North Korea threatens to use force in response to drills between US and South Korea

0

North Korea has expressed that the current state of affairs between South Korea and the United States is not satisfactory, and they may take action in response.

The North warned the South Korean and U.S a day later troops started their yearly computer-driven practice and different physical training for 11 days. This year’s training sessions were going to include 48 field exercises, which is twice as many as last year.

The North Korean Defense Ministry said in a statement on state media that it strongly disagrees with the U.S’s South Korea is openly showing a military threat to another country and trying to invade it.

A person from the government of North Korea said that their military will keep an eye on their enemies and do important military actions to keep the Korean Peninsula safe.

The person speaking didn’t say what North Korea will do, but people think North Korea will probably do missile tests or other things to make their military stronger.

North Korea sees military exercises by its enemies as practice for invading their country. Both South Korea and the U.S participate in these drills. Officials have said many times that their training is focused on defending themselves. North Korea has responded before to South Korea and the United States. Performing drills by shooting many missiles into the water.

The military leaders in South Korea said last week that this year’s joint military exercises with the United States were planned to stop North Korea’s nuclear threats. The drills will include shooting weapons, bombing, air attacks, and intercepting missiles.

Worries about North Korea’s nuclear program have increased over the last two years. This is because North Korea has been testing missiles more frequently and has openly threatened to use nuclear weapons first. The United States The US and South Korea are doing more military exercises and sending more powerful soldiers. The military is using things like big ships and planes that can carry nuclear bombs as a reaction.

This year, North Korea shot six missiles and practiced firing cannons. Kim Jong Un, the leader of North Korea, said that his country will not try to make peace with South Korea and promised to stop trying to unite peacefully with them. Kim said North Korea will be more aggressive with its military at the disputed sea border with South Korea.

Specialists think that North Korea may believe that having more powerful weapons will give them more power in future talks with the United States. North Korea wants to be recognized as a nuclear state so that they can get relief from the economic sanctions imposed by the U. S

It is expected that North Korea will increase tensions by doing more missile tests and using aggressive language this year, as the United States. and South Korea are getting ready for big elections. Experts believe that North Korea might do something to cause trouble near the border with South Korea.

Seven guys detained in India on suspicion of raping tourists in groups

Seven men have been arrested in India for allegedly raping a woman and attacking her husband. This case has brought attention to the widespread issue of sexual violence against women in the country.

On Saturday, the police said they arrested three men for the incident and are looking for four more.

Dumka’s Deputy Commissioner, Anjaneyulu Dodde, told the media on Tuesday that four more people have been arrested.

The police found a couple who had been traveling on a motorcycle from West Bengal to Nepal. They were found late on Friday by officers on patrol in Dumka district, Jharkhand state.

They went to the hospital, and the woman told the doctor that she had been raped.

The police know who the wanted suspects are and have put together a special team to investigate, according to Kherwar. It is not known if the three people who were arrested have a lawyer to help them.

The arrests happened because a couple who travel and make videos said on their Instagram that they were attacked in India with knives held to their throats. The woman was assaulted and taken to the hospital for DNA testing.

The couple writes in Spanish, and the woman says on her Instagram page that she is from Brazil.

The woman shared on her Instagram story that she has bruises on her face and said that even though her face looks hurt, it’s not the most painful part. “I thought I was going to pass away. ”

In another message on Sunday, the couple said thank you to their followers for their help and said they are okay. They also said the police are trying their best to catch the rest of the people involved.

India’s Women’s Commission expressed disapproval of the reported attack.

The head of NCW, Rekha Sharma, talked to the victim and gave them the help they needed. The organization shared this on social media on Saturday.

“If someone did something wrong, they won’t get away with it,” he said on Saturday.

India has been trying really hard for many years to deal with a lot of violence against women. Some cases of foreign visitors getting raped got a lot of attention from other countries and made the problem known worldwide.

In 2018, a British woman was said to have been raped while walking to her hotel in Goa, a popular place for tourists. Two years before that, an American woman was said to have been drugged and raped by a group of men in her five-star hotel room in New Delhi. In 2013, six men were given life sentences for raping a Swiss tourist together.

According to the National Crime Records Bureau in India, there were 31,516 cases of rape in 2022, which averages out to 86 cases per day.

Experts say there might be many more rape cases than we know about in a country where people feel ashamed and judged for being a victim of rape because it is a very male-dominated society.

Seven detained by Turkiye for selling information to Israel’s espionage service

0

Turkish police arrested seven more people they believe were selling information to the Israeli spy agency Mossad. This is part of a series of arrests in Turkiye for the same reason.

The police arrested the suspects at the same time in Istanbul. The Interior Minister Ali Yerlikaya announced this on the social media site X, which used to be called Twitter. The raids were a team effort with Turkey’s spy agency.

Yerlikaya said that the people who were arrested are believed to have been gathering information about people and businesses in Turkey and then selling it to a spy agency in Israel. “We won’t let anyone spy in our country. ”

It is not known yet if there are any charges, and the authorities did not give any more information.

Last month, seven more people, including private detectives, were arrested for the same suspicions. In the beginning of January, Turkish police arrested 34 people for possibly spying for Israel.

The people who were arrested in January are being accused of planning to do things like watching and attacking foreign people who live in Turkey.

At that time, the Minister of Justice Yilmaz Tunc said that most of the people accused were charged with doing spying for Israel.

The government’s Anadolu Agency reported that on Tuesday, some people were arrested, including a former civil servant who now works as a private detective. It is said that he was trained by Mossad in Belgrade, Serbia. He gathered information about companies and people in the Middle East, and also put tracking devices in the vehicles of people that Israeli intelligence was keeping an eye on, according to Anadolu.

In 2022, Turkey and Israel became friends again after many years of arguments. They did this by sending ambassadors to each other’s countries. However, the relationship quickly got worse after the war between Israel and Hamas. Ankara became one of the most vocal critics of Israel’s military operations in Gaza.

In December, the leader of Israel’s security agency said they were ready to attack the militant Hamas group in Lebanon, Turkey, and Qatar.

The President of Turkey, Recep Tayyip Erdogan, told Israel that there will be bad results if they go through with their plan to attack Hamas members in Turkey.

Ministerial Statement On The Security Of The Nation In Light Of The Alleged Statement By Edgar Chagwa Lungu

MINISTERIAL STATEMENT ON THE SECURITY OF THE NATION IN LIGHT OF THE ALLEGED STATEMENT BY THE FORMER REPUBLICAN PRESIDENT, MR. EDGAR CHAGWA LUNGU, THAT CITIZENS WOULD RISE AGAINST THE PRESIDENT BEFORE 2026.

DELIVERED BY:

HONOURABLE JACK J. MWIIMBU, MP
MINISTER OF HOME AFFAIRS AND INTERNAL SECURITY

MADAM SPEAKER,
LET ME THANK YOU FOR GIVING ME THE OPPORTUNITY TO MAKE A MINISTERIAL STATEMENT ON THE MATTER OF URGENT PUBLIC IMPORTANCE RAISED BY HONOURABLE MICHELO KASAUTA, MEMBER OF PARLIAMENT FOR BWEENGWA CONSTITUENCY. THE MATTER OF URGENT PUBLIC IMPORTANCE IS ON THE SECURITY OF THE NATION IN LIGHT OF THE ALLEGED STATEMENT BY THE FORMER REPUBLICAN PRESIDENT, MR. EDGAR CHAGWA LUNGU, THAT CITIZENS WOULD RISE AGAINST THE PRESIDENT BEFORE 2026.

MADAM SPEAKER,
ZAMBIA IS A DEMOCRATIC SOCIETY. THE NEW DAWN ADMINISTRATION FORMED GOVERNMENT TO AMONG MANY ISSUES FOSTER A BETTER DEMOCRACY AND RESTORE THE RULE OF LAW, ORDER, RESPECT FOR HUMAN RIGHTS INCLUDING LIBERTIES AND FREEDOMS. BY CREATING A GOOD GOVERNANCE ENVIRONMENT, WE HAVE SEEN OUR CITIZENS ENJOY LIBERTIES AND FREEDOMS AS WELL AS MORE ECONOMIC INVESTMENT. THIS SITUATION HAS SECURED FOR US THE COOPERATION OF OUR PEACE-LOVING CITIZENS WHO HAVE TRUST IN THE VISIONARY LEADERSHIP OF OUR PRESIDENT, HIS EXCELLENCY, MR. HAKAINDE HICHILEMA.

MADAM SPEAKER,
THE GOVERNMENT HAS PERFORMED WELL ON THE GOVERNANCE SCALE AND THERE IS NO KNOWN OR LATENT ACTION FROM THE GOVERNMENT TO WARRANTY CITIZENS TO FORCE THE PRESIDENT TO GIVE UP POWER AND CALL FOR ELECTIONS BEFORE 2026. WE ARE SAFE AND SECURE. THE STATE OF THE NATION IS STRONG. WE ARE NOT HOWEVER, GOING TO DISMISS AS EXAGGERATION THE ALLEGED PRONOUNCEMENTS BY MR. EDGAR CHAGWA LUNGU INDICATING THAT PEOPLE WOULD RISE AND FORCE THE PRESIDENT TO GIVE UP POWER. BEING FORMER HEAD OF STATE, PERHAPS THERE COULD BE SOMETHING HE KNOWS WHICH GOVERNMENT IS NOT AWARE OF, COINCIDENTALLY SIMILAR STATEMENTS HAVE BEEN MADE BY SOME SENIOR MEMBERS OF THE CLERGY AND OTHER POLITICAL PARTY LEADERS. AS SUCH SECURITY WINGS SHOULD TAKE INTEREST IN THE MATTER. THERE COULD BE SOME COVERT OPERATIONS BEING UNDERTAKEN. WE ARE NOT GOING TO FOLD OUR ARMS AND LAMENT. THIS IS BECAUSE WE HAVE SEEN SITUATIONS WHERE FEW CARELESS POLITICIANS HAVE CONVINCED A WHOLE NATION THAT IT IS ON THE BRINK OF A CIVIL WAR. WE AS A RESPONSIBLE GOVERNMENT SHALL ENSURE THAT THERE IS LAW AND ORDER IN THE COUNTRY.

MADAM SPEAKER,
IN THE RECENT PAST, GOVERNMENT HAS NOTED WITH GREAT CONCERN MANEUVERS BY THE FORMER PRESIDENT AIMED AT ATTRACTING UNDUE ATTENTION FROM SYMPATHISERS. SEEKING ATTENTION, THE FORMER PRESIDENT HAS RESORTED TO DESPERATE MEANS, UNFORTUNATELY SOME OF THE ACTIVITIES ARE REPULSIVE. IT IS NOT RIGHT TO MOCK CITIZENS BY FAKING BEING AMAZED AT PRICES OF GOODS, FAKING BEING KIND TO THE PEOPLE HIS GOVERNMENT DEFRAUDED AND EVEN MAKING CARELESS PRONOUNCEMENTS THAT HAVE THE POTENTIAL TO ENDANGER PUBLIC SECURITY. THIS IS AN UNFORTUNATE AND CARELESS BEHAVIOR FROM A FORMER HEAD OF STATE.

MADAM SPEAKER,
WE ARE PARTICULARLY CONCERNED WITH THE BEHAVIOR MANIFESTED BY THE FORMER PRESIDENT ON 27TH FEBRUARY, 2024. THIS IS BECAUSE THE RECENT BEHAVIOR IS PART OF HIS HISTORY OF A PECULIARLY VICIOUS FORM OF VIOLENCE THAT CITIZENS WITNESSED DURING HIS SEVEN-YEAR RULE WHICH LED TO A BREAKDOWN OF LAW AND ORDER IN THE COUNTRY. SADLY, THROUGH SUCH BEHAVIOR, COUNTLESS ZAMBIANS SUFFERED HUMAN RIGHTS ABUSE. HE MUST READ THE TIMES. THIS IS NOT TIME TO FAN AND PERPETUATE VIOLENCE. RATHER, IT IS TIME FOR THE NEW DAWN ADMINISTRATION TO HEAL THE DIVISIONS HE CREATED AND RE-BUILD THE ECONOMY THAT HIS REGIME LEFT IN A MESS. TODAY, MANY OPPOSITION PARTY LEADERS IN ZAMBIA TALK AS IF THEY WERE ENEMIES OF GOVERNMENT ENGAGED IN WAR. THIS SHOULD STOP. THEY MUST CONTRIBUTE TO THE REBUILDING OF THE NATION THROUGH POSITIVE CHECKS AND BALANCE.

MADAM SPEAKER,
THE FORMER PRESIDENT’S BEHAVIOR AND THAT OF FORMER GOVERNMENT LEADERS REPRESENT AN EXTRA-ORDINARY PHENOMENON: PURE DESTRUCTIVE AND UNPATRIOTIC. THEY ARE NOT POLITICIANS WITH GENUINE CONCERNS TO GROW THE ECONOMY OR TO IMPROVE LIVELIHOODS. THEY DO NOT WISH TO TAKE REIGNS TO FOSTER DEVELOPMENT. THEY SEEK ONLY TO DESTROY EVEN THE LITTLE THAT THEY LEFT WHICH THE NEW DAWN ADMINISTRATION SEEKS TO MEND. THEY DO NOT AIM TO HELP ANY PARTICULAR SECTION OF THE SOCIETY. THEY DELIGHT IN THE SUFFERING OF OUR CITIZENS. SOME OF THEM EVEN ADVOCATE VIOLENCE TO ADVANCE THEIR SELFISH DESIRES. EVEN IF THEY SEEM TO CHAMPION THE WORD PATRIOTIC, THEY SELDOM PRACTICE PATRIOTISM IN THEIR UNDERTAKINGS. THEY TRY TO DISGUISE WHO THEY REALLY ARE WITH THE VENEER OF SYMPATHETIC POLITICAL VOCABULARY. BUT WE KNOW THEM, THE PEACE-LOVING ZAMBIANS KNOW THEM.

MADAM SPEAKER,
THE NEW DAWN GOVERNMENT SHALL UPHOLD THE SUPREMACY OF RULE OF LAW AND MAINTAIN LAW AND ORDER FOR OUR CITIZENS TO ENJOY LIBERTIES AND FREEDOMS. SIMILARLY, WE SHALL UPHOLD NATIONAL SECURITY WHICH IS ESSENTIAL FOR OUR CITIZEN’S LIVELIHOODS, ACCESS TO GOODS AND SERVICES, AS WELL AS THE FREE EXERCISE OF CIVIL, POLITICAL, SOCIAL AND ECONOMIC RIGHTS. WE SHALL NOT CONDONE ANY ACTIVITIES THAT UNDERMINE NATIONAL SECURITY.

I URGE ALL PEACE-LOVING ZAMBIANS TO REFRAIN FROM ANY ACTS THAT MAY BRING OUR CHERISHED PEACE AND NATIONAL SECURITY INTO JEOPARDY.

MADAM SPEAKER, I THANK YOU

PUBLIC PROTECTOR DISMISSES REPORTS OF TRIBAL CLEANSING IN THE CIVIL SERVICE

The Public Protector, Mrs. Caroline Sokoni wishes to inform the nation that the statement published in some sections of the media alleging that the Office of the Public Protector conducted investigations in the civil service bordering on discrimination on the basis of tribe or purported ethnic cleansing is untrue.

Mrs. Sokoni has clarified that the institution has not received any complaint nor has it initiated any investigation on discrimination on the basis of tribe in the civil service. Therefore, the published statement that the Office of the Public Protector conducted a probe and its investigations revealed that there is ethnic cleansing in the civil service is false and irresponsible and should not be
entertained by any well-meaning citizen. “I would like to assure members of the public and other concerned stakeholders that no report of such a nature exists at the Office of Public Protector and the allegation should be treated with the contempt it deserves,”
Mrs. Sokoni said.

