Rapper Kanye West has been accused of punching a man in the face after he allegedly grabbed his wife inappropriately in Los Angeles.

West, 46, allegedly hit the unnamed male, who the Los Angeles Police Department said in a battery report first “pushed or grabbed” his wife, Bianca Censori.

In retaliation, Kanye punched him, according to the LAPD report obtained by TMZ.

The unnamed man did not require treatment for injuries, but filed the battery report with police following the ordeal on Tuesday night, April 16.

West and Censori fled the scene.

Ye is now being investigated by the Los Angeles Police Department over the battery case.

Officials have not formally announced charges against Ye or the man who claims he got punched.

Reacting, the rapper’s team told DailyMail that Bianca wasn’t merely pushed during the ordeal. Instead, they say she was sexually assaulted by the random man – who put his hands under her dress, grabbed her waist, and blew her kisses.

Kanye West’s representatives told DailyMail.com: “Grabbed” is grossly inadequate as a description of what happened. Bianca was physically assaulted.

The rep said: “The assailant didn’t merely collide into her. He put his hands under her dress, directly on her body, he grabbed her waist, he spun her around, and then he blew her kisses.

“She was battered and sexually assaulted.”

The ordeal allegedly happened on Tuesday night, just hours after Censori was seen walking barefoot in Disneyland California along with father-of-four Kanye West.

It’s not tribalism, I plead for your indulgence to listen/Read with an open mind. Despite the many Lozi people in prominent political Govt positions from Speaker of the National Assembly to Finance the Minister, we have not seen anyone defending HH against the Barotseland Nationalist publicly. He has been attacked mercilessly by this group and many Lozi people, with some even calling for secession. And this thing keeps on escalating but Lozi people in senior political position in UPND are quiet.

Why are they not speaking to their people? Does this mean they are sympathetic to the call of Barotseland establishment for secession? Where is the Speaker of the National assembly Nelly Mutti ,Where is the Minister of Finance Musokotwane, why is the UPND provincial elders in Western province not saying anything? Where are the MPs? Where is the Minister of infrastructure Milupi? And sensitive offices in security that I can’t mention on social media out of respect. This quiet diplomacy is just no longer working.

The Lozi have some good key positions in Government. We excuse the Lozi civil servants because they can’t get involved in such matters, and slightly excuse those working at State house because it will be seen like HH has sent them and cause more confusion. Where are the Lozi elders and leaders in political offices to defend their leader?

When the Kola foundation issued a statement that was against Government; Bembas lead by Kabuswe in Government including MPs came out to disown the group behind the letter. When the Umodzi Kum’mawa was first announced, we saw easterners including the Deputy Speaker, MPs and UPND Eastern province denounce the organization through a press conference.

Even Luapula United was condemned by people from Luapula in Government and politics. If you look at the above three organizations, they were not really calling for something sinister compared to what the Barotseland Nationalist is calling for.

Elo if it’s opposition political rally ati “we will crush you”, people just practicing their democratic rights.

I remember even RB was treated the same by some of the people in Government today, when he faced the same challenges with western province that lead to killing of people. If they had spoken out, am sure the issue would not have escalated to extremes or the way it’s escalate now.

MMD lost the Presidential elections by 100,000 votes that was attributed to declining numbers Western province. Ladies and Gentlemen for a lack of a better term, you can’t be eating and dining on the same table with HH and yet can’t defend him. You have to make your stand known. Alleged Police Torture Caused Man’s Death, Family Demands Justice

A family in Nakonde is demanding justice for their relative identified as Isaac Sinkala, who died under mysterious circumstances at Nakonde District Hospital last week.

The family has refused to proceed with his burial after discovering severe injuries on his body when they went to clean the body at the district mortuary on Wednesday.

The family alleges that the injuries are indicative of torture while he was in police custody.

Haggai Sinkala was arrested on April 3rd, 2024 for the alleged assault of a woman. He was initially detained at Nakonde police post before being transferred to the main station in Mukoma.

According to police records, Sinkala was released on April 8, but his whereabouts during detention were unknown to his family.

The family’s search for Sinkala ended tragically at the hospital on April 9th, where they found him unresponsive.

He passed away the same day, and the cause of death was initially diagnosed as trauma by the hospital, Chete FM has learned.

On April 16, the day of the planned burial, family members discovered wounds on Sinkala’s head, joints, arms, and private parts while preparing his body, the findings led them to cancel the burial and seek answers from the police about the circumstances leading to Sinkala’s death.

A meeting at the police station revealed conflicting accounts, Adam Chimfwembe, who has spoken to Chete FM News on behalf of the family, states that cell captains reported Sinkala was non-communicative and in poor health upon detention, contradicting.

They claim, information reached out to them suggested he was beaten by police officers while he was detained at the police post.

Deputy Commanding Officer Ronald Zambo for Muchinga Province has confirmed that a team has been dispatched to investigate the matter thoroughly, including a pathologist to determine the exact cause of death.

Mr Zambo has acknowledged knowing about Sinkala’s death five days after his release from custody and assures of details once investigations are concluded.

NGOCC WELCOMES GOVERNMENT’S APPEAL FOR HUMANTARIAN AID

The Non-governmental Gender Organisations’ Coordinating Council (NGOCC) welcomes the appeal by the Government of the Republic of Zambia for humanitarian aid to mitigate the impending human crisis that has been occasioned by the drought that threatens to affect 9.8 million Zambians.

On Tuesday, President Hakainde Hichilema in a televised national address revealed that 9.8 Zambians are affected in eighty-four (84) districts. The Head of State stated that Zambia urgently needs a total of 23.5 billion Zambian Kwacha (US$940.6 million) to avert a humanitarian crisis.

It is a truism that any humanitarian crisis negatively impacts mostly the most vulnerable in our society which include women and children. It goes without saying therefore, the majority of the 9.8 billion Zambians that will be adversely affected will be women and children in the 84 districts.

The women’s movement therefore joins the Government to appeal to the international community and the private sector to urgently provide relief support to mitigate the effects of the drought especially on women and children. Women and men experience climate change impacts differently due to their socially constructed roles and responsibilities. Women often have more limited rights than men, limited mobility and less access than men to resources, information and decision-making authorities. Consequently, they are more significantly vulnerable to the impacts of climate change and have fewer capacities to adapt and diversify their livelihood options.

We are therefore glad to note the measures that the Government is putting in place specifically to mitigate the impacts on the school feeding program, protection of the integrity and well-being of children under five, as well as pregnant women and mothers. Even as we anticipate the support from the international community and other partners there is need to ensure the engendering of the response mechanisms given the differentiated impacts on women and men, girls and boys. The drought will without doubt likely cause an increase in communicable diseases like cholera due to the low water tables and drying of boreholes. The situation is mostly going to compound the scarcity of water both in rural and urban areas. This means that women will endure the brunt of walking long distances to fetch not only water but also food and energy sources.

As the women’s movement we have intensified our awareness raising on climate change mitigation and resilience in the all the ten provinces and the districts that we are operating in as NGOCC to ensure we educate the women on the drought situation.

Local Government and Rural Development Minister Hon. Garry Nkombo has hailed President Hakainde Hichilema for equitably sharing the nation’s wealth through the unpreceded increment of the Constituency Development Fund – CDF.

Hon. Nkombo has disclosed that Chawama Constituency alone, has in the last three years received a total of 24 million Kwacha in skills training, loans and grants, a figure he said would have been disbursed in 15 years had the CDF allocation remained at the initial 1.6 million Kwacha per constituency.

‘’President Hakainde Hichilema is determined to continue with the increments in CDF so that each constituency and our people can fill the impact of these funds regardless of political party affiliation” remarked Hon. Nkombo.

The minister said that the new dawn government is walking the talk by ensuring that tangible development is brought closer to the people, and this can be seen through the speedy decentralization agenda.

The minister made these remarks during the handover of the 2024 grants and skills CDF disbursements where a tune of Two Million, Two Hundred & Thirty Thousand Kwacha (K2, 230, 000.00) was issued to 108 Cooperatives with a total sum of Seven Hundred, Six Hundred & Thirty -Five Thousand, Four Hundred Sixteen Kwacha (7, 635, 416 .00) handed to 815 skills training.

Others who received a share of the 2024 CDF funds included 70 boarding school students who received Two Hundred Forty-One Thousand, One Hundred Fifty Kwacha, Nine Ngwee (K 241 .150. 09).

Those present at the event included Lusaka District Commissioner Ms. Rosa Zulu, Chawama Ward 2 Councillor Jawara Karma, Councillor Davies Chembo from Nkoloma ward and Councillor Ponsilio Phiri from John Howard ward 3.

Others also at the handover event were Lilayi Ward 4 Councillor Bright Mafuta and CDF Chairperson Mr. Reuben Nkandu.

US Senate revokes Alejandro Mayorkas’ articles of impeachment

The Senate quickly finished with the impeachment articles against Homeland Secretary Alejandro Mayorkas on Wednesday. The trial ended before it really started because the Democratic majority ignored the Republican’s attempts to make the process last longer.

House Republicans tried to fire Mayorkas on February 13, but they had to try two times because they didn’t get enough votes the first time. The person chosen by Biden got impeached, which hasn’t happened to a Cabinet member in almost 150 years. The upper chamber had less conflict and finished a few hours after starting. They voted mostly along party lines to declare that the two articles of impeachment against Mayorkas were unconstitutional. These articles were for not following the law and for breaking public trust. Lisa Murkowski was the only Republican who did not vote yes or no on the first article.

The quick Senate trial was the end of a plan by House Republicans to bring attention to the Biden administration’s handling of the southern border before the election. It didn’t work out very well. However, many people thought that the case they wanted to bring to the Senate didn’t have enough strong points. Some also saw it as taking the focus away from other important messages during the election year. The House GOP accuses Mayorkas, the first Latino and immigrant to have the job, of doing serious wrongs, but constitutional experts say there is not enough evidence to support these accusations.

Chuck Schumer, the person in charge of the majority in the Senate, started the meeting by making a deal with Republicans. The deal would have allowed a set amount of time for discussing and voting on trial resolutions and points of order before deciding whether to dismiss the case.

