Guinea-Bissau: Attempted coup was foiled, says President Embaló

Guinea-Bissau’s president says heavy gunfire that broke out in the capital on Friday was an attempted coup.

He had been out of the country at the time, attending the UN’s COP28 climate conference in Dubai.

Speaking on Saturday, President Umaro Sissoco Embaló promised “serious consequences” for the perpetrators.

This is the second foiled coup against his leadership in under two years. The unrest began late on Thursday evening into Friday mid-morning.

A man described as the leader of a group of soldiers who tried to free a detained minister and a senior state official in Guinea-Bissau has been caught, the military says.

Members of the National Guard had taken the officials before seeking refuge in barracks south of the city.

Special forces then intervened after attempts to negotiate failed, resulting in an exchange of gunfire.

Calm is said to have been restored later.

Finance Minister Souleiman Seidi and António Monteiro, the secretary of state for the treasury, had been detained amid investigations into the alleged irregular withdrawal of $10m (£8m) of state funds.

They were questioned on Thursday afternoon by an anti-corruption inquiry to clarify the payments to 11 companies.

In a parliamentary session on Monday, the leader of the country’s main opposition party alleged that the owners of the companies were close to leaders of the country’s governing coalition.

Mr. Seidi defended the payments as legal.

On Thursday after the questioning, Mr. Seidi and Mr. Monteiro were arrested and detained so as not to jeopardise the investigations, local media said.

National Guard soldiers later in the evening invaded the police cells, located near Bandim market, “with AK-47 weapons and bazookas” and extricated the detained officials, the privately owned O Democrata news outlet reported.

It said the National Guard took them to an unknown location.

On Friday morning, regional stabilisation forces deployed by the regional West African bloc Ecowas were seen patrolling the streets, the AFP news agency reported.

Guinea-Bissau has suffered a series of coups and attempted coups since gaining independence from Portugal in 1974.

In February last year, President Embaló said he survived a coup attempt after being under heavy gunfire for five hours – in an incident in which 11 people died.

Without providing details, he said the attack was linked to drug trafficking in the country.

Some however doubted the official version of the events, amid questions including who was really behind the attempt, how many people were involved, and who was in command.

Talking to the BBC’s Newshour program, Alberto Dabo, a journalist in Bissau, directly linked the recent events to what happened last year.

“After the coup attempt, many high-ranking officials of the army who were held responsible for that are in jail without any judgment. And some high-ranking members of the army are demanding their liberation,” he said.

Patriotic Front Vice President Given Lubinda has described as totally diabolical the minimal attention being given to the mining disaster that has claimed multiple lives in Chingola.

Speaking this afternoon at the PF Secretariat, Mr Lubinda expressed worry with the manner the Chingola open pit mine disaster is being handled by the country’s leadership.

Mr Lubinda said last time something similar happened was during the reign of First Republican President Dr. Kenneth Kaunda and the then head of state left everything he was doing in order to mourn with the Zambians.

“The last time we had such an accident in Zambia, was in 1970 and 87 lives were lost in Muflira… Dr Kenneth Kaunda had to leave whatever he was doing, he went and camped on the Copperbelt for a week and went and visited the homes of every victim and yet today, this is the third day going, we haven’t heard about any political leadership that has been provided in Chingola” Mr Lubinda said.

The PF Vice President wonders why Vice President Mrs Nalumango is in Lusaka and not in Chingola to commensurate with the families of the victims of the disaster.

“Where is she? She’s acting President and here in Lusaka instead of going to communicate with the people in Chingola.” He said.

“President Hakainde is in Dubai, having meetings in Dubai instead of coming back to Zambia to come and face the challenges people are facing, the lives that are lost in Chingola, are Zambian lives and there is nothing more precious than one Zambian life.” Mr Lubinda added.

He further said that with the number of people that have been lost it is expected of the President to prioritize mourning with Zambians as the occurrence is a national disaster.

“President Hakainde Hichilema is in Dubai, having meetings in Dubai instead of coming back to Zambia to come and face the challenge that his people are facing.” He said.

And the PF Veep also assured that if the disaster had occurred during the PF’s days, it would have been declared a national disaster and a week of national mourning would have been put in place.

“Had that happened during the reign of the Patriotic Front, I can assure you that we’d have declared that a national disaster and we’d have declared a week of national mourning.” He said

Before we accuse UPND of sponsoring Miles Sampa to destabilize the Patriotic Front, let us look at this matter without political lenses.

Edgar Lungu loses elections, and he officially resigns from politics and from his position as President of the Patriotic Front. His letter to the cabinet confirms this. This decision is also confirmed by the Patriotic Front as a party after they advertised the position of Presidency of the party and those interested were asked to pay K200,000.

Miles Sampa just like others expressed interest to fill up the vacancy in the office of the Party Presidency. Edgar Lungu was very much aware of what was happening, he allowed this process to go on.

At this point mingalato started. The convention to elect the new President could not take place. It was excuse after excuse. Edgar Lungu started playing games with the candidates because he had plans to return back into politics. ECL started playing mingalato because he wanted to come back as President of the Party despite having resigned.

As part of mingalato, Lungu appointed Raphael Nakachinda as secretary general of the party. Despite this move being illegal. Throughout this process, Edgar Lungu and his mingalato did not care about democracy.

Fed up with Lungu’s Mingalato Miles Sampa called for an ‘extraordinary general conference’ where he was elected President. In short Miles, also started playing mingalato. Where is UPND or President Hakainde Hichilema in all this?

Edgar Lungu was caught pants down at his mingalato by Miles Sampa. In 2014 ECL played the same mingalato and got away with it but this time Sampa was miles ahead in thinking.

PF claims democracy is under threat under the New Dawn. What was democratic about getting K200,000 from candidates and later imposing Lungu as President? Was it democratic to deny members of PF a convention for two years?

This confusion has been brought because of Edgar Lungu’s greedy and selfish motives and no one else. It is Edgar Lungu who has been playing mingalato all the time and he should never play the victim. Bill 10 was mingalato, Hatembos case was mingalato, treason case was mingalato but HH was equal to task and God saved him.

If you kill by a sword, you will die by a sword.

Government says it is aware of the schemes by the opposition to incite the local citizenry to commit lawlessness.

Minister of Information and Media Cornelius Mweetwa says the government has seriously taken note of issues raised by former President Edgar Lungu in his public address yesterday.

During his public address yesterday, former President Lungu expressed concern on various governance issues he said was threatening democracy which must be protected.

Speaking in a press briefing held in Chipata today, Mr Mweetwa said the issues raised by Mr Lungu are a representation of “ people drinking from the cup of bitterness” after failing to accept the verdict of the people after the 2021 General Elections.

Mr Mweetwa, who is also Chief Government Spokesperson, said the issues raised by the former President after describing the New Dawn Government as dictatorship in nature are highly misplaced and uncalled for.

“We welcome the public address by the former President Edgar Lungu, we are taken aback that the former President has reduced himself from a Statesman to a position below and expectation of the people of Zambia, “he said.

The chief government spokesperson said the former President during his public address misinformed the people of Zambia and the globe.

The Government under the leadership of President Hakainde Hichilema is one that is anchored by the rule of law and not by men, he said.

The government spokesperson has urged the people of Zambia not to fall for the political treachery initiated by the former Head of State and his cohorts.

Mr Mweetwa said the people of Zambia were fed up and settled for something more than the political rhetoric offered by the previous administration.

” We respect him as former President and the he issues raised. But Mr Edgar Lungu is wrong messenger of this message, “he said.

Revealing that government is aware of the plans by the opposition in the country to call upon people to be up in arms and cause confusion, he said the New Dawn Government rules by the law and will not in any way allow lawlessness in the country.

“The Zambia today is better off than the Zambia two years ago. I want to indicate that what former President Lungu and his friends are doing are creating a side show away from the main trajectory of the country.

“ They cannot compete on policy but politics. We need to address issues that will benefit the people of Zambia, “he said.

Meanwhile, Mr Mweetwa said Government will not remove the former President’s immunity in order for him to face the law for his misconduct during tenure.

Former Health Minister Dr Chitalu Chilufya on Thursday characterised Cornelius Mweetwa, the Chief Government Spokesperson as Chemical Ali for his skills of incorrectly disseminating information with intention in playing the government’s public relations role.

Dr Chilufya the Patriotic Front (PF) Mansa legislator on Thursday lightened up debate in Parliament on the 2024 budget for the Ministry of Information and Media when he jokingly called Mr Mweetwa as “Chemical Ali.”

Ali Hassan Majid al-Tikriti, nicknamed Chemical Ali was an Iraqi politician and military commander who served as Defence Minister during the 1991 Iraq War. He was dubbed
“Chemical Ali by Iraqis for his notorious use of chemical weapons in attacks against the Kurds.

“Chairperson (Moses Moyo), Chemical Ali…or is it Minister of disinformation…Information (Mr Mweetwa) has just cited my young brother from Munali constituency (Mike Mposha) as having derailed his presentation by lying to him that I received a text from honourable (Raphael) Nakacinda (PF secretary general) neglecting my capacity to debate,” Dr Chilufya said.

Earlier, Mr Mweetwa had said: “It caught my attention from Dr Chilufya who spoke at length on what he said were the wrong things happening which he associated with what he called shrinking democratic space …and he was reading from what I have just been informed by Mr Mposha (Minister of Water) that he was reading a text written to him by Mr (Raphael) Nakacinda (PF secretary general).”
Mr Mweetwa said the debate of Dr Chilufya was welcome as such debates are needed in a democracy like Zambia’s.

“There must be dissenting views, but some dissenting views are unfounded. But again those are some of the benefits of democracy…to tolerate views that may not be factual. But you must co-exist with them. Dr Chilufya, thank you for epitomising democracy in this House. This is how it should be,” Mr Mweetwa said.
He said the state of the media in any country reflected the state of democracy in that nation.

“In the two years of the new dawn administration, no media house has been closed. No journalist has been threatened, harassed, or told to leave a government function. All media houses are treated equally. The public broadcasters and media houses cover every citizen including politicians equally,” Mr Mweetwa said.

He said it was quite unprecedented to cover the opposition when they would speak off cuff and no one is worried that if the opposition speaks something divergent to the taste of those in government, you would get retired in national interest.

“Such is a state of our democracy…it is self-evident therefore that Zambia’s democratic space is widening. Today, each time the opposition is having a press briefing, they will be covered by the public media,” Mr Mweetwa said.

✅When in opposition, there was no single day that the UPND advocated for bloodshed and civil disobedience as the opposition is doing.

✅New Dawn Government is anchored on the rule of law and not rule of men.

✅The only trips President Hichilema is undertaking are those which are necessary and beneficial to the nation.