The Ombudsman has revealed that what the institution is currently
investigating is the indefinite placement of some civil servants and public officials on holding at the Public Service Management Division (PSMD). This is in contravention of cabinet circular number two (2) of 2022 titled “Measures to improve programme implementation and service delivery in public service,” which prohibits surrendering of officers by Heads of Ministries and public institutions.

Mrs. Sokoni has since assured members of the Public and other stakeholders that the findings of this investigations will be made public once concluded.

The Public Protector has explained that the Office of the Public Protector has laid down communication procedures from the time it commences an investigation to the point it produces the final report. Members of the public would wish to know that the Public Protector only makes the findings of any investigation public once affected parties have been notified of the final findings.

She has also urged the media to be ethical and verify information with concerned parties before disseminating it to the public as it has the potential to adversely affect the public perception and threaten national security.

EFFECTIVELY, THE US HAS NOT ENDED ZIM SANCTION- Fred M’membe

EFFECTIVELY, THE US HAS NOT ENDED ZIM SANCTIONS

Effectively, the United States has not ended its sanctions against Zimbabwe. The US has announced a new Zimbabwe sanctions regime, keeping measures on Comrade President Emmerson Mnangagwa and his allies. The US is also pulling out of talks for a debt relief deal for Zimbabwe.

What does the new sanctions programme really say? Have sanctions been lifted? Have they gone a step up?

Not quite. The US is simply using a different stick. The US President, Joe Biden, has scrapped the sanctions programme that the US has used to impose measures on Zimbabwe since 2003, called Executive Orders. But he has done so only to make way for a new regime of measures under a different programme, known as the Magnitsky sanctions. Targeted are three companies and 11 individuals.

Among the listed are Comrade President Mnangagwa, Comrade Vice-President Constantino Chiwenga, businessman Kuda Tagwirei, and deputy security chief Walter Tapfumaneyi. The measures include travel bans and asset freezes, the same as under the previous regime of sanctions.

Tagwirei was already designated.

The US is also maintaining the Zimbabwe Democracy and Economic Recovery Act (ZDERA), a separate set of sanctions that it imposed on Zimbabwe 2001, in response to land reform and rights abuses. Repealing this law would require legislation by US lawmakers.

The previous sanctions regime, under Executive Orders, now falls away. This means individuals and companies that were listed are now no longer sanctioned.

According to the US government: “All persons blocked solely pursuant to E.O. 13288, E.O. 13391, or E.O. 13469 (the authorities of the Zimbabwe Sanctions Program) will be removed today from OFAC’s Specially Designated Nationals and Blocked Persons (SDN) List; All property and interests in property blocked solely pursuant to the Zimbabwe Sanctions Program will be unblocked today; and OFAC will remove the Zimbabwe Sanctions Regulations from the Code of Federal Regulations.”

Those off the list include Comrade Vice-President Kembo Mohadi and Emmerson Mnangagwa Jr. Among the key state companies now no longer under sanctions are state mining firm ZMDC, the Minerals Marketing Corporation of Zimbabwe, Zimbabwe Defence Industries and Ziscosteel.

However, if someone was penalised for sanctions under the older orders, and the case is still pending, they still have to face the punishment. While the executive order falls away, and Western companies can transact with formerly sanctioned companies, they are likely to still consider in the risk of dealing with businesses from a country whose leader is under US measures.

A total of three companies and 11 people remain on the sanctions list. Mnangagwa is the only sitting president under the Magnitsy sanctions.

On Mnangagwa, the State Department says: “Mnangagwa provides a protective shield to smugglers to operate in Zimbabwe and has directed Zimbabwean officials to facilitate the sale of gold and diamonds in illicit markets, taking bribes in exchange for his services.”

First Lady Auxillia Mnangagwa is also now sanctioned. The US says: “The First Lady of Zimbabwe, Auxillia Mnangagwa, facilitates her husband’s corrupt activities.”

The US also sanctioned Tagwirei and his wife, Sandra, accusing her of being “instrumental in Tagwirei’s business activities.” Their company, Sakunda, is also sanctioned.

Also listed is Tagwirei’s business associate Obey Chimuka and his companies Fossil Agro and Fossil Contracting, one of the local companies currently working on government infrastructure projects such as the Beitbridge highway.

Remaining under sanctions are government and security officials, including Chiwenga, Defence Minister Oppah Muchinguri, Police Commissioner Godwin Matanga and his deputy Stephen Mutamba, Tapfumaneyi, plus Owen Ncube.

The US has also pulled out of talks, led by the African Development Bank and including the European Union and other creditors, for debt relief for Zimbabwe.

What do they really want to see in Zimbabwe? Regime change! A Zimbabwe without Zanu-PF in power!

“LEAVE KALIMI’S SEAT ALONE” -NAKACINDA

“LEAVE KALIMI’S SEAT ALONE ,” NAKACINDA

..he has full use of his mental faculties..

Smart Eagles/Tue. March 5.

Patriotic Front Secretary General Hon. Raphael Mangani Nakacinda has told the UPND to lay off Malole constituency as its lawmaker Hon. Robert Kalimi is back from hospital in South Africa with a brain that is functioning at full and perfect capacity .

Hon. Robert Kalimi who was involved in horrific accident a couple of months ago and was in South Africa for treatment ,returned home to Zambia a few days ago and is expected to resume his functions as Malole MP , momentarily.

SG Nakacinda has bemoaned the manoeuvres by the UPND who have been making attempts to have the Malole seat nullified and has called the behaviour inhumane and barbaric.

He said the PF was aware of schemes by the UPND Chairperson for elections , who is Local Government Minister , Hon. Gary Nkombo , who had attempted to send doctors to SA to try and certify Hon. Kalimi as unfit to hold the office of MP and thanked the South African doctors for dismissing the assertion as ridiculous and certifying Hon. Kalimi as fit to continue discharging the functions of his office as Malole lawmaker.

Hon. Nakacinda challenged the Speaker of the National Assembly Madam Nelly Muti to do the right thing by Hon. Kalimi citing examples of former speakers such as Amusa Mwanamwambwa who organised for Mr Levy Ngoma, who had been hospitalised for a long time then, to go to parliament on a stretcher to log in during his time as speaker. He also gave an example of Speaker Matibini, who facilitated for Hon. Moses Muteteka to be taken to parliament on a stretcher to log in, enabling him to continue as MP.

Hon. Nakacinda said it is only now , during the UPND regime that a total disregard for humility is being witnessed to the extent that the UPND were scheming to rob Hon. Kalimi of his seat whilst he lay sick in hospital. He bemoaned the lack of Ubuntu which he stated is being eroded in todays political dispensation of the UPND.

Nakacinda emphasised that in this time and era , technology has made it very easy for a person to still work even from their homes as all they need to do is log in their Ipad to the system and they can participate in the parliamentary proceedings demonstrating that there is no need for Hon. Kalimi’s seat to be nullified.

Nakacinda who was accompanied to Hon. Kalimi’s residence by former National Guidance and Religious Affairs Minister Hon. Godfridah Sumaili among other party functionaries, said the PF was grateful to God for the full recovery of Hon. Kalimi and urged Hon. Gary Nkombo and the UPND to stop the schemes around the Malole constituency seat because the MP is back with his brain fully functional.

Meanwhile, Hon. Nakacinda has urged President Hakainde Hichilema to lead the nation with a human face . He said the lamentations by the President to God as to what he had done to encounter challenges during his reign, are self inflicted and that God cannot move in for President Hichilema because HH is allowing his people to wallow in anguish and suffering.” God does not like lukewarm people .the Bible says , if you are neither hot nor cold , I will spit you out of my mouth,” said Nakacinda.

Among the few things PF did right, was leasing out Munyaule market in 2019- Hon. Gary Nkombo

0

STATEMENT BY THE MINISTER OF LOCAL GOVERNMENT AND RURAL DEVELOPMENT, HON. GARY NKOMBO, MP, CLARIFYING ON THE DEMOLITION OF MUNYAULE MARKET IN THE LUSAKA CENTRAL BUSINESS DISTRICT ISSUED ON 5TH MARCH, 2024.

In 2019, the Lusaka City Council resolved to lease out the Munyaule market during a full council meeting held on 28th June 2019, as recorded under Minute Number C/23/06/19.

Following that resolution, a 15-year lease agreement was entered into between the Lusaka City Council and Kaddoura Construction Limited a privately-owned company to construct the Munyaule Market.

The construction works could not immediately take off as there was resistance to vacate the premises by the vendors/traders. Several efforts were made to engage the vendors but to no avail.

The traders were notified of the demolitions through notices to traders instructing them to relocate to other premises that the council had organized for them to operate from as the contractor was ready to commence construction work on the site, but they decided to be defiant.

The latest notice was issued on 17th January 2024 notifying the traders of the need to relocate to designated trading places by 29th February 2024. Unfortunately, despite the Council’s clear instructions, the traders did not vacate the area, which violated the Urban and Regional Planning Act No. 3 of 2015.

In the wake of Cholera and the need to address the sanitary facilities for the traders, the move to relocate the traders from Munyaule market to pave the way for the construction of a modern market aims to enhance the market’s infrastructure and create a more conducive and trading environment for traders and shoppers alike. This measure is meant to prevent outbreaks of various diseases in the future.

This is one of the Projects the colleagues from the PF initiated, which the new dawn Government wants to carry forward given the need to provide safe and clean environment for our traders.

The correct number of affected traders is 920 and not 4000 reported in the press.
To accommodate the affected traders, the council has taken the following steps:

The council has secured space behind BH and New Soweto markets for traders to temporarily conduct business as they await the completion of the modern market at Munyaule.

Some traders have already been accommodated along Lumumba road just before the main Lumumba market and 120 were taken to City Market.

Once the modern market is done at Munyaule, priority will be given to the evicted traders. To normalise this, Kaddoura has already given offer letters to the same traders to avoid confusion when that time comes

ECZ FORCING MILES SAMPA ON VOTERS- Mundubile

ECZ FORCING SAMPA ON VOTERS

…it is no wonder that he is polling as low as 3 votes because Zambians are totally opposed to the illegalities being perpetrated by the UPND in collusion with the ECZ, says Brian Mundubile.

By Daily Nation

THE Electoral Commission of Zambia (ECZ) is now an institution being run by UPND cadres who have clothed themselves with powers they do not have such as imposing expelled and rejected Matero Member of Parliament Miles Sampa on the Patriotic Front (PF) general membership, Brain Mundubile has said.

Mr Mundubile, the Leader of Opposition in Parliament says Zambians have clearly realized that Mr Sampa and his group of renegades is a UPND group masquerading as members of the PF and that was why the former ruling party general membership have decided to protest through the vote.

Mr Mundubile, the Mporokoso PF lawmaker said in an interview yesterday that the zeros Mr Sampa’s candidates were receiving in the ward by-elections was a representation of the lack of support on the part of ECZ for its decision to impose Mr Sampa the former ruling party.

He said all the genuine members of the PF were so upset with Mr Sampa’s association with the UPND and had decided to protest the ECZ imposition through the vote.

“The ECZ as we have always said before is an institution run by UPND cadres who have clothed themselves with powers they do not have. The true members of the PF are so upset with Mr Sampa’s association with the UPND and are protesting through the vote in the by-elections where Mr Sampa’s group has been polling between 0 and 3 votes,” Mr Mundubile said.

Mr Mundubile said it was because of the ECZ cadres masquerading as commissioners that Bowman Lusambo and Joseph Malanji were out of Parliament after the duo was barred from re-contesting their seats by the commission even after the courts of law had declared them eligible.

He said it was the reason Zambia’s democratic credentials on the international community had reached the lowest ebb and that it was unfortunate that the UPND had continued on its trajectory of destroying the country’s cherished beacon of peace and pioneer of multiparty politics.

Mr Mundubile explained that the UPND had introduced electoral conditions such as the president of a political party being the signatory on the adoption certificate for a candidate through which to disfranchise citizens from electing leaders of their choices.

“The UPND in introducing draconian electoral conditions are attempting to create a desperate situation for PF candidates aspiring to contest by-elections so that they could accept Mr Sampa as president of the PF to have their adoption certificates signed.

“But the PF members are now reacting against the ECZ imposition of Mr Sampa and that is why he (Sampa) is polling between 0 and 3 votes. The sooner the UPND realizes that the Sampa project has failed and collapsed the better. Let them concentrate on what would be of benefit Zambians who are faced with humongous economic challenges,” Mr Mundubile said.

“We the genuine members, both in Parliament and outside are now enjoying how the UPND is failing to govern because of their failure to listen to the opposition advice. On Mr Sampa, the best they can do is abandon the project and work for the people. But we can clearly see that we have no direction as a country but as the opposition, we have resolved that Zambia needs help and we shall step up,” he said.

CHINESE WANTED IN COURT AFTER HIS 10 KÎLLED A 13 YEAR OLD GIRL

THE Chinese businessman whose 10 dogs mauled a 13-year-old to death some four months ago is wanted at court so that he can answer to a manslaughter charged at the Lusaka High Court.
C THE Chinese businessman whose 10 dogs mauled a 13-year-old to death some four months ago is wanted at court so that he can answer to a manslaughter charged at the Lusaka High Court.

But when the case was called yesterday before Lusaka High Court Judge Egispo Mwansa, the accused, Kingo farms director Shi Yaming, of New Kasama, was nowhere to be seen in court.

A State advocate informed the court that Shi, who is on bail, was not present before court.
“Information gathered from the arresting officer is that is that he [the accused] was given bail from the lower court and details of the sureties are on the record of the lower court,” the prosecutor said and added that the defence team from Legal Aid Board could get details of the sureties from the lower court’s records in order to trace the accused.

But defence lawyer Temwa Mwansa from the Legal Aid Board argued that that it was the State’s duty to ensure that the accused is before court especially that the defence team has not met the client.

Judge Mwansa then guided that it is the duty of the State to ensure that all accused persons appear before court when needed.

“It is the duty of the State to present all accused persons regardless of where they are to the court especially in our circumstances where [defence] counsel says she has not met her client. We adjourn this matter to allow you time to find out where the accused is,” Judge Mwansa said.
The matter will resume on Thursday this week.

Allegations are that on November 8 last year, 13-year-old Sharon Banda was mauled to death by a pack of 10 dogs around 05:00 hours at Kingo farm.

The victim was reported to have gone to the toilet which is outside her house and while there, about 10 dogs charged and attacked her leaving her dead with deep cuts.

12 REASONS WHY UPND WILL BE DEREGISTERED IN 2026 AFTER HH LEAVES STATE HOUSE- Dr. Chris Zumani

0

12 REASONS WHY UPND WILL BE DEREGISTERED IN 2026 AFTER HH LEAVES STATE HOUSE

By Dr. Chris Zumani Zimba

In his book, “The Republic”, Ancient Greek philosopher, Plato warned that democracy is a dangerous system as it risks bringing dictators, tyrants and demagogues (people without proper skills, cultural values, morals or human grace) into power. This is where Zambia’s democracy is today under Hakainde Hichilema (HH) and the UPND.

In this summary discourse, we have identified 12 major reasons why we believe that our people voted into power true tyrants, demagogues and dictators to themselves in August 2021 and why UPND risks being outlawed and deregistered once HH is voted out of power either in 2026 or 2031:

1. UPND is a ethnic and regional party by history, operation, leadership and style of governance, key cabinet/state house and top government appointments: HH runs a political party of tribal demagogues

Since HH’s leadership in 2006, UPND has been a tribal and regional political party following the death of Anderson Mazoka and the birth of ‘Chuindu Chaitwa’ Movement of ‘only a Tonga can succeed a Tonga’. All these years today, UPND has remained a political outfit of tribal and regional demagogues which is against PART II under Article 8 of the Zambian Constitution on our “national values and principles”. This is unlawful political practice and system: it will be seriously visited once they lose power.

