There is no Law in Zambia that forces employees to support Mr. Lungu and UKA. Civil Servants conditions of service does not include supporting Mr. Lungu’s Alebwelelapo.

He can only sort out Civil Servants outside the Civil Service conditions of service, which means breaking the Law with impunity. In Unionism they say an injury to one is an injury to all. CHAONA MUNZAKO CHAPITA MAWA CHILI KWAIWE. All workers in the Country must stand together and teach Mr. Lungu and his UKA a lesson they will never forget.  Workers in Zambia will have the last laugh.

Meanwhile as UPND we appeal to all workers to remain calm and continue serving Zambians diligently and only punish Mr. Lungu and UKA in the ballot box. Your time is coming to sort him out first. All workers in Zambia must not be intimidated by Mr. Lungu’s utterances. Mr. Lungu is just a bully and should be ignored. We are aware that in the past PF carders were sponsored to brutalize workers. The case at hand is that of Kabwe Municipal Council employees. Carders were sent to brutalize these workers who were merely asking for their money.

We further wish to assure all workers in the Country that under the leadership of President HH and his new Dawn Government workers will continue enjoying their rights as provided for in their respective conditions of service. President HH understands that human capital is a corner stone for any sustainable development. A good working environment for all workers through good Industrial Relations is very key to attracting foreign investment. There is no Investor who would risk his money in a Country where a President fights with employees.

Clearly, Mr. Lungu is not willing to change and he will never be remorseful for the atrocities committed under his rule of terror. Zambians must ask themselves if they want to go back to the days of being gassed. Our respected mothers were stripped naked in public. Some mimes like KCM were turned into cash cows. We wish to warn Mr. Lungu not to take his lawlessness to the mines again. You spoiled the future of the young miners. Keep away from the mines.

UKA ALLIANCE IN THE UK CONDEMNS SPEAKER NELLIE MUTTI FOR INTERFERENCE IN ACC INVESTIGATIONS

Lusaka – Thursday, 29th August 2024

The UKA Alliance in the UK, under the leadership of its Chairperson, Mr. Isaac Mulezuma, strongly condemns the recent actions of the Speaker of the National Assembly, Ms. Nelly Butete Kashumba Mutti, for her blatant interference in the Anti-Corruption Commission’s (ACC) ongoing investigations. This conduct is not only an abuse of her position but also a direct affront to the rule of law and the principles of good governance.

Reports have surfaced indicating that Ms. Mutti actively sought to shield Mr. Francis Tanganyika, the Deputy Director of Administration and Human Resources at the National Assembly, from an ACC investigation. It is highly concerning that she first sent her aides to pressure ACC officials, and when this failed, she personally confronted the Acting Director General, Ms. Monica Chipanta-Mwansa, at the ACC offices.

Mr. Isaac Mulezuma expressed his deep concern over these actions, stating, “The behavior of Ms. Mutti is a serious violation of her duties as Speaker. Her role requires her to uphold and respect the law, not to interfere with it. By attempting to obstruct an independent investigation, she has shown a blatant disregard for the legal processes that are fundamental to our democracy.”

This incident is part of a troubling pattern of biased behavior by Ms. Mutti, who has repeatedly demonstrated partiality in Parliament. Her history of gagging opposition members, issuing unjust suspensions, and expelling MPs without due process has already undermined confidence in her ability to serve as an impartial Speaker. Now, her actions to protect a senior official from investigation further erode trust in her leadership.

The UKA Alliance calls on Members of Parliament to address this serious issue when Parliament reconvenes. An immediate investigation into Ms. Mutti’s conduct is necessary, and appropriate actions must be taken to prevent further abuses of power. Additionally, Mr. Tanganyika should be suspended from his duties to allow the ACC to carry out its investigation without interference.

Mr. Mulezuma also called on President Hakainde Hichilema and other government leaders to reaffirm their commitment to upholding the independence of Zambia’s institutions and the fight against corruption. “No one is above the law, including the Speaker of the National Assembly. Ms. Mutti’s actions must be met with firm legal and institutional measures to protect the integrity of our democracy and the rule of law,” Mr. Mulezuma emphasized.

Amb. Emmanuel Mwamba appears before Lusaka Magistrate, Hon. Chrispin Hampungani in a case of Sedition, an offence which was allegedly Contrary to Section 57(1) (b) as read with Section 60 (1) (a) (b) (d) (I) of the Penal Code Act Chapter 87 of the laws of Zambia.

Prosecutor calls her witness.

Witness swears on the bible. He identified himself as Victor M Mateyo aged 48 of
Lilayi Estate.

He stated that he is a Police Officer with Service No.1947.

He is currently Acting Senior Superintendent based in
Kapiri Mposhi as Officers Commanding.

Victor Mateyo- It was on 13th of November 2023
I was on duty in Kapiri Mposhi when I was called that there were officers from the Zambia Police Service Headquaters who wanted to see me.
Prosecutor: What did they want?
Victor Mateyo-The reason was to find out if Mr. Emmanuel Mwamba had given a notification to the Police regarding a posting on his Facebook Page calling for mass action and nation-wide shutdown.

We checked through our records and further inquired from stations if they had received any notifications from Mr. Emmanuel Mwamba.

We got a reply that there was none.

Henceforth I submitted a report which I did. This report is in court as I speak.

I must also mention that I also saw the post by Mr. Emmanuel Mwamba which he posted on 4th November 2023.

This post was calling for mass action and nationwide shutdown.
This post made me wonder what Mr. Emmanuel Mwamba intended to achieve by posting such words.

The recent announcement of an indefinite shut down with a ten (10) day notice of Society Business Park – SBP, has not only raised eyebrows on how prudent the Nation Pension Scheme Authority – NAPSA top management is running the fund, but has also shined the light on how engineering firms seem to be used to rubber stamp suspected waste, substandard works and at times looting of public funds.

This building complex has been subject to engineering reports stating that there are structural defects and that these needed to be attended to for continued use of the building. Photos of cracks in the building are available, but the public was meant to believe that some re-enforcements and remedial works had been done. The complex went on to attract credible and local clients who it now seems have been risking their dear lives spending their working lives in its various shops, offices, restaurants, an international hotel etc opening up a minefield for legal and personal liabilities – a topic for another day.

So, when the sudden announcement of the closure of the entire Society Business Park was made by NAPSA board chairperson Shipango Muteto flanked by his Director General Muyangwa Muyangwa, it raise further questions as to whether the board and management had received new information which had not been available all alone since this park is a hive of business and social activities.

The other big question was whether the NAPSA team was merely avoiding the burning question as to how NAPSA had ended up purchasing SBP which its owners – ZNBS had valued at $1.2 million for $9 million using public pensions funds, effectively bailing out the Zambia National Building Society – ZNBS from the present and future liabilities of the structurally problematic business park as the original owners. In any way, what would be the motivation of NAPSA doing this deal and pumping in more money?

The media statement which Muteto as board chairperson signed off and availed to the Zambian Business Times  – ZBT did not address the question on how NAPSA ended up purchasing the problematic building, and why ZNBS as previous owner was relieved of the liabilities by NAPSA – which manages pension funds. It is still questionable even today why NAPSA, despite being a custodian of pension funds and backed by pension contribution would be so keen to proceed and buy off the troubled building complex??

But the NAPSA press conference went on, announced the immediate closure but did not address the elephant in the room. However, for those with a keen eye for details, the statement had a note to editors, under which NAPSA mentioned HOPKAS engineering consultants as having provided the latest report which it was insinuated, may have called for the immediate closure of SBP.

ZBT immediately contacted HOPKAS CEO Hopeson Kasumba enquiring as to what his new finding were, what could have necessitated such a drastic action such that tenants and workers were left with a 10 days notice. Some jobs are at risk of being lost, an international hotel – Hilton Garden Inn was still taking reservations – leaving question marks on how much claim they will make from NAPSA, Pick n Pay supermarket was still trading with hordes of customers still thronging their premises and banks such as FNB posting a notice of an unexpected branch closure, Young Phiroz – a popular local store telling ZBT that there were completely caught unaware and some over 17 jobs are at risk among some of the notable tenants.

Hopeson Kasumba as CEO for HOPKAS which NAPSA had specifically named in its statement of announcing the shut down stated that his firm had like previous engineering consultants found some structural defects and that his firm had recommended repair and remedial measures. He however indicated that the firm did not recommend for immediate closure and shutdown of the complex.

Further investigations by ZBT found that HOPKAS was actually not the only latest consulting engineering firm to have issued a solicited structural engineering report, but that Oaktic Systems – an engineering consultancy firm is actually the latest. NAPSA however had omitted (not sure whether intensional or not) mentioning Oaktic in its media statement, further raising suspicion as to why this was the case.

ZBT then contacted Oaktic Systems through its listed principal officer Malijani Lungu, to get his side of the story as well as confirm if their findings were so grave to warrant the immediate closure of Society Business Park and the adjoining tower that houses Hilton Garden Inn, an international hotel which had also been caught up in the sudden turn of events.

The ZBT checks also revealed that Oaktic systems Ltd had in 2022 won a tender with the Ministry of Local Government for Euro 545,000 for consulting services for the design and supervision for roads in Mazabuka and Monze districts. Malijani Lungu however refused to categorically confirm or deny if his firms report recommended for the immediate closure of Society Business Park.

If one follows the sequence of events, it raises concerns that there has been and continue to be wrong doings around Society Business Park. Whatever is happening with these transactions, the companies involved and actions surrounding Society Business Park, NAPSA, ZNBS, Engineering firms and experts involved, there is need for an independent inquiry and investigations by experts to ensure that public funds are not wasted, abused or simply looted. The Anti-Corruption Commission – ACC should also take keen interest in this matter before critical evidence is erased. By calling for an independent review and investigation, we as a business media are simply playing our role in the safeguarding of public funds.

You can imagine that just the action of shutting down Society Business Park, as asset bought using public funds for $9 million (K320 million) is likely to be written down or written off completely. More so, if demolition is the final outcome, more costs will have to be incurred over and above the already comfirmed $9 million bill charged against pensioners funds. The refunds, legal costs and possible compensation to tenants, some of whom are multinationals will have to be borne by NAPSA which ultimately falls on the humble salaried employees and pensioners money.

Fears are new emerging that NAPSA investments are being made not out of sound and expert business analysis, but under undue influence, a recipe for more loss making ventures in future and risking the cashflow position of Zambias biggest pension fund. If you look at the value for money which pensioners are getting, its hard to not accuse NAPSA of not serving the interests of its core stakeholders – the pensioners.

That is why it is important that an independent review and investigation is conducted to restore public confidence. Two wrongs will never make a right. Our initial review shows that wrong doing most likely transcends the period when the first warning were reported to the current purchase  and later shut down of SBP

Hence the call and need to conduct these investigations transparently. The review should cover the entire period from the time the initial concerns were raised to the current transactions of buying an already known structurally defective building using pensioners funds. It is hard for a sound mind not to suspect foul play and corrupt activities.

Socialist party president Fred M’membe says death is inevitable and has asked his party members to prepare for it.

Speaking at the 64th birthday celebration of his close ally and Socialist Party Zambia Secretary General Dr Cosmas Musumali, Dr M’membe said Socialists are not afraid of death.

Dr M’membe said the days of Dr Musumali living are coming to end and urged members to prepare.

“You can even start preparing his coffin,” Dr M’membe jokingly said to a handful Socialist members invited for the occasion.

Dr M’membe said he was worried about the post Socialist Party leadership when him and Musumali would be no more. He urged Dr Musumali to up the training.

At the moment Dr M’membe said Dr Musumali is replaceable. He called on the party members to read widely and be knowledgeable saying a socialist should be one who is conscious and knowledgeable.

Dr M’membe said the journey he and Dr Musumali embarked on will not be finished by them hence the need to groom the leadership that understands the ideals and ideology of the party.

And Dr Musumali said he was humbled by Dr M’membe who had to fly from China for his birthday.

Dr Musumali said socialism entails in making society better than one finds it. He bemoaned that 60 years of independence, people still struggle for basic things like clean water, clothing and education. He said this was a sign of failure and there was urgent need to correct the situation.