Republican Senator Eric Schmitt from Missouri said he wouldn’t agree to end the impeachment case without a trial, calling it a “unprecedented” step. Many Republicans wanted to make a deal so they could give speeches on the floor criticizing Democrats and the situation at the border. If not for that rule, only people who everyone agrees with could give speeches, which is unlikely because of how important the situation is.

Schumer wanted to stop the first impeachment article because he didn’t think it accused the president of doing something really bad, as the Constitution says it should. After many votes, the Senate voted 51-48 to reject the first article of impeachment, with one person not voting.

After a few more votes, Schumer’s proposal to get rid of the second accusation was also accepted. This means the second accusation of impeachment was stopped by a vote from one party.

The House sent the impeachment charges to the Senate on Tuesday. On Wednesday, the senators were sworn in to be jurors. It is very unlikely that the chamber would vote to find guilty, which would need a two-thirds majority vote – a very difficult thing to achieve.

Democrats are criticizing the impeachment as a political trick. They say that Republicans don’t have a good reason for it and that it’s not right to impeach a Cabinet official just because they disagree on policies.

“We want to solve this problem as quickly as we can,” Schumer said during a speech on the Senate floor on Tuesday. “Impeachment should not be used to solve a disagreement over policies. ”

He said, “That’s a really bad example. ” This would be a bad example for Congress to follow. Whenever the House agrees on a new policy, they send it to the Senate and force them to do an impeachment trial. This is ridiculous. That’s not fair. “That is even more disorder. “

EU official calls on G7 to strengthen air defence for Ukraine

The EU’s top diplomat has asked G7 foreign ministers to quickly give Ukraine more air defence systems. He said taking too long could make the war go in Moscow’s favor.

The Italian Foreign Minister, Antonio Tajani, wants to impose more punishments on Iran for its recent attack and to give real support to Ukraine to defend itself from Russia’s invasion.

Foreign ministers from several countries were meeting in Capri to talk about wars in Ukraine and between Israel and Hamas. They wanted to send a united message about these conflicts. On Wednesday, leaders from the European Union met in Brussels and promised to increase punishments on Iran for sending drones and missiles to groups in Gaza, Yemen, and Lebanon.

Borrell said the EU will make the sanctions stronger and add more to punish Tehran and stop future attacks on Israel. He also said that Israel should be careful.

“I don’t want to make it sound worse than it is, but we’re very close to a war in the Middle East. It could have big effects on the rest of the world, especially in Europe,” he cautioned. “Please, don’t do it anymore. ”

Kuleba and NATO’s Jens Stoltenberg were at the Capri meeting as visitors. Kuleba said his country needs important help with military equipment like guns, bullets, and defense systems because Russia is moving closer to the border.

A person delivering legal papers for Trump’s lawyers said he gave the papers to Daniels but had to leave them on the ground because she wouldn’t take them. This was stated in a court document released on Wednesday.

“I told her she was given the papers and told her what they were,” said Dominic DellaPorte, who delivers legal documents. “She ignored me and continued walking into the place, and she had a blank expression. ”

Before a showing of the “Stormy” movie at the 3 Dollar Bill club, there was a fight between Trump’s lawyers and Daniels’ lawyer. This fight has been going on for a month and is still going on this week as Trump’s criminal trial starts in Manhattan.

Trump’s lawyers want Judge Juan M. to do something. Merchan wants Daniels to follow the subpoena. They included a picture that they said DellaPorte took of Daniels as she walked away.

UKA URGES PRESIDENT HAKAINDE HICHILEMA TO REFLECT ON HIS DESIRE FOR A “KUOMBOKA SHOW DOWN”

UKA is calling upon President Hakainde Hichilema to uphold the dignity of the presidency and not down grade it through gate crushing at the Kuomboka ceremony to be held this coming Saturday.

President Hichilema should realize that the presidency is the people’s apex personification of their chosen governance system and must not be subjected to ridicule through an insatiable appetite to score political mileage or unwisely settle self created political disputes.

The President must realize that he created the unnecessary tension between himself and the Barotse Royal Establishment (BRE) through uncalled for comments on the Barotse matter. He should have sought wisdom from previous presidents on how this matter was treated each time it came up during their respective tenures.

It is worrying to see that the President’s chosen path in this ever-recurring Barotse issue has been escalating hostility rather than deceleration of the tension of the Barotse issue through a broad based consultative and mature deliberation approach.

The BRE has settled on the guest of honour in reciprocation to the same status accorded to the Litunga during last year’s Ukusefya pa ngwena ceremony by the Mwine Lubemba. It will be worth noting that during President Lungu’s tenure, it was actually decided that government officials were no longer required to grace the traditional ceremonies but that such ceremonies would be graced by their royal highnesses themselves. It therefore follows that whether there is tension between President Hichilema and the BRE or not, the BRE is in order and is on firm ground to choose their preferred guest of honour at the Kuomboka ceremony.

The president is being urged not to salvage his dwindling political fortunes through gate crushing at an event he is not invited to. The message from the KUTA and from the Barotse Youth Alliance is loud and clear and the president should uphold the dignity of the presidency by simply staying away. Zambians expect nothing less than the president respecting and upholding the apex of the epitome of their chosen governance system.

Clearly, looking at the militancy with which both the KUTA and the Barotse Youth Alliance are expressing their disapproval of the President’s un invited presence, the situation is most likely to escalate into possible chaos that might lead to violence and God forbid, loss of life. The total disregard to the safety of the lives of the people is reminiscent of the Biblical story in 1 Kings 3:16 – 28 in which the uncaring and unloving mother agreed to the cutting of the baby into two.

President Hakainda must desist from a seemingly never ending unwise desires to turn the Kuomboka ceremony into a theatrical specter to score political mileage as he did in 2017. Had it not been for the wisdom of President Lunga, who ordered his security detail not to escalate the situation but move his motor cade off the road to avoid a show down, lives would have been lost and history would have taken a completely different turn.

Zambians will hold President Hakainde responsible for any risks posed to people’s lives. He did it before save for the wisdom of President Lungu and he wants to do it again in another format and that’s why UKA dare says, don’t do it!

Charlene Kabaso Mumba was never married to footballer Boyd Mkandawire a family member has revealed

Sister clears air on Charlene’s marital status

CONTRARY to social media speculation and rumors, late Charlene Kabaso Mumba was never married to footballer Boyd Mkandawire, a family member has revealed.

Charlene died in a road traffic accident on Kafue road last Saturday and was put to rest at Leopards Hill Memorial Park in Lusaka today.

The same accident left Chipolopolo star Rainford Kalaba, who was the passenger in the vehicle she was driving, critically injured and currently admitted to the University Teaching Hospital.

In the wake of the accident and mourning of the mother of two, gossip mills went into over drive with rumours that Charlene was having an affair with the 2012 AfCON winning player and cheating on Boyd Mkandawire.

But Charlene’s sister, Jennifer Kabaso refuted the rumours.

Speaking to Kalemba after Charlene’s burial, Kabaso said her sister was never married to Boyd although they had two children together.

“My sister Charlene had never been married to Boyd, no dowry was ever paid to the family although she had two sons with him. That’s why you never heard that she was married in her life history because truly my sister Charlene was never married to Boyd Mkandawire,” Kabaso explained.

“So unlike the false social media rumours, my sister was neither married nor divorced with Boyd. Yes they fell in love at some point and even had kids, but they were never married not even traditionally,” added Kabaso.

Meanwhile, in their tribute, Charlene’s siblings have described her as a free-spirited person who was the light of the family.

They said her bubbly personality and accommodative nature made a likable person with contagious laughter.

“Cha, some people call you, the golden egg, the kasuli of the family, words can not express the pain and brokenness we feel right now. It still sounds like a tale and we keep thinking it is just a bad dream. Our Charlene, the pride of the family. You were loved, you are loved and will forever be even in death.

“We cried together, we shared love and above all we laughed together and that is beyond. Charlene, may your soul rest in peace from your sisters, Constance, Isabel and Kelly your brother,” said Margret who read the tribute on behalf of her siblings.

Zambia is teetering on the brink of economic collapse due to grand theft and graft perpetuated by the ruling party of President Hakainde Hichilema says Dr. Cosmas Musumali, Secretary General of the Socialist Party (SP) on Hot FM today.


Dr. Musumali described as unfortunate the fact that under President Hichilema ´theft and graft´ has risen to a catastrophic national level of ´asset stripping´ compared to the ´pocket change´ theft under the previous PF administration.


“The damage PF caused to the economy is nothing compared to the damage UPND will leave behind,” Dr Musumali said, “the difference is PF stole pocket change while UPND are white-collar criminals stealing national assets.”


Dr Musumali said while PF crimes cannot go uncondemned especially after a government report said several assets have been forfeited to the state including $24 million from Konkola Copper Mine (KCM) liquidator Milingo Lungu, the massive theft under President Hichilema is worrying.


“We have a situation where a company, a mine like Mopani assets are being taken over by companies, either belonging to the Presidents friends, relatives or associates which is criminal,” Dr Musumali said.


“They (UPND associates) are taking over shareholding in national assets its going into their hands from battery value chain, fertiliser contracts to the mines the evidence is there for all to see,” said Dr. Musumali.


He said it is easy for the current government to recover monies stolen from previous administration, “basically pocket change that can be traced through an audit trail, but it will be hard to recover anything after UPND is gone because the shareholding will be in foreign hands.”
Dr Musumali said Hichilema and his associates are, “owning the economy (through acquisition of stakes in national assets) while PF simply got ´kickbacks´…UPND is going for national assets.


He said when government changes as its bound to change in 2026, “ we will be a the mercy of the new owners of the assets (HH´s partners)…these are bigger thieves than PF ever was and mind you the first PF was not bad it was the hijackers afterwards that were bad.”
Dr Musumali said there is no way President Hichilema ca be ´trusted ‘with the fight against corruption when he is right in the middle of it with his associates, urging Zambians to give a decisive ´no vote´ on HH and corp in the next polls.


