Judge Situmbeko Chocho rules that Hon. Mundubile must join himself to the earlier case of Raphael Nakacinda Vs. Miles Sampa, refuses to grant him Injunction

COURT DECISION
5.1
The clear and undisputed facts are that the 2nd Defendant (Miles Sampa) did call
for an Extra Ordinary Convention at which he was elected The Party
president, it is not for me at this point to consider the alleged
illegality of the calling and undertakings of the said convention.

5.2 The facts surrounding this matter are similar to the facts under
cause 2023/HP/1866, which cause is before this Court. I find that
the issues, facts and most importantly question of the provisions of
the Patriotic Front Party Constitution, the alleged illegality of the Extra-Ordinary Ordinary Conference Convention are similar in the two
matters/ actions.

The relief claimed in both these matters arise out
of the same transaction or event.

5.3 The circumstances of the matters make it difficult for me to order for the consolidation of the matters without the consent of the
Parties by reason of the existence of the following points/issues;

1. Different Law firms representing the Plaintiffs and Defendants
in both matters.

2. The Party as Plaintiff in the Cause 2023/HP/1866 is actually
a Defendant under this cause.

Be that as it may, I shall pursuant to Order 4 Rule 9 of the Rules of
the Supreme Court (1999 Edition) and Order 3 Rule 2
of the High Court Rules Cap 27 of the Laws of Zambia, order the
Stay of the proceedings under this Cause 2023/HP/1899 pending
the determination of Cause under 2023/HP/1866.

6. CONCLUSION
With the above in mind I cannot consider the application for an
Injunction in this Cause. Staying these proceedings in view of the
other matter under cause 2023/HP/1866 is NOT prejudicial but meant for orderly discharge of justice.

I must for the record state that Counsel owes a very important and cardinal duty to the Court and should not be seen to aid
Parties/Clients in abusing Court process or indeed withholding
critical information from the Court.

The relief of Injunction is an equitable relief and it is a basic yet fundamental principle that he who comes to equity must come with clean hands.

An injunction as an equitable remedy cannot be
employed in a manner that encourages a multiplicity of actions.

In conclusion the following is my decision or Order:

The proceedings under Cause Number 2023/HP/1899 is hereby stayed pending the determination o f Cause
2023/HP/1866.

The Plaintiff is at liberty to apply for
joinder under causc 2023/HP/1866.

6.4.1.2 Costs in the cause.

PF MPs DELIVER STRONG MESSAGE TO BRITISH, EU AND US MISSIONS

PF MPs DELIVER STRONG MESSAGE TO BRITISH, EU AND US MISSIONS.

……warn them against their continuous funding of the UPND to Mutilate the Constitution and Multi Partyism.

Lusaka…….Friday, November 3, 2023. [SMART Eagles]

Opposition Patriotic Front Members of Parliament have warned the British, European Union and US Missions in Zambia of Consequences if their alleged support to the UPND towards Mutilating the Constitution in the Country Continues.

The MPs who visited the mentioned missions are concerned that the country will degenerate into Chaos if the cooperating partners in question back the UPND in disregarding the Rule of Law and drive the agenda of a one party state.

Speaking on behalf of the lawmakers, Lukashya MP Hon George Chisanga said the feedback from stakeholders is strongly suggesting that the EU, US and the British embassy are conniving and funding what the UPND government is doing.

Hon Chisanga said it was therefore cardinal to deliver a message that the Zambian people are increasingly becoming exabarated and would take things in their own hands.

“They have decided that maybe we the Members of Parliament are not doing enough to ensure that Parliament is properly managed and the constitution is being respected. They have said that if this continues. They are going to take things in their own hands. We are aware that they are the ones who have a programme with Government in terms of the reforms they want to do,” he said.

Hon Chisanga said the Zambian people are of the view that they would not be held responsible of the Chaos that would follow if the disregard to the rule of law and breach of the constitution continues.

“Our concern is informed that if the people take things in their own hands, everyone will be affected. If you see what happened today in Parliament even the law has been mutilated. We want to ask our Collegues to pay attention to what the people are doing.
The People believe that the UPND are working with their cooperating partners to achieve the ends that they want to achieve,” he said.

KITWE TEACHER LEFT IN TEARS AFTER BEING GIFTED NEW CAR BY FORMER PUPILS

A Mr. Kalembo Fredrick from Kitwe today failed to lift his shoe and make a step after his former pupils from Parklands showered him with so much love.

According to the information available, Mr. Kalembo, who is now clocking 33 years in service, is known to be one of those teachers you cannot hate. He is loved by almost everyone except for a few teachers who get offended when he is praised in their presence.

Today, a team of former pupils, 2005 intake, surprised Mr. Kalembo with a new car and money amounting to K30,000. The scene left everyone in tears especially those who have known him for a long time.

Mr. Kalembo sold his car five years ago to school his only daughter and later got a huge loan to to make sure the life of his daughter was secured. His wife died in 2015 and since then everyone has considered him special because of his dressing and allegedly talking to himself.

The former pupils led by their head boy, who is now an important man at Kansenshi Mine, today visited their former school to encourage the grade 12s who shall start their exams on Monday and gift their former teacher a new car as well as help him to start a business.

The people near him including the former pupils could not hold it they were already shedding tears…Mr. Kalembo, this is a small token to say thank you. You shaped and made us who we are today said the former head boy and embraced him.

Meanwhile, Kitwe residents have said they have never witnessed a miracle and wonder if they will ever witness a sweet thing like this.

Teachers should be appreciated they sacrifice too much!

Devon Oil Fails To Challenge Media Inquiry Why Their Contract Was Cancelled After Ministry Of Energy Gave The Side Of Their Story

0

By CIC Investigations.

DEVON OIL FAILS TO CHALLENGE MEDIA INQUIRY WHY THEIR CONTRACT WAS CANCELLED AFTER MINISTRY OF ENERGY GAVE THE SIDE OF THEIR STORY.

CIC took interest in the ongoing saga that is implicating Energy Minister Hon Peter Kapala who is being accused of cancelling the supply of cheaper fuel from Devon company and agreeing to buy from Agro Fuel at a higher price.

Ministry of Energy said that its true a company called Devon expressed interest to supply fuel at a cheaper cost than Agro and government in quest to find cheaper and affordable fuel considred them and gave them a contract and later cancelled it. He said as Ministry they do not deny cancelling the contract because it was abrogated by Devon themselves for failing to meet the agreed requirements in the contract. Hon Kapala said that he has no apology for protecting Zambia from a bad deal oiled in a cheap fuel face with compromised documents and lies.

Speaking to CIC when they paid a curtesy call on his office yesterday to get facts of the matter, Hon Kapala said the deal that was given to Devon to supply cheap fuel was valid for one month only and they where told to supply by 26th September 2023 their fuel ought to have been in the TAZAMA pipeline.

He said Devon was asked to bring 30% bond performance (equivelant to surety) so that incase of anything government can cash in to recover the lose in an event the deal does not go well and to avoid government losing money. He explained that bond performance is kind of a surety because alot of money was involved in the deal. He went further to say that Devon lied that they have fuel to be available within the specified time agreed in the contract yet their ship had not even docked and they never secured their birthing slot in Tanzania, that government went out of its way to contact Tanzania government if they could priotise Devon to ofload their fuel but where told the ship is not there. That government even helped to secure the birthing slot for Devon thinking the ship is there because they couldn’t secure themselves yet their ship was not there and the Tanzanian side confirmed not seeing their ship at the harbour.

He revealed that the 30 % bond performance document was brought 2 weeks later and not signed by the owners of Devon only the insurance company signed on it making it not only useless but worthless to the government because the amount in it was lower than the agreed value and that being the first time Ministry of Energy was doing business with Devon it was not worthy doing business with them if they couldn’t produce the sensible bond performance as requested by government that has value to what they claim to supply.

He said Devon can not complain of the contract being cancelled because they where told by 26th September the fuel should be in the pipeline if later than that then no deal yet their fuel was ready by 28th October 2023 that government couldnt risk the shortage in the country as it is an economic and security risk hence opted to give the contract to Agro fuel who where ready and their consignment ship was in place.

On the amount, Hon Kapala said the difference in question is not that much but the key issue is that government cancelled the Devon deal not because it was cheaper to opt for Agro Fuel as they are saying is expensive but because their bond performance amount value was lower than the amount agreed and it was delivered 2 weeks against the stipulated time frame with no signatures of the owners of Devon making worthless and useless (he insisted).

Hon Kapala said he does not care about the media propaganda being sponsored against him because his ministry acted in good faith and he stands by that. He said Devon fuel came very late when the contract was already cancelled and TAZAMA could not alllow them to load because another deal was already in force.

CIC contacted Devon company through their managing Director Mr Chombe Gondwe asking him to challenge the ministry if at all Hon Kapala is lying towards the events that led to the cancellation of the contract but he could neither deny nor confirm other than otpting to remain mute and said there will be a press briefing slated for yesterday and that CIC was invited. CIC waited for the invitation of the presser the entire day only to hear that its been cancelled. CIC pressed Devon further to give details of their bond performance documents and explain what was agreed in the contract terms and time they where told to supply and agreed vs the time fuel actually came alas the Managing Director remains mute and not picking calls.

Hon Kapala has stood his ground and advised OMC president to ask Devon for the whole story before calling for his dismisal that no amount of propaganda no matter how many people will be sponsored to speak against him will make him do the wrong thing against Government’s proceedure and that he welcomes ACC or any investigative wings to check the procurement process and see if they did anything wrong. He said if Devon was genuine why are they not telling the nation why they failed to bring the bond perfornance document in time and not in 2 weeks, why are did they not sign it and why did they lie that they have fuel to supply in that period when they knew they don’t have at that time. He challenged the media house reporting against him to get full information from both sides. He went on to say politics at hand coupled with propaganda must not make people to jump into conclusion simply because someone said its cheap fuel when it was a bad deal.

CIC deeper investigations revealed that Devon leaderships include former State House Political Adviser Mr Kaiser Zulu.

China has Belt and Road, now the US has the Lobito Corridor from Angola to Zambia

China has Belt and Road, now the US has the Lobito Corridor from Angola to Zambia

By Lenin Ndebele

The Lobito Corridor has become the G7’s major Partnership for Global Infrastructure and Investment (PGI) project in Africa.

Six months have been set aside for the feasibility study, and the aim is to finish construction in five years.

The project could see US and Chinese private firms working together.

In about five years, the Group of Seven (G7) countries aim to have completed what is arguably a response to China’s Belt and Road Initiative (BRI) investments in Africa.

The G7’s flagship in Africa is the Partnership for Global Infrastructure and Investment (PGI) project, the Lobito Corridor.

The feasibility study for the project is expected to start by year-end, but construction should be done within the next five years, said the acting special co-ordinator for the Partnership on Global Infrastructure Investment, Helaina Matza.

“We want this rail to be built within five years. That’s complicated for any large-scale rail project, let alone one that’s crossing multiple jurisdictions,” she said.

The Lobito Corridor and the Zambia-Lobito rail line will stretch from southern Africa to central Africa.

It will cut across Zambia, Angola, and the Democratic Republic of the Congo (DRC).

The project involves building 260km of primary feeder roads and about 550km of rail line in Zambia, spanning from the Jimbe border to Chingola in the country’s copper region.

After the project is completed, it will expand an economic corridor that connects the host nations with global markets, promoting regional prosperity and trade as well as the common goal of a connected, open-access train that runs from the Atlantic to the Indian Ocean.

In July this year, Zambia, the DRC, and Angola came together to sign a memorandum of understanding (MoU) on how to revive the corridor that is set to be the shortest and fastest way to port from the major mining districts.

A consortium led by multinational commodities trader Trafigura will run the R10.5 billion railway project.

This presented an opportunity for the United States and its partners (G7) to be part of a promising project.

As such, on the sidelines of the 2023 Global Gateway Forum in Brussels, Belgium, last week, the African Development Bank (AFDB), the US, European Commission, Zambia, Angola, and the DRC signed another MoU outlining the partners’ intentions to collaborate across multiple sectors to realise the full economic potential of the corridor.

The US is already doing infrastructure work in Angola; therefore, it made sense to jump on the opportunity to work on the full Lobito route.

“When we found the opportunity to support the work that the DRC Government, the Angolan Government, and the Zambian government had already decided they wanted to do in their tripartite agreement, which they very serendipitously signed on 4 July this year, we wanted to make sure we were doing everything we could to help with those efforts.

“And we had some early PGI success in Angola, where over the course of the last year this initiative has been in motion for a little over a year and a half; our implementation team has been around for about nine months, and now we have a full team on the US side doing this work,” she added.

Matza said it was an American policy to “focus on these important economic corridors that promote connectivity, that allow us to layer investments across the telecoms space, the energy space, and then, of course, supporting the development of rail and ports.”

This is a direct challenge to China’s BRI, largely viewed as an unsettling extension of China’s rising power.

It will be impossible to avoid working with China on the Lobito project since Mota-Engil, partly owned by China Communications Construction Corporation (CCCC), signed an agreement to run the Lobito Corridor as part of a consortium led by Trafigura.

Nipsey Hussle’s assets valued at over $11M to be equally split between his two children

0

Nipsey Hussle’s total assets, valued at over $11 million, will be equally split between his two children Kross, 7, and 14-year-old Emani after they were declared the deceased rapper’s sole beneficiaries.

Hussle, born Ermias Asghedom, was fatally shot outside his Marathon Clothing store in his South-Central Los Angeles neighborhood in March 2019. In the wake of his death, his brother, Sam Asghedom, legally became the administrator of the late rapper’s estate, Face2Face Africa previously reported.

Per PEOPLE, recent court documents revealed Kross will receive 50% of cash and non-cash assets that will be transferred to his mother and the Victory Lap rapper’s ex-girlfriend, Lauren London. They have also been awarded an extra $113,000 as reimbursement for expenses spent on Emani’s “health, education and other matters.”