2. UPND won Power in 2021 using unlawful tactics of sponsoring ethnic divisions, tribal hostilities and violent regionalism against a legitimate government-the PF

There is no doubt or debate on this matter as everything was confirmed by Cornelius Mweetwa, Chief Government Spokesman and UPND Chairman for Publicity and Information. The video evidence is available everywhere plus the court conviction of Dr. Chishimba Kambwili. This is against article 8 on “National Values”; article 54 on “Electoral Code of Conduct”; article 60 on “political parties”, article 165 on “institution of chieftaincy and traditional institutions”, and Part I . 2, 3 and 4 of the Republican Constitution. Once they fall out of grace from voters, UPND will be held accountable and deregistration is assured ahead.

3. UPND is unlawfully working to totally kill multiparty democracy and impose a one party dictatorship system in Zambia

The evidence of this crime is visible in all the three wings of government. The fact that Miles Sampa and his team of few ‘PF’ gladiators are now supported by the executive, parliament and judiciary to sustain a brutal unlawful act and immoral conduct against the PF constitution, our multiparty democracy system and good governance values we hold dear is testimony of HH and UPND’s political brutality to impose a one party dictatorship in Zambia.

Look at Electoral Commission of Zambia (ECZ), it is signature of outlawed political tribalism at its best and a clear desire to forcefully introduce dictatorship. Yes, Dr Sishuwa Sishuwa, Retired Archbishop T. Mpundu, Dr. Fred M’membe, Bowman Lusambo, Joseph Malanji, Chama America, Chilufya Tayali, Edith Nawakwi, Sean Tembo and many others will be happy state witnesses against UPND in this mater after HH leaves power.

4. UPND is urinating on the RULE OF LAW by paralyzing and weaponizing the judiciary, police, ECZ and enforcement agencies

In a country that is renowned and respected for being a model of diplomacy, democracy and good governance in the regional, UPND has done the uncalled for to everything we pride for as a Zambia. Today, Zambians who oppose HH and UPND are now official enemies of the state. Innocent civil servants deemed PF sympathizers or those from outside the Zambezi regions have systematically been either demonized, demoted or red carded. In less than three years, HH has arrested more political critics than Mwanawasa, Sata and Lungu combined. UPND has weaponized all state institutions against anyone and everyone deemed their political threat. But once HH leaves office, the walls of safety will fall down against UPND as a party.

5. The UPND government will be held responsible for 2024 hunger as they sold maize reserves: its a wicked war crime of imposing starvation on citizens the state is mandated to protect

The president declared drought as national disaster last week. It’s laughable because Zambia had enough maize to feed the nation for two years ahead. HH and his government selfishly sold 1.5 metric tons FRA maize reserves to DR Congo in 2022 against stakeholders advice. According to the Rome Statute of the International Criminal Court, this is like war crime of starvation of civilians as a method of warfare as seen in Yemen, Ethiopia, Syria, South Sudan, Nigeria and elsewhere.

This is a crime against humanity, imposing hunger on over 20 million people. Many Zambians will starve to death as a result of HH’s reckless business decision to export maize reserves he merely inherited from PF and Lungu. When UPND leaves office in 2026 which is very likely, many citizens will surely demand the new government to access the scope of death and misery for this decision. And everyone involved will certainly face heavy state Justice and punishment: there is no way UPND will escape this crime.

6. HH’s Presidency was won on the sacrificial bloodshed and murder of Jackson Nkungo, PF North Western Chairman

I talk about Jackson Kungo over and over because l attended his burial with President Lungu in Solwezi and saw how his children, wife, family and friends grieved over his brutal murder. Look, HH won the presidency on the sacrificial blood and death of Jackson Kungo who was openly stoned, tortured and murdered by UPND cadres at a polling station in Solwezi on 12th August, 2021. The bloodshed and murder of Kungo is fixed in the eyes and ears of HH and his entire UPND top leadership. They know it!

But HH always pretends as if he knows nothing of how his UPND cadres massacre Jackson Kungo, PF North Western Provincial Chairman then. Today, HH and their UPND leaders mislead Zambians like they don’t smell human blood and political deaths. Even the death of Mufulira 15 youth, Chrispine Bunda who was recently murdered by HH’s ZNS officers is merely muted like it’s a lizard that was killed. Once they leave power, UPND will now face the law in full scale and deregistration will be their noble place.

7. HH has unilaterally auctioned our mineral resources to foreigners by giving tax breaks to big mines while milking every coin from poor Zambians

Yes, the UPND government has betrayed Zambians by giving of Unsolicited Tax Holidays to foreign mining companies while imposing multiple taxes on poor citizens. Zambia is losing out billions of dollars annually because the UPND Government in 2021 gave away this money in tax concessions to mining companies. Many experts believe that there was grand corruption in the UPND Government for this treacherous decision against Zambians. The decision by the UPND Government in 2022 to relinquish Zambia’s 20% stake in First Quantum Minerals (FQM) in exchange for a small sum in royalties per year is nothing other than criminality and betrayal. Once they leave office, hell fire will fall on the UPND.

8. The UPND government runs a kleptocracy-rule by theft with corruption, looting and plundering of public resources made ‘normal’

The Auditor General’s Report as well as Financial Intelligence Centre Publications for 2022 and 2023 are first and second evidence of these vices under the UPND regime. The famous 2023 KK Airport gold scandal fully confirmed how deep rooted kleptocratic HH’s government is. How Egyptian businessmen were conned to freely land with guns and more than U$7.5 million dollars on a personalized jet and latter duped, ‘released’ and only U$5 million declared by state agents to the public. At its best, this act was the flagship of kleptocracy under the UPND. While such examples are multiple, the full truth will only be revealed once the UPND leave power and concerned citizens hold them to account.

9. UPND has made Zambia so regionally divided and ethnically hostile against each other by its tribal policies and inconsistent politics

By conduct, UPND is a tribal government and HH its tribal leader. By ethnic presidential appointments and governance style, Zambia is today more ethnically divided and hostile. By betraying the Litunga, the Kuta and the Lozi people on Barotseland, regional politics is now more ripe and dangerous than ever before. Between 2006 and 2022, HH proclaimed Barotseland as a real ancient Kingdom of the Lozi people in Zambia. In 2022, he is on video confirming Barotseland. Today 2024, he openly denounced any existence of a place called Barotseland in Zambia. This has worsened regional tensions and ethnic politics worse now than ever before. After they leave power, the Lozi people will surely petition UPND and HH over these matters. So are many Zambians.

10. UPND won power in 2021 based on pure lies, false promises, historic cheating and corrupt manipulation of citizens

The false campaign promises and naked political lies HH and UPND vomited on Zambians before August 2021 can feel the Red Sea and River Nile. We are talking about reducing mealie meal, fertilizer, fuel, electricity, water bills, sugar, salt, cooking oil, meat, eggs, etc to creating thousands of jobs, bringing billions of dollars into Zambia, eradicating tribalism, regionalism, nepotism, and more and more lies. Both HH and UPND stand only safer before 2026 when Zambia votes and people decide. After that, HH and UPND will be petitioned by thousands of angry citizens and the answer may be just to outlaw the party. Before 2021, HH and UPND made Zambians both fools and idiots politically.

11. HH and UPND are using public resources to run tribal, defamatory and divisive media platforms-Koswe and Zambian Watchdog

We all know from 2021 to 2023 empirical publications from “Zambia Whistleblowers” that “Koswe” and “Zambian Watchdog” are UPND inspired and now government sponsored social media platforms being sponsored by State House. Their top bloggers are on state house payrolls and are using state house equipments. Given the regional hostility, tribal politics, defamation contents and malicious propaganda these two platforms publish each day against hundreds of innocent people, trust me, in 2026, there is no doubt that we will see many Zambians taking this matter from the lowest to the highest court in the land against HH and UPND.

12. HH and the UPND government are using tax payers money to hire and pay homosexual promoters as State House Presidential external advisers

HH appointed and pays millions of dollars to gay and lesbian renowned promoters as his personal foreign advisors at State House. Against our Christian Nation identity and values, HH has made Tony Blair and his firm, globally renowned for promoting liberalism, gay and lesbian rights as his closest and full time foreign advisors. While his SDA church is so softly mute about this unlawful contract, time is coming when Zambians will demand answers from HH. At that time, UPND will also be directly affected because of their empirical policy linkages to liberal groups at regional and global level where Tony Blair is equally connected politically in promoting liberal values.

Mnangagwa engages Hichilema

President Emmerson Mnangagwa is talking to his Zambian counterpart Hakainde Hichilema about the ongoing El Niño-induced drought after Zambia declared a National State of Disaster and Emergency last week, NewsDay can report.

Briefly speaking to the Press during the seven-day 56th session of the United Nations Economic Commission for Africa Conference of African Ministers of Finance, Planning and Economic Development in Victoria Falls on Monday, Mnangagwa said there were behind-the-scene talks between him and Hichilema over the two countries’ food security situation.

Responding to NewsDay’s enquiry whether the Zimbabwean leader would follow Zambia in declaring a National State of Disaster and Emergency given its worsening effects on local energy and food security, Mnangagwa said: “Fortunately, my dear brother, my younger brother, HH (Zambian President Hakainde Hichilema) discussed with me this morning and it’s not prudent to divulge what two heads of State are discussing about that issue until certain things have happened, then you will know. But we have been discussing this morning, on the same issue you are asking about.”

Responding to other journalists, Mnangagwa said the time had now come to implement measures in agriculture to mitigate against such weather events like El Niño.

“This morning, I have been discussing with one or two heads of State. We felt that we need to promote irrigation coverage so that whether there is drought or no drought at least we have enough irrigation hectarage to give food security,” he said.

Southern Africa has been battling worsening climatic conditions given this 2023/24 agricultural season which is characterised by the El Niño phenomenon that has caused erratic rainfall.

Mnangagwa, who officiated during the opening of the conference on Monday, as Zimbabwe took over the chairmanship of the event from Uganda, called for a new economic model during his speech.

“For us in southern Africa, the ongoing El Niño phenomenon is currently affecting weather patterns in some parts of the region, with our agriculture and energy sectors negatively affected. These realities necessitate structural shifts towards resource-efficient, non-polluting, equitable models of economic growth,” he said.

Barotse National Freedom Alliance trustee William Harrington writes to Solicitor General over his landmark submission at the International Court of justice

SOLICITOR GENERAL
P.O. BOX 50106, LUSAKA

CONGRATULATORY MESSAGE

ON YOUR RECENT LANDMARK SUBMISSION TO THE INTERNATIONAL COURT OF JUSTICE (IC)

It is my honour and pleasure to convey to you this congratulatory message on behalf of the
Barotse National Freedom Alliance, the peace-loving people of Barotseland and indeed on my
own behalf for your landmark submission on behalf of the Zambian Government at the recent
International Court of Justice (ICJ) hearing on the Israeli — Palestinian conflict.

lam conveying this message as a Trustee of the Barotse National Freedom Alliance (BNFA) and
as a concerned citizen, please therefore note my interest. BNFA is an organisation assigned to,
amongst other things, implement resolutions of the Barotse National Council (BNC) of 2012 ina
DIPLOMATIC, LEGAL, PEACEFUL AND NON-VIOLENT manner, please therefore note my
interest.

As you may be aware, the BNC was sanctioned and its resolutions endorsed by The Litunga,
King of Barotseland and the Barotse Royal Establishment (BRE).

Having closely monitored the IC) proceedings and in particular you eloquently presented
submission with great interest, allow me to quote your closing remarks that are of particular
interest to us, and | quote:-

“As we conclude, we wish to submit that the Court is neither the only dispute mechanism
available nor is the best in all circumstances. The best dispute resolution mechanism is the
one that delivers optimal and suitable solutions depending on the particular circumstances of
each case and there is certainly no one size fit all”

Mr. President, those of us who have practiced law for many years know how in determining a
Winner and a Loser, the Court’s decisions have in almost all cases left permanently ruined
relationships between neighbours on a difference that could have been resolved in a better
way by adopting alternative dispute resolution mechanism such as a negotiated settlement,
conciliation or mediation.

In conclusion therefore, The Republic of Zambia reiterates the call for relentless efforts aimed
at achieving peace in the Middle East based on the principle of a two states solution. Both
Israel and Palestine have a duty to respect International Human Rights Law and International
Humanitarian Law. Therefore any recourse to the conflicts should not be one that puts blame
squarely on one party but rather one that advances a negotiated solution ……” End quote.

You have further stated that, quote:- “ZAMBIA RECOGNISES THE INALIENABLE RIGHT OF THE
PALESTINIAN PEOPLE TO SELF-DETERMINATION”. End quote (Zambia Daily Mail —- Wednesday
February 28, 2024) Solicitor General, we cannot agree with you any more on that score as this
declaration is enshrined in International and Human Rights Law and must surely apply to
Barotseland, the abrogation of the Barotseland Agreement of 1964 (BA64) notwithstanding.

Our commendations to you therefore, are based on the fact that the foregoing statements
speak to a civilised manner of dealing with matters especially of dispute nature as opposed to
high-handed, strong arm and oppressive tactics against unarmed and defenceless people. The
International Instruments and doctrines you ably quoted in your presentation, in particular the
principle of sanctity of treaties Pacta Sunt Servanda which are now as forming jus cojens and
obligations erga omnes, no doubt point to the need for PEACEFUL SET TLEMENT OF DISPUTES.
The Barotseland dispute arising from the unilateral abrogation/repudiation of the Barotseland
Agreement 1964 (BA64) stands out as such a dispute in the case of Zambia.

It is against this background that the BNFA appeals to you, as Solicitor General of Zambia with
Constitutional powers and mandate to provide legal advice to the Executive arm of
Government to impress upon it to attend to the Barotseland impasse in the same spirit as your
unequivocally belaboured position during your presentation to the IC). We believe you have the
rare opportunity to redeem your veracity and professional acumen and judiciously render
considered and appropriate legal advice to the Government of Zambia.

Once again we commend and thank you for your presentation to the ICJ of which we take
serious note. It is our considered view that this should be the starting point towards reaching
an amicable settlement to all the parties in respect of the unilaterally abrogated Barotseland
Agreement of 1964 by the then Zambian Government in 1964. The issue of Barotseland cannot
be simply wished away as historical experience shown. We fervently believe that the time is

now ripe more than ever before for an amicable solution. We should not behave like the
proverbial ostrich that “buries its head in the sand” as if to hide from a looming danger.

In this regard, we will continue to insist that President Hakainde Hichilema seriously
and urgently considers appending his signature to the PERMANENT COURT OF
ARBITRATION SUBMISSION document that was presented time soon after he
assumed office. The said document was presented to His Excellency in the firm belief
that he remains committed to his 2021 pre-election assurance for an AMICABLE
SOLUTION to the Barotseland impasse. We are concerned and saddened that so far
there is only a deafening silence from His Excellency.

The Unholy Alliance Between Speaker Nelly Mutti And Embattled Matero MP, Miles Sampa On The Spotlight- UKA Alliance

THE UNHOLY ALLIANCE BETWEEN SPEAKER NELLY MUTTI AND EMBATTLED MATERO MP, MILES SAMPA ON THE SPOTLIGHT

SPEAKER NELLIE MUTTI’S CONSTITUTIONAL BREACHES MUST END……BEFORE SHE PLUNGES OUR COUNTRY INTO CHAOS….

March 4, 2024

As the United Kwacha Alliance (UKA), we have noticed National Assembly Speaker, Nellie Mutti´s continued wanton breach of the constitution.

If Ms Mutti´s wanton desecration of not only the constitution but what is left of the integrity in the Zambia National Assembly is not stopped, we will have nothing but only a shell of our democracy left in our nation. She is a threat to the very core legislative justice and discourse.

We refer to the matter of her decision to ‘endorse’ one Mr. Miles Sampa as the sole candidate for Zambia to the Presidency of the Pan African Parliament (PAP), a decision that has raised dust not only in Zambia but the entire continent. This is due to the legal encumbrances that surround Mr Sampa’s existence in the Zambian parliament.

In October last year, Mr. Sampa, the Matero Constituency Member of Parliament, was first suspended and then later expelled for a myriad of offences that are not just on the table of his former ruling party the Patriotic Front (PF), but also in the courts of law in Zambia as well as the very Parliament that Ms. Mutti presides over.

