Revealed: Patrick Shai Tried To Reach Out To Cassper Off-Camera

Veteran actor Patrick Shai died a broken man.

This was revealed by a close friend and colleague, Botlhale Modisane, who is from the Tshegofatso Pule Foundation.

Modisane told a local publication that the actor who hanged himself in his garage at his home in Dobsonville, Soweto, was misunderstood.

Before his death, Shai had tried to reach out to rapper Cassper Nyovest to explain the meaning behind a viral video and that he meant no harm.

In the video in question, Shai had challenged the rapper to a boxing match and later apologised.

He apologised on social media but still wanted to speak to Nyovest personally.

According to his close friend Modisane, Shai challenged the rapper to a match so that he could raise funds for anti-gbv organisations.

Shai was passionate about GBV issues in the country. As quoted by Sunday World, Modisane said:

“He formed the Khuluma Ndonda Foundation and wanted Cassper to answer to the challenge so they can have a proper meeting.

He wanted to explain the context of the video that he shot to promote the boxing match.”

iHarare had reported that Shai who was well known for his roles on Generation, 7de Laan, Skeem Saam and The River, went viral just a couple of days ago when he shared a video of himself insulting Cassper Nyovest and his family.

“Before I die I want to make sure that I’ve beat you so that on my tombstone they can write this is the man who beat Caster or Costa or whatever your sht name is … Come you son of a btch,” Patrick said.

In response, Cassper did not take this lightly and released a series of tweets defending his family. Tweeps also mercilessly dragged him even after he issued an apology.

Following news of his death, tweeps think Patrick Shai was depressed, suicidal and the video was just a cry for help.

However, some are opinioning that the backlash he received from social media could have prompted him to commit suicide.- iHarare

Zambia’s success will be Africa’s success- HH

The year 2021 has been a landmark year for Zambia. Two important events occurred. The passing of the first president of independent Zambia, Dr. Kenneth Kaunda, was mourned in June. Then, in the election in August 2021, the people of Zambia voted decisively for change.

I mention the passing of Dr. Kaunda because Zambia has strong roots. He was a person who sought to serve ordinary Zambians and, even if some of the policy decisions his party made did not have optimal outcomes, his intention was to place ordinary Zambians at the center of the country’s development.

Sadly, Zambia has not lived up to its promise. Over the last decade, we have witnessed the erosion of our economy and the corruption of our politics. As a consequence, our debt has risen to unsustainable levels, reducing the country’s capacity to invest in productive areas of our economy and its ability to address the gaps in health care, education, and other social services.

Our national budget has been overwhelmed by debt servicing, emoluments, and consumption, when there should have been greater room for investment and growth.

The scourge of corruption has eroded our much-needed resources including the debt itself, robbing us further of the opportunity for growth.

This slide towards debt, disaster, and dependency set our country on a bleak course.

Fortunately, the people of Zambia that decided to change direction and the election—notably under difficult pandemic conditions—saw a change of government and the opportunity for a new beginning.

It was our third peaceful, democratic transfer of leadership since the advent of multi-party democracy three decades ago. It was an African success.

Notably, Zambia’s transition is an example of Africa’s success in addressing its own challenges: The African Union played an instrumental role in ensuring our smooth transfer of power.

This transition also sends a clear message that Africa embraces the right to democratic choice. It comes after the historic stand taken by the courts in our neighbor, Malawi, where a rigged election outcome was rejected, and new elections were successfully held in 2019.

In both these cases, it was Africans who held the election, contested it, and adjudicated on its fairness. We can say with pride that Africans own democracy on the continent.

The road ahead will not be without challenges but, with a clear vision and plan, and with relentless determination, we will deliver on the aspirations of our people.

My administration’s focus over the next five years will be on restoring macroeconomic stability and promoting the growth of the economy.

We will pay special attention to lowering the fiscal deficit, reducing public debt, and restoring social and market confidence. We will also promote national unity and good governance by strictly adhering to the rule of the law and democratic accountability.

Our priority is a simple one: We must find a way to include the jobless youth in our economy. In order to do that, we need to build our economy by encouraging new investment and giving our young people the skills they need to participate fully in the economy.

Growing the economy requires agile thinking that uses all the levers at our disposal. We must urgently attend to restoring our mining sector to its rightful place as a leading global producer of copper by ensuring regulatory fairness and attending to obstacles that stand in the way of new investment. We must strive to increase the production of copper and other minerals so that Zambia can reclaim its place as one of Africa’s leading mining countries.

We need to make Zambia a preferred investment destination by cutting red tape and reducing policy uncertainty which cause investors to hesitate.

We must encourage the growth of new businesses. We need 1,000—perhaps even 10,000—entrepreneurs to bloom, igniting our small business sector as a key employer and source of innovation and growth.

To do this, we must make it easier for small businesses to gain access to capital. Government must understand the challenges that entrepreneurs and investors face, and do its part to welcome investment, growth, and innovation.

None of this will happen without clean and purposeful governance. The institutions mandated to investigate and prosecute will be given unfettered autonomy to act without fear or favor and without political bias. Malpractice and mismanagement must be rooted out.

From the election to economic recovery, Zambia’s success will, in this way, be Africa’s success.

TIME TO REPEAL THE PUBLIC ORDER ACT

The decision to summon to Police, Opposition leaders that held a press briefing at Southern Sun Hotel on Monday, brings into sharp focus the debate that must foster outstanding changes regarding the Public Order Act.

Patriots for Economic Progress( PEP) has announced that he has received a call-out to report to the Police Service Headquarters for investigations.

He says this is in apparent relation to a press conference held at Southern Sun Hotel by seven Opposition leaders, to raise serious concerns over public and governance issues.

The leaders included Harry Kalaba of the Democratic Party, New Heritage Party leader, Chishala Kateka, People’s Alliance for Change (APC) Andyford Banda, National Democratic Congress leader, Saboi Imboela, Economic Freedom Fighters leader, Kasonde Mwenda and United for Better Zambia leader, Hector Soondo.

PUBLIC ORDER ACT AND THE NEED TO REPEAL IT

The Public Order Act has been challenged regularly and culminated in the Christine Mulundika case in 1996.(CHRISTINE MULUNDIKA AND 7 OTHERS v THE PEOPLE (1995) S.J.).

In the Mulundika Case, the appellant challenged the constitutionality of certain provisions of the Public Order Act Cap 104, especially section 5(4).

The challenge followed on the fundamental freedoms and rights guaranteed by Article 20 and 21 of the Republican Constitution.

In its Judgement, the Supreme Court quashed the said provisions and held that sub-section 4 of section 5 the Public Order Act, CAP 104, contravened Articles 20 and 21 of the Constitution.

For this reason the said provisions were declared null and void, and invalid for their unconstitutionality.

But the Government quickly drafted a fresh law circumventing the judgment and literally reinstated the quashed provisions.

However, the provisions that removed the need to obtain a permit were revised to petitioners informing the Police about a procession tbrough a seven days’ Notice.

There is still great misunderstanding on the application of the law as the Police always assume that the Notice lodged in amounts to an application for a Permit.

The Police has regularly denied parties and citizens to hold public processions, demonstration, rallies or public events citing a long list of irrational excuses including the lack of man-power or public insecurity or the presence of the President or Vice President in an area.

Clearly, it is time to repeal this obnoxious and archaic colonial law that governments after government have used and abused for their own preservation.

The Public Order Act infringes on various constitutionally guaranteed rights and freedoms such as the rights to assemble, expression, and movement.

Empowerment funds given to PF artists will be recovered by govt Arts- PS Pastor Kangwa Chileshe

WE’LL RECOVER EMPOWERMENT FUNDS FROM ARTISTS, VOWS PS

MINISTRY of Youth, Sport and Arts Permanent Secretary Kangwa Chileshe says government will not scrape off any loans which were paid to artists, adding that legal action can also be taken if need be.

On August 12, 2020, government gave K30 million as Presidential Arts Empowerment Fund, through the National Arts Council (NAC), to ‘deserving artists’ as loans.

In November 2020, 152 artists in various categories benefited from the revolving fund.

In an interview, Kangwa said effective January month-end, beneficiaries would be required to present their payment plans to the Ministry.

“There are situations where youths genuinely borrowed money, went into a project and there are records to that effect. But they are struggling for one reason or the other. It could be pandemic, lack of skills or they entered into a business without knowledge.

We are not going to take a blanket approach and say let us scrap off the entire debt. We cannot do that because these are national resources. We are accountable to Zambian people who put us in power for those resources,” Kangwa said.

“The number one objective for us as a Ministry is recovery because we want to be transparent with our resources. There are situations where these resources were used for political expediency.

In the sense that when they were being given out, the intention and motive was not actually for young people to pay back. In such situations, we demand obviously that they pay back so that things are corrected. We do demand that those resources be paid back.”

Kangwa said beneficiaries of the empowerment fund had the responsibility to pay back.

“The empowerment funds which artists were given, my expectation obviously is that artists who were given finances under CEEC, National Arts Council and basically through this Ministry have a responsibility to pay back the Zambian people.

They have a responsibility to pay back and so we expect them to pay back. We are not scraping off any debt for any artists concerning how much money they borrowed,” he said.

“Infact, if I were them, I would actually present myself to the Ministry as opposed to the Ministry starting to pursue them. They are the ones who should come to the Ministry and talk to us.

They should say I borrowed K500,000 or a million Kwacha and this is the plan I have to pay back. They can say give me time and this is the amount I am able to remit the Ministry this month. I am expecting that because that is responsibility.”

Kangwa said the Ministry had already written letters to 80% of the beneficiaries reminding them to remit the funds.

“Now if they are going sit down and wait and say we will see what they will do, then letters are going to find them. Infact, we have already started writing letters to everyone. Anyone who got a cent from this Ministry, we have written to almost 80% of them to pay back so that is the expectation. Even those that acquired whatever form of loan, there is correspondence in every part of this country for them to pay back.

If they are not in a position to start remitting, they must come to the Ministry and give us a position on how they might be able to do that in the nearest future. So that is where we are and we are not leaving any stone unturned,” he said.

“Listen, we are not trying to punish the young people but we are just trying to set a standard and a standard that stipulates that we must be very prudent in the management of resources for this country. We must be very careful because these assets belong to Zambians.

You know, the crisis we have in this country is the issue of youth unemployment and lack of entrepreneurship. So if we take a laissez-faire attitude towards resources, we are not going to achieve anything. So it starts with fiscal discipline. And this Ministry, being Youth, Arts and Sports, we must be exceptional in the execution of discipline.”

Kangwa said the UPND government was not going to victimise the youths.

“By the end of the month, we will have a Youth Director and we will have a full-fledged department. This means that effective even at the end of this month, there will be a requirement by the artist to begin to do what I have just told you. So the delay does not mean that we have forgotten about it and we are not going to act on it, no.

So before we finish everything we are doing in-house and complete the alignment of the Ministry by the end of the month, my expectation is that the wise ones will begin to engage us as a Ministry as opposed to waiting on us to take action,” said Kangwa.

“So everything is on the table including legal action. That is why I am saying there are no jokes because it is serious business. Everything is on the table to recover stolen and misused assets. We are also saying the UPND government did not come to victimise the youths but we have a human face.

So it is not like we are going into a fight but we only want to help the youths. What we do not want is people being used by political parties to strip the Ministry of its assets. We want the youths to be genuine.”

Zambia, Not Yet Uhuru- Zimbabwean Human Rights Activist Hopewell Chin’ono

Africa should NOT judge new presidents on civil service salary increments or nice sounding populist speeches.

New African presidents should be judged based on the people that they appoint to serve in their new Governments and judged on whether they are building STRONG state institutions, and finally on their legacy after leaving office.

Africa’s demise has been mainly caused by idolizing political leaders instead of idolizing state institutions and deriving a patriotic sentiment from competent institutions not populist personalities.

Institutions matter more than people in power because they precede us all, people come and go so a state can’t be modelled on a person.

Yes, Zambians can and should applaud it when pensioners get paid their money on time unlike in the past, and when teachers and nurses get salary increments, but that should not be the primary measure of one’s presidency because those are the basics that any Government should deliver.

The bar had been set so low by the PF Government such that President Hakainde Hichilema doesn’t need to do much to get a round of applause.

But is that how he is going to be measured, based on a corrupt and incompetent previous regime?

The REAL measurement of a new president’s abilities especially those that emerge from opposition should be on whether he or she allows state institutions to be strong and independent.