Samiel Asghedom and his family were awarded the other 50% of assets on behalf of Emani as they are the 14-year-old’s legal guardians. The assets, according to PEOPLE, include a 2012 Chevy Suburban, 100% membership interest in All Money Inc, 100% interest in Marathon Studios, 100% interest in The Marathon Touring, 100% interest in The Marathon Clothing Inc and the deceased rapper’s trademark portfolio. Other assets include additional companies and businesses.

Hussle and London had been dating since 2013 when he was fatally shot. In an appearance on PEOPLE Every Day podcast in January, the 38-year-old actress touched on how she has been dealing with her former partner’s death.

“I have to wake up with the intention of this every day because there are days I don’t want to, and I’m like angry about it,” she said. “And that’s what healing is. It is up and down, side to side, all over the place. You know what I mean? And with each new level, there’s something else.”

In February, the deceased Eritrean-American rapper’s killer, Eric Holder Jr., was sentenced to 60 years to life in prison after he was found guilty of first-degree murder last July for fatally shooting Hussle, Face2Face Africa reported.

Superior Court Judge H. Clay Jacke gave Holder’s sentence in a Los Angeles courtroom after hearing from one of Hussle’s friends and reading a letter from Holder’s father. Holder was also found guilty of two counts of attempted voluntary manslaughter after two others were injured in the shooting.

At the start of his trial last June, prosecutors told the court that Holder’s actions were planned and premeditated. Deputy District Attorney John McKinney alleged Holder was well aware he was going to take the rapper’s life. Hussle was struck at least ten times, McKinney said, adding that Holder also kicked the Racks in the Middle rapper’s head before fleeing the scene.

McKinney said the two men had gotten into a dispute after Hussle was made aware of Holder being a snitch. McKinney said the rapper had intended to “clear that up,” per The Associated Press. And prior to the shooting, the prosecutor said Holder together with Hussle and two of his friends had a “cool conversation.” Hussle was said to be without any security when he went to his store.

Ashling Murphy: Murder allegedly alleges masked guy killed Ashling

0

The man who is blamed for killing Ashling Murphy said in court that someone he didn’t know, who was wearing a mask, attacked him and killed the 23-year-old teacher.

Irish broadcaster RTÉ said that he admitted to lying to the Irish police and claimed he doesn’t remember confessing to her murder.

Jozef Puska, a 33-year-old man from Lynally Grove, Mucklagh in County Offaly, is on trial at Dublin’s Central Criminal Court for the murder of Ms Murphy. However, he claims he is innocent and is testifying in his own defense.

Ms Murphy was attacked and killed while running near Tullamore on 12 January 2022.

Mr Puska said that the person who attacked him was wearing dark clothes and a mask on their face.

He said that a man yelled at him in English, but he couldn’t understand him and didn’t know why the man attacked him.

He said that a man stabbed him in the stomach. Then he saw a woman show up, and the man attacked her.

Mr Puska said he did not hurt Ms Murphy and continued to say that he tried to assist her with her injuries. However, he left the area because he was feeling overwhelmed and frightened.

He said he fell into a hole and passed out for several hours.

Mr Puska said he couldn’t remember admitting to killing her in the hospital two days later in court.

He said he doesn’t remember what happened on the day he confessed, but he admitted he may have talked to the police about his family.

He confessed to telling false information to the police, including getting stabbed in Blanchardstown, because he was worried about his family’s safety. He said to Judge Hunt that he didn’t want to inform his family about the attack in Tullamore because he was afraid they would look for the person who hurt him.

Mr Puska said he didn’t run away to Dublin from Tullamore and he said he didn’t purposely change how he looks.

He said he frequently had difficulty remembering some things, and he was telling the truth, not lying.

He denied the accusation of following women in Tullamore and said that he couldn’t do that because he is married. He also said he didn’t scare Anne Marie Kelly, who spoke in court before, and he just glanced at her.

Mr Puska asked for his clothes to be thrown away because he had not seen them again.

Ashling Murphy was alive when Mr. Puska was with her, but he could see that she was dying.

He said he didn’t know how to help her because he didn’t have any medical experience. Then, he left and stayed hidden in a ditch for four hours because he didn’t have enough energy to keep going.

When someone asked Mr. Puska if he was the one who stabbed Ashling Murphy 11 times, he replied, “No, it wasn’t me. ”

Lawyer Anne-Marie Lawlor argued that Ms. Murphy scratched him in an attempt to protect herself, and his DNA was found underneath her fingernails.

He said that Ms Murphy had gloves on and any DNA found near her could be explained because he was near her.

“He said it is strange. ”

Mr Puska said he was being honest about what he remembered, but Ms Lawlor said he had always lied during the investigation and was still lying on Friday.

The trial is almost finished, and there is only one more person left to give their testimony. After that, the lawyers will make their final speeches. It is likely that the jury will start discussing and making their decision by the middle of next week.

Senate authorises US Navy’s first female commander

0

The Senate has agreed that Admiral Lisa Franchetti should become the leader of the US Navy.

As the head of the Navy, she is the first woman to join a special group of high-ranking military officers called the Joint Chiefs of Staff.

Her appointment was accepted with a vote of 95 in favor and 1 against, as the Senate made an effort to fill important positions in military leadership.

A senator from the Republican party is trying to stop the appointment of military personnel because they disagree with the Pentagon’s policy on abortion.

The person is a 38-year veteran of the Navy. They used to be in charge of the US 6th Fleet and US naval forces in South Korea, and they also commanded a group of aircraft carriers.

President Joe Biden nominated a woman for the first time to lead a military service branch of the Pentagon.

The US Coast Guard is led by a woman named Admiral Linda Fagan. However, instead of being part of the Department of Defense, it falls under the Department of Homeland Security.

Senators also took up two other important positions.

General David Allvin became the top officer in the US Air Force and Lt Gen Chris Mahoney became the second-in-command of the Marine Corps. This happened quickly because the Commandant of the Marine Corps had a heart attack.

Alabama Republican Senator Tommy Tuberville has been stopping the Democrat-led Senate from approving almost 400 military promotions for the past nine months. He opposes a Pentagon policy that covers the travel costs of service members who need to go to another state for an abortion.

On Wednesday night, the Republicans disagreed with him for the first time and loudly stated the names of 61 people to vote on each one separately, which went around his refusal.

Alaska Republican Dan Sullivan criticized Mr. Tuberville for punishing the careers of US troops. He mentioned that these soldiers had nothing to do with a policy dispute and had no authority to resolve it.

Many military officials and lawmakers believe that he is endangering the safety of the United States during the wars in Ukraine and the Middle East.

Senate Majority Leader Chuck Schumer said in a statement that both groups need to cooperate to make sure our military is fully ready and has all the resources it needs to protect the American people, especially during this difficult time.

Secretary of Defense Lloyd Austin said he is happy that some job assignments have been approved, but he also said that the extremely long wait to confirm our military’s top leaders has harmed our military’s preparedness and created unnecessary burdens on military families.

“He said in a statement that these individuals are excellent leaders who have served their country for many years. He is confident that they will continue to be great leaders of our group as they address the important national security concerns we face during these difficult times. ”

However, we still have over 370 highly qualified leaders who have had their nominations delayed for no good reason.

Apple’s revenue falls to $89.5bn in three months

0

Apple has experienced a decline in sales, despite robust demand for its iPhones and services, including the streaming platform Apple TV+.

The technology company reported a 1% decrease in revenues, amounting to $89.5 billion (£73.3 billion), for the three months ending on September 30, in comparison to the corresponding period of the previous year.

Sales of its Mac computers and iPads faced challenges following a surge in interest post-lockdown. This marks the fourth consecutive quarter where Apple has observed a decline in year-on-year sales.

In an investor update, Apple announced a record-breaking profit of $23 billion, driven by a new high in iPhone sales during the three-month period. The company also reported substantial earnings from services such as iCloud and Apple Music, generating $22.3 billion, which represented a 16% increase compared to the previous year.

However, Apple expressed concerns about potential supply chain disruptions that could impact the delivery of its new iPhone 15 Pro and Pro Max devices.

Apple chief executive Tim Cook said it was “working hard to manufacture more”.

“We do believe that later this quarter, we’ll reach a supply-demand balance,” he said.

Mr Cook said he felt the firm had its “strongest line-up of products ever” heading into the key Christmas trading period.

The most recent update indicates that certain Apple products have been struggling to maintain customer interest in recent times. For instance, sales of its Mac computers decreased to $7.6 billion for the quarter, down from $11.6 billion the previous year.

Apple unveiled its latest iPhone lineup in September during a highly anticipated event. During this event, it was announced that the iPhone 15 would no longer feature the company’s proprietary lightning charging port, a change that was enforced by the European Union. Instead, it now uses a USB-C cable, which is considered a “universally-accepted standard.”

Challenges have also arisen in other areas, including economic uncertainty affecting consumers in the Chinese market. Apple reported a 2.5% drop in sales in China, although CEO Tim Cook noted that, after accounting for foreign exchange rates, their business in China had grown year on year.

Cook made a surprise visit to China last month, where he met with gamers in Chengdu. This marked his second visit to China this year, which is a significant market for Apple. The company’s operations in China have been affected by pandemic restrictions and ongoing tensions between the US and China.

In March, Cook expressed that Apple had a “symbiotic” relationship with China, emphasizing its role as a key manufacturing base.

Australian woman accused of three killings amid suspected mushroom poisoning

0

A woman from Australia is believed to have killed and tried to kill several people, including her ex-husband’s relatives, by feeding them poisonous mushrooms. She has been charged with multiple counts of murder and attempted murder.

Three individuals passed away after Erin Patterson, who is 49 years old, cooked and served a dish called beef Wellington. Beef Wellington is a meal that contains mushrooms. This incident occurred in the month of July while Erin was hosting guests.

According to the police, three murder charges are connected to the lunch incident, while three out of five attempted murder charges are related to different incidents that occurred between 2021 and 2022.

Ms Patterson says she did not do anything wrong.

She said she did not mean to make her guests sick on purpose during the family lunch at her house in Leongatha on 29 July.

The toxicology reports show that the victims ate poisonous deathcap mushrooms.

Her ex-husband Simon Patterson was also asked to come to the meal, but he couldn’t make it in the end.

In addition to being charged with three murders, Ms Patterson has also been charged with two attempted murders for what happened during lunch in July.

The police have not given information about the two charges related to attempted murder. However, it is known that one of the people eating became very sick, but they did not die and got better.

Ms Patterson has been accused of trying to kill someone three times by giving them poisoned food in 2021 and 2022. No additional information has been provided.

The police suspect Ms. Patterson because she and her two children were unhurt after lunch.

On Thursday, she was arrested and the police spent a long time searching her house in Leongatha, which is about 125km (78 miles) south-east of Melbourne.

Special dogs that are trained to find things like laptops and Sim cards were present at the location.

Inspector Dean Thomas, who is in charge of the Homicide squad, spoke at a press conference about the case. He said that the case is very complicated and sad, and it may have long-lasting effects in the future.

He said that he cannot think of another investigation that has gotten so much attention from the media and the public, not just in Victoria but also in other parts of the country and the world.

Gail and Don Patterson, who are the parents of Ms. Patterson’s ex-husband, were at the lunch. Gail’s sister Heather Wilkinson and her husband Ian Wilkinson were also there.

Four people were brought to the hospital on 30 July because they were very sick, according to the police.

The Patterson couple, who were both 70 years old, and Ms. Wilkinson, who was 66 years old, died within a few days. Wilkinson, who is 68 years old, was very sick and had to go to the hospital. Thankfully, after two months of getting medical help, he got better and is healthy now.

Erin Patterson said that she went to the hospital because her stomach was hurting after eating. Doctors put a tube in her body to give her fluids and gave her medicine to protect her liver.

She said she used a combination of mushrooms she bought from a supermarket and some mushrooms she bought from an Asian grocery store a few months ago to make the beef Wellington dish.

“I feel really upset to think that these mushrooms might have caused my loved ones to get sick,” she wrote in a statement in August.

I want to make it clear that I had no intention of harming the people I loved.

Her kids didn’t come to lunch, so they ate some leftover beef Wellington the next day. But she said the mushrooms were removed from the dish because she doesn’t like mushrooms.

Ms Patterson also talked about a food dehydrator that the police found at a nearby dump. She confessed to owning it and said she got rid of it because she was very scared after the deaths.

She has been taken into custody and will go to court on Friday at Latrobe Valley Magistrates’ Court.

Mushroom cook attempted to kill his ex four times – Police

0

An Australian woman is being accused of killing three people by giving them poisonous mushrooms. Court documents also claim that she attempted to kill her ex-partner four times.

Erin Patterson, who is 49 years old, was accused of committing three murders and trying to commit five others on Thursday.

The murder charges are about a family lunch she held in July at her house in Leongatha, Victoria.

Ms Patterson is still saying she didn’t do it.

She went to court for a short time on Friday. Her case was delayed until 3 May because the prosecutors need time to look at her computer stuff that the police took from her home. She did not ask to be released before the trial.

There were about six TV crews waiting outside the hearing in a small town called Morwell, which is about 60km away from Leongatha.

But except for the cameras and curious people in the area, nobody saw Ms Patterson. She was taken from her cell in the police station to the court building through a tunnel.

According to court papers that were given to the local press on Friday, the police say that Ms. Patterson tried to murder her separated husband, Mr. Simon Patterson, on three different occasions from November 2021 to September 2022.

The supposed fourth attempt happened when she made a special meat dish called beef Wellington for his parents, Gail and Don Patterson, his aunt Heather Wilkinson, and her husband Ian Wilkinson, during lunch. Simon Patterson did not go to the meal.

Erin Patterson said she used both fresh button mushrooms from a regular store and dried mushrooms she bought from an Asian grocery several months ago to make the dish.