Respected Constitutional Lawyer SC John Sangwa observed that the issue of Mr. Sampa, “cannot be adjudicated upon by any other body until the courts act.” He was further quoted in a recorded live interview on Radio Phoenix as having said “the Speaker has ´gone rogue´ because you cannot have a matter before the courts of law adjudicated upon by anyone else.” In simple language Ms. Mutti should not be granting the favours she is giving Sampa unless she is perhaps compromised, or it is the courts that are on TRIAL.

An URGENT injunction was taken out by the aggrieved party, the PF which Mr. Sampa believes he now heads with the blessings of Ms Mutti. The injunction has not been heard in more than five months, defeating the very purpose of the ´injunction´.

It is therefore with utter dismay that we have noted Ms. Mutti´s decision to not only endorse Mr. Sampa, an embattled member of parliament but to also write a letter to the Pan African Parliament (PAP) recommending that he becomes the President of PAP from our Parliament and where he was expelled by his party.

Ms. Mutti has ignored court processes challenging her decision to recognise renegade Sampa as President of PF and now she is, in our view as UKA, committing a further breach of the constitution by endorsing him to the highest seat in PAP.

Speaker Mutti’s actions are extremely reckless and can only be interpreted as a bidding to please President HH and the UPND at the expense of Zambia’s international image.

Are we, as a nation, incapable of finding someone more suited to the role of PAP President than Mr. Sampa?

Why is Ms Mutti blatantly breaching the constitution?

Why is Ms Mutti risking her entire career for Mr Miles? What is the score?

PeP STATEMENT ON LACK OF DELIVERY OF RELIEF FOOD BY DMMU- SEAN TEMBO

PeP STATEMENT ON LACK OF DELIVERY OF RELIEF FOOD BY DMMU

Liberty House-Lusaka, 5th March 2024

1. As Patriots for Economic Progress (PeP) we are concerned that the Disaster Management and Mitigation Unit (DMMU) under the Office of the Vice President, has not yet commenced distribution of relief food across the country, in view of the ongoing devastating drought. It should be noted that under normal rainfall conditions, people would have started harvesting food from their fields by this time of the year. The fact that there is no food in their fields due to the drought, means that people have already started starving by now.

2. As Patriots for Economic Progress (PeP), we are fully aware of the fact that Government has a tendency to sleep on the job regarding emergencies, and only act at the last minute when lives have already been lost. This is what happened during the cholera epidemic where Government was asleep when the epidemic was first detected in October 2023 and only started to act in January 2024 when the epidemic had reached its peak and hundreds of innocent lives had been lost.

3. As Patriots for Economic Progress, we wish to warn Government not to sleep on the job this time around. The blood of any Zambian lives that will be lost due to hunger, will be on the hands of President Hakainde Hichilema who sold our maize reserves to DRC without any regard for the food security of the Zambian people.

4. We want to see activity on the part of DMMU in terms of distributing relief food in the next few days. The Zambian people deserve to be protected from the ravages of hunger by their Government. President Hakainde Hichilema needs to be reminded that this is not the time for long speeches and rhetoric. It is time for action in terms of actual delivery of relief food to all affected citizens.

May God Bless the People of Zambia and Our Ailing Nation.

0

Hichilema must declare one full month of national mourning for the Senseli Mine and more than 700 cholera-dead, compensate their families and not hide behind the drought

By Azwell Banda,

It is obvious one of the reasons why Hakainde Hichilema is constantly in the air and abroad at great expense to Zambia’s poor tax payers is because he actually hates all the moments he is in Zambia.

In Zambia he sees hunger, dirty and poverty everywhere, he feels the cries of the majority of Zambians complaining about the incredible lies and false promises he made to win elections, he has an opposition that correctly gives him sleepless nights and he is fully aware that the real mass pain and suffering from the economic Tsunami his government has unleashed on Zambia has not even started yet!

And so, off he went, very happily, to Namibia to rest from Zambia under the good pretext of attending the burial of late Namibian president Hage Geingob. To make all Zambians complicit in his unearned but well desired absence from Zambia, he actually declared a two-day mourning period for late Namibian president Hage Geingob, over the burial period. President Hage Geingob was decently buried last Sunday in Namibia at Heroes Acre. The burial was attended by 25 heads of state and several former presidents, besides the millions of Namibians who mourned their dear departed president.

But, of the 25 heads of state who attended the burial of Hage Geingob last Sunday, one president should have correctly apologised and been absent at the burial because he should have been in mourning: President Hakainde Hichilema of the Cholera Republic of Zambia. Never in the history of Zambia have more than 700 poor Zambians died from a cholera episode. Never in the history of Zambia has an unknown number of so many miners died and been buried beneath where they died, as did the miners at Senseli Mine. Never in the history of Zambia have we had more than 2,000,000 poor Zambians suffering acute hunger as before a drought started compounding the problem of acute national hunger.

Never, ever, in the history of Zambia have we had, all at the same time, a massive cholera outbreak, an anthrax outbreak, fall army worms and several other outbreaks of endemic diseases; now to be compounded by the hot and dry weather a large part of the country is experiencing. Never in the period after Zambia banned GMO maize in Zambia have we been a dubious transit point to the DRC of such huge quantities of GMO maize and mealie meal some of which is now being consumed in Zambia. Never in the history of Zambia have we had a government self-inflicted critical shortage of maize and absurd high prices of mealie meal as we are experiencing now, under Hichilema’s government.

What kind of president of an extremely poor and heavily indebted country would leave his country in mourning for more than 700 and still counting poor people dead, in extremely humiliating circumstances from cholera, to go and attend the burial of a president in a neighbouring country, no matter how good the relationships between such a president and the citizens and country of such a president in mourning of its cholera dead? What is the value and meaning of the lives of the more than 700 dead Zambians to Hakainde Hichilema and his UPND government?

Now we understand why the extremely poor Zambians who were and are still dying from cholera were attacked and actually accused by the UPND government, for bringing the fate of possible and actual death from cholera upon themselves. We heard that the majority of the dead from cholera actually did not die at health facilities; they died where they struggled to prevent death and to survive. The UPND government told us that shallow wells, unplanned slum settlements, drinking alcohol including kachasu, migrating to Lusaka or any town from a village without a plan, and incredibly, not knowing how to use toilets and similar bad behaviour among Zambia’s poor people especially in Lusaka the epicentre of the cholera epidemic, were the causes of the cholera outbreak and the massive deaths. Young people, especially poor young people, were blamed for behaving in ways that exposed them to the cholera epidemic.

There was not a single acknowledgement of responsibility of any kind or failure by the UPND government, now two and a half years in government, for the disastrous and deadly cholera epidemic that has killed more than 700, and is still killing them; poor and working class Zambians the majority of them in Lusaka. In opposition, the UPND government promised to attend to the critical shortage of decent housing for the majority of Zambians. Two and a half years in government there is no nationwide emergence housing construction programme for our urban poor, who are the majority in all our urban areas.

In opposition and in their manifesto, the UPND government promised to attend to the urgent matters of absence of sanitation, safe and clean water and properly staffed and well supplied government health facilities across the country. In government, well, the size of the cholera epidemic and the massive number of poor and working class Zambians killed is the best testimony that none of these things have happened well enough to prevent a massive and deadly cholera epidemic.

Incredibly, Hakainde Hichilema celebrated being made an international champion of the fight against cholera: Zambia has perennial outbreaks of cholera and yet Hichilema’s government had no cholera vaccines and ready government wide cholera prevention and fighting emergency plans as the cholera epidemic exploded in December/January 2024, an epidemic which started in October 2023. Why?

As thousands of extremely poor and working class Zambians, who are the majority of Zambians, especially in Lusaka, were fighting cholera in their bodies, Hakainde Hichilema and several of his minsters went on holidays for Christmas and New Year celebrations, in December and January, completely unconcerned about the exploding cholera epidemic. Why? To be fair, Prima Dona Minister of Health Sylvia Masebo was available, became busy, risked her life, and ran around as she usually does, like a headless chicken doing what she could to help, with her mortar mouth constantly running. It was she who went around closing drinking places in working class communities and blaming criminal and bad behaviour by the poor and the working class, for the cholera epidemic.

A “National Day of Prayer” for cholera was announced but cancelled; apparently one of the reasons for cancelling the event was that the government rules did not permit large gatherings. And yet the funeral of Lieutenant General Ronnie Shikapwasha was an official state funeral and attended by a multitude of people, at Mulungushi International Conference Centre, on January 21, 2024, as the cholera epidemic raged on. Apparently, the government rule for large gathering was waived, for the official state funeral of a member of our elite class to take place.

There has been no official state memorial for the unknown large number of Senseli Mine disaster victims, because they were extremely poor working class Zambians. Since they were “illegal miners” working in a clearly unsafe mine, they brought the deaths upon themselves. They are dead and buried where they got trapped, that’s it, that’s all they deserve.

The families of the dead Senseli miners cannot claim compensation from anyone, not even government, since they were “illegal miners”. And yet in opposition, Hichilema and the UPND promised to regularise artisanal and small mining employment by among other things, licensing this kind of economic activity, making finances available, and making technical and other resources available including those for safe mining. Two and a half years in government Hichilema can only continue to promise and lie that his government is working on these things.

The working class families and communities from where the dead Senseli miners lived are still grieving, still suffering trauma, and many do not know whether their still missing ones are among the dead: some believe one day their missing loved one will suddenly appear, and account for their absence.

Our cholera dead and the miners who died at Senseli Mine were not animals; they were full human beings like any other human being, rich or poor. Our inability to demand full government accountability for their deaths, our failure to fully and properly mourn and memorialise their deaths, dehumanises us, all those of us who are alive, rich or poor. It is a soulless and a country full of the “living dead” which can so easily “walk away” and forget so many of its people dead and yet pretend it has feelings for the well to do, when they die.

It is a soulless, inhuman and utterly cold and selfish politician who will cheat their way into government by lying and making false promises to the working class and the poor who are the majority of voters, and ignore them contemptuously when they are dead. To our rulers in the UPND and their social class mates in the opposition, the poor working class who died at Senseli Mine and from cholera are less human than them, and their dead social class mates.

The UPND government must be forced to erect fitting memorial statues, hold proper official national mass memorials and commemorative funerals for the poor working-class dead at Senseli Mine, and those from the cholera epidemic, both disasters which as they are in government they must account for.

The UPND government must not be allowed to hide behind the drought: the economic and social Tsunamis their IMF and World Bank backed neoliberal economic and social policies had already plunged millions of Zambians into desperate poverty and excruciating hunger, long before the drought. Hichilema and his friends in government must be forced to account for the suffering they have unleashed and intensified among the majority of Zambians. We devalue, denigrate and insult the very essence of being human, and not animals, if we fail to demand these basics of decent human behaviour, from the UPND government.

US reluctant to finance Angola-Zambia extension of Lobito Corridor

US reluctant to finance Angola-Zambia extension of Lobito Corridor

The US International Development Finance Corporation has doubts about the relevance of extending the Lobito Corridor, which links Luacano in central-eastern Angola to Solwezi in northern Zambia, and may not finance the work.

The International Development Finance Corporation (DFC), a US state agency, announced in December it will finance work on the Angolan section of the Lobito Corridor, a multi-branch cross-border rail line that will transport Congolese and Zambian copper to the Atlantic coast.

The financing will be earmarked for the rehabilitation of the 1,300 km of railway linking the town of Lobito to the Democratic Republic of Congo (DRC) by the Lobito Atlantic Railway (LAR) consortium, which is made up of Portugal’s Mota-Engil, Switzerland’s Trafigura and Belgium’s Vecturis (AI, 15/12/23) and is chaired by Portugal’s Francisco Franca. Africa Intelligence understands the transaction should be finalised by June. But another part of the project may not see the light of day: the construction of a new railway line to create the Zambian section of the corridor and connect it to the existing Angolan one.

Production on the up

The DFC, which is headed by Scott Nathan, has been studying the commercial interest of the Angola-Zambia segment since last July, but is not convinced of its relevance. It would require the construction of an entirely new railway line in both countries, which would be much more expensive than rehabilitating the existing Angolan and Congolese lines.

This view is shared by the LAR consortium, which has been awarded a 30-year concession to rehabilitate and operate the Angolan railway as far as the DRC border. This is the case even though a Zambian extension would mean LAR extending its Angolan concession by ten years, in accordance with the agreement it has signed with Luanda.

The Congolese branch of the Lobito Corridor is once again operating between the Angolan border town of Luacano and Kolwezi in the DRC (AI, 22/01/24) and will later extend as far as Lubumbashi after the rehabilitation of the existing railway. Alongside this is the Zambian section of the railway, a brand-new line, which seems much less crucial to the US.

The DRC produced around 2.3m tonnes of copper in 2023 – compared with Zambia’s around 800,000 tonnes – thanks in particular to sites where production is rising sharply.

These include the Kamoa-Kakula complex, near Kolwezi, operated by the Canadian company Ivanhoe Mines headed by Robert Friedland, which is already producing 400,000 tonnes a year. Ivanhoe is the first mining company to transport its copper from Kolwezi to Lobito thanks to an agreement with the LAR consortium.

Zambia’s current leading copper producer, Canada’s First Quantum, which is based at the Kanshanshi mine near Solwezi, produced just 135,000 tonnes last year, although it is aiming for 250,000 tonnes a year. Vedanta, a mining conglomerate owned by Indian-British binational Anil Agarwal which has just finalised its return to Konkola Copper Mines (AI, 31/01/24), operates at a copper site located in Chingola in northeast Zambia, a long way from the Angolan border.

Vague about where money will go

But the DFC does not want its decision not to fund the Zambian branch at Lobito to be seen as a U-turn by its Zambian and European partners. The $1.6bn memorandum of understanding, announced with great fanfare on 26 October in Brussels at the Global Gateway Forum, was vague about the distribution of the money, and concerned all the branches of the Lobito Corridor.

It was presented as joint financial support coordinated by Amos Hochstein, President Joe Biden’s energy adviser, European Commissioner for International Partnerships Jutta Urpilainen, and the African Development Bank (AfDB).

These donors signed a memorandum of understanding with DRC Prime Minister Jean-Michel Sama Lukonde Kyenge, Angolan Coordination Minister José de Lima Massano and Zambian Finance Minister Situmbeko Musokotwane. The United States and the European Union used the occasion to encourage Lusaka to launch feasibility studies on this new segment.

Copper Production Drops to 682000 tonnes in 2023 from 837 996 tonnes in 2020

UPND Policies Killing Mining Sector as EFF Calls For Reforms

In light of the alarming decline in Zambia’s Copper Production since the United Party for National Development (UPND) assumed power in 2021, the Economic Freedom Fighters-EFF urgently calls for comprehensive reforms in the mining sector. The precipitous drop from 837,996 tonnes in 2020 to a mere 682,000 tonnes in 2023 as was disclosed by the Mr. Chipoka Mulenga the Commerce Minister is a stark indicator of the failure of UPND’s policies.

The lack of transparency and accountability surrounding the pro-West policies implemented by the current government has cast a shadow over the mining sector, hindering its growth and stifling the economic potential of our nation. The secrecy surrounding these policies has left citizens in the dark, unable to comprehend the decision-making processes that directly impact their livelihoods.

The Zambian people deserve to know the truth about the management of our invaluable natural resources. The declining copper production levels underscore the urgency for immediate reforms in the mining sector. The Economic Freedom Fighters-EFF implores the UPND government to prioritize transparency and engage in open dialogue to address the concerns of the citizens.

It is essential for the government to take responsibility for the ramifications of its policies on the mining sector, which serves as the lifeblood of our economy. The Economic Freedom Fighters-EFF demands that the UPND government not only acknowledges the evident failure in copper production but also takes swift and concrete actions to rectify the situation.