The Center for Dialogue has defended the ongoing state compensations of UPND aligned plaintiffs, saying law enforcers are to blame for the unlawful arrests they effected on those being compensated.

So far, Transport and Logistics Minister Frank Tayali has been awarded K450, 000 by the Lusaka High Court on account of the trauma he suffered when a gun was pointed at him in 2020, UPND Lusaka Provincial Chairperson Obvious Mwaliteta And James Sichomba were awarded K900, 000 each as compensation for wrongful prosecution and UPND National Chairperson For Special Duties, William Banda has commenced civil proceedings against the state in the Lusaka High Court demanding K3 million for unlawful imprisonment.

In an interview with Phoenix News, Center for Dialogue Executive Director Caroline Katotobwe says the consent judgements and compensations that the country is currently witnessing are expected following the restoration of the rule of law.

Ms. Katotobwe states that anyone that has suffered at the hands of law enforcers in any democratic state should be compensated despite their political affiliation.

She has however urged law enforcers going forward, to be careful when handling citizens before making an arrest to avoid a repeat in future adding that law enforcers who executed their duties unjustly should be held accountable.

Meanwhile, Opposition People’s Alliance for Change Leader Andyford Banda says politically motivated arrests have the potential to set a detrimental precedent for the country.

Reacting to the court’s consent judgments between government and UPND litigants, as well as the acquittal of Zumani Zimba, former president Edgar Lungu’s political advisor, Mr. Banda says it is unfortunate that the ruling UNPD despite being voted on the premise of formulating reforms and upholding of rule of law, the current happenings are unjustified and disappointing.

Mr. Banda is advocating for the implementation of reforms within the current legal system and the police service.

And Political Scientist Professor Bizeck Phiri has urged judges in the courts to detach themselves from political actors, so that they make decisions solely based on the evidence presented before them without political hands.

WHY I HAVE A PROBLEM WITH CONCOURT: INCOHERENCE

Our Constitutional Court continues to amaze me. Since its establishment in 2016, I find most of the decisions it has made really perplexing.

I wonder whether the judges make decisions under undue political pressure or what. One need not be a constitutional lawyer to note glaring incoherence in most of the judges’ decisions.

I am looking at the case where Concourt has dismissed the petition by former Secretary to the Treasury Fredson Yamba, in which he asked the court to quash the indictment against him on account that it includes constitutional issues which the subordinate court lacks jurisdiction to determine.

Mr. Yamba contended that proceeding with trial could amount to injustice.

Specifically, M. Yamba had an issue with the inclusion of Article 183 in the particulars of the offence. He contended that the inclusion of breach of the Constitution in the charge sheet rendered the subordinate court incompetent to hear the matter because that court lacks jurisdiction to interpret or determine breaches, violations, or contraventions of the Constitution.

He contended further that the Constitution grants the Constitutional Court original and final jurisdiction to interpret the Constitution and determine whether the Constitution has been breached or not.

But, the Concourt declined to grant that the charge sheet and attendant prosecution was a violation of Article 1(5) and 128(1)(a) and (b) of the Constitution.

Passing judgment, the Concourt ruled that Mr. Yamba should have raised the issue of constitutional reference in the charge sheet at the subordinate court.

“We note that when the petitioner first had an issue with the charge, he raised a preliminary objection that was then duly considered by the subordinate court. The petitioner thus ought to have raised the issue regarding the constitutional reference in the charge sheet.

“In the absence of evidence that he raised the issue of constitutional reference before the subordinate court, to enable that court to consider whether there was a constitutional issue to be referred to this court, as required by Article 128(2) of the Constitution, the issue regarding the charge sheet cannot be competently considered in these proceedings,” the Concourt held.

To be clear, Article 1(5) of the Constitution provides as follows:

“A matter relating to this Constitution shall be heard by the Constitutional Court.”.

Furthermore, Article 128(2) of the Constitution provides as follows:

“Subject to Article 28(2), where a question relating to this Constitution arises in a court, the person presiding in that court shall refer the question to the Constitutional Court.”.

My understanding of Article 128(2), cited above, is that reference to Concourt, of a question by the person presiding in a court, is not an appeal. Rather, it is merely a procedural issue. Simply a reference.

In other words, the Concourt has the power to hear the Yamba case for the first time since Atticle 128(2) does not confer appellate jurisdiction onto Concourt. Appellate jurisdiction is the authority to review a decision from a lower court. Reference is not an appeal.

Put differently, a court exercising original jurisdiction is the first court to hear the case, whereas appellate jurisdiction refers to the power to review the decisions of other courts that have already issued rulings in a given case.

In my view, Article 128(2) of the Constitution does not confer jurisdiction on the Magistrate Court to issue a ruling as to whether Article 183, that is stated in the charge sheet for Mr. Yamba is a constitutional matter or not.

But, since the Concourt has the last say on constitutional matters (apart from Bill of Rights issues), Mr. Yamba will have no option but to go back to the Magistrate Court to ask the Magistrate to refer the matter to Concourt. If the Magistrate refuses, then Mr. Yamba may have to appeal to the Concourt and present the same arguments. If the Magistrate does not refuse but simply refer to the matter, the Concourt will hear the same arguments anyway.

What a waste of time and resources! Going round in circles!

When I reflect on the Yamba case, I wonder why we have Article 118(2)(b) and (e) in the Constitution.

Article 118(2) provides as follows:

“In excersizing judicial authority, the courts shall be guided by the following principles…

(b) justice shall not be delayed
(e) justice shall be administered without undue regard to procedural technicalities

Since its establishment in 2016, I have had a very big problem with the Concourt’s decisions on constitutional matters brought before it. The court appears to suffer from an inherent problem of incoherence. It was actually for this reason, that in 2016, I did file a complaint at the Judicial Complaints Commission (JCC) for the removal of the entire bench for incompetence and gross misconduct concerning the manner in which the bench handled the presidential petition. Almost a decade later, we still have the same circus in the Concourt!

Zambian Tycoon Accuses Bob Diamond’s Atlas Mara of Breach of Agreement

Dr. Rajan Mahtani, the 75-year-old founder of Finance Bank Zambia (FBZ), has testified in a London court, alleging that Bob Diamond’s Atlas Mara breached the terms of an acquisition agreement. Dr. Mahtani, along with co-claimants, is seeking up to $100 million (£80m) in damages from Atlas Mara, accusing them of acting with “sinister motives.”

The dispute revolves around the acquisition of FBZ by Atlas Mara, with Dr. Mahtani intending to secure the future of the bank. However, he claims that Atlas Mara failed to honor the terms of the agreement, leading to financial losses and reputational damage.

During the court proceedings, Dr. Mahtani detailed events leading up to the 2016 deadline for repurchasing one of FBZ’s subsidiaries from Atlas Mara. Under the agreement, Atlas Mara would sell Finance Building Society (FBS) to a third party if a buyer was found by December 31, 2016. Dr. Mahtani, intending to buy and run it as a standalone business, claims that Atlas Mara breached this agreement.

Atlas Mara’s legal representative, Anna Boase KC, suggested that Dr. Mahtani orchestrated a series of communications to pressure Atlas Mara into selling FBS back to him. She referenced emails and letters sent on December 21, 2016, containing confirmation of his intention to repurchase FBS. Boase accused Dr. Mahtani of disregarding the sale and purchase agreement (SPA) and attempting to manipulate the situation.

In response, Dr. Mahtani denied the allegations, stating that he believed he was dealing with “honorable, bona fide parties” and accused Atlas Mara of breaching the agreement with “sinister motives.” He highlighted a lack of cooperation and adherence to the SPA, leading to difficulties in completing the transaction.

Beatrice Hamza Bassey, General Counsel of Atlas Mara, testified that the firm did not take Dr. Mahtani’s intentions seriously and had no reason to ask for the SPA, as they did not consider the deal a priority. She claimed that it was impossible to conclude the deal by the deadline and accused Dr. Mahtani of an “ambush” with a barrage of documents.

Dr. Bwalya Ng’andu, former Deputy Governor of the Bank of Zambia, provided testimony related to the court case. He confirmed that the Bank of Zambia did not take a position on whether the repurchase of FBS by Dr. Mahtani should proceed. He clarified that the commercial terms agreed upon by the parties, as outlined in the SPA, would apply.

Denying claims of expressing views that could discredit Dr. Mahtani, Dr. Ng’andu emphasized the professional relationship maintained by the Bank of Zambia. He stated that the bank would not give signals to others about issues unrelated to them.

The court hearing is set to continue, with further testimonies and evidence presented.

The sixth President of Zambia H.E Edgar Lungu has called on all opposition parties to unite and work together to stop Zambia from declining from a democratic to a dictatorship Africa state almost sixty years after independence from colonialism.
The former President, fresh out of retirement, beat the opposition clarion unity call in Lusaka weeks after giving up luxurious privileges accorded to retired Zambian heads of states that include cars, houses and security including a hefty salary to ´save democracy´ he stated in a live speech broadcast nationwide.


“I am exceedingly humbled by the unanimous positive response from my brothers and sisters in opposition,” President Lungu said, “opposition must join hands to defend Zambia´s democracy before it dies…working together we can conquer and overcome those (in ruling party UPND) trying to kill our democracy.”


In an open call for unity, the sixth President extended an invitation to ´work with all´ the major opposition parties and leaders (named in the speech individually) to save Zambia from open dictatorial tendencies he said are being practiced by President Hichilema and his UPND.
Reflectively, the PF President praised all the influential church mother bodies, the law association of Zambia and other civil society groups for voicing out against ´arbitrary arrests´ and prolonged detentions that have become normal in Zambia since President Hichilema assumed office in August 2021.
“I come back to politics not just to save PF but to save the democracy our forefathers hard fought for almost sixty years ago and I am ready to go all the way even in the face of my immunity being lifted while working with fellow brothers and sisters from the opposition,” President Lungu said.


Calling for resilience among lovers of democracy in Zambia, President Lungu cautioned that no matter how some people chose to ´look the other way´, “No one will be spared” for prosecution and persecution under President Hichilema, as he targets perceived enemies.
Of greater concern, the lawyer turned President bemoaned the fact that the autonomy line between the three arms of government, Legislature, Executive and Judiciary remains blurred now.


“The blatant breach of the constitution in parliament is sad while the judiciary is openly on trial here today,” said the former President in reference to Speaker Nellie Mutti´s recent wanton disregard of the constitution in recognising a rebel legislator called Miles Sampa as the new President of PF even in the face of a court order.


President Lungu urged the judiciary to deliver justice in a transparent manner because, “justice must be seen to be done” as they currently appear to be compromised and on trial.

PATRIOTIC Front (PF) president Miles Sampa has assured that violence and threats will not be party of his leadership style as he leads the country’s biggest opposition political party.