According to the police, all four of the people she invited to her house got very sick and had to go to the hospital.

Within a few days, the Patterson couple, who were 70 years old, as well as Ms. Wilkinson, who was 66 years old, passed away. Wilkinson, who is 68 years old, had a serious illness and had to go to the hospital. Luckily, he got better afterwards.

The police think that the four people ate death cap mushrooms, which can cause death if eaten.

Ms Patterson became a person of interest when she and her two kids were found without any injuries after lunch.

But she says she didn’t mean to make her guests sick and she went to the hospital after eating too and got medicine to protect her liver.

She wrote in August that she feels very upset to think that these mushrooms might have caused the sickness of her loved ones.

The police say that this case is very complicated and sad. They think it will have an impact for many years.

On Thursday, Homicide squad Inspector Dean Thomas said that there hasn’t been any other investigation that has received as much attention from the media and the public as this one, not only in Victoria but also across the country and around the world.

Donald Trump Jr. testifies in civil fraud trial in New York

The oldest son of former President Donald Trump said he did not help with the financial papers that are causing problems for the family’s property business in a court case about fraud.

Donald Trump Jr, who is 45 years old, seemed calm and laid back in court in New York City. He made some funny remarks and insisted that he had not done anything wrong.

His brother and sister, Ivanka and Eric Trump, are going to give testimony soon.

The judge has already said that the Trump Organization made its wealth seem bigger than it really was and lied about its business records.

The court case will decide what punishment should be given. Letitia James, who is in charge of the legal affairs in New York and belongs to the Democratic Party, wants to punish the former president with a fine of $250 million and prevent him from carrying out any business activities in New York.

Donald Trump Jr is the first of Donald Trump‘s children to provide information in this legal matter. Earlier this week, he went on the conservative Newsmax network and said that the trial was a fake and unfair court.

He and Eric Trump are both being sued together with their father. The two brothers have important positions at the Trump Organization.

Mr Trump Jr, wearing a blue suit and a bright pink tie, answered questions for a little more than an hour. His statement will continue on Thursday.

He started his presentation by talking about Generally Accepted Accounting Principles (GAAP), which are the rules and guidelines businesses follow to keep their financial records accurate.

Mr admitted that he didn’t know much about GAAP, except for some things he remembered from his college business classes.

When the state attorney asked him about his understanding of the topic, he made the courtroom laugh by saying, “I don’t understand anything. ”

“I let my accountants handle it,” Mr.

During the trial, Mr. Trump Jr apologized to the judge because he was talking too fast for the court stenographer to type everything accurately.

“I’m sorry, Your Honour, I moved to Florida, but I continued to live at the fast pace of New York,” he said jokingly.

He said in court that he had done “every single thing” while working for the family business. He’s not an accountant, though.

Mrsaid that his position in the company became more important after his father, who is a Republican and the president of the United States, was elected.

“He said that we no longer informed my father about the business decisions. ”

Both of Trump’s brothers were appointed as trustees of the company when their father became president in 2017, in order to prevent any conflicts of interest.

On Wednesday, someone asked Mr. Trump Jr if he had approved his father’s “statement of financial condition. ” He responded by saying that he did not remember doing so.

The afternoon in court was mostly quiet, but there were a few intense arguments between Mr. Trump’s lawyers and the New York attorney general’s team towards the end of questioning.

The lawyers asked Mr. Trump Jr if he helped make the company’s financial papers.

He mentioned that he depended on others to “create a document like this”.

The accountants were doing it. “He said that is exactly why we gave them money. ”
Mrinformed the court that the responsibility for the task was with Allen Weisselberg, a long-serving finance chief. Weisselberg had been charged in this case and admitted his guilt last year for committing tax crimes.

“I had to listen to the people who knew a lot about those things,” he said, and he trusted Weisselberg and his accounting team.

Judge Arthur Engoron, a Democrat from New York, is overseeing the trial and has already determined that Mr Trump is responsible for exaggerating his assets in order to obtain loans that were advantageous to him.

A short time before his son was going to speak in court, Mr. Trump posted on his Truth Social account: “Stop bothering my kids, Engoron. ” You bring shame to the job of being a lawyer.

Last week, the judge gave a penalty to the former president for breaking a rule twice. The penalty was $15,000 because he talked about a court worker when he wasn’t supposed to.

At first, Ivanka Trump was named as one of the people being accused in the case. However, she was later taken off the list and made to testify as a witness instead.

On Wednesday, Ms. Trump’s lawyers asked for the order to testify to be changed. She is supposed to testify on 8 November.

The person who used to be the president and is currently the top contender to be the Republican choice for president in 2024, is expected to give evidence on Monday.

Last week, he went to court to see his old lawyer Michael Cohen testify. Cohen said that one of his jobs at the Trump Organization was to increase the value of assets by using a number chosen randomly by Mr.

MrTrump is currently dealing with four criminal trials. These include cases in Georgia and Washington DC where he is being accused of trying to change the outcome of the 2020 election that he lost.

PF WRITES TO SADC OVER DETERIORATION OF PEACE AND SECURITY IN ZAMBIA

PF ALERTS SADC OVER DETERIORATION OF PEACE AND SECURITY IN ZAMBIA

…..charges that Zambia is on a dangerous descent into lawlessness

Lusaka… Friday November 3, 2023 (SMART EAGLES)

The Patriotic Front has written to the Southern Africa Development Community (SADC) over the deteriorating political and security situation in Zambia.

PF Secretary General Raphael Nakachinda says since the assumption of power in August 2021 by the UPND party in Zambia, there has been a steady and now a rapid erosion of civil and political rights of citizens leading to a very precarious political and security situation in the country.

This is in a letter dated 2nd November, 2023 addressed to His Excellency, Joao Lorenzo President of Angola & SADC Chairman.

“Your Excellency, we draw your specific attention to the fact that Zambia is unfortunately descending into chaos at a time when it has the special honor of presiding over the SADC Organ on Politics, Defence and Security (Troika), the very organ that must monitor any developments that may undermine law, order and create any sense of insecurity in any of the regional bloc’s 16 member-countries. Since August 2021, when the Patriotic Front (PF) party lost elections and handed over power in a free and fair manner as per the national statutes and SADC principles open free and fair elections and general observation of democratic principles, Zambia unfortunately seems to be on a regressive path towards the one party tendencies which the regional bloc has individually and severally rejected,” said Hon Nakachinda.

“The increasingly authoritarian regime of President Hakainde Hichilema has now begun a brutal process to outlaw opposition parties by targeting the main opposition party the PF which they want converted into a wing of the ruling party both in and outside Parliament. These undemocratic acts have started with the ruling party, the UPND, organizing the installation of an expelled PF member of parliament for Matero constituency, Hon. Miles Sampa as the purported leader of the PF by way of organizing an illegal convention in breach of the PF Party constitution and Article 60 of the Republican Constitution as evidenced by heavy presence of State Police at the illegal convention.”

He added that the ruling UPND party have since nominated and written to the Speaker of the National Assembly Hon. Nelly Mutti, another renegade expelled member Mr. Robert Chabinga as Leader of the Opposition in Parliament.

Hon Nakachinda said although elected under the PF initially, Mr. Chabinga and Mr. Miles Sampa have publicly announced that they have joined the ruling UPND because they believe in the leadership of President Hakainde Hichilema and the policies of the UPND party and not the PF.

“These are the two renegade members the government has now installed as purported president and Leader of the Opposition in Parliament. The two have on several occasions travelled in the entourage of President Hakainde Hichilema on international trips against the position and policy of the party. These are elected members of Parliament who are renegade but are being used by Mr. Hakainde Hichilema to destroy the Patriotic Front and the constitution of the country,” he submitted.

“The government has blockaded and occupied the PF Party secretariat which they want to hand over to this renegade group as evidenced by the heavy presence of state security. Activities to physically petrol-bomb the premises have began as evidenced by strange explosive-like objects that our party security spotted the night before the police occupation. These terror-activities are designed to frame the PF as the one planting these objects.
The President, Mr. Hichilema led government helped Mr. Miles Sampa to mobilize people from the streets including members of the UPND to organize an illegal convention to install these renegades into the leadership of the PF as a platform to annihilate the PF party which is the largest opposition party in the country thereby creating a one- party state.”

He said President Hichilema wants to wipe out the opposition particularly the PF, in order to Repeal Article 4 to introduce a one-party state.

He further said this will effectively end multi-party politics and confine Zambia into the dark corners of the dictatorships that SADC rejected many decades ago.

“Secondly, the brutal removal of the PF from Zambia’s political dispensation is aimed at amending the presidential term limit from five (5) to seven (7) years, and from two five-year terms to unlimited. The constitutionally elected Leader of the Opposition in the Zambian National Assembly is Hon. Brian Mundubile, MP, who, as per constitutional provisions, is elected by members of the largest opposition in the House which is the Patriotic Front party. For the past 26 months, the UPND has banned all forms of public gatherings and prevented opposition parties from all forms of mobilization, free speech, and any other forms of political activity,” he concluded.

UPND SCHEMES ONE PARTY STATE

….. and seven year presidential term, charges PF

Lusaka… Friday November 3, 2023 (SMART EAGLES)

The former ruling party, Patriotic Front (PF) has charged that the planned brutal removal of PF from Zambia’s political dispensation is aimed at amending the presidential term limit from five to seven years and from two five -year terms to unlimited.

And the party has observed that abductions and secret detentions of political opponents have become the order of the day for the entire period that Hakainde Hichilema has been President.

PF Secretary General Raphael Nakachinda says these developments have now led to a state of insecurity in the country owing to the heightened political tensions in the country.

This is contained in a letter dated 2nd November, 2023 addressed to His Excellency Joao Lorenzo President of Angola and Southern Africa Development Community (SADC) Chairperson.

“Since he can’t call himself to order as Troika Chairman, we therefore call upon Your Excellency, to assume this responsibility personally or delegate to the deputy chairperson of the Organ to call a special session on Zambia to forestall the possible escalation of the situation into full-scale chaos that can destabilize the country and undermine regional security. For the past 26 months since the UPND party was elected into government, President Hakainde has relied on heavy-handed political methods and has not hesitated to deploy the police to brutalize innocent citizens’ especially political opponents,” he submitted in a letter.

“The Registrar of Societies, a government agency that regulates political parties has been directed to remove office bearers of the PF and replace them with members of the ruling UPND party so that the main opposition party, the PF is officially controlled by the government. The Zambian Parliament has two major parties, the ruling UPND party with 82 seats, and the main opposition PF with 60 seats, 13 independents and 01 from PNUP. To transfer ownership of the 60 seats to the ruling party will not only kill Zambian democracy, but has the potential to plunge this country into civil strife. This coupled with the deliberate tribal and regional abuse of the Zambian society may equally steer genocide or heightened tribal hatred thereby destabilizing and threatening region stability and security.”

WE URGE THE PATRIOTIC FRONT TO CALM DOWN

By Dr Nevers Mumba

We all understand how difficult and frustrating it is to go through what the PF is currently going through. However, we wish to advise our colleagues to calm down, think and reflect before taking any step. We offer this support to our colleagues from a wealth of similar experience. Anything you do in haste and anger usually ends up injuring the very prospects you seek to achieve.

To day, we noticed that the leadership of PF trooped to the American Embassy to seek the support of the US in their “fight’ for democracy. Yesterday, they had the honor of presenting their grievances to the visiting German President. Under normal circumstances, there is nothing wrong with such efforts.

However, not too long ago, the PF stalwarts are on record to have called the West as imperialists who are using President Hakainde Hichilema to advance the imperialist agenda in the region of bringing regime change to Zimbabwe. It is this inconsistency that will disempower our colleagues. You cannot abuse the West on one hand and when you need their help, you troop to them without apologizing for your previous behavior. The moral thing for our colleagues would have been to go to the Zimbabwean Embassy, the country whose democracy they glorified. This is called consistency and morality.

Our position is that our colleagues the PF probably have a good case of what they call “limited democratic space,” but we advise them to take responsibility of their own actions and statements first.
For the PF to be taken seriously by anyone, they need to calm down and think through their actions before creating more bad precedents for future generations.

When you offend a neighbor, first go to them and say sorry before asking them for any favors. Our colleagues should have released a statement ahead of their visit to the American Embassy in which they state that, they regret the unpalatable statements they made against the West and that they were just politicking.

We have insisted on reminding the PF about their previous misdeeds so that they can find it in their hearts to accept for once by saying sorry before they cry foul. We are not saying this to belittle the problems they currently face but we are of the view that their future lies in acknowledging their past and publicly seek for forgiveness.

MMD is committed to equitable justice for all. Both the ruling and opposition parties must be allowed to enjoy their full liberties. We don’t support any contraction of democracy in the nation and we urge all institutions of government to treat all Zambians the same. It was for democracy that MMD was founded and it will be for democracy that MMD will be sustained.

Questions to PF !

1. Is it UPND which put an illegal PF central Committee?

2. Is it UPND which canceled the convention?

3. Is it UPND which expelled Miles Sampa , Davies Chama , Chabinga and others ?

4. Is it UPND which brought back ECL ?

5. Is it UPND which made Lubinda appoint Nakacinda ?

6. Is it UPND which dribbled Miles Sampa at Mulungushi Rock of Authority?

7. Is it UPND which advertised the PF presidency for Miles and others to apply?

8. Is it UPND which put a caretaker Secretariat when ECL and Davies Mwila resigned from politics?

9. Is it UPND which drafted a resignation letter for ECL ?

10. Is it UPND which wrote a message for ECL to announce a come back ?

11. Is it UPND which continued to postpone the election of President in PF ?

12 . Is it UPND which made Davies Mwila to resign to create a vacuum in the Secretariat ?