Our party remains steadfast in its commitment to the well-being of the Zambian people, advocating for policies that promote sustainable economic growth and prosperity for all. We stand united in our call for urgent reforms and transparency in the mining sector to revitalize our nation’s economic backbone.

Under an EFF-led government, mineral resource sovereignty and citizen ownership with participation will be prioritized. We vow to ensure that mining benefits Zambians and involve citizens in the full mineral exploration and production lifecycle.

It is vital for Zambia to retain control over its resources thus under an EFF-led government, prosperity for all Zambians will reign. By utilizing Zambia’s resources and maintaining sovereignty, we will ensure long-term prosperity and economic growth for all citizens.

Join EFF, a new generation of leadership!

Wherever we want to go, our feet will take us there.

Kasonde Mwenda C.
President
Economic Freedom Fighters (EFF)

About the Economic Freedom Fighters (EFF):
The Economic Freedom Fighters (EFF) are dedicated to promoting economic freedom, social justice, and equality for all citizens. The EFF is committed to holding the government accountable and advocating for the well-being of the Zambian people.

UPND ABUSE OF GOVERNMENT RESOURCES IN MILENGE WARD BY ELECTION

Milenge.. Tuesday, March 5, 2024

The Socialist Party (SP) campaign manager for the Milenge ward by election Maximo Mutambo has blamed the loss of the Milenge’s mumbotuta ward by election on UPND blatant use of government resources and machinery.

Speaking in an interview with Lukwanga news on Monday, Mutambo stated that the elections were not free and fair as the UPND abused the powers of the government by implementing several programs during the campaign period which amounts to electoral malpractice and against the electoral code of conduct.

He adds that the road construction which was barely started a week before the elections, was meant to disadvantage opposition political parties who were taking part in that election.

He further mentioned that the government’s resources were abused including vehicles and funds to entice voters to vote for the ruling party.

Mr Mutambo also stated that the funds meant for social cash transfer beneficiaries were also disbursed to anyone including those who were not registered to benefit from the program.

He has since described the by election as not free and fair because the elections were between the socialist party and the government and not the upnd as apolitical party.

“The ZNS heavy equipments were mobilized for the road construction, DC ‘s vehicles, youths and sports, community development vehicles, ministry of health and other government vehicles were all mobilized to help the UPND campaigns,” Mutambo said.

“The construction of the road has since stopped without even finishing. One wonders how they are going to campaign in 2026 in mumbotuta ward because they will find people dislusioned and ready to take them on.”

On Friday ,the UPND scooped the Mumbotuta ward by elections in Milenge constituency of Luapula province with 329 votes, while the Socialist Party was second with 240 votes.

The Citizen First party had 77 while the Liberation Movement had 41. Meanwhile, the PF and the independent had 05 and zero respectively

DOING AWAY WITH ROYAL PROCESSIONS WILL INCREASE PRODUCTIVITY

AUSTERITY MEASURES

The UNITED KWACHA ALLIANCE would like to congratulate President Hakainde for finally bowing down to our, and other opposition parties, calls for this government to put in place austerity measures.

We are glad that President Hakainde has finally woken up to the need to start addressing this issue as we have been demanding.

We agree that the ministers trips must be restricted to the barest minimum. This should be, not only for foreign trips, but also for local trips.

President Hakainde must put his money where his mouth is by ensuring this pronouncement is not a mere public relations stunt and statement but make it a promise that he will keep.

Zambians demand that politicians must keep their promises and not turn them into lies.

To turn his decree about austerity to become a reality, PresidentHakainde should therefore do the following;

Stop ministers traveling to campaign at by elections, including even Ward elections. Recently we saw four ministers go to campaign at a ward election. The fuel, allowances and accommodation for themselves and their drivers could have been saved.

Have the V8s that several ministers are still driving sold as was promised months ago so that vehicle that are more efficient and have lower fuel consumption are used.

Ensure that after every trip outside Lusaka an activity report is filed and published by the minister within seven days of the trip having been made.

In the case of trips outside the country, have the minister issue a ministerial statement in Parliament within seven days of their return. If upon their return Parliament is adjourned and not in session, the ministerial statement must be made within seven days of the next sitting.

These measures will ensure that only important trips are undertaken and that the country is kept informed on what is being done on their behalf.

The President must equally reduce his trips as currently he has recorded a record of being Zambia’s most travelled President. If anything, presidential trips are twenty or thirty times more expensive than ministerial trips.

The President must immediately move to State House as the frequent commutes to and from Community House are an unnecessary drain on state resources.

Some of the austerity measures he United Kwacha Alliance President would put in place are

A. The UKA President would move into, and reside at, State House in order to ensure that there will be no need to;

i) erect a helipad at the personal residence of the President

ii) provide dedicated ZESCO supply lines and transformer station to the personal residence of the President

iii) transport staff housed at the State House compound on a daily and nightly basis to the personal residence of the President

iv) have frequent police details to be posted on the route to and from the President’s personal residence to State House

B. The UKA President will stop having the ‘Royal Processions’ to and from the airport each time the President flies out of and into Lusaka in order to;

i )avoid locking down traffic for Lusaka residents who are stopped by the traffic police for very long periods of time

ii )save on fuel used to transport every government official from the Vice President, ministers, service chiefs, secretary to the cabinet, District Commissioners right down to many civil servants. All these troop and participate in the Royal Procession merely to go and line up to shake the President’s hand.

C. The UKA President will utilize the helipad at State House to go by helicopter to either city airport or the international airport. Last minute instructions can be given at State House or whoever has to be interacted with urgently before the trip can fly with him in the helicopter to the airport.

D. Apart from saving money, doing away with the Royal procession will increase productivity.

Chamisa breaks silence on his game plan

OPPOSITION politician Nelson Chamisa yesterday revealed that he had personally embarked on grassroots campaigns in villages to map his next political move and distanced himself from any other political party.

Chamisa stepped down as opposition Citizens Coalition for Change (CCC) leader in January, citing infiltration by Zanu-PF after self-proclaimed party secretary-general Sengezo Tshabangu went on a rampage to recall dozens of party legislators and councillors.

Despite, his exit from CCC, factions within the opposition party have continued associating themselves with him, with one of the factions being led by Welshman Ncube refusing to let go of his face as the party logo.

Chamisa’s close allies, led by former legislators Amos Chibaya and Gift Siziba have been criss-crossing the country, mobilising support on behalf of Chamisa under a campaign dubbed the Blue Movement.

But Chamisa told NewsDay in an exclusive interview, that he was not focusing on forming another political party, but on forming a new government.

“I have been meeting people,” said Chamisa. “I have been in the countryside. I am meeting people in villages, community leaders, opinion leaders and traditional leaders.

“I am meeting people personally and it is an amazing show of confidence and hope. People are so committed. Zimbabweans are prepared to whatever extent for change to be realised in Zimbabwe. It’s like the spirit of the liberation struggle indefatigable and indomitable. Zimbabwe needs a new government, not just a new movement. I am doing everything to make sure that I do not let the delayed hope and expectation of Zimbabwe be jeopardised. People have hope of change everywhere I go and I will not disappoint them.”

The young politician, who was also a former Cabinet minister in the 2009 to 2013 Government of National Unity, said he was courting regional and international support, to “urgently” resolve the country’s political crisis, after he refused to accept the August 23 and 24 election results in which President Emerson Mnangagwa was declared the winner.

After he resigned from the CCC, Chamisa met several diplomatic representatives in the country, including Canadian Ambassador to Zimbabwe Adler Aristilde and British Ambassador to Zimbabwe Pete Vowles, to discuss various political issues.

“I am leaving no stone unturned to make sure that the will of the people prevails,” he said.

“As to what practical steps I am going to take, I am doing wide consultations with the citizens and opinion leaders. I will announce very soon what the next step is. What must come is something that cannot afford to fail, because we do not have that luxury.

“We have so many stones that have to be turned and these are local stakeholders, labour, the church, students, women’s groups, farmers groups, and traditional leaders, beyond our border and within the region Sadc [Southern African Development Community], AU [African Union] and all those stones need to be turned and I am glad that the response that I am getting from both within and beyond is amazing.”

The former CCC leader insisted Sadc was still seized with Zimbabwe’s political situation.

“There is an unresolved national question of leadership. It can’t be a closed chapter, when a student has failed an examination, it can’t be the end of the story. There must be a proper examination and proper qualification out of a system and process. Sadc passed the verdict that the Zimbabwe election did not pass the election credibility test. No discredited process can produce a credible outcome,” he told NewsDay.

WHY ALL UNMARRIED SEVENTH-DAY ADVENTIST MEN MUST READ THE MESSAGE BELOW

I’m a sad woman today there’s no one who hurts a single SDA woman like an SDA man who refuses to notice her.

And these SDA men can make you feel invisible. You see, an SDA man is very confident, composed, eloquent! They sing well, speak good English and dress like Prince Harry.

The only problem we have with you dear brothers is that when it comes to zero grazing, you are not good. You don’t like the grass in your local farm, so you ignore us. Little by little, you are announcing a wedding with exotic ladies.

As for us local grass you invite us to your wedding committees. It’s painful for us, though we must pretend and smile

It’s not like we can’t do something about it. We also get noticed by exotic men. But you know that means automatic problem… We should only be married from within 🙏

I HOPE TODAY WE OPENED OUR EYES
On this we can’t go on strike. But we beseech you our SDA brethren to open your eyes when you come to church.

It’s not like we are in a hurry to be in your houses, but you are just too visible to continue cooking and sleeping alone 😎. And don’t even dare say that God’s time has not come 😂😂😂. Look for another excuse😋…Thou shalt not lie that SDA single ladies are not available. We are the majority in church, but we also behave like we are taken- some kind of “playing hard”(that’s how we were told to behave not to look cheap)… And it’s not paying off. You just pass us like logs of wood…

APPROACH OUR DAMSELS
So the ball is back in your court. Approach us and talk to us. Ask us our names, where we come from, our favorite destination… Just anything else beyond “Happy Sabbath”.. So that you get to know us… You will realize that we are queens clothed in choir uniform. We also want to know if what we see from the outside is what you are when you take us home… That’s what it ought to be.

Approach us. We’re lonely

US adds Zimbabwe First Lady Auxillia Mnangagwa to its sanctions list

“These changes to our approach provide an opportunity for the Government of Zimbabwe to undertake key reforms to improve its record on human rights, good governance, and anti-corruption.

“Consistent with the findings of Treasury’s 2021 sanctions review, we are committed to the use of economic sanctions towards a clear and specific objective, in coordination with diplomacy and other tools of statecraft.”

“Specifically, the Department of the Treasury is designating three entities and eleven individuals, including President Emmerson Mnangagwa, Vice President Constantino Chiwenga, Brigadier General (Retired) Walter Tapfumaneyi, and businessman Kudakwashe Tagwirei, pursuant to Executive Order 13818, which builds upon and implements the Global Magnitsky Human Rights Accountability Act, for their involvement in corruption or serious human rights abuse.

“These designations build on recent U.S. Government actions, including pausing U.S. participation in the African Development Bank Dialogue and utilizing the Department of State’s new visa restriction policy for undermining democracy in Zimbabwe.

“These steps are concurrent with the termination of the preexisting Zimbabwe sanctions program that began in March 2003 and expanded on in subsequent orders.

“Actions to retire the previous sanctions program and designate key actors under the Global Magnitsky sanctions program are part of an ongoing effort to ensure we are promoting accountability for serious human rights abuse and corruption in a targeted and strategic manner,” the US government noted.

Government spokesperson Nick Mangwana said the development represents Mnangagwa’s positive re-engagement efforts.

“Well, this is massive. A great vindication of President Mnangagwa’s Foreign Policy.

“That said, as long our President is under Sanctions Zimbabwe remains under illegal sanctions, as long as Members of the First Family are under sanctions, Zimbabwe remains under illegal Sanctions, and as long as senior leadership is under sanctions, we are all under sanctions,” he said.

U.S. Secretary of State Antony Blinken said in a statement that the designations “are part of a stronger, more targeted sanctions policy towards Zimbabwe the United States is implementing.”

“Key individuals, including members of the Government of Zimbabwe, bear responsibility for these actions, including the looting of government coffers that robs Zimbabweans of public resources,” he said.

The Zimbabwean government has for years been blaming sanctions for the economic crisis but critics point to massive corruption and rights abuses for suffocating the country’s economy.

An online protest movement exposes corruption in Uganda. Officials and others are rattled

Abuse of public funds. Failing hospitals. Potholes in the streets of Kampala, the capital of Uganda.

These and other issues feature in an online protest campaign that is rattling government officials and others in this East African country where street protests are practically outlawed — and where corruption is widespread and often deadly.

The campaign has been trending on the social media platform X, formerly Twitter, as #UgandaParliamentExhibition. It relies on leaks of official documents and has been cast as an “exhibition” — in a sequence of postings — about controversial issues.

The latest posts, about Uganda’s National Assembly, purport to reveal details about abuse of public resources, nepotism in staff recruitment and even collusion between civil servants and lawmakers on oversight committees.

They also focus on Parliament Speaker Anita Among, an influential member of the ruling party, who is criticized for allegedly collecting huge sums in allowance spending on foreign travel, including trips that did not happen.

The campaign alleges Among was paid the equivalent of $894,500 in per diems and entertainment allowances between July and January, an astonishing amount in a country struggling to implement its budget amid persistent revenue shortfalls.

A parliamentary commission which Among heads had earlier raised daily per diem rates for the speaker from $990 to $4,000. The annual per capita income in Uganda was $850 in 2022, according to World Bank figures.

Among has not commented on the online campaign, and The Associated Press could not independently verify the allegations posted by its organizers, who include Jimmy Ssentongo, a prominent rights activist in Uganda.

Chris Obore, a spokesman for the National Assembly, said in a statement that “Parliament acknowledges concerns raised in the ongoing #UgandaParliamentExhibition on the institution.”

“In the spirit of openness, accountability and transparency, we are duty bound to study the specifics of all concerns and conclusively address them,” he said, without elaborating.

The government of President Yoweri Museveni, who has held power in Uganda since 1986, has long been accused of shielding corrupt but influential officials from criminal prosecution. After his reelection to a sixth term in 2021, Museveni promised to crack down on corruption.

But many Ugandans are not hopeful.

Local media outlets frequently report on corruption issues, but activists, opposition figures and others who try to stage street demonstrations face arrest under a law that requires them to first notify police of their plans to rally.

The online protest movement has become significant for its ability to name and shame specific individuals before an attentive audience, said Marlon Agaba, head of the Anti-Corruption Coalition Uganda watchdog.

“In a country where civic space has been shrinking, citizens are finding alternative and innovative ways to express their displeasure in terms of how the country is being governed,” he said. “This campaign also shows the power that new media has in shaping discourses on governance.”

The #UgandaParliamentExhibition has also cast a wide net, seeking evidence of wrongdoing among both government and opposition figures.

Mathias Mpuuga, a former opposition leader in the National Assembly, was said to have received a $131,000 “service award” for his work in Parliament.

Mpuuga denies any wrongdoing, but another opposition figure who nominated Mpuuga to the parliamentary post is accusing him of abuse of office.

“If we allow that corruption to get into us, then it’s going to destroy us,” said Kyagulanyi Ssentamu, a popular singer who is also known as Bobi Wine, speaking to local broadcaster NTV on Monday.

“Whenever huge sums of money exchange hands … there’s something that’s being given in exchange,” he said.

Chamisa blasts Zanu PF govt over “command curriculum” in Zimbabwe

Former opposition Citizens Coalition for Change (CCC) leader Nelson Chamisa has outlined a vision for a “formidable modern education system” in Zimbabwe, urging the government to move beyond recent curriculum changes and engage in broader public consultations and collaboration.

In a statement titled “BUILDING A FORMIDABLE MODERN EDUCATION SYSTEM: PREPARING ZIMBABWE FOR THE FOURTH INDUSTRIAL REVOLUTION,” Chamisa criticises the recently scrapped Continuous Assessment Learning Activities (CALA) and expresses skepticism towards the newly introduced heritage-based curriculum, calling it a “Command Curriculum” implemented without public consultation.

