawrence Kasonde is scheduled to vote at 14:00 hours at CBU with Shadreck Mumba of the united prosperous and peaceful Zambia not reachable by broadcast time.

And in Kabushi Constituency, some of the electorate talked to say they have decided to shun the elections because their preferred candidate was not taking part in the polls while some say they have voted in order to have representation in parliament.

UPND candidate Bernard Kanengo cast his vote at 7:30hrs at Kaloko polling station, Independent candidate Richard Kalasa is not a registered voter in Kabushi Constituency while independent candidate Alfred Yombwe and leadership movement Osias Telela were unreachable by broadcast time.

Meanwhile, Non-Governmental Organization Center for Governance President Patrick Mutanga has described the low turnout as a silent boycott by the electorate in Kabushi Constituency.

Mr. Mutanga has also expressed concern over the lack of monitoring agencies for three participating candidates saying only non-governmental organization observers and UPND are present in polling stations.

A false dawn? Be worried, Zambia- Sishuwa Sishuwa

After coming to power via a democratic election, President Hakainde Hichilema and the ruling UPND have manipulated the Electoral Commission of Zambia and the judicial process to exclude key opposition candidates from the ballots taking place today. At the heart of these manoeuvres is the fear of defeat to the excluded candidates and the desire to increase their number of MPs in parliament for the purpose of amending the constitution to entrench themselves in power.

To give the elections some guise of legitimacy, they have ‘allowed’ weaker rival candidates to remain on the ballots in both Kwacha and Kabushi constituencies. In so doing, the UPND has strategically rigged and ‘won’ the elections even before the first ballot is cast. This form of rigging is called electoral exclusion. By employing this desperate and dangerous strategy to win polls, the ruling party is effectively fermenting civil strife and even civil war – the usual outcomes of similar experiences elsewhere in Africa.

If Hichilema and the UPND are prepared to go to this length merely to ‘win’ a parliamentary by-election, what would stop them from rigging a presidential election? Having been in the doldrums of opposition politics for over two decades, the UPND is sending a clear message that they will go to any length – including manipulating the rules and norms of a democratic political game, illegitimately banning rival candidates, and abusing incumbency advantage – to secure electoral victory and retain power.

Be worried, Zambia. Our democracy is still under attack, but now by President Hichilema, the man who vowed to rescue it when he was in opposition.

If we are to improve the quality of our governance, we must remain engaged in the democratic process in between elections, as opposed to waiting for Election Day to rescue the country from the abyss. Without the consequences of criticism from many of the voices from academia, civil society and the church who spoke truth to power under the previous regime, this ‘new dawn’ leadership might turn out to be a tragedy for both our democracy and the country.

Contrary to what many are saying, Zambia is not returning to democracy. Not yet.

The controversial by-elections in Kwacha and Kabushi constituencies have finally gone to the polls after a protracted process to give the two areas representation in parliament.

The by-election was initially scheduled to have taken place on September 15th 2022 but was pushed to today, October 21st after they were halted by the Lusaka High Court pending the determination of the petition where the two former MPs Bowman Lusambo and Joseph Malanji for Kabushi and Kwacha respectively challenged the decision by the Electoral Commission of Zambia –ECZ- to reject their nomination papers.

The ruling followed the injunction filed by Mr. Lusambo and Mr. Malanji where they sought the suspension of the parliamentary elections in their constituencies.

In the affidavit before the court, Mr. Malanji and Mr. Lusambo claimed that they would suffer prejudice unless the parliamentary polls are suspended.

The by-election further suffered a setback after two independent candidates Lawrence Kasonde and Alfred Yombwe withdrew their candidature in the Kabushi and Kwacha Parliamentary by-elections two days before the election, which they later rescinded.

The by election is taking place without the participation of the biggest opposition political party, the Patriotic Front.

Meanwhile, the opposition Patriotic Front has challenged Zambians to interrogate whether President Hakainde Hichilema’s actions regarding the embattled Kwacha and Kabushi constituency parliamentary by-elections are within the confines of law or places him above the law.

PF Acting President Given Lubinda has charged that today’s election which has excluded the former ruling party from participating is illegal following yesterday’s ruling by the Court of Appeal that the stay of the election by the High Court is still in force.

Mr. Lubinda in an interview with Phoenix News wonders whether the head of state understands the rule of law or the sanctity of the courts of law whose ruling he and the Electoral Commission of Zambia-ECZ- have allegedly ignored.

EVANGELICAL Fellowship of Zambia board chairperson Paul Mususu says the peace and prosperity being preached in Zambia should be centred on hard work.


And Bishop Mususu has admonished pastors against preaching “miracle money”.
In a homily yesterday during the National Day of Repentance, Prayer and Fasting at Lusaka’s Showgrounds graced by
Vice-President Mutale Nalumango, Bishop Mususu said Zambia would not develop on handouts.
“All hard work brings profit, but mere talk leads only to poverty. You want to chase poverty, work. You want to chase poverty in the nation, please work. May I draw attention to my beloved politicians because sometimes we also fall prey to that. It is not about handouts, it is about hard work. You can give somebody bread or a fish, they will eat today and tomorrow. They will be at you doorstep demanding for more but if you train them, give them some work to do, it becomes profitable,” he said. “They will not only get out of your way, off your radar, but they will be able to sustain and help others as well. Zambia will never prosper by handouts. It takes hard work. Proverbs 14:23 very clearly states that hard work brings profit. All of us doing our bits, our country will be prosperous.”
Bishop Mususu admonished the church to stop preaching “miracle money”.