13. Is it UPND which took Lubinda and others to court ?

14. Is it UPND which dubiously amended the constitution to secure the appointment of Lubinda?

15. Is it UPND , playing imingalato to revenge for the ECL Mulungushi Rock of Authority- Mingalato , where KAMBWILI and others Bali bapika (were dribbled)?

Look , PF has been embroiled in its own political confusion. What citizens are seeing in PF today is exactly the way they were running the country. They were competing to steal public funds, export Mukula , cause bloodshed , and dividing the country.

ECL behavior to get rid of others is not new ; we saw how he treated KBF , Harry Kalaba , KAMBWILI until he fainted in court , and GBM . The expulsion of Miles Sampa and others is what ECL is good at . Now that the expulsion has backfired , they are accusing others . They have forgotten that ECL is himself a “confusion.” That is what he is . Unfortunately, KAMBWILI , KBF don’t learn !

KBF has finished himself by copying KAMBWILI’s politics of flip-flopping so early and lacking consistency!

GBM , Chitalu Chilufya , seem to have a bit of timing on this one . I won’t give them 10/10 for now , until I observe them closely .

The whole team that were hammered in the general elections in 2021 is busy mourning the confusion of PF and accusing others .

Relax gentlemen , just sort out your own legal battles .

The Speaker Of The National Assembly, Hon Nelly Mutti And The Imperative For Impartiality In Presiding Over Parliamentary Affairs

0

THE SPEAKER OF THE NATIONAL ASSEMBLY, HON NELLY MUTTI AND THE IMPERATIVE FOR IMPARTIALITY IN PRESIDING OVER PARLIAMENTARY AFFAIRS.

By Chanoda Ngwira

In any democratic society, the role of the Speaker of the National Assembly is of utmost importance. Hon Nelly Mutti, the current Speaker in Zambia, holds a pivotal position as she presides over the affairs of the National Assembly. However, recent events have raised questions about her impartiality, particularly in relation to the treatment of Members of Parliament from the ruling UPND party and the opposition, especially PF and some Independents. This biased stance not only erodes democracy but also poses a threat to the Republican Constitution and the harmonious functioning of Parliament.

The cornerstone of parliamentary democracy lies in the ability of the Speaker to ensure fair and unbiased proceedings. The Speaker’s role is to be the guardian of parliamentary rules and regulations, impartially applying them to all Members of Parliament, irrespective of their political affiliation. By maintaining a neutral stance, the Speaker fosters an environment where healthy debate thrives, allowing differing viewpoints to be heard and weighed objectively.

Unfortunately, several incidents have raised concerns about the impartiality of Hon Nelly Mutti. Reports suggest that she has been giving preferential treatment to UPND MPs and the Executive while displaying a more heavy-handed approach towards opposition MPs. Such actions, are deeply troubling as they compromise the integrity of her office and undermine the principles of democracy.

Partisanship in the house of legislature can be detrimental to the democratic process. As the Speaker, Hon Nelly Mutti must recognize the far-reaching consequences of her actions. By showing favoritism towards one party, she masks the freedom of expression and legitimate concerns of the opposition, effectively stifling their voices. This erosion of democratic values undermines the very foundations of a just and inclusive society.

Moreover, the role of the Speaker extends beyond the confines of the National Assembly. The Speaker is responsible for upholding the tenets of the Republican Constitution, a document designed to ensure the effective functioning of the nation. A partisan approach not only undermines the Speaker’s responsibility but also jeopardizes the stability and order of parliamentary proceedings.

It is essential for the Speaker to remember that her position bears enormous responsibility. A failure to exercise impartiality may lead to serious trouble and confusion in Parliament, and if left unchecked, this can ultimately lead to anarchy. The Speaker must consider the potential consequences of her actions and the wider implications on the nation.

In conclusion, the presence of a neutral and impartial Speaker is critical for the effective functioning of a democratic society. The recent issues regarding Hon Nelly Mutti’s partisan approach towards treating politicians from different parties must be urgently addressed. The erosion of democracy caused by such actions is a call for concern and requires immediate attention. The Speaker must embrace impartiality and ensure fairness in proceedings to uphold the democratic values and protect the Republican Constitution, thereby facilitating a harmonious environment in the National Assembly. Only then can the true spirit of democracy prevail.

SAVE ZAMBIA, START MOBILISING TO KICK OUT THIS TIN- POT DICTATOR IN 2026- Fred M’membe

SAVE ZAMBIA, START MOBILISING TO KICK OUT THIS TIN- POT DICTATOR IN 2026

We are no longer in doubt that Mr Hakainde Hichilema is an intolerant, ruthless, cruel, heartless tin-pot dictator presiding over the most corrupt regime in the history of this country.

Today, Mr Hichilema is using the criminal justice system to fix his political and other enemies. The police has become his personal political, social and business tool to use, or rather abuse, as he desires.

Mr Hichilema seems to care less about anybody but himself.

But he is forgetting that care is the essence of strength – strength, power without care is savage and brutal, and selfish. While strength with care is compassion – the practical action that is needed to help others.

Mr Hichilema has become an Emperor Bokasa and a Mobutu Sese Seko in one – two in one. He wants to be an absolute ruler by annihilation or co-option of all critical voices and political opposition. He only wants to hear from those who sing praises for him and only him alone.

But the Zambian people must understand that in every society, there are men of base instincts. These sadists, brutes go about in the guise of human beings, yet they are monsters. If they are offered a drink from the river of blood, they will not be satisfied until they drink the river dry. Such is the character and nature of the man at the helm of this country’s leadership today.

We all want to win, but it shouldn’t be at the annihilation of our political competitors. We should win because we are better understood, supported and trusted. There should be no choice between being principled and unelectable; and electable and unprincipled. We should win because of what we believe in.

Mr Hichilema is not a man to give another term of office – he has shown us his true colours, his real character, his true self. If he is given another term of office nothing will remain of this country in terms of multiparty democracy and pluralism. He is not only destroying the economy of this country but also our national unity by introducing tribalism and regionalism never seen in Zambia before.

So let’s save Zambia, start mobilising to kick out this tin-pot dictator, annihilator in 2026!

One bad term doesn’t deserve another, aleya!

CADRES ARE NOW IN HIGH OFFICES- HON MUNDUBILE.

………as he exposes a scheme to suspend PF MPs in Parliament and amend the constitution.

Lusaka………Friday, November 3, 2023 [Smart Eagles].

As the nation is still in shock by the continuous breach of the Constitution by the Executive and its stooges, it has emerged that Parliament is the next target.

Legitimately Elected Leader of Opposition Hon Brian Mundubile said there is no constitutionalism in the Zambian Parliament because representation is hampered.

Hon Mundubile said an elected Opposition Member is not given an opportunity to give a divergent view.

He has since exposed a scheme by the UPND Government to amend the constitution using ilegalities.

He said the speaker now intends to suspend PF Members of Parliament Following a wrongly raised point of order.

“Hon Andeleki and Hon Anakoka are always on standby to rise on point of orders, because the ruling is already there. They plan to suspend PF MPs today all in an effort to weaken the Party. They want to ganner some numbers and amend the constitution. The executive is leaning on Parliament,” he explained.

Hon Mundubile said the UPND want to include clauses in the constitution which will be definitely rejected by the Zambians.

“President HH nolonger wants a running mate in the constitution, he wants the term of office to be extended to 7 years.

They believe that if they went ahead and succeeded, the term of office will be extended. And remove the running mate. They want to introduce Multi cultural clause…..We are unpopular because we have stood firm,” he said.

He has noted that the cadres in the UPND Regime are in high offices such that they can rule one out of order even when you are in order.

“When Hon Kang’ombe was almost wrongly evicted, members of the PF stood up and they called that disorderly.

But when Hon Emmanuel Jay Jay banda was being evicted, members of the UPND stood up and showered insults at Banda, what do you call that. We want to see what Parliament will do, because our members have been written to. It is not incumbent for a member of Parliament to stand up and say they protecting the speaker,” he said.

LET US BE HONEST EDGAR LUNGU IS THE ONE PLAYING MINGALATO

By Mellbin Simangolwa

Before we accuse UPND of sponsoring Miles Sampa to destabilize the Patriotic Front, let us look at this matter without political lenses.

Edgar Lungu loses elections, and he officially resigns from politics and from his position as President of the Patriotic Front. His letter to the cabinet confirms this. This decision is also confirmed by the Patriotic Front as a party after they advertised the position of Presidency of the party and those interested were asked to pay K200,000.

Miles Sampa just like others expressed interest to fill up the vacancy in the office of the Party Presidency. Edgar Lungu was very much aware of what was happening, he allowed this process to go on.

At this point mingalato started. The convention to elect the new President could not take place. It was excuse after excuse. Edgar Lungu started playing games with the candidates because he had plans to return back into politics. ECL started playing mingalato because he wanted to come back as President of the Party despite having resigned.

As part of mingalato, Lungu appointed Raphael Nakachinda as secretary general of the party. Despite this move being illegal. Throughout this process, Edgar Lungu and his mingalato did not care about democracy.

Fed up with Lungu’s Mingalato Miles Sampa called for an ‘extraordinary general conference’ where he was elected President. In short Miles, also started playing mingalato. Where is UPND or President Hakainde Hichilema in all this?

Edgar Lungu was caught pants down at his mingalato by Miles Sampa. In 2014 ECL played the same mingalato and got away with it but this time Sampa was miles ahead in thinking.

PF claims democracy is under threat under the New Dawn. What was democratic about getting K200,000 from candidates and later imposing Lungu as President? Was it democratic to deny members of PF a convention for two years?

This confusion has been brought because of Edgar Lungu’s greedy and selfish motives and no one else. It is Edgar Lungu who has been playing mingalato all the time and he should never play the victim. Bill 10 was mingalato, Hatembos case was mingalato, treason case was mingalato but HH was equal to task and God saved him.

If you kill by a sword, you will die by a sword.

UPND NOT SCARED OF THE PF…it is scared of democracy, notes Kafwaya

0

UPND NOT SCARED OF THE PF

…it is scared of democracy, notes Kafwaya

Lusaka, Friday, November 3, 2023 (Smart Eagles)

Lunte Member of Parliament Mutotwe Kafwaya has noted that the ruling United Party for National Development (UPND) is scared of democracy because it wants to rule in perpetuity.

Hon Kafwaya said when he and other lawmakers for the mighty Patriotic Front (PF) addressed the press at Parliament grounds yesterday that the ruling party is doing everything in trying to kill democracy.

He warned that the country would be robbed of democracy come 2026 if not careful.

“I wrote an article years ago where I was saying people think that UPND fears PF. But the truth is UPND does not fear PF, what UPND fears is democracy. That is what UPND does not want. This is why you what you are seeing is that everything they are doing is in a quest to kill democracy in this country. If we are not careful as a nation, by 2026, there will be no democracy at all in this country because there will be no political party to compete with UPND,” he said.

“Maybe the question could be what is democracy? In my own view democracy is you having a say in the affairs of the nation and also me having a say in the affairs of the nation. So both of you are represented to channel your views appropriately and your views are advanced. For those of us who are privileged to represent, we receive the views and we advance the views as such.”

Meanwhile, Hone Kafwaya slammed Speaker of the National Assembly Nelly Mutti over her conduct regarding matters to do with the PF.

His sentiments follow acknowledgement of the Miles Sampa camp by the Speaker.

The lawmaker also insinuated that the Speaker’s action on Kamfinsa lawmaker Christopher Kang’ombe who was not given the opportunity to express himself was unfair.

He further charged that the plan by UPND is to completely obliterate PF.

“This is why we are saying you cannot stop democracy in the executive, you cannot stop democracy in the judiciary, in the manner you have, and you also want to stop it here, the last hope of democracy is at the assembly. The plan by UPND is to completely obliterate PF. This is why they are doing all these things that they are doing,” he said.

“Why would UPND not want democracy? I have heard that UPND are planning to be in power in perpetuity. They have been saying we will be in power for minimum 50 years and for them to be in power for 50 years obviously they should not have competition. This is the truth. If they have competition, there is no way they can go beyond 2026 because Zambians have already said no to UPND.”

THERE’S A CRISIS LOOMING IN THE JUDICIARY- Fred M’membe

By Fred M’membe

THERE’S A CRISIS LOOMING IN THE JUDICIARY

There is a looming standoff between Mr Hakainde Hichilema’s corrupt puppet regime and the judiciary over the conditions of service for judges.

The dispute is the result of an ongoing stalemate between the two parties, with the Executive being the culprit and dragging its feet on the issue of the conditions of service and tenure of judges. This corrupt UPND puppet regime aims to freeze or reduce the conditions of service and remuneration of judges under the guise of cutting expenses and costs thereby saving and encouraging frugality in the application of state resources.

These manoeuvres coupled with the arrogant handling of the issue by the Hichilema led Executive has annoyed and frustrated the judges, with some now threatening to walk out of their chambers and take the state to the Constitutional Court. If this happens, it will definitely be an extraordinary and unprecedented situation in the history of the judiciary in Zambia.

For the first time in history, we are faced with a situation where the Executive wants to pit the Attorney General against the judges whilst appearing before other judges. Mr Hichilema is pushing the judiciary to appear before itself? What type of confusion is this? What an epic leadership failure and disaster? What type of arrogance and exaggerated sense of self worthy is Mr Hichilema possessed with? How can everyone be wrong except him? How many battles will he engage in and win? Isn’t this recklessness?

This country is in a crisis. There are more negative and worrisome features in the manner Mr Hichilema is administering this country. Parliament is gone. The judiciary is almost gone too and the Executive, which is headed by Mr Hichilema is rotten to the core. So where will the citizens turn to if all key institutions of governance become discredited and eventually collapse? He is even trying to cause confusion, divisions in the church. Look at how he has divided and paralysed the Catholic leadership!