The governance bar has been so low in Africa, it is literally on the floor, such that we ululate at small things that should ordinarily be normal, and we become defensive when the leaders we support are criticized.

Such intolerance is what built the Mugabes, Chilubas, Lungus, and now the Chakweras of Africa.

Presidents come and go, what we should celebrate are strong state institutions which they would have built or strengthened in order not to allow any new president to abuse citizens using state power as we are accustomed to in Zimbabwe.

We should ask ourselves a simple question.

Can the president in your country be stopped by state institutions from jailing you when you have not committed any crime except for calling him out or exposing their corruption?

If the answer is NO, then it is not yet time to celebrate unless if they surrender real power to the state institutions, and know that their job is merely administrative, and to lead and not to rule.

The African is still awkwardly backward because he or she follows political personalities instead of following and feeling protected by institutions of the State.

Americans love their country and institutions and not necessarily an individual because people come and go, but institutions remain.

When I lived in Britain, I knew that if I called the police for assistance, they would protect me when I am in danger.

In Africa you must call an uncle who is connected to a policeman.

Sadly, the police will need permission to do their work in Africa or to arrest a person of political interest.

The police are an example of an institution that needs to be strong and independent and not take instructions from political elites.

In Malawi a warrant of arrest was issued on Friday because a protest leader had said; “We thought Chakwera was a wise man, but he is proving to be a fool”.

This is the same President Lazarus Chakwera who in 2019 when he was in opposition said this; “Whether or not what the legislator said about Mutharika was an insult is not the issue. The issue is that this idea of arresting any Malawian, not to say anything of one who is a parliamentarian, for merely expressing how they feel about the illogical conduct of Mutharika’s failed government, is primitive, unacceptable, and stupid.”

The Malawian scenario proves that charisma will take you to the top, but only integrity will comfortably keep you there.

I have also made the same mistake of looking at individual presidents through the few things that they would have gotten right or through populist demagoguery.

It is because I have seen so many bad things being done by their office forebearers, the day you see good, you are overwhelmed with joy. That is a dangerous mistake I have made.

The question of measurement of a president’s success should be answered by the legacy of that president, and not only the things they say to make the citizens and media happy without necessarily seeing the real substance of their delivery.

So from now on, I want to see how President Hakainde Hichilema handles the issue of taking hordes of Government workers including army generals to see him off at the airport or welcome him back home.

I want to see how he reforms institutions like the national broadcaster, and how he handles the issue of his advisor and permanent secretary who were plotting to abuse their office power and implicating President Hichilema in the process.

Zambian National Broadcasting Corporation, the Zambian equivalent of the Zimbabwean Broadcasting Corporation still broadcasts live visuals on television of President Hichilema leaving the country.

That is extra ordinarily foolish for a poor country like Zambia because doing so costs loads of money.

The president will be at work, the citizens will see him leaving during the ordinary news bulletin if need be.

But President Hichilema departures are now comical broadcasts on television, not even Robert Mugabe did that, that is how ridiculous it is.

That does not signal change, President Hichilema might be a good man, but if these things keep happening this way, it means he appointed the wrong people, something that gives away on his leadership style and capabilities.

His officials implicated him in a corrupt scandal last week, if he keeps them in their positions, it means what they were saying about him was correct, again it speaks into the REAL him, and that is tragic for a man who came to power with such fanfare.

So firstly we need to establish, why do formal institutions fail?

They fail usually because incumbents either appoint incompetent loyalists to head them or ensure that they are not adequately funded to enable them carry out their operations.

Although President Hichilema has made great appointments to the offices of Chief Justice and Central Bank Governor, he has appointed partisan officials to key positions in the civil service such as permanent secretaries and district commissioners.

He is also yet to initiate any significant institutional reforms aimed at strengthening the independence of the judiciary and anti-corruption agencies and reducing the power of the executive.

Take the issue of Zambia National Broadcasting Corporation, is the responsible minister capable of understanding what needs to be done?

That is a question that Zambians should be answering.

Secondly, when President Hichilema was in opposition politics, he was highly critical of laws that successive incumbents had used to undermine the opposition parties including his own party, and to undermine democracy.

These include the Public Order Act which regulates public assemblies, the defamation of the president Law which criminalizes ridicule or insults against the Head of State, and the Cyber Security and Cyber Crimes Act, which polices the use of social media.

The then main opposition leader Hichilema pledged to reform the first and repeal the last two immediately when elected.

This requires a legislative agenda, why hasn’t he done it in 6 months since being elected since he said he will do it as soon as he is elected?

So far, he has done neither. Instead, as we have seen in Malawi, the police have used the same legislations to arrest Hichilema’s critics for insulting the president, and to undermine media freedom.

It may be too early, but questions are now being raised about his commitment to strengthening democracy in Zambia and that should worry him if he is serious about implementing his flowery election promises.

Thirdly, presidents succeed or fail based on the team that they choose to surround themselves with.

Abraham Lincoln is famous for putting together a “team of rivals”.

Whilst in opposition, President Hichilema said he would appoint competent and credible individuals of unquestionable integrity to government.

In power, he has so far done the opposite and shown unwillingness to dismiss aides engaged in scandal.

Two examples illustrate this point. The first was his failure to dismiss a presidential advisor for dishonesty.

In November 2021, a leading private newspaper uncovered a scandal in which a newly appointed Special Assistant to the President for Economic Affairs was publicly exposed as being dishonest.

The facts of the case were that the State House advisor, Jito Kayumba, had publicly and in his curriculum vitae claimed to be a member of the Board of the Bank of Zambia.

The Bank of Zambia moved to complain about this embarrassing deceit.

Kayumba’s attempt to cover his tracks were followed by further revelations of how he had repeated similar false claims elsewhere.

It hardly needs to be said that high Government officials, both within cabinet and State House, need to be of impeccable integrity.

In this regard, President Hichilema has explained the long delay in appointing such officials by pointing to the need to spend time examining the background and integrity of possible candidates.

Such integrity is particularly crucial in a programme of cleaning up a government system riddled with corrupt practice.

Following a public clamour for the resignation or dismissal of the advisor, President Hichilema, in a tell-tale sign of how he might deal with the possible corruption involving members of his inner circle, simply kept quiet.

When he finally spoke, it was through his spokesperson who claimed that; “President Hichilema is committed to upholding the highest levels of integrity, transparency, and accountability, retain[s] the highest confidence in [the advisor] and holds [him] in the highest esteem.”

This statement entails a disastrous dislocation between adherence to the principle of integrity followed by its immediate repudiation in practice.

The second example involves President Hichilema’s political advisor, Levy Ngoma, who was recorded in the leaked conversation planning how to use state institutions to sow seeds of internal divisions in the opposition Democratic Party.

In addition to the fact that a state official is using taxpayers’ resources (time, office, insights, etc) to advance partisan interests, Ngoma explicitly implicated President Hichilema, making it clear that his actions were endorsed by the president.

It is disappointing that a political leader who spent time fighting efforts by incumbents to undermine his party when in opposition is now doing the same to opposition parties now that he is in power.

Most importantly, President Hichilema has neither denied that he was involved in the Ngoma scandal, nor moved to dismiss his official for using public office to undermine state institutions and the political opposition.

Instead, as he did in the Kayumba case, the president has simply kept quiet in the hope that the issue will die with time.

A president’s commitment to upholding integrity in public office is measured by how he deals with the dishonesty and other transgressions of those close to him that he appointed.

Recently Zambia media reported that the wife of the Minister of Green Economy and Environment’s was appointed as Head of procurement at power parastatal ZESCO without advertising the post.

ZESCO is a parastatal, these appointments must be competed for! The President’s supporters have point that the wife has always worked for ZESCO.

The question remains, was the post advertised and interviews contacted? The answer is NO.

More media reports from Zambia mentioned that Zambia’s Commerce Minister Chipoka Mulenga’s wife, a qualified Engineer, Likonge Makai Mulenga was also appointed as the new Board Chairperson of the Rural Electrification Authority (REA).

This again is seen as low-level nepotistic appointments meant to reward political friends who are already in cabinet.

Why should we as Zimbabweans or other Africans care about what happens in Zambia and Malawi or any African with new presidents emerging from opposition politics?

We should care because Zimbabwe is part of the SADC ecosystem and our struggles are not uniquely different as Africans.

Presidents Hichilema and Lazarus Chakwera came into power promising to be different from the dictatorships that they opposed.

However, as we have seen in Malawi, President Chakwera is proving to be worse than his predecessor.

Decisions that affect YOU and me as Zimbabweans are made by these leaders at regional level.

The more corrupt and autocratic they are, the more they are likely to side with the Zimbabwean dictatorship as Thabo Mbeki did in 2008.

The more open and democratic they are, the more they will side with the people of Zimbabwe as Presidents Ian Khama of Botswana and the late Levy Mwanawasa of Zambia did.

So, it is in our interests to see a more successful Zambia with strong institutions and a solid democratic culture which detests duplicitous behavior.

Africa or Zambia doesn’t need a president who make soundbite announcements, yet their administrations are doing the same old chicanery that the PF gang under Edgar Lungu used to do. That is not change.

If a leader is still getting people to see him off at the airport and receive him when he comes back from his trips abroad, then he has not changed the culture of bootlicking, and he has no interest in building strong state institutions.

If a leader is still being broadcast live on state television leaving the country, then very little has changed, we should not just change the leader, we should change the system too!

President Hichilema’s supporters have said that it is his officials who are doing these things not him.

If this were remotely true, then he should not only stop these old and comical habits, but he should also make the institutions strong by giving them autonomous power to stop this weird culture of bootlicking through appointment of competent Zambians.

To do that, it starts with the people you appoint!

The dangers of employing incompetent bureaucrats are that they will do unprofessional things in your name in the hope of pleasing their you.

If he doesn’t fire them, it means he is condoning the bad things they are doing.

So ultimately, salary increments should be the product of institutions and not seen as an act of one man’s generosity.

Civil servants should get salary increments because the economic circumstances require that it is done, not because it is a president who woke up feeling happy as happens in Banana Republics.

That can only happen when institutions are strong, autonomous and protected by the law.

Board members of parastatals should go through rigorous interviews and not be picked at the whim of a president.

President Hichilema should go to parliament with a legislative agenda that seeks to fortify Zambian institutions.

Then we will have reason to celebrate his presidency because when things are written in laws, it means individuals can’t circumvent the institutions!

If they do, the law will be demanded to take its course unless you are in Banana Republics like Zimbabwe.

Will President Hichilema do this? That answer will determine whether he will be a good president or another sweet tongued political salesman selling dreams that never come to fruition!

Unless the President appoints competent Zambians and dignifies his office by firing dishonest and corrupt officials, the dream of a better Zambia will remain a fleeting illusion to be pursued, but never attained. In essence a dream deferred.

One things I have come to learn from Elisha Matambo’s statement when receiving Madam Rashida Mulenga is that UPIYEND aren’t interested in keeping old members but interested in the 1.8m.

Yes, Mr. Matambo, you can call them DISGRUNTLED YOUTHS today but remember, Bowman Lusambo called the same youths as disgruntled and where is he and his party today?

Take a chill-pill mudaala because people that you are receiving today would have done well joining UPIYEND when in opposition. Sir, your said Ambassador wouldn’t have joined us had we never won 2021 polls.

By bringing in PIYEFU members, Sir, who are merely 1.8m, you are flashing out us, who are the majority, 2.8m. Have you forgotten how we suffered for UPIYEND? Our names politically aligned us in PIYEFU Government.

Our businesses were stepped on because of being ran by us (Tongas). We were not even comfortable mentioning our Surnames in PIYEFU strongholds because we were being killed daily in the eyes of uniformed men.

Bo Matambo, at your current level of anxiety, I won’t be surprised when you will parade uniformed men to receive Bowman Lusambo, Kampyongo, Mundubile, ECL, Inonge Wina and others in UPIYEND because your desire is ONLY to grow the party at any cost.

Malanji sues Mulenga over fake G12 certificate claim

FORMER foreign affairs minister Joseph Malanji has sued UPND losing candidate for Kwacha Constituency in the 2021 general elections Abel Mulenga for defamation of character.

Malanji was declared winner of the election but it was nullified following Mulenga’s petition on account of, among other things, Malanji’s alleged failure to produce a grade 12 certificate.

Malanji has since appealed the High Court’s nullification of his election in the Constitutional Court.

But Mulenga also went on to lodge a criminal complaint at Kitwe Central Police Station, accusing Malanji of having forged a grade 12 certificate which he used to successfully file in his nominations as candidate in the August 12 general elections.