“Just like I admonished our politicians, may I passionately appeal to my fellow clergy, especially us in the evangelical fraternity and
Pentecostal charismatic, there isn’t anything as miracle money. You must stop that. Let us help people to work. If you produce miracle
money, you are mischievously robbing the banks because the banks are the only ones entitled to print money and by the way money is not divine. It is not grace. Money is man-made. Show me the coin, whose

inscription is on the money? Even if the American dollar has ‘in God we trust’, that dollar is not grace. It is still on earth. So as
we prosper our country, let us perform miracles to heal people, to heal them and make them well so that they go to work and not lazying around and queuing up for this miracle money,” he said. “I know I may be treading on ice here but it needs to be said. The Bible says it is God by His grace who helps us produce wealth.”


Bishop Mususu said prayer and fasting was the best practice as shown by the lord who didn’t just teach it but practiced too.
“He talked about giving alms. He talked about prayer and he also talked about fasting,” he said. “In verse 2 of Chapter six of Mathew, when you give to the needy, notice, it does not say if you give to the needy, verse five says when you pray, again notice, he has not said if you pray. And then he says in verse 17, when you fast, so it is a matter of when these things are done. It is not if. Prayer and fasting are assumed by the lord Jesus Christ that a Christian ought to do these things.”


Bishop Mususu said the day of prayer and fasting was a great day in Zambia.
He said the Apostle Paul in Ephesians in Chapter 4 of the bible, says “I urge you to live a life worthy of the calling”.

“Zambia is called Christian nation and where we live a life worthy of living, keeping up with the calling of Christians, we need to live a kind of life. Then he describes the kind of life this Christian nation ought to have. You notice in verse two, he says ‘completely be
humble’. I suggest to you that if we have to enjoy what is promised in verse three, we can only do so with humility and gentleness. He says when you are humble and gentle to one another, it will be easy for us to keep the unity of purpose, the unity of the spirit. Arrogance and pride destroys unity and peace,” he said.
Bishop Mususu also implored Zambians to be patient.
“There is no peace when people are in a rush, in a hurry, pushing each other and trampling on each other to be the first,” he said.
Bishop Mususu said unity in the country was what would promote prosperity.
“We have in our theme hardwork. Let me suggest to us even on the onset… there is a number of us that think that work was as a
result of the curse, the Adam fall. No! Hard work was commissioned even before the fall. Genesis accounts for that wherein it says, in
verse five, before God created man it never rained. Why? Gensis says because there was no man to till the land. So only when God created man did he cause the rain to fall,” said Bishop Mususu. “Further He also raises and commissions Adam in the garden of Eden.
He said ‘till the land, that is your assignment’. What was added to our labour was sweat. In other words what was to be enjoyed before the fall was something that Adam needed to do but after the fall work became tough.”
The prayers were held under the theme ‘promoting national unity, peace, integration for a prosperous Zambia through hard work’.
Notables among those that attended the prayers were former vice-presidents Inonge Wina and Nevers Mumba, acting PF president Given Lubinda, former religious affairs minister Godfridah Sumaili and former first lady Esther Lungu.
Former president Edgar Lungu who was invited to be part of the prayers at the Showgrounds, opted to attend prayers in Mtendere along with Professor Nkandu Luo.

24th AUGUST 2022

ECZ PREVENTS BOWMAN LUSAMBO, JOSEPH MALANJI FROM FILING THEIR NOMINATIONS

The Electoral Commission of Zambia (ECZ) says it will NOT accept nominations from any candidate who caused a vacancy in the National Assembly.

ECZ Corporate Affairs Manager PATRICIA LUHANGA says this is in line with Article 72 sub section 4 of the Constitution of Zambia Amendment Act Number 2 of 2016.

24th AUGUST 2022

Law Association of Zambia condemns the ECZ for engaging in interpretation of the Constitution, a preserve of the Judiciary on their false stance that certain candidates were not eligible. LAZ also remind ECZ that nullification of the seat did not mean disqualification citing the Constitutional Court ruling in the matter of nine Members of Parliament that the Speaker expelled Vs LAZ.

25TH AUGUST 2022

ECZ Returning Officers in Kabushi and Kwacha constituencies refuse to accept nominations filed by Hon. Bowman Lusambo and Hon. Joseph Malanji, claiming that they were not eligible to participate in the elections.

13TH SEPTEMBER 2022

HIGH COURT HALTS ELECTIONS

THE Lusaka High Court granted Bowman Lusambo and Joseph Malanji their application to halt activities relating to the by-elections in Kabushi and Kwacha, pending determination of their matter.

This was two days before the election was due to be held on 15th September 2022.

12TH &13 SEPTEMBER 2022

INDEPENDENT CANDIDATES RESIGN

Two independent candidates; Alfred Yombwe and Lawrence Kasonde submitted resignations as parliamentary candidates for Kabushi and Kwacha constituencies in accordance with Article 52(6).

ECZ acknowledged their resignations but refuse to call for fresh nominations as required by law.

14TH SEPTEMBER 2022

ELECTIONS SUSPENDED

Following the High Court Ruling canceling the election, the Electoral Commission of Zambia inform stakeholders that the election scheduled for 15th September 2022 had been suspended until further Notice.

16th SEPTEMBER 2022

The High Court quashed the State’s application for leave to appeal against the suspension of the Kabushi and Kwacha parliamentary by-elections.

The Court further denied an application by the state to stay the suspension of the by-elections.

The opposition Patriotic Front PF’s Lawrence Shaba wins the Luangwa District Council Chairperson by-election.