We have been compelled to comment on these issues because the judges seem to have had enough and are now talking and complaining openly. We would like to remind Mr Hichilema that no matter how low he thinks of the judges he has favoured with jobs conditions of service and tenure of judges are important for the overall independence, effective functioning of, and public confidence in the courts. In fact, judges should command the highest salaries within the public sector, both to reinforce the unique role and characteristics of the office and to attract the most qualified candidates. Remuneration of judges must be high enough to limit the risk of conflicts of interest or corruption arising from the need for judges to supplement their income.

Below are the judge’s grievances, which Mr Hichilema’s corrupt puppet regime is trying to sidestep:

  1. Refusal to be a part of the Specified Offices’ Pension Benefits Bill of 2023. Currently, Judges Conditions of Service are governed by the Judges Conditions of Service Act cap 277 and S.I No. 140 of 1996 which is called The Judges (Salaries and Conditions of Service) Regulations.

Of serious concern to the judges here is their already accrued benefits. And Judges are saying that they’re ready to be declared redundant if this bill becomes law.

  1. Also of concern relating to conditions is:

a) Settling in allowance /computation leave pay – It has been reduced without a legal explaination as to how it has changed.

b) Motor vehicles – In 2021, motor vehicles were procured. About 13 of them but due the so called policy direction by the President, they are just parked and awaiting to be sold or used by visiting foreign dignitaries.

c) Furniture – Judges are entitled to furniture but so they have not been getting it.

d)Security – Judges are entitled to armed police guard 24 hrs at their place of residence but for that to happen, the judges have to provide the armed officer accommodation and if they don’t, it will not work.

e) Official Motor Vehicle – to be maintained by the judiciary and it is supposed to be replaced every 5 years if funds are available.

  1. Judges do not accept to be part of the judicial (code of conduct bill 2023).

Listed above are just some of the demands of the judges to the Executive branch of the government. But as earlier indicated the Executive is trying to elude or avoid fulfilling its obligations.

We have said it before that Mr Hichilema and his minions don’t need high salaries and improved conditions of service because they are making a lot of money from fertiliser, oil, mining deals and other corrupt schemes. Judges don’t.

Therefore, we demand that Mr Hichilema and the UPND government urgently improve the salaries and conditions of service for the judges. We make this important call after noticing that Mr Hichilema and his corrupt puppet regime are deliberately trying to play down the need for better remuneration and conditions of service for judges by using selfish and dishonest justifications and claims of frugality or prudence with state resources.

It’s sad that all this is taking place at a time when Mr Hichilema himself and the UPND politicians currently serving in this government are becoming more and more richer whilst trying to cheat their way out by citing the economy as the main contributor to their inability to remunerate judges appropriately.

The biggest challenge with this government, and Mr Hichilema in particular, is that they don’t want to see the governance of this country in any other way than beyond deceit, lies and manipulation. They always want to do things out of political expediency, greediness and at the expense of their fellow citizens. When it suits him, Mr Hichilema blames the economy yet the same does not apply to him and those around him. And it is the same mouths that are everyday telling Zambians how well the economy is doing and growing under their leadership. This was the essence of those graphs Mr Hichilema presented to the nation at that famous press conference of his.

We know that truthfully the economy is biting and their fiscal policies have lamentably failed but let them not allocate state resources selectively. Everyone – the judiciary, police, civil, servants etc – deserves their fair share amidst the difficulties facing the country today.

Mr Hichilema should not be allowed to deal with the remuneration and conditions of service for our judges in a way that will reduce their independence and public confidence in the courts.

We therefore call upon Mr Hichilema to stop the arrogance and selfishness, and immediately look into the remuneration and conditions of service of the judiciary. We cannot have a society where our judges are placed in a position of literally pleading with the Executive for a better pay and conditions of service.

We want to emphasize that the judiciary is a respected and dignified arm of the state and Mr Hichilema must realise that the first step to effective, fair and efficient dispensation of justice is to ensure that those presiding over our court system are adequately remunerated and taken care of by the state.

DEMOCRACY UNDER THREAT – HON KAMPAMBA MULENGA

UPND hell bent on killing democracy

Lusaka, Friday, November 3, 2023 (Smart Eagles)

Kalulushi member of parliament Kampamba Mulenga has warned that Zambian is in trouble under the leadership of the UPND regime.

Speaker when she and other Parliamentarians from the mighty Patriotic Front (PF) addressed the media yesterday, Hon Kampamba stressed the need for people to stick together.

She noted that UPND government is using every tactic to ensure that democracy dies.

The lawmaker also warned that the repercussions of what UPND is doing are killing what every forefather believed in and fought for.

She lamented that UPND is not only killing PF but the entire nation.

“They are crashing our families, they are crashing the principles of our democracy…they talk about all the time, we have free education. May I remind this country that even from MMD government we had free education,” she said.

She scorned UPND over its “failed” free education as she said the teacher pupil ratio is unbelievable.

The lawmaker also castigated government over the cost of living that has escalated like never before.

Hon Kampamba also bemoaned the state of medical facilities.

“There is no proper health system anymore. There are no medicines,” she said.

The MP said instead of concentrating on issues affecting citizens, UPND is busy with PF issues.

“PF was accused of a lot of things. These are thieves, they are common criminals, they have stolen the money, what money did we steal? Now that they are in government they know why it is so difficult. Government has systems, it is so difficult to steal money,” she said.

She reminded the ruling party of the dirty things they said about PF prior to 2021 elections.

Regarding the recent happenings in PF, the lawmaker cried that “we are treated like children in that house.”

On the change of the leader of opposition in Parliament, she said “I should be given for an opportunity to vote for my leaders.”

She said democracy is being killed by the very people who used allege that democracy was being suffocated under the PF.

SUPPORTING ILLEGALITIES CAN PLUNGE THE COUNTRY INTO CHAOS – NG’AMBI

Lusaka, Friday, November 3, 2023

Patriotic Front (PF) Member of the Central Committee for Industry – Frank Ng’ambi has warned that supporting illegalities can plunge the country into unprecedented chaos.

MCC. Ng’ambi has expressed shock that some Zambians are supporting the Miles Sampa led PF faction for holding an illegal convention last week.

He said illegalities must not be tolerated because even in the governing UPND there are disgruntled members who can hold an illegal convention and replace the current party leadership led by President Hakainde Hichilema.

Featuring on Muvi TV’s special programme, Mr. Ng’ambi, who represented PF Vice President Given Lubinda, emphasised that the convention that elected the suspended PF Matero Member of Parliament was illegal.

“Basically, anyone can wake up in the morning and have a convention, are they going to admit them? If that happens, are they going to admit them without the chairman of the party, without the Secretary General, without the members of their National Management Committee, are they going to admit them because in any political party there are fallouts,” Mr. Ng’ambi said.

“Even in UPND there are fallouts, there are people who are not happy with the leadership of President HH. The question is if the State House is involved in the challenges we are going through as the Patriotic Front, what is motivating them? Are they seeing PF winning the election in 2026? If that is the position then you can clearly say that it’s the state acting behind these factions,” he said.

Mr. Ng’ambi said only the Secretary General of PF is mandated to call for a convention.

Meanwhile, Mr. Ng’ambi said Sixth Republican President Edgar Lungu never ceased to be PF President after the 2021 General Elections.

He said Mr. Lungu was just on sabbatical leave because the PF Central Committee objected to his idea to resign as PF President.

On PF rebranding, Mr. Ng’ambi said the process was progressing well as evidenced by the fusion of over 20 young people in the Central Committee.

He assured people that PF will have vibrant leaders to win the 2026 general elections.

Lubinda gives German President Hichilema Protest Report
…on rampant abuses of human rights in Zambia

From PF vice President Given Lubinda

03.11.23

Hon. Given Lubinda, the vice President of the largest opposition party in Zambia Patriotic Front (PF) has cautioned visiting Germany President Frank-Walter-Steinmeier to ´not get fooled´ by President Hakainde Hichilema´s rhetoric that things are well, and democracy is growing in Zambia when it’s not.

Mr. Lubinda, a former Foreign Affairs Minister and long serving lawmaker has told the Germany leader that the democratic space in Zambia has shrunk to an all time low while human and political rights abuses are on in the rise in a written protest letter delivered to the Germany embassy in Lusaka.

“I am compelled to write you because the President of Zambia has invested heavily propaganda project a façade to the international community that all is well when it’s not, as he (Hichilema) exhibits dictatorial tendencies in reality,” Mr Lubinda said.

Zambia enjoys warm relations with the Federal Republic of Germany dating back to independence in 1964 and is a constant recipient of development aid on condition that it provides a free expression and association space to its citizens which Mr. Lubinda says has suffered lately since Mr Hichilema became President in 2021 after a victory over President Edgar Lungu of PF.

Mr. Lubinda told the German President whose country is known for strict adherence to a human rights code of conduct in the European to take the following notes as he returns to Berlin while Zambia´s democratic space shrinks under President Hichilema:

  • The sad situation of state police arresting without charge, political opponents for several days or weeks without charging them against the laws of Zambia and international human rights standards.
  • In Zambia today no political parties or civil society groups are allowed to hold public rallies and demonstrations by state police and government, a brazen abuse of human rights.
  • On 30th October state police crossed the line by stopping the PF from holding an ´in door´ meeting, beyond the public open space rallies that can’t hold anymore, an action tantamount to colonial style politics.
  • In Zambia today, hate speech has become a crime used like a blunt instrument to punish anyone who dares speaks against President Hichilema, the case of Sean Tembo and Stardy Mwale
  • In Zambia today, a former respected Ambassador such us Emmanuel Mwamba can be arrested and beaten and abducted in broad day light at a car wash with no comment of disgust emanating from President Hichilema
  • Sadly, the sixth President of Zambia Mr Edgar Lungu cannot be allowed the freedom to exercise or travel abroad for a routine medical check up as per rights required by Mr Hichilema whose police force has ordered him to seek permission before he can do any physical exercise in public, something that was normal even before independence from colonial masters.
  • Mr Lubinda especially condemned President´s Hichilema´s wanton attack on the PF whose disintegration he has commenced using state police, the courts and parliament by sponsoring a rebel low level member of parliament from Matero Miles Sampa now masquerading as the president of the PF in parliament against the law.

The full litany of abuses prevailing in Zambia are available on the party´s website as distributed to the Germany embassy Mr. Lubinda hopes the largest economy in Europe will share with the entire European Union.

Mr Lubinda also bemoaned the fact that the EU, the U.S and other corporating partners are loudly silent today in the face of rampant human and political rights in Zambia as compared to the rule of President Edgar Lungu.

President Steinmeier is yet to respond to the PF vice President´s Protest Letter but has had a one-on-one meeting with leader of the opposition in the house hon. Brian Mundubile.

Although by law, hon. Mundubile is the bonafide leader of the opposition, Speaker of the house Nellie Mutti has against the law recognised another person as the leader of the house in a bid to destroy the largest opposition party in parliament.

ECL’ s POLITICAL HANGOVER A DANGER TO PF

ECL’ s POLITICAL HANGOVER A DANGER TO PF

The last few days have not only been exciting but also interesting following an announcement by Former President, Edgar Lungu that he has u-turned to sit on the pinnacle of the now opposition, Patriotic Front(PF).

However, the happenings that have dominated the former ruling party in the last two years are man-made due to the failure by Mr. Lungu himself to graciously and peacefully hand-over power to a potential successor.

This is because Mr Lungu has seemingly never possessed the art of smooth transitions, as he once proclaimed that possibly he was going to hand-over State power to himself.

And his latest antics are merely an actualisation of his prophesy.

Obviously, the themed soap opera dubbed; “Return of ECL” is beyond description and difficult to comprehend considering that he had resigned from active politics after his disastrous performance in the 2021 general elections to incumbent, Hakainde Hichilema, a man the previous administration had arrested more than fifteen (15) times to thwart his political ambition.

My writings today will focus on the decision and prospective impact of his return to active politics:

Firstly, the perpetual failure to facilitate the hosting of the extra-ordinary general conference to elect new office bearers has been the major driving force to the ongoing confusion, which should sorely be attributed to the former president, who has employed political gymnastics.

This is due to his inability to provide clarity to his status within the rank and file of the party upon exiting office.

Ostensibly, this was a well orchestrated move to launch his political comeback.

This is clearly a case of political hangover. Consequently, marking the beginning of the problem thus political parties should take responsibility or simply put be accountable for their reckless behaviour than blaming others.

I am shocked to say the least that emerging leadership of young individuals are on top of their voices jubilating without seeing the need to take over and recruit rather than recalling a retiree to steer the party forward that has terribly failed to move beyond the point where the predecessor left off.

The return of President Lungu offer no guarantee that the former will either bounce back or unite into a formidable establishment to unseat the incumbent when he failed to do so when he had state power.

Secondly, other opposition leaders have validated his coming back apparently in the name of a democratic right, ‘VERY UNFAIR INDEED.’

President Lungu ironically knows that most local political parties are empty shells, money mongers and skeletons with nothing and eventually they will succumb to the ploy due to their lack of unity and subsequently, back the former in the next elections.

Thirdly, events that have punctuated the second coming of Mr. Lungu have demonstrated President Hichilema’s retention of the country to normalcy, which they can call their own amidst provocation from the former ruling party.

Previously, people would have been brutalized or in some cases shot at with impunity but today we have a Police proving professional than ever before.

Mr. Lungu is free to move about while President Hichilema is steadily focused on delivering and mending the country left in economic stitches yet people want to claim economic emancipation when the monies were in the few politically exposed characters.

Those that have called Mr. Lungu to come back into active politics are unfair because the former president did his best in seven years, which was not good enough to offer him an extension.

Mr Lungu has nothing to offer either today or in the future because he is a spent force, who initially allegedly admittedly that he had no vision for Zambia and now has no political party.