This act prompted Malanji to sue for defamation after police exonerated him following their investigation in collaboration with the Examinations Council of Zambia.

“On 27th November, 2021 at 12:30 hours, Kitwe Central Police Station received a report from M/Charles Abel Mulenga aged 57 of house number 44kk3 Jambo Drive, Kitwe.

He reported that Hon. Joseph Malanji abused the electoral process by presenting a forged Grade 12 certificate for adoption as he claimed that he was very aware that hehas no grade 12 certificate.

He only based on the pronouncement by the Kitwe High Court during the election petition,” read part of the clearance letter from the Kitwe district police headquarters signed by a P Bwalya dated December 22, 2021.

“Hon. Joseph Malanji voluntarily produced the grade 12 results to the police and the police subjected the same for verification with Examinations Council of Zambia.

Examinations Council of Zambia verified and confirmed that the examination results submitted were genuine and were fully issued by the Examination Council of Zambia.

Hence Hon. Malanji has the genuine grade 12 certificate based on the authentic of the Examination Council of Zambia.”

And according to a writ of summons filed dated January 20, 2022, filed in the Lusaka High Court principal registry, Malanji is demanding damages for defamation of character, exemplary damages, an order for an injunction restraining the defendant whether by himself, servants or agents or otherwise whosoever it may be acting on behalf of the defendant from making statements about the plaintiff that are defamatory, interest on the amount found to be due at commercial bank lending rate and any other relief that the court may deem fit plus costs.

Chipenzi wonders why PF is quiet on Chitala’s Zesco asset stripping expose

GEARS Initiative Zambia says there is need to extend investigations to all companies that fall under the IDC and all board of directors and management.

GEARS executive director MacDonald Chipenzi said reading through excerpts from Mbita Chitala’s new book, he wonders why PF members could keep quiet and gloss over a serious matter being raised by Dr Chitala.

“Going by the reports from various media outlets, there was serious schemes anchored on abuse of state assets, resources, money and corruption. Dr Mbita Chitala raises and cites the issue of PF trying to use Zesco to fundraise for its campaigns for 2021 general election as reasons to part ways after he refused to succumb to their machinations,” he said.

“Since IDC board had some clergymen, we must also know what role they played in this pending asset stripping of Zesco and political shenanigans. From the tone of Dr Mbita Chitala’s book, it may be clear that all companies under IDC may have been subjected to the same treatment of pressure to raise funds for the PF campaigns no wonder the plushy campaigns we saw. Hence, there is need to extend the investigations to all companies that fall under the IDC and all board of directors and management e.g. National Airports Corporation (NAC), Zamtel, among other companies.”

Chipenzi said it was extremely sad for IDC under the chairpersonship of then Republican president Edgar Lungu to fail to safeguard public interest but instead opted for partisan political interests.

“The intentions were evil and the devil in the detail must be exposed. Investigations are in order. Find out and see how the IDC board and management’s intentions to strip companies and fundraise for the PF campaigns for the 2021 general election using Zesco and other state companies were actualised,” he said.

Chipenzi said said all those involved must be summoned, investigated and arrested to stand trial for their unpatriotic conduct and behaviour.

He said the new dawn government must learn a lesson from the PF and avoid appointing cadres in government institutions because that was a recipe for abuse of public resources and corruption.

He said cadres must be spared from appointments but go for professionals to make State companies generate enough income to create more employment for the youth.

“The new dawn government and the new ruling party must avoid using parastatal companies to raise funds for campaigns or political activities,” advised Chipenzi.

I Stole To Provide For My Baby – Man Tells Court

AN electrician of Choma has told the magistrate court that he stole because he was under pressure to provide for the mother of his child.

David Hababola, aged 25, stood charged with burglary and theft contrary to section 303 (a) and read together with section 272 of the penal code chapter 87 of the laws of Zambia.

When asked why he committed the offence, Hababola said he needed to clear some debt from a person who was threatening him with arrest.

He added that he had constantly been under pressure from the family of the mother to his child to provide basic needs for them.

It is alleged that on dates unknown but between January 10, 2022 and January 11, 2022 in Choma, Hababola broke into Mr Abraham Zulu’s house and stole one television set, a pressing iron and two cables all valued at K7, 409.

Brief facts before court were that on January 11, 2022 Mr Zulu went to bed and secured his property but around 06:00 hours the following day, he discovered that some property was missing.

He then went to report at Choma Central Police where investigations were made and led to the arrest of Hababola while recovering property worth K800.

When called to take plea before Senior Resident Magistrate Peter Mungala, Hababola pleaded guilty and clarified that he committed the crime at midnight as the complainant was not home.

“I have a three-yea- old child who will suffer if I go to prison and I was under too much pressure as I needed to pay off a debt,” he said in mitigation.

Magistrate Mungala considered his mitigation and the fact that he was a first time offender who readily admitted the charge without wasting the court’s time.

He added that the offence was a felony and rampant in the district hence the need to punish Hababola and deter would-be offenders.

Magistrate Mungala sentenced him to three years imprisonment with hard labour.

Woman On United Airlines Flight Woke To Find Man Fondling Her Breast

A woman in the US travelling on a United Airlines flight awoke to find another passenger allegedly fondling her breast, according to federal officials.

Court documents say the woman had been travelling from Las Vegas to Washington when she fell asleep on the flight.

She then woke up to find Ivan Lopez Jr, 26, ‘rubbing her right breast’, with prosecutors saying she shouted: “Get away from me.”

Lopez Jr then got up and went to the back of the plane and admitted to a flight attendant that he had ‘sexually assaulted’ the woman sitting next to him’.

The flight attendant immediately moved him from the 12th row to the 21st row in order to keep him away from the female passenger.

Officials said in a statement: “According to court documents, it is alleged that Lopez was a passenger on a commercial flight from Las Vegas McCarran International Airport to Washington Dulles International Airport on December 24, 2021.

“During the flight, the passenger seated next to Lopez fell asleep. The indictment alleges that she awoke to Lopez repeatedly rubbing her right breast.

“When the passenger opened her eyes, she allegedly observed Lopez leaning over her and his right hand was placed on her right breast.

“The passenger allegedly yelled at Lopez and he moved to the back of the aircraft, where he allegedly admitted to a flight attendant that he sexually assaulted the woman.”

Lopez Jr now faces a charge of abusive sexual contact aboard an aircraft, and if convicted could be jailed for up to two years.

The victim told an FBI agent that Lopez Jr touched her for around 10 seconds, an affidavit in the case states.

She also said that the contact he made with her was ‘not accidental’, while a flight attendant said Lopez admitted to groping the woman and ‘further stated that he thought was in trouble and that he was sorry’.

Lopez Jr told the FBI that ‘he wanted to get the woman’s attention by poking her on her right shoulder, so that he could ask her what she was listening to through her headphones’, also claiming that turbulence caused him to ‘accidentally’ touch her breast, the affidavit states.

According to the US Department of Justice, another man was recently charged for a separate incident aboard a flight also headed for Washington Dulles International Airport.

On 2 December, Elias Fethamlk, 40, ‘knowingly interfered with a flight attendant’s duties by disregarding the flight attendant’s instructions and assaulting the flight attendant.

He had been travelling from Dublin, Ireland, on board an Ethiopian Airlines flight when the incident took place.

If convicted, Fethamlk faces a maximum penalty of 20 years in prison.

Seer1 Has Now Become HH’s Chief Advisor, Claims Chilubi PF MP

Seer 1 has now become HH’s chief advisor, says Chilubi member of parliament (PF) Mulenga Fube.

But UPND member Christine Phiri said as society is dynamic, the President can speak about issues which have been said by any other person, including Seer 1, but that does not mean that he is getting advice from him.

Speaking with Daily Revelation, Fube said he was saddened with the polarisation of the Church in the country, where many because of love of money and fame, because vuvuzelas for either the PF or the opposition during the general election campaigns, which has rendered them ineffective now on the many issues happening in the country, pointing to increased prices of fuel and electricity and subsequently the rise in the cost of living.

He said those who supported the UPND also happened to mix up with people “like the number 1 Advisor of possibly the President, because what Seer 1 says is what comes out the next day from the President.”

“For instance if he (Seer 1) says anything, even when he says ‘you promise heaven and earth’, you find that the President operates that the next day. If Seer 1 has released a video on ministers stealing and they are disappointing the President, the President will be cautioning the ministers, and will twist it to say that they are being taught by PF elements,” Fube said. “Seer 1 is the chief advisor from the way things are coming out. He was the chief advisor before elections, he’s still the chief advisor. I don’t fear Seer 1 myself if he wants he can take me on with his curses and the like. I am above that…Seer 1 has confessed that he does not really support the Christ we talk about…away from the main doctrines of different Christian Churches despite the diversity.”

He said even those from the Church who took sides in supporting the PF became vuvuzelas and compromised themselves in the process. He said the 2021 elections, also saw something unique in that even the Catholics who have been objective, some individuals within the Church compromised themselves.

Fube further said he heard Education minister Douglas Siakalima complain about teachers who supported PF, but did not talk about teachers who supported the UPND.

“To me actually the teachers who were supporting them they are supposed to be disciplined. May be the teachers that were supporting the PF can even hide under supporting the government of the days because me when I was DC I was saying you must read the PF manifesto and make sure that you implement the 7th National Development Plan. And there is nothing wrong with that. What is wrong is to be partisan,” Fube said, adding that it was not wise to victimize the civil servants, even career ones, just because they served under the PF.

But Phiri, the UPND losing parliamentary candidate for Milanzi in the 2021 general elections, said just because the President might have coincidentally said something which might have been said by anyone, including Seer 1, did not mean that he was seeking their advice.

She said the President is someone who has been consistent about preaching against corruption, from his time in the opposition, and right into State House after he took office. Phiri said President Hichilema has consistently warned his ministers, government and party officials that he did not want to associate with people who were corrupt.

Chief Mpezeni advises HH to ignore critics, focus on delivering to Zambians

PARAMOUNT Chief Mpezeni of the Ngoni people in Eastern Province says President Hakainde Hichilema should remain focused and ignore his critics.

And Water Development permanent secretary Joe Kalusa says government is committed to ensuring that it provides water to its citizens.

Speaking when Kalusa paid a courtesy call on him at Ephendukeni palace on Friday, Mpezeni said President Hichilema should not be detracted by the people who were criticising him.

“As a leader or as government, you cannot do everything at once, but the biggest point is that, let the President work. Apitilize kusebenza osati azimva zokamba banthu, ukafika pam’pando ambiri azayamba kukukambila zoipa koma chikulu ngati ndiwe mtsogoleri weo pitiliza chabe naubwino kuti banthu akondwele (let him continue working without paying attention to the critics, when you assume office, a lot of people will talk ill of you but the best is to continue doing good to the people),” he said.

Mpezeni urged the government to work on dams that were damaged in his area and many parts of the province.

He said he was confident that the new dawn government would work for the people.

Mpezeni said some contractors that were being contracted to repair dams were not doing commendable works.

He said he was impressed with the performance of Eastern Water and Sanitation Company.

Mpezeni urged the water company to continue serving the best interest of the people.

And Kalusa, who is on a familiarisation tour of water infrastructure in the province, said President Hichilema attaches great importance to the water and sanitation services to Zambians.

He said government was aware that life evolves through water.

Kalusa said government would see to it that the dams that the traditional leader talked about where rehabilitated.

“The government will look at the water infrastructure through the budget so that it takes care of the Zambian people. For our animals, plants to survive, they need water. So, we are going to ensure that we improve the water situation in both urban and rural areas,” said Kalusa.

Copper, Cobalt, the Minerals that will drive the World- Amb. Emmanuel Mwamba

There is a low-intensity debate on the future of mining in Zambia.

Despite her rich mineral endowments; copper, cobalt, gold, emerald, and other minerals being mined in large quantities every year, there are little financial returns to Zambia.

COPPER & COBALT MINES

For the first time in 30 years, the Zambian government wholly owns some of the largest mines; Konkola Copper Mines and Mopani Copper Mines.

Given the economic value the mines have for Zambia, even before they are fully exploited, the direction taken to sell them to foreign entities may be careless.

COBALT PRICES

Currently, cobalt prices on the world market are trading at US$70,954 a tonne.

The gray metal, typically extracted from copper deposits, has historically been of secondary interest to miners.

But demand has exploded worldwide because cobalt is used in electric-car batteries, helping them run longer without a charge.