He also observed that a number of people of his era had died of diseases such as Aids and other curable diseases.

Dr Musumali said out of sixteen siblings he was among the seven living and from his first job him and another person were alive.

He thanked his wife (white lady) of 40 plus years who was in attendance and his 17 year old son for the support. He said family and his socialist Comrades have made him and proud of that.

First Quantum Minerals – FQM has vowed to remain positive by joining other manufacturers in Zambia to remain resilient in the wake of global and domestic shocks such as the energy crisis and currency volatility.

FQM has since announced a K350 000 Diamond Sponsorship package to promote the Manufacturers Month starting next week organized by the Zambia Association of Manufacturers.

FQM Zambia Lead-Infrastructure Development, Jed Goldstein, said the sponsorship underscores FQM’s unwavering commitment to fostering local economic development and advancing Zambia’s manufacturing sector.

Mr Goldstein said the support for the conference aligns with FQM’s strategic focus on enhancing local procurement and supplier capacity building.

“We have consistently prioritized engaging with local suppliers to stimulate economic growth, create employment opportunities, and reduce reliance on imports. “As a sector, we are faced with several challenges hindering our operations. The sector has been impacted by global and domestic disruptions, inflationary pressures, and currency volatility, all of which have contributed to an increase in the cost of doing business. Exchange Rate Volatility has adversely impacted the cost of procuring raw materials and inputs required for production, especially where the same are not locally available. Energy which includes fuel pump prices as well as electricity rationing arising from the national disaster the country is currently grappling with. As a result of these challenges, the sector growth in the first quarter of the year 2024 shrunk to 2.3% from 3.7% which was recorded in the same period in 2023,” she said.

And Zambia Association of Manufacturers (ZAM) Chief Executive Officer, Muntanga Lindunda, said this year’s Manufacturers Month coincides with Zambia’s 60th Independence Anniversary, providing an opportunity to celebrate the resilience and innovation of the manufacturing sector.

No Zambian citizen should be arrested for exercising their right to protest within the confines of the law.

We write to call upon H.E the President Mr Hakainde Hichilema to take interest in the arrest of a youth activist Jason Mwanza a Zambian citizen who was picked by the Police from the freedom statue in Lusaka today where he staged a lone protest having notified the police.

The arrest of Jason Mwanza confirms the injustice happening under the  watch of H.E President Hichilema. It’s your duty Mr President to ensure that the Zambia Police who act in your “name” does the right thing and learn to respect the rights of all citizens. Mr President you promised that your administration would respect human rights. Jason Mwanza has not committed any crime for the Police to detain or arrest him today. May God touch your heart tonight Mr President.

On the 24th of August, 2021 during your inauguration Mr President you promised as follows;
“We said Bally and team will fix our economy, but we will do more than that. We will grow our economy so we can lift more people out of poverty than ever before. We will promote unity in diversity and ensure respect for the fundamental human rights and freedoms for all. We will restore the rule of law, general order in our public places and communities, and return our country back to normalcy,” President Hichilema told a packed National Heroes Stadium.

Jason Mwanza must be released within 48 hours or be taken before a court of competent jurisdiction. This nonsense by some within the Zambia Police to intimidate citizens with dissenting view should be kept in check or may continue compromising the freedoms of citizens. Some actions taken by the Police in recent past has continued to dent the image of President Hichilema who promised to respect rights of all citizens.

EFCC orders Lusambo  to open his defense today without fail

FORMER Lusaka Province Minister Bowman Lusambo and his wife Nancy Manase have engaged the Law firm of former Attorney General Likando Kalaluka, to guide them through their defense, a week after the couple part ways with Makebi Zulu Advocates.

The firm had applied to have Lusambo’s case adjourned, so that it can  acquaint itself with the case but, the Economic and Financial Crimes Court directed that Lusambo accounts for his wealth today.

Submitting before magistrate Faidess Hamaundu, Kimberly Chota Kaumba from Messrs Likando Kalaluka, said the firm filed in a notice to adjourn the matter Pursuant to Section 202 of the Criminal Procedure Code (CPC) as read together with the EFCC Rules Section in 10.

“We were only retained yesterday and seeing that the matter is coming up for defence, we need proper instructions from our clients as well as for the interest of Justice, we would like to represent our client sufficiently and efficiently. We ask for time to prepare for our defence.”Kamba said.

In response ACC prosecutor Chawezi Nalwenga said, the prosecution was served with a notice of intention to adjourn the case in the morning:

She said Rule 10 of the ECFC Rules of 2024 clothes the court with the discretion to grant an adjournment only in exceptional compelling circumstances.

“The accused persons have not exhibited special circumstances to warrant the court to grant the adjournment. We note the notice of appointment of the defence however we also wish to highlight the fact that at the last sitting, this court had ordered that the accused persons’ lawyers, Makebi Zulu Advocates file a notice of withdraw which we note was not filed nor served on the State,” said Nalwenga.

Kaumba asked for two days in which to prepare the couple for defense.

“Defence is the most crucial aspect of the case. It would only be fair that counsel seized with conduct of this matter familiarizes with it because, it would be impossible to prepare 15 witnesses if the court does not grant us this adjournment. It is thereby our prayer that the adjournment be granted,” said Kaumba.

Magistrate Hamaundu said the defense was eating into its own time.

“The rules say that the court can set a time frame for defence. Are you aware when this matter started? I warned the parties that they have limited time,” said magistrate Hamaundu.

“I’ll only grant your adjournment to tomorrow(today) because you have to start with the accused.”

Lusambo is facing 10 corruption-related charges before the Economic and Financial Crimes Court; among them one count of corrupt acquisition of public property, five counts of possessing property suspected to be proceeds of crime, three counts of tax evasion and one count of conspiracy to defraud.

He is jointly charged with his wife Nancy for possessing four houses in Silverest Gardens, Chongwe which were suspected to be procceds of crime.

The case comes up on August 28.

FORMER foreign affairs minister Joe Malanji bought seven houses in Silverest Gardens and Chongwe, a day after returning from Turkey in 2020, the Economic and Financial Crimes Court has heard.

The seven houses cost a whopping $50,000 and Malanji paid cash, according the testimony of Kwaleyela Mukelabai, a Senior Assistant commissioner under the anti-money laundering unit at the Drug Enforcement Commission (DEC).

Testifying before principal resident magistrate Irene Wishimanga, Mukelabai said he got information from the National Assembly regarding Malanji’s earnings from the period he became a minister in 2016 and 2021 among them : salaries, allowances, and gratuities which were cumulative of K5.1 million.

“When the documents were provided to me analysis of those documents showed that he received allowances K749, 000, salaries K1, 400, 000 and gratuities K1.4 million and for 2019 to 2021 gratuity was K531, 000 coming to K2 million for the gratuity,” Mukelabai said.

“The total income was over K5.1 million that’s what he legally earned from 2016 to 2021.”

Mukelebai said he visited Silverest gardens in the company of Lubinda Chirwa from the ACC to establish whether the intel that Malanji had seven houses in Silverest gardens, was correct.

“After checking the system with Francis Chipeta, we were able to establish that indeed there were houses owned by Mr Malanji. Documents revealed that a $50,000 cash was paid to Silverest gardens by Mr Malanji on December 31, 2020,” Mukelabai said.

“I was interested on the date because, it was connected to the deposits made by Malanji at Stanbic upon his return from Turkey. I concentrated on three houses: no.033, no.269 and house no. 270. The system showed the statement of account for each house which showed the date payments were done towards the purchase.”

He said According to Francis Chipeta payments were being made in staggered arrangements. The $50,000 was broken down in $18,000, $16,000 and $14,000. And the receipts were issued in Malanji’s name.

“After the holistic investigation I decided to call Mr Malanji for an interview for purpose of clarification. The Commission in the initial stages as I said, there were two reports when the first report was made around March he was invited to explain about the purchase of the first helicopter,” Mukelabai said.

“Mr Malanji said the source for the acquisition of the helicopter had come from the contracts he had in Congo and that he had a contract with China Civil engineering construction corporation in Lubumbashi DRC.”

He said Malanji provided documents: a sub contract, some withdraw slips showing that Mass investment Limited had paid Gibson Power Systems: He also provided some receipts which were showing that he received cash from the DRC, documents showing that there were interim payments certificates, a letter written by himself to Stanbic Bank which was showing that it was from Cosmopolitan Branch.

Mukelabai Malanji showed him some  documents from Row Bank, showing Mass investment had made a transaction to pay Gibson Power systems.

He said he allowed Malanji to leave and engaged the Financial Intelligence Centre and requested it to verify the authenticity of the documents by verify with the FIC in the neighboring DRC.

“The FIC in Congo wrote to our FIC in Zambia explaining that those purported withdraw slips were not authentic. The account number showing on the documents was not the correct number at Row Bank in DRC,” Mukelabai said.

“Since I was informed that the documents were not authentic I decided to head to DRC for my investigations in 2021. I went informally (on a secret mission) to conduct investigations before I could formally write to authorities to help with information.”

He said he decided to verify whether; China Civil. Engineering Construction Company exists, addresses which were provided on the two contracts  between China Civil Engineering Corporation and Gibson Power System, Transactions between Mass investment and Gibson power Systems and whether the addresses were correct.

“The addresses given for China Civil Engineering and Gibson Power Systems was 1902 Nyeta road and Mass investment was plot no.2 Mayenge avenue. We went to the consulate with my colleague and with the help of the staff, I proceeded to go and check on those addresses. I discovered that Nyeta street had plot numbers going up to 47 so plot no. 1902 did not exist in that street,” Mukelabai said.

“From there, I proceeded to avenue Mayenye at plot no. 2. When I reached there, a woman came out of the gate and I requested to speak to the CEO of Mass investment. The woman mentioned that she was a catholic nun and that is where the Catholic nuns were residing. To prove this, I asked her to call other nuns. They confirmed that there was never Mass investment. The older ones said they had Lived there since they were young.”

He said he returned to Zambia and drafted
a mutual legal assistance to the DRC government, and he was allowed to go and officially do investigate in the DRC.

“While in DRC my case was given to the prosecutor general who was equivalent to the DPP of this country who upon visiting him told us that the case had been located to an investigating magistrate Charles Lwanga Kabozya.”Mukelabai said.

He said Kabozya had informed him that, according to the investigation he carried out, he established that China Civil Engineering never dealt with Gibson Power Systems.

According to Kabozya, Row bank responded to his inquiry and stated that the seven withdraw slips, bank statements for payment from Mass Investment, were not authentic.

“Mr Charles Kabozya said Row bank provided statements for Mass investments and when I looked at the statements, I was able to see that the Bank statements which Mr Malanji provided to us was from 2017 yet the account for Mass Investment was opened in 2020,” Mukelabai said.

“China Civil Engineering said the contract it was working on at the time, was too small to subcontract Gibson Power Systems. I came back after establishing that the documents Mr Malanji had given us were all not authentic.”

He added that he also established that Malanji had written to Stanbic on October 15, 2020 asking Stanbic Bank to inform the Bank of Zambia (BoZ) that, at some point in future he would be depositing US$100, 000 in cash which would come from the contract which Gibson Power Systems had from Congo.

“To this letter he (Malanji) had attached the contract between China Civil Engineering Company and Gibson Power Systems. Francis Chilufya confirmed that indeed the Bank had received the letter from Malanji and it was received from the Cosmopolitan branch,”said Mukelabai.

PRESIDENT Hakainde Hichilema has told Catholic Bishops to correct Government in a civil way instead of running to newspapers and social media when the Government makes mistakes.

Officiating at the Association of Zambia Diocesan Catholic Clergy conference in Kabwe yesterday, President Hichilema stated that his Government has no problem with being corrected when it makes mistakes as it is the right thing to do.

“When we make mistakes, correct us because it’s the right thing to do but don’t correct us by shouting at us in the newspapers and on social media. Interact with the nearest public sector worker close to you, pass the message,” he reiterated.

The Head of State went on to reveal that his Government has never been against the Catholic Church, contrary to what has been portrayed in the media.

He shared that most of his cabinet ministers are actually devoted Catholics whom he rightfully appointed.