The SP number two also encouraged Hichilema´s government to start stockpiling gold and build a gold reserve like PF did to hedge against dollar shockwaves and other economic challenges in future.


“Gold reserves are better and stronger than dollar reserves and Zambia must stockpile and buy gold not dollars,” said Dr Musumali.
Under President Edgar Lungu, the PF government started a gold stockpile exercise that amounted to about $70 million in just under half a year but was dumped immediately President Hichilema assumed office with no explanation.

For sometime now,I have been wondering what Mr Edgar Chagwa Lungu wants to come back into government to do that which he couldn’t do in 7 years.
I have been asking myself questions such as these;

1. When Chilekwa, his personal barber man at state house, secretly gunned down Lawrence Banda in Kaoma by-election campaigns,Mr Lungu never commented anything after that worrisome incidence,was he not briefed by his inner circle of informers on who pulled the trigger soon after? If he was briefed, was keeping quiet a moral thing to do?

2. When Nsama Nsama, the late state Prosecutor was shot dead whilst on duty,Mr Lungu never gave any reassuring message to the Zambian people and the world at large about making frantic efforts…….not leaving any stone unturned……,blur,blur….those political statements of hunting down the killer, the question is as commander in chief of all state security and intelligence agencies, wasn’t a detailed report availed to him immediately the killing happened? If he was detailed,was the report making him uncomfortable to inform the nation?

3. When that era of”gassing” of citizens, where a lot of people lost lives for merely suspected to be behind those terrorising incidences, wasn’t Mr Lungu,as head of state and commander in chief receiving daily briefings over the same? If he was,why was he deciding to remain mute when innocent people were being gruesome killed?

4. When forest 27 was being degazetted and plots shared amongst the very people elected to protect forest reserves, wasn’t he briefed?

5. When his children and family members were acquiring wealth beyond their age and income, and as a well brought up father, didn’t it concern him? Any normal parent must be concerned when his 21 year old child start acquiring expensive properties beyond his income, you ask questions?

6. Mr Milingo pocketed K600,000,000 from KCM as an appointed liquidator by Mr Lungu, this was at a time when our GDP growth rate was in negatives to support such income,wasn’t Mr Edgar Chagwa Lungu being briefed on the financial status of the mine and the country at large?

7. If Mr Edgar Chagwa Lungu was briefed about the Post Newspaper not remitting taxes to ZRA, and decided to clap it on that account, wasn’t he briefed that from the time he appointed Mr Milingo to take over control of KCM,no taxes, including PAYE were being remitted to ZRA despite being deducted from employees?, that no employees’ pension contributions were being remitted to pension houses such as NAPSA despite reflecting on employees payslips as having being deducted? In short, wasn’t he briefed that from the time he appointed Mr Milingo to take care of KCM,no creditors were paid, thus both staff, suppliers and contractors?

8. When Mr Edgar Chagwa Lungu was contracting those debts to unsustainable levels, wasn’t his financial crew advising him that the time was coming when the owners of the borrowed funds will need their money back? If he was advised that to repay that debt,he needed external support such as Lizard of France,why did he hound out the influencial global financial players with fingers on global financial keys such as IMF, American Ambassador, Cuban Ambassador, including Pastors and Papas,among others out of the country?

Just like he was unmoved by the unfortunate events above when he was in power,he seems not to be moved even today that the net is closing on him.Even Gamblers know when to count their money.
Those who play chess knows when the game is over even when the King is still standing, especially when your queen, pawns and your knights are in troubled waters.At that stage, the dignified thing to do is to give up before the cloud closes,

ABOUT USELESSNESS: A CASE OF GIVING PROBLEMS TO THE PEOPLE WHO EMPLOYED YOU TO FIND SOLUTIONS

1. Yesterday, l was taken by surprise by President Hakainde Hichilema’s impromptu announcement that he was going to address the nation. I wondered what about? Then his address came. He announced to the nation that the country requires K23.5 billion to mitigate the effects of the drought, and said that his Government had only been able to raise K1.3 billion, leaving a deficit of K22.2 billion.

2. Two things immediately struck me at that moment. Firstly, it occurred to me that the President had declared the drought as a national disaster more than 3 months ago, and just left the matter at a declaration, with no proposed solutions on how his Government was going to mitigate the effects of the drought. In other words, the President and his Government have been calculating how much will be needed to provide relief assistance to the affected population, for more than 3 months, meanwhile the affected people are either sleeping hungry, or in the case of the rural population, sleeping on wild roots. Are those really the attributes of a serious President who cares about his people?

3. The other thing that struck me about President Hakainde Hichilema’s address yesterday was the fact that after he indicated how much his Government needs to provide relief assistance for drought victims and that he has a shortfall of K22.2 billion, he ended there without providing a solution of where he intends to get that money. In other words, instead of providing a solution to the problem facing the people, he was giving the problem back to the people without a solution.

4. A serious President was supposed to say: “we have a deficit of K22.2 billion for us to provide relief assistance for the effects of the drought, and my Government has decided to re-align the National Budget by cutting down on expenditure for sectors A, B and C so as to mobilize the required deficit of K22.2 billion which is urgently needed to save lives by providing relief assistance to our population that is hard hit by the effects of the drought”. That would be a President offering solutions to the people who employed him to do exactly that. But alas, Hakainde Hichilema does not have any solutions, and is only able to offer a restatement of our problems.

5. The President should ask himself what it is he is offering the people in return to the many perks that the people of Zambia have provided him as Republican President. The food he eats at his home is provided by the people of Zambia. The suits, shoes, shirts etcetera that he wears are provided by the people of Zambia. The private jet that he uses to galavant the world is provided by the people of Zambia, together with the hotel bills for the seven star hotels in which he stays when he goes out of the country. The reason the people of Zambia are so generous to provide President Hakainde Hichilema with all the perks that he enjoys is because they expect that he will provide solutions to problems which the nation faces from time to time.

6. If the people of Zambia knew that their President is unable to provide any solutions to their problems, am very confident that they would not be willing to extend to him the perks that he currently enjoys as Republican President. And the issue of the current drought is as big as the national problems come.

7. When we had the last big drought in 1991/92, President Fredrick Titus Jacob Chiluba did not give the problem to the citizens. Instead, he worked quietly and found a solution. Next we just realized that there was yellow mealie meal and yellow flour for our bread and buns. In other words, President FTJ Chiluba had found a solution to the drought problem. He had done exactly what the people of Zambia had employed him to do.

8. By restating the problem of financing the mitigating measures of the current drought, instead of providing a solution, President Hakainde Hichilema is proving to be a useless President. He is not useful to the people of Zambia. At this point, all well-meaning citizens should ask themselves why we should continue to endear the President with the many perks that he has been enjoying.

9. Why should the people of Zambia continue to prove free food to a President that is unable to find solutions to the current drought. Why should the people of Zambia continue to prove free suits and other clothes to an impotent President? A President who is unable to birth any solutions for the nation? A eunuch. A liability. A President who consumes so much from the people but gives back so little?

10. More than 3 months after declaring the drought a national disaster, President Hakainde Hichilema and his Government have not delivered a single bag of relief food to any household across the country. Is this President serious? Is this President mentally fit? This level of uselessness is indeed unprecedented. Anyway, let me end here for today before he sends his Zambezi Squad to come and break down the door to my house. Let him go look for that K22.2 billion and provide relief food to all citizens affected by drought. We don’t need problems from him, only solutions. Every job has benefits and responsibilities. In order to enjoy the benefits, one must first discharge the responsibilities. It is immoral for Mr. Hakainde Hichilema to only enjoy the benefits of being Republican President and yet abscond from discharging his responsibilities. Go do your job sir !!!

WE NEED A SINCERE NATIONAL DIALOGUE, THINGS ARE NOT GOING WELL

Today, our country is bedeviled with a lot of difficulties; ranging from the economy, politics and social issues.

There is an intensifying crisis of governance, rule of law, democracy and social cohesion in Zambia under Mr Hakainde Hichilema and the UPND.

The sharp rise in repression, ethnic bigotry, grand corruption, tribalism and many other vices has left a dark spot on the unity, patriotism, and democracy of our country. The truth is, things are no longer the same anymore. This country is deeply divided. It is in unfathomable problems. Political competitors, private citizens, and other critical voices are degraded and brutalized through unseen repression, and hardship without any tolerance and restraint.

It is no longer a secret that Mr Hichilema has set this country on a risky path of destruction. The thoughtless manner in which this administration has been circumventing the law and abusing state institutions is a clear testimony of the illegitimate intentions of this administration.

Mr Hichilema and the UPND have literally incapacitated the rule of law and constitutional order in the country, and are going about their daily business with impunity, without oversight or regard for the ethical, cultural, political and economic consequences of their actions.

They have been unashamed with their systematic destruction of state institutions with the single resolve of reigning with fear and terror. But what is the end game? For how long will they be on this path before the citizens push back? What type of country do they think will be built and developed on the back of repression, tribalism, corruption, and so on and so forth?

Mr Hichilma needs to know that a leadership that reigns with force, fear, and terror, and is devoid of consent and understanding of the citizens, ends up in grief. This country has come a long way to come and self-destruct in such a manner. There is need for stakeholders – the Church, political parties, civil society, traditional leaders, among many others – to find a clear path that can strengthen and repair relationships, nurture a deep sense of political and cultural or ethnic harmony as well as achieve consensus on critical economic, governance, development and democracy problems.

We need a sincere National Dialogue on Values, Governance, and Constitutionalism, Human Rights, Reconciliation, the Economy, Social Cohesion, and many more. We need to begin to find collective solutions to these problems.

Things are not going well. Let us avert any future and worse crises now. There is a need to build social cohesion and trust before the 2026 general elections.

…to resolve the crisis of the mealie meal shortage and competitive pricing to cure the endless queues Zambians are being subjected to access the staple food

FORMER President Edgar Lungu has advised the UPND government to consider engaging private millers who have over the years worked with successive governments in managing the mealie meal market if the current crisis of Zambians queuing for the staple food has to be resolved.


And former President Lungu has said the Zambia National Service (ZNS) was never meant to take over the production and trading in the mealie meal market but the project was merely meant to supplement the private sector.