Zambia is not benefitting much from this price boom due to low production (or declared production) of the metal.

According to mineral production figures obtained from the Ministry of Mines and Minerals Development, the country’s cobalt production stood at a paltry 287.19 metric tonnes in 2020 compared to the production of 367.281 metric tonnes in 2019.

The leading country in worldwide cobalt mine production in 2020 was Democratic Republic of Congo, having produced an estimated 95,000 metric tonnes.

And copper prices have hit the highest peak in 20 years trading at about $9,500 – $10,000 per tonnes.

As a country, and especially for our new economic managers, we must embrace and hold onto the mines the way a drowning man clutches to a straw.

Any consideration for an equity partner must favour Zambia than previous hollow exploitative partnerships we have seen in the past.

ZAMBIA´S COPPER MINES A GLIMPSE

Zambia is Africa´s second largest copper producer churning out about 850,000 metric tonnes of copper annually which is loaded on trucks and later shipped abroad to destinations such as China in raw form-a tragedy.

It is another tragedy to sell our copper and cobalt cheaply as a raw material overseas and get pocket change through our minority shareholding in the various mining entities currently dominated by foreign companies based in UK and Canada such as FQM and Barrick Gold to mention but a few.

Especially now when the industrialised West and East are working at doing away with fossil fuels to ramp up the manufacturing of Electric Vehicles, so called EVs that are environmentally friendly and easy to maintain.

ELECTRIC VEHICLES: THE GOOSE THAT LAYS THE GOLDEN EGG

The EV industry is a growing and booming industry which promises to make several countries such as Zambia extremely wealthy in a few years to come once properly harnessed.

A recent Allied Market Report, which studies the industry, shows that the global value of the EV industry will stand at about US$803 billion annually by 2027, as the demand for the new transport mode peaks.

From that figure you can see that, it makes more economic sense for Zambia to keep its copper mines, dig new ones and or increase ownership in existing mines.

This is not the time to sell whatever mine you have as a country.

Seventy (70) per cent of the components that are used to make an EV, whether hybrid or plugged in come from copper and cobalt, the majority of which are buried in Zambia.

Conventional vehicles you and I use that run on gasoline or petrol are being phased out because that form of energy is not renewable and contributes to environmental degradation compared to electric vehicles.

Zambia with its massive copper deposits and cobalt must now court motor vehicle companies in Europe such as VW, BMW and Tesla to do the following:

  1. Set up factories in Zambia in industrial parks around the country and add value to copper and cobalt and other minerals in partnership with the car companies, stop exporting raw copper
  2. Partner with EV companies to train and employ Zambians in adding value to copper in the factories they will set up in Zambia
  3. Stop discussing plans to ever sell off our mining companies to foreign entities because that is day-light robbery that only makes us poor.
  4. Zambia must start thinking BIG instead of selling off the mines just because someone will get a kick back or already got a kick back in one form or another.
  5. Create thousands of jobs through EV industrial parks and not sale the national treasure.

CONCLUSION

We have made bad economic decisions in the past but we now have an opportunity to correct them instead of digging one loss making pit to fill in another.

We need to learn from the past.

In the 1980s, the state-owned mines with lack of investment, deteriorating efficiency of operations, and unsound economic decisions, combined with low prices, brought both Zambia’s national mining companies to the brink of collapse.

When the mines were privatized in the 2000s, little benefits came to Zambia as unfair mining agreements, lack of transparency and cheating plagued the industry.

Let’s stop the toxic and lazy talk of selling mines and instead invest in or seek profitable partnerships for our people.

PF are crying foul because they are guilty – Changala

GOOD governance activist Brebner Changala says the Patriotic Front is scared of the fast-track courts because they are guilty.

In an interview, Changala wondered why the former ruling party members are failing to celebrate noble moves by the UPND government that will benefit the country.

Former PF secretary general Davies Mwila said the establishment of fast-track courts was targeted at the former ruling party members.

“They are proving the notion that ‘the guilty ones are always afraid’. These courts should be celebrated by everyone that wishes to see the country develop. It should not be viewed as a target institution for one political party,” Changala said.

“The country is not just about the PF. We have experienced parties like the MMD, why should one party cry foul? The PF is crying foul because they are guilty. And the party will not be taken to court but individuals.”

He said the fast-track courts must be celebrated and not viewed as a target institution for one political party.

Changala has since praised the new dawn government for coming up with the first track courts, stating that this would help settle many cases on time.

“Economic and financial crimes take time, like five years at the least. And history has shown us that mostly, the accuseddo not get convicted or acquitted as many cases remain hanging. And this court will ensure that such cases are held in an express manner,” Changala explained.

“For example, when someone is accused of acquiring the money he cannot account for, this means that that person will be taken to court and do express trial.”

He said the courts would also help deter people from stealing public resources with impunity as has been the case in the past.

“The new dawn administration should be praised for coming up with these economic and financial crimes courts as these courts will help to recover stolen asserts. Fast-track courts will also help instill fear in people who steal from government,” said Changala.

Preparing yoursel for retirement .when retirement age arrives you must be prepared, Mentally, Physically and Financially.

1) Children. Your children should not be too young or too spoiled to force to stay at work longer. It’s better to have all your children at younger age struggle with them with lower salaries and teach them self reliance, independence, self control and petiance. Again never count them as investment, they will complain help if they wish. But the disaster is when you have to maintain them with your pension.

2) Car. In your young working life never waste your money in expensive big cars. Never commit your salary in a car. Get your personal loans mostly to invest in property and from that 50 000 buy yourself something good to move around with. Make sure it takes you 5 years with that car. And immediately make sure that you have at least 1 000 a month going into car saving account. That will give you 12 000 a year which is 360 000 the day you retire. Then you went to retirement with a brand new car with all motor plans and the rest. You won’t be able to negotiate with machines.

3) Property. Use your personal loans to invest in 3 types of property. a) A house in your plot back home. It does not need to be a palace, just a good house to sleep in at peace with your wife/husband. b) A house in your working town. You can start by buying a plot and and build. It can take time but you will be done one day before you retire. c) Build some muilt rest. You can use a mortgage to build muilt res, but you must make sure the muilt res rentals are more than your installments and the loan duration is 5 or10 years earlier than your retirement date. At the day of retirement all this must be complete and free.

4) Masimo / Moraka. You must start to invest in all of this or one of them now. Make sure by the retirement age you don’t have the desire to go and buy a Masimo or dikgomo. You must be in a position to sell. If funds permit make sure you have boreholes in both your Masimo and Moraka. Then plan around planting many fruits trees. If your Masimo is near electricity connect it. Do some poultry houses and some shade nets.

5) Futher Education. Never waste your time going to school to pursue Masters or PhD hoping they will increase your salary when you are already over 40. Unless it is the company policy or sponsored. Do online. The very important education after 40 should be towards things you will do on retirement. Learn to pluagh maize, vegs, keeping chickens and goats, baking and finincial management. This is what you need.

6) Social life. Start to be a responsible family member when you are still able. Go to family weddings and fenurals and participate. Sluaghter cattle with them. Prepare salds with them. Run around as elders send you. Coming to family functions on the day of the function with a camp chair and a cooler box is a desaster for your retirement.

6) The day of retirement you must have no single loan, no fun insurance deduction only medical aid, no child maintenance, no school fees, no plan to buy a tshimo or Kgomo, finished the mortgage of your muilt res, with a brand new car not from your pension.

Before you dream of your pension annuity at least you must be sure of 5000 to 10 000 a month from your various investments. Your moraka must be profitable then. You Masimo must be producing. Your Mult res rantels must now go to your pockets. You can choose to rent your town house or stay in it with no pressure. You start to sell chickens, eggs, goats, Madila, fruits, Morogo, vegs, dinawa, phane as a keeping busy project using a brand new car.

All your pension including the 33% must be for your pleasure and medicals. Take your wife/husband on trips.

Not Pension is 5% of your salary. Never think you will archive things you failed to do with 95% of your salary using 5%. I have seen many houses at window level and owners passed on as a result of depression trying to start new and expensive life with pension.

Veteran actor, director and activist Ntate Patrick Shai committed suicide today at his home. Details as to why he decided to take his own life have not yet been revealed. However, many chose to believe his sudden death has to do with the tiff he had with Cassper Nyovest.

The star who was well known for his roles on Generation, 7de Laan, Skeem Saam and The River, went viral just a couple of days ago when he shared a video of himself insulting Cassper Nyovest and his family.

DEMOCRATIC Party president Harry Kalaba says he has been greeted with silence over the audio he leaked exposing State House scheme of disturbing his party.

Kalaba disclosed that when he received the leaked audio around 01:00 hours, the first person he shared it was President Hakainde Hichilema and later chief government spokesperson and Minister of Information and Media Chushi Kasanda.

He said it was surprising that some government officials were describing the audio circulating on social media as fake and wondered how they came to that conclusion.

He said the only institution which could state whether the video was real or fake was the Zambia Information and Communication Technology Authority (ZICTA).

“When I got the information that State House and President Hakainde Hichilema are involved in destabilising the DP, I approached the President who denied having being involved in sponsoring anyone and encouraged me, that ‘my brother, just forge ahead’, and I thought he was encouraging me genuinely not until around 01:00 hours when I received the audio,” Kalaba revealed when he was featured on 5FM radio on Thursday.

“And I said ‘yes, this is my moment’. The first person I sent it to to is President Hichilema, but he has not answered. He is quiet up to now. Maybe he is very busy with foreign duties. The second person is the chief government spokesperson, who is Minister of Information and Media, Chushi Kasanda, my wife. Me I call her my wife. She is also quiet. The third person is my brother, Josephs Akafumba, all of them have remained quiet.”

Kalaba said his party now had reason and proof that President Hichilema had interest to destroy DP by meddling into its political affairs as revealed in the leaked video.

He said he was not bothered with the leaked audio because he believes in speaking the truth.

Kalaba said he wanted to become a priest, the reason he always wanted to say the truth in national matters.

“Even that audio you are taking about, did I kill a person or it’s the truth? I am not bothered because it’s the truth. Because I wanted to become a priest, so I always want to say the truth on national matters,” he said.

Kalaba advised the UPND government not to take national matters lightly as that was the reason why Zambians voted PF out of power.

He disclosed that the leaked audio of the two senior government officials was a State House scandal.

But chief government spokesperson Chushi Kasanda says President Hichilema has called for transparency over the recording.

She said whoever is in the audio conversation had no blessing from the President.

In an interview yesterday, Kasanda said there is no way that the President would give anybody
such a directive.

Kasanda, the Minister of Information and Media, distanced President Hichilema from the audio that went viral days ago.

“I want to distance the President and Vice-President [Mutale Nalumango] from that audio. The President has been very clear that he wants people to have their
freedom and he wants people to have their independence and wants to see democracy thrive,” she said.

“Therefore, there is no way that the President would give anybody any directives, not even any Cabinet minister would be given such a directive. So I distance the President and Vice-President from such allegations.”

Kasanda also said contrary to Ministry of Information and Media director Thabo Kawana’s statement that the audio was fake, the government is in a process to establish the origin of the
audio.

She said the government had asked the Zambia information and Communications Technology Authority (ZICTA) to establish authenticity of the audio before she can further talk to the media.

“There was a statement given by Mr Kawana that the audio was fake, so what we are trying to establish is that is the audio fake or not. That is the
first step and I think we will be concluding with this this afternoon (yesterday) and we want to establish where it came from – any of the two phones or if it came from somewhere else,” said Kasanda.

“I was at ZICTA yesterday (Thursday) in the afternoon. I am going there this
morning at 09:00 (yesterday). So we are trying to establish all that and once we establish that then it will be safer to answer any story [question] from the media and I will be as candid as possible. Once this is established I will come out and tell the people. The President wants us to be transparent. He says be transparent and whatever you find, tell the people.” – The Mast

I had to reread chapter twenty-eight of the controversial book by former ZESCO chairman Mbita Chitala. It has extremely shocking revelations! Government obtained a loan of USD392 million from China for installation of internet and data facilities via Smart Zambia (Cabinet Office). But government wanted the loan to sit on the ZESCO books. Unknown to ZESCO, 15% of the counter-part funding (about US$ 60 million) had already been released without ZESCO knowledge.
And where is this money?
“….it’s 15% counterpart contribution funding for the loan was not only wrongly released but also grossly abused and that many people maybe received bribes on that deal and hence the pressure on ZESCO to accept the USD392 million on-loan lent instructions,” Chitala revealed.