“Catholics should help us in meeting the needs of the people. We value this role which the church plays. Partner with us, we are not competitors, we serve the same community.
This President’s cabinet, majority of them are Catholics. This man, Minister of Home Affairs, this man, Minister of Technology and Science, another man who is not here, Minister of Defence, they are all ex Mukasa seminary so we call them in our cabinet.”

“Secretary to the cabinet, Kangwa is Catholic Deputy Secretary to the cabinet economics, Siyakalenge is Catholic, Deputy Secretary to the cabinet administration Oliver is a Catholic. How can there be a message that the UPND Government is against the Catholic Church?
So you think I wasn’t aware that they are Catholic? This thing of the UPND being against Catholic is an imagination. I’m Adventist myself, I have nothing against the Catholic Church. I read a lot, I check social media I hear what people say all our churches are cherished,” said President Hichilema.

He further assured the church that his government will deal with any form of unruly cadreism, irrespective of one’s political affiliation.

He called on the Catholic Church to utilise the Constituency Development Fund (CDF ) to improve the livelihoods of the people.

I want to make it clear that I strongly oppose retribution and will not stand by to watch it happen to anyone, including those who have treated me badly in the past.

I fully support the return to power of President Edgar Chagwa Lungu, but I do not want to see the injustices that occurred during his previous rule to be repeated. I expect the ‘NEW” President Lungu to be different from the one who allowed bad things to happen to citizens while being silent.

I do not want to see companies being closed down simply because they are perceived to be supportive of a particular political party, such as the UPND, or any opposition party.

I am against the unjust shutdown of media houses, like the illegal closure of The Post.

I do not want to see citizens arrested for expressing themselves, as I was arrested for criticizing President Lungu and other government officials during PF rule.

I am expressing my stance so that everyone knows where I stand. These are fundamental issues which I wouldn’t want to compromise.

Under President Hichilema, things have been even worse, leading me to be in exile. I have suffered greatly under his leadership, more than I did under President Lungu, but I do not wish for people to be targeted for retribution.

I am sure many of you have noticed that I have created friendship with some of those police officers that treated me badly. I harbor no grudge, or bitterness against those that verbally or physically abused me.

If individuals have committed crimes, it should be law enforcement to follow up rather than politicians issuing directives, as this compromises justice.

Politicians should focus on the positive change they will bring to the lives of citizens, rather than on pursuing their perceived enemies.

If individuals have committed crimes while persecuting us, let the law take its course, but it should not be part of our campaign promises, because it is divisive and threatens the peace of citizens.

Persecution and retribution do not develop the country, rather, they set it back the progress that could have been made in the past.

When The Post Newspaper was unjustly closed down, thousands of innocent citizens lost their jobs.

This time around, several companies have been closed down, with the directors attending courts, causing many citizens to suffer unemployment and fall into abject poverty. This is not progress.

Kafwaya Backs Lungu’s Call for Professionalism Among Civil Servants

Lusaka, August 27, 2024 – Lunte MP, Hon. Mutotwe Kafwaya, has thrown his support behind former President Edgar Lungu’s call for discipline and professionalism in the civil service, stressing that such values are key to Zambia’s progress.

During a recent address, Lungu made a clarion call to all public servants to uphold the integrity of the civil service and reminded those who engaged in misconduct to think twice before making or accepting to do any action that goes against the law.

“I took time to listen to President Lungu him as I always do when he speaks. I sensed that he has developed a strong desire to see a professional civil service. This is exactly what my position is as well.”

Hon. Kafwaya, a former civil servant himself, took time to reflect on President Lungu’s words and emphasized how crucial it is for government workers to maintain professionalism in a country where the public service is at the heart of the economy.

“The significance of having a professional civil service in a country like ours where we only have public service economy and no other cannot be overemphasized.” said Hon. Kafwaya.

“We depend on it for everything, so we need our civil servants to be disciplined and focused.”

Hon. Kafwaya acknowledged that Lungu’s statements are bound to stir debate due to the former president’s lasting influence. Yet, he stood firm in his agreement with Lungu’s message.

“I join those who want to see discipline in the civil service,” he stated. “As someone who’s been in those shoes, I know the difference a professional, committed workforce can make.”

He further encouraged civil servants to make the right choices.

“For those who will heed the former presidents counsel, your reward is is on the way. However for those who will decide against his counsel by deliberately flaunting the law with impunity, sanctions await you.”

The Lunte Lawmaker’s message wasn’t just for civil servants; he also reminded the government of its duty to respect the law and serve the people transparently.

“Our role is to stand with the people and guide the government to operate within the bounds of the law, pointing out where they can do better,” he noted.

The Parliamentarian echoed President Lungu’s stern warning that public officials acting unlawfully, whether by choice or under pressure, would face legal repercussions.

Hon. Kafwaya closed his statement with a clear message to all public officers If they care about their future, they should choose professionalism.

His words are a timely reminder to civil servants across the country that professionalism, discipline, and integrity should be at the forefront of public service, as they are essential for the nation’s development.

An employee was charged by the Bank for carrying out foreign exchange transactions using her account for her and her mother at lower rates. The Bank found this conduct dishonest as it caused them to suffer loss and dismissed her, without paying her any benefits

The dispute went to the High Court in which the Judge ruled that the dismissal was fair and lawful as the conduct of the employee amounted to gross misconduct. However, the High Court held that the dismissed employee, was entitled to severance pay in the form of gratuity, despite being permanent and pensionable.

Unhappy with the Judgment, the Bank appealed to the Court of Appeal, arguing that a permanent and pensionable employees are not entitled to gratuity. The Bank also argued that if an employee is dismissed, they cannot benefit from their own misconduct by being awarded a gratuity.

A panel of three judges were constituted to determine the case. The critical issue was who should get gratuity in terms of the law.

The Court was adamant that a permanent employee does not qualify for gratuity as it is not a contract of fixed contract. The Court held that

“The sum of our analysis is that a permanent contract of employment is not equivalent to a contract of fixed duration.Therefore, the lower court’s assertion that a permanent contract is also a contract of fixed duration because it expires at retirement (if not terminated in other ways) is incorrect as there is no single retirement age.”

The Judges said that only employees on long-term (fixed-term) contracts are entitled to gratuity and not those who are employed on permanent and pensionable contracts.

The Court went ahead and held that

“Might we add that employees who have been dismissed for misconduct are excluded from severance pay because their actions have fundamentally breached the terms of the employment contract.”

According to the court,where an employee is dismissed, his/her misconduct disqualifies him from receiving the additional payment of gratuity. The Court clarified dismissed employees are only entitled to their accrued leave days, unpaid salaries and nothing else

The Judges emphasised that the law on gratuity only applies and extends to employees who have been terminated through no fault of their own .

Case citation – Stanbic Bank Zambia Plc v. Natasha Phiri – Appeal No. 274 of 2022 and Judgment rendered on 22nd August, 2024.

Interesting case. If you are a permanent employee or dismissed from employment, you are not entitled to any gratuity for your service

Even the late Michael Sata whilst in opposition was consistent in delivering his alternative solutions of
✓ more money in citizens pockets,
✓ lower taxes,
✓more jobs to the citizens and that provided the basis upon which the citizens voted him into power. Whilst in office,he was being held to account for those promises!

Today the New Dawn Administration is equally being called to account for its promises made whilst in opposition because President Hakainde Hichilema, his running mate Vice President Nalumango and his team were offering clear and convincing promises as alternative solutions to the myriad of challenges which the Lungu administration was facing then.

On the other hand, the New Dawn Administration is today using those same promises as a checklist for its performance in the three years of it being in power. However, we’re neither reading or hearing any objective alternative solutions from the opposition political parties today.What we’re hearing are either endless remainders of how this New Dawn Administration has failed or threats of retribution once given government machinery.People don’t give power on such promises.

Amongst the consistent alternative solutions President Hichilema and his running mate VIP Nalumango were making to the Zambians’ were;

  1. To lower the cost of living which was relatively high then
  2. To provide free Education which was not being offered then.
  3. To come and restore University Students meal allowances which the sitting government had abolished.
  4. To Increased CDF from K1.6m .
  5. Restructure debt within his first term in office which became impossible then
  6. Re-Open mines based on mutual benefit which mines were all heading towards closures.
  7. Provide permanent and pensionable jobs in government and quasi-government based on nothing else but qualifications only
  8. To pay Retirees some of whom were camping at Given Lubindas office daily.
  9. To end political hooliganism in public places such as Intercity bus terminus, city market and other similar public places.
  10. To restore rule of law which the ruling political party cadres then were exempted.
  11. To improve agriculture in order to lower the cost of mealie meal
  12. To bring on board alternative sources of energy instead of solely relying on ZESCO generated hydro power energy.

12.To fight corruption of the past, present and the future.

This is a checklist even the Zambian people are using to rate the three years performance of the New Dawn Administration in office today!
The Zambian citizens and other stakeholders are able to determine and judge the performance efficiency from these very promises the New Dawn Administration offered whilst in opposition!

Zambian citizens may listen to the opposition but trust me they’ll make decisions based on the above checklist!

Zambians are expecting all the opposition political parties aspiring to take over this government to state even in much more clearer language than what the New Dawn was promising.

It would be reckless, irrational,subjective and dangerous for Zambians’ to change the current government based on unclear and uncoordinated promises.

Alternatively, let the opposition political parties get the same list of the UPND promises and start explaining through various media platforms how different they’ll handle those promises item by item from the way the current government is handling them.

I want to assure the opposition political parties that politics of insults and threats is losing its taste to many Zambians especially the youths.
Yes they’ll attend your rallies expecting to hear your alternative solutions to the problems they’re currently facing and not just to be reminded of the problems they’re experiencing but if such messages of hope are not coming out clearly,then forget!

Therefore, the messages we convey to people on rallies or radios can not only be counter productive, but also be used to assess our readiness to run government or we just want power to satisfy our own egos and private interest.

Doctors strike in Nigeria over kidnapped colleague

Doctors in Nigerian public hospitals have started a seven-day nationwide strike to demand the release of their colleague, Dr Ganiyat Popoola, who has been held by kidnappers for eight months.

The mother of five was taken from her home in the middle of the night on 27 December alongside her husband and a nephew.

Her husband was released in March after a ransom was reportedly paid but the kidnappers held onto the ophthalmologist and her relative.
The doctors say they will not even provide emergency care during the strike.

They feel that the security agencies are not doing enough to secure Dr Poopola’s freedom.

President of the doctors’ association Dr Dele Abdullahi told the BBC: “It’s been eight months of agony for her, her family, and her colleagues. The life of doctors should matter to Nigerians,” adding that if nothing changes, they would declare an indefinite strike.

Her colleague Dr Ibrahim Mohammed Okpanaki said doctors were “demoralised and terrified. In a country where medical workers are leaving, those that have chosen to stay should be protected.”

Dr Poopola started working at the National Eye Centre hospital about six years ago, Dr Okpanaki said.

He described her as a very dedicated professional and responsible family woman.

At the time she was kidnapped, she was still breast-feeding her youngest child.
The hospital in Kaduna, north-west Nigeria, is one of the biggest eye hospitals in the country.

Experts say the hospital’s location on the outskirts of Kaduna city makes it an easy target for kidnappers.
Her home was within the vicinity of the hospital.

In 2021, dozens of students were taken from the nearby college of forestry.
Dr Poopola’s kidnappers are asking for 40m naira (£19,000; $25,000) for their freedom.

Although a controversial law criminalising ransom payments came into effect in 2022, they are still often paid by relatives desperate to free their loved ones.

The law carries a jail sentence of at least 15 years for anyone who pays a ransom, although no one has yet been convicted.

The government is yet to comment on the strike or the doctor’s situation.

Dr Popoola’s husband has declined requests to talk to the media.
Dr Abdullahi told the BBC that “the family was exploring a diplomatic route initially, but they have now given us the permission to explore other options”.

In recent years, kidnapping has become rife in Nigeria, with hundreds of people abducted, largely by criminal gangs who see it as an easy way to make money. It has been particularly bad in the north-west of the country.