The State had applied for an order to stay the decision of the High Court suspending by-elections in Kabushi and Kwacha constituencies as it intends to appeal against the ruling.

THE Court of Appeal orders a stay of proceedings and the matter before the Lusaka High Court in which Joseph Malanji and Bowman Lusambo are seeking an order that it should hold fresh nominations for Kwacha and Kabushi constituencies.

The Court of Appeal dismisses an application to discharge the stay of proceedings against the High Court it granted on 17th September, 2022.

Green Party President Peter Sinkamba and Governance Activist Isaac Mwanza petition the Constitutional Court alleging that the Electoral Commission of Zambia (ECZ) contravened the Constitution by failing to cancel elections and call for fresh nominations in Kwacha and Kabushi Constituencies after Independent Candidates, Alfred Yombwe and Lawrence Kasonde submitted their resignations.

INDEPENDENT CANDIDATES RESCIND DECISION TO WITHDRAW FROM ELECTIONS

Two Independent candidates who withdrew from taking part in the Kabushi and Kwacha Parliamentary By-elections write to the Electoral Commission of Zambia (ECZ) informing it if their decisions to rescind their withdrawal as candidates. They requested ECZ to be allowed to contest the polls.

In the past ECZ has refused to accept the renunciation of the letters of withdrawal stating that this is not provided for in law.

11TH OCTOBER 2022

DESPITE COURT ORDER, ECZ CALLS FOR ELECTIONS IN KABUSHI AND KWACHA

THE Electoral Commission of Zambia set Friday, October 21, 2022 as the date for the Kabushi and Kwacha by-elections. The commission also prescribed Thursday October 11 to Thursday October 20, 2022 as the period for campaigns for the two by-elections.

18TH OCTOBER 2022

THE Constitutional Court rules that ECZ did not breach the Constitution when it failed to cancel the Kabushi and Kwacha by-elections and call for fresh nominations after two independent candidates resigned from the election. The Court recognized that the High Court Order to suspend polls was still in force. The Court states that the decision by ECZ not to call for fresh nominations was justified as a High Court order suspended all activities related to elections in Kabushi and Kwacha constituencies.

20TH OCTOBER 2022

All court cases involving Attorney General Chambers adjourned -Acting Chief Justice

Acting Chief Justice, Hon. Mrs. Justice Roydah Mwanakulya Chinungi Kaoma, adjourns all cases involving the Attorney General until after the Kabushi and Kwacha parliamentary by-elections.

Justice Kaoma responded to an urgent request from the Attorney General written by Solicitor General, Marshall Muchende that all cases involving the chambers be adjourned as the state advocates were attending an arbitration course arranged at Chartered Institute of Arbitration between 19th October to 21st October 2022.

Justice Kaoma granted the request from the Attorney General Chambers.

Both the Court of Appeal and the High Court werebexpected to render their judgements regarding the two parliamentary by-elections where the Attorney General was a party to.

The Constitution Court has ruled that upon the lapse of 21 days set for the High Court to hear and determine a court challenge to nominations, proceedings and all orders made by the Court ceased to have any force.

This is in the matter in which Kabushi UPND aspiring candidate Bernard Kanengo was seeking an interpretation of whether the 21 days prescribed to hear matters of nominations can be stayed or extended.

In his matter, Kanengo cited the Attorney General and ECZ as respondents seeking a determination of whether pursuant to Article 52 (4) of the Constitution, the prescribed 21 days period set for the High Court to hear the matter can be extended.

On 18th October, 2022, the Constitutional Court stated that ECZ couldn’t hold fresh nominations as the orders of the High Court to hold the elections was in force.

This morning the Appeals Court also ruled that any election held in light of the Court Order will be illegal.

However the Constitutional Court has ruled that the proceedings of the High Court have lapsed as the 21 day period has expired.

SOMETIMES I BLAME MYSELF FOR THE MESS IN UPND NOW BECAUSE VERY FEW PEOPLE LIKE US THAT COULD SPEAK OUR MINDS LEFT THE PARTY AND HH REMAINED WITH BLUE EYED COWARDS AND PRAISE SINGERS

Leaving the UPND was certainly one of my best political moves that I ever made and even though people leave political parties for various reasons, sometimes you do not realise just how God orders your steps to make certain decisions until certain things happen. I’m sure Anderson K Mazoka, Michael C Sata and Edgar C Lungu could attest to this looking at their political trajectories after they left their previous political parties.

Praise singers may not know this, but apart from being one of the Media people for the party and President when I was in UPND, I was also part of the Strategy and Advisory group that advised the President on certain key issues of the party. ALL written statements from the President came from this group. At first I was the only female, but being the gender Activist that I am, I bemoaned the fact that I was the only woman in the group and they challenged me to bring other women to the group. ‘Bring women like you and not just anyone,’ I was challenged. And I brought Chipo Mwanawasa and Dr. Munkombwe, then in South Africa. Among the people in this group were Clayson Hamasaka, Dr. Mwananyanda, Johns Malunga and Monze Muleya. (I have deliberatel mentioned some of the names holding big jobs at statehouse and being accused of coming from nowhere, because I certainly know where they came from).

I constantly see some people in UPND that don’t even know how that party operates complain that President HH has brought people they don’t know to the party and Statehouse. But what they don’t realise is that UPND had specific advisory groups that dealt with issues that people were not even aware of. They were not in the formal structures but separate groups that people didn’t even know of. I can’t complain, I was respected and we worked very well. My opinions were also normally respected. At the time Clayson Hamasaka used to say that if UPND had 10 people like Saboi and another woman called Nana, then the party would form government. I was both an administrator and a grassroot person, but most importantly my contributions were well respected. It is just so sad that things happen that destroy certain things (which is a story for another day).