LUNGU HAS NOTHING TO OFFER BESIDES LAWLESSNESS – GOVERNANCE ACTIVIST

A LUSAKA-based governance activist has welcomed former president Edgar Lungu’s return to active politics but noted that the former Head of State had nothing more to offer than lawlessness.

During late president Micheal Sata’s memorial in Lusaka, Lungu announced that he had returned to save the PF and also fight for democracy.

But reacting to his announcement, Dillon Mayangwa said Lungu had nothing to offer besides violence and the lawlessness that was associated with his seven year rule.

Mayangwa said Lungu was man with a clear legacy of breaching the constitution or misinterpreting it.

“For instance, the constitution says when a petition has been filed in following a presidential election, the incumbent president must hand over power to the Speaker of the National Assembly until the matter is concluded. In 2016, president Lungu’s election was petitioned but he arrogantly refused to hand over power to the Speaker in disregard of a constitutional provision,” Mayangwa said.

Mayangwa also recalled that Lungu had misled his ministers to continue performing ministerial duties when Parliament had been dissolved before the 2016 elections.

“What kind of lawyer is he who does not follow or understand the constitution?” He is back to active politics and the first thing he does is to claim he is the president of the party from which he resigned two years, that is confusion,” Mayangwa said adding; “that is why I am saying, from where I stand, Lungu has nothing more to offer than lawlessness”.

Mayangwa cautioned Lungu to rethink his position because Zambians had not forgotten all the violence his cadres had subjected them to.

“What president Lungu needs to do is help resolve the wrangles in the PF by bringing the disputing parties together for dialogue like a true statesman, not throwing himself in the confusion to also fight,” he said.

Muyangwa said it was not too late for Lungu to right his wrongs and assume the position of a statesman by conducting himself honourably.

“The fact that people were quiet it is because they being forced to give him respect as a father of the nation. A lot of things that we were supposed to say about Edgar Lungu, we would say because he inherited the seat of a surviving former president. But now that he has come to politics, people will treat him with political gloves which unfortunately comes with disprespect sometimes” said Mayangwa.

“People will have to remind him of what kind of a politician he is. They will remind him that he made our students destitutes by grabbing meal allowance from them. They will remind on who he destroyed the institutions of governance with his violent cadres. He will be reminded of cadresm leaders,” added Muyangwa.

Zambian Patriots Will Triumph Over Their Despotic, Arrogant And Ignorant Puppet Hichilema- Fred M’membe

ZAMBIAN PATRIOTS WILL TRIUMPH OVER THEIR DESPOTIC, ARROGANT AND IGNORANT PUPPET HICHILEMA

There is more that needs to be done to defend, protect and safeguard our country’s dignity and sovereignty.

We need to stand together and resist the tyranny, oppression and repression that has taken hold in the country today.

This country is on a road to destruction and chaos, and what is clearly needed is a better understanding of, not just Mr Hakainde Hichilema and his corrupt puppet regime’s draconian intentions, but the deliberate silence and complicit acts of Mr Hichilema’s puppet masters like US, Britain and the European Union.

Therefore, comprehending and understanding the deliberate intentions to destroy our country by both Mr Hichilema and his puppet masters is the first step to redeem ourselves. We say this because at rate we are going and when one critically analyses the reckless destruction of our institutions of governance such as the judiciary, legislature and many others, by this regime, it’s clear that Zambia is thirsty for another wave of liberation from this intolerant, repressive and corrupt regime and its puppet masters.

And we must by all means necessary come together and take the necessary steps to restore order, stability and democracy in our country. Particularly, that we have all witnessed how the silence of the West is fueling further abuse and violations of human rights, interference with state systems like the courts and the police, and general lack of respect for the rule of law by this corrupt puppet regime.

As all this is taking place, the enthusiasm from the West that has always greeted our nation and others whenever similar abuses occur is missing. Why?

Well, it is because the West is complicit in the destruction of our multiparty democracy and our country by Mr Hichilema. To them, we are just another African country and they don’t care or mind how we end up. Even if Zambia is set on fire through Mr Hichilema’s careless actions, they don’t care, so long as their puppet remains in charge and enables to get whatever they want in terms of our natural resources and can set up their AFRICOM facilities without impediments. This is exactly how the West has created wars and destroyed countries before. It’s through unpatriotic and irresponsible puppet leaders like Mr Hichilema.

No doubt, the West is propping up Mr Hichilema as the new leader to protect and advance Western imperialism and its interests in our country, our region and our continent. That is why they’re cannot prevent the abuses, protect human rights or call- out Mr Hichilema for his excesses, violations and dictatorial tendencies.

In short, the West is happy and sees nothing wrong with what is happening in Zambia today. They see nothing wrong with the wanton destruction of our democracy and the destruction of the country in which we live in.

No wonder they can afford to watch the unprecedented incidents like what we witnessed in Parliament yesterday with a smile because to them, we are just Africans! We mean nothing and will always amount to nothing.

But this will not be allowed to continue. Whilst they can tolerate Mr Hichilema, the Zambian people can’t tolerate him and his brutal and bovine behaviour.

Let them know that this dictatorship they’re trying to instal in this country will not work. It will backfire badly.

Ours is not a nation that was established, built and sustained through puppetry and Western stoogeism.

We are a country and a people that have always believed that we are our own liberators and have never had any doubt about our own ability and destiny.

They can plan and attempt to execute their dreams but they must know that their intentions will never be fulfilled. Zambia is never short of brave, capable and determined citizens to defend it like our Ngoni ancestors did from December 1987 to February 4, 1898. They must know that Mr Hichilema will be democratically defeated and shamed together with his puppet masters by the people of this country.

This regime will regret the consequences of its present actions and wish they never ruled this country.

No matter what they do, who kill, try to exclude Zambian patriots will triumph over their despotic, arrogant and ignorant puppet Hichilema.

We’re Concerned About Recent Actions By Zambian Authorities Which Have Infringed On People’s Rights – US Ambassador to Zambia Michael Gonzales

WE’RE CONCERNED ABOUT RECENT ACTIONS BY ZAMBIAN AUTHORITIES WHICH HAVE INFRINGED ON PEOPLE’S RIGHTS – US Envoy

By Mukosha Funga Njenga

United States Ambassador to Zambia Michael Gonzales says his government is concerned about recent actions by Zambian authorities that have infringed upon the democratic rights of the Zambian people.

Last week, a consortium of civil society organisations held a press conference at which they lamented that the civic space was shrinking in Zambia.

Speaking on behalf of the other CSOs, Chapter One Foundation executive director Linda Kasonde cited several instances which showed that the civic space was shrinking

“Zambia needs to embrace the rights and freedoms of every citizen for us all to develop as a nation that lives in harmony and upholds and respects human rights and the rule of law. We have observed worrying trends with the failure by public authorities to protect the rights to freedom of expression and freedom of assembly which are the bedrock of our democracy.

In June 2023, the Zambia Daily Mail fired a photojournalist for photographing people queuing up for mealie-meal in Ndola. On 13th October 2023, the Independent Broadcasting Authority cautioned Hot FM radio station over their interview of Dr Sishuwa Sishuwa, a Zambian academic, for not challenging his sentiments on tribal discrimination in the public service,” said Kasonde.

“On 18th October 2023, a day when the nation was supposed to be fasting, praying, reflecting and reconciling, law enforcement agents in Lusaka thwarted a planned protest against the rising cost of living. On 25th October 2023, the Zambia Police Service forced their way into the home of Patriots for Economic Progress (PeP) president Sean Tembo in a bid to arrest him despite him urging the police to wait for his lawyers to arrive. Previously, around the first week of September 2023, Mr Tembo had been arrested and detained by the Police Service for “hate speech” for six days in violation of his right to be brought before a court of law within 48 hours. These examples are but a few that show a shrinking of the civic space in Zambia”.

In response to a press query regarding the concerns which the CSOs raised, Ambassador Gonzales highlighted the importance of having an active civil society and political opposition in a democracy.

“Over the past two years, Zambia’s emerging democracy has been one of the country’s biggest international assets. However, the United States is concerned about recent actions by Zambian authorities that have infringed upon the democratic rights of the Zambian people. In any democratic system, it is important to have an active civil society and political opposition not only supporting progress achieved by the government, but also highlighting where governments fall short or are not meeting public needs or expectations. Such dissent IS loyalty and patriotism as it provides key incentives to drive those in leadership to course correct,” Ambassador Gonzales stated.

He observed that recent actions appeared to bias the application of the rule of law in favour of the governing party and against dissenting voices.

“When opposition leaders are harassed, radio stations are questioned for content on their shows, and citizens are prevented from freely assembling, democracy suffers. I am concerned about recent actions that appear to bias the application of the rule of law in favor of the governing party and against dissenting voices. The public made clear that such actions were unacceptable under the previous government and they remain unacceptable under the current government. Indeed, when the Zambian people overwhelmingly elected President Hichilema in August 2021, it was in large part a rejection of these practices and inspired by commitments by the then-opposition that, if elected, they would not stand for these anti-democratic practices,” stated Ambassador Gonzales.

“In the absence of clear statements by the government and accountability measures for those responsible for repressive acts, it is understandable that the public could question if the government condones such conduct or may even be directing it. We understand that is not the intent of this Administration, but actions speak louder than words. When actions require the approval of authorities in power, by definition, they stop being rights and freedoms.

The United States urges the government and police to strengthen their protection, and enforcement, of full rights and freedoms for all people

IT IS IMPOSSIBLE TO HAVE DEMOCRACY WITHOUT THE PARTICIPATION OF MASSES- Dr Fred M’membe

IT IS IMPOSSIBLE TO HAVE DEMOCRACY WITHOUT THE PARTICIPATION OF MASSES

…even the marginalized have to participate – Dr M’membe

Lusaka, Thursday, November 2, 2023 (Smart Eagles)

President of the Socialist Party (SP) Dr Fred M’membe has argued that it is impossible to have democracy without the participation of the masses.

Dr M’membe has explained that democracy entails the participation of everyone including the vulnerable.

He said this when he and the party General Secretary Dr Cosmas Musumali had a conversation around socialism and other issues affecting the affairs of the country today .

“It is not possible to have democracy without the participation of so many people. Democracy entails participation of people, the greatest level of participation of the masses. We had Greece, we are usually told about the old Greece, the Greek Agora, and it is given to us as the architype or prototype of democracy,” he said.

“We are told of the meetings in the city halls where everybody gathers and they decide. But that story is not complete because they don’t tell us that the old Greece we are talking about had over 30,000 slaves. But the slaves never went to the city hall. They were excluded from the democratic process.”

He argued that the democracy in Greece that is being talked about is incomplete.

“So the democracy we talk about in Greece is part of democracy, it is not complete democracy. Capitalist democracy is also partial; it is just for the well to do. Those with money and they use their money to gain power,” he said.

“If you are poor you cannot be an MP, unless a rich man sponsors you, or a rich company sponsors you. So it means a poor person cannot set themselves a political agenda, a political goal and attain it. They can only do so when they come together and struggle in a revolutionary way. When that happens there is a revolution.”

The opposition leader said it doesn’t matter how the revolution happened.

“And it doesn’t matter how it happens. That is why even in America, when they were under the imperial rule of the British and others, they had to take up arms and liberate themselves. There was a revolution in 1876 that triumphed in America, and it was a violent revolution because it was an armed struggle,” he said.

“People forget that the USA liberated itself through the use of arms. And there was a revolution. Power changed from imperial powers.”

Meanwhile, Dr Musumali said there is no democracy for the masses.

“Building on the concept of democracy, so the capitalist, for the fewer people that control, they have democracy amongst themselves. For the masses out there it is dictatorship, it is not part of them. They are just used as a pawn, they are just used as validation, but it is not really their democracy,” he said.

“And that is what this project is about. Those who were excluded, those who were marginalized, those who were overlooked, we want them to come together. But in this process we are not going to exclude the small minority that governs today, we are simply let everybody participate.”

Opposition Candidates In Congo Elections Speak Out Against Lack Of Transparency In Ongoing Electoral Process

DRC 2023 ELECTION: Opposition Candidates In Congo Elections Speak Out Against Lack Of Transparency In Ongoing Electoral Process

With less than two months before the DRC goes to polls to elect its president, opposition candidates in the 2023 General Elections have expressed their concern over the lack of transparency in the ongoing electoral process.

In a joint-statement signed by seven opposition candidates including popular figures Moïse Katumbi, Martin Fayulu, Delly Sesanga and Dr. Denis Mukwenge, the electoral commission, CENI, has been brought to the light of several anomalies affecting the holding of a free, transparent, fair and credible.

Other opposition candidates that are part of the statement include the youthful Seth Kikuni, Franck Diongo as well as Marie Josée Ifoku.

The opposition candidates have complained over CENI’s lack of transparency and proficiency in its operations especially in relation to the voter register and provision of a complete map out of polling stations as well as the body’s non-adherence to the electoral schedule.

From left to right: Dr. Mukwege, Martin Fayulu & Moise Katumbi
“The country is in bad shape and the current electoral process is characterized by a deliberate lack of transparency. The vagueness maintained by the CENI on the financial, logistical and organizational aspects of the process portends chaotic elections,” the statement reads.

“This is why we, candidates for the presidential election after evaluation, note the following. The holding of good elections in December 2023 remains, more than ever, a major challenge for peace and social cohesion.

“Since the start of the electoral process, the CENI has taken more and more liberties with the law and the electoral calendar. It also condoned numerous irregularities which seriously compromised national harmony and civil peace in the country.

“The lack of transparency in the conduct of its operations is coupled with opacity in the financing process and in the management of CENI’s finances, which is characterized by the generalization of over-the-counter markets,” the statement reads.

The opposition leaders contend that “after so much lightness and artistic vagueness which characterized all the pre-electoral operations (in particular the registration, the poor quality of voter’s cards, the refusal of an independent audit, the non-publication of the voters’ lists and the mapping completeness of polling stations, non-compliance with the electoral calendar, etc.) which took place without any consensus,” is a recipe for anarchy.