Nigeria appoint former Stuttgart boss Labbadia

Nigeria have appointed former Stuttgart boss Bruno Labbadia as their new men’s head coach ahead of the 2025 Africa Cup of Nations qualifying campaign.

The 58-year-old German was interviewed by the Nigeria Football Federation (NFF) on Thursday after talks with Swede Janne Andersson and Frenchman Herve Renard collapsed.

BBC Sport Africa can confirm that a contract with the German has not as yet been signed.

Labbadia’s first game in charge is scheduled to be the Nations Cup qualifier against Benin in Uyo on 7 September before the three-time African champions travel to Rwanda three days later.

Gustavo Poyet, Aitor Karanka and Fabio Cannavaro were the other contenders interviewed late in the day by the NFF.

A desperate choice

Former Sweden coach Andersson, 61, had been in talks with the NFF and looked the frontrunner to take charge with compatriot Peter Wettergren as his assistant.

But the Swede was only available in November due to “personal commitments”.

Despite accepting a lucrative offer, two-time Nations Cup winner Renard, 55, failed to make plans for signing his contract, forcing the NFF to look elsewhere as they searched for Finidi George’s successor.

Former Super Eagles forward George stepped down earlier this year only two matches into a two-year contract following a poor start to World Cup qualification.

The failure to land Renard or Andersson came as a huge blow to NFF president Ibrahim Gusau, who had been negotiating intensely with both camps.

In a race against time, the NFF opened talks with Labbadia, former Sunderland, Brighton and Greece manager Poyet, Karanka, who had spells in charge of Nottingham Forest and Middlesbrough, and former Italy captain Cannavaro.

But Labbadia, who holds a UEFA Pro License and previously managed Hertha Berlin, Wolfsburg, Hamburg and Bayer Leverkusen in his homeland, was the preferred choice.

In a statement, NFF general secretary Mohammed Sanusi said: “The NFF Executive Committee has approved the recommendation of its Technical and Development Sub-Committee to appoint Mr Bruno Labbadia as the head coach of the Super Eagles. The appointment is with immediate effect.”

Nigeria turn to Germany again
Labbadia is the sixth German to take charge of the Super Eagles, following Karl-Heinz Marotzke (who had two stints between 1970 and 1974), Gottlieb Goller (1981), Manfred Honer (1988-1989), Berti Vogts (2007-2008) and Gernot Rohr (2016-2021).

But he will have his work cut out to manage expectations.

What seemed to many like a comfortable World Cup qualifying draw has proven to be more difficult than expected, with unfancied Rwanda leading the way in Group C and only Zimbabwe boasting a worse record than Nigeria after four rounds of the 10-game campaign.

He will also need to immediately get the media and a jaded fanbase onside.

There is currently no permanent home ground for men’s and women’s national teams, with recent fixtures mostly hosted in Uyo by default as the Godswill Akpabio Stadium is the only ground that satisfies the Confederation of African Football’s requirements for international football.

Similarly, there is no bespoke training facility in the vein of England’s St George’s Park, Morocco’s King Mohammed VI training complex or France’s Clairefontaine, and arrangements are typically made on an ad-hoc basis.

There is also the issue of players being owed allowances and match bonuses, something that persists within the current squad.

Labbadia is now faced with two important qualification campaigns for the 2025 Nations Cup and 2026 World Cup.

He will have little time to get to know his players but immediate results will still be expected.

Al-Shabaab turns 18: Why has the Somalia terror group refused to die?

The United Nations Security Council unanimously voted on 15 August 2024 to extend the mandate of the 12,626 men and women of the African Union Transition Mission in Somalia (Atmis).

The African mission has been stationed in Somalia for the past 17 years to support the government’s battle against the homegrown terrorist group al-Shabaab. Despite recent government successes, fighting continues in Somalia.

Why has al-Shabaab proved such a hard nut to crack?

It’s 18 years since the militant group Harakat al-Shabaab, as al-Shabaab refers to itself, rose out of the disintegrating Somali state. It emerged in 2006 from an existing radical network that lorded it over the capital Mogadishu through Sharia courts. Since then it has suffered both battlefield defeats and territorial losses. Yet it remains as strong as ever.

In 2012 it joined the al-Qaeda global terrorist network. Al-Shabaab’s strength is estimated at between 7,000 and 12,000 soldiers, making it numerically the strongest organisation under the al-Qaeda umbrella.

Al-Shabaab has grown rich and retained influence, thanks to six main factors.

Faulty western doctrine

The west and its African partners have focused on the “hearts and minds” approach to counterinsurgency in Somalia. Building democratic institutions and democracy is part of this strategy. But these are institutions that don’t always function in a war zone, and fail to have the intended effects.

This strategy, along with the focus on military strength, has tended to neglect the security of the local population. Civilians are left to the mercy of bandits and insurgents. Locals are exposed to pressure to supply insurgents, pay taxes to them, and to join them. In many cases, they rely on insurgents for protection in local conflicts.

Illegal taxation

I am a researcher and author who studies the war economy, security, political Islam and religion and development. My area of focus includes the Horn of Africa. My book, Horn, Sahel and Rift, the Faultlines of African Jihad, highlights factors that have enabled African jihadists to survive and flourish for decades. Some of these factors apply in the case of al-Shabaab.

Al-Shabaab is a revenue-collecting machine involved in illegal taxation, smuggling and money laundering. It can do this because its opponents don’t do enough to protect conquered areas or areas controlled by the government. Al-Shabaab is able to govern and control even areas that are militarily controlled by the state and the African Union mission.

The government has mounted a campaign against al-Shabaab taxation in Mogadishu since 2022. It has managed to curtail the group’s electronic money transfer channels by monitoring the business community more closely.

The government’s western allies have also helped to crack down on money laundering networks outside Somalia, in Dubai, Kenya, Uganda, Cyprus and Finland.

But even these efforts have failed to take the security problems of the Somali business community into account.

In this context, the Somali business community will willingly pay taxes to Al-Shabaab. Author Aisha Ahmad has made the point that this money was crucial in explaining how al-Shabaab re-emerged after substantial losses in 2006-2007 and 2011-2016.

Protection

The group’s reputation as a protector has been built from the start. While al-Shabaab’s interpretation of sharia was harsh, it offered predictability and, in some cases, even protection. Al-Shabaab’s court system produced results.

The group’s ability to implement its policies, and to punish civilians resisting them, added to its influence.

Communal rivalries
Clans are an important factor in every aspect of life in Somalia. Clans define the relationship between people and all actors in the country, including Al-Shabaab.

Clan has become more important for al-Shabaab’s internal and external politics. It has put increased emphasis on wooing traditional leaders and organising them in a national clan shura (consultative council). In some cases, the group has attempted to counterbalance government influence among some clans, and hinder government mobilisation of clan militias. In strategic regions, for example, along al-Shabaab supply routes, clan elders can have a great deal of influence.

Clans have been mobilised recently by government to fight al-Shabaab. But support forces from clans can fracture because of clan conflicts, undermining the war on al-Shabaab. Clan conflicts will in some cases also drive clans, and individuals, to ally with the Shabaab for protection.

Rural security, including mediation between clans, has not been a part of the approach to fight al-Shabaab.

Army weaknesses

The Somali army has improved vastly over the last decade and a half. It drives the current offensive and does most of the fighting. An institution that barely existed 15 years ago has today around 19,000 troops. Of these 8,000 are mobile troops trained by American and Turkish officers. Desertion rates are much lower than they used to be. Training has improved and soldiers get paid, which wasn’t always the case.

But the army still lacks the numbers to launch credible offensives in several regions simultaneously. Its lack of motorisation also limits its ability to shift units from one region to another. This raises doubts about the military support that the Somali army can provide to federal states which are reluctant to face al-Shabaab alone.

The Somali army has internal problems to deal with too. These include corruption and clan-based recruitment.

The existence of safe areas

The core regions that al-Shabaab controls in lower and middle Juba in the southern part of Somalia, as well as in the South West state, have yet barely been touched by the current offensive. Al-Shabaab has held territories in these areas for more than a decade and a half. Its administration structures are well established at a local level.

These regions create a hinterland that al-Shabaab can use to rest forces, train new troops, and plan and coordinate operations and propaganda efforts. It is impossible to vanquish the group without taking these territories.

What next?

The previous patterns of offensives against al-Shabaab in Somalia highlight weaknesses in both the western and local counterinsurgency strategies. The result is a relative stalemate. The lessons of the past still hold value for the future – but are often neglected.

Zimbabwe Communist Party slams Zanu-PF’s bid to extend Mnangagwa’s rule

The Zimbabwe Communist Party (ZCP) has criticised Zanu-PF’s efforts to extend President Emmerson Mnangagwa’s rule, asserting that Zimbabwe needs to move beyond the current leadership due to its role in the nation’s ongoing economic difficulties.

ZCP General Secretary Ngqabutho Nicholas Mabhena made these remarks in response to recent calls from Zanu-PF’s Harare Province for constitutional amendments that would allow President Mnangagwa to remain in office beyond 2028 when his current term is set to end.

Speaking against the proposed amendments, Mabhena questioned the logic of extending Mnangagwa’s presidency.

“While any constitution can be amended, we don’t see the need to amend the Zimbabwean Constitution to allow President Emmerson Mnangagwa to stay in office. There is no basis,” he told CITE.

Zanu-PF’s Harare Province, led by Chairman Godwills Masimirembwa, recently resolved at a provincial inter-district conference to push for constitutional changes. These could include extending the number of years per term, increasing the term limit from two terms to three, or eliminating term limits entirely.

Masimirembwa suggested that any such amendments should specifically benefit Mnangagwa, enabling him to continue his leadership.

However, Mabhena sharply criticised these proposals, particularly questioning the credibility of Zanu-PF’s much-touted Vision 2030.

“What projects is Zanu-PF talking about? The so-called Vision 2030 doesn’t exist. What is the vision? It is not there,” Mabhena said.

The general secretary argued that Mnangagwa’s administration has failed in critical areas such as economic restructuring, job creation, and boosting production.

“You cannot say you want a person who has failed in restructuring the economy, failed to create jobs, failed to ensure there is production, and then your main priority is that this same person should continue in office to see through this vision. What vision?” Mabhena questioned, expressing deep scepticism about the government’s goals.

Mabhena further lamented the state of the economy, highlighting high unemployment, the exodus of people to neighbouring countries in search of better opportunities, and the instability of the local currency.

“There’s massive unemployment, young people are leaving in droves for neighbouring countries. So the 2030 vision only exists in the minds of Zanu-PF members,” he said, accusing the party of using the vision as a cover for looting state resources.

“In fact, it is a vision of looting resources so they want Mnangagwa to stay in office so that they can continue looting. Our currency is unstable, there’s no organized production, unemployment is at its highest, and our economy is informal. What vision are they talking about?”

He also pointed to deteriorating infrastructure as evidence of the government’s failure.

“You can’t drive from Bulawayo to Victoria Falls; look at the roads across the country. There is no railway network. What vision are they talking about? The vision does not exist,” Mabhena said.

For the ZCP, Mabhena also stated that the issue of failed leadership extends beyond Mnangagwa to Zanu-PF as a whole.

“It’s not only about Mnangagwa, it’s about Zanu-PF as a political institution. The party has no clue on how to organize production. We must organise an election enabling a new government to take over because Zanu-PF has failed. It has failed to rebuild the economy of Zimbabwe,” he declared.

As Zanu-PF prepares for its 21st Annual People’s Conference at the Zimbabwe International Trade Fair (ZITF) Grounds in Bulawayo from October 22 to 27, 2024, Mabhena noted that the focus should be on the need for new leadership rather than extending Mnangagwa’s tenure.

“President Mnangagwa and Zanu-PF should not be given another term in the name of Vision 2030. We must have elections in 2028 and let the people of Zimbabwe elect a government of their choice,” he insisted.

The general secretary also questioned Zanu-PF’s reliance on Mnangagwa for their “so-called” Vision 2030, asking if the ruling party was facing a leadership crisis.

“Even if Zanu-PF claims to be a strong institution, why do they place the implementation of their Vision 2030 on one person—Mnangagwa? Are they telling us they have no one else capable of leading them and carrying through their vision? If so, then Zanu-PF is admitting they have a leadership crisis,” he said.