He said unlike his opponents who thrived on intimidation, violence and threats, his leadership was all-inclusive and peaceful.

Sampa said alebwelelapo project coordinator Raphael Nakacinda and team still have to undergo five stages of misery before they acknowledge his leadership.

Sampa submitted before the High Court that since he replaced Edgar Lungu as the leader of the PF, no member of the party has been ejected or threatened with suspension as alleged by Mporokoso member of parliament Brian Mundubile

In this matter Nakacinda, Mutotwe Kafwaya, Greyford Monde and Mundubile are challenging Samp’s installation as president during at a convention held on October 24, 2023.

Mundubile had asked the Court to grant him an injunction stopping Sampa’s Secretary General Morgan Ng’ona from hounding him out of the party.

However Sampa filed an affidavit in opposition to Mundubile’s application for an order of interim injunction.

He said the re-launching of an application that has already been dealt with by the Court is a abuse of Court process on reasons that there is an injunction already filed by Nakacinda and Mundubile’s application is a repetition of what Nakacinda is praying for.

“Contrary to the allegations that Mundubile is facing an impending expulsion the same could not be further from the truth,” Sampa said.

He clarified that neither himself nor his secretary general Ng’ona have suspended or expelled any party member neither has anyone been threatened with suspension or expulsion.

“Mundubile is being melodramatic and mischievous when he claims that if the injunction is not granted he is likely to be expelled because his defiance of me renders him susceptible to expulsion,” Sampa said.

“As president of PF I am not running the party the same way the plaintiffs and their cohorts were running it by using threats, violence suspensions and expulsions.”

He said he runs the party democratically and intends to work with every disciplined member of the party who has interests of the party at heart.

Sampa said no member has been under threat for opposing him.

“The plaintiffs are afraid of their own shadows and their fears have no basis in reality as no one has threatened to suspend or expel them,”Sampa said.

“I am awaiting for plaintiffs to exhaust five stages of grief and come to accept that I am president of the party.”

He indicated that reality will soon strike and his opposers will accept him as they are still in denial about the state of affairs.

Sampa charged that there is nothing to injunct as the matters sought to be stopped have been overtaken by events and can only be determined either before judge Timothy Katanekwa or Situmbeko Chocho if Nakacinda and his team still wish to pursue the matter.

“The stage to be granted an injunction has passed and what should follow is the determination of the case,” he said.

The matero member of parliament said Nixon Chilangwa is also claiming to be secretary general of the PF as he was appointed before Nakacinda.

He said case is inappropriately before court as there cannot be two claimants of the same position from the same faction.

Sampa said the court should establish who the real Secretary General is because Nakacinda is acting on the illegal appointment of Lubinda who was also illegally installed as acting vice president by Lungu.

He stated that only judge Katanekwa will ascertain whether Lungu’s appointments were valid and Nakacinda and Lubinda’s fate are tied to the decision yet to be made by judge Katanekwa.

Sampa requested that the matter be dismissed or stayed pending determination of the matter before judge Katanekwa.

We have no time celebrating or rejoicing over the sentencing of any human being to prison where they will have to swap their designer clothes for the orange garb and get to work undertaking backbreaking chores such as growing cabbages and tomatoes and of course, getting themselves soiled tending to pigs!

We are a God-fearing people – peace loving, in fact.

However, we have little or no sympathy for one Chishimba Kambwili for the unfortunate situation he finds himself in.

In case you are not yet in the loop, the Kasama Magistrates court has handed Kambwili a 5-months jail sentence for the offence of expressing hatred and ridicule of the people of Southern province based on tribe and place of origin.

Videos of Kambwili energetically uttering disparaging tribal remarks and spewing venom on a certain ethinic group as one of the former senior leaders of PF who is also an MP smiles, eagerly are available on social media.

Kambwili is not a stranger to stirring controversy on issues of tribe; he is a danger to this nation.

As a matter of fact, prior to the 2021 general elections, the Electoral Commission of Zambia had censured and briefly banned him from the campaign trail for committing similar offences as the leadership of PF at the time remained tight lipped on the matter.

And way back in 2009, Local Government and Housing Minister at the time, Hon. Benny Tetamashimba, had requested Patriotic Front (PF) president Michael Sata to discipline his Roan Member of Parliament Chishimba Kambwili for insulting the humble people of North-Western province during a public rally in Kitwe.

During the rally, Kambwili blamed the people of Luanshya for having voted for Labour and Social Security Deputy Minister Simon Kachimba as Member of Parliament for the area, saying he knew a lot of well meaning and successful Luvales, but not Mr Kachimba.

Why should Kambwili always bring in the issue of tribe whenever he’s conducting his politics?

Pitying one ethnic grouping against another isn’t healthy in a nation which is already polarised. We praise God for President Hakainde Hichilema who is already trying hard to reunite our nation by taking development to every corner of the nation and assembling a government that represents a national character.

Unfortunately, it seems our colleagues in PF and certain opposition political parties are are not comfortable with certain tribes!

Whenever a golden opportunity presents itself, you’ll see them go to town demeaning and scandalizing those tribes.

We’ve seen this from former cabinet ministers, senior members of the party and some of their MPs. We ought to remind these individuals that the genocide in Rwanda was a culmination of decades of division and incitement of hatred towards the Tutsi by extremists in the country’s leadership, which was controlled by members of the Hutu majority group.

It’s important to reiterate that there are still a few individuals still on the loose out there, including Patriotic Front MPs and so called opposition leaders. They remain unrepentant in as far promoting hate speech is concerned. Like rabid dogs, they have little trouble poking and provoking other ethnic groups by continuously stereotyping or labelling them.

We’d like to sound a clarion call to the police not to hesitate to bring to book such enemies of the people and subject them court processes where appropriate punishment will be prescribed to them as an example to other would be culprits.

He said this head 78 is the eyes and ears of the President and when they see non performance amongst the Ministers they are entitled to report. When they see the benches in parliament are empty all the times they are supposed to report and when they notice the below average performance of Ministers their standard of living, conduct and behavior they are supposed to report.

He further highlighted the importance of the office of the President but bemoaned the current state of the department.

Former Radio Phoenix presenter Lennon Shinde best known as DJ Len has shared an emotional piece on how certain people will love you for your fame.

HE SAYS WHEN HE LEFT THE MEDIA MOST OF THE PEOPLE HE THOUGHT WERE HIS FRIENDS STOPPED CALLING HIM.

In 2006 I joined one of Zambia’s biggest commercial radio stations, PhoenixFm which catapulted me into mainstream media as i worked there as an On Air presenter and producer. I hosted prime time shows from PM drive time shows to morning breakfast shows till the time I decided to hang up the boots as change is inevitable. My experience working in the media exposed me and taught me a lot. It also shaped my life significantly. I travelled, I attended almost every happening event, I interviewed and mingled with people from all walks of life from all around the world. From celebrities, politicians, technocrats, athletes to everyday people to mentioned but a few. I showcased my craft at top shows like BigBrotherAfrica, MTVAfricamusicawards, I did live broadcast shows from the shores of the Indian Ocean etc and that’s besides my acting career where I am still very active to date and now producing my first TV series.

While I was at Radio Phoenix, I hosted flagship shows like Letthepeopletalk where I was lucky to be tutored by the likes of the great late ErrolHickey mhsriep, FrankMutubila, SamSakala and sir KennethMaduma. On this program I interacted and interviewed people from all walks of life. I interviewed people like the late MichaelChilufyaSata Zambia’s 5th republican president mhsriep, the late RupiahBanda Zambia’s 4th republican president mhsriep, Dr NeversMumba, former vice president of Zambia, EdgarChagwaLungu former Zambian president and the current republican president HE HakaindeHichilema.

I helped to catapult so many young politicians into mainstream politics. Same thing with entertainers, musicians or celebrities or whatever you want to call them. When I was hosting shows like the Local Rhythms countdown and many other shows, these people would be waiting in ques outside the studio just to have a word or to see me in the hopes of being promoted or have there music played. As you would imagine, I had friends from all walks of life, well atleast I thought I did. And all this while I gave myself selflessly. Some of the people I have worked with would attest to that.

In 2020, God blessed me in ways I never thought possible and had to quit media for a while to focus on other these blessings. I also just needed a break especially after spending so many years in the media. And like they say, it’s better to leave the stage while people are clapping. I resigned when I was still hosting prime time shows.

Like with families when a father dies, it’s like his family dies as well. That’s what happened when i decided to leave the spotlight or media in 2020.

The friends I thought I had disappeared. People I helped stopped calling and stopped picking my calls because they thought they could not feed off me. But many times when i called I was actually calling to offer them more opportunities as I continued to work in the background in media. I for one has been a person that respects myself and will not go begging from anyone. I always would rather be the one to give than to receive.

This has actually turned out to be the best thing that has happened because now I can see clearly. I now know better. I now have little to no friends and I am grateful and loving it. It’s stress free and I have no Leeches trying to feed off me at every opportunity they get.

Fast forward, will I get back into mainstream media? Yes, my own Radio or TV station? Maybe! media house? I am already producing my first TV series under Lengreenmedia, there are endless possibilities.

Lessons from my journey, I know people better now.

US House of Representatives to vote this week on Santos’ expulsion

The US House of Representatives is going to vote again to kick Congressman George Santos out of the group this week.

Two times before, people tried to remove the New Yorker from his seat, but now a report on his behavior in office has made it very likely that he will be removed from his position.

Republicans want the 35-year-old to quit. They don’t want to have another vote.

Mr Santos admits that the next vote will probably pass, but he is still resistant.

This is the third time we are experiencing this. “I don’t think it’s important,” he told reporters at the Capitol on Tuesday.

“The politicians in Washington DC can send me home if they think this process was fair and constitutional. I wish them well. ”

The Speaker of the House, Mike Johnson, said he thinks the voting will happen on Friday.

Mr Johnson said on Wednesday that he has concerns about removing Mr Santos because it could create a rule that could affect other lawmakers later on.

“We will let people vote based on what they feel is right,” said Mr Johnson at a news conference on Wednesday. “I believe that people will make the decision carefully and honestly. ”

It’s not common for Congress to kick out members, and if the latest vote passes, Mr Santos will only be the sixth lawmaker in House history to be removed.

Earlier this month, a group in charge of making sure politicians behave well said he took money from his campaign and used his role as a candidate to make money for himself.

The panel’s final report accused the Republican of using campaign money for Botox treatments, buying things on OnlyFans, and taking vacations in the Hamptons.

Mr Santos criticized the report as a “political attack,” but he also said he won’t try to be the president again because of the investigation.

The Long Islander is in trouble with the law and is accused of doing many bad things, like stealing money and breaking campaign finance rules.

He stayed in office after two votes to kick him out. Some people said he didn’t do anything wrong and should have a fair trial.