The current Lusaka District Commissioner, then Lusaka Province Chairlady Mrs. Rose Zulu used to say that ‘when we have a meeting with the President, Saboi should always be there.’ This is so because people in UPND would freeze when they saw HH and instead of telling him what they wanted when they go to see him, he spends the entire two hours talking instead and telling them what he wanted.

Why am I saying this today? It is simple. My biggest concern about UPND is that they turned HH into a small god when he was still in opposition. In UPND, HH is the law and the law is HH. Something I would challenge even as a member of the party and I would say that we were destroying our own leader. And luckily, he actually loved and respected me for that. Something UPND members say even today. I mean real UPND members, not people that have never even seen him but screaming loudest on Facebook.

Sadly, the UPND and HH have brought that same mentality into government. HH has very few advisors in that party because they freeze in his presence and he advises his advisors. My concern was alway that, if you could make a person a small god before he even had instruments of power, what more when he had? Well, my worst fears are now confirmed. HH is now a small god with instruments of power and just like in UPND as a party, he now wants to entrench himself as the law, the Alpha and the Omega, the Constitution of the Republic of Zambia. If people will not see him and his autocratic agenda for what it is and stop it before if fully manifests, we shall have a serious problem in this country.

With all his weaknesses and use of guerrilla media, Hamasaka is actually one of the brave people that could stand up to the President. But he has been consumed with power and doing the right thing for Zambia may not be his priority. With all due respect, I look at his line of Advisors and I can honestly tell you that I don’t think that there is even one that advises him. He is the one that advises the advisers. After all, he is the Alpha and Omega. But sadly, running a country is a collective effort and Constitutionalism should be a must, otherwise the man will burn his fingers and burn them badly.

‘President Hakainde Hichilema is at a point of telling Zambians to hell with your constitution,’ PF Chairperson for Information and Publicity Raphael Nakacinda has said.

Hon Nakacinda charged that the Head of State has no regard to Constitution.

He alleged that the disregard to the Constitution by the President and UPND members has been happening for a while.

“Mr Hakainde’s disregard to the Constitution and clear intent to suspend the constitution. There is a background to his behavior of disregarding the Constitution and also him developing a notion that he enjoys absolute power and therefore he can do anything he wants,” he said.

“At the beginning the Zambian people ignored this behavior when in fact we should have commenced impeachment proceedings because already from the beginning, the threat was eminent against the principle of Constitutionalism.”

Hon Nakacinda said the country has in the recent past witnessed the removal, “systematically, but using jungle methods and jungle law” of Constitutional office bearers including the DPP.

The PF MCC charged that the removal of the DPP was made before the JCC made the recommendations.

He said the JCC is a slaughter house for the careers of professional judicial officers, judges and magistrates.

Hon Nakacinda said there is fear running through the judiciary because professional judges are thinking of their career.

“You may recall that at the beginning, President Hakainde Hichilema created Ministries and swore in people as Ministers without following the requirement of the law, or requirements of the law. You remember that he swore in a minister of finance before Parliament was sworn in,” he said.

He said for a Head of State there is no excuse that ‘I am learning on the job.’

“When it comes to issues of the law, we expect that he would be thorough and prudent. He has extra hands to help him make sound decisions. President HH is almost reaching at a point of saying to hell with the Constitution. He is at a point of telling Zambians to hell with your constitution. Look at the interference in the operations of the ECZ,” he said.

And Hon Nakacinda said “I am sorry to say this but the ECZ today is more like just a servant’s quarter of Community house.”

Court of appeal hammers final nail in Lusambo, Malanji by-election coffin

THE COURT of Appeal has hammered the final nail in the coffin of Bowman Lusambo and Joe Malanji’s bid to return to parliament after their elections were nullified last November.

Since the nullification of their seats on account of violence, bribery lacking Grade 12 certificate, the duo vowed to retain their seats but the Electoral Commission of Zambia rejected their nominations leading to the postponement of the by-election after they took the matter the court.

After a tense legal battle, the Court of Appeal has turned down the request by former Kwacha Constituency member of parliament Joseph Malanji and his counterpart Bowman Lusambo stop the Electoral Commission of Zambia from conducting elections in Kwacha and Kabushi Constituencies tomorrow.

Judges Justin Chashi, Mwiinde Siavwapa and Kelvin Muzenga said their hands were tied as Malanji and Lusambo were asking a wrong court to bar the electoral body from conducting elections in the two constituencies slated for October 21,2022.

The trio explained that they only stopped the High Court from rendering its decision in the main matter pending an appeal by the State over the lower Court’s refusal to refer the matter to the Constitutional Court for a determination of constitutional questions it raised, therefore they cannot issue another order staying the by-election when the same was already effected by the High Court.

This was after Malanji and Lusambo’s lawyers opposed the court’s decision to have the matter adjourned on reasons that there was a notification that the Attorney General and advocates from his chambers would not attend to cases that require his input as they were attending an arbitration course organised by the Chartered Institute of Arbitration.

Tutwa Ngulube and Makebi Zulu demanded that the matter be heard today as the ECZ was undermining the Courts to proceed with elections when a court order restraining it from holding elections in the two constituencies was still in force.

They said the adjournment sought by the State was a calculated move to facilitate the elections to go ahead.