According to reports, the proposed resolutions made by Zanu-PF’s Harare Province will be presented to the party leadership at the upcoming annual conference, where discussions about the proposed constitutional amendments are expected to take centre stage.

However, Mabhena urged Zimbabweans to continue resisting such plans so that “Zanu-PF gets the message that people are tired of them.”

Diddy has filed a motion to dismiss a $30m lawsuit filed by record producer Rodney ‘Lil Rod’ Jones, who sued him for constant groping and a possible drug-induced r@pe.

Back in February, Jones filed suit just weeks before two of Combs’ homes were raided by federal agents amid a s3x trafficking probe.

Jones claimed he was ordered to recruit prostitutes and have s3x with them for the star’s pleasure, and has hundreds of hours of video documenting Combs’s ‘serious illegal activity’. Diddy has denied all allegations of wrongdoing.

At that time, the embattled hip-hop star was already facing lawsuits from three women and had lost a host of commercial deals in the wake of the claims.

Now Combs, 54, has fired back at Jones’ second amended lawsuit in new court documents filed in Manhattan Federal Court on Monday, accusing him of ‘exploiting’ the star for money.

The filing reads: ‘Jones’ Second Amended Complaint is his third attempt to dress up a run-of-the-mill commercial disagreement as a salacious RICO [Racketeer Influenced and Corrupt Organizations Act] conspiracy.

‘Running to nearly 100 pages, it includes countless tall tales, shameless celebrity namedrops, and irrelevant images. Yet, despite all its hyperbole and lurid theatrics, the SAC fails to state a single viable claim against any of the Combs Defendants.

‘Replete with legally meaningless allegations and blatant falsehoods, the SAC’s [Second Amended Complaint] true purpose is to generate media hype and exploit it to extract a settlement—no surprise, given that his attorney was recently referred to this Court’s Grievance Committee for engaging in a ‘pattern’ of ‘improperly fil[ing] cases in federal court to garner media attention, embarrass defendants with salacious allegations, and pressure defendants to settle quickly.’

The documents also claim Jones posted a video laughing about the lawsuit and joking about money Diddy would have to pay him.

‘Taking a page from his lawyer’s playbook, Jones recently posted a video on the ‘X’ platform in which he, together with a performer known as ‘Uncle Murda,’ laughed about this lawsuit (despite his allegations of ‘severe emotional distress’), demanded Mr Combs pay him ‘that money by Monday,’ and warned: ‘I’m from Chicago, we don’t play about our business.’

‘Like the SAC, Jones’ videotaped threats on social media are part of a calculated effort to promote his personal brand and profit from the exposure. Such tactics have no place in federal court.’

Combs’ Lawyer, Erica Wolff said: ‘Mr. Jones’s lawsuit is pure fiction — a shameless attempt to create media hype and extract a quick settlement.

‘There was no RICO conspiracy and Mr Jones was not threatened, groomed, assaulted, or trafficked. We look forward to proving – in a court of law – that all of Mr Jones’s claims are made up and must be dismissed.’

Diddy shot back at Jones’ claims his ‘business or property’ was hurt due to non-payment for services he performed on Diddy’s 2023 The Love Album: Off The Grid – saying he failed to prove this under the RICO Act.

The documents also allege Jones never offered a primary claim under the Trafficking Victims Protection Act of 2000 – showing that he was forced to commit a sex act in exchange for something of value or fall victim to any such act.

Diddy also claims Jones failed to provide details describing the alleged sexual assault claims and sexual harassment claims he made against the star.

Regarding an argument over breach of oral contract, Diddy says that has run beyond the statute of limitations.

Jones’ attorney Tyrone Blackburn told TMZ: ‘This is clearly a billing exercise by Combs’ latest set of attorneys, who are late to the game and are attempting to fill their pockets with this Hail Mary motion to dismiss before their client is indicted.’

THE UPND Ministers hon. Jack Mwiimbu and hon Cornelius Mweetwa have been competing as to who is the biggest drama King in the ruling party. While hon Mweetwa took the first spot for a long while, hon Mwiimbu has clearly taken over the number one spot. Shocking that they are both lawyers by profession.

At the Citizen’s First/ UKA Samfya rally over the weekend, President Edgar Chagwa Lungu clearly said civil servants doing ifyabupuba will face the consequences when government changes in 2026.

If some people condemning his statement knew how the opposition are suffering at the hands of some of these politically influenced civil servants, they would not even say a word.

President HH sorted out civil servants that were political and abused him when he was in opposition. Truth of the matter is that, when power changes, it is not just the people who say so, but anyone who forms government can never condone civil servants that abuse the law to sort out the opposition on behalf of the ruling party. Civil servants should stay away from politics and work with the government of the day, while serving the public, which includes the opposition. Why should a civil servant fail to serve me when I visit their office, all because I am not in the ruling party? Why should the police arrest me anyhow all because the politicians have told them so? Why should court judgements be politically influenced?

Before they give people charges, the police even clearly tell you that they are waiting for instructions. So I repeat, there is nothing wrong that President ECL said in Samfya. Presidents Sata and HH both said similar things while in opposition and when they formed government, politically exposed civil servants became casualties. That is the sad reality of our politics.

And while in the past, only high ranking civil servants became casualties of political changes, the UPND has actually fired even low ranking officials that were perceived to be political while they were in opposition. So civil servants have learnt the hard way the consequences of doing ifyabupuba fyama politics when your job requires you to be neutral.

We ALL want a professional and objective civil service for the good of Zambia and all its citizens. That is the only way that our country will develop now and in future.

On Sunday, August 25, 2024, footage of a group of UPND cadres clad in party regalia, and threatening to attack security guards with machetes, at the Catholic-owned Yusufu radio in Muchinga province’s Mpika district, went viral on social media.

And yesterday, Catholic Bishop of Mpika, Rt. Rev. Edwin Mulandu confirmed the incident through a statement informing all priests, religious leaders and Catholics in the diocese of what he termed as the invasion of the diocesan pastoral premises and harassment of security staff. Bishop Mulandu narrated that a group of young men dressed in red regalia suspected to be affiliates of a major political party, forcefully entered the premises and that their apparent intent was to disrupt a political program, which was scheduled to air Citizens First president Mr Harry Kalaba. Bishop Mulandu further stated that despite the guard’s attempts to manage the situation calmly and professionally, the intruders continued to act aggressively and threatening the staff members, and residents at the property with offensive weapons.

“We have officially lodged a complaint to the police, here in Mpika, to investigate this matter and take appropriate action against the individuals involved. It is imperative that such incidents are managed to prevent any future occurrences and to ensure the safety and security of our premises and their occupants,” reads the Bishop’s statement in part.

This country has never faced a shameless regime that is resolved to govern through intimidation, persecution, vindictiveness and fear. A regime that uses the police and law enforcement to abuse, pursue and mistreat political competitors and private citizens under the guise of safeguarding peace, national security and order. Certainly, Mr Hakainde Hichilema has calculated to suppress free political expression to prevent opponents and private citizens from holding them to account.

Mr Hichilema and the UPND’s many failures have exposed them as incompetent and incapable of fulfilling the vast campaign promises they made to the people. And now that they can no longer manipulate and deceive the people, they want to dodge responsibility by silencing political rivals and citizens through repression, victimization and draconian laws. Mr Hichilema and his league’s grip on power keep getting tighter and tighter. They’re mercilessly choking everybody and everything that dares to stand in their way. They’ve even stopped pretending about their brutal style of governance. They now wear tyranny as a badge of pride and honor. To them, it’s either their way or no way. They’re determined to entrench themselves without hesitation through manipulation of the law, legislative mischief, malicious abuse of governance systems, and exercise of physical violence and force

This government poses the greatest danger to our rights, freedoms and existence. Our national unity, peace and security is under threat. Anyway, we wait to see what the police will do since Bishop Mulandu has lodged a formal complaint with them. We hope the victims of this attack won’t end up being suspects as this seems to be the trend with Mr Hichilema’s cadre police service.

Indeed, these are dangerous times! But the people’s will shall ultimately prevail. 2026 yena Hichilema aleya!

THE “HH ROAD”: HICHILEMA’S AWKWARD OBSESSION WITH HIMSELF

Mr Hakainde Hichilema was last Saturday at Mkaika, in Katete district of Eastern province attending the Kulamba traditional ceremony. And speaking at the ceremony, Mr Hichilema, who claimed to have silenced the people that doubted his capacity to deliver, promised to prioritize the construction of the Chadiza-Chipata road, which he has now named the “HH Road”.

Every country name infrastructure, spaces or places after its finest sons and daughters. And these are usually eminent individuals that are worthy of recognition because of their heroic acts, values, ideas or politics deserve remembrance, promotion and preservation for future generations not to forget their names.

The naming of public spaces is never a single leader’s private matter or decision. It is an act of gratitude for the individual’s service to their country. And it is society that decides in collaboration with its leaders to appreciate these individuals for what they have done to humanity. This is the dominant logic behind the naming of public spaces after celebrated individuals. And public spaces, buildings, roads or places are named after leaders when they are out of office, not when they are still serving.

Haven’t you wondered why, for all his great contributions to this country’s infrastructural changes and development, none of the public roads, buildings or infrastructure was named after Mr Michael Chilufya Sata whilst he was still in office? We are reliably informed that it was Mr Sata’s wish that no single infrastructure project be named after him whilst he was still president. Numerous suggestions to name public spaces, roads and buildings were made at the time, but the man flatly refused: “Are you normal? How do you name something when I am still here (in office)? Who do you want to impress?”. We are told this was Mr Sata’s common response to his lieutenants every time the issue of naming things before him came up.

In fact, on September 30, 2011, Mr Sata named the then newly constructed 40,100-seater stadium in Ndola as Levy Mwanawasa Stadium, in honour of Zambia’s third republican president, who clinched the deal with the Chinese government five years before the stadium opened its doors to the public. Mr. Mwanawasa never named the stadium after himself upon sealing the deal with Beijing for its construction. It took Mr Sata to come and bestow the honor on his departed colleague five years later. Naming places, roads and buildings is supposed to be an honor bestowed on an individual by other people; as opposed to doing it yourself. That is wide of the mark and too despotic!

Therefore, it is very awkward that Mr Hichilema, in his current capacity and for his own interest, can be going round naming government projects after himself, when he is using public money for these projects. Public office is for serving the people and not a personal branding voyage. If Mr Hichilema loves his name so much, why hasn’t he named his cattle ranches after it? Mr Hichilema knows that he is losing power hence this desperation. He knows that history will not be so kind on him, it won’t flatter him, as all his terrible deeds would be remembered well. That is why he is now urgently attempting to leave some traces of himself before 2026, but it’s too late.

The Economic Freedom Fighters-EFF, on behalf of the Zambian people, expresses deep outrage and condemnation at the Hakainde Hichilema UPND Government’s clandestine and corrupt decision to transfer the profitable Katuba, Manyumbi, and Kafulafuta Toll Plazas on the Lusaka-Ndola Highway into foreign hands. These toll plazas, which collectively generate over $40 million annually, have been instrumental in funding vital services such as poverty alleviation programs, medicine for public hospitals, school support, and road maintenance. This decision is not only a betrayal of the Zambian people but a glaring example of a government that prioritizes foreign profits over national interest.

This transfer, done in the shadows and without the consent or knowledge of the Zambian public, is happening only months after the commencement of a few earthworks on the highway. The toll plazas in question, which were built with Zambian resources and have been crucial in generating revenue for the country, are now being handed over to a foreign consortium that has contributed nothing but is set to make millions. This move is a blatant act of economic sabotage.

What is even more disheartening is that the revenue from these toll plazas will no longer benefit the Zambian people but will instead line the pockets of foreign entities that had no role in the construction or maintenance of these toll plazas. This is daylight robbery. The Hichilema administration, through this corrupt concession, is allowing foreign companies to exploit Zambian resources for their gain, while ordinary Zambians bear the burden.