Some people who did not support those actions said they wanted to wait for the House’s investigation on ethics to finish first. Some of the members who previously supported Mr. Santos now want him to be removed.

When the House started working again on Tuesday, two Democrats and the Republican leader of the ethics committee each submitted a motion to remove someone from their position.

Both resolutions, which are important, need to be discussed and voted on in the House within the next two days, or before Thursday.

The Republican leaders said they will allow time for discussion on Thursday and then hold a vote on Friday.

The Democratic measure is like a backup plan. It’s meant to make sure there’s a vote if the Republicans don’t bring up their own resolution this week, according to co-author Robert Garcia.

MrSantos has been criticizing his colleagues online since the ethics report was released, and he is expected to complain more during a press conference on Thursday morning.

His party is finding it hard to decide if they should vote to remove him.

First, it would decrease the Republicans’ small House majority by even more.

If Mr Santos is kicked out, the Governor of New York has 10 days to set up a vote. The vote would happen 70 to 80 days after that.

In her new role, Chabeli will spearhead the strategic vision and operational excellence across the entire SABC Group. “This appointment reflects SABC’s commitment to maintaining excellence in broadcasting and meeting the evolving needs of its diverse audience,” the broadcaster said.

IOL News has reported that the SABC is struggling and hence Chabeli has a difficult task to get it profitable once more. The national broadcaster was looking at getting some $80 million in additional funding from the government earlier this month but its request was denied.

Malawi court favors Multichoice in DSTV tariff adjustment

The Malawi Communications Regulatory Authority (MACRA) has lost a case against Multichoice Malawi in the implementation of price adjustment and the management of DStv Services subscription fees.

This was a judicial review case in which MultiChoice Malawi wanted the court to interpret the law on whether or not MultiChoice Africa Holdings should be seeking approval from Macra before adjusting DStv tariffs.

The move followed Macra’s decision to stop MultiChoice Africa Holdings (MAH) from adjusting tariffs without its approval.

But High Court Judge, William Yakuwawa Msiska on Friday, December 1, 2023 ruled that MACRA was not supposed to regulate DStv rates as they are not set by MultiChoice Malawi.

This means that the company can now implement earlier DStv tariffs.

Multichoice Malawi (MCM) is a content broadcasting service provider with a content licence renewed on 24th July 2020 for a period of 7 years to provide Subscriber Management Services (SMS).

Under the SMS licence, DSTV offers five bouquets/packages from high to low end: (premium; compact plus; compact; family; and access)

The Licence, together with the Communications Act, sets the terms and conditions to be implemented by all service providers including MCM.

Previous years up to June 2022, MCM has been submitting to the Authority all its tariff requests to seek approval.

On 3rd June 2022 – Multichoice Malawi (MCM) submits a tariff request to MACRA for DStv and GOtv services.

On 21st June 2022 – MCM makes a public announcement to adjust tariffs effective 1st August 2022 before the MACRA Board convenes for an approval of the same

On 24th June 2022 – MACRA Technical Committee met to consider tariff requests, however, MCM’s request was not deliberated due to the public announcement on the price adjustment made on 21st June 2022.

On 28th June 2022 – MACRA notified MCM of a preliminary finding of breach of section 74(1) of the Communications Act and Clause 11.2 of MCM’s SMS licence for implementing DStv tariff adjustment without prior approval from MACRA.

On or around 12th July 2022 – MCM applied to the High Court for permission to commence judicial review proceedings, challenging MACRA’s preliminary finding that MCM had breached the Communications Act and its licence and further challenging MACRA’s decision to invite MCM to a disciplinary hearing. MCM also applied for an injunction against the hearing.

On 13th July 2022 – MACRA suspended MCM’s disciplinary hearing pending the decision of the High Court on MCM’s application to commence judicial review proceedings.

On 25th July 2022 – the High Court refused to permit MCM to commence judicial review proceedings against MACRA because the application was premature. MCM should have first attended the disciplinary hearing before approaching the High Court. The application for injunction was also dismissed.

On 1st August 2022 – MCM proceeded to implement the tariff adjustments without approval from MACRA Board.

On 28th November 2022 – MCM was heard before the Legal and Administration Committee (LAC) of the Board of MACRA, which recommended to the Board to find MCM in of breach of the Communications Act and the licence for implementing tariff changes without prior approval.

On 22nd December 2022 – MACRA Board upheld the recommendation by the Legal and Administration Committee and made a final finding of breach. The Board imposed the following sanctions:

a. that MCM should pay K10 million fine;

b. cease and desist from implementing the revised and unapproved tariff structure; and

c. refund the customers the difference between the unapproved tariffs and the approved tariffs.

On 13th January 2023 – MCM was granted leave to commence judicial review proceedings against MACRA and obtained an injunction restraining MACRA from implementing the decision in 10 above, to find MCM in breach and from implementing the consequential sanctions imposed on MCM.

On 17th January 2023 – MACRA DG meets with MCM General Manager at BICC in Lilongwe to map a way forward.

From 23rd to 27th January 2023 – MACRA and MCM engaged at technical level at Nkopola Lodge in Mangochi for an amicable settlement of the court case. But negotiations failed due to the insistence of MCM that DStv tariffs should not be subject to prior approval by MACRA.

On 14th June 2023 – MACRA Board met with MCM/Multichoice Africa Holdings (MAH) led by their Group CEO in Salima to discuss on possible settlement out of court of the matter.

On 11th July 2023 – MACRA Board approved the recommendations from the Salima meeting to allow MCM to ‘notify’ the tariffs to the Authority but with MACRA reserving the right to intervene whenever it deemed the proposed tariff implementation unfair or unjust. MACRA wrote MCM of the proposal. MCM has not responded.

On 17th July 2023 – MCM notified MACRA of the proposed tariff increase for DSTV services effective 1st August 2023.

On 28th July 2023 – MACRA obtained an injunction from High Court restraining MCM from implementing second DSTV tariffs without prior approval from MACRA.

On 31 July 2023 – MCM obtained a temporary relief/order to stay implementing the injunction that MACRA obtained. The temporary stay was granted to allow MCA to rectify its system, which was already set to bill using the new tariffs. The order was for four days until 3rd August 2023.

On 1st August 2023 – MCM proceeded to implement the second tariff adjustment without approval from MACRA Board.

On 4th August 2023 – MCM applied to the High Court ex parte (without giving notice of the application to MACRA) for directions on how it should conduct itself and to avoid being in contempt of court in view of the fact that Multichoice Africa Holdings Ltd (MAH) had stated it could not reverse the DSTV tariff adjustment for Malawi. The High Court directed that the application be heard inter parte (both parties to be present at the hearing) on 7th August 2023. Consequently, the court extended the stay order to 7th August 2023, the date of the inter parte hearing.

On 8th August 2023 – the High Court A hearing of both parties on the injunction was held and the High Court upheld the injunction obtained by MACRA and vacated the stay order obtained by MCM.

On 8th August 2023 – MCM announced the withdrawal of DStv services in Malawi.

LUNGU VOWS TO FIGHT HIS WAY BACK TO POWER

FORMER president Edgar Lungu has vowed to fight using all means necessary to return to power as a way of enhancing democracy.

Speaking in a recorded Facebook video published this afternoon, Lungu said he was willing to fight by political, cival and legally means, even risking his life in order to uphold democracy.

He said he was humbled by the response of opposition leaders at his decision to return to active politics

“I am confident that working together we shall conquer and overcome, in defense of the constitution and democracy”

“Victory is certain we shall definitely defeat those who are scheming against our democracy because power rests with the people and the people fight, the people will win and defend their democracy.”

The former president said he wasn’t doing this for himself but for democracy and to prevent the PF from being destroyed or stolen.

“And our democracy is a multiparty democracy. A democracy where the opposition and civil society can freely express themselves,” he said.

“A democracy where anyone among the opposition leaders can become president. And certainly we will become president in 2026.”

He encouraged his supporters across the country to remain calm as PF sails through troubled waters.

“Victory is certain, we shall fight this battle with all the available means, legal, political and civil. Beyond that I don’t know.”

“Because if you can’t fight using legal means, you can’t fight using political means… or civil options because they can’t allow it then God help us,” added Lungu

Lungu’s reemphasized that following his return to active politics, he was ready for anything coming his way, including “risking my own life in the hands of these desperate people who are aware that they have completely lost public support, and confidence due to their many unfulfilled promises.”

He said he was aware that the next move by the UPND against him was to lift his immunity from prosecution

“This too shall not worry me because I know that it is one of their ploy to divert the public attention from their failures,” Lungu said.

“If it’s me that they are looking for they shouldn’t bother my children, my wife or nay of my associates, they should come for me straight. two years down the line they have not come but I know they are still working on it (removal of immunity). But when it comes, I am ready.”

Further, Lungu accused UPND of trying to destroy democracy by treating the opposition unfairly through different means such arrests of opposition leaders.

“So what you are saying in terms of Mingalato will not end with the PF at all. No one is spared and no one out there should be cheated that they will be spared,” added Lungu

“They (UPND) act almost all the time, contrary to what they tell the nation Sean Tembo, leader of the Patriots for Economic Change has been unlawfully detained several times…. Harry Kalaba was arrested for merely eating nshima at a market and Today someone will say that PF was worse (and) was hell.”

Meanwhile PF national youth chaiperson Christopher Kang’ombe, who gave a vote of thanks after the briefing, pledged to defend the PF and stand by their leader, Lungu while calling for justice.

“If the courts of law do not give us justice, we will give ourselves the justice we want,” Kan’gombe said while alleging that government had selected leaders on behalf of their party.

PF paved Kambwili’s road to prison

All was well between Chishimba Kambwili and PF until Edgar Lungu dismissed him from Cabinet in November 2016.

In Kambwili’s world, that amounted to a declaration of war. He went on a belligerent path trying to fight PF but to no avail.

Aware that his chances in PF were next to zero, Kambwili and his erstwhile sidekick Mwenya Musenge, who was also sent packing from the party, then ventured out under the National Democratic Congress (NDC). Kambwili wasn’t ready to take the plunge. So, he posed as ‘NDC consultant’ while holding the Roan seat under PF.

But he was on very shaky ground and PF were determined to cripple him.

Following a point of order raised by then Malambo MP Makebi Zulu on whether Kambwili could remain PF MP while professing to be NDC, Speaker Patrick Matibini returned on 27 February 2019 with a ruling that read like a court judgment. He was, after all, a former High Court judge.

The Constitutional Court would later overrule his decision to declare Roan vacant, but it was too late.

Meanwhile, Kambwili and Musenge’s marriage of convenience wasn’t going according to plan. Like two quarrelsome hunters fighting over premium parts of the carcass, the two fought over who owned the party. They expelled each other at a dizzying pace that even the most dedicated of political observers could not keep up.