He advocates for a “CITIZENOCRACY” approach, emphasizing the importance of public participation and stakeholder involvement in both policy development and implementation.

“We must construct policies through consultation and collaboration with global education experts, educators, school development bodies, industry, business stakeholders, and those with parental responsibilities,” he said.

Chamisa argues this collaboration will ensure that education policies are “forward-thinking” and responsive to both global and local needs.

The statement emphasises the need for a well-funded education system that caters to the specific needs of students, parents, and teachers.

Chamisa highlights the importance of human capital development and strategic investment in education anchored in comprehensive market research.

His vision extends beyond immediate reforms, outlining an ambitious goal of transforming Zimbabwe into a “business hub, tech hub, and education hub of the world” within the next three decades.

He said there was a need to embrace emerging technologies like AI and blockchain to prepare future generations for the challenges and opportunities of the Fourth Industrial Revolution.

“On account of this, a well funded education system that is sensitive and responsive to the needs and requirements of pupils, parents and teachers is fundamental.

“Our aim is to turn Zimbabwe into a business hub, tech hub and education hub of the world. To achieve this, we must take bold steps and make revolutionary moves,” Chamisa noted.

He added: “In a New Great Zimbabwe, we will turn things around and become a superpower in the next three decades. For the next 10 years we have 3 key revolutions: blockchain,AI and Biotech revolutions.

“The rapid speed at which these technologies, AI, quantum computing, the metaverse, and others – are evolving will be a pressing question, especially as we try to grapple with the challenges relative to this constant evolution

“We must be ready to use emerging technologies and AI to govern better, making government systems trustworthy, inclusive, safe, resilient, and sustainable.”

Chamisa called for a complete restructuring of the education system, criticising it for teaching “a lot of wrong lessons” and focusing on creating employees rather than entrepreneurs.

He advocates for a curriculum that balances academic and vocational education, prioritizes skill development over rote memorization, and introduces foreign languages alongside local languages.

Drawing inspiration from countries like Finland, South Korea, and Singapore, Chamisa urged the government to learn from successful education models and implement reforms that will equip Zimbabwean youth with the skills and knowledge necessary to compete on a global scale.

Nikki Haley victorious in Republican primary held in Washington D.C

0

Nikki Haley has won the Republican primary in the District of Columbia, notching her first victory of the 2024 campaign.

Her victory Sunday at least temporarily halts Donald Trump’s sweep of the GOP voting contests, although the former president is bound to pick up several hundred more delegates in this week’s Super Tuesday races.

Despite her early losses, Haley has said she would remain in the race at least through those contests, although she has declined to name any primary she felt confident she would win. Following last week’s loss in her home state of South Carolina, Haley remained adamant that voters in the places that followed deserved an alternative to Trump despite his dominance thus far in the campaign.

The Associated Press declared Haley the winner Sunday night after D.C. Republican Party officials released the results.

Washington is one of the most heavily Democratic jurisdictions in the nation, with only about 23,000 registered Republicans in the city. Democrat Joe Biden won the district in the 2020 general election with 92 per cent of the vote.

Haley held a rally in the nation’s capital on Friday before heading back to North Carolina and a series of states holding Super Tuesday primaries. She joked with more than 100 supporters inside a hotel ballroom, “Who says there’s no Republicans in D.C., come on.”

“We’re trying to make sure that we touch every hand that we can and speak to every person,” Haley said.

As she gave her standard campaign speech, criticizing Trump for running up federal deficit, one rallygoer bellowed, “He cannot win a general election. It’s madness.” That prompted agreement from Haley, who argues that she can deny Biden a second term but Trump won’t be able to.

While campaigning as an avowed conservative, Haley has tended to perform better among more moderate and independent-leaning voters.

Four in 10 Haley supporters in South Carolina’s GOP primary were self-described moderates, compared with 15 per cent for Trump, according to AP VoteCast, a survey of more than 2,400 voters taking part in the Republican primary in South Carolina, conducted for AP by NORC at the University of Chicago. On the other hand, eight in 10 Trump supporters identified as conservatives, compared to about half of Haley’s backers.

Trump won an uncontested D.C. primary during his 2020 reelection bid but placed a distant third four years earlier behind Sen. Marco Rubio of Florida and former Ohio Gov. John Kasich. Rubio’s win was one of only three in his unsuccessful 2016 bid. Other more centrist Republicans, including Mitt Romney and John McCain, won the city’s primaries in 2012 and 2008 on their way to winning the GOP nomination.

Gangs raid Haiti’s biggest jail, forcing hundreds of convicts to escape

0

Many prisoners escaped from Haiti’s main prison after armed gangs attacked the facility during a violent night in the city. At least five people died on Sunday.

The jailbreak made Haiti’s violence worse. Violent groups are increasing their attacks in Port-au-Prince while the Prime Minister Ariel Henry is away trying to get support for a UN-backed security force to make the country more stable.

Three people were shot and were lying at the prison entrance. The entrance was wide open and there were no guards around. On Sunday, empty concrete patios were covered in plastic sandals, clothes, and electric fans. Normally, they are crowded with people. In a different area, two men were found dead with their hands tied behind their backs. People walked by the roadblocks set up with burning tires.

Haiti’s government asked people to stay peaceful while it tries to catch the people who committed crimes and got away when violence broke out.

The police are trying their best to catch the prisoners who escaped and the people who helped them. They want to bring back the peace and order in the country.

Arnel Remy, a lawyer who helps people in prison, said that less than 100 out of almost 4,000 inmates are still in jail. 18 ex-Colombian soldiers accused of being hired to help kill the Haitian President Jovenel Moise decided to remain in Haiti. On Saturday night, some Colombians posted a video asking to be saved.

“Please, we need your help,” said Francisco Uribe in a message that was shared a lot on social media. “They are killing people inside the cells without choosing who to target. ”

On Sunday, Uribe told reporters that he didn’t run away because he is innocent.

Colombia’s foreign ministry asked Haiti to give extra protection to the men.

When there was no news from the prison, families went there to see if their loved ones were okay.

Alexandre Jean said she doesn’t know if her son is alive. She looked around the cells to see if she could find him. “I am unsure of what to do. ”

There was a lot of violence on Saturday night, with many different areas saying they heard gunshots.

There were reports that about 1,400 prisoners escaped from a prison in Port-au-Prince. Gangs with weapons took control of the country’s main soccer stadium and caused damage. They also held one worker captive for several hours, according to the soccer federation. Many people in Haiti couldn’t use the internet because the main mobile network’s connection got cut.

In less than two weeks, gangs have attacked several state buildings, working together more and targeting places like the Central Bank that they usually would not have. Gangs attacked and killed four police officers on Thursday.

The US is taking steps to help keep the airport safe in Haiti after gangs shot guns there. The embassy stopped all its official trips to the country and told American citizens to leave as quickly as they can. The embassy said it will cancel all consular appointments until Thursday.

The Biden administration is watching the worsening security situation very closely. They are not sending troops but are providing money and help with organizing things.

An official from the National Security Council said that violence only makes it harder to have a democratic change and hurts many people’s lives. A person in charge, who didn’t want to be named, repeated what the United States said. helping with voting, fair government, and bringing back democracy.

The main place where the violence happened on Saturday night was the National Penitentiary in Haiti. Some gang leaders are being held there. During the shooting, police asked for help.

“The police union said on social media that they need help and used the “SOS” emoji eight times. ” “Let’s get the army and the police to stop the bad guys from getting into the prison. ”

Fights happened after a lot of angry protests that got worse in the last few days. The prime minister went to Kenya to try to save a plan for the U. Nto send a security mission to Haiti, led by Kenya. Henry became the prime minister after Moise was killed. He has been delaying the elections for both the parliament and president, which didn’t happen for almost ten years.

Haiti’s National Police has about 9,000 officers to keep more than 11 million people safe, according to the U. NThey are often outnumbered and overpowered by gangs, who are believed to have control over most of Port-au-Prince, up to 80 per cent.

Former high-ranking police officer Jimmy Cherizier, also known as Barbecue, is now in charge of a group of gangs and says he is the one behind the recent increase in violent attacks. He said they wanted to catch the leader of Haiti’s police and government officials to stop Henry from coming back.

The prime minister, who is a brain surgeon, has ignored demands for him to quit and didn’t say anything when asked if he thought it was okay to return home.

EU slaps Apple with US$2 billion fine over music streaming competition

The European Union has fined Apple for breaking antitrust rules on Monday. The fine is the first of its kind for Apple in the EU. A big technology company has to pay almost 2 billion dollars for not being fair to other music streaming services.

Apple stopped app developers from telling iPhone and iPad users about cheaper music subscriptions that they can get outside of the app. This was said by the European Commission, who are in charge of making sure there is fair competition between companies in the European Union.

That is against the law according to EU rules about competition. Apple behaved this way for almost ten years, which meant many people paid much more money for music streaming subscriptions, according to the commission.

Five years ago, Swedish streaming service Spotify complained about something, and now the company has been ordered to pay a 1. 8 billion euro fine after a long investigation.

The EU is working to make Big Tech companies follow the rules. They fined Google a lot of money and are also accusing Meta of messing with online ads. The commission is also looking into whether Apple’s mobile payments service is breaking antitrust laws.

Apple responded strongly to the commission and Spotify, saying it will challenge the fine.

The company said that the decision was made even though the Commission didn’t find any real evidence that consumers were being hurt. The decision also doesn’t consider the fact that the market is doing well, has lots of competition, and is growing quickly.

Spotify is expected to gain from the decision. They have a large share of the music streaming market in Europe and have been in talks with the commission many times over the years. They do not pay Apple for using its App Store.

“Surprisingly, the decision made today only makes a successful European company even stronger in the digital music market,” Apple said.

The committee’s investigation first focused on two things. Apple makes app developers use its own payment system, which charges a 30% fee on all subscription sales.

However, the EU changed their focus and are now looking at how Apple stops app creators from informing their users about cheaper ways to pay for subscriptions without using an app.

The investigation discovered that Apple stopped streaming services from telling users about the cost of subscription offers outside of their apps. This also included not allowing links in their apps for users to pay for other subscriptions or sending emails to inform users about different pricing options.

The fine comes at the same time as new EU rules aimed at stopping big tech companies from controlling online markets are about to start.

The Digital Markets Act starts on Thursday and gives rules to big companies like Apple, Meta, Google, and ByteDance. They could get big fines if they don’t follow the rules.

The DMA’s rules are meant to stop big tech companies from doing the same things that Apple is being investigated for. Apple has said it will follow the rules in Europe by letting iPhone users use different app stores and allowing developers to use other payment methods.

The commission is also looking into whether Apple’s mobile payments service is unfair to other companies. Apple has said it will let other companies use its tap-and-go mobile payment system to try to solve the problem.

Former CFO of Trump Organisation to enter a guilty plea to accusations of perjury

0

The person who used to be in charge of the money for the Trump Organization is likely to admit to lying under oath on Monday. This is about an investigation into how the company manages its money.

Allen Weisselberg, who used to be a close friend of Donald Trump for a long time, went to the Manhattan district attorney’s office very early on Monday morning. He should say if he is guilty or not later today.

Weisselberg said no to answering questions. Seth Rosenberg, a lawyer for Weisselberg, also refused to make a statement.

Weisselberg has been talking with Manhattan prosecutors for a few weeks about his testimony during the investigation into the former president. Several people who know about the investigation said that he testified in 2020 and last year.

It is not known which specific charges he will admit to.

In the plea talks, Weisselberg is not expected to go against Trump and will not speak against him in the trial scheduled for later this year.

Trump is accused of lying about his business records to hide a secret payment before the 2016 election. Weisselberg was very involved in the money stuff, but the lawyers for both sides don’t plan to have him testify. Trump says he didn’t do the bad things he’s accused of.

Weisselberg will admit he is guilty again, after pleading guilty to tax fraud in 2022 and testifying in the trial of two Trump Org. Entities are things or beings that exist. Weisselberg told the truth in court and the companies were found guilty and had to pay a fine. The judge decided that Weisselberg will go to jail for five months and then be on supervised release. He spent around 100 days in Rikers Island jail.

The new charges are really bad for Weisselberg, who is old and has health problems. Last month, a judge in New York found Weisselberg guilty of fraud in a case brought by the attorney general. The judge ordered him to pay $1 million, plus interest. This is about half of the $2 million severance he got from the Trump Organization.

Russia and Germany fight over recorded audio about missiles intended for Ukraine

0

The German government has strongly denied that Russia‘s release of a conversation between senior German military officers was a sign that Germany was getting ready to go to war with Russia.

The government tried to handle the problems caused by the audio leaked at home, and promised to quickly investigate how top German military conversations were leaked.

“The German Chancellor’s spokesman Wolfgang Buechner, said it is very clear that the claims about Germany preparing for war against Russia are just false Russian propaganda. ”

Wolfgang Buechner, who speaks for the government, said that Russia is trying to start problems with Germany by spreading information.

The 38-minute recording has German military officers talking about how Kyiv could use Taurus missiles against Russian forces. German authorities have not doubted that the recording is real. But, Scholz said a week ago that giving these weapons to Ukraine is not a good idea. He doesn’t want Germany to get involved in the war.

Russia’s foreign ministry warned Germany on Monday that there would be serious consequences because of the leak, but they did not explain further.

“If the German people don’t do something about this, there will be bad consequences for Germany,” said Maria Zakharova, a spokesperson for the foreign ministry.

The relationship between the two countries has been getting worse since Russia attacked Ukraine two years ago.

On Friday, Margarita Simonyan, who is in charge of a Russian TV channel that gets money from the government, posted a recorded conversation online. This happened on the same day that Alexei Navalny, a politician who opposed the government, was buried after dying in a prison two weeks ago. It also appeared just a few weeks before the election for Russia’s president.

According to the dpa news agency, a leaked audio recording reveals that four officers, including Germany’s Air Force leader Ingo Gerhartz, were talking about using Taurus missiles in Ukraine before meeting with the country’s Defence Minister Boris Pistorius.

The officers said that if German soldiers helped, they could deliver Taurus missiles quickly. Training Ukrainian soldiers to do it themselves would take a long time.

The video also shows that the German government has not approved the delivery of the cruise missiles that Ukraine wants, according to dpa.

In Germany, people are arguing about whether Ukraine should get missiles because Kyiv is losing battles, and the United States hasn’t sent military help yet. Germany now gives the second most military help to Ukraine after the U. Sand is increasing its help even more this year. Scholz said last week that Germany will not give Taurus missiles to Ukraine. Ukraine had been asking for the missiles for months, but Germany was taking a long time to decide. Taurus missiles can reach up to 500 kilometers, and could potentially be used against targets deep inside Russia.

On Monday, the ambassador from Germany went to visit the foreign ministry in Moscow, Russia. Russia media said Ambassador Alexander Graf Lambsdorff was called in by the foreign ministry, but the German government said his visit was already planned before the audio was released.

Germany’s defense ministry tried to make the officers’ conversation in the leak seem less important, saying it was just a discussion of ideas before meeting with the defense minister.

The government is looking into how Russian agents were able to listen in on and share a private conversation among important German military leaders. It said it would tell about what it found. Some German news outlets said that the police officers were in an online meeting when they were recorded.

Buechner, who speaks for the chancellor, said that the German government will try to stop false information, especially from Russia.

The Kremlin said it is waiting for the German government’s investigation results.

Mr Smith was increasingly incensed by his colleague’s lack of professionalism. He found it extremely frustrating. Scholz promised that they would quickly and thoroughly investigate the situation. “We want to know what the investigation found,” said spokesperson Dmitry Peskov.

British Columbia provides $30K bonuses to entice and keep nurses

0

“The British Columbia government is offering extra rewards to attract new nurses to the province. Nurses who are willing to work in the north will get the highest bonuses.