The Economic Freedom Fighters-EFF has consistently maintained that this concession was fraudulent from the start. It is nothing more than a scheme to defraud the Zambian people, orchestrated by a few businessmen with connections to the President and his UPND cronies. This is not a deal for the benefit of Zambia, but rather a ploy to enrich a select few and fund the UPND’s re-election bid in 2026.

There is no logical justification for this treacherous act. Why should a foreign company, which has brought no investment to Zambia, be handed control of our toll plazas? The Road Development Agency (RDA) and the National Road Fund Agency (NRFA) should have been tasked with managing the Lusaka-Ndola Dual Carriageway, ensuring that all revenue generated stays within Zambia. Instead, we are now witnessing a scenario where for the next 30 years or more, Zambian motorists will be financing foreign interests.

The Economic Freedom Fighters-EFF demands immediate action from the government. We call for the cancellation of this fraudulent concession and the return of control over the Katuba, Manyumbi, and Kafulafuta Toll Plazas to the Zambian people. The government must prioritize the welfare of its citizens and safeguard our national resources from foreign exploitation.

This underhanded deal, as revealed in the correspondence dated 6th August 2024, shows the depth of this betrayal. The letter, addressed to the Director & Chief Executive Officer of the Road Development Agency, outlines the covert transition process, where toll revenues from these plazas are to be deposited into the Concessionaire’s Escrow Account starting from 19th August 2024. The National Road Fund Agency (NRFA) has shamefully capitulated to this demand, seeking approval from the Ministry of Finance and National Planning to comply with this outrageous request.

We, the Economic Freedom Fighters-EFF, stand firm in our commitment to defending the interests of the Zambian people. We will not allow this government to continue with its reckless squandering of our national resources. We demand transparency, accountability, and the immediate reversal of this fraudulent deal. The time has come for the Zambian people to rise and hold their government accountable for its actions.

AS the State continues to unmask how the National treasury was allegedly ripped off, under the guise of procuring property for Zambian missions abroad by the Ministry of Foreign Affairs, the Economic and Financial Crimes Court has heard that the contract price for the purchase of a chancery in Turkey was inflated from US$9 million to US$19.5 million.

Kwaleyela Mukelabai, a Senior Assistant commissioner under the anti-money laundering unit at the Drug Enforcement Commission (DEC) said, during investigations he established that money was sent to Turkey by the ministry of Finance, before the contract for the procurement of property could be approved by the Attorney General.

In this case fomer secretary to the treasury Fredson Yamba is accused of failing to adhere to guidelines relating to the management of public resources, and is jointly charged with Joseph Malanji, a former minister who is accused of possessing property suspected to be proceeds of crime.

In his testimony before principal resident magistrate Irene Wishimanga, the witness said no approval was sought from the Zambia Public Pricurement authority (ZPPA), for the purchase of chanceries and staff houses for missions abroad.

Mukelabai said he interviewed Lydia Kwibisa, who was the in-house legal counsel at the Ministry of Foreign Affairs who explained that, in December 2020 she received a one paged contract drafted in Türkçe from the Permanent Secretary, Dr Ronald Simwiinga regarding the procurement of properties in Turkey at a price of US$19,500,000 and she was asked to send to the Attorney General’s office for approval.

“The document was approved by former solicitor general Abraham Mwansa. I interviewed Mr Mwansa to find out how a one paged contract with specific conditions was approved in its form and content,” he explained.

Mukelabai told the Court that Mwansa said, he could not recall whether the contract had other accompanying documents.

He said he decided to go to Turkey for further investigations and he interviewed the accountant for the Zambia mission, Kennedy
Sankenga who disclosed that the procurement was dealt with at high level and only the ambassador, the late Joseph Chilengi, Joseph Malanji and himself (Sankenga) were the only people who knew about the process involving the procurement of the 12 properties.

“He mentioned that documentation pertaining to the transactions of the procurement of the property were kept under lock and key by the ambassador and payments to lawyers, estate agents, among others were processed separately. There was a separate backing sheet for operations and backing sheets involving the procurement of 12 properties,” Mukelabai said.

“Whilst gathering documents, I came across a payment voucher of $4,868,000 to Burhan Asaf Shafak it also had letters of instruction written in Turkish and English attached to the same.”

He said he noticed that the one paged contract signed by Mwansa was at variance with the 45 paged contract he found in Turkey, which had payment vouchers attached to it.

“I noticed that on December 28, 2020 there were three major activities that were of interest to me during the investigation that happened that day: Mr Malanji arrived in Turkey, on the same day the contract which was different was signed and the US$4, 868,000 was transferred from the Zambian Embassy dollar account to a Mr Burhan Asaf Shafak.”

Shafak was a lawyer who represented the landlord, who sold the chancery to government.

He said he discovered a letter to the işBank, for payment of US$2,095,000 to Shafak. Other vouchers were $195,000 to Mero for real estate services, another US$60,000 to Mr Tan Zapata for legal services.

“Another document was called an invoice it was outlining how the total funds received by Burhan were used. It was US$6,877,000. Mr Sankenga said on December 29, 2020 ambassador Chilengi instructed him to go to the bank where he was expected to escort Burhan for transactions at the bank,” Mukelabai said.

“Mr Sankenga explained that he escorted Burhan because the previous week, Burhan had gone to book for the withdraw of the money over the counter, and the bank told him it would be approved if the people who paid him were available.”

He said according to Sankenga, $4,600, 000 was withdrawn over the counter by Burhan but, the bank statement showed that US$4,768,000US$ was put in the bags that were later taken to Malanji at Sheraton Hotel.

He said general Kavuma who was the defense attaché was asked to make a fresh clearance for Malanji’s private jet, which was scheduled to leave at 14:00 hours but he couldn’t leave because Sankenga had delayed to take the money.

It was reported that the late Chilengi, pleaded with general Kavuma to engage his colleagues so that Malanji’s bags could not be searched at the Airport.

“General kavuma said he was not comfortable with the instructions because he was in uniform, and informed his colleagues that, the minister’s entourage goes straight to the plane because it had delayed and that’s exactly what happened and the minister sped off,”he said.

Mukelabai said according to Betty Namukoko, Malanji’s jet touched down on December 29 around 02:00 hours, and she and others had gone to welcome him.

He said he interviewed the real estate agent that was engaged by the embassy, who gave him quotations of the chancery building and staff house depending on the location, which was about US$9.2 million.

“The contract price which was US$ 19.5 million dollars was not reflective of the properties on the ground. According to the quotation of US$9.2 million, I noticed that it was inflated by 10.3 million dollars,” Mukelabai said.

He said out of the US$7.1 million which was sent to Turkey by the Ministry of Finance ($5 million and 2$ million) about nine properties could have been purchased, but instead there was only one property that was bought in August 2021.

Mukelabai added that he tried to interview Burhan to give an account of how the money was spent, but he threatened to unleash Turkish authorities on him, on the premise that he had no authority to speak to him.

“The political attaché tried to talk to him and said, the only reason we were asking him about the property was because the ambassador was late. He still didn’t cooperate we survived the threat and drove back to Ankara,”said Mukelabai.

Court denies Muchemwa bail, says chances of his appeal succeeding are slim

THE Economic and Financial Crimes Court, has declined to admit incarcerated former PF intercity bus terminus ‘commander’ Francis Muchemwa to bail.

Lusaka Chief resident magistrate Chibwili ruled that chances of Muchemwa’s appeal succeeding are dim.

Muchemwa was on July 26, 2024 sentenced to three years imprisonment with hard labor by the EFCC for possessing a luxurious house, apartments, land with incomplete flats, and two Faw trucks worth over K12 million which were way beyond his legitimate source of income.

He was also fined K141,000 for obtaining pecuniary advantages by false pretenses, when he drew the said amount from ZESCO as subsistence allowances for the trips he undertook yet, he never filed an imprest retirement report.

The convict applied for bail pending appeal against his conviction and sentencing.

In his two grounds of appeal Muchemwa said the Court erred in law and fact, when it convicted and sentenced him for failure to submit documentary evidence proving that his wealth was clean, on a technicality.

He also argued that t magistrate Chibwili erred in law and fact, when he found him guilty for obtaining free money from ZESCO based on circumstantial evidence.

During bail hearing, Muchemwa’s lawyer Nathan Muyembe asked the Court to temporarily release his client pending appeal.

Muyembe said the appeal has prospects of success.

He cited  the case of Titus Zulu versus The People where a superior court guided that bail pending appeal must not be delayed.

Muyembe said his client was ready to meet the conditions set by the Court.

ACC prosecutor Chawezi Nalwenga in opposing the application said according to Section 332 of the Criminal Procedure Code (CPC) bail pending appeal is not granted as a matter of right but, rather it is the discretion of the court.

She said it is impossible for Muchemwa to serve part of his three year – sentence by the time his appeal against his conviction will be heard as the Economic and Financial Crimes Court hears matters within five months.

Nalwenga said, Muchemwa has not demonstrated that his appeal against his jailing for possessing tainted wealth has prospects of success, nor has he proved that he would have served a substantial part of the sentence, by the time the appea is heard.

She said the EFCC hears matters within five months immediately plea is taken.

And Daniel Ngwira added that no prejudice will be occasioned to Muchemwa and the court should not be swayed because he is incarcerated as incarceration is a natural consequence of a conviction.

In his ruling magistrate Chibwili said: “I do not find that there are any exceptional circumstances warranting me to grant bail. The application is denied”.

THE Economic and Financial Crimes Court yesterday heard that immediately he returned from Turkey, former Minister of Foreign Affairs Joseph Malanji deposited the money allotted for the purchase of a chancery in Turkey which he had allegedly diverted, into his company accounts.

The money was later used by Malanji to buy two helicopters from two aviation companies in South Africa.

Kwaleyela Mukelabai, a Senior Assistant commissioner under the anti-money laundering unit at the Drug Enforcement Commission (DEC) narrated before principal resident magistrate Irene Wishimanga, that the two black bags full of dollars which Malanji had gone to personally collect from Turkey ended up in his living room.

Mukelabai said he interviewed Malanji’s driver
Christopher Pomboloka, who confirmed having picked up from the Airport on December 30, 2020 in the wee hours, and he was given two black bags which he put in the former minister’s vehicle and later drove to his home.

He said according to Pomboloka, Malanji asked him to leave the bags in the living room, after which he instructed him to pick him up in the afternoon.

Mukelabai said in the afternoon on the said day, Pomboloka picked up Malanji, and took him to play golf.

“I went to PACRA to ask for the companies which Mr Malanji had interest in and the official provided documents in which Malanji had an interest and was a director. There was Gibson power systems; Gibson Air Chatters, Gibson Development properties and Royal Gibson Hotel,” Mukelabai said.

“The printouts showed that indeed Mr Malanji was a director together with his brother Benson Malanji.”

He said he interviewed Francis Chilufya from Stanbic who provided bank statements for Gibson Power Systems’ dollar and Kwacha accounts where Malanji was the sole signatory.

“When I was shown the transactions on the accounts, what I noticed on December 31, 2020, was that Mr Malanji started depositing dollars in the Gibson Power Systems Dollar account amount $100, 000 per day for a period of 14 days.” Mukelabai disclosed.

“There were also monies which were being transferred from a company called Sudika General dealers which was managed by Diana Maniko who was a branch manager at Stanbic Kabulonga branch to Gibson power systems.”

He said when he interviewed Maniko, she informed him that the money which was being deposited into her company account and transferred to Gibson Power Systems came from Malanji.

“Some money was wired to National Airways Corporation (NAC) in South Africa. The bank statement showed a total of US$1, 400,000 was deposited to Gibson Power Systems and sent to (NAC) for the procurement of a helicopter,” Mukelabai said.

“There was also a transfer of a $400, 000 which was broken down in $200,000 to a company called MML aviation in South Africa which I came to learn was the payment of a second helicopter.”

He said Malanji also deposited some money in Gibson Power Systems Kwacha account from October 26, 2020 to October 30, 2020 immediately he returned from Morocco.

“He travelled to Mortgage on October 22, 2020 and returned on October 25 the amounts were in the range of K2 million per day, he was converting dollars into Kwacha it was a K10 million that he deposited. During the said period he was depositing a $100, 000 everyday,” Mukelabai said.