Kambwili lost control of NDC and PF celebrated. But he still had the cover of the opposition UPND who were increasingly becoming his allies. As his legal woes multiplied, UPND leaders and members sheltered him and offered him tonnes of solidarity as he appeared for his myriad court cases.

From the steps of the Lusaka Magistrate’s Court Complex and with microphones and cameras before him, Imbwili launched scud missiles that hit and shook the PF tent with unsurpassed ferocity.

That he had humiliated PF by keeping the Roan seat under his belt in the resultant by-election only added to their dismay.

But PF were resolved to corner him. They went to work and gave him an offer he could not resist: Come back here and get your freedom or remain there and go to jail. The choice was clear.

By now, he was a convict sentenced to 12 months for forgery and was only out on bail pending appeal.

UPND Alliance Chairman Charles Milupi has a long story to tell about how Kambwili started avoiding the Alliance meetings. Unknown to them, PF were turning the screw on him and the squeeze was getting tighter by the day.

Remember Kambwili had once told the nation that if he went back to PF, then we could call him mad, a lunatic.

By the time the 2021 election came, Kambwili was where PF wanted him to be – in their camp. They had a special assignment for him. They allocated him a helicopter and sent him up North.

It was there where he said the unseemly and the despicable. Jumping from one radio station to another, he spread his hate speech against Tongas unrestrained.

No one in the party paused for a moment to question the path he had taken.

One of Lungu’s last acts before he left office was to pardon several people, among them Kambwili who had an appeal lodged in the High Court. He got his reward for the hate speech he spread against Tongas.

It’s quite a conundrum. He was pardoned for doing the PF’s dirt work in the campaign. But it’s that same dirt work that has now landed him in prison.

We hear he is appealing, but that is a double-edged pursuit. The High Court may in fact find that the five months he got was a tap on the wrist.

PF aided Kambwili’s activities and must take the blame as much as he should. It’s not enough for Raphael Nakacinda to say Kambwili’s conviction is “regrettable”.

What is regrettable, in fact, is not his conviction, but that they allowed him to go on that senseless path of hate.

His conviction is a lesson to our politicians to focus on development, not tribe and other divisive issues.

Sishuwa asks govt to publish agreement with Vedanta, calls it greatest betrayal of Zambians

Historian Sishuwa Sishuwa has challenged the Zambian government to publish contents of the agreement with Vedanta Resources regarding KCM.

Writing on X, Sishuwa says if Zambians were to see the contents of the just signed Shareholder Agreement with Vedanta for the takeover of KCM, many will be so livid that they will likely demand for the immediate resignation of President Hakainde Hichilema for working against the interests of the Republic.

“I have seen, read, and understood the Agreement, and I challenge the Government to publish it in full in the name of transparency and accountability if they have nothing to hide,” he stressed.

“I am aware that Hichilema discarded the terms and conditions prepared by patriotic and very capable technocrats in the civil service and exerted pressure on the Zambia Consolidated Copper Mines-Investment Holdings (ZCCM-IH) to wholly accept the ones produced by Vedanta Resources. The concessions given to Vedanta – let us just say the concessions Vedanta has effectively given itself and which Hichilema agreed to without even subjecting the Shareholder Agreement to discussion in Cabinet – are so dreadful and anti-Zambia that any citizen who signs that terrible agreement must ordinarily be charged with SABOTAGE or TREASON.

Dr Sishuwa said the contents of the Agreement with Vedanta constitute the ultimate betrayal of public trust and the interests of the State.

“Argh! We are going nowhere serious with Hichilema at the helm of Zambia, unless he changes course, for the better. He has become a clear and present danger to Zambia’s economy, to our democracy, our constitutional order, our nationhood and its future, to the lives of ordinary Zambians, and must be peacefully removed from office at the earliest available opportunity.”

Dr Sishuwa said what consoles him is the knowledge that as of today, many people in Zambia may not know who they will vote for in the next election, but they already know who they will not vote for.

“The best thing about electing Hichilema president was that we are no longer distracted by his threat or potential to be better than those who came before him and we can now start looking for suitable, if better, alternatives. If Hichilema did not become President of Zambia, we would have lived with some degree of guilty for not giving him the chance to govern. We could have also succumbed to certain narratives that suggest that some regions of Zambia can provide better leaders than others. To some extent, it is not regrettable that the man got the opportunity to lead.”

He added, “Now we know that in order to develop, Zambia does not need a given region or an individual from a particular ethnic group in State House. The country simply needs competent men and women who are patriots, have a feasible plan, and are committed to restoring the nation’s dignity, where they come from notwithstanding.”

He said, “In a certain weird and perverted sense, it is good that Zambians gave Hichilema a chance to reveal who he truly is.”

Dr Sishuwa said the Chewa-speaking people of Zambia have a saying that “The best way of proving the potency of a man who claims that he is able to achieve an erection is for the woman to undress for him.”

He said in August 2021, Zambians undressed for Hichilema after a decade-and-half of claiming that he is capable of taking them to greater heights.

DIRECTOR of Public Prosecutions (DPP) Gilbert Phiri has noted the need to incorporate youths in the fight against corruption in the country.

And Phiri says his two jobs in the public service, first as Anti-Corruption Commission director general and later as DPP do not feel like jobs, but “a passion; it’s not about a salary, it’s a calling”.

Speaking when he received an Award for Most Influential Local Anti-Corruption Actor from Transparency International recently, Phiri said there is need to be fearless to win the corruption fight.

“I thank God for the opportunity to serve. We have to be fearless if we are to win this war. We must carry the young people along with us and have a very long term goal to transform our society. I see hope. I know that we can do it,” said Phiri. “And you know for a long time I was in the private sector. When I came into public service, I discovered something that has already been…in me. My two jobs, Anti-Corruption Commission – now at the National Prosecution Authority – don’t, in fact in real terms feel like jobs. It’s a passion. It’s not about a salary, it’s a calling and I thank God that this has been recognised.”

Transparency International also awarded former Swedish Ambassador to Zambia Anna Maj Hultgård as the Most Influential International Anti-Corruption Actor Posthumously.

Others are, Zambia Police Service traffic section for ‘The most improved public institution in the 2022 Zambia bribe payers index’, Road Transport and Safety Agency as second institution; and Zambia Police commissioner for Southern Province Auxensio Daka as third in the same category.

Daka said the small steps being recognised will push police to do better.

“I want to thank TI-Z for recognising the small steps that are happening in the Zambia Police and I want to emphasise [that] they are small steps,” said Daka. “And the recognition that we have been given encourages the Zambia Police to do better. The challenges are huge but small steps can be recognised and appreciated.”

Transparency International Zambia chapter president Priscilla Chansa said the organisation is implementing a new project aimed at documenting cases of corruption prosecuted in the courts of law.

“In re-emphasising the role of the judiciary in the fight against corruption, TI-Z is implementing a new project aimed at documenting cases of corruption prosecuted in the courts. The regional data base is aimed at stopping impunity for corruption to enhance accountability,” said Chansa. “In advocating for greater enforcement of the public procurement, beneficial ownership registration and to enhance social media utilisation of sensitising citizens about progressive intervention measures in the fight against corruption, TI-Z has increased the use of social media platforms and developed an innovative online platform which will interface company registration information with public procurement information.”

Meanwhile, chief Mukuni said there is need for more involvement of traditional leaders in programmes aimed at fighting corruption.

“Through this invitation, you have demonstrated that you recognise and value the important role of traditional leaders in building the culture of ethics and integrity in the society. I call upon all of you to emulate the good example set by the organisers of this conference. I implore you to go back to your various institutions and take time to reflect on how you can strengthen your collaboration with traditional leaders from across the country in the area of governance and anti-corruption,” said Mukuni in a speech read on his behalf by Mukuni Village Development Trust chairman Mupotola Siloka.-The Mast

Governments decision to award Transport Minister Frank Tayali is not just illegal, it’s ´daylight robbery´ says State Counsel and Lukashya law maker George Chisanga.

Hon. Chisanga says, best case scenario, if Tayali had to get any compensation for looking into the barrel of a gun of an officer on duty illegally, he would have been paid nothing more than K150,000 after taxes.

“It stinks of corruption to award someone (Tayali) public funds over a matter that has not been fully adjudicated in the courts of law in full,” said hon. Chisanga, a former Law Association of Zambia (LAZ) President.

Hon. Chisanga was speaking on the heels of a ´confetti of consent judgements´ that have enriched exclusively, a drove of sympathisers of the ruling UPND government with the latest being Tayali who feels traumatised that a gun was pointed at him during a political encounter ahead of a political poll in 2021 as he supported current Zambian President H.E Hakainde Hichilema.

“Even the K80,000 award to hon. Tayali´s lawyers is wrong because you must ask what did they do? How many witnesses were called, how much of the courts time was wasted? If computations were done and guilt was established hon. Hon. Tayali would have not gotten anything beyond K150,000 and his lawyers even less, if he won because we don’t also know under what condition the officer with the gun was working. This is theft of taxpayer’s money…” Hon. Chisanga who has been at the bar for more than 30 years said on Hot FM.

CONSTITUTION CAUTION

Hon. Chisanga has warned Zambians to look out for ´tale tale´ signs of the Hichilema government deep desire to change the constitution and perpetuate their stay in office against the will of the people following their fast loss of popularity after the 2021 ´protest vote´.

The respected constitutional lawyer also urged Zambians to note that Zambians beyond the UPND family such as Stephen Kampyongo nine others, Emmanuel Mwamba, Fred M´membe, Raphael Nakachinda, Sean Tembo and others have been arrested and could sue too including hon Given Lubinda and others.

“This is not just a dangerous precedent but its against the law,” hon. Chisanga said who also accused President Hichilema and House Speaker Nellie Mutti of breaching the constitution of Zambia on recent political issues.

A cross section of Zambians have expressed dismay at the plethora of suspicious consent judgements the office of the Attorney General has awarded to supporters of President Hichilema that run-in billions of taxpayer’s monies.

Hon. Chisanga stated that hon. Mutti is no longer a fair ´umpire´ of the National Assembly, an affront on the legislator, she is apparently ´biased´ because she doesn’t allow free expression in the august house.

He concluded that if the PF was wrong and lost power in its governance, it doesn’t justify the UPND governments decision to repeat the same wrongs, it’s a recipe for loss for UPND.

Leader of the opposition Socialist Party (SP) Fred M’membe has disclosed that police are not ready to proceed with any case that they have arrested him for.

Police were today supposed to proceed with the espionage case that the opposition leader stands charged with.

In an interview with the press, Dr Fred M’membe’s lawyer, Simon Mwila said he received a call from senior police officers alerting him that they were not ready to proceed.