Commenting for the first time on the continued scarcity of the ZNS Eagle mealie meal which Zambians are now queuing and stampeding for, former President Lungu said ZNS had never had the capacity whatsoever to produce and meet the demand of the country’s staple food.
He said during his tenure as President, there were regular meetings with the private millers and grain traders to discuss how best to manage the mealie meal industry and that the private sector had always provided the best solutions.


Former President Lungu said under his administration, there was never a time when the country had a shortage of mealie meal and that because of the relationship government had with the private sector, the prices of mealie meal were always stable and affordable to citizens.


“When late President Michael Sata warned that we should never bring people into government who should do job on training, he meant every word. Zambians elected a leader who is learning how to govern but unfortunately, he is a slow learner. Even the few people that he listens to are also new and slow learners and this is the price we are paying for inexperience,” former President Lungu said.


“The ZNS was intended to supplement the efforts of the private milling sector and never meant to take over the market. Truth be told, ZNS has no capacity whatsoever to produce mealie meal and meet national demand.


Government should consider engaging private millers who have from time immemorial worked with successive governments to resolve the mealie meal crisis. Zambians are now being subjected to queuing for staple food in this day and era…it is unacceptable and should never have been allowed,” he said.
He recalled that the ZNS milling progeramme was mooted by the PF government whose original blueprint was not to take over the milling business market, warning that things could get worse than what was currently obtaining.
“It is a no brainer that the PF mooted the programme but ZNS was never designed to stifle the private sector. For me, it is not a surprise that we are where we are with citizens queuing up for mealie meal.


Even Dr Webster Chabe, the Seventh Day Adventist (SDA) Pastor has told him (President Hakainde Hichilema) to wake up because there is a real crisis of hunger in rural communities where this ZNS Eagle mealie meal is not distributed. I hope he will listen,” former President Lungu said.

The Litunga of the Barotseland has invited the Chitimukulu of the Bemba Royal Establishment as Guest of Honour at the 2024 Kuomboka Traditional ceremony of the lozi people of western province in a reciprocal gesture.

This follows the Litunga’s gracing of the 2023 Kusefya Pa Ngw’ena traditional Ceremony of the Bemba Speaking People.

This is in line with a recent government position and call on traditional leaders to hold traditional ceremonies devoid of political undertones but as platforms of cultural and traditional promotions and development.

We therefore find it strange that politicians are making a mileage out of President Hakainde Hichilema announced intentions to attend the Kuomboka Traditional ceremony this weekend.

What is wrong with President Hichilema attending the ceremony in his capacity as a citizen of this country and a subject of both chiefs to attend the ceremony in his capacity as a citizen? Why do we want to politicize even social events?

We wish to advise the opposition not to taint traditional ceremonies with their smear campaigns but allow the traditional authorities manage them without undue political pressure.

Zambia is built on a strong traditional and cultural foundation which has kept us together and fostered our national peace and unity in diversity.

The UPND respects and cherishes the role the traditional leadership have played and continue to play in fostering that national unity and we urge them to continue providing direction to all including the political sphere.

We therefore wish to state here in no uncertain terms that President Hakainde Hichilema reserves the right to visit any part of this country and participate in any activities both of political and traditional nature provided they foster national unity and economic development.

His intended visit to the Barotseland and subsequently the Kuomboka Traditional ceremony comes at the backdrop of him being a citizen of this country and a subject of traditional values and norms.

Let us not politicize the ceremony but allow everyone to participate without undue pressure.

The effects of El Hino as a result of global warming during the 2023/ 2024 rain season did not occur as a surprise.

The international weather monitoring agencies with state of the art equipment and technology on weather had shared valuable information and or data.

Proactive nations with level headed leadership began to prepare and put in place response measures to insulate their people and countries from adverse effects.

The discussions on global warming is not a new phenomenal, countries, academicians, researchers, environmentalists and many other international organizations such as the United Nations, World Health Organization, FAO, over two decades ago, have been raising alarm on the negative effects of global warming resulting from human’s poor stewardship of the God created environment.

In the response to the drought in Zambia the President Mr Hakainde Hichilema declared the situation as a nation disaster.

Ordinarily such a declaration could have gone in details to provide the response measures that government had drafted to minimize the negative impact on the people’s social economic well-being.

Unfortunately all President Hakainde Hichilema did was the usual rhetorical pronouncements saying no Zambian will starve or die of hunger.

Why did the President assure the nation when he didn’t have the monetary resources to provide relief to the citizens!!!

This is not the first time Zambia is faced with drought, previous Presidents ably responded with the urgency the situation required.

Up to now President Hakainde Hichilema’s administration has not offered any relief to the starving citizens except for social media lip services.

President Hakainde Hichilema must quickly come to real terms with the hunger and social economic hardships that the people are facing.

He must provide escalated solutions.

Hunger Zambians will not wait for the President’s international begging bowl to fill, when the country has so many and or endured with God given mineral and natural wealth to tap into in response for a rainy day.

President Hakainde Hichilema must work at the pace that a condition declared a national disaster requires instead of placing Zambian citizens at the back of the international begging nations line.

The people requires immediate solutions not rhetoric and or lamentations from the President.

AKA’s family won’t endorse book on his ‘toxic’ romance with late girlfriend Anele

The parents of late South African rapper AKA, real name Kiernan Forbes, have expressed outrage over an upcoming book by acclaimed author Melinda Ferguson, which has already ignited controversy.

The book titled When Love Kills – The Tragic Tale of AKA and Anele, shares the “devastating story of the hip-hop hero whose highly public life unravelled after Anele [AKA’s girlfriend who died a year before his death] plummeted to her death. Details would soon emerge that showed the couple had been caught up in a whirlwind of obsession, alleged substance abuse and violence”.

AKA’s parents, Tony and Lynn Forbes have now distanced themselves from the book, expressing their anger and disapproval. They said they find the intended publication of the book and the timing distasteful and opportunistic.

The statement read;

“We are not in any way associated with Melinda Ferguson’s book and we do not endorse it. In the same breath, we distance ourselves from the contents of the book,” the statement read.

“When Melinda reached out to us, we respectfully and rightfully declined to contribute to her book.

“At this stage we cannot give any further comment on the book as we are unaware of its contents. We do, however, find the intended publication of the book and the timing distasteful and opportunistic.”

Ferguson who disclosed that she was not expecting such an overwhelming response from the public after the book was announced late last week, wrote on Facebook;

“I’m not going to lie here… the last 24 hours have been a lot. While I knew that the book would probably cause a stir, I did not expect the crazy responses that it has received since someone broke the news on social media yesterday.

While I have been touched by the love and support I’ve received I have also felt deeply affected and misunderstood by the spitting vitriol. I know we live in a world of social media, where unkindness and callousness drive the conversation, but it’s a lot.

I wrote this book in an attempt to try and understand a story about two people who fell down a rabbit hole of toxic love. Something kept driving me to keep on in search of some kind of truth around what happened.

And why they were now both dead … I have been through my own kind of hell in my life as an addict and as someone who has embarked on dangerous and obsessive relationships. Their story spoke to me. It literally broke my heart.

While researching and writing, I found it especially tragic that Anele, who had just turned 22 when she died, has no actual voice in this book. Besides a few utterings on social media, there are no records of any of her statements or interviews in the public realm. She had yet to make her mark, so I had to rely on what other people have said about a significant character in this story.

In the last moments of Anele’s life, as she lay on the tar after she had plummeted from the 10th storey of the Pepperclub in Cape Town, she silently mouthed the words: “Please help me.” As I got deeper and deeper into my writing, I felt her call grow louder and louder.”

Myanmar’s detained former leader and Nobel laureate Aung San Suu Kyi has been moved from prison to house arrest, a spokesperson for the military government said.

Suu Kyi, 78, has been detained by the Myanmar military since it overthrew her government in a 2021 coup.

Confirming her house arrest, Junta spokesperson, Major General Zaw Min Tun said: ‘Since the weather is extremely hot, it is not only for Aung San Suu Kyi … for all those, who need necessary precautions, especially elderly prisoners, we are working to protect them from heatstroke.’

Suu Kyi has been serving a 27-year prison term on a variety of criminal convictions, from treason and bribery to violations of the telecommunications law, which her supporters and rights groups say were fabricated for political reasons.

A nationwide conflict in Myanmar began after the army in 2021 ousted the elected government, imprisoned Suu Kyi, and began suppressing nonviolent protests seeking a return to democratic rule.

In February, her son Kim Aris said she was being held in solitary confinement and that she was in good spirits ‘even if her health is not as good as it was in the past’.

Aris has previously said how he wanted his mother to be returned to her home in Myanmar’s largest city, Yangon.

Last fall, he called the decision by the military leaders to keep his mother in prison while she is suffering from poor health ‘heinous’ in an interview with The Independent.

‘To hold someone illegally in prison, a move condemned by the outside world is compounded into further and heinous wrong when basic human rights are abrogated,’ he said.

World leaders and pro-democracy activists have repeatedly called for her release.

Her legal team is continuing to appeal to prove her innocence in the cases, as well as working on appeals for 14 others she faces.

A spokesperson for the NUG shadow government called for the unconditional release of Suu Kyi and U Win Myint, Myanmar’s ousted president, who has also been moved to house arrest according to media reports.

‘Moving them from prisons to houses is good, as houses are better than prisons. However, they must be unconditionally freed. They must take full responsibility for the health and security of Aung San Suu Kyi and U Win Myint,’ spokesperson Kyaw Zaw said late on Tuesday.

“I couldn’t sleep last night because I was thinking about if I could do that,” she said.

Trump smiled and nodded big when one person said he read two of the former president’s books, “The Art of the Deal” and “How to Get Rich. ” The man, who said some of his wife’s family members work for the Republican Party, said he didn’t think there was anything that would stop him from looking at the case fairly.

“He said that everyone should follow the law. ”

The charges are about Trump’s company paying $130,000 to his lawyer, Michael Cohen. He gave money to stop Stormy Daniels from telling everyone about her time with Trump. Trump said that the meeting never happened.