However judge Chashi said the ECZ had already announced a fresh date for elections and granting another order suspending them would be of no effect as the High Court was the right forum to address the issue.

He added that the Court will still determine the matter on October 28 even though the by-election will go ahead tomorrow.

PF chairperson for information and publicity Raphael Nakacinda says the alleged bribe scandal surrounding the US $100 million scandal is just a tip of an iceberg of criminality going on in the UPND government.


“So that $100 million scandal is just a tip of the iceberg. There is more going on in this government. It stinks with criminality,” he says.
Meanwhile, TFM business associate in Zambia Jim Belemu has referred all queries on the controversial contract to the company in South Africa.


In a letter to their local representative Dr Belemu dated 15 May 2022, TFM Holdings chairman Mcebisi Nlozi raised concerns on the alleged request for facilitation fees on contract MOH/SP/W/005/20.

This is the tender for the proposed construction and equipping of seven “No. X 150 bed capacity infectious diseases isolation hospitals in Zambia”.

“Dr Jim, we write to you to place on record that we have been approached by representatives of the Minister of Health to arrange facilitation fees and a vehicle for her. We are for obvious reasons very uncomfortable with this and wish to task you to place this on record in Zambia. Thank you very much for your assistance,” wrote Nlozi.

Commenting on the letter, Nakacinda told The Mast that the revelations by TFM Holdings, a South African company which was contracted to construct some prefabricated hospitals in Southern, Western and North Western provinces, implicates “everybody including the President”.
“All these revelations that are coming in we would want them authenticated. It is just that in Zambia there are very few people who have the courage to state the truth as it is for fear of either being victimised or intimidated. But you see the potency of truth is that regardless of the intimidation you face at the end of the day the truth will eventually prevail,” Nakacinda said. “The scandal of that $100 million is one that implicates everybody including the President. So to that effect the PS (permanent secretary Dr George Magwende) that was fired was just a sacrificial lamb. Actually, he was attempting to do the right thing and to that effect, it created discomfort to the powers that be
and that is how he was sacrificed but there is more revelation coming around. This whole scandal including a predetermined move to have the cancelled contract challenged so that there could be compensation. And compensations will only still go to meet the same needs or still go in the same pockets of those that had earlier attempted to benefit if the contract went through. So it is both ways. Tt is a catch 22 situation. Whether the contact is cancelled, they will still orchestrate a challenge so that they can then be compensated and through that compensation, they will still get the same money they were going to get if the contract had gone through – a scheme of dealers finding ways of raising money out of these things.”


Nakacinda said the UPND was deceitful on a number of issues.
“That’s UPND for you. It thrives on deceit. On that contract itself they said something else on the floor of Parliament and they
are doing another thing. Look at the firing of police officers – the list of 54 officers came out that they were to be fired in national
interest. When we exposed it, they opposed and said it was not genuine, it was fake but just one month down the line the same list of
people have been fired,” he noted. “So when we talk about that $100 million scandal, our binoculars has been zooming directly so that we expose every criminal around that contract. …Gilbert Phiri who they want to take to the DPP office, who is a personal lawyer to the President, will never have the guts to investigate the corruption of UPND.”
Nakacinda claimed that the UPND had resorted to interfering with state institutions.


“Look at the fertiliser scandals. Now we are getting to learn that even the Auditor General’s report when it was initially presented to the President, there is information that it was doctored and edited to remove some of the very critical information that would have exposed corruption and theft of pubic funds around the fertilizer deal…what is happening now is that even watchdog institutions are being interfered with, the same way they are interfering with ECZ (Electoral Commission of Zambia) and everybody,” he charged. “These institutions that are supposed to operate independently are now paralysed. So that $100 million scandal is just a tip of the iceberg. There is more going on in this government. It stinks with criminality.”
Nakacinda was one of the people that raised alarm over the $100 million at the time the contract was approved by the Ministry
of Justice, Attorney General, the Ministry of Health and the Zambia Public Procurement Authority (ZPPA).
Efforts to get a comment from health minister Sylvia Masebo failed as her mobile phone went unanswered and messages remained unattended to.

Lusaka police detain 19-year-old girl for lying that she had been abducted when she was in fact with her boyfriend

20th October, 2022 – Police in Matero of Lusaka Province has charged and arrested a female juvenile aged 19 for the offence of Cheating Contrary to Section 311 of the Penal Code Act Chapter 87 of the Laws of Zambia. It is alleged that the juvenile left home on 16th October, 2022 at around 16:00 hours pretending that she was going to church instead she went to the boyfriend’s house in Lilanda West were she faked to have been abducted.


This follows after Brighton Mwamba aged 38 from Lilanda west who is an uncle to the juvenile reported to the police that his niece aged 19 was abducted by unknown people as she was going to church on Sunday 16th October, 2022 in Soweto compound. It was further alleged that the juvenile was injected with unknown substance which made her become unconscious and was later taken to unknown place.

The alleged abductors called Mr Sitima Tasi of Chongwe the uncle to the juvenile and demanded a sum of K50, 000 or else something bad would happen to her and an ultimatum of 48 hours was given to him. On 17th October, 2022 around 12:00 hours the Aunt identified as Dainess Banda aged 34 of the same abode called the victims’s number and she answered further explained to her aunt that she didn’t know where she was but it was in a house without windows with only a door. She went on to state that there were Ten other girls in the house and that they were being kept without eating.


Police instituted investigations into the matter and on 19th October, 2022 managed to retrieve the juvenile from the boyfriend’s house in Lilanda Township. She has been detained in Police custody and will appear in Court soon.