“The matter where Dr Fred M’membe is alleged to have committed an offence of espionage was supposed to take off this morning. Unfortunately, we were called early in the morning as a legal team by senior police officers from Force Headquarters who indicated to us that they are not ready for us despite them having signed on the police bond for the client saying he should appear today before the chief resident magistrate in court 3 at subordinate Court in Lusaka,” he said.

“So we wait to hear for any information that is going to come and we will be going to the police Headquarters to extend the bond that was granted to our client.”

And Dr M’membe told the press in an interview that Police arrested him in a hurry.

He wondered how much time they need to proceed with the matter.

“The police are not ready to proceed with the so called espionage case. I don’t know how much time they need to be ready because this issue has been on for a long time. They arrested me in a hurry, they could not even give me bond, they had to lock me up,” he said.

“Now they are not ready to proceed with any case. By any case I mean all the cases they have arrested me on so far, none of them has proceeded. Why arrest if they are not ready to proceed? If they have not completed their investigations why arrest someone?”

He said the cases he stands charged with are political cases meant to cripple opposition.

“Again, it shows abuses on the criminal justice system, to fix political opponents. These are not legitimate criminal cases. These are political cases to try and cripple the opposition, to try and weaken the opposition. To try and intimidate us. This is not a recipe for governing well,” he said.

We have the money but we have a government that has surrendered Zambia’s economic sovereignty to foreigners, Socialist Party (SP) Deputy General Secretary Antonio Mourinho Mwanza has alleged.

Mr Mwanza said today when he featured on UNZA radio that there is need for government to reintroduce subsidies on fuel, a commodity among the major drivers of the economy.

He explained how the cost of fuel is directly tied to the cost of living in the country.

“Government says they don’t have the money for direct subsidies. For now we can say okay, but reintroduce the indirect subsidies. We are asking the government to waiver off VAT and Exercise taxes on fuel products. VAT is 16% exercise taxes account for about 8%. Immediately the government waives off VAT and exercise taxes, the fuel prices will go down immediately by not less than 24%. That will cushion our people because uja wa Yango, uja wa Taxi, uja wa bus, cashing ba Godwin afuniko panga,” he said.

“Mwine wa bus sazavinvela kuti no fuel inadula. Eve afuna che cashing yake ibwele. Mwine wa taxi afuna cashing yake ibwele. Its not only that. Us, ise be tiyuzing’a ma bus, tivutikilamo ndise because pamene tenzo lipila K10 tilipila K20. Pamene tenzo lipila K12 tilipila K24. Pamene tenzolipila K100 tilipila K250. Bag ya fataleza tenzo lipila ise K20 kuipeleka from Katete to Msolo, tilipila K50 per bag. We are being inconvenienced, the cost of living is going up because everything is going up as a result of the high fuel prices.”

Mourinho further explained that, that is the direct subsidy where government can pay directly to reduce the cost of fuel.

“No government will tell you we don’t have the money to do it and we are reminding them. Scrap off the tax holidays and other tax incentives you’ve given the mines. Close the tax loopholes that the mines are using and you will be able to raise not less than US$3.8 billion, annually from the mining sector alone. That is the money that now you need to use to subsidise fuel, that is the money you need to use to subsidise electricity, that is the money you need to use to subsidise water,” he said.

“And we have nothing here, palibe, tilibe vilivonse vamene tili navo because everything is being taken out. So we are demanding that government must first reintroduce SI that has been scrapped off or simply waive off VAT and exercise taxes on fuel and the fuel prices will go down automatically by not less than 24%.”

He implored government to close the loopholes which the mining companies are using so that the country can get more money.

Mr Mwanza called on government to “scrap off mineral royalty tax making it deductible, scrap it off, we can get the money, we will use this money to subsidise fuel. If we don’t do this ba Godwin, it doesn’t matter what you say, it doesn’t matter what you do, it doesn’t matter how many trips President Hakainde Sammy Hichilema takes, it doesn’t matter, apa ali pa 67, it doesn’t matter he can even take 200 trips. If he doesn’t deal with the fundamentals of the economy, kulibe vamene bazakachita pali cost of living.”

Some Consent Judgments amount to corruption-Prof Ndulo

Prominent legal scholars Prof Muna Ndulo and Dr Obrien Kaaba have described some recent Consent Judgements entered into between the state and some individuals as acts of corruption.

In a statement, Prof. Ndulo of Cornell University and Dr Kaaba from UNZA noted that although some Consent Judgements are justifiable, some are a racketeering scheme.

The duo have since appealed to President Hichilema to put a stop to this.

“We are also concerned that in some cases, the lawyers representing concerned individuals and those in State Chambers have previously had personal connections, raising questions about conflict of interest and the credibility of the negotiations and the protection of public interest in these settlements,” they said.

They also called on President Hichilema to critically analyze his legal team at State House and dismiss those who are behind the racketeering scheme.

Press Statement by Prof Muna Ndulo and Dr O’Brien Kaaba on the Consent Orders Being Entered into by the State and Various Litigants

We have observed with bewilderment and disbelief several consent orders entered into between the State Chambers and various individuals involving huge sums of money.
Although some appear well deserving, in a number these cases, there is either no sound legal justification for the settlements or the awards and the legal costs are grossly inflated. For example, in the case of Kaizar Zulu, it is clear he was not acting on behalf of the state and there is no moral or legal justification whatsoever for the state to compensate those he injured in his private capacity. It would appear that someone in the State Chambers is fishing for such cases for personal gain, and that is corruption. It must be stopped forthwith.
We are also concerned that in some cases the lawyers representing concerned individuals and those in State Chambers have previously had personal connections, raising questions about conflict of interest and the credibility of the negotiations and the protection of public interest in these settlements.
We call upon President Hichilema to critically evaluate his legal team in State Chambers and dismiss those who are behind these racketeering schemes.
We are appalled that oversight institutions such as the ACC, which should be in the forefront of protecting public resources, are doing nothing serious about the problem. This should have been stopped a long time ago had ACC been proactive, strategic and serious about protecting public resources.
The deals at the Ministry of Justice clearly indicate that to have a sustainable fight against corruption, it is not enough that the top national leadership is committed to the eradication of corruption. We need institutional transformation. We need to redesign institutions like ACC to make them capable and truly professional and independent.

Resource-Rich Africa Has No Excuse to Remain Poor, Says African Development Bank President

With $6.2 trillion worth of natural resources, 65 percent of the world’s uncultivated arable land, and a vibrant youth population, Africa has no excuse to be poor, African Development Bank Group President Dr Akinwumi Adesina said on Tuesday.

He said the continent must look inward urgently to solve its many challenges and urged citizens to hold governments accountable for poverty.

The Bank President made the call in Lagos where he delivered a lecture to mark the 40th anniversary of The Guardian, Nigeria’s foremost independent newspaper. The lecture was held under the theme, For the World to Respect Africa.

Adesina, who won The Guardian’s ‘Man of the Year’ Award in 2021, stressed that Africa should not be where it is today and urged its resource-rich nations to strengthen good governance, transparency, accountability, and sound management policies to turn things around.

He said considering the vast natural resources that Africa has, it must become a continent that grows inclusive and well-distributed wealth.

“If we manage our natural resources well, Africa has no reason to be poor. We have $6.2 trillion in natural resources,” he said. “So how in the world are we still poor? We simply need to pull up our socks, stamp out corruption, and manage our resources in the interest of our countries and our people,” added Adesina.

He explained further: “Saudi Arabia has oil, as does Nigeria. Kuwait has oil, as does Nigeria. Qatar has abundant gas, as does Nigeria and other countries. Yet, Nigeria is the country with the largest share of its population living below the extreme poverty line in 2023 in Africa. Clearly, there is something fundamentally wrong in our management, or rather mismanagement, of our natural resources.”

As an example, the Bank president cited South Korea, which raised its GDP per capita from $350 in the 1960s to approximately $33,000 by 2023. “That is the kind of quantum leap that we need,” Adesina said: “We must ask ourselves, when will we make the shift that South Korea made, from being a country that was once on the low end of the development ladder to the rich, industrialised nation that it is today.”

“I am optimistic about Nigeria. I am optimistic about Africa. I believe in Africa,” he added.

Adesina said: “Africa needs the right policies, investments, infrastructure, logistics, and financing…We must make sure that this is driven by a highly skilled, dynamic, and youthful workforce,” he told the audience of ministers and other senior government officials, former state governors, business leaders, academics, and media at The Guardian event.

The Bank President commended The Guardian, for continuing to “guard the truth”.

He said: “Over the years, this world-class publication has set a benchmark for journalistic excellence. It has helped to shape public discourse, champion accountability, and serve as a people’s watchdog. In doing so, The Guardian has justifiably earned the respect of Nigerians and readers across the world.”

Adesina said Africa could play a leading role in resolving not only its own challenges but global ones. “While we must deal with bread-and-butter development issues, we must think strategically as we set ourselves on a path to becoming wealthy nations. Our countries must become great contributors to global wealth and development financing for others.”

He highlighted the African Development Bank’s interventions to drive inclusive development in Africa, including boosting food security.

The African Development Bank has invested about $8 billion in agriculture over the past seven years, improving food security for 250 million people across the continent. In response to Russia’s invasion of Ukraine, which disrupted wheat and maize supplies to Africa, the Bank rapidly approved a $1.5 billion emergency food production facility for countries across the continent.

“Today, this facility is supporting 20 million farmers in 36 countries to produce 38 million tonnes of food valued at $12 billion. This is 8 million tonnes above the 30 million tonnes of food Africa was importing from Russia and Ukraine,” Adesina said.

“But even as we do this, we must do more than simply producing more food and agricultural commodities,” Adesina added. “The export of raw commodities is the door to poverty. The export of value-added products is the highway to wealth.”

The African Development Bank and its partners have provided $1.6 billion to develop 25 Special Agro-Industrial Processing Zones to support private sector processing and add value to commodities across 15 countries.

With partners, the Bank this month launched a $3 billion Alliance for Special Agro-Industrial Processing Zones to support the development of these zones in 11 more countries.

Ahead of the 2023 UN Climate Change Conference starting on 30 November in Dubai, Adesina said the African Development Bank will amplify Africa’s calls for climate justice and greater investment in climate action, including adaptation.

The Bank has launched a $1 billion Africa Climate Risk Insurance Facility for Adaptation to scale up climate risk insurance for African countries.

International Resources Holding, an affiliated company of Abu Dhabi IHC, has been selected as equity partner for Mopani.

The Board of Directors of ZCCM Investments Holdings Plc (“ZCCM-IH” or the “Company”) (the “Board”) refers the shareholders of ZCCM-IH (“Shareholders”) to the cautionary announcement released on SENS on 10 November 2023 and the announcement made on SENS on 15 June 2022 in relation to the appointment of Rothschild & Co. South Africa (Pty) Ltd (“Rothschild & Co.”) to assist ZCCM-IH with a strategic review of Mopani Copper Mines Plc (“MCM”) to ensure its sustainability and continued development (“Strategic Review”) and the various media reports that have subsequently referenced the Strategic Review.