Interestingly, Chitala praises President Edgar Lungu for having stopped this “scam” when he heard about it. He telephoned Chitala telling him that the Smart-Zambia loan was more “scandalous than the buying of the 40 fire tenders at USD 1 million each”.
“Fortunately, the President of the republic of Zambia Edgar Lungu forewarned me of the attempted fraud and I was able to cancel the extraordinary board meeting of the ZESCO board,” Chitala further disclosed.
Chitala had summoned his board members to inform them of the deal and said he was ready to quit his position if the board accepted the bogus transaction. But the President stopped the meeting as it was not necessary.

But the question still begs – who got the USD60 million dollars?

Despite the President alerting Chitala, he claims, the same transaction reappeared through the IDC which incorporated a new company called Infratel Limited to take over the ZESCO fire network assets.
“I informed Kaluba (IDC CEO) that ZESCO could not let go it’s fiber network to third party infratel,” he said.
“ZESCO firecom network is one of the anchor for the National Security as it acts as a protective mechanism in the operation of ZESCO limited,” he added.

But the author is leaving us guessing. Since the President stopped this scam, where did the USD60 million go?
“It was also apparent that since government money had been expended without any work to show for, this would add to the other scandals of trust or common theft of public resources by politicians and public servants,” he concluded.

UPND National Youth Chairman Gilbert Liswaniso says harassment of civil servants by political cadres will not be tolerated.

Mr Liswaniso says UPND youths throughout the country should adhere to the presidential directive by being decent.

He was speaking when he paid a courtesy call on Mwandi district commissioner Sikuka Mwitumwa Kabika at her office in Mwandi royal village, Western Province, this afternoon.

“Time to harass civil servants is over. If you have issues, that’s why we have these offices so that we can take our issues and they be resolved,” Mr Liswaniso said.

President Hakainde Hichilema’s victory last year was delivered mainly by the country’s youth and womenfolk.

“I ask you to have an open-door policy for them – youths and women,” he requested.

Mr Liswaniso is calling on all Zambians to secure the change of government which they did.

On her part, Mrs Kabika updated Mr Liswaniso and his entourage that there is peace in the district.

Later, Mr Liswaniso paid a courtesy call on Mwandi council chairperson Mike Mwendalubasi at his office.

Mr Mwendalubasi is impressed that Mr Liswaniso is going round visiting the ruling party’s youth structures.

He also disclosed that his council is not ‘importing’ human resource but employing local people.

So far, according to Mwandi Council Chairperson, the Mwandi town council has employed 12 local people, among them council police officers, a driver, an office orderly and office cleaners.

And Mr Mwendalubasi commended the UPND National Youth Chairman for cementing the vision of President Hakainde Hichilema.

And Mr Liswaniso is confident that the new dawn administration will ensure that youths and women benefit from the national cake through formation of cooperatives leading to creation of jobs.

“Youths and women delivered the victory of President Hakainde Hichilema and the UPND.And President is clear on diversity of cooperatives. No one will come to Mwandi Constituency in a Likili bus to take contracts from the locals” he emphasised.

In another development, Mwandi Council Chairperson said his office is going to operate with zero tolerance to corruption in a bid for all citizens to benefit from economic liberation.

“UPND is still growing in Mwandi District and it has remained a UPND bedroom, historical attachment is delivering a first councillor.

As good ambassadors of the party all councillors and the area Member of Parliament are on course implementing the new dawn administration’s vision embracing all for economic development” he indicated.

The ruling UPND has received a huge boost ahead of the 3rd February Kabwata parliamentary by-elections as Democratic Change-MDC-an Alliance partner has joined the on-going campaigns.

The move comes barely a day after the Nevers Mumba-led New Hope MMD members led by party Vice President for Politics, Reuben Samboh joined the re-launch of the Kabwata campaign, yesterday.

The gesture, according to MDC SG, Lucky Mulusa, is aimed at boosting UPND’s chances of scooping the vacant Kabwata Constituency parliamentary seat.

In his speech at the same event, UPND Secretary General, Batuke Imenda

He charged that UPND’s victory in the just-ended Liangata in Senanga and Sokontwe ward in Milenge was a sign of the confidence that the people of Zambia has in the UPND.

“Allow me to thank the people of Milenge and the people of Liangati for making history. This shows that when the people of Zambia rejected the PF, it was not by fluke. We should not allow ourselves to go back to the rotten system of the PF which led to misery amongst our people. Let us not forget the numerous crimes committed by the PF such as the gassing of citizens and gunning and arresting of political opponents. They want to come back and finish you,” he said.

Imenda pointed out that there were a number of successes that the UPND-led Government has score in its 5 months in office that should encourage the people of Kabwata to elect a lawmaker from the ruling party.

“There are a number of achievements that the UPND-led Government has so far scored. We have free education and an increased CDF allocation. The impending employment of 11, 000 health workers and the planned recruitment of 30, 000 teachers is just another achievement that cannot be overlooked. We have seen the payment of thousands of retirees whose benefits have been cleared. We also have Zambia Railways workers whose terminal benefits and arrears have been cleared coupled with the K1.6 million Equalization Fund for all the 116 districts in the country,” he said.

Echoing the words of his SG, MDC Vice President for Politics, Renard Hikaumba stressed that the people of Kabwata should not be intimidated but should rather rise to the occasion to replicate the 12th August 2021 heroics where they ushered in the UPND-led New Dawn administration in office.

He said the will power that the people of Kabwata exhibited by voting for UPND after they refused to be “cowed” and “intimidated” should be replicated on the 3rd of next month.

He charged that the achievements that the UPND-led Government has so far made in its first 5 months in public office should motivate the people of Kabwata to vote for a UPND parliamentary representative next month.

And UPND Chairperson for Labour and Social Security, Godfrey Beene has warned the people of Kabwata not allow the past regime to continue on its trajectory of continuing to rob Zambia if its wealth.

UPND National Trustee, Grace Chivube charged that it would be suicidal for the people of Kabwata to elect people who have a “dark” history of stealing from the people.

“…as you the people of Kabwata await development, it is important that you remember what the UPND has on the table for you. Zambia Railways workers already paid. Retirees already paid. CDF increased from K1.6 million to K25.7 million and many other projects coming So, you should vote for Andrew Tayengwa so that he can help you attain your aspirations,” she charged.

THE PF are provoking President Hakainde Hichilema so that he loses focus in his efforts to recover stolen money, says Keegan Chipango.

And Chipango, a former MMD Livingstone Mulungushi Ward councillor, has accused the UPND media team of going to sleep and leaving the President to be attacked by PF.

In an interview, Chipango said corruption was not an easy thing to get rid of but required determination and unity.

He said the PF was using experience they gained in the past 10 years to fight battles against President Hichilema.

“They are using ‘black’ propaganda. They are provoking President Hichilema so that he loses focus in his efforts to recover stolen money. But good enough he President Hichilema] has also gained experience in the past years and is not answering them. But I am calling on UPND members to support his efforts of recovering the stolen monies,” he said.

“If you read world history, you will remember what happened to J.F. Kennedy. He had won on the premise to fight corruption and when it come to implementation, he was assassinated and when his brother tried to take over, he was also eliminated. I am calling on UPND members to support HH because the battle he has started is not an easy one, but the good thing is that it has the support of Zambians,” Chipango said.

He noted that the lazy attitude by UPND, especially its media team, to defend President Hichilema, was very worrying.

“As a result, the common man or a common Zambian is believing the PF. It is high time the UPND media team protected the President in fighting this battle because it will take the next 10 years. Corruption is not an easy thing to get rid of, it requires determination, unity and appreciation of whoever is trying to contribute to its end. It is high time the UPND realised that they are no longer in the opposition, they are in power,” Chipango said.

He urged Zambians to be bold and put the country first because PF members had a lot of connections and were capable of bribing waitresses.

Chipango added that the fight against corruption was for all Zambians, including PF members.

He said the battle was not for President Hichilema alone.

“What he is trying to do is simply to get back what was stolen from the Zambian people, he simply wants to get back what belongs to us all,” he said.

He accused the UPND media of going to sleep and leaving President Hichilema to received a lot of attacks from the PF.

“The UPND media is allowing the PF to set the narrative for them, they (PF) are setting the agenda for them as a result they (UPND) are dancing to their (PF) tune hence their lies travelling faster then the truth,” he said.

“The people who surround President Hichilema must help him achieve what the Zambians voted him for, they should help him return what was stolen,” said Chipango.

She had come into Kitwe on a transfer from Kasama but didn’t stay longer because her family could not move from Kasama so we had to allow her to go back to reunite with her family but the short period I worked with her was amazing. She’s a pure professional who has been in the public service for long and she’s extremely humble, intelligent and the best Deputy any DC would like to work with.

Iam disturbed to watch a video of her being attacked and crying for help in her office by idiots who thinks govt can be run like aka sido. When you are displeased with some one who is in a govt office there are smart ways to push for that person to be remove from the office unlike using criminality like what I have seen in that video.

Sometime back when I served as DC some disgruntled Party youths wanted to come and lock up my office because they didn’t like me. Well even during our time, youths used to close people’s offices a practice that was foolish and one that should never be entertained but now a new dimension has been added that of beating an officer in his office.

When I got Intel that the youths were organizing to come and close my office, I told the security wings in Kitwe then that they should not do anything as I would sort those youths out myself and those youth are lucky they aborted their mission because they would have been taught a lesson of a life time had they proceeded with their plan because I was ready and I could not allow lowlessness.

Those foolish criminals who attacked the Kasama DAO regardless of who they are, are very well know in kasama and the police should report to the public the arrest of those criminals and we should see the law taking its course.

Public servants must be protected to work in peaceful environment and without intimidation from esp political hooligans. A DAO unlike a DC is a pure professional and there have been very rare cases that u will find a Cadre(politician) in that office.

KASAMA DC must be in the fore front in ensuring that justice is meted on those idiots who went to attack the office of the president.

Economic Fighters (EF) leader Wynter Kabimba says President Hakainde Hichilema, his political Advisor Levy Ngoma and Home Affairs and Internal Security permanent secretary Josephs Akafumba must come clean over the leaked audio they are said to be conspiring against the Democratic Party (DP).

Speaking with Daily Revelation on the audio which has gone viral where Ngoma and Akafumba are conspiring to frustrate the filing in of nominations for the DP candidate in Kabwata, further saying that they have the Registrar of Societies in their pocket but Electoral Commission of Zambia director Patrick Nshindano is standing in their way, which however, has been described as a fabrication by those in government, Kabimba demanded that President Hichilema and his officials come clean on this matter, rather than just escaping from it by saying that it was a fabrication, especially that they claimed that they were coming into power to clean the mess so that state institutions could operate independently without political interference.

“The whole issue hinges on investigations. The government position is to the effect that the conversation is fabricated. Then let them tell us who fabricated the conversation.

In the absence of that then the inescapable conclusion will be that that conversation took place,” Kabimba said. “The journalist from KBN is not being accused of being the one who fabricated the conversation, but airing the conversation which had already gone viral.”

Kabimba said even the move by the police to summon the journalist from KBN was an act of intimidation, as reporters have a duty to report on matters of public interest, given that the audio was already making the rounds on social media.

“So let them come clean, after all in the denial they were not accusing KBN of manufacturing the audio. So there is nothing, it’s an Act by police to cover the truth over the matter. They are the ones trying to clean up for the government,” said Kabimba. “The police and ZICTA must tell us the truth. Was that a genuine conversation?”

Kabimba continued.

The APNAC statement was coined and approved by the entire executive of the association and is by no means an individual stance as insinuated by Mr Nyambe

Evidently in a prejudice approach, TIZ has chosen to deem our statement as down playing the very important roles played by ACC and DEC in the fight against corruption. On the contrary, we hail their roles and those of all other Stakeholders both in the public and CSOs, and will continue to do so.

We take exceptional recognition that our fellow Zambians throughout the country have unanimously resolved that all those cited for abuse of public resources should be arrested and prosecuted. As APNAC Zambia we want to assure ACC, DEC, TIZ and indeed all Stakeholders that we are on the same side with them. We shall not defend anyone suspected of illegal dealings whatsoever.

As not only an anti corruption institution but also a human rights watchdog, we however shall not shy away to impress upon our Stakeholders mandated to prosecute, to be conscious not to repeat the ills of the yester past. We had in mind how suspects have before been treated at the hands of law enforcement agencies and prompting a public outcry. A number of examples can be cited including that of our now Republican President.