Nurses can get $30,000 for working for at least two years in the northern parts of the province, or $20,000 for working in other rural and faraway places.

Even in big cities, nurses who apply for jobs that are hard to fill or in high demand could get bonuses as high as $15,000.

The government will give $15,000 to nurses who work for two years in the GoHealth BC travel nurse program.

Health Minister Adrian Dix revealed the rewards at a press conference on Friday. He also talked about other ways the government is trying to solve the problem of not having enough nurses in the province.

“Dix said we need to practice more. ” “We need more ways for nurses trained in other countries to work here, and we’re working on making that happen. ”

One part of the plan is to make the Provincial Rural Retention Incentive bigger. Nurses can make up to $8,000 a year if they choose to work in one of 63 communities that qualify for the program.

Also, the government is getting ready to put in place rules about how many nurses there must be for each patient in different places where people get medical care.

This means there is one nurse for every four patients in regular hospital units, one nurse for every three patients in palliative care, and one nurse for every patient in intensive care.

British Columbia is starting to use ratios like Australia and California. “will be the first place in Canada to do it. ”

“Having enough nurses for each patient not only benefits the patients, but also helps the nurses,” stated Adriane Grear, who is the president of the BC Nurses’ Union. “But they help get new employees, keep them, and I think other places will copy what we’re doing. ” What we are doing here is very important for history. What we are doing here shows our beliefs about health-care workplaces.

New benefits have been added for people who are learning to become nurses in B.C. This means that students studying Nursing or Psychiatric Nursing can get $2,000 off their tuition fees each year. Indigenous students in a BSN program can get an extra $5,000 off their tuition.

The province will spend $237. 6-million on hiring, keeping, and training employees.

Jack Teixeira enters guilty plea for disclosing sensitive national defence data

0

The person from the Massachusetts Air National Guard who shared secret intelligence reports on social media has confessed to keeping and sharing classified information on purpose.

22-year-old Jack Teixeira admitted to all six charges against him for breaking the espionage act in court on Monday morning.

Teixeira said he would talk with the intelligence community and the U.S Court documents say that the Department of Defense must give all the important papers it has or knows about.

In return, the prosecutors have said they will request the judge to give a prison sentence of 16 years and 8 months. The suggested sentence is much shorter than the much longer prison sentence he could have gotten if he didn’t make a deal. According to court documents, prosecutors said they won’t charge Teixeira with more crimes under the Espionage Act.

A judge will make the final decision in September. The person from Massachusetts has been in jail since he was first arrested in April 2023.

The leaked document shocked the intelligence world when it was first revealed last year. The leak made people wonder how a 21-year-old computer expert with weapons and a history of violent talk could get high-level security clearance from the US government.

It also showed that the Pentagon had big problems keeping its most important secrets safe, according to defence and intelligence sources at the time.

Teixeira stood with his two lawyers and said he was guilty on Monday morning. He had on an orange outfit from prison and a rosary around his neck. Teixeira’s family and supporters, including his father, sat behind him.

Court papers say that Teixeira managed a little-known chat room on Discord called “Thug Shaker Central,” where people shared funny pictures and talked about guns and religion.

While working at a military base on Cape Cod, Teixeira searched government databases without permission, even though he was told not to by his bosses. According to prosecutors, Teixeira started posting messages with secret information in a chat app called Discord. Later, he also put up pictures of secret documents.

The papers, some of which were looked at by CNN, had very secret info in them. This info included listening in on important friends and enemies and honest opinions about the Russia-Ukraine war. Lawyers claim that the papers Teixeira shared also have details about a US company’s accounts that were accessed by a “foreign enemy. ” There is also a document talking about a plan by a foreign enemy to attack US forces overseas.

Judge Indira Talwani talked about what Teixeira is accused of doing and the information he is accused of giving out during the court hearing on Monday. She asked Teixeira if he disagreed with the accusations.

“No, Judge,” said Teixeira.

The judge asked if there was any disagreement about whether the documents were top secret and if their unauthorized disclosure could harm national security.

Teixeira said, “No, judge. ”

The lawyers said that after the information was made public, Teixeira got rid of his electronic devices and got a new phone number and email address. He was arrested at his home in Massachusetts about a week later.

After he was accused, the US Air Force punished 15 people who did not report concerns about Teixeira’s behavior before the leaks. This includes the commander of Teixeira’s unit, who was removed from his position.

Michael Bachrach, Teixeira’s lawyer, said outside the federal courthouse in Boston that his client admitted to doing the right thing and did not sell secret information to other countries.

DEFENCE LAWYERS QUESTIONS SEAN TEAMBO’S PRESENCE AT THE BAR WITHOUT DPP CONSCENT IN THE LUCIFER CASE

DEFENCE LAWYERS QUESTIONS SEAN TEAMBO’S PRESENCE AT THE BAR WITHOUT DPP CONSCENT IN THE LUCIFER CASE

March 04, 2024

Lusaka MAGISTRAGE Nsunge Chanda has reserved ruling to 18th March 2024 in a matter in which UPND Secretary General, Batuke IMENDA has been sued by Patriots for Economic Progress, Sean Tembo for alleged labeling Lusaka Diocese Archbishop Alick Banda as Lucifer.

The defence team led by Larry Njungu of Mutemwa Chambers challenged the presence of the plaintif Sean Tembo at the bar in the absence of express permission from the Director of Public Prosecution (DPP) allowing him to function as a Private Prosecutor.

Counsel Njungu submitted that it was illegal and without statutory basis for Mr Tembo to sit at the bar when the DPP had not provided any guidance to that effect and was therefore in a wrong place.

“Mr Tembo is blind in so far as the law is concerned, and it’s wrong for him to suggest to this honourable court that we are appealing against the ruling of 2nd February 2024 through the back door,” Mr Njungu said.

Another defence lawyer McQueen Zaza of Ilunga and Company submitted that the bar is a pure sanctuary for legal practitioners and others permitted to sit thereon by the DPP.

Counsel Zaza submitted that Article 180, Clause 8 of the Constitution of Zambia is explicitly clear saying “The functions of the Director of Public Prosecution may be exercised in person or by a public officer or legal practitioner, authorised by the Director of Public Prosecution, acting under the general or special instructions of the Director of Public Prosecution.”

“Is Sean Tembo a legal practitioner, no; he is an Accountant. But can an individual who is not a legal practitioner prosecute a criminal matter without the permission of the DPP?” said Mr Zaza.

He said, even if Mr Tembo was allowed to function as a Private Prosecutor, he could only function as a Co-Prosecutor to the DPP or the lead Public Prosecutor as provided for under the laws of Zambia.

He further submitted that Article 128, Clause 2 of the Constitution of Zambia demands that any matter with glitches on the Constitution, should be determined by the Constitution Court.

He maintained that in the absence of authority or permission from the Office of the DPP, Mr Tembo cannot prosecute the matter, and allowing him to do so would be a violation of the Constitution of Zambia.

In his argument, Mr Tembo said the application by the defense wasn’t new and as such it was frivolous and lacked merit adding that the defence was wasting the courts time as the matter was previously raised on 22nd January 2024 and the court rendered a ruling on 8th February 2024.

He added that he was sitting at the Bar at the convenience of the court, but the defence lawyers watered down his argument indicating that the court is about laws and not conveniences.

Mr Tembo who had on two occassions sat in the public gallery said he was ready to sit anywhere in court to make the defence lawyers happy.

But in response, defence counsel Timmy Munalula of Mulungoti and Company submitted that the defense would seek the Constitution Court’s determination on the legality of the proceeding and that the accused person can be sitted in the accused doc in the absence of authority from the DPP to prosecute the matter by way of a Private Prosecutor.

“The Constitution Court enjoins this honourable court to stand down when dealing with a matter that borders on the constitution. It’s also the discretion of this court to look at the Constitution part of this matter,” said Mr Munalula.

Magistrate Chanda has reserved ruling to 18th March 2024.

Mr. Tembo is in this matter representing himself and has since applied to the DPP to privately prosecute the matter, a request the DPP has rejected.

WE ARE GOING BACKWARDS…we don’t regret removing PF but we didn’t understand UPND very well – Changala

By Fanny Kalonda(The Mast)

GOVERNANCE activist Brebner Changala says the country is going to have serious food shortages.

He also says should there be a regime change, “you will see how active the ACC will be as if at the time of the new dawn ACC never existed”.

Featuring on Prime TV’s Oxygen of Democracy programme on Monday, Changala said leadership is lacking adding that “we are just going backwards”.

He added that people celebrated when UPND won elections but the party is no longer attractive.

“When we changed government in 2021, I haven’t said this let me put it to the viewers, we all celebrated. It’s an open secret that I was one of the many citizens that really made sure that we had a change of government and the new dawn administration came into power. The UPND even today is not an attractive political party for various reasons because since multiparty came, this is the only political party that doesn’t even attract new membership,” Changala said. “What we don’t regret is having removed the Patriotic Front, what we regret is that we didn’t understand our colleagues very well. They helped us to stop the mayhem. But what we are seeing today with time, they might not be any different. Am talking to you right now [Raphael] Nakacinda is in cells for a statement he made in 2022. That’s two years ago.”

He said the country is lacking leadership, “a situation anyone would realise when they open their eyes”.

“He’s in cells, he has not been charged. Now the “resident says, ‘when you are arresting somebody, you must have done your investigations, charge him. If the case is bondable, give him bond’. But what we are seeing today, we are just going backwards. We are just going backwards… Me and UPND were once synonymous. But I want to tell you and through you the people of Zambia that when we support a cause there are certain ideals and certain values that brings us together,” Changala said. “This country I will repeat is lacking leadership. There are things that you can see if you have open eyes, you don’t need to be a rocket scientist. The economy is failing. The exchange rate has gone haywire and we have drought. This is the time that you must have resolved leadership that will be available in the time of need. I have seen in the last month in which we have seen everything go haywire. The exchange rate skyrocketing, fuel and what have you. The leadership of this country has gone under. It can’t come out openly meet you the media, address the nation and give us hope. What is it that they have in their magic basket that will make us go through during these trying moments? But they don’t talk to us.”

He noted that the country has a bad economy and citizens are being given half baked information.

“We are going to have serious food shortages in this country. We have a bad economy and they are giving us half baked information,” Changala lamented.

And Changala said corruption is endemic in the new dawn administration citing single sourcing of fertiliser by Alpha Commodities and the refusal of a permanent secretary to allow the Auditor General audit the Ministry of Agriculture.

“It is because they are hiding something.

These are lip services because the fight against corruption in this country is highly selective. And they will play to the gallery especially to the donnor community. Should there be a regime change, you will see how active the ACC will be as if at the time of the new dawn ACC never existed. And many time, I take time to go to ACC and understand where has the corruption gone to,” he said. “And I have given them a challenge. When you fight corruption after the regime changes, that becomes political persecution. It’s important to fight corruption in real time. And I will tell you right now, corruption is endemic in this administration…This fight against corruption cannot succeed if it is selective.”

Changala also noted that there are more than 300 civil servants who stay home on a full salary.

“What we see, experiencing, is reverse tribalism and it’s becoming endemic because people who are qualified are being removed. PF used to do what they used to call retired in national interest but we are experiencing a situation where people who are qualified are being shunted to Cabinet Office in holding positions. You must have heard about that,” said Changala. “You are director at the Ministry of Education, you are not needed there, you have done nothing wrong so they remove you and shunt you to Cabinet Office. They are there, there are more than 300 civil servants and they stay home on a full salary. Let anybody challenge me, they don’t work but they get paid and we have done our own investigation and it is all about tribe. 80 per cent to 90 per cent of the people that have been shunted to Cabinet Office in holding positions are our colleagues from Northern, Eastern. Now they are being replaced with the so-called disadvantaged people.”

HH THINKS HE IS THE MOST EDUCATED…he lectures Engineers, preaches to the Clergy forgetting he is a Layman – Antonio Mwanza

SAMMY THINKS HE IS THE MOST EDUCATED

…he lectures Engineers, preaches to the Clergy forgetting he is a Layman – MOURINHO

Lusaka..Monday, March 4, 2024 ( Smart Eagles )

If you look at President Hakainde Sammy Hichilema, you can tell that in his mind, he believes that the hierarchy of this earth is God first, Jesus second and third its him, says Socialist Party (SP) Deputy General Secretary Antonio Mourinho Mwanza.

Quoting from the Holy Bible in the Book of James Chapter four, Mourinho said God opposes the proud and exalts the humble.

He, quoting Proverbs 29 verse 2 added that when the righteous are in authority, the people rejoice, “but when the wicked rule, the people mourn.”

Mr Mwanza lamented while addressing the media in Lusaka today that Zambian people are mourning right now.

“Insala, ichipowe, ubupina; people are mourning right now… a family of five in Lusaka needs K10,500 or K10,300 to survive. The question we ask ourselves is how many people in this country receive K10,000 as their income on a monthly basis? How much is a salary of a teacher, a nurse, a doctor, a Judge, a journalist?” he asked.

“How much is the capital of a woman at Munyaule Market? If you look at the salaries of civil servants, amidst high inflation rate, where the Kwacha has totally lost its value, and the things that we used to buy for K1000 now, if you go to shoperite or any other shop, ija yamene mwenzonyamula trollies nikunyamulila kumanja, ,muli K1,000. Ma light ya K500 yenzonkala mwenzi onse lelo ma light ya K500 ni two weeks yasila. Unga tenzo gula K130, tigula K350 and K850 in places like Milengi, where we were for the by election. We are in a crisis.”

He noted the President Hichilema’s call on other political players to work in collaboration with him to ensure that solutions are found to problems facing the general populace.

Mr Mwanza however disclosed that the Head of State is not being sincere in his call.

“The President of this country, President Sammy Hichilema was addressing the nation. And when he was addressing the nation to declare hunger as a national disaster, he called upon all the stakeholders to work together with him burry our political differences and to embrace each other for the good of Zambia. But the President is not being honest in his call because we as opposition have always asked the President to meet us, to discuss national issues affecting our people. But President Hakainde Sammy Hichilema has always refused to meet us,” he said.

“On 4th October 2023, 11 opposition political parties came together wrote to the President asking for a meeting. The President didn’t even have the courtesy of writing back. So when he says he wants us to work with him, what does he mean? He is the one who doesn’t want to work with others. He is the one who believes that only him knows everything. Because according to him he is the most intelligent Zambian.”

He noted that the President thinks he is the most educated man in the country.

“He knows everything. Even when he goes to meet technocrats, engineers, he is the one who lectures them on matters of engineering when himself is not an engineer,” he said.

“When he meets the clergy, he wants to preach the message to the clergy when himself is a layman. He is a man who is obsessed with himself and doesn’t want to take advice. He claims that we have not been advising him as opposition parties, the Socialist Party has been on record. If we advise President Hakainde Sammy Hichilema, he just goes to the page…”

UKA Alliance Visits Demolished Munyaule Market

UKA Visits Demolished Munyaule Market

…sympathises with victims of razed down shops.

4th March 2024

UKA wants four thousand victims of demolished market owners accommodated immediately said the alliance Communications head President Jackson Silavwe on Monday in the company of senior UKA member and Citizenss First (CF) President Harry Kalaba.

“We are aware that up to 4000 mart store owners have been affected by the Hakainde Hichilema´s government decision to demolish the stores here at Munyaule and measures must be taken to immediately accommodate the traders,” Mr Silavwe said.

During an ‘on the spot check’ at the market that has been reduced to debris without warning to traders to evacuate their goods by the Hichilema government, UKA believes the best thing to do now is mitigate the damage and offer the marketeers an alternative lease of livelihood to survive as the cost of living in Lusaka shoots beyond K10,300 per month on basics alone for a small family of five.

In Zambia one bread winner is known to take care of at least ten members of the extended family hence the reason the 4000 displaced and disposed marketeers represent thousands of impoverished Zambians that shall sink further into poverty by President Hichilema´s heartless action.