The Strategic Review was focused on assessing MCM’s balance sheet given its high level of indebtedness and the liquidity requirements necessary to run and further develop the mine.

IRH has a strategy to invest in critical minerals and develop a new entity that encompasses the entire metals and mining supply chain.

This proposed partnership between ZCCM-IH, IRH and MCM represents an important strategic step for the revitalisation of the Zambian mining industry and the Zambian economy and the continued development of the Copperbelt.

The significant interest from leading global strategic investors during the SEP process, indicates the high-quality nature and strategic value of MCM, despite the short-term challenges it has been facing.

As the preferred SEP, and subject to the definitive transaction documents being entered into, IRH will, inter alia, inject funds into MCM which will be used to stabilise short-term working capital, fund the completion of the mine development projects and unlock the long-term potential of MCM as well as restructure its balance sheet and reset its existing relationship with Glencore.

Further details on the planned restructuring will be provided once all the documentation has been finalised.

The capital investment combined with the industry experience of the IRH and MCM management teams should enable MCM to achieve its long-term potential and enable it to increase copper production to at least 200,000 tonnes per annum whilst promoting increased industrialisation on the Copperbelt and stabilising employment and local supply chains.
ZCCM-IH and IRH are committed to ensuring that MCM delivers its optimal production levels and becomes a leading Zambian producer of copper. The conclusion of the transaction is subject to entry into definitive transaction documents and will be subject to various conditions precedent commensurate to a transaction of this nature. ZCCM IH will provide further details once all definitive transaction documents have been agreed.

Hakainde Hichilema stood in the queue to becoming President of Zambia for 15 years before voters finally removed him from it in August 2021. This demonstrates how badly the man wanted this job. But it has taken him only two years in office to display his unfitness for the role. When it comes to the bigger national issues, such as safeguarding our cherished democracy, getting the best out of Zambia’s mineral wealth, respecting the constitution and the rule of law, fighting corruption beyond rhetoric, genuine promotion of national unity and equitable distribution of appointments to public service positions, sorting out the cost-of-living crisis and the deplorable conditions of life for most Zambians, Hichilema has, so far, lamentably failed.

And if Zambians were to see the contents of the just signed Shareholder Agreement with Vedanta Resources Limited for the takeover of Konkola Copper Mines, many will be so livid that they will likely demand his immediate resignation for working against the interests of the Republic. I have seen, read, and understood the Agreement, and I challenge the Government to publish it in full in the name of transparency and accountability if they have nothing to hide. I am aware that Hichilema discarded the terms and conditions prepared by patriotic and very capable technocrats in the civil service and exerted pressure on the Zambia Consolidated Copper Mines-Investment Holdings (ZCCM-IH) to wholly accept the ones produced by Vedanta Resources. The concessions given to Vedanta – let us just say the concessions Vedanta has effectively given itself and which Hichilema agreed to without even subjecting the Shareholder Agreement to discussion in Cabinet – are so dreadful and anti-Zambia that any citizen who signs that terrible agreement must ordinarily be charged with SABOTAGE or TREASON. The contents of the Agreement with Vedanta constitute the ultimate betrayal of public trust and the interests of the State.

Argh! We are going nowhere serious with Hichilema at the helm of Zambia, unless he changes course, for the better. He has become a clear and present danger to Zambia’s economy, to our democracy, our constitutional order, our nationhood and its future, to the lives of ordinary Zambians, and must be peacefully removed from office at the earliest available opportunity. What consoles me is the knowledge that as of today, many people in Zambia may not know who they will vote for in the next election, but they already know who they will not vote for.

The best thing about electing Hichilema president was that we are no longer distracted by his threat or potential to be better than those who came before him and we can now start looking for suitable, if better, alternatives. If Hichilema did not become President of Zambia, we would have lived with some degree of guilty for not giving him the chance to govern. We could have also succumbed to certain narratives that suggest that some regions of Zambia can provide better leaders than others. To some extent, it is not regrettable that the man got the opportunity to lead. Now we know that in order to develop, Zambia does not need a given region or an individual from a particular ethnic group in State House. The country simply needs competent men and women who are patriots, have a feasible plan, and are committed to restoring the nation’s dignity, where they come from notwithstanding.

In a certain weird and perverted sense, it is good that Zambians gave Hichilema a chance to reveal who he truly is. The Chewa-speaking people of Zambia have a saying that “The best way of proving the potency of a man who claims that he is able to achieve an erection is for the woman to undress for him.” In August 2021, Zambians undressed for Hichilema after a decade-and-half of claiming that he is capable of taking them to greater heights!

Lawyers for the Patriotic Front have given Home Affairs and Internal Security, Permanent Secretary, Dickson Matembo and Acting Chief Registrar of Societies, Mariah Mulenga, 48 hrs to reverse the illegal changes that have recenlty been made to the register of Office Bearers at the Registrar of Societies.

The officials have been warned that the officials will face contempt of court charges as the changes maxe are illegal since the matters are before the Lusaka High Court.

Former Chief Registrar of Societies, Thandiwe Phiri-Mhende submitted to the Lusaka High Court that the register of the Patriotic Front has not been changed following the illegal and sham conference held by a expelled Matero MP, Miles Sampa.

Having been fully aware of the undue influence of your Permanent Secretary, Mr. Dickson Matembo and rather than acting in cohorts with him to cause changes to the Patriotic front register, it was incumbent upon you to follow the constitution or of the Patriotic Front party and restrain yourself from illegally altering the names of the office bearers’ register especially that it is common knowledge that the persons you registered on the 29th of November 2023 as office bearers did not legitimately attain the positions they purport to hold as there was no legitimate conference held for such appointments in line with the dictates of the Party constitution.

Further, having been notified and aware of the proceedings in court before Judge Situmbeko Chocho, you proceeded to effect changes in total disregard of the proceedings.

This in itself shows bad faith on your part and discloses your intention to cause harm to the Patriotic Front party.

We have thus been instructed to commence proceedings against you personally together with Mr. Dickson Matembo and the Attorney General for appropriate remedies including Misfeasance in public office should you not reverse your act wth 48 hours of this notice.

Side chick who sued sugar daddy for refusing to take care of her needs loses case

Ghana’s Accra High Court has dismissed a lawsuit filed by a woman who accused her “sugar daddy” of sexual harassment and failing to fulfill some promises he made to her. Per Graphic Online, the court also slapped the plaintiff Deborah Seyram Adablah with an $800 cost.

Adablah made the news in the West African nation after she filed the lawsuit against Ernest Kwasi Nimako – a former Chief Finance Officer of a bank. Adablah had claimed she and Nimako started their affair after the bank the defendant worked at took her in as a National Service Personnel.

But the judge on Wednesday declared that though the relationship between Adablah and Nimako was deemed immoral and frowned upon by society, the plaintiff’s filed writ had no reasonable cause of action.

The court ruled that it could not give judicial stamps to the case because of the foundation of their relationship. “You cannot recover the price of something you have committed into an immoral act,” the court stated.

Prior to Wednesday’s ruling, the defendant had filed an application seeking the court to dismiss Adablah’s case. The plaintiff filed the lawsuit in January, claiming that Nimako, who she calls her “sugar daddy”, made a host of promises to her, Graphic Online reported.

Adablah claimed Nimako promised to buy her a car, take care of her accommodation costs for three years, give her $250 monthly as a stipend, marry her after divorcing his wife, and also provide her with money to set up a business.

She alleged that Nimako registered the car in his name and later reclaimed it after she used it for just one year. She also said Nimako failed to cover her accommodation costs for the three years as promised, adding that he only paid for one year.

The plaintiff in the dismissed lawsuit had asked the court to order Nimako to register the car in her name and also hand the vehicle back to her. She also asked the court to order Nimako to provide her with money so she could “start a business to take care of herself as agreed by the plaintiff and the defendant.” She also asked the court to order Nimako to settle the remaining accommodation arrears – which is for two years.

She further requested that the court order the defendant to cover her medical costs for the “side effect of a family planning treatment” that Nimako made her do to prevent her from getting pregnant.

We have observed with bewilderment and disbelief several consent orders entered into between the State Chambers and various individuals involving huge sums of money.

Although some appear well deserving, in a number these cases, there is either no sound legal justification for the settlements or the awards and the legal costs are grossly inflated.

For example, in the case of Kaizar Zulu, it is clear he was not acting on behalf of the state and there is no moral or legal justification whatsoever for the state to compensate those he injured in his private capacity.

Lunte Member of Parliament Hon Mutotwe Kafwaya says the Debt restructuring deal the Government has been pursuing since assuming office is as good as dead.

Hon Kafwaya has cited alleged corruption and dishonesty in the manner the UPND Government is approaching the deal as the reason for the collapse.

He said the revelations that Government agreed to pay 2.5 billion between 2024 and 2025 to bondholders has annoyed the IMF.

He said Government agreed to give bondholders $2.5billion in 2024-2025 despite a running programme of $1.3billion with the IMF and despite the clear unaffordability of such an undertaking.

Hon. Kafwaya said instead of a haircut of 40% as demanded from China and others, Government agreed to only 18% haircut,contrary to the G20 Common Framework of equal debt treatment to creditors.

Hon Kafwaya said the face value of the new bonds was increased to $3.135 billion in both scenarios, exceeding the original $3 billion face value of the old notes.

He said the deal was established to be so bad that Zambia was directed to immediately renounce the corrupt agreement and place such an announcement on the London Stock Exchange.

“The agreement announced on 26th October 2023 with External Bondholder Steering Committee is so absurd that it has shocked the IMF, Official Creditor Committee headed by China and France. Explain the scandalous clauses agreed in the Debt Restructuring deal that has been renounced,” he said.

Hon Kafwaya said Government is being viewed as having entered into a corrupt deal and pushing Zambia back again into a debt distress.

And Hon Kafwaya stated that the carelessness of the UPND is now costing the nation.

He said it is embarrassing for the UPND to be entering into corrupt deals with bondholders.

Hon Kafwaya said the only way of coming out from the economic hardship is for the UPND to begin to be more honest with governance matters.

“Going back to debt distress when the economy is in bad shape. What we are going to see now in the next one month is high cost of living beyond reasonable measure,” he said.

THE ‘wealthy’ nephew of Geoffrey Bwalya Mwamba, Adolphus Mubanga yesterday lamented of being neglected by his relatives as he took a solo trip to prison after he was jailed two years by the Economic and Financial Crimes Court for failing to account for his wealth.