We also shall not shy away to speak out on TIZ and Mr Maurice Nyambe when and if we feel they begin to take a partisan line either pro the ruling party of the day or pro the opposition party of the day. On humane grounds, We will also cite TIZ if they advocate or condone abrogation of human rights for any suspect be it in the ruling or opposition ranks.

The President of Zambia His Excellency Hakainde Hichilema has made it very clear that arrests should only be made after investigations have been made and not vice versa. APNAC supports this stance and it’s in that theme we made the single line that Mr Nyambe picked from our entire statement.

The advocacy against corruption should cast a blind eye to party affiliation and objectively pursue all deemed wanting with equal vigor without fear or favour while upholding suspects human rights.

APNAC Zambia is a voluntary association for all MPs willing to join regardless of their party affiliation as long as they pay the subscription fee and believe in fighting corruption. I want to guarantee that as Chairperson of APNAC Zambia, I will be the first one to resign should the association act or be seen to act in a manner shielding any suspect against the will of our fellow Zambians. This has not happened at all except in the presumptive mind of Mr Nyambe. I am confident that it will not happen while I remain chairman.

We stand in solidarity with ACC, DEC and all other objective Stakeholders in this noble cause of fighting the Corruption scourge that is solely at the Centre of Zambia’s ever increasing Gini Co-efficient or gap between the rich few and the majority poor.

PF cadre Maxwell Chongu appears at court over alleged criminal charges

PF cadre Maxwell Chongu this morning showed up at the Lusaka Magistrates’ Court over alleged criminal charges but his case did not take off as the case record is not ready.

This is in a matter where he is facing two counts of unlawful wounding.

It is alleged that Chongu on March 4, 2017 wounded Richard Sinonge on his left ankle and Innocent Nyambe on his stomach using a machete.

The incident occurred during a clash between PF and UPND cadres in Lusaka’s Northmead area.

Chongu was spotted at the court premises on Monday January 17, but was sent away by state prosecutor Stuyvesant Malambo who directed him to avail himself before court today.

When he showed up at Court today in the company of his lawyer Jonas Zimba to answer to his criminal charges, Chongu was informed that the docket was not set for prosecution by the National Prosecutions Authority (NPA).

Malambo extended Chongu’s police bond to February 11.

And High Court judge Mirriam Bah-Matandala has urged law enforcement officers to refrain from punishing, humiliating and degrading suspects during the course of executing their mandate.

According to a ruling dated January 18, 2022 in relation to Chongu’s police bond to February 11.

Mr. Nakacinda assured what he termed the UPND ‘new dark’ administration that if they so wish they can victimize the entire opposition begining with PF, FDD, EF, Socialist party, PNUP among others but the truth about their evils and corruption will not go unabated and unexposed.

“We strongly condemn this attempt and many others to ransack our veeps house and we shall soon take legal redress in interpreting the provisions of the law that are being abused in broad daylight with impunity. Whatever is causing them to act like they are on steroids will soon be curtailed by the courts of law,” he said.

“The Zambian people desperately demand answers for the opposite unexpected rise in cost of living, they are not interested in these illegal unwarranted political persecutions and DETENTIONS,” Mr. Nakacinda said.

The PF MCC has since implored the international community to take keen interest in the BRUTAL and REPRESSIVE REGIME led by Mr Hichilema.

SENIOR Chief Mukuni has taken keen interest in the Zesco planned stripping by IDC and the sell of the Victoria Falls land by Given Lubinda to his Chinese friend as highlighted in Dr Mbita Chitala’s book.

The former Zesco board chairman explained reasons he resigned from the power utility board over a year ago.

On December 2, 2020, Dr Chitala announced his resignation through a Facebook post and went quiet.

He has however detailed his stormy experiences with the Industrial Development Corporation (IDC) management in his latest book titled, CORPORATE CAPTURE: THE POLITICAL ECONOMY OF ELECTRICITY MANAGEMENT IN
ZAMBIA (How Not to Manage a State Enterprise).

He alleges how IDC chief executive officer Mateyo Kaluba issued unlawful instructions to his team, among other things.

“…Kaluba was obviously unhappy with the President’s insistence on our continuation of service on the ZESCO Board as it would hinder his and other IDC members’ plans to strip ZESCO of its assets and so on. To prevent exacerbating the misunderstanding, I advised all the members
to reply acceptance of re-appointment and they reluctantly sent in their letters to IDC,” he explains.

“As soon as I took up the re-appointment as Chairman of ZESCO, the IDC members inundated me with requests and directives some of which were clearly unlawful and I declined to attend to them explaining in detail either their impracticability or their unlawfulness. In all this, I consulted my board members and management on all the issues the IDC raised and accordingly informed the IDC of the decision of the ZESCO Board on each individual matter.”

Dr Chatala highlights events at the IDC annual meeting in Livingstone in November 2020 where individual IDC board members harangued him and accused him of not being in tandem with the wishes and resolutions of the IDC Board of directors.

“I repeated with emphasis the ZESCO resolutions and informed them in no uncertain terms that for as long as I was chairman of the ZESCO Board, I would not be persuaded by any person to commit transgressions and criminal conduct that impaired ZESCO and that I was prepared to retire if so needed,” Dr Chitala states.

He further explains that he briefed then finance minister Bwalya Ng’andu about his standoff with the IDC management.

Dr Chitala says Dr Ng’andu supported the Zesco board’s resolutions not to strip the company’s assets.

Mukuni said he was very interested in the revelations by Dr Chitala because they exonerate his actions which date as far back as 2017 over the way the PF government was handling Zesco.

“The catalyst was however my refusal to involve myself in asset striping of ZESCO where they wanted ZESCO to surrender its Fibrecom
networks to a new company called Infratel Limited which was essentially a tool to strip assets from ZAMTEL, ZICTA and ZESCO; my refusal to allow TATA Zambia to sell its 50% shareholding to an IDC arranged partner in Itezhi-Tezhi Power Corporation instead of ZESCO taking over the assets on behalf of Zambians,” he explains.

The belief that the former ruling party, the Patriotic Front (PF), will one day bounce back into power and rule Zambians again must be confronted with honest, truth and independence.

Those who so much believe that there is still a chance for PF to come back into power must take an honest stock of why this party was rejected in the previous elections. When the stock taking is done, it is clear that Zambians could no longer accept to be led by a party that transformed into a criminal enterprise.

The overwhelming support which Hakainde Hichilema received in the previous elections, from all parts of the country, reflects the magnitude of rejection of the PF by Zambians. Of course, we do not think Zambians hate Edgar Lungu in his individual capacity as a PF leader. We equally think Hakainde is not the most loved person among all those who participated in the previous election. What we think is – and we believe we are not far from truth – that people detested what PF became and wanted to have this party replaced at all cost. It did not take one to like Hakainde for them to cast a vote in his favour. It was about the misdeeds of the PF.

Therefore, those who pontificate an idea that there is chance for PF to one day bounce back into power are perhaps using their personal feelings to make such false conclusions.

PF lost its own identity which is expressed in its foundation. This party – as things are now – is not different from an enterprise that is established for the purpose of undertaking criminal activities.

We agree with those who say PF is a criminal enterprise. We say this not out of malice but after an honest interrogation of things beyond what the surface suggests. For the past seven years, this country was in the hands of criminals. They had no interest to serve the people but to plunder as much as they could. It is only after government changed hands that we understand the amount of theft, of plunder that characterized this criminal organisation.

Many PF senior members have buried sacks of monies in bushes. They have all sorts of property and luxurious owning everywhere beyond their earnings. All these are proceeds of criminal activities.

Can such an organisation come back to power? Certainly not. Who can ever trust these criminals to lead this country again?

We know that PF is using the Malawian situation to make themselves believe they have some chances to bounce back. But what they do not want to accept is that, the former ruling party of Malawi was and is not a criminal enterprise.

We are not saying these things from nowhere. The Financial Intelligence Centre as well as the Auditor General reports has detailed these criminal activities of PF. These are things which are in the public domain.

It’s like applying and getting a job in government is now out-of-bounds for all those related to either the President, the Vice President or the Cabinet Minister.
Worse still registering a business company and applying for a government contract has also become an abomination, what do you want these relatives of the President,Vice President or Cabinet Ministers to do in this country? These are adult bonafide citizens of this country with the same rights like any other citizen.


Whether it’s the wife, husband,son, nephew, uncle or friend this should not be part of the criteria for disqualifying someone from either getting a job or contract in government.


These are not Presidents,Vice President or Cabinet Ministers but private citizens responsible for their conducts or misconducts.If a wife to the Minister,a brother to the Minister or a son to the President is confronted by the law, the law will not treat her or him as a relative to the President or Minister but as an independent adult citizen old enough to bare the consequences of his or her conduct.Those former PF Ministers who are being investigated on corruption charges,why are their wives or husbands not being investigated by virtue of being relatives? Each adult citizen accounts for his or her own conduct or misconduct.Let us draw a line between the President, the Vice President or Cabinet Minister on one hand and their relatives on the other hand.These two are not intertwined and the closest they can become is the declaration of interests!


These are citizens who cannot even go round riding Presidential or Ministerial vehicles because the law doesn’t recognize them as such!These are citizens with separate families to feed from their relatives in government.


If a brother to Hon.Kabuswe gets a government contract,why should this adult man be addressed as, “a brother to the Mines Minister, Hon.Paul Kabuswe’s gets a government contract” instead of addressing his brother by his name as Mutale?
Just like getting a job in government has predetermined procedures, even getting a government contract has procurement procedures to be followed.It is ignorance of the highest level to even entertain the idea that one can grab a government contract from a responsive bidder and award it to a non responsive bidder, just how possible is this? Which Principle Officer can even sign such a contract? There is an Act that governs procurement or bidding process including contract awards.Whoever,falls short of these prerequisites drops off the list of other competitors.Let’s desist from “Mwamba-lising” citizens by pigeonholing them into small clusters of relatived to this one or to that one.Let us debate on their qualifications, competencies, skills and experience.Let the rules of engagement be applied fairly to everyone.Let us compete for these government jobs or contract on the basis of qualifications, experience, competencies and skills rather than spending so much time on who is one related to in government.
There are rules and regulations governing contract management such as declaration of interests which any contractor and employer knows.


Let’s be careful in trying to criminalize such matters because we risk excluding or discouraging important talent,skill and competency by narrowing our scope.

CEC PONDERS ACTION AGAINST MBITA CHITALA FOR PUBLISHING “LIES” IN HIS BOOK

COPPERBELT Energy Corporation (CEC) has refuted former Zesco board chairman Mbita Chitala’s claims that the corporation had schemed a corporate capture of Zesco.

In a statement, Wednesday, CEC senior manager corporate affairs Chama Nsabika said the claims by Dr Chitala were meritless and the corporation was currently discussing what additional action it would take to challenge this.

“We are deeply concerned with the way Dr. Chitala’s book is positioned and with its depiction of CEC. Our Board is discussing any additional action the Company could take, about which our stakeholders will be informed accordingly. CEC remains committed to transparency and full disclosure.

The Company reassures all its stakeholders that it is engaging constructively with the new board and management team at ZESCO, the Ministry of Energy and the ERB with the key objective of advancing the interest of the sector in a fair and equitable manner,” Nsabika stated.

She noted that Dr Chitala contradicted himself several times in the book.

“CEC is deeply concerned by the claims made by Mbita Chitala, the immediate past board chairman of ZESCO Limited (ZESCO), in his recently released book, ‘Corporate Capture: The Political Economy of Electricity Management in Zambia (How Not to Manage a State Enterprise)’.

The integrity of the book, which is purported to contain information inter alia suggestive of a CEC scheme in the alleged corporate capture of ZESCO, is questionable and the claims made against CEC meritless. It is extremely disappointing that Dr Chitala chose to make such serious and unsubstantiated claims against a company bound by strict disclosure obligations as a listed entity, whose information can easily be verified.

As one of the leading listed companies on the Lusaka Securities Exchange (LuSE), CEC adheres to strong corporate governance principles and conduct and has clear, transparent and honest communication and disclosures,” Nsabika said.

“Whatever Dr. Chitala’s motives, it is clear that he makes several contradictions, misstatements, omissions of fact and repositioning of narratives to lead the reader to a particular conclusion. Dr Chitala openly acknowledges various schemes, including the establishment of a new special purpose vehicle, which were considered to take over CEC while he was chairman of ZESCO.

He provides two detailed options which he sketches out in the book. This could explain his motivation to undermine CEC so as to bring its value down and possibly take over the Company on the cheap.”