Prosecutors say that the money given to Cohen was recorded as legal fees, but it wasn’t true. The prosecutors said the money was part of a plan to hide harmful information.

Venezuela protests the police raid by closing its embassy in Ecuador

Venezuelan President Nicolas Maduro closed his country’s embassy and consulates in Ecuador to support Mexico after Ecuadorian police raided the Mexican Embassy in Quito.

Maduro and other presidents in a virtual meeting supported Mexico’s request to kick Ecuador out of the United Nations because of the raid on April 5th. But Maduro was the only one who said he would close embassies and bring back staff.

“Everyone has strongly condemned Ecuador’s move,” Maduro said. “No one is defending this cruel act in the world today. ”

Ecuador’s President Daniel Noboa told police to go to the Mexican Embassy to capture their ex-Vice President Jorge Glas, who broke the law and had been hiding there since December. Mexico gave him permission to stay just a few hours before the police found Glas in a bedroom and took him out by force.

The very unusual use of force was strongly criticized by governments worldwide because diplomatic buildings are seen as foreign territory and should not be violated according to the Vienna treaties.

Noboa did not go to the meeting on Tuesday. He said last week that he allowed the raid to protect national security. His government says that Glas was wanted for his criminal convictions, not for political reasons. They also accused Mexico of breaking the Vienna treaties by giving Glas asylum.

Mexico stopped talking to Ecuador after the raid and told its diplomats to come back home. It wanted to get support from the CELAC meeting to help with its case at the UN and in front of the International Court of Justice.

Honduras President Xiomara Castro, who is in charge of CELAC, started the meeting on Tuesday by reading a suggested message criticizing Ecuador’s actions. Then she showed a video of Ecuadorian officials entering Mexico’s Embassy, with exciting music playing.

The President of Mexico, Andres Manuel Lopez Obrador, said again that Ecuador should be kicked out of the United Nations until it says sorry and promises not to do it again.

He also posted another video declaring an emergency for the country’s electricity sector during long power outages in Quito.

Maduro said that he should have come and taken responsibility for himself in front of Ecuador, Latin America, the Caribbean, and the world, but he did not show up. “I’m from Venezuela and I can tell you that he’s hiding. The people of Ecuador need to know this. ”

US lifts sanctions on Zimbabwe, targeted ones on Mnangagwa circle remain

The United States Department of the Treasury’s Office of Foreign Assets Control (OFAC) has lifted Zimbabwe Sanctions Regulations from the Code of Federal Regulations.

The sanctions were first implemented in 2003 through Executive Order 13288, citing concerns about the Zimbabwean government’s actions undermining democratic processes and institutions.

The decision to terminate the sanctions regime follows US President Joe Biden’s approval of a new Executive Order terminating the Zimbabwe sanctions program in March.

“OFAC is taking this action because the national emergency on which part 541 was based was terminated by the President on March 4, 2024.

“The rule is currently available for public inspection with the Federal Register and will take effect upon publication in the Federal Register on April 17, 2024,” the US department said.

President Emmerson Mnangagwa, his wife First Lady Auxillia Mnangagwa together with nine Zimbabwean individuals and three entities, however remain sanctioned under the Global Magnitsky programme for their alleged connection to corruption or serious human rights abuses.

Apart from Mnangagwa and his wife Auxillia, others on the sanctions list are Vice President Constantino Chiwenga, police Commissioner General Godwin Matanga and his deputy Stephen Mutamba, Defence Minister Oppah Muchinguri Kashiri, Sakunda Holdings proprietor Kudakwashe Tagwirei and his wife Sandra Mpunga, director of Fossil Fuel Obey Chimuka, Central Intelligence Organization (CIO) deputy director Walter Tapfumaneyi and Midlands Provincial Affairs and Devolution Minister Owen Mudah Ncube.

The three entities on the sanctions list are: Sakunda Holdings, Fossil Agro, and Fossil Contracting.

The latest marks the end of a two-decade long era of sanctions imposed on the African nation.

The sanctions were first implemented in 2003 through Executive Order 13288, citing concerns about the Zimbabwean government’s actions undermining democratic processes and institutions. The order was followed by two more executive orders that expanded the scope of the sanctions.

The new order revokes the previous executive orders that authorised the sanctions program.

While the sanctions are lifted, OFAC clarifies that any enforcement actions or investigations related to violations that occurred during the sanction period will continue. It is also stated that the termination does not affect any rights or penalties incurred before March 4, 2024.

China Cancels Zimbabwe’s Interest-Free Loans

China has taken action to address Zimbabwe’s debt situation by cancelling unspecified amounts of interest-free loans and committing to assisting the country in navigating its debt crisis. This move comes amidst concerns raised by activists regarding the potential entrapment in a perpetual debt cycle. As of September 2023, Zimbabwe’s publicly guaranteed debt totaled $17.7 billion, with $12.7 billion external and $5 billion domestic. A significant portion of the foreign debt originated from China, as Zimbabwe became ineligible for loans from multilateral creditors like the World Bank and the International Monetary Fund (IMF) due to defaults dating back to the early 2000s.

Since the ousting of long-time leader Robert Mugabe six years ago, the country has struggled to negotiate debt restructuring agreements with its creditors. The debt restructuring dialogue, led by former Mozambican president Joachim Chissano and African Development Bank president Akinwunmi Adesina, faced setbacks when the United States withdrew support due to perceived reluctance from Harare to implement reforms.

China, now the largest non-Paris Club creditor for Zimbabwe, has expressed readiness to support the country in overcoming its debt challenges. 1. On 13th August 2023, a Whistle-Blower lifted the lid on the on-going multi-million dollar crime occuring on the Apron of the Kenneth Kaunda International Airport.

2. The matter was so hot that despite the investigations on-going, we were treated to three major press conferences in a space of two days, one by Minister of Mines and Minerals Development, Paul Kabuswe who claimed it was a small matter of iron, tin and alumunium and warned politicians not to alarm the nation.

DEC finally confirmed the major scandal announcing that it had detained 11 people, confiscated $5.7million, including guns and an executive aircraft.

Finally President Hakainde Hichilema came on to allay fears that he could be shielding State House officials allegedly involved in the brewing international scandal.

3. Minister of Home Affairs and Internal Security, Jack Mwiimbu also responded to demands of MPs and issued a Ministerial Statement.

He said the following items were found and seized from the aircraft:
(a)
US$5,697,700;
(b)
602 bars of purported gold weighing about 127.28 kg:
(c)
four bars of gold, weighing 1,414.17 g, authenticated by the relevant authorities;
(d)
five pistols and eleven pistol magazines;
(e)
126 rounds of ammunition; and
(f)
one drilling machine

He stated that based on the findings, law enforcement agencies decided to charge five
Egyptians and six Zambians with espionage on the premise that they accessed the air-side, which
is a restricted area, for purposes that were prejudicial to safety and interest of the Republic of
Zambia, contrary to Section 3 (a) of the State Security Act, Cap. 111 of the Laws of Zambia.

He also stated that on the other hand, the four crew members of the Global Express jet were cleared and released from
custody and were allowed to return to their different countries.

He also confirmed that on Friday, 1st September, 2023, the DPP, Gilbert Phiri, entered a nolle prosequi in respect of the five Egyptians and one Zambian national, while the rest were committed to the High Court.

4. They hard tried to hide the crime. It became clear that a cover-up was underway anyway.

Of all the powerful people involved, undue attention was shifted and focus to a Lusaka businessman and goldsmith, Alex Kasanda. The media were carried in tow to search his house and courtrooms making him the centre of the transaction.

5.Soon the Director of Public Prosecutions (DPP), Gilbert Phiri discharged six key figures in the scandal following the Nolle Prosquei. Phiri ordered the relase of the five Egyptians; Walid Botros, Mounir Awad, Mohamed Gooda , Yasser ABDELGHAFOR and Michael Botros.

The Zambian suspect who also walked to freedom is Chartered Accountant and Chairperson of the Bene Mukuni Traditional Ceremony, Mulungu Oswald Diangamo.

6. Shortly after that,the Egyptians were given permission to leave the country.

7. It wasn’t long before the plane and the money followed them.

8. On Friday, 12th April, 2024 we received reports that the plane, which was under legal seizure and forfeiture ptocess was hurriedly being prepared for departure. And during the evening, the plane taxied and took off!

The Bombardier Global Express, BD-T7-700-1A10 (T-WSS) aircract belongs to IBIS Air (PTY) Ltd and World Aviation Sinai Int’l Ltd.

9. Under our laws this was tainted property and that’s why DEC, ZRA and Law Enforcement Agencies routinely seizes not only the contraband but vessels or vehicles involbed in the crimes.

10. The Drug Enforcement Commission and the DPP claim that since there was an application by representatives of IBIS Air and others before the Lusaka High Court under the Forfeiture of Proceeds of Crimes Act of 2010, Section 12, where third party can lay claim, the authorities decided to oblige and release the aircraft under a Consent Judgement.

11. Why a Consent Judgement? Why didn’t the DPP defend the seizure and forfeiture in court? Why enter into this Consent Agreement? To whose benefit and interest are we serving if such a high value property, valued in excess of $20million can be released without even the pretence of a court hearing?

12. They said everyone would face the law but they released the Egyptians, they said no assets involved in the crime will be released, but the plane has been released..they say $5.7million has been forfeited to the State….just wait, it’s a matter of time….meanwhile the poor Zambians in the case will be sacrificed…

EDGAR LUNGU’S ELIGIBILITY CASE MOVES TO JUNE

The matter in which a Lusaka resident sought to establish whether Edgar Lungu, the sixth President of Zambia qualified to stand in the 2021 elections has been pushed forward to the June session of the Constitution Court said Makebi Zulu, the sixth President’s lawyer.

Counsel Zulu also expressed concern at the fact that President Lungu´s ´eligibility case´ has been heard five times already by the same court returning with the same conclusion—he was constitutionally eligible to run for re-election in the last poll.

“Today we raised preliminary issues to the effect that this is fifth time the eligibility case of the sixth President is being heard by the same court,” said Zulu.