“The K10 million was transferred to FNB Gibson Power Systems account where he was liquidating an overdraft facility which he started accumulating as far back as 2013.”

He said Malanji had borrowed money from FNB in 2013, to renovate Royal Gibson Hotel on the Copperbelt.

“After he returned from Morocco he deposited the money and it was used to clear the overdraft. He got K4.9 million , K7.9million and K10.2 million it ballooned to K14 million,” Mukelabai said.

“Over $600,000 had been deposited in Sudika account by Diana Maniko and Mr Malanji which was subsequently deposited into Gibson Power Systems account.”

The witness said Chawezi Nyirenda another employee at FNB who was managing Gibson Air Chatter account, disclosed that there was a transfer of US$110, 000 from Burhan Shafak on July 20, 2021 to the said account.

“I was able to find the same amount on Shafak’s bank Statement which was transferred on July 26. September 2, 2020 there’s another transfer of $105, 000 to Gibson Air Chatters,” Mukelabai said.

He said he was informed that FNB had commenced Court proceedings against Malanji’s hotel because Royal Gibson Hotel had failed to pay the overdraft facility.

“I also interviewed Sandra Muwowo from ABSA Bank who managed Gibson Property Development accounts. She said there were cash deposits made by Malanji in March 2021 and June 2021 few days after he returned from Turkey,” said Mukelabai.

“She said after depositing US$300,000 Mr Malanji wired it to MML Aviation for the BELL 206 Ranger as well as US$400, 000 that was also deposited a total of US$700, 000 was paid for on the smaller jet. The one which was bought in January was BELL 430. Muwowo said the deposits of $100, 000 in March and in June had accumulated to US$400,000 which was wired to NAC aviation for servicing of the helicopter.”

DETAINED Lusaka businessman Shadreck Kasanda is now at the end of his rope over his prosecution for aggravated robbery since he was re-arrested last week Tuesday, as he now wants the Lusaka High Court to compel police officers at Ibex Hill, to take him to Court.

The businessman who is accused of robbing his Egyptian Client Micheal Adel Michel Botros of US$5 million in a gold scam, has filed a writ of Habeas Corpus ad subjiciendum pleading with the Court to take interest into the unlawful deprivation of his freedom.

In an affidavit in support of ex-parte notice of motion for writ of habeas corpus ad subjiciendum, Kasanda said he was arrested for armed robbery in August 2023 and put on trial in April 2024.

He said the prosecution closed its case on August 20,2024, and his lawyers proceeded to make oral submissions for no case to answer, and the State discharged him by discontinuing the case through a nolle prosequi.

“On the same day, barely an hour from my discharge, I was re-aressted and detained by the respondent without being informed the reasons for my re-arrest,” he stated.

He explained that, on August 21, a warn and caution statement was administered to him for the same offense of aggravated robbery on same facts.

Kasanda complained that since August 20, following his re-arrest, up to date, he has been in detention without cause or being charged with any offence.

“The State has refused or neglected to charge me and take me to court, and my lawyers’ efforts to have me released have also failed, as the police allege that they are still investigating the matter,” he said.

He stated that his continued detention by the police without any charge or cause, is unlawful and unconstitutional.

“I respectfully apply to this court to issue forthwith a writ of habeas corpus directing the officer – in- charge ,Ibex Police Station to present me before court immediately after receipt of such writ, to undergo and receive all and singular such matters and things as this court shall then and there consider the legality of my continued detention without cause or charge,” said Kasanda.

“I implore this court to inquire into the legality and validity of the denial of my liberty by the State, by scrutinizing rigorously the impugned detention.“

Today, Minister of Commerce, Trade and Industry Hon. Chipoka Mulenga unveiled equipment at Mulungushi textiles limited to kick start the operationalisation of the plant.

Below are the highlights;

– Government is elated for the potential contribution to the growth of the Zambian economy particularly in advancing the economic transformation agenda.

– The revitalisation of Zambia – China Mulungushi Textiles Limited is in line with the Eight National Development Plan of government.

– The development of this facility which will be done in four (4) phases will involve:

1) Printing fabrics and garments at an estimated investment of USD20 million;

2) A 20MW Solar Plant at an estimated investment cost of USD20 million. This plant will generate power for Mulungushi Textiles while the excess will be fed into the national grid;

3) Solar Panel Assembly Plant at an estimated investment cost of USD50 million; and

4) Spinning facility at an investment cost of USD80million.

– Government is expecting about 400 containers laden with various machines and equipment which are already in transit from China.

– Mulungushi textiles limited plans to create about 500 jobs this year. As well as, business opportunities through, out-grower schemes are expected to be created with over 50,000 small scale farmers in Central Province.

– Key interventions that have made the revitalisation of this company was of the Investment, Trade and Business Development Act No. 18 of 2022 that broadened the definition of Rural Area for investment incentives purposes.

– Government has put in place a number of interventions that are aimed at supporting affected citizens through creation of business and job opportunities.

– This occasion is one example of the results of these Government interventions, which have included provision of both fiscal and non-fiscal incentives for business growth.

-Government has since encouraged companies to develop captive power plants to be used in their production activities.

– The Ministry desires for the business community to be able to freely dialogue in all areas of concern including policy, legal and regulatory frameworks in order to unlock Zambia’s economic potential.

INTERNATIONAL Credit Rating Agency (ICRA) Zambia country director David Mwambazi says it is exciting that the push to have an African credit rating has gained momentum, with full implementation expected next year.

Mr Mwambazi has been picked as one of the delegates to the 9th Ad hoc Committee meeting on African Peer Review Mechanism (APRM) Support for African Union member states which is expected to adopt a roadmap for the operationalisation of a continental credit rating.

The meeting will take place in Cairo , Egypt in October.

Mr Mwambazi was recognised for his efforts in pushing for a continental credit rating body.

“On behalf of the African Peer Review Mechanism Continental Secretariat, I wish to convey our sincere appreciation to you for the continued valuable support always provided to the APRM,” the invitation letter states.

The APRM is often described as “Africa’s unique and innovative approach to governance” with the objective of improving governance dynamics at the local, national, and continental levels.

Mr Mwambazi said his invitation to the continental body’s governance organ is also a recognition of the importance of ICRA’s presence in Zambia.

ICRA is one of the fastest-growing credit rating agencies globally, after Moody’s, S&P and Fitch, with a presence across Europe, Africa, and Asia.

The Securities and Exchange Commission recently accredited and approved ICRA Rating Agency Limited to operate as a credit rating agency in Zambia.

Mr Mwambazi insists that the emergence of a continental credit rating agency will have a positive impact.

There has been a push for Africa to have its own credit rating to provide fairer and more reliable information about the credit status of countries on the continent.

AU commissioner for development, trade, tourism, industry, and minerals Albert Muchanga announced in July that a new credit rating agency designed to address the needs of African sovereign borrowers is expected to be operational by next year.

He said the agency aims to provide a “more tailored” approach to credit ratings for African nations, which have traditionally faced challenges related to high borrowing costs and inadequate representation in global rating systems.

According to Mr Muchanga, the initiative is driven by a desire for a fairer evaluation and to improve the financial conditions under which African countries operate.

The credit rating will operate independently of the AU or any other regional bloc.

‘They can make my hair look better’ – Trump wants to get a haircut at a Black barbershop

During a recent interview with Lawrence Jones on Fox & Friends, the Republican Party’s presidential nominee Donald Trump expressed his interest in visiting a Black barbershop and getting a haircut there.

Per Mediate, Trump, 78, touched on that topic and also made false allegations against Vice President Kamala Harris. He also spoke about what was happening in Chicago and attacked the state’s governor JB Pritzker.

Jones is said to have asked Trump if he was interested in going to such establishments when she played videos of his visit to a Black barbershop.

“So, Mr. President, let’s talk about Chicago. You brought it up. I had the opportunity — I’ve been going all over Chicago for years now. But I went to a barbershop and there was a lot of people there,” Jones said during the August 22 interview.

“They talked about you. They talked about Kamala Harris stealing the tip plan from you. They say they’re open — this is a little bit from the folks that I talk to. Watch.”

The video then played a conversation Jones had with an unidentified male in the barbershop. “We’ve been doing these barber shop tours since ’03, and it’s really enlightening to hear individuals start to change their political direction. I think it’s time that Blacks in general need to boost our political IQ, stop being blindly faithful to a one-party system that does not work for us,” the man said.

“So I’ve always liked Donald Trump. You know, he was icon for years in our community and, all of a sudden, now he’s this big Klansman (ph).”

When Jones asked the man what changed, he replied, “I think the — I think the powers that be saw his potential in our community. The man added: “But they don’t have — they don’t — they don’t know how to communicate. So they’d rather not do it.”

After the video ended, Jones then asked Trump if he was interested in visiting Black barbershops. “So, Mr. President, he says that you got to directly communicate to the voters. Will you be on the ground at barbershops, local communities, talking about the issues that matter to them?” he asked.

Trump responded in the affirmative. “And I am going to be doing that. I like that guy, and I like those people in — I watched yesterday as you did it. You are doing fantastically, by the way,” Trump stated.

“I watched yesterday as you did the interviews. Those are great people. Those are people just want safety. They don’t want much. He wants to run his barbershop.”

The 78-year-old continued: “The people that were getting the haircut — I was thinking about maybe going there myself because that’s — they — I like the work, maybe they just — they make my hair look better. I’d pay a lot of money for that haircut. They can make my hair look better.

“But you know, honestly, those are great people, those are hardworking people. They’re strong. They’re tough. And they know they’re being conned by the Democrats.”

But Trump did not stop there as he then went ahead to attack the state’s governor. “You have a corrupt political system in Chicago. Look at your governor — the governor is an incompetent guy. He was thrown out of the family business. He was — Hyatt Hotels, I was partners with them years ago in a job in New York. They threw him out of the business,” he claimed.

“I know the family very well. They threw him out because they didn’t want him in the business. He ends up being governor. He has money. He ends up being governor. He’s incompetent.”

Trump also spoke about what he felt was happening in Chicago and the state. “Look, the Chicago and the whole Illinois thing is very, very corrupt, but we’re putting a big play there. We’re putting a big play in New York. You have the same situation in New York,” he claimed.

“If you went to a barbershop — any barbershop that you’re talking about, if you went to a barbershop in New York, in Los Angeles, in any place you want to talk about, you’re going to find the same thing, the same reaction.

“They’re really upset and I watch the mothers on your show this morning before we went on, so sad. They’ve given up on life, you have the worst prosecutors they go after guys like me, they don’t go — they go after me because I question the elections and things like that.

“It’s nonsense. If an election — if you can’t question an election, you — we don’t have a country. But when people get killed, when their children get killed, nothing happens.”

Trump then concluded by registering his displeasure over the outcome of the Jussie Smollett case and why he felt he was going to pull significant votes from Chicago.

“I remember Jussie Smollett, I said you got to prosecute this guy and they did. But Jussie Smollett was given a free hand and yet these killers — and they know who they are. The worst thing is they know who they are. They don’t even go and pick them up,” he claimed.

“And you have many communities like that. Chicago is terrible in that respect, but you have many communities like that. Chicago, 20 years ago, was a great city. I built a great building in Chicago. In fact, I see it every time they do the skyline. But Chicago has gone really wrong, and I think I’m going to get a tremendous amount of votes from Chicago.”

Australian workers can now choose to ignore work-related emails, calls outside of office hours

Australian workers now have legal protection against work-related intrusions into their personal time, thanks to a newly implemented “right to disconnect” law.

This regulation, which took effect on Monday, ensures that employees cannot be penalized for ignoring work emails, texts, or calls outside of their official work hours.

The law is a response to the increasing overlap between professional and personal lives, a trend that has intensified since the COVID-19 pandemic blurred the lines between home and the workplace.

Advocates of the policy argue that it empowers employees to reclaim their personal time without fear of repercussions, pushing back against the growing expectation to remain available beyond the workday.

“Before we had digital technology there was no encroachment, people would go home at the end of a shift and there would be no contact until they returned the following day,” said John Hopkins, an associate professor at Swinburne University of Technology.