Nsabika said CEC was still studying the book and were seeking legal guidance on some of the allegations and inaccurate statements.

“We are continuing to study the book systematically and are still seeking legal guidance on some of the allegations and inaccurate statements. However, in the interest of transparency, we would like to highlight a few of the allegations and inaccurate statements: Throughout the book, Dr. Chitala tries to build the narrative that CEC’s shareholding is dominated by foreign interests.

In Table 60, he presents a ‘CEC shareholding at becoming public’, which is completely fabricated. Two shareholder groups in the table which he credits with a combined 45.1 percent shareholding in the Company were not even shareholders of the company at the time. ZCCM IH and ZECI, two entities representing Zambians, held over 72 percent of the shares which is not captured therein,” Nsabika said.

“In Table 61, he again continues with the misrepresentation showing shareholding in 2018 with ZCCM-IH at 13.25% instead of 20%. CEC is a listed company on the LuSE and, therefore, its shareholding is a matter of public record and easily verifiable by anyone.

It is surprising that Dr. Chitala, whose biography at the beginning of the book refers to him as, ‘a registered finance and investment adviser with the Zambian Securities and Exchange Commission’ couldn’t verify this basic information which he relies on to make a key argument in his book.”

Nsabika said Dr Chitala contradicted himself with regards to the actual tariffs CEC pays Zesco.

“An allegation he makes consistently is that CEC disadvantages ZESCO by paying a suboptimal tariff. Dr Chitala contradicts himself with regard to what the actual tariff CEC pays ZESCO. On page xvii, he states, ‘[ZESCO sold] to the mines through CEC at an average tariff of US$c 6.33/kWh. This was simply poor business’. Yet on page 114, he states, ‘Under the BSA, CEC obtained power from ZESCO at an average tariff of US$c 8.11/kWh.

If the chairman of ZESCO for 5 years is not clear what their largest customer buys power at, why should we expect any difference from those he reported to? No wonder Mr Ronald Chitotela recently argued in Parliament that under the BSA, ZESCO sold power to CEC at US$c 3/kWh,” Nsabika said.

“CEC – Mopani Tariff Negotiations of 2017; Dr Chitala on page 148 writes: ‘Until I left ZESCO, CEC had not concluded its tariff discussions with Mopani and failed to provide any progress to ZESCO or government.” This is, again, another blatant lie by Dr Chitala.

The truth is that CEC and Mopani completed these negotiations within 2017 and signed an addendum to their Power Supply Agreement (PSA) reflecting the agreed changes in tariff. It is again difficult to understand the motive behind blatant lies as presented on this subject by Dr Chitala.

Following the signing of the addendum between CEC and Mopani, CEC proceeded to inform both ZESCO and the government and proposed a draft addendum to the BSA to ZESCO. However, under the leadership of Dr Chitala, ZESCO was unwilling to review the addendum from CEC nor to sign it.”

Nsabika said what had been presented in the book on the Bulk Supply Agree was misrepresented.

“..Dr Chitala completely omits an important aspect of the BSA contained in Clause 1 (a) (iii) which prohibited CEC from purchasing the power it supplied to its mining customers from any other source but ZESCO, unless in situations where ZESCO had no capacity to supply CEC’s power requirements.

The BSA, therefore, exclusively reserved the Copperbelt mining market for ZESCO’s power and, thus, solidly protected ZESCO’s business interest in this respect. It was always clear that under the BSA, CEC could not and did not buy power from any other company but ZESCO,” she stated.

Nsabika said Dr Chitala also contradicted himself on claims that CEC owed Zesco amounts ranging from US$225 – 325 million.

“Dr Chitala makes various claims of CEC owing ZESCO an amount ranging from US$225 – 325 million. On page xxix, he pegs CEC’s alleged owing to ZESCO at US$325 million and on page 120, when discussing his proposal for ZESCO to acquire CEC, he states, ‘ZESCO would have to pay a cash price of US$288 million.

However, ZESCO also noted that CEC owed ZESCO about US$257.1 million and that this amount would be used to offset the price for the purchase of any ordinary shares from CEC’.

However, Dr Chitala goes on to contradict himself on page 124 by stating that the purported money that CEC owes ZESCO is the subject of Judicial Review proceedings in a case brought by the Chamber of Mines against the Energy Regulation Board (ERB) in 2014. Dr. Chitala states, ‘If the ERB decision is determined to be lawful by the Zambian High Court, ZESCO would be entitled to claim US$ 225 million from CEC’.

Worth noting is that CEC would also be entitled to claim a similar amount from the mines in such a case. Further, Dr Chitala omits to state that the decision of the ERB, while being the subject of the ongoing judicial review, has also been stayed by the High Court,” Nsabika said.

Nsabika said CEC was committed to promoting transparency.

“Again, Dr. Chitala selectively does not take the reader through to the final outcome but rather chooses to end with the following, ‘ZESCO considered the CEC action as groundless, not least since ZESCO had not been privy to that PSA and was itself free as the Electricity Act 2019 provided to compete for business’.

The final outcome is that the matter came up for a status conference in August 2021 at which both ZESCO and KCM informed the court that they were discontinuing their actions following the quashing of SI 57 of 2020 by the High Court upon which they had grounded their respective claims. ZESCO finally filed its notice discontinuing the action,” stated Nsabika.

I had a long call yesterday from one of the former board members of IDC. His call was prompted by my review of the controversial book authored by former ZESCO chairman Mbita Chitala. In nutshell, the caller was telling me how difficult it was to deal with Chitala as IDC because he was appointed by the President and had unfettered powers and looked down upon IDC.
“In Livingstone during our annual meeting, Chitala openly bragged that he does not get instructions from IDC,” the IDC man said.
Two former ministers have also confirmed that Chitala was appointed by State House and therefore was very difficult to manage.

But then IDC has issued a statement saying Chitala was appointed by IDC and not the President. In any case, IDC is chaired by the President.
Anyway, we shall take it IDC is right and Chitala and former IDC board members who included former Ministers are wrong.
“Chitala twice accepted his appointment to the ZESCO board by IDC, contrary to his claims that they were presidential appointments,” the IDC statement reads.
Chitala disputes this in his book and insists it was the President who appointed him. Let us leave that for now.

Interestingly, IDC is saying during the Chitala reign, ZESCO performed badly. Like really? So why did you keep him on the board for five years! In fact when first board was dissolved, he was brought back on the new board.
“ZESCO losses grew by 5,481% between 2017 and 2020…” IDC said in statement, which clearly insinuate that Chitala was bad leader.
“Similarly, in the same period the solvency of the company dropped by 201%, seriously endangering the solvency of the largest power utility in the country,” IDC further claims.
So since you appointed him, why did you keep him for three years as chairman with this record of loss making? This statement is more than meet an eye!

Chitala has mentioned specific cases of attempted asset stripping including the proposed sale of Itezhi Tezhi Power Corporation. He has even mentioned names of the people from IDC who attempted to sell this national asset to the UK company without ZESCO approval. IDC has not disputed this fact except to say there was no asset stripping and that ZESCO is doing much better now after Chitala!
“Since December 2020, ZESCO has gone on to record a profit for the year ending December 2021 after five straight years loses…” IDC statement reads.
This Chitala must be a bad guy. For five years on the board, the company was only making losses and only to recover to profit making a year later after Chitala was out? Stranger than fiction!

Further, Chitala accuses the IDC of being corrupt. IDC has not responded to that accusation. By the way, the IDC CEO was recently arrested and charged by ACC for corruption in the Mukula scam involving one of the IDC subsidiary ZAFFICO. Why has IDC kept quiet on the arrest of the top man?

Speaking in Lusaka today, PF Information and Publicity Chairperson Raphael Nakacinda said the revelations on the sale of KCM through a special purpose vehicle must be explained and possibly terminated.

He said the possible sale of KCM to Vedanta will not benefit the poor Zambians but a few clique in the new dawn government that possibly began to cut the deals before elections.

‘’There are schemes to bring the same Vedanta that was oppressing the people of the Copperbelt to try and continue cannibalizing our national resources. …..There were revelations before elections that Vedanta might have also financed the UPND during the campaign, could this be the reward?,’’ he stated.

Hon Nakacinda has therefore appealed to President Hakainde Hichilema to stick to his promise of protecting the resources of the Zambian People.

Meanwhile, Hon Nakacinda said well-meaning citizens of the country should start protecting the country’s democracy.

He said the evil schemes of wanting to advance a one party state has been validated in a leaked Audio of alleged President Hichilema’s Special Assistant for Politics Levy Ngoma in which he was in a conversation with an alleged government official to try and destabilize a named opposition political party.

‘’What was seemingly hidden under cover in State House is clearly being validated by what was revealed by Mr Levy Ngoma that there was an assignment given to him to try and dismantle opposition political parties,’’ he said.

In another development, the matter in which Hon Nakacinda is charged with defamation of the President has been referred to the Constitutional Court to rule whether it can continue in the Subordinate Courts.

Hon Nakacinda’s Lawyer Makebi Zulu said this follows an application made to refer the matter to the Constitutional Court.

‘’Were as the Constitution provides for national values and principles and espouses the principle of equity, social justice, equality and non discrimination. We have a situation were article 98 of the Constitution gives immunity to the President that no civil or criminal proceedings can be instituted against him. Then how can he be cross examined in instances were he is said to institute litigation against others?” questioned Mr. Zulu.

‘’We have argued that if the President is able to defame others saying ‘you are a clique of thieves’, the same said of him it becomes a criminal case. Where is the equality? The state has agreed that there is a Constitutional question to be raised. The Court has said in the latter that there is no objection… The matter has been deferred for ruling as to whether it continues in the Subordinate Courts on Friday, January 28,’’he said.

CIVIL rights activist Brebner Changala says members of the PF are agitated about the enactment of the economic and financial crimes fast track court because they spearheaded the ransacking of public resources.
He says it is unwise for former minister of justice Given Lubinda and his team to act like champions of democracy when they were the architects and foundation of institutionalised anarchy witnessed in the PF regime.


“The PF have become crybabies. The creation of the Economic and Financial Crimes Fast-track Court is created for every citizen that is domiciled in Zambia. The PF are crying foul because they know very well that they were at the forefront cannibalising the treasury. Stealing money for medicine, free education, and meal allowances,” Changala said in an interview. “That institution (Economic and Financial Crimes Fast-track Court) is being created to help the people of Zambia recover the stolen resources at the quickest pace of time. And this is to remove the encumbrances of matters taking too long in the courts of law when the urgency for recovering the resources is eminent and cannot be delayed any further.”He said it was nobody’s desire to jail people who never participated in the plunder.


Changala however said most of the PF members would be caught in the web during the exercise.
“That court will only see faces that had their hand in the cookie jar and nobody must blame the other but themselves,” he said.
Changala advised Lubinda to hold his tongue and introspect on his failures to uphold the rule of law as a minister of justice.
“Given Lubinda who is now acting president of PF must take a back seat and reflect on his time in government as minister of justice. Many challenges that they are facing today that involve abuse of office, financial misappropriation and total breakdown in the rule of law was because he failed to perform his functional duty as minister of justice,” he said. “One of the failures that he must accept and lies squarely on his shoulders is the failure to enact an enabling legislation to parliament to operationalise the Office of the Public Protector. If the Office of the Public Protector had been enabled, all the chaos that the PF engaged themselves in would have been checked by an independent body. Changala said the PF administration had no any arm of government that could check their shortcomings, correct their misconduct, and manage their abuse of office.


He asked Lubinda to hang his political gloves as he cannot advocate good governance when he participated in the misrule which was promoted by the PF regime.


“One of the things Lubinda and his colleagues must do is to sit down, stay away from active politics and reflect as to whether they are the right people to pledge checks and balances on the new dawn administration when they themselves had the same powers in the recent past, and yet they decided to abuse their offices and dismantle the Constitution and bring State-sponsored breakdown in the rule of law,” said Changala. “Given Lubinda and the gang of PF leadership must take a back sit and reflect very seriously as to whether they have the moral compass to talk about the rule of law.”

MMD president Nevers Mumba has commended the government for showing accountability in the manner in which contracts are given and public resources are managed.

“We [Bembas] are not a confused tribe that all we have are insults, no,” stressed Mumba.

Featuring on Prime TV’s Oxygen of Democracy programme on Monday night, Mumba added that President Hakainde Hichilema was focusing on uniting the country and ensuring that the economy was rebuilt, which the MMD supported.

“We are working with the new dawn government because they have shown accountability in the manner in which contracts are given,” he said.