According to official court records, President Lungu´s case has been once taken to the Concourt by Reverend Dan Pule, Bampi Kalasa, Legal Resources Foundation sued and Sishuwa Sishuwa jointly with the Chapter One foundation.

“This time around one Michelo Chizombo sued (President Lungu) claiming the same issues of eligibility raised in previous matters yet again,” said counsel Zulu.
“Today we raised preliminary issues to say that the matter has already been dealt with,” said Zulu.

After so much drama, heavily armed police and UNZA students believed to have been bused to the Supreme Court premises in Lusaka where the court is housed, however, the case failed to take off on a logistical glitch of lack of electricity and font size of court papers filed in defence of President Lungu.

“Because of load shedding (poor light) we couldn’t proceed today. We will be back in June session of concourt life,” said lawyer Makebi Zulu outside the court grounds in an address to the media.

The sixth President was escorted to court by top party stalwarts that include vice president Given Lubinda, leader of the opposition in parliament Hon. Brian Mundubile, Secretary General Raphael Nakachinda, former Foreign Affairs Minister Joseph Malanji and Ms. Mumbi Phiri.

President Lungu´s case has the potential of setting into motion a series of legal impasses crushing because if he is declared to have not qualified to run in 2021, every appointment he made could be illegal, including that of the constitutional court judges according to legal experts.

2. FISP has always been a savior, you engaged in disruptive and corrupt behaviour, bangled the distribution of farming inputs, three years in a roll.

3. You continously engaged in wasteful expenditure such undertaking 67 unnecessary international trips.

5. You delibetately gave away revenue from the mining sector and the annual revenue has dropped from $1.1billion in 2019 ,2020 and 2021,to a paltry $250million a year.

6. Even opportunities such as the sale of Mopani Copper Mines which has earned ridiculous and scandalous transaction fees of $15.7million to Rothschild &Co and Baker McKenzie, is so bad that no money is coming into the Treasury. The $620million price for the 51% Mopani Copper Mine shares is a mere investment pledge into the capital projects and operation capital for the mine, investment that should be separate from the share sale price.

7. In July 2023, the Famine Early Warning Systems Network( FEWS NET) warned of the impending El Niño weather phenomenon and impending food insecurity that would affect Southern Africa in 2024. You kept on exporting the maize.

In November 2023, FEWS-NET again warned of the severe dry spells that would occur in January and February 2025, what did you do with this information? You didn’t advise the farmers and even scaled up the export of maize.

7. Even when you have been warned that six million people may be affected by the famine, your priorities and focus remain in fighting and decimating the Opposition, abusing human rights, closing the democratic and media space and continously engaging in wasteful expenditure.

Information Minister Cornelius Mweetwa has issued a veiled threat against privately owned media house KBNTV whom he has accused of peddling propaganda and politics instead of real news during a press conference at his office.

Mweetwa also signalled the Independent Broadcasting Authority (IBA), the media regulator of Zambia to investigate the content of media houses like KBNTV run by Pastor Kennedy Mambwe.

“Let´s be of good use when disseminating information to the public by channelling out good information to the public and not to be used as purveyors of lies and misinformation,” said an angry Mweetwa.

“I recently witnessed with gross horror and consternation a TV station KBNTV hosting a discussion on the President (Hichilema) of the republic of Zambia commissioning one toilet in Kitwe and opening phone lines allowing unsuspecting citizens to make comments on an uninformed basis and creating a caption that the diaspora is disappointed with the President,” said Mweetwa.

Mweetwa said he expected KBNTV and other media to investigate stories before going for discussion programmes on air and allegedly mislead Zambians through ´misinformation´.

Then came the ominous warning from Mweetwa to KBNTV, “as the Minister in charge I don’t want to be checking whether IBA is following up the content that some of our media outlets are feeding the nation in line with the provisions of the IBA Act of 2002 that sets out the conditions media houses must follow particularly with content.”

Mweetwa said, “the public must not be misinformed by some media houses who are doing partisan politics because the President wasn’t launching one toilet.”

Relations between Mweetwa and KNTV hit an all-time low recently when the widely followed TV station exposed the Minister when he tried to cover his tracks for admitting that government was responsible for fanning disunity in the previous administration of President Lungu and fanning tribalism to win elections.

In a ´hot off the mic´ with senior journalist Innocent Phiri recently, Mweetwa is heard asking KBNTV´s Phiri (IP) to clean his mess promising to pay him in return of ´cleaning up´ following the after math that saw Socialist Party President Dr Fred M´membe to report Mweetwa to police.

“You are my friend and ´ambassador´ you need to help me out on this (fanning tribalism), and I will pay you through friendship,” Mweetwa promised Phiri.

Dr M´membe´s complaint against Mweetwa filed in February to police has not been attended to yet while repeated calls by the SP leader have gone largely unanswered.

During the press conference, however, Mweetwa, the chief spokesman of government did not complain about the Times of Zambia, Daily Mail or ZNBC that openly cheer for the government without apology and is deemed as bias by commentators of media.

Analysts fear that Mweetwa´s call for the IBA to check the content of KBNTV could be a step towards a punitive measure in a country where the democratic space has been reported to be shrinking since August 2021.

Recently his permanent secretary during an appearance on KBNTV also accused the station of being ´sympathetic´ to the opposition led United Kwacha Alliance (UKA) without evidence, although the station always hosts government officials.

It is unclear how the IBA will react to the ‘instruction´ given to them by Mweetwa to investigate KBNTV matters.

…Brian Mundubile is advising President Hichilema never to consider the SDA Copperbelt Conference president as an enemy of the UPND after openly telling the head of State that he will soon be history.

Lusaka – Wednesday, 17 April 2024.

PRESIDENT Hakainde Hichilema should begin looking at Dr Webster Chabe, the Seventh Day Adventist (SDA) Copperbelt Conference president as a messiah who has delivered the most difficult message against the one-party State, but for unity and national development on behalf of Zambians who are going through the worst economic hardships ever, Brain Mundubile has said.

Mr Mundubile, the Leader of the Opposition in Parliament says President Hichilema should start looking at Dr Chabe, the Catholic Church, the Law Association of Zambia (LAZ), the Human Rights Commission (HRC) and many other stakeholders who have spoken out on how bad things had become under the UPND as brothers who should be embraced.

Mr Mundubile, the Patriotic Front (PF) Mporokoso Member of Parliament said in an interview yesterday that what Dr Chabe told President Hichilema last week during his sermon was that the Catholic Church, OCiDA, LAZ, HRC and many others had been talking about and that it was time President Hichilema began looking at his praise singers with suspicion.

“We want to encourage Dr Webster Chabe, the SDA Pastor to continue speaking for the people and reminding President Hichilema that he will not be in that office forever. Indeed, soon and very soon, he will be history. It is our hope that President Hichilema will look at Dr Chabe as a true brother and not as a political enemy and should look at his praise singers, those who tell him theing are alright when in fact not with suspicion,” Mr Mundubile said.

“What Dr Chabe told President Hichilema and his government is what the Catholic Church has been saying. This is what LAZ, the Human Rights Commission, it is what OCida has been saying. President Hichilema should begin looking at Dr Chabe as a messiah who has delivered the most difficult message under very difficult circumstances,” he said.

He said it would be wise for President Hichilema and the UPND to look at Dr Chabe as a friend of the head of State and the ruling party.

Mr Mundubile stated that Dr Chabe was courageous enough to deliver a message on behalf of Zambians because the SDA Pastor wanted President Hichilema to receive first-hand information about the suffering of the people and the impending famine.

“Dr Chabe was also quick to ask President Hichilema what it was that he would be remembered for. President Hichilema should begin working on his legacy. I am happy that he did not segregate in his preaching and acknowledged that governments before the UPND had each left something to be remembered for.”

Former President Edgar Lungu will be remembered for championing various economic infrastructure, including modern international airports, roads, flyover bridges, the 650 health posts across the country and the more than 1, 000 classrooms.

Former President Lungu ended load shedding. President Rupiah Banda will be remembered for Formula One and a healthy economy.

What is it that President Hichilema will be remembered for? What Dr Chabe did is what all the Church leaders should be doing…speaking on behalf of the suffering citizens and not pleasing those in power,” Mr Mundubile asked.

And Mr Mundubile said Zambians were not prepared to go back to the one-party State and they shall frown and fight any attempts by the UPND to revert the country into a dictatorship.

“What we have, even when we claim that we are a constitutional democracy are memories of the one-party State. In Zambia today, under President Hichilema, Zambians are being denied their right to freedom of assembly and association, citizens are being stop from participating in elections, they are being detained without trial and for no reason at all, there is torture and extra-judicial killings. This is akin to one party state, Mr Mundubile said.

BACKGROUND

In 2021, when UPND won the elections, Government sought to remove the court appointed liquidator at KCM, Mr. Milingo Lungu. However, Government did not have the legal mandate or powers to remove a Court appointed Liquidator. The Law enforcement agencies then started investigations and charged Mr Milingo Lungu with the theft of K4.4m from KCM and the being in possession of property suspected to be proceeds of crime and seized a house worth over $750,000 which was believed to have been bought from the K4.4m taken from KCM without authority.

POLITRICKS

In a case that looked like it was straight out of a Jefferey Archer novel on Political mingalato, the DPP offered Milingo Lungu immunity from prosecution in exchange for relinquishing his role as Provisional liquidator of KCM. The deal was supposedly offered by State House and was a way of getting the liquidator out of the way. Were the charges genuine or bogus and used as a bargaining chip for the him to relinquish his role? We will never know, there was a public outcry that saw the DPP removed from her office without giving her side of the story (She has asked the court to lift her oath of secrecy so she could tell it all, the court denied the request)

FACTS

Under pressure from the public, the LEAs re-opened the case and re-arrested him over the same charges. The immunity was lifted.
So instead of prosecuting him for the crimes of theft of K4.4m and being in possession of property suspected to be proceeds of crime, the LEAs again entered into a consent Judgement for Milingo Lungu to forfeit his rights to the $24m in fees that he is supposed to be paid from the liquidation of KCM. He did not forfeit the $24m, but the right to claim

Tokyo, 17th April 2024

The Japanese government has pledged an investment of $1.5 billion United States Dollars to support investment by Japanese companies to boost Zambia’s mining sector.