They argue that it is necessary that a few days before the electoral campaign starts on November 19, urgent measures be taken to save the electoral process.

Meanwhile, the presidential bidders are also calling the electoral commission to resolve the issue of defective voter’s cards that were issued to citizens who stand the risk of failing to exercise their right to vote due to the authorities’ incompetencies.

“It’s of great importance to resolve the issue of duplicate cards that have become illegible due to their poor quality, mainly due to the CENI procurement process. No Congolese should be deprived of their right to vote because the CENI is incapable of producing voter’s cards in good condition,” they stated.

CENI were also reminded of their violations of the Congolese electoral law by going ahead with publication of provincial voter lists while sitting government officials, also bidding for election, have made public political campaign statements to disadvantage the opposition.

“By its press release no. 050/CENI/2023 of October 5, 2023, in violation of articles 6 and 8 of the electoral law, the CENI resumed the display of voter lists. Meanwhile, in defiance of the most basic rules of electoral justice, provincial governors and political actors of the regime are poisoning the political climate with declarations and the adoption of arbitrator measures. The cases of the governor of central Kasai who addressed the populations by using them to not tolerate the campaign of any candidate other than that of the outgoing president and that of the governor of Kinshasa threatens advertising agencies who would like to offer their services to displays opposition candidates is one classic example,” they explained.

The DRC goes to the polls on the 20th of December 2023 to elect its 6th president with 25 candidates including incumbent Fèlix Tshisekedi, in the race.- DRC News Today

GOVERNMENT SAYS IT WILL NOT BE INVOLVED IN THE RIVALRY WITHIN THE PATRIOTIC FRONT ( PF) – JACK MWIIMBU

Minister of Home Affairs and Internal Security Jack Mwiimbu says Government is aware of the squabbles within PF, but will not take sides.

Mr Mwiimbu also clarified that the PF secretariat was closed off recently to both rivalry intraparty factions so as to ensure that violence does not engulf the country.

He maintained that the rule of law will continue to govern the country and that lawlessness will not be tolerated.

“We have noted the intraparty squabbles and violence obtaining. We have issued currently obtaining between two rival factions in the PF. They have take each other to court. Relating to the issues in court, I want to state that we have no role to play within the intraparty squabbles in PF.

There are accusations that we are taking a side, but we will not take sides. We did provide security to ensure the PF secretariat was protected. If we did not move in , there would have been a blood bath. It is our responsibility to protect lives of individuals and property.”

Mind you, the PF secretariat is in the Central Business District (CBD) and so if violence takes course, the whole Lusaka will be affected,” he said.

He noted that it is Governments responsibility to protect lives of Zambian’s whether PF or not.

“If is was wrong for us to protect lives and property of individuals, then I take responsibility. As you are aware, the political rivalry is in court and so we do not want to comment. The matter will be sorted by the two rival factions. We will not behave the way PF behaved by destroying the Movement for Multiple Party Democracy (MMD). Those that destroyed MMD are part of the saga in PF. The fight is between the two,” he said.

Mr Mwiimbu also noted that Government is aware that opposition political parties has petitioned Southern Africa Development Community (SADC) leaders pertaining to the alleged lack of political space in the country.

“For us we believe Democratic space is there. What we have noted and sadly see is that opposition deliberately commit crimes and then cry foul,” he said.

In a world of social media theatrics, Kidist Kifle, the self-proclaimed international wife of Yo maps, recently stirred the pot on her Facebook page. She posted a picture of a woman with the intention of trolling and expecting her fans to join in the insult fest. Yet, fate had other plans.

Much to her chagrin, what should have been a roast turned into a surprising twist. The girl in the picture was showered with compliments and praise for her beauty, defying Kidist’s expectations. It was a moment that left Kidist scrambling.

Kidist had initially captioned the image with a rather condescending statement, “we are not the same sis, I can have your family on payroll.” However, her fans took a different route, becoming incensed at her derogatory words. Instead of joining in the mockery, they rallied behind the girl in the photo, offering words of admiration and encouragement.

It’s a fascinating example of how the unpredictability of the internet can turn the tables on even the most confident of social media personalities. In this digital age, where public opinion is capricious, one should tread carefully, as what’s intended as a jest can sometimes become a lesson in humility.

Did Edgar Lungu defraud the Zambian Govt?

0

By Michael Chishala

Former President Edgar Chagwa Lungu recently announced his return into active politics, to the surprise of no one. According to information in the public domain, it strongly suggests that he resigned as PF President in August 2021 and he then wrote to Cabinet Office informing them he was no longer party President and therefore entitled to his benefits as per Benefits of Former Presidents (Amendment) Act of 1998.

Cabinet Office obliged and have been paying him taxpayer money for his benefits as a former president, presumably because they did their due diligence and were satisfied that he was no longer in active politics. The Act states in Section 5(1) as follows:

5(1) The pension and other benefits conferred by this Act shall not be paid, assigned or provided to a former President who is—

(a) in receipt of a salary from the Government; or
(b) engaged in active politics

“Active politics” is defined in the Act to mean either “the doing of any act indicating a person’s intention to hold elective or appointive office” or “the holding of elective or appointive office” in a political party or in an organization whose main aim is the furtherance of political objectives.

All this raises a number of pertinent issues. Mr Lungu on 28th October 2023 declared out of his own mouth the following as quoted by News Diggers:

“I have decided to return to active politics and continue as president of PF…. I am back to active politics as PF president elected in 2021 with a mandate up to 2026. The PF will hold a general conference at the right time to choose a leader before the next elections in 2026. After this conference, I will hand over to whoever will be elected to lead the PF in the 2026 general elections.”

He was thus clearly admitting that he has been the PF president all along since 2021, hence the use of the word “continue” and referencing his “mandate” up to 2026. Three big issues immediately arise:

1. If Mr Lungu is still PF president from his election in 2021 by his own public admission, does it mean he is guilty of obtaining money under false pretences which is an offence under Zambian law? Why would he claim his benefits from the government if he was still PF president at the time? Does it mean he deliberately misled the government of Zambia that he was no longer in active politics (as defined by the Act) when in fact, he was?

2. Mr Lungu receiving his generous benefits on the basis of a misleading letter he wrote to Cabinet Office suggests he uttered a false document to the government of Zambia. The law frowns upon such, and he may be liable to being prosecuted for this.

3. If Mr Lungu is still the PF president and this was already known to Cabinet Office, why have they been spending hundreds of thousands of Kwacha on him, including spending possibly millions to build him a retirement home?

Mr Lungu might be at risk of being dragged to court for fraud, obtaining money under false pretences and uttering a false document to the government. Provided he did in fact resign as PF President and there is documentary proof of this, he will have to answer some very difficult questions on the witness stand to square his latest public statements with the letters on file.

If he ends up in court and faced with fines and possible jail time he retreats to the previous default position of retirement, his zombie party dies even faster. And it means his foot soldiers have to go fight Mr Miles Sampa without him and that fight will be very ugly and protracted with no prisoners taken.

At least grant me an injunction otherwise Ng’ona will expell me, Mundubile pleads with court

SUPPLANTED leader of the opposition in parliament Brian Mundubile yesterday pleaded with the Lusaka High Court to place a caveat on his removal from his position by issuing a restraining order to PF secretary Morgan Ng’ona, stopping him from changing party structures.

Mundubile who is Mporokoso constituency member of parliament lamented that he is likely to lose his seat in the National Assembly if Ng’ona’s powers are not limited as he is at the verge of being expelled from the party.

In this matter Mundubile is contesting the election of Miles Sampa as PF president in the Lusaka High Court.

Mundubile has Raphael Nakacinda, Sampa, the Registrar of Societies as respondents in the matter.

He is seeking a declaration that the convention held on behalf of the PF declaring Sampa as the president of the party is null and void.

Mundubile wants a declaration that Sampa’s decision to appoint Ng’ona as secretary general of PF is null and void.

He wants the Court to decree that all decisions, orders, statements and correspondence issued by Sampa and his secretary general on behalf of the party are illegal.

Mundubile is further seeking an order stopping Sampa and Ng’ona from executing their duties in the name of the party.

In his statement of claim Mundubile said Article 52(2) of the PF constitution provides that a candidate interested in contesting as party president must indicate his interest to the secretary general of the party.

He said the PF constitution requires that for a general conference to be held, the central committee must summon such a meeting as required by article 58(k) of the PF constitution.

The lawmaker said the national chairman is mandated to preside over all meetings of the party which include the general conference in line with Article 55(c) of the party constitution.

“There was no electoral commission appointed in accordance with article 64 and 65 of the party as there was non compliance with Regulation 67 and 68 of the party Constitution which requires that such meeting shall be called by the central committee,”said Mundubile.

When the matter came up for inter-party hearing Sampa’s lawyers indicated that they could not proceed with hearing as they were not served the documents on time.

Jean Madaika said he could not respond to the claims and oppose the application for an injunction due to time.

Mundubile’s lawyer Patrick Chulu said there was no breach in serving the documents and objected to Madaika’s application for an adjournment as the matter was urgent.

“The major risk in this matter is that if Mundubile is expelled from the PF, he will lose his seat and this matter will be rendered an academic exercise,” Chulu said.

“It is in public domain that as of today the plaintiff has been removed as a leader of opposition in Parliment because of the letter that Ng’ona wrote to Parliament.”

Chulu begged judge Charles Zulu to sign the ex-parte order if he allowed an adjournment so that Mundubile continues shouting ’yayaya’ in parliament pending determination of his case.

Judge Zulu ordered the parties to file necessary documentation by today and scheduled hearing at 17:00 hours. https://kalemba.news/…/at-least-grant-me-an-injunction…/

REVOKE THE APPOINTMENT OF COMPROMISED NEW ELECTORAL COMMISSION OF ZAMBIA CEO- Fred M’membe

REVOKE THE APPOINTMENT OF COMPROMISED NEW ELECTORAL COMMISSION OF ZAMBIA CEO

The Electoral Commission of Zambia (ECZ) is an important electoral management body whose primary mandate is to ensure that elections are conducted in a democratic, transparent, free and fair manner.

The powers of the ECZ, whose fundamental principle as an independent and autonomous electoral body, are guaranteed in our Constitution.

However, we are extremely concerned with the manner in which the ECZ is conducting its affairs, particularly the recent appointment of Mr Brown Kasaro to serve as the commission’s Chief Electoral Officer.

We would like to state from the onset that this appointment is a recipe for disaster owing to Mr Kasaro’s checkered history with the Commission where he once served as director IT.

If only the people charged with the responsibility of appointing Mr Kasaro had cared to consult or conduct a thorough vetting process, they would have known and understood the circumstances under which Mr Kasaro parted ways with ECZ in the first place.

It’s not a secret that Mr Kasaro was relieved of his duties from ECZ as director IT, after his alleged dealings with the UPND were uncovered by one of the state security wings. Mr Kasaro stood accused of so many things, which portrayed him as a compromised individual and therefore, made it impossible for him to continue his career with the Commission.

It therefore, goes without saying that the appointment of Mr Kasaro is inappropriate, unacceptable and should be immediately revoked. Clearly, there is a demonstrable reason for the revocation of this appointment owing to Mr Kasaro’s alleged bias.

With all that has been said and unearthed about Mr Kasaro, surely there is a substantial likelihood that he will not be respected and regarded as a fair adjudicator in the management of the electoral process by all stakeholders, probably with the exception of the UPND, who have planted him at ECZ.

There is absolutely no need for more allegations of bias against Mr Kasaro, before ECZ can decide if he is suitable for the job or not because it’s clear that the person they want to install at the helm of the Commission is not who they think he is or who they believe he will be. The man is a UPND cadre!

There’s more we can say about Mr Kasaro unsuitability for this job but we don’t want to appear personal and petty.

Keeping Mr Kasaro in that job is a recipe for a disastrous and discredited electoral process in 2026. And if ECZ is not careful they will set this country on fire and destroy our democracy for no reason, other than extreme desperation and uncontrolled appetite for money, power and control by Mr Hakainde Hichilema and his league.

Let Mr Hichilema find a job for Mr Kasaro and other UPND cadres at their party secretariat and not sensitive institutions like ECZ.

MADAM SPEAKER & HER HYPOCRISY IN ZAMBIAN PARLIANMENT

MADAM SPEAKER & HER HYPOCRISY IN ZAMBIAN PARLIANMENT

By: iTvNews Editorial part 1

In this quick editorial piece, we just want to submit a few issues of concern with regards to what is going on in the Republic of Zambia, centering on the ongoing abuse of the law by the Hichilema led government which has coined itself a name of “New Dawn” when the reality is totally opposite.

It is very clear that President HH’s UPND government is determined to ignore the concerns and cries of those who elected them into office, but wants to preside over a Country where only those singing praises to the President, a thing which we can assure him that he will not achieve.

This is because Zambia is a democratic nation with over seventy tribes whose beliefs and approach to national issues are equally different. This is what solidifies democracy.

First forward, just today, November 1st 2023, speaker of the National Assembly, Madam Nelly Mutti ejected Kamfinsa Member of Parliament, Hon. Christopher Kang’ombe who took to the floor in an attempt to raise a matter of urgent Public Importance. Unfortunately, the core matter will never exactly be known as he was curtailed.

As is now the new normal, Ms. Mutti quickly interjected the law maker claiming that she had already known what the MP needed to talk about.