“Now, globally it’s the norm to have emails, SMS, phone calls outside those hours, even when on holiday.”

In 2023, Australians clocked an average of 281 hours of unpaid overtime, with the Australia Institute estimating this time’s worth at approximately A$130 billion ($88 billion).

Australia has now joined a select group of around 24 countries, primarily across Europe and Latin America, that have enacted similar “right to disconnect” laws.

France was a trailblazer in this area, introducing such legislation in 2017. A notable enforcement of this law occurred the following year when Rentokil Initial faced a €60,000 ($66,700) fine for demanding constant availability from an employee.

Rachel Abdelnour, an advertising professional, welcomed the new regulations, noting that they would significantly enhance her ability to unplug from work, particularly in an industry where client schedules often diverge from traditional working hours.

“I think it’s actually really important that we have laws like this,” she told Reuters.

“We spend so much of our time connected to our phones, connected to our emails all day, and I think that it’s really hard to switch off as it is.”

REFUSALS MUST BE REASONABLE

The new regulations in Australia include provisions for handling emergencies and roles with unconventional hours, allowing employers to reach out to their employees. Workers, however, can refuse to respond if the request is deemed unreasonable.

The Fair Work Commission (FWC) will be responsible for determining what constitutes a reasonable refusal, taking into account the employee’s job responsibilities, personal situation, and the nature of the contact.

The FWC has the authority to enforce compliance through cease and desist orders and can impose fines up to A$19,000 for individuals and A$94,000 for businesses.

Despite these measures, the Australian Industry Group, representing employers, argues that the lack of clarity in the application of these rules could lead to confusion and reduced workplace flexibility. They warn that this could potentially hinder economic progress and impact business operations

“The laws came literally and figuratively out of left field, were introduced with minimal consultation about their practical effect and have left little time for employers to prepare,” the group said on Thursday.

The president of the Australian Council of Trade Unions Michele O’Neil said the caveat built into the law meant it won’t interfere with reasonable requests. Instead, it will stop workers from paying the price for poor planning by management, she said.

She cited an unidentified worker who finished a shift at midnight, only to be texted four hours later and told to be back at work by 6 a.m.

“It’s so easy to make contact, common sense doesn’t get applied anymore,” she said.

“We think this will cause bosses to pause and think about whether they really need to send that text or that email.”

Before Barack Obama became the 44th U.S. President, there was a plot by members of a Wayward, Fla., chapter of the Ku Klux Klan in September 2008 to assassinate him, according to the New York Post.

The plan involved meticulously tracking Obama’s motorcade schedules, securing .50-caliber rifles, and arranging getaway vehicles to be destroyed after the attack. However, their plot was foiled from within.

Joe Moore, an insider who had been initiated into the Klan a year prior, had earned their trust with an embellished military record and expert marksmanship. He was chosen to be the one to pull the trigger. Unbeknownst to his fellow Klansmen, Moore was a counterterrorism informant working to thwart their assassination plot.

“I had to follow my orders and do whatever it took to prevent the assassination of Barack Obama,” Moore writes in his memoir, White Robes and Broken Badges. “Because I was the only one who could.”

As a patriotic American who despised bullies, Moore played a critical role in the FBI’s first-ever undercover operation targeting the KKK. He participated in every activity, from cross burnings to witnessing acts of violence and eerie rituals, all while wearing a recording device. During his time undercover, Moore encountered numerous law enforcement officers and government officials who were secretly aligned with the Klan.

Moore’s decision to mislead his Klan comrades ultimately saved Obama’s life, paving the way for him to become the first Black president of the United States. Moore, originally from Jacksonville, endured years of rubbing shoulders with devout racists.

He recalls one member showing him bunkers filled with firearms and tactical gear, while another gave him a tour of a backyard incinerator he referred to as “my own personal crematorium.”

Living a double life took a toll on Moore, who had to practice various techniques to maintain his cover, including listening to specific music and wearing an American flag-embroidered cap to help him get into character.

However, keeping his realities separate was a constant challenge. “The deeper I became entrenched in the Klan, the more of a challenge it became to leave all that at the door when I went home to my wife and son,” writes Moore, who relied on breathing techniques from his military days to cope.

After Obama was elected and following the protests over Michael Brown’s death in Ferguson, the Klan saw a surge in membership. Despite the risks, Moore went undercover again in 2013, infiltrating another Klan chapter in Bronson, Fla. His first undercover mission ended prematurely to protect his cover, but by then, Moore had already implicated four prominent Klan members in a conspiracy to murder a Black man named Warren Williams over a personal grudge.

The fallout from Moore’s work was significant. A gun battle in 2015 outside a Home Depot in Alachua, Fla., forced Moore and his family into hiding, taking on new identities. “I’d lie awake nights thinking that my payback for the most successful infiltration of the Ku Klux Klan in FBI history was losing my house, almost all my possessions, my friends, and by all accounts, my future,” Moore recalls.

His efforts were not in vain. In 2017, the four Klan members were sentenced to prison, and Moore’s work dealt a significant blow to the organization. However, he notes that many former Klan members migrated to other extremist groups like the Oath Keepers and the Proud Boys.

“I take great pride in dealing a hateful organization a devastating near deathblow,” writes Moore, who now lives with his family in an undisclosed location. “The overall movement in general, though, was far, far from dead or even in decline.”

Reflecting on his past, Moore criticizes the state of America, pointing to former President Donald Trump for contributing to the nation’s current divisions. He draws a line from the Klan to modern white nationalist groups and the January 6 insurrection, emphasizing the ongoing threat to democracy.

“The Klan and the like-minded groups it has produced have learned to balance bullets with bluster and pistols with paper, both of which have the potential to do far more irrevocable damage on the state of our democracy than the former,” Moore writes. “With the 2024 election looming, and democracy itself on the ballot… we should be very afraid.”

Following their first date, where they bonded over a shared love for superheroes and sci-fi, Williams and Ohanian got engaged in early January 2017.

Mnangagwa to stay in office beyond 2028

ZANU-PF structures are pushing for constitutional amendments to allow President Emmerson Mnangagwa to extend his presidency beyond 2028, when his second and final term is set to end. The proposed changes to the Constitution are expected to be a major topic at the upcoming 21st Annual People’s Conference in Bulawayo, despite Mnangagwa’s earlier statements that he would retire in 2028. These amendments would also impact two other ZANU-PF factions, led by Vice President Constantino Chiwenga and party spokesperson Christopher Mutsvangwa, who are reportedly vying to succeed the 81-year-old leader.

Once the recommendations from the People’s Conference are finalized, they will be forwarded to Parliament, where ZANU-PF holds a two-thirds majority, enabling the party to push through the necessary processes to remove the current two-term limit for the presidency.

On Sunday, ZANU-PF’s Harare province resolved to support constitutional amendments that would either remove the two-term limit or extend the length of each presidential term. The province argues that these changes would allow President Mnangagwa to continue leading the country and complete his infrastructural development projects.

Godwills Masimirembwa, ZANU-PF Harare provincial chairman, stated that the provincial inter-district conference was “united in the belief that President Mnangagwa should continue to lead the country beyond 2028.” He acknowledged the constitutional challenges but emphasized that the party was exploring ways to overcome them, including extending the length of each term or increasing the number of terms allowed.

ZANU-PF deputy secretary for security, Tendai Chirau, echoed these sentiments, highlighting the party’s strong support for Mnangagwa’s leadership and his Vision 2030, which aims to transform Zimbabwe into an upper-middle-income society.

In Mashonaland West, a key region for ZANU-PF, party structures also resolved that Mnangagwa should remain in office. The main, youth, war veterans, and women’s wings all cited Mnangagwa’s progress on Vision 2030 projects – such as roads, bridges, boreholes, and dams – as justification for his continued presidency.

Mary Mliswa-Chikoka, ZANU-PF Mashonaland West chairman, presented the province’s resolutions during a Provincial Coordinating Committee (PCC) meeting held in Nyabira over the weekend. These resolutions will be consolidated and presented at the People’s Conference in Bulawayo, with the selection of the province’s delegates already underway.

ED2030 slogan tears Zanu-PF structures

The push within Zanu-PF to extend President Emmerson Mnangagwa’s tenure beyond the constitutionally-mandated two terms has left the party’s provincial chairpersons in a difficult position, uncertain about the outcome and wary of potential fallout from Mnangagwa’s successor.

Sources revealed that chairpersons are apprehensive about alienating Vice-President Constantino Chiwenga, who is seen as the likely successor despite his public reluctance to express ambitions for the presidency. The internal debate centers around the ‘ED 2030’ slogan, which advocates for Mnangagwa to remain in office until 2030, even though Mnangagwa has stated he will step down at the end of his two terms in 2028.

Some provincial members have resisted chanting the ‘ED 2030’ slogan, arguing that it contradicts Mnangagwa’s stated intention to leave office in 2028 and fearing repercussions for either supporting or opposing the extension.

Provincial chairpersons in Masvingo, Midlands, and Matabeleland North, known for their support of Mnangagwa, have called for the President to rule beyond his constitutional limit. However, Vice President Chiwenga has not endorsed the slogan, instead urging discipline to achieve the 2030 vision after youth supporters chanted it.

In response, Vice President Kembo Mohadi has publicly supported the slogan, arguing that freedom of expression is protected by the Constitution. This has further complicated the situation, as internal divisions become evident.

Zanu-PF chairpersons are now divided, unsure whether to support the 2030 agenda or align with Chiwenga. Efforts to reach Zanu-PF national political commissar Munyaradzi Machacha for comment were unsuccessful.

Machacha acknowledged the frictions within Zanu-PF and other political parties but did not provide specific details. Zanu-PF director of information and publicity, Farai Marapira, downplayed the divisions, emphasizing the party’s commitment to unity and dialogue.

Former Zanu-PF national political commissar Mike Bimha previously dismissed the ‘2030, vaMnangagwa vanenge vachipo’ slogan as unrecognized, but recent chants by Mnangagwa’s supporters have fueled speculation about maneuvers to extend his term.

Midlands Provincial Affairs Minister Owen Ncube and Zanu-PF secretary for legal affairs Patrick Chinamasa have openly supported Mnangagwa’s potential term extension. Sacked BBC presenter, Jermaine Jenas has revealed he cannot sleep and is ‘like a zombie’ after admitting to sending ‘inappropriate texts’ to two co-workers.

The England and Tottenham footballer was sacked from his presenting job on The One Show and Match Of The Day after junior staffers raised concerns over his behaviour.

Now, Jenas fears for the future of his marriage with his wife of 13 years, Ellie Penfold, who is said to be angry but has not ended their relationship.

The 41-year-old ex-England, Newcastle United and Tottenham Hotspur midfielder told The Sun: ‘I haven’t slept properly since they told me, to be honest.

‘I mean, the anxiety that builds up in your body over these types of things. I haven’t had any sleeping pills. I’ve just not been sleeping.

‘You just kind of lay there, mind’s ticking over until you just pass out. Part of me would just rather go out and run until I collapse.’

Jenas, who has three children with Ellie and another teenage daughter from an early relationship, revealed his wife has not yet told him whether their marriage can last.

He also told the newspaper: ‘When I see Ellie most days, she just kind of gets up. She goes to make sure the children are OK. I feel ashamed. I feel I’ve let everybody down – friends, family, colleagues.

Jenas previously told his former female colleagues he is ‘genuinely sorry’ for sending inappropriate messages – issuing a direct apology after being allegedly told not to contact the two women due to ‘legal process’.

The presenter previously said he sent ‘inappropriate messages’ but insisted they were ‘between two consenting adults’ and that his behaviour was not illegal.

Jenas, who is married and has four children, also revealed he has a ‘self-destructive streak’ with his relationships and he is receiving therapy.

The father-of-four joined The One Show in 2020 as a stand-in co-host following the departure of Matt Baker and he was made a permanent fixture the following year.

Jenas has been a regular pundit on sports programmes Match Of The Day and Match Of The Day 2 and a presenter on BBC Radio 5 Live.

He has been widely regarded as a natural successor to replace Gary Lineker as host of Match Of The Day but was noticeably absent from Saturday’s first episode of the new season.