Japan’s Minister of Economy, Trade and Industry (METI) Mr. Saito Ken says the Japanese business corporation is eager to invest in the country’s mining industry.

He said this during a bilateral meeting held earlier at the METI Offices in Tokyo.

And METI Vice Minister Mr. Taku Ishii reaffirmed the pledge during the Japan Zambia Investment Seminar in Tokyo today organised by the Japan Organisation for Metals and Energy Security (JOGMEC).

He said his government seeks support from the Zambian government once the investment becomes materialised and hopes to conclude the investment agreement as soon as possible.

“I have heard from the former Minister that His Excellency President Hakainde Hichilema has high hopes for Japan to use its capital and technology to create value addition and jobs for the young generation in your country. Our country shares the same sentiment. We aim to build a win-win relationship that will create jobs in your country not only through mine development, but also through the creation of supply chains for smelting and processing, human resource development, and technical cooperation”, he said.

Mr. Ishii also explained that cooperation in the exploration field is also progressing between JOGMEC and the Zambian Ministry of Mines and Mineral Resources arising from the Memorandum of Association signed between the Ministry of Mines and Mineral Development and JOGMEC.

“We have already provided training in satellite exploration techniques to 159 government officials of your country through JOGMEC, and will continue to promote exploration and technical cooperation in a wider area, he added.

He explained that through such efforts, the Japanese government would like to support the establishment of a supply chain for important minerals by the public and private sectors of both countries and the further strengthening of business relations between the two countries.

Speaking at the same event, Minister of Mines and Minerals Development Mr. Paul Kabuswe stated that to enhance the beneficial cooperation in mineral exploration and mining, government is proposing collaboration and investment with Japan in areas such as continued cooperation and support in geological mapping of the country so that the geological mapping coverage is increased from the current 56.36% which ultimately is expected to increase investment in the exploration and mining sector.

Mr. Kabuswe also proposed continued cooperation and support in geochemical and geophysical mapping of the country which supplements geological mapping/exploration and ultimately increase investment in the exploration and mining sector.

He further sought continued cooperation and support in building capacity at the geological survey department in the area of geosciences particularly in new and advanced technology of geological, geophysical, and geochemical mapping among others.

Mr. Kabuswe expressed gratitude to the Japanese government for the long-standing relationship as the two countries celebrate 60 years of bilateral relations this year.

And JOGMEC Chairman and Chief Executive Officer Mr. Ichiro Takahara said his organisation is committed to enhancing investment to Zambia especially in the mining sector.

More than eight people, motivated by succession wrangles, have been arrested for abducting Chief Chitambo’s close party in Chitambo District, Central Province.

The incident occurred on Saturday, April 2024.

In an interview with Freelance Journalist Bangwe Naviley Chisenga, Chief Chitambo of the Lala people of Chitambo thanked Zambia Police Service in general and particularly Christopher Chibuye, the Officer Commanding for Serenje and Chitambo Districts, for quick action to restore law and order in the Chiefdom.

The Traditional Leader said the rival camp pounced on Headmen that were presiding on Traditional Court cases, beating them ruthlessly.

He said the camp further went for his uncle, visually impaired, beating him mercilessly.

“They started by abducting my young brother, Daniel Kunda, on Sunday night. He was beaten mercilessly and held as a shield to lead them to our uncle Mr. Lupoka who is visually impaired. When they arrived at my uncle’s house, they lied to him that your nephew the Chief has brought you something. My uncle only survived because of his grandson who fought back to rescue his grandfather but in the process he was badly injured by the door of the bus used by the attackers. When they failed to abduct my uncle, they were still holding my young brother hostage and they told him to lead them to the palace. I received a report and told people around the palace to be on alert. The attackers surrounded the Palace but ran away when youths mobilized and they parked the vehicle at a distance. The attackers went away with my young brother and returned to search for me and my wife, following day. They found a Chief’s Retainer who was badly beaten, abducted and taken away, he said.

Chief Chitambo said the attackers went to the palace where they beat up Chief’s Retainers.

“Before they could beat and pick up the retainer they on Sunday night also beat pick up on my Young brother brother Daniel Kunda at my village in masemo,” he said.

The Lala Chief said the suspects are currently in Police custody and will appear in Court soon.

“Because I was not in the village when this incidence happened, I have been informed that about 12 of those dangerous criminals have been arrested. They are not necessarily fighting for Chieftainship, no. They have just taken advantage of the situation. The people involved have got a record of murder, previously. So they have just taken advantage of the situation. When I was chosen as Chief, some of my relatives involved in the fracas were part of those that chose me and among those arrested are some of my relatives that actually chose me. Now, because some have been criminals before they have just taken advantage of the situation,” he said.

Chief Chitambo said three other suspects are on the run with Police working hard to arrest them.

“What is more disastrous is that one of the most dangerous criminals by the name of Michael Fresh, one female called Munshya Kunda and Mwewa commonly known as Izo Izo are on the run. However, Police have intensified efforts and monitoring the situation insisting that the culprits be arrested. We are working with the Police to ensure that the three are arrested. I have just received information that on Monday, night, there was a bus parked within the premises of the Palace suspected to be the same people,” he said.

Acting Minister of Foreign Affairs and International Corporation Mulambo Haimbe says the government will continue to seek European Union (EU) support in various electoral reforms.

Mr Haimbe says the EU has had a long-standing relationship with Zambia regarding the electoral observer missions which date back to 2001.

Speaking when the EU delegation handed over a final report of the EU election follow up mission, Mr Haimbe, who is also Minister of Justice, charged that there is a need for electoral reforms and cooperation with the EU before the 2026 elections.

ZANIS reports that Mr Haimbe has also emphasised the need to put in place electoral reforms by mid- 2025 in order to address various electoral issues in Zambia.

He thanked the EU for its continued support in the electoral observer mission in Zambia and looks forward to continued cooperation on key priorities areas.

And European Union Ambassador to Zambia Karolina Stasiak disclosed that the report being presented started in January 2024 and was spearheaded by Maria Elena, a member of the European Parliament.

Ms Stasiak said the report is independently done by experts conforming to international standards and does not represent the views of the delegation of the European Union.

Ms Stasiak said she had the opportunity to meet with a number of stakeholders such as the electoral commission, political parties including President Hakainde Hichilema to take stock of the implementation of the recommendations that the EU observation mission formulated in 2021.

She indicated that the report will be handed over to different stakeholders in Zambia and others that Ms. Arena met to discuss the progress made in electoral reforms, and what needs to be done before the 2026 elections to enhance the electoral process in the long term.

She said the report notes the progress in the adoption of the Access to Information Act and removal of the criminal defamation of the President from the penal code.

Ms Stasiak has commended the efforts that the government has made in other fields to adopt long term strategic reforms.

ATTORNEY GENERAL CLARIFIES MOPANI COPPER MINES (MCM Plc) TRANSACTION

In case you missed it, the Attorney General Mulilo Kabesha, SC says Government followed the laid down procedure in the transaction involving the Partnership and Investment Agreement between ZCCM-IH and Delta Mining, a subsidiary of International Resources Holdings Limited (IRH), to capitalize and revive the troubled Mopani Copper Mines Plc. Article 210 of the Constitution which requires the approval of the National Assembly by a vote of at least two-thirds of the members of Parliament was not violated.

Below are highlights from the Statement;

✅ The transaction involving Mopani Copper Mines PLC is not covered under Article 210 of the Constitution. Therefore, there is no need to subject it to the approval of the National Assembly as prescribed under the said Article.

✅The correct position of the law is that Article 210 of the Constitution applies in cases involving the sale, transfer, or disposal of a “Major State Asset” which for purposes of the said Article includes a parastatal and equity held by Government.

✅Mopani Copper Mines PLC (“Mopani”) is neither a parastatal nor is it a Company in which Government has equity.

✅Mopani is a Company incorporated under the Companies Act which is a separate legal entity from Government and transactions involving its issued shares are governed by the Regulatory Framework covered by the said Act.

✅ Government did not have any shares or equity in Mopani prior to the transaction and it is only through this transaction that Mopani issued and Government subscribed to 1 Special share in Mopani which will allow for Government to have a seat on the Board and be involved in the decisions of Mopani going forward.

✅The transaction has restored the position that existed post the privatization process when Government held a special share which expired in 2015.

✅The transaction by Mopani, involving Delta Mining, a subsidiary of International Resources Holdings Limited (IRH), was in conformity with all the regulatory requirements including the corporate governance procedures which included the holding of Extraordinary Meetings to seek the approval of the shareholders for the transaction involving USD1.1 billion investment by International Resources Holdings RSC Limited (“IRH”) through its wholly owned subsidiary, Delta Mining Limited (“Delta”) for a 51% interest in Mopani Copper Mines PLC (“Mopani”).

FORMER president Edgar Lungu will spend more than K200,000 on transporting cadres for his eligibility case hearing at the Supreme Court in Lusaka this morning.

His henchmen spent the whole of last night rounding up people in various compounds in the capital city to be bused so they can put up a show of support and solidarity to the former president.

According to an instruction sent through in their exclusive WhatsApp group, each constituency should contribute 10 bus loads of cadres.

“Good afternoon constituency chairmen. Tomorrow there’s eligibility ruling for our party President Dr ECL at Supreme Court of zambia. You are all directed to hire 10 Rosa busses per constituency at K1000 kwacha go / come. The district secretary and the district treasure are going to register every bus upon arrival and should be at the court starting from 0730hrs. Ten busses per constituency,” read the directive also seen by Kalemba.

In this case Youth activist Michelo Chizombe l has filed a petition in the Constitutional Court questioning Lungu’s third bid to participate in elections.

He wants the Court to declare that Lungu’s participation in the previous election was unconstitutional.

Chizombe wants the Court to pronounce that Lungu is not eligible to contest a presidential election under the current constitution as read with the now repealed 1991 Constitution (as amended).

The youth activist has cited Lungu, the Electoral Commission of Zambia and the Attorney General as respondents in the matter.