We would like to warn persons with ill motives of wanting to commit promiscuity or any other crimes and later on use an excuse of being abducted that as police we shall not treat such falsehoods with kid gloves. Whoever shall be found wanting will be made to face the full wrath of the law. We are encouraging the citizenry to join hands with the Police in the fight against crime for the betterment of our society.

Court of Appeal dismisses application to stay tomorrow’s by-elections on the Copperbelt

THE Court of Appeal has denied a motion by the Patriotic Front (PF) to have another stay given for the by-elections slated to take place tomorrow for Kabushi and Kwacha Constituencies on the Copperbelt because there is already one in effect before the High Court.

The Court has also stated with regards to an instruction letter by the Attorney General to adjourn the matters before court from October 19th to October 21st that it is normal, just like when it has issued such an instruction in the past when the Law Association of Zambia (LAZ) is holding an Annual General Conference.

The Court of Appeal in it’s sitting comprising Mr Justice Justin Chashi, Mr Justice Mwiinde Siyavwapa and Mr Justice Kelvin Muzenga noted that it was not in order for them to issue a stay on elections for Kabushi and Kwacha Constituencies as there was one already in effect before the High court.

Lawyer Makebi Zulu argued that he was extremely worried because the court had rules of which should be adhered to.

“My concern is in a matter of public interest, which is that of staying elections. The consideration of elections should have been more important than the matter of an arbitration. If this matter is adjourned, then the elections should not go on tomorrow,” he said.

However, Mr Justice Chashi stated there was already a stay on elections.

“What is the point of you asking this court for a stay if there is another stay. A stay itself is already there, asking for another will have no effect,” he said.

He instead advised the Lawyers to work on the issue of contempt proceedings which were filed before the court.

“The Court of Appeal has nothing to do with the stay. We have no jurisdiction. That is why we must distinguish this, because we have specific matters before us. You are questioning yourselves because of mixing issues. Your are in doubt with yourselves. What is before us has nothing to do with the main elections and you know very well. We will not add confusion to confusion,” he said.

In his argument Tutwa Ngulube argued that there was no communication before the court as to why there was absence from the state.

He further argued that if elections should proceed tomorrow, it will be an issue of contempt as there was a matter to stay the elections.

In response to the communication from the state not being given, Mr Justice Chashi stated that there was an instruction which was also in public domain stating that there should be a adjournment in the matter as the Attorney General had other matters to attend to which was normal.

Mr Justice Muzenga also clarified that issuance of the letter of adjournment was also done in the past when there was holding of matters such as an Annual General Meeting by the Law Association of Zambia (LAZ) and so such was normal.

The Court of Appeal then adjourned the matter to Friday October 28 next week.

Meanwhile, after Court, Mr Zulu said whatever the outcome of tomorrow’s on by-elections, they will argue it next week Friday because the court has alluded to the fact that what is happening is an illegality as the high court stay of election is valid.

Hon Raphael Nakacinda has called on Zambians to critically examine the conduct of President Hakainde Hichilema and his government.

The PF Chairperson for Information and Publicity said during a briefing in Lusaka that the President has painfully learnt the rising discontent and frustrations among people.

He accused the Head of State of wanting to cartel people’s democratic rights to express themselves on the expectations from the government.

“And it looks like the option maybe just to restrict the freedoms of Zambians. A state of emergency will mean that now with impunity people can be searched, people can be imprisoned without trial for a longer period of time,” he said.

“All I am saying is that let us critically examine the conduct of the Head of State and his government. What does he want to do? Isn’t it to limit the citizens’ rights? he has attempted to do that through violence. He has attempted to do that through arrests. Everyone who has spoken against this government has been threatened with arrests, if not arrested.”

And Hon Nakacinda has questioned where critical organization like LAZ are.

“The question we have this morning is where is LAZ? Because when the country is at cross roads like this, history has it that the family of the learned have always spoken loudly in defense of human rights through LAZ,” he said.

“Now that there is a new leadership, we are optimistic that possibly this LAZ will find its voice. Where are the Constitutional Experts? Where are our spiritual fathers? Where is the church? The EFZ……this is not to embarrass anybody, I want to ask, where is our Archbishop, retired, Telesphore Mpundu with this when these things are happening? Where are self-acclaimed Constitutional Lawyers and experts? John Sangwa?”

He said the people that he mentioned had their voices heard so loud when they were dealing only with the PF hooliganism.

“Where are voices like that of my sister Linda Kasonde. I want to state that all these that I have mentioned today including the judiciary, you are under trail….Your voices were heard so loud when you were dealing only with the PF hooliganism, but today when your constitution is being abrogated your silence is too loud,” he said.

WHY IS THE ECZ ABROGATING THE LAW?

Why is the Electoral Commission of Zambia (ECZ) abrogating the law and changing the precedent it has set when it comes to Kabushi and Kwacha? On Monday, 17 October 2022, the Constitutional Court recognised that the order by the High Court to stay the elections in Kwacha and Kabushi Constituencies, remains valid.

Further, can the ECZ cite any law that empowers the Commission to proceed to conduct elections if a candidate who had resigned changes their mind after the Commission has even acknowledged receipt of their resignation? What the ECZ has done this time is lawless. The law requires the Commission to cancel the nominations and call for fresh ones only. There is no law that provides for a nominated candidate who has resigned to rescind their decision after resigning. After receiving the resignations of the two candidates, what the ECZ should have done is to call for fresh nominations from all eligible candidates. Anyone interested, including those who had resigned, would be free to file their nominations, if they are eligible to stand for the election.