And Mumba urged the Church to be united and speak against the use of vulgar language in the name of idioms.

He said the Church needed to come together and be united so that when they spoke the government also responded.

“The Church should come out and put their foot down because this is not an immoral country, but Zambia believes in morality both in speech and in action. For example, there is a certain language that a husband and wife can use in the bedroom and cannot be used on a bus going to the Copperbelt because there are certain places where certain words can be used and it is not everywhere,” Mumba said.

“What you cannot say to your mother, don’t say it. And what you cannot say to your father, don’t say it. So, I feel like the Church must have stepped in like last week and condemn insulting words called idioms which they put on us as Bembas. We are not a confused tribe that all we have are insults, no. Those are used in specific circumstances. They are cultural heritage that define where we come from. The audience time and place should be chosen.”

Mumba said there was need to practice politics that would build the nation and not just make noise.

He said there was also need for politicians to prioritise the needs of the people instead of just attacking whatever the government initiated.

“There is need for politicians to practice politics that build the nation and not just make noise and show Zambians that they are there. Let’s be mature enough to deal with the issues that affect the Zambian people,” said Mumba.

President Hichilema Challenged to Investigate the $50 millions Fertilizer Scandal

The Patriotic Front (PF) has challenged President Hakainde Hichilema to institute investigations into the $50 millions fertilizer scandal. Speaking at a media briefing in Lusaka today, PF Vice President Given Lubinda said that President Hichilema should also extend his corruption crusade to some of his people serving in his government as he follows up historic corruption.

Mr. Lubinda said that the PF supports the fight against corruption hence it’s call on the president to extend the corruption fight to cases being committed by people serving in his government.

He said that the PF will be forced to remind President Hichilema if they see no action being taken on historic cases affecting his colleagues.

“For now we appeal to him to investigate the scandal involving the $50M deal in which caked and underweight fertilizer has been procured for FISP at a collosal cost of $1,407 per tonne when the price obtaining in the country is below $1,000 per tonne,” Mr. Lubinda said.

Mr. Lubinda said the PF party is shocked that ministers in the new dawn government who were highly spoken about by President Hichilema when he was appointing them have now been reduced to common criminals who are being taught the art of stealing by a clique. Mr. Lubinda has since advised president Hichilema to watch over his ministers rather than warning the clique.

“Warning the clique not to tempt the UPND ministers because they are very weak souls will not help,” Mr. Lubinda said.

He said that the PF is disappointed that even after several leadership workshops where the President was sensitizing his Ministers and Permanent Secretaries, there are still weak angels in government. Mr. Lubinda has questioned what kind of lectures the President offered to his Ministers for them to later engage the clique for further studies.

Meanwhile, Mr. Lubinda has said that the PF party is reliably informed by PF members within the system that the new dawn government is now targeting lawyers and law firms that have been defending PF members on the list of targeted victims. He said that the UPND government is doing this to intimidate these law firms so that they stop providing legal services to the PF.

“We have indisputable evidence that Zambia Revenue Authority, National Pensions Authority, Workman’s Compensation Control Board, and other tax agents of the state have been triggered into action to investigate the compliance levels of the Law firms,” he said.

The PF Vice President has since questioned how there can be the Rule of Law which President Hichilema has been preaching when some citizens are denied legal representation. He said the former ruling party is aware that the new dawn government is doing all this to decimate the PF because they cannot stand the pressure of being reminded of their campaign promises.

1. A President is a very powerful person. He can do as he pleases at any given time. Wherever he looks, all he sees are his own appointees. His inferiors. His juniors. What can they possibly tell him? What do they know? If they had more wisdom than him, then they would have been the President and he would have been their appointee. But no, he is their President. Which means he is wiser than all of them. And talking about those in the opposition; what are they yapping about? What do they know? If they had any sound ideas of how to run the country, then the Zambian people would’ve given them some decent votes in the last election. But no. They were all blessed with zeros. It is the President who was blessed with 2.8 million votes. More than 1 million in excess of his closest rival. The President has an overwhelming mandate from the Zambian people. The people love him. He can do as he pleases, when he pleases.

2. The above is possibly the kind of reasoning that resides in the mind of President Hichilema and his clique of praise singers as they embark on one disastrous mission after another. As they increase the prices for key factors of production such as fuel and electricity with the consequent trickle down increase in the cost of living for the Zambian people. As the award themselves fertilizer contracts and then fail to deliver inputs to farmers on time. As they accuse the previous regime of teaching their ministers how to steal. As they spend millions of Kwacha in taxpayers money globe-trotting and living a merry life in the presidential jet, while judges, lawyers and the public at the Constitutional Court go without toilet paper because Musokotwane’s 2022 National Budget has not been funded and is still just on paper. As their national youth chairman threatens to beat up anyone that challenges their demi-god while the police cheer on. As they claim to have paid retirees and yet the paid retirees are still protesting at their offices on a daily basis. As they engage in a Spanish Inquisition against their predecessors instead of appreciating what was achieved by others and adding on their own achievements for the benefit of mother Zambia. Atakati.

3. Indeed, the nyudoni is full of malice, incompetence and arrogance. Of course there is nothing strange about such behavior for an African government. The PF regime behaved exactly the same, no so long ago. But what is strange however is the fact the nyudoni has embraced their malice, incompetence and arrogance a bit too early in office. If someone heard Garry Nkombo belittle and insult street vendors in Cairo road, they would think he is a minister of a Government that has been in office for at least 20 years and which has won several re-elections. One would not believe that he is a minister in the nyudoni administration which has been in office for less than 6 months. And this transcends to all nyudoni ministers and senior civil servants. Even when they are not saying anything, they have an air of deep rooted arrogance about them. They probably believe that they’re not even supposed to be walking around by themselves. That we should be carrying them around on our back. Kuti tikazibapapa pamsana pathu. Atakati.

And now they feel that they are very well entrenched in office that they can even begin to engage in extracurricular activities such as undermining our democracy by using state institutions such as the Office of the Registrar of Societies and the Electoral Commission of Zambia to prevent some political parties from participating in the Kabwata by-election. And when their amateurish small boys; Levy Ngoma and Josephs Akafumba are caught pants down raping our democracy, they then send their UPND militia in Zambia Police uniforms to intimidate media houses such as KBN television who reported the scandal. 5. But the good news is that the Zambian people are watching quietly and are taking note. Outside observers might think Zambians are docile, but we are a patient people. We like to give our leaders the benefit of doubt. We like to make sure, beyond any reasonable shadows of doubt, that our leaders have failed before we remove them and usher in someone else. So far people’s discontent with the nyudoni is slowly manifesting itself. The recent citizens’ arrest of UPND cadres by bus drivers at Kulima Tower Bus Station for soliciting payments, is just a tip of the discontent that Zambians have regarding Bally’s lip service towards UPND cadres harassing citizens in markets and bus stations. When Bally speaks in public, he says he will not tolerate cadrerism, but on the ground, he nods his National Youth Chairman to deploy cadres to harass and collect money from innocent citizens. And when these UPND cadres are reported to the police, the police look the other way. Obviously by instruction from the chief UPND cadre who mascarades as Inspector General of Police, Lemmy Kajoba. And after a couple of months of harassment from UPND cadres with no action taken by the police when the people lodge complaints, the people have now taken matters in their own hands and have started effecting citizens arrests as evidenced by what happened at Kulima Tower Bus Station a few days ago. This should worry Bally and his clique of praise singers. It also serves as a timely warning that you cannot harass people who are trying to earn an honest living and they take it while lying down. If you push people hard enough, they will rise against you. They do not need to wait for 2026 general elections. They can remove you even before then. Atakati.

KBN T.V. AND THE LEAKED AUDIO: WHAT DOES THE LAW SAY?

Since the audio leakage in which it is purported that President Hakainde Hichilema’s political advisor, Levy Ngoma and Ministry of Home Affairs and Internal Security permanent Secretary, Joseph Rikki Akafumba, discussed ECZ CEO and took sides in the internal squabbles of the opposition Democratic Party (DP), raised mixed comments from various stakeholders.

Worst still was the summoning of the KBN T.V. manager whose station aired the audio first which summons have also triggered sharp criticisms from some media bodies and human rights defenders against the Zambia Police Service and the Government.

The question is, is there any possible violation of the law by the KBN T.V. or not but mere media harrassmemt by the new dawn government using the police?

President HH has promised the nation of respecting the rule of law and by nature, the rule of law means enforcement sections of the existing laws whether good or bad by the police or any LEA failure to which it would be lawlessness.

Zambia last year hastily enacted the Cyber security and crimes Act No. 2 of the 2021 which sought to intercept, monitor and interfere with cyber communication among other mandates by law enforcement agencies.

In this Act under section 32(2)(a) and (b), it is illegal for a person to access, disclose or attempt to disclose to another person, the content of any intercepted communication or use or attempt to use, the contents of any intercepted communication.

Penalty attached to this act by any person, on conviction, is 1m penalty units (ZMK300, 000) or 10 yrs in prison (subsec 3 of sec. 31).

In addition, only law enforcement agencies are mandated to intercept, attempt to or use, or procure another person to intercept and use any intercepted communication (sec 26) any other person who is not a LEA or spouse of the LEAs who does intercept or use intercepted communication commits an offence and is liable on conviction to the penalties cited above.

On summoning and searching suspected cyber offenders, the Act empowers the cyber inspector/LEAs under sec. 15 to summon any suspect to answer questions, produce physical or electronic record, document or copy of the article which is subject of or relevant to the investigation and also orally examine a person who appears to be acquainted with facts and circumstances relating to the alleged cyber offence/threat.

The LEAs also have been empowered under the Act to enter, access and search premises and seize any information, make copies of a book, document or records the suspect has in possession of, at any reasonable time and without prior notice (Sec11)

Section 12 criminalises obstruction from suspects of the LEAs from conducting a lawful search or seizure and Sec. 15 criminalises giving false or refusing to give information or refusing to cooperate with or hinders the LEAs from conducting lawful search or seize or refusing to produce any record, document or copy required by the LEAs

This is how bad the law is to the media and investigative journalism and it is why we opposed it and challenged it in court.

Action Aid ZAMBIA, at one time, organised a media sensitization seminar to enable media appreciate the new working environment journalists would be operating under with the Act, I was a facilitator but alas, only a few media heads came and the rest were intern reporters.

Therefore, with the above, it will be unfair to condemn the police for enforcing the law which was left by the previous regime or condemn the Government

There are two possibilities in the case of KBN T.V. that is, the station broke the law knowingly to challenge it in court when arrested and called for its repeal or broke it ignorantly without any purpose for doing so.

I still stand on the position that the Cyber security and crimes Act is a bad law in the fight against corruption and in the promotion of a transparent and accountable governance system in Zambia

Therefore, my considered comment and opinion on the KBN T.V. issue is to condemn the law and call for its immediate review to remove all these evil sections in it than attacking police and government.

They are trying to repudiate and dismiss it as “fake” because they know it is not a small thing.

Many commentators on the recording of the conspiracy against Harry Kalaba and the Democratic Party have compared our current administration to that of its predecessors. The similarities are striking: a willingness to tap into the darker currents of our political climate, a disregard for the rule of law, and an overriding concern with settling political scores and damaging perceived enemies.

It is already apparent that this administration will also be marred by scandal.

Clearly, our governance system urgently needs far-reaching reforms which seek to restore faith in our political system by combating the corrupting influence of power and money in politics; promoting ethics and transparency in government; protecting people against abuses of government power; and limiting certain extraordinary exercises of presidential authority.

In less than five months, our current administration has created and exacerbated a broad range of problems.

Clearly, their corrupt use of power presents a threat to the rule of law and the multiparty democratic norms that we have been pursuing as a nation over the last 30 years.

Political practices like these
undermine our multiparty political dispensation. And they have been complicit in brazen acts of corporate corruption – the Jangulo fertilisers corruption scheme. Their blatant abuse of power is also focusing attention on long-standing practices that have undermined our political process and skewed it toward the politically connected at the expense of everyone else.

By bringing these pernicious problems into the spotlight, their misconduct is creating an opportunity for significant reform, if there is sufficient political will.

We must be ready to seize the opportunity to advocate for bold responses that do not just restore the prior status quo but also make fundamental positive changes. In the absence of those changes, the country risks recurrences of this kind of administration, where a demagoguing president full of sweet promises and nothings rigs the system for himself and his friends while seeking to misuse the levers of government in order to maintain power by weakening or destroying political opponents and their parties.