And CF president Harry Kalaba, speaking before a crowd of the Munyaule victims gathered said, “we sympathise with our people our suffering people that have lost property here twaumfwa ubulanda (we feel pity for the victims) and we feel saddened at the fact that the government cannot empathise with suffering Zambians given the brutal action they have taken to demolish your stores.”

Mr Kalaba a former cabinet minister wondered, “how will Zambians put food on the table, pay rent or take their children to school following the destruction of their property by the UPND this is not only heartless it is unacceptable and shows how uncaring UPND is because their (UPND) bellies are full as Zambians wallow in poverty.

Mr Hichilema in opposition promised to embrace marketeers and every Zambian earning a living outside the formal sector but his pre-election promise like many others seem to have changed. Several promises he made including reducing the prices of mealie meal and fuel have been broken.

The People versus Edgar Chagwa Lungu: a recurring reminder of the past

The People versus Edgar Chagwa Lungu: a recurring reminder of the past

By Prof Munyonzwe Hamalengwa

Clank! The loud noise of iron metal door banging loudly against metal roused him from his troubled sleep.

He flung his lanky upper body up. He had on a cold sweating white Tshirt clinging to his body. Through the white curtains at the far end of his room, he could see steel metal bars. He let out a horsy loud cry, “Oh, my God, oh my God!” Esther came out of the washroom rushing towards Edgar.

Esther: Edgar what is it?

Edgar Chagwa Lungu: Esther, I had that recurring nightmare again that I was in prison. I woke up with a start and those metal bars looked like those bars in prisoners’ cells. And I heard a loud noise like a prison door closing. Esther, this nightmare was so real. You see, people dream a lot about the past but this is about the future. It is like I can foretell my future. Esther, it is scary.

Esther: This dream has been with you for sometime.

Edgar got out of bed and sauntered to the window. He opened the curtains. It was a bright sunny morning outside. He looked up and could see the beautiful Table Mountain not far from his hotel in Cape Town. He was not in prison. He was in a beautiful hotel in Cape Town. He remembered he and Esther and others had landed last night to attend a conference at the Cape Town Convention Centre. The conference was entitled, “Africa’s Last Stand Against the International Criminal Court”.

Edgar: Esther, I wonder if this nightmare has anything to do with the theme of the conference. This ICC thing is targeting African leaders. Given Lubinda surveyed Zambians and they overwhelmingly supported the idea that we remain in the ICC. And I have to report at this session about Zambia’s reaction to Africa’s fear.

Esther: You need counselling, Edgar. You should discretely ask your friends if there are any therapists they know who can help with allaying that recurring nightmare, Edgar. It is affecting my life too.

Edgar started laughing.

Edgar: Esther, do you know what kind of friends I have? These are hard skinned toughened political operatives some of whom fought guerrilla wars and a bullet could be expected any minute from anywhere during their years. Do you think Jacob Zuma is the type of person who can seek counselling? He avoided bullets from the agents of Apartheid throughout his life. Counselling is the last thing on his mind. Look at Kagame and Museveni. They fought in the bush for years, expecting to be killed any moment. They don’t know the word counselling. They will think I am a cry baby. I never suffered for my country. They did. Look at Joseph Kabila with whom I will be having a private coffee session immediately upon arrival at the conference, he allegedly killed his father; he doesn’t seem to have any nightmares.

Esther: Then what do you suggest you do because I get troubled every time you have these nightmares and they seem to be getting worse and worse as time goes on. Tell, me what was involved in this one, Edgar? I will hear you as I make the coffee. Do you want a massage first or I just make the coffee. Maybe you should do your treadmill as well. It is right at the corner there. You also didn’t finish your Jameson last night. What is going on, Edgar?

Edgar: Sit down Esther. This nightmare was so real. The last words I heard before the clanking of the prison gate was judge Banda-Bobo’s words and I remember the words clearly stating, “Accordingly, immunity is revoked and the various heads of charges against you will proceed”. Flashes of images jammed my brainwave in competition for prominence. I saw the image of Chiluba sitting alone in the accused’s box in court and that image is on the cover of Richard Sakala’s book on Chiluba. Chiluba who had all these friends was sitting alone in the prisoner’s box, Esther. There was also a similar picture of Zuma sitting alone in the prisoner’s box after he left power. Alone, Esther! Another book cover imposed itself with the title “Prosecuting Heads of States” and several heads of states were on the cover including Charles Taylor, Saddam Hussein, Milesovic, Pinochet and others. But, Esther, the most disturbing was a flash of an article on the front page of The Post newspaper and I could see the date clearly, April 27, 2015 and it blared,”Lungu Won’t Escape: His Immunity Will Be Lifted Immediately He Leaves Office – UPND”. You see why I closed The Post, Esther? They were a formidable enemy. The Post destroyed Rupiah Banda. The Post emboldened Michael Sata. They helped him win the presidency. They were going to spoil my victory in 2016. Regarding the UPND, they are so stupid, how do you disclose to your enemy what you are going to do to them when you replace them? I had to…

Esther puts her finger to her mouth as if zipping the mouth, as she is looking at Edgar.

Esther: Edgar, don’t start revealing all that information. This hotel room could be bugged. The South Africans are much more friendly to HH, you know. Be guarded. Don’t vent now. Shish Shishi Shishi.

Edgar: I am not revealing any information about the killing of any political opponent though the thought has occurred to me. And I have rejected some advice from some of my political advisors to start killing political opponents. Zambians don’t kill. If there is any legacy that our founding fathers left us with, it is not to kill political opponents. You could isolate them in jail like I tried to do with HH. Nkumbula and Kapwepwe were not killed. Chiluba was not killed. Sata was not killed by Mwanawasa or RB. I won’t kill HH. I will use other means. I have already used other means.

Esther again motions by way of zipping her mouth. Esther: Stop that Edgar, if you lose your immunity in future, they could use the evidence that they will gather from this room.

Edgar: Esther, I am not revealing to you any criminality. Right now I am immune from any civil or criminal prosecutions here in South Africa and in Zambia. I was just going to tell you so that you don’t lose sleep at night. I have already fixed HH, legally, that is. I appointed Irene Mambilima as chief justice immediately after she announced my victory in 2015. She was not going to rule against me in any future election. But I changed tactics and reorganised the judiciary and changed the Constitution. I appointed all the new judges, hand picked them, qualified or not qualified. Do you think handpicked judges who don’t go through the rigorous vetting process like that of Kenya and South Africa can overrule the President? There is no decision, Esther, that this government has lost since appointing all these judges. I also removed the DPP Mutembo Nchito who posed danger to my office. Almost all appointments across the board that I have made are from either the northern or eastern parts of the country. I may have made some from outside these areas to mislead or as accidents.

Esther: Edgar, now you are talking. That is my man. You are not as stupid as people think you are. Why do you think I married you? Brilliant. Sometimes you scare me with your careless statements at airports. I can’t figure that one out, Edgar. Do you get carried away when you see a plane? But, it is very good you have never sat down to give a press conference and then to be, what word can I use, cross-examined by the press. Trump gives a lot of those press conferences. I used to like Obama’s press conferences. I think you should start doing that, Edgar. After all these years in power, you now have a vision. But how Zambians voted for you after admitting you had no vision mystifies me. And how they still live you without giving any cross-examined press conferences to show your grasp of Zambian realities bamboozles me.

Edgar: Esther, I told you that we are safe and I have fixed everything. Tasila doesn’t call me The Fixer for nothing. What I fix is permanent. I fixed the 2015 and 2016 elections. They may in future find where we buried the UPND votes but it won’t then matter. This KBF fellow is a danger if he writes a book about how I fixed the elections.

Esther: On that I completely agree. Pour it out my man.

Edgar: You see, with the presidential election petition, when I saw that I may lose, I took the advice of the lawyers and Chilufya Tayali and closed the court on a so-called technicality. I could have lost that petition and I would be in a jail cell somewhere. The same with the third term, we knew Simbyakula messed up the drafting of the amendments. We knew it prohibited me from running again. It is clear. When I saw that I could lose that, I appointed Musaluke as the seventh Constitutional Court judge to rescue me. Are you with me, Esther? And you know what, we are the sponsors of the case that decided the third term but we let the lackeys, some so-called opposition parties that in fact we have created and sponsored them to move the court. But we started it. The same thing we have done with the National Dialogue Forum. We told Given Lubinda to start talking about lacunas in the Constitution that we needed to refine. And most respectable organisations joined the bandwagon of refining the Constitution. We hired some student cadres and political rejects and look at where we are now. On the verge of changing the Constitution in our own image! Look, even at the KCM/Vedanta liquidation case, I have already pronounced that we will liquidate the company and sell it to the highest bidder and we pay some debts. Every judge knows what I want. You see, when The Post and Hansungule used to say that whatever Edgar wants, Edgar gets, they are right.

Esther: We discussed all that, Edgar, with some of your colleagues. Edgar, you are so good at using the law, what do you call it, arms-length or what? The law talks but you are there manipulating it behind closed doors. Edgar, I am so proud of you. You don’t have to use force, kill or poison people as some of your advisors want. You have learnt a lot, Edgar, from Museveni and Kagame. You are more subtle and smoother than them. Edgar, there was this song I used to like by a Black Nigerian-British singer Sade called “smooth operator”. You and I used to like that song, smooth operator. Edgar you are a smooth criminal. You can’t catch a smooth criminal, Edgar. No fingerprints at the scene of the crime. Edgar, I think you should teach at Harvard after leaving power. I think we should spend several years in Eastern United States later.

Edgar: That is it Esther, but I am not done with power yet. I am staying till 2026. By that time, no one will still be talking about stripping me of my immunity. There will be a one party state by then through this NDF that I have created. The UPND will be moribund by then. Kambwili will be in jail. HH will be heading his by then over one million cows all over Zambia and totally uninterested in politics. They allege that I have stated that a Tonga will one day be present but not HH. Esther, did I say that? I don’t remember. I say a lot of things at airports before boarding a plane to escape being questioned by reporters. I am like Reagan, I have to be protected from my own mouth, otherwise I will state the truth as I know it.

Esther: I look forward to living in the US, Edgar. The trips I have made are too short. I want a big break and walk around incognito, Edgar. We have made our money. Our children don’t have to work a day in their lives. Edgar, let’s leave in 2021. Hand over power to Davies Chama. He will take care of your legacy. There is no one else, is there? Davies Mwila would split the country. I have my own fears, Edgar. It is better to leave power on your own motion and volition and not be pushed out like Mugabe or Mbeki and Zuma. Emulate Mandela, Edgar.

Edgar: Esther there are some people who don’t want me to leave because they benefit tremendously. This power doesn’t belong to me alone. I am beholden to people. Look at the 48 houses that have no owner. How can that be in a country like Zambia where houses are accounted for? The ACC can’t find an owner. All these people and more depend on my presidency to cover such implausibles. I am under pressure to fire the entire ACC to save face. I have gut feelings that these 48 houses will backfire mightly in the future. This is not sitting well with Zambians. They think the houses are mine or our children’s or yours or some political operative acting under my superintendency.

Esther: I have been following that story. No one, not even the ACC agrees with what has happened. Someone will eventually talk, Edgar. It is scary, Edgar.

Edgar: But something deeper is worrying me, Esther. This nightmare I had this night. It was so real. I dreamt that Siyunyi the DPP that I appointed had recommended that I be denied bail. She said I was a flight risk, that I had a private jet, that I had plenty of money, land, houses and friends abroad. She pointed out specific places and friends, Museveni, Kagame, the King of ESwatini. She said because of my money I would interfere with witnesses and obstruct justice. She said I was a danger to the safety and security of Zambia. She played a tape which stated that I once said the following: “we didn’t get the vote in 2015, we didn’t get the vote in 2016 but we are still here. If we don’t get the vote in 2021 we are not moving out.”

She said I was plotting rebellion and have committed treason by allegedly rigging the election of 2016. She said I should have long been impeached for breaching the Constitution severally by refusing to step down and handing over power when there was a presidential election petition filed, by threatening judges in my speech at Solwezi airport and by commenting on matters still before the Court. She said I am a tribalist-in-chief and my Tribalist statements can lead deranged PF cadres to start committing Genocide particularly against the TongaS. She said a lot of things in there. She applied for stripping of my immunity and immediately the judge stripped my immunity I heard the prison gate close with the bang CLANK, which woke me up.

Esther, she was reading a document marked, The People versus Edgar Chagwa Lungu. I saw it clearly.

Esther: Edgar, you are The Fixer. Nothing is impossible with you.

Edgar: Esther, In the dream, I couldn’t get hold of any lawyer. They all gave excuses. I am thinking of representing myself.

Esther starts laughing at the mention of self-representation by Edgar.

Esther: If this nightmare becomes reality in the future, Edgar, don’t represent yourself. What do they say: a lawyer who represents himself has a fool for a client. Edgar, you can’t give a press conference with all the briefings you get and you are not in custody , how could you possibly represent yourself from a jail cell? Spare the country the drama. Let’s leave in 2021 without being pushed. It is not too late to emulate Mandela.

Edgar: Esther, I am scared of the title of the proceedings I saw in the dream: The People versus Edgar Chagwa Lungu.

SPEAKER NELLIE MUTTI’S CONSTITUTIONAL BREACHES MUST END……BEFORE SHE PLUNGES OUR COUNTRY INTO CHAOS- UKA

SPEAKER NELLIE MUTTI’S CONSTITUTIONAL BREACHES MUST END……BEFORE SHE PLUNGES OUR COUNTRY INTO CHAOS
4th April 2024

COURT UPDATE – THE PEOPLE VS BATUKE IMENDA

SEAN TEMBO
COURT UPDATE – THE PEOPLE VS BATUKE IMENDA

Lusaka, 4th March 2024

The matter in which the UPND Secretary General Mr. Batuke Imenda is charged with Hate Speech for referring to the Archbishop of Lusaka Dr. Alick Banda as “the Lucifer of Zambia” came up for a hearing today, Monday, 4th March 2024 before Lusaka Magistrate Hon. Chanda in Court 10 at 10hrs.

The Complainant, Mr. Sean Tembo informed the Court that he had not yet received any correspondence from the DPP regarding a decision on whether the Complainant can proceed to privately prosecute the matter or not. In the last correspondence which the DPP made to the Complainant, he had demanded for evidence proving that the Accused had indeed committed the alleged offense. The Complainant proceeded to provide the DPP with the requested evidence in audio-video format and also indicated that he has four witnesses lined up, who are willing and available to testify in Court against the Accused Batuke Imenda. The DPP then went quiet and has been quiet ever since.

During today’s hearing, in addition to his Counsel Mr. Larry Njungu, the Accused Batuke Imenda engaged two additional Counsel from two different law firms, being Counsel Senzo Zaza and Counsel Timothy Munalula. The Complainant Mr Sean Tembo continued to represent himself.

Counsel for the Accused Batuke Imenda made an application before Court to have the matter referred to the Constitutional Court for determination of alleged constitutional issues. The Complainant Mr Sean Tembo opposed the Accused person’s application on the basis that there are no constitutional issues that require determination by the Constitutional Court, and that the issues raised by the Accused in his application are simply challenging the procedure to be followed for criminal matters brought to Court by way of complaint under Section 90 of the Criminal Procedure Code Act, Cap 88 of the Laws of Zambia, and that the said issues are not constitutional in nature.

The Complainant also argued that the issues raised by the Accused person in his application to have the matter referred to the Constitutional Court where previously raised in an application to raise preliminary issues that the Accused filed before Court on 22nd January 2024 and that the Court dismissed those issues in a ruling delivered on 8th February 2024, and that therefore the application to raise constitutional issues amounted to a de facto appeal using the back door of the ruling rendered by Court on 8th February 2024 and that it therefore amounted to an abuse of Court process by the Accused Batuke Imenda.

The Court has reserved ruling on the Defence’s application to stay the matter and refer it to the Constitutional Court for determination of alleged constitutional issues, to Monday, 18th March 2024.