As he was being led to a posh vehicle belonging to the Anti-Corruption Commission that was in the car park awaiting to transport him to Lusaka Central Correctional Facility, the handcuffed Mubanga complained that the Mwambas had cast him off too early.

The relatives noted among them GBM’s last born son Muma, daughter Musama and three others opted to remain in the Courtroom at the Lusaka Magistrates’ Court as Mubanga was being taken to his jail house.

Upon noticing that there was no one to see him off Mubanga complained about being discarded.

“These people (relatives) they are not even here, I have asked them to give me some money but they have failed to provide for me, can you imagine,” Mubanga lamented to the ACC officer in the car park.

Mubanga who is the country director of Curzon Global Limited was sentenced to two years imprisonment for posessing K5,555,954 in his three bank accounts which is suspected to have been illl gotten.

Mubanga was facing three counts of posessing property suspected to be proceeds of crime which he denied.

In count one Mubanga between June 1, 2021 and August 30, 2021, possessed ZMW4, 050,000 in his Bank Account held at First National Bank Zambia, property reasonably suspected of being Proceeds of crime.

In the second count Mubanga between July 1,2015 and August 30,2015 possessed ZMW980, 000 through Muchinga Procurement Limited Bank Account held at Intermarket Bank, property reasonably suspected of being proceeds of crime.

In the third count Mubanga between August 1, 2015 and November 30, 2015 possessed ZMW 525,954 through his Bank Account held at Absa Bank Zambia PLC, property reasonably suspected of being proceeds of crime.

In her judgement Lusaka principal resident magistrate Irene Wishimanaga ruled that there is no evidence to show Mubanga’s source of income for the obscene amounts of money deposited into his accounts.

She said the prosecution does not have to show the link between the accused and the property to prove that the same was ill-gotten as what needed to be proved is the transactions.

“It raised suspicion when Muchinga procurement was paid without reason to show what it did for Curzon global in order to receive such amounts of money warranting Mubanga to claim that it was an agent fee,”Magistrate Wishimanga said.

She said there is no trail of money for the payments of the services Mubanga rendered to Curzon Global as he failed to explain how much he was getting as an agent.

“The state has proved the case beyond reasonable doubt. I find Adolphus Mubanga guilty for possessing property suspected to be proceeds of crime and I convict him accordingly,” magistrate Wishimanga said.

In mitigation Mubanga’s lawyer Francis Daka asked the Court to exercise leniency and that he had no explanation as he had already exculpated himself in his defence.

Handing down her sentence magistrate Wishimanga imposed a two year jail term in each count and ordered that the sentences will run concurrently.

Or “When is the UPND giving you a job?”
Even, “What are the leaders of your Party saying about your unemployment?”
Including, “Have the UPND responded to your calls for a job?”
Others have mocked me, “So you think HH can give you a job?”

This morning, I thought I should make an important and sincere clarification on this matter: that I need just any job, not necessarily a political appointment. Let this be clear to all; both political opponents and allies.

The call for a job is not motivated by me being a UPND cadre or praise singer. It is inspired by poverty; and backed by University papers. I am wallowing in financial crippledness, I need to work and earn a salary and the good part is that I have Masters and Bachelors Degrees in Public Administration from the University of Zambia (UNZA) specializing in Local Government Administration and I hold a Certificate in Computer Studies from LIFETECH College coupled with a Grade 12 School Certificate from David Kaunda Technical High School (DKTHS). Therefore, the job I seek should be based on merit not patronage.

I can work both in the public and private sectors and I am ready to take up any position in either. I qualify for a number of jobs in the corporate world or social milieu, for instance, Local Councils, Ministries, Human Resource (HR) departments, Multinational corporations, Foreign Service, Non-Governmental Organizations (NGOs), the Business world, Universities/Social Research organisations and so on.

My call for a job is done primarily in my capacity as an embattled human being, who happens to be a citizen of the Republic of Zambia, not necessarily as a member of the UPND. I am asking for your empathy, especially you the well-meaning fellow Zambians regardless of political affiliation, tribe etc.

I hereby re-echo the call for a job. Look, I was dismissed maliciously, unfairly and unlawfully in 2020. I am now suffering and I need help -a job; help from any person(s) who can render it.

“How can you serve in the civil service when you’re politically active?” Some have asked me. The thing is: I choose a job over politics; I can exercise political neutrality. Please get this point.

“Did you join the UPND so that they could give you a job?” another question I am being asked. The answer to this question is NO. I joined the UPND because I felt it was the most capable political organisation in the country to take Zambia forward, I believe in a better Zambia for all and I wished I could contribute to this national aspiration through being a member of the Party.

I know there are many people within the UPND who are jobless like me and they too need employment; I am not special but I am in a serious financial crisis, I desperately need a source of income to take care of my family -hence my opening up to you all. I opened up not because I was special but due to the fact that I could not take it. I hope you understand.

“Can you accept a job in a political party other than the UPND?” more difficult questions for me. Look, I do not need questions, I need a job. I am not here to be tempted but to seek assistance. Napapata bantu ba Mulungu. Help me, I am suffering. I know my situation gives joy to my enemies but I believe a well-wisher will respond some day and pull me out of this lonely ditch.

Allow me to conclude by apologizing to you all for any stress that this persistent call for a job may have caused. It is just that I desperately need support -a job. However, this is the last time you are hearing me ask for a job because I have done enough. You will never hear me talk about this again. Be assured. For now, I will just be waiting quietly whilst praying that a good Samaritan appears to rescue me.

ZAMBIAN ARMY, BELGIAN DEFENCE FORCE UNITE TO SEAL LANGUAGE BARRIER

Commander Zambia Army, Lieutenant General Sitali Dennis ALIBUZWI, says the Zambia Army and the Kingdom of Belgium Armed Forces are working closely to reduce the language barrier among military personnel as one of the ways to enhance bilateral cooperation.

The Commander says the cooperation is aimed at nothing but encouraging the two countries to support the United Nations (UN) in peacekeeping operations and other operations exercises in which they are both engaged, adding that Zambia and Belgium will endeavour to explore more areas of mutual interest, especially joint training in linguistic, which he added is being looked into, in greater detail.

Lt Gen Alibuzwi said this when the Kingdom of Belgium Defence Attaché to Zambia, Colonel GS Jeanique Debrabandere, called on him at Army headquarters.

And Col Debrabandere said the Belgium Defence Force is more than ready to receive Zambian officers and soldiers wanting to undergo military training in Belgium, provided they are informed in time.

She further stated that Command should not hesitate to send any correspondence that is training-related, adding that Belgium has a well-established military academy based in the capital, Brussels, and produces top-notch military officers.

The two countries’ military cooperation dates back to the days when the Zambian Army started sending officers for courses to be trained in different fields, particularly linguistics.

Zambia Wake-Up Party (ZAWAPA) President Howard Kunda has criticized the huge compensations being awarded to Government officials and UPND supporters by courts.

The Lusaka High Court has entered a consent judgment awarding UPND Lusaka Province Chairperson Obvious Mwaliteta and James Sichomba K900,000 each as compensation for wrongful prosecution.

Furthermore, Transport Minister Frank Tayali was this week awarded K450, 000 by the Lusaka High Court on account of the trauma occasioned to him by the police who pointed a gun at him in 2020.

Mr. Tayali filed a claim for compensation in the court for the incident that occurred when the Minister accompanied President Hakainde Hichilema then as opposition leader for interrogations at the Police Headquarters in Lusaka.

But Mr. Kunda has question the compensation arguing that it amounts to looting public funds.

“I am saddened by the issue of these huge compensations; I think our country is worsening in terms of governance. You can’t imagine that this is the kind of change the people of Zambia voted for, the change that we should put money in the pockets of these leaders in this manner. I think they should be ashamed of themselves by wanting to loot the resources of the country through this same compensation,” Mr. Kunda said.

“I think that our country deserves better and I would want to tell the Zambian people that these are things we have seen for ourselves and come 2026 we need to remove this Government without any remorse. They have shown us that they are just a bunch of people that want to loot the country in form of compensation.”

The former Parliamentary Public Accounts Committee Chairperson warned that people getting huge compensations risk being prosecuted and jailed in future.

“If our forefathers who fought for our independence resorted to wanting to get compensation after independence how much money were we going to remain with? All the money would have gone to compensate freedom fighters. These compensations by this government are day light robbery and they shouldn’t even defend themselves. This is something all of us must be against. When ZAWAPA is voted in office in 2026 everyone who has stolen money from the people of Zambia in this way of compensation will not only pay back but also be jailed,” Mr. Kunda stated.

With cries from ordinary Zambians escalating day in day out amid what one would describe as “early Christmas” bonuses dished out to those aligned to UPND in the name of compensations, Socialist Party (SP) Deputy General Secretary Antonio Mwanza has castigated the Attorney General Mulilo Kabesha over his conduct.

As though it is not the same government which claimed to have inherited empty coffers upon being elected into power in 2021, it has on the other hand continued compensating its officials and close associates, a move which stakeholders have bemoaned and called white color plunder.

Among the people to be compensated is Hon Frank Tayali, Minister of Transport and Logistics who gets to walk away with K450,000 plus K80,000 as damages.

Furious about unfortunate happenings which are occurring at a time when majority Zambians are wallowing in abject poverty, Mr Mwanza warned that the Attorney General has set a very bad precedence.

“It is a wrong precedence that the Attorney General is creating. The Attorney General’s role is to defend the state. And in doing so he must see to it that the cases come to a logical conclusive end that to enter into this default judgement. He has set a very dangerous precedence,” he said.

“Tomorrow when those ordinary Zambians that have sued the state are not compensated, are not given these hefty compensations, what will be the position of the Attorney General. He has weakened himself, he has weakened his office.”

He has wondered what would happen to some individuals serving in the civil service who have allegedly been unfairly dismissed by the government of angels.

Mr Mwanza cited some senior police officers as the people among those that were unfairly dismissed.

“But he has set a precedence that he will not be able to contain. Because I know of a number of Zambians that have sued the state for compensation. We are talking about police officers who were unfairly dismissed by this government. This government has dismissed over 25 senior police officers. And as we are speaking right now over 20 police officers have sued the state for unlawful dismissal,” he said.

“Why is he not entering default judgement for those police officers who have sued for illegal dismissals? Why is the Attorney General not entering default judgement for the numerous directors from different ministries of this government that have sued this government for unlawful dismissal? So he set a precedence that will be very difficult for him and for the country.”

He cried that the Attorney General has let Zambians down.

“Because now, all these people that UPND government is unlawfully dismissing, they are all going to rise up and demand that they need their money. And do we as a country have money to be dishing out… I think the Attorney General is letting the state down because his role is to defend the matter until the very end. As it is, he is not defending the state, he is defending UPND,” he said.