It will be unconstitutional for the ECZ to conduct elections in Kabushi and Kwacha constituencies without calling for fresh nominations. Article 52 (6) of the Constitution of Zambia provides that “Where a candidate dies, resigns or becomes disqualified in accordance with Article 70, 100 or 153 or a court disqualifies a candidate for corruption or malpractice, after the close of nominations and before the election date, the Electoral Commission shall cancel the election and require the filing of fresh nominations by eligible candidates and elections shall be held within thirty days of the filing of the fresh nominations”.

This is the only provision that deals with the resignations of successfully nominated candidates. In both Kabushi and Kwacha, we had a candidate who resigned and the ECZ acknowledged receipt of their resignations. Once a candidate has resigned, the law requires the Commission to cancel the existing nominations, call for fresh nominations by eligible candidates and hold a new election within 30 days of the date of the new nominations. Indeed, this is what the ECZ has previously done. When a candidate belonging to the opposition UPP who had successfully filed nomination papers for the Kabwata by-election resigned, ECZ immediately cancelled the election and called for fresh nominations. When Ms Charity Lumpa who had successfully filed nomination papers for Lusaka Central resigned as an independent candidate prior to the 12 August 2021 election, the ECZ cancelled the earlier nominations and called for fresh ones.

We want to remind the ECZ that this is not a game where one can do whatever they like without any regard to the laws of the land. The decisions of the ECZ should always be based on the or backed by law. The ECZ should stop this lawlessness and do the correct, legal thing.

The Court of Appeal has observed that the Kabushi and Kwacha elections were stopped by the Order of the High Court.

The Court also affirmed that the Constitutional Court also recognized that the parliamentary by-elections were stayed.

The Court emphasized that what the Court stopped were the proceedings and not the court orders that were issued by the High Court.

The Court also stated that lawyers (for Malanji and Lusambo) must pursue contempt proceedings.

The Court of Appeal also clarified that there were dealing with the specific matter of appeal by the Attorney General on an interlocutor matter.

The Court also stated that an administrative instruction by the Chief Justice to adjourn matters such as when the Law Association of Zambia is holding an annual General Conference is normal.

The Court therefore adjourned the matter to next week Friday, 28th October 2022.

UNIVERSITY of Zambia Lecturer and Researcher Ntazana Mutungwa Musukuma has advised former Republican President Edgar Chagwa Lungu to completely retire from active politics and focus on guiding the nation as a dignified statesman.

Reacting to a recent statement made by the former Head of State that there was nothing special in anyone being PRESIDENT, Mr Musukuma said such utterances by Mr Lungu are most likely to be misunderstood by the general public and perceived to border on political lines.

“Forget about politicking. Move on. Be a statesman that the Nation will look up-to for guidance, in the best interest of the country. Your continued political bombardings only work towards reducing your dignity. Emulate the likes of Nelson Mandela, a former President who became not only a great statesman for his country South Africa but also a World Icon,” advised Musukuma.

The UNZA Lecturer said that it was not true that there was nothing special about being President as stated by Mr Lungu because PRESIDENCY is the most dignified and highest office on the land and anyone occupying that highest Office is special and should be respected by all. He said that it is because the President is special that he is heavily guarded and protected.

“During the 2021 campaigns, you intended to hand over power to yourself, as you told us. You sang ‘Alebwelelapo Pa Mupando’ and danced. You desired to retain power because it was sweet. Why should you after losing the election tell us there is nothing special in being President? These self-contradictions only put your reputation in disrepute, which is not good for a former President,” said Musukuma.

Mr Musukuma said that it was embarrassing for a former Head of State to subject himself to attacks in the media through uttering politically-charged sentiments.

“Because of what you said recently, almost everyone is now talking against you, including opposition leaders like Ms Judith Kabemba. This does not augur well in the eyes of regional and international communities. However, for Zambia as a nation to project a good image of you Sir, the onus is on you to portray yourself as a statesman you ought to be,” said Musukuma.

The UNZA Lecturer said that having seemingly failed to leave behind a legacy worth talking about, the best Mr Lungu can now do is position himself as the best statesman.

“Let those that surround the former President help him by advising him correctly. Many have described his legacy as one of corruption and thuggery but now that he’s out of State House, he can use this time to score as a statesman, to help the poor, orphans, widows, the sick, the aged, people living with disabilities, street kids and so on,” said Musukuma.

Adding, “The worst that can happen to Mr Lungu is for him to fail as a statesman like many say he failed as President.”

During prayers on this year’s National Day of Prayer on 18th October, 2022, instead of praying for national reconciliation, peace and unity, Mr Lungu went off-mark and charged that there was nothing special about anyone being President, in apparent reference to incumbent President Hakainde Hichilema, a statement Which has widely been condemned by well-meaning Zambians.

Zambia is amongst the top copper producers in the World but has relatively remained stagnant when compared to peers.

Imagine 3 babies born on the same date in Zambia, Chile and Congo DR.

They find that God gave their Countries of birth a million football grounds everywhere visible.

50 years later the child born in Chile 🇨🇱 becomes the soccer ⚽️ World Cup winner. One born in Congo DR takes Silver medal.

Despite also having a million stadia as Chile and Congo DR, Zambia not only did not qualify for the World Cup, but still remains in the amateur divisions or ranks.

Chile and Zambia’ s copper production were at par in 1964. Zambian and Congo DR share the same huge rock of copper underground and above surface there are ‘imaginary’ man made separation of the rock called borders namely Mikambo and Kasumbalesa border.