Chizombe argues that Lungu’s nomination and participation in the 2021 presidential election was against the provisions of the law.

But in his answer to the petition Lungu said proceeding with case would be an attempt to give Chizombe an opportunity to re-litigate a matter that has already been decided upon and the same would be in breach of the Res Judicata rule.

Lungu said the Constitutional Court is functus officio ( Lacking authority) after having settled the dust over his eligibility to contest for presidency in future.

The case will be heard by the full bench this morning.

It started like a ridiculous joke since this matter has been dealt with comprehensively in the past, by the Constitutional Court.

This was until ZNBC began to give the case undue coverage and inserting regular interviews from Justice Minister, Mulambo Haimbe.

It became clear that a serious political project was in the air to probably bar former President, Edgar Lungu’s future presidential prospect using the very supposedly sacred institution that gave him the nod, twice, to contest the Presidency.

A Lusaka resident Michelo Chizombe has petitioned the Constitutional Court to revisit its earlier rulings and declarations that Zambia’s Sixth President was eligible to contest the 2021 elections.

Michelo contended that the Electoral Commission of Zambia (ECZ) contravened the Republican constitution when it accepted Edgar Lungu’s nomination papers and included him on the ballot.

He further sought a declaration that the respondent (Edgar Lungu) was not eligible to contest a presidential election under the current Constitution as read with the now repealed 1991 Constitution (as amended).

Attorney-General, Mulilo Kabesha, supported the Petition and also contended that article 106 of Act no. 2 of 2016 Constitution did not have retrospective effect.

Kabesha stated that Article 106(3) was a Constitutional prohibition and limitation clause , therefore, it also prevailed over the substance of article 106 (6), to the extent that its provisions conflict with article 106(3).

He therefore urged the Constitutional Court to set aside its earlier judgements which declared the ex-President eligible to contest future elections having reportedly served twice in office.

The Constitutional Court is a court of first and last stance instance on matters of the constitution hence calling it to revisit its previous decisions, has been viewed as a clear attempt to bring the court into mockery and its integrity may lie in tatters portraying it as a court that yields to State House and Executive pressure.

In December 2018, the full bench of the Court declared that President Lungu was eligible to contest the forthcoming 2021 presidential election.

The Constitutional Court also ruled that Lungu did not serve full term between 2015 and 2016, a move that made him eligible to contest the 2021 polls.

Again in 2021,the Constitutional Court dismissed yet another petition questioning Lungu’s eligibility by UPND Katuba Member of Parliament Bampi Kapalasa and UPND Member Joseph Busenga, on the grounds that the matter was already determined in the Dan Pule case earlier decided in 2018.

The matter comes up on Thursday, 17th April 2024 before the full bench of the Court.

Edgar Lungu’s lawyers have raised a preliminary issue arguing that the matter is “res judicata” meaning that a matter that has been adjudicated upon by a competent court may therefore not be pursued any further by the same parties.

Lungu and the $24 million payment

I commend the government for recovering – through an out of court settlement – $24 million from former Konkola Copper Mines (KCM) provisional liquidator Milingo Lungu. However, I do have several questions about this deal.

First, how much did Milingo Lungu take out of KCM altogether from which the $24m has been recovered? If there has never been a full audit to establish how much money he got from the company he was appointed to liquidate, can the government explain why. The sum of $24m may look like a lot of money, but if it has been taken out of $300m, for instance, it is peanuts. There are credible reports that Milingo Lungu was found with $60m in various banks within Zambia alone. How has this amount come down to $24m? Where is the $36m difference? Can the government explain, please.

Second, since the Hichilema administration simply replaced Milingo Lungu with its own provisional liquidator, Celine Meena Nair, how do we establish with certainty that Nair did not extract similarly huge sums of money from KCM the same way her predecessor was doing? Yes, KCM has since been handed back to Vedanta Resources Ltd, but Nair had hitherto served as KCM provisional liquidator for nearly two years, having been appointed to the role on 9 May 2022. Nothing structurally – in terms of the weaknesses that enabled Milingo Lungu to extract such large sums of money from KCM – had fundamentally changed during her tenure. How much was the substitute liquidator being paid? What were her terms of engagement? Can the government publish the contract she was given? Or are we to wait until after a change of government before we establish the possible plunder that may have occurred under the substitute liquidator?

Third, what is the fate of the senior government officials that Milingo Lungu had named in court – in a matter that has since been discontinued to pave the way for this out of court settlement – as those with whom he had cut a deal in exchange for immunity from criminal prosecution? In April 2022, Milingo Lungu told the Constitutional Court that he had evidence of how he cut a deal to stop his prosecution with key State actors namely Principal Private Secretary to the President Bradford Machila, Attorney General Mulilo Kabesha, Solicitor General Marshal Muchende, Director of Public Prosecutions Lillian Fulata Siyunyi, Special Assistant to the President for Legal Affairs Christopher Mundia and Administrator General and Official Receiver Natasha Kalimukwa.

Was this $24m deal cut to prevent Milingo Lungu from presenting this evidence – reported to be recordings of his meetings with the named State officials – before court to protect the implicated officers? And who presided over this latest deal? If it was the Attorney General’s chambers, was the government not short-changed – assuming Milingo Lungu had more money than the amount forfeited – given that Kabesha and Muchende had both been named as among the officers who had cut an earlier deal with him in exchange for immunity from prosecution? If this deal with Milingo Lungu was, as reported, done by Drug Enforcement Commission (DEC) Director General Nason Banda, can Banda swear that $24m is all the money they found on the former KCM provisional liquidator? And did the naming of State House and government officials who were involved in the earlier deal have a bearing on this settlement? In other words, how much pressure was exerted or put on Banda, if any, to agree to this deal considering the powerful positions of the people that were named by Milingo Lungu as the architects of his immunity deal and who may have had much to lose if the court case had gone to an open trial?

Fourth, what exactly are the terms of the government’s out of court settlement with Milingo Lungu? Can the alleged consent agreement be published in the name of transparency and public interest so that Zambians – in whose name the deal was supposedly cut – may find answers to some of the questions that arise from the deal? For example, what did the State pledge to Milingo Lungu in return for the latter agreeing to forfeit this money that had he had all along claimed was lawfully earned as part of the contract he had signed with KCM? Did Milingo Lungu agree to surrender this money without admitting criminality? If he has been allowed to walk away without a formal record of criminal conviction, what stops Milingo Lungu from being appointed as provisional liquidator of another state entity in future? If he has admitted criminality, what next? Will he go to prison? Or are we seeing the creation of a two-tier justice system in Zambia: one where VIP criminals get away with the plunder of public resources, provided they pay back a portion of the loot, and another where ordinary Zambians are sent to prison for misdemeanours such as stealing a chicken or a bag of mealie meal?

Fifth, did the government ask Milingo Lungu to declare all his assets? If he has not been asked to do so, why? If he has, where can the public find this evidence? It is said that Milingo Lungu is a wealthy man. The public deserves to know if this is true, and, if it is, how this wealth was acquired, whether it was legitimately earned, and if he became wealthy after or before he became KCM provisional liquidator. And while we are here, when will President Hichilema and his presidential aides publish their assets and declarations? There are credible reports of a very senior official in the presidency who recently secretly opened three bank accounts for their children and wife in the UK, and two other officials who did the same in South Africa. There is nothing wrong with opening offshore accounts, provided the money that is ending in these accounts is earned from legitimate income and the concerned public officials can explain how they earned it – when the time comes! For now, all that we need from President Hichilema, his aides, and other public officials, is for them to publicly declare their assets and liabilities. That is all. Can they please do this if they have nothing to hide? This kind of transparency is very important to the fight against corruption. Tasila Lungu, who served as a councillor under the Patriotic Front, has been made to account for differences between her actual income and declared assets when the father was in office, but this is only possible because she declared her assets, which were also published. How are we going to know if President Hichilema and his aides are looting public funds – directly or indirectly as enablers – when they have not publicly declared their assets and liabilities?

President Edgar Lungu and his brother fooled Zambians to believe KCM was making a loss and it needed to be liquidated yet they continued mining and export.

Issue:

Did the actions of the Provisional Liquidator, Milingo Lungu, appointed to oversee the liquidation of KONKOLA Copper Mines (KCM), constitute a violation of Zambian laws, and if so, what are the potential legal consequences?

Rule: According to Zambian law, the appointment of a Provisional Liquidator is governed by the Companies Act, Chapter 388 of the Laws of Zambia. The primary duty of a Provisional Liquidator is to manage the affairs of the company under liquidation in accordance with the provisions of the Companies Act.

Analysis: In this case, the actions of Milingo Lungu, the appointed Provisional Liquidator of KONKOLA Copper Mines, deviated from his prescribed duties. Instead of overseeing the liquidation process, Lungu engaged in mining and exporting copper, thereby exploiting the company’s assets for personal gain. This constitutes a serious breach of fiduciary duty and misuse of authority.
Furthermore, Lungu’s misrepresentation to the Zambian citizens about the financial status of KCM, leading to the false impression that liquidation was necessary, may also be considered fraudulent conduct under Zambian law. Such actions not only deceive the public but also undermine the integrity of the financial system.

Violation of Zambian laws:
* Breach of fiduciary duty as a Provisional Liquidator under the Companies Act.
* Misrepresentation and fraud in providing false information to the Zambian citizens regarding KCM’s financial status.
Potential Punishment:
* Criminal charges for fraud and misrepresentation under the Penal Code of Zambia, which may result in imprisonment upon conviction.
* Civil penalties, including restitution and fines, for breach of fiduciary duty under the Companies Act.
* Asset forfeiture and disgorgement of profits obtained through unlawful activities.

Judgment: Based on the evidence presented, it is likely that Milingo Lungu will face criminal prosecution and civil liability for his actions as the Provisional Liquidator of KONKOLA Copper Mines. The court may order imprisonment, financial penalties, and restitution to the state for the ill-gotten gains. Additionally, Lungu’s appointment as Provisional Liquidator may be revoked, and he may be disqualified from holding similar positions in the future.