And now we ask ourselves the following questions;
1. When did Madam Nelly Mutti become a sangoma {witchdoctor} or God for her to start reading people’s minds and immediately gag them even before hearing what they want to say?
2. What was so difficulty for the speaker to allow the lawmaker to put his point across, whether useful or not , then later give a ruling of her choice or to the satisfaction of whomever she may want to impress? Besides, it seems she is immune to shame and now comfortably shows bias towards the executive.
3. Why is the speaker always in a hurry to ‘defend or speak’ on behalf of MPs/Ministers on the right-hand side or executive? Has President HH appointed incompetent leaders such that they always need the speakers shield in the house?
4. Is there another position she is eyeing better than that of the dignified Speaker of the National Assembly for her to keep doing tuchawa, Muzungu anikonde {praise singing/boot licking} to the powers that be?
5. Must we propose that she makes use of video footage available in the Parliament library on how to preside the affairs of the house that feature her predecessors?

MUTTI’S HYPOCRITICAL RULING:
We have also noticed as an editorial team of iTvNews another embarrassing and hypocritical judgement passed by the Speaker of National Assembly prior to the incident of the Kamfinsa MP in which she kept on disturbing the debate through her usual unnecessary interjections to Shiwang’andu MP, Hon. Stephen Kampyongo.

The MP reminded the speaker that the house, through her stewardship was breaching the Constitution of Zambia under article 74 {2} on the procedure of appointing Leadership of the opposition, Chief whip and the deputy Chief whip.
Ms. Mutti literally ignored the advice such that she kept on arguing and exchanging words with Hon. Kampyongo who at that point she had willingly given the mandate to speak.
In her ruling she said it was not her duty to determine whether or not there was a constitutional breach in the Miles Sampa case.
The speaker in her “hypocrisy” ruled that such matters can only be determined and interpreted by the constitutional Court. At this point we dropped our jaws at the inconsistencies.

This is the same Speaker who made a biased ruling on December 7th 2021 when she ‘arrogantly’ banned nine PF MPs whose seats were nullified by the High Court from attending Parliament business.

This is despite the fact that the nine affected MPs had filed an appeal to the constitution Court. Ms. Mutti disregarded the advice from the legal experts including those who have served in Parliament before her with the likes of Hon. Given Lubinda who clearly stated that the decision of chasing away the nine MPs whose seats had been nullified was illegal and indeed she was later found wanting by Constitutional Court which quashed her biased ruling.

For the avoidance of doubt here are the names of the nine MPs who suffered injustice at the hands of Ms. Mutti. Bowman Lusambo (Kabushi), Joe Malanji (Kwacha), Allen Banda (Chimwemwe), Kalalwe Mukosa (Chinsali), Mutotwe Kafwaya (Lunte), Lucas Simumba (Nakonde), Taulo Chewe (Lubansenshi), Christopher Chibuye (Mkushi North) and Sibongile Mwamba (Kasama Central).

The nine MPs petitioned the court, and the Speaker’s decision was quashed for being illegal, unreasonable and unfair on March 22nd 2022.

So, how can Speaker Mutti today claim to be a law-abiding citizen? Is it because the move by Miles Sampa seems to favor the UPND politically, a party which nominated Madam Mutti?

This is hypocrisy of the highest order or double standards which can be equated to the words of former late South African President Nelson Mandela who said “A person who changes his position depending on whom he is dealing with, is not a leader who can lead a nation”.
The is the exact case of speaker Nully Mutti. Our summary to this rather long editorial piece is to advise the speaker, hoping that she will now listen, is that hers and the job of her deputies is to play referee. Nothing more.

Otherwise, the happenings in the people’s house are unacceptable to Zambia’s democracy and if anything, we wish to ride on the words issued by OCIDA through Emeritus Archbishop Telesphore Mpundu on the need for President Hichilema and his government to tame Ms. Mutti and her deputies because the presiding officers especially Ms. Mutti and second deputy speaker Moses Moyo are not helping the President but frustrating his vision.

Madam speaker!
Curtailing or “inciting violence” in Parliament does not make one a good speaker and this is alarmingly. This must be stopped because that is our Parliament whose dignity we should preserve at all cost.

Madam speaker and your deputies!
Be aware that the same way Dr. Kaunda, Mama Betty, Lily Monze, Kapwepwe, Mainza Chona and many others fought the colonial masters in a quest to champion Zambia’s Independence, you shall be fought as well by the current generation you are trying to frustrate.
We end here for now

Cabinet Approves Review of Minimum Wages

0

Cabinet has granted its approval for the issuance of a Statutory Instrument (SI) pertaining to the revision of minimum wages and conditions of service for various categories of workers covered by the Minimum Wages and Conditions of Employment Act. This decision comes in response to the recommendation put forth during the Tripartite Consultative Labour Council meeting, where government representatives, Trade Unions, and employers’ representatives collectively concurred on the necessity of reviewing the existing minimum wage rates.

The announcement of this pivotal development was made following the 18th Cabinet Meeting, which took place on Monday under the chairmanship of President Hakainde Hichilema. This is according to a press statement released to the media by Chief Government Spokesperson Cornelius Mweetwa.

Mweetwa explained that the decision to review minimum wages was guided by the desire to ensure that workers earning the minimum wage receive improved conditions of service, acknowledging the rising cost of living that affects their livelihoods.

The issuance of the Statutory Instrument represents a pivotal step in addressing the well-being and economic security of the nation’s workforce, particularly those in lower-paying employment sectors such as domestic workers and shop workers. The revised minimum wage rates aim to align better with the current economic realities faced by workers.

In addition to the review of minimum wages, Cabinet also approved the issuance of the National Pension Scheme Authority (NAPSA) Penalty Waiver Regulations for the year 2023. This action is intended to enact the provisions of the National Pension Scheme Amendment Act Number 20 of 2022 concerning penalty waivers.

The NAPSA Penalty Waiver Regulations, 2023 will significantly alleviate the financial burden on businesses and offer relief to employers regarding the settlement of their outstanding NAPSA contributions.

Furthermore, Cabinet has greenlit the introduction of three key bills to the Zambian Parliament. These bills are the Zambia Institute of Procurement and Supply Bill, 2023, the Zambia Institute of Architects Bill, 2023, and the Zambia Institute of Quantity Surveyors Bill, 2023. Each of these proposed legislative measures holds the potential to bring positive changes and enhancements to their respective professional sectors.

Lastly, Cabinet has endorsed the Amendment Protocol on the Agreement for the Establishment of the Intergovernmental Standing Committee on Shipping of goods in international trade. This decision reflects the government’s commitment to streamlining and enhancing international trade procedures.

The series of approvals and legislative measures demonstrates the government’s dedication to fostering improved conditions for workers, supporting businesses, and facilitating streamlined governance across various professional sectors.

THE FREE EDUCATION LIE, DECEPTION- Fred M’membe

THE FREE EDUCATION LIE, DECEPTION

The importance of free education needs neither theoretical nor political discussion. The right to education has been recognised as a human right in a number of international conventions, including the International Covenant on Economic, Social and Cultural Rights, which recognises a right to free, primary education for all, an obligation to develop secondary education accessible to all with the progressive introduction of free secondary education, as well as an obligation to develop equitable access to higher education, ideally by the progressive introduction of free higher education.

And free education must be free education. Things must be called by their right names. What resembles free education may not necessarily be free education and as such it shouldn’t be called free education – it should be called by its right name.

What Mr Hakainde Hichilema has been calling free education is really not free education as such – it is something else, something that may resemble free education but is not.

Let’s try to closely examine Mr Hichilema’s free education:

1. FUNDING: Providing free education to citizens requires significant financial resources. Schools are underfunded and are barely surviving. For instance, there is no free education for pupils in the boarding schools. Instead, the government has dictated that parents must pay K1,000 (one thousand kwacha) per child per term. This money goes towards the procurement of foodstuff for 90 days. Now, divide 90 days into K1,000. It gives you K11.11. Divide this K11.11 into three meals (breakfast, lunch and dinner). It gives you K3.70. What kind of meal can one buy for K3.70? How are head teachers in boarding schools managing things? They have removed fish, beef, and chicken from the menu. Children are eating soya chunks and cabbage.

The government only sends K200 (two hundred kwacha) to all secondary schools (both boarding and day) per child per term, to cater for teaching and learning materials, maintenance of infrastructure, administrative issues, allowances for staff, orphan and vulnerable children, and co-curricular activities. So a basic school in a rural area, which has 80 pupils in grades 8 and 9, receives no more than K16,000 (sixteen thousand kwacha) per term. These meagre amounts sent to schools have terms and conditions, just like the IMF. A percentage meant for the maintenance of infrastructure, for example, cannot be used for the procurement of foodstuff, even in the event that the school has run out of food. That would constitute a misapplication of funds. Head teachers are struggling a lot, and most of them have developed hypertension under Mr Hakainde Hichilema’s government.

2. INFRASTRUCTURE AND RESOURCES: Mr Hichilema’s government has only introduced so-called free education to learners in day schools from grades 8 to 12. This has created a challenge of inadequate infrastructure and limited educational resources, such as textbooks, digital technologies, and school facilities. Expanding free education while ensuring quality requires substantial investment in infrastructure development and resource allocation. The haphazard CDF arrangement is not helping in any way as regards infrastructure development in education. This situation calls for a massive construction of schools across the country.

3. TEACHER SHORTAGE AND QUALITY: Recruiting and retaining qualified teachers is essential for the success of free education. The employment of 30,496 in 2022 was a very good effort. However, simple research has shown that many teachers who were posted in rural areas have started going back to urban areas through transfers based on political connections. Schools in remote areas are still lacking teachers, compromising free education.

4. EQUITY AND ACCESS: Although free education aims to promote equitable access, there are disparities in accessing education, particularly in remote or marginalised areas. Ensuring that all children have equal opportunities requires addressing barriers, such as distance, gender disparities, and cultural factors that may inhibit access to education.

5. EFFECTS OF THE RISING COST OF LIVING: Before Mr Hichilema’s so-called free education, parents in rural areas were paying K150 per term, while those in urban areas were paying K200 per term per child. In addition, the government was sending schools grants every term. Whatever benefits could have accrued from the removal of the K150 and K250 school fees per term have completely been eroded by the increasing cost of living – the high cost of mealie-meal, relish, and transport prices.

6. PROPAGANDA: The dissemination of biased and misleading information in order to shape public opinion by Mr Hichilema’s government has really destroyed education. Taken at face value, one would think Zambia was doing very well in the education sector. But frankly speaking, the fake free education has destroyed the little quality that remained before Mr Hichilema took office. The government does not talk about things that matter most, such as literacy levels, learner performance, skills development, teacher motivation, and so on. It is busy manipulating and controlling public opinion by presenting selective information. Creating a biased narrative that aims to persuade people in favour of its policy of fake free education won’t do. The government paints a picture as though it introduced free education for the first time in Zambia. It portrays to the public like it is spending a lot of money on free education. This is a lie, a deception; and by 2026, Zambia’s education will be of very low quality and useless.

OF THE SPEAKER AND THE HOUSE

OF THE SPEAKER AND THE HOUSE

By Ackim Katebe

I have been a follower of parliamentary debates for a long time now since the time I had worked at Parliament, albeit for a short time.

I can talk of a lot of great debtors we have had in the past and I can as well talk about the presiders who were great.

Looking at our Parliament, where we stand as at now looking at where we are from, I can tell you that this is the worst Speaker in the history of our Parliament to have ever presided over that house together with her deputies, and these are problems.

When we raised a red flag for appointing a known UPND supporter to an impartial role of a speaker, it’s such issues we were trying to avert.

As the speaker of the National Assembly, your role is to preside over parliamentary proceedings and ensure fair play among members of Parliament, but with this speaker that is not the reality.

When I say this is the worst presider, it is not because I lack a word in the Queen’s language to call her for what she has so far shown, I mean just that. To qualify my claim, let’s consider these qualities;

Impartiality: As a Speaker, one is supposed to maintain impartiality by treating all members equally, regardless of their political affiliations. Your decisions should be based on parliamentary rules and procedures, not on personal or political biases. This is not the case with Madam Nellie Mutti.

Enforce Rules: Be well-versed in parliamentary rules and procedures, and consistently apply them. Ensure that members follow the established rules of debate, speaking time limits, and order in the chamber.

Facilitate Debate: Encourage constructive and respectful debate. Allow members to express their views and engage in discussions while ensuring that the debate remains civil and focused on the issues. Today Hon. Kangombe was stopped from debating even before he debated, he was merely building to his point yet he was stopped. This is not the only case, there plenty examples I can cite.

Maintain Decorum: Uphold the decorum of the chamber by preventing disruptions, personal attacks, and any behavior that undermines the dignity of the Parliament. In our Parliament, when the opposition Member is debating, the rulling members pass comments and it is all ok with the speaker but if roles are reversed it becomes a problem for her.

Balance Speaking Time: Allocate speaking time fairly among different political parties and individual members to ensure that all voices are heard.

Respect for Minority Views: Ensure that minority views and opposition voices are respected and given the opportunity to be heard, even if they differ from the majority.

Decisiveness: Make timely and firm decisions when disputes or breaches of parliamentary rules occur. Your decisions should be based on the principles of fairness and parliamentary tradition.

Protect Parliamentary Privilege: Safeguard parliamentary privilege, which allows members to speak freely in the chamber without the risk of legal action. This is crucial for open and robust debate.

Transparency: Be transparent in your actions and decisions. Clearly communicate your reasons for making specific rulings or taking certain actions.

Consultation: Consult with parliamentary leaders and members when making important decisions that affect the functioning of the assembly. Seek consensus whenever possible. The PF MPs were never consulted on the issue of the Leader of the Opposition in Parliament yet she expects peace.

So when I say this is the worst, it’s because of the highlighted pointers that I feel are lacking and will bring anarchy in the house of the highest order that this country has never witnessed.

Democracy should not just be talked about when it suits the occasion, it must be seen in how we deliberate national matters

This Speaker has gone to every length to stifle opposing voices so much so that every other day, there is a member from the opposition who is told “seat down”, “get out of the house”, just like that. Debates are nolonger enjoyable to watch and listen to because the debates are one sided.

If nothing is done, I foresee a crisis coming our way in that house.