It’s the same big rock of copper deep underground that forms the foundation base for the North Western and the Copperbelt provinces in Zambia while on the Congo DRC side the province is called Kantanga.

With that in mind, here is the current global Copper production status quo. A total of 21 million metric tones (MT) of Copper is produced globally.

Copper production fell last year in Zambia, which ranks sixth in terms of copper production by country. Its 2021 rate of 830,000 MT was down from 2020’s production of 853,000 MT. There are four major mines that dominate the country’s copper production, including Barrick Gold’s (TSX:ABX,NYSE:GOLD) Lumwana, First Quantum Minerals’ (TSX:FM,OTC Pink:FQVLF) Kansanshi and Konkola Copper Mines, a subsidiary of Vedanta Resources (NYSE:VEDL). The Zambian government recently took complete ownership of Mopani Copper Mines (in which it had a 10 percent stake) from Glencore.

If our copper production strategies since independence was football, It would have been called chipantepante. Kick in whichever direction convenient when in possession of the ball.

We have been indecisive swinging from nationalisation, privatization to mixed approach.

We have now coined a 10 year plan to boost production and have done so by varying the Mineral Royalty Tax (MRT) calculations. We have forgone huge revenue to the public Treasury. The aim as we have been told is to maintain and attract foreign investors that will jumpstart our copper production to desired levels. Happens to be a decade strategy and a gamble that might or might not work.

We need a factual (not political) research to establish why we have lagged behind peers in our Copper mining.

It’s never too late to change our mindset and strategy so as to catch up with the Congo DR 🇨🇩 current copper production levels of 1.8m MT compared to our meagre 830,000 MT. All this when the Congo DR has far more tribal, political, economical and security challenges than those of Zambia.

FAZ SEX SCANDAL: General Secretary Adrian Kashala Allegedly Demanding Sexual Favours To Appoint Journalists As Media Officers

FAZ general secretary Adrian Kashala is allegedly abusing his office by preying on young female journalists with appointments as Media Officers at international tournaments in return for sexual favours.

Sources have disclosed that Kashala has been asking female sports journalists to allegedly reward him with horizontal pleasure for giving them an opportunity to travel with the women’s national soccer team as media officers.

A selected number of female sports journalists from traditional media houses have had an opportunity to travel with the women’s national teams at all levels.

The sources say Kashala has asked for sexual favours from a majority of the journalists but not all of them have given in to his antics.

“If a journalist does not give in, a certain attitude is created towards that journalist and she is declared an enemy of the association.

“Any journalist, especially females, who travel with the national team must have the approval of the GS,” the source said.

When at a tournament or during an international assignment, Kashala then asks the female journalist to compile their media reports from his room.

“What is surprising is that Mr. Kashala would ask the journalists to work from his room when they are also accommodated in the same delegation as officials of the traveling contingent,” the source explained.

Some female journalists are very uncomfortable with Kashala’s conduct because he sometimes declares he owns them and warns those with intentions to stay away or face his wrath.

“He is actually in the habit of boasting about it because the general perception is that no one can do anything about it; he feels untouchable,” the source added.

The allegations against Kashala come on the back of several reports of sexual misconduct being abetted at Football House by the Andrew Kamanga-led Executive Committee.

Zambia women’s Under-17 national team coach Kaluba Kangwa has admitted to impregnanting a girl allegedly 15-years old at the time when she trained at Bauleni United Sports Academy (BUSA). Kangwa is alleged to have engaged in such mischievous activity with several other suspected minors at BUSA while senior women’s national team coach Bruce Mwape has denied any allegations of sexual misconduct with the senior Women’s national team.

Reports of sexual abuse between player to player have also been recorded.

In view of the allegations, I sent an electronic mail to Mr. Kashala copied to Mr. Kamanga (in case he claims he was not aware of the correspondence) on Thursday, October 13, 2022 with no response so far.

On Friday, October 14, 2022, I followed up with Mr. Kashala and sent the same message to his WhatsApp lines just in case he did not see the email, or if it was out of use, but so far to no avail.
Yesterday, I followed up with a telephone call to Mr. Kashala which went unanswered.

Good afternoon,

My name is Augustine Mukoka, a freelance journalist.

On September 23, 2022, you announced that FAZ would open an inquiry into alleged “sexual abuse incidences” in women football.

It is now over 21 days (three weeks) from the time this announcement was made. I have a few questions regarding the same as a follow-up.

How far has the inquiry gone and what are their findings?

What is the composition of the committee inquiring into these alleged sexual incidents.

On what days is the committee sitting? If not started, when is the inquiry expected to start sitting?

What are the terms of references? What mechanisms are in place to protect the victims from retributions?

Stakeholders, including myself, are calling for an independent body to investigate these incidences. How independent is the FAZ inquiry?

Furthermore, there are allegations that you, as FAZ General Secretary, is using your position, which is a public office, to obtain sexaul favors from a string of female sports journalists.

What is the veracity of these allegations?

It’s alleged that one of the bargaining chips you use to allegedly lure these unsuspecting journalists is appointing them as Media Officers at either COSAFA or CAF women tournaments.

Some of the allegations suggest that your modus operandi during these tournaments when you show up is to invite female journalists to work from your room.

Is there a designated journalists’ desk in the room of a FAZ official such as yourself when assigned to any of these tournaments?

What criteria does the association use to select active practicing journalists from traditional media houses to work as FAZ Media Officers?

I would appreciate it if you could answer these questions for the article I am working on.
